Writ of amparo (recurso de amparo) filed under case file number 21-008991-0007-CO, brought by Nombre01, national identity document (cédula de identidad) CED01, on behalf of the students of the ESCUELA LÍDER LA FLOR DE BAHÍA BALLENA, against the MINISTERIO DE EDUCACIÓN PÚBLICA.

RECITALS:

  1. 1By written submission filed with the Clerk's Office of this Court at 09:45 on May 25, 2021, the petitioner filed a writ of amparo against the Ministerio de Educación Pública and stated, in summary: that on May 15, 2016, official letter N°EFB-002-2017 was sent to the Dirección de Infraestructura y Equipamiento Educativo requesting an assessment for the construction of a new school due to the extremely poor conditions of the La Flor de Bahía school. In addition, the Dirección de Infraestructura was again urged to provide an institutional response to the health order (orden sanitaria) issued by the regional Health Area under reference N°BRU-ARS-O-ERS-294-2019, given that the institution had three months to carry out the required improvements. The petitioner states that in June 2019, MSc. Johnny Sánchez Fernández submitted official letter N° JE-ELFB-049-06-2019, detailing the actions taken by the Junta Educación and the La Flor de Bahía school before the Ministerio de Salud de Palmar Norte in response to the health order BRU-ARS-O-ERS-294-2019; and that official letter N° JE-ELFB-048-06-2019 was sent to the Dirección de Infraestructura y Equipamiento Educativo requesting a project execution plan.The petitioner asserts that by official letter DVM-A-DIEE-DGPE-2025-2019 of July 2, 2019, the Dirección de Infraestructura reiterated its commitment to complying with the health order issued, and attached a schedule of activities under which construction works were to begin in October 2020. Nombre02 states that on October 18, 2019, by official letter DIEE-DC-OF-397-2019 from the Dirección de Infraestructura, the bid-opening process was initiated for the direct contracting (contratación directa) procedure, which remained open until 10:00 on October 29 of that year. Nombre02 further states that in official letter DIEE-DC-0077-2020 of June 26, 2020, the Dirección de Infraestructura y Equipamiento Educativo reported that changes had been made as a result of its internal reorganization, under which the drafting departments were required to assume responsibility for the technical analysis of bids within design professional services contracting processes.Likewise, a list of educational centers with pending bid analyses was submitted, in which the Escuela La Flor de Bahía appeared as one of the pending cases and whose current status was indicated as "under bid analysis." The petitioner alleges that at the time this writ was filed, the poor infrastructure conditions at the school continued and had in fact worsened with the increase in school enrollment, with the school currently serving two hundred and sixty students and twenty-two staff members who receive and deliver lessons under conditions of overcrowding (hacinamiento) and risk due to the state of the school's infrastructure. The petitioner adds that classrooms have suffered flooding due to heavy downpours and poor stormwater management, requiring urgent attention to protect the physical well-being of the children and the staff who work there. The petitioner requests that the writ be granted and that the respondent authority be ordered to expedite the contracting procedures necessary for the construction of the new building for the La Flor de Bahía school.
  2. 2By order of 13:04 on May 26, 2021, the present writ of amparo was admitted for processing, and reports were requested from the Director of the Dirección de Infraestructura y Equipamiento Educativo and the Regional Director of Education of Pérez Zeledón — both of the Ministerio de Educación Pública — as well as from the Principal of the Escuela Líder La Flor de Bahía Ballena.
  3. 3Ramón Fernando Monge Ilama, in his capacity as Education Supervisor for Circuit 04 of the Dirección Regional de Educación de Pérez Zeledón, reports under oath regarding the actions taken by the Junta de Educación and the administration of the Escuela Líder La Flor de Bahía, code 1007, Circuit 04, of the Dirección Regional de Educación de Pérez Zeledón, given that the Principal is currently on leave. He states that on February 6, 2017, by official letter EFB-002-2017, health order BRU-ARS-O-ERS-1071-2016 was forwarded to the Dirección de Infraestructura y Equipamiento Educativo, which set a three-month deadline to carry out the specified improvements to the school building. He notes that on November 30, 2017, official letter DIEE-3059-2017 was received, informing of a deposit to be made in tranche A (tracto A), in the amount of ¢12,023,554.00 (twelve million twenty-three thousand five hundred and fifty-four colones, zero céntimos).He reports that on December 11, 2017, in Minutes 323, the board approved the budget for the amount described in the preceding paragraph and submitted the documentation to the Dirección de Infraestructura y Equipamiento Educativo, with a copy to the engineer in charge, Rigoberto González Espinoza; a start-up resolution and justification for the contracting of professional services were attached. He recalls that on February 27, 2019, official letter N° 02065-2019-DHR, case file N° 272669-2018-SI, addressed to Architect Andrea Obando Torres, Director of the Dirección de Infraestructura y Equipamiento Educativo, was received, requesting a report on the matter — this arising from the fact that on September 5, 2018, Mr. Milton Arcadio Lobo Cortés had filed a complaint with the Defensoría de los Habitantes de la República due to the Dirección de Infraestructura y Equipamiento Educativo's failure to act.He affirms that on March 13, 2019, inspection report BRU-ARS-O-ERS-294-2019 was received, containing a site inspection report of the institution by the Health Regulation Team (Equipo de Regulación de la Salud). He states that on June 24, 2019, communication MS-DRRSBRU-ARSO-ERS-793-2019 was received, requesting that the institution submit a remedial plan (Plan remedial). He further states that on June 27, 2019, official letter N° JE-ELFB-048-06-2019 was sent to the Dirección de Infraestructura y Equipamiento Educativo requesting a project execution plan, in compliance with health order BRU-ARS-O-ERS-295-2019 and official letter MS-DRRSBRU-ARSO-ERS-793-2019 from the Ministerio de Salud de Palmar Norte, for which there was a ten-business-day deadline to submit it. He explains that on June 28, 2019, the Principal, MSc. Johnny Sánchez Fernández, and the Chairman of the Junta de Educación, Mr.Milton Arcadio Lobo Cortés, by means of official letter JE-ELFB-049-06-2019, submitted to the Ministerio de Salud, Palmar Norte office, a report of the actions taken by the Junta de Educación in response to health order BRU-ARS-O-ERS-294-2019. He explains that on July 2, 2019, by official letter DVM-A-DIEE-DGPE-2025-2019, the Dirección de Infraestructura y Equipamiento Educativo reiterated its willingness to comply with what was requested in the health order, attaching a schedule of activities projecting the start of works for October 2020. He declares that on October 7, 2020, the Defensoría de los Habitantes, in case N° 272669-2020, by official letter Nº 11985-2020-DRH, established a fifteen-business-day deadline for the Director of the Dirección de Infraestructura y Equipamiento Educativo, the Deputy Minister of Administrative Affairs of Education, and the Director of the Área de Salud de Osa to submit reports.He notes that, as of the date of this report, no such reports have been received. He adds that on October 18, 2019, by official letter DIEE-DC-OF-397-2019, the Dirección de Infraestructura y Equipamiento Educativo authorized the opening of bids for the direct contracting procedure, which remained open until 10:00 on October 29, 2019. He adds that on June 26, 2020, by official letter DIEE-DC-0077-2020, the Dirección de Infraestructura y Equipamiento Educativo reported that changes had been made as a result of the reorganization of that directorate, under which the drafting departments were required to assume the functions of technical bid analysis within the design professional services contracting processes. Likewise, a list of educational centers with pending bid analyses was submitted, in which the Escuela La Flor de Bahía appeared as one of the pending cases and whose current status was indicated as "under bid analysis." He recounts that the poor infrastructure conditions at the school continue and have in fact worsened, compounded by the increase in school enrollment, with more than two hundred and fifty students and twenty-two staff members who use the school's infrastructure on a daily basis.He asserts that, given the poor state of the infrastructure, there is an imminent risk that the Ministerio de Salud Pública will order the closure of the school, and that the community has no adequate space to house the students and staff.
  4. 4Geovanny Soto Solórzano, in his capacity as Regional Director of Education of Pérez Zeledón, reports under oath that he endorses the report submitted by Mr. Fernando Monge Ilama, Supervisor of Educational Centers, School Circuit 04. He further adds that the Dirección Regional de Educación, through the Supervision Office of School Circuit 04 and the school itself, has carried out all the corresponding procedures to address the needs of the Escuela Líder La Flor de Bahía Ballena, and that the process has been significantly delayed due to matters outside its competence.
  5. 5Catalina Salas Hernández, in her capacity as Director of the Directorate of Educational Infrastructure (Dirección de Infraestructura Educativa) of the Ministerio de Educación Pública, testifies under oath that the educational center's infrastructure needs are known to her, as the relevant and appropriate process has been carried out to address and make progress in resolving the structural needs. She states that a report was requested from the Department of Works Development (Departamento de Desarrollo de Obra) of the Directorate of Educational Infrastructure, which transmitted official communication DVM-A-DIE-DDO-0653-2021, indicating that the process is currently at the bid analysis stage, that a request for General Correction Notices (Subsanes Generales) was made, that on April 8, 2021, review of the submitted general corrections began, that on April 22, 2021, document DVM-A-DIE-DDO-0330-2021 was transmitted — an analysis of bids and general correction — in which only one of the bidders (oferentes) was required to submit corrections on the technical component, that individual correction notices (subsanes individuales) were notified on June 2, 2021, that the individual corrections were received on June 9, 2021, and that they are pending review in order to generate the final report and continue with the professional services procurement process for the development of the entire design consultancy and blueprints for the construction of the new works.She further states that once the final report has become definitive, the legal staff would need approximately one month to transfer to the Department of Works Development the contract signed by the successful bidder (adjudicatario) and by the board president, after which a minimum expected period of approximately one year would be needed to have the blueprints ready along with the respective permits, that is, by 2022. She goes on to explain that once that stage is completed, the resources will need to be requested, and that this depends on the investment plan (plan de inversión) for that period. She specifies that, subject to authorization of the budgeted amounts under the approved program for managing investment in educational infrastructure — which must be approved by the Asamblea Legislativa — the resources could be made available by 2024. She further notes that the works procurement process could subsequently begin, which would take a minimum of approximately six additional months if all proceeds smoothly without objections, appeals, or external factors beyond the control of this office that could delay the aforementioned stages — such as the indicated budget allocation or a lack of active management by the Junta de Educación itself — in which case the works would begin in the second semester of 2024, with completion expected no earlier than the first semester of 2025; these timeframes are given on account of the variety of processes involved and the complexity inherent in educational construction by its nature, yet they are materially possible, achievable, and viable from a technical, financial, and administrative standpoint, and are consistent with the principle of legality (principio de legalidad) governing public procurement (contratación administrativa). She requests that the writ be dismissed.
  6. 6The legally prescribed formalities have been observed throughout the proceedings.

CONSIDERING:

I. SUBJECT OF THE WRIT

The petitioner alleges that since 2016, the Directorate of Educational Infrastructure and Equipment (Dirección de Infraestructura y Equipamiento Educativo) of the respondent Ministry has been processing an assessment for the construction of a building for the Escuela Flor de Bahía, due to the deplorable conditions in which it is found, a situation for which the Área de Salud issued health orders (órdenes sanitarias) BRU-ARS-O-ERS-1071-2016 and BRU-ARS-O-ERS-294-2019. He indicates that to date the poor infrastructure conditions at the school continue, which he considers to be a violation of the fundamental rights of the students and administrative staff of the educational center.

II. ESTABLISHED FACTS

The following facts are considered proven as relevant to the resolution of this matter:

On February 6, 2017, by means of Official Communication N° EFB-002-2017, the Junta de Educación of the Escuela Flor de Bahía forwarded to the Directorate of Educational Infrastructure and Equipment health order n°BRU-ARS-O-ERS-1071-2016, in which a three-month period was granted to carry out improvements to the educational center's building (see report and evidence submitted).

By means of Official Communication N° DIEE-3059-2017 of November 30, 2017, the Directorate of Educational Infrastructure and Equipment informed the Junta de Educación of the educational center in question: "In accordance with the schedule for the execution of projects of the Directorate of Educational Infrastructure and Equipment, I am pleased to inform you that in the upcoming payrolls of the current year, the sum of ¢12,023,554 will be deposited, subject to the budgetary allocation (contenido presupuestario) of the Ministerio de Hacienda and the allocation of resources to meet Infrastructure and Land Purchase needs. The resources are earmarked for: PAYMENT OF PROFESSIONAL SERVICES (TRACTO A) AND PRELIMINARY STUDIES, and it is therefore essential that you proceed to budget said resources as follows: The Junta de Educación or Administrative Board must meet to prepare the supplementary budget (presupuesto extraordinario) (Accounting), reflecting said amount in the corresponding line items; it must then adopt the relevant resolution in the minutes and proceed to sign and stamp said budget.

The Junta de Educación or Administrative Board shall bring the said supplementary budget to the respective Regional Directorate so that the Board Liaison Officer (Encargado de Juntas) may review the budget in accordance with the 'Guide for the Verification of Internal Approval of the Budget Plan,' after which review, he will proceed to sign and stamp the budget. The Junta de Educación or Administrative Board shall send the supplementary budget with the respective signatures and stamps to the DIEE by means of the following email address, Víctor Hernández Román ...01 or by fax: Telf01, within a period of no more than 10 business days following receipt of this document. Notes:

  • 1)You must submit only the 3 sheets prepared in Excel; no other documents should be attached.
  • 2)Resources will NOT be deposited until a copy of the budget has been sent to the indicated email address.
  • 3)Resources will be deposited once the Ministerio de Hacienda releases the Infrastructure quota, as it is the entity that carries out transactions to the respective Caja Única del Estado accounts" (see report and evidence submitted).

On December 11, 2017, in Minutes 323, the Junta approved the budget in the amount described in the preceding point and forwarded the documentation to the Directorate of Educational Infrastructure and Equipment, with a copy to the engineer in charge, Rigoberto González Espinoza; a commencement resolution and the justification for the procurement of professional services were attached (see report).

On September 5, 2018, Mr. Milton Arcadio Lobo Cortés, of the Junta de Educación of the educational center, filed a complaint with the Defensoría de los Habitantes de la República on account of the non-compliance and inaction of the Directorate of Educational Infrastructure and Equipment (see reports and evidence submitted).

By means of Official Communication N° 02065-2019-DHR, contained in case file (expediente) N° 272669-2018-SI, the Director of the Child and Adolescent Affairs Area of the Defensoría de los Habitantes requested from Andrea Obando Torres, Director of the Directorate of Educational Infrastructure and Equipment, a report regarding the structural situation of the Escuela Flor de Bahía (see reports and evidence submitted).

On March 13, 2019, the Brunca Regional Health Governing Directorate (Dirección Regional de Rectoría de la Salud Brunca) conducted a follow-up inspection at the institution and concluded that: "In view of the current conditions of the school, the information provided by the Junta de Educación, and the fact that it presents greater deterioration compared to the previous visit — and that as a result of this new visit additional risk conditions were identified that cannot be remedied through surface-level or cosmetic repairs — measures must be taken to eliminate the risks arising from structural, aesthetic, wastewater treatment, overcrowding, universal accessibility, and thermal comfort issues currently affecting the institution. Accordingly, in order to safeguard public health and the environment and to protect the student body, administrative staff, and persons attending the educational institution, the institution is declared dangerous, and therefore a new health order shall be issued incorporating the new improvements and revoking health order BRU-ARS-O-ERS-1071-2016, which was moreover not complied with" (...) And it set out nine improvements to be carried out at the institution (see reports and evidence submitted).

On June 24, 2019, the Directorate of the Governing Health Area of Osa (Dirección del Área Rectora de Salud de Osa) sent official communication MS-DRRSBRU-ARSO-ERS-793-2019 requesting from the institution a "remedial plan (plan remedial) necessary to address the non-conformities corresponding to health order BRU-ARS-O-ERS-295-2019 within a maximum period of ten business days" (see reports and evidence submitted).

On June 27, 2019, the Director of the Escuela La Flor de Bahía sent official communication N° JE-ELFB-048-06-2019 to the Directorate of Educational Infrastructure and Equipment, requesting an execution plan for the works in order to comply with health order BRU-ARS-O-ERS-295-2019 and official communication MS-DRRSBRU-ARSO-ERS-793-2019 from the Ministerio de Salud of Palmar Norte, which granted a period of ten business days in which to submit it (see reports and evidence submitted).

On June 28, 2019, the Director of the educational center and the President of the Junta de Educación submitted official communication JE-ELFB-049-06-2019 to the Ministerio de Salud, Palmar Norte office, regarding the actions taken by the Junta de Educación in response to health order BRU-ARS-O-ERS-294-2019 (see reports and evidence submitted).

On July 2, 2019, the Directorate of Educational Infrastructure and Equipment transmitted official communication DVM-A-DIEE-DGPE-2025-2019 to the Ministerio de Salud, indicating the works to be carried out at the Escuela Flor de Bahía: "Construction of 6 DIEE-2016 classrooms of 72m², 2 preschool classrooms of 84 m², 1 language classroom of 72 m², 1 dining hall of 144 m², 4 restroom blocks (baterías de servicios sanitarios) of 30 m², 1 administrative building of 84 m², 1 library of 72 m², 1 computer classroom of 72 m², 1 support module of 144 m², 1 parent waiting area, 1 security guardhouse of 31 m², covered walkways, 1 covered sports court of 900 m², and complementary works." In addition, the activity schedule was indicated, with a projected start date for the works of October 2020 (see reports and evidence submitted).

On October 7, 2020, the Defensoría de los Habitantes, under case N° 272669-2020, issued a series of recommendations to the Director of the Directorate of Educational Infrastructure and Equipment, the Deputy Minister of Education for Administrative Affairs (Vice ministro Administrativo de Educación), and the Director of the Área de Salud of Osa, in connection with the situation at the Escuela Flor de Bahía (see reports and evidence submitted).

On October 18, 2019, by means of Official Communication DIEE-DC-OF-397-2019, the Contracting Department (Departamento de Contrataciones) of the Directorate of Educational Infrastructure and Equipment authorized the opening of bids for the direct contracting (contratación directa) procedure, which remained open until 10:00 hours on October 29, 2019 (see reports and evidence submitted).

On June 26, 2020, through official communication DIEE-DC-0077-2020, the Directorate of Educational Infrastructure and Equipment (Dirección de Infraestructura y Equipamiento Educativo) notified that changes had been made as a result of the DIEE reorganization, under which the drafting departments were required to assume the functions of technical analysis of bids within professional design-services procurement processes. Also included was a list of educational centers for which bid analysis remained pending; Escuela La Flor de Bahía was among those pending, and its current status was noted as being in the bid-analysis stage (see reports and supporting evidence).

On September 11, 2020, the bid analysis was assigned to architect Alexander Aguilar Sobalbarro (see reports and supporting evidence).

On October 23, 2020, the respondent submitted document DVM-A-DIE-DDO-0110-2020 as a response document for the Defensoría de los Habitantes, which states: "that in attending to the priority cases carried over from the now-defunct Contracting Department of the DIEE, pursuant to DVM_A_DIEE_0233_2020 and under the orders of the assigned General Coordinator of the Contracting Department, Engineer Pablo Zúñiga, appointed by you and who continues in the department under my supervision performing this function, the architect attended to the case once space was found within the first two priority points indicated in document DVM-A-DIE-DDO-0030-2020; and that on October 12, 2020, he submitted to you document DVM-A-DIE-DDO-0080-2020, General Cure Request" (see reports and supporting evidence).

On January 13, 2021, document DVM-A-DIE-DDO-0035-2021 was submitted as a response document for the Territorial Liaison of the Casa Presidencial, which states: "There is no notification that the general cures (subsanes generales) requested have been submitted by the bidders, and upon reviewing the digitized case file (expediente digitalizado), these have not yet been included therein, nor have the aforementioned documents" (see reports and supporting evidence).

On April 8, 2021, the Directorate of Educational Infrastructure and Equipment began reviewing the general cures that had been submitted (see reports and supporting evidence).

On April 22, 2021, document DVM-A-DIE-DDO-0330-2021 was submitted, containing the bid analysis and general cure, in which only one of the bidders was required to submit a cure on the technical portion (see reports and supporting evidence).

On June 2, 2021, individual cures (subsanes individuales) were notified (see reports and supporting evidence).

On June 9, 2021, the individual cures were received and are pending review in order to generate the final report (see reports and supporting evidence).

III. ON THE RIGHT TO ENJOY A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT IN EDUCATIONAL CENTERS

This Court, in Judgment N° 2019-3032 of 9:45 a.m. on February 22, 2019, stated the following:

"III.- On the right to enjoy a healthy and ecologically balanced environment in Educational Centers — The right to health recognized in Articles 21 of the Political Constitution, 1 and 11 of the American Declaration of the Rights and Duties of Man, 4 of the American Convention on Human Rights, and 10 of the Additional Protocol to the American Convention on Human Rights in the Area of Rights, is intimately linked to the right to live in a healthy and balanced environment, enshrined in constitutional Article 50. Environmental quality is a fundamental parameter of quality of life, alongside health, food, work, housing, and education, among others. Accordingly, the State has the obligation to ensure adequate protection of the environment, for which it must take the necessary measures to ensure that the environment is free of contamination and that alterations produced both by human activity and by nature, whether in the immediate or distant surroundings, do not constitute harm to the environment or to the health of persons living therein.

This right is especially recognized when it is associated with other fundamental rights, such as the right to education. The latter is configured as a fundamental right, which is expressed in the public service provided by the State through the various educational centers throughout the country. Therefore, the least the State can do is ensure that, in providing this public service, it does not infringe upon other fundamental rights, such as the right to health and to a healthy environment, for both students and the teaching and administrative staff of the educational institution."

IV. ON THE SPECIFIC CASE

In the case under study, the petitioner alleges that since 2016, the construction of a new school has been under consideration due to the deplorable conditions at educational center Escuela La Flor de Bahía, but that no progress has been made. The petitioner further alleges that, although the Ministry of Health has conducted follow-up visits to monitor compliance with the sanitary orders (órdenes sanitarias) issued, neither the plan of necessary actions to complete the required infrastructure for the educational center has been carried out, nor has any meaningful progress been achieved with the Directorate of Educational Infrastructure and Equipment of the Ministry of Public Education, despite the fact that the school's current conditions place minors at risk, as well as their rights to a healthy and balanced environment and to education. After reviewing the court record (autos), the Court found it established that since 2016, the Regional Directorate of Health Governance of the Brunca region of the Ministry of Health issued sanitary order BRU-ARS-O-ERS-1071-2016 due to the severe deterioration suffered by the Escuela Líder Flor de Bahía.

Although the Board of Education (Junta de Educación) and the director of the educational center sought improvements from the Directorate of Educational Infrastructure and Equipment of the Ministry of Education, these improvements were never carried out. Subsequently, a complaint was filed with the Defensoría de los Habitantes due to the inaction of the authorities with respect to the situation of the educational center; and during a follow-up visit conducted by the Ministry of Health on March 7, 2019, it was determined that the school had deteriorated even further compared to the first inspection conducted in 2016. Under these circumstances, through new sanitary order BRU-ARS-O-ERS-295-2019 of March 13, 2019, three months were granted to present an improvement plan to resolve the nine deficiencies found, together with a schedule for the completion or conclusion of each activity. In this regard, on July 2, 2019, the Directorate of Educational Infrastructure and Equipment sent official communication DVM-A-DIEE-DGPE-2025-2019 to the Ministry of Health, indicating its willingness to comply with what was requested in the sanitary order and attaching an activity schedule projecting the start of works for October 2020; however, in October 2019, the administrative procurement process began, which, at the time the writ of amparo (recurso de amparo) was filed, had not progressed beyond the bid-analysis stage, with the delay attributed to the restructuring of the Directorate of Educational Infrastructure and Equipment.

Based on the foregoing facts, the Court concludes that the authorities of the Ministry of Public Education have openly violated the fundamental rights of the students and staff of the Escuela Líder Flor de Bahía. On one hand, it is determined that despite the fact that the building is in worse condition than at the time of the first inspection, efforts to construct a new educational center or at least to repair it have borne no fruit. It was thus established that students are currently in conditions of overcrowding (hacinamiento) and danger, as "the existing gutters and roof of the facilities have deteriorated further; the metal components such as structural supports show their bases completely deteriorated by rust, with a large number of holes caused by wear; classrooms continue to lack dropped ceilings (cielorraso), and some pieces in areas that did have them have fallen away; the roof structure and supports are built entirely of wood, which is infested with termites (comején), leaving some areas in an advanced state of decay; some metal roofing sheets (láminas) are hanging dangerously while others show bulging caused by moisture and poor fastening.

As for the internal electrical system, the electrical wiring is observed to be without conduit, unsecured, and hanging in various sections; the circuit breaker panels (cajas de breaker) have no covers; and deteriorated junction boxes and electrical outlets (toma corrientes) are observed (…)," among other deficiencies. Such conditions constitute a clear violation of the right to education, the right to health, and the right to a healthy environment — a situation that this Court cannot condone. Although the Directorate of Educational Infrastructure of the Ministry of Public Education underwent a restructuring, the administrative authorities of the Ministry of Public Education should have, in the meantime, taken the necessary steps to ensure that infrastructure projects such as the one at issue in this amparo were not halted. Under these circumstances, the appropriate course of action is to grant the appeal, with the consequences set forth in the operative part (parte dispositiva) of this judgment.

V. NOTE BY JUSTICE SALAZAR ALVARADO

As a matter of principle, I hold that cases related to the action or inaction of the Public Administration in the repair, construction, modification, or demolition of any infrastructure work should be dismissed, as such omission constitutes a matter of legality whose resolution belongs to the ordinary courts, before which the interested party may argue their disagreements more fully. However, when such administrative conduct — whether an omission or otherwise — gives rise to a violation of other fundamental rights protected under this constitutional jurisdiction, or affects groups considered vulnerable, I do proceed to examine the merits of the matter, as this constitutes an exception to my general position on these matters, as is the case here, where the petitioner indicates that the Escuela Líder Flor de Bahía is in deplorable physical and sanitary conditions and has been awaiting the construction of a new educational center since 2016 without obtaining positive results, attributable to a lack of inter-institutional coordination, all of which places the life and health of the minors attending that center at risk.

VI. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby notified that, if any paper documents, objects, or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device have been submitted, these must be retrieved from the office within a maximum period of thirty business days counted from the notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena at Session N° 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial N° 19 of January 26, 2012, as well as pursuant to the agreement approved by the Consejo Superior del Poder Judicial at Session N° 43-12 held on May 3, 2012, Article LXXXI.

THEREFORE:

The writ of amparo (recurso de amparo) is granted. Catalina Salas Hernández, in her capacity as Director of the Directorate of Educational Infrastructure of the Ministry of Public Education (Ministerio de Educación Pública), or whoever holds that position in her stead, is ordered to issue the necessary directives within the scope of her respective competencies and to take the corresponding steps so that, within a maximum period of EIGHTEEN MONTHS counted from the notification of this Judgment, the construction of the Escuela Flor de Bahía is carried out with the structural improvements specified by the Ministry of Health. Said facility must guarantee the right to health and a healthy and adequate environment for the education of the students of that educational center. The foregoing is subject to the warning that, pursuant to Article 71 of the Constitutional Jurisdiction Act (Ley de la Jurisdicción Constitucional), imprisonment of three months to two years, or a fine of twenty to sixty days, shall be imposed on any person who receives an order that they must comply with or cause to be complied with, issued in an amparo writ, and fails to comply with it or fails to cause it to be complied with, provided the offense is not more severely penalized under another provision.

The State is condemned to pay costs, damages, and losses (costas, daños y perjuicios) caused by the acts underlying this declaration, which shall be assessed in the execution of judgment before the contentious-administrative jurisdiction (lo contencioso administrativo). *210099210007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del veinte de agosto de dos mil veintiuno .

Recurso de amparo que se tramita en el expediente número 21-008991-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, a favor de los estudiantes de la ESCUELA LÍDER LA FLOR DE BAHÍA BALLENA, contra el MINISTERIO DE EDUCACIÓN PÚBLICA.

RESULTANDO:

  1. 1Por escrito presentado ante la Secretaría de esta Sala a las 09:45 horas del 25 de mayo de 2021, la parte recurrente presenta recurso de amparo contra el Ministerio de Educación Pública, y manifiesta; en resumen: que, el 15 de mayo de 2016, se solicitó por oficio N°EFB-002-2017, a la Dirección de Infraestructura y Equipamiento Educativo, la valoración para la construcción de una nueva escuela debido a las pésimas condiciones que presenta el centro educativo La Flor de Bahía. Además, y se le reiteró a la Dirección de Infraestructura brindar una respuesta de atención institucional a la orden sanitaria emitida por el Área de Salud de la zona N°BRU-ARS-O-ERS-294-2019, debido a que se contaba con tres meses para realizar las mejoras a la institución. Señala, que en el mes de junio de 2019, el MSc. Johnny Sánchez Fernández presentó el oficio N° JE- ELFB-049-06-2019, con las acciones realizadas por la Junta Educación y la escuela La Flor de Bahía ante el Ministerio de Salud de Palmar Norte, en respuesta a la orden sanitaria BRUARS-O-ERS-294-2019 y se envió el oficio N° JE- ELFB-048-06-2019, a la Dirección de Infraestructura y Equipamiento Educativo solicitando un plan de ejecución de la obra.Afirma que mediante oficio DVM-A-DIEE-DGPE-2025-2019 de 2 julio de 2019, la Dirección de Infraestructura reiteró su anuncia a cumplir la orden sanitaria girada, además adjuntó un cronograma de actividades donde incluso las obras debían iniciarse en octubre de 2020. Nombre02 que el 18 de octubre de 2019, mediante oficio DIEE-DC-OF-397-2019 de la Dirección de Infraestructura se dio la apertura de las ofertas para el procedimiento de contratación directa, el cual se mantuvo hasta las 10:00 horas del 29 de octubre de ese año. Nombre02, que en oficio DIEE-DC-0077-2020, de 26 de junio 2020 la Dirección de Infraestructura y Equipamiento Educativo comunicó que se realizaron cambios a causa de la reorganización de la misma, en la cual se estableció que los departamentos formuladores debían asumir las funciones de análisis técnico de las ofertas dentro de los procesos de contratación de servicios profesionales de diseño.Asimismo, se remitió el listado de los centros educativos que se encontraban pendientes de realizar el análisis de ofertas, donde la Escuela La Flor de Bahía era uno de los pendientes y en su estado actual, se indicaba que se encontraba en análisis de ofertas. Alega que hasta el momento de la interposición de este recurso continúan las malas condiciones en la infraestructura de la escuela y se han incrementado con el aumento de matrícula escolar, por lo que, actualmente cuenta con doscientos sesenta estudiantes y veintidós miembros del personal, que reciben e imparten lecciones en condiciones de hacinamiento y riesgo debido a la infraestructura del centro educativo. Agrega que han sufrido inundaciones de aulas por los fuertes aguaceros y el mal manejo de las aguas pluviales, por lo que requiere atención urgente para proteger la integridad física de los niños y niñas, así como del personal que labora en dicho lugar.Solicita que se declare con lugar el recurso y se ordene a la autoridad recurrida agilizar los procedimientos de contratación necesarios para la construcción de la nueva edificación para la escuela La Flor de Bahía.
  2. 2Por resolución de las 13:04 horas del 26 de mayo de 2021, se dio curso al presente recurso de amparo y se solicitó informe a la Directora de Infraestructura y Equipamiento Educativo y el Director Regional de Educación de Pérez Zeledón, ambos del Ministerio de Educación Pública, así como al Director de la Escuela Líder La Flor de Bahía Ballena.
  3. 3Informa bajo juramento Ramón Fernando Monge Ilama en su condición de Supervisor de Educación Circuito 04, de la Dirección Regional de Educación de Pérez Zeledón, en relación con lo actuado por la Junta de Educación y Dirección de la Escuela Líder La Flor de Bahía, código 1007, del Circuito 04, de la Dirección Regional de Educación de Pérez Zeledón, por motivo de que el Director se encuentra en periodo de descanso. Señala, que el 06 de febrero de 2017, mediante Oficio EFB-002-2017 se trasladó a la Dirección de Infraestructura y Equipamiento Educativo la Orden Sanitaria BRU-ARS-O-ERS-1071-2016, la cual daba un plazo de tres meses para realizar las mejoras señaladas al edificio institucional. Alude, que el 30 de noviembre 2017, se recibió el Oficio DIEE-3059-2017 donde se informa un depósito para hacer en tracto A, por la suma de ¢12.023.554.00 (doce millones veintitrés mil quinientos cincuenta y cuatro colones, cero céntimos).Refiere, que el 11 de diciembre 2017, en el Acta 323, la junta aprobó el presupuesto por el monto descrito en el punto anterior y remitió la documentación a la Dirección de Infraestructura y Equipamiento Educativo, con copia al Ingeniero a cargo, Rigoberto González Espinoza; se adjuntó acuerdo de inicio y la justificación para la contratación de servicios profesionales. Evoca, que el 27 de febrero de 2019 se recibe Oficio N° 02065-2019-DHR, Expediente N° 272669-2018-SI, dirigido a la Arquitecta Andrea Obando Torres, Directora de Infraestructura y Equipamiento Educativo, donde se le solicita un informe al respecto, lo anterior, de que el 05 de septiembre del 2018, el señor Milton Arcadio Lobo Cortés, interpuso denuncia ante la Defensoría de los Habitantes de la República debido al incumplimiento de la Dirección de Infraestructura y Equipamiento Educativo. Afirma, que el 13 de marzo de 2019, se recibe informe de visita BRU-ARS-O-ERS-294-2019, con informe de inspección a la institución por parte del Equipo de Regulación de la Salud.Manifiesta, que el 24 de junio de 2019, se recibe MS-DRRSBRU-ARSO-ERS-793-2019 solicitando a la institución un Plan remedial. Aduce, que el 27 de junio de 2019 se envía oficio N° JE- ELFB-048-06-2019, a la Dirección de Infraestructura y Equipamiento Educativo solicitando un plan de ejecución de la obra, lo anterior para el cumplimiento de la orden sanitaria BRU-ARS-O-ERS-295-2019, y el oficio MS-DRRSBRU-ARSO-ERS-793-2019 del Ministerio de Salud de Palmar Norte, donde se contaba con diez días hábiles para presentarlo. Expone, que el 28 de junio de 2019, el Director, MSc. Johnny Sánchez Fernández y el Presidente de la Junta de Educación, señor Milton Arcadio Lobo Cortés, mediante Oficio JE- ELFB-049-06-2019, presentan al Ministerio de Salud sede Palmar Norte, las acciones realizadas por la Junta Educación ante la orden sanitaria BRU-ARS-O-ERS-294-2019. Explica, que el 02 julio del 2019, mediante oficio DVM-A-DIEE-DGPE-2025-2019, la Dirección de Infraestructura y Equipamiento Educativo reitera su disposición a cumplir con lo solicitado en la orden sanitaria, adjunta un cronograma de actividades, con proyección de inicio de las obras para octubre del año 2020.Declara, que el 07 de octubre de 2020, la Defensoría de los Habitantes, con el caso N° 272669-2020, con el Oficio Nº 11985-2020-DRH, establece un plazo de quince días hábiles, a la Directora de la Dirección de Infraestructura y Equipamiento Educativo, Viceministro Administrativo de Educación y Director del Área de Salud de Osa, para dar informes. Plantea, que a la fecha, no se han recibido dichos informes. Acota, que el 18 de octubre del 2019 mediante Oficio DIEE-DC-OF-397-2019, la Dirección de Infraestructura y Equipamiento Educativo autorizó la apertura de las ofertas para el procedimiento de contratación directa, el cual se mantuvo hasta las 10:00 horas del 29 de octubre de 2019. Añade, que el 26 de junio de 2020, mediante oficio DIEE-DC-0077-2020, la Dirección de Infraestructura y Equipamiento Educativo comunicó que se realizaron cambios a causa de la reorganización de dicha dirección, en la cual se estableció que los departamentos formuladores debían asumir las funciones de análisis técnico de las ofertas dentro de los procesos de contratación de servicios profesionales de diseño.Asimismo se remitió el listado de los centros educativos que se encontraban pendientes de realizar el análisis de ofertas, donde la Escuela La Flor de Bahía era uno de los pendientes y en su estado actual se indicaba que se encontraba en análisis de ofertas. Relata, que las malas condiciones en la infraestructura de la escuela continúan, incluso, se han incrementado, aunado al aumento de matrícula escolar, con más de doscientos cincuenta estudiantes y veintidós miembros del personal, que día a día hacen uso de la infraestructura del centro educativo. Asevera, que es inminente el riesgo que existe de que dado el mal estado de la infraestructura, el Ministerio de Salud Pública ordene el cierre y en la comunidad no se cuenta con un espacio adecuado para albergar a los estudiantes y funcionarios.
  4. 4Informa bajo juramento Geovanny Soto Solórzano en su condición de Director Regional de Educación de Pérez Zeledón, que se adhiere al informe brindado por el señor Fernando Monge Ilama, Supervisor de Centros Educativos, Circuito Escolar 04. Además, agrega que de parte de la Dirección Regional de Educación, por medio de la oficina de Supervisión del Circuito Escolar 04 y del mismo centro educativo, se han realizado todos los trámites correspondientes para solventar las necesidades presentadas en la Escuela Líder La Flor de Bahía Ballena, y que por cuestiones fuera de la competencia el proceso se ha atrasado en gran manera.
  5. 5Informa bajo juramento Catalina Salas Hernández en su condición de Directora de la Dirección de Infraestructura Educativa del Ministerio de Educación Pública, que se sabe de las necesidades en infraestructura que sufre el centro educativo, pues se ha llevado a cabo el proceso respectivo y atinentes para atender y avanzar en solventar las necesidades estructurales. Relata, que se solicitó informe al Departamento de Desarrollo de Obra de la Dirección de Infraestructura Educativa, quienes remiten oficio DVM-A-DIE-DDO-0653-2021, indicando que actualmente, el proceso se encuentra en el análisis de ofertas, se hizo solicitud de Subsanes Generales, el día 08 de abril de 2021 se inició con la revisión de subsanes generales presentados, el pasado 22 de abril de 2021, se remitió el documento DVM-A-DIE-DDO-0330-2021, análisis de ofertas y subsane general, en el cual solo uno de los oferentes debería de subsanar en la parte técnica, se notificaron los subsanes individuales el día 02 de junio de 2021, los subsanes individuales fueron recibidos el 09 de junio de 2021 y están pendientes de revisión para generar el informe final y continuar con el proceso de contratación de servicios profesionales para el desarrollo de toda la consultoría de diseño y planos, para la construcción de la nueva obra.Continúa y afirma, que teniendo el informe final en firme, se tardaría un mes aproximadamente por parte del staff legal para trasladar al departamento de Desarrollo de Obra, el contrato firmado por el adjudicatario y por el presidente de la junta, luego de eso, se tardaría aproximados un plazo mínimo esperable de un año para tener listos los planos con los respectivos permisos, es decir para el año 2022. Sigue y expone que, una vez con esa etapa finalizada se deberán solicitar los recursos y que eso depende del plan de inversión de ese periodo. Especifica, que según lo permita la autorización de lo presupuestado del programa aprobado para la gestión de inversión en infraestructura educativa, que debe estar aprobado por la Asamblea Legislativa, entonces los recursos se podrían disponer para el año 2024. Puntualiza, que posteriormente se podría iniciar el proceso de contratación de obra, el cual estaría listo en un plazo mínimo aproximado de seis meses más, si todo transcurre bien sin objeciones y apelaciones y sin factores externos ajenos a este dependencia que puedan atrasar las etapas dichas, como la asignación del presupuesto indicada o falta de gestiones activas de la misma Junta, las obras estarían iniciando en el segundo semestre del 2024, siendo que las mismas se esperarían estuviesen listas en un plazos no menor al primer semestre de 2025, dichos plazos se rinden en razón de que se trata de procesos variados y de que por la naturaleza de construcción de educación educativa son complejos, no obstante son plazos materialmente posibles, realizables y viables desde un punto de vista técnico, financiero, administrativo y conformes al principio de legalidad que rigen en materia de contratación administrativa. Solicita se declare sin lugar el recurso.
  6. 6En los procedimientos seguidos se han observado las prescripciones de ley.

Redacta el Magistrado Salazar Alvarado; y,

CONSIDERANDO:

I. OBJETO DEL RECURSO

El recurrente alega que desde el año 2016, se tramitó ante la Dirección de Infraestructura y Equipamiento Educativo del Ministerio recurrido, la valoración para la construcción de una edificación para la escuela Flor de Bahía, debido a las pésimas condiciones en las que se encuentro, situación por la cual el Área de Salud emitió las órdenes sanitarias BRU-ARS-O-ERS-1071-2016 y BRU-ARS-O-ERS-294-2019. Señala, que a la fecha las malas condiciones en la infraestructura de la escuela continúan, lo cual estima violatorio de los derechos fundamentales de los estudiantes y personal administrativo del centro educativo.

II. HECHOS PROBADOS

De importancia para la resolución de este asunto, se tienen por demostrados los siguientes hechos:

El 06 de febrero de 2017, mediante Oficio N° EFB-002-2017, la Junta de Educación de la Escuela Flor de Bahía trasladó a la Dirección de Infraestructura y Equipamiento Educativo, la Orden Sanitaria n°BRU-ARS-O-ERS-1071-2016, en la cual se dio un plazo de tres meses para realizar las mejoras al edificio del centro educativo (véase informe y pruebas aportadas).

Mediante Oficio N° DIEE-3059-2017 de 30 de noviembre de 2017, la Dirección de Infraestructura y Equipamiento Educativo, indicó a la Junta de Educación del centro educativo en cuestión: “De acuerdo con la programación, para la ejecución de proyectos de la Dirección de Infraestructura y Equipamiento Educativo; tengo el agrado de informarles que en las siguientes planillas del año en curso, se les depositará la suma de ¢12.023.554 sujeto al contenido presupuestario del Ministerio de Hacienda, y la destinación de recursos para suplir las necesidades de Infraestructura y Compra de Terreno. Los recursos están destinados para: PAGO DE SERVICIOS PROFESIONALES (TRACTO A) Y ESTUDIOS PRELIMINARES por lo que es imprescindible que procedan a presupuestar dichos recursos, de la siguiente manera: La Junta de Educación o Administrativa deberá reunirse para confeccionar el presupuesto extraordinario (Contable), donde se refleje dicho monto y en las partidas correspondientes; para luego tomar el acuerdo en actas y proceder a firmar y sellar dicho presupuesto.

La Junta de Educación o Administrativa llevará a la Dirección Regional respectiva dicho presupuesto extraordinario, para que el Encargado de Juntas proceda a revisar el presupuesto según la “Guía para la verificación de Aprobación Interna del Plan de Presupuesto”, luego de dicha revisión, procederá a firmar y sellar el presupuesto. La Junta de Educación o Administrativa enviará a la DIEE el presupuesto extraordinario con las respectivas firmas y sellos, por medio del siguiente correo electrónico, Víctor Hernández Román ...01 o bien al fax: Telf01, en un periodo no mayor a 10 días hábiles posteriores a la recepción de este documento. Notas:

  • 1)Sólo deben entregar las 3 hojas que confeccionaron en Excel, no deben adjuntar ningún otro documento.
  • 2)Los recursos NO se depositarán, hasta que no se haya enviado una copia del presupuesto al correo indicado
  • 3)Se depositarán los recursos hasta que el Ministerio de Hacienda libere la cuota de Infraestructura, ya que el ente que realiza las transacciones a las respectivas cuentas de Caja Única del Estado” (véase informe y pruebas aportadas).

El 11 de diciembre 2017, en el Acta 323, la Junta aprobó el presupuesto por el monto descrito en el punto anterior y remitió la documentación a la Dirección de Infraestructura y Equipamiento Educativo, con copia al Ingeniero a cargo, Rigoberto González Espinoza; se adjuntó acuerdo de inicio y la justificación para la contratación de servicios profesionales (véase informe).

El 05 de septiembre del 2018, el señor Milton Arcadio Lobo Cortés, de la Junta de Educación del centro educativo interpuso denuncia ante la Defensoría de los Habitantes de la República debido al incumplimiento e inercia de la Dirección de Infraestructura y Equipamiento Educativo (véase informes y pruebas aportadas).

Mediante Oficio N° 02065-2019-DHR, que consta en el expediente N° 272669-2018-SI, la Directora del Área de Niñez y Adolescencia de la Defensoría de los Habitantes le solicitó a la Andrea Obando Torres, Directora de Infraestructura y Equipamiento Educativo, un informe con respecto a la situación estructural de la Escuela Flor de Bahía (véase informes y pruebas aportadas).

El 13 de marzo de 2019, la Dirección Regional de Rectoría de la Salud Brunca realizó informe de visita de seguimiento en la institución, y concluyó que: “Vistas las condiciones actuales de la Escuela, lo indicado por la Junta de Educación y a que presenta mayor deterioro en comparación con la visita anterior y que producto de esta nueva visita se encontraron otras condiciones de riesgo, que no pueden ser subsanadas con reparaciones superficiales o estéticas, se deberán tomar medidas que involucren la eliminación de los riesgos por problemas estructurales, estéticos, de tratamiento de aguas residuales, hacinamiento, accesibilidad universal y de confort térmico que presenta actualmente la institución. Ante ello, con el fin de garantizar la salud pública y del ambiente y velar por la población estudiantil, administrativo y personas que asisten a la institución educativa, se declara la institución peligrosa por lo que se deberá girar nueva orden sanitaria que incorpore las nuevas mejoras y dejar sin efecto la Orden Sanitaria BRU-ARS-O-ERS-1071-2016, la cual además no fue cumplida”(… ) Y estableció nueve mejoras a realizar en la institución (véase informes y pruebas aportadas).

El 24 de junio de 2019, la Dirección del Área Rectora de Salud de Osa, envía oficio MS-DRRSBRU-ARSO-ERS-793-2019 solicitando a la institución un “plan remedial necesario para atender las no conformidades correspondientes a la Orden Sanitaria BRU-ARS-O-ERS-295-2019 en un plazo máximo de diez días hábiles” (véase informes y pruebas aportadas).

El 27 de junio de 2019, el Director de la Escuela La Flor de Bahía remitió el oficio N°JE- ELFB-048-06-2019 a la Dirección de Infraestructura y Equipamiento Educativo, solicitando un plan de ejecución de la obra, para el cumplimiento de la orden sanitaria BRU-ARS-O-ERS-295-2019, y el oficio MS-DRRSBRU-ARSO-ERS-793-2019, del Ministerio de Salud de Palmar Norte, donde se otorgaba un plazo de diez días hábiles para presentarlo (véase informes y pruebas aportadas).

El 28 de junio de 2019, el Director del centro educativo y el Presidente de la Junta de Educación, entregó el Oficio JE- ELFB-049-06-2019, al Ministerio de Salud sede Palmar Norte, sobre las acciones realizadas por la Junta Educación ante la orden sanitaria BRU-ARS-O-ERS-294-2019 (véase informes y pruebas aportadas).

El 02 julio del 2019, la Dirección de Infraestructura y Equipamiento Educativo remitió el oficio DVM-A-DIEE-DGPE-2025-2019, al Ministerio de Salud, indicando las obras a realizar en la Escuela Flor de Bahía: “Construcción de 6 aulas diee-2016 de 72m², 2 aulas preescolar de 84 m², 1 aula de idiomas de 72 m², 1 comedor 144 m², 4 baterías de servicios sanitarios 30 m², 1 administración de 84 m², 1 biblioteca de 72 m², 1 aula de cómputo de 72 m2, 1 módulo de apoyo de 144 m2, 1 área de espera para padres, 1 caseta de guarda de 31 m², pasos cubiertos, 1 cancha techada de 900 m² y obras complementarias”. Además, se indicó el cronograma de actividades, con proyección de inicio de las obras para octubre del año 2020 (véase informes y pruebas aportadas).

El 07 de octubre de 2020, la Defensoría de los Habitantes, bajo el caso N° 272669-2020, elaboró una serie de recomendaciones la Directora de la Dirección de Infraestructura y Equipamiento Educativo, al Vice ministro Administrativo de Educación y al Director del Área de Salud de Osa, con relación a la situación de la Escuela Flor de Bahía (véase informes y pruebas aportadas).

El 18 de octubre del 2019, mediante Oficio DIEE-DC-OF-397-2019, el Departamento de Contrataciones de la Dirección de Infraestructura y Equipamiento Educativo autorizó la apertura de las ofertas para el procedimiento de contratación directa, el cual se mantuvo hasta las 10:00 horas del 29 de octubre de 2019 (véase informes y pruebas aportadas).

El 26 de junio de 2020, mediante oficio DIEE-DC-0077-2020, la Dirección de Infraestructura y Equipamiento Educativo comunicó que se realizaron cambios a causa de la reorganización de la DIEE, en la cual se estableció que los departamentos formuladores debían asumir las funciones de análisis técnico de las ofertas dentro de los procesos de contratación de servicios profesionales de diseño, asimismo se remitió el listado de los centros educativos que se encontraban pendientes de realizar el análisis de ofertas, donde la Escuela La Flor de Bahía era uno de los pendientes y en su estado actual se indicaba que se encontraba en análisis de ofertas (véase informes y pruebas aportadas).

El 11 de setiembre de 2020, se asignó el análisis de ofertas al arquitecto Alexander Aguilar Sobalbarro (véase informes y pruebas aportadas).

El día 23 de octubre de 2020, la parte recurrida remitió el documento DVM-A-DIE-DDO-0110-2020, como insumo de respuesta para la Defensoría de los Habitantes, en el cual se le indica: “que por atención de prioridades de los casos que arrastra del desaparecido Departamento de Contrataciones DIEE, según DVM_A_DIEE_0233_2020 y bajo las órdenes del asignado Coordinador general del Departamento de Contrataciones, el Ing. Pablo Zúñiga, nombrado por usted y que sigue en el departamento a mi cargo realizando esta función, es que el arquitecto le brindo atención al caso, una vez encontrado un espacio dentro de los dos primeros puntos de prioridad indicados en el documento DVM-A-DIE-DDO-0030-2020, siendo que para el día 12 de octubre del 2020 remite a su persona el documento DVM-A-DIE-DDO-0080-2020, Solicitud de Subsane General” (véase informes y pruebas aportadas) .

El día 13 de enero de 2021, se remitió el documento DVM-A-DIE-DDO-0035-2021, como insumo de respuesta para Enlace Territorial de la Casa Presidencial, en el cual se indica: “No se tiene comunicado de que los subsanes generales solicitados ya fueron entregados por los oferentes, y revisando el expediente digitalizado aún no se muestran incluidos estos, ni los documentos antes mencionados” (véase informes y pruebas aportadas).

El día 08 de abril de 2021, la Dirección de Infraestructura y Equipamiento Educativo inició con la revisión de subsanes generales presentados (véase informes y pruebas aportadas).

El 22 de abril de 2021 se remitió el documento DVM-A-DIE-DDO-0330-2021, análisis de ofertas y subsane general, en el cual solo uno de los oferentes debería de subsanar en la parte técnica (véase informes y pruebas aportadas).

El 02 de junio de 2021, se notificaron los subsanes individuales (véase informes y pruebas aportadas).

El 09 de junio de 2021, los subsanes individuales fueron recibidos y están pendientes de revisión para generar el informe final (véase informes y pruebas aportadas).

III. SOBRE EL DERECHO A GOZAR DE UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO EN LOS CENTROS DE EDUCACIÓN

Esta Sala, en Sentencia N° 2019-3032 de las 9:45 horas de 22 de febrero de 2019, indicó lo siguiente:

“ III.- Sobre el derecho a gozar de un ambiente sano y ecológicamente equilibrado en los Centros de Educación- El derecho a la salud reconocido en los artículos 21 de la Constitución Política, 1 y 11 de la Declaración Americana de los Derechos y Deberes del Hombre, 4 de la Convención Americana sobre Derechos Humanos y 10 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos, se encuentra íntimamente ligado al derecho a vivir en un ambiente sano y equilibrado, consagrado en el artículo 50 constitucional. La calidad ambiental es un parámetro fundamental de la calidad de vida; al igual que la salud, alimentación, trabajo, vivienda, educación, entre otros. En consecuencia, el Estado tiene la obligación de procurar una protección adecuada al ambiente, para lo cual debe tomar las medidas necesarias a fin de que el medio esté libre de contaminación, y que las alteraciones producidas tanto por el hombre como por la naturaleza, en el entorno próximo o lejano, no constituyan una lesión al ambiente ni a la salud de las personas que en él habitan.

Se reconoce especialmente este derecho cuando está asociado a otros derechos fundamentales, como lo sería el derecho a la educación. Este último se configura como un derecho fundamental, el cual se traduce en el servicio público que brinda el Estado en los distintos centros educativos del país. Por lo tanto, lo menos que puede hacer el Estado es que al brindar la prestación de este servicio público no lesione otros derechos fundamentales, como sería el derecho a la salud y a un ambiente sano, tanto de los estudiantes como del personal docente y administrativo de la institución educativa”.

IV. SOBRE EL CASO CONCRETO

En el caso bajo estudio, el recurrente acusa que desde 2016, se está valorando la construcción de una nueva escuela, debido a las pésimas condiciones que presenta el centro educativo La Flor de Bahía, pero no se ha concretado. Alega que, si bien el Ministerio de Salud ha realizado visitas de seguimiento para el cumplimiento de las órdenes sanitarias emitidas, no se ha cumplido con el plan de acciones necesario para concretar la infraestructura requerida para el centro educativo, ni se ha logrado mayor avance con la Dirección de Infraestructura y Equipamiento Educativo del Ministerio de Educación Pública, pese a que las condiciones actuales de la escuela ponen en riesgo a los menores de edad, así como sus derechos a un ambiente sano y equilibrado y a la educación. Tras analizar los autos, la Sala tuvo por probado que desde el año 2016, la Dirección Regional de Rectoría de la Salud Brunca del Ministerio de Salud, giró la orden sanitaria BRU-ARS-O-ERS-1071-2016, por el gran deterioro que sufre la Escuela Líder Flor de Bahía.

Si bien es cierto, la Junta de Educación y la Dirección del centro educativo gestionó la realización de mejoras ante la Dirección de Infraestructura y Equipamiento Educativo del Ministerio de Educación, éstas nunca se realizaron. Posteriormente, se interpuso una denuncia ante la Defensoría de los Habitantes por la inercia de las autoridades ante la situación del centro educativo, y mediante visita de seguimiento realizada por el Ministerio de Salud el 7 de marzo de 2019, se determinó que existe un mayor deterioro de la escuela, que en la primera inspección realizada en el 2016. Así las cosas, mediante nueva orden sanitaria BRU-ARS-O-ERS-295-2019 de 13 de marzo de 2019, se otorgaron tres meses para presentar un plan de mejoras para resolver las nueve deficiencias encontradas, junto con un cronograma de realización o finalización de cada actividad. Al respecto, el 02 julio del 2019, la Dirección de Infraestructura y Equipamiento Educativo envió oficio DVM-A-DIEE-DGPE-2025-2019, al Ministerio de Salud, indicando su disposición a cumplir con lo solicitado en la orden sanitaria, adjuntando un cronograma de actividades, con proyección de inicio de las obras para octubre del año 2020; sin embargo, en octubre de 2019 inició el proceso de contratación administrativa, el cual, al momento de la interposición del recurso de amparo, no había pasado de la etapa de análisis de ofertas, justificando el atraso por la reestructuración de la Dirección de Infraestructura de Equipamiento Educativo.

De los hechos expuestos, la Sala logra concluir que las autoridades del Ministerio de Educación Pública han lesionado abiertamente los derechos fundamentales de los estudiantes y del personal de la Escuela Líder Flor de Bahía. Por un lado, se determina que a pesar de que el inmueble se encuentra en peores condiciones que aquellas encontradas en la primera inspección, los esfuerzos por construir un nuevo centro educativo o al menos repararlo, no han dado fruto. Así las cosas, se constató que los estudiantes se encuentran actualmente en condiciones de hacinamiento y peligro, pues “las canoas existentes y techo de las instalaciones se han deteriorado más, las piezas metálicas como soportes de la estructura presentan sus bases completamente deterioradas por el óxido, observándose gran cantidad de huecos por desgaste, las aulas continúan sin cielorraso, algunas piezas de las áreas que sí poseían se han desprendido, la estructura y soporte de techo están construidas completamente con madera, misma que se encuentra infestada con comején por lo que hay zonas con avanzado estado de pudrición, algunas láminas están colgando peligrosamente y otras se observan con abultamiento producto de la humedad y mala fijación.

El sistema eléctrico interno se observa que el cableado eléctrico se encuentra sin entubar, no se encuentra fijado y cuelga en varios sectores, las cajas de breaker no poseen tapa y se observan cajas de conexión o toma corrientes deteriorados, (…)”, entre otras falencias. Tales condiciones constituyen una violación evidente del derecho a la educación, a la salud y a un ambiente sano, situación que no puede ser avalada por esta Sala. Si bien la Dirección de Infraestructura Educativa del Ministerio de Educación Pública sufrió una restructuración, las autoridades administrativas del Ministerio de Educación Pública debieron, mientras tanto, disponer lo necesario para que los proyectos de infraestructura como el que es objeto de este amparo no se paralizaran. Así las cosas lo procedente es declarar con lugar el recurso, con las consecuencias que se indican en la parte dispositiva de esta sentencia.

V. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En tesis de principio, considero que los casos relacionados con la actividad o inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa (omisiva o no) se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en que la parte recurrente indica que la Escuela Líder Flor de Bahía se encuentra en deplorables condiciones físico-sanitarias, esperando la construcción de un nuevo centro educativo desde el año 2016, sin obtener resultados positivos, atribuible a la falta de coordinación interinstitucional, todo lo cual pone en riesgo la vida y salud de los menores de edad que estudian en dicho centro.

VI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara con lugar el recurso. Se ordena a Catalina Salas Hernández en su condición de Directora de la Dirección de Infraestructura Educativa del Ministerio de Educación Pública, o a quien en su lugar ocupe el cargo, que gire las directrices necesarias, en el respectivo ámbito de sus competencias, y gestione lo correspondiente para que, en el plazo máximo de DIECIOCHO MESES contado a partir de la notificación de esta Sentencia, se realice la construcción de la Escuela Flor de Bahía con las mejoras estructurales señaladas por el Ministerio de Salud. Dicho inmueble deberá garantizar el derecho a salud, y un ambiente sano y adecuado para la educación de los estudiantes de ese centro educativo. Lo anterior bajo apercibimiento que, con base en lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
