Constitutional protection petition (recurso de amparo) processed under case file No. 21-013534-0007-CO, filed by [Nombre01 001], national identity document number (cédula de identidad) [Valor CED01], against the MINISTERIO DE AMBIENTE Y ENERGÍA and the MINISTERIO DE SEGURIDAD PÚBLICA.

Recitals:

  1. 1By written submission received at the Clerk's Office of the Chamber at 16:36 hours on July 13, 2021, the petitioner files a constitutional protection petition against the MINISTERIO DE AMBIENTE Y ENERGÍA and the MINISTERIO DE SEGURIDAD PÚBLICA, and states the following: that the respondent has carried out actions concerning the occupation of land by residents in human settlements (asentamientos humanos), specifically on sites over which the government has never exercised any form of dominion; yet officials are now issuing administrative orders that are not even known to the residents themselves, with no notice of any kind being provided. The petitioner states that, through agreements reached by certain officials within MINAE, specifically at the offices of the Área de Conservación Tortuguero, National Parks, productive human settlements are being dismantled, destroying what many residents have spent more than half a century caring for and maintaining, and which constitutes their means of subsistence.The petitioner states that she is a victim of officials Víctor Montero Navarro, Luis Diego Arce Gamboa, and one Nombre01 Nombre02, who on June 28, 2021, destroyed everything on her land and, after leaving her sleeping on zinc sheets exposed to the open air, returned to humiliate her, shout at her, burn her clothing and, again, her insulin medications and her cooler. She recounts that her rights are not recognized, and that her home and all her belongings have been destroyed. She adds that the respondent institution has treated her property as a no-man's-land in order to commit this outrage. She states that officials Víctor Montero Navarro, Luis Diego Arce Gamboa, and Nombre02, whose surnames she does not know, along with others whose identities she does not know, assaulted her and even attempted to kill her: when she told them not to burn her cooler because it contained her insulin, they laughed and told her they would do it even faster — that is, burn the medications.She states that this violates her fundamental rights. She recounts that she holds a cadastral survey plan (plano catastrado) for property No. L-78153-92, as well as a deed of sale of improvements (carta de venta de mejoras). She adds that MINAE is violating the applicable provisions of the General Law of Public Administration (Ley General de Administración Pública) regarding proper administrative notification procedures, because officials carry out arbitrary evictions in a dehumanizing and uncontrolled manner, replete with humiliating and degrading actions and assaults directed not only at properties but also at residents. She states that on the very same day the eviction notification was issued — giving residents no opportunity to exercise their right to due process, and knowing that the moratorium (moratoria) already approved under decreto 9577 by the Legislative Assembly was in effect — officials proceeded to expel her from her property, destroy all her belongings, and assault her.She states that MINAE gravely violates citizens' constitutional principles and guarantees: officials arrive at properties where private property rights have been exercised — rights established prior to any public domain (dominio público) encumbrances — without a technical or expert study, and without demonstrating with certainty to residents that the sites where their homes, crops, grazing animals, and domestic animals and birds are located are State property. Now, years later, they attempt to carry out evictions through officials who are not even licensed survey engineers (ingenieros topógrafos) with expertise in land measurement and area delineation — they are merely forestry engineers or agronomists who lack the necessary qualifications to carry out an eviction against humble people who have spent their entire lives working these farms to survive. She recounts that these officials sign the administrative orders and then execute them themselves, accompanied by Fuerza Pública officers from Tortuguero, GPS devices in hand but without topographic maps (hojas cartográficas), relying on spurious knowledge of topography, being only forestry technicians or forestry engineers — not geodesists (Geodestas) or licensed survey engineers.She adds that they issue a notification purportedly giving residents 10 days to vacate and then immediately, at that very moment, carry out the eviction and destroy absolutely everything. She states that she is an elderly person (adulto mayor) who was removed from her home, her house was burned, her domestic animals were taken away, her insulin medications were burned — nearly causing her death — and she was left sleeping on burned zinc sheets on the ground. She states that MINAE has looted her food, leaving her with nothing to eat. She recounts that official Víctor Montero Navarro, who identified himself as head of the Tortuguero Office, when asked why other cattle ranchers who are neighbors and landowners — just like her — of the same lands in the Pavona de Cariari de Pococí area were not being evicted, laughed and told her that "if she had the same money, it would be different." She adds that this statement leaves much to be desired and much to consider; she cannot pass judgment, she only repeats what Mr.Montero Navarro told her. She states that she has never logged or deforested — she has spent decades caring for nature and surviving on a subsistence economy based on agricultural products that were completely burned; even the trees of the surrounding vegetation were cut down with chainsaws; her chickens were killed, her pigs and livestock (semovientes) were released and driven off, and her drinking-water wells were clogged with garbage and filth. She states that no prior documentation was provided to her before the eviction, specifically with respect to this MINAE administrative file. She recounts that all these acts were carried out with the participation of the Fuerza Pública, who limited themselves to observing — genuinely moved by the outrageous conduct of the MINAE officials — and the only thing they said was that they were not intervening because they could see that what the MINAE officials were doing was unjust; in other words, the Fuerza Pública officers were brought along to ensure that residents would not defend themselves against the abuses and insolence of the MINAE officials.She adds that she has inquired at the offices of the MINISTERIO DE SEGURIDAD PÚBLICA in Tortuguero and in Guápiles as the regional office, but neither delegation accepts responsibility: in Tortuguero they say the officers were from Guápiles, and in Guápiles they say the officers were from Tortuguero. What she is certain of is that they were officers of the MINISTERIO DE SEGURIDAD PÚBLICA and came directly from the Delegación Cantonal de Guápiles. She considers that such conduct violates her fundamental rights.
  2. 2By order issued at 11:40 hours on July 15, 2021, the petitioner was served with a notice of deficiency (prevención).
  3. 3The notice of deficiency having been satisfied, by order issued at 14:06 hours on July 21, 2021, the present petition was admitted for processing.
  4. 4By written submission entered into the Legal System on July 23, 2021, Roy Venegas Hidalgo, Head of the Police Post of the Delegación Policial de Nombre03, states under oath that as of that date, no administrative eviction orders have been issued directed at the residents of the Barras de Tortuguero sector, or more specifically at the petitioner. He mentions that official communication SINAC-ACTO-DASP-PNT-CP-AF-004-2021, dated May 27, 2021, signed by Ing. Víctor Hugo Montero Navarro, officer in charge of the Control and Protection Program of the Parque Nacional Tortuguero, was received, in which he requested: "… next month of June, specifically on the 28th and 29th, we will be carrying out two evictions as demolitions within the grounds of the Parque Nacional Tortuguero (PNT), as part of the administrative actions of SINAC-ACTO-PNT, which have already been exhausted… Our request is that you provide security with at least 5 Fuerza Pública officers while the ACTO-PNT park rangers (Guardaparques) carry out the technical work, eviction, seizure (decomiso), detention, and destruction, as the case may be…".He notes that, in response to that request, the actions of the Fuerza Pública police officers were limited solely and exclusively to providing perimeter security for the personnel of the Sistema Nacional de Áreas de Conservación Tortuguero. He requests that the petition be dismissed (se declare sin lugar).
  5. 5By written submission entered into the Legal System on July 27, 2021, Michael Soto Rojas, Minister of Public Security, states under oath that there is no record of this Ministry having instructed or ordered any administrative eviction against the petitioner. He notes that on May 27, 2021, the Dirección 12 Caribe of the Fuerza Pública received an official communication from the officer in charge of the Control and Protection Program of the Parque Nacional Tortuguero, requesting police support for an operation to be carried out on June 28 and 29. He mentions that in response to the aforementioned request for assistance and collaboration, the Delegación Policial provided police escort for perimeter security purposes only. He requests that the petition be dismissed.
  6. 6By written submissions incorporated into the Legal System on July 28, 2021, Andrea Meza Murillo, Minister of Environment and Energy, and Laura Segura Rodríguez, Acting Director of the Tortuguero Conservation Area of the Sistema Nacional de Áreas de Conservación, both of the Ministry of Environment and Energy, report under oath that they have exercised dominion over the lands belonging to the State, one of which is Tortuguero National Park. They note that the first complaint filed against the petitioner was in February 2014, under official memorandum ACTO-GASP-RENVSBC-04-2014, pursuant to which a judicial ruling ordered the demolition and eviction of the dwelling where he was living illegally. They mention that some time later he again encroached on the land, constructing new dwellings, giving rise to a series of complaints for unlawful occupation (usurpación) and environmental damage, such as land-use change (cambio de uso del suelo), harm to wetlands (humedales), illegal logging (tala), among others.They add that through official memorandum SINAC-ACTO-DASP-PNT-DE-025-2020, dated August 28, 2020, a complaint was filed with the Prosecutor's Office of Nombre03 against the petitioner for the offense of invasion of the protected wildlife area (área silvestre protegida) known as Tortuguero National Park and unlawful occupation of public-domain property, on the grounds that he had built a dwelling and was keeping crops and domestic animals inside the Park. They further add that through administrative order No. SINAC-ACTO-DASP-PNT-OA-002-2020, the petitioner was ordered as follows: "1. Remove and dismantle all types of infrastructure (houses-dwellings-corrals-fences-and/or any type of construction in which human hands have had a part) regardless of the material from which it was built, and remove it outside the Protected Wildlife Area (Tortuguero National Park), located at GPS point 1166702 - 546432. 2.Eliminate all types of crops found on the plot at coordinates in CRTM05 format 1166702 - 546432, within Tortuguero National Park. 3. Remove outside Tortuguero National Park all types of domestic and/or farm animals (chickens-ducks-turkeys-dogs-cats, goats, pigs, sheep-cattle and equines, among others). 4. Vacate the invaded area, together with the persons accompanying you as family members or collaborators (laborers or companions), within Tortuguero National Park, at GPS coordinates 1166702 - 546432, by the end of the number of days indicated herein." Said order was served on the petitioner on September 23, 2020, and he was given 20 business days to comply. They indicate that on September 28, 2020, the petitioner filed a motion for reconsideration (recurso de revocatoria) with subsidiary appeal (apelación en subsidio) and a stay of enforcement against administrative order No. SINAC-ACTO-DASP-PNT-OA-002-2020; these were resolved through Resolution No. R-SINAC-ACTO-DASP-PNT-01-2020, which was served on him on October 8, 2020, and through Resolution No. R-SINAC-CONAC-045-2020 of the National Conservation Area Council, which was served on him on January 26, 2021.They state that, in compliance with the administrative orders, the petitioner was verbally informed on several occasions, following the rulings on the subsidiary appeal and motion for reconsideration, that he would be evicted, but as a matter of strategy no exact date was given to him, and he consistently disregarded the notices; indeed, a complaint for contempt of authority was filed with the Prosecutor's Office of Nombre03 through official memorandum No. SINAC-ACTO-DASP-PNT-DE-001-2021, for failure to comply with the administrative order. They note that the eviction date was set for June 28, 2021, with the support of Fuerza Pública, SENASA, paramedic support, and CONAPAM (with whom it was agreed that any anomaly would be reported to them, since they were unable to attend) and accredited COVIRENAS volunteers; this eviction was planned and organized within Tortuguero National Park, with the full support of the Protected Wildlife Areas Directorate of the Tortuguero Conservation Area, the ACTo Legal Advisory Office, and the ACTo Regional Directorate, with the knowledge of the Executive Directorate of SINAC, the Office of the Minister of Environment and Energy, and the Second Vice-Presidency.Likewise, functional direction was provided by the Environmental Prosecutor's Office of Pococí. They mention that at no time was there any abuse of authority; no one was shouted at or humiliated; the petitioner was given a reasonable amount of time to remove his belongings from the area to be evicted and outside the perimeter of the National Park; once his belongings were removed from the dwellings, demolition proceeded and all agricultural crops incompatible with the forest and wetland ecosystems, the native ecosystems and the nature of the zone were eliminated, with the exception of the chicken coops, the pigsty, and some goat enclosures, where the opportunity was once more extended to remove said animals within 10 calendar days, pursuant to Sanitary Order No. 0185649 of SENASA. It is noted that on June 29, 2021, ACTo officials were able to spot a structure built from zinc sheets and pieces of wood, very close to the land unlawfully occupied by the petitioner; an investigation was carried out, and at the scene was found Mr. [Nombre01 003], who indicated that the petitioner had built the structure and that he was watching over it.They add that on July 13, 2021, the land unlawfully occupied by the petitioner was visited again; persons were observed at the site and the animals were still on the premises, and so, with the intention of issuing a second administrative order to seize the animals, the petitioner requested that he be allowed to finish removing the animals over the course of 1 or 2 days, and accordingly those days were granted to him. They request that the appeal be dismissed.
  7. 7The legal requirements have been duly observed in the proceedings followed.

Considering:

I.Subject matter of the appeal. The petitioner states that he is an elderly person (adulta mayor). He alleges that the respondent authorities have carried out an arbitrary eviction against him, which entailed the destruction of his home and even the burning of his belongings, resulting in the loss of his property. He states that he was the victim of humiliation and assault by the respondent authorities at the time of the eviction. He states that the actions were carried out without observing due process (debido proceso). He considers his fundamental rights to have been violated.

II. Established facts. The following facts are considered duly proven as relevant to the decision of this matter

On February 4, 2014, the Tortuguero Conservation Area of the Sistema Nacional de Áreas de Conservación, through official memorandum ACTO-GASP-RENVSBC-04-2014, filed a complaint against the petitioner with the Prosecutor's Office of Nombre03 for unlawful occupation of State lands within Tortuguero National Park, illegal logging, harm to wetlands, and land-use change. (see sworn report and evidence submitted); Through a ruling issued at 16:10 hours on April 20, 2016, the Criminal Court of the Second Judicial Circuit of the Atlantic Zone, Nombre03, ordered the demolition of the structures, specifying as follows: "specifically the dwelling-type structure built of wood and zinc (as shown in the photographs at folio 2 and folio 23 verso) and any other structure at the scene of the events, provided they are located within Tortuguero National Park, specifically at the referenced coordinates. Said demolition is ordered to be carried out directly by MINAET, given that the lands are under its administration and protection, as is the case with Tortuguero National Park…".

(see sworn report and evidence submitted); On June 26 and 27, 2016, the Tortuguero Conservation Area of the Sistema Nacional de Áreas de Conservación proceeded with the demolition of the structures in compliance with the ruling issued at 16:10 hours on April 20, 2016, by the Criminal Court of the Second Judicial Circuit of the Atlantic Zone. (see sworn report and evidence submitted); On August 28, 2020, the Tortuguero Conservation Area of the Sistema Nacional de Áreas de Conservación, through official memorandum SINAC-ACTO-DASP-PNT-DE-025-2020, filed a complaint against the petitioner with the Prosecutor's Office of Nombre03 for the offense of invasion of the protected wildlife area known as Tortuguero National Park and unlawful occupation of public-domain property, on the grounds that he had built a dwelling and was keeping crops and domestic animals inside the Park. Remove and dismantle all types of infrastructure (houses-dwellings-corrals-fences-and/or any type of construction in which human hands have had a part) regardless of the material from which it was built, and remove it outside the Protected Wildlife Area (Tortuguero National Park), located at GPS point 1166702 - 546432. 2. Eliminate all types of crops found on the plot at coordinates in CRTM05 format 1166702 - 546432, within Tortuguero National Park. 3. Remove outside Tortuguero National Park all types of domestic and/or farm animals (chickens-ducks-turkeys-dogs-cats, goats, pigs, sheep-cattle and equines, among others). 4. Vacate the invaded area, together with the persons accompanying you as family members or collaborators (laborers or companions), within Tortuguero National Park, at GPS coordinates 1166702 - 546432, by the end of the number of days indicated herein." Said order was served on the petitioner on September 23, 2020, and he was given 20 business days to comply.

(see sworn report and evidence submitted); On September 28, 2020, the petitioner filed a motion for reconsideration with subsidiary appeal and a stay of enforcement against administrative order No. SINAC-ACTO-DASP-PNT-OA-002-2020 of the Tortuguero Conservation Area of the Sistema Nacional de Áreas de Conservación. (see sworn report and evidence submitted); Through Resolution No. R-SINAC-ACTO-DASP-PNT-01-2020 of October 1, 2020, the Tortuguero Conservation Area of the Sistema Nacional de Áreas de Conservación denied the motion for reconsideration filed by the petitioner. Said resolution was served on the petitioner on October 8, 2020. (see sworn report and evidence submitted); Through Resolution No. R-SINAC-CONAC-045-2020 of December 22, 2020, the National Conservation Area Council resolved to deny in all respects the petitioner's subsidiary appeal, upheld the content of administrative order No. SINAC-ACTO-DASP-PNT-OA-002-2020 of September 23, 2020, and declared administrative channels (vía administrativa) exhausted.

Said resolution was served on the petitioner on January 26, 2021. (see sworn report and evidence submitted); On June 28, 2021, the Tortuguero Conservation Area of the Sistema Nacional de Áreas de Conservación carried out the eviction with the support of Fuerza Pública, SENASA, paramedic support, and CONAPAM (with whom it was agreed that any anomaly would be reported to them, since they were unable to attend) and accredited COVIRENAS volunteers, and received functional direction from the Environmental Prosecutor's Office of Pococí. It was noted that the petitioner was given a reasonable amount of time to remove his belongings from the area to be evicted and outside the perimeter of the National Park; once they were outside the dwelling, demolition proceeded and all agricultural crops incompatible with the forest and wetland ecosystems, the native ecosystems and the nature of the zone were eliminated; at no time was he shouted at or humiliated.

(see sworn report and evidence submitted); By means of Sanitary Order (Orden Sanitaria) N° 0185649 issued by SENASA, the petitioner (amparado) was granted a period of 10 calendar days to remove the animals from the site. (See sworn report and supporting evidence submitted.)

On June 29, 2021, officials from the Área de Conservación Tortuguero of SINAC observed the construction of a shed made of zinc sheets and pieces of wood, located very close to the land unlawfully occupied by the appellant. They located Mr. [Nombre01 003], who stated that the shed had been built by the petitioner and that he was looking after it. (See sworn report submitted.)

On July 13, 2021, officials from the Área de Conservación Tortuguero of SINAC proceeded to visit the land unlawfully occupied by the petitioner and observed that animals were still present. For this reason, they were about to issue a second administrative seizure order (orden administrativa de decomiso). However, the appellant requested one or two additional days to finish removing the animals, which was granted. (See sworn report submitted.)

III.On the specific case.- From the analysis of the sworn reports and the evidence submitted for the resolution of this matter, it has been established that the appellant's claim lacks merit and, therefore, it is not true that a violation of fundamental rights occurred in the terms alleged. In that regard, it is established as proven that the eviction (desalojo) and the demolition (demolición) of the structures carried out by SINAC's authorities were due to their construction on public domain (dominio público) property — specifically, in the present case, within Parque Nacional Tortuguero — which was even acknowledged by the Juzgado Penal del II Circuito Judicial de la Zona Atlántica, which, by means of a ruling issued at 16:10 hours on April 20, 2016, ordered the demolition of the structures against the appellant for invading an area of said national park. In addition to the foregoing, this Court finds that the respondent authorities followed due process (debido proceso) in carrying out the eviction of the appellant, given that, on September 23, 2020, the Área de Conservación Tortuguero of SINAC issued Administrative Order No. SINAC-ACTO-DASP-PNT-OA-002-2020, by which the petitioner was granted a period of 20 business days to vacate the area he was occupying within Parque Nacional Tortuguero, as well as to remove all infrastructure, crops, and animals belonging to him — thereby complying with the precautionary requirement (prevención) established by this Court in circumstances such as those of the present case.

It is on record that this order was duly served on that same date; furthermore, on September 28, 2020, the petitioner challenged the order by filing a motion for reconsideration with a subsidiary appeal and stay of the administrative act (recurso de revocatoria con apelación en subsidio y suspensión del acto), both of which were in fact resolved and duly notified. Based on the foregoing, any violation of due process and of the appellant's right of defense (derecho a la defensa) with respect to the eviction carried out against him by the respondent authorities on June 28, 2021, is ruled out. Now, if the appellant considers that he has a superior right over the property and that he is entitled to continue in possession of it, or if his claim concerns the legal nature of the property — on the grounds that it is privately owned — he must be advised that such matters must be resolved through the appropriate legality channels (vía de legalidad), whether administrative or judicial, before which he must raise his arguments and not before this Court.

Furthermore, the appellant claims that the respondent authorities burned his belongings and his money, and on that basis requests their restitution. In this regard, he must be advised that, through a writ of amparo (recurso de amparo), no claims may be asserted other than those directed at restoring or preserving the fundamental rights and freedoms of the holder thereof, which have been violated or are under threat, in a personal capacity. Accordingly, it may not be used to seek any form of compensation (indemnización), since it is not within the purview of this Court to determine whether or not the appellant is entitled to compensation for the harm he claims to have suffered, as that matter constitutes an ordinary legality dispute that is not within the jurisdiction of this Court to resolve. Accordingly, the petitioner must file whatever claims he deems appropriate before the relevant administrative or judicial authority, before which he may broadly discuss the merits of the matter and assert his claims. In any event, from the evidence submitted by SINAC's authorities, photographs of the appellant's belongings outside the demolished structures can be observed, since it was reported under oath that, prior to carrying out the operations, the petitioner was given a reasonable period of time to remove his belongings from the land to be vacated.

For the foregoing reasons, the appropriate course of action is to dismiss the present writ in all its aspects.

IV. DOCUMENTATION SUBMITTED TO THE CASE FILE

This Court must advise the appellant that if any paper documents, objects, or evidence supported by any additional device, or by electronic, computer, magnetic, optical, telematic, or new-technology media have been submitted, these must be retrieved from the office within a period of 30 business days after receipt of notification of this judgment; otherwise, all such materials will be destroyed in accordance with the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in session No. 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial No. 19 of January 26, 2012, as well as in the resolution approved by the Consejo Superior del Poder Judicial in session No. 43-12 held on May 3, 2012, Article LXXXI.

*210135340007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del trece de agosto de dos mil veintiuno .

Recurso de amparo que se tramita en expediente No. 21-013534-0007-CO, interpuesto por [Nombre01 001], cédula de identidad [Valor CED01], contra el MINISTERIO DE AMBIENTE Y ENERGÍA y el MINISTERIO DE SEGURIDAD PÚBLICA.

Resultando:

  1. 1Por escrito recibido en la Secretaria de la Sala a las 16:36 horas del 13 de julio de 2021, la parte recurrente interpone recurso de amparo, contra el MINISTERIO DE AMBIENTE Y ENERGÍA y el MINISTERIO DE SEGURIDAD PÚBLICA, y manifiesta lo siguiente: que el recurrido ha ejecutado acciones en la ocupación de tierras por parte de sus pobladores en los asentamientos humanos, específicamente en sitios sobre los cuales nunca el gobierno ha ejercido ningún tipo de dominio más, sin embargo, ahora vienen dictando órdenes administrativas que son incluso de desconocimiento de los mismos habitantes, desde toda perspectiva, tomando en consideración de que no se cumple ningún tipo notificación de la misma. Indica que, mediante acuerdos tomados por algunos funcionarios a lo interno del MINAE, propiamente en las oficinas del Área de Conservación Tortuguero, Parques Nacionales, desmantelan asentamientos humanos productivos, arrasando con lo que a muchos habitantes les ha costado más de medio siglo cuidar, mantener y constituye su medio de subsistencia.Manifiesta que es víctima de los funcionarios Víctor Montero Navarro, Luis Diego Arce Gamboa y uno de Nombre01 Nombre02, quienes el 28 de junio de 2021 destruyeron todo en su terreno y, después de haberla dejado durmiendo en latas de zinc a la intemperie, regresaron a humillarla, a gritarle, a quemar sus ropas y, nuevamente, sus medicamentos de insulina y la hielera. Narra que los derechos no los conocen, su casa y todo se lo han destruido. Agrega que el instituto recurrido ha tomado su propiedad como tierra de nadie para cometer esta barbarie. Indica que los funcionarios Víctor Montero Navarro, Luis Diego Arce Gamboa y Nombre02, cuyos apellidos desconoce, así como otros cuyas identidades desconoce, la agredieron e, incluso, hasta intentaron asesinarla al decirles que no quemaran su hielera porque ahí tenía la insulina y, entonces, riéndose le dijeron que mucho más rápido lo harían, o sea, quemar los medicamentos.Manifiesta que esto es violatorio de sus derechos fundamentales. Narra que tiene plano catastrado de la propiedad No. L-78153-92, así como carta de venta de mejoras. Agrega que el MINAE transgrede la aplicación de la normativa correspondiente a la Ley General de Administración Pública, en cuanto a la no aplicación del procedimiento correcto para realizar notificaciones administrativas, ya que, ejecutan actos de desalojo arbitrarios y fuera del contexto con un trato inhumano, fuera de control, provisto de acciones humillantes, degradantes, agresiones en contra no solo de las propiedades sino de los habitantes. Indica que el mismo día en que realizaron la notificación de que van a desalojar, no dando oportunidad al ciudadano a ejercer el debido derecho de defensa y sabiendo que se encontraba en proceso la moratoria que ya fue aprobada al decreto 9577 por parte de la Asamblea Legislativa, procedieron a expulsarla de su propiedad, destruir todos sus bienes y agredirla.Manifiesta que el MINAE violenta gravemente los principios y garantías constitucionales de los ciudadanos, llegando a las propiedades en las cuales se ha ejercido un derecho privado de propiedad consolidado antes de las afectaciones al dominio público, sin un estudio técnico y pericial, llegan sin demostrar con certeza a los habitantes que el lugar donde se ubican sus casas, sembradíos, animales que pastan, animales y aves domésticos, son propiedades del Estado, y que ahora, al pasar los años, pretenden desalojar a través de funcionarios que, incluso, no son ingenieros topógrafos con experticia en medición de terrenos, en ubicación de áreas, son solamente ingenieros forestales o agrónomos que no tienen el estudio necesario para realizar un desalojo en contra de gente humilde que ha vivido toda su vida en las fincas trabajando para poder sobrevivir. Narra que estos funcionarios firman las órdenes administrativas y ellos mismos las ejecutan acompañados de oficiales de Fuerza Pública de Tortuguero, con GPS en la mano sin hojas cartográficas, fundamentándose en conocimientos espurios de topografía siendo que solamente son técnicos forestales, o ingenieros forestales, no son ni Geodestas ni Ingenieros Topógrafos.Agrega que proceden a realizar una notificación donde supuestamente dan 10 días para desalojar e, inmediatamente, en ese mismo momento ejecutan el desalojo destruyendo absolutamente todo. Indica que es adulto mayor, lo sacaron de su casa, quemaron su casita, sacaron los animales domésticos, quemaron sus medicamentos de insulina, por lo que casi muere, lo dejaron durmiendo en unas latas de zinc quemadas en el suelo. Manifiesta que el MINAE ha saqueado sus alimentos, dejándolos sin nada que comer. Narra que el funcionario Víctor Montero Navarro, quien dijo ser jefe de la Oficina de Tortuguero, ante su consulta del por qué a otros ganaderos que son vecinos y dueños, como él, de las mismas tierras en la zona de la Pavona de Cariari de Pococí, no los desalojan, riéndose, le dijo que "si tuviera igual dinero, sería diferente". Agrega que esa expresión deja mucho que desear y mucho que pensar, no puede juzgar, solo repite lo que el señor Montero Navarro le dijo.Indica que nunca ha talado o deforestado, son décadas cuidando la naturaleza, y sobreviviendo con una economía de subsistencia de productos agrícolas que fueron quemados totalmente, hasta los mismos árboles de la vegetación los cortaron con motosierra; mataron las gallinas, soltaron y corrieron los cerdos y los semovientes, y taquearon los pozos de agua de consumo humano con basura y cochinadas. Manifiesta que no se le indicó ningún documento previo al desalojo, propiamente, en cuanto a este expediente administrativo del MINAE se refiere. Narra que todos estos actos se realizaron con participación de la Fuerza Pública, pero, se limitaron a observar, realmente conmovidos por las actuaciones descabelladas de los funcionarios de MINAE, y lo único que decían era que ellos no se metían porque ellos veían que era una injusticia lo que estaban haciendo los funcionarios del MINAE, sea que fueron llevados a verificar que los ciudadanos no se defendieran de las torturas e insolencias de los funcionarios del MINAE.Agrega que ha consultado en las oficinas del Ministerio de Seguridad Pública en Tortuguero y en Guápiles como oficina Regional, pero, ninguna de las delegaciones se responsabiliza, ya que, en Tortuguero dicen que eran oficiales de Guápiles y en Guápiles que eran oficiales de Tortuguero, por lo que lo único que está seguro es que eran oficiales del Ministerio de Seguridad Pública y que provenían directamente de la Delegación Cantonal de Guápiles. Estima que tal actuación resulta violatoria de sus derechos fundamentales.
  2. 2Mediante resolución a las 11:40 horas del 15 de julio de 2021, se le realizó una prevención al recurrente.
  3. 3Por cumplida la prevención, mediante resolución a las 14:06 horas del 21 de julio de 2021, se dio curso al presente recurso.
  4. 4Por escrito incorporado al Sistema Jurídico el 23 de julio de 2021, Roy Venegas Hidalgo, Jefe del Puesto de la Delegación Policial de Nombre03, informa bajo juramento que al día de hoy no han dictado órdenes administrativas de desalojo dirigidas a los habitantes del sector de Barras de Tortuguero, o más específicamente al recurrente. Menciona que se recibieron el oficio SINAC-ACTO-DASP-PNT-CP-AF-004-2021, con fecha del 27 de mayo de 2021, firmado por el Ing. Víctor Hugo Montero Navarro, encargado del Programa de Control y Protección del Parque Nacional Tortuguero, donde solicitó: “… el próximo mes de junio propiamente los días 28, 29, estaremos ejecutando dos desalojos como demolición dentro de los terrenos del Parque Nacional Tortuguero (PNT), como parte de las acciones en la vía administrativa del SINAC-ACTO-PNT, las cuales ya fueron agotadas… La solicitud que hacemos es nos puedan brindar seguridad con al menos 5 oficiales de Fuerza Pública, mientras que los funcionarios Guardaparques del ACTO-´PNT, ejecutan las labores, técnicas, desalojo, decomiso, detención y destrucción, Según sea el caso…”.Señala que en atención a dicha solicitud, las actuaciones de los funcionarios policiales de la Fuerza Pública se limitaron únicamente y exclusivamente a brindar seguridad perimetral a los funcionarios del Sistema Nacional de Áreas de Conservación Tortuguero. Solicita que se declare sin lugar el recurso.
  5. 5Por escrito incorporado al Sistema Jurídico el 27 de julio de 2021, Michael Soto Rojas, Ministro de Seguridad Pública, informa bajo juramento que no consta que este Ministerio haya instruido ni ordenado desalojo administrativo contra el amparado. Señala que el 27 de mayo de 2021, la Dirección 12 Caribe de la Fuerza Pública, recibió oficio del encargado del Programa de Control y Protección del Parque Nacional Tortuguero, en el cual solicitó el apoyo de la policía para un operativo a realizarse los días 28 y 29 de junio. Menciona que como respuesta a la solicitud de auxilio y colaboración mencionada, la Delegación Policial prestó acompañamiento policial para brindar seguridad perimetral únicamente. Solicita que se declare sin lugar el recurso.
  6. 6Por escritos incorporados al Sistema Jurídico el 28 de julio de 2021, Andrea Meza Murillo, Ministra de Ambiente y Energía, y Laura Segura Rodríguez, Directora a.i. del Área de Conservación Tortuguero del Sistema Nacional de Áreas de Conservación, ambas del Ministerio de Ambiente y Energía, informan bajo juramento que sí han ejercido dominio sobre los terrenos que le pertenecen al Estado, siendo uno de ellos el Parque Nacional Tortuguero. Señalan que la primera denuncia interpuesta contra el recurrente fue en febrero de 2014, bajo el oficio ACTO-GASP-RENVSBC-04-2014, donde por sentencia judicial se ordenó la demolición y desalojo del rancho donde vivía de manera ilegal. Mencionan que tiempo después volvió a invadir construyendo nuevos ranchos, y dándose una serie de denuncias, por usurpación y daños ambientales, como cambio de uso del suelo, afectación de humedales, tala, entre otros. Añaden que mediante oficio SINAC-ACTO-DASP-PNT-DE-025-2020, con fecha 28 de agosto de 2020, se interpuso denuncia ante la Fiscalía de Nombre03 contra el recurrente por el delito de invasión del área silvestre protegida Parque Nacional Tortuguero y usurpación de bienes de dominio público, debido a que se construyó un rancho y mantenía cultivos y animales domésticos dentro del Parque.Agregan que mediante orden administrativa No. SINAC-ACTO-DASP-PNT-OA-002-2020, se le ordenó al recurrente lo siguiente: “1. Remover y desmantelar todo tipo de infraestructura (casas-ranchos-corrales-cercas-y/o todo tipo de construcción donde la mano del hombre haya influido) sin importar el material del cual haya sido construido y extraer fuera del Área Silvestre Protegida (Parque Nacional Tortuguero), ubicado en el punto de GPS 1166702 - 546432. 2. Eliminar todo tipo de cultivo que se encuentre en el predio con coordenadas en formato CRTM05 1166702 - 546432, dentro del Parque Nacional Tortuguero. 3. Extraer fuera del Parque Nacional Tortuguero todo tipo de animal doméstico y/o de granja (gallinas-patos-chompipes-perros-gatos, cabras, cerdos, ovejas-ganado vacuno y equino, entre otros). 4. Desalojar el área invadida, por usted y personas que le acompañan en calidad de familiares u colaboradores (peones o acompañantes), dentro del Parque Nacional Tortuguero, en las coordenadas de GPS 1166702 - 546432, al término de los días que se le indica, en esta orden.”, dicha orden le fue notificada el 23 de setiembre de 2020 y se le brindó 20 días hábiles para el cumplimiento de esta.Indican que el recurrente el 28 de setiembre de 2020, interpuso recurso de revocatoria con apelación en subsidio y suspensión del acto contra la orden administrativa No. SINAC-ACTO-DASP-PNT-OA-002-2020; los cuales fueron resueltos mediante resolución No. R-SINAC-ACTO-DASP-PNT-01-2020, que le fue notificada el 08 de octubre de 2020 y mediante resolución No. R-SINAC-CONAC-045-2020 del Consejo Nacional de Área de Conservación, que le fue notificada el 26 de enero de 2021. Refieren que en apego a las órdenes administrativas, al recurrente se le indicó en varias oportunidades, de manera verbal, posterior a las resoluciones de apelación y revocatoria, que sería desalojado, pero por estrategia no se le dio fecha exacta y siempre hizo caso omiso, incluso de interpuso una denuncia ante la Fiscalía de Nombre03 por desobediencia a la autoridad, mediante el oficio No. SINAC-ACTO-DASP-PNT-DE-001-2021, por no atender a la orden administrativa.Señalan que se fijó la fecha del desalojo para el 28 de junio de 2021, con el apoyo de Fuerza Pública, SENASA, apoyo de Paramédico y CONAPAM (con quienes se acordó, se les consultaría cualquier anomalía ya que no podía asistir) y voluntarios acreditados COVIRENAS, este desalojo fue planeado y organizado en el seno del Parque Nacional Tortuguero, con el total apoyo de la Dirección de Áreas Silvestres Protegidas del Área de Conservación Tortuguero, Asesoría Legal de ACTo y la Dirección Regional del ACTo, con el conocimiento de la Dirección Ejecutiva del SINAC, oficina de la Ministra del Ambiente y Energía y la Segunda Vicepresidencia. Asimismo, se tuvo dirección funcional de la Fiscalía Ambiental de Pococí. Mencionan que en ningún momento hubo abuso de autoridad a nadie se le gritó ni se le humilló, se le brindó el tiempo prudente al recurrente de sacar sus pertenencias del terreno a desalojar y fuera del perímetro del Parque Nacional, una vez con sus pertenencias fuera de los ranchos, se procedió a demoler y eliminar todo los cultivos agrícolas incompatibles con los ecosistemas de bosque y humedal, ecosistemas autóctonos y naturaleza de la zona, a excepción de los gallineros, la porqueriza y unos encierros de cabras, donde se brindó una vez más, la oportunidad de sacar dichos animales en 10 días naturales, y mediante la Orden Sanitaria N° 0185649 de SENASA.Indica que el 29 de junio de 2021, funcionario de ACTo lograron visualizar una construcción de un rancho hecho de láminas de zinc y trozos de madera, muy cercano al terreno usurpado por el recurrente, se procedió a investigar y en el lugar se encontraba el señor [Nombre01 003], quien indicó que el rancho lo construyó el recurrente y él lo estaba cuidado. Añaden que el 13 de julio de 2021, nuevamente se procedió a visitar el terreno usurpado por el recurrente, observando personas en el sitio y tenía los animales en el lugar, por lo que, con la intención de emitir una segunda orden administrativa, con la intención de decomisar los animales, el recurrente solicitó que le dejaran de terminar de llevarse los animales en el plazo de 1 o 2 días, por lo que se procedió a brindarle los días solicitados. Solicitan que se declare sin lugar el recurso.

7- En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Hernández López; y,

Considerando:

I.Objeto del recurso. El recurrente manifiesta que es una persona adulta mayor. Acusa que las autoridades recurridas han ejecutado acciones de desalojo arbitrario en su contra, las cuales implicaron la destrucción de su casa e incluso quemaron hasta sus pertenencias provocando la pérdida de sus bienes. Menciona que fue víctima de humillaciones y agresiones por parte de las autoridades recurridas al momento de realizar el desalojo. Refiere que las acciones se realizaron sin seguir el debido proceso. Considera lesionados sus derechos fundamentales.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

El 04 de febrero de 2014, el Área de Conservación Tortuguero del Sistema Nacional de Áreas de Conservación mediante oficio oficio ACTO-GASP-RENVSBC-04-2014, interpuso denuncia contra el recurrente ante la Fiscalía de Nombre03 por usurpación de terrenos del estado dentro del Parque Nacional Tortuguero, tala ilegal, afectación de humedales y cambio de uso del suelo. (ver informe rendido bajo juramento y prueba aportada); Mediante resolución de las 16:10 horas del 20 de abril de 2016, el Juzgado Penal del II Circuito Judicial de la Zona Atlántica, Nombre03 ordenó la demolición de las obras indicando lo siguiente: “propiamente la edificación tipo rancho o vivienda construida en madera y zinc (según fotografía de folio 2 y 23 vuelto) y cualquier otra edificación en el lugar de los hechos, siempre y cuando se encuentren dentro del Parque Nacional Tortuguero, propiamente en las coordenadas referidas.

Tal derribo se ordena ejecutarlo directamente al MINAET, por tratarse de terrenos bajo su administración y protección, como es el Parque Nacional Tortuguero…”. (ver informe rendido bajo juramento y prueba aportada); El 26 y 27 de junio de 2016, el Área de Conservación Tortuguero del Sistema Nacional de Áreas de Conservación procedió con la demolición de obras en acatamiento a la resolución de las de las 16:10 horas del 20 de abril de 2016 del Juzgado Penal del II Circuito Judicial de la Zona Atlántica. (ver informe rendido bajo juramento y prueba aportada); El 28 de agosto de 2020, el Área de Conservación Tortuguero del Sistema Nacional de Áreas de Conservación mediante oficio oficio SINAC-ACTO-DASP-PNT-DE-025-2020, interpuso denuncia contra el recurrente ante la Fiscalía de Nombre03 por el delito de invasión del área silvestre protegida Parque Nacional Tortuguero y usurpación de bienes de dominio público, debido a que construyó un rancho y mantenía cultivos y animales domésticos dentro del Parque.

(ver informe rendido bajo juramento y prueba aportada); Mediante orden administrativa No. SINAC-ACTO-DASP-PNT-OA-002-2020 del 23 de setiembre de 2020, el Área de Conservación Tortuguero del Sistema Nacional de Áreas de Conservación le ordenó al amparado lo siguiente: “1. Remover y desmantelar todo tipo de infraestructura (casas-ranchos-corrales-cercas-y/o todo tipo de construcción donde la mano del hombre haya influido) sin importar el material del cual haya sido construido y extraer fuera del Área Silvestre Protegida (Parque Nacional Tortuguero), ubicado en el punto de GPS 1166702 - 546432. 2. Eliminar todo tipo de cultivo que se encuentre en el predio con coordenadas en formato CRTM05 1166702 - 546432, dentro del Parque Nacional Tortuguero. 3. Extraer fuera del Parque Nacional Tortuguero todo tipo de animal doméstico y/o de granja (gallinas-patos-chompipes-perros-gatos, cabras, cerdos, ovejas-ganado vacuno y equino, entre otros). 4.

Desalojar el área invadida, por usted y personas que le acompañan en calidad de familiares u colaboradores (peones o acompañantes), dentro del Parque Nacional Tortuguero, en las coordenadas de GPS 1166702 - 546432, al término de los días que se le indica, en esta orden.”. Dicha orden le fue notificada al amparado el 23 de setiembre de 2020 y se le brindó 20 días hábiles para el cumplimiento de esta. (ver informe rendido bajo juramento y prueba aportada); El 28 de setiembre de 2020, el amparado interpuso recurso de revocatoria con apelación en subsidio y suspensión del acto contra la orden administrativa No. SINAC-ACTO-DASP-PNT-OA-002-2020 del Área de Conservación Tortuguero del Sistema Nacional de Áreas de Conservación. (ver informe rendido bajo juramento y prueba aportada); Mediante resolución No. R-SINAC-ACTO-DASP-PNT-01-2020 del 01 de octubre de 2020, el Área de Conservación Tortuguero del Sistema Nacional de Áreas de Conservación rechazó el recurso de revocatorio presentado por el amparado.

Dicha resolución se le notificó al recurrente el 08 de octubre de 2020. (ver informe rendido bajo juramento y prueba aportada); Mediante resolución No. R-SINAC-CONAC-045-2020 del 22 de diciembre de 2020, el Consejo Nacional de Área de Conservación resolvió rechazar en todos los extremos el recurso de apelación en subsidio del amparado, mantuvo el contenido de la orden administrativa No. SINAC-ACTO-DASP-PNT-OA-002-2020 del 23 de setiembre de 2020, y dio por agotada la vía administrativa. Dicha resolución se le notificó al recurrente el 26 de enero de 2021. (ver informe rendido bajo juramento y prueba aportada); El 28 de junio de 2021, el Área de Conservación Tortuguero del Sistema Nacional de Áreas de Conservación realizó el desalojo con el apoyo de Fuerza Pública, SENASA, apoyo de Paramédico y CONAPAM (con quienes se acordó, se les consultaría cualquier anomalía ya que no podía asistir) y voluntarios acreditados COVIRENAS y tuvo la dirección funcional de la Fiscalía Ambiental de Pococí.

Indicó que al amparado se le brindó el tiempo prudente al recurrente de sacar sus pertenencias del terreno a desalojar y fuera del perímetro del Parque Nacional, las cuales, una vez fuera del rancho se procedió a demoler y eliminar todo los cultivos agrícolas incompatibles con los ecosistemas de bosque y humedal, ecosistemas autóctonos y naturaleza de la zona; en ningún momento se le gritó ni se le humilló. (ver informe rendido bajo juramento y prueba aportada); Mediante la Orden Sanitaria N° 0185649 de SENASA, se le brindó el plazo de 10 días naturales al amparado para sacar los animales del sitio. (ver informe rendido bajo juramento y prueba aportada); El 29 de junio de 2021, los funcionarios del Área de Conservación Tortuguero del Sistema Nacional de Áreas de Conservación visualizaron una construcción de un rancho de láminas de zinc y trozos de madera, muy cercano al terreno usurpado por el recurrente, localizaron al señor [Nombre01 003], quien indicó que el rancho lo construyó el amparado y él lo estaba cuidado.

(ver informe rendido bajo juramento); El 13 de julio de 2021, lo funcionarios del Área de Conservación Tortuguero del Sistema Nacional de Áreas de Conservación procedieron a visitar el terreno usurpado por el amparado, observando aún la permanencia de animales, razón por la cual, iban a emitir una segunda orden administrativa de decomiso. No obstante, el recurrente solicitó el plazo de 1 o 2 días para terminar de llevarse a los animales, el cual, le fue concedido. (ver informe rendido bajo juramento).

III.Sobre el caso concreto.- De los análisis de los informes rendidos bajo juramento y las pruebas aportadas para la resolución del asunto, ha quedado demostrado que no lleva razón el recurrente en su alegato y, por ende, no es cierto que se haya dado una vulneración de derechos fundamentales en los términos en que lo reclama. En ese sentido, se tiene por acreditado que, el desalojo y la demolición de las obras realizados por las autoridades del SINAC, se deben a razones de edificación en un bien de dominio público, siendo en el caso concreto del Parque Nacional Tortuguero, lo cual, incluso fue reconocido por parte del Juzgado Penal del II Circuito Judicial de la Zona Atlántica, quien mediante resolución de las 16:10 horas del 20 de abril de 2016 ordenó la demolición de las obras contra el recurrente por invadir zona de dicho Parque Nacional. Aunado a lo anterior, esta Sala verifica que las autoridades accionadas han seguido el debido proceso para realizar el desalojo contra el recurrente, debido a que, en fecha 23 de setiembre de 2020, el Área de Conservación Tortuguero del Sistema Nacional de Áreas de Conservación dictó la orden administrativa No. SINAC-ACTO-DASP-PNT-OA-002-2020, por medio de la cual, se le brindó al amparado el plazo de 20 días hábiles para desalojar la zona que estaba ocupando dentro del Parque Nacional Tortuguero así como también remover todo tipo de infraestructura, cultivo y extraer los animales de su pertenencia –cumpliendo con la prevención estipulada por esta Sala en circunstancias como las del caso concreto-.

La cual, consta que le fue debidamente notificada ese mismo día; además, en fecha 28 de setiembre de 2020, impugnó dicha orden por medio del recurso de revocatoria con apelación en subsidio y suspensión del acto, los cuales efectivamente le fueron resuelto y notificados como corresponden. A partir de lo expuesto, se descarta la lesión al debido proceso y al derecho a la defensa del recurrente respecto al desalojo que se practicó en su contra por las autoridades accionadas el 28 de junio de 2021. Ahora bien, si el recurrente considera que tiene un mejor derecho sobre el bien y que le asiste el derecho de continuar poseyéndolo, o bien, su reclamo versa sobre la naturaleza jurídica del bien, al considerar que se trata de un bien de carácter privado, se le debe indicar que tales extremos deben ser dilucidados en la vía de legalidad correspondiente, administrativa o jurisdiccional, vías en la cuales deberá interpone sus alegatos y no ante esta Sala.

Por otra parte el recurrente reclama que las autoridades recurridas le quemaron sus pertenencias y su dinero, motivo por el cual, solicita que se le restituyan dichos bienes. Al respecto, se le debe indicar que a través del recurso de amparo, no pueden hacerse valer otras pretensiones que las dirigidas a restablecer o a preservar los derechos y libertades fundamentales, violados o amenazados, en forma personal a su titular. En ese sentido, no puede ser utilizado para buscar algún tipo de indemnización, debido a que a esta Sala no le corresponde determinar si el recurrente tiene o no derecho a obtener una indemnización por las afectaciones que reclama haber sufrido, pues dicho extremo constituye a un conflicto de legalidad ordinaria que no compete dilucidarse ante esta Jurisdicción. De ese modo, deberá interponer los reclamos que considere pertinentes ante la vía administrativa o jurisdiccional respectiva, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones.

En todo caso, de la prueba aportada por las autoridades del Sistema Nacional de Áreas de Conservación se observan que fotografías de las pertenencias del recurrente fuera de las obras demolidas, debido a que, se informó bajo juramento que previo a realizar las actuaciones al amparado se le brindó el tiempo prudente al recurrente de sacar sus pertenencias del terreno a desalojar.

Por las razones anteriores, lo procedente es declarar sin lugar el presente recurso en todos sus extremos.

IV. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:
