Resulting:

1.- By brief filed at 1:41 p.m. on July 27, 2021, the petitioner, EDGAR ARIAS CHAVARRÍA, identity card number 0109830397, filed a claim for disobedience of what was ordered by this Chamber in Judgment No. 2020-010461 at 9:50 a.m. on June 9, 2020, given that said Judgment ordered the following: "(…) The action is granted. Víctor Manuel Hidalgo Solís, in his capacity as Municipal Mayor of the canton of Santa Bárbara de Heredia, as well as Garita Montoya, in her capacity as Acting Director of the Rector Health Area of Santa Bárbara de Heredia, are ordered, within a period no longer than SIX MONTHS, counted from the notification of this judgment, to adopt the necessary measures within the scope of their respective powers, in order to foresee and provide a definitive solution to the environmental problem reported by the petitioners, a term within which the Administration must take the corresponding measures to alleviate the situation (…)".- 2.- By resolution at seven fifty-six hours on July twenty-nine, two thousand twenty-one, a hearing was granted for THREE DAYS, counted from the notification of this resolution, to Víctor Manuel Hidalgo Solís, in his capacity as Municipal Mayor of the canton of Santa Bárbara de Heredia, as well as to Karina Garita Montoya, in her capacity as Acting Director of the Rector Health Area of Santa Bárbara de Heredia, or whoever holds those positions, so that they may refer to and provide the corresponding evidence regarding the facts and omissions attributed to them.

3.- By brief filed at 10:33 p.m. on August 4, 2021, VÍCTOR MANUEL HIDALGO SOLÍS, in his capacity as MUNICIPAL MAYOR of the canton of Santa Bárbara de Heredia, responded to the hearing granted by the Chamber, and indicates that on June 15 (sic), a coordination meeting was held between the Municipality of Santa Bárbara and the Health Area of Santa Bárbara, from the points discussed it was agreed:

1- To conduct joint inspections, Ministry of Health and Municipality to perform dye tests and verify which houses discharge soapy water (aguas jabonosas) into the storm drains (desfogues pluviales).

2- Notification to the neighbors concerned according to the result of the dye test. That they must build a respective tank for black water (aguas negras) and soapy water (aguas jabonosas).

3- Coordination with CONAVI and with the owners adjacent to the cantonal route to change the channeling of stormwater (aguas pluviales), through a water channeling project from national route 127 to the national route called "Calle Azofeifa".

4- Communication with the current property owners where the channel passes, so that they keep the watercourse (cauce) clean and avoid flooding.

On June 3, 2020, a virtual meeting was held between CONAVI and the Municipality of Santa Bárbara, where point 3 of the topics discussed addressed the flooding in the plain of San Bosco, there is an urgent need to execute an agreement between the Municipality and CONAVI, since the project aims to achieve the proper water channeling from national route 127 and pass it to a cantonal route. CONAVI committed to drafting the specific Agreement so that the Legal Department of the Municipality could review it and progress could be made in attending to this emergency. On November 12, it was transferred to the Legal Advisory Unit of the Municipality and it is ready to be presented to the Municipal Council at the Ordinary Session on Monday, January 11, for its study, approval, and authorization for signature by the council body. In addition, a field visit to the canton was scheduled for June 9, 2020.

At Ordinary Session 44-2021 on March 1, 2021, the Municipal Council agreed, through Municipal Agreement No. 877-2021 point 2), to authorize the Mayor to sign the aforementioned agreement. As of today, we are awaiting the update of the data (legal credentials) of the person authorized to sign the agreement on behalf of CONAVI.

He adds that, due to the Pandemic, the canton of Santa Bárbara has remained between yellow and orange alert, that the Municipal Emergency Committee has been focused on attending to the most vulnerable residents of the canton, that during the rainy season months of August, September, October, and November, the Municipality's actions were triggered by landslides, with the Municipal Emergency Committee, the Environmental Unit (single-person and member of the CME), the restrictions and the distribution of daily supplies, they were forced to reschedule inspections as stated in the attached inspection minutes dated October 9, November 13, November 20, and December 10; the inspections by the Municipality's Environmental Unit had few personnel.

At the virtual meeting held on June 10, 2021, the municipal mayor Eng. Víctor Hidalgo Solís and Dr. David Cortés Sánchez, director of the Rector Health Area Santa Bárbara; unanimously agreed to use the format proposed by the Municipal Environmental Management unit for notifying neighbors about the construction of a septic tank (tanque séptico) or biological pit (fosa biológica) to mitigate this water management problem, since only stormwater (aguas pluviales) should go to the street. Also relying on the General Health Law No. 5395, in its Article 276: "Only with permission from the Ministry may natural or legal persons make drains or proceed with the discharge of solid or liquid residues or waste or others that may contaminate surface, underground, or maritime water, strictly adhering to the regulatory safety standards and conditions and to the special procedures that the Ministry imposes in the particular case to render them harmless." The notification proposal is attached as an annex (see evidence 5 and 9).

On November 11, 2020, by official letter VA-MSB-081-2020, signed by the Deputy Municipal Mayor, Mr. Vinicio Moreira, Síndico of Purabá, was requested to coordinate a meeting with the residents of Calle Paniagua and Calle Azofeifa, with the Mayor's Office, the Municipal Technical Departments, and the presence of the District Council, in order to find a comprehensive solution to the water channeling problem in the mentioned sector.

On December 23, 2020, the Municipal Mayor, together with Mr. Vinicio Moreira, Síndico of Purabá, along with property-owning neighbors who have filed complaints regarding water channeling, met on Calle Carreta in San Bosco to seek a joint solution for the flooding that occurs in winter, and it was agreed to present proposals and solutions that would be reviewed in January 2021.

It is important to mention that the undersigned and the Infrastructure and Urbanism Commission, the latter composed of the municipal technical team, on June 24, 2021, conducted an inspection in the zone to determine the site where the water outlet (desfogue de aguas) will be built, from which it was concluded that: "That Calle La Carreta is declared public and it is inventoried in the road management regulations of the Municipality of Santa Bárbara. Currently, the following information is available from the cadastral map of the road in question." The plans shown below reflect that the street is entirely public; this street is divided into two streets by a natural fence 140 meters long. In addition, in that same fence there are electricity poles from the CNFL that illuminate the right side. It is this street where it is desired to redirect the course of the stormwater (aguas pluviales) and cancel its passage through private properties.

In the Reglamento de Vialidad y Transportes of the Municipality of Santa Bárbara, Calle La Carreta is inventoried with a width of 4 meters, so the Municipality must widen the road, in order to build the new water passage.

The plans from 1988 show that the left side of the street is public, so the street can be widened and the recovery of the street can be carried out, always under the same name of Calle Carreta. Among other things, coordination with the CNFL must be done for the relocation of the electricity poles that are in the middle of the public street, and subsequently carry out the channeling of the stormwater (aguas pluviales) from the community through the same street.

The plans that precede show that they reflect that the street is public on the side it is desired to widen; that there is an error in the content of the Reglamento de Vialidad y Transporte, the plans are of the initial plot and the final plot respectively.

Municipality and Ministry of Health Intervention It is important to mention that the Municipality of Santa Bárbara and the Ministry of Health have been making efforts to improve the situation of stormwater (aguas pluviales) and wastewater (aguas residuales) present in the canton, a product of the lack of urban planning.

Both institutions have been addressing the problem jointly to find a solution; below, a timeline completed to date for the intervention in the case is shown:

7 de abril 2021 Inspección con Conavi para ver obras en conjunto para realizar en el lugar.

4 de mayo 2021 Los vecinos envían oficio para que la calle se pueda ampliar para que el ancho de vía sea mayor y poder desviar la acequia.

24 de junio 2021 Inspección en la zona con los técnicos de la Municipalidad y el Ingeniero Vial externo.

On the other hand; • The Ministry of Health and the Municipality of Santa Bárbara are conducting house-by-house inspections to address the issue of wastewater (aguas servidas).

1. In total, 50 properties (fincas) with a total of 70 dwellings were identified.

2. 67 dye tests (pruebas de coloración) with fluorescein were conducted in 67 dwellings.

3. Of the 67 tests conducted, 16 yielded negative results and 51 yielded positive results.

4. 31 sanitary orders (órdenes sanitarias) were notified.

5. Of the 31 sanitary orders (órdenes sanitarias) notified, there are 22 sanitary orders in force for compliance, 9 are already expired, of which there are 3 orders fulfilled, 1 partially fulfilled, an order that could not be fully verified as no persons were found in the dwelling, and 4 sanitary orders not fulfilled, 6. The deadlines for the 22 sanitary orders in force are set to expire between the months of July, August, and September 2021.

In the month of July and August 2021 • The Municipality of Santa Bárbara will continue to notify all neighbors in the area to raise awareness about wastewater (aguas residuales).

Solution to flooding and bad odor problems in the sector.

The Municipality of Santa Bárbara presents several proposals to resolve the water problems (stormwater (pluviales) and wastewater (residuales)) in the San Bosco community sector. The works proposed for finding a solution will be carried out by bodies that the Municipality of Santa Bárbara defines.

Project Impact • The width of the public street will be expanded.

• With this new proposal, the floods that occur in the lower parts of the community would be eradicated.

• Better ease of pedestrian and vehicular traffic in the area would be provided.

What was requested by the Chamber regarding the problem of wastewater (aguas servidas) present in the community is being complied with. The Municipality of Santa Bárbara will be distributing additional information so that neighbors comply with what the law says about the treatment of wastewater (aguas servidas) in the sector.

For this, the Municipality of Santa Bárbara has scheduled the delivery of information that must be complied with; in addition to the necessary technical advice so that neighbors can comply with the treatment of the water being deposited in the stormwater system pipes (caños del sistema pluvial).

From the technical side, criteria would be requested to give feasibility to the project.

1. Social. 2. Environmental. 3. Road. 4. Infrastructure. 5. Legal. 6. Cadastre.

For the project to be feasible, there must be a partnership between the parties involved, the approval of the owners of the plots where the new sewer (alcantarillado) is projected, and the municipality.

The Municipal Administration is carrying out the pertinent steps for the execution of this work, but the support of the Municipal Council, the Road Committee is required for the construction of the project.

There are factors that may affect the baseline of the timeline, which will be monitored as risks in order to manage them; among them, the paperwork between entities (CNFL, CONAVI, and ASADA Calle Lajas) for the works stands out.

The municipal technical criterion must be considered for the execution of the project in adherence to applicable regulations.

Finally, he indicates that due to the foregoing and as shown in the evidence, the Municipality has coordinated the necessary actions to provide a real and definitive solution to the problem afflicting the residents.

4.- By certification of the Acting Judicial Technician 3 and the Acting Secretary, both of the Constitutional Chamber, it is indicated that reviewed, at twenty-one hours forty-two minutes on August nine, two thousand twenty-one, in the COSTA RICAN JUDICIAL CASE MANAGEMENT SYSTEM for the CONTROL OF DOCUMENTS RECEIVED AND THIS CASE FILE, it did not appear that from July 29 to August 6, 2021, the REGIONAL DIRECTOR OF THE MINISTRY OF HEALTH OF SANTA BÁRBARA had filed any brief or document, in order to render the report requested in the resolution issued at seven hours fifty-six minutes on July twenty-nine, two thousand twenty-one.

Likewise, a weekly timeline for the intervention of the San Bosco ditch (acequia) is provided.

II.- Based on the foregoing, and the attached evidence, this Chamber dismisses the non-compliance alleged against the respondent institutions, in relation to what was ordered in Judgment No. 2020-010461 at 9:50 a.m. on June 9, 2020, as it was accredited that attention has indeed been given to what was ordered on that occasion, insofar as their powers are concerned.

While it is true that a definitive solution to the problem raised has not yet been materialized, the actions taken by the representatives of the Ministry of Health and the Municipality of Santa Barbara, aimed at resolving that situation, are clear and evident; however, it is evident that this is a complex project, and an intervention timeline is already in place, therefore the claim of non-compliance is without merit.

Resultando:

1.- Por escrito presentado a las 13:41 horas del 27 de julio de 2021, el recurrente, EDGAR ARIAS CHAVARRÍA, cédula de identidad 0109830397, presenta gestión de desobediencia de lo ordenado por esta Sala en la Sentencia N° 2020-010461 de las 9:50 horas del 09 de junio del 2020, toda vez que en esa Sentencia se dispuso lo siguiente: “(…) Se declara con lugar el recurso. Se ordena a Víctor Manuel Hidalgo Solís, en su condición de Alcalde Municipal del cantón de Santa Bárbara de Heredia, así como a Garita Montoya, en su condición de Directora a.i. del Área Rectora de Salud de Santa Bárbara de Heredia, que, dentro del plazo no mayor a SEIS MESES, contados a partir de la notificación de esta sentencia, adopten las medidas que sean necesarias dentro del ámbito de sus respectivas competencias, a fin de que prevean y brinden una solución definitiva a la problemática ambiental denunciada por los recurrentes, término dentro del cual la Administración deberá tomar las medias que correspondan para paliar la situación (…)”.- 2.- Mediante resolución de las siete horas cincuenta y seis minutos del veintinueve de julio de dos mil veintiuno, se otorgó audiencia por TRES DÍAS, contados a partir de la notificación de esta resolución, a Víctor Manuel Hidalgo Solís, en su condición de Alcalde Municipal del cantón de Santa Bárbara de Heredia, así como a Karina Garita Montoya, en su condición de Directora a.i. del Área Rectora de Salud de Santa Bárbara de Heredia, o quienes ocupen esos cargos, para que se refieran y aporten las pruebas correspondientes respecto a los hechos y omisiones que se les atribuyen.

3.- Mediante escrito presentado a las 22:33 horas del 04 de agosto del 2021, VÍCTOR MANUEL HIDALGO SOLÍS, en su condición de ALCALDE MUNICIPAL del cantón de Santa Bárbara de Heredia, atendió la audiencia otorgada por la Sala, e indica que en fecha 15 de junio (sic), se llevó a cabo una reunión de coordinación entre la Municipalidad de Santa Bárbara y el Área de Salud de Santa Bárbara, que de los puntos tratados se acordó:

1- Realizar inspecciones en conjunto, Ministerio de Salud y Municipalidad para realizar pruebas de coloración y verificar qué casas tributan aguas jabonosas a los desfogues pluviales.

2- Notificación a los vecinos que corresponda según resultado de la prueba de coloración. Que deberán construir respectivo tanque para aguas negras y jabonosas.

3- Coordinación con el CONAVI y con los propietarios colindantes con la ruta cantonal para cambiar la canalización de las aguas pluviales, a través de un proyecto de canalización de aguas desde la ruta nacional 127 hasta la ruta nacional denominada "Calle Azofeifa".

4- Comunicación con los actuales propietarios por donde pasa el canal, para que mantengan limpio el cauce y evitar las inundaciones.

En fecha 03 de junio de 2020, se llevó a cabo reunión virtual entre el CONAVI y la Municipalidad de Santa Bárbara, donde con el punto 3 de los temas tratados se abordó la inundación en la planada de San Bosco, urge realizar convenio entre la Municipalidad y el CONAVI, ya que el proyecto tiene como propósito lograr la adecuada canalización de aguas desde ruta nacional 127 y pasar a ruta cantonal. El CONAVI, se comprometió realizar el borrador del Convenio específico para que el Departamento Legal de la Municipalidad lo revise y poder avanzar con la atención de esta emergencia. En fecha 12 de noviembre se trasladó a la Unidad de Asesoría Jurídica de la Municipalidad y el mismo se encuentra listo para que se conozca por el Concejo Municipal en la Sesión Ordinaria del día Lunes 11 de enero, para su estudio, aprobación y autorización de firma por parte del cuerpo edil. Además, se programó gira para visita al cantón en fecha 9 de junio de 2020.

En la Sesión Ordinaria 44-2021 de fecha 01 de marzo del 2021, el Concejo Municipal acordó mediante el Acuerdo Municipal N° 877-2021 punto 2), autorizar al señor Alcalde a suscribir el convenio citado. A la fecha se está a la espera de la actualización de los datos (calidades) del autorizado a suscribir el convenio por parte del CONAVI Agrega que, a causa de la Pandemia, el cantón de Santa Bárbara se ha mantenido entre alerta amarilla y naranja, que el Comité Municipal de Emergencias se ha abocado a la atención de los vecinos del cantón más vulnerables, que durante los meses de agosto, setiembre, octubre y noviembre la época lluviosa, activo por deslizamientos el accionar de la Municipalidad, con el Comité Municipal de Emergencias, la Unidad Ambiental (unipersonal y miembro del CME), las restricciones y la repartición de diarios, se vieron obligados a reprogramar las inspecciones según como conta en las actas de inspección adjuntas en fecha 9 de octubre, 13 de noviembre, 20 de noviembre y 10 de diciembre poco personal las inspecciones por parte de la Unidad Ambiental de la Municipalidad.

En la reunión virtual efectuada el 10 de junio del 2021, el alcalde municipal Ing. Víctor Hidalgo Solís y el Dr. David Cortés Sánchez, director del Área Rectora de Salud Santa Bárbara; acordaron mediante aprobación unánime, utilizar el formato propuesto por la unidad de Gestión Ambiental Municipal para la notificación a los vecinos, sobre la construcción de un tanque séptico o fosa biológica para mitigar este problema con el manejo de las aguas, ya que solo las aguas pluviales deben ir a la calle. También amparándonos en la Ley General de Salud N° 5395, en su artículo 276: "Solo con permiso del Ministerio podrán las personas naturales o jurídicas hacer drenajes o proceder a la descarga de residuos o desechos sólidos o líquidos u otros que puedan contaminar el agua superficial, subterránea, o marítima, ciñéndose estrictamente a las normas y condiciones de seguridad reglamentarias y a los procedimientos especiales que el Ministerio imponga en el caso particular para hacerlos inocuos". La propuesta de notificación se adjunta como anexo (ver prueba 5 y 9).

En fecha 11 de noviembre del 2020, mediante el oficio VA-MSB-081-2020, suscrito por la señora Vicealcaldesa Municipal, se le solicita al señor Vinicio Moreira, Síndico de Purabá, coordinar una reunión con los vecinos de Calle Paniagua y Calle Azofeifa, con la Alcaldía Municipal, los Departamentos Técnicos Municipales y que esté presente el Concejo de Distrito, para poder encontrarle una solución integral al problema de canalización de aguas del sector mencionado.

En fecha 23 de diciembre de 2020, el Alcalde Municipal, junto con el señor Vinicio Moreira Síndico de Purabá, junto con vecinos propietario que han interpuesto denuncias pro canalización de aguas, se reunieron en calle Carreta de San Bosco, para buscar una solución en conjunto por las inundaciones que se dan en invierno y se acordó, presentar propuestas y soluciones que serían vistas en el mes de enero del 2021.

De importancia mencionar que el suscrito y el Comisión de Infraestructura y Urbanismo, esta última integrada por el equipo técnico municipal, en fecha 24 de junio del 2021, se llevó acabo inspección en la zona para determinar el sitio donde se realizará el desfogue de aguas, del mismo se concluye que: “Que Calle La Carreta está declarada como pública y Ia misma esta inventariada en el reglamento de vialidad de la Municipalidad de Santa Bárbara. En la actualidad se tiene la siguiente información del mapa catastral de la carretera en cuestión”.

A continuación, los planos que se muestran son reflejo de que la calle es pública en su totalidad, esta calle está dividida en dos calles por medio de una cerca natural de 140 metros de longitud. Además, en esa misma cerca hay presencia de postes de electricidad de la CNFL que alumbran del lado derecho. Es en esta calle donde se quiere trasladar el curso de las aguas pluviales y cancelar el paso por las propiedades privadas.

En el Reglamento de Vialidad y Transportes de la Municipalidad de Santa Bárbara, calle La Carreta se encuentra inventariada con un ancho de 4 metros, por lo que la Municipalidad debe ampliar el ancho de la vía, para poder construir el nuevo paso de las aguas En los planos del año de 1988 muestran que el lado izquierdo de la calle es público, por lo que la calle se puede ampliar y realizar la recuperación de la calle, siempre bajo el mismo nombre de Calle Carreta. Entre otras cosas se debe coordinar con la CNFL el traslado de los postes del tendido eléctrico que se encuentran en medio de la calle pública, y posteriormente llevar a cabo la canalización de las aguas pluviales de la comunidad por la misma calle.

Los planos que preceden, se muestra que son reflejo de que la calle es pública del lado que se desea ampliar; que existe un error en lo contenido en el Reglamento de Vialidad y Transporte, los planos son del predio inicial y del predio final respectivamente.

Intervención Municipalidad y Ministerio de Salud Es importante mencionar que Ia Municipalidad de Santa Bárbara y el Ministerio de Salud ha estado realizando esfuerzos para poder mejorar la situación de las aguas pluviales y residuales que están presentes en el cantón, producto de la no planificación urbana.

Ambas instituciones han estado abordando el problema de manera conjunta para la búsqueda de una solución, a continuación, se muestra un cronograma realizado hasta la fecha de la intervención del caso:

10 de junio 2020 Reunión Ministerio de Salud y Municipalidad para la coordinación 15 de junio del 2020 Reunión Ministerio de Salud y Municipalidad Coordinación 3 de setiembre del 2020 Reunión Ministerios de Salud y Municipalidad.

9 de diciembre del 2020 Se tiene reunión con los vecinos para la ampliación de la calle La Carreta con una longitud de 172 metros, la calle esta inventariada dentro del reglamento de vialidad con el número de código C4-04-117.

23 de diciembre del 2020 Se realiza inspección con el Ministerio de Salud para revisar el estado de situación de la acequia y la vialidad del proyecto para trasladar la acequia por calle La Carreta.

7 de abril 2021 Inspección con Conavi para ver obras en conjunto para realizar en el lugar.

4 de mayo 2021 Los vecinos envían oficio para que la calle se pueda ampliar para que el ancho de vía sea mayor y poder desviar la acequia.

24 de junio 2021 Inspección en la zona con los técnicos de la Municipalidad y el Ingeniero Vial externo.

Por otro lado; • El Ministerio de Salud y la Municipalidad de Santa Bárbara están realizando las inspecciones casa a casa para ver el tema de las aguas servidas.

1. En total se identificaron 50 fincas con un total de 70 viviendas.

2. Se realizaron 67 pruebas técnicas de coloración con fluoresceína, en 67 viviendas 3. De las 67 pruebas realizadas, 16 dieron como resultado negativo y 51 dieron resultado positivo.

4. Se notificaron 31 órdenes sanitarias.

5. De las 31 órdenes sanitarias notificadas, hay 22 órdenes sanitarias vigentes para su cumplimiento, 9 ya se encuentran vencidas, de las cuales hay 3 órdenes cumplidas, 1 parcialmente cumplida, orden que no se ha podido verificar del todo, ya que no se han encontrado personas en la vivienda, y 4 órdenes sanitarias no cumplidas, 6. Los plazos de las 22 órdenes sanitarias vigentes están para vencer entre los meses de julio, agosto y setiembre de 2021.

En el mes de julio y agosto del 2021 • La Municipalidad de Santa Bárbara continuara realizando la notificación a todos los vecinos de la zona para la concientización sobre las aguas residuales.

Solución de los problemas de inundaciones y malos olores en el sector.

La Municipalidad de Santa Bárbara presenta varias propuestas para resolver la problemática de las aguas (pluviales y residuales) en el sector de la comunidad de San Bosco. Los trabajos que se proponen para la búsqueda de una solución serán realizados por instancias que la Municipalidad de Santa Bárbara defina.

Impacto del Proyecto • Se ampliará el ancho de la calle pública.

• Con están nueva propuesta se erradicaría las inundaciones que se presentan en las partes bajas de la comunidad.

• Se daría una mejor facilidad de tránsito peatonal y vehicular en el lugar.

Se cumple con lo solicitado por la sala sobre el problema de las aguas servidas que están presentes en la comunidad. La Municipalidad de Santa Bárbara estará repartiendo información adicional para que los vecinos cumplan con lo que dice la ley sobre el tratamiento de las aguas servidas en el sector.

Para ello la Municipalidad de Santa Bárbara tiene programado la entrega de información que se debe cumplir; además del asesoramiento técnico necesario para que los vecinos puedan cumplir con el tratamiento de las aguas que se están depositando en los caños del sistema pluvial.

De la parte técnica se solicitaría criterios para darle factibilidad al proyecto.

1. Social.

2. Ambiental.

3. Vial.

4. Infraestructura.

5. Legal.

6. Catastro.

Para que el proyecto sea realizable es necesario que exista una alianza entre los involucrados, se debe contar con el visto bueno de los dueños de los predios donde se proyecta el alcantarillado nuevo y la municipalidad.

La Administración Municipal está haciendo las gestiones pertinentes para la realización de esta obra, pero se requiere del apoyo del Concejo Municipal, junta Vial para construcción del proyecto.

Existen factores que pueden afectar la línea base del cronograma, los cuales se monitorearan como riesgos con el fin de manejar los mismos, entre ellos se destaca la tramitología entre instancias (CNFL, CONAVI y ASADA Calle Lajas) para los trabajos.

Se debe tomar en cuenta el criterio técnico municipal para la ejecución del mismo en apego a la normativa aplicable.

Finalmente, indica que por lo antes expuesto y como se denota en las pruebas, la Municipalidad ha coordinado las acciones necesarias para darle una solución real y definitiva a la problemática que aqueja a los vecinos.

4.- Mediante constancia de la Técnica Judicial 3 a.i. y el Secretario a.i., ambos de la Sala Constitucional, se indica que revisado, a las veintiuno horas cuarenta y dos minutos del nueve de agosto de dos mil veintiuno, en el SISTEMA COSTARRICENSE DE GESTIÓN DE DESPACHOS JUDICIALES el CONTROL DE DOCUMENTOS RECIBIDOS Y ESTE EXPEDIENTE, no apareció que del 29 de julio al 06 de agosto de 2021, el DIRECTOR REGIONAL DEL MINISTERIO DE SALUD DE SANTA BÁRBARA haya presentado escrito o documento alguno, a fin de rendir el informe que se le solicitó en la resolución dictada a las siete horas cincuenta y seis minutos del veintinueve de julio de dos mil veintiuno.

Redacta el Magistrado Salazar Alvarado; y,

Considerando:

I.- Mediante la Sentencia N° 2020-010461 de las 9:50 horas del 09 de junio del 2020, se dispuso lo siguiente: “(…) Se declara con lugar el recurso. Se ordena a Víctor Manuel Hidalgo Solís, en su condición de Alcalde Municipal del cantón de Santa Bárbara de Heredia, así como a Garita Montoya, en su condición de Directora a.i. del Área Rectora de Salud de Santa Bárbara de Heredia, que, dentro del plazo no mayor a SEIS MESES, contados a partir de la notificación de esta sentencia, adopten las medidas que sean necesarias dentro del ámbito de sus respectivas competencias, a fin de que prevean y brinden una solución definitiva a la problemática ambiental denunciada por los recurrentes, término dentro del cual la Administración deberá tomar las medias que correspondan para paliar la situación (…)”.

II.- Sobre la gestión planteada. Por escrito presentado a las 13:41 horas del 27 de julio de 2021, el recurrente EDGAR ARIAS CHAVARRÍA, cédula de identidad 0109830397, presenta gestión de desobediencia de lo ordenado por esta Sala en esa oportunidad. Al respecto, cabe señalar que mediante resolución de las siete horas cincuenta y seis minutos del veintinueve de julio de dos mil veintiuno, se otorgó audiencia por tres días, contados a partir de la notificación de esta resolución, a Víctor Manuel Hidalgo Solís, en su condición de Alcalde Municipal del cantón de Santa Bárbara de Heredia, así como a Karina Garita Montoya, en su condición de Directora a.i. del Área Rectora de Salud de Santa Bárbara de Heredia, o quienes ocupen esos cargos, para que se refieran y aporten las pruebas correspondientes respecto a los hechos y omisiones que se les atribuyen. En atención a ello, por escrito presentado a las 22:33 horas del 04 de agosto del 2021, Víctor Manuel Hidalgo Solís, en su condición de ALCALDE MUNICIPAL del cantón de Santa Bárbara de Heredia, atendió la audiencia otorgada por la Sala, e indica que en fecha 15 de junio (sic), se llevó a cabo una reunión de coordinación entre la Municipalidad de Santa Bárbara y el Área de Salud de Santa Bárbara, que de los puntos tratados se acordó:

En fecha 11 de noviembre del 2020, mediante el oficio VA-MSB-081-2020, suscrito por la señora Vicealcaldesa Municipal, se le solicita al señor Vinicio Moreira, Síndico de Purabá, coordinar una reunión con los vecinos de Calle Paniagua y Calle Azofeifa, con la Alcaldía Municipal, los Departamentos Técnicos Municipales y que esté presente el Concejo de Distrito, para poder encontrarle una solución integral al problema de canalización de aguas del sector mencionado. En fecha 23 de diciembre de 2020, el Alcalde Municipal, junto con el señor Vinicio Moreira Síndico de Purabá, junto con vecinos propietario que han interpuesto denuncias pro canalización de aguas, se reunieron en calle Carreta de San Bosco, para buscar una solución en conjunto por las inundaciones que se dan en invierno y se acordó, presentar propuestas y soluciones que serían vistas en el mes de enero del 2021. La Comisión de Infraestructura y Urbanismo, integrada por el equipo técnico municipal, y el Alcalde, en fecha 24 de junio del 2021, se llevó acabo inspección en la zona para determinar el sitio donde se realizará el desfogue de aguas, del mismo se concluye que: “Que Calle La Carreta está declarada como pública y la misma esta inventariada en el reglamento de vialidad de la Municipalidad de Santa Bárbara. En la actualidad se tiene la siguiente información del mapa catastral de la carretera en cuestión.”.

Agrega que los planos muestran que la calle es pública en su totalidad, la cual está dividida en dos calles por medio de una cerca natural de 140 metros de longitud. Es en esta calle donde se quiere trasladar el curso de las aguas pluviales y cancelar el paso por las propiedades privadas. En el Reglamento de Vialidad y Transportes de la Municipalidad de Santa Bárbara, calle La Carreta se encuentra inventariada con un ancho de cuatro metros, por lo que la Municipalidad debe ampliar el ancho de la vía, para poder construir el nuevo paso de las aguas. En los planos del año de 1988 muestran que el lado izquierdo de la calle es público, por lo que la calle se puede ampliar y realizar la recuperación de la calle, siempre bajo el mismo nombre de Calle Carreta. Entre otras cosas se debe coordinar con la CNFL el traslado de los postes del tendido eléctrico que se encuentran en medio de la calle pública, y posteriormente llevar a cabo la canalización de las aguas pluviales de la comunidad por la misma calle. En cuanto a la Intervención de la Municipalidad y del Ministerio de Salud, indica que han estado realizando esfuerzos para mejorar la situación de las aguas pluviales y residuales que están presentes en el cantón, producto de la no planificación urbana. Ambas instituciones han estado abordando el problema de manera conjunta para la búsqueda de una solución, a continuación, se muestra un cronograma realizado hasta la fecha de la intervención del caso:

10 de junio 2020 Reunión Ministerio de Salud y Municipalidad para la coordinación 15 de junio del 2020 Reunión Ministerio de Salud y Municipalidad Coordinación 3 de setiembre del 2020 Reunión Ministerios de Salud y Municipalidad.

9 de diciembre del 2020 Se tiene reunión con los vecinos para la ampliación de la calle La Carreta con una longitud de 172 metros, la calle esta inventariada dentro del reglamento de vialidad con el número de código C4-04-117.

23 de diciembre del 2020 Se realiza inspección con el Ministerio de Salud para revisar el estado de situación de la acequia y la vialidad del proyecto para trasladar la acequia por calle La Carreta.

7 de abril 2021 Inspección con Conavi para ver obras en conjunto para realizar en el lugar.

4 de mayo 2021 Los vecinos envían oficio para que la calle se pueda ampliar para que el ancho de vía sea mayor y poder desviar la acequia.

24 de junio 2021 Inspección en la zona con los técnicos de la Municipalidad y el Ingeniero Vial externo.

Asimismo, se aprecia que el Ministerio de Salud y la Municipalidad de Santa Bárbara están realizando las inspecciones casa por casa para ver el tema de las aguas servidas.

1. En total se identificaron cincuenta fincas con un total de setenta viviendas.

2. Se realizaron sesenta y siete pruebas técnicas de coloración con fluoresceína, en sesenta y siete viviendas 3. De las sesenta y siete pruebas realizadas, dieciséis dieron como resultado negativo y cincuenta y una dieron resultado positivo.

4. Se notificaron treinta y un órdenes sanitarias.

5. De las treinta y un órdenes sanitarias notificadas, hay veintidós órdenes sanitarias vigentes para su cumplimiento, nueve ya se encuentran vencidas, de las cuales hay tres órdenes cumplidas, una parcialmente cumplida, orden que no se ha podido verificar del todo, ya que no se han encontrado personas en la vivienda, y cuatro órdenes sanitarias no cumplidas, 6. Los plazos de las veintidós órdenes sanitarias vigentes están para vencer entre los meses de julio, agosto y setiembre de 2021.

En el mes de julio y agosto del 2021 El Alcalde recurrido, indica que la Municipalidad de Santa Bárbara continuará realizando la notificación a todos los vecinos de la zona para la concientización sobre las aguas residuales.

En cuanto a la solución de los problemas de inundaciones y malos olores en el sector, la Municipalidad de Santa Bárbara presenta varias propuestas para resolver la problemática de las aguas (pluviales y residuales) en el sector de la comunidad de San Bosco. Los trabajos que se proponen para la búsqueda de una solución serán realizados por instancias que la Municipalidad de Santa Bárbara defina.

Impacto del Proyecto • Se ampliará el ancho de la calle pública.

• Con están nueva propuesta se erradicaría las inundaciones que se presentan en las partes bajas de la comunidad.

• Se daría una mejor facilidad de tránsito peatonal y vehicular en el lugar.

El Alcalde recurrido considera que se cumple lo solicitado por la Sala sobre el problema de las aguas servidas que están presentes en la comunidad. La Municipalidad de Santa Bárbara estará repartiendo información adicional para que los vecinos cumplan con lo que dice la ley sobre el tratamiento de las aguas servidas en el sector. Para ello la Municipalidad de Santa Bárbara tiene programado la entrega de información que se debe cumplir; además del asesoramiento técnico necesario para que los vecinos puedan cumplir con el tratamiento de las aguas que se están depositando en los caños del sistema pluvial. Asimismo, se aporta un cronograma semanal para la intervención de la acequia San Bosco.

II.- Con base en lo expuesto, y las evidencias adjuntas, esta Sala descarta el incumplimiento alegado por parte de las instituciones recurridas, en relación con lo ordenado en la Sentencia N° 2020-010461 de las 9:50 horas del 09 de junio del 2020, al acreditarse que sí se ha venido dando atención a lo ordenado en esa oportunidad, en lo que a sus competencias se refiere. Si bien es cierto, aun no se ha concretado una solución definitiva al problema planteado, las acciones tomadas por la representación del Ministerio de Salud y la Municipalidad de Santa Barbara, dirigidas a solventar esa situación, son claras y evidentes; sin embargo, resulta evidente que se trata de un proyecto complejo, y ya se cuenta con un cronograma de intervención, por lo que la gestión de incumplimiento resulta improcedente.

Por tanto:
