BACKGROUND:

  1. 1By means of a written filing received at the Chamber's Secretariat at 14:07 hours on June 10, 2021, the petitioners filed a writ of amparo against the Rural Water Supply System Administrator Association Nombre02. They explain that they are residents of the community of El Palmar de Horquetas de Sarapiquí, and that since 2009 they have been pursuing the establishment of a water supply system (acueducto) for their community through the Nombre02 Administrator Association, in order to guarantee water service; furthermore, institutions such as the Instituto Costarricense de Acueductos y Alcantarillados, INDER, SETENA, the Instituto Costarricense de Acueductos y Alcantarillados, and the Municipality of Puerto Viejo de Sarapiquí have participated in the process, but nothing has been accomplished. They add that money has been collected from the community and private consulting firms have been hired, but that over twelve years nothing has been communicated to the community and no progress on the project is visible.They state that El Palmar is a community of two hundred and fifty families living on small parcels donated by INDER, which at the time of the donation promised to bring water to the community, a promise they claim has still not been fulfilled. They add that a school with fifty children and twelve teachers, a Basic Comprehensive Health Care Team (Equipo Básico de Atención Integral en Salud), and a large population of elderly persons and children in general operate in that community, making access to potable water service important, since they currently rely on an artisanal water source drawn by a pump, which, when it burns out or when electricity is cut off, leaves them without water, as everything runs on electricity. They report that several individuals have gone to the Rural Water Supply System Administrator Association Nombre02 to request a water connection (paja de agua); however, they are told that there is insufficient water intake at that location and no further explanation is given, nor any possible date by which the situation might be resolved.They state that the community is tired of waiting and that the will and commitment of the institutions involved are required for the project to move forward and be completed. They further note that the pandemic has worsened the situation, since water is indispensable for personal hygiene and for complying with Ministry of Health protocols. They describe having submitted requests on May 20 and 27, 2021. They ask that they be granted water service in the same manner as residents of other nearby communities who already have such service. They request that the writ be granted.
  2. 2By resolution issued at 10:26 hours on June 18, 2021, the present proceeding was admitted and notice was given to the
  3. 3The notice was answered by Daniel Vega Barquero, in his capacity as President of the Rural Water Supply System Administrator Association Nombre02 of Horquetas de Sarapiquí, who acknowledges that the petitioners are indeed residents of El Palmar and have made multiple requests for potable water service in their community; however, they have been informed that the current supply system lacks the hydrological and hydraulic capacity to immediately fulfill the request. He clarifies that the association is in the process of improvements and expansions to meet those requirements, and thus to be able to fulfill the requests in a technically and legally sound manner. He notes that the water supply system is in a state of water deficit (déficit hídrico), which means that, under current regulatory and technical standards, it is the association's responsibility not to grant new water availabilities (disponibilidades) until the technical conditions — sufficient flow rate (caudal) for supply — and legal conditions — flow rate allocated by the Dirección Nacional de Aguas — have changed; therefore it is not legally appropriate to remove the allocated flow rate from a subscriber (abonado) who has legitimized their rights through due process and assign it to another who is not yet in a position to be served.Hence the need to carry out the expansion and improvement project on which they have been working for the past five years. He indicates that there is no infrastructure in El Palmar, the location where the petitioners request connection to the system, as no piping has been installed, which makes it materially impossible to carry out the requested connection. He adds that the studies mentioned by the petitioners are requirements of the national regulatory framework that must be respected, since the project involves several stages from the standpoint of permits, studies, financing, and infrastructure. He notes that the technical studies of the system's hydraulic capacity are conducted in order to verify the current and future conditions for properly supplying the El Palmar settlement (Asentamiento), which is located more than ten kilometers from the supply sources. He indicates that multiple permits are pending approval.He states that the El Palmar water supply project was designed with four components: "(…) a. Component #1 Contribution from the ASADA (…) (…) b. Component #2 Contribution from INDER (…) (…) c. Component #3 Contribution from AyA (…) (…) Component #4 Contribution from INDER (…)". He notes that every possible effort has been made to advance the project and provide the community with potable water; however, until INDER and the Instituto Costarricense de Acueductos y Alcantarillados are in a position to carry out the works and those works are actually built, it is materially impossible for the Water and Sewer Systems Administrator Association to supply the community of El Palmar with potable water, since the project carries an excessively high cost, estimated at approximately seven hundred million colones, funds that the association does not have. He requests that the writ be denied.
  4. 4The legal formalities required in the proceedings have been observed.

Drafted by Magistrate Salazar Alvarado; and,

WHEREAS:

I. ADMISSIBILITY OF THE WRIT

With respect to amparo actions directed against private parties, as is the case here, the Chamber has clearly stated: "By reason of its exceptional nature, the ordinary procedure for writs of amparo against private-law subjects begins with an examination of whether, in the case at hand, any of the circumstances that make it admissible are present — and only then, if so, whether it should be granted or not" (Sentencia N° 151-97). Article 57 of the Ley de la Jurisdicción Constitucional establishes that this type of action is available against acts or omissions of private-law subjects when they act or are required to act in the exercise of public functions or powers, or are situated — de jure or de facto — in a position of power against which ordinary jurisdictional remedies are clearly insufficient or untimely to safeguard the fundamental rights and freedoms referred to in Article 2, subparagraph a), of that same Law. In the present matter, the Chamber finds that the Rural Water Supply System Administrator Association Nombre02 of Sarapiquí is acting in the exercise of a public function, and therefore it is appropriate to proceed to a review of the merits of the writ (see Sentencia N° 2010-005400 of 10:15 hours on March 19, 2010).

II. SUBJECT OF THE WRIT

The petitioners state that they are residents of the community of El Palmar de Horquetas de Sarapiquí and that since 2009 they have been pursuing the establishment of a water supply system for their community through the Pablo Presbere Rural Water Supply System Administrator Association, in order to guarantee water service; however, they have not obtained access to water. They request that they be granted water service in the same manner as residents who already have such service.

III. PROVEN FACTS

The following facts are deemed duly established as relevant to the resolution of this matter:

The petitioners are residents of El Palmar de Horquetas de Sarapiquí (see report and attached evidence).

The petitioners have made multiple requests to the Pablo Presbere Rural Water Supply System Administrator Association for potable water service in their community; however, they have been informed that the current supply system lacks the hydrological and hydraulic capacity to immediately fulfill the request, as the association is in the process of improvements and expansions to meet those requirements and to fulfill the requests in a technically and legally sound manner (see report submitted by the respondent authority).

The water supply system is in a state of water deficit, which means that, under current regulatory and technical standards, no new water availabilities are granted until the technical conditions — sufficient flow rate for supply — and legal conditions — flow rate allocated by the Dirección Nacional de Aguas — have changed (see report submitted by the respondent authority).

IV. ON THE PROVISION OF SERVICES AND THE OPERATION OF WATER SUPPLY SYSTEM ADMINISTRATOR ASSOCIATIONS

The Regulation of Administrator Associations of Community Water and Sewer Systems — ASADAS —, N° 32529, establishes in its Article 21 the duties and powers of the administrator associations, those relevant to the resolution of this matter being cited below:

"Article 21. — The duties and powers of ASADAS are as follows:

(…)

Subsection 4) To authorize new services, connections, and reconnections where water and/or sewer systems have the technical capacity to accommodate them; otherwise, the provisions set forth in Article 18 of this regulation must be met.

(…)

Subsection 9) To provide public services in an efficient, equal, and timely manner to all users, without distinction of any kind, provided that the requirements established in the Reglamento de Prestación de Servicio al Cliente are met, while maintaining equitable and mandatory community participation at the time of the construction of the water and sewer system.

(…)

Subsection 19) To issue a water availability certificate (sello de disponibilidad hídrica), which shall be valid for six months for single-family dwellings and for one year for other developments requiring potable water and sanitary sewer service, and which may be extended. This certificate must always be issued where there is technical feasibility, where it does not detract from the quality of service being provided, and where infrastructure exists (…)".

V. ON THE SPECIFIC CASE

In the present writ, the petitioners state that they are residents of the community of El Palmar de Horquetas de Sarapiquí. Since 2009, they have been pursuing the establishment of a water supply system for their community through the Pablo Presbere Water Supply System Administrator Association, in order to guarantee water service; however, nothing has been accomplished.

The respondent authority, in its report submitted under oath, indicates that the petitioners have been informed that the current supply system lacks the water supply capacity (capacidad hídrica) or hydraulic capacity (capacidad hidráulica) to address the request immediately, as the system is currently undergoing an improvement and expansion process to resolve the requirements and thereby address requests in a technically and legally compliant manner. It states that the aqueduct is in a state of water deficit (déficit hídrico), which means that, from the perspective of current technical and regulatory standards, no new service connections (disponibilidades) are being granted until the technical conditions — sufficient flow rate (caudal) to supply the system — and legal conditions — flow rate assigned by the Dirección Nacional de Aguas — have changed. It further asserts that, at present, there is no infrastructure in El Palmar, the location where the petitioners are requesting connection to the system, as there are no installed pipes, which makes it materially impossible to carry out the requested connection; nonetheless, they are doing everything within their power to advance the project and provide the community with drinking water (agua potable).

As a first point, as indicated in the preceding Whereas clause (Considerando), this Chamber must clarify that the Regulation cited is itself clear in stating that it is the responsibility of these types of associations to authorize new services where there is technical capacity, and to grant water availability, provided that technical feasibility, infrastructure, and the absence of detriment to the quality of the service rendered are all in place. That is to say, the regulatory provisions governing the ability of aqueduct managing associations (asociaciones administradoras del sistema de acueducto) to grant new drinking water services are consistent with the recognition this Tribunal has made regarding the dimension of the so-called fundamental right to drinking water (derecho fundamental al agua potable), reiterating that, where there is a technical impossibility to provide the service, the managing entity cannot be compelled to approve or supply it.

Accordingly, this Chamber finds that the denial of drinking water service was due to a technical and legal impossibility on the part of the Asociación Administradora del Acueducto Nombre02 and, consequently, the denial is not arbitrary. Thus, in the case under review, the respondent association did not deny service to the petitioners arbitrarily, as its denial was a response to a technical and legal impossibility. In view of the foregoing, and for the reasons set out above, this Constitutional Tribunal does not find that, in this matter, the fundamental rights of the petitioners have been violated.

VI.Notwithstanding what was stated in the preceding Whereas clause, and notwithstanding that the present appeal must be dismissed, the respondent authority shall take note so that it effectively undertakes every effort within its power to bring about, as soon as possible, the infrastructure improvements to the aqueduct that were indicated in its submitted report.

VII. DOCUMENTATION SUBMITTED TO THE FILE

The parties are hereby notified that any documents submitted in paper form, as well as objects or evidence contained in any additional device of an electronic, computer-based, magnetic, optical, telematic, or new-technology nature, must be retrieved from the office within a maximum period of thirty business days counted from the notification of this Judgment. Failing this, all materials not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in Session N° 27-11 of August 22, 2011, article XXVI, and published in the Boletín Judicial N° 19 of January 26, 2012, as well as in the resolution approved by the Consejo Superior del Poder Judicial, in Session N° 43-12 held on May 3, 2012, article LXXXI.

THEREFORE:

The appeal is dismissed. The respondent authorities shall take note of what is stated in Considerando VI of this Judgment.

RESULTANDO:

1 .- Por medio del escrito recibido ante la Secretaría de la Sala a las 14:07 horas del 10 de junio de 2021, los recurrentes interponen recurso de amparo contra de la Asociación Administradora del Acueducto Rural Nombre02. Explican que son vecinos de la comunidad de El Palmar de Horquetas de Sarapiquí, y desde el año 2009, se gestionó el acueducto para esa comunidad ante la Asociación Administradora Nombre02, para garantizar el suministro de agua, además, han participado instituciones como el Instituto Costarricense de Acueductos y Alcantarillados, el Instituto Nacional de Desarrollo Rural, la Secretaría Técnica Nacional Ambiental, el Instituto Costarricense de Acueductos y Alcantarillados y la Municipalidad de Puerto Viejo de Sarapiquí, pero no logran concretar nada. Agregan que se ha solicitado dinero a la comunidad y se han contratado compañías consultoras privadas, pero en doce años no se comunica nada al pueblo ni se ven avances en el proyecto.

Expresan que El Palmar es una comunidad de doscientas cincuenta familias que viven en pequeñas parcelas, donadas por el Instituto Nacional de Desarrollo Rural y al momento de la donación, prometieron llevar el agua a la comunidad, pero reclaman que todavía no ha ocurrido. Agregan que en ese lugar funciona una escuela con cincuenta niños y doce docentes, un Equipo Básico de Atención Integral en Salud y, además, cuentan una enorme población de adultos mayores y niños en general, por lo que la necesidad de contar con el servicio de agua potable es importante, porque actualmente se sirven de un agua artesanal que se saca con una bomba, pero cuando ese aparato se quema o se corta el fluido eléctrico, se quedan sin agua, porque todo funciona con electricidad. Refieren que varias personas se han apersonado a la Asociación Administradora del Acueducto Rural Nombre02 a solicitar una paja de agua; sin embargo, se les indica que ahí no hay captación suficiente de agua y no les brindan más explicaciones, ni una fecha posible en que se pueda solucionar la situación.

Expresan que el pueblo está cansado de esperar y que se requiere voluntad y compromiso de las instituciones involucradas para que el proyecto avance y se concluya. Por otra parte, indican que en el marco de la pandemia, la situación se agrava, porque el agua es indispensable para la higiene personal y para cumplir los protocolos del Ministerio de Salud. Describen que han realizado gestiones que han enviado en fechas 20 y 27 de mayo de 2021. Solicitan que se les otorgue el suministro de agua al igual que los ciudadanos de otros pueblos aledaños que ya tienen dicho servicio. Solicitan se declare con lugar el recurso.

  1. 2Mediante resolución de las 10:26 horas del 18 de junio de 2021, se dio curso al presente proceso, y se concedió audiencia al
  2. 3Contesta la audiencia otorgada Daniel Vega Barquero, en su condición de Presidente de la Asociación Administradora del Acueducto Rural Nombre02 de Horquetas de Sarapiquí que, efectivamente, los recurrentes son vecinos de El Palmar y han realizado múltiples gestiones para que se les suministre el agua potable en su comunidad; sin embargo, se les ha informado que el sistema de abastecimiento actual no cuenta con la capacidad hídrica ni hidráulica para atender de forma inmediata la solicitud. Aclara que se encuentran en un proceso de mejoras y ampliaciones para solventar los requerimientos, y así poder atender las solicitudes de forma técnica y legal. Comenta que el acueducto se encuentra en un estado de déficit hídrico, lo que implica que desde la óptica normativa - técnica vigente, es su responsabilidad no otorgar nuevas disponibilidades hasta que no se hayan cambiado las condiciones técnicas (caudal suficiente para abastecer) y legales (caudal asignado por parte de la Dirección Nacional de Aguas), por lo que no es procedente legalmente quitar el caudal de un abonado que ha legitimado sus derechos siguiendo el debido proceso y asignárselo a otro que aún no está en posibilidades de ser abastecido.De allí la necesidad de la ejecución del proyecto de ampliación y mejoras en que han estado trabajando los últimos cinco años. Indica que no existe infraestructura en El Palmar, sitio donde los recurrentes solicitan la conexión al sistema, ya que no hay tuberías instaladas, lo que provoca la imposibilidad materialmente de realizar la conexión solicitada. Agrega que los estudios que mencionan los recurrentes son requerimientos del marco regulatorio nacional que se deben respetar, ya que el proyecto implica la realización de varias etapas desde el punto de vista de permisos, estudios, financiamiento e infraestructura. Señala que los estudios técnicos de capacidad hidráulica del sistema, se realizan con el fin de verificar las condiciones actuales y futuras para abastecer de forma correcta el Asentamiento de El Palmar, ya que esta zona se encuentra a más de diez kilómetros de las fuentes de abastecimiento.Indica que hay múltiples permisos en proceso esperando su aprobación. Señala que, con respecto al proyecto de abastecimiento de El Palmar, se diseñó considerando cuatro componentes: “(…) a. Componente #1 Aporte de la Asada (…) (…) b. Componente #2 Aporte de INDER (…) (…) c. Componente #3 Aporte de AyA (…) (…) Componente #4 Aporte de INDER (…)”. Menciona que se han hecho todos los esfuerzos posibles para lograr dicho proyecto y poder dotar de agua potable a la comunidad; sin embargo, hasta que el Instituto de Desarrollo Rural y el Instituto Costarricense de Acueductos y Alcantarillados estén en capacidad de ejecutar las obras y las mismas se construyan, para la Asociación administradora de los Sistemas de Acueductos y Alcantarillados es materialmente imposible abastecer a la comunidad de El Palmar de agua potable, ya que el proyecto tiene un costo un costo demasiado elevado, ya que supera aproximadamente los setecientos millones de colones, dinero con el cual no cuentan. Solicita se declare sin lugar el recurso.
  3. 4En los procedimientos seguidos se han cumplido las prescripciones legales.

Redacta el Magistrado Salazar Alvarado; y,

CONSIDERANDO:

I. ADMISIBILIDAD DEL RECURSO

Tratándose de acciones de amparo dirigidas contra sujetos privados, como es aquí el caso, la Sala ha sido clara al decir: "Por su excepcional naturaleza, el trámite ordinario de los recursos de amparo contra sujetos de derecho privado exige comenzar por examinar si, en la especie, estamos o no ante alguno de los supuestos que lo hacen admisible, para –posteriormente y en caso afirmativo– dilucidar si es estimable o no" (Sentencia N° 151-97). Establece el artículo 57, de la Ley de la Jurisdicción Constitucional, que esta clase de demandas se conceden contra las acciones u omisiones de sujetos de derecho privado cuando estos actúen o deban actuar en ejercicio de funciones o potestades públicas, o se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2, inciso a), de la misma Ley. En el sub judice, considera la Sala que la Asociación Administradora del Acueducto Rural Nombre02 de Sarapiquí, está actuando en ejercicio de una función pública, por lo que resulta procedente entrar a analizar por el fondo el amparo (ver Sentencia N° 2010-005400 de las 10:15 horas del 19 de marzo de 2010).

II. OBJETO DEL RECURSO

Los recurrentes manifiestan que son vecinos de la comunidad de El Palmar de Horquetas de Sarapiquí, y 1desde el año 2009, se gestionó el acueducto para su comunidad ante la Asociación Administradora del Acueducto Rural Pablo Presbere, para garantizar el suministro de agua; sin embargo, no han obtenido acceso al líquido. Solicitan que se les otorgue el suministro de agua al igual que los ciudadanos que ya tienen dicho servicio.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

Los recurrentes son vecinos de El Palmar de Horquetas de Sarapiquí (ver informe y prueba adjunta).

Los recurrentes han realizado múltiples gestiones ante la Asociación Administradora del Acueducto Rural Pablo Presbere, para que se les suministre el agua potable en su comunidad; sin embargo, se les ha informado que el sistema de abastecimiento actual no cuenta con la capacidad hídrica ni hidráulica para atender de forma inmediata la solicitud, ya que se encuentran en un proceso de mejoras y ampliaciones para solventar los requerimientos y atender las solicitudes de forma técnica y legal (ver informe rendido por parte de la autoridad recurrida).

El acueducto se encuentra en un estado de déficit hídrico, lo que implica que desde la óptica normativa técnica vigente, no se otorguen nuevas disponibilidades hasta que no se hayan cambiado las condiciones técnicas -caudal suficiente para abastecer- y legales -caudal asignado por parte de la Dirección Nacional de Aguas- (ver informe rendido por parte de la autoridad recurrida).

IV. SOBRE EL OTORGAMIENTO DE SERVICIOS Y EL FUNCIONAMIENTO DE LAS ASOCIACIONES ADMINISTRADORAS DE ACUEDUCTOS

El Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales –ASADAS-, N° 32529, establece, en su artículo 21, los deberes y atribuciones de las asociaciones administradoras, siendo de interés para la resolución de este asunto los que se citan a continuación:

“Artículo 21. — Son deberes y atribuciones de las ASADAS, los siguientes:

(…)

Inciso 4) Autorizar nuevos servicios, conexiones y reconexiones de existir acueductos, y/o alcantarillados sanitarios con capacidad técnica, de lo contrario deberá cumplir con las especificaciones señaladas en el artículo 18 del presente reglamento.

(…)

Inciso 9) Otorgar los servicios públicos en forma eficiente, igualitaria y oportuna a todos sus usuarios, sin distinciones de ninguna naturaleza, siempre que se cumpla con los requisitos solicitados por el Reglamento de Prestación de Servicio al Cliente, manteniendo la participación equitativa y obligatoria de la comunidad al momento de la construcción del sistema de acueductos y alcantarillados.

(…)

Inciso 19) Otorgar, el sello de disponibilidad hídrica, el cual tendrá una vigencia de 6 meses para viviendas unifamiliares y de un año para otros desarrollos, que requieran del servicio de agua potable y alcantarillado sanitario, el cual podrá ser prorrogado. Este sello deberá otorgarse siempre que exista viabilidad técnica, no vaya en detrimento de la calidad del servicio que se presta y exista infraestructura (…)”.

V. SOBRE EL CASO CONCRETO

En el presente recurso, los recurrentes manifiestan que son vecinos de la comunidad de El Palmar de Horquetas de Sarapiquí. Desde el año 2009, han gestionado el acueducto para su comunidad, ante la Asociación Administradora del Acueducto Pablo Presbere, para garantizar el suministro de agua; sin embargo, no se ha concretado nada.

Ahora bien, la autoridad recurrida, en su informe rendido bajo la solemnidad del juramento, indica que se ha indicado a los recurrentes que el sistema de abastecimiento actual no cuenta con la capacidad hídrica ni hidráulica para atender de forma inmediata la solicitud, ya que se encuentran en un proceso de mejoras y ampliaciones para solventar los requerimientos y así atender las solicitudes de forma técnica y legal. Señala que el acueducto se encuentra en un estado de déficit hídrico, lo que implica que, desde la óptica normativa - técnica vigente, no se otorguen nuevas disponibilidades hasta que no se hayan cambiado las condiciones técnicas -caudal suficiente para abastecer- y legales -caudal asignado por parte de la Dirección Nacional de Aguas-. Asegura que, actualmente, no existe infraestructura en El Palmar, sitio donde los recurrentes solicitan la conexión al sistema, ya que no hay tuberías instaladas, lo que provoca la imposibilidad materialmente de realizar la conexión solicitada; no obstante, están realizando todo lo que está a su alcance para lograr dicho proyecto y poder dotar de agua potable a la comunidad.

En un primer orden de ideas, tal y como se indicó en el Considerando supra, esta Sala debe aclarar que, el mismo Reglamento de cita es claro en señalar que corresponde a este tipo de asociaciones la autorización de nuevos servicios con capacidad técnica, así como otorgar la disponibilidad de agua, siempre que exista viabilidad técnica, infraestructura y no se vaya en detrimento de la calidad del servicio prestado. Es decir, las previsiones reglamentarias para que las asociaciones administradoras del sistema de acueducto puedan otorgar nuevos servicios de agua potable, se encuentran en consonancia con el reconocimiento que este Tribunal ha efectuado, en cuanto a la dimensión del denominado derecho fundamental al agua potable, de donde se reitera que, si existe imposibilidad técnica para la prestación del servicio, no puede obligarse a la entidad administradora a la aprobación o el suministro del mismo.

Así, esta Sala acredita que la denegatoria del servicio de agua potable, obedeció a una imposibilidad técnica y legal de la Asociación Administradora del Acueducto Nombre02 y, en consecuencia, la denegatoria no es arbitraria. De manera, que en el caso bajo estudio, ciertamente la asociación recurrida no les negó el servicio a los recurrentes de forma antojadiza, ya que respondió a una imposibilidad técnica y legal. Así las cosas, por las razones expuestas, este Tribunal Constitucional no considera que, en la especie, se hayan quebrantado los derechos fundamentales de los recurrentes.

VI.A pesar de lo indicado en el Considerando anterior, y a pesar de que el presente recurso debe ser desestimado, deberá tomar nota la autoridad recurrida para que, efectivamente, se realicen las gestiones que estén a su alcance para que se materialicen las mejoras a la infraestructura del acueducto, indicadas en su informe rendido, a la brevedad posible.

VII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta Sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara sin lugar el recurso. Tomen nota las autoridades recurridas de lo señalado en el Considerando VI de esta Sentencia.- Fernando Castillo V.
