Post-judgment motion (gestión posterior) filed by [Nombre01 001], in connection with judgment No. 2021-009168 issued at 9:05 hours on May 7, 2021.
Findings:
The opinion is drafted by Justice Delgado Faith; and,
Considering:
In judgment No. 2021-009168 issued at 9:05 hours on May 7, 2021, it was ordered:
III.On the specific case. In the sub lite, the petitioner (recurrente), who states that she lives with her mother, alleges that for more than 7 years she has filed complaints against her neighbors with the Ministry of Health due to a problem of seepage of dirty water onto her property, which causes infestations and foul odors; however, no effective solution has been found for the problem, to the detriment of public health and a healthy and ecologically balanced environment.
From the review of the case record, it is established as proven that the petitioner is the daughter of [Nombre01 010]. On March 2, 2015, [Nombre01 010] filed a complaint before the Regional Health Authority (Área Rectora de Salud) of Alajuelita against [Nombre 011] for "sewage (aguas negras), septic tank (tanque séptico)," "wastewater (aguas residuales), treatment plant," and "stormwater or greywater (aguas pluviales o servidas)"; she also described the complaint in the following terms: "The neighbor's water is flowing onto my property, keeping my yard permanently wet — dirty water with a foul smell." On April 22, 2015, the Regional Health Authority of Alajuelita conducted an inspection to address a complaint; however, no one was found at the reported residence at that time, so the inspection was rescheduled. In Visual Inspection Report (Acta Inspección Ocular) No. Y-122-2015 of May 19, 2015 of the Regional Health Authority of Alajuelita, it was recorded that a dye test (prueba de coloración) was performed on the sanitary fixture in the reported dwelling, which is the property of [Nombre01 002].
On May 25, 2015, [Nombre01 010] appeared before the Regional Health Authority of Alajuelita to submit photographs related to the result of the dye test. In Visual Inspection Report No. Y-162-2015 of June 17, 2015 of the Regional Health Authority of Alajuelita, it was noted that [Nombre01 002] was informed that the first sewage dye test had come back positive, and additionally that a dye test was performed on the greywater to determine whether it was seeping onto the property. In Visual Inspection Report No. Y-212-2015 of August 5, 2015 of the Regional Health Authority of Alajuelita, it was stipulated that the inspectors visited the home of [Nombre01 012] and observed moisture along the yard's shared boundary line (colindancia); furthermore, that they visited the home of [Nombre01 004] and performed the final greywater dye test in a bathroom. Technical Report (Informe Técnico) CS-ARS-AL-GA-339-2015 of September 8, 2015 concluded as follows: "4.1 It is concluded that the water seepage reported by [Nombre01 015] does not originate from the home of [Nombre01 002].
Said seepage is observed along the southern boundary of the property. 4.2 However, it was confirmed that there is sewage seepage originating from the home of [Nombre01 004] (the reported party) into the front yard of the home of [Nombre01 013]. Said seepage originates from the wastewater final disposal system (septic tank and/or drainage field). 4.3 With regard to 4.2, where it is concluded that the reported water seepage does not originate from the reported party's home, dye tests will be conducted at the home of [Nombre01 006], who also shares the southern boundary with the property of [Nombre01 001], in order to characterize the type of water seeping and its origin. 4.4 In light of the conclusion in point 4.2, a sanitary order (orden sanitaria) will be issued to [Nombre01 004] so that she carries out the necessary works on her wastewater treatment and final disposal system to prevent the water from seeping onto the property of [Nombre01 015] (…)." On October 16, 2015, the Regional Health Authority of Alajuelita notified [Nombre01 004] of sanitary order No. 026-2015, by which she was directed, within a period of forty-five business days, to do the following: "Inspect and repair the existing septic tank so that the sewage from her home is properly disposed of, in such a manner as to eliminate the seepage of said water onto the property of [Nombre01 015]." On November 26, 2015, [Nombre01 016] appeared before the Regional Health Authority of Alajuelita and stated that the problem had gotten worse.
In Visual Inspection Report No. Y-099-2016 of March 17, 2016 of the Regional Health Authority of Alajuelita, it was recorded that no water was observed at the home of [Nombre01 009]; furthermore, that the inspectors visited the home of [Nombre01 004] and performed a sewage dye test. On March 21, 2016, [Nombre01 004] informed the Regional Health Authority of Alajuelita that due to financial difficulties she had been unable to comply with the sanitary order and that she had not gone to IMAS because she did not have a residency card. On May 2, 2016, [Nombre01 004] informed the Regional Health Authority of Alajuelita that she had been unable to comply with the sanitary order. In Visual Inspection Report No. Y-390-2016 of September 26, 2016 of the Regional Health Authority of Alajuelita, it was recorded that [Nombre01 004] stated she had been unable to comply with the sanitary order. On October 10, 2016, [Nombre01 004] sent a note to the Regional Health Authority of Alajuelita, in which she described the difficulties in carrying out the requested repairs and requested additional time.
The Regional Health Authority of Alajuelita, by official communication (oficio) CS-ARS-AL-GA-211-2016 of October 26, 2016, notified [Nombre01 004] of a declaration of uninhabitability (declaratoria de inhabitabilidad) of the dwelling on grounds of insanitary conditions and granted her one month to vacate. The Regional Health Authority of Alajuelita, by official communication CS-ARS-AL-GA-217-2016 of October 31, 2016, granted [Nombre01 004] a deadline until January 31, 2017 to carry out what had been ordered. On November 8, 2018, [Nombre01 010] and the petitioner informed the Regional Health Authority of Alajuelita that the water seepage had worsened and that it was coming from neighboring dwellings; they also referred to a constructed wall that they feared might collapse as a result of the situation. In Visual Inspection Report No. M-183-2018 of November 28, 2018 of the Regional Health Authority of Alajuelita, it was mentioned that the home of [Nombre01 006] was visited and a dye test was performed on the greywater from the utility sink (pila).
From November 28, 2018 to April 8, 2021, no additional complaints regarding water seepage were filed by the petitioners. On April 15, 2021, the director of the Regional Health Authority of Alajuelita was notified of the filing of the present constitutional protection writ (amparo). In Visual Inspection Report No. Y-19-2021 of April 20, 2021 of the Regional Health Authority of Alajuelita, the following was stipulated: "First, we visited the complainant's dwelling and verified the following:
Regarding this matter, even though the respondent authority issued a sanitary order in October 2015, there is no indication that it diligently pursued compliance therewith, nor that it enforced compliance through the means provided by the legal framework for such purposes. In that regard, not only did years of procedural inactivity attributable to the Ministry of Health elapse, but it was not until after notification of the filing of the present writ that the need for a comprehensive evaluation of the case by an engineer was identified. Accordingly, adequate handling of the reported problem — which is related to the seepage of sewage, wastewater, and greywater — is not established. It is therefore of paramount importance not only to promptly identify the cause of the problem, but also to find its solution, so as to provide adequate protection of public health and the environment.
Consequently, the granting of the constitutional protection writ is warranted, on the terms that will be set forth in the operative section (parte dispositiva) of this judgment.

Por tanto:
The writ is granted. Ricardo Ocampo Salas, in his capacity as director of the Regional Health Authority of Alajuelita of the Ministry of Health, or whoever holds that position, is ordered to issue the corresponding orders, take the appropriate measures, and coordinate all pertinent actions, so that, within a maximum period of ONE MONTH from the notification of this judgment, the cause of the problem reported since March 2, 2015 is determined and the corresponding sanitary orders are issued for its proper resolution. He is likewise ordered to ensure compliance with such orders within the deadlines set forth therein. The respondent authority is hereby warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, imprisonment of three months to two years or a fine of twenty to sixty fine-days (días multa) shall be imposed on whoever receives an order that must be complied with or enforced, issued within the framework of a constitutional protection writ, and fails to comply with or enforce it, provided the offense is not more severely punishable under other law.
The State is ordered to pay the costs, damages, and losses (costas, daños y perjuicios) occasioned by the facts underlying this declaration, which shall be assessed in enforcement proceedings (ejecución de sentencia) before the administrative litigation (contencioso administrativo) courts. Said ruling was notified to the respondent authority on May 10, 2021.
In the sub examine, the petitioner states that the health and life of her family are at risk. Nombre02 notes that the one-month period granted by the Court has already elapsed; however, the Ministry of Health has not come to her home. She criticizes the respondent authority for failing to resolve her situation, with her home flooded by both fecal matter and "green water," causing health problems.
Regarding this matter, the Área Rectora de Salud de Alajuelita, upon being granted a hearing in these proceedings, asserts that, based on the results of inspection Y-20-2021 of April 20, 2021, the complaint filed by the petitioner (amparada) was closed and archived; however, this fact was not reported to the Constitutional Chamber (Sala) prior to the issuance of the principal judgment in this case. Now, in any event, as was established among the proven facts in ruling n.° 2021-009168 of 9:05 a.m. on May 7, 2021, Ocular Inspection Report (Acta de Inspección Ocular) n.° Y-19-2021, also dated April 20, 2021, stipulated: "(…) 6) It is important to note that the land on which the dwellings in question are located has a steep slope with elevation differences of more than one meter. Furthermore, neighboring residents located downhill experience moisture problems due to surface runoff (escorrentía superficial), particularly during the rainy season. In light of the foregoing, a request will be made for regional-level support so that an engineer may comprehensively evaluate the case." In other words, on the one hand it is asserted that the complaint was archived as a result of the inspection conducted on April 20, 2021, while on the other, it is observed that on that very same date it was noted that support from an engineer was required to evaluate the case in its entirety.
Now, it was not until June 29, 2021—after the alleged archiving of the complaint and after the hearing granted in connection with the contempt motion (gestión de desobediencia)—that the director of the Área Rectora de Salud de Alajuela sent an email to the Unidad de Rectoría de la Salud Región Central Sur, in which he stated: "(…) I request that you assist us as soon as possible with an engineer to assess the alleged damage to a wall caused by water seepage whose origin has not been determined, as all dye tests have come back negative (…)." Furthermore, the case file (expediente) reflects that the civil engineer of the Proceso de Regulación de la Salud, through technical report MS-DRRSCS-URS-IT-0322-2021 of July 16, 2021, concluded: "6. Conclusions: 6.1 Attention is given to the request for technical support to assess damage to a boundary wall (tapia) structure located along the southern boundary of the residence where Ms. [Nombre01 010] resides. 6.2 No evidence of damage suggesting a risk of collapse is observed in the structure, as no cracking in structural elements is observed, no loss of verticality is observed, nor are there any other conditions that would compromise the overall stability of the structure and suggest a risk to the occupants of the complainant's property. 6.3 In one section of the structure (Photograph No. 3), water seepage is observed, a condition that, based on what was observed on-site, has not caused damage to the structure that would compromise it or suggest a risk of collapse. 7.
Recommendations: In follow-up to the assessment request issued by the director of the Área Rectora de Salud de Alajuelita, it is recommended that this report be forwarded, in which it is concluded that the boundary wall subject to inspection does not exhibit conditions evidencing a risk of collapse and that, under current conditions, it does not suggest a danger to the occupants of the property occupied by Ms. [Nombre 010]." With respect to the foregoing, it is noted that the engineer's assessment addresses water seepage only in general terms and, in any event, the record does not reflect that the cause of the problem at issue has been determined. Furthermore, the director of the Área Rectora de Salud de Alajuelita mentioned that, due to the topography of the land, the water may be of natural origin and, if that were the case, the ministry would have no legal authority to intervene; however, such a statement constitutes a mere possibility.
In that regard, it must be emphasized that the complaint referred to a problem involving blackwater (aguas negras), wastewater (aguas residuales), and greywater (aguas servidas); however, there is no comprehensive approach to the situation described in the complaint, nor is it ruled out that the water (allegedly blackwater, wastewater, and greywater) constitutes a public health problem. In fact, the appellant (recurrente) alleges in the contempt motion that "her home is flooded with both fecal matter and green water." Precisely, it is important to reiterate that the granting of the constitutional rights petition (estimatoria del amparo) was based on the failure to demonstrate adequate follow-up of the reported problem, which is related to the seepage of blackwater, wastewater, and greywater. Accordingly, this Tribunal determined it to be of paramount importance not only to promptly identify the cause of the problem but also its solution, so as to provide adequate protection for public health and the environment.
Consequently, the appropriate course of action is to uphold the contempt motion, pursuant to the terms to be set forth in the operative section (parte dispositiva) of this ruling.
The parties are hereby advised that if any paper documents, objects, or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device have been submitted to the court, these must be retrieved from the court office (despacho) within a maximum period of 30 business days counted from notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, in accordance with the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Full Court (Corte Plena) in session N° 27-11 of August 22, 2011, artículo XXVI, and published in Boletín Judicial número 19 of January 26, 2012, as well as in the resolution approved by the Superior Council of the Judiciary (Consejo Superior del Poder Judicial) in session N° 43-12 held on May 3, 2012, artículo LXXXI.

Ricardo Ocampo Salas, in his capacity as director of the Área Rectora de Salud de Alajuelita, or whoever holds that position in his stead, is hereby ordered to immediately comply with the provisions set forth in ruling n.° 2021-009168 of 9:05 a.m. on May 7, 2021. This order is issued with the warning (apercibimiento) that administrative proceedings shall be initiated against him should he fail to comply. This judgment shall be personally served upon Ricardo Ocampo Salas, in his capacity as director of the Área Rectora de Salud de Alajuelita, or whoever holds that position in his stead.

Resultando:

Considerando:
En la sentencia n.° 2021-009168 de las 9:05 horas del 7 de mayo de 2021, se dispuso:
“III.- Sobre el caso concreto. En el sub lite, la recurrente, quien manifiesta vivir con su mamá, acusa que desde hace más de 7 años denunció a sus vecinos ante el Ministerio de Salud, debido a un problema de filtración de aguas sucias en su propiedad, lo cual provoca plagas y malos olores; sin embargo, no se ha dado una solución efectiva al problema, en detrimento de la salud pública y un ambiente sano y ecológicamente equilibrado.
Del estudio de los autos se tiene por demostrado, que la recurrentes es hija de [Nombre01 010]. El 2 de marzo de 2015, [Nombre01 010] planteó una denuncia ante el Área Rectora de Salud de Alajuelita en contra de [Nombre 011], por “aguas negras, tanque séptico”, “aguas residuales, planta de tratamiento” y “aguas pluviales o servidas”; asimismo, describió la denuncia en los siguientes términos: “Las aguas del vecino se pasan a mi propiedad haciendo que mi patio permanezca siempre húmedo, aguas sucias con mal holor (sic)”. El 22 de abril de 2015, el Área Rectora de Salud de Alajuelita efectuó una inspección a los efectos de atender una denuncia; sin embargo, en ese momento no se encontró a nadie en la casa denunciada, por lo que se reprogramó la inspección. En el Acta Inspección Ocular n.° Y-122-2015 de 19 de mayo de 2015 del Área Rectora de Salud de Alajuelita, se consignó que se realizó prueba de coloración en el servicio sanitario en la vivienda denunciada propiedad de la señora [Nombre01 002].
El 25 de mayo de 2015, [Nombre01 010] se apersonó al Área Rectora de Salud de Alajuelita a los efectos de aportar fotos relacionas con el resultado de la prueba de coloración. En el Acta Inspección Ocular n.° Y-162-2015 de 17 de junio de 2015 del Área Rectora de Salud de Alajuelita, se señaló que a [Nombre01 002] se le comunicó que la primera prueba de coloración de aguas negras había salido positiva y, además, que se hizo prueba de coloración en aguas servidas a los efectos de determinar si se estaban filtrando en la propiedad. En el Acta Inspección Ocular n.° Y-212-2015 de 5 de agosto de 2015 Área Rectora de Salud de Alajuelita, se estipuló que se apersonaron a la vivienda de [Nombre01 012] y se observó humedad en la línea de la colindancia del patrio; además, que se apersonaron a la casa de [Nombre01 004] y efectuaron la última prueba de coloración de aguas servidas en un baño. El Informe Técnico CS-ARS-AL GA-339-2015 de 8 de setiembre de 2015 concluyó lo siguiente: “4.1 Se concluye que la filtración de agua denunciada por la señora [Nombre01 015] no proviene de la casa de [Nombre01 002].
Dicha filtración se observa en la colindancia sur de la propiedad. 4.2 Sin embargo, sí se comprobó que existe una filtración de aguas negras proveniente de la casa de la señora [Nombre01 004] (denunciada) hacia el patio frontal de la casa de la señora [Nombre01 013] . Dicha filtración proviene del sistema de disposición final de aguas residuales (tanque séptico y/o drenaje). 4.3 En relación al (sic) 4.2 donde se concluye que la filtración de aguas denunciada no proviene de la casa de la denunciada, se procederá a realizar pruebas de coloración en la vivienda de la Sra. [Nombre01 006] , quien también colinda al sur con la propiedad de la señora [Nombre01 001] con el fin de caracterizar el tipo de agua filtrada y su origen. 4.4 En virtud de lo concluido en el punto 4.2 se procedera (sic) a girar una orden sanitaria a la señora [Nombre01 004] con el fin de que ella realice las obras necesarias en su sistema de tratamiento y disposición final de aguas residuales con el fin de que las mismas no se filtren a la propiedad de la señora [Nombre01 015] (…)”.
El 16 de octubre del 2015, el Área Rectora de Salud de Alajuelita notificó a [Nombre01 004] la orden sanitaria n.° 026- 2015, mediante la cual se le ordenó, en el plazo de cuarenta y cinco días hábiles, lo siguiente: “Revisar y reparar el tanque séptico existe (sic) con el fin de que se dispongan adecuadamente las aguas negras de su vivienda, de modo tal que se elimine la filtración de esas aguas a la propiedad de la señora [Nombre01 015]”. El 26 de noviembre de 2015, [Nombre01 016] se apersonó al Área Rectora de Salud de Alajuelita y manifestó que el problema estaba peor. En el Acta Inspección Ocular n.° Y-099-2016 de 17 de marzo de 2016 del Área Rectora de Salud de Alajuelita, se consignó que en la casa de la señora [Nombre01 009] no se observan aguas; además, que se apersonaron a la casa de [Nombre01 004] y se efectuó la prueba de coloración de aguas negras. El 21 de marzo del 2016, [Nombre01 004] comunicó al Área Rectora de Salud de Alajuelita que por problemas económicos no había podido cumplir con la orden sanitaria y que no había acudido al IMAS por no tener cédula de residencia.
El 2 de mayo de 2016, [Nombre01 004] comunicó al Área Rectora de Salud de Alajuelita que había no había podido cumplir la orden sanitaria. En el Acta de Inspección Ocular N° Y-390-2016 de 26 de setiembre de 2016 del Área Rectora de Salud de Alajuelita, se consignó que [Nombre01 004] manifestó no haber podido cumplir con la orden sanitaria. El 10 de octubre del 2016, [Nombre01 004] remitió una nota al Área Rectora de Salud de Alajuelita, en la que expuso dificultades para realizar las reparaciones solicitadas y solicitó más tiempo. El Área Rectora de Salud de Alajuelita, mediante oficio CS-ARS-AL-GA-211-2016 de 26 de octubre de 2016, notificó a [Nombre01 004] la declaratoria de inhabitabilidad de la vivienda por insalubre y le otorgó un mes para su desalojo. El Área Rectora de Salud de Alajuelita, por oficio CS-ARS-AL-GA-217-2016 de 31 de octubre de 2016, le concedió plazo a [Nombre01 004] hasta el 31 de enero del 2017 para ejecutar lo ordenado.
El 8 de noviembre de 2018, la [Nombre01 010] y la recurrente comunicaron al Área Rectora de Salud de Alajuelita que la filtración de aguas había empeorado y que estas prevenían de las viviendas colindantes; además, hizo referencia a un muro construido que temen que se caiga por esa situación. En el Acta de Inspección Ocular N° M-183-2018 de 28 de noviembre de 2018 del Área Rectora de Salud de Alajuelita, se mencionó que se visitó la casa de [Nombre01 006] y se hizo la prueba de coloración en las aguas servidas de la pila. Del 28 de noviembre de 2018 al 8 de abril de 2021 no se plantearon denuncias adicionales de la accionantes por filtración de aguas. El 15 de abril de 2021, el director del Área Rectora de Salud de Alajuelita fue notificado del curso de este amparo En el Acta de Inspección Ocular n.° Y-19-2021 de 20 de abril de 2021 del Área Rectora de Salud de Alajuelita se estipuló: “Primeramente, nos apersonamos a la vivienda de la denunciante y comprobamos lo siguiente:
Desde este panorama, se observa una omisión del Área Rectora de Salud de Alajuelita que amerita la intervención de este Tribunal.
Sobre el particular, aun cuando la autoridad recurrida emitió una orden sanitaria en octubre de 2015, no se aprecia que se haya procurado de forma diligente su cumplimiento ni tampoco que se haya exigido su acato a través de los medios previstos por el ordenamiento jurídico para tales fines. En ese sentido, no solo transcurrieron años de inactividad procesal atribuible al Ministerio de Salud, sino que fue hasta después de la notificación del curso de este amparo, que se determinó que (sic) la necesidad de una evaluación íntegra del caso por parte de un ingeniero. Por lo anterior, no se acredita un adecuado manejo de la problemática denunciada, la cual se encuentra relacionada con la filtración de aguas negras, residuales y servidas. De ahí que resulte trascendental no solo definir de forma pronta la causa del problema sino también su solución, para así brindar un adecuado resguardo a la salud pública y al ambiente.
En consecuencia, procede la estimatoria del amparo, en los términos que se dictarán en la parte dispositiva de esta sentencia.

Por tanto:
Se declara con lugar el recurso. Se ordena a Ricardo Ocampo Salas, en su condición director del Área Rectora de Salud de Alajuelita del Ministerio de Salud, o a quien ocupe ese cargo, que gire las órdenes correspondientes, tome las medidas oportunas y coordine lo pertinente, a los efectos de que, en el plazo máximo de UN MES contado a partir de la notificación de esta sentencia, se determine la causa de la problemática denunciada desde el 2 de marzo de 2015 y se dicten órdenes sanitarias correspondientes para su debida solución. Asimismo, se le ordena velar por el respectivo cumplimiento de tales órdenes en los plazos consignados en ellas. Se advierte a la autoridad recurrida que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. La Magistrada Hernández López pone nota. El Magistrado Salazar Alvarado pone nota. Notifíquese”.
Tal resolución fue notificada a la autoridad recurrida el 10 de mayo de 2021.
En el sub examine, la recurrente manifiesta que la salud y la vida de su familia está en peligro. Nombre02 que ya pasó el mes que otorgó la Sala; sin embargo, el Ministerio de Salud no se apersonó a su casa. Reprocha que la autoridad recurrida no le resuelve la situación y su casa está inundada tanto de materia fecal como de “aguas verdes ”, lo que provoca problemas de salud.
Sobre el particular, el Área Rectora de Salud de Alajuelita, con ocasión de la audiencia otorgada en autos, asevera que, de acuerdo con el resultado de la inspección Y-20-2021 de 20 de abril de 2021, se procedió con el cierre y archivo de la denuncia planteada por la amparada; sin embargo, esto último no fue informado a la Sala previo al dictado de la sentencia principal de este proceso. Ahora, en todo caso, tal y como se tuvo por demostrado en los hechos probados de la resolución n.° 2021-009168 de las 9:05 horas del 7 de mayo de 2021, el Acta de Inspección Ocular n.° Y-19-2021 también del 20 de abril de 2021, estipuló: “(…) 6) Es importante mencionar que el terreno donde se ubican las viviendas implicadas tienen una alta pendiente y con desniveles de más de un metro. Además, los vecinos más abajo se presentan problemas de humedad por la escorrentía superficial especialmente en época de invierno. Por lo anterior se procederá a solicitar apoyo a nivel regional para que un ingeniero evalúe el caso integralmente ”. Es decir, por un lado se afirma que la denuncia fue archivada con ocasión de la inspección de 20 de abril de 2021, pero por el otro, más bien, se observa que en esa misma fecha se indicó que se requiere apoyo de un ingeniero para que evalúe el caso íntegramente.
Ahora, no fue sino hasta el 29 de junio de 2021 (luego del presunto archivo de la denuncia y de la audiencia otorgada en virtud de la gestión de desobediencia), que el director del Área Rectora de Salud de Alajuela envió un correo electrónico a la Unidad de Rectoría de la Salud Región Central Sur, en el que manifestó: “(…) Le solicito se nos colabore lo antes posible con un ingeniero para que valore la supuesta afectación de un muro por una filtración de aguas que no se ha podido determinar su origen, ya que, todas las pruebas de coloración han sido negativos (…)”. Además, consta en el expediente, que el ingeniero civil del Proceso de Regulación de la Salud, mediante informe técnico MS-DRRSCS-URS-IT-0322-2021 de 16 de julio de 2021, concluyó: “6. Conclusiones: 6.1 Se da atención a la solicitud de apoyo técnico para valoración de afectación de estructura tipo tapia ubicada en la colindancia sur de la vivienda donde reside la Sra. [Nombre01 010]. 6.2 En la estructura no se observa evidencia de daño que sugiera un riesgo de colapso, debido a que, no se observan agrietamientos en elementos estructurales, no se observa pérdida de verticalidad u otras condiciones que comprometan la estabilidad global de la estructura y sugieran riesgo para los ocupantes del inmueble denunciante. 6.3 En un sector de la estructura (Fotografía No.3) se observa filtración de agua, condición que conforme lo observado en sitio, no ha provocado daños sobre la estructura que la comprometan y sugieran un riesgo de colapso. 7.
Recomendaciones: En seguimiento a la solicitud de valoración emitida por la dirección del Área Rectora de Salud de Alajuelita, se recomienda hacer traslado del presente informe en el cual se concluye que la tapia sometida a inspección no muestra condiciones que evidencien un riesgo de colapso y que bajo las condiciones actuales, no sugiere un peligro para los ocupantes del inmueble ocupado por la Sra. [Nombre 010]”.
En relación con lo anterior, se aprecia que el criterio del ingeniero se refiere de manera general a una filtración de aguas y, en todo caso, no consta en autos que se hubiere determinado la causa de la problemática de marras. Incluso, el director del Área Rectora de Salud de Alajuelita mencionó que, debido a la topografía del terreno, las aguas pueden ser de origen natural y, de ser ese el caso, el ministerio no tendría alcance legal para intervenir; empero, tal manifestación constituye una mera posibilidad. En ese sentido, se debe recalcar que la denuncia hizo referencia a un problema de aguas negras, residuales y servidas; empero, no se aprecia un abordaje íntegro de la situación denunciada, ni tampoco se descarta que las aguas (presuntamente negras, residuales y servidas) no constituyan un problema de salud pública. De hecho, la recurrente acusa en la gestión de desobediencia que “su casa está inundada tanto de materia fecal como de aguas verdes”.
Precisamente, es importante reiterar que la estimatoria del amparo se dio porque no se acreditó un adecuado seguimiento de la problemática denunciada, la cual se encuentra relacionada con la filtración de aguas negras, residuales y servidas. Por lo que este Tribunal determinó trascendental no solo definir de forma pronta la causa del problema sino también su solución, para así brindar un adecuado resguardo a la salud pública y al ambiente.
En consecuencia, lo procedente es acoger la gestión de desobediencia, según los términos que se dictarán en la parte dispositiva de este pronunciamiento.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se acoge la gestión formulada. Se ordena a Ricardo Ocampo Salas, en su condición de director del Área Rectora de Salud de Alajuelita, o a quien en su lugar ocupe ese cargo, el cumplimiento inmediato de lo dispuesto en la sentencia n.° 2021-009168 de las 9:05 horas del 7 de mayo de 2021. Lo anterior bajo el apercibimiento de ordenarse la apertura de un procedimiento administrativo en su contra si no lo hiciere. Notifíquese esta sentencia a Ricardo Ocampo Salas, en su condición de director del Área Rectora de Salud de Alajuelita, o a quien en su lugar ocupe ese cargo, en forma personal.
