Document Review 1 *CO* Res. Nº 2021-014294 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at twelve hours and zero minutes on the twenty-third of June of two thousand twenty-one.
Action of unconstitutionality (acción de inconstitucionalidad) filed by Nombre01, of legal age, married, businessman, identity card number CED01, resident of Alajuela, in his capacity as president of CORPORACIÓN CEFIRO S.A., against the sixth paragraph of Article 8 of the Código de Minería.
WHEREAS:
Drafted by Magistrate Castillo Víquez; and,
CONSIDERING:
An action of unconstitutionality (acción de inconstitucionalidad) is a proceeding subject to certain formal requirements that must be satisfied in order for the Sala to validly adjudicate the merits of the challenge. In that regard, Article 75 of the Ley de la Jurisdicción Constitucional establishes the admissibility requirements for an action of unconstitutionality. First, the existence of a prior pending proceeding (asunto previo pendiente de resolver) is required—whether before the courts or in the process of exhausting the administrative channel (vía administrativa)—in which unconstitutionality has been invoked as a reasonable means of protecting the right or interest considered to have been infringed. In the second and third paragraphs, the law establishes, by way of exception, circumstances in which no prior pending proceeding is required: when, by the nature of the matter, there is no individual and direct injury, or when diffuse or collective interests (intereses difusos o colectivos) are being defended, or when the action is filed directly by the Contralor General de la República, the Procurador General de la República, the Fiscal General de la República, or the Defensor de los Habitantes.
II.With regard to the requirement of a prior pending proceeding, this Sala, in ruling no. 1995-4190, issued at 11:33 a.m. on July 28, 1995, stated the following:
"First, this is an incidental proceeding by nature, not a direct or popular action, which is to say that the existence of a pending matter—whether before the courts or in the process of exhausting the administrative channel—is required in order to access the constitutional jurisdiction, but in such a way that the action constitutes a reasonable means of protecting the right considered to have been infringed in the main proceeding, so that what is resolved by the Constitutional Tribunal has a positive or negative bearing on that pending proceeding, inasmuch as it rules on the constitutionality of the norms to be applied in that matter; and only by way of exception does the legislation permit direct access to this jurisdiction—as provided for in the second and third paragraphs of Article 75 of the Ley de la Jurisdicción Constitucional." That being the case, the requirement of a prior pending proceeding does not constitute a merely formal requirement, since it is not sufficient for a base proceeding to exist, nor is a mere invocation of unconstitutionality enough; it is additionally required that the action be a reasonable means of protecting the right or interest considered to have been infringed.
This means that it is necessary to verify the existence of a proceeding in which the fundamental rights of individuals are at stake and in which the challenged norms have a direct bearing on the resolution of the case (see, in the same vein, rulings no. 1990-1668, 1993-4085, 1994-798, 1994-3615, 409-I-95, 1995-851, 1995-4190, and 1996-791, among others). There are also other formal requirements that must be met, namely: the explicit identification of the challenged norms, duly substantiated, with specific citation of the constitutional norms and principles alleged to have been infringed; authentication by an attorney of the brief in which the action is filed; accreditation of standing requirements (poderes y certificaciones); and a literal certification of the brief in which the unconstitutionality of the norms was invoked in the base proceeding—all requirements which, if not met by the petitioner, give rise to the dismissal of the action.
III.ON THE INADMISSIBILITY OF THIS ACTION.- In the case under study, the petitioner alleges the unconstitutionality of the sixth paragraph of Article 8 of the Código de Minería, insofar as it provides: "(…) Within the mining reserve area established in this article, exploration permits, mining exploitation concessions (concesiones de explotación minera), and material processing rights may only be granted to workers duly organized in cooperatives dedicated to small-scale mining for family subsistence, artisanal, and coligallero purposes, under the conditions established in this Law and its regulations. (…)". This is because, in the petitioner's view, the challenged norm is contrary to Articles 33 and 34 of the Constitution, inasmuch as independent workers or workers organized in other types of collective entities are not permitted to freely engage in the exploitation of the mining reserve area established in that article, which the petitioner considers to be an arbitrary and disproportionate difference in treatment.
The petitioner also alleges that the challenged Article 8 is injurious to the acquired rights (derechos adquiridos) of those who were in the process of obtaining a concession at the time that norm entered into force, since it was applied to them retroactively. On the basis of the foregoing, the petitioner requests that the sixth paragraph of Article 8 of the Código de Minería be declared unconstitutional, on the grounds that it is discriminatory and injurious to an alleged acquired right of the represented party, which, pursuant to that provision, is prevented from holding a mining exploitation concession. As the base proceeding for this action, the petitioner filed an administrative contentious proceeding (proceso contencioso administrativo) against the State, under case file no. 21-002758-127-CA, within which the petitioner challenges the validity of resolution no. R-119-2021-MINAE, issued at 7:25 a.m. on May 5, 2021, by the Ministerio de Ambiente y Energía, by which the appeal against the decision denying the petitioner's application for a mining exploitation concession was rejected.
In that regard, given its similarity to the question raised in this action, it is pertinent to cite resolution no. 2019-024745, issued at 12:10 p.m. on December 11, 2019, rendered in case file no. 19-018840-0007-CO, which is an action of unconstitutionality filed by the petitioner here, Nombre01, acting on behalf of MCC Mining CO S.A., against Article 1°, paragraphs four and five of Ley n° 8904, which amended the Código de Minería. In that ruling, the Sala Constitucional held as follows:
"III.- ON THE SPECIFIC CASE. Having analyzed the arguments of the petitioner, the Sala concludes that the action must be summarily rejected, for the reasons set forth below. First, on the basis of its subject matter. The petitioner argues that those provisions are unconstitutional for infringing the principles of equality and proportionality. The petitioner states that the challenged norm only permits the granting of concessions for the exploitation of metallic mining to workers' cooperatives dedicated to small-scale mining. The petitioner alleges that this entails establishing discriminatory treatment between this legal form and others of a different nature but composed of natural persons, discrimination that ultimately extends to natural persons. As can clearly be inferred from the foregoing, the petitioner's claim is that the exception the norm makes with respect to granting the concession to 'workers' cooperatives' be declared unconstitutional, since the petitioner considers that concessions could also be granted in favor of other types of persons, whether natural or legal, without this being detrimental to the right to a healthy environment.
Having analyzed the petitioner's arguments, it is important to note that the petitioner raises an unconstitutionality by relative omission (inconstitucionalidad por omisión relativa), although not in a technical or formal manner. For purposes of clarification, it must be borne in mind that sub-constitutional norms that grant a benefit to a particular group may incur in unconstitutionality by relative omission. It is well known that this type of unconstitutionality has two aspects. The first occurs when the enacted legal norm fails to comply with certain contents or requirements of the constitutional mandate, thereby failing to satisfy the constitutional demands imposed on the legislature. The second is associated with the exclusion of a particular group not taken into account at the time of legislating or enacting a norm of general application. In such cases, the principle of equality is violated, '(…) either because it expressly excludes a particular group of individuals, without apparent reason, from a benefit to which they would be entitled or from a legitimate expectation; or because the provision, in regulating that benefit, does so in favor of a particular group and remains silent with respect to the rest.
According to the doctrine, it may happen that the provision is silent regarding the legal situation of another group of persons who should receive the same treatment, either because there is no reason to distinguish their situation from that of others, or because they form part, like the former, of the same group of persons whose situation must be regulated uniformly, as the Constitution so requires. From the provision, an implicit norm can then be derived, one that regulates the legal situation of this group of persons omitted by the provision differently from the explicit norm, and that differentiation may be contrary to the Constitution by violating the principle of equality[1].' (See the dissenting vote (voto de minoría) in ruling no. 8763-04 of the Sala Constitucional).
It is thus clear that the subject matter of the action was not correctly framed, since the alleged unconstitutionality of the norms is not on account of what they provide, but rather on account of what they do not regulate (by failing to include other legal forms as eligible to apply for a concession), a situation that falls within the category of unconstitutionality by omission.
IV.The second reason for rejecting this action is that the company lacks standing, since, although it has a prior pending proceeding, that proceeding is not a reasonable means of protecting the right considered to have been infringed. In the present matter, we are faced with a norm that grants a benefit to a group of persons organized through a specific legal form—the cooperative—for the pursuit of a specific activity as well: small-scale mining exploitation. In doing so, the norm excludes other potential beneficiaries, who might be organized through other legal forms such as corporations (sociedades anónimas). However, at this point it is necessary to note that a potential ruling upholding the action would not result in a favorable outcome for the petitioner company in the prior pending proceeding. What is resolved in the action would in no way benefit it, since the consequence of a declaration of unconstitutionality—and the consequent annulment of the norm, the annulment being what the petitioner itself requests when, in its prayer for relief, it clearly asks that the 'fourth and fifth paragraphs of Article 1 of Ley No. 8904 be annulled'—would be that the benefit is annulled for workers' cooperatives, which in no way affects or improves the current situation of the petitioner company.
It must be recalled that it is an essential requirement of the action proceeding, given its incidental character, that a potential declaration of unconstitutionality have a bearing on or connection to the main proceeding—that is, that it be a reasonable means of protecting the right or interest considered to have been infringed—since it has been repeatedly stated that there is no popular action in the area of constitutional review of norms under our law, the general rule being the incidental character of the action and direct access to review being the exception (Article 75 of the Ley de Jurisdicción Constitucional)."
V.On the other hand, the petitioner's subsidiary claim must also be rejected, since this Court holds only the powers of a "negative legislator (legislador negativo)," with authority to annul norms, and not those of a positive legislator (legislador positivo), enacting legal norms. Thus, there is no way in which the Court could extend the benefit granted to cooperatives to other legal entities, since doing so would exceed the competences conferred upon it by the legislature. Accordingly, when the petitioner asks this Court to "subsidiarily issue an interpretive ruling (sentencia interpretativa) in which the Constitutional Court establishes that wherever the fourth and fifth paragraphs of article one of Ley No. 8904 refer to 'workers' cooperatives,' it must also be understood as constitutionally valid to grant concessions to other types of legal persons," he is in reality asking the Court to legislate, which is entirely contrary to the principle of separation of powers (separación de funciones) of our political system, and obviously falls outside the competences of this Court. In this regard, the Court has stated:
"Although this Constitutional Court is empowered to act as a negative legislator, with the authority to annul from the legal order all norms it deems unconstitutional, it is in fact barred from acting as a positive legislator creating norms. (…) Likewise, since this is a Court that acts as a negative legislator, it is clear that a potential favorable ruling—with the consequent elimination of the norm—would not remedy the omission alleged by the petitioner, and so the action as framed lacks utility and is therefore manifestly inadmissible. As in this case, what is challenged is not the text of the norms themselves but rather what they allegedly omit—in the petitioner's view—this Court cannot rule with the aim of usurping the competences of other bodies or branches. Under such circumstances, the action is inadmissible with respect to this issue." (Voto No. 2009-12210 of 14:40 hours on August 5, 2009) (In the same vein, Voto No. 2018-015584 of 12:21 hours on September 19, 2018)
VI.CONCLUSION.- The foregoing permits the ready conclusion that the action does not satisfy the requirement of being a reasonable means of protecting the right alleged to have been violated in the prior proceeding, since, even if the action were granted, the petitioner would not obtain a favorable result therein. For the reasons set forth, the action is inadmissible on the merits and must be rejected. Justice Rueda Leal states different reasons.
VII.Different reasons of Justice Rueda Leal. With respect, I consider that the action should have been rejected outright for reasons different from those set forth in the majority opinion. The principal opinion proceeds from the premise that a potential declaration of unconstitutionality of the challenged norm would neither benefit nor improve the petitioner's particular situation. In analogous cases, I have stated the following:
"After carefully analyzing the point, I cannot share the majority's view because, at bottom, it ignores the typology of the different constitutional judgments.
In general, the Court's abstract constitutional review (control abstracto de constitucionalidad) leads to a conclusion as to whether or not a norm is consistent with the Constitution. If the norm is declared unconstitutional, the natural consequence is its annulment with ex tunc effects, given that a contradiction between said norm and the constitutional bloc (bloque de constitucionalidad) has been established, whose hierarchical force expels the norm from the legal order. In these cases, the normative substrate (sustrato normativo) (Normsubstanz) contains the source of unconstitutionality, so that its removal is appropriate in order to restore constitutional order.
However, it may also occur that the unconstitutionality does not lie in the normative substrate itself, but rather in the normative relationship between two or more subjects arising from a violation of the right to equality. This occurs when the norm results in a differentiated treatment or an unconstitutional preferential treatment that injures the aforementioned fundamental right. In such a case, the constitutional defect does not lie, for example, in the fact that a certain benefit is granted to or denied from a given subject in an unconstitutional manner (for instance, by being arbitrary), but rather in the fact that one person receives it while another does not, or in the manner in which such benefit has been distributed. The same logic applies when dealing with the imposition of or exemption from a burden.
These cases are characterized by the fact that their resolution is not univocal: the treatment may be extended to all subjects, eliminated for all, or arranged in a different manner. Faced with this situation, the Court may declare the norm incompatible with the Constitution but order effects different from pure and simple annulment, as established in article 91 of the Ley de la Jurisdicción Constitucional. In particular, one possible type of judgment consists of declaring unconstitutionality but granting the body that issued the challenged norm a reasonable period of time to enact a new norm that resolves the situation.
It should be noted that this last type of judgment, however, recognizes exceptions, such as cases in which there is a violation of another constitutional right or in which there is only one valid solution. In the first case, the Court itself may restore constitutional order, since the harm to the constitutional order arises not only from the violation of the right to equality but also from another fundamental right; in the second, the gravity of the violation or its particular circumstances point to only one solution as reasonably viable. In such types of judgment, for the reasons stated, there would be no incompatibility with the principle of judicial self-restraint (autocontención) of the constitutional judge.
These explanations must be applied to the sub examine. The petitioner alleged the existence of a violation of the equality principle. In response to this claim, the majority ruling held that there was no benefit for the petitioner from the annulment of the norm, and therefore proceeded to reject the action outright. If the foregoing theory is applied, one observes that the Court merely concluded that the unconstitutionality was not found in the normative substrate, but left unaddressed the claim regarding the possible unconstitutional differentiated treatment in violation of the right to equality. Therein lies the error of the majority opinion, since the harm done to the petitioner is not limited to the failure to extend a benefit or to include the petitioner within a restriction, but lies in the fact that another party does receive the benefit while the petitioner does not. Moreover, if the sub judice were admissible, the challenged differentiation of treatment could lead to a declaration of unconstitutionality of the norm, with modulation of effects (modulación de efectos) pursuant to article 91 of the Ley de la Jurisdicción Constitucional.
Nevertheless, the majority opinion implies that the Court comes to disregard its own powers to adjust the effects of its rulings, assuming that only annulment with declaratory effects is possible, all to the procedural detriment of the petitioner." (Resolución N° 2017-010912 of 11:52 hours on July 12, 2017) The foregoing is applicable to the sub lite. Now, although I do not share the majority's reasoning, I do agree that the action must be rejected outright; however, I do so because in the written invocation of unconstitutionality cited by the petitioner—the motion for reconsideration (recurso de revocatoria) filed in the administrative proceeding (vía administrativa)—the unconstitutionality of article 8 of Ley 8904 is alleged. However, upon examining that norm, it is observed that it does not contain an article 8, as its numbering ends with numeral 4 (not counting transitional provisions).
Given the formalism that accompanies the action of unconstitutionality (acción de inconstitucionalidad) process, proper identification of the challenged norm is indispensable, and the Court cannot substitute for the activity of the parties in this respect. (…)".
Now, based on the aforementioned considerations, in the case before us, as in the precedent set forth, this action is not a reasonable means of protecting the right or interest that the petitioner claims has been violated, since the petitioner's claim is that this Court declare the unconstitutionality of the norm that exceptionally provides that, within the mining reserve area, exploitation mining concessions may only be granted to "workers duly organized in cooperatives dedicated to small-scale mining for family subsistence, artisanal purposes, or coligallero activities." Such a declaration would, in any event, not benefit the petitioner within the underlying administrative contentious proceeding (proceso contencioso administrativo), since the elimination of the possibility of granting concessions to workers' cooperatives does not have the immediate effect of granting concessions to other natural or legal persons within the mining reserve area.
On the contrary, as this Court previously noted, there is no way in which the Court could extend the benefit granted to cooperatives to other legal entities, since doing so would exceed the competences conferred upon it by the legislature, nor could it, much less, establish transitional provisions—a legislative competence—to the effect that those who were processing a permit or concession retained the right to complete the respective proceedings toward the granting of the permit or concession, as applicable, as well as the right to exploit it if granted. Ergo, given that such is the petitioner's claim, even in the hypothetical that a declaration of unconstitutionality were to give rise to the annulment of the act denying the concession in the underlying proceeding, this would not compel the Public Administration to grant the concession. Consequently, the appropriate course of action is to reject this action outright, since it does not satisfy the requirement of being a reasonable means of protecting the right alleged to have been violated in the prior proceeding.
IV.CONCLUSION.- Based on the foregoing considerations, it is ordered that this action be rejected outright. Justice Fernández Argüello dissents and orders that the action be given due course.
The parties are hereby notified that if they have submitted any paper documents, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the office within a maximum period of 30 business days counted from the notification of this judgment. DISSENTING VOTE OF JUSTICE FERNÁNDEZ ARGÜELLO With respect, I depart from the majority's view of the Court and order that the action of unconstitutionality be given due course, based on the following considerations:
It should be noted that in the base proceeding, the plaintiff does not seek to have the concession granted to it, but rather that the continuation of the administrative proceeding be ordered — an outcome that is plausibly obtainable if the substantive argument of the action regarding the alleged unconstitutionality were to be upheld. What this Chamber decides, therefore, is capable of having a direct and immediate bearing in favor of the company within the main proceeding, which is why I find that the invocation made in that matter does constitute a reasonable means of protecting the rights and interests of the plaintiff, within the meaning of Article 75.1 of the Ley de la Jurisdicción Constitucional. For that same reason, I find that the precedent cited in the majority ruling (N° 2019-024745), while similar, is not applicable to the specific case at hand. Given the specific claims that have been brought — I reiterate — the purpose of the administrative contentious proceeding that serves as its basis is not for the concession to be granted, but rather for the closure of the file to be set aside, the reason for that closure being precisely the existence of the challenged provision.
Furthermore, the majority of this Chamber, in conducting a procedural assessment on the merits of the action, concludes — in order to declare it inadmissible — that even if the action were upheld, this would not entail the creation of a right for corporations with respect to obtaining mining concessions in the areas provided for by the provision. However, to reach that conclusion, I find it indispensable to allow the case to proceed and to determine — following the extensive deliberation that normally precedes the resolution of this type of constitutional review proceeding — whether, as is now argued, the existence of the alleged unequal treatment can be ruled out, and of course, should it be found to exist, whether this Tribunal can remedy that potential unconstitutionality, as claimed by the plaintiff or by any other means available, in accordance with the broad legal powers that, in this area, the Ley de la Jurisdicción Constitucional confers upon it.

Revisión del Documento 1 *CO* Res. Nº 2021-014294 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las doce horas y cero minutos del veintitrés de junio de dos mil veintiuno.
Acción de inconstitucionalidad interpuesta por Nombre01, mayor, casado, empresario, cédula de identidad n° CED01, vecino de Alajuela, en su condición de presidente de CORPORACIÓN CEFIRO S.A., contra el párrafo sexto del artículo 8 del Código de Minería.
RESULTANDO:
Redacta el Magistrado Castillo Víquez; y,
CONSIDERANDO:
La acción de inconstitucionalidad es un proceso con determinadas formalidades, que deben ser satisfechas a los efectos de que la Sala pueda válidamente conocer el fondo de la impugnación. En ese sentido, el artículo 75 de la Ley de la Jurisdicción Constitucional, establece los presupuestos de admisibilidad de la acción de inconstitucionalidad. En primer término, se exige la existencia de un asunto previo pendiente de resolver, sea en vía judicial, o bien, en el procedimiento para agotar la vía administrativa, en que se haya invocado la inconstitucionalidad como medio razonable para amparar el derecho o interés que se considera lesionado. En el párrafo segundo y tercero, la ley establece de manera excepcional, presupuestos en los que no se exige el asunto previo, cuando por la naturaleza del asunto, no exista una lesión individual y directa, o se trate de la defensa de intereses difusos o colectivos, o bien cuando es formulada en forma directa por el Contralor General de la República, el Procurador General de la República, el Fiscal General de la República y el Defensor de los Habitantes.
II.Ahora bien, en cuanto a la exigencia de un asunto pendiente de resolver, esta Sala por sentencia n.° 1995-4190, de las 11:33 horas del 28 de julio de 1995, señaló lo siguiente:
“En primer término, se trata de un proceso de naturaleza incidental, y no de una acción directa o popular, con lo que se quiere decir que se requiere de la existencia de un asunto pendiente de resolver -sea ante los tribunales de justicia o en el procedimiento para agotar la vía administrativa- para poder acceder a la vía constitucional, pero de tal manera que, la acción constituya un medio razonable para amparar el derecho considerado lesionado en el asunto principal, de manera que lo resuelto por el Tribunal Constitucional repercuta positiva o negativamente en dicho proceso pendiente de resolver, por cuanto se manifiesta sobre la constitucionalidad de las normas que deberán ser aplicadas en dicho asunto; y únicamente por excepción es que la legislación permite el acceso directo a esta vía -presupuestos de los párrafos segundo y tercero del artículo 75 de la Ley de la Jurisdicción Constitucional.” Así las cosas, la exigencia de un asunto previo pendiente de resolver, no constituye un requisito meramente formal, toda vez, que no basta con la sola existencia de un asunto base, ni con la simple invocación de la inconstitucionalidad, pues se requiere, además, que la acción sea un medio razonable para amparar el derecho o interés que se considera lesionado.
Esto quiere decir, que es necesario que se verifique la existencia de un asunto en el que estén de por medio los derechos fundamentales de las personas y en el cual las normas impugnadas tengan una incidencia directa para la resolución del caso (ver en igual sentido las sentencias n.° 1990-1668, 1993-4085, 1994-798, 1994- 3615, 409-I-95, 1995-851, 1995-4190, y 1996-791, entre otras). Asimismo, existen otras formalidades que deben ser cumplidas, a saber, la determinación explícita de la normativa impugnada, debidamente fundamentada, con cita concreta de las normas y principios constitucionales que se consideren infringidos, la autenticación por abogado del escrito en el que se plantea la acción, la acreditación de las condiciones de legitimación (poderes y certificaciones), así como la certificación literal del escrito en el que se invocó la inconstitucionalidad de las normas en el asunto base, requisitos todos que, en caso de no ser cumplidos por el accionante, dan lugar a la inadmisión de la acción.
III.SOBRE LA INADMISIBILIDAD DE ESTA ACCIÓN.- En el caso en estudio, la parte accionante alega la inconstitucionalidad del párrafo sexto del artículo 8 del Código de Minería, en cuanto dispone lo siguiente: “(…) En el área de reserva minera, establecida en este artículo, únicamente podrán otorgarse permisos de exploración, concesiones de explotación minera y beneficio de materiales a trabajadores debidamente organizados en cooperativas dedicadas a la minería en pequeña escala para subsistencia familiar, artesanal y coligallero, según las condiciones establecidas en esta Ley y su Reglamento. (…)”. Esto porque, en criterio de la parte accionante, la norma impugnada es contraria a los artículos 33 y 34 constitucionales, toda vez que, no se permite que trabajadores independientes u organizados en otro tipo de entes colectivos, puedan ejercer libremente la explotación del área de reserva minera establecida en ese artículo, lo que estima es una diferencia de trato arbitraria y desproporcionada.
Asimismo, alega que el artículo 8 impugnado es lesivo de los derechos adquiridos de quienes se encontraban en proceso de obtener una concesión, al momento de entrar en vigencia esa norma, pues se les aplicó de manera retroactiva. Con base en lo anterior, el gestionante solicita que se declare inconstitucional el párrafo sexto del artículo 8 del Código de Minería, en tanto estima discriminatorio y lesivo de un supuesto derecho adquirido por su representada, que con base en esa disposición se le impida ser concesionaria de explotación minera. Así, como asunto base de esta acción, planteó un proceso contencioso administrativo contra el Estado, bajo el expediente n° 21-002758-127-CA, dentro del cual impugna la validez de la resolución n° R-119-2021-MINAE de las 07:25 horas del 5 de mayo de 2021 del Ministerio de Ambiente y Energía, mediante la cual se rechazó el recurso de apelación contra la decisión que denegó su solicitud de concesión de explotación minera.
Al respecto, debido a su similitud con la cuestión planteada en esta acción, resulta pertinente citar la resolución n° 2019-024745 de las 12:10 horas del 11 de diciembre de 2019, dictada dentro del expediente n° 19-018840-0007-CO, que es una acción de inconstitucionalidad interpuesta por el aquí accionante, Nombre01, en representación de MCC Mining CO S.A., contra el artículo 1°, párrafos cuarto y quinto de la Ley n° 8904 que reformó el Código de Minería. En dicha sentencia la Sala Constitucional dispuso lo siguiente:
“III.- SOBRE EL CASO CONCRETO. Luego de analizados los argumentos del actor, la Sala concluye que la acción debe ser rechazada de plano, de conformidad con las razones que se exponen a continuación. En primer lugar, en razón del objeto. El accionante estima que esas disposiciones son inconstitucionales por infringir los principios de igualdad y proporcionalidad. Señala que la norma cuestionada solamente permite otorgar concesiones para la explotación de minería metálica a las cooperativas de trabajadores dedicadas a la minería en pequeña escala. Alega que esto supone establecer un trato discriminatorio entre esta figura jurídica y otras de distinta naturaleza, pero conformadas por personas físicas, discriminación que finalmente alcanza a las personas físicas. Como bien puede deducirse de lo expuesto, la pretensión del accionante es que se declare inconstitucional la excepción que hace la norma en relación con otorgar la concesión a “cooperativas de trabajadores”, pues considera que el otorgamiento de concesiones podría hacerse, también, a favor de otro tipo de personas, sea físicas o jurídicas, sin que ello vaya en detrimento del derecho al medio ambiente sano.
Analizados los argumentos del actor, es importante destacar que este plantea una inconstitucionalidad por omisión relativa, aunque no lo hace de forma técnica ni formal. Para efectos aclaratorios, hay que tener presente que las normas infraconstitucionales que conceden un beneficio a un determinado grupo, pueden incurrir en una inconstitucionalidad por omisión relativa. Es bien sabido que este tipo de constitucionalidad tiene dos vertientes. La primera, cuando la norma legal que se dicta incumple determinados contenidos o previsiones del mandato constitucional, con lo que no se satisface las exigencias constitucionales impuestas al legislador. La segunda, se asocia con la exclusión de un determinado grupo no contemplado a la hora de legislar o dictar una norma de carácter general. En estos supuestos, se vulnera el principio de igualdad, “(…) bien porque excluye expresamente a un grupo determinado de individuos sin razón aparente, de un beneficio al que tendrían derecho o una expectativa fundada; bien, porque el enunciado al regular ese beneficio, lo hace a favor de un grupo determinado y guarda silencio sobre el resto.
Según la doctrina, puede suceder que la disposición, guarde silencio sobre la situación jurídica de otro grupo de sujetos, que debieran recibir el mismo trato, bien porque no hay motivo que permita distinguir su situación de la de otros, bien porque forman parte, como los primeros, de un mismo grupo de personas cuya situación debe ser regulada unilateralmente, por así lo ordena la Constitución. Del enunciado cabe derivar entonces una norma implícita, que regula de modo distinto en la norma explícita, la situación jurídica de este grupo de personas omitidas por el precepto, y esa diferenciación, puede ser contraria a la Constitución por vulnerar el principio de igualdad[1]”. (Véase el voto de minoría de la sentencia n.° 8763-04 de la Sala Constitucional).
Es claro entonces, que el objeto de la acción no fue correctamente planteado, pues la alegada inconstitucionalidad de las normas no es por lo que disponen, sino por lo que no regulan (al no incluirse a otras figuras jurídicas como habilitadas para solicitar una concesión), situación que cabe dentro de los supuestos de inconstitucionalidad por omisión.
IV.El segundo motivo para rechazar esta acción es que la empresa carece de legitimación, pues si bien cuenta con un asunto previo, este no es medio razonable de amparar el derecho que se considera lesionado. En el presente asunto, estamos en presencia de una norma que otorga un beneficio a un grupo de personas organizadas a través de una figura jurídica concreta: la cooperativa, para el desarrollo de una actividad concreta también: explotación de minería de pequeña escala. Al hacerlo, excluye a otros posibles beneficarios, quienes podrían organizarse a través de otras figuras legales como sociedades anónimas. No obstante, llegados a este punto es preciso notar que la eventual declaratoria con lugar de la acción, no tendría como consecuencia un resultado favorable para la empresa actora en el asunto previo. Lo resuelto en la acción, en nada la beneficiaría, pues la consecuencia de la declaratoria de inconstitucionalidad –y consiguiente anulación de la norma, nulidad que es solicitada por el propio accionante cuando en su petitoria claramente solicita que se “anulen los párrafos cuarto y quinto del artículo primero de la Ley No. 8904”-, sería que el beneficio se anule para las cooperativas de trabajadores, lo que en nada incide ni mejora la situación actual de la empresa accionante.
Recuérdese que es requisito esencial del procedimiento de la acción, dado su carácter de remedio incidental, que la eventual declaratoria de inconstitucionalidad, tenga incidencia o conexidad con el asunto principal, esto es, que sea un medio razonable para amparar el derecho o interés que se considera lesionado, pues se ha señalado reiteradamente la inexistencia de una acción popular en materia de control de constitucionalidad de las normas en nuestro derecho, siendo la regla general el carácter incidental de la acción y el acceso directo al control, la excepción (artículo 75 de la Ley de Jurisdicción Constitucional).
V.Por otra parte, debe rechazarse también, la pretensión subsidiaria del accionante, pues este Tribunal solo tiene competencias de “legislador negativo”, anulando normas, y no como legislador positivo, dictando normas legales. Así, no habría forma alguna en que la Sala pudiera extender el beneficio otorgado a las cooperativas, a otras figuras legales, pues esto excedería las competencias que el legislador le otorgó. Así entonces, cuando el actor solicita a esta Sala que “de forma subsidiaria se emita una sentencia interpretativa en donde la Sala Constitucional establezca que, en donde los párrafos cuarto y quinto del artículo primero de la Ley No. 8904 hacen referencia a “cooperativas de trabajadores”, debe entenderse también como constitucionalmente válido, el otorgamiento de concesiones a otro tipo de personas jurídicas”, en realidad le está pidiendo a la Sala que legisle, lo cual es totalmente contrario al principio de separación de funciones de nuestro sistema político, y obviamente escapa de las competencias de esta Sala. En este sentido, la Sala ha señalado:
“Si bien este Tribunal Constitucional se encuentra facultado para actuar como un legislador negativo, con la potestad de anular del ordenamiento jurídico todas aquellas normas que considere inconstitucionales, lo cierto es que se encuentra impedido para actuar como un legislador positivo creador de normas. (…) Asimismo, al ser éste un Tribunal que actúa como legislador negativo, queda claro que una eventual sentencia estimatoria, con la consecuente eliminación de la norma, no repararía la omisión indicada por el promovente, por lo que la acción planteada en esos términos, carece de utilidad y por ende es manifiestamente improcedente. Como en este caso, lo impugnado no es en sí el texto de las normas, sino aquello que -a criterio del accionante- omiten, este Tribunal no puede pronunciarse con el fin suplantar competencias de otros órganos o poderes. Bajo tales circunstancias, la acción resulta inadmisible en cuanto a este extremo”. (Voto No. 2009-12210 de las 14:40 horas del 5 de agosto del 2009) (En el mismo sentido voto No. 2018-015584 de las 12:21 hrs. del 19 de setiembre de 2018)
VI.CONCLUSIÓN.- Lo expuesto permite concluir, fácilmente, que la acción no cumple el requisito de ser medio razonable de amparar el derecho que se estima lesionado en el asunto previo, en tanto, aún si se acogiera la acción, el actor no obtendría un resultado favorable en aquel. En razón de lo expuesto, la acción resulta inadmisible por el objeto y debe ser rechazada. El Magistrado Rueda Leal da razones diferentes.
VII.Razones diferentes del Magistrado Rueda Leal. Respetuosamente, considero que la acción debió rechazarse de plano por motivos diferentes a los expuestos en la sentencia de mayoría. El voto principal parte del hecho de que la eventual declaratoria de inconstitucionalidad de la norma cuestionada no beneficiaría ni mejoraría la situación particular de la parte accionante. En casos análogos, he indicado lo siguiente:
“Tras analizar con detenimiento el punto, no puedo compartir la opinión de la mayoría porque, en el fondo, ignora la tipología de las diferentes sentencias constitucionales.
Generalmente, el control abstracto de constitucionalidad de la Sala lleva a concluir la conformidad o no de una norma con la Constitución Política. Si la norma es declarada inconstitucional, la consecuencia natural es su anulación con efectos ex tunc, toda vez que se ha constatado una contradicción entre dicha norma y el bloque de constitucionalidad, cuya potencia jerárquica expulsa a la primera del ordenamiento jurídico. En estos casos, el sustrato normativo (Normsubstanz) contiene el motivo de la inconstitucionalidad, de manera que procede su remoción, a fin de restaurar el orden constitucional.
Empero, también puede acontecer que la inconstitucionalidad no radique en el sustrato normativo en sí, sino en la relación normativa entre dos o más sujetos derivada de una violación al derecho a la igualdad. Este hecho ocurre cuando la norma lleva a un trato diferenciado o a un favorecimiento inconstitucional por lesión el citado derecho fundamental. En tal caso, el vicio de constitucionalidad no radica, verbigracia, en que cierto beneficio le sea a otorgado o denegado de modo inconstitucional (por ejemplo por ser arbitrario) a determinado sujeto, sino más en que a una persona se le dé pero a la otro no, o bien, en la forma que tal beneficio se ha venido a distribuir. Idéntica lógica aplica cuando se trata de la imposición o exención de alguna carga.
Estos casos se caracterizan porque su solución no es unívoca: el trato puede ser acordado a todos los sujetos, eliminado a todos, o dispuesto de una manera diferente. Ante este panorama, el Tribunal puede declarar la incompatibilidad de la norma con la Constitución pero disponer efectos diferentes a la anulación pura y simple, como establece el artículo 91 de la Ley de la Jurisdicción Constitucional. En particular, un tipo de sentencia posible consiste en declarar la inconstitucionalidad pero conceder a la entidad que emitió la norma cuestionada, un plazo prudencial para emitir una nueva norma que solvente la situación.
Se acota que este último tipo de sentencias, sin embargo, conoce excepciones, como los asuntos en que existe una violación a otro derecho constitucional o una única solución válida. En el primer caso, la propia Sala puede restablecer el orden constitucional toda vez que la lesión al orden constitucional no proviene solo de la afectación al derecho a la igualdad, sino también de otro derecho fundamental; en el segundo, la intensidad de la lesión o sus particulares circunstancias señalan como razonablemente viable solo cierta solución. En tales tipos de sentencia, por las razones expuestas, no se daría incompatibilidad alguna con el principio de autocontención del juez constitucional.
Estas explicaciones deben extrapolarse al sub examine. La parte accionante acusó la existencia de una lesión al principio de igualdad. Ante este reclamo, la resolución de mayoría estableció que no había beneficio para la parte actora con la anulación de la norma, por lo que procedió a rechazar de plano la acción. Si se aplica la teoría expuesta, se observa que la Sala apenas concluyó que la inconstitucionalidad no se encontraba en el sustrato normativo, pero dejó sin atender el reclamo sobre el posible trato diferenciado e inconstitucional, en violación al derecho a la igualdad. Ahí consiste el error del voto de la mayoría, toda vez que el perjuicio que se le hace al recurrente no se reduce a que no se le extienda un beneficio o se le incluya en un impedimento, sino que radica en que a otro sí se le conceda lo anterior mas a él no. Todavía más, de ser procedente el sub judice, la diferenciación de trato impugnada puede llevar a que la norma sea declarada inconstitucional, con la modulación de efectos según el artículo 91 de la Ley de la Jurisdicción Constitucional.
No obstante, el voto de mayoría implica que la Sala viene a desconocer sus propias facultades para ajustar los efectos de sus fallos, asumiendo que únicamente es posible la anulación con efectos declarativos, todo en perjuicio procesal de la parte accionante.” (Resolución N° 2017-010912 de las 11:52 horas del 12 de julio de 2017) Lo anterior es aplicable al sub lite. Ahora, aunque no comparto los razonamientos de la mayoría, sí coincido en que la acción debe ser rechazada de plano; sin embargo, lo hago porque en el escrito de invocación de inconstitucionalidad citado por el accionante –el recurso de revocatoria planteado en la vía administrativa– se reclama la inconstitucionalidad del artículo 8 de la Ley 8904. Empero, al acudir a esa norma, se observa que ella no contiene un artículo 8, pues su numeración concluye con el ordinal 4 (sin contar la normativa transitoria). Dado el formalismo que acompaña al proceso de acción de inconstitucionalidad es imprescindible la adecuada identificación de la norma que se cuestiona, sin que la Sala pueda suplir la actividad de las partes en este respecto. (…)”.
Ahora bien, con base en las consideraciones precitadas, en el caso que nos ocupa, al igual que en el antecedente expuesto, esta acción no es un medio razonable de amparar el derecho o interés que la parte actora estima lesionado, pues, su pretensión es que esta Sala declare la inconstitucionalidad de la norma que dispone excepcionalmente que en el área de reserva minera únicamente podrán otorgarse concesiones de explotación minera a “trabajadores debidamente organizados en cooperativas dedicadas a la minería en pequeña escala para subsistencia familiar, artesanal o coligallero”. Declaratoria que, en todo caso, en nada beneficiaría al actor dentro del proceso contencioso administrativo base, pues que se elimine la posibilidad de concesión para las cooperativas de trabajadores no tiene como efecto inmediato que se concedan concesiones a las demás personas físicas o jurídicas en el área de reserva minera.
Por el contrario, como lo señaló anteriormente este Tribunal, no habría forma alguna en que la Sala pudiera extender el beneficio otorgado a las cooperativas, a otras figuras legales, pues esto excedería las competencias que el legislador le otorgó, ni muchos menos establecer una normativa transitoria -competencia del legislador-, en el sentido de que quienes se encontraban tramitando un permiso o una concesión conservaban el derecho de terminar los trámites respectivos tendentes al otorgamiento del permiso o de la concesión en su caso, así como el derecho de explotarlo si fuere concedido. Ergo, siendo la pretensión del accionante la referida, aun y cuando, en el hipotético de que la declaratoria de inconstitucionalidad diera pie a anular el acto denegatorio de la concesión en el juicio base, ello no obligaría a la Administración Pública a otorgar la concesión. En consecuencia, lo procedente es rechazar de plano esta acción, toda vez que no cumple con el requisito de ser un medio razonable de amparar el derecho que se estima lesionado en el asunto previo.
IV.CONCLUSIÓN.- Con base en las consideraciones anteriores, se dispone rechazar de plano esta acción. El magistrado Fernández Argüello salva el voto y ordena dar curso a la acción.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se rechaza de plano esta acción. El magistrado Fernández Argüello salva el voto y ordena dar curso a la acción.

VOTO SALVADO DEL MAGISTRADO FERNÁNDEZ ARGÜELLO Respetuosamente, me separo del criterio de la mayoría del Tribunal y ordeno dar curso a la acción de inconstitucionalidad, con base en las siguientes consideraciones:
Nótese, en el proceso base, la actora no pide que se le otorgue la concesión, sino que se ordene la continuación del trámite administrativo, y ello es de plausible obtención, si se llegara a acoger la tesis de fondo de la acción, sobre la inconstitucionalidad reclamada. Lo que se decida, entonces, por parte de esta Sala, sí es susceptible de incidir en forma directa e inmediata, en favor de la empresa, dentro del proceso principal, razón por la cual, estimo que la invocación efectuada en ese asunto, sí constituye medio razonable de amparar los derechos e intereses de la parte actora, en los términos del numeral 75.1 de la Ley de la Jurisdicción Constitucional. Por esa misma razón, estimo que el antecedente jurisprudencial que se cita en el voto de la mayoría (N° 2019-024745), aunque similar, no es aplicable al caso concreto. Por las concretas pretensiones formuladas, se insiste, la finalidad del contencioso administrativo que le sirve de base, no es, que se otorgue la concesión, sino que se deje sin efecto el archivo del expediente que se decretó y cuyo motivo es, justamente, la existencia de la norma cuestionada.- Además, la mayoría de la Sala, haciendo un juicio de procedibilidad sobre el fondo de la acción, concluye -para declararla inadmisible-, que aún de acogerse ésta, ello no implicaría la constitución de un derecho para las sociedades anónimas, en punto a la obtención de concesiones mineras en las zonas que prevé la norma; empero, para arribar a esa conclusión, estimo indispensable dar curso al proceso y determinar, luego de la amplia discusión que precede normalmente la resolución de este tipo de procesos de control constitucionalidad, si como ahora se aduce, cabe descartar o no la existencia del trato desigual acusado y desde luego, en caso de existir, si este Tribunal puede solventar esa eventual inconstitucionalidad, según lo reclamado por la actora o bien, por cualesquiera otros medios, conforme a las amplias potestades legales que, en esta materia, le otorga la Ley de la Jurisdicción Constitucional.
