San José, at nine twenty a.m. on dieciseis de julio de dos mil veintiuno.

Amparo proceeding filed by KURT THOMAS HOCKER, residence identification card 184000070233, against the MUNICIPALIDAD DE QUEPOS, SECRETARÍA TÉCNICA NACIONAL AMBIENTAL (SETENA), and SHIMANU S.A.

Background:

  1. 1By a written submission received by the Secretariat of the Chamber at 12:59 on 22 de junio de 2021, the petitioner files an amparo proceeding on behalf of Shimanu S.A. against the Secretaría Técnica Ambiental (SETENA) and the Municipalidad de Quepos. He states that, since octubre del 2020, he has sought an order from the municipality halting the construction project owned by the company known as 3-102-633985 SRL, which is being built in Manuel Antonio de Quepos, behind the Plaza Vista 1, Plaza Vista 2, and Emilio's Restaurant buildings, all owned by the same company and constructed on the same property, because that construction project is encroaching upon the public road and narrowing the right-of-way (derecho de vía), and because it is being built partially on the 25% portion of its Puntarenas property number 00219804-000 that the owners must reserve for gardens and green areas, thereby mitigating the use of the maximum 75% site coverage occupied by the aforementioned buildings and allowing that area to serve as the property's green lung, thus preventing the community and the entire country from being turned into a gloomy expanse of gray construction.He maintains that the construction project does not have the location permits issued by the Ministerio de Salud, nor does it possess the construction plans that should have been prepared for the construction of the corresponding treatment plant that it undertook to build when obtaining environmental feasibility approval (viabilidad ambiental) from SETENA. He mentions that there is a latent risk that the development company may ultimately pollute the environment by failing to construct the treatment plant it undertook to build, such that the sewage could create a source of infection posing an evident risk to public health. He adds that the Municipalidad de Quepos has ignored the series of complaints filed. SETENA, for its part, rejected the complaint filed by the company he represents, and the appeal lodged against that rejection was dismissed, on the grounds that the reported facts do not fall within its jurisdiction but instead come under the jurisdiction of the Municipalidad de Quepos, the Instituto Costarricense de Acueductos y Alcantarillados, and the Ministerio de Salud.He disagrees and asserts that the environmental feasibility approval granted to that company has not been implemented by its representatives; furthermore, neither the Municipalidad de Quepos nor SETENA took care to oversee compliance with it, much less sanction the company's omissions and actions. He states that, on 12 de mayo de 2021, the Municipalidad de Quepos, through inspections conducted at the construction project, determined that the company was building 242.2 square meters beyond what was authorized by the building permit, but the municipal inspector merely gave the reported company a deadline to bring itself into compliance with the law. He believes that, given the seriousness of the reported facts, the logical course would be to order the corresponding precautionary measures (medidas cautelares), direct that the construction project be halted, and order the necessary expert examinations (pericias) to enforce the right-of-way and, consequently, require that company to move its construction beyond the boundaries of that right-of-way.Likewise, with respect to the 25% that must be reserved for gardens and green areas, the company should be required to move its construction outside that 25% portion of the land dedicated to purposes other than construction and be allowed to complete its project on the portion of the land that it may legally develop, without this impairing its constitutional right to private property, since the owner company will always retain ownership of its entire property; it simply may not build on that 25% portion of its property or on the public road. He requests the following precautionary measure: “That the Municipalidad de Quepos be ordered to halt the aforementioned construction immediately, even with the assistance of the Fuerza Pública, and to conduct the expert examinations necessary to determine the percentage of the encroached-upon land that corresponds to the public road. To carry out the foregoing measures, I request that a Judge from one of the Judicial Offices of Cantón de Quepos be commissioned, because the local government, through certain officials, has devoted itself to accepting gratuities in exchange for favors, particularly the Departamento de Ingeniería y Control Urbano, which is responsible for granting building permits.Likewise, I request that an expert examination be ordered regarding the 25% portion of the land that must be reserved for green areas and gardens, for the purpose of determining the area within that percentage that has been encroached upon by the reported construction project, since that area is vital to environmental protection and, consequently, to protecting the rights to health and life, as these rights cannot coexist in the absence of a healthy and ecologically balanced environment. Once the encroachment upon both the public road and the aforementioned 25% portion of the land, as well as the failure to comply with the setbacks (retiros), has been determined.” Finally, he requests that “the respondent authorities be ordered to direct the development company to move the reported construction project outside the 25% reserved for gardens and green areas, outside the public road, and outside the areas corresponding to the front setbacks.Honorable Justices, because of the constant and ongoing acts of corruption by municipal officials, not only involving this developer but also dozens of developers who have made the Quepos and Manuel Antonio area their home or place of business, I respectfully request that, if legally possible, the requested expert examinations be conducted by experts from the Judiciary. If this Honorable Chamber does not consider it appropriate to grant that request, I ask that those expert examinations be ordered to be conducted together with the private experts whom the undersigned petitioner will bring to the construction project at the time and date specified by the respondent authorities, at my own expense, because I fear that, after this entire legal odyssey, they will misrepresent the expert reports and reach conclusions contrary to what is actually evident at the site.”
  2. 2By a decision issued at 10:38 on 25 de junio de 2021, the petitioner was ordered to cure the deficiencies in his filing (prevención) by stating “the dates on which he filed each of the complaints at issue and the authorities before which he initiated them. He must provide complete, legible copies of those complaints, together with the corresponding proof of receipt or transmission, and, if he received any response, he must state the outcome of each complaint and submit the documentation generated in connection with those proceedings; if no response was received, he must also clarify which of those submissions went unanswered. The foregoing is required because that information is essential for rendering the decision required by law, with the warning that the proceeding will be summarily dismissed if he fails to comply.”
  3. 3In a written submission added to the Chamber’s digital case file at 12:52 hours on June 29, 2021, the petitioner states that the complaint before the Secretaría Técnica Nacional Ambiental was filed with that agency on February 1, 2021; however, it was rejected by a resolution issued by that Secretariat at 10:00 hours on March 24, 2021. His client challenged that resolution by filing the corresponding appeal (recurso de apelación) on April 8, 2021, which was denied by a resolution issued by that Secretariat at 9:30 hours on June 16, 2021. His client then challenged that resolution through the corresponding motion for reconsideration (recurso de revocatoria), filed on June 22, 2021. He states that, one day before filing the amparo proceeding (recurso de amparo), he attempted to obtain a copy of the administrative case file (expediente administrativo) from SETENA in order to submit it to the Chamber, but the request was denied.With regard to the Municipalidad de Quepos, the complaints were filed simultaneously with the Departamento de Ingeniería y Control urbano and the Alcaldía Municipal on October 21, 2020. Although he received official letter number MQ-DICU-476-2020 in response to the complaint filed with the Departamento de Ingeniería y Control Urbano de la Municipalidad de Quepos on October 21, 2020, that department did not address any of the reported facts or take any action aimed at ascertaining the substantive truth (verdad real) of those facts or at halting the process as an interim measure (medida provisional). Because the municipal engineer failed to address the reported facts, he reiterated the complaint on November 13, 2020. Thus, by official letter number MQ-DICU-509-2020, the Departamento de Ingeniería responded to the reiterated complaint without resolving the situation described. He adds that, since October 21, 2020, when the complaints were filed with the Alcaldía Municipal and the Departamento de Ingeniería, the heads of those offices took no action aimed at investigating the reported matters or conducting the corresponding expert examinations (pericias), until March 10, 2021, when the Departamento de Ingeniería sent him official letter MQ-DlCU-057- 2021 by email, informing him that within a reasonable period they would provide him with the report concerning the reported facts—that is, regarding the 25% of the land on which the development company is erecting its construction project—while omitting any reference to the report on the encroachment upon the public roadway.Therefore, since October 21, 2020, when the complaints were filed simultaneously with the Alcaldía Municipal and the Departamento de Ingeniería, the Municipalidad de Quepos has not conducted the minimum required expert examinations to verify the encroachment upon 25% of the land, the encroachment upon the adjacent public roadway, or the failure to comply with the legally required setbacks (retiros de ley). Moreover, since March 10, 2021, when the aforementioned official letter was sent to him assuring that the respective reports would be prepared and delivered, his counsel has not received any report, expert opinion (peritaje), or other information to that effect, even though nearly 4 months have elapsed since that date, (March 10, 2021). He states that the very resolution concerning potable-water availability, issued by the local AyA office in Quepos on July 24, 2019 in favor of the development company, determined that “as a result of the basic studies and the technical report contained in the official letter, the following was determined: Water availability for remodeling is approved. no new service is approved.The property has 3 services; no additional services will be provided”; in other words, the property where the reported construction project is being erected cannot be granted any additional potable-water availability because it already has 3 potable-water services. This problem, together with the development company’s urgent need to obtain the municipal building permit (permiso de construcción), prompted the engineer in charge of the project, Shelem Rebeca Castro Vásquez, possibly to commit an offense under the Ley Contra la Corrupción y el Enriquecimiento Ilícito en la Función Pública, because, taking advantage of her friendship with the chief official of the local AyA office, she lied or provided false information to obtain potable-water availability for remodeling, when in fact they are erecting a large building, favoring a purely private interest over the interests of the hundreds of residents of the Manuel Antonio area who are now suffering from a lack of that precious resource.He argues that he received no response from the Alcaldía Municipal and that, from the Departamento de Ingeniería y Control Urbano, he received the written submissions attached hereto, which reveal a mocking attitude on the official’s part, including urging him to call the Policía de Tránsito regarding the public-roadway issue, when in fact encroachment upon the public roadway falls entirely within the purview of the respondent municipality; nevertheless, neither the engineer in charge of the Departamento de Ingeniería nor the mayor took any action to put an end to the reported conduct. He disagrees with the engineer’s decision and complains that, instead of immediately forwarding the challenge to the next-higher authority, in this case the mayor, the engineer decided it himself, usurping powers that belonged solely to the mayor. Moreover, although on January 11, 2021 he submitted a request to the mayor asking him to decide the appeal filed against official letter number MQDICU- 509-2020 of the Departamento de Ingeniería Municipal, 6 months later the mayor has still not decided that appeal.With respect to the evidence submitted, he asserts that “I submit to the case record the documentation whose absence was noted by this Honorable Constitutional Chamber, consisting of the following. The complaint filed with the Alcaldía Municipal de Quepos, bearing a receipt date of October 21, 2020, to which no response was provided. The complaint filed with the Departamento de Ingeniería Municipal on October 21, 2020 is not submitted because it is already included in the case file. The response issued by the Departamento de Ingeniería Municipal concerning that complaint is submitted. The complaint filed with SETENA on February 01, 2021 is submitted. The appeal filed with SETENA is not submitted for the reasons explained supra. The motion for reconsideration filed with SETENA on June 21, 2021 is not submitted because it is already included in the case file. A copy of the reiterated complaint filed with the Departamento de Ingeniería Municipal on November 13, 2020 is submitted.The written submission issued by the Ingeniero Municipal regarding that reiterated complaint is likewise submitted. The appeal filed against official letter number MQ-DICU-509-2020 of the Departamento de Ingeniería Municipal is submitted; that appeal was never forwarded to the Alcalde Municipal for appellate review. Also submitted is the request addressed to the Alcalde Municipal on January 11, 2021, seeking a decision on the appeal filed against official letter number MQ-DICU-509-2020 of the Departamento de Ingeniería Municipal, which to date remains undecided. A new complaint filed on November 11, 2020, requesting that the construction project be halted, is submitted; it produced no favorable results. An email sent by the Departamento de Ingeniería Municipal to my email address is submitted, through which that department informed me that it would very soon provide me with the report concerning the maximum site coverage (cobertura máxima) used by the development company; that report was never provided, even though nearly 4 months have elapsed since the email was sent.A request dated June 21, 2020, addressed to the Departamento de Ingeniería Municipal and seeking copies of the administrative case file relating to the development company represented by Mr. ELI DAYAN, is submitted. The response to that request is submitted, in which the Ingeniero Municipal, seeking every possible excuse to avoid providing me with a copy of the aforementioned case file, claims that there is no copy of a building permit in the name of ELI DAYAN. This demonstrates once again his collusion with that individual, because he knows Mr. ELI DAYAN very well and took advantage of the fact that the undersigned requested a copy of that permit in the name of Mr. ELI DAYAN or the company he represents, since at that time I did not know whether the permit was held personally in that gentleman’s name or in the name of a company. AyA requirements forms for obtaining the corresponding Potable-Water Availability are submitted, demonstrating the evasion of law (fraude de ley) committed by both the engineer in charge of the project and the Ingeniero Municipal, because the engineer in charge of the project applied for that potable-water availability to remodel commercial premises, when in fact it was intended for the construction of a 540-square-meter, 2-story building; and the Ingeniero Municipal, despite being aware of that evasion of law, nevertheless granted the building permit, notwithstanding its illegality.”
  4. 4In a written submission added to the Chamber’s digital case file at 12:39 hours on July 1, 2021, the appellant states: “Because my client’s condominiums are located adjacent to the land owned by the development company where the 540-square-meter, 2-story building is being erected, I am a direct witness to the disregard for the maximum lot coverage authorized by law, the encroachment upon the public roadway, and the failure to comply with the legally required setbacks (retiros). All of this is likewise known to the municipal officials, who have appeared at the site to conduct inspections, but that is all they amount to, mere inspections, as evidenced by the inspection report and photographs submitted with the amparo proceeding (recurso de amparo) filed before this Honorable Constitutional Chamber on June 22, 2021, during which the municipal official detected an increase of 242 additional square meters in the construction project without the corresponding municipal permit, according to the municipal report prepared by the municipal inspector; however, as can be seen, there were (sic) no repercussions in that regard.” He argues that the officials were not authorized to omit the corresponding penalties for the violations found.He reiterates what he previously stated. He asks “what (sic) is the Municipality doing in this matter to comply with the constitutional mandate to safeguard the rights and interests of the inhabitants of its canton? It is obvious that it is neglecting the obligations imposed upon it by operation of law (Article 87 of the Construction Law), since it is obvious that it is not fulfilling its supervisory duties with respect to the works being erected within its jurisdiction, nor is it ensuring faithful compliance with the provisions of that law. The second question is why SETENA, as the entity responsible for environmental policy and for monitoring compliance with the obligations undertaken by developers in their environmental feasibility approvals (Viabilidades Ambientales), has turned a blind eye to all the violations brought to its attention. While it is true that the National Environmental Technical Secretariat cannot be everywhere or extend the arm of the law throughout the entire country, it is also true that, when a citizen brings all these violations to its attention through a complaint—circumstances that the Secretariat itself does not dispute—the proper course was to act immediately; and if its senior officials considered that the reported facts did not fall within its jurisdiction, they should have used their good offices and coordinated institutionally with the Municipalidad de Quepos, Ministerio de Salud, and Ministerio del Ambiente to achieve a comprehensive solution for the benefit of the environment and our right-of-way.” He asks the Chamber to examine Puntarenas survey plan number 1946207-2017, corresponding to the land owned by the development company, Puntarenas property number 00219804-000, where the irregular construction project is being erected, in order to determine “the encroachment both upon the 25% of the land that must be reserved for purposes other than construction and upon the public roadway, as well as the failure to comply with the legally required setbacks.”
  5. 5Article 9 of the Constitutional Jurisdiction Law empowers the Chamber to summarily dismiss, on procedural grounds or on the merits, at any time, including upon filing, any application submitted for its consideration that is manifestly inadmissible, or when it determines that sufficient grounds exist to dismiss it, or that it merely reiterates or reproduces an identical or similar prior application that was dismissed.

Justice Esquivel Rodríguez drafts the opinion; and,

Whereas:

I. SUBJECT MATTER OF THE PROCEEDING

The appellant alleges that the company named 3-102-633985 is constructing a project and encroaching upon a public road, as well as upon the 25% of the land that must be reserved for gardens and green areas. He asserts that it does not have permits from the Ministerio de Salud, nor does it possess the construction plans that it was required to prepare for the construction of the corresponding treatment plant it undertook to build when obtaining environmental feasibility (viabilidad ambiental) from SETENA. He adds that the Municipalidad de Quepos has disregarded the series of complaints filed and, furthermore, has failed to respond. SETENA, for its part, rejected the complaint filed by his client, and the appeal lodged against that rejection was denied on the ground that the reported facts did not fall within its jurisdiction but instead concerned the Municipalidad de Quepos, Instituto Costarricense de Acueductos y Alcantarillados, and Ministerio de Salud. He disagrees. Finally, he complains that access to the administrative file was denied.

II. THE SPECIFIC CASE

In this case, it is observed that, in the initiating submission, the relief expressly sought by the protected party was as follows:

“That the Municipalidad de Quepos be ordered to immediately halt the aforementioned construction, even with the assistance of the Fuerza Pública, and to conduct such expert examinations as may be necessary to determine the percentage of encroached land corresponding to the public roadway. To carry out the foregoing measures, I request that a judge from one of the Judicial Offices of the Cantón de Quepos be commissioned, because the local government, through certain officials, has devoted itself to accepting bribes (sic) in exchange for favors, especially the Departamento de Ingeniería y Control Urbano, which is responsible for issuing construction permits. Likewise, I request that an expert examination be ordered regarding the 25% of the land that must be reserved for green areas and gardens, for the purpose of determining the area within that percentage that has been encroached upon by the reported construction project, since that area is vital to environmental protection and, consequently, to protecting the rights to health and life, because those rights cannot coexist in the absence of a healthy and ecologically balanced environment.

Once the encroachment upon both the public roadway and the aforementioned 25% of the land, as well as the failure to comply with the setbacks, has been determined.” Finally, he asks that “the respondent authorities be ordered to require the development company to relocate the reported construction project outside the 25% reserved for gardens and green areas, outside the public roadway, and outside the areas corresponding to the front setbacks. Honorable Justices, because of the constant and ongoing acts of corruption by municipal officials, not only involving this developer but dozens of others who have made the Quepos and Manuel Antonio area their home or place of business, I respectfully request that the requested expert examinations, if legally possible, be conducted by judicial experts. If this Honorable Chamber does not consider it appropriate to grant that request, I ask that the examinations be ordered to be conducted together with the private experts whom the undersigned appellant will bring to the construction project at the time and date specified by the respondent authorities, at my expense, because I fear that, after this entire legal ordeal, they will misrepresent the expert findings and reach conclusions different from what is actually evident at the site.” In view of the foregoing, it is apparent that the relief sought by the appellant amounts to nothing more than a dispute concerning ordinary legality, which does not involve, at least directly, any fundamental right and therefore exceeds the jurisdiction of this Chamber.

Indeed, this Court is neither a supervisory body for legality nor an additional level of administrative review; accordingly, it is not for this Court to determine, under the applicable regulatory framework, the factual circumstances and technical criteria concerning whether the respondent company is building upon the 25% of the land that must be reserved for gardens and green areas or whether there is any encroachment upon the public roadway. Consequently, it is not within this Court’s purview to order an expert examination to verify or disprove that situation. Nor is it for this Court to decide whether public officials have committed the offense of corruption or any other offense, whether the reported company lacks construction permits, or whether the works must be halted. This Chamber is certainly not a forum for processing complaints, and it is therefore improper for the protected party to come directly before this Court to raise such claims. Those matters must be brought before the Administration, as he states he has been doing, or, where appropriate, before the ordinary courts.

Notwithstanding the foregoing, this Chamber could assess a failure to issue a final decision on a complaint relating to the right to the environment or to physical integrity. Therefore, in order to rule out that possibility, by a Presidency decision issued at 10:38 hours on June 25, 2021, the appellant was ordered to specify “the dates on which he filed each of the complaints at issue and the authorities before which he initiated them. He must provide complete and legible copies of those complaints, together with the corresponding proof of receipt or transmission, and, if he received any response, must state the outcome of each complaint and submit the documentation generated in connection with those proceedings; if not, he must also clarify which of those applications received no response. This is required because such information is essential to render the legally appropriate decision, with the warning that the proceeding will be summarily dismissed if he fails to do so.” Having reviewed the applicant’s response, the following is observed:

  • a)On February 1, 2021, the protected party filed a complaint with SETENA, which was decided on March 24, 2021. The protected party then appealed that decision, and the appeal was denied on June 16, 2021. In addition, more recently, on June 22, 2021, the petitioner filed a motion for reconsideration (recurso de revocatoria) against that decision. Accordingly, as regards SETENA, it may be inferred that the claim concerns disagreement with the decision rather than a failure to issue a decision. It is therefore improper to admit this claim, since such disagreements must be litigated through ordinary proceedings.
  • b)On October 21, 2021, the petitioner simultaneously filed two complaints with the Departamento de Ingeniería y Control Urbano and the Alcaldía Municipal.

b.1) Regarding the complaint filed with the Departamento de Ingeniería y Control Urbano (in which, in addition to alleging violations of subconstitutional regulations relating to the level of construction and other matters, the protected party alleged, for purposes of constitutional relevance, that “with the construction materials and material-hauling equipment, the person I have reported obstructs the free movement of vehicles and poses a danger to pedestrians traveling along that roadway to their places of employment”), the protected party himself states that he received a response through official letter MQ-DICU-476-2020, with which he disagrees because “it did not answer anything concerning the reported facts, nor did it take any action aimed at determining the true facts reported or at halting the process, even as a provisional measure.” Because he disagreed, the applicant states that he reiterated the complaint on November 13, 2020, and received a response through official letter MQ-DICU-509-2020, with which he also disagrees. In this respect, the foregoing discussion applies: disagreements with a response cannot be reviewed by this Court.

It also follows that, on November 19, 2020, the appellant appealed the latter official letter (MQ-DICU-509-2020); however, according to him, that filing has neither been answered by the Department of Engineering and Urban Control nor forwarded to the hierarchical superior. Nevertheless, the record shows that the appeal (recurso de apelación) was answered by official letter MQ-DICU-527-2020 of November 26, 2020. Accordingly, the claim also concerns disagreement with the decision rendered.

Furthermore, the protected party (amparado) alleges that on January 11, 202, he filed a written submission with the Mayor stating that: “Since November 19, 2020, I have filed with the Department of Engineering and Urban Control of this Municipality a formal appeal against official letter number MQ-DICU-509-2020; however, as of the date this submission was filed, that appeal has not yet been decided or notified, and I therefore request that said appeal be decided and notice thereof provided.” However, as explained above, that appeal had already been decided on November 26, 2020. Thus, the statements of the protected party (tutelado) and the evidence submitted demonstrate that the purpose of this claim is to have the mayor, rather than the aforementioned department, decide that appeal. He is advised, however, that this Chamber does not oversee the legality of the Administration’s actions or decisions; consequently, this Court lacks jurisdiction to determine, in this specific case, which administrative remedies (recursos administrativos) are or are not available under the applicable rules of law and, on that basis, to decide, pursuant to subconstitutional legislation (normativa infraconstitucional), whether that appeal should have been forwarded to the Mayor’s Office.

The evidence submitted also shows that, on March 10, 2021, the Department of Engineering and Urban Control sent the protected party an email stating that: “in connection with the complaint concerning the coverage of the cor (sic). The resc report (sic) will be delivered within a reasonable period of time.” In this regard, the protected party alleges that this report concerns construction on 25% of the land, but not the encroachment upon the public roadway. It follows that the alleged failure to deliver it does not concern a matter of constitutional significance, but rather compliance with subconstitutional legislation governing which area may be developed and which must be reserved for gardens. Therefore, that failure to deliver is likewise not admissible for consideration by this Court, as clarified above.

b.2) Furthermore, with respect to the complaint filed with the Mayor’s Office, also on October 21, 2020, to which a failure to respond is alleged, although the appellant submitted it as evidence, he did so without a receipt stamp. The prior order to cure (prevención) is therefore deemed not to have been complied with, and it is consequently improper to admit this claim.

  • c)Furthermore, regarding the alleged denial of access to the aforementioned case file (expediente), it follows that, recently, in judgment 2021-002222 at 9:15 a.m. on February 5, 2021, an amparo proceeding (amparo) brought by the same appellant concerning the issue raised here was adjudicated as follows:

I. SUBJECT MATTER OF THE APPLICATION

The appellant alleges that, on October 21, 2020, he filed a complaint with the respondent municipality and, at the same time, requested a copy of an administrative case file (expediente administrativo). He asserts that, despite having reiterated his request, as of the date this application was filed, his submission had not been addressed, and he therefore considers his fundamental rights to have been violated. (…)

III. MERITS

In the present case, on October 21, 2020, the appellant requested a copy of an administrative case file concerning the building permits granted for a property where, in his view, construction work was being performed unlawfully. Nevertheless, he alleges that, as of the date this application was filed, the requested material had not been provided to him, and he therefore considers his fundamental rights to have been violated.

The respondent authority, in its report submitted under oath, states that through official letter N° MQ-DICU-477-2020, served on the protected party on October 30, 2020, he was informed that there were no building permits on record in the name of Mr. Elie Dayan and, therefore, that they had no administrative case file. Likewise, because of the complaint filed by the appellant, they conducted an on-site inspection (inspección de campo) on November 20, 2020, of the property where the construction work had been reported. During that proceeding, it was determined that construction work was being performed without building permits; consequently, administrative case file N° T-PC-253-10-2020 was opened so that the property owner could bring the construction work into legal compliance. Subsequently, through official letter N° MQ-DICU-551-2020, dated December 28, 2020, the Department of Engineering and Urban Control of the Municipalidad de Quepos made the requested information available to the protected party, stating that: “(…) some of the information contained in that case file is confidential and, because neither you nor your principal is an active party to this proceeding, this type of information cannot be sent to you (…)”.

In this regard, this Court considers that the protected party’s fundamental rights were indeed violated, because it has not been established that the information he requested was delivered. This Court observes that, following service of the decision admitting the present proceeding, the respondent authorities, through official letter N° MQ-DICU-551-2020, dated December 28, 2020, made the requested information available to the protected party. Nevertheless, there is no certainty that it was actually provided or that it will be delivered to the appellant within a reasonable period, considering that the request was submitted on October 21, 2020.

Furthermore, it should be noted that although, in observance of the right to informational self-determination (autodeterminación informativa), derived from Article 24 of the Constitución Política, and pursuant to the Ley de Protección de la Persona frente al Tratamiento de sus Datos Personales, the respondent authority is required to protect its employees’ data, that circumstance cannot serve as justification for denying members of the public access to public information, since the Administration is also required to comply with Article 30 of the Constitución Política, which guarantees free access to data of a public nature.

In view of the foregoing considerations, the application must be granted, on the terms set forth in the operative part (parte dispositiva) of this judgment. (…)

OPERATIVE PROVISIONS (POR TANTO):

The application is granted and, consequently, Jong Kwan Kim Jin and Alfonso Moreno Navarro, respectively Municipal Mayor and Acting Head of the Construction Development Unit, both of the Municipalidad de Quepos, or whoever holds those offices in their stead, are ordered, within TEN DAYS from service of this Judgment, to deliver to the protected party what was requested in the submission filed on October 21, 2020, excluding any personal or sensitive information contained in that documentation, as provided in Ley N° 8968, “Protección de Datos de la Persona frente al Tratamiento de sus Datos Personales,” or other applicable legislation. The respondent authority is warned that, pursuant to and in accordance with Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that the person must comply with or cause to be complied with, and who fails to comply with or cause compliance with it, shall be subject to imprisonment for three months to two years, or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.

The Municipalidad de Quepos is ordered to pay the costs and the damages and losses caused by the facts underlying this ruling, which shall be assessed during enforcement proceedings before the contentious-administrative jurisdiction (ejecución de sentencia de lo contencioso administrativo). Let notice be given.-” Accordingly, if the protected party considers that this judgment has not been complied with, he must raise that allegation in that case file (20-023319-0007-CO), so that the appropriate decision under the law may be rendered.

  • d)Finally, any disagreements the protected party may have regarding the manner in which the company obtained confirmation of potable-water availability must likewise be pursued through ordinary legal channels (vías de legalidad ordinaria), rather than before this Chamber, because, as stated previously, the Chamber is not a forum for processing complaints.

As a corollary to the foregoing, the application is declared inadmissible.

III. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these must be collected from the Court Clerk’s Office within a maximum period of 30 business days from service of this judgment. Otherwise, any materials not collected within that period shall be destroyed, as provided in the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court (Corte Plena) at session N° 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as in the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on May 3, 2012, Article LXXXI.

Therefore (Por tanto):

The application is dismissed on the merits.

PROCESO: RECURSO DE AMPARO RESOLUCIÓN Nº 2021016032 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del dieciseis de julio de dos mil veintiuno .

Recurso de amparo interpuesto por KURT THOMAS HOCKER, cédula de residencia 184000070233, contra la MUNICIPALIDAD DE QUEPOS, SECRETARÍA TÉCNICA NACIONAL AMBIENTAL (SETENA) y SHIMANU S.A..

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 12:59 horas del 22 de junio de 2021, el recurrente interpone recurso de amparo a favor de Shimanu S.A., contra la Secretaría Técnica Ambiental (SETENA) y la Municipalidad de Quepos. Indica que desde octubre del 2020 ha gestionado ante la municipalidad la paralización del proyecto constructivo propiedad de la empresa denominada 3-102-633985 SRL, que se levanta en Manuel Antonio de Quepos, detrás de los edificios Plaza Vista 1, Plaza Vista 2, y Emilio's Restaurant, todos propiedad de la misma empresa y construidos en la misma finca, en virtud de que ese proyecto constructivo está invadiendo la calle pública y estrechando el derecho de vía, y porque se está construyendo parcialmente en el 25% de su terreno finca de Puntarenas número 00219804-000, que es el porcentaje que los propietarios deben reservar para jardines y zonas verdes y así paliar el uso del 75% de cobertura máxima que ocupan los edificios mencionados supra, y que funcione como pulmón de esa propiedad y así evitar convertir la comunidad y al país entero en un lúgubre lugar de obras grises.Sostiene que el proyecto constructivo no cuenta con los permisos de ubicación expedidos por el Ministerio de Salud ni está en posesión de los planos constructivos que debió haber elaborado para la construcción de la respectiva planta de tratamiento a la que se comprometió al suscribir la viabilidad ambiental ante la SETENA. Menciona que existe un riesgo latente de que la empresa desarrolladora eventualmente contamine el medio ambiente por la omisión de construir la planta de tratamiento a la que se comprometió, de modo que las aguas negras podrían generar un foco de infección con evidente riesgo para la salud pública. Añade que la Municipalidad de Quepos ha hecho caso omiso a la serie de reclamos presentados. Por su parte, SETENA rechazó la denuncia interpuesta por su representada y la apelación formulada en contra de ese rechazo fue declarada sin lugar, con el argumento de que los hechos denunciados no son de resorte de su competencia, sino que corresponden a la Municipalidad de Quepos, al Instituto Costarricense de Acueductos y Alcantarillados y al Ministerio de Salud.Discrepa de ello y asegura que la viabilidad ambiental otorgada a esa empresa no ha sido ejecutada por sus personeros; además, ni la Municipalidad de Quepos ni SETENA se preocuparon por fiscalizarlas ni mucho menos sancionar las omisiones y acciones de esa empresa. Comenta que, el 12 de mayo de 2021, la Municipalidad de Quepos, por medio inspecciones realizadas en el proyecto constructivo, determinó que la empresa está construyendo 242.2 metros cuadrados más allá de lo autorizado por el permiso de construcción, pero el inspector municipal solo le otorgó plazo a la empresa denunciada para ajustarse a derecho. Estima que, ante la gravedad de los hechos denunciados, lo lógico sería decretar las respectivas medidas cautelares y ordenar paralizar el proyecto constructivo y disponer la ejecución de las pericias correspondientes para hacer respetar el derecho de vía y, por ende, obligar a esa empresa a correr su construcción fuera de los límites de ese derecho de vía.Incluso, respecto al 25% que debe reservarse para jardines y zonas verdes, debería obligar a la empresa a correr su construcción fuera de ese 25% de terreno dedicado a otros fines ajenos a los constructivos, y permitirle terminar su proyecto en la parte de terreno que legalmente puede desarrollar, sin que ello implique menoscabo a su derecho constitucional a la propiedad privada, pues la empresa propietaria siempre tendrá bajo su dominio la totalidad de su terreno, solo que no puede construir en ese 25% de terreno de su propiedad ni en la vía pública. Solicita la siguiente medida cautelar: “Que se le ordene a la Municipalidad de Quepos, la paralización inmediata de la citada construcción, aun con el auxilio de la Fuerza Pública, y proceda a ejecutar las pericias que sean necesarias para determinar el porcentaje de terreno invadido que corresponde a la vía pública. Para ejecutar las anteriores diligencias, solicito se ordene comisionar a un Juez/a de uno de los Despachos Judiciales del Cantón de Quepos, pues el Gobierno local por medio de ciertos funcionarios, se ha dedicado aceptar dadivas a cambios de favores, en especial el Departamento de Ingeniería y Control Urbano, encargado del otorgamiento de permisos de construcción.En igual sentido solicito se ordene pericia respecto al 25% de terreno que debe reservarse para zonas verdes y jardines, con el propósito de determinar el área invadida que pertenece a ese porcentaje, por el proyecto constructivo denunciado, pues dicha zona es vital para la protección del ambiente y por ende para proteger el derecho a la salud y a la vida, puesto que estos derechos no pueden co-existir en ausencia de un ambiente sano y ecológicamente equilibrado. Una vez determinada la invasión tanto de la vía pública como del mencionado 25% de tierra y el irrespeto a los retiros”. Finalmente, pide que “se le ordene a las autoridades recurridas ordenarle a la empresa desarrolladora, correr su proyecto constructivo denunciado fuera del 25% reservado para jardines y zonas verdes y fuera de la vía pública, y de las zonas que pertenecen a los retiros frontales. Señores Magistrados, por los constantes y permanentes actos de corrupción de los funcionarios Municipales no solo con este desarrollador, sino con decenas de ellos que han hecho de la zona de Quepos y Manuel Antonio su hogar o lugar de negocios, solicito con el debido respeto disponer, que la ejecución de las pericias solicitadas, de ser jurídicamente posible, por medio de los peritos de la Judicatura.Si esta Honorable Sala no considera oportuno acceder a dicha solicitud, solicito se ordene la ejecución de dichas pericias, junto con los peritos privados que el suscrito recurrente apersonará al proyecto constructivo a la hora y fecha que indiquen las autoridades recurrida, con las costas a mi cargo, pues temo que después de todo esta odisea legal, ellos tergiversen los peritajes y dispongan distinto a lo que en realidad se refleja en el campo”.
  2. 2Por resolución de las 10:38 horas del 25 de junio de 2021, se le previno al recurrente que indicara “las fechas en la cuales planteó cada una de las denuncias que reclama y ante qué autoridades las incoó. Deberá aportar copias completas, legibles y con los respectivos comprobantes de recibido o envío de dichas denuncias y, de haber recibido alguna respuesta, deberá indicar cuál fue el resultado de cada una de ellas y presentar la documentación generada con ocasión a dichas diligencias, en caso negativo, también deberá aclarar cuales de esas gestiones no obtuvieron respuesta. Lo anterior, por cuanto tal información resulta esencial para resolver lo que en derecho corresponda y bajo apercibimiento de rechazar de plano el recurso si no lo hiciere”.
  3. 3Por escrito incorporado al expediente digital de la Sala a las 12:52 horas del 29 de junio de 2021, el recurrente manifiesta que la denuncia ante la Secretaría Técnica Nacional Ambiental se presentó ante esa dependencia el 1 de febrero del 2021; sin embargo, fue rechazada por resolución de esa Secretaría de las 10:00 horas del 24 de marzo del 2021. Tal resolución fue recurrida por su representada mediante el respectivo recurso de apelación el 8 de abril de 2021, el cual fue declarado sin lugar por resolución de las 9:30 horas del 16 de junio de 2021 de esa secretaría. Luego, su representada recurrió esa resolución mediante el respectivo recurso de revocatoria presentado el 22 de junio del 2021. Menciona que, un día antes a la interposición del recurso de amparo, trató de obtener copia del expediente administrativo ante la SETENA a fin de aportarlo ante la Sala, pero fue denegado. En cuanto a la Municipalidad de Quepos, las denuncias fueron presentadas en forma simultánea ante el Departamento de Ingeniería y Control urbano y ante la Alcaldía Municipal, el 21 de octubre de 2020.De la denuncia presentada ante el Departamento de Ingeniería y Control Urbano de la Municipalidad de Quepos el 21 de octubre del 2020, si bien recibió el oficio número MQ-DICU-476-2020 como respuesta, ese departamento no contestó nada relativo a los hechos denunciados ni ejecutó ninguna acción tendente a averiguar la verdad real de los hechos denunciados ni para paralizar el proceso como medida provisional. En vista de que el ingeniero municipal obvió abordar los hechos denunciados, el 13 de noviembre de 2020 reiteró la denuncia. Así, mediante el oficio número MQ-DICU-509-2020, el Departamento de Ingeniería contestó la reiteración de la denuncia, sin solventar situación expuesta. Añade que, desde el 21 de octubre de 2020, cuando se formularon las denuncias ante la Alcaldía Municipal y ante el Departamento de Ingeniería, sus jerarcas no adoptaron ninguna acción tendente a investigar denunciados ni para realizar las pericias correspondientes, sino hasta el 10 de marzo de 2021, que el Departamento de Ingeniería le remitió vía correo electrónico el oficio MQ-DlCU-057- 2021, mediante el cual le hicieron saber que en un tiempo prudente le entregarían el informe en relación con los hechos denunciados, es decir, respecto al 25% del terreno en el que la empresa desarrolladora está levantando su proyecto constructivo, pero omitiendo referirse al informe sobre la invasión a la vía pública.Ergo, desde el 21 de 2020, cuando se formularon las denuncias en forma simultánea ante la Alcaldía Municipal y ante el Departamento de Ingeniería, la Municipalidad de Quepos no ha llevado ha efectuado las pericias mínimas de rigor para corroborar la invasión al 25% del terreno, la invasión a la vía pública adyacente, ni el irrespeto a los retiros de ley. Por otro lado, desde el 10 de marzo de 2021, cuando se le remitió el oficio antes mencionado asegurando la ejecución y entrega de los informes respectivos, esta representación no ha recibido ningún tipo de informe, peritaje o información alguna en esa dirección, pese a que desde esa fecha, (10 de marzo del 2021), ya han transcurrido casi 4 meses. Enuncia que la misma resolución de disponibilidad de agua potable, emitida por la oficina local del AyA de Quepos el 24 de julio del 2019 a favor de la empresa desarrolladora, resolvió que “como resultado de los estudios básicos e informe técnico que consta en oficio, se determinó lo siguiente: Se aprueba disponibilidad de agua para remodelación. no se aprueba nuevo servicio.Propiedad cuenta con 3 servicios, no se brindarán servicios adicionales”, es decir, la finca donde se levanta el proyecto constructivo denunciado, no puede ser sujeto de una disponibilidad de agua potable adicional, pues ya cuenta con 3 servicios de agua potable. Este problema y la urgencia de la empresa desarrolladora de obtener el permiso de construcción Municipal, fue la que motivó a la ingeniera a cargo de la obra Shelem Rebeca Castro Vásquez, a incurrir en la posible comisión de un delito contemplado en la Ley Contra la Corrupción y el Enriquecimiento Ilícito en la Función Pública, pues ella, aprovechándose de la amistad que la une al funcionario en Jefe de la oficina local del AyA, mintió o proveyó información falsa para obtener una disponibilidad de agua potable para remodelar, cuando en realidad están levantando un edificio de grandes dimensiones, favoreciendo el interés meramente privado por sobre el interés de los cientos de habitantes del área de Manuel Antonio que ahora están adoleciendo del preciado líquido.Arguye que de parte de la Alcaldía Municipal no recibió ninguna respuesta, y de parte del Departamento de Ingeniería y Control Urbano recibió los memoriales que se adjuntan, de los que se desprende una actitud de mofa de parte del funcionario, inclusive instándolo a llamar a la Policía de Tránsito por el problema de la vía pública, cuando en realidad la invasión a la vía pública es de resorte absoluto de la municipalidad accionada; sin embargo, ni el ingeniero a cargo del Departamento de Ingeniería ni el alcalde ejecutaron alguna acción para ponerle fin a lo denunciado. Discrepa de lo resuelto por el ingeniero y reclama que, en lugar de remitir inmediatamente la impugnación ante el superior en grado, en este caso el alcalde, procedió a resolverla él mismo, usurpando competencias que le correspondían solo a aquel. Incluso, aunque el 11 de enero de 2021 formuló ante el alcalde una solicitud para que resolviera el recurso de apelación formulado contra el oficio del Departamento de Ingeniería Municipal número MQDICU- 509-2020, 6 meses después no ha resuelto ese recurso.En relación con la prueba aportada, aduce que “aporto a los autos la documentación echada de menos por esta Honorable Sala Constitucional, que consiste en la siguiente. Denuncia presentada ante la Alcaldía Municipal de Quepos, misma que contiene la fecha de recibido del 21 de octubre del 2020, de la que no hubo respuesta. La denuncia presentada ante el Departamento de Ingeniería Municipal el 21 de octubre del 2020 no se aporta, pues la misma ya consta en el expediente. Se aporta lo respondido por el Departamento de Ingeniería Municipal respecto a dicha denuncia. Se aporta la denuncia presentada ante la SETENA el 01 de febrero del 2021. No se aporta el recurso de apelación presentado ante la SETENA, por las razones que se explicaron supra. No se aporta el recurso de revocatoria formulado ante la SETENA el 21 de junio del 2021, pues el mismo ya consta en el expediente. Se aporta copia de la reiteración de la denuncia formulada ante el Departamento de Ingeniería Municipal el 13 de noviembre del 2020.Se aporta de igual manera el memorial emitido por el Ingeniero Municipal respecto a esa reiteración de denuncia. Se aporta recurso de apelación formulado contra el oficio del Departamento de Ingeniería Municipal número MQ-DICU-509-2020, mismo que nunca fue elevado en apelación ante el Alcalde Municipal. De igual forma se aporta solicitud dirigida al Alcalde Municipal el 11 de enero del 2021, peticionando la resolución del recurso de apelación formulado en contra del oficio del Departamento de Ingeniería Municipal número MQ-DICU-509-2020, mismo que a la fecha aún no ha sido resuelto. Se aporta nueva denuncia formulada el 11 de noviembre del 2020, solicitando la paralización del proyecto constructivo, sin resultados positivos Se aporta correo electrónico remitido por el Departamento de Ingeniería Municipal a mi dirección de correo electrónico, mediante el cual dicho departamento me pone en conocimiento que muy pronto me entregarían el informe respecto a la cobertura máxima utilizada por la empresa desarrolladora, mismo que nunca fue remitido, pese a que ya transcurrieron casi 4 meses desde su envío.Se aporta solicitud dirigida al Departamento de Ingeniería Municipal con fecha del 21 de junio del 2020 solicitando copias del expediente administrativo relacionado con la empresa desarrolladora, representada por el Señor ELI DAYAN. Se aporta contestación a dicha solicitud, mediante la cual el Ingeniero Municipal, buscando toda excusa para evitar facilitarme copia del citado expediente, alude a que no existe copia de permiso de construcción a nombre de ELI DAYAN, lo que demuestra una vez más su confabulación con dicho sujeto, pues él conoce muy bien al Señor ELI DAYAN y se aprovechó que el suscrito gestionó copia de dicho permiso a nombre del Señor ELI DAYAN o de la compañía que él representa, puesto que para ese entonces no sabía si el permiso estaba a nombre de dicho Señor a título personal o a nombre de una empresa. Se aportan formularios de requisitos de AyA para la obtención de la respectiva Disponibilidad de Agua Potable, con la que demuestra el fraude ley cometido tanto por la ingeniera a cargo de la obra como el Ingeniero Municipal, pues la ingeniera a cargo de la obra gestionó dicha disponibilidad de agua potable para remodelar un local comercial, cuando en realidad era para construir un edificio de 540 metros cuadrados de construcción en 2 niveles, y el Ingeniero Municipal, pese a tener conocimiento de ese fraude de ley, siempre otorgó el permiso de construcción, pese a su ilegalidad”.
  4. 4Por escrito incorporado al expediente digital de la Sala a las 12:39 horas del 1 de julio de 2021, el recurrente manifiesta que: “Por ubicarse los condominios de mi representada contiguo al terreno propiedad de la empresa desarrolladora donde se levanta el edificio de 540 metros cuadrados en 2 niveles, soy testigo fiel del irrespeto a la cobertura máxima autorizada por ley, la invasión a la vía pública, y el irrespeto a los retiros de ley. Todo esto es sabido de igual manera por los funcionarios municipales, quienes se han apersonado al sitio a realizar inspecciones, pero que pasa a ser solo eso, meras inspecciones, prueba de ello es el acta de inspección y fotografías aportadas junto al recurso de amparo presentado ante esta Honorable Sala Constitucional el 22 de junio del 2021, inspección en la que el funcionario municipal detectó un incremento en el proyecto constructivo en 242 metros cuadrados de más sin contar con el respectivo permiso municipal, según el acta municipal levantada por parte del inspector municipal, pero como se observa, no hubieron (sic) repercusiones al respectivo”.Arguye que los funcionarios no estaban autorizados a omitir las sanciones correspondientes por las violaciones constatadas. Reitera lo ya indicado. Consulta “que (sic) está haciendo la Municipalidad en el presente asunto para cumplir con el mandato Constitucional de velar por los derechos e intereses de los habitantes de su cantón? Pues es obvio que está descuidando las obligaciones impuestas a ellos por ministerio de ley, (Artículo 87 de la Ley de Construcciones), pues es obvio que no está cumpliendo sus labores de fiscalización respecto a las obras que se levantan en su Jurisdicción, a como tampoco está velando por el fiel cumplimiento de los preceptos de dicha ley. La segunda es, porque la SETENA, como entidad encargada de la política ambiental y fiscalizadora del cumplimiento de las obligaciones contraídas por los desarrolladoras en las Viabilidades Ambientales, se ha hecho de la vista gorda respecto a todas las violaciones traídas ante su atención?.Si bien es cierto la Secretaría Técnica Nacional Ambiental no puede estar en todas partes ni alargar el brazo de la ley en todo el país, pero también es cierto que si es el ciudadano que trae ante su atención todas estas violaciones mediante denuncia, circunstancias que la misma Secretaría no controvierte, lo procedente era actuar de inmediato, y sus Jerarcas consideraban que dichos hechos denunciados no eran de su competencia, pues debieron interponer sus buenos oficios y realizar coordinación Institucional con la Municipalidad de Quepos, Ministerio de Salud, y el Ministerio del Ambiente, para lograr una solución integral en bienestar del medio ambiente y de nuestro derecho de vía”. Solicita a la Sala que valore el plano de Puntarenas número 1946207-2017, que corresponde al terreno propiedad de la empresa desarrolladora finca de Puntarenas número 00219804-000, que es donde se levanta el irregular proyecto constructivo, a fin de que se determine “la invasión tanto al 25% del terreno que debe reservarse para otros fines ajenos a los constructivos, la invasión a la vía pública y el irrespeto a los retiros de ley.”
  5. 5El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta la Magistrada Esquivel Rodríguez; y,

Considerando:

I. OBJETO DEL RECURSO

El recurrente acusa que la empresa denominada 3-102-633985 está construyendo un proyecto e invadiendo calle pública, así como el 25% del terreno que se debe reservar para jardines y zonas verdes. Afirma que no cuenta con los permisos del Ministerio de Salud ni está en posesión de los planos constructivos que debió haber elaborado para la construcción de la respectiva planta de tratamiento a la que se comprometió al suscribir la viabilidad ambiental ante la SETENA. Añade que la Municipalidad de Quepos ha hecho caso omiso a la serie de reclamos presentados; además, ha incurrido en una falta de respuesta. Por su parte, SETENA rechazó la denuncia interpuesta por su representada y la apelación formulada en contra de ese rechazo fue declarada sin lugar, con el argumento de que los hechos denunciados no son de resorte de su competencia, sino que corresponden a la Municipalidad de Quepos, al Instituto Costarricense de Acueductos y Alcantarillados y al Ministerio de Salud. Discrepa de ello. Finalmente, reclama denegatoria de acceso al expediente administrativo.

II. SOBRE EL CASO CONCRETO

En la especie, se observa que, en el escrito de interposición, la pretensión expresamente planteada por la parte tutelada fue la siguiente:

“Que se le ordene a la Municipalidad de Quepos, la paralización inmediata de la citada construcción, aun con el auxilio de la Fuerza Pública, y proceda a ejecutar las pericias que sean necesarias para determinar el porcentaje de terreno invadido que corresponde a la vía pública. Para ejecutar las anteriores diligencias, solicito se ordene comisionar a un Juez/a de uno de los Despachos Judiciales del Cantón de Quepos, pues el Gobierno local por medio de ciertos funcionarios, se ha dedicado aceptar dadivas (sic) a cambios de favores, en especial el Departamento de Ingeniería y Control Urbano, encargado del otorgamiento de permisos de construcción. En igual sentido solicito se ordene pericia respecto al 25% de terreno que debe reservarse para zonas verdes y jardines, con el propósito de determinar el área invadida que pertenece a ese porcentaje, por el proyecto constructivo denunciado, pues dicha zona es vital para la protección del ambiente y por ende para proteger el derecho a la salud y a la vida, puesto que estos derechos no pueden co-existir en ausencia de un ambiente sano y ecológicamente equilibrado.

Una vez determinada la invasión tanto de la vía pública como del mencionado 25% de tierra y el irrespeto a los retiros”. Finalmente, pide que “se le ordene a las autoridades recurridas ordenarle a la empresa desarrolladora, correr su proyecto constructivo denunciado fuera del 25% reservado para jardines y zonas verdes y fuera de la vía pública, y de las zonas que pertenecen a los retiros frontales. Señores Magistrados, por los constantes y permanentes actos de corrupción de los funcionarios Municipales no solo con este desarrollador, sino con decenas de ellos que han hecho de la zona de Quepos y Manuel Antonio su hogar o lugar de negocios, solicito con el debido respeto disponer, que la ejecución de las pericias solicitadas, de ser jurídicamente posible, por medio de los peritos de la Judicatura. Si esta Honorable Sala no considera oportuno acceder a dicha solicitud, solicito se ordene la ejecución de dichas pericias, junto con los peritos privados que el suscrito recurrente apersonará al proyecto constructivo a la hora y fecha que indiquen las autoridades recurrida, con las costas a mi cargo, pues temo que después de todo esta odisea legal, ellos tergiversen los peritajes y dispongan distinto a lo que en realidad se refleja en el campo”.

Ante este panorama, se advierte que lo pretendido por la parte recurrente no es más que un conflicto de legalidad ordinaria, que no involucra, al menos en forma directa, derecho fundamental alguno, motivo por el cual excede el ámbito de competencia de esta Sala. En efecto, este Tribunal no es un contralor de legalidad ni una instancia más de la Administración, de modo que no le corresponde revisar, de acuerdo con el marco normativo, los supuestos fácticos y los criterios técnicos, si la empresa recurrida se encuentra construyendo sobre un 25% del terreno que debe ser reservado para jardines y zonas verdes, o bien, si existe algún tipo de invasión en la vía pública. Consecuentemente, no es de su resorte ordenar alguna pericia para verificar o desacreditar tal situación. Tampoco le atañe decidir si existe un delito de corrupción u algún otro por parte de los funcionarios públicos, o bien, si la empresa denunciada carece de permisos de construcción y si las obras deben paralizarse. Ciertamente, esta Sala no es una instancia tramitadora de denuncias, de modo que resulta improcedente que el tutelado acuda directamente ante este Tribunal a exponer tales reclamos. Esos extremos deben ser planteados ante la Administración, como así indica estarlo haciendo o, en su caso, la jurisdicción ordinaria.

No obstante lo anterior, lo que esta Sala podría valorar sería alguna falta de resolución definitiva a alguna denuncia planteada, que se relacione con el derecho al ambiente o a la integridad física. Por ello, a fin de descartar que este fuese el caso, mediante resolución de Presidencia de las 10:38 horas del 25 de junio de 2021, se le previno al recurrente que indicara “las fechas en la cuales planteó cada una de las denuncias que reclama y ante qué autoridades las incoó. Deberá aportar copias completas, legibles y con los respectivos comprobantes de recibido o envío de dichas denuncias y, de haber recibido alguna respuesta, deberá indicar cuál fue el resultado de cada una de ellas y presentar la documentación generada con ocasión a dichas diligencias, en caso negativo, también deberá aclarar cuales de esas gestiones no obtuvieron respuesta. Lo anterior, por cuanto tal información resulta esencial para resolver lo que en derecho corresponda y bajo apercibimiento de rechazar de plano el recurso si no lo hiciere”.

Ahora bien, vista la respuesta dada por el promovente, se observa lo siguiente:

  • a)El 1 de febrero de 2021, el amparado planteó una denuncia ante SETENA, la cual fue resuelta el 24 de marzo de 2021. Luego, el tutelado recurrió esa resolución y ello fue declarado sin lugar el 16 de junio de 2021. Además, recientemente, el 22 de junio de 2021, el petente interpuso un recurso de revocatoria contra esa resolución. Así las cosas, en cuanto a SETENA, se infiere que lo reclamado versa, más bien, sobre una disconformidad con lo resuelto, mas no sobre una falta de resolución. Por ello, resulta improcedente admitir este extremo, pues tales desavenencias son propias de discutirse ante la vía ordinaria.
  • b)El 21 de octubre de 2021, el petente interpuso de manera simultánea dos denuncias ante el Departamento de Ingeniería y Control Urbano y la Alcaldía Municipal.

b.1) En relación con la denuncia incoada ante el Departamento de Ingeniería y Control Urbano (donde, además de acusarse incumplimientos a la normativa infraconstitucional relativos al nivel de construcción y otros, el tutelado acusó, para efectos de relevancia constitucional, que “con los materiales de construcción y equipo de acarreo de materiales, mi denunciado obstaculiza el libre tránsito de los vehículos y representa un peligro para los peatones que transitan por esa vía hacia sus lugares de empleo”), el propio tutelado manifiesta que se le respondió a través del oficio MQ-DICU-476-2020, del discrepa, pues “no contestó nada referente a los hechos denunciados ni ejecutó ninguna acción tendiente a averiguar la verdad real de los hechos denunciados ni para paralizar el proceso aun en carácter de medida provisional”. Al estar disconforme, el promovente aduce que el 13 de noviembre de 2020 reiteró la denuncia y, por oficio MQ-DICU-509-2020 se le contestó, de cuya respuesta también disiente. En este sentido, resulta de aplicación lo indicado supra en torno a que las desavenencias con lo contestado no son analizables ante este Tribunal.

Ahora, también se desprende que, el 19 de noviembre de 2020, el recurrente apeló este último oficio (MQ-DICU-509-2020); empero, según indica este, esa gestión no ha sido contestada por el Departamento de Ingeniería y Control Urbano ni elevada ante el superior jerárquico. Ahora, de los autos se colige que esa apelación fue contestada por oficio MQ-DICU-527-2020 del 26 de noviembre de 2020. Por lo que lo reclamado también versa sobre una disconformidad con lo resuelto.

Por otra parte, el amparado acusa que el el 11 de enero de 202 planteó un escrito ante el Alcalde indicando que “Desde el 19 de noviembre de 2020 interpuse ante el Departamento de Ingeniería y Control Urbano de esta Municipalidad, formal recurso de apelación en contra del oficio número MQ-DICU-509-2020, sin embargo, a la fecha de la presentación del presente memorial, dicho recurso aún no ha sido resuelto ni notificado, solicitado por lo tanto se proceda con la resolución y notificación de dicho recurso”. Sin embargo, como se explicó supra, tal recurso de apelación ya había sido resuelto desde el 26 de noviembre de 2020. Por ello, de las manifestaciones del tutelado y la prueba aportada se evidencia que lo pretendido con este reclamo es que sea el alcalde el que resuelva ese recurso de apelación y no el departamento aludido; empero, se le aclara que esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones de la Administración, por lo que no es competencia de este Tribunal revisar, en el caso concreto, qué recursos administrativos son procedentes o no, según las normas de derecho aplicables y, con base en ello, decidir, de acuerdo con la normativa infraconstitucional, si resultaba procedente elevar ese recurso ante la Alcaldía.

También, de la prueba aportada se tiene que, el 10 de marzo de 2021, el Departamento de Ingeniería y Control Urbano le envió al tutelado un correo indicándole que “con relación a la denuncia por la cobertura de las cor (sic). En un periodo de tiempo prudente se entregará el informe resc (sic)”. En este sentido, el tutelado acusa que este informe se relaciona con la construcción sobre el 25% del terreno, mas no respecto a la invasión de la vía pública. De ahí que la acusada falta de entrega no concierne a un tema de relevancia constitucional, sino del cumplimiento de la normativa infraconstitucional en torno a qué área puede ser construida y cuál debe reservarse para jardines, por lo que esa omisión de entrega tampoco es admisible de ser conocido ante este Tribunal, como se aclaró supra.

b.2) Por otra parte, respecto de la denuncia incoada ante la Alcaldía también el 21 de octubre de 2020, cuya falta de respuesta se acusa, se tiene que, aunque al recurrente la aportó como prueba, lo hizo sin el sello de recibido, de ahí que se tiene por no cumplida la prevención, de modo que resulta improcedente admitir este extremo.

  • c)Por otra parte, en cuanto a la acusada denegatoria del expediente aludido, se desprende que, recientemente, por sentencia 2021-002222 de las 9:15 horas del 5 de febrero de 2021, se conoció un amparo del mismo recurrente en relación con el tema aquí planteado y se dispuso lo siguiente:

I. OBJETO DEL RECURSO

La parte recurrente acusa que el 21 de octubre de 2020, interpuso una denuncia ante el municipio recurrido, y a su vez, solicitó una copia de un expediente administrativo. Asegura que, a pesar de haber reiterado su solicitud, a la fecha de interposición de este recurso, no se ha atendido su gestión, por lo que estima lesionados sus derechos fundamentales. (…)

III. SOBRE EL FONDO

En el presente caso, la parte recurrente solicitó, el 21 de octubre de 2020, una copia de un expediente administrativo, referente a los permisos de construcción otorgados en una propiedad que, a su criterio, realizaba obras de manera irregular. No obstante, acusa que, a la fecha de interposición de este recurso, no se le ha brindado lo solicitado, por lo que estima lesionados sus derechos fundamentales.

Ahora bien, la autoridad recurrida, en su informe rendido bajo la solemnidad del juramento, asegura que a través oficio N° MQ-DICU-477-2020, notificado al amparado el 30 de octubre de 2020, se informó que no constan permisos de construcción a nombre del señor Elie Dayan, por lo que no contaban con un expediente administrativo. Asimismo, debido a la denuncia interpuesta por el recurrente, procedieron a realizar una inspección de campo el 20 de noviembre de 2020, a la propiedad cuyas obras fueron denunciadas. En dicha diligencia, se constató que se realizaba una obra sin permisos de construcción, por lo que se inició el expediente administrativo N° T-PC-253-10-2020, para que el propietario del inmueble colocara las obras a derecho. Posteriormente, a través del oficio N° MQ-DICU-551-2020, de fecha 28 de diciembre de 2020, el Departamento de Ingeniería y control Urbano de la Municipalidad de Quepos, colocó a disposición del amparado la información solicitada, indicando que: “(…) alguna de la información contenida en dicho expediente es de carácter confidencial, y al no ser su persona o su representada parte activa de este trámite, no se le puede remitir este tipo de información (…)”.

Al respecto, este Tribunal considera que sí se ha dado una lesión a los derechos fundamentales del amparado, ya que no se logra acreditar que se haya entregado la información solicitada por el amparado. Observa este Tribunal que, posterior a la notificación de la resolución que da curso al presente proceso, las autoridades recurridas, mediante el oficio N° MQ-DICU-551-2020, de fecha 28 de diciembre de 2020, colocaron a disposición del amparado la información solicitada, lo cierto es que no existe certeza de que la misma haya sido, efectivamente, facilitada, o bien, que vaya a ser entregada al recurrente dentro de un plazo racional, tomando en consideración que la gestión fue presentada desde el 21 de octubre de 2020.

Por otro lado, conviene indicar que si bien, en atención al derecho a la autodeterminación informativa, derivado del artículo 24, de la Constitución Política, y en aplicación de lo dispuesto en la Ley de Protección de la Persona frente al Tratamiento de sus Datos Personales, la autoridad recurrida se encuentra en la obligación de proteger los datos de sus servidores, lo cierto es que dicha situación no puede convertirse en una justificación para denegar información de carácter público a los administrados, ya que la Administración también se encuentra obligada a cumplir con lo dispuesto en el artículo 30, de la Constitución Política, que garantiza el libre acceso a los datos de naturaleza pública.

En mérito de las consideraciones expuestas, el recurso debe ser declarado con lugar, en los términos dispuestos en la parte dispositiva de esta sentencia. (…)

POR TANTO:

Se declara con lugar el recurso y, en consecuencia, se ordena a Jong Kwan Kim Jin y a Alfonso Moreno Navarro, por su orden Alcalde Municipal y Jefe a.i. de la Unidad de Desarrollo Constructivo; ambos de la Municipalidad de Quepos, o a quien en su lugar ejerza ese cargo, que en un plazo de DIEZ DÍAS, contado a partir de la notificación de esta Sentencia, se entregue al amparado lo solicitado en la gestión presentada el 21 de octubre de 2020, con exclusión de la información personal o sensible que se encuentre en esa documentación, según lo dispuesto en la Ley N° 8968 de “Protección de Datos de la Persona frente al Tratamiento de sus Datos Personales” u otra normativa atinente. Se le advierte a la autoridad recurrida que, bajo apercibimiento y de conformidad con lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena a la Municipalidad de Quepos al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese.-“ De ahí que, si el tutelado estima que existe un incumplimiento a esa sentencia, deberá alegarlo dentro de ese expediente (20-023319-0007-CO), a efectos de que se resuelva lo que en derecho corresponda.

  • d)Finalmente, las disconformidades que tenga el tutelado con la forma en que la empresa accedió a la disponibilidad de agua potable, tampoco son propias de discutirse en esta Sala, sino ante las vías de legalidad ordinaria, pues como se indicó anteriormente, la Sala no es una instancia tramitadora de denuncias.

Corolario de lo expuesto, se declara improcedente el recurso.

III. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI .

Por tanto:

Se rechaza por el fondo el recurso.
