Decision No. 2021014966 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine fifteen a.m. on July 2, 2021.
Petition for constitutional relief (recurso de amparo) being processed under case number 21-008991-0007-CO, filed by JOSÉ PABLO MURILLO MURILLO, identity card CED02, against the MINISTERIO DE EDUCACIÓN PÚBLICA and the MINISTERIO DE SALUD.
BACKGROUND:
Following several follow-up visits to verify compliance with the directives issued, it is clear that the educational center remains in noncompliance with the requirements imposed. Nevertheless, because it is an educational center, before proceeding with closure due to noncompliance, the Regla Técnica para Clausuras de Alto Impacto a Establecimientos y Actividades Públicos y Privados must be applied. According to report ARS-PZ-ERS-1109-2019, the objective application of the Regla Técnica para Clausuras de Alto Impacto a Establecimientos y Actividades Públicos y Privados results in a determination not to proceed with closure. Accordingly, the Área Rectora de Salud de Pérez Zeledón is responsible for continuing to follow up on the proceedings in order to verify compliance with the provisions of Health Order (Orden Sanitaria) ARS-PZ-ERS-OS-0109-2016. It is clear that the Dirección de Área Rectora de Pérez Zeledón has taken all necessary actions within the scope of its authority to address the situation, ensure compliance with the Health Order, and guarantee the minimum conditions of access and safety required by law (including relocation of the school), since compliance with the schedule for the relocation and construction of the entire school, even though the budget has already been allocated, is logically not within the authority of the Ministerio de Salud.
Regarding the allegations made by petitioner José Pablo Murillo Murillo, it states that the Dirección cannot comment on whether the Instituto Costarricense de Acueductos y Alcantarillados and the Instituto de Costarricense de Electricidad have expressed displeasure to the Junta, nor on whether the Junta de Educación or the Dirección has had the funds needed to carry out the construction for more than a year, because this matter does not fall within the Ministerio’s authority and no formal communication concerning it has been provided to us. Nevertheless, with respect to compliance with the directives issued by the Área Rectora de Salud de Pérez Zeledón, as has repeatedly been noted, the educational center remains noncompliant as of this date; therefore, the conditions identified in Health Order ARS-PZ-ERS-OS-0109-2016 remain in place. It requests that the petition be denied.
Justice Salazar Alvarado writes the opinion; and,
Considering:
The petitioner alleges that he is the President of the Junta de Educación of Escuela Las Juntas de Pacuar. He states that construction of the new educational facility has been in process since 2010, but has not materialized. He alleges that, although the Ministerio de Salud has conducted follow-up visits to ensure compliance with the health orders (órdenes sanitarias), the action plan required to complete the infrastructure needed for the educational facility has not been fulfilled, nor has greater progress been achieved with the Dirección de Infraestructura y Equipamiento Educativo of the Ministerio de Educación Pública. He asserts that, for more than one year, the Junta de Educación has had more than seven hundred ninety-five thousand (795.000.000) colones in the Caja Única del Estado; however, these funds have not been used, even though the school’s current conditions place the minors who attend every day at risk, as well as their right to a healthy and ecologically balanced environment and their right to education. Accordingly, he requests the intervention of the Chamber.
The following facts are deemed established and relevant to the resolution of this matter:
aa) By official letter DVM-A-DIE-SL-0207-2021, dated 21 de abril del 2021, the Dirección de Infraestructura y Equipamiento Educativo notified the Junta and requested that it adopt a resolution seeking authorization for competitive direct contracting (contratación directa concursada), pursuant to Article 145 of the Reglamento a la Ley de Contratación Administrativa (see reports and evidence submitted).
bb) A conversation was held between the legal professional on the Legal Team of the Dirección de Infraestructura y Equipamiento Educativo and the current Principal of the school, who stated that the newly elected Junta de Educación is currently undergoing formalization before the Dirección Regional. The action requested in official letter DVM-A-DIE-SL-0207-2021 is pending so that the process may continue (see reports and evidence submitted).
This Chamber, in Judgment N° 2019-3032 issued at 9:45 hours on 22 de febrero de 2019, stated as follows:
“III.- On the right to enjoy a healthy and ecologically balanced environment in schools—The right to health recognized in Articles 21 of the Constitución Política, 1 and 11 of the Declaración Americana de los Derechos y Deberes del Hombre, 4 of the Convención Americana sobre Derechos Humanos, and 10 of the Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos is closely linked to the right to live in a healthy and balanced environment, enshrined in Article 50 of the Constitution. Environmental quality is a fundamental parameter of quality of life, as are health, food, work, housing, and education, among others. Consequently, the State has an obligation to ensure adequate protection of the environment, for which purpose it must take the necessary measures to keep the environment free from pollution and to ensure that alterations caused by either human beings or nature, in the immediate or broader surroundings, do not harm the environment or the health of those who live there.
This right is particularly recognized when it is associated with other fundamental rights, such as the right to education. The latter is a fundamental right embodied in the public service provided by the State at the country’s various schools. Therefore, the very least the State must do when providing this public service is to avoid infringing other fundamental rights, such as the right to health and to a healthy environment, of both the students and the school’s teaching and administrative staff.”
In the case under review, the petitioner alleges that the construction of the new Escuela Las Juntas de Pacuar has been under processing since 2010 but has not materialized. He alleges that, although the Ministerio de Salud has conducted follow-up visits to verify compliance with the health orders (órdenes sanitarias) issued, the action plan necessary to deliver the infrastructure required by the school has not been implemented, nor has any significant progress been made with the Dirección de Infraestructura y Equipamiento Educativo of the Ministerio de Educación Pública. He contends that, for more than a year, the Junta de Educación has had more than seven hundred ninety-five thousand colones (795.000.000) in the Caja Única del Estado; however, those funds have not been used, even though the school’s current conditions endanger the minors who attend every day, as well as their rights to a healthy and balanced environment and to education.
After reviewing the record, the Chamber deemed it proven that the authorities of the Dirección Regional de Rectoría de la Salud Brunca of the Ministerio de Salud, by official letter BRU-URS-RS-178-2015, dated 08 de octubre del 2015, stated that an inspection conducted on 07 de octubre del 2015 had determined that the current facilities were severely deteriorated and overcrowded and that the property’s topography would not permit future expansion of the facilities. Subsequently, by official letter ARSPZ-ERS-01025-2016 of 09 de mayo del 2016, it was determined, based on a new inspection, that the facilities had deteriorated further and that the classrooms had poor ventilation and lighting; moreover, the classrooms, offices, and school cafeteria located on an upper level had only one exit route. Accordingly, Health Order N° ARS-PZ-ERS-OS-0109-2016 directed the Principal of the school, Mr. Giovanni Bonilla Cascante, and the President of the Junta de Educación, Mr.
José Pablo Murillo Murillo, both of that school, to do the following within three months: “1. Submit to this Ministry an action plan, with the corresponding schedule, setting forth the actions aimed at completing the project to construct new educational facilities, together with a copy of the registered survey plan (plano catastrado) of the land on which the facilities would be installed or the works carried out. 2. Until adequate facilities are available, those responsible for the current school must have prepared and implemented the following at the school: I. Emergency response and prevention plan. ll. Waste-management program.” Based on the facts set forth above, the Chamber reaches the following conclusions. Regarding the authorities of the Ministerio de Educación Pública, this Court finds that they have openly violated the fundamental rights of the students of Escuela Las Juntas de Pacuar.
First, it has been established that commencement of the new construction remains pending and, therefore, Health Order ARS-PZ-ERS-OS-0109-2016 has yet to be complied with. It has been shown that, although the property is in worse condition than at the time of the first inspection, efforts to construct a new school have borne no fruit. Accordingly, it was deemed proven that the students are currently in overcrowded conditions, that the facilities have deteriorated further, and that the classrooms have poor ventilation and lighting; moreover, the classrooms, offices, and school cafeteria located on an upper level have only one exit route, among other deficiencies. Such conditions constitute a clear violation of the right to education and to a healthy environment, a situation that this Chamber cannot endorse and that warrants granting the petition against the Ministerio de Educación Pública.
Regarding the health authorities, the Chamber notes that they failed to make sufficient efforts to ensure enforcement of the health order they issued in 2016. Again, that order imposed an obligation on the Dirección de Infraestructura y Equipamiento Educativo of the Ministerio de Educación Pública to submit a remedial plan for the relocation and construction of the Escuela Las Juntas de Pacuar. The Chamber considers that, had that health order been fully complied with, the students would not be enduring the deplorable physical and sanitary conditions in which the school finds itself solely because of an interinstitutional coordination problem dating back six years. In light of the foregoing, the petition is granted, with the effects to be stated in the operative portion of this Judgment.
As a general rule, I maintain that claims concerning omissions related to infrastructure matters can and should be addressed by the competent administrative and oversight bodies, as well as by the ordinary courts.—However, I have also made the qualification that endangerment of rights such as physical integrity and health warrants the intervention of this Court.—That is the situation in this specific case, as demonstrated by the established facts, which support the conclusion that there is an imminent danger to the physical integrity or health of the persons—students, teachers, and other staff generally—who attend the Centro Educativo Las Juntas de Pacuar, and that the authorities aware of the problem have not acted with the diligence necessary to remedy this urgent situation.—For these reasons, I concur with the majority opinion.—
As a matter of principle, I consider that cases concerning action or inaction by the Public Administration in repairing, constructing, modifying, or demolishing any infrastructure must be dismissed because such an omission is a matter of legality whose adjudication falls within the jurisdiction of the ordinary courts, before which the interested person may litigate his or her objections more fully. However, when such administrative conduct, whether an act or omission, results in a violation of other fundamental rights protected under this constitutional jurisdiction, or affects groups regarded as vulnerable, I do examine the merits, because such a situation constitutes an exception to my position on this matter, as occurs in this case, in which the petitioner states that Escuela Las Juntas de Pacuar is in deplorable physical and sanitary condition and has been awaiting the construction of a new school since 2016 without positive results, owing to a lack of interinstitutional coordination, all of which endangers the lives and health of the minors who study at that school.
The parties are advised that, if they submitted any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the Court Clerk’s Office within a maximum period of thirty business days from service of this Judgment. Otherwise, any material not retrieved within that period shall be destroyed, in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena in Session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial N° 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at Session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.
THEREFORE:
The petition is granted. Catalina Salas Hernández, Grettel Pérez Arias, Guiselle Cruz Maduro, Christian Valverde Alpízar, and Gustavo Rodríguez Herrera, in their respective capacities as Director of Educational Infrastructure of the Ministry of Public Education, Director of Escuela Las Juntas, Minister of Education, Director of the Brunca Regional Health Governing Directorate, and Director of the Pérez Zeledón Health Governing Area, the latter two of the Ministry of Health, are ordered to issue the necessary directives, within their respective spheres of authority, to coordinate on an interinstitutional basis and construct a new school for the students of Escuela Las Juntas within EIGHTEEN MONTHS from notification of this judgment. Said property shall guarantee a healthy and suitable environment for the students of that educational institution to exercise their right to education. The foregoing is subject to the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in a writ of amparo (recurso de amparo) that they must comply with or enforce, and fails to comply with or enforce it, shall be subject to imprisonment for three months to two years, or twenty to sixty day-fines, provided that the offense is not punishable by a more severe penalty.
The State is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment (ejecución de sentencia) before the contentious-administrative jurisdiction. SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del dos de julio de dos mil veintiuno .
Recurso de amparo que se tramita en el expediente número 21-008991-0007-CO, interpuesto por JOSÉ PABLO MURILLO MURILLO, cédula de identidad CED02, contra el MINISTERIO DE EDUCACIÓN PÚBLICA y el MINISTERIO DE SALUD.
RESULTANDO:
Redacta el Magistrado Salazar Alvarado; y,
Considerando:
El recurrente alega que es el Presidente de la Junta de Educación de la Escuela Las Juntas de Pacuar. Indica que desde 2010 se está tramitando la construcción del nuevo centro educativo, pero no se ha concretado. Alega que, si bien el Ministerio de Salud ha realizado visitas de seguimiento para el cumplimiento de las órdenes sanitarias, no se ha cumplido con el plan de acciones necesario para concretar la infraestructura requerida para el centro educativo, ni se ha logrado mayor avance con la Dirección de Infraestructura y Equipamiento Educativo del Ministerio de Educación Pública. Aduce que desde hace más de un año, la Junta de Educación dispone de más de setecientos noventa y cinco mil (795.000.000) colones en Caja Única del Estado; sin embargo, no se ha hecho uso de éstos, pese a que las condiciones actuales de la escuela ponen en riesgo a los menores de edad que asisten todos los días, así como su derecho a un ambiente sano y equilibrado, y el derecho a la educación. Por lo anterior, solicita la intervención de la Sala.
De importancia para la resolución de este asunto, se tienen por demostrados los siguientes hechos:
aa) Mediante oficio DVM-A-DIE-SL-0207-2021, de fecha 21 de abril del 2021, la Dirección de Infraestructura y Equipamiento Educativo notifica a la Junta y se les solicita la toma del acuerdo de solicitud de autorización para la contratación directa concursada, según artículo 145 del Reglamento a la Ley de Contratación Administrativa (véanse informes y pruebas aportadas).
bb) Se sostuvo conversación entre la profesional del Equipo Legal de la Dirección de Infraestructura y Equipamiento Educativo, y la Directora actual del centro educativo, quien indicó que actualmente se encuentran en proceso de formalización ante la Dirección Regional de la nueva Junta de Educación electa, se está a la espera de lo solicitado en el oficio DVM-A-DIE-SL-0207-2021 a fin de brindar continuidad al proceso (véanse informes y pruebas aportadas).
Esta Sala, en Sentencia N° 2019-3032 de las 9:45 horas de 22 de febrero de 2019, indicó lo siguiente:
“III.- Sobre el derecho a gozar de un ambiente sano y ecológicamente equilibrado en los Centros de Educación- El derecho a la salud reconocido en los artículos 21 de la Constitución Política, 1 y 11 de la Declaración Americana de los Derechos y Deberes del Hombre, 4 de la Convención Americana sobre Derechos Humanos y 10 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos, se encuentra íntimamente ligado al derecho a vivir en un ambiente sano y equilibrado, consagrado en el artículo 50 constitucional. La calidad ambiental es un parámetro fundamental de la calidad de vida; al igual que la salud, alimentación, trabajo, vivienda, educación, entre otros. En consecuencia, el Estado tiene la obligación de procurar una protección adecuada al ambiente, para lo cual debe tomar las medidas necesarias a fin de que el medio esté libre de contaminación, y que las alteraciones producidas tanto por el hombre como por la naturaleza, en el entorno próximo o lejano, no constituyan una lesión al ambiente ni a la salud de las personas que en él habitan.
Se reconoce especialmente este derecho cuando está asociado a otros derechos fundamentales, como lo sería el derecho a la educación. Este último se configura como un derecho fundamental, el cual se traduce en el servicio público que brinda el Estado en los distintos centros educativos del país. Por lo tanto, lo menos que puede hacer el Estado es que al brindar la prestación de este servicio público no lesione otros derechos fundamentales, como sería el derecho a la salud y a un ambiente sano, tanto de los estudiantes como del personal docente y administrativo de la institución educativa”.
En el caso bajo estudio, el recurrente acusa que desde 2010 se está tramitando la construcción de la nueva Escuela Las Juntas de Pacuar, pero no se ha concretado. Alega que, si bien el Ministerio de Salud ha realizado visitas de seguimiento para el cumplimiento de las órdenes sanitarias emitidas, no se ha cumplido con el plan de acciones necesario para concretar la infraestructura requerida para el centro educativo, ni se ha logrado mayor avance con la Dirección de Infraestructura y Equipamiento Educativo del Ministerio de Educación Pública. Aduce que desde hace más de un año, la Junta de Educación dispone de más de setecientos noventa y cinco mil colones (795.000.000) en Caja Única del Estado; sin embargo, no se ha hecho uso de éstos, pese a que las condiciones actuales de la escuela ponen en riesgo a los menores de edad que asisten todos los días, así como sus derechos a un ambiente sano y equilibrado y a la educación.
Tras analizar los autos, la Sala tuvo por probado que las autoridades de la Dirección Regional de Rectoría de la Salud Brunca del Ministerio de Salud, mediante oficio BRU-URS-RS-178-2015, de fecha 08 de octubre del 2015, indicó que en visita de inspección realizada el 07 de octubre del 2015, se determinó que las actuales instalaciones se encuentran muy deterioradas, existe hacinamiento, y por la topografía de la propiedad no se permitiría una futura extensión de las instalaciones. Posteriormente, mediante oficio ARSPZ-ERS-01025-2016 del 09 de mayo del 2016, se determinó que según nueva visita de inspección, hay mayor deterioro en las instalaciones, mala ventilación e iluminación en las aulas, además éstas, las oficinas y comedor escolar, que se ubican en un nivel superior solo tienen una ruta de salida. Así las cosas, por Orden Sanitaria N° ARS-PZ-ERS-OS-0109-2016 se conminó al Director de la Escuela, el señor Giovanni Bonilla Cascante y al Presidente de la Junta de Educación, el señor José Pablo Murillo Murillo, ambos de dicho centro educativo, para que en el plazo de tres meses: “1.
Aportar a este Ministerio, un plan de acciones, con respectivo cronograma, conteniendo las acciones tendientes a concretar el proyecto de construcción de nuevas instalaciones educativas, debiéndose adjuntar una copia del plano catastrado del terreno en que se instalaría o realizarían las obras. 2. Entretanto se cuenta con las adecuadas instalaciones, los responsables del centro educativo actual deben tener por elaborado e implementando en el mismo lo siguiente: I. Plan de atención y prevención de emergencias. ll. Programa de manejo de residuos”.
A partir de los hechos expuestos, la Sala llega a las siguientes conclusiones. En cuanto a las autoridades del Ministerio de Educación Pública, este Tribunal establece que han lesionado abiertamente los derechos fundamentales de los estudiantes de la Escuela Las Juntas de Pacuar. Por un lado, se determina que se está a la espera de inicio de las obras nuevas, por lo que continua pendiente de cumplir la Orden Sanitaria ARS-PZ-ERS-OS-0109-2016. Se demuestra que a pesar de que el inmueble se encuentra en peores condiciones que aquellas de la primera inspección, los esfuerzos por construir un nuevo centro educativo no han dado fruto. Así las cosas, se tuvo por demostrado que los estudiantes se encuentran actualmente en condiciones de hacinamiento, hay mayor deterioro en las instalaciones, mala ventilación e iluminación en las aulas, además éstas, las oficinas y comedor escolar, que se ubican en un nivel superior solo tienen una ruta de salida, entre otras falencias. Tales condiciones constituyen una violación evidente del derecho a la educación y a un ambiente sano, situación que no puede ser avalada por esta Sala y que llevan a que se declare con lugar el recurso en contra del Ministerio de Educación Pública.
En lo que respecta a las autoridades de salud, la Sala nota que no se efectuaron esfuerzos suficientes por velar por la ejecución de la orden sanitaria que ellas emitieron desde 2016. Nuevamente, dicha orden prescribió el deber de presentar un plan remedial de reubicación y construcción del centro educativo Las Juntas de Pacuar por parte de la Dirección de Infraestructura y Equipamiento Educativo del Ministerio de Educación Pública. La Sala estima que, de haberse cumplido a cabalidad dicha orden sanitaria, los estudiantes no padecerían las deplorables condiciones físico-sanitarias en las que se encuentra el centro, únicamente por un problema de coordinación interinstitucional, que data de seis años atrás. En virtud de lo expuesto, se declara con lugar el recurso, con los efectos que se dirán en la parte dispositiva de esta Sentencia.
Como línea general sostengo que los reclamos por omisiones en relación con temas de infraestructura pueden y deben ser atendidos por los órganos administrativos competentes y de control así como por la jurisdicción ordinaria.- Pero también he dejado hecha la salvedad de que la puesta en peligro de derechos como la integridad física y la salud ameritan la intervención de este Tribunal.- Ello sucede en este caso concreto tal y como se demuestra del elenco de hechos demostrados que permite concluir que existe un peligro inminente para la integridad física o la salud de las personas -estudiantes, docentes y demás personal en general que asisten al Centro Educativo Las Juntas de Pacuar y que las autoridades que conocen del problema no han actuado con la diligencia necesaria para dar remedio a dicha urgencia.- Por estas razones es que concurro con el voto de mayoría.-
En tesis de principio, considero que los casos relacionados con la actividad o inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa (omisiva o no) se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en que la parte recurrente indica que la Escuela Las Juntas de Pacuar se encuentra en deplorables condiciones físico-sanitarias, esperando la construcción de un nuevo centro educativo desde el año 2016 sin obtener resultados positivos, atribuible a la falta de coordinación interinstitucional, todo lo cual pone en riesgo la vida y salud de los menores de edad que estudian en dicho centro.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara con lugar el recurso. Se ordena a Catalina Salas Hernández, Grettel Pérez Arias, a Guiselle Cruz Maduro, Christian Valverde Alpízar y a Gustavo Rodríguez Herrera, por su orden Directora de Infraestructura Educativa del Ministerio de Educación Pública, Directora de la Escuela Las Juntas, Ministra de Educación, Director de la Dirección Regional de Rectoría de la Salud Brunca y Director del Área Rectora de Salud de Pérez Zeledón, ambos del Ministerio de Salud, que giren las directrices necesarias, en el respectivo ámbito de sus competencias, a fin de coordinar de forma interinstitucional y construyan una nueva escuela para los estudiantes de la Escuela Las Juntas, en el plazo de DIECIOCHO MESES, contado a partir de la notificación de esta sentencia. Dicho inmueble deberá garantizar un ambiente sano y adecuado para el ejercicio de derecho a la educación de los estudiantes de ese centro educativo.
Lo anterior bajo apercibimiento que, con base en lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
