Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at thirteen hours and fifteen minutes on the twenty-fourth of February, two thousand and twenty-one.
Consolidated actions of unconstitutionality CED01 and CED02, brought by Nombre01, national identity card CED03; LUIS FERNANDO MORALES RODRÍGUEZ, national identity card CED04; Nombre02, national identity card CED05; Nombre03, national identity card CED06; Nombre04, national identity card CED07; and Nombre05, national identity card CED08, in their capacity as president with the powers of a general attorney-in-fact (apoderado generalísimo) of JARDINES DE LA CATARATA SOCIEDAD ANÓNIMA, corporate identification number CED09; against Articles 4, subsection 59), 47, 49, 52, 62, 88, 105, 106, and Transitorio II of Decreto Ejecutivo N° 40548-MINAE, which constitutes the Regulations to the Ley de Conservación de la Vida Silvestre, N° 7317, of July 12, 2017.
Background:
The petitioner's allegations of violation of the constitutional right to a healthy and ecologically balanced environment are being used as a pretext to access this jurisdiction by way of direct standing, seeking to protect a subjective right of a patrimonial nature by disguising it as protection of the right to a healthy and ecologically balanced environment. It should be noted that, as explained below, the petitioner proceeds from a false premise: that all zoos are, per se, an instrument for wildlife conservation; and that the substantive objections relate essentially to an apparent conflict between regulatory provisions and statutory law that must be resolved within the realm of ordinary contentious-administrative jurisdiction (sede ordinaria contenciosa), since the petitioner fails to establish the constitutional relevance of those objections, as the Chamber resolved in a similar case: "the petitioner's substantive objections relate, essentially, to an apparent conflict between a regulatory provision and other statutory and regulatory law, which presents a dispute that must be assessed and resolved within the realm of ordinary legality, as established by the repeated case law of this Chamber.
Even though the petitioner makes a brief reference to the right to a healthy and ecologically balanced environment, this is done primarily to support the petitioner's potential standing to bring this action, but thereafter the specific or actual harm that the challenged provisions might cause to the aforementioned fundamental right is not developed or argued in a broad and sufficient manner" (Judgment 10590-2016). Under these circumstances, it is considered that the petitioner lacks standing and the action is therefore inadmissible.
Furthermore, addressing the merits of the arguments raised by the representative of the petitioner company, the Procuraduría General de la República considers that the challenged Regulation does not contain any provision that contravenes the Constitución Política or the Convenio de Diversidad Biológica, nor are such provisions contrary to the rules of science and technique in this subject matter. The Procuraduría ultimately concludes that the petitioner lacks standing because the challenged regulatory provisions are capable of individual application. The petitioner's interests are legitimately defensible before this jurisdiction, but not under the figure of direct standing, and only upon fulfilling the requirements of the first paragraph of Article 75 of the Ley de la Jurisdicción Constitucional. The petitioner's allegations of violation of the constitutional right to a healthy and ecologically balanced environment are being used as a pretext to access this jurisdiction by way of direct standing, seeking to protect a subjective right of a patrimonial nature by disguising it as protection of environmental law.
There is no evidence that the challenged articles of Decreto N° 40548-MINAE contradict the legislative framework they implement, nor that they conflict with Articles 50 and 89 of the Constitución Política, Article 9 of the Convenio sobre Diversidad Biológica, or constitutional principles. The challenged provisions do not lack technical grounding. The analysis of the various technical criteria exceeds the competence of this advisory body, as well as the purpose and nature of constitutional review by way of such an action.
The defense of diffuse interests is an exception that enables petitioners to exercise a direct action (acción directa); it is therefore also necessary to analyze the definition of "diffuse interest" at the doctrinal and case-law levels. He cites national doctrine and case law from 1993, noting that the defense of diffuse interests cannot be so broad and generic as to be confused with the interest recognized in all members of society to ensure constitutional legality, since the latter is excluded from the current system of constitutional review (Judgment N° 1997-002389 of 14:39 hours on April 29, 1999 (sic)). Additionally, he cites Judgment N° 2015-002693 of 9:05 hours on February 25, 2015. He argues that in the present case, it is clear to the Administration that the petitioners are a group of individually identifiable persons with particular interests and specific cases that may be submitted to the Administration for its assessment.
The petitioners' commercial and professional activities demonstrate this, by pointing out that Nombre05 is the authorized representative (apoderado) of Jardines de la Catarata S.A., a private management facility registered with SINAC as a commercial zoo. They therefore have a commercial relationship with the regulated activities, and the reason for the challenge is the defense of their own personal and commercial interests, which is why they should have pursued the matter before the ordinary contentious-administrative venue. He points out that the effective defense of diffuse interests has not been demonstrated; he maintains that all the petitioners have a direct and particular interest in permitting processes or are subject in some manner to the Ley de Conservación de la Vida Silvestre and its implementing regulations, which duly establishes that this is not a case of the defense of diffuse interests — the requirement necessary to justify a direct action.
He further argues that the actions also fail to demonstrate protection corresponding to each citizen's duty to safeguard the right to a healthy and ecologically balanced environment; rather, they defend subjective rights and interests in which even patrimonial or economic harm is alleged as a result of the establishment of regulations aimed at wildlife conservation — in open contradiction between individual and collective interests. In a similar vein, he cites Judgments N° 2016-17336, N° 1999-001830, and N° 1997-2389. In conclusion, he argues that the petitioners may be subject to acts giving rise to claims in the administrative or judicial venue, and that by invoking the exception in paragraph two regarding direct action, they seek to have the exception to indirect action (acción indirecta) applied as an avenue to come directly before this Chamber. Accordingly, he considers that the actions must be rejected for failing to satisfy the requirements for bringing a direct action, and that by resorting to this jurisdiction in that manner, the petitioners distort the purpose of the defense of diffuse interests — instruments for the protection of collective environmental interests.
On the merits, reference is made to Article 4, paragraph 59, and numeral 105 of the Regulation to the Ley de Conservación de la Vida Silvestre, to note that, in adherence to technical criteria, the Costa Rican legislature defined a regulatory framework that has categorized the management sites (sitios de manejo), each with distinct objectives and activities. It must be kept in mind that the activities are carried out with living beings, whose special needs—depending on the species and the individual—cannot be disregarded. A plain reading of the rules makes clear that wildlife (fauna silvestre) breeding or rescue activities do not correspond to the nature or objectives of zoos (zoológicos), which are defined in the Ley de Conservación de la Vida Silvestre. The restrictions identified by the petitioners originate in the statute, not in the regulation. It is science and technique that have prevailed in the Law by providing that the rescue and rehabilitation of wildlife intended for later release must be carried out under technical conditions of isolation that ensure the individual does not lose its natural survival skills in the process of reintegration into the wild; accordingly, this function has been reserved by statute for Rescue Centers (Centros de Rescate).
Only if the animal's health condition permanently condemns it to captivity may it be transferred to a zoo (Article 18 bis of the Law)—a place where constant exhibition, contact with caretakers, veterinary treatments, or other handling practices alter instinctive behaviors toward humans and other animals. These statutory-level regulations do not in any respect violate Article 50 of the Constitución Política, nor numeral 9, paragraph c) of the Convention on Biodiversity. What they do is reinforce the commitments undertaken in the Convention by clearly regulating and structuring what ex situ management sites must comply with, through the use of technical-scientific criteria. In the report, the minister refers to the applicable constitutional principles, to wildlife conservation and management sites, establishing that conservation is the management, use, and preservation of wildlife by present and future generations.
Traditionally, it has been stated that conservation has two components, one subordinated to the other. In situ conservation (conservación in situ) is the maintenance of wildlife within its natural ecosystems and habitats, which is the way an ecosystem remains healthy. On the other hand, ex situ conservation (conservación ex situ) is a support tool for in situ conservation and consists of the maintenance of wildlife outside its habitat. To achieve adequate conservation, respect for technical-scientific criteria is necessary. The report reiterates the criteria set out in the previous report on the 2014 action of the World Conservation Union (UICN). The objectives of rescue centers or non-commercial wildlife breeding facilities (zoocriaderos), as management sites established by the Ley de Conservación de la Vida Silvestre, serve conservation purposes, are non-profit, and their activities are fully aligned with science and technical criteria.
The minister reiterates the criteria set out in the previous report regarding the objectives of zoos, compliance with Article 50 of the Constitución Política, as well as Articles 2 and 9 of the Convention on Biological Diversity. He maintains that the challenged provisions do not limit activities related to ex situ conservation and therefore do not violate the Convention; on the contrary, they strengthen it. Matters related to the rescue, reintroduction, breeding, or reintroduction of wildlife in national territory, in the technical terms consistent with the Ley de Conservación de la Vida Silvestre, are subject to strict state regulation. The constitutional analysis of the rules cannot be carried out based on a reading of a rule in isolation. A comprehensive study of the law and of the various regulated aspects is required, as well as a historical, social, and ethical contextualization of those rules.
The minister argues that the petitioners attribute the violation of the constitutional right to a healthy and ecologically balanced environment to the following arguments: 1, it makes zoo operations unviable because animals available for exhibition may become scarce; and 2, the provisions ignore the important role that zoos play worldwide in ex situ conservation. Both arguments are mere unsubstantiated personal assessments; as has been extensively explained, the challenged regulations do not undermine conservation and guarantee better fulfillment of the objectives of each management site, permitting linkage among the different functions of the management sites and ensuring the best treatment and the best options for wildlife. The minister reiterates that in Costa Rica matters related to the reproduction and collection of wildlife are subject to state regulation for the legal reason that they are public domain assets (bienes de dominio público), and for the technical-scientific reason that they must be carried out only when there is a public interest, by specialized entities, with clear conservation objectives, and authorized and supervised by the State.
Specifically, regarding Article 47 (rental of wildlife collections or individual animals), the minister asserts that there are criteria that prevent treatment contrary to that applicable to public domain assets, and that the Administration lacks a rule authorizing such use; therefore, in strict adherence to the principle of legality, it could not authorize this type of commercial wildlife activity. Private-law subjects lack sufficient authority to enter into a contract, as they do not hold title to wildlife; this is how the legislature understood it in Article 95 of the Ley de Conservación de la Vida Silvestre, which provides that those who trade, negotiate, traffic, or deal in wild animals, their products and derivatives, without the respective permit from SINAC, shall be sanctioned. Regarding Article 49 (use of wild animals in audiovisual activities), contrary to what the plaintiffs contend, there are sufficient criteria and scientific support to state unequivocally that the handling of wild animals without technical criteria does not contribute to environmental education, conservation, or the sustainable use of wildlife (this is based on a document signed by the Hospital de Especies Menores y Silvestres de la Escuela de Medicina Veterinaria de la Universidad Nacional).
Regarding Article 52 (mobile or itinerant exhibitions), the aim is to eradicate the illegitimate practices that had been occurring in the country, where public domain assets were treated by private parties at their own discretion in open violation of the rules protecting them as elements of biodiversity and national heritage, and in violation of all animal welfare (bienestar animal) legislation applicable to wildlife. These exhibitions do not meet, nor can they meet, the minimum welfare conditions for wildlife specimens that are the subject of "exhibition." Under the law, zoos are the management sites designated to ensure that wild animals maintain adequate living conditions in an attractive and educational manner for the public; exhibitions are permitted for environmental education purposes; the Ley de Conservación de la Vida Silvestre establishes that the management sites authorized for these purposes are zoos and restricted-management artisanal wildlife breeding facilities (zoocriaderos artesanales de manejo restringido).
Mobile or itinerant exhibitions are restricted to taxidermied wild animals, based on technical and scientific criteria. Mobile or itinerant exhibitions of live wild animals do not respect animal welfare principles, subjecting them to stress when they are transported outside their familiar environment to another location where environmental factors change. There are negative consequences of mobile or itinerant exhibition because it promotes pet-habituation (mascotización), the handling is not carried out by expert or trained personnel, it promotes animal mistreatment, and it increases the risk of disease transmission, among other things. Regarding Article 88 (format of the management plan (plan de manejo): security barriers), these are matters that must be addressed through ordinary proceedings and not through constitutional proceedings; moreover, the requirement challenged by the plaintiff had been in force since 2005.
Regarding Article 115 (commercial arthropod wildlife breeding facilities), the minister notes that they do not have within their functions exhibition or environmental education, which are reserved by law for zoos and restricted-management artisanal wildlife breeding facilities. The challenged rules complement the statutory definitions; both the classification of management sites and the activities that, by their nature and objectives, each may carry out are imposed by the Law and not by the regulation. There is no violation of the principle of equality before the law, since the regulation governs and orders activities that the law itself has conceptualized differently. Restricted-management sites breed only those species whose populations are not endangered or restricted, and whose statutory objectives include environmental education and ecosystem restoration, not commercialization. Both technically and legally they are different, and the Administration is authorized by law to regulate their activities in a differentiated manner.
Regarding Transitory Provision II of the Regulation, this is a tool allowing management sites to carry out a gradual transition toward compliance with the amendments to the Regulation, and it must be analyzed together with Transitory Provision I. It is false that management sites are required to implement the challenged rules, since the permits currently in force remain valid until their expiration. And regarding the allegations of violation of the right to carry on an economic activity permitting freedom of enterprise and freedom of contract, the minister refers to Resolution N° 2018-002844 of 9:20 a.m. on February 21, 2018. He requests that the action be dismissed for lack of standing (falta de legitimación), and subsidiarily, that it be denied.

Whereas:
I.On Admissibility. Article 75 of the Law of Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional) governs the prerequisites that determine the admissibility of constitutional challenges (acciones de inconstitucionalidad), requiring the existence of a pending matter before an administrative or judicial venue (sede administrativa o judicial) in which unconstitutionality is invoked. This requirement is not necessary in the cases provided for in the second and third paragraphs of that article—that is, when, by the nature of the rule, there is no individual or direct harm; when the action is grounded in the defense of diffuse interests (intereses difusos) or interests that concern the community as a whole; or when the action is filed by the Attorney General of the Republic (procurador General de la República), the Comptroller General of the Republic (contralor General de la República), the Prosecutor General of the Republic (fiscal General de la República), or the Ombudsman (defensor de los Habitantes), in these last cases within their respective areas of competence.
The text in question provides that the action lies when "by the nature of the matter, there is neither individual nor direct harm." Second, the statute contemplates the possibility of bringing an action in defense of "diffuse interests"; this concept, whose content has been gradually shaped by the Constitutional Chamber (Sala Constitucional), may be summarized in the terms employed in Judgment N° 1993-3750 of 15:00 hours of 30 July 1993:
"…Diffuse interests, although difficult to define and even more difficult to identify, cannot be—under our law, as this Court has already held—merely collective interests; nor so diffuse that their ownership merges with that of the national community as a whole, nor so concrete that specific individuals or personalized groups are identified or easily identifiable vis-à-vis them, whose standing (legitimación) would derive not from diffuse interests but from the corporate interests that concern a community as a whole. They are, then, individual interests that are at the same time diluted within more or less extensive and amorphous groups of persons who share an interest and therefore suffer harm—actual or potential—that is more or less equal for all; it is thus aptly said that these are equal interests of the groups found in certain circumstances and, at the same time, of each of their members.
That is, diffuse interests have a dual nature: they are both collective—because they are common to a generality—and individual, and may therefore be asserted as such." In sum, diffuse interests are those whose ownership belongs to groups of people not formally organized, but united by a particular social need, a physical characteristic, ethnic origin, a particular personal or ideological orientation, the consumption of a certain product, and the like. In such cases, the interest is spread out and diluted (diffuse) among an unidentified plurality of subjects. The Court has enumerated various rights that it has characterized as "diffuse," including: the environment, cultural heritage, the defense of the country's territorial integrity, and the sound management of public expenditure, among others. In this regard, two clarifications must be made: on the one hand, these goods transcend the sphere traditionally recognized for diffuse interests, since they relate, in principle, to aspects that affect the national community and not merely particular groups within it; environmental damage does not affect only the residents of a region or the consumers of a product—it harms or poses a serious risk to the natural heritage of the entire country and even of Humanity; likewise, the defense of the sound management of public funds authorized in the National Budget is an interest that concerns all inhabitants of Costa Rica, not only any particular group among them.
On the other hand, the enumeration made by the Constitutional Chamber amounts to no more than a simple description inherent in its obligation—as a judicial body—to confine itself to the cases submitted to it, and it cannot under any circumstances be understood to mean that only those rights expressly recognized by the Court as diffuse may be considered as such.
II.On Diffuse Interests and the Standing of the Petitioners (accionantes) in the Case under Study. The petitioners assert that their standing derives from the defense of diffuse interests with respect to the protection of the right to a healthy and ecologically balanced environment. In this regard, it should be noted that, in the reiterated case law of this Court, the scenarios set out in the second paragraph of Article 75 of the Law of Constitutional Jurisdiction constitute exceptions to the rule contained in the first paragraph of the same article, and must be carefully examined in each specific case. Diffuse interest has been understood as an interest related to a right or legal situation of a special and particular nature, which may be shared by other persons, with all interested parties forming a specific group or category. Thus, the violation of that right may affect everyone in general or each person individually; for that reason, any member of the community may bring the action to protect the right deemed to have been infringed. On this point, the reiterated case law of the Court states:
"It has been established that this is a special type of interest, whose manifestation is less concrete and individuable than that of the collective interest (interés colectivo) just defined in the preceding considerando, but which cannot become so broad and generic as to be confused with the interest recognized in all members of society to watch over constitutional legality—since the latter, as has been repeatedly stated, is excluded from the current system of constitutional review. It is therefore an interest distributed among each of the governed, mediate if you will, and diluted, but no less verifiable for that, for the defense before this Court of certain constitutional rights of singular relevance to the adequate and harmonious development of society. It is the special characteristics of these rights in themselves—and not the particular situation of the subjects who may hold them vis-à-vis those rights—that is the key to distinguishing and determining the presence of so-called diffuse interests, as has been expressed in various rulings such as 03705-93 of fifteen hours of the thirtieth of July regarding the right to the environment, number 05753-93 of fourteen hours forty-five of the ninth of November of that same year regarding the defense of the historical heritage, and number 00980-91 of thirteen thirty of the twenty-fourth of May of nineteen ninety-one regarding electoral matters" (Judgment number 360-99 of 15:51 hours of 20 January 1999).
From this definition, it is possible to conclude that diffuse interest is comprised of an eminently subjective element—relating to its ownership or attribution—and an objective element—relating to the impact of the good on society—which distinguishes it from other legal situations. With regard to the first—the subjective element—it is clear that ownership is spread among a non-individualized human group that co-participates in the enjoyment of the legal good that is the object of the interest, but whose composition does not consist of an identifiable, bounded, and relatively well-defined set of subjects, as is the case with collective interest. From the objective perspective, it must be clarified that not every "spread-out" interest acquires the legal category of "diffuse interest," but only those imbued with deep social relevance, the assessment of which depends on the circumstances of each case—see, among others, Judgments N° 2006-15960 and N° 2014-4904.
In this sense, just as it has been held that such interest cannot be so broad and generic as to be confused with the right to watch over constitutional legality—which would amount to the tacit establishment of a popular action not contemplated by the Law of Constitutional Jurisdiction—neither can it be so concrete as to allow for an individual claim, since in that case standing would derive from that claim—see, among others, Judgments N° 2008-13442, N° 2009-300 and N° 2009-9201. Thus, examples of such interests include the right to a healthy and harmonious environment, the defense of the historical heritage, electoral matters, the defense of the right to health, and the oversight of public funds. Accordingly, in the case under study, where the petitioners ground their standing in the defense of diffuse interests in matters of protection of a healthy and ecologically balanced environment, the appropriate course of action is to rule as indicated in the following considerandos.
III.On Third-Party Interventions (coadyuvancias). A large number of interested parties appeared in the action to intervene in support of the petitioners' claim. These applications were filed between 20 and 21 February 2018. The admissibility of said applications was resolved by order of the President of the Court, issued at 11:18 hours on 1 March 2018, taking into account that the first publication of the notice was made on 30 January 2018, so that pursuant to Article 83 of the Law of Constitutional Jurisdiction, only the intervention applications filed on 20 February 2018 were deemed procedurally proper. In the same vein, applications filed after that date were resolved by order issued at 10:22 hours on 17 April 2018. In order to notify the large number of intervening parties, notification was effected by notices published in Official Judicial Gazette (Boletín Judicial) N° 048 of 14 March, and for the later applications, in N° 075 of 30 April, both of 2018.
IV.Subject Matter of the Challenge. The consolidated constitutional challenges are directed at impugning Articles 4, subsection 59), 47, 49, 52, 62, 88, 105, 106, and Transitorio II of Decreto Ejecutivo N° 40548-MINAE, which constitutes the Regulations to the Wildlife Conservation Act (Reglamento a la Ley de Conservación de la Vida Silvestre), N° 7317 of 12 July 2017. On the one hand, the petitioners—in favor of zoos—challenge the provisions for failing to authorize them to carry out rescue, reintegration (reinserción), reintroduction (reintroducción), or reproduction (reproducción) activities, as well as the obligation to have contraception (anticoncepción) plans in place, the prohibition on reproduction, and the prohibition on reintroducing wildlife (fauna silvestre). On the other hand, Jardines de la Catarata Sociedad Anónima challenges the shift in approach taken in the contested Regulation, whereby zoos would no longer continue to receive rescued animals and their offspring; the prohibition on renting out collections or individual specimens of wildlife; the restriction on the use of animals for educational and instructional purposes to audiovisual materials only; the failure to provide for the possibility of exhibiting taxidermied wildlife in zoos (permitted only for mobile or itinerant exhibitions); the requirement of three barriers, which is incompatible with the type of containment maintained by the Zoológico Jardines de la Catarata; and other matters. The petitioners allege violations of Articles 50 and 89 of the Constitution, as well as of the Convention on Biological Diversity (Convención sobre la Diversidad Biológica).
In this manner, the consolidated actions challenge the following articles of the Regulations to the Wildlife Conservation Act:
"Article 4.- Definitions. For the purposes of applying the LCVS and these regulations, in addition to the definitions contained in Articles 1, 2, and 5 (sic) of the LCVS, the following terms shall be understood as follows:
1…
59. Zoo for commercial purposes: A wildlife management site (sitio de manejo de fauna) that meets the requirements established in the LCVS for zoos; such facilities are authorized to legally acquire wild animals for exhibition, provided they are included in the collection plan (plan de colección).
They shall not be authorized to engage in reproduction, in accordance with the regulations established by the LCVS and these regulations.
[…]
"Article 47.- Rental of wildlife (fauna silvestre) collections or individual specimens. Wildlife specimens may not be rented under any circumstances." […]
"Article 49.- Use of wild animals in audiovisual activities. For the use of wildlife in advertising campaigns, documentaries, news reports, film shoots, recordings, and similar activities, the Protocol developed by SINAC for these purposes must be followed.
Every effort must be made to ensure that the images and messages conveyed through audiovisual materials strengthen respect for wildlife, its needs, and natural behaviors, as well as respect for current regulations, and non-promotion of practices of keeping wildlife as pets (mascotización) and illegal captivity.
All audiovisual productions that use wildlife must include, in a legible manner, the following notice in the credits: 'Wildlife must remain in its habitat and natural conditions. Recordings made in Costa Rica encourage respect and conservation of wildlife and wild flora.' The use of images or videos showing persons in direct contact with wildlife shall be permitted only in veterinary or technical-scientific procedures necessary for the conservation and well-being of the wild animal, and may only be carried out by trained technical staff of the management facility (sitio de manejo). Handling of wildlife by visitors, volunteers, tourists, and similar persons shall not be permitted. Entry into holding and pre-release enclosures shall be restricted and authorized exclusively to technical staff.
In the event that wild specimens are to be transported outside the management facility that holds them in custody for use in audiovisual activities, the interested party must submit a written permit request to the Área de Conservación where the management facility keeping the wild animals in captivity is located. The request must include the date of transport, the number and type of animals, the objectives of the audiovisual activity, the veterinarian and biologist responsible for handling, transport and handling conditions, handling equipment, the length of time the animal will be outside the management facility, and other details specified in the corresponding protocol.
SINAC shall evaluate the request and shall rule by administrative resolution (resolución administrativa) whether to approve or reject the transport and handling of the animals for the specific activity. Only the transport outside the management facility of non-releasable animals belonging to certain species from the taxonomic groups birds, reptiles, and amphibians may be authorized, with each case to be analyzed individually. The conditions granted shall be set forth in the administrative resolution.
The Área de Conservación shall have 15 days to resolve the request.
If the permit is granted, the interested party must make the corresponding payment and present the original proof of payment to the respective Área de Conservación.
Exempt from the procedure established in this article is audiovisual material produced by hobbyists who intend solely to preserve a personal memory and who therefore do not pursue commercial or for-profit ends; however, they must still respect wildlife, its needs and natural behaviors, and current regulations, and must not engage in pet-keeping behavior." […]
"Article 52.- Mobile or traveling exhibitions. SINAC may authorize mobile or traveling exhibitions of taxidermied wild animals, their parts, products, and by-products, with the sole objective of providing environmental education (educación ambiental) in schools within the national education system. The collection must be registered in the Sistema Nacional de Información de Vida Silvestre.
For authorization of this type of exhibition, the interested party must submit the application in accordance with the provisions of Article 14 of these regulations, together with a mobile or traveling exhibition proposal that includes the following: objective, target group(s), description of thematic areas, type of activity during the exhibition, specimens to be exhibited and their unique identification number, and exhibition design or sketch.
The authorization granted by SINAC is without prejudice to any other requirements the interested party must fulfill for holding the exhibition event before other public or private entities.
The administrative resolution shall determine the specific conditions for carrying out the exhibition during events, and shall be granted for a maximum period of three years, renewable for equal periods. The resolution shall authorize the transport of the collection." […]
"Article 88.- Format of the management plan (plan de manejo). The management plan must contain:
(…)
h. Facilities:
(…)
i. Security barriers: Every wildlife management facility must have at least two security barriers. The first barrier shall be the enclosure directly containing the individual or individuals. Zoos (zoológicos) and restricted-management artisanal wildlife breeding facilities (zoocriaderos artesanales con manejo restringido) must have a second barrier located at least one meter from the first, with the objective of keeping visitors from touching the first barrier. Perimeter barrier: every wildlife management facility must have a perimeter fence separating the facilities from neighboring properties, serving as a barrier in the event of escapes.
ii. Venomous snake species: In the particular case of zoos housing venomous snake species, the infrastructure must account for risk situations such as natural disasters, fires, thefts, and similar events, so as to ensure that the animals do not escape or cause harm to human beings, wildlife, or domestic animals. Likewise, three security barriers must be constructed between the snakes and the visitors.
[…]
"Article 105.- Zoos. Zoos are management facilities authorized for the exhibition of wildlife, with or without commercial purposes. They may develop conservation, education, exhibition, and research programs. They are not authorized to carry out rescue, reinsertion (reinserción), reintroduction, or reproduction activities involving wildlife. These facilities must have a contraception plan (plan de anticoncepción) for the wild animals they keep in captivity, which shall be included in the management plan." "Article 106.- Commercial zoos (zoológicos comerciales). Commercial zoos shall be authorized to legally acquire wild animals for exhibition, provided that these are covered by the collection plan (plan de colección). To that end, they must maintain records verifying the origin of each specimen and request the permits established in these regulations for importation and commercialization. These facilities shall not be authorized for reproduction." And finally, the following transitional provision of the Regulations is challenged:
"Transitional Provision II. Within a maximum period of six months following the publication of these regulations, all management facilities in the country must present to the corresponding Área de Conservación an action plan detailing the organizational, infrastructural, and technical-management changes required to comply with the LCVS and adapt to these regulations." In accordance with Reglamento N° 40548-MINAE of July 12, 2017, it entered into force on February 14, 2018.
V.On the standing (legitimación) of the petitioners (accionantes) and the precedent that determines its inadmissibility. Previously, the Sala had heard an unconstitutionality action (acción de inconstitucionalidad) in which Articles 33, 50, 51, 110, and 115 of Decreto Ejecutivo N° 40548-MINAE were challenged in similar terms to the present case, insofar as the challenged provisions affected the operating regime of authorized zoos and artisanal wildlife breeding facilities (zoocriaderos artesanales). The consolidated actions now before us are governed by the ruling previously issued. Through Sentencia N° 2018-18563 of 9:20 a.m. on November 7, 2018, issued in expediente N° 17-019669-0007-CO, it was established that:
"III.- Lack of standing of the petitioners in this case.- The petitioners appear in this action under the claim of standing to defend diffuse interests (intereses difusos), specifically in defense of the right to the environment. However, for the reasons set forth below, this Sala finds, based on the substantive challenges raised by the petitioners, that these do not actually respond to a defense of the right to the environment.
First, as the Procuraduría General de la República notes in its report, the petitioners are using the defense of the right to the environment to access this court's jurisdiction through direct standing, when in reality what is being sought is to protect a subjective right of a patrimonial nature. The petitioners challenge the restriction established in the challenged provisions—which prohibits visits to commercial wildlife breeding facilities (zoocriaderos con fines comerciales) and commercial arthropod breeding facilities (zoocriaderos comerciales de artrópodos)—on the grounds that prohibiting such visits limits a more effective and beneficial environmental education. But more than the limitation on environmental education, when they state that they are owners of wildlife breeding facilities and that there is no objective reason justifying the fact that only certain types of breeding facilities may receive visitors, it becomes apparent that their interest is very particular, namely, that visits be permitted at the breeding facilities they own.
Second, the defense of the economic sustainability of commercial wildlife breeding facilities and commercial arthropod breeding facilities cannot be classified as a diffuse interest, since it pertains, as the Procuraduría General de la República notes in its report, to a very specific group of persons, namely, the owners of certain management facilities. Claiming for themselves the objective of environmental education, on the argument that it will provide them with better economic sustainability, is not the defense of a diffuse interest, but rather of a direct and particular interest.
Third, if the petitioners believe that the environmental education objective should have been extended to other management facilities and not only to restricted-management artisanal wildlife breeding facilities, they have the option, as the Minister of Environment and Energy informs, of requesting to develop a management plan and register both facilities (commercial breeding facility and restricted-management artisanal wildlife breeding facility). Therefore, there is no standing or basis to allege a violation of the principle of equality when the possibility is open to them.
Fourth, the challenged regulatory provisions are susceptible to individual application, directly affecting the legal sphere of particular persons. Thus, the petitioners may be subject to acts giving rise to claims in administrative or judicial proceedings, and in such cases it is not possible to claim direct standing through the defense of diffuse interests.
Fifth, the argument that public visitation promotes the environment is contradictory, since, as noted in the Procuraduría General de la República's report, public visitation affects captive wildlife, potentially causing discomfort, fear, or stress that may affect their reproduction or well-being, and may even compromise their survival. The Minister notes that science has studied these processes and does not recommend combining wildlife breeding activities for commercialization with visitation activities. Consequently, the petitioners' arguments, rather than defending the right to the environment, actually work against it.
In conclusion, given that the defense of the right to a healthy environment by the petitioners (accionantes) is being used to access this jurisdiction by way of direct standing (legitimación directa), when what is actually sought is to protect a subjective right of a patrimonial nature. Given that the defense of the economic sustainability of commercial-purpose wildlife breeding facilities (zoocriaderos) and commercial wildlife breeding facilities for arthropods cannot be classified as a diffuse interest (interés difuso), and that claiming for themselves the objective of environmental education — on the grounds that it will provide them with greater economic sustainability — does not constitute the defense of a diffuse interest but rather a direct and particular one. Given that there is no standing or basis for alleging a violation of the principle of equality, since the possibility of applying for a type of wildlife breeding facility management that does permit visits remains open to them.
Given that the challenged regulatory provisions (normativa reglamentaria) are capable of individual application, directly affecting the legal sphere (esfera jurídica) of specific individuals, making it impossible to invoke the defense of a diffuse interest. And given that the petitioners' arguments, rather than defending the right to a healthy environment, actually work against it, since science does not recommend combining wildlife breeding activities for commercial purposes with visitation activities. This Chamber does not consider that the petitioners have standing to bring this constitutional challenge (acción de inconstitucionalidad). Accordingly, this action must be dismissed, as is hereby done." Now, in accordance with what the Procuraduría General de la República has indicated, the actions are aimed at challenging the deterioration of ex situ conservation (conservación ex situ) and what the petitioners identify as the absence of technical grounds and a contradiction with the Ley de Conservación de la Vida Silvestre, to the detriment of the economic sustainability of zoos.
It also agrees with the Ministry of Environment and Energy that the challenged regulatory framework is entirely capable of individual application and of directly affecting the legal sphere of specific and identifiable individuals who engage in a particular activity subject to the regulation set forth in the Ley de Conservación de la Vida Silvestre and its implementing regulation. The Ministry's report identifies the commercial and professional activities of each of the petitioners, so that it is reasonable to conclude that the challenged regulatory framework may be susceptible to individual and direct application — that is, it directly affects the legal sphere of specific and identifiable individuals, under the regulations of the Ley de Conservación de la Vida Silvestre and its implementing regulation. In this way, it is clear that, contrary to the alleged defense of diffuse interests (intereses difusos), what underlies the case is some degree of dissatisfaction with the regulatory constraints to which the petitioners must submit in the course of the activity they carry out or intend to carry out; as the report of the Minister of Environment and Energy rightly notes, the petitioners are directly linked — as founders, managers, or employees — to various companies involved in the display of wildlife (fauna silvestre) or its tourist promotion.
In the case of Jardines de la Catarata S.A., it is a privately managed site registered with SINAC as a commercial zoo. Thus, it is not viable to invoke alleged conservation and environmental education concerns in order to make use of the mechanism of diffuse interests and thereby bring a direct constitutional challenge while bypassing the strict admissibility requirements set forth in the Ley de la Jurisdicción Constitucional, as noted in Considerandos I and II of this ruling.
Under this reasoning, and taking into account the identity of the petitioners and the challenged regulatory provisions, it is clear that the precedent of Sentencia N° 2018-18563, issued at 9:20 a.m. on November 7, 2108, is fully applicable to the present action, from which it must necessarily be concluded that, as in that prior instance, the petitioners lack standing to bring this proceeding, and it is therefore improper to consider and rule upon the issues raised. Accordingly, the appropriate course of action is to dismiss this action.
The parties are hereby warned that if they have submitted any paper documents, as well as objects or evidence contained in any additional device of an electronic, computer-based, magnetic, optical, telematic, or new-technology nature, such items must be retrieved from the court office within a maximum period of thirty business days counted from the notification of this judgment. Otherwise, all material not retrieved within that period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in Sesión N° 27-11 of August 22, 2011, artículo XXVI, and published in the Boletín Judicial N° 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in Sesión N° 43-12 held on May 3, 2012, artículo LXXXI.
Por tanto:

Separate reasons of Justices Rueda Leal and Fernández Argüello regarding the notion of diffuse interests, drafted by the former. In the majority's view, it is not viable to claim standing on the basis of diffuse interests when the challenged rule is capable of individual application and of directly affecting the legal sphere of specific and identifiable individuals. The undersigned cannot agree with this statement for the following reasons.
It is true, as the judgment notes, that the diffuse interest is characterized by affecting a group of people in a diffuse manner, so that it is, as it were, "spread out." However, we consider the majority's restriction — eliminating the existence of a diffuse interest whenever the provision is capable of individual application — to be untenable. Such a delimitation divides cases into a binary that contradicts reality itself, since there are situations in which a particular interest coexists alongside a diffuse interest. Among the subject matters that the Chamber recognizes as giving rise to a diffuse interest are, for example, the right to a healthy and balanced environment, electoral matters, and the right to life. On the environmental front, consider a government measure that eliminates a wildlife refuge. If the refuge were a state-owned one (artículo 82 inciso a) of the Ley de Conservación de la Vida Silvestre), a diffuse interest would exist.
However, if the refuge is private (numeral 82 inciso c) of the law), its elimination would clearly affect the owner, so there would be no standing based on a diffuse interest, even though the environment — in and of itself — may suffer the same degree of harm in both cases. Likewise, in electoral matters, a provision may affect a party's candidate (individual application) without thereby ruling out a violation of the integrity of the electoral process that concerns all citizens. In sum, the existence of a diffuse interest does not preclude a specific individual from experiencing a more intense injury to their particular interests than the general public. An application of the principio pro actione also leads to interpreting rules in a manner favorable to the protection of fundamental rights (derechos fundamentales) and the preservation of constitutional supremacy. To that extent, we consider that diffuse interests may subsist even in cases where individual application of a provision is possible.
That said, beyond this conceptual disagreement, we agree that the specific case must be dismissed because the aim is not to protect the environment as a diffuse interest, but rather to protect particular interests distinct from the environment — such as, for example, the ability of the companies or individuals concerned to continue their exhibition activities.

Res. Nº 2021-03851 NOTE BY JUSTICE GARRO VARGAS In this matter, I have concurred with the dismissal of the constitutional challenge. However, I have chosen to append a separate note in which I seek to articulate my position regarding standing and the admissibility (admisibilidad) of this specific proceeding.
In that regard, I consider it necessary to clarify that the majority's ruling does not mean that it may be accepted — as a general rule — that, whenever a claim for an individual and direct violation may exist, it is per se improper to assert that the parallel protection of diffuse interests is also warranted. That is to say, there will be cases in which, depending on the substantive legal situation affected, both scenarios may arise simultaneously.
Different is the case where it can reasonably be inferred that, although a diffuse interest is alleged, what underlies the claim is a clear personal and individual benefit of another nature or, indeed, another subjective right that does not simultaneously encompass the protection of diffuse interests. That second scenario is the one presented in the specific case before us, in which both the Procuraduría General de la República and the Minister of Environment and Energy demonstrated that the petitioners are acting in defense of a clearly individual interest related to the exercise of their ordinary commercial activity, rather than a genuine diffuse interest in protecting the environment.
Ultimately, it does not appear valid to use the "cloak" of a diffuse interest to secure the admissibility of a constitutional challenge, when it can be verified that what is being sought is the protection of other types of rights or interests that could well be protected in a constitutional challenge, but through the avenue contemplated in art. 75, párrafo 1°, of the Ley de la Jurisdicción Constitucional.

Resultando:
Los alegatos de la accionante de violación al derecho constitucional a un ambiente sano y ecológicamente equilibrado, se están utilizando como una excusa para acceder a esta jurisdicción por la vía de la legitimación directa, buscando tutelar su derecho subjetivo de carácter patrimonial, encubriéndolo como tutela al derecho a un ambiente sano y ecológicamente equilibrado. Nótese que, como se indica posteriormente, la accionante parte de una premisa errónea: que todos los zoológicos son, per se, un instrumento de conservación de la vida silvestre; y que sus reproches de fondo se refieren esencialmente a un aparente conflicto entre normas reglamentarias y normativa legal que debe ser conocido dentro del ámbito de la jurisdicción contenciosa, pues no logra fundamentar su relevancia constitucional, como lo resolvió la Sala en un caso similar: “los reproches de fondo del accionante se refieren, esencialmente, a un aparente conflicto entre una norma reglamentaria y otra normativa legal y reglamentaria, lo que supone una controversia que debe valorarse y resolverse dentro del ámbito de la legalidad ordinaria, tal como lo señala la reiterada jurisprudencia de esta Sala.
Incluso, aunque el accionante hace una breve referencia al derecho a un ambiente sano y ecológicamente equilibrado, lo hace para efectos, principalmente, de sustentar su eventual legitimación para interponer esta acción, pero, luego, no se desarrolla u argumenta, de manera amplia y suficiente, la afectación concreta o efectiva que pudiese generarse al citado derecho fundamental, con la normativa cuestionada” (Sentencia 10590-2016). Así las cosas, se considera que la accionante carece de legitimación y la acción deviene inadmisible.
Por otra parte, aborda por el fondo de los argumentos incoados por el representante de sociedad accionante, en el sentido que la Procuraduría General de la República considera que el Reglamento impugnado, no contiene disposición que contravengan la Constitución Política, o el Convenio de Diversidad Biológica, ni son contrarias a las reglas de la técnica y de la ciencia en esta materia. Para finalmente concluir que la accionante carece de legitimación pues la normativa reglamentaria cuestionada es susceptible de aplicación individual. Sus intereses son legítimamente defendibles en esta jurisdicción, pero no bajo la figura de la legitimación directa, sino cumpliendo los requisitos del párrafo primero, del artículo 75, de la Ley de la Jurisdicción Constitucional. Sus alegatos de violación al derecho constitucional a un ambiente sano y ecológicamente equilibrado se están utilizando como una excusa para acceder a esta jurisdicción por la vía de la legitimación directa, buscando tutelar un derecho subjetivo de carácter patrimonial encubriéndolo como tutela al derecho ambiental.
No se evidencia que los artículos impugnados del Decreto N° 40548-MINAE, contradigan el marco de configuración legislativa que reglamentan, ni que se contrapongan a los artículos 50 y 89, de la Constitución Política, el numeral 9, del Convenio sobre Diversidad Biológica, o principios constitucionales. Las normas impugnadas no carecen de sustento técnico. El análisis de los diversos criterios técnicos excede la competencia de este órgano asesor, así como el propósito y la naturaleza del control de constitucionalidad, por la vía de la acción.
La defensa de los intereses difusos es una excepción que habilita a los recurrentes a ejercer la acción directa, es necesario también analizar la definición de “interés difuso” a nivel doctrinal y jurisprudencial. Cita la doctrina nacional y jurisprudencial desde 1993, en que señala que la defensa de los intereses difusos no puede llegar a ser tan amplia y genérica que se confunda con el interés reconocido a todos los miembros de la sociedad de velar por la legalidad constitucional, ya que éste último está excluido del actual sistema de revisión constitucional (Sentencia N° 1997-002389 de las 14:39 horas del 29 de abril de 1999 (sic)). Adicionalmente, cita la Sentencia N° 2015-002693 de las 9:05 horas del 25 de febrero de 2015. Alega que en el caso, es claro para la Administración que los accionantes son un grupo de personas individualizables con intereses particulares y casos específicos que pueden ser presentados ante la Administración para su valoración.
Las actividades comerciales y profesionales de los accionantes lo demuestran, al argumentar que el señor Nombre05 es el apoderado de Jardines de la Catarata S.A., sitio de manejo privado inscrito ante el SINAC como zoológico comercial. Por lo que tienen una relación comercial con las actividades reguladas y la razón de la impugnación es en defensa de sus propios intereses personales y comerciales por lo que debieron acudir a la sede ordinaria contenciosa. Por lo que tienen una relación comercial con las actividades reguladas y la razón de la impugnación es en defensa de sus propios intereses personales y comerciales por lo que debieron acudir a la sede ordinaria contenciosa. Apunta a que no se logra demostrar la efectiva defensa de intereses difusos, sostiene que todos los accionantes tienen un interés directo y particular en procesos de permisos o sujetos de alguna manera a la Ley de Conservación de la Vida Silvestre y su reglamento, razón por la cual queda debidamente expuesto que no se trata de la defensa de intereses difusos, requisito para justificar una acción directa.
Argumenta que tampoco se demuestra que con las acciones haya tutela que corresponda a cada ciudadano de velar por el derecho a un ambiente sano y ecológicamente equilibrado, sino la defensa de derechos e intereses subjetivos en donde se argumenta, incluso, daño patrimonial o económico por el establecimiento de las regulaciones que procuran la conservación de la vida silvestre, en abierta contradicción entre los intereses individuales y colectivos. En sentido similar, cita las Sentencias N° 2016-17336, N° 1999-001830 y N° 1997-2389. En conclusión, argumenta que los accionantes pueden ser sujeto de actos que originen reclamaciones en la vía administrativa o jurisprudencial, y que al alegar la excepción del párrafo dos referida a la acción directa, procuran que se les aplique la excepción a la acción indirecta como opción para acudir a esta Sala de manera directa. De este modo, considera que se deben rechazarse las acciones pues no cumplir con los supuestos para accionar directamente, que al acudir a la jurisdiccional así desnaturalizan la defensa de los intereses difusos, instrumentos de defensa de los intereses colectivos ambientales.
En cuanto al fondo, se refiere al artículo 4, inciso 59, y numeral 105, del Reglamento a la Ley de Conservación de la Vida Silvestre, para señalar que en apego al criterio técnico, el legislador costarricense definió una normativa que ha categorizado los sitios de manejo, con objetivos y actividades diferenciadas. Se debe tener presente que las actividades se desarrollar con seres vivos, cuyas necesidades especiales según la especie y cada individuo no pueden ser ignoradas. De la simple lectura de las normas se aprecia que las actividades de reproducción de fauna silvestre o rescate de fauna no corresponden a la naturaleza ni a los objetivos de los zoológicos, las cuales se encuentran definidas en la Ley de Conservación de la Vida Silvestre. Las restricciones señaladas por los recurrentes se originan en la ley, no en el reglamento. Es la técnica y la ciencia la que ha imperado en la Ley al disponer que los rescates y rehabilitación de fauna para luego ser liberada tenga que realizarse en condiciones técnicas de aislamiento que asegure que el individuo no pierda en el proceso sus habilidades naturales para supervivencia en el medio natural, por ello ha sido reservada por ley para los Centros de Rescate.
Solo si la condición de salud condene al individuo al cautiverio permanente podrá trasladarse a un zoológico (artículo 18 bis, de la Ley), sitio donde la exhibición constante y el contacto con el cuidador y tratamientos veterinarios u otras prácticas de contacto modifican los comportamientos instintivos ante el ser humano y otros animales. Estas regulaciones con rango de ley no violentan en ningún aspecto el artículo 50, de la Constitución Política, ni el numeral 9, inciso c) del Convenio de Biodiversidad. Lo que vienen a hacer es a reforzar los compromisos adquiridos en la Convención al regular y estructurar con claridad lo que deben cumplir los sitios de manejo ex situ, mediante el uso del criterio técnico-científico. En el informe, el ministro se refiere a los principios constitucionales aplicables, a la conservación de la vida silvestre y los sitios de manejo, estableciendo que conservación es el manejo, uso y preservación de la vida silvestre por las generaciones presentes y futuras.
Tradicionalmente, se ha indicado que tiene dos componentes, uno supeditado al otro. La conservación in situ, la cual es el mantenimiento de la vida silvestre dentro de sus ecosistemas y hábitat naturales, la cual es la manera par que un ecosistema se mantenga sano. Por otro lado, está la conservación ex situ, la cual es una herramienta de apoyo a la conservación in situ, y consiste en el mantenimiento de la vida silvestre fuera de su hábitat. Para lograr una conservación adecuada, es necesario el respeto a los criterios técnicos científicos. Reitera los criterios expuestos en el anterior informe de la acción del año 2014 de la Unión Mundial para la Naturaleza (UICN). Los objetivos de los centros de rescate o zoocriaderos no comerciales, como sitios de manejo establecidos por la Ley de Conservación de la Vida Silvestre tiene fines de conservación, no son de lucro y sus labores están completamente apegadas a la ciencia y el criterio técnico.
Reitera los criterios expuestos en el anterior informe, sobre los objetivos de los zoológicos, el cumplimiento del artículo 50, de la Constitución Política, así como de 2 y 9, de la Convención sobre la Diversidad Biológica. Sostiene que las disposiciones impugnadas no limitan las actividades relacionadas con temas de conservación ex situ y por lo tanto no violentan la Convención, sino que contrariamente, las fortalecen. Los temas relacionados con el rescate, reinserción, reproducción o reintroducción de fauna silvestre en el territorio nacional, en los términos técnicos que lo coincide la Ley de Conservación de la Vida Silvestre están sujetos a la estricta regulación estatal. El análisis de la constitucionalidad de las normas no puede hacerse partiendo de la lectura de la norma aislada. Se requiere el estudio integral de la ley y de los diferentes aspectos regulados, así como la contextualización histórica, social y ética de las mismas.
Argumenta que los recurrentes atribuyen la lesión al Derecho constitucional de un ambiente sano y ecológicamente equilibrado a los siguientes argumentos: 1, Vuelve inviable la operación de los zoológicos por que se llegue a escasear los animales para exhibir; y 2, las disposiciones ignoran la importante labor que realizan los zoológicos en el mundo para la conservación ex situ. Ambos argumentos son simples apreciaciones personales no justificadas, como se ha explicado abundantemente, las regulaciones impugnadas no atentan contra la conservación y garantizan un mejor cumplimiento de los objetivos de cada sitio de manejo, permitiendo en encadenamiento entre las diferentes funciones de los sitios de manejo y garantizando el mejor trato de las mejores opciones para la fauna silvestre. Reitera que en Costa Rica los temas relacionados con reproducción y colecta de fauna silvestre es materia de regulación estatal por la razón jurídica de que son bienes de dominio público y por la razón técnica científica de que deben ser realizados solamente cuando medie interés público por entes especializados y con objetivos claros de conservación, autorizados y supervisados por el Estado.
Concretamente, sobre el artículo 47 (alquiler de colecciones o individuos de fauna), asevera que existen criterio que impiden un tratamiento contrario a la de bienes de dominio público, y que la Administración no cuenta con una norma que habilite ese uso, y por lo tanto, en estricto apego al principio de legalidad, no podría autorizar este tipo de actividad comercial de fauna silvestre. Los sujetos de derecho privado carecen de facultados suficientes para realizar un contrato, por no poseer el dominio de la fauna silvestre, así lo ha entendido el legislador en el artículo 95, de la Ley de Conservación de la Vida Silvestre, que quienes comercien, negocien, trafiquen o trasieguen animales silvestres, sus productos y derivados, sin el permiso respectivo del SINAC serán sancionados. En el artículo 49 (uso de animales silvestre en actividades audiovisuales), contrario a los señalado por los accionantes, hay criterio y respaldo científico suficiente para afirmar de manera inequívoca que la manipulación sin criterio técnico de los animales silvestres no contribuye a la educación ambiental, la conservación ni el uso sostenible de la vida silvestre (esto con fundamento en documento suscrito del Hospital de Especies Menores y Silvestres de la Escuela de Medicina Veterinaria de la Universidad Nacional).
En cuanto al artículo 52 (exhibiciones móviles o itinerantes), con lo que se procura erradicar las prácticas ilegítimas que se venían dando en el país donde los bienes de dominio público eran tratados por los particulares a su antojo en abierta violación de la normativa que protege a los mismos como elementos de la biodiversidad y patrimonio nacional, para la fauna toda la legislación sobre bienestar animal. No reúnen ni podrán reunir las mínimas condiciones de bienestar para los especímenes de fauna que son objeto de “exhibición”. Bajo la ley los zoológicos son los sitios de manejo designados para garantizar que los animales silvestres mantengan condiciones de vida adecuada de forma atractiva y didáctica para el público, las exhibiciones se permiten con fines de educación ambiental, la Ley de Conservación de la Vida Silvestre establece que los sitios de manejo autorizado para estos son los zoológicos y zoocriaderos artesanales de manejo restringido.
Las exhibiciones móviles o itinerantes están restringidos a los animales silvestres disecado, basado en criterios técnicos y científicos. Las exhibiciones móviles o itinerantes de animales silvestres vivos no respetan los principios de bienestar animal, sometiéndolos a estrés al ser traslados fuera de su ambiente conocido a otro sitio donde cambia factores del entorno. Hay consecuencias negativas de la exhibición móvil o itinerante porque promueve la mascotización, el manejo no es realizado por personal experto o capacitado, promueve el maltrato animal, aumenta el riesgo de contagio de enfermedades, entre otras cosas. Sobre el artículo 88 (formato del plan de manejo: barreras de seguridad), son temas que deben ser discutidos en la vía ordinaria y no en la vía de constitucionalidad, además de que, el requisito cuestionado por el accionante estaba vigente desde el 2005. Sobre el artículo 115 (zoocriaderos comerciales de artrópodos), señala que no tienen dentro de sus funciones la exhibición o educación ambiental, reservado por ley a los zoológicos y zoocriaderos artesanales de manejo restringido.
Las normas impugnadas se complementan con las definiciones de ley, tanto la clasificación de los sitios de manejo como las actividades que según su naturaleza y objetivos pueden desarrollar vienen impuestos por la Ley, y no por el reglamento. No hay quebrantamiento al principio de igualdad ante la ley, pues regula y ordena actividades, que la misma ley ha conceptualizado de forma diferente. Los de manejo restringido solo reproducen especies cuyas poblaciones no están en peligro de extinción o población restringida y que dentro de los objetivos de ley tienen la educación ambiental y la restauración de ecosistemas, no la comercialización. Tanto técnicamente como legalmente son diferentes y la administración está facultada por ley para regular las actividades de forma diferenciada. En cuanto al transitorio II del Reglamento, esa una herramienta para que los sitios de manejo puedan realizar una transición gradual hacia el cumplimiento de las reformas al Reglamento, y debe ser analizado en conjunto con el transitorio I. Es falso que los sitios de manejo estén obligados a implementar normas cuestionadas, por cuanto los permisos que actualmente están vigentes se mantienen hasta su vencimiento.
Y sobre las alegaciones de violación al derecho a ejercer una actividad económica que permita la libertad de empresa y la libertad de contratación, remite a la Resolución N° 2018-002844 de las 9:20 horas del 21 de febrero de 2018. Solicita que la acción sea rechazada por falta de legitimación, y subsidiariamente, sin lugar.
Redacta el Magistrado Salazar Alvarado; y,
Considerando:
I.Sobre la admisibilidad. El artículo 75, de la Ley de la Jurisdicción Constitucional, regula los presupuestos que determinan la admisibilidad de las acciones de inconstitucionalidad, exigiendo la existencia de un asunto pendiente de resolver en sede administrativa o judicial en el que se invoque la inconstitucionalidad, requisito que no es necesario en los casos previstos en los párrafos segundo y tercero de ese artículo, es decir, cuando por la naturaleza de la norma no haya lesión individual o directa, cuando se fundamente en la defensa de intereses difusos o que atañen a la colectividad en su conjunto, o cuando sea presentada por el procurador General de la República, el contralor General de la República, el fiscal General de la República o el defensor de los Habitantes, en estos últimos casos, dentro de sus respectivas esferas competenciales. Dispone el texto en cuestión que procede cuando "por la naturaleza del asunto, no exista lesión individual ni directa". En segundo lugar, se prevé la posibilidad de acudir en defensa de "intereses difusos"; este concepto, cuyo contenido ha ido siendo delineado paulatinamente por parte de la Sala, podría ser resumido en los términos empleados en la Sentencia N° 1993-3750 de las 15:00 horas del 30 de julio de 1993:
"…Los intereses difusos, aunque de difícil definición y más difícil identificación, no pueden ser en nuestra ley -como ya lo ha dicho esta Sala- los intereses meramente colectivos; ni tan difusos que su titularidad se confunda con la de la comunidad nacional como un todo, ni tan concretos que frente a ellos resulten identificados o fácilmente identificables personas determinadas, o grupos personalizados, cuya legitimación derivaría, no de los intereses difusos, sino de los corporativos que atañen a una comunidad en su conjunto. Se trata entonces de intereses individuales, pero a la vez, diluidos en conjuntos más o menos extensos y amorfos de personas que comparten un interés y, por ende reciben un perjuicio, actual o potencial, más o menos igual para todos, por lo que con acierto se dice que se trata de intereses iguales de los conjuntos que se encuentran en determinadas circunstancias y, a la vez, de cada una de ellas. Es decir, los intereses difusos participan de una doble naturaleza, ya que son a la vez colectivos -por ser comunes a una generalidad- e individuales, por lo que pueden ser reclamados en tal carácter".
En síntesis, los intereses difusos son aquellos cuya titularidad pertenece a grupos de personas no organizadas formalmente, pero unidas a partir de una determinada necesidad social, una característica física, su origen étnico, una determinada orientación personal o ideológica, el consumo de un cierto producto, etc. El interés, en estos casos, se encuentra difuminado, diluido (difuso) entre una pluralidad no identificada de sujetos. Esta Sala ha enumerado diversos derechos a los que les ha dado el calificativo de "difusos", tales como: el medio ambiente, el patrimonio cultural, la defensa de la integridad territorial del país y del buen manejo del gasto público, entre otros. Al respecto, deben ser efectuadas dos precisiones: por un lado, los referidos bienes trascienden la esfera tradicionalmente reconocida a los intereses difusos, ya que se refieren, en principio, a aspectos que afectan a la colectividad nacional y no a grupos particulares de ésta; un daño ambiental no afecta apenas a los vecinos de una región o a los consumidores de un producto, sino que lesiona o pone en grave riesgo el patrimonio natural de todo el país e incluso de la Humanidad; del mismo modo, la defensa del buen manejo que se haga de los fondos públicos autorizados en el Presupuesto de la República es un interés que atañe a todos los habitantes de Costa Rica, no tan solo de un grupo cualquiera de ellos.
Por otra parte, la enumeración que ha hecho la Sala Constitucional no pasa de una simple descripción propia de su obligación -como órgano jurisdiccional- de limitarse a conocer de los casos que le son sometidos, sin que pueda, de ninguna manera, llegar a entenderse que solo pueden ser considerados derechos difusos aquellos que la Sala expresamente haya reconocido como tales.
II.Sobre los intereses difusos y la legitimación de los accionantes en el caso bajo estudio. Las accionantes señalan que su legitimación proviene de la defensa de los intereses difusos respecto de la protección al derecho a un ambiente sano y ecológicamente equilibrado. Al respecto, cabe indicar que en reiterada jurisprudencia de este Tribunal, los supuestos del párrafo segundo, del artículo 75, de la Ley de la Jurisdicción Constitucional, constituyen excepciones a la regla contenida en el párrafo primero del mismo artículo, que deben ser analizados cuidadosamente en cada caso concreto. El interés difuso ha sido entendido como aquel interés relacionado con un derecho o situación jurídica de naturaleza especial y particular, que puede ser compartido por otras personas, formando todos los interesados un grupo o categoría determinada. Así, la vulneración de ese derecho puede afectar a todos en general o a cada uno en particular, de ahí que cualquier miembro de la colectividad puede interponer la acción para proteger el derecho que se estima lesionado. Sobre el particular, la reiterada jurisprudencia de la Sala indica que:
"Se ha señalado que se trata un tipo especial de interés, cuya manifestación es menos concreta e individualizable que la del colectivo recién definido en el considerando anterior, pero que no puede llegar a ser tan amplio y genérico que se confunda con el reconocido a todos los miembros de la sociedad de velar por la legalidad constitucional, ya que éste último -como se ha dicho reiteradamente- está excluido del actual sistema de revisión constitucional. Se trata pues de un interés distribuido en cada uno de los administrados, mediato si se quiere, y diluido, pero no por ello menos constatable, para la defensa, en esta Sala, de ciertos derechos constitucionales de una singular relevancia para el adecuado y armónico desarrollo de la sociedad. Son las especiales características de éstos derechos por sí mismas y no la particular situación frente a ellos de los sujetos que puedan ostentarlos, la clave para la distinción y determinación de la presencia de los llamados intereses difusos tal y como se manifestado en distintas resoluciones como la 03705-93 de las quince horas del treinta de julio para el derecho al ambiente, la número 05753-93 de las catorce horas cuarenta y cinco del nueve de noviembre de ese mismo año para la defensa del patrimonio histórico y la número 00980-91 de las trece y treinta del veinticuatro de mayo de mil novecientos noventa y uno para la materia electoral" (Sentencia número 360-99 de las 15:51 horas del 20 de enero de 1999)”.
De esta definición, es posible estimar que el interés difuso está conformado por un elemento eminentemente subjetivo, relativo a su pertenencia o titularidad del interés, y otro objetivo, relacionado con la incidencia del bien en la sociedad, que lo distingue de otras situaciones jurídicas. En relación con el primero -el subjetivo-, es claro que la misma se encuentra difuminada en un grupo humano no individualizado, que coparticipa en el disfrute del bien jurídico objeto del interés, pero cuya conformación no resulta de un conjunto de sujetos identificable, abarcable y de contornos relativamente nítidos, como sí ocurre en el interés colectivo. Y desde la perspectiva objetiva, debe aclararse que no todo interés "difuminado" adquiere la categoría jurídica de "interés difuso", sino únicamente aquellos impregnados de una profunda relevancia social, cuya valoración resulta de las circunstancias de cada caso –ver, entre otras, Sentencias N° 2006-15960 y N° 2014-4904-.
En este sentido, así como se ha dicho que ese interés no puede ser tan amplio y genérico que se confunda con el derecho a velar por la legalidad constitucional -lo que supondría la instauración tácita de una acción popular no contemplada por la Ley de la Jurisdicción Constitucional-, tampoco puede ser tan concreto que permita el reclamo individual, pues en tal caso, la legitimación derivaría de ese reclamo -ver, entre otras, Sentencias N° 2008-13442, N° 2009-300 y N° 2009-9201-. Así, ejemplos de tales intereses son el derecho a un ambiente sano y armonioso, la defensa del patrimonio histórico, la materia electoral, la defensa del derecho a la salud y la fiscalización de los fondos públicos. De tal forma, en el caso bajo estudio, donde las accionantes refieren su legitimación respecto de la defensa de intereses difusos en materia de protección a un ambiente sano y ecológicamente equilibrado, lo que corresponde es pronunciarse conforme se indica en los considerandos siguientes.
III.Sobre las coadyuvancias. En la acción se apersonaron gran cantidad de interesados para coadyuvar en la pretensión de los accionantes. Estas gestiones fueron incoadas entre las fechas del 20 y 21 de febrero de 2018. La admisibilidad de las mencionadas solicitudes fue resuelta por resolución de la presidencia de la Sala, de las 11:18 horas de 1° de marzo de 2018, tomando en cuenta que la primera publicación del aviso se dio el 30 de enero de 2018, de modo que conforme al artículo 83, de la Ley de la Jurisdicción Constitucional, tuvo por procedente únicamente las gestiones de coadyuvancia presentadas el 20 de febrero de 2018. En el mismo sentido, se resolvió para las otras coadyuvancias que fueron presentadas con posterioridad a esa fecha, por resolución de las 10:22 horas del 17 de abril de 2018. Con el fin de notificar a esa cantidad de intervinientes, se procedió a la notificación por edictos publicados en los Boletines Judiciales N° 048 del 14 de marzo, y para las últimas gestiones, en el N° 075 del 30 de abril, ambos de 2018.
IV.Objeto de la impugnación. Las acciones de inconstitucionalidad acumuladas se dirigen a impugnar los artículos 4, inciso 59), 47, 49, 52, 62, 88, 105, 106 y el Transitorio II, del Decreto Ejecutivo N° 40548-MINAE, que es Reglamento a la Ley de Conservación de la Vida Silvestre, N° 7317 del 12 de julio de 2017. Por un lado los accionantes -a favor de los zoológicos- impugnan las disposiciones por no autorizarles llevar a cabo actividades de rescate, reinserción, reintroducción o reproducción, así como la obligación de contar con planes de anticoncepción y prohibición de la reproducción, así como la prohibición de reintroducir fauna silvestre. Por otra, Jardines de la Catarata Sociedad Anónima, reclama el cambio de enfoque dado en el Reglamento impugnado, para que los zoológicos no sigan recibiendo animales rescatados y su reproducción, la prohibición de alquiler de colecciones o individuos de fauna silvestre, por restringir el uso de animales con fines didácticos y educativos a través de materiales audiovisuales, por no prever la posibilidad de exposiciones de vida silvestre disecada en los zoológicos (solo para exhibiciones móviles o itinerantes), la exigencia de las tres barreras es incompatible con el tipo de contención que mantiene el Zoológico Jardines de la Catarata, entre otras cosas. Reclaman la violación al artículo 50 y 89, Constitucionales, así como a la Convención sobre la Diversidad Biológica.
De este modo, en las acciones acumuladas se impugnan los siguientes artículos del Reglamento a la Ley de Conservación de la Vida Silvestre:
“Artículo 4.- Definiciones. Para los fines de la aplicación de la LCVS y de este reglamento, además de las definiciones contenidas en el artículo 1, 2 y 5 (sic) de la LCVS, se entenderá por:

59. Zoológico con fines comerciales: Sitio de manejo de fauna que cumple lo establecido en la LCVS para zoológicos, estarán autorizados para adquirir, de manera legal, animales silvestres para su exhibición, siempre que estos estén contemplados en el plan de colección.
No estarán autorizados para la reproducción, de acuerdo con las regulaciones establecidas por la LCVS y este reglamento”.
[…]
“Artículo 47.- Alquiler de colecciones o individuos de fauna silvestre. Los especímenes de fauna silvestre no podrán ser objeto de alquiler bajo ninguna circunstancia”.
[…]
“Artículo 49.- Uso de animales silvestres en actividades audiovisuales. Para el uso de la fauna silvestre en compañas publicitarias, documentales, reportajes, rodajes, filmaciones y otros similares, se deberá seguir el Protocolo elaborado por el SINAC para los efectos.
Se deberá procurar que las imágenes y los mensajes que se comuniquen con los materiales audiovisuales, fortalezcan el respeto hacia la fauna silvestre, sus necesidades y comportamientos naturales, así como el respeto a la normativa vigente y la no promoción de prácticas de mascotización y cautiverio ilegal.
Todas las producciones audiovisuales que utilicen fauna silvestre, deberán incluir en los créditos y de manera legible la siguiente leyenda “La fauna silvestre debe permanecer en su hábitat y condiciones naturales. Las filmaciones hechas en Costa Rica incentivan el respeto y conservación de la fauna y flora silvestre”.
El uso de imágenes o videos que muestren a personas en contacto directo con la fauna silvestre se permitirá solamente en procedimientos veterinarios o técnico-científicos necesarios para la conservación y bienestar del animal silvestre, y solo podrá ser realizado por personal técnico capacitado del sitio de manejo. No se permitirán manipulaciones a la fauna silvestre por visitantes, voluntarios, turistas y similares. El ingreso a las jaulas de estancia, preliberación será restringido y autorizado únicamente al personal técnico.
En caso de que se pretenda transportar especímenes silvestres fuera del sitio de manejo que los mantiene en custodia para ser usados en actividades audiovisuales, el interesado deberá hacer la solicitud de permiso por escrito al Área de Conservación donde está ubicado el sitio de manejo que mantiene los animales silvestres en cautiverio. La solicitud deberá incluir fecha del traslado, cantidad y tipo de animales, objetivos de la actividad audiovisual, veterinario y biólogo responsables del manejo, condiciones de transporte y manejo, equipo para el manejo, tiempo que el animal estará fuera del sitio de manejo, entre otras especificadas en el protocolo correspondiente.
El SINAC valorará la solicitud y resolverá vía resolución administrativa si aprueba o rechaza el transporte y manejo de los animales para la actividad específica. Solamente se podrá autorizar el transporte fuera del sitio de manejo de animales no liberables de algunas especies de los grupos taxonómicos aves, reptiles y anfibios, analizando cada caso en específico. Las condiciones otorgadas se indicarán en la resolución administrativa.
El Área de Conservación tendrá 15 días para resolución la solicitud.
En caso de que el permiso sea otorgado, el interesado deberá realizar el pago del monto correspondiente y presentar el comprobante original de pago ante el Área de Conservación respectiva.
Queda exento del procedimiento establecido en este artículo el material audiovisual realizado por aficionado que pretendan únicamente la preservación de un recuerdo y que por ello no persigue fines comerciales o de lucro, aunque sí deberán respetar la fauna silvestre, sus necesidades y comportamientos naturales, la normativa vigente y no deberán incurrir en comportamiento de mascotización”.

Artículo 52.- Exhibiciones móviles o itinerantes. El SINAC podrá autorizar exhibiciones móviles o itinerantes de animales silvestres disecados, sus partes, productos y subproductos, con el único objetivo de brindar educación ambiental en centros educativos del sistema educativo nacional. La colección debe estar inscrita en el Sistema Nacional de Información de Vida Silvestre.
Para la autorización de este tipo de exhibición el interesado deberá presentar la solicitud de acuerdo a lo establecido en el artículo 14 de este reglamento, junto con una propuesta de exhibiciones móviles o itinerantes que incluya lo siguiente: objetivo, grupo(s) meta, descripción de los ejes temáticos, tipo de actividad durante la exhibición, especímenes a exhibir y número único de identificación, diseño o croquis de la exhibición.
La autorización que otorga el SINAC se da sin perjuicio de los demás requisitos que deba cumplir el interesado para la realización del evento de exhibición ante otras dependencias públicas o privadas.
La resolución administrativa determinará las condiciones específicas para la realización de la exhibición durante los eventos, y será otorgada por un plazo máximo de tres años, prorrogable por plazo iguales. La resolución autorizará el transporte de la colección”.

“Artículo 88.- Formato del plan de manejo. El plan de manejo deberá contener:
(…)
h. Instalaciones:
(…)
i. Barreras de seguridad: Todo sitio de manejo de vida silvestre deberá tener al menos dos barreras de seguridad. Una primera barrera será la del recinto, que contenga directamente al individuo o individuos. Los zoológicos y zoocriaderos artesanales con manejo restringido, deben tener una segunda barrera, al menos a un metro de la primera barrera con el objetivo de contener a los visitantes para que no toquen la primera barrera. Barrera perimetral: todo sitio de manejo de fauna deberá tener una cerca perimetral, la cual deberá separar las instalaciones de los terrenos vecinos, siendo una barrera en caso de escapes.
ii. Especies de serpientes venenosas: En el caso particular de los zoológicos con especies de serpientes venenosas, la infraestructura deberá considerar situaciones de riesgo como catástrofes naturales, incendios, robos, entre otros, de manera que se garantice que los animales no se escapen o perjudiquen a seres humanos, animales silvestres y domésticos. Asimismo deberán construirse tres barreras de seguridad entre las serpientes y los visitantes.
[…]
“Artículo 105.- Zoológicos. Los zoológicos son sitios de manejo autorizados para la exhibición de fauna silvestre, con o sin fines comerciales. Podrán desarrollar programas de conservación, educación, exhibición e investigación. No están autorizados para realizar labores de rescate, reinserción, reintroducción o reproducción de fauna. Estos sitios deben tener un plan de anticoncepción para los animales silvestres que manejen en cautiverio, el cual estará contenido en el plan de manejo”.
“Artículo 106.- Zoológicos comerciales. Los zoológicos comerciales estarán autorizados para adquirir, de manera legal, animales silvestres para su exhibición, siempre que estos estén contemplados en el plan de colección. Para ello, deberán mantener registros que comprueben el origen de cada uno de los especímenes y solicitar los permisos establecidos en este reglamento para la importación y comercialización. Estos sitios no estarán autorizados para la reproducción”.
Y, finalmente, se impugna la siguiente disposición transitoria del Reglamento:
“Transitorio II. En un plazo máximo de seis meses posteriores a la publicación de este reglamento, todos los sitios del manejo del país deberán presentar ante el Área de Conservación correspondiente, un plan de acción que detalle los cambios organizativos, de infraestructura y manejo técnico para el cumplimiento de la LCVS y la adaptación a este reglamento”.
De conformidad con el Reglamento N° 40548-MINAE del 12 de julio de 2017, este entró en vigencia a partir del 14 de febrero de 2018.
V.Sobre la legitimación de los accionantes y el precedente que determina su improcedencia. Ahora bien, con anterioridad, la Sala conoció de una acción de inconstitucionalidad en la que se discutían los artículos 33, 50, 51, 110 y 115, del Decreto Ejecutivo N° 40548-MINAE, en similares términos a como se hace en esta oportunidad, por cuanto las disposiciones impugnadas afectaban el régimen de operación de zoológicos autorizados y zoocriaderos artesanales. Las acciones acumuladas que ahora nos ocupa, estarían controladas por lo resuelto con anterioridad. Mediante la Sentencia N° 2018-18563 de las 9:20 horas del 7 de noviembre de 2018, dictada dentro del expediente N° 17-019669-0007-CO, se estableció que:
“III.- La falta de legitimación de los accionantes en este caso.- Los accionantes se apersonan en esta acción bajo el alegato de legitimación de defensa de intereses difusos, en concreto, en defensa del derecho al ambiente. Sin embargo, por las razones que se detallan a continuación, esta Sala constata, según los reproches de fondo de los accionantes, que no responden en realidad a la defensa del derecho al ambiente.
En primer lugar, tal como lo afirma la Procuraduría General de la República en su informe, la defensa del derecho al ambiente por parte de los accionantes se está utilizando para acceder a esta jurisdicción por la vía de la legitimación directa, cuando en realidad lo que se busca es tutelar un derecho subjetivo de carácter patrimonial. Impugnan los accionantes la restricción establecida en las normas impugnadas, de no permitir las visitas en los zoocriaderos con fines comerciales y los zoocriaderos comerciales de artrópodos, pues consideran que, impedir tales visitas limita una educación ambiental más efectiva y provechosa. Pero más que la limitación a la educación ambiental, cuando indican que son dueños de zoocriaderos y que, no hay ninguna razón objetiva que justifique el hecho que solo cierto tipo de zoocriaderos puedan recibir visitantes, se observa que su interés es muy particular, a saber, que se permitan las visitas en los zoocriaderos que poseen.
En segundo lugar, la defensa de la sostenibilidad económica de los zoocriaderos con fines comerciales y los zoocriaderos comerciales de artrópodos, no puede catalogarse como un interés difuso, pues atañe, según lo expresa la Procuraduría General de la República en su informe, a una colectividad muy concreta de personas, sea, los propietarios de ciertos sitios de manejo. Pretender para sí mismos el objetivo de educación ambiental, bajo el argumento de que ello les dará mejor sostenibilidad económica, no es la defensa de un interés difuso, si de un interés directo y particular.
En tercer lugar, si los accionantes consideran que debió conferirse a otros sitios de manejo el objetivo de educación, y no solamente a los zoocriaderos artesanales con manejo restringido, tienen la posibilidad, según lo informa el Ministro de Ambiente y Energía, de solicitar desarrollar un plan de manejo e inscribir ambos sitios (zoocriadero comercial y zoocriadero artesanal de manejo restringido). Así que, no hay legitimación ni sustento para alegar violación al principio de igualdad, si la posibilidad la tienen abierta.
En cuarto lugar, la normativa reglamentaria cuestionada es susceptible de aplicación individual, incidiendo directamente en la esfera jurídica de personas singulares. Así que las personas accionantes pueden ser sujeto de actos que originen reclamaciones en la vía administrativa o jurisdiccional, no siendo factible alegar en estos casos, legitimación directa por la vía de la defensa de intereses difusos.
En quinto lugar, el argumento de que la visitación pública va en pro del ambiente resulta en una contradicción, puesto que, más bien, como se indica en el informe de la Procuraduría General de la República, la visitación pública afecta a la fauna silvestre en cautiverio, pudiendo provocar malestar, miedo o estrés, que afecten su reproducción o bienestar, e incluso comprometer su supervivencia. Indica el Ministro que la ciencia ha estudiado estos procesos y no recomienda combinar las actividades de zoocría para comercialización con las actividades de visitación. Consecuentemente, los alegatos de los accionantes, más que en defensa del derecho al ambiente, resultan en su contra.
En conclusión, dado que, la defensa del derecho al ambiente por parte de los accionantes se está utilizando para acceder a esta jurisdicción por la vía de la legitimación directa, cuando en realidad lo que se busca es tutelar un derecho subjetivo de carácter patrimonial. Dado que, la defensa de la sostenibilidad económica de los zoocriaderos con fines comerciales y los zoocriaderos comerciales de artrópodos, no puede catalogarse como un interés difuso, y pretender para sí mismos el objetivo de educación ambiental, bajo el argumento de que ello les dará mejor sostenibilidad económica, no es la defensa de un interés difuso, si de un interés directo y particular. Dado que, no hay legitimación ni sustento para alegar violación al principio de igualdad, si la posibilidad de solicitar un tipo de manejo de zoocriadero que sí permita las visitas, la tienen abierta. Dado que, la normativa reglamentaria cuestionada es susceptible de aplicación individual, incidiendo directamente en la esfera jurídica de personas singulares, no siendo posible entonces alegar la defensa de un interés difuso.
Y dado que, los alegatos de los accionantes, más que en defensa del derecho al ambiente, resultan en su contra, pues la ciencia no recomienda combinar las actividades de zoocría para comercialización con las actividades de visitación. No considera esta Sala que los accionantes cuenten con legitimación para acceder a esta acción de inconstitucionalidad. En consecuencia debe declarar sin lugar esta acción, tal como en efecto se hace”.
Ahora bien, conforme a lo señalado por la Procuraduría General de la República, es que las acciones están dirigidas a impugnar el desmejoramiento de la conservación ex situ y la ausencia de lo que acusan los accionantes es la falta de fundamentos técnicos y contradicción con la Ley de Conservación de la Vida Silvestre, con afectación a la sostenibilidad económica de los zoológicos. Coincide también con el Ministerio de Ambiente y Energía que la normativa que se cuestiona sí es totalmente susceptible de aplicación individual y de incidir directamente en la esfera jurídica de personas singulares e identificables, que ejercen una determinada actividad, sujeta a la regulación señalada en la Ley de Conservación de la Vida Silvestre y su reglamento. En el informe del Ministerio se señalan las actividades comerciales y profesionales de cada uno de los accionantes, de modo que es razonable concluir que la normativa que se impugna puede ser susceptible de aplicación individual y directa, es decir, que incide directamente en la esfera jurídica de personas singulares e identificables, bajo las regulaciones de la Ley de Conservación de la Vida Silvestre y su reglamento.
De tal manera, es claro que contrario a la aducida defensa de intereses difusos, lo que se encuentra de por medio es algún grado de inconformidad con la sujeción a que deben someterse para la regulación de la actividad que ejercen o pretenden ejercer; véase que como bien refiere el informe del Ministro de Ambiente y Energía, los accionantes se encuentran directamente relacionados como fundadores, gerentes o servidores de diversas empresas relacionadas con la exhibición de fauna silvestre o su promoción turística. En el caso de Jardines de la Catarata S.A., es un sitio de manejo privado inscrito en el SINAC como zoológico comercial. Así, resulta inviable aducir presuntos problemas de conservación y de educación ambiental, para utilizar la figura de los intereses difusos y promover con ello una acción de inconstitucionalidad directa obviando los estrictos requisitos de admisibilidad señalados en la Ley de la Jurisdicción Constitucional, tal como se indicó en los considerandos I y II de esta resolución.
Bajo esta inteligencia, y tomando en consideración la identidad de las accionantes y de la normativa cuestionada, es claro que el precedente de la Sentencia N° 2018-18563, de las 9:20 horas del 7 de noviembre de 2108, resulta plenamente aplicable a esta acción que ahora se conoce, de donde debe necesariamente concluirse que, al igual que en aquella anterior ocasión, los accionantes carecen de legitimación para la interposición de este proceso, por lo que resulta improcedente conocer y pronunciarse sobre los aspectos planteados. De tal manera, lo procedente es declarar sin lugar esta acción.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara sin lugar la acción. Los Magistrados Rueda Leal y Fernández Argüello dan razones diferentes respecto de la noción de intereses difusos. La Magistrada Garro Vargas consigna nota.- Fernando Castillo V.

Razones distintas de los magistrados Rueda Leal y Fernández Argüello respect de la noción de intereses difusos, con redacción del primero. En criterio de la mayoría, resulta inviable alegar legitimación por intereses difusos cuando la norma cuestionada es susceptible de aplicación individual e incidir directamente en la esfera jurídica de personas singulars e identificables. Los infrascritos no pueden compartir esta afirmación por los siguientes motivos.
Es cierto, como indica la sentencia, que el interés difuso se caracteriza por concernir a aun a un grupo de personas, de manera que está “difuminado”. Sin embargo, consideramos que la restricción que efectúa la mayoría -eliminando la existencia de un interés difuso cuando la disposición sea susceptible de aplicación individual – es insostenible. Tal delimitación divide los casos en un binomio que contrasta con la misma realidad, pues existen situaciones en que al lado del interés difuso confluye un interés particular. Entre las materias que la Sala reconoce como interés difuso está, verbigracia, el derecho al ambiente sano y equilibrado, la materia electoral y el derecho a la vida. En el tema ambiental, piénsese en una disposición estatal que elimine un refugio de vida silvestre. Si se tratara de un refugio estatal (artículo 82 inciso a) de la de Conservación de la Vida Silvestre), entonces existiría un interés difuso.
Sin embargo, si el refugio es privado (numeral 82 inciso c) de la ley), entonces su eliminación afectaría claramente al propietario, por lo que no existiría legitimación por interés difuso, a pesar de que el ambiente – en si mismo- puede tener el mismo grado de afectación en ambos casos. Igualmente, en materia electoral, una disposición puede afectar al candidato de un partido (aplicación individual), sin descartar por ello una vulneración para la pureza el proceso electoral que concierne a todos los ciudadanos. En definitiva, la existencia e un interés difuso no excluye que un sujeto pueda experimentar una lesión de mayor intensidad en sus intereses particulares que la generalidad de personas. Una aplicación del principio pro actione también lleva a interpretar las normas de manera favorable para la tutela de los derechos fundamentales y la protección de la supremacía constitucional. En ese tanto, estimamos que los intereses difusos pueden subsistir incluso en casos que permitan la aplicación individual de una disposición.
Ahora bien, aparte de esa discrepancia conceptual, coincidimos en que el caso concreto debe ser declarado sin lugar porque no se pretende la tutela del ambiente, en tanto interés difuso, sino de intereses particulares distintos al ambiente, como es, verbigracia, que las empresas o sujetos concernidos puedan continuar su actividad de exhibición.

Res. Nº 2021-03851 NOTA DE LA MAGISTRADA GARRO VARGAS En este asunto he concurrido con mi voto en la desestimatoria de la acción de inconstitucionalidad. Pero he optado por consignar una nota separada con la que pretendo perfilar mi criterio en relación con la legitimación y la admisibilidad de este proceso en concreto.
En ese sentido, considero necesario precisar que lo resuelto por la mayoría no significa que se pueda admitir —como regla general― que, cuando pueda existir un reclamo por una violación individual y directa, no procede per se afirmar que no corresponde tutelar paralelamente la protección de los intereses difusos. Es decir, habrá casos en que en atención a la situación jurídica sustancial afectada podría configurarse ambos supuestos.
Distinto es el caso en que razonablemente se pueda desprender que, si bien se alega un interés difuso, lo que subyace es una clara utilidad personal e individual de otra naturaleza o, incluso, otro derecho subjetivo que no engloba paralelamente la protección de los intereses difusos. Ese segundo supuesto es el que se nos presenta en el caso concreto, en el cual, tanto la Procuraduría General de la República como el Ministro de Ambiente y Energía, evidenciaron que los accionantes están accionando en resguardo de un interés de corte claramente individual, relacionado con el ejercicio de su actividad comercial ordinaria, más que un genuino interés difuso de tutelar el medio ambiente.
En definitiva, no parece que resulte válido utilizar “el ropaje” de un interés difuso para garantizar la admisibilidad de una acción de inconstitucionalidad, cuando se puede corroborar que lo que se procura es el resguardo de otro tipo de derechos o intereses que bien podrían ser tutelados en una acción de inconstitucionalidad, pero a través del supuesto contemplado en el art. 75, párrafo 1°, de la Ley de la Jurisdicción Constitucional.
