Writ of amparo proceeding in case number 21-010481-0007-CO, filed by [Nombre01 001], national identification number [Valor CED01], against the MUNICIPALIDAD DE ALAJUELA AND THE MINISTERIO DE SALUD.
FINDINGS OF FACT:
"(...)
SECOND: On June 11, 2021, the undersigned visited the indicated urbanization, since there is no exact address for the residence of Mr. [Nombre01 003]. At the site, several neighbors were consulted without success; finally, two other neighbors, Mr. [Nombre01 004] and Mr. [Nombre01 005], indicated that the person in question is the owner of the land behind their homes and is the person who sold them the lots to build on that site. Mr. Nombre02 does not live there but in San José.
On that small street there are approximately 16 dwellings, some built quite some time ago and a row of newer homes (2 years old) on the left (approximately 8 new houses) (photograph 1).
The neighbors explain the situation as follows: They indicate that when the new row of houses was built on the left side of the street, the neighbors on the right side began to experience flooding from stormwater (aguas pluviales), since the water had less room to flow; it was for this reason that the Municipalidad carried out work to create a deep drainage ditch in front of the entrances to the houses on the right side of the street, correcting the problem for them.
The Municipalidad told the new neighbors (on the left side) that if they wished, they could discharge wastewater to the front, but Mr. [Nombre01 004] indicates that they installed absorption tanks (tanques de absorción) on their properties and drainage systems so that the water from their homes would not affect their neighbors across the street.
Furthermore, in conversation with older neighbors, they indicated that several years ago the Ministerio de Salud had corrected the improper handling of wastewater and that neighbors were required to close the exterior outlets through which wastewater was being discharged from their properties.
They then indicate that the Municipalidad carried out some work (2019) seeking to channel stormwater along the center of the street, but that they encountered a large rock at the end of the street; subsequently, the pandemic began and the workers withdrew. Neighbors indicate that the street was left cut off, that a large hole was left at the entrance to the street, and that the water continued to flow freely. Since the property of Mr. Nombre02 is the lowest point in the area, the water will always run toward that property.
The following is extracted from an attached note submitted by neighbors in February 2020 to the department of storm drainage and road management (Alcantarillado pluvial y de gestión vial) of the Municipalidad:
...Another problem that arises and that must equally be resolved is that some days ago, municipal personnel arrived to carry out work to channel the water from that street, since it has flooding problems; they came and attempted to break it open at the entrance going inward, but ran into a large rock, and so they decided to leave the street in poor condition and withdraw from the site. As you can observe, various materials have had to be used to fill it in, causing inconvenience to schoolchildren, elderly persons, and mothers carrying young children, who must pass through there and sometimes slip and fall.
If you can align with that property, you could dig the trench along that boundary, which would solve the flooding problem the area is experiencing, and you would not have to touch the enormous rock in the center of the street...
The neighbors indicate that they are aware of the problem being caused on Mr. [Nombre01 003]'s property and acknowledge that he is right, and they request that the Municipalidad complete the work it began and provide proper conveyance for this water, which is mostly stormwater. They indicate that when it rains, a great deal of water flows down by gravity and all of it enters that property.
During the visit, although it was not raining, a small but constant trickle of water was observed flowing down the culvert installed by the Municipalidad (photographs 2 and 5), and it does indeed flow directly onto the property of Mr. Nombre02; however, this water originates from as far back as the entrance to the INVU urbanization (from the supermarket) (photograph 3), and not solely from this adjacent small street. Based on the characteristics of this water, it does not constitute wastewater, but may include drainage from washing machines, for example, based on the route observed. According to the neighbors, the real problem occurs when it rains, since the volume of water is so great that, due to this reason and the topography of the petitioner's property, this large gully has formed there (photograph 5).
THIRD: This year the neighbors have once again joined efforts to reactivate the water channeling and paving project, sending another note to the Municipalidad (attached). They indicate that they have been told that the budget for paving is already in place, but that the same road management department has indicated that if the water channeling is not corrected beforehand, paving is not feasible.
Conclusions
Upon reviewing the facts and based on what was investigated, the following is noted:
There are more than 30 dwellings between the walkway and the main street of this urbanization. Despite the Municipalidad having approved (according to the neighbors) the discharge of laundry water into the storm drain, most houses direct it into a drainage system (a situation addressed by the Ministerio de Salud in 2014).
No evidence was found of wastewater (fecal matter), nor of water with poor appearance or unpleasant odors during the inspection, though at least one discharge from a washing machine was noted.
The site has no sanitary sewer system, and the storm drainage system was only constructed on one side of the street and reaches only a certain point.
The stormwater generated by the rooftops of all these houses, together with the water from the street, flows into the street gutter (cordón de caño), which ultimately discharges onto the petitioner's property.
The piping work (trabajo de entubado) that the petitioner has requested of the Municipalidad has not been carried out.
The culvert pipe (tubo de alcantarilla) installed by the Municipality precisely at the boundary of the appellant's property was indeed observed.
The gully (zanja) that has formed on Mr. Blanco's property was documented; given its size and depth, it can be confirmed that it results from the force of water during the rainy season.
The water observed at the time of the visit was clear and emitted no foul odors.
The new neighbors indicated that the Municipality allowed them to discharge their waters to the front of their properties, despite the absence of any sewer system (alcantarillado); however, owing to flooding problems on that street, most of them chose to build absorption tanks (tanques de absorción).
Photographs of at least 3 of the applications submitted at the Municipality's service platform by the neighbors are attached."
CONCLUSIONS
In accordance with the foregoing, the Ministry of Health, through the Regional Health Authority (Área Rectora de Salud) of Alajuela 2, conducted an on-site inspection and determined that there are indeed more than 30 houses between the alameda and the main street of this residential development, that there is no sanitary sewer system (alcantarillado sanitario), that no evidence of sewage (aguas negras) was found, but that wastewater (aguas residuales) and stormwater (aguas pluviales) were present, draining onto the property of the appellant herein, and that much of this is due to work carried out by the local Municipality, which appears to have been left incomplete, as the pipe the Municipality installed for these waters causes them to discharge directly onto the property of the appellant herein.
For the foregoing reasons, we consider that the Ministry of Health has not violated any right of the protected party herein." Dismissal of the writ is requested.
"(…) With respect to the resolution of fifteen hours and seventeen minutes of June eighth, two thousand twenty-one, by which the Sala Constitucional requests a report on the writ of amparo (recurso de amparo) filed by [Nombre01 001], national identification No. [Valor 003], which is being processed under expediente No. 21-010481-0007-CO, I hereby state:
1. That [Nombre01 001] did indeed submit requests to our institution expressing dissatisfaction regarding the improper disposal of wastewater (as the appellant described) from a sector of the community where the appellant's property is located.
2. That, in response to the requests submitted by [Nombre01 003], it has been indicated to him that our institution does not have the legal tools to act in cases of improper disposal of wastewater by property owners in the canton, given that Ley N°5395, Ley General de Salud, establishes that the Ministry of Health is the entity responsible for overseeing and ensuring compliance with regulations regarding the proper disposal of wastewater (gray or black water).
3. With respect to the claim made by [Nombre01 003] that some neighbors of the community where the appellant's property is located (INVU Dulce Nombre) are discharging sewage into drainage ditches (caños) with the approval of the Municipality, it is necessary to clarify that our institution does not endorse, nor does it grant permits or approvals for property owners to carry out acts of this nature; however, it is legally limited in its scope of action pursuant to point 2 of this memorandum.
4. That, in November 2018, our institution constructed a stormwater channel (canal pluvial) and installed 45-cm-diameter piping on the northeast-facing street (See Image No. 1, red line), given that the houses located to the south of the street (red line) constantly experienced flooding problems due to improper management of rainwater in the area. (…)
5. That, at the location indicated by the green line, from the point where the magenta line and the yellow line meet (Image No. 1), water has always flowed naturally due to the topography of the area.
6. Furthermore, it is necessary to clarify that the appellant owns two properties in the area (Folio Real 2-501966-000 and No. 2-027531-000), which are indicated in red and green in Image No. 2. (…)
7. It is essential to establish that stormwater from most of the area flows through the site indicated in point 5 of this document because, topographically, it is the lowest point in the area, with elevation differences exceeding 5.0 m in depth relative to the appellant's property, making it physically, technically, and economically [unfeasible] to drain the waters through any point other than the current one.
As can be seen in the attached profiles, the public road's grade reaches its lowest level at control points D and 3, depending on which profile is viewed (profile A, 81 C, D, or profiles 1, 2, 3), in Images No. 3 and No. 4. (…)
8. If the profiles generated and provided in Images No. 3 and No. 4 are compared, points O and 3 correspond to the same location, which demonstrates that from any point on the public road, that site corresponds to the lowest topographic elevation.
9. Consideration must be given to the provisions of the Ley General de Caminos Públicos, specifically in Article 20, which states:
All holders of real property, under any title, are obligated to receive and allow to flow through their lots the waters from roads whenever the gradient of the terrain so determines, and when their parcels are adjacent to road drainage outlets, they must keep these drainage outlets clean, in perfect working condition, and free of obstructions. The Ministry or Municipalities shall order the work to be carried out and shall charge for the work plus a fifty percent (50%) surcharge, if this obligation is not fulfilled. The Ministry of Public Works and Transportation and the Municipalities must coordinate with the Ministry of Agriculture on road protection measures for projects involving new alignments or maintenance work on existing roads, in regions where such works may cause or intensify erosion or divert the natural drainage of fields. (Emphasis added) 10. That our institution does not have a sanitary sewer system in the area and no evidence has been found of any authorization to discharge wastewater into the stormwater drainage system; therefore, the discharge of wastewater (gray or black water) in the sector is prohibited, and it falls within the jurisdiction of the Ministry of Health to determine compliance or non-compliance with the provisions of said regulation, as applicable.
It is of great importance to clarify that the Municipality of Alajuela does not grant permits nor endorse the discharge of sewage into drainage ditches, nor does it have a sanitary sewer system in the area; therefore, resolution of the matters set forth herein falls within the jurisdiction of the Ministry of Health. Accordingly, this Administration considers that the Municipality of Alajuela has been diligent and has carried out the tasks PERTAINING TO ITS JURISDICTION, and therefore this writ of amparo should be declared without merit." Dismissal of the writ is requested.

Considering:
The appellant files a writ of amparo and states that he is the owner of a plot of land in the INVU residential development in La Garita de Alajuela. He notes that, in the past, approximately 30 residential houses were built, in which the owners decided to discharge sewage into drainage ditches, with the approval of the Municipality, given that the area had no sewer system. He argues that said waters ended up on his property, causing a small river to form on it. Faced with that situation, he decided to build a culvert to drain the foul-smelling waters. Moreover, he states, the Ministry of Health was compelled to clean his property; however, the Municipality failed to comply with the orders and, on the contrary, did not proceed with pipe installation (entubado). He then notes that in 2019, to his surprise, the municipal entity brought in a backhoe (retroexcavadora) and, tearing up the entrance road to his property, placed a large pipe at the boundary of the lot, allowing sewage to drain there.
He states that, as a consequence, a canyon more than 3 meters deep and 2 meters wide formed, filled with foul water emitting unbearable odors, which even prevents access to the property. Additionally, pools of sewage have formed within the lot, making it impossible to walk through the area. Furthermore, this action is also contaminating the Itiquis River and the La Garita reservoir. For this reason, he argues that he has spoken on repeated occasions with municipal officials, who have offered to pipe the waters, but as of the filing of this writ, nothing has been done in this regard. Despite his efforts, he claims that as of the filing of this writ, nothing has been achieved and he continues to bear the consequences of the Municipality's negligence.
Of importance to the decision in this matter, the following facts are considered duly established, either because they have been so proven or because the respondent authority failed to address them, as required in the initial order:
Facts relating to the Ministry of Health:
In an inspection conducted by the Regional Health Authority of Alajuela 2 on June 11, 2021, it was confirmed that there are more than 30 residential houses in the area between the alameda and the main street of this residential development (see evidence and report submitted by the respondent authorities).
No evidence of sewage (fecal matter), or water with a foul appearance or unpleasant odors was observed during the walkthrough, but at least one washing-machine discharge was indeed identified (see evidence and report submitted by the respondent authorities).
There is no sanitary sewer system at the site, and stormwater drainage was only constructed on one side of the street and extends only up to a certain point (see evidence and report submitted by the respondent authorities).
The stormwater generated from the rooftops of all these houses, along with the water from the street, flows into the street's curb drain (cordón de caño), which ultimately drains onto the appellant's property, on which no residential infrastructure exists (see evidence and report submitted by the respondent authorities).
The pipe installation work requested by the appellant from the Municipality has not been carried out, and the culvert pipe installed by the Municipality begins at the appellant's property boundary, where a gully was observed that formed due to the force of water during the rainy season (see evidence and report submitted by the respondent authorities).
The new neighbors indicated that the Municipality allowed them to discharge their waters to the front of their properties, despite the absence of any sewer system; however, owing to flooding problems on that street, most of them chose to build absorption tanks (see evidence and report submitted by the respondent authorities).
Facts relating to the Municipality of Alajuela:
In November 2018, the Municipality of Alajuela constructed a stormwater channel (canal pluvial) and installed 45cm-diameter piping along the street running in a northeasterly direction, because the houses located to the south of the street were constantly experiencing flooding problems due to improper management of rainwater in the area (see evidence and report submitted by the respondent authorities).
The petitioner owns two properties in zone Dirección01 and No. 2-027531-000 (see evidence and report submitted by the respondent authorities).
The Municipality of Alajuela does not have a sanitary sewer system (alcantarillado sanitario) in the area, nor has any authorization been found to discharge wastewater (aguas residuales) into the stormwater system; therefore, the discharge of wastewater (whether gray water or black water) in the sector is prohibited (see evidence and report submitted by the respondent authorities).
The stormwater drainage works (alcantarillado pluvial) carried out by the respondent municipality in 2018 in the INVU housing development (urbanización) in La Garita de Alajuela were not completed, as a result of which the waters flowing through the locality were not properly managed (see evidence and report submitted by the respondent authorities).
Prior to the substantive analysis of the facts alleged in this amparo proceeding (proceso de amparo), it should be noted that, within the framework of the Social and Democratic State governed by the Rule of Law (Estado Social y Democrático de Derecho), Economic, Social and Cultural Rights have as their fundamental objective to guarantee economic well-being and the development of human beings and peoples. From this, one can identify both a subjective dimension and an objective dimension of such rights. Thus, with regard to the subjective dimension, positive rights (derechos prestaciones) require the general activity of the State in order to satisfy individual or collective needs. For its part, the objective dimension frames such rights as vital minimums (mínimos vitales) that the State must safeguard in favor of individuals. The satisfaction of those needs entails the creation of the necessary conditions and a commitment to progressively achieving their enjoyment.
In the case of the Costa Rican constitutional bloc (bloque de constitucionalidad), such rights are found in Article 50 of the Political Constitution and Article 26 of the American Convention on Human Rights. In the development, protection, and full enjoyment of the aforementioned rights, the role of Municipalities and their bodies — including district municipal councils (concejos municipales de distrito) — is of particular relevance; by virtue of Article 169 of the Constitution, they are obligated to effectively provide the public services entrusted to them. Thus, as applied to the present case, such obligations entail the effective maintenance of public thoroughfares (vías públicas) — roads, sidewalks, and drainage systems — through which other rights are exercised and enjoyed, such as freedom of movement, health, and the right to a healthy environment. With respect to the latter, the rulings of this Court (Sala) in its case law are of particular relevance. Thus, in Judgment No. 2007-017552 of 12:22 hours on November 30, 2007, it stated:
"(...) The aforementioned Article 50 also delineates the Social State of Law; accordingly, we may conclude that the Political Constitution emphasizes that environmental protection is an appropriate mechanism for safeguarding and improving the quality of life of all persons, which makes it necessary for the Public Powers to intervene with respect to the factors that may disrupt its balance and prevent individuals from developing and living in a healthy environment. The impact of the right to a healthy and ecologically balanced environment on the activities of the State finds its primary justification in the fact that, by definition, rights are not confined to the private sphere of individuals but also have significance within the very structure of the State, in its role as guarantor of those rights; and, secondarily, because the activity of the State is directed toward the satisfaction of the interests of the community. In constitutional case law, the concept of 'environment' has not been limited to the primary elements of nature — namely soil, air, water, marine and coastal resources, minerals, forests, biological diversity in flora and fauna, and landscape — which together form the environmental framework without which basic needs — such as food, energy, housing, sanitation, and recreation — would be impossible to meet. It is important to emphasize that this term has been understood in a more comprehensive manner, establishing a 'macro-environmental' concept, one that also encompasses aspects related to the economy, the generation of foreign exchange through tourism, agricultural activity, and others: 'For the foregoing reasons, Environmental Law must not be associated solely with nature, since nature is merely one part of the environment. Nature protection policy also extends to other aspects, such as the protection of wildlife, forests, natural parks, and natural resources. It is, therefore, a macro-environmental concept, intended to leave no important concepts out and thereby unify the body of law we call Environmental Law (...)'"
Having stated the foregoing, it follows that this Court, as guarantor of Fundamental Rights, stands as an overseer of compliance with the obligations arising from the provisions of Articles 21 and 50 of the Political Constitution, which constrain the State to recognize the aforementioned rights and, furthermore, to commit to deploying the materially and legally legitimate means to guarantee them.
After analyzing the evidentiary elements submitted, this Court finds a violation of the fundamental rights of the protected party (parte amparada). From the reports submitted by the representatives of the respondent authorities (autoridades recurridas)—which are deemed to have been given under oath, with the consequences, including criminal consequences, provided for in article 44 of the Law governing this Jurisdiction—and from the evidence submitted for the resolution of the matter, it has been duly established that the inspection conducted by the authorities of the Ministerio de Salud on June 11, 2021 confirmed that there are more than 30 residential dwellings between the tree-lined boulevard and the main street of this housing development (urbanización). Likewise, during the inspection no evidence was found of the presence of blackwater (aguas negras) (fecal matter), nor of water with an unpleasant appearance or foul odors, but at least one washing machine drain discharge was identified.
The record reflects that there is no sanitary sewer (alcantarillado sanitario) on the site, and the stormwater drainage system (alcantarillado pluvial) was only constructed on one side of the street and extends only up to a certain point. The stormwater (aguas pluviales) generated on the rooftops of all these houses, along with that from the street, falls onto the street's drainage curb channel (cordón de caño), which ultimately discharges onto the petitioner's (recurrente) property, on which no residential infrastructure exists. According to the health authorities, the piping (entubado) work that the petitioner requested of the Municipalidad has not been carried out, and the drainage pipe installed by the Municipalidad begins on the petitioner's property, where a trench (zanja) was observed, formed by the force of the water during the rainy season. Similarly, the new neighbors indicated that the Municipalidad allowed them to discharge their water to the front of their properties, despite the absence of any type of drainage system, but that due to flooding problems on that street, most of them chose to build absorption tanks (tanques de absorción).
The neighbors also reported that the Municipalidad began work with the aim of providing adequate drainage for the water, particularly stormwater, but did not complete it. On the other hand, the respondent authorities (autoridades accionadas) of the Municipalidad de Alajuela reported that in November 2018 a stormwater channel (canal pluvial) was constructed and a 45cm-diameter pipe was installed in the street running northeast, given that the houses located to the south of the street constantly experienced flooding problems due to improper management of rainwater in the area. They indicated that the petitioner owns two properties in the area: Dirección01 and Nº 2-027531-000. Likewise, the respondent officials (personeros) of the local government indicated that there is no sanitary sewer system on the site, and no evidence has been found of any authorization to discharge wastewater (aguas residuales) into the stormwater system; therefore, the discharge of wastewater (grey or black) in the area is prohibited.
From the established factual record, this Constitutional Court can conclude that, in fact, adequate stormwater management does not exist in the reported location, a situation that affects the municipal residents (munícipes) of the area and in particular the protected party (tutelado). This is inferred from the fact acknowledged by the respondent local government, as well as from the on-site inspection conducted by the Área de Salud de Alajuela. In this regard, it appears that the installed drain primarily affects one of the petitioner's lots (predios), apparently because the drainage system was not completed by the Municipality. Although it was not possible to confirm that the stormwater drains were being used to discharge blackwater, the fact remains that the piped runoff (escorrentía) has undermined the entrance to the petitioner's property. While it is true, as stated by the local authorities, that holders of real property (poseedores de bienes raíces), under any legal title, are obligated to receive and allow roadway water to flow through their lots as determined by the grade difference (desnivel) of the terrain, and when their holdings (fundos) are adjacent to road drains, it is also the responsibility of the municipalities to oversee the construction and maintenance of drainage systems.
Furthermore, the health authorities also detected during the inspection that there is at least one greywater (aguas jabonosas) drain that mixes with stormwater, which must also be addressed by the health authorities in coordination with the Municipal entity in order to resolve the problems facing the community. It is relevant to note that article 169 of the Constitución Política establishes that the administration of local interests and services in each canton (cantón) shall be the responsibility of the Municipal Government. Local interests and services have been defined by the Sala as indeterminate legal concepts (conceptos jurídicos indeterminados) whose content is not precisely resolved by law for application to specific cases, making it necessary for those responsible for applying them to rely on value judgments and experience in order to determine their content. The creation of adequate drainage systems within a community so as not to cause damage to property, health, or environmental harm to residents is, within the terms set out by the Constitución Política, of interest to the canton and is part of the services that the Municipalidad is obligated to provide.
In this same vein, the Ley General de Salud, in article 285, provides that stormwater must be disposed of in an adequate and sanitary manner in order to prevent soil contamination and contamination of natural water sources used for human consumption, the formation of vector and disease breeding sites (criaderos de vectores), and air contamination through conditions that compromise its purity and quality. For this reason, Municipalidades are obligated to adopt specific conduct in furtherance of their purposes, taking the necessary measures to provide the residents of the communities they serve with an efficient stormwater drainage system. This entails, in many cases, issuing the corresponding administrative orders requiring residents of the area to comply with the regulations established for such purposes. It is clear that, in accordance with reasonableness standards, the Municipalidad must construct the necessary infrastructure to ensure the adequate flow of such water, or issue the corresponding orders to the persons involved, so as to guarantee the right to health and to a pollution-free environment without causing harm to third parties. As a corollary of the foregoing, the present amparo (proceso de amparo) proceedings must be granted, as indicated in the operative part (parte dispositiva) of this ruling.
In the case of appeals on environmental matters, I maintain as a general position that the Sala should refrain from hearing claims brought before it for alleged violations of article 50 of the Constitución Política, leaving their adjudication to the administrative courts and the contentious-administrative jurisdiction. However, I have also noted that my position does not preclude acknowledging the existence of particular cases or groups of cases that, in my view, would in fact be better protected by the Sala and therefore should be heard and resolved by it.- Within such groups of cases, and without this enumeration being considered a closed and definitive list, I can indicate that the Sala should reserve jurisdiction over situations such as claims for environmental violations that also pose a direct risk to human health, or to access to or the quality of water; cases of gross and direct violations of the environment in which a clear absence of protection by state authorities is established, provided that the nature of the claim also lends itself to being addressed through the amparo instrument as a summary and special procedural remedy, since I also believe that the amparo should not be "ordinarized" to address, even in the cases cited above, matters that exceed its capacity to be adequately handled within it.
In the specific case at hand, the situation presented falls within such exceptional cases, as reference is made to the existence of a threat to human health due to the inadequate disposal of wastewater and the lack of piping thereof; therefore, in this situation I agree with the majority that this Court should hear and rule on the merits of this case, as has been done.
The parties are hereby notified that, if they have submitted any paper documents, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in session N° 27-11 of August 22, 2011, article XXVI, and published in the Boletín Judicial número 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in session N° 43-12 held on May 3, 2012, article LXXXI.
Por tanto:
The appeal is hereby declared GRANTED. HUMBERTO SOTO HERRERA, in his capacity as Mayor, and LAWRENCE CHACÓN SOTO, in his capacity as Coordinator of the Stormwater Drainage Activity, both of the Municipalidad de Alajuela, or whoever holds such positions, are hereby ordered to take the corresponding measures and coordinate what is necessary so that, within a period of SIX MONTHS counted from the notification of this judgment, they carry out the necessary improvements to the stormwater drainage system of the Urbanización INVU in La Garita de Alajuela, including a discharge point, for the adequate channeling of stormwater. They shall likewise coordinate with DANIEL SALAS PERAZA, in his capacity as Minister of Health, or whoever holds such position, and the other competent authorities of the Área Rectora de Salud de Alajuela, the corresponding actions so that, within the same period, the owners of dwellings located in the area where the protected party resides are required to build drainage systems for the adequate disposal of sewage (aguas servidas).
The respondents are hereby warned that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, imprisonment of three months to two years, or a fine of twenty to sixty days, shall be imposed on anyone who receives an order, issued in an amparo appeal (recurso de amparo), that they are obligated to comply with or enforce, and who fails to comply with or enforce it, provided the offense is not more seriously penalized by other law. The State and the Municipalidad de Alajuela are condemned to pay the costs, damages, and losses caused by the facts underlying the present declaration, which shall be assessed in the execution of the contentious-administrative judgment. *210104810007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del veinticinco de junio de dos mil veintiuno .
Recurso de amparo que se tramita en el expediente número 21-010481-0007-CO interpuesto por [Nombre01 001], cédula de identidad [Valor CED01], contra la MUNICIPALIDAD DE ALAJUELA Y EL MINISTERIO DE SALUD.
RESULTANDO:
“(...)
SEGUNDO: El 11 de junio del 2021 quien suscribe se apersona a la Urbanización indicada, ya que no existe una dirección exacta de la vivienda del Sr. [Nombre01 003] . En el sitio se consulta con varios vecinos sin tener éxito, finalmente otros vecinos, Sr. [Nombre01 004] y Sr. [Nombre01 005], indican que se trata del dueño del terreno trasero de sus casas de habitación, y es la persona quien les vendió los lotes para construir en ese sitio. El Sr. Nombre02 no vive en el sitio sino en San José.
En esa callecita hay un aproximado de 16 casas de habitación unas construidas ya hace bastante tiempo y la línea de viviendas nuevas (2 años de antigüedad) a la izquierda (aproximadamente 8 casas nuevas) (fotografía 1).
Los vecinos explican la situación de la siguiente manera: Indican que, al construirse la nueva línea de casas al lado izquierdo de la calle, a los vecinos del lado derecho se les empezó a inundar sus con aguas pluviales ya que ahora el agua quedaba mas encerrada, es por ello que la Municipalidad realizo un trabajo de un caño profundo frente a las entradas de las casas del lado derecho de manera que se corrigió el problema para ellos.
A los vecinos nuevos (lado izquierdo) la Municipalidad les indico que si ellos querían podían tirar las aguas residuales al frente, pero indica el Sr. [Nombre01 004], que ellos realizaron tanques de absorción en sus propiedades y drenajes para que las aguas de sus casas no llegaran a afectar a sus vecinos del frente.
Además, conversando con vecinos mas antiguos indicaron que ya hace varios años el Ministerio de Salud había corregido el mal manejo de las aguas negras y los vecinos debieron clausurar las salidas de aguas residuales a lo externo de sus propiedades.
Seguidamente indican que la Municipalidad estuvo realizando algunos trabajos (2019) en búsqueda de canalizar las aguas pluviales por el centro de la calle, pero que toparon con una piedra de grandes dimensiones al final de la calle y que posteriormente inicio la pandemia y se retiraron, indican que la calle quedo cortada, que dejaron un hueco grande en la entrada de la calle y las aguas continuaron a la libre, y al ser la finca del Sr. Nombre02 el punto más bajo, siempre correrán hacia esa propiedad.
Se extrae de la nota adjunta presentada por los vecinos en febrero del 2020 al departamento de Alcantarillado pluvial y de gestión vial de la Municipalidad, lo siguiente:
...Otro problema que se desprende y que igual deben darle solución es que hace días, personal de su Municipio llegaron a realizar un trabajo para canalizar las aguas de esa calle, ya que presenta problemas de inundación, llegaron e intentaron romperla en la entrada hacia adentro, topándose con una gran roca, por lo que decidieron dejar la calle en mal estado, y retirarse del sitio, como pueden observar se ha tenido que recurrir a todo tipo de material para rellenar, generando inconvenientes a los niños de escuela, adultos mayores y madres con niños de brazos, que deben transitar por ahí, y en ocasiones resbalan y caen.
Si logran alienar esa propiedad, pueden hacer la zanja arrecostado a ese lindero, con lo cual solventarían el problema de inundación que presenta la zona, y no tendrían que tocar la enorme roca que está en el centro de la calle...
Los vecinos indican estar conscientes del problema que se le está generando al Sr. [Nombre01 003] en su propiedad y le dan la razón y solicitan que la Municipalidad finalice el trabajo iniciado y le de conducción adecuada a estas aguas, las cuales en su mayoría son aguas pluviales. Ya que indican que por gravedad cuando llueve baja mucha agua y toda ingresa a ese terrero.
Durante la visita, aunque no estaba lloviendo, se observó un pequeño hilo de agua constante que bajaba por esa alcantarilla que colocó la municipalidad (fotografía 2 y 5), y ciertamente ingresa directamente a la propiedad del Sr. Nombre02, pero inclusive son aguas que se generan desde la entrada a la urbanización el INVU (desde el supermercado) (fotografía 3), y no solamente de esta callecita aledaña. Estas aguas por sus características no son aguas negras, pero si pueden ser aguas del desfogue de lavadoras, por ejemplo, según el recorrido que se pudo realizar. Según indican los vecinos el problema real se da cuando llueve, ya que la cantidad de agua es tanta que por ese motivo en la propiedad el recurrente y por su topografía se ha formado esta gran zanja. (fotografía 5).
TERCERO: Este año los vecinos han unido esfuerzos nuevamente para volver a reactivar el proyecto de canalización de las aguas y asfaltado, enviando otra nota a la municipalidad (adjunta). Indican que les han comentado que para el asfaltado ya hay presupuesto, pero que el mismo departamento de gestión vial les ha indicado que si no se corrige de previo la canalización de las aguas no es viable realizar la pavimentación.
Conclusiones
Realizando un recuento de los hechos y según lo que se logró investigar se tiene:
Hay más de 30 casa de habitación entre la alameda y la calle principal de esta urbanización, a pesar de que la Municipalidad avaló (según indican los vecinos), que las aguas de pilas se condujeran al pluvial la mayoría de las casas las dirige a un drenaje (situación intervenida por Ministerio de Salud en 2014).
No se evidencio presencia de aguas negras (materia fecal), ni aguas con mal aspecto u olores desagradables durante el recorrido, pero si al menos una de desfogue de lavadoras.
En el sitio no hay alcantarillado sanitario, y el pluvial solamente se construyo de un lado de la calle y llega hasta cierto punto.
Las aguas pluviales que se generan en los techos de todas estas casas, más las de la calle, caen a la calle l cordón de caño, el cual finalmente desfoga en la propiedad del recurrente.
El trabajo de entubado que solicita el recurrente a la Municipalidad no se ha realizado.
Si se observó el tubo de alcantarilla que la Municipalidad instaló justamente donde comienza la propiedad del recurrente.
Se evidencio la zanja que se ha formado en la propiedad del Sr. Blanco, la cual por su tamaño y profundidad se puede asegurar que es producto de la potencia del agua en época lluviosa.
El agua observada al momento de la visita es clara y no desprende malos olores.
Los nuevos vecinos indican que la municipalidad les permitió sacar las aguas al frente, a pesar de que no hay ningún tipo de alcantarillado, pero que debido a los problemas de inundaciones en esa calle, la mayoría opto por construir tanques de absorción.
Se adjuntan fotografías de al menos 3 de los trámites entregados en la plataforma de servicios de la Municipalidad por parte de los vecinos. .”
CONCLUSIONES
De conformidad con lo aquí expuesto, el Ministerio de Salud, a través del Área Rectora de Salud de Alajuela 2, realizó inspección en el sitio, y determinó que sí hay mas de 30 casas entre la alameda y la calle principal de esta urbanización, que no hay alcantarillado sanitario, que no se evidenció la presencia de aguas negras, pero si la presencia de aguas residuales y pluviales las cuales desfogan en la propiedad del aquí recurrente, que gran parte de esto se debe al trabajo realizado por la Municipalidad de la localidad, el cuál quedó aparentemente incompleto ya que el tubo que pusieron para dichas aguas, hace que caigan propiamente en la propiedad del aquí recurrente.
Por lo anterior, consideramos que el Ministerio de Salud, no ha violentado derecho alguno al aquí amparado.” Solicita se desestime el recurso.
"(. .. ) Con respecto a la resolución de las quince horas con diecisiete minutos del ocho de junio de dos mil veintiuno, mediante la cual la Sala Constitucional solicita rendir informe sobre el Recurso de Amparo presentado por el señor [Nombre01 001] , cédula de identidad Nº [Valor 003] , el cual se tramita bajo el expediente Nº 21-010481-0007-CO, me permito indicar:
1. Que, efectivamente el señor [Nombre01 001] realizó gestiones ante nuestra institución donde exponía su molestia por la inadecuada disposición de las aguas residuales (según manifestó el recurrente) de un sector de la comunidad donde se ubica su propiedad.
2. Que, en las gestiones realizadas por el señor [Nombre01 003] se le ha señalado que nuestra institución no posee las herramientas legales para proceder en caso de disposición inadecuada de las aguas residuales por parte de propietarios de inmuebles en el cantón, esto por cuanto la Ley N°5395, Ley General de Salud, establece que el Ministerio de Salud será el ente encargado de velar y procurar el cumplimiento de la norma en cuanto a la adecuada disposición de aguas residuales (grises o negras).
3. Con respecto a la aseveración que realiza el señor [Nombre01 003] sobre la decisión de una parte de los vecinos de la comunidad donde se ubica su propiedad (Invu Dulce Nombre), de tirar las aguas negras a los caños con el visto bueno de la Municipalidad, es necesario indicar que nuestra institución no avala, ni otorga permisos o vistos buenos para que los propietarios de inmuebles realicen actos de esta naturaleza, pero que se encuentra legalmente limitada en su rango de acción debido a lo señalado en el punto 2 del presente oficio.
4. Que, en el mes de noviembre de 2018 se realizó por parte de nuestra institución, la construcción de un canal pluvial y se instaló tubería de 45cm de diámetro en la calle con dirección noreste (Ver Imagen Nº 1, línea roja), dado que las casas que se ubican al sur de la calle (línea roja) presentaban constantemente problemas de inundación debido a un mal manejo de las aguas de lluvia en el lugar. (…)
5. Que, donde se ubica la línea verde, a partir del punto donde se unen la línea color magenta y la línea amarilla (Imagen Nº 1), las aguas siempre han discurrido de forma natural debido a la topografía de la zona.
6. Además, resulta necesario aclarar, que el recurrente posee dos propiedades en la zona (Folio Real 2-501966-000 y Nº 2-027531-000) las cuales señalan con rojo y verde en la imagen Nº 2. (…)
7. Es imprescindible establecer que, las aguas pluviales de la mayor parte de la zona discurren por el sitio señalado en el punto 5 del presente documento debido a que topográficamente es el punto más bajo de la zona, con diferencias de elevación superiores a los 5,0m de profundidad con respecto a la propiedad del recurrente, por lo que es física, técnica y económicamente evacuar las aguas por otro punto que no se el actual.
Como se puede apreciar en los perfiles adjuntos, el desnivel de la vía pública tiene su nivel más bajo en los plintos D y 3, según el perfil que se observe (perfil A, 81 C, D o perfil 1, 2, 3), en las imágenes Nº 3 y Nº 4. (…)
8. Si se comparan los perfiles generados y aportados en las imágenes Nº 3 y Nº 4, los puntos O y 3 corresponden al mismo lugar, lo cual demuestra que desde cualquier sitio de la vía pública el sitio corresponde al nivel topográfico de menor elevación.
9. Se debe considerar lo establecido en la Ley General de Caminos Públicos, concretamente en su artículo 20 que señala:
Todos los poseedores de bienes raíces, por cualquier título, están obligados a recibir y dejar discurrir dentro de sus predios, las aguas de los caminos cuando así lo determine el desnivel del terreno y, cuando sus fundos estén inmediatos a los desagües de un camino, deberán mantener estos desagües limpios, en perfecto estado de servicio y libres de obstáculos. El Ministerio o las Municipalidades mandarán a ejecutar el trabajo y cobrarán el trabajo más el cincuenta por ciento (50%) de recargo, si esta obligación no se cumpliere. El Ministerio de Obras Públicas y Transportes y las Municipalidades deberán coordinar con el Ministerio de Agricultura fas medidas de protección de los caminos en los proyectos de nuevos trazados o en los trabajos de conservación de los existentes, en las regiones donde los mismos puedan provocar o intensificar la erosión ó desviar el desagüe natural de los campos. (El resaltado es propio) 10. Que nuestra institución, no posee sistema de alcantarillado sanitario en el lugar y tampoco se ha encontrado evidencia de que exista autorización para evacuar las aguas residuales al sistema pluvial, por lo que el vertido de aguas residuales (grises o negras) en el sector se encuentra prohibido, siendo competencia del Ministerio de Salud determinar el cumplimiento o no de lo señalado en dicha norma, según corresponda.
Es de gran importancia aclarar que, la Municipalidad de Alajuela, no otorga permisos ni avala la descarga de aguas negras a los caños, ni tampoco se posee sistema de Alcantarillado Sanitario en la zona, por lo que es competencia del Ministerio de Salud la solución de lo aquí expuesto. Por cuanto, considera ésta Administración, que la Municipalidad de Alajuela ha sido diligente y ha realizado las labores propias ATINENTES A SU COMPETENCIA, por lo que debe de declararse el presente Recurso de Amparo Sin lugar.” Solicitan se desestime el recurso.
Redacta la Magistrada Picado Brenes ; y,
Considerando:
La parte recurrente interpone recurso de amparo y expone que, es propietario de un terreno en la Urbanización INVU en La Garita de Alajuela. Comenta que, en el pasado, fueron construidas alrededor de 30 casas de habitación, en las que sus propietarios decidieron tirar las aguas negras a los caños, lo dicho, con el visto bueno de la Municipalidad, dado que en la zona no había alcantarillado. Esas aguas, aduce, iban a dar al inmueble de su propiedad, con lo que se empezó a formarse un pequeño río en la misma. Ante esa situación, decidió edificar una alcantarilla para sacar las aguas malolientes. Incluso, dice, el Ministerio de Salud se vio obligado a limpiar su propiedad; empero, la Municipalidad no atendió las órdenes y, por el contrario, no ha procedido a entubar. Ahora bien, comenta que para el año 2019 y, para su sorpresa, el ente municipal llevó una retroexcavadora y, destruyendo la calle de entrada a su terreno, colocó un tubo enorme en el límite del inmueble, dejando que las aguas negras desfogaran allí.
Dice que, como consecuencia, se formó un cañón de más de 3 metros de profundidad por 2 metros de ancho, lleno de agua sucia que desprende olores insoportables, que incluso, le impide el acceso a la propiedad. Asimismo, se han formado pozos de aguas negras dentro del inmueble que impiden caminar por la zona. Además, con esa acción se está contaminando también el río Itiquis y la represa de La Garita. Por ese motivo, esgrime que en reiteradas ocasiones ha conversado con funcionarios municipales, quienes han ofrecido entubar las aguas, pero al momento de interposición de este recurso, no han hecho nada al respecto. Pese a sus intentos, acusa que al momento de interposición de este recurso, no se ha logrado nada y, sigue afrontando las consecuencias de la negligencia municipal.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:
Hechos relativos al Ministerio de Salud:
En inspección realizada por el Área Rectora de Salud de Alajuela 2 el 11 de junio del 2021 se constató que en el lugar hay más de 30 casa de habitación entre la alameda y la calle principal de esta urbanización (ver pruebas e informe rendido por parte de las autoridades accionadas).
En el lugar no se evidenció presencia de aguas negras (materia fecal), ni aguas con mal aspecto u olores desagradables durante el recorrido, pero si al menos una de desfogue de lavadoras (ver pruebas e informe rendido por parte de las autoridades accionadas).
En el sitio no hay alcantarillado sanitario, y el pluvial solamente se construyo de un lado de la calle y llega hasta cierto punto (ver pruebas e informe rendido por parte de las autoridades accionadas).
Las aguas pluviales que se generan en los techos de todas estas casas, más las de la calle, caen a la calle l cordón de caño, el cual finalmente desfoga en la propiedad del recurrente, en la cual no existen infraestructura habitacional (ver pruebas e informe rendido por parte de las autoridades accionadas).
El trabajo de entubado que solicita el recurrente a la Municipalidad no se ha realizado y el tubo de alcantarilla que la Municipalidad instaló comienza la propiedad del recurrente, lugar en el cual se evidenció una zanja, que se ha formado por la potencia del agua en época lluviosa (ver pruebas e informe rendido por parte de las autoridades accionadas).
Los nuevos vecinos indicaron que la municipalidad les permitió sacar las aguas al frente, a pesar de que no hay ningún tipo de alcantarillado, pero que debido a los problemas de inundaciones en esa calle, la mayoría opto por construir tanques de absorción (ver pruebas e informe rendido por parte de las autoridades accionadas).
Hechos relativos a la Municipalidad de Alajuela:
En el mes de noviembre de 2018 se realizó por parte de la Municipalidad de Alajuela, la construcción de un canal pluvial y se instaló tubería de 45cm de diámetro en la calle con dirección noreste dado que las casas que se ubican al sur de la calle presentaban constantemente problemas de inundación debido a un mal manejo de las aguas de lluvia en el lugar (ver pruebas e informe rendido por parte de las autoridades accionadas).
El recurrente posee dos inmuebles en la zona Dirección01 y Nº 2-027531-000 (ver pruebas e informe rendido por parte de las autoridades accionadas).
La Municipalidad de Alajuela no posee sistema de alcantarillado sanitario en el lugar y tampoco se ha encontrado evidencia de que exista autorización para evacuar las aguas residuales al sistema pluvial, por lo que el vertido de aguas residuales (grises o negras) en el sector se encuentra prohibido (ver pruebas e informe rendido por parte de las autoridades accionadas).
Las obras de alcantarillado pluvial realizadas por el municipio accionado en el año 2018 en la urbanización INVU en La Garita de Alajuela no fueron concluidas por lo cual no se dispuso de forma adecuada de las aguas que discurren en la localidad (ver pruebas e informe rendido por parte de las autoridades accionadas).
De previo al análisis de fondo de los hechos reclamados en este proceso de amparo, corresponde indicar que, en el marco del Estado Social y Democrático de Derecho, los Derechos Económicos Sociales y Culturales tienen como objetivo fundamental garantizar el bienestar económico y el desarrollo del ser humano y los pueblos. A partir de esto, se puede señalar un contenido subjetivo y otro objetivo de tales derechos. Así, en cuanto al sentido subjetivo, los derechos prestaciones demandan la actividad general del Estado para la satisfacción de las necesidades individuales o colectivas. Por su parte, el sentido objetivo configura a tales derechos como mínimos vitales que el Estado debe resguardar a favor de las personas. La satisfacción de esas necesidades supone la creación de condiciones necesarias y el compromiso de lograr progresivamente su goce. En el caso del bloque de constitucionalidad costarricense, encontramos tales derechos en el contenido del artículo 50 de la Constitución Política y el artículo 26 de la Convención Americana sobre Derechos Humanos.
En el desarrollo, tutela y pleno disfrute de los derechos de cita, resulta de relevancia la función de las Municipalidades y sus órganos -incluyendo los concejos municipales de distrito-, las cuales, a partir del artículo 169 constitucional, se encuentran en la obligación de prestar en forma efectiva los servicios públicos que les han sido encomendados. Así, de aplicación en el caso concreto, tales obligaciones conllevan el efectivo mantenimiento de las vías públicas -caminos, aceras y alcantarillado-, por medio de las cuales se ejercitan y disfrutan otros derechos, tales como la libertad ambulatoria, la salud y el derecho a un ambiente sano. Respecto a este último, resulta de relevancia lo indicado por este Tribunal en su jurisprudencia. Así, en Sentencia N° 2007-017552 de las 12:22 horas de 30 de noviembre de 2007, indicó:
“(...) El artículo 50 citado, también perfila el Estado Social de Derecho, por lo que podemos concluir que la Constitución Política enfatiza que la protección del ambiente es un mecanismo adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los Poderes Públicos sobre los factores que pueden alterar su equilibrio y obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano. La incidencia que tiene el derecho a un ambiente sano y ecológicamente equilibrado dentro de la actividad del Estado, encuentra su primera razón de ser, en que por definición, los derechos no se limitan a la esfera privada de los individuos, sino que tienen asimismo trascendencia en la propia estructura del Estado, en su papel de garante de los mismos y, en segundo término, porque la actividad del Estado se dirige hacia la satisfacción de los intereses de la colectividad. En la jurisprudencia constitucional el concepto de ‘ambiente’, no ha sido limitado a los elementos primarios de la naturaleza, sea el suelo, el aire, el agua, los recursos marinos y costeros, los minerales, los bosques, la diversidad biológica en la flora y fauna, y el paisaje; a partir de los cuales se conforma el marco ambiental sin el cual las demandas básicas -como la alimentación, energía, vivienda, sanidad y recreación- serían imposibles. Es importante resaltar que este término se ha entendido de una manera más integral, estableciéndose un concepto ‘macro-ambiental’, al comprender también aspectos referentes a la economía, a la generación de divisas a través del turismo, la explotación agrícola y otros: ‘Por lo anterior, el Derecho Ambiental no debe asociarse sólo con la naturaleza, pues ésta es únicamente parte del ambiente. La política de protección a la naturaleza se vierte también sobre otros aspectos como la protección de la caza, de los bosques, de los parques naturales y de los recursos naturales. Se trata, entonces, de un concepto macro-ambiental, para no dejar conceptos importantes por fuera y así lograr unificar el conjunto jurídico que denominamos Derecho Ambiental (...)”
Dicho lo anterior, se tiene que esta Sala, como garante de los Derechos Fundamentales, se erige como un controlador del cumplimiento de las obligaciones derivadas de lo dispuesto en los artículos 21 y 50 de la Constitución Política, los cuales constriñen al Estado a reconocer los derechos señalados y, además, a disponer a utilizar los medio materiales y jurídicamente legítimos para garantizarlos.
Después de analizar los elementos probatorios aportados, este Tribunal acredita una lesión a los derechos fundamentales de la parte amparada. De los informes rendidos por los representantes de las autoridades recurridas -que se tienen dados bajo juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto ha sido debidamente acreditado que, de la inspección realizada por las autoridades del Ministerio de Salud el 11 de junio del 2021 se constató que en el lugar hay más de 30 casa de habitación entre la alameda y la calle principal de esta urbanización. Asimismo, en el lugar no se evidenció presencia de aguas negras (materia fecal), ni aguas con mal aspecto u olores desagradables durante el recorrido, pero si al menos una de desfogue de lavadoras. Consta que en el sitio no hay alcantarillado sanitario, y el pluvial solamente se construyo de un lado de la calle y llega hasta cierto punto.
Las aguas pluviales que se generan en los techos de todas estas casas, más las de la calle, caen a la calle l cordón de caño, el cual finalmente desfoga en la propiedad del recurrente, en la cual no existen infraestructura habitacional. Según señalan las autoridades sanitarias, el trabajo de entubado que solicita el recurrente a la Municipalidad no se ha realizado y el tubo de alcantarilla que la Municipalidad instaló comienza en la propiedad del recurrente, lugar en el cual se evidenció una zanja, que se ha formado por la potencia del agua en época lluviosa. De igual forma, los nuevos vecinos indicaron que la municipalidad les permitió sacar las aguas al frente, a pesar de que no hay ningún tipo de alcantarillado, pero que debido a los problemas de inundaciones en esa calle, la mayoría optó por construir tanques de absorción. Igualmente, informaron los vecinos que la Municipalidad inició un trabajo con la finalidad de dar una conducción adecuada a las aguas, sobre todo pluviales, pero no lo concluyó.
De otra parte, informaron las autoridades accionadas de la Municipalidad de Alajuela que en el mes de noviembre de 2018 se realizó la construcción de un canal pluvial y se instaló tubería de 45cm de diámetro en la calle con dirección noreste dado que las casas que se ubican al sur de la calle presentaban constantemente problemas de inundación debido a un mal manejo de las aguas de lluvia en el lugar. Indicaron que el recurrente posee dos inmuebles en la zona Dirección01 y Nº 2-027531-000. De igual manera, los personeros accionados del gobierno local indicaron que en el sitio no hay sistema de alcantarillado sanitario y tampoco se ha encontrado evidencia de que exista autorización para evacuar las aguas residuales al sistema pluvial, por lo que el vertido de aguas residuales (grises o negras) en el sector se encuentra prohibido. De la base fáctica acreditada es posible deducir por parte de este Tribunal Constitucional que efectivamente, en el lugar denunciado no existe un adecuado manejo de las aguas pluviales, situación que afecta a los munícipes de la localidad y en particular al tutelado.
Esto se infiere del hecho reconocido por parte del gobierno local accionado, así como, de la inspección realizada in situ por parte de Área de Salud de Alajuela. En ese sentido, se aprecia que el desagüe instalado afecta principalmente uno de los predios del recurrente, aparentemente, en razón de que dicho alcantarillado no fue concluido por parte del Municipio. Si bien no se logró constatar que los desagües pluviales fueran utilizados para el vertido de aguas negras, lo cierto es que la escorrentía entubada a socavado la entrada del inmueble del recurrente. Si bien es cierto lo señalado por parte de las autoridades locales en el sentido de que los poseedores de bienes raíces, por cualquier título, están obligados a recibir y dejar discurrir dentro de sus predios, las aguas de los caminos cuando así lo determine el desnivel del terreno y, cuando sus fundos estén inmediatos a los desagües de un camino, también es responsabilidad de los municipios velar por la construcción y mantenimiento de los alcantarillados.
De otra parte, también las autoridades sanitarias detectaron en la inspección que existen al menos un drenaje de aguas jabonosas que se mezcla con las aguas pluviales lo cual también debe ser atendido por parte de las autoridades sanitarias en coordinación con el ente Municipal a efectos de solventar la problemática que enfrenta la localidad. Es conveniente tomar en cuenta que el artículo 169, de la Constitución Política, establece que la administración de los intereses y servicios locales en cada cantón, estará a cargo del Gobierno Municipal. Los intereses y servicios locales han sido definidos por la Sala como conceptos jurídicos indeterminados donde la ley no resuelve con exactitud su contenido para su aplicación a casos concretos, por lo que resulta necesario acudir a criterios de valor y de experiencia, por parte de quien le corresponde aplicarlo, para determinar su contenido. La creación de medios de drenaje adecuados dentro de una comunidad a efectos de no causar daños a la propiedad, a la salud ni problemas de ambientales a sus vecinos es, dentro de los términos indicados por la Constitución Política, de interés del cantón y es parte de los servicios que la Municipalidad está en la obligación de brindar.
En este mismo sentido, la Ley General de Salud, en su artículo 285, establece que las aguas pluviales deberán ser eliminadas adecuada y sanitariamente a fin de evitar la contaminación del suelo y de las fuentes naturales de agua para el uso y consumo humano, la formación de criaderos de vectores y enfermedades y la contaminación del aire mediante condiciones que atenten contra su pureza y calidad. Por tal motivo, las Municipalidades, están obligadas a asumir un determinado comportamiento para la satisfacción de sus fines, tomando las medidas requeridas para proveer a los habitantes de la comunidad que representan de un sistema eficiente de drenaje de las aguas pluviales. Lo que implica, en muchos casos, girar las órdenes administrativas correspondientes para que los vecinos de la zona cumplan la normativa dispuesta para tales efectos. Resulta claro que, ajustado a criterios de razonabilidad, debe la Municipalidad construir la infraestructura necesaria para hacer discurrir adecuadamente esas aguas, o bien dictar las órdenes correspondientes a las personas involucradas, para así garantizar el derecho a la salud y a un ambiente libre de contaminación y sin perjudicar a terceros. Corolario de lo expuesto, se impone la estimatoria del presente proceso de amparo tal como se indica en la parte dispositiva de este pronunciamiento.
En el caso de recursos por cuestiones ambientales sostengo como línea general que esta Sala debe abstenerse de conocer los reclamos que se le presenten por supuesta infracción al artículo 50 de la Constitución Política para dejar en manos de la justicia administrativa y la jurisdicción contenciosa administrativa su conocimiento. Pero también he advertido que mi planteamiento no impide reconocer la existencia de casos particulares o grupos de casos que, según mi criterio, si resultarían aún mejor tutelados por esta Sala y por tanto deben ser conocidos y resueltos por ella.- Dentro de tales grupos de casos, y sin que esta enunciación pueda considerarse como una lista cerrada y definitiva, puedo señalar que la Sala debe reservarse el conocimiento de situaciones como por ejemplo los reclamos por infracciones ambientales que además pongan en riesgo directo la salud de las personas, o el acceso o calidad del agua; los casos de violaciones groseras y directas al ambiente y en los cuales se constate una palmaria ausencia de la protección por parte de las autoridades estatales, siempre y cuando además la naturaleza del reclamo permita ser abordado mediante el instrumento del amparo como instituto procesal sumario y especial, ya que estimo que tampoco se debe “ordinariar” el amparo para abordar, aún en estos casos citados, temas que rebasen la capacidad de ser atendidos adecuadamente en el mismo.
En el caso concreto, se observa que la situación planteada se ubica dentro tales casos de excepción pues se hace referencia a la existencia de una amenaza a la salud de las personas por la inadecuada disposición de aguas residuales, y falta de entubado de las mismas, de modo que en esta situación concuerdo con la mayoría en que este Tribunal debe conocer y decidir sobre el fondo de este caso, tal y como se ha hecho.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara CON LUGAR el recurso. Se ordena a HUMBERTO SOTO HERRERA, en condición de Alcalde y a LAWRENCE CHACÓN SOTO , en condición de Coordinador de la Actividad de Alcantarillado Pluvial, ambos de la Municipalidad de Alajuela, o a quienes ejerzan tales cargos, que tomen las medidas correspondientes y coordinen lo necesario para que, en el plazo de SEIS MESES, contado a partir de la notificación de esta sentencia, realicen las mejorar necesarias en el alcantarillado pluvial de la Urbanización INVU en La Garita de Alajuela incluyendo un punto de desfogue, para la adecuada canalización de aguas pluviales. Asimismo, deberán coordinar con DANIEL SALAS PERAZA, en condición de Ministro de Salud, o con quien ejerza tal cargo, y demás instancias competentes del Área Rectora de Salud de Alajuela, las acciones correspondientes para que, dentro del mismo plazo, se obligue a los propietarios de viviendas ubicadas en la localidad donde habita el tutelado a que construyan los drenajes para la adecuada evacuación de aguas servidas.
Se advierte a los recurridos que, de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y a la Municipalidad de Alajuela al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a la presente declaratoria, los cuales se liquidarán en ejecución de sentencia de lo contencioso administrativo.
