Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty in the morning on once de junio de dos mil veintiuno.

Amparo proceeding (recurso de amparo) filed by Nombre01, identity card CED01, against the MUNICIPALIDAD DE ESCAZÚ, the MINISTERIO DE SALUD, and the SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN.

Findings:

  1. 1By a written submission received by the Clerk’s Office of this Chamber on 18 de marzo de 2021, the appellant filed an amparo proceeding against the Municipalidad de Escazú, the Ministerio de Salud, and the Sistema Nacional de Áreas de Conservación. She states that, since julio de 2020, she has been awaiting resolution of the complaints she filed regarding contamination from sewage and gray water (aguas fecales y jabonosas) that discharges freely onto the property (real property recorded under real-property folio registration number , located in San José, San Antonio, Escazú, registered cadastral survey No. SJ 0010149-1970) owned by the company she represents (VETRA S.A.) and continues onward to the local river. She explains that the contaminated water reaches one side of the property through 2 culverts from the residential lots located uphill, which form a neighborhood in Escazú. She adds that some of the water pools on the lot, while some overflows onto the street and then follows the gutter to the riverbed.She alleges that she reported this situation to the respondent municipality in julio de 2020 and, because nothing was done about it, reiterated her complaint on 03 de setiembre, since it is a problem affecting the entire community and COVID-19 may also be transmitted through fecal matter. She alleges that foul odors reach the property and that insects, rodents, flies, and cockroaches are present at the site, all of which are vectors posing risks to society at large. She states that she filed a complaint on the same grounds with the Ministerio de Salud in julio de 2020 and again on 03 de setiembre, at which time she requested an inspection and the issuance of the corresponding health orders (órdenes sanitarias). She adds that, in response, she was informed that the visit would be conducted on 15 de setiembre, but it was not until more than a month later, and after multiple telephone calls, that she was told they had been unable to enter the lot; accordingly, by written submission on 22 de octubre, she clarified that there is a clearly visible, unlocked pedestrian entrance through which they may enter.Nevertheless, she alleges that she does not know whether the inspection was ultimately conducted and continues to await the adoption of measures. She states that on 03 de setiembre she also contacted SINAC to report that untreated contaminated water was being discharged into a river whose name she does not know; however, she received no response and nothing was done about it, as the water continues to flow downstream without restriction. She complains that none of the respondents has coordinated any solution, given that the foul odors persist and the water continues to flow. In light of the foregoing, she applies to the Chamber for protection of her fundamental rights and requests that the proceeding be granted.
  2. 2By a ruling issued at 8:49 on 23 de marzo de 2021, the proceeding was admitted, and reports concerning the facts alleged by the appellant were requested from the mayor of the Municipalidad de Escazú, the director of the Área Rectora de Salud de Escazú of the Ministerio de Salud, and the regional director of the Sistema Nacional de Áreas de Conservación (SINAC) for the Área de Conservación Central.
  3. 3By a written submission received via email at 14:39 on 29 de marzo de 2021, Arnoldo Barahona Cortés, in his capacity as mayor of the Municipalidad de Escazú, submitted a report under oath. He states as follows: “(…) this municipal corporation provided her with a response (…) through official letter DA-600-2020, which was served at the email address ...01 on 29 de octubre de 2020 (…) because that was the means designated by the appellant. In that regard, the appellant was informed in the aforementioned official letter that a dye-application campaign would be conducted and, consequently, inspections would be carried out beginning the week that started on lunes 05 de octubre, for the purpose of determining the source of the water flowing through the channel. Furthermore, a report concerning the complaint filed by the appellant was requested from Eng. Jerson Calderón Valverde, Coordinator of the Environmental Management Subprocess, who stated, among other things, the following in official letter CORGA-254-2021 dated 07/04/2021: “In addressing this case, the Environmental Management Subprocess has taken the following actions within the scope of municipal authority: • 09 de julio de 2020: Inspection of the site at the request of Ms.Nombre01 (…) During that inspection, the interested party was informed that the owner was within its rights to seal the water outlets onto its property. Ms. Nombre01 requested the Spring Impact Inquiry procedure (Consulta de Afectación de Nacientes), which was resolved through official letter GA-CA-5492020. • 25 de septiembre 2020: In response to document AJ-590-2020, official letter GA-CA604 2020 was sent. That letter states that the Municipalidad would conduct an investigation to determine the source of the water flowing through the property. The investigation would begin at the properties observed directly upstream from the water outlet, access to which is through Dirección01. • 07 de octubre 2020: an inspection visit was made to two properties for the application of fluorescein. The results may be viewed in the attached official letters NOFGA-0185-2021 and NO71 GA0186-2021. Accordingly, based on the results obtained (...) the residents were notified so that they could submit a proposal to remedy the problem by constructing an adequate system, and the cases in which municipal personnel were denied entry were referred to the Ministerio de Salud for the corresponding action through official letter CORGA 0186 2021 dated 19/03/2021, as recorded on folio 25 of the case file at issue, for the purpose of addressing the complaint filed by Ms. Nombre01, within the scope of our authority. (…)”. In light of the foregoing, he requests that the proceeding be denied.
  4. 4By submission received at 12:47 hours on 17 de abril de 2021, William Barrantes Barrantes, in his capacity as Director of the Escazú Health Governing Area of the Ministry of Health, reported under oath. He states as follows: “(…) This Governing Area received a complaint from the protected party herein concerning wastewater (aguas residuales), which crosses her property through sewers that discharge into the nearby stream. The complaint states, based on information from neighbors, that the respondent is the Municipalidad de Escazú. (…) On 3 de setiembre del 2020, documents signed by Ms. Nombre01 and Mr. Álvaro Sagot Rodríguez were received, requesting: ‘I request that a schedule of activities be established and that I be provided with a copy thereof. I request that you, as the governing authority, identify the two sewers or pipes that carry contaminated water onto our property. Alternatively, I request that I at least be authorized to close the sewers myself, because no one has a constitutional right to pollute, and our property is not a place for depositing contaminated water.I request, where applicable, that each house discharging contaminated water be required to install its own septic tank and that the discharge of wastewater and sewage into the sewers carrying all such liquid waste onto our property be absolutely and categorically prohibited.’ Regarding the request filed on 03 de setiembre del 2020, through official letter MS›DRRSCS-DARSE-1223-2020 of 4 de setiembre del 2020, the petitioners were informed that it was impossible to provide the schedule of activities because, while addressing complaints during the course of a case, various situations or circumstances may arise that prevent compliance with the schedule. In this regard, it should be clarified that the activities conducted during the preliminary investigation (investigación preliminar) to gather evidence are confidential as to all parties. Disclosing the schedule and the actions to be taken by the Administration would compromise the outcome of the investigation, since it could alter or taint the procedure for collecting indicia (indicios) and evidence.Furthermore, regarding the request to close the sewers, the same official letter informed her that sealing sewers or authorizing third parties to do so was improper. It must be clear that this Health Authority must act pursuant to the principle of legality (principio de legalidad); therefore, under the General Health Law (Ley General de Salud), and as the protected party was informed, the necessary administrative health measures (medidas sanitarias administrativas) must be ordered to ensure that the properties have an adequate wastewater-disposal system, a circumstance determined through a sodium fluorescein dye test. (...) On 15 de setiembre del 2020, as recorded in inspection report MSDRRSCS-DARSE~AIO~AFS-198-2020. a visit was made to the reported site. At the time of the inspection, access to the affected property was closed, so the adjoining neighborhood was surveyed to determine circumstances relevant to the case at issue.On 17 de septiembre del 2020 at 14:08 hours, Ms. Ayud Carboni was notified by email of the result of the visit and was advised that the site had been visited but the property had not been entered because it appeared to be secured with a padlock. That same day, at 17:45 hours, a response was received from Ms. Nombre01 stating that there was a gate for personal use that was not padlocked. At this point, it must be emphasized that, contrary to what the protected party states in the petition, even if the entrance is not padlocked, this Health Authority may not enter private property without the owner’s corresponding authorization, since such conduct could constitute the offense of trespass upon private property; accordingly, that assertion is unlawful and entirely without legal basis.(…) On 22 de setiembre del 2020, as recorded in inspection report MS-DRRSCSDARSE~AIO-AFS~21 0-2020, an inspection visit was conducted at the residence owned by Ms.Nombre02 Nombre02, located at Dirección02 (a neighborhood adjoining the affected property), as a follow-up to the complaint filed by Ms. Nombre01. At the site, a sodium fluorescein dye test was performed on the residence’s plumbing fixtures. The dye was checked for on the complainant’s property, where no sodium fluorescein was observed; however, the dye was seen in the nearby stream. The result was therefore deemed positive, and health orders (órdenes sanitarias) MS-DRRSCS-DAR5E-0$-126-2020 were issued to Nombre02, MS~DRRSCS-DARSE-OS-117-2020 to Nombre03, MS-DRRSCS-DARSE-OS-124-2020 to Guido José Sandí Sandí. MS-DRRSCSDARSE-OS-120›2020 to Nombre04. MS-DRRSCSDARSE-OS-122-2020 to Nombre05. MS-DRRSCSDARSE-OS-1 18-2020 to Nombre06, MS-DRRSCS›DARSE~OS-123-2020 to Nombre07, MS-DRRSCS-DARSE-OS¬121-2020 to Nombre08. MSDRRSCS-DARSE~OS›125-2020 to Nombre09, and MS-DRRSCS-DARSE-OS119-2020 to Nombre10, all owners of the property registered under real-property folio number .(…) On 12 de noviembre del 2020, Ms. Nombre01 was informed by email that the health orders had been served on the owners of the property registered under real-property folio number , and she was also advised that dye tests would be performed at the other properties. For the foregoing reason, this office rejects the appellant’s allegations that she did not know whether the visit had taken place, since she was informed of all actions taken by this Health Authority in response to the complaint. (…) The notified property owners proceeded to comply with the orders contained in the aforementioned administrative acts (actos administrativos), initially submitting a corrective-action plan to remedy the improper disposal of wastewater, which was reviewed and approved by this office before it was implemented. Compliance with the health orders was verified, and through official letters MS-DRRSCSDARSE-502-2021, |1/|S-DRR$QS.DAR5E-606,2021 and MSDRRSCS-DARSE›606-2021, the corrective work was declared completed.(...) On 23 de febrero del presente año, another inspection visit was conducted at the properties located at the entrance to Dirección02, adjacent to the complainant’s property. A new dye test was performed on the plumbing fixtures in the residence of Mr. Nombre11, legal representative of ORCAZU CUARENTA SOCIEDAD ANONIMA, which owns the property registered under real-property folio number . A positive result was obtained, and administrative act N°MS~DRRSCS-DARSEOS›O4122021 was therefore issued; it remains in force, and compliance with its directives is pending within the prescribed period. It is further stated that no rodents have been observed in the area during the inspections conducted on the complainant’s property. In that regard, as may be seen, the Escazú Health Governing Area has not failed to perform its duties and, in response to the complaint filed, has taken the actions required under the powers delegated to it by law.It has issued the necessary administrative acts and continues to follow up on the case at issue. Accordingly, the protected party’s assertion that this Authority has failed to act in response to that complaint is emphatically rejected. (...)” Based on the foregoing, he requests that the petition be denied.
  5. 5By submission received at 12:47 hours on 17 de abril de 2021, Aimará Espinoza Ulate, in her capacity as Head of the San José Subregional Office of the Sistema Nacional de Áreas de Conservación (SINAC) of the Área de Conservación Central, reported under oath. She states that on 3 de setiembre de 2020 official letter No. SINAC-ACC-D-1362-2020 was received, referring to that office the complaint filed by the protected party. Accordingly, she indicates that the relief sought by the protected party in the complaint does not fall within that institution’s authority; therefore, the official letter was forwarded to the official in charge of the Environmental Management Subprocess of the Municipalidad de Escazú, with a copy to the Escazú Health Governing Area of the Ministry of Health, the authorities with jurisdiction over the matter. Based on the foregoing, she requests that the petition be denied.
  6. 6By submission received at 7:47 hours on 26 de abril de 2021, the appellant stated as follows: “(sic) I wish to submit, ad effectum videndi, evidence that, as of this date, the problem involving the pollution caused by an entire community remains fully ongoing, even though nearly a year has passed since it was reported. For that purpose, I am submitting a new certified laboratory water test showing the quantity of fecal matter flowing onto our property and how it is even mixed with soapy water, as shown in the photographs. To date, NO ONE has assessed the soapy water, because the tests performed were on toilets and washbasins, but not on sinks or water outlets used when washing clothes. It is therefore clear that the respondents never went there to solve any problem, even though they may have visited the area. The effects on health and quality of life, water pollution, damage to the landscape, foul odors (…) continue unabated.It is truly exasperating and distressing that the respondents irresponsibly appear before this Chamber and claim that they have addressed the conditions under which we are living, but this is completely false. The objective answer as of this date is that studies remain outstanding (…) REGARDING THE MUNICIPALIDAD’S RESPONSE. They say they have kept me informed of everything, but that is completely false, because the email address at which they claim to have expressly notified me is NOT the one we designated for receiving notices. The Municipalidad states that it responded to: ...01 on 29 de octubre de 2020 (see folio 14 of the administrative record) because it was the means designated by the appellant.’ In this regard, it should be noted that the email address designated for notices was ...02; that is, whether by mistake or in bad faith, the municipal representatives sent notice to a nonexistent email address by deleting an ‘a’ from the address provided.As evidence of this, I urge them to review our written complaint and the response they submitted to this Chamber. Regardless of the foregoing, as I stated, the problem continues openly and with the full knowledge of an entire community and of the Municipalidad itself. The municipal officials washed their hands of the matter by saying that they had referred the case to the Ministry of Health, but the Health officials did not perform their duties either. REGARDING THE MINISTRY OF HEALTH’S RESPONSE. It is clear that this entity is lying and has never resolved any problem, and the highly contaminated water continues to arrive morning, afternoon, and night. This is demonstrated by the test results I am submitting and the dated photographs I am sending today. The property, we ourselves, the community, and the river are polluted every day. REGARDING SINAC’S RESPONSE. They have never done anything or notified us of anything, and even now they say that they will coordinate with the other respondents, but nothing happens.(…) As of this date, there is a highly dangerous abandonment of authority (abandono de competencias) for a State whose constitutional provisions 21, 50 and 89 protect the right to live in a pleasant, healthy, and pollution-free environment. (...)”
  7. 7The statutory requirements have been observed in the processing of these proceedings.

Justice Araya García drafts the opinion; and,

Considering:

I.Preliminary matters. Before analyzing the merits of the case—concerning the alleged violation of the right to prompt and proper proceedings—it must be clarified that, since Judgment Nº 2008-02545 at 8:55 hours of 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction—with some exceptions—those matters in which it is disputed whether the public administration has complied with the time limits established by the General Law of Public Administration (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, in order to conclude an administrative proceeding—initiated ex officio or at the request of a party—by means of a final act, or to hear the applicable administrative appeals. Specifically, the sub judice case presents an exception, since it concerns the Administration’s alleged delay in addressing an environmental complaint filed with the respondent authorities, which, to date, has not been resolved. Having clarified this point, the Chamber proceeds to rule on the specific situation raised in this amparo proceeding (recurso de amparo).

II.Subject matter of the appeal. The appellant alleges that, since julio de 2020, she has been awaiting resolution of the complaints she filed with the respondent authorities concerning contamination caused by sewage and soapy wastewater that discharge freely onto her property. She complains that no solution has been coordinated, since the foul odors persist and the water continues to flow.

III. Proven facts. The following facts relevant to deciding this amparo proceeding are deemed established

Regarding the Municipalidad de Escazú.

1. On 3 de setiembre de 2020, the protected party filed a complaint with the Municipalidad de Escazú concerning contamination caused by sewage and soapy wastewater that discharge freely onto her property. She provided the email address ...02 as the means for receiving notices (see evidence submitted in the digital case file).

2. By official letter DA-600-2020, the municipal authority stated that a dye-application campaign would be conducted and that, consequently, inspections would begin on 5 de octubre de 2020 to determine the source of the water flowing through the channel (see report submitted by the respondent Municipality).

3. On 29 de octubre de 2020, official letter DA-600-2020 was served on the protected party at the email address ...01 (see report submitted by the respondent Municipality).

4. On an undetermined date, the respondent Municipality requested a report from engineer Jerson Calderón Valverde, Coordinator of the Environmental Management Subprocess, concerning the complaint filed by the appellant. He stated as follows: “(…) In addressing this case, the Environmental Management Subprocess has taken the following actions within the scope of municipal authority: • 09 de julio de 2020: Site inspection at the request of Ms. Nombre01 (…) During that inspection, the interested party was informed that the owner was entitled to seal the water outlets discharging onto her property. Ms. Nombre01 requested the Spring Impact Inquiry procedure (Consulta de Afectación de Nacientes), which was resolved through official letter GA-CA-5492020. • 25 de septiembre 2020: In response to document AJ-590-2020, official letter GA-CA604 2020 was sent, stating that the Municipality would conduct an investigation to determine the source of the water flowing through the property.

The investigation would begin at the properties observed directly upstream from the water outlet, access to which is through Dirección01. • 07 de octubre 2020: An inspection visit was conducted at two properties for the application of fluorescein. The results may be seen in the attached official letters NOFGA-0185-2021 and NO71 GA0186-2021. Accordingly, based on the results obtained (…)” (see report submitted by the respondent Municipality).

5. On an unspecified date, the municipal body notified the residents of the area so that they could submit a proposal to remedy the problem by constructing an appropriate system. Cases in which municipal personnel were denied entry were referred on el19 de marzo de 2021, by official letter CORGA-0186 2021, to the Ministerio de Salud for appropriate action (see report submitted by the respondent Municipality).

Regarding the Área Rectora de Salud de Escazú.

1. On 2 de julio de 2020, the protected party completed a complaint form against the Municipalidad de Escazú concerning the contamination of her property caused by wastewater and solid waste overflowing from the sewers, resulting in foul odors and the presence of insects and rodents. The complaint was assigned number 15411-20 (see evidence submitted in the digital case file).

2. On 3 de setiembre de 2020, the appellant reiterated the complaint before the Área Rectora de Salud de Escazú (see evidence submitted in the digital case file).

3. On 4 de setiembre de 2020, the respondent authority, through official letter MS-DRRSCS-DARSE-1223-2020, informed the protected party as follows: “(…) an inspection visit has been scheduled for 15 de setiembre del presente año (…) to identify the area, assess the case, and determine the actions to be taken. No activity schedule is prepared when addressing complaints, since various situations or circumstances may arise while a case is being handled. Furthermore, given the Covid-19 health-alert situation (…) the complaint will be addressed according to the human resources available. (...) The Ministerio de Salud may not seal sewers or authorize third parties to do so. What it does (…) is order the owners or legal representatives of properties to have an adequate wastewater-disposal system when it has been established (…) that they do not have one. (…) Buildings that test positive following the sodium-fluorescein dye test must have an adequate wastewater-disposal system (…) it is not the duty of this office to tell owners (…) which wastewater-treatment system they must use (…) the Ministerio de Salud has no guidelines stating that wastewater is a means of Covid-19 transmission (...)” 4.

On 15 de setiembre del 2020, as recorded in inspection report MSDRRSCS-DARSE~AIO~AFS-198-2020, the respondent authority visited the reported site. At the time of the visit, access to the affected property was found to be closed; therefore, the adjoining neighborhood was inspected to identify circumstances relating to the case (see evidence submitted in the digital case file).

5. On 17 de septiembre de 2020, the respondent Área de Salud informed the protected party, by email sent to ...03, of the results of the visit conducted on 15 de setiembre de 2020 (see report submitted and evidence provided in the digital case file).

6. On 22 de setiembre del 2020, as recorded in inspection report MS-DRRSCSDARSE~AIO-AFS~21 0-2020, the respondent authority conducted an inspection visit at the residence owned by Ms. Nombre02 Nombre05, located at Dirección02 (a neighborhood adjoining the affected property). On that date, “(…) a sodium-fluorescein dye test was performed on the residence’s plumbing fixtures; the presence of the dye was checked at the complainant’s property, where no sodium fluorescein was observed. However, the dye was seen in the nearby stream; therefore, the result was deemed positive, and the following health orders (órdenes sanitarias) were issued: MS-DRRSCS-DAR5E-0$-126-2020 to Nombre02, MS~DRRSCS-DARSE-OS-117-2020 to Nombre03, MS-DRRSCS-DARSE-OS-124-2020 to Guido José Sandí Sandí. MS-DRRSCSDARSE-OS-120›2020 to Nombre04. MS-DRRSCSDARSE-OS-122-2020 to Nombre05. MS-DRRSCSDARSE-OS-1 18-2020 to Nombre06, MS-DRRSCS›DARSE~OS-123-2020 to Nombre07, MS-DRRSCS-DARSE-OS¬121-2020 to Nombre08. MSDRRSCS-DARSE~OS›125-2020 to Nombre09, and MS-DRRSCS-DARSE-OS119-2020 to Nombre10, all owners of the property recorded under real-property folio registration (…)” (see report submitted and evidence provided in the digital case file).

7. Health orders MS~DRRSCS-DARSE-OS-117-2020, MS-DRRSCS-DARSE-OS-124-2020, MS-DRRSCSDARSE-OS-120›2020, MS-DRRSCSDARSE-OS-122-2020, MS-DRRSCSDARSE-OS-1 18-2020, MS-DRRSCS›DARSE~OS-123-2020, MS-DRRSCS-DARSE-OS¬121-2020, MSDRRSCS-DARSE~OS›125-2020, and MS-DRRSCS-DARSE-OS119-2020 were duly served (see evidence submitted in the digital case file).

8. On 22 de octubre de 2020, the protected party reiterated, for the second time, the complaint filed on 3 de setiembre de 2020. (See evidence submitted in the digital case file.)

9. On 12 de noviembre del 2020, the respondent authority informed the protected party by email of the notices served on the owners of the property recorded under real-property folio registration and also advised her that dye tests would be performed at the remaining properties (see report submitted and evidence provided in the digital case file).

10. The owners of property N°148546, who were served with the health orders, complied as ordered. They initially submitted a corrective-action plan to remedy the improper disposal of wastewater, which was reviewed and approved by the Área de Salud de Escazú before its implementation. Compliance with the plan was verified, and the corrective works were deemed completed (see report submitted by the respondent authority).

11. On 23 de febrero de 2021, the respondent authority conducted another inspection visit at the properties located at the entrance to Dirección02, adjacent to the complainant’s property, where another dye test was performed on the plumbing fixtures. A positive result was obtained, and health order N°MS~DRRSCS-DARSEOS›O4122021 was therefore issued. That order remains in effect pending compliance with its directives within the prescribed period (see report submitted and evidence provided by the respondent authority).

12. On 16 y 23 de marzo de 2021, the respondent authority conducted two visits to the area, during which a dye test was performed and yielded a negative result (see evidence provided by the respondent authority).

Regarding SINAC.

1. On 3 de setiembre de 2020, the appellant filed a complaint with the Área Rectora de Salud de Escazú reporting contamination of her property caused by wastewater and solid waste overflowing from the sewers, resulting in foul odors and the presence of insects and rodents (see evidence submitted in the digital case file).

2. On an unspecified date, the SINAC authorities referred the complaint filed by the protected party to the official in charge of the Environmental Management Subprocess of the Municipalidad de Escazú, with a copy to the Área Rectora de Salud de Escazú of the Ministerio de Salud, since those were the competent authorities in the matter (see report submitted by the respondent authority).

IV. Unproven facts. The following facts relevant to deciding this amparo proceeding are not deemed established

1. That the SINAC authorities informed the appellant that they lacked jurisdiction to address the complaint filed and that it would therefore be referred to the Municipalidad de Escazú, with a copy to the Área Rectora de Salud de Escazú.

2. That the Área Rectora de Salud informed the protected party of the owners’ compliance with the health orders concerning property N°148546, or of the results and actions taken following the visits conducted on 23 de febrero, 16 y 23 de marzo, all in 2021.

V.Regarding the Municipalidad de Escazú. The matter under review shows that on 3 de setiembre de 2020, the protected party (amparada) filed a complaint with the respondent Municipality concerning the contamination caused by fecal and soapy wastewater flowing freely onto her property.

In this regard, the report submitted by the municipal body stated that, through official letter DA-600-2020, the municipal authority responded to the complaint filed by the protected party, informing her that a dye-testing campaign would be conducted and, consequently, inspections would begin on 5 de octubre de 2020 to determine the source of the water flowing through the channel. She was notified thereof at email address ...01 on 29 de octubre de 2020.

In this respect, the evidence submitted shows that the means designated by the protected party for receiving notices was email address ...02; that is, the Municipalidad de Escazú made a clear clerical error by sending the cited official letter to the protected party at the wrong address.

Moreover, the report submitted indicated that a report had been requested from the coordinator of the Environmental Management Subprocess and that, on 9 de julio de 2020, an inspection was conducted at the reported site. During that inspection, the protected party was informed that the property adjoining hers had the right to block the water outlets leading onto its premises, whereupon the petitioner requested an inquiry concerning the impact on springs (nacientes), which was resolved through official letter GA-CA-5492020. Subsequently, on 25 de septiembre 2020, official letter GA-CA604 2020 was sent to the protected party, informing her that an investigation would be conducted to determine the source of the water flowing through the property. That investigation would begin at the properties located directly upstream from the water outlet; accordingly, on 7 de octubre 2020, those two properties were inspected for purposes of applying the fluorescein test (prueba de fluoresceína).

In light of the result of that test, the municipal body notified the residents of the area so that they could submit a proposal to remedy the problem by constructing an appropriate system for handling stormwater (aguas pluviales). Cases in which municipal personnel were not allowed to enter were referred to the Ministerio de Salud for the appropriate action.

In this respect, although the record shows that the respondent authorities took certain steps intended to address the complaint filed by the protected party, the fact remains that the problem continues.

VI.Regarding the Área de Salud de Escazú. In this regard, the record shows that on 2 de julio de 2020, the protected party submitted a complaint form against the Municipalidad de Escazú concerning contamination of her property caused by wastewater (aguas residuales) and solid waste overflowing from the sewers. The complaint was reiterated on 3 de setiembre and 22 de octubre, both of 2020.

In this regard, the Ministerio de Salud authorities reported that an inspection visit was scheduled for el15 de setiembre de 2020, in order to The foregoing was communicated to the petitioner through official letter MS-DRRSCS-DARSE-1223-2020, together with the following: “(…) The Ministerio de Salud cannot seal sewers or authorize third parties to do so. What it does (…) is order the owners or legal representatives of properties to have an adequate wastewater disposal system when it has been established (…) that they do not have one. (…) Buildings yielding a positive result following the sodium fluorescein dye test (prueba de coloración a base de fluoresceína sódica) must have an adequate wastewater disposal system (…) it is not the duty of this agency to tell owners (…) which wastewater treatment system they must use (…) the Ministerio de Salud has no guideline stating that wastewater is a means of transmission of Covid-19 (…)”.

Accordingly, the record shows that on 15 de setiembre del 2020, the respondent authority conducted a visit to the reported site, as documented in inspection record MSDRRSCS-DARSE~AIO~AFS-198-2020. When the inspection was carried out, access to the affected property was found to be closed, and therefore the adjoining neighborhood was surveyed to identify circumstances relevant to the case. This was reported to the petitioner by email on 17 de setiembre de 2020.

As a result of the foregoing, on 22 de setiembre del 2020, a second visit was made to the site, during which a sodium fluorescein dye test was conducted on the dwelling’s plumbing fixtures. Based on the result, multiple sanitary orders (órdenes sanitarias) were issued and duly served, and the protected party was also informed thereof. The report submitted further shows that residents of the area complied with the sanitary orders issued and that a corrective action plan was submitted to remedy the improper disposal of wastewater. The plan was reviewed and approved by the Área de Salud de Escazú, and compliance with it was subsequently verified.

Moreover, it was established that on 23 de febrero de 2021, the respondent authority conducted another inspection of the properties located at the entrance to Dirección02, adjacent to the complainant’s property. A new dye test was applied to the plumbing fixtures and yielded a positive result, for which reason sanitary order N°MS~DRRSCS-DARSEOS›O4122021 was issued. Likewise, on 16 and 23 de marzo de 2021, the respondent authority made two visits to the area, during which a dye test was performed and yielded a negative result.

This Court established that the health authorities addressed the complaint filed by the protected party, taking the measures necessary to inspect the area and issue the pertinent sanitary orders to remedy the reported problem, all of which was communicated to the protected party. Notwithstanding the foregoing, it was not established that the respondent authorities informed the petitioner about the sanitary orders issued in connection with the owners of property N°148546, or about the results of and actions taken as a result of the visits conducted on 23 de febrero, 16 and 23 de marzo, all of 2021.

Notwithstanding the foregoing, although the record shows that the authorities took pertinent actions to remedy the situation described by the protected party in the complaint she filed, the fact remains that the problem in the area persists.

VII.Regarding the Sistema Nacional de Áreas de Conservación. In this regard, the record shows that, indeed, on 3 de setiembre de 2020, the petitioner filed a complaint reporting contamination of her property caused by wastewater and solid waste overflowing from the sewers.

In response, the SINAC authorities forwarded the complaint filed by the protected party to the person in charge of the Environmental Management Subprocess of the Municipalidad de Escazú, with a copy to the Área Rectora de Salud de Escazú del Ministerio de Salud, as those were the competent authorities in the matter. However, it was not established that this was communicated to the petitioner.

VIII.Conclusion. In light of the foregoing, because a violation of the protected party’s right to prompt and effective justice (derecho de justicia pronta y cumplida), as well as her right to a healthy and ecologically balanced environment, has been established, the appropriate course is to grant this constitutional relief petition (recurso de amparo), subject to the directions set forth in the operative portion of this judgment.

IX. NOTE BY JUSTICE SALAZAR ALVARADO

In environmental matters, it is the undersigned’s view that, where the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the administrative litigation courts (jurisdicción contenciosa administrativa). Nevertheless, I do address the merits of the matter when other rights of persons affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (artículo 50, de la Constitución Política), as is the case here, where the petitioner stated that, since julio de 2020, she has been waiting for decisions on the complaints she filed with the respondent authorities concerning contamination caused by fecal and soapy wastewater flowing freely onto her property. The foregoing violates the right to enjoy a healthy and ecologically balanced environment and a decent quality of life.

X.Documentation submitted to the case file. The parties are hereby advised that, if they have submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the court office within a maximum period of 30 business days from service of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, approved by the Corte Plena at session No. 27-11 of 22 de agosto de 2011, artículo XXVI, and published in Boletín Judicial número 19 of 26 de enero de 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 de mayo de 2012, artículo LXXXI.

Por tanto:

The petition is granted. Arnoldo Barahona Cortés, in his capacity as mayor of the Municipalidad de Escazú; William Barrantes Barrantes, in his capacity as director of the Área Rectora de Salud de Escazú del Ministerio de Salud; and Aimará Espinoza Ulate, in her capacity as head of the Oficina Subregional de San José del Sistema Nacional de Áreas de Conservación (SINAC) del Área de Conservación Central, or whoever may hold those offices in their stead, are ordered to carry out all actions within the scope of their authority and to undertake the necessary coordination so that, within SIX MONTHS from service of this judgment: a) the contamination problem on the petitioner’s property is definitively resolved in accordance with the law; and b) the protected party is notified of all actions taken as a result of the complaint filed. They are hereby warned that, pursuant to artículo 71, de la Ley de la Jurisdicción Constitucional, any person who receives an order issued in a constitutional relief proceeding that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years or to a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty.

The respondent authorities are ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative litigation courts. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del once de junio de dos mil veintiuno .

Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, contra la MUNICIPALIDAD DE ESCAZÚ, el MINISTERIO DE SALUD y el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN.

Resultando:

  1. 1Por escrito recibido en la Secretaría de esta Sala el 18 de marzo de 2021, la recurrente interpuso recurso de amparo contra la Municipalidad de Escazú, el Ministerio de Salud y el Sistema Nacional de Áreas de Conservación. Manifiesta que, desde julio de 2020 está en espera de que se resuelvan las denuncias que interpuso por la contaminación de aguas fecales y jabonosas que desfogan libremente en la propiedad (inmueble inscrito a folio real matrícula , situado en San José, San Antonio, Escazú, plano catastrado No. SJ 0010149-1970) de su representada (VETRA S.A.) y continúan hasta el río de la localidad. Detalla que las aguas contaminadas llegan a través de 2 alcantarillas, a un costado del inmueble, desde los lotes residenciales que están en la parte alta y que conforman un barrio en Escazú. Añade que las aguas se quedan empozadas en el lote, otras se desbordan a la calle y luego siguen por el cordón de caño hasta el cauce del río.Alega que esta situación la denunció ante la municipalidad recurrida en julio de 2020 y como no se hizo nada al respecto, la reiteró el 03 de setiembre, ya que se trata de una problemática para toda la comunidad, pues además puede haber contagio de la COVID-19 a través de la materia fecal. Acusa que los olores que llegan al inmueble son fétidos y hay insectos, roedores, moscas y cucarachas en el sitio, los cuales son vectores de riesgos para la sociedad en general. Señala que en los mismos términos presentó denuncia ante el Ministerio de Salud en julio de 2020, y nuevamente el 03 de setiembre, ocasión en la que solicitó una inspección, y que se dictaran las órdenes sanitarias correspondientes. Agrega que en respuesta se le comunicó que efectuarían la visita el 15 de setiembre, pero fue hasta más de un mes después y posterior a múltiples llamadas telefónicas, que se le señaló que no pudieron ingresar al lote; por lo que mediante escrito, el 22 de octubre les aclaró que existe un paso peatonal totalmente visible y sin candado, por el cual pueden ingresar.No obstante, acusa que desconoce si finalmente se hizo la inspección, y continúa en espera que se tomen medidas. Refiere que el 03 de setiembre también acudió al SINAC, para denunciar que se están lanzando en crudo las aguas contaminadas al río cuyo nombre desconoce; sin embargo, no le respondieron ni se hizo nada al respecto, ya que el agua continúa bajando sin ninguna limitación. Reclama que ninguno de los recurridos ha coordinado solución alguna, dado que los malos olores y las aguas continúan fluyendo. Por lo expuesto, acude a la Sala en protección de sus derechos fundamentales y solicita que se declare con lugar el recurso.
  2. 2Mediante resolución de las 8:49 horas de 23 de marzo de 2021, se le dio curso al proceso y se solicitó informe al alcalde de la Municipalidad de Escazú, a la directora del Área Rectora de Salud de Escazú del Ministerio de Salud, y al director regional del Sistema Nacional de Áreas de Conservación (SINAC) del Área de Conservación Central, sobre los hechos alegados por la recurrente.
  3. 3Por escrito recibido vía correo electrónico a las 14:39 horas de 29 de marzo de 2021, informó bajo juramento Arnoldo Barahona Cortés, en su condición de alcalde de la Municipalidad de Escazú. Manifiesta lo siguiente: “(…) esta corporación municipal le brindó respuesta (…) a través del oficio DA-600-2020, mismo que fue notificado al correo electrónico ...01 en fecha 29 de octubre de 2020 (…) por ser el medio señalado por el recurrente. Al respecto, se le indicó a la recurrente en el oficio supra citado que, se iba a realizar una campaña de aplicación de colorante, por consecuencia, las inspecciones se iban a llevar a cabo a partir de la semana que inició el lunes 05 de octubre con el objetivo de determinar el origen de las aguas que discurren por el canal. Ahora bien, se le solicitó un informe al ing. Jerson Calderón Valverde, Coordinador del Subproceso de Gestión Ambiental sobre la denuncia presentada por la recurrente, quien indicó mediante el oficio CORGA-254-2021 de fecha 07/04/2021 entre otras cosas lo siguiente: "En atención o este caso, según fas competencias municipales se ha realizado las siguientes gestiones por porte de Subproceso Gestión Ambiental: • 09 de julio de 2020: Inspección al sitio a solicitud de la señora Nombre01 (…) En dicha inspección se le indicó a la interesada que el propietario estaba en su derecha de condenar las salidas de aguas a su predio.La señora Nombre01 solicitó el trámite de Consulta de Afectación de Nacientes, trámite que fue resuelto con el oficio GA-CA-5492020. • 25 de septiembre 2020: En respuesta al documento AJ-590-2020 se envía el oficio GA-CA604 2020. en dicho oficio se indica que la Municipalidad realizará una investigación para determinar la procedencia de las aguas que discurren por el predio. La investigación iniciaría en los predios que se observan directamente aguas arriba de la salida de agua, predios cuyo acceso es por Dirección01. • 07 de octubre 2020: se realiza visita de inspección a dos propiedades para aplicación de Fluoresceína. Los resultados se pueden observar en los oficios NOFGA-0185-2021 y NO71 GA0186-2021 adjuntos. En ese sentido, de conformidad con los resultados obtenidos (...) se procedió a notificar a los vecinos con la finalidad de que los mismos presentaran una propuesta para remediar el problema con la construcción de un sistema adecuado y los casos que no permitieron el ingreso al personal municipal se trasladaron mediante el oficio CORGA 0186 2021 de fecha 19/03/2021 al Ministerio de Salud para su respectiva atención como así consta a folio 25 del expediente de marras correspondientes con la finalidad de atender la denuncia presentada por la señora Nombre01, ego dentro del marco de nuestras competencias. (…)”. Por lo expuesto, solicita se declare sin lugar el recurso.
  4. 4Mediante escrito recibido a las 12:47 horas de 17 de abril de 2021, informó bajo juramento William Barrantes Barrantes, en su condición de director del Área Rectora de Salud de Escazú del Ministerio de Salud. Manifiesta lo siguiente: “(…) Esta Área Rectora recibió denuncia de la aquí amparada, por aguas residuales, las cuales atraviesan su propiedad por medio de alcantarillas que desfogan en la quebrada cercana. Se consigna en la misma que el denunciado es la Municipalidad de Escazú por referencia de vecinos. (…) El 3 de setiembre del 2020, ingresa documentación suscrita por la señora Nombre01 y el señor Álvaro Sagot Rodríguez solicitando: "Pido que se establezca un cronograma de actividades aportándome copia de este. Pido que ustedes, como ente rector procedan al señalamiento de las dos alcantarillas o tuberías que llevan aguas contaminadas a nuestro fundo. En su defecto, pido que al menos se me autorice cerrar las alcantarillas por mi cuenta, pues nadie está autorizado a contaminar por derecho constitucional y nuestro fundo no es sitio para depositar las aguas contaminadas.Solicito que se disponga, de ser el caso, que cada casa que lanza sus aguas contaminadas tenga que hacer su respectivo tanque séptico y que se prohíba de forma absoluta y tajante al lanzamiento de aguas residuales y fecales a las alcantarillas que llevan todos esos residuos líquidos a nuestro inmueble” Con relación a la gestión planteada en fecha 03 de setiembre del 2020, por oficio MS›DRRSCS-DARSE-1223-2020 del 4 de setiembre del 2020, se le indicó a los recurrentes la imposibilidad de brindar el cronograma de actividades, al ser que, en atención de denuncias durante el desarrollo del caso se pueden dar diversas situaciones o circunstancias que impidan el cumplimiento del cronograma. En cuanto a este extremo, vale aclarar que las actividades que se realizan durante la investigación preliminar para recabar pruebas resultan confidenciales para todas las partes. En caso de revelar el cronograma y acciones a seguir por la administración compromete el resultado de la investigación, toda vez que se puede alterar o viciar el procedimiento de recolección de indicios y la prueba.Por otra parte, en cuanto a la solicitud de cierre de alcantarillas en el mismo oficio se le comunicó que es improcedente sellar alcantarillas o dar autorización a terceros para hacerlo. Debe quedar claro que esta Autoridad de Salud debe actuar bajo el principio de legalidad, por lo que al amparo de la Ley General de Salud, y así se hizo saber a la amparada se deben dictar las medidas sanitarias administrativas necesarias para que los inmuebles deben cuenten con un adecuado sistema de eliminación de aguas residuales, situación que se determina con la aplicación de la prueba de coloración a base de fluorescencia sódica. (...) El 15 de setiembre del 2020, tal y como consta en el acta de inspección MSDRRSCS-DARSE~AIO~AFS-198-2020. se realizó visita al sitio denunciado. Al momento de la inspección el acceso a la propiedad afectada se encontraba cerrado, por lo que se realizó recorrido por el barrio colindante para determinar situaciones referentes al caso de marras.El 17 de septiembre del 2020 a las 14:08 horas por correo electrónico se le comunicó a la señora Ayud Carboni el resultado de la visita, en donde se le indica que se visitó el sitio pero que no se ingresó a la propiedad ya que se visualizó cerrada con candado, ese mismo día, a las 17:45 horas se recibe respuesta por parte de la señora Nombre01, en donde indica que existe un portón de uso personal que no tiene candado. En este punto se debe hacer hincapié que contrario a lo que expone la amparada en el escrito del recurso, esta Autoridad de Salud aunque el ingreso se encuentre sin candado, no se puede acceder a la propiedad privada sin la respectiva autorización del propietario, toda vez que dicha actuación podría configurar un eventual delito de violación a la propiedad privada, por lo que dicha aseveración resulta ¡legitima y carente de todo fundamento legal.(…) El 22 de setiembre del 2020, según consta en el acta de inspección MS-DRRSCSDARSE~AIO-AFS~21 0-2020, se realizó visita de inspección a la vivienda propiedad de la señora Nombre02 Nombre02, ubicada en Dirección02 (barrio colindante con la propiedad afectada), en seguimiento a la denuncia incoada por la señora Nombre01.En sitio, se realizó prueba de coloración a base de fluoresceína sódica en las piezas sanitarias de la vivienda, dicha coloración fue verificada en la propiedad de la denunciante, en donde no se observó la presencia de fluoresceína sódica, sin embargo, dicho colorante se visualizó en la quebrada cercana, por lo que se valora como positiva y se giran las ordenes sanitarias MS-DRRSCS-DAR5E-0$-126-2020 a Nombre02, MS~DRRSCS-DARSE-OS-117-2020 a Nombre03, MS-DRRSCS-DARSE-OS-124-2020 a Guido José Sandí Sandí. MS-DRRSCSDARSE-OS-120›2020 a Nombre04. MS-DRRSCSDARSE-OS-122-2020 a Nombre05. MS-DRRSCSDARSE-OS-1 18-2020 a Nombre06, MS-DRRSCS›DARSE~OS-123-2020 a Nombre07, MS-DRRSCS-DARSE-OS¬121-2020 a Nombre08. MSDRRSCS-DARSE~OS›125-2020 a Nombre09, y MS-DRRSCS-DARSE-OS119-2020 a Nombre10, todos propietarios del inmueble matrícula de folio real . (…) El 12 de noviembre del 2020, se le informó a la señora Nombre01 vía correo electrónico de la notificación de las ordenes sanitarias a los propietarios del inmueble matricula de folio real , además se le comunico que se estará realizando prueba de coloración en los demás inmuebles.Es por lo anterior, que no tiene esta instancia por recibidos los alegatos presentados por la recurrente del desconocimiento de si se realizó la visita, ya que esta fue comunicada de todas las actuaciones realizadas por esta Autoridad de Salud en atención a la denuncia (…) Los propietarios del inmueble notificados procedieron a cumplir lo ordenado mediante los actos administrativos supra citados, presentando inicialmente el plan de acciones correctivas para solventar la inadecuada disposición de aguas residuales, mismas que fueron revisados y aprobados por esta instancia previo a su ejecución. Se verificó el cumplimiento de las ordenes sanitarias y por oficios MS-DRRSCSDARSE-502-2021, |1/|S-DRR$QS.DAR5E-606,2021 y MSDRRSCS-DARSE›606-2021 se da por finalizadas las obras correctivas. (...) En fecha 23 de febrero del presente año, se procedió a realizar nueva visita de inspección a los inmuebles ubicados en la entrada al Dirección02, contiguo a la propiedad de la denunciante.Se aplicó nueva prueba de coloración en las piezas sanitarias de la vivienda del señor Nombre11, representante legal de ORCAZU CUARENTA SOCIEDAD ANONIMA, quien es la propietaria del inmueble matricula de folio real en donde se obtuvo un resultado positivo por lo que se emite el acto administrativo N°MS~DRRSCS-DARSEOS›O4122021, mismo que se encuentra vigente y a espera de cumplimiento de las ordenanzas en el plazo establecido. Se indica a su vez, que durante las inspecciones realizadas a la propiedad de la denunciante no se ha visualizado la presencia de roedores en la zona. En ese orden de ideas, como se puede apreciar el Área Rectora de Salud Escazú no ha sido omisa en el cumplimiento de sus funciones, y en atención a la denuncia incoada ha realizado las acciones que corresponden conforme a las competencias delegadas por ley, se han emitido en ese sentido los actos administrativos necesarios y se sigue dado seguimiento al caso de marras, por lo que se rechaza enfáticamente lo expuesto por la amparada respecto a que esta Autoridad no ha actuado en atención a dicha denuncia (...)”. Por lo expuesto, solicita se declare sin lugar el recurso.
  5. 5Mediante escrito recibido a las 12:47 horas de 17 de abril de 2021, informó bajo juramento Aimará Espinoza Ulate, en su condición de jefe de la Oficina Subregional de San José del Sistema Nacional de Áreas de Conservación (SINAC) del Área de Conservación Central. Manifiesta que el 3 de setiembre de 2020 se recibió el oficio No. SINAC-ACC-D-1362-2020 en que se le dio traslado a la denuncia interpuesta por la amparada. En virtud de ello, señala que las pretensiones indicadas por la tutelada en la denuncia interpuesta no se encuentran dentro de las competencias de esa institución, por lo dicho oficio fue remitido a la encargada del Subproceso de Gestión Ambiental de la Municipalidad de Escazú, con copia al Área Rectora de Salud de Escazú del Ministerio de Salud, autoridades competentes al efecto. Por lo expuesto, solicita se declare sin lugar el recurso.
  6. 6Por escrito recibido a las 7:47 horas de 26 de abril de 2021, la recurrente manifestó lo siguiente: “(sic) Deseo aportar ad effectum videndi prueba de que a la fecha el problema de contaminación de una comunidad entera sigue plenamente vigente a pesar de que ya casi vamos para un año desde que se denunció. Para ello aporto un nuevo examen de aguas de laboratorio certificado, donde se aprecia la cantidad de materia fecal que está bajando a la propiedad nuestra y donde incluso ello se combina con aguas jabonosas como se aprecia en las fotos. A la fecha NADIE ha valorado las aguas jabonosas pues las pruebas hechas son inodoros y lavatorios, pero no en pilas o desfogues de aguas donde se lava ropa. Por esto es claro que en realidad los recurridos nunca fueron a solucionar problema alguno, aunque hayan visitado la zona. La situación sobre la salud, la calidad de vida, contaminación de aguas, daño al paisaje, malos olores (…) continúa descaradamente.La verdad es desesperante y angustiante que de forma irresponsable los recurridos se presenten a esta Sala a decir que han dado respuesta a las situaciones que vivimos, pero ello es totalmente falso. La respuesta objetiva a la fecha es que faltan estudios (…) SOBRE CONTESTACIÓN DE LA MUNICIPALIDAD. Ellos dicen que me han tenido enterada de todo, pero es totalmente falso, porque el correo al que dicen haberme notificado expresamente NO es el que pusimos para oír notificaciones. Desde la Municipalidad dicen que respondieron a: ...01 en fecha 29 de octubre de 2020 (ver folio 14 del expediente administrativo) por ser medio señalado por el recurrente”. Al respecto cabe indicar que el correo señalado para notificaciones fue ...02 es decir, los representantes municipales por error o por mala fe me notificaron a un correo inexistente, al eliminar una “a” del correo señalado y como prueba de ello los insto a ver nuestro escrito de denuncia y la contestación que le hacen a esta Sala.Independientemente a lo anterior, como expuse el problema sigue y a vista y paciencia de toda una comunidad y de la misma municipalidad. Los funcionarios municipales se limpiaron las manos al decir que habían pasado el caso al Ministerio de Salud, pero los funcionarios de Salud no cumplieron con sus deberes tampoco. SOBRE CONTESTACIÓN DEL MINISTERIO DE SALUD. Es claro que esa entidad miente y nunca han resuelto problema alguno y las aguas altamente contaminadas siguen llegando mañana tarde y noche y esto quedo de manifiesto en los exámenes que les aporto y las fotografías con fecha que les estoy haciendo llegar el día de hoy. El inmueble, nosotros, la comunidad y el río se contaminan todos los días. SOBRE RESPUESTA DEL SINAC. Ellos nunca han hecho nada, ni nos han notificado nada y por ello incluso a la fecha dicen que van a coordinar con los otros recurridos, pero nada ocurre. (…) A la fecha hay un abandono de competencias muy peligroso para un Estado que tiene unas normas 21, 50 y 89 constitucionales que defienden el derecho a vivir en un ambiente agradable, sano y sin contaminación. (...)”.
  7. 7En la substanciación del proceso se han observado las prescripciones de ley.

Redacta el Magistrado Araya García; y,

Considerando:

I.Cuestiones preliminares. De previo a analizar el fondo del asunto –por la presunta violación del derecho a un procedimiento pronto y cumplido– debe aclararse que, a partir de la Sentencia Nº 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub-lite, se plantea un supuesto de excepción, pues, se está ante la supuesta demora de la Administración en atender una denuncia ambiental interpuesta ante las autoridades recurridas, la cual, a la fecha no ha sido resuelta. Aclarado el punto, se entra a resolver, la situación concreta planteada en este amparo.

II.Objeto del recurso. La recurrente alega que, desde julio de 2020, está en espera de que se resuelvan las denuncias que interpuso ante las autoridades recurridas, por la contaminación de aguas fecales y jabonosas que desfogan libremente en su propiedad. Reclama que no se ha coordinado solución alguna, dado que los malos olores y las aguas continúan fluyendo.

III.Hechos probados. De relevancia para dirimir el presente recurso de amparo, se tienen por acreditados los siguientes hechos:

Sobre la Municipalidad de Escazú.

1. El 3 de setiembre de 2020, la amparada interpuso una denuncia ante la Municipalidad de Escazú, motivo de la contaminación de aguas fecales y jabonosas que desfogan libremente en su propiedad. Aportando como medio para recibir notificaciones el correo electrónico ...02 (ver prueba aportada al expediente digital).

2. Mediante el oficio DA-600-2020, la autoridad municipal indicó que se iba a realizar una campaña de aplicación de colorante, por consecuencia, las inspecciones se iban a llevar a cabo a partir del 5 de octubre de 2020 con el objetivo de determinar el origen de las aguas que discurren por el canal (ver informe rendido por la Municipalidad recurrida).

3. El 29 de octubre de 2020, se notificó el oficio DA-600-2020 a la tutelada, al correo electrónico ...01 (ver informe rendido por la Municipalidad recurrida).

4. En fecha indeterminada, la Municipalidad accionada solicitó un informe al ingeniero. Jerson Calderón Valverde, Coordinador del Subproceso de Gestión Ambiental, sobre la denuncia presentada por la recurrente, quien indicó lo siguiente: "(…) En atención o este caso, según fas competencias municipales se ha realizado las siguientes gestiones por porte de Subproceso Gestión Ambiental: • 09 de julio de 2020: Inspección al sitio a solicitud de la señora Nombre01 (…) En dicha inspección se le indicó a la interesada que el propietario estaba en su derecha de condenar las salidas de aguas a su predio. La señora Nombre01 solicitó el trámite de Consulta de Afectación de Nacientes, trámite que fue resuelto con el oficio GA-CA-5492020. • 25 de septiembre 2020: En respuesta al documento AJ-590-2020 se envía el oficio GA-CA604 2020, en dicho oficio se indica que la Municipalidad realizará una investigación para determinar la procedencia de las aguas que discurren por el predio.

La investigación iniciaría en los predios que se observan directamente aguas arriba de la salida de agua, predios cuyo acceso es por Dirección01. • 07 de octubre 2020: se realiza visita de inspección a dos propiedades para aplicación de Fluoresceína. Los resultados se pueden observar en los oficios NOFGA-0185-2021 y NO71 GA0186-2021 adjuntos. En ese sentido, de conformidad con los resultados obtenidos (…)” (ver informe rendido por la Municipalidad recurrida).

5. En fecha no señalada, el órgano municipal notificó a los vecinos de la zona, con la finalidad de que los mismos presentaran una propuesta para remediar el problema con la construcción de un sistema adecuado, siendo que los casos en los que no permitió el ingreso del personal municipal se trasladaron el19 de marzo de 2021, mediante el oficio CORGA-0186 2021 de fecha, al Ministerio de Salud para su respectiva atención (ver informe rendido por la Municipalidad recurrida).

Sobre el Área Rectora de Salud de Escazú.

1. El 2 de julio de 2020, la tutelada llenó un formulario de denuncia en contra de la Municipalidad de Escazú, en virtud de la contaminación de su propiedad, en virtud de las aguas residuales y sólidos que se desbordan de las alcantarillas, lo que ocasiona malos olores y la presencia de insectos y roedores, a la cual se le asignó el número 15411-20 (ver prueba aportada al expediente digital).

2. El 3 de setiembre de 2020, la recurrente reiteró la denuncia ante el Área Rectora de Salud de Escazú (ver prueba aportada al expediente digital).

3. El 4 de setiembre de 2020, la autoridad recurrida, mediante el oficio MS-DRRSCS-DARSE-1223-2020, le informó a la amparada lo siguiente: “(…) se tiene programada una visita de inspección para el 15 de setiembre del presente año (…) para la identificación de la zona, valoración del caso y acciones a realizar. No se realiza un cronograma de actividades en la atención de denuncias, ya que durante la atención del aso se pueden dar diversas situaciones o circunstancias. Además, bajo la situación de alerta sanitaria por Covid-19 (…) la denuncia se atenderá según el recurso humano que haya. (...) El Ministerio de Salud no puede sellar alcantarillas ni dar autorización a terceros para que así lo hagan. Lo que realiza (…) es ordenar a los propietarios o representantes legales de los inmuebles, poseer un adecuado sistema de eliminación de aguas residuales cuando haya sido comprobado (…) que no lo posea.

(…) las edificaciones que tengan un resultado positivo reas la prueba de colocación a base de fluoresceína sódica deberán cumplir con un adecuado sistema de eliminación de aguas residuales (…) no es deber de esta instancia indicar a los propietarios (…) qué sistema de tratamiento de aguas residuales deben utilizar (…) el Ministerio de Salud no cuenta con ningún lineamiento que indique que las aguas residuales son medio de transmisión de Covid-19 (...)” 4. El 15 de setiembre del 2020, la autoridad accionada, según el acta de inspección MSDRRSCS-DARSE~AIO~AFS-198-2020, realizó la visita al sitio denunciado, siendo que, al momento de realizar ésta se encontró que el acceso a la propiedad afectada se encontraba cerrado, por lo que se realizó recorrido por el barrio colindante para determinar situaciones referentes al caso (ver prueba aportada al expediente digital).

5. El 17 de septiembre de 2020, el Área de Salud recurrida le informó a la tutelada, vía correo electrónico a la dirección ...03, el resultado de la visita efectuada el 15 de setiembre de 2020 (ver informe rendido y prueba aportada al expediente digital).

6. El 22 de setiembre del 2020, la autoridad recurrida, según consta en el acta de inspección MS-DRRSCSDARSE~AIO-AFS~21 0-2020, realizó visita de inspección a la vivienda propiedad de la señora Nombre02 Nombre05, ubicada en Dirección02 (barrio colindante con la propiedad afectada), fecha en la que “ (…) se realizó prueba de coloración a base de fluoresceína sódica en las piezas sanitarias de la vivienda, dicha coloración fue verificada en la propiedad de la denunciante, en donde no se observó la presencia de fluoresceína sódica, sin embargo, dicho colorante se visualizó en la quebrada cercana, por lo que se valora como positiva y se giran las ordenes sanitarias: MS-DRRSCS-DAR5E-0$-126-2020 a Nombre02, MS~DRRSCS-DARSE-OS-117-2020 a Nombre03, MS-DRRSCS-DARSE-OS-124-2020 a Guido José Sandí Sandí. MS-DRRSCSDARSE-OS-120›2020 a Nombre04. MS-DRRSCSDARSE-OS-122-2020 a Nombre05. MS-DRRSCSDARSE-OS-1 18-2020 a Nombre06, MS-DRRSCS›DARSE~OS-123-2020 a Nombre07, MS-DRRSCS-DARSE-OS¬121-2020 a Nombre08. MSDRRSCS-DARSE~OS›125-2020 a Nombre09, y MS-DRRSCS-DARSE-OS119-2020 a Nombre10, todos propietarios del inmueble matrícula de folio real (…)” (ver informe rendido y prueba aportada al expediente digital).

7. Las ordenes sanitarias MS~DRRSCS-DARSE-OS-117-2020, MS-DRRSCS-DARSE-OS-124-2020, MS-DRRSCSDARSE-OS-120›2020, MS-DRRSCSDARSE-OS-122-2020, MS-DRRSCSDARSE-OS-1 18-2020, MS-DRRSCS›DARSE~OS-123-2020, MS-DRRSCS-DARSE-OS¬121-2020, MSDRRSCS-DARSE~OS›125-2020 y MS-DRRSCS-DARSE-OS119-2020 fueron debidamente notificadas (ver prueba aportada al expediente digital).

8. El 22 de octubre de 2020, la tutelada reiteró, por segunda vez, la denuncia interpuesta el 3 de setiembre de 2020. (ver prueba aportada al expediente digital).

9. El 12 de noviembre del 2020, la autoridad recurrida informó a la amparada, vía correo electrónico, sobre las notificaciones realizadas a los propietarios del inmueble matricula de folio real , además se le comunico que se estaría realizando una prueba de coloración en los demás inmuebles (ver informe rendido y prueba aportada al expediente digital).

10. Los propietarios del inmueble N°148546, a lo cuales se les notificó las ordenes sanitarias, cumplieron lo ordenado, presentando inicialmente el plan de acciones correctivas para solventar la inadecuada disposición de aguas residuales, el cual fue revisados y aprobado por el Área de Salud de Escazú, previo a su ejecución, verificándose el cumplimiento de este y dándose por finalizadas las obras correctivas (ver informe rendido por la autoridad recurrida).

11. El 23 de febrero de 2021, la autoridad recurrida realizó una nueva visita de inspección a los inmuebles ubicados en la entrada al Dirección02, contiguo a la propiedad de la denunciante, en la que se aplicó nueva prueba de coloración en las piezas sanitarias, obteniéndose un resultado positivo por lo que se emitió la orden sanitaria N°MS~DRRSCS-DARSEOS›O4122021, mismo que se encuentra vigente y a espera de cumplimiento de las ordenanzas en el plazo establecido (ver informe rendido y prueba aportada por la autoridad recurrida).

12. En fechas 16 y 23 de marzo de 2021, la autoridad recurrida realizó dos visitas a la zona, en las que se realizó una aprueba de coloración, la cual obtuvo un resultado negativo (ver prueba aportada por la autoridad recurrida).

Sobre el SINAC.

1. El 3 de setiembre de 2020, la recurrente interpuso una denuncia ante el Área Rectora de Salud de Escazú, en la que denunció la contaminación de su propiedad, en virtud de las aguas residuales y sólidos que se desbordan de las alcantarillas, lo que ocasiona malos olores y la presencia de insectos y roedores (ver prueba aportada al expediente digital).

2. En fecha no indicada, las autoridades del SINAC, remitieron la denuncia interpuesta por la tutelada a la encargada del Subproceso de Gestión Ambiental de la Municipalidad de Escazú, con copia al Área Rectora de Salud de Escazú del Ministerio de Salud, al ser estas las autoridades competentes al efecto (ver informe rendido por la autoridad recurrida).

IV.Hechos no probados. De relevancia para dirimir el presente recurso de amparo, no se tienen por acreditados los siguientes hechos:

1. Que las autoridades del SINAC le hayan informado a la recurrente que estas no eran competentes para atender la denuncia interpuesta, por lo que ella sería remitida a la Municipalidad de Escazú, con copia al Área Rectora de Salud de Escazú.

2. Que el Área Rectora de Salud le haya comunicado a la tutelada el cumplimiento de las órdenes sanitarias por parte de los propietarios del inmueble N°148546 de así como sobre el resultado y acciones tomadas en virtud de las visitas realizadas en fechas 23 de febrero, 16 y 23 de marzo, todos de 2021.

V.Sobre la Municipalidad de Escazú. Del sub examine, se desprende que el 3 de setiembre de 2020, la amparada interpuso una denuncia ante la Municipalidad recurrida, motivo de la contaminación de aguas fecales y jabonosas que desfogan libremente en su propiedad.

Al respecto, del informe rendido por el órgano municipal, se informó que, mediante el oficio DA-600-2020, la autoridad municipal brindó respuesta a la denuncia interpuesta por la amparada, en donde se le indicó que se iba a realizar una campaña de aplicación de colorante, por consecuencia, las inspecciones se iban a llevar a cabo a partir del 5 de octubre de 2020 con el objetivo de determinar el origen de las aguas que discurren por el canal, siendo ello notificado a esta al correo electrónico ...01 en fecha 29 de octubre de 2020.

En ese sentido, de la prueba aportada, consta que, el medio señalado por la tutelada como medio para recibir notificaciones fue la dirección de correo electrónica ...02; es decir, hubo un claro error material por parte de la Municipalidad de Escazú en notificarle el oficio de cita a la amparada.

Por otro lado, del informe aportado, se indicó que se solicitó un informe al coordinador del Subproceso de Gestión Ambiental el 9 de julio de 2020 se realizó una inspección al sitio denunciado, en la que se le señaló a la tutelada que la propiedad que colinda con la suya tenía derecho de condenar las salidas de aguas a su predio, a lo que la recurrente requirió un trámite de consulta de afectación de nacientes, el cual fue resuelto mediante el oficio GA-CA-5492020. Posteriormente, el 25 de septiembre 2020, se remitió el oficio GA-CA604 2020 a la amparada, en el que se le señaló se realizaría una investigación para determinar la procedencia de las aguas que discurren por el predio. Dicha investigación daría inicio en los predios que se observan directamente aguas arriba de la salida de agua; así, el 7 de octubre 2020 se realizó dicha inspección a dos propiedades para aplicación de la prueba de fluoresceína.

En virtud del resultado de dicha prueba, el órgano municipal notificó a los vecinos de la zona, con la finalidad de que los mismos presentaran una propuesta para remediar el problema con la construcción de un sistema adecuado, a fin de tratar las aguas pluviales, siendo que, en los casos en los que no permitió el ingreso del personal municipal se trasladaron al Ministerio de Salud para su respectiva atención.

En ese sentido, si bien consta que las autoridades accionadas realizaron ciertas acciones tendientes a fin de atender la denuncia interpuesta por la amparada, lo cierto es que la problemática continúa.

VI.Sobre el Área de Salud de Escazú. Sobre el particular, consta que en fecha 2 de julio de 2020, la tutelada presentó un formulario de denuncia en contra de la Municipalidad de Escazú, en virtud de la contaminación de su propiedad, en virtud de las aguas residuales y sólidos que se desbordan de las alcantarillas, denuncia que fue reiterada en fechas 3 de setiembre y 22 de octubre, ambos de 2020.

Al respecto, las autoridades del Ministerio de Salud informaron que se programó una visita de inspección para el15 de setiembre de 2020, a fin de Lo anterior, fue informado a la recurrente mediante el oficio MS-DRRSCS-DARSE-1223-2020, así como que: “(…) El Ministerio de Salud no puede sellar alcantarillas ni dar autorización a terceros para que así lo hagan. Lo que realiza (…) es ordenar a los propietarios o representantes legales de los inmuebles, poseer un adecuado sistema de eliminación de aguas residuales cuando haya sido comprobado (…) que no lo posea. (…) las edificaciones que tengan un resultado positivo reas la prueba de colocación a base de fluoresceína sódica deberán cumplir con un adecuado sistema de eliminación de aguas residuales (…) no es deber de esta instancia indicar a los propietarios (…) qué sistema de tratamiento de aguas residuales deben utilizar (…) el Ministerio de Salud no cuenta con ningún lineamiento que indique que las aguas residuales son medio de transmisión de Covid-19 (…)”.

Así, consta que el 15 de setiembre del 2020, la autoridad accionada, según el acta de inspección MSDRRSCS-DARSE~AIO~AFS-198-2020, realizó la visita al sitio denunciado, siendo que, al momento de realizar ésta se encontró que el acceso a la propiedad afectada se encontraba cerrado, por lo que se realizó recorrido por el barrio colindante para determinar situaciones referentes al caso, lo cual le fue informado a la recurrente vía correo electrónico el 17 de setiembre de 2020.

Debido a lo anterior, el 22 de setiembre del 2020, se realizó una segunda visita al sitio donde se realizó prueba de coloración a base de fluoresceína sódica en las piezas sanitarias de la vivienda, producto de la cual se giraron múltiples órdenes sanitarias, las cuales fueron debidamente notificadas, lo cual también le fue comunicado a la tutelada. Asimismo, del informe rendido consta que los vecinos de la zona cumplieron con las órdenes sanitarias emitidas, siendo que se presentó un plan de acciones correctivas para solventar la inadecuada disposición de aguas residuales, el cual fue revisado y aprobado por el Área de Salud de Escazú, verificándose, posteriormente, su cumplimiento.

Por otro lado, se tuvo por demostrado que el 23 de febrero de 2021, la autoridad recurrida realizó una nueva visita de inspección a los inmuebles ubicados en la entrada al Dirección02, contiguo a la propiedad de la denunciante, en la que se aplicó nueva prueba de coloración en las piezas sanitarias, obteniéndose un resultado positivo por lo que se emitió la orden sanitaria N°MS~DRRSCS-DARSEOS›O4122021. De la misma forma, en fechas 16 y 23 de marzo de 2021, la autoridad recurrida realizó dos visitas a la zona, en las que se realizó un aprueba de coloración, la cual obtuvo un resultado negativo.

Ahora bien, este Tribunal tuvo por demostrado que las autoridades de salud atendieron la denuncia interpuesta por la tutelada, tomando ante ello las medidas necesarias a fin de inspeccionar la zona y emitir las ordenes sanitarias pertinentes, a efectos de solventar la problemática denunciada, todo lo cual le fue comunicado a la amparada. A pesar de lo anterior, no se tuvo por demostrado que las autoridades recurridas hayan informado a la recurrente sobre las órdenes sanitarias emitidas por parte de los propietarios del inmueble N°148546 de así como sobre el resultado y acciones tomadas en virtud de las visitas realizadas en fechas 23 de febrero, 16 y 23 de marzo, todos de 2021.

A pesar de lo anterior, si bien consta que las autoridades hayan realizado acciones pertinentes a fin de solventar la situación descrita por la tutelada en la denuncia interpuesta, lo cierto es que la problemática en la zona persiste.

VII.Sobre el Sistema Nacional de Áreas de Conservación. Al respecto, consta que, en efecto, el 3 de setiembre de 2020, la recurrente interpuso una denuncia en la que denunció la contaminación de su propiedad, en virtud de las aguas residuales y sólidos que se desbordan de las alcantarillas.

Ante ello, las autoridades del SINAC, remitieron la denuncia interpuesta por la tutelada a la encargada del Subproceso de Gestión Ambiental de la Municipalidad de Escazú, con copia al Área Rectora de Salud de Escazú del Ministerio de Salud, al ser estas las autoridades competentes al efecto. Sin embargo, no se tuvo por demostrado que esto le haya sido comunicado a la recurrente.

VIII.Conclusión. En virtud de lo expuesto, al acreditarse la infracción al derecho de justicia pronta y cumplida de la tutelada, así como su derecho a un ambiente sano y ecológicamente equilibrado, lo procedente es acoger el presente recurso, con las indicaciones que se dirán en la parte dispositiva de esta sentencia.

IX. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la recurrente aseguró que, desde julio de 2020, está en espera de que se resuelvan las denuncias que interpuso ante las autoridades recurridas, por la contaminación de aguas fecales y jabonosas que desfogan libremente en su propiedad. Lo anterior, en violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.

X.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 de 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 de 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. Se ordena a Arnoldo Barahona Cortés, en su condición de alcalde de la Municipalidad de Escazú, a William Barrantes Barrantes, en su condición de director del Área Rectora de Salud de Escazú del Ministerio de Salud, y a Aimará Espinoza Ulate, en su condición de jefe de la Oficina Subregional de San José del Sistema Nacional de Áreas de Conservación (SINAC) del Área de Conservación Central, o a quienes en sus lugares ocupen dichos cargos, que lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias y coordinen lo necesario, para que dentro del plazo de SEIS MESES, contado a partir de la notificación de esta sentencia: a) se resuelva en definitiva, conforme a Derecho corresponda, el problema de la contaminación en la propiedad de la recurrente; b) le sea notificado a la amparada todas las acciones realizadas en virtud de la denuncia interpuesta.

Lo anterior, bajo el apercibimiento de que, con base en lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a las autoridades recurridas al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
