Action of unconstitutionality (acción de inconstitucionalidad) filed by Nombre01, of legal age, in a domestic partnership (unión libre), identity card no. CED01, customs management and port logistics adviser, resident of Limón, against official letters SJD-126-2014 and SJD-170-2014 issued by the Instituto Costarricense de Turismo and its legal opinion AL-214-2014; clauses 4.1.1-22), 5.2.2, subsections 11) and 12), 8.5.2, and 9.1, and Additional Measure no. 9 of Annex 3 to the Public Works Concession with Public Service Contract for the Design, Financing, Construction, Operation, and Maintenance of the Moín Container Terminal; the execution, on February 13, 2012, by the Administration and the concessionaire APM Terminals, of the consolidated contract incorporating addenda 1 and 2, entitled “Public Works Concession with Public Service Contract for the design, financing, construction, operation, and maintenance of the Moín Container Terminal”; official letter no. UE-TCM-OF-OF-01 13-2013 dated October 24, 2013, issued by the Manager of the TCM Implementing Unit, and official letter no. DMP-DI-2013-0363 dated November 11, 2013, issued by the Acting Director of Infrastructure of the Maritime-Port Division, approving the design submitted by the concessionaire; and official letter no. UE-TCM-OF-0192-2014 dated December 19, 2014, issued by the Board of Directors of the Consejo Nacional de Concesiones, notifying APM Terminals de Moín S.A. of the construction stage corresponding to Phase 2A of the Moín Container Terminal, effective as of January 19, 2015.

He questions why, if JAPDEVA was already carrying out port operations involving the loading and unloading of containers with very high and recognized technical, logistical, and financial capacity, it should be deprived of exercising its powers in order to grant all Caribbean port operations to a foreign private company at a price two or three times higher than that charged by JAPDEVA. He further alleges that the institution fell into crisis when the Terminal de Contenedores de Moín, administered by the Dutch firm APM Terminals, began operations in February 2019. He claims that even the Contraloría General de la República did not approve JAPDEVA’s budget for fiscal year 2021. He also alleges that the institution has been unable to overcome its financial hardship despite the multimillion-dollar transfers it has received during these years to save it from bankruptcy. He asserts that, on 12 de febrero de 2021, it was announced that JAPDEVA was headed toward a shutdown of operations at its ports in Limón.
Its financial situation is increasingly critical. The petitioner refers to the principle of administrative efficiency (principio de eficiencia administrativa) and the principle of equality (principio de igualdad). He states that he is challenging clauses 4.1.1-22), 8.5.2 and 9.1 of the Public Works Concession Agreement with Public Service (Contrato de Concesión de Obra Pública con Servicio Público) for the Design, Financing, Construction, Operation and Maintenance of the Terminal de Contenedores de Moín because, taken together, they are being used to formally satisfy the legality requirement for a set of provisions that, in his view, violate the substantive limits of Constitutional Law (Derecho de la Constitución) with respect to such important principles as legality, equality, private property, reasonableness, antitrust, proportionality, and administrative efficiency. He contends that clauses 4.1.1-22), 8.5.2 and 9.1 of the concession agreement (contrato de concesión) create an odious privilege for APM Terminals, to the detriment of the principles of equality before the law, freedom of trade, freedom of contract, free competition, consumer choice, and nondiscrimination in employment, as well as the principles of reasonableness and proportionality in the management of public resources, a situation that objectively jeopardizes JAPDEVA’s budgetary balance.
In this regard, they also violate the principles of free competition, equality and nondiscrimination in employment, and preference for Costa Rican workers under equal conditions, because the institution and its workers are left unable to perform the work for which they were responsible for sixty years, as the Terminal de Contenedores de Moín became the specialized terminal for container handling, not only for the Complejo Portuario de Limón y Moín but throughout Costa Rica’s Caribbean coast, as well as the only terminal responsible for serving container ships—fully-cellular container ships—used to import and export cargo to and from Costa Rica. He transcribes Articles 33, 46, 50, 68, 74, 176 and 191 of the Constitución Política. He states that, in light of Articles 50 and 74 cited above, the problems facing the Limón community cannot be disregarded. Hence the importance of the protection that the legal system (ordenamiento jurídico) must afford JAPDEVA.
He alleges that the restriction or limitation on JAPDEVA’s exercise of port business activities and the establishment of a monopoly in favor of a foreign private company were imposed through a concession agreement, which directly and manifestly violates the constitutional principle of the statutory reservation (reserva de ley) governing restrictions on fundamental rights and, consequently, infringes freedom of enterprise and trade. With respect to the standards or principles of reasonableness and proportionality, he considers that making the Terminal de Contenedores de Moín the specialized terminal for container handling, not only for the Complejo Portuario de Limón y Moín but throughout Costa Rica’s Caribbean coast, as well as the only terminal responsible for serving container ships—fully-cellular container ships—used to import and export cargo to and from Costa Rica, based solely on the unusual justification that, according to the Plan Nacional de Desarrollo Portuario prepared in 1995 and the Plan Maestro para el Complejo Portuario Limón-Moín, the demand for the efficient and effective provision of a public service in accordance with international standards created a need to increase capacity to meet that demand and likewise improve the country’s competitiveness by providing it with new infrastructure, not only exceeds what is reasonably and proportionately recognized under ordinary legislation for other business operators, but also constitutes an outrageous and excessive abuse that allows royalties to be distributed to foreign private companies and public funds to be squandered, thereby affecting the budgetary balance of JAPDEVA, which was created to promote development strategies in Limón and to provide services as strategic as those relating to the movement of goods through the country’s most important port.
On the basis of the foregoing, he requests that clauses 4.1.1-22), 8.5.2 and 9.1 of the Public Works Concession Agreement with Public Service for the Design, Financing, Construction, Operation and Maintenance of the Terminal de Contenedores de Moín be declared unconstitutional. Separately, he alleges that he expressly challenges official letters (oficios) SJD-126-2014 and SJD-170-2014 and legal opinion (criterio legal) AL-214-2014, as well as clause 5.2.2, subparagraphs
UE-TCM-OF-0192-2014 dated 19 de diciembre de 2014, issued by the Board of Directors of the Consejo Nacional de Concesiones, whereby APM Terminals de Moín S.A. was notified of the construction stage corresponding to Phase 2A of the Terminal de Contenedores de Moín, effective as of 19 de enero de 2015. She argues that this Chamber, in several proceedings, has ruled that it is not a reviewer of the legality of the acts or decisions of the active Administration (Administración activa), nor may it replace the Administration in the exercise of its powers; accordingly, it is not the Chamber’s role to act as an appellate body in this matter and review whether the construction project for the Nueva Terminal de Contenedores de Moín complies with the applicable legal rules, much less to usurp the powers of that Administration by determining in advance whether all applicable statutory and regulatory requirements for authorizing the project have been met, since all these are matters of ordinary legality that must be adjudicated through the ordinary administrative or judicial channels.
Nevertheless, under this Chamber’s case law, it is evident that, pursuant to the general principle of the non-derogability of a rule in an individual case (inderogabilidad singular de la norma para el caso concreto), the constitutional principles of reasonableness and proportionality, and the provisions of Articles 50 and 89 of the Constitución Política, legislative approval to perfect and authorize the administrative contract (contrato administrativo) for the Public Works Concession with Public Service (Concesión de Obra Pública con Servicio Público) for the Design, Financing, Construction, Operation, and Maintenance of the Terminal de Contenedores de Moín generally, and specifically to proceed with the construction works for the Terminal de Contenedores de Moín, should have been obtained beforehand or during the processing of the respective concession contract (contrato de concesión). Failure to do so omitted a substantive requirement from the administrative procedure (procedimiento administrativo), rendering the contract thus approved unconstitutional because of an essential defect in its processing.
In this case, the Administration failed to comply with Article 5 of the Ley sobre la Zona Marítimo Terrestre, Ley nro. 6043 of 2 de marzo de 1977, under which only the Asamblea Legislativa may grant permits or award concessions in areas permanently covered by the sea and adjacent to the coastlines. She alleges that, by omission, the challenged acts violate Articles 6, 9, 11, 50, 89, and 140, subsection 19), as well as the constitutional principles and standards of legality, reasonableness, and proportionality, in relation to Article 5 of the Ley sobre la Zona Marítimo Terrestre. She argues that, in this case, under the Public Works Concession with Public Services (Concesión de Obra Pública con Servicios Públicos) for the Financing, Design, Construction, Operation, and Maintenance of the new Terminal de Contenedores in Puerto Moín, executed on 13 de febrero de 2012 between the Administration and the concessionaire APM Terminals, the port or pier was built on an artificial island that encroached upon the area permanently covered by the sea and adjacent to the coastline, four hundred meters offshore, measuring one thousand five hundred meters long and four hundred twenty meters wide; in the future, it will encompass more than eighty hectares that must be filled in over the existing seabed, in addition to another fifty hectares of seabed where dredging will be carried out.
She states that it could be argued that nothing prevents the Asamblea Legislativa, through the Ley General de Concesión de Obras Públicas con Servicios Públicos, from authorizing the Poder Ejecutivo to grant concessions over public property without requiring specific approval in each individual case, since it is understood to have granted general approval for that purpose. However, where areas permanently covered by the sea and adjacent to the coastlines are concerned, and authorization is sought to carry out permanent or major works at sea, pursuant to Article 5 of the Ley sobre la Zona Marítimo Terrestre, the procurement (contratación) may not be based solely on Article 74 of the Ley de Contratación Administrativa, the Ley General de Concesión de Obras Públicas con Servicios Públicos, or special laws, because the legislature intended to provide heightened protection by referring the matter to the Asamblea Legislativa for the respective grant, since the legislation establishes, exclusively and to the exclusion of all others, that in such cases only the Asamblea Legislativa may grant those permits or award those concessions.
She states that, in conclusion, Articles 6, 9, 11, 50, 89, and 140, subsection 19, of the Constitution, as well as the constitutional principles and standards of legality, reasonableness, and proportionality, have been violated by omission because the aforementioned contract was not submitted to the Asamblea Legislativa for approval, as required by Article 5 of the Ley sobre la Zona Marítimo Terrestre. She requests that this constitutional challenge (acción de inconstitucionalidad) be granted.
Justice Nombre02 drafts the opinion; and,
Considerations:
I.Regarding official letters SJD-126-2014 and SJD-170-2014 of the Instituto Costarricense de Turismo and its legal opinion AL-214-2014, clauses 4.1.1-22), 5.2.2 subsections 11) and 12), 8.5.2, 9.1, and Additional Measure No. 9 of Annex 3 to the Public Works Concession Agreement with Public Service for the Design, Financing, Construction, Operation, and Maintenance of the Terminal de Contenedores de Moín. With respect to the aforementioned administrative acts (actos administrativos) and the aforementioned public works concession agreement with public service, it must be noted that this action reiterates a prior action (expediente nro. 21-003621-0007-CO), filed by the same petitioner, in which this Chamber already ruled, through decision No. 2021-005640 at 9:15 hours on 17 de marzo de 2021—to the extent relevant—that:
“III.- ON THE INADMISSIBILITY OF THIS ACTION AGAINST OFFICIAL LETTERS SJD-126-2014 AND SJD-170-2014 OF THE INSTITUTO COSTARRICENSE DE TURISMO AND ITS LEGAL OPINION AL-214-2014. The petitioner states that he is filing this action of unconstitutionality (acción de inconstitucionalidad) against ‘(…) official letters SJD-126-2014 and SJD-170-2014 of the Instituto Costarricense de Turismo and its legal opinion AL-214-2014 (…)’. Notwithstanding the applicant’s allegations, this action is inadmissible with respect to this subject matter because Article 73 of the Ley de la Jurisdicción Constitucional, in subsections a) and b), provides as follows: ‘Article 73.- An action of unconstitutionality shall lie: a) Against laws and other provisions of general application, including those originating in acts of private parties, that violate, by action or omission, any constitutional rule or principle. b) Against individual acts of public authorities, when they violate, by action or omission, any constitutional rule or principle, if they are not subject to habeas corpus or amparo remedies.
(…)’. Based on the foregoing, the action of unconstitutionality filed against the official letters and legal opinion issued by the Instituto Costarricense de Turismo is inadmissible because it does not meet the requirements established in the aforementioned provision, since it is not directed against provisions of general application alleged to violate constitutional rules and principles. In this case, the challenged official letters and legal opinion are not normative in nature, and the action of unconstitutionality filed for that purpose is therefore inadmissible.
IV.ON THE INADMISSIBILITY OF THIS ACTION AGAINST THE PUBLIC WORKS CONCESSION AGREEMENT WITH PUBLIC SERVICE FOR THE DESIGN, FINANCING, CONSTRUCTION, OPERATION, AND MAINTENANCE OF THE TERMINAL DE CONTENEDORES DE MOÍN. The petitioner also challenges ‘(…) Clauses 4.1.1-22), 5.2.2 subsections 11) and 12), 8.5.2, 9.1, and Additional Measure No. 9 of Annex 3 of the PUBLIC WORKS CONCESSION AGREEMENT WITH PUBLIC SERVICE FOR THE DESIGN, FINANCING, CONSTRUCTION, OPERATION, AND MAINTENANCE OF THE TERMINAL DE CONTENEDORES DE MOÍN’. Notwithstanding the petitioner’s arguments, constitutional jurisdiction (jurisdicción constitucional) is not the appropriate forum for reviewing the content of the challenged concession agreement; therefore, with respect to this aspect, the action is inadmissible by reason of its subject matter. This is because Article 10 of the Constitución Política assigns this Chamber the task of ‘(…) declaring, by an absolute majority of its members, the unconstitutionality of rules of any kind and of acts subject to Public Law’.
Likewise, as stated in the preceding consideration, Article 73 of the Ley de la Jurisdicción Constitucional specifies that ‘An action of unconstitutionality shall lie: a) Against laws and other provisions of general application, including those originating in acts of private parties, that violate, by action or omission, any constitutional rule or principle. (…)’. Under those provisions, an action against a contract may not be brought before this Chamber, even if it is a concession agreement. With respect to the aforementioned subsection a), when it refers to the possibility of challenging ‘other provisions of general application, including those originating in acts of private parties,’ it should be clarified that this refers to provisions having normative scope (for example, regulations or bylaws), rather than contractual provisions, as that is the proper meaning of the phrase ‘rules of any kind’ used in constitutional Article 10. (In this regard, see decisions No. 2005-13070 at 16:02 hours on 22 de setiembre del 2005 and No. 2009-000310 at 15:18 hours on 14 de enero de 2009).”
Accordingly, the action was ultimately summarily dismissed with respect to those claims. This was based on the conclusion that, in this case, the challenged conduct could not be contested through an action of unconstitutionality, pursuant to Article 73, subsections a) and b), of the Ley de la Jurisdicción Constitucional. Therefore, the petitioner must abide by what was decided on that occasion, as there is no reason justifying a change in that criterion.
II.Regarding the execution, on 13 de febrero de 2012, by the Administration and the concessionaire APM Terminals, of the consolidated agreement incorporating addenda 1 and 2, entitled “Public Works Concession Agreement with Public Service for the Design, Financing, Construction, Operation, and Maintenance of the Terminal de Contenedores de Moín”; official letter No. UE-TCM-OF-OF-01 13-2013 dated 24 de octubre de 2013 from the Manager of the Unidad Ejecutora TCM and official letter No. DMP-DI-2013-0363 dated 11 de noviembre de 2013 from the Acting Director of Infrastructure of the División Marítimo Portuaria, approving the design submitted by the concessionaire; and official letter No. UE-TCM-OF-0192-2014 dated 19 de diciembre de 2014 from the Junta Directiva del Consejo Nacional de Concesiones, notifying APM Terminals de Moín S.A. of the construction stage corresponding to Phase 2A of the Terminal de Contenedores de Moín, effective as of 19 de enero de 2015.
This second action seeks to expand the subject matter of the challenge concerning the aforementioned public works concession agreement with public service and other administrative acts related to the performance of that agreement. In such a case, the holding set forth in the aforementioned decision No. 2021-005640 is fully applicable, namely that, in the case at bar (sub lite), the circumstances provided for in Article 73, subsections a) and b), of the Ley de la Jurisdicción Constitucional are not present.
III.In connection with what was stated in the two preceding considerations, it should be emphasized that, in the matter before the Court (sub judice), the petitioner raises various objections concerning the admissibility, advisability, and validity of the aforementioned public works concession agreement with public service, as well as a series of administrative acts associated with the performance of that agreement. This Chamber has already ruled on such objections on multiple occasions, holding that they concern matters that may not properly be resolved within this constitutional jurisdiction.
Thus, the petitioner first challenges the content of the aforementioned agreement and, in particular, the concession granted to APM Terminals, asserting that the aforementioned company was exclusively granted a public works concession with public service for the purpose of developing and operating the new Terminal de Contenedores de Moín, which, in his view, violates various constitutional provisions and principles, principally Article 46 of the Constitution. He particularly challenges the granting of that concession, claiming that JAPDEVA was already providing the respective container loading and unloading services more efficiently. He also claims that Costa Ricans are being harmed by the high prices and delays in the provision of port services by the aforementioned company APM Terminals. Finally, he alleges that this situation has plunged JAPDEVA into a severe financial crisis. It should be noted that, with respect to the objections raised by the petitioner, in judgment No. 2013-16146 at 9:05 hours on 6 de diciembre de 2013, this Chamber held—to the extent relevant—that:
“I.- Subject matter of the proceeding. The appellant seeks protection of the constitutional principle of freedom of enterprise and fair competition, as well as the principle of equality, the right to work, and the right to a decent wage, alleging that the Executive Branch exclusively granted a public works concession with public service to APM Terminals Central America B.V. and APM Terminals Moín S.A. for the design, financing, construction, operation, and maintenance of the new Terminal de Contenedores de Moín, thereby eliminating JAPDEVA’s authority to provide the most important service within Limón’s port operations, namely servicing container ships, with the resulting reduction in revenue and elimination of jobs, and hindering free competition between JAPDEVA and private companies.
II.On the merits. After examining the record, the Chamber finds that the amparo appeal (recurso de amparo) must be denied for the reasons stated below. First, if the appellant has any disagreement with clause No. 9 of the public works concession agreement with public service awarded to APM Terminals Central America B.V. and APM Terminals Moín S.A., or considers the content of that contractual clause to be arbitrary, unlawful, or abusive, he must raise that claim through the appropriate ordinary legal proceedings, because the Chamber lacks jurisdiction to resolve disputes of this nature. As this Court has held on previous occasions, ‘(…) the applicant must bear in mind that disputes concerning the proper interpretation of the clauses of the agreements at issue, their scope, the obligations they impose on the parties, and the provisions of the rules governing the subject matter are matters for those proceedings, not this jurisdiction, because they concern an issue of ordinary legality that falls outside the Chamber’s jurisdiction’ (see judgment 2009-015459 at 18:10 hours on 29 de setiembre de 2009).
Second, it may be inferred from the appellant’s statements that the contractual clause he challenges refers to the alleged exclusivity that APM Terminals Central America B.V. and APM Terminals Moín S.A. would have with respect to servicing container ships. Specifically, he claims that clause number 9 of the concession agreement (contrato de concesión) in question, in fact, grants a private company the exclusive right to provide the service formerly provided by the public entity JAPDEVA. In this regard, it must be clarified to the protected party (amparado) that the decision whether or not to grant that company exclusivity in providing that specific type of service (containers) does not, in itself, constitute a constitutionally significant violation. As the appellant himself indicates, what is being eliminated is the legal authority to provide a service, as a result of a policy decision by the Administration.
This type of measure falls within the natural discretion available to the Administration in carrying out administrative management, which is inherent in its sphere of authority, in accordance with its governmental priorities. Thus, constitutional review would apply only if, in exercising such powers, a fundamental right were clearly and manifestly violated, which has not occurred in this case. The mere disagreement of the claimant with that measure concerns a purely political issue rather than a legal-constitutional one, which is why this Court is required to exercise judicial restraint.
Furthermore, the statements given under oath by the respondents show that on 16 de julio de 2011, the JAPDEVA Workers’ Union filed administrative-litigation proceedings (proceso contencioso administrativo) concerning the matter disputed here. Those proceedings were decided at first instance by the Administrative Litigation Court through resolution number 0153-2012-VI, which dismissed its claim in all respects. The respondents state that, subsequently, on 28 de marzo de 2012, the Union filed another administrative-litigation proceeding, which is currently being processed under expediente número 12-001630-1027-CA and concerns all events that occurred after the agreement was endorsed. According to the information provided by the defendants, that proceeding remains pending. Accordingly, there is even greater reason to dismiss the amparo action (amparo), given that the facts related to the public-works concession agreement with public service obligations for the design, financing, construction, operation, and maintenance of the Moín Container Terminal (awarded to the private companies APM Terminals Central America B.V. and APM Terminals Moín S.A.) are being examined in the competent ordinary proceedings” (the underlining does not appear in the original).
This criterion was reiterated in judgments nro. 2014-18103 de las 11:33 horas del 31 de octubre de 2014 and nro. 2015-001659 de las 9:05 horas del 6 de febrero de 2015. More recently, in judgment nro. 2019-001409 de las 09:05 horas del 25 de enero de 2019, when considering a similar claim, the Chamber ruled as follows:
“... the appellant files an amparo action against the signatories of the ‘Public-Works Concession Agreement with Public Service Obligations for the Design, Financing, Construction, Operation, and Maintenance of the Moín Container Terminal’ and states that the Port Authority (JAPDEVA) provides port services to container ships for handling the loading and unloading of containers. He states that on 13 de febrero de 2012, the Granting Administration entered into an agreement with the concessionaire APM Terminal for operating the loading and unloading of container ships, an action that departs from the constitutional legal framework. He considers that the agreement contains limitations and restrictions that adversely affect users (shipping and stevedoring companies), because it will no longer be possible to request services for container ships from the Limón and Moín administrative offices. He therefore requests that the relevant clause (chapter 4, subsection 22) be annulled and that the action be granted with the consequences prescribed by law.
(...)
With respect to the arguments and relief sought as set forth in the first Findings of Fact (Resultando), it must be noted that this Chamber is not responsible for reviewing the legality of the Administration’s actions or decisions. It therefore has no jurisdiction to determine whether the relief sought by the protected party is proper or whether it complies with the legal provisions currently in force, as that task belongs to ordinary administrative or judicial proceedings. Whether or not the challenged clause is proper is not a matter to be discussed in this Jurisdiction, since it is not capable of violating any fundamental right and therefore falls outside its sphere of jurisdiction; it must instead be resolved through ordinary administrative or judicial proceedings. Accordingly, any claim or disagreement concerning the terms of the agreement must be submitted to the respondent authorities or brought before the competent judicial forum, where the merits may be fully litigated, any appropriate interim measures (medidas cautelares) may be requested, and the claimant’s claims may ultimately be asserted. By virtue of the foregoing, the amparo action is inadmissible and must be so declared.” For its part, in judgment nro. 2019-016605 de las 9:40 horas del 30 de agosto de 2019, this Court ruled:
“It follows from the arguments presented by the claimant that he seeks to have this Court determine which cargo JAPDEVA must handle in connection with the TCM concession; halt the processing of bill No. 21426; define the causes of JAPDEVA’s financial crisis; determine whether the termination of its employees’ employment relationships is proper; determine whether contractual breaches have occurred at the TCM; and prevent the transfer of funds to JAPDEVA for its liquidation. However, such claims do not concern constitutional matters, but merely questions of ordinary legality.” The claimant additionally alleges a violation of article 5 of the Ley sobre la Zona Marítimo Terrestre, asserting that because this is a project located in the maritime-terrestrial zone (zona marítimo terrestre), it is for the Asamblea Legislativa to grant the concession pursuant to that provision. This argument was considered by this Constitutional Court in an earlier amparo action (processed under expediente nro. 14-08863-0007-CO), in which judgment nro. 2014-10174 de las 9:05 horas de 27 de junio de 2014 was issued. On that occasion, this Chamber rejected that claim in the following terms:
V.Lastly, the appellant maintains that article 5 of the Ley sobre la Zona Marítimo Terrestre provides that “unless otherwise stipulated, only the Asamblea Legislativa may issue permits or grant concessions in areas permanently covered by the sea and adjacent to the coastlines”; however, APM Terminals Moín Sociedad Anónima will construct a pier in the sea extending approximately 1 kilómetro from the coast, without possessing the permits required by that provision. He also alleges that the company intends to exploit natural resources in the adjacent sea to fill in the area and create an artificial island, without possessing the permits required by the Código de Minería. In this regard, the claimant must be reminded that the Sala Constitucional is not responsible for reviewing the legality of the respondent authorities’ actions or decisions, nor may it replace the active Administration in exercising its powers.
It therefore does not serve as an appellate authority in this matter and may not review whether the project for construction of the Nueva Terminal de Contenedores de Moín complies with the legal provisions currently in force, much less usurp the powers of the respondent by assessing in advance whether all applicable statutory and regulatory requirements for authorizing the project have been satisfied, since all these are matters of ordinary legality that must be resolved through ordinary administrative or judicial proceedings. Furthermore, according to SETENA, environmental feasibility (viabilidad ambiental) does not in itself mean that the developer may begin the project; rather, it is a requirement that must be fulfilled before obtaining the other authorizations or permits from other authorities that are necessary to construct, operate, or otherwise carry out the desired activity. Accordingly, compliance with all requirements, studies, concessions, permits, and authorizations necessary under the legal system currently in force to approve commencement of the work must first be verified through proceedings concerning ordinary legality.”
This criterion was reiterated in judgment nro. 2014-20750 de las 11:40 horas del 19 de diciembre de 2014.
Finally, the claimant alleges a violation of Ley nro. 2906 de 24 de noviembre de 1961, which designated as a recreation and tourism zone the strip measuring doscientos metros in width from the ordinary high-tide line, located within the maritime mile between the northern boundary of the urban area of the city of Limón, namely Portete, and the site known as “12 millas o Swarm Moth,” north of the city of Limón, as well as the area extending cien metros on both sides of Río Moín in the section parallel to the beach. He alleges that APM Terminals was granted a concession in the area described in Ley nro. 2906, which he considers improper. Regarding this point, this Court already ruled, in judgment nro. 2019-025322 de las 10:45 horas del 20 de diciembre de 2019, that:
“I.- SUBJECT MATTER OF THE AMPARO ACTION. The appellant states that through Ley N° 2906 del veinticuatro de noviembre de mil novecientos sesenta y uno, the strip measuring doscientos metros in width from the ordinary high-tide line, located within the maritime mile between the northern boundary of the urban area of the city of Limón, namely Portete, and the site known as ‘12 millas o Swarm Moth,’ north of the city of Limón, as well as the area extending cien metros on both sides of Río Moín in the section parallel to the beach, was designated as a recreation and tourism zone. Notwithstanding the foregoing, the defendants entered into the agreement entitled ‘Public-Works Concession Agreement with Public Service Obligations for the Design, Financing, Construction, Operation, and Maintenance of the Moín Container Terminal’ and granted APM Terminals a concession over the area described in Ley N° 2906, which he considers improper. He requests that this amparo action be granted and that the agreements, decisions, and contracts affecting the areas covered by the cited Ley N° 2906 be annulled.
Regarding the filing submitted by Nombre03, whereby he joins this amparo proceeding (recurso de amparo), it should be noted that, pursuant to article 34, third paragraph, of the Law on Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional), active third-party intervention (coadyuvancia activa) refers to a person who, although not currently suffering harm caused by the Administration, may potentially benefit indirectly from the decision in a particular amparo proceeding and therefore appears in that proceeding to assist or support the petitioner in the case. Accordingly, in this matter the applicant does not qualify as an intervenor (coadyuvante), but rather as a co-petitioner (co-recurrente), because he considers that the “Public Works Concession Contract with Public Service for the design, financing, construction, operation, and maintenance of the Moín Container Terminal” is contrary to the spirit of Law N° 2906. Consequently, applicant Nombre04 is recognized as a co-petitioner, and his claim is joined to the present proceeding.
Regarding the possibility of granting port concessions (concesiones), the Chamber has previously considered and upheld the application of the General Law on Public Works Concessions (Ley General de Concesiones de Obras Públicas) to such situations. Specifically, with respect to the port of Moín, this Court stated the following in Judgment N° 2015-009384 at 9:05 hours on 25 de junio de 2015:
“…V.- Lastly, the petitioner argues that article 5 of the Law on the Maritime-Terrestrial Zone (Ley sobre la Zona Marítimo Terrestre) provides that ‘unless otherwise stipulated, only the Legislative Assembly may grant permits or award concessions in areas permanently covered by the sea adjacent to the coasts’; nevertheless, APM Terminals Moín Sociedad Anónima will build a dock in the sea extending approximately 1 kilometer from the coast, without holding the permits required under that provision. He also alleges that the company intends to exploit natural resources in the adjacent sea to create fill and construct an artificial island, without holding the permits required by the Mining Code (Código de Minería). In this regard, the applicant must be reminded that the Sala Constitucional does not oversee the legality of the actions or decisions of the respondent authorities, nor may it replace the active Administration (Administración activa) in exercising its powers.
Accordingly, it is not for this Chamber to act as an appellate body in this matter and review whether the construction project for the New Moín Container Terminal complies with the legislation currently in force, much less to usurp the powers of the respondent by determining in advance whether all applicable statutory and regulatory requirements for authorizing the project have been met, since all of these are matters of ordinary legality (legalidad ordinaria) that must be resolved through the ordinary administrative or judicial channels…”.
Because this precedent applies to the case under consideration, if the protected party remains dissatisfied, it may, if it sees fit, resort to the appropriate administrative or judicial legal channel to submit whatever applications it considers relevant so that the proper determination may be made under the law. Consequently, the proceeding is inadmissible, and it is so declared.” Therefore, although the applicant alleges that, in his view, the matter involves individual acts (actos subjetivos) that could be reviewed through an action of unconstitutionality (acción de inconstitucionalidad), pursuant to article 73(b) of the Law on Constitutional Jurisdiction, the fact remains that the subject matter of this action concerns a dispute of ordinary legality outside the scope of this Chamber’s jurisdiction, as this Court has consistently held. In accordance with this Court’s settled precedents, the applicant’s various objections must be raised through the ordinary channels.
As a corollary to the foregoing, with respect to official communications SJD-126-2014 and SJD-170-2014 of the Instituto Costarricense de Turismo and its legal opinion AL-214-2014, clauses 4.1.1-22), 5.2.2, subparagraphs 11) and 12), 8.5.2, 9.1, and Additional Measure no. 9 of Anexo 3 to the Public Works Concession Contract with Public Service for the Design, Financing, Construction, Operation, and Maintenance of the Moín Container Terminal, the applicant shall abide by the determination already made in judgment 2021-005640. As to all other matters, the action under consideration must be summarily dismissed, as hereby ordered.
The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve them from the court office within a maximum period of 30 business days counted from service of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the “Regulations on Electronic Case Files before the Poder Judicial” (“Reglamento sobre Expediente Electrónico ante el Poder Judicial”), approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, article LXXXI.
Por tanto:
With respect to official communications SJD-126-2014 and SJD-170-2014 of the Instituto Costarricense de Turismo and its legal opinion AL-214-2014, clauses 4.1.1-22), 5.2.2, subparagraphs 11) and 12), 8.5.2, 9.1, and Additional Measure no. 9 of Anexo 3 to the Public Works Concession Contract with Public Service for the Design, Financing, Construction, Operation, and Maintenance of the Moín Container Terminal, the applicant shall abide by the determination made in vote no. 2021-005640 at 9:15 hours on 17 de marzo de 2021. As to all other matters, the action is summarily dismissed.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas cinco minutos del nueve de junio de dos mil veintiuno .
Acción de inconstitucionalidad promovida por Nombre01, mayor, en unión libre, cédula de identidad nro. CED01, asesor en gestoría aduanera y logística portuaria, vecino de Limón, contra los oficios SJD-126-2014 y SJD-170-2014 del Instituto Costarricense de Turismo y su criterio legal AL-214-2014, las cláusulas 4.1.1-22), 5.2.2 incisos 11) y 12), 8.5.2, 9.1 y la Medida Adicional nro. 9 del Anexo 3 del Contrato de Concesión de Obra Pública con Servicio Público para el Diseño, Financiamiento, Construcción, Operación y Mantenimiento de la Terminal de Contenedores de Moín, la suscripción del contrato consolidado con las adendas 1 y 2, denominado “Contrato de Concesión de Obra Pública con Servicio Público para el diseño, financiamiento, construcción, explotación y mantenimiento de la Terminal de Contenedores de Moín”, realizada el 13 de febrero de 2012, por la Administración y la empresa concesionaria APM Terminals, los oficios nro. UE-TCM-OF-OF-01 13-2013 del 24 de octubre de 2013 del Gerente de la Unidad Ejecutora TCM y nro. DMP-DI-2013-0363 del 11 de noviembre de 2013 del Director a. i. de Infraestructura de la División Marítimo Portuaria, en que se aprobó el diseño presentado por la concesionaria, y el oficio nro. UE-TCM-OF-0192-2014 del 19 de diciembre de 2014 de la Junta Directiva del Consejo Nacional de Concesiones, en que se notificó a la empresa APM Terminals de Moín S.A. sobre la etapa de construcción correspondiente a la Fase 2A de la Terminal de Contenedores de Moín, con rige a partir del 19 de enero de 2015.
Resultando:
Redacta el Magistrado Nombre02; y,
Considerando:
I.Respecto de los oficios SJD-126-2014 y SJD-170-2014 del Instituto Costarricense de Turismo y su criterio legal AL-214-2014, las cláusulas 4.1.1-22), 5.2.2 incisos 11) y 12), 8.5.2, 9.1 y la Medida Adicional nro. 9 del Anexo 3 del Contrato de Concesión de Obra Pública con Servicio Público para el Diseño, Financiamiento, Construcción, Operación y Mantenimiento de la Terminal de Contenedores de Moín. En lo referente a los citados actos administrativos y el mencionado contrato de concesión de obra pública con servicios público, debe indicarse que esta acción es una reiteración de una anterior (expediente nro. 21-003621-0007-CO), interpuesta por el mismo accionante, en que esta Sala ya resolvió, mediante voto nro. 2021-005640 de las 9:15 horas del 17 de marzo de 2021 -en lo que interesa-, que:
“III.- SOBRE LA INADMISIBILIDAD DE ESTA ACCIÓN CONTRA LOS OFICIOS SJD-126-2014 Y SJD-170-2014 DEL INSTITUTO COSTARRICENSE DE TURISMO Y SU CRITERIO LEGAL AL-214-2014. El accionante dice interponer esta acción de inconstitucionalidad contra “(…) los oficios SJD-126-2014 y SJD-170-2014 del Instituto Costarricense de Turismo y su criterio legal AL-214-2014 (…)”. Pese a las alegaciones de la parte gestionante, esta acción es improcedente en cuanto a este objeto, dado que el artículo 73 de la Ley de la Jurisdicción Constitucional en sus incisos a) y b), dispone lo siguiente:“Artículo 73.- Cabrá la acción de inconstitucionalidad: a) Contra las leyes y otras disposiciones generales, incluso las originadas en actos de sujetos privados, que infrinjan, por acción u omisión, alguna norma o principio constitucional. b) Contra los actos subjetivos de las autoridades públicas, cuando infrinjan, por acción u omisión, alguna norma o principio constitucional, si no fueren susceptibles de los recursos de hábeas corpus o de amparo.(…)”.
Con base en lo anterior, la acción de inconstitucionalidad planteada contra los oficios y criterio legal emitidos por el Instituto Costarricense de Turismo resulta inadmisible por no cumplir con los presupuestos previstos en la norma precitada, pues no está dirigida contra disposiciones de carácter general que se estime infringen normas y principios constitucionales. En este caso, los oficios y criterio legal impugnados no tienen carácter normativo, resultando improcedente con tal propósito la acción de inconstitucionalidad planteada.
IV.SOBRE LA INADMISIBILIDAD DE ESTA ACCIÓN CONTRA EL CONTRATO DE CONCESIÓN DE OBRA PÚBLICA CON SERVICIO PÚBLICO PARA EL DISEÑO, FINANCIAMIENTO, CONSTRUCCIÓN, OPERACIÓN Y MANTENIMIENTO DE LA TERMINAL DE CONTENEDORES DE MOÍN. La parte accionante impugna también “(…) las Cláusulas 4.1.1-22), 5.2.2 incisos 11) y 12), 8.5.2, 9.1 y la Medida Adicional N° 9 del Anexo 3° del CONTRATO DE CONCESIÓN DE OBRA PÚBLICA CON SERVICIO PÚBLICO PARA EL DISEÑO, FINANCIAMIENTO, CONSTRUCCIÓN, OPERACIÓN Y MANTENIMIENTO DE LA TERMINAL DE CONTENEDORES DE MOÍN”. Pese a sus argumentos, la jurisdicción constitucional no es la vía apropiada para revisar el contenido del contrato de concesión impugnado, por lo que en cuanto a este aspecto la acción es improcedente en razón de su objeto. Esto, toda vez que, el artículo 10 de la Constitución Política asigna a esta Sala la tarea de “(…) declarar, por mayoría absoluta de sus miembros, la inconstitucionalidad de las normas de cualquier naturaleza y de los actos sujetos al Derecho Público”.
Asimismo, tal como se indicó en el considerando anterior, el artículo 73 de la Ley de la Jurisdicción Constitucional precisa que “Cabrá la acción de inconstitucionalidad: a) Contra las leyes y otras disposiciones generales, incluso las originadas en actos de sujetos privados, que infrinjan, por acción u omisión, alguna norma o principio constitucional. (…)”. De conformidad con esas disposiciones, no cabe plantear una acción ante esta Sala contra un contrato, no obstante se trate de un contrato de concesión. En el caso del inciso a) precitado, al referirse a la posibilidad de combatir “otras disposiciones generales, incluso las originadas en actos de sujetos privados”, cabe aclarar que se refiere a disposiciones de alcance normativo (por ejemplo, un reglamento o un estatuto) y no contractual, ya que es eso lo que rectamente se sigue a partir de la frase “normas de cualquier naturaleza” que utiliza el ordinal 10 constitucional. (En este sentido, véanse los votos n°2005-13070 de las 16:02 horas del 22 de setiembre del 2005 y n°2009-000310 de las 15:18 horas del 14 de enero de 2009).”
Por lo que, finalmente, se rechazó de plano la acción en cuanto a tales extremos. Lo anterior, al concluirse que, en la especie, las conductas cuestionadas no eran impugnables mediante acción de inconstitucionalidad, conforme a lo previsto en el artículo 73, incisos a) y b), de la Ley de la Jurisdicción Constitucional. Ergo, el accionante deberá estarse a lo ya resuelto en tal oportunidad, al no existir motivo que justifique variar de criterio.
II.En cuanto a la suscripción del contrato consolidado con las adendas 1 y 2, denominado “Contrato de Concesión de Obra Pública con Servicio Público para el diseño, financiamiento, construcción, explotación y mantenimiento de la Terminal de Contenedores de Moín”, realizada el 13 de febrero de 2012, por la Administración y la empresa concesionaria APM Terminals, los oficios nro. UE-TCM-OF-OF-01 13-2013 del 24 de octubre de 2013 del Gerente de la Unidad Ejecutora TCM y nro. DMP-DI-2013-0363 del 11 de noviembre de 2013 del Director a. i. de Infraestructura de la División Marítimo Portuaria, en que se aprobó el diseño presentado por la concesionaria, y el oficio nro. UE-TCM-OF-0192-2014 del 19 de diciembre de 2014 de la Junta Directiva del Consejo Nacional de Concesiones, en que se notificó a la empresa APM Terminals de Moín S.A. sobre la etapa de construcción correspondiente a la Fase 2A de la Terminal de Contenedores de Moín, con rige a partir del 19 de enero de 2015.
En esta segunda acción, se pretende ampliar el objeto de impugnación en lo referente al citado contrato de concesión de obra pública con servicio público y otros actos administrativos relacionados con la ejecución de tal contrato. En cuyo caso, resulta plenamente aplicable lo ya indicado en el citado voto nro. 2021-005640, en sentido que en el sub lite no se configuran los supuestos previstos en el artículo 73, incisos a) y b), de la Ley de la Jurisdicción Constitucional.
III.En relación con lo ya indicado en los dos considerandos anteriores, debe destacarse que, en el sub judice, el accionante formula diversos reproches relativos a la procedencia, conveniencia y validez del citado contrato de concesión de obra pública con servicio público, así como de una serie actos administrativos vinculados con la ejecución de dicho contrato. Reproches respecto de los que ya se ha pronunciado esta Sala, en múltiples ocasiones, en el sentido que corresponden a temas que no procede dilucidar en esta jurisdicción de constitucionalidad.
Así, el accionante cuestiona en primer lugar el contenido del citado contrato y, en particular, la concesión otorgada la empresa APM Terminals, en tanto reclama que se otorgara de manera exclusiva a la referida empresa una concesión de obra pública con servicio público con el fin de desarrollar y explotar la nueva Terminal de Contenedores de Moín, lo que a su parecer violenta lo establecido en diversas normas y principios constitucionales, principalmente, el artículo 46 constitucional. Cuestiona, particularmente, que se otorgara tal concesión en tanto afirma que JAPDEVA ya prestaba los respectivos servicios de la carga y descarga de contenedores de forma más eficiente. También reclama que los costarricenses se están viendo afectados por los altos precios y atrasos en la prestación de servicios portuarios por la mencionada empresa APM Terminals. Finalmente, alega que esta situación ha sumido a JAPDEVA en una grave crisis financiera. Debe señalarse que, respecto a los reproches expuestos por el accionante, en la sentencia No. 2013-16146 de las 9:05 horas del 6 de diciembre de 2013, esta Sala -en lo que interesa- estimó:
“I.- Objeto del recurso. El recurrente acude en resguardo del principio constitucional de libre empresa y competencia leal, así como el principio de igualdad, derecho al trabajo y salario digno, pues acusa que el Poder Ejecutivo otorgó -de manera exclusiva- una concesión de obra pública con servicio público a la empresa APM Terminals Central America B.V. y APM Terminals Moín S.A. para el diseño, financiamiento, construcción, explotación y mantenimiento de la nueva Terminal de Contenedores de Moín, suprimiendo con ello las facultades de JAPDEVA para brindar el servicio más importante en la actividad portuaria de Limón, como lo es la atención de barcos contenedores, con la consecuente disminución en los ingresos percibidos así como la eliminación de fuentes de empleo, obstaculizando la libre competencia entre JAPDEVA y las empresas privadas.
II.Sobre el fondo. Luego de examinados los autos, la Sala estima que se debe declarar sin lugar el recurso de amparo, por las razones que se dirán. En primer término, si el recurrente mantiene algún tipo de disconformidad con la cláusula número 9 del contrato de concesión de obra pública con servicio público adjudicado a la empresa APM Terminals Central America B.V. y APM Terminals Moín S.A., o bien, considera que el contenido de dicha cláusula contractual resulta arbitrario, ilegal o abusivo, deberá alegarlo en la vía de legalidad correspondiente, por carecer la Sala de las competencias para dirimir este tipo de conflictos. Como lo ha sostenido este Tribunal en anteriores ocasiones, “(…) debe tomar en cuenta la petente, que los conflictos atinentes a la correcta interpretación de las cláusulas de los contratos en cuestión, de sus alcances y de las obligaciones que de ellas se derivan para las partes, así como lo dispuesto por la normativa que rige la materia, es labor propia de tales vías, y no de esta jurisdicción, pues se trata de un problema de legalidad ordinaria cuyo conocimiento es ajeno al ámbito de competencia de la Sala”(ver sentencia 2009-015459 de las 18:10 horas del 29 de setiembre de 2009).
En segundo lugar, de las manifestaciones del recurrente se extrae que la cláusula contractual que impugna hace referencia a la alegada exclusividad que tendría la empresa APM Terminals Central America B.V. y APM Terminals Moín S.A., en cuanto a la atención de barcos contenedores se refiere. En concreto reclama que la cláusula número 9 del contrato de concesión en mención, en realidad lo que hace es brindar exclusividad a una empresa privada para que preste el servicio que daba la empresa pública JAPDEVA. Al respecto, es preciso aclararle al amparado que la decisión de haberle entregado o no la exclusividad a dicha empresa para la prestación de ese tipo de servicio en concreto (contenedores), no constituye por sí misma una lesión de relevancia constitucional. Como indica el propio recurrente, lo que se está suprimiendo es la facultad legal de brindar un servicio, esto debido a una decisión de oportunidad por parte de la Administración.
Tal tipo de medida corresponde al espacio natural de que dispone la Administración para ejercer la gestión administrativa, consustancial a su ámbito competencial, de acuerdo con sus prioridades de gobierno. De esta forma, el control de constitucionalidad solo se aplicaría en caso de que en el ejercicio de tales competencias, de manera evidente y manifiesta se vulnerara algún derecho fundamental, cuestión que en la especie no ocurre. La mera disconformidad de la parte accionante con la referida medida atañe más bien a un problema puramente político, antes que a uno jurídico-constitucional, motivo por el que este Tribunal está obligado a aplicar autocontención.
Por otro lado, de las manifestaciones dadas bajo juramento por los recurridos se aprecia que el 16 de julio de 2011, el Sindicato de Trabajadores de JAPDEVA interpuso proceso contencioso administrativo, referido al tema aquí en disputa, el cual fue resuelto en primera instancia por el Tribunal Contencioso Administrativo mediante resolución número 0153-2012-VI, en la que se declaró sin lugar su demanda en todos los extremos. Los recurridos afirman que, posteriormente, el 28 de marzo de 2012, el Sindicato presentó de nuevo otro proceso contencioso administrativo, el cual actualmente se tramita en el expediente número 12-001630-1027-CA y versa sobre todos los hechos que se dieron una vez refrendado el contrato. Según lo informado por los accionados, dicho proceso se encuentra en trámite. Así las cosas, con mucha más razón procede la desestimatoria del amparo, en vista de que los hechos relacionados con el contrato de concesión de obra pública con servicio público para el diseño, financiamiento, construcción, explotación y mantenimiento de la terminal de contenedores de Moín (adjudicado a favor de las empresas privadas APM Terminals Central America B.V. y APM Terminals Moín S.A.), se encuentran siendo examinados en la vía ordinaria competente” (el subrayado no corresponde al original).
Criterio reiterado en los votos nro. 2014-18103 de las 11:33 horas del 31 de octubre de 2014 y nro. 2015-001659 de las 9:05 horas del 6 de febrero de 2015. Mientras que, de forma más reciente, mediante voto nro. 2019-001409 de las 09:05 horas del 25 de enero de 2019, al conocer de un reclamo similar, la Sala resolvió lo siguiente:
“... la parte recurrente interpone recurso de amparo contra los firmantes del “Contrato de Concesión de Obra Pública con Servicio Público para el Diseño, Financiamiento, Construcción, Operación y Mantenimiento de la Terminal de Contenedores de Moín”, y manifiesta que la Autoridad Portuaria (JAPDEVA) presta servicios portuarios a los buques portacontenedores para el manejo de la carga y descarga de contenedores. Refiere que el 13 de febrero de 2012, la Administración Concedente suscribió un contrato con la concesionaria APM Terminal para la operación de la carga y descarga de los barcos portacontenedores, actuación que se aparta del marco jurídico constitucional. Considera que dicho contrato posee limitaciones y restricciones que causan una afectación a los usuarios (navieras y estibadoras), debido a que no se podrá solicitar más la prestación de servicios para barcos portacontenedores ante las intendencias de Limón y Moín, por lo que solicita se anule la cláusula referida (capítulo 4, inciso 22) y se declare con lugar el recurso con las consecuencias de ley.
(...)
En relación con los alegatos y pretensiones expuestas en el Resultando primero, se impone advertir que esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones de la Administración, de modo que no le compete revisar si la pretensión requerida por el amparado es procedente, o si se ajusta o no a la normativa legal vigente, labor propia de la vía común, administrativa o jurisdiccional. La procedencia o no de la cláusula cuestionada no constituye un asunto que deba discutirse en esta Jurisdicción, puesto que no tiene la virtud de vulnerar derecho fundamental alguno, por lo que resulta ajeno al ámbito de su competencia que debe dirimirse en la vía común, administrativa o jurisdiccional. Por lo anterior, cualquier reclamo o discrepancia respecto a los términos del contrato, deberá ser planteado ante las autoridades recurridas o en la vía jurisdiccional competente, sedes en las cuales podrá, en forma amplia discutir el fondo del asunto, solicitar las medidas cautelares del caso y, eventualmente, hacer valer sus pretensiones. En virtud de lo anterior, el amparo resulta inadmisible y así debe declararse”.
Por su parte, en el voto nro. 2019-016605 de las 9:40 horas del 30 de agosto de 2019, este Tribunal resolvió:
“De los argumentos expuestos por el accionante, se desprende que su pretensión es que este Tribunal defina cuál carga debe ser operada por JAPDEVA en relación con la concesión de TCM; que se detenga el trámite del proyecto de Ley No. 21426, que se definan las causas de la crisis financiera de JAPDEVA, se determine si procede o no la terminación de la relación de trabajo de sus empleados, así como si se han producido incumplimientos contractuales en la TCM; e impedir el traslado de fondos hacia JAPDEVA para liquidarla. Sin embargo, tales pretensiones no son materia de constitucionalidad, sino de mera legalidad.” El accionante, adicionalmente, acusa una infracción al artículo 5 de la Ley sobre la Zona Marítimo Terrestre, por cuanto, asevera que al tratarse de un proyecto ubicado en la zona marítima terrestre, corresponde a la Asamblea Legislativa otorgar la concesión en virtud de lo dispuesto en dicho ordinal. Este alegato fue conocido por este Tribunal Constitucional en un recurso de amparo anterior (tramitado en el expediente nro. 14-08863-0007-CO), en el cual se dictó el voto nro. 2014-10174 de las 9:05 horas de 27 de junio de 2014. En esa oportunidad, esta Sala rechazó ese extremo bajo los siguientes términos:
V.Por último, el recurrente sostiene que el artículo 5 de la Ley sobre la Zona Marítimo Terrestre señala que "salvo disposición en contrario, solamente la Asamblea Legislativa podrá conceder permisos u otorgar concesiones en las zonas cubiertas permanentemente por el mar, adyacentes a los litorales"; sin embargo, la empresa APM Terminals Moín Sociedad Anónima construirá un muelle en el mar, saliendo aproximadamente 1 kilómetro de la costa, sin contar con los permisos que dispone dicha norma. Acusa también que la empresa pretende explotar los recursos naturales en el mar adyacente para rellenar y crear una isla artificial, sin tener los permisos que exige el Código de Minería. Al respecto, debe recordársele a la parte accionante que la Sala Constitucional no es un contralor de la legalidad de las actuaciones o resoluciones de las autoridades recurridas, tampoco puede reemplazar a la Administración activa en la gestión de sus competencias, de modo que no le corresponde hacer las veces de alzada en la materia y revisar si el proyecto de la construcción de la Nueva Terminal de Contenedores de Moín se ajusta o no a la normativa legal vigente, y mucho menos usurpar las atribuciones de la parte recurrida, valorando de previo si se han cumplido con todos los requisitos legales y reglamentarios del caso para autorizar el proyecto, pues todos estos son aspectos de legalidad ordinaria que deben dirimirse en la vía común, administrativa o jurisdiccional.
Además, de acuerdo con lo dispuesto por la SETENA, la viabilidad ambiental no implica por sí misma que el desarrollador pueda iniciar el proyecto, sino que es un requisito que debe cumplir y después obtener las demás autorizaciones o permisos ante otras autoridades, para que pueda construir, operar o, en general, desarrollar la actividad deseada. Así las cosas, será en la vía de la legalidad donde se deberá comprobar el cumplimiento previo de todos los requisitos, estudios, concesiones, permisos y autorizaciones necesarias, de conformidad con el ordenamiento jurídico vigente, para aprobar el inicio de la obra”.
Criterio reiterado en el voto nro. 2014-20750 de las 11:40 horas del 19 de diciembre de 2014.
Finalmente, el accionante alega una infracción a la Ley nro. 2906 de 24 de noviembre de 1961, en que se declaró como zona de recreo y turismo, la faja de doscientos metros de ancho, desde la pleamar ordinaria, comprendida dentro de la milla marítima entre el límite norte de la zona urbana de la ciudad de Limón, o sea de Portete, y el sitio conocido como “12 millas o Swarm Moth”, al norte de la ciudad de Limón, así como la zona comprendida dentro de los cien metros de ambos lados del Río Moín en la sección paralela a la playa. Acusa que se otorgó la concesión a la empresa APM Terminals en la zona descrita en la Ley nro. 2906, lo que estima es improcedente. En cuanto a este punto, este Tribunal ya resolvió, en el voto nro. 2019-025322 de las 10:45 horas del 20 de diciembre de 2019, que:
“I.- OBJETO DEL AMPARO. El recurrente señala que por medio de la Ley N° 2906 del veinticuatro de noviembre de mil novecientos sesenta y uno, se declaró como zona de recreo y turismo, la faja de doscientos metros de ancho, desde la pleamar ordinaria, comprendida dentro de la milla marítima entre el límite norte de la zona urbana de la ciudad de Limón, o sea de Portete y el sitio conocido como “12 millas o Swarm Moth”, al norte de la ciudad de Limón, así como la zona comprendida dentro de los cien metros de ambos lados del Río Moín en la sección paralela a la playa. A pesar de lo anterior, los accionados suscribieron el denominado “Contrato de Concesión de Obra Pública con Servicio Público para el diseño, financiamiento, construcción, explotación y mantenimiento de la Terminal de Contenedores de Moín”, y otorgaron en concesión a la empresa APM Terminals la zona descrita en la Ley N° 2906, lo que estima es improcedente. Solicita que se declare con lugar el presente recurso de amparo, y se anulen los acuerdos, resoluciones y contratos que afecten las áreas contempladas en la Ley N° 2906 citada.
En cuanto al escrito presentado por Nombre03, por medio del cual, se adhiere a este recurso de amparo, se debe indicar que de conformidad con el artículo 34, párrafo tercero, de la Ley de la Jurisdicción Constitucional, la figura de la coadyuvancia activa hace referencia a aquella persona que sin estar sufriendo una lesión actual por parte de la Administración, puede eventualmente beneficiarse indirectamente de la resolución de un determinado recurso de amparo, razón por la cual se apersona a dicho proceso para asistir o apoyar a la parte recurrente en el caso. De tal forma, en el presente asunto el gestionante no corresponde a la figura de coadyuvante sino a la de co-recurrente, al estimar que el “Contrato de Concesión de Obra Pública con Servicio Público para el diseño, financiamiento, construcción, explotación y mantenimiento de la Terminal de Contenedores de Moín, es contrario al espíritu de la Ley N° 2906. En consecuencia, el gestionante Nombre04 se tiene como co-recurrente y se acumula su pretensión a la presente.
En torno al tema de la posibilidad de otorgar puertos en concesión, la Sala ya conoció y avaló la aplicación de la Ley General de Concesiones de Obras Públicas para ese tipo de situaciones. Particularmente en cuanto al caso del puerto de Moín, este Tribunal en la Sentencia N° 2015-009384 de las 9:05 horas del 25 de junio de 2015, señaló:
“…V.- Por último, el recurrente sostiene que el artículo 5 de la Ley sobre la Zona Marítimo Terrestre señala que "salvo disposición en contrario, solamente la Asamblea Legislativa podrá conceder permisos u otorgar concesiones en las zonas cubiertas permanentemente por el mar, adyacentes a los litorales"; sin embargo, la empresa APM Terminals Moín Sociedad Anónima construirá un muelle en el mar, saliendo aproximadamente 1 kilómetro de la costa, sin contar con los permisos que dispone dicha norma. Acusa también que la empresa pretende explotar los recursos naturales en el mar adyacente para rellenar y crear una isla artificial, sin tener los permisos que exige el Código de Minería. Al respecto, debe recordársele a la parte accionante que la Sala Constitucional no es un contralor de la legalidad de las actuaciones o resoluciones de las autoridades recurridas, tampoco puede reemplazar a la Administración activa en la gestión de sus competencias, de modo que no le corresponde hacer las veces de alzada en la materia y revisar si el proyecto de la construcción de la Nueva Terminal de Contenedores de Moín se ajusta o no a la normativa legal vigente, y mucho menos usurpar las atribuciones de la parte recurrida, valorando de previo si se han cumplido con todos los requisitos legales y reglamentarios del caso para autorizar el proyecto, pues todos estos son aspectos de legalidad ordinaria que deben dirimirse en la vía común, administrativa o jurisdiccional…”.
Como este precedente es aplicable al caso en estudio, de persistir en su disconformidad, podrá la parte amparada, si a bien lo tiene, acudir ante la vía de legalidad que corresponda, administrativa o jurisdiccional, a fin de plantear allí las gestiones que estime pertinentes para que se resuelva lo que en derecho proceda. En consecuencia, el recurso es inadmisible y así se declara.” Por ende, aunque el accionante alegue que, a su juicio, se está en presencia de actos subjetivos que podrían conocerse mediante una acción de inconstitucionalidad, conforme lo dispuesto en el inciso b) del artículo 73 de la Ley de la Jurisdicción Constitucional, lo cierto es que el objeto de la presente acción hace referencia a un conflicto de legalidad ordinaria ajeno al ámbito de competencia de esta Sala, como así lo ha resuelto de forma consistente este Tribunal. En concordancia con los precedentes reiterados de este Tribunal, los distintos reparos del accionante deberán formularse en las vías ordinarias.
Como corolario de lo anterior, el accionante deberá estarse a lo ya resuelto en sentencia 2021-005640, respecto de los oficios SJD-126-2014 y SJD-170-2014 del Instituto Costarricense de Turismo y su criterio legal AL-214-2014, las cláusulas 4.1.1-22), 5.2.2 incisos 11) y 12), 8.5.2, 9.1 y la Medida Adicional nro. 9 del Anexo 3 del Contrato de Concesión de Obra Pública con Servicio Público para el Diseño, Financiamiento, Construcción, Operación y Mantenimiento de la Terminal de Contenedores de Moín. En lo demás, debe rechazarse la plano la acción en estudio, como así se dispone.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
En cuanto a los oficios SJD-126-2014 y SJD-170-2014 del Instituto Costarricense de Turismo y su criterio legal AL-214-2014, las cláusulas 4.1.1-22), 5.2.2 incisos 11) y 12), 8.5.2, 9.1 y la Medida Adicional nro. 9 del Anexo 3 del Contrato de Concesión de Obra Pública con Servicio Público para el Diseño, Financiamiento, Construcción, Operación y Mantenimiento de la Terminal de Contenedores de Moín, estese el accionante a lo resuelto en el voto nro. 2021-005640 de las 9:15 horas del 17 de marzo de 2021. En lo demás, se rechaza de plano la acción.
