**Text of the resolution** *200078920007CO* Res. Nº 2021012711 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine hours thirty minutes on June four, two thousand twenty-one.
Non-compliance management of the amparo (constitutional protection) appeal processed in expediente number 20-007892-0007-CO, filed by JOHANNY PORRAS RAMOS, identity card 0302230643, against the MUNICIPALITY OF TURRIALBA AND THE MINISTRY OF HEALTH.
**Whereas:** 1.- By means of a brief filed before this Constitutional Jurisdiction on May 17, 2021, the appellant claims that the respondent authority has not complied with what was ordered in the judgment issued in this process.
2.- By means of a court order at 21:12 hrs. on May 19, 2021, a hearing was granted to the respondent authorities so that they could pronounce on the possible non-compliance with what was resolved in judgment 2020-015125 of 09:15 hrs. on August 14, 2020, in which it was ordered: "Giselle Solano Fernández and Mariela Esther Díaz Ríos are ordered, as well as Luis Fernando León Alvarado and Arturo Francisco Rodríguez Morales, respectively, in their capacities as director of the Turrialba Health Governing Body, regional director of the Central East Health Governance, mayor and president of the Council, both of Turrialba, or whoever holds those positions, to arrange and coordinate what is necessary so that the existence of the claimed environmental and construction problems is immediately verified, which must be completed within a period of one month from the notification of this judgment. Once said period has elapsed, they must order, immediately, the initiation of the respective procedures, in order to bring the situation of those constructions into compliance with the law. To that end, they must coordinate all necessary actions so that the Ministry of the Presidency, the Ministry of Public Security, the Ministry of Housing and Human Settlements, the Ministry of National Planning and Economic Policy, the Institute of Agrarian Development, and the Joint Social Assistance Institute are integrated, in the event that the eviction of the informal settlement (precario) Lomas del Río must be carried out." 4.- By a brief filed on May 25, 2021, GISELLE SOLANO FERNÁNDEZ, in her capacity as Director of the Turrialba Health Governing Body, reports under oath and states that: “(...) In response to the indication in Resolution N° 22020-015125 of 09:15 hrs on August 14, 2020, which is transcribed: “Giselle Solano Fernández and Mariela Esther Díaz Ríos are ordered, as well as Luis Fernando León Alvarado and Arturo Francisco Rodríguez Morales, respectively, in their capacities as director of the Turrialba Health Governing Body, regional director of the Central East Health Governance, mayor and president of the Council, both of Turrialba, or whoever holds those positions, to arrange and coordinate what is necessary so that the existence of the claimed environmental and construction problems is immediately verified, which must be completed within a period of one month from the notification of this judgment.
Once said period has elapsed, they must order, immediately, the initiation of the respective procedures, in order to bring the situation of those constructions into compliance with the law. On Thursday, August 20, 2020, Official Letter MS- DRRSCE-DARST-0775-2020 (copy attached) is sent by email to the Municipal Council of Turrialba with a copy to the Sala Constitucional, in which the undersigned requests the Municipal Council of Turrialba for immediate coordination and to visit the site in order to carry out a diagnosis of the environmental situation and the constructions of the reported place. The response from the Municipal Council is awaited, leaving the stipulated period in accordance with Article 32 of the Ley de la Jurisdicción Constitucional.
- On September 11, 2020, a copy of Official Letter N° SM-897-2020 enters the Turrialba Health Governing Body, demonstrating that the Municipal Council of Turrialba analyzes official letter MS-DRRSCE-DARST-0775-2020 and agrees to forward it to Lic. Carlos Calvo Sánchez, Legal Advisor of the Council, to Mayor Master Luis Fernando León Alvarado, to Eng. Gerardo Sequeria Pereira of the Urban Development Department, and to the Municipal Environmental Commission of the Municipality of Turrialba, so that within a period of ten business days they provide a report to the Council on what is appropriate in the case in question.
- On October 7, 2020, official letter MT-DA-LFLA438-2020 (5920) is received through email, in which the Vice Mayor of the Municipality of Turrialba requests a hearing with the undersigned to discuss the cited topic. The undersigned replies on October 9, 2020, through official letter MS-DRRSCE-DARST-0978-2020, summoning her to a meeting at the Casa de la Cultura on Thursday, October 22, 2020.
- On October 6, 2020, Official Letter SM-979-2020 is received through email from the Municipal Council of Turrialba, informing the Directorate of the Turrialba Health Governing Body, Eng. Gerardo Sequeira Pereira of the Urban Development Department, and the Census and Cadastre Department, the latter two of the Municipality of Turrialba, that they approve the report presented by Lic. Carlos Calvo Sánchez, Legal Advisor of the Council, in which he indicates that it is difficult for the Municipal Council to carry out the task of analyzing the environmental or construction problems in the Lomas del Río site, given that they do not have the technical, environmental, or construction knowledge to resolve what was requested. Therefore, the support of the technicians that the Administration has is essential, as this matter has always been handled, which is even already known by the Special Commission.
Likewise, Lic. Carlos Calvo Sánchez, Legal Advisor of the Council, indicates that he recommends the Municipal Council coordinate with the Municipal Mayor's Office, the Ministry of Health, and other related public institutions, analyze and provide a definitive solution to the object of the appeal, and that it is important to know the report of Eng. Gerardo Sequeira Pereira and that of the Census and Cadastre Department so that, once known, a meeting can be convened with all the involved institutions.
- After knowing the report of the Municipal Council, the Directorate of the Turrialba Health Governing Body begins convening the institutions involved in the matter.
- On October 9, 2020, through email, the undersigned sends official letter MS-DRRSCE-DARST-0975-2020 to Captain Manuel Chinchilla Chaves, Chief of the Fuerza Pública of Turrialba, explaining the situation and convening a meeting on Thursday, October 22, 2020, to develop an intervention strategy at the site.
- On October 9, 2020, through email, the undersigned sends official letter MS-DRRSCE-DARST-0976-2020 to Licda. Catherine Aguilar Fonseca, Representative of the Offices of the Joint Social Assistance Institute IMAS in Turrialba, explaining the situation in question and convening her to a meeting on Thursday, October 22, 2020, to develop an intervention strategy in the matter.
- On October 9, 2020, through email, the undersigned sends official letter MS-DRRSCE-DARST-0977-2020 to Mr. Fernando Mata, Chief of the Ministry of Environment and Energy of Costa Rica (MINAE), explaining the problem and convening him to a meeting on Thursday, October 22, 2020, to develop an intervention strategy in the case.
- On October 9, 2020, through email, the undersigned sends official letter MS-DRRSCE-DARST-0979-2020 to Licda. Milagro Rowe Arias, Vice Mayor of the Municipality of Turrialba, requesting approval to use the Casa de la Cultura, in order to hold the meeting scheduled for October 22, 2020, in that space, where the case of Lomas del Río in Barrio San Rafael de Turrialba will be addressed and in which several institutions will participate.
- On October 22, 2020, the scheduled meeting takes place. Representatives from the Turrialba Health Governing Body, the Ministry of Environment and Energy, the Joint Social Assistance Institute (IMAS), and the Municipality of Turrialba participate. The background, actions to be taken, and responsible parties are discussed, and action timelines are established. (Meeting minutes attached).
Likewise, according to the attached minutes, the following is agreed:
- On October 23, 2020, an email is received from Licda. Milagro Rowe Arias, Vice Mayor of the Municipality of Turrialba, in which she informs the institutions involved in the matter that after the meeting of Thursday, October 22, 2020, the following progress is presented:
- On October 27, 2020, the undersigned sends official letter MS-DRRSCE-DARST-1049-2020 to the Sala Constitucional, informing it of the actions taken by this Turrialba Health Governing Body in response to the presented problem.
- On Wednesday, October 28, 2020, a copy of report SINAC-ACC-OT-1473-2020 is received by email, signed by Eng. Sergio Obando Torres of the Prevention, Control and Protection Office based in Turrialba, indicating that, according to the analysis, it is evident that the tenement is located outside the conservation area of the Río Turrialba; however, for the purpose of mapping the site, for relevant purposes, they proceeded at the site to establish the right bank, downstream, of the Río Turrialba to align the protection area. He points out that due to the characteristics of the Río Turrialba, defining the bank is complicated, applying as a criterion what is established in Article 69 of the Ley de Aguas 276, which defines the riverbed as the land covered by its waters during the largest ordinary floods.
Third: The Directorate of the Turrialba Health Governing Body, through official letter MS-DRRSCE-DARST-1127-2020, requests Dr. Heylin Quesada Alvarado, Director of the Turrialba Health Area, to provide updated information on the number of families living in the Lomas del Río place in San Rafael de Turrialba.
Fourth: The report from the Instituto Costarricense de Electricidad and the Turrialba Jiménez Health Area is awaited to define the actions to follow in the cited case.
After sending official letter MS-DRRSCE-DARST-1122-2020 to the Sala Constitucional; the Directorate of the Turrialba Health Governing Body receives information on Friday, November 13, 2020, via email from Dr. Zoila Rojas Guevara, Acting Nursing Chief of the Turrialba Jiménez Health Area, regarding family groups and whether they rent a room and who lives in precarious conditions.
On November 17, 2020, official letter 1500-190-2020 is received, signed by Mr. Jefry Rafael Alvarado Salas, Regional Director, Distribution and Commercialization Business of the Huetar Caribe Regional Directorate of the Instituto Costarricense de Electricidad, indicating the list of services with the respective meter numbers and location located in Lomas del Río, San Rafael de Turrialba.
On November 25, 2020, Resolution N° 2020022620 of nine hours thirty minutes on November twenty-four, two thousand twenty, is received, which indicates: "GISELLE SOLANO FERNÁNDEZ, in her capacity as Director of the Turrialba Health Governing Body, as well as ARTURO FRANCISCO RODRIGUEZ MORALES, in his capacity as President of the Council, and LUIS FERNANDO LEON ALVARADO, in his capacity as Mayor, are reiterated the IMMEDIATE compliance of judgment N° 2020-015125 of 09:15 hrs. on August 14, 2020, under the warning of certifying documents to the Public Prosecutor's Office in accordance with the provisions of Article 71 of the Ley de la Jurisdicción Constitucional.” On Monday, February 22, 2021, official letter MT-DA-LFLA-131-2021 (160221) is received, in which Licda. Milagro Row Arias, Vice Mayor of the Municipality of Turrialba, convenes a meeting on March 3, 2021, at 10:00 am at the Casa de la Cultura de Turrialba to continue with the coordination of necessary actions and the unification of efforts, in the reference case.
On Monday, February 22, 2021, the Turrialba Health Governing Body receives the amparo (constitutional protection) appeal, Expediente N° 20-007892-0007-CO, Appellant Johanny Porras Ramos, Respondent Mayor of the Municipality of Turrialba, in which it is indicated that ...a hearing is granted for THREE DAYS from the notification of this resolution, to Giselle Solano Fernández and Mariela Esther Díaz Ríos, as well as to Luis Fernando León Alvarado and Arturo Francisco Rodríguez Morales, respectively, in their capacities as director of the Turrialba Health Governing Body, regional director of the Central East Health Governance, mayor and president of the Council, both of Turrialba, or whoever holds those positions, so that they may refer to and provide the corresponding evidence regarding the facts and omissions attributed to them.
On March 3, 2021, a meeting is held with the participation of collaborators from the institutions Patronato Nacional de la Infancia (PANI), Consejo Nacional de la Persona con Discapacidad (CONAPDIS), Municipality of Turrialba, Joint Social Assistance Institute (IMAS), the Fuerza Publica, and the undersigned to address the topic of the Eviction of Lomas del Río. Meeting minutes attached.
On March 10, 2021, a meeting is held with the participation of the Legal Advisor of the Municipality of Turrialba, the Advisor of the Municipal Council, Representatives of the Joint Social Assistance Institute (IMAS), the Vice Mayor of the Municipality of Turrialba, Representatives of the National Council for Persons with Disabilities (CONAPDIS), and the Ministry of Housing and Human Settlements (MIVHA), where several agreements are made with the aim of following up on the cited topic. (Minutes attached).
On March 10, 2021, official letter MT-DA-LFLA-206-2021 is received, signed by Licda. Milagro Rowe A., Vice Mayor of the Municipality of Turrialba, attaching the information corresponding to the minutes and inputs involved for analysis and discussion at the next meeting on March 17, 2021. On March 17, 2021, a meeting is held with Representatives of the Institutions Turrialba Health Governing Body, National Council for Persons with Disabilities (CONAPDIS), Institute of Rural Development (INDER), Ministry of Housing and Human Settlements (MIVHA), Patronato Nacional de la Infancia (PANI), Joint Social Assistance Institute (IMAS), and the Municipality of Turrialba, with the aim of reviewing the lists of families living in Lomas del Río and following up on the tasks assigned to each institution. On March 30, 2021, official letter MS-DRRSCE-DARST-0301-2021 is sent to the Sala Constitucional in response to Resolution No. 2021004475, which is transcribed: “Giselle Solano Fernández, in her capacity as Director of the Turrialba Health Governing Body, as well as Arturo Francisco Rodríguez Morales, in his capacity as President of the Council, and Luis Fernando León Alvarado, in his capacity as Mayor, the latter two of the Municipality of the Canton of Turrialba, or whoever holds those positions, are reiterated the IMMEDIATE compliance of judgment N° 2020-015125 of 09:15 hrs. on August 14, 2020, under the warning of certifying documents to the Public Prosecutor's Office in accordance with the provisions of Article 71 of the Ley de la Jurisdicción Constitucional” - On April 14, 2021, a copy of emails is received from the conversations held between Licda. Catherine Aguilar Fonseca, Head of the Local Social Development Unit Turrialba IMAS, Cartago Regional Social Development Area, and Licda. Milagro Row Arias, Municipal Vice Mayor of Turrialba, regarding the request to conduct a census in the Lomas del Río locality; however, they did not attach the official letters they cited. (Documents attached) On May 24, 2021, the undersigned receives this amparo (constitutional protection) appeal, in which the accusation of disobedience is once again presented.
On May 25, 2021, the undersigned requests the Municipality of Turrialba to provide information regarding the census that was to be conducted in the Lomas de Río locality, therefore emails are received attaching the following official letters that have been issued by the Municipality of Turrialba.
- Official Letter MT-DA-LFLA-242-2021 (22321) dated March 22, 2021, addressed to Mr. Raymi Padilla Vargas of the Inter-institutional Eviction Assistance Commission of the Presidency of the Republic and signed by Licda. Milagro Row Arias, Municipal Vice Mayor of Turrialba, requesting the integration of a representative of the Ministry of the Presidency into the Inter-institutional Commission, through the intervention of the Inter-institutional Eviction Assistance Commission. - Official Letter MT-DA-LFLA-243-2021 (22321) dated March 22, 2021, addressed to Licda. Catherine Aguilar IMAS, signed by Licda. Milagro Row Arias, Municipal Vice Mayor of Turrialba, requesting a census to verify on-site the real information of the population that makes up the community or hamlet (caserío) Lomas del Río, in order to obtain more accurate information detailing aspects that must be referred and submitted in the Eviction intervention for Lomas del Río. Catherine Aguilar Fonseca, Head of the Local Social Development Unit IMAS, Turrialba, indicating that it is not the responsibility of the Local Unit to conduct said census; however, she expresses the commitment and interest in accompanying the Municipality of Turrialba in the preparation of the census. (Document attached).
- Official Letter MT-DA-LFLA-421-2021 dated May 17, 2021, addressed to Mr. Juan Luis Bermúdez Madriz, Executive President of the Joint Social Assistance Institute (IMAS), signed by Licda. Milagro Row Arias, Municipal Vice Mayor of Turrialba, requesting the institution's support so that the human resources of the Cartago Social Development Area are authorized to carry out the verification of the information of the population that makes up the community or hamlet (caserío) Lomas del Río. (Document attached).” It requests that the action be dismissed.
5.- By a brief filed on June 1, 2021, LUIS FERNANDO LEÓN ALVARADO, in his capacity as Mayor of the Canton of Turrialba, reports under oath that: “(…) The Municipality of Turrialba has fully complied with the provisions of resolution 2020015125 of nine hours and fifteen minutes on August fourteen, two thousand twenty, of the Sala Constitucional, in which it has carried out various actions and coordination with the different public institutions involved in this amparo (constitutional protection) appeal, in order to comply with the provisions of the cited resolution. Among the various coordination and execution actions, the following actions have been carried out:
- The Municipal Mayor's Office and the Municipal Council of Turrialba carried out immediate coordination and verified the constructions at the reported site.
- Through the Vice Mayor of the Municipality of Turrialba, the Health Authorities and public entities were convened for coordination with the other public entities, at the Casa de la Cultura on Thursday, October 22, 2020.
- The Municipal Council of Turrialba agrees to form a Special Commission for Lomas del Río, and the Ministry of Health Turrialba authorities are informed of this. Likewise, it is indicated through Lic. Carlos Calvo Sánchez, Legal Advisor of the Council, who recommends that the Municipal Council coordinate with the Municipal Mayor's Office, the Ministry of Health, and other related public institutions to analyze the situation in Barrio San Rafael, Lomas del Río sector. Therefore, the convening of the involved institutions begins to address the situation OBJECT in an INTEGRAL manner.
Convocations are sent to address the topic: On the date of October 22, 2020, at the Casa de la Cultura of the Municipality of Turrialba, the meeting is held with the participation of Representatives of the Turrialba Health Governing Body, the Ministry of Environment and Energy, the Joint Social Assistance Institute (IMAS), and the Municipality of Turrialba. The background, actions to be taken, and responsible parties are discussed, and action timelines are established. (Meeting minutes attached). All with the aim of integrating various involved parties and various institutions and convenes a meeting to develop an intervention strategy in the matter.
Institutions involved in said meeting were:
Representative of the Fuerza Pública of Turrialba, through Captain Manuel Chinchilla Chaves. (who broadly states the conditions regarding the problems in the Lomas del Río sector.)
Representative of the Offices of the Joint Social Assistance Institute IMAS in Turrialba, who, through the Head Lic. Catherine Aguilar Fonseca, explains the situation in question Representative and Chief of the Ministry of Environment and Energy of Costa Rica (MINAE), who, through Mr. Fernando Mata, explains the problem At said meeting, the following agreements are made:
Through the Municipal Mayor's Office, Licda. Milagro Rowe Arias, Vice Mayor of the Municipality of Turrialba, informs the institutions involved in the matter that after the meeting of Thursday, October 22, 2020, progress is presented, including:
1- The SINAC Report. Which, on the date of October 28, 2020, through Report SINAC-ACC-OT-1473-2020 signed by Eng. Sergio Obando Torres of the Prevention, Control and Protection Office based in Turrialba. In the official letter, it is indicated that the tenement is located outside the conservation area of the Río Turrialba; however, for the purpose of mapping the site, for relevant purposes, they proceeded at the site to establish the right bank, downstream, of the Río Turrialba to align the protection area. He points out that due to the characteristics of the Río Turrialba, defining the bank is complicated, applying as a criterion what is established in Article 69 of the Ley de Aguas 276, which defines the riverbed as the land covered by its waters during the largest ordinary floods.
2- The Health Area determines that there are minors, therefore it is essential to involve PANI.
3- Official letter MT-DA-LFLA-515-2020 (221020) is received to the Instituto Costarricense de Electricidad (ICE) and a response is awaited.
4- The Directorate of the Turrialba Health Governing Body, through official letter MS-DRRSCE. DARST-1127-2020, requests Dr.
Heylin Quesada Alvarado, Director of the Health Area of Turrialba, to provide updated information on the number of families living in the place Lomas del Río in San Rafael de Turrialba.
5- The Costa Rican Institute of Electricity is requested to provide information on the situation, and on November 17, 2020, via Official Letter 1500~ 190-2020 signed by Mr. Jefry Rafael Alvarado Salas, Regional Director, Distribution and Commercialization Business of the Huetar Caribe Regional Directorate of the Institute.

6- Through Official Letter MS-DRRSCE-DARST-1122-2020, Dr. Zolla Rojas Guevara, Acting Head of Nursing, informs the Health Area of Turrialba Jiménez regarding family groups and whether they rent rooms and which live in precarious conditions.
SECOND:
As part of the coordination actions, through Official Letter MT-DA-LFLA-131-2021 (160221), Licda. Milagro Rowe Arias, Vice-Mayor of the Municipality of Turrialba, calls a meeting, and on March 10, 2021, at 10:00 am at the Casa de la Cultura de Turrialba, coordination actions were carried out to address the subject matter of the amparo appeal. In the working group held, collaborators from the institutions National Child Welfare Agency (Patronato Nacional de la Infancia, PANI), National Council for Persons with Disabilities (Consejo Nacional de la Persona con Discapacidad, CONAPDIS), Municipality of Turrialba, Joint Institute for Social Assistance (Instituto Mixto de Ayuda Social, IMAS), the Public Force, Ministry of Health, municipal officials, such as the Legal Advisor of the Municipality of Turrialba, the Advisor to the Municipal Council, Representatives of the Joint Institute for Social Assistance (IMAS), the Vice-Mayor of the Municipality of Turrialba, Representatives of the National Council for Persons with Disabilities (CONAPDIS), the Ministry of Housing and Human Settlements (MIVHA) participated, where several agreements are adopted with the objective of following up on the cited matter. (Attached Minutes).
On March 10, 2021, through Official Letter MT-DA-LFLA-206-2021 signed by Licda. Milagro Rowe A., Vice-Mayor of the Municipality of Turrialba, information corresponding to the minutes and inputs involved for analysis and discussion at the next meeting on March 17, 2021, is rendered. (see attached evidence).
At the Inter-institutional Meeting of March 17, 2021, a meeting is held with the participation of Representatives of the Institutions: Turrialba Health Governing Area, National Council for Persons with Disabilities (CONAPDIS), Institute of Rural Development (INDER), Ministry of Housing and Human Settlements (MIVHA), National Child Welfare Agency (PANI), Joint Institute for Social Assistance (IMAS), and the Municipality of Turrialba, with the objective of reviewing the lists of families residing in Lomas del Río and following up on the tasks assigned to each institution. (see attached evidence).
- On April 14, 2021, a report is received from Licda. Catherine Aguilar Fonseca, Head of the Local Social Development Unit of Turrialba IMAS, Regional Social Development Area of Cartago, and Licda. Milagro Row Arias, Municipal Vice-Mayor of Turrialba, regarding the request to conduct a census in the locality of Lomas del Río (see evidence).
- Through Mayor’s Office Official Letter No. MT-DA-LFLA-242-2021 (22321) dated March 22, 2021, addressed to Mr. Raymi Padilla Vargas of the Inter-institutional Attention Commission on Evictions of the Presidency of the Republic and signed by Licda. Milagro Row Arias, Municipal Vice-Mayor of Turrialba, requesting Integration into the Inter-institutional Commission a representative of the Ministry of the Presidency, through the intervention of the Inter-institutional Attention Commission on Eviction.
- Through Mayor’s Office Official Letter No. MT-DA-LFLA-243-2021 (22321) dated March 22, 2021, addressed to Licda. Catherine Aguillar IMAS, signed by Licda. Milagro Rowe Arlas, Municipal Vice-Mayor of Turrialba, requesting a census be conducted with the objective of verifying on-site the real information of the population that makes up the Lomas del Río community or hamlet (caserío) in order to obtain more accurate information detailing aspects that must be referred and submitted in the Eviction intervention of Lomas del Río. (Attached Document).
- Through Mayor’s Office Official Letter No. MT-DA-LFLA-421 2021 dated May 17, 2021, addressed to Mr. Juan Luis Bermúdez Madriz, Executive President of the Joint Institute for Social Assistance (IMAS), signed by Licda. Milagro Row Arlas, Municipal Vice-Mayor of Turrialba, requesting the institution's support so that the human resources of the Social Development Area of Cartago are authorized to carry out the verification of the information of the population that makes up the Lomas del Río community or hamlet (caserío). (Attached Document).
THIRD:
WE STATE THAT THE MAYOR'S OFFICE and MUNICIPAL COUNCIL HAVE MET PERSONALLY WITH THE APPELLANT AND INTERESTED NEIGHBORS JOHANNY PORRAS RAMOS and neighboring persons from San Rafael who accompanied him, such as Mr. Fernando Sandoval Ulate, Franklin Madriz, and Manuel Antonio Zamora. (evidence is attached where the signatures of those present and their ID numbers are recorded in the Minutes of the Municipal Mayor's Office). The actions and coordination carried out were extensively explained to them personally through the Municipal Mayor's Office. The Vice Mayor also met personally with the appellant and his companions, all neighbors of San Rafael; they were given extensive information about the work carried out by the mayor's office and the institutions of the commission in search of joint alternatives, in addition to the complexity of the process due to being a highly vulnerable population with high-risk social and economic conditions. FOURTH: Through resolution 1490- 2020-DM, the MSP suspends administrative evictions due to COVID 19.” 6.- According to a record added to the case file, between May 25 and June 1, 2021, the Regional Director of the Central East Health Governance did not submit any writing or document to render the report requested in the resolution issued at twenty-one hours twelve minutes of May nineteen, two thousand twenty-one, in case file number 20-007892-0007-CO.
7.- In the substantiation of this process, the legal requirements have been observed.
Drafted by Magistrate Picado Brenes; and,
Considering:
I.- In the present matter, the appellant accuses that the respondent authority has not complied with what was ordered in the judgment issued in this process. Therefore, by means of an order at twenty-one hours twelve minutes of May nineteen, two thousand twenty-one, the respondent authorities were given a hearing to pronounce on the possible non-compliance with what was resolved in judgment 2020-015125 at 09:15 hrs. of August 14, 2020, in which it was ordered: "Giselle Solano Fernández and Mariela Esther Díaz Ríos, as well as Luis Fernando León Alvarado and Arturo Francisco Rodríguez Morales, respectively, in their capacity as director of the Health Governing Area of Turrialba, Regional Director of the Central East Health Governance, mayor and president of the Council, both of Turrialba, or whoever holds those positions, are ordered to arrange and coordinate what is necessary so that it is immediately verified whether the claimed environmental and construction problems exist, which must be completed within a period of one month counted from the notification of this judgment. Upon completion of said period, they must immediately order the initiation of the respective procedures, with the purpose of bringing the situation of those constructions into compliance with the law. To that effect, they must coordinate all necessary actions so that the Ministry of the Presidency, Ministry of Public Security, Ministry of Housing and Human Settlements, Ministry of National Planning and Economic Policy, Institute of Agrarian Development, and Joint Institute for Social Assistance are integrated, in the event that the eviction of the squatter settlement (precario) Lomas del Río must be carried out." In this regard, from what was reported by the respondent authorities of the Health Governing Area of Turrialba and the Municipality of Turrialba, in relation to the alleged non-compliance, it is observed that these have been carrying out actions aimed at complying with what was ordered in the judgment. However, it is also established that several of these actions were carried out outside the granted period and compliance with what was ordered in the indicated judgment has not yet been completed. Based on the foregoing, it is appropriate to reiterate the order so that the respondents proceed to the effective compliance with judgment No. 2020-015125 at 09:15 hrs. of August 14, 2020. GISELLE SOLANO FERNÁNDEZ, in her capacity as Director of the Health Governing Area of Turrialba, as well as ARTURO FRANCISCO RODRÍGUEZ MORALES, in his capacity as President of the Council, and LUIS FERNANDO LEÓN ALVARADO, in his capacity as Mayor, the latter two of the Municipality of the Canton of Turrialba, or whoever holds those positions, are warned that in the event of failure to comply with what is ordered in this judgment, the testimony of documents will be forwarded to the Public Prosecutor's Office pursuant to the provisions of Article 71 of the Constitutional Jurisdiction Law.
II.- DOCUMENTATION SUBMITTED TO THE FILE. The parties are warned that, if any paper document has been submitted, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology-produced device, these must be removed from the office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, any material that is not removed within this period will be destroyed, pursuant to the provisions of the "Regulation on the Electronic File before the Judicial Branch" (Reglamento sobre Expediente Electrónico ante el Poder Judicial), approved by the Full Court in session No. 27-11 of August 22, 2011, Article XXVI, and published in Judicial Bulletin number 19 of January 26, 2012, as well as in the agreement approved by the Superior Council of the Judicial Branch, in session No. 43-12 held on May 3, 2012, Article LXXXI.
THEREFORE:
GISELLE SOLANO FERNÁNDEZ, in her capacity as Director of the Health Governing Area of Turrialba, as well as ARTURO FRANCISCO RODRÍGUEZ MORALES, in his capacity as President of the Council, and LUIS FERNANDO LEÓN ALVARADO, in his capacity as Mayor, the latter two of the Municipality of the Canton of Turrialba, or whoever holds those positions, are REITERATED the IMMEDIATE compliance with judgment No. 2020-015125 at 09:15 hrs. of August 14, 2020, under the warning of forwarding testimony of documents to the Public Prosecutor's Office pursuant to the provisions of Article 71 of the Constitutional Jurisdiction Law. Gestión de incumplimiento del Recurso de amparo que se tramita en expediente número 20-007892-0007-CO, interpuesto por JOHANNY PORRAS RAMOS, cédula de identidad 0302230643, contra la MUNICIPALIDAD DE TURRIALBA Y EL MINISTERIO DE SALUD.
Resultando:
1.- Mediante escrito presentado ante esta Jurisdicción Constitucional el 17 de mayo de 2021, el recurrente acusa que la autoridad accionada no ha cumplido con lo ordenado en sentencia dictada en este proceso.
2.- Mediante auto de las 21:12 hrs. del 19 de mayo de 2021 se dio audiencia a las autoridades accionadas para que se pronunciaran sobre el posible incumplimiento de lo resuelto en la sentencia 2020-015125 de las 09:15 hrs. del 14 de agosto de 2020, en la que se dispuso: "Se ordena a Giselle Solano Fernández y a Mariela Esther Díaz Ríos, así como a Luis Fernando León Alvarado y a Arturo Francisco Rodríguez Morales, respectivamente, en condición de directora del Área Rectora de Salud de Turrialba, de directora Regional de Rectoría de la Salud Central Este, de alcalde y de presidente del Concejo, ambos de Turrialba o a quienes ocupe esos cargo, que dispongan y coordinen lo necesario a efecto que de inmediato se verifique si existen los problemas ambientales y constructivos reclamados, lo cual deberá ser finalizado en el plazo de un mes contado a partir de la notificación de esta sentencia. Cumplido dicho plazo, deberán ordenar, de inmediato, el inicio de los procedimientos respectivos, con el objeto de ajustar a derecho la situación de esas construcciones. A ese efecto, deberán coordinar todas las acciones necesarias a efecto que se integren el Ministerio de la Presidencia, Ministerio de Seguridad Pública, Ministerio de Vivienda y Asentamientos Humanos, Ministerio de Planificación Nacional y Política Económica, Instituto de Desarrollo Agrario e Instituto Mixto de Ayuda Social, en el supuesto que deba realizarse el desalojo del precario Lomas del Río".
4.- Por escrito presentado el 25 de mayo de 2021, informa bajo juramento GISELLE SOLANO FERNÁNDEZ, en su condición de Directora del Área Rectora de Salud Turrialba, y señala que: “(...) En atención a lo indicado en la Resolución N° 22020-015125 de las 09:15 hrs del 14 de agosto de 2020 la cual se trascribe “Se ordena a Giselle Solano Fernández y a Mariela Esther Díaz Ríos, así como a Luis Fernando León Alvarado y a Arturo Francisco Rodríguez Morales, respectivamente, en condición de directora del Área Rectora de Salud Turrialba, de directora Regional de Rectoría de la Salud Central Este, de alcalde y de presidente del Concejo, ambos de Turrialba o a quienes ocupe esos cargos, que dispongan y coordinen lo necesario a efecto que de inmediato se verifique si existen los problemas ambientales y constructivos reclamados, lo cual deberá ser finalizado en el plazo de un mes contado a partir de la notificación de esta sentencia.
Cumplido dicho plazo, deberán ordenar, de inmediato, el inicio de los procedimientos respectivos, con el objeto de ajustar a derechos la situación de esas construcciones. A ese efecto, deberán coordinar todas las acciones necesarias a efecto que se integren el Ministerio de Presidencia, Ministerio de Seguridad Publica, Ministerio de Vivienda y Asentamientos Humanos, Ministerio de Planificación Nacional y Política Económica, Instituto de Desarrollo Agrario e Instituto Mixto de Ayuda Social, en el supuesto que deba realizarse el desalojo del precario Lomas del Río”, se informa lo siguiente:
El jueves 20 de agosto de 2020 se envía por correo electrónico al Concejo Municipal de Turrialba con copia a la Sala Constitucional el Oficio MS- DRRSCE-DARST-0775-2020 (copia adjunta) en donde la suscrita le solicita al Concejo Municipal de Turrialba la coordinación inmediata y visitar el lugar con el objetivo de realizar un diagnóstico de la situación ambiental y las construcciones del lugar denunciado. Se espera la respuesta del Concejo Municipal dejando como el plazo estipulado de acuerdo con el artículo 32 de la Ley de la Jurisdicción Constitucional.
- El 11 de setiembre de 2020 ingresa al Área Rectora de Salud Turrialba copia del Oficio N° SM-897-2020 en donde se demuestra que el Concejo Municipal de Turrialba analiza el oficio MS-DRRSCE-DARST-0775-2020 y acuerda trasladarlo al Lic. Carlos Calvo Sánchez Asesor Legal del Concejo, al señor Alcalde Master Luis Fernando León Alvarado, al Ing. Gerardo Sequeria Pereira del Departamento de Desarrollo Urbano y a la Comisión Municipal de Ambiente de Municipalidad de Turrialba, para que un plazo de diez días hábiles brinden un informe al Concejo de lo que procede en el caso en cuestión.
- El 07 de octubre de 2020 se recibe a través del correo electrónico el oficio MT-DA-LFLA438-2020 (5920) en donde la Vicealcaldesa de la Municipalidad de Turrialba solicita audiencia a la suscrita para conversar sobre el tema citado. La suscrita le contesta el 09 de octubre de 2020 a través del oficio MS-DRRSCE-DARST-0978-2020 que se le convoca a reunión en la Casa de la Cultura el jueves 22 de octubre de 2020.
- El 06 de octubre de 2020 se recibe a través del correo electrónico el Oficio SM-979-2020 del Concejo Municipal de Turrialba en donde informan a la Dirección del Área Rectora de Salud Turrialba, al Ing. Gerardo Sequeira Pereira del Departamento de Desarrollo Urbano y al Departamento de Censo y Catastro los dos últimos de la Municipalidad de Turrialba que aprueban el informe presentado por el Lic. Carlos Calvo Sánchez Asesor Legal del Concejo en donde indica que al Concejo Municipal se le dificulta realizar la labor de analizar los problemas ambientales o constructivos en el lugar Lomas del Río en virtud de que no cuentan con los conocimientos técnicos, ambientales ni constructivos, para solventar lo solicitado. Por lo tanto, es fundamental el apoyo de los técnicos que posee la Administración, tal y como siempre se ha manejado dicho asunto, que incluso ya es conocido por la Comisión Especial.
Asimismo, indica el Lic. Carlos Calvo Sánchez Asesor Legal de Concejo que recomienda al Concejo Municipal coordinar con la Alcaldía Municipal, Ministerio de Salud y demás instituciones públicas relacionadas, analizar y dar solución definitiva al objeto del recurso y que es importante conocer el informe del Ing. Gerardo Sequeira Pereira y el del Departamento de Censo y Catastro para que una vez conocidos convocar a una reunión con todas las instituciones involucradas.
- Después de conocido el informe del Concejo Municipal, la Dirección del Área Rectora de Salud Turrialba, inicia con la convocatoria a las instituciones involucradas en el asunto.
- El 09 de octubre de 2020 a través de correo electrónico, la suscrita envía el oficio MS-DRRSCE-DARST-0975-2020, al Capitán Manuel Chinchilla Chaves Jefe de la Fuerza Pública de Turrialba en donde le explica la situación y convoca a una reunión el jueves 22 de octubre de 2020 para tomar una estrategia de intervención en el sitio.
- El 09 de octubre de 2020 a través de correo electrónico, la suscrita envía el oficio MS-DRRSCE-DARST-0976-2020 a la Licda. Catherine Aguilar Fonseca Representante de las Oficinas del Instituto Mixto de Ayuda Social IMAS en Turrialba en donde le explica la situación en cuestión y le convoca a reunión el jueves 22 de octubre de 2020 para tomar una estrategia de intervención en el asunto.
- El 09 de octubre de 2020 a través de correo electrónico, la suscrita envía el oficio MS-DRRSCE-DARST-0977-2020 al señor Fernando Mata Jefe del Ministerio de Ambiente y Energía de Costa Rica (MINAE) en donde le explica la problemática y le convoca a reunión el jueves 22 de octubre de 2020 para tomar una estrategia de intervención en el caso.
- El 09 de octubre de 2020 a través de correo electrónico, la suscrita envía el oficio MS-DRRSCE-DARST-0979-2020 a la Licda. Milagro Rowe Arias Vicealcaldesa de la Municipalidad de Turrialba en donde le solicita la aprobación para utilizar la Casa de la Cultura, con el objetivo de efectuar en ese espacio la reunión programada para el 22 de octubre de 2020 en donde se tratara el caso de Lomas del Río en el Barrio San Rafael de Turrialba y en la cual participaran varias instituciones.
- El 22 de octubre de 2020 se realiza la reunión programada, participan Representantes del Área Rectora de Salud Turrialba, Ministerio de Ambiente y Energía, Instituto Mixto de Ayuda Social (IMAS) y de la Municipalidad de Turrialba. Se conversa sobre los antecedentes, acciones a tomar y responsables y se establecen los tiempos de acción. (Acta de reunión adjunta).
Asimismo, de acuerdo con el acta adjunta se acuerda lo siguiente:
- El 23 de octubre de 2020 se recibe correo electrónico de la Licda. Milagro Rowe Arias Vicealcaldesa de la Municipalidad de Turrialba en donde comunica a las instituciones involucradas en el asunto que después de la reunión del jueves 22 de octubre de 2020 se presentan los avances:
- El 27 de octubre de 2020 la suscrita envía el oficio MS-DRRSCE-DARST- 1049-2020 a la Sala Constitucional en donde le informa lo actuado por esta Área Rectora de Salud Turrialba en atención a la problemática presentada.
- El miércoles 28 de octubre de 2020 se recibe por correo electrónico copia del informe SINAC-ACC-OT-1473-2020 suscrito por el Ing. Sergio Obando Torres de la Oficina de Prevención, Control y Protección sede en Turrialba en donde indica que de acuerdo a lo analizado es evidente que la cuartería se ubica fuera del área de conservación del Río Turrialba, sin embargo, para efectos de mapear el sitio, para fines competentes, procedieron en el lugar a establecer la rivera derecha, aguas abajo, del Río Turrialba para realizar el alineamiento del área de protección, Señala que por las características del Río Turrialba, definir la rivera es complicado, aplicando como criterio lo establecido en el artículo 69 de la Ley de Aguas 276, que define el cauce del río, como el terreno que cubren sus aguas en las mayores crecidas ordinarias.
Tercero: La Dirección del Área Rectora de Salud Turrialba a través del oficio MS-DRRSCE-DARST-1127-2020 le solicita a la Dra. Heylin Quesada Alvarado Directora del Área de Salud Turrialba brindar información actualizada de la cantidad de familias que viven en el lugar Lomas del Río en San Rafael de Turrialba.
Cuarto: Se está a la espera del informe por parte del Instituto Costarricense de Electricidad y del Área de Salud Turrialba Jiménez para definir las acciones a seguir en el caso citado.
Después de enviado el oficio MS-DRRSCE-DARST-1122-2020 a la Sala Constitucional; la Dirección del Área Rectora de Salud Turrialba recibe el viernes 13 de noviembre de 2020 vía correo electrónico información por parte de la Dra. Zoila Rojas Guevara Jefatura Enfermería a.i. del Área de Salud Turrialba Jiménez referente a los grupos familiares y si alquilan cuarto y cuales viven en condiciones precarias.
El 17 de noviembre de 2020 se recibe el oficio 1500-190-2020 suscrito por el señor Jefry Rafael Alvarado Salas Director Regional, Negocio Distribución y Comercialización de la Dirección Regional Huetar Caribe del Instituto Costarricense de Electricidad, en donde se indica la lista de servicios con el respectivo número de medidos y localización ubicados en Lomas del Río San Rafael de Turrialba.
El 25 de noviembre de 2020 se recibe la Resolución N° 2020022620 de las nueve horas treinta minutos del veinticuatro de noviembre de dos mil veinte que indica “Se reitera a GISELLE SOLANO FERNÁNDEZ, en su condición de Directora del Área Rectora de Salud Turrialba, así como, a ARTURO FRANCISCO RODRIGUEZ MORALES, en condición de Presidente del Concejo y a LUIS FERNANDO LEON ALVARADO, en condición de Alcalde, el cumplimiento INMEDIATO de la sentencia N° 2020-015125 de las 09:15 hrs. Del 14 de agosto de 2020, bajo la advertencia de testimoniar piezas al Ministerio Publico conforme lo dispuesto en el artículo 71 de la Ley de la Jurisdicción Constitucional”.
El lunes 22 de febrero de 2021 se recibe el oficio MT-DA-LFLA-131-2021 (160221) en donde la Licda. Milagro Row Arias Vicealcaldesa de la Municipalidad de Turrialba convoca a reunión el 03 de marzo de 2021 a las 10:00 am en la Casa de la Cultura de Turrialba para continuar con la coordinación de las acciones necesarias y la unificación de esfuerzos, en caso de referencia.
El lunes 22 de febrero de 2021 el Área Rectora de Salud Turrialba recibe el Recurso de Amparo, Expediente N° 20-007892-0007-CO, Recurrido Johanny Porras Ramos, Recurrido Alcalde de la Municipalidad de Turrialba en donde se indica que ...se confiere audiencia por TRES DIAS contando a partir de la notificación de esta resolución, a Giselle Solano Fernández y a Mariela Esther Díaz Ríos, así como a Luis Fernando León Alvarado y a Arturo Francisco Rodríguez Morales, respectivamente, en condición de directora del Área Rectora de Salud Turrialba, de directora Regional de Rectoría de la Salud Central Este, de alcalde y de presidente del Concejo, ambos de la Turrialba o a quienes ocupen esos cargos, para que se refieran y aporten las pruebas correspondientes respecto a los hechos y omisiones que se les atribuyen.
El 03 de marzo de 2021 se realiza reunión en donde participaron colaboradores de las instituciones Patronato Nacional de la Infancia (PANI), Consejo Nacional de la Persona con Discapacidad (CONAPDIS), Municipalidad de Turrialba, Instituto Mixto de Ayuda Social (IMAS), la Fuerza Publica y la suscrita para tratar el tema del Desalojo de Lomas del Río. Acta de Reunión adjunta.
El 10 de marzo de 2021 se realiza reunión en donde participaron la Asesora Legal de la Municipalidad de Turrialba, el Asesor del Concejo Municipal, Representantes del Instituto Mixto de Ayuda Social (IMAS), la Vicealcaldesa de la Municipalidad de Turrialba, Representantes del Consejo Nacional de la Persona con Discapacidad (CONAPDIS), el Ministerio de Vivienda y Asentamientos Humanos (MIVHA) en donde se toman varios acuerdos con el objetivo de darle seguimiento al tema citado. (Minuta adjunta).
El 10 de marzo de 2021 se recibe el oficio MT-DA-LFLA-206-2021 suscrito por la Licda. Milagro Rowe A. Vicealcaldesa de la Municipalidad de Turrialba en donde adjunta la información correspondiente a las minutas e insumos involucradas para el análisis y discusión en la próxima reunión del 17 de marzo de 2021. (documento adjunto).
El 17 de marzo de 2021 se realiza reunión con Representantes de las Instituciones Área Rectora de Salud Turrialba, Consejo Nacional de la Persona con Discapacidad (CONAPDIS), Instituto de Desarrollo Rural (INDER), Ministerio de Vivienda y Asentamientos Humanos (MIVHA), Patronato Nacional de la Infancia (PANI), Instituto Mixto de Ayuda Social (IMAS) y la Municipalidad de Turrialba con el objetivo de revisar las listas de las familias que habitan en Lomas del Río y dar seguimiento a las tareas asignadas a cada institución. El 30 de marzo de 2021 se envía el oficio MS-DRRSCE-DARST-0301-2021 a la Sala Constitucional en atención a la Resolución No 2021004475 la cual se transcribe “Se reitera a Giselle Solano Fernández, en su condición de Directora del Área Rectora de Salud Turrialba, así como, a Arturo Francisco Rodríguez Morales, en condición de Presidente del Concejo y a Luis Fernando León Alvarado, en condición de Alcalde, estos últimos de la Municipal del Cantón de Turrialba o, a quienes ocupen esos cargos, el cumplimiento INMEDIATO de la sentencia N° 2020-015125 de las 09:15 hrs. del 14 de agosto de 2020, bajo la advertencia de testimoniar piezas al Ministerio Público conforme lo dispuesto en el artículo 71 de la Ley de la Jurisdicción Constitucional” - El 14 de abril de 2021 se recibe copia de correos electrónicos de las conversaciones que mantienen la Licda. Catherine Aguilar Fonseca Jefa de la Unidad Local de Desarrollo Social Turrialba IMAS Área Regional de Desarrollo Social Cartago y la Licda. Milagro Row Arias Vicealcaldesa Municipal de Turrialba referente a la solicitud de realizar censo en la localidad Lomas del Río, sin embargo no adjuntaban los oficios que citaban. (Documentos adjuntos) El 24 de mayo de 2021 la suscrita recibe el presente Recurso de Amparo en donde nuevamente se presenta la acusación de desobediencia.
El 25 de mayo de 2021 la suscrita le solicita a la Municipalidad de Turrialba brindar información respecto al censo que se iba a realizar en la localidad Lomas de Río, por lo que se reciben correos electrónicos en donde adjuntan los siguientes oficios que se han emitido por parte de la Municipalidad de Turrialba.
- Oficio MT-DA-LFLA-242-2021 (22321) con fecha 22 de marzo de 2021, dirigido al señor Raymi Padilla Vargas de la Comisión de Atención Interinstitucional de Desalojos de la Presidencia de la República y suscrito por la Licda. Milagro Row Arias Vicealcaldesa Municipal de Turrialba en donde solicita la integración a la Comisión de Interinstitucional un representante del Ministerio de Presidencia, a través de la intervención de la Comisión de Atención Interinstitucional de Desalojos. - Oficio MT-DA-LFLA-243-2021 (22321) con fecha 22 de marzo de 2021 dirigido a la Licda. Catherine Aguilar IMAS suscrito por la Licda. Milagro Row Arias Vicealcaldesa Municipal de Turrialba en donde se solicita realizar un censo con el objetivo de verificar en sitio la información real de la población que conforma la comunidad o caserío Lomas del Río a efecto de obtener información más exacta, que detalle aspectos que deben ser referidos y remitidos en la intervención de Desalojo de Lomas del Río. (Documento adjunto).
- Oficio IMAS-ARSDSC-ULDST-0287-2021 con fecha 14 de abril de 2021 dirigido a la Licda. Milagro Row Arias Vicealcaldesa Municipal de Turrialba suscrito por la Licda. Catherine Aguilar Fonseca Jefatura de la Unidad Local de Desarrollo Social IMAS, Turrialba en donde indica que no corresponde a la Unidad Local realizar dicho censo, sin embargo, manifiesta el compromiso e interés para la acompañar a la Municipalidad de Turrialba en la elaboración del censo. (Documento adjunto).
- Oficio MT-DA-LFLA-421-2021con fecha 17 de mayo de 2021 dirigido al señor Juan Luis Bermúdez Madriz Presidente Ejecutivo del Instituto Mixto de Ayuda Social (IMAS), suscrito por la Licda. Milagro Row Arias Vicealcaldesa Municipal de Turrialba en donde solicita el apoyo de la institución a efectos de que se autorice el recurso humano, del Área de Desarrollo Social Cartago, para llevar a cabo la verificación de la información de la población que conforma la comunidad o caserío Lomas del Río. (Documento adjunto).”. Solicita se desestime la gestión.
5.- Por escrito presentado el 01 de junio de 2021, informa bajo juramento LUIS FERNANDO LEÓN ALVARADO en condición de Alcalde del Cantón de Turrialba que: “(…) La Municipalidad de Turrialba, ha cumplido a cabalidad lo dispuesto en la resolución 2020015125 de las nueve horas y quince minutos del catorce de agosto del año dos mil veinte de la Sala Constitucional, en la cual ha realizado distintos acciones y coordinaciones con las distintas instituciones públicas, involucradas en el presente recurso de amparo, con el fin de cumplir con los dispuesto en la resolución citada. Dentro de las diversas acciones de coordinación y ejecución, se ha realizado las siguientes acciones:
- La Alcaldía Municipal y el Concejo Municipal de Turrialba realizamos una coordinación en forma inmediata y se verificaron sobre las construcciones del lugar denunciado.
- Por medio de la Vicealcaldesa de la Municipalidad de Turrialba se convocó a las Autoridades de Salud y entes públicos, para las coordinaciones con los demás entes públicos, en la Casa de la Cultura el jueves 22 de octubre de 2020.
- El Concejo Municipal de Turrialba acuerda conformar una Comisión Especial Lomas del Río, y se informa de esto a las autoridades del Ministerio de Salud Turrialba, Asimismo, así se índica por medio del Lic. Carlos Calvo Sánchez, Asesor Legal de Concejo, quien recomienda al Concejo Municipal coordinar con la Alcaldía Municipal, Ministerio de Salud y demás instituciones públicas relacionadas, analizar la situación en el Barrio San Rafael sector Lomas del Río. Por lo tanto, se inicia con la convocatoria a las instituciones involucradas para atender en forma INTEGRAL la situación objeto.
Se envían convocatorias para tratar el tema: En fecha de 22 de octubre de 2020 en Casa de la Cultura de la Municipalidad de Turrialba, se realiza la con la participan Representantes del Área Rectora de Salud Turrialba, Ministerio de Ambiente y Energía, Instituto Mixto de Ayuda Social (IMAS) y de la Municipalidad de Turrialba. Se conversa sobre los antecedentes, acciones a tomar y responsables y se establecen los tiempos de acción. (Acta de reunión adjunta). Todo con el fin de integrar a diversos involucrados y diversas instituciones y le convoca a reunión el para tomar una estrategia de intervención en el asunto.
Instituciones involucradas en dicha reunión fueron:
Representante de la Fuerza Pública de Turrialba, por medio del Capitán Manuel Chinchilla Chaves. (quien manifiesta en forma amplia las condiciones sobre los problemas en el sector de Lomas del Río.
Representante de las Oficinas del Instituto Mixto de Ayuda Social IMAS en Turrialba, quien por medio de la Jefatura Lic. Catherine Aguilar Fonseca explica la situación en cuestión Representante y Jefe del Ministerio de Ambiente y Energía de Costa Rica (MINAE) quien por medio del Señor Fernando Mata explica la problemática En dicha reunión se toman los siguientes acuerdos:
Por medio de la Alcaldía Municipal, la Licda. Milagro Rowe Arias, Vicealcaldesa de la Municipalidad de Turrialba, comunica a las instituciones involucradas en el asunto que después de la reunión del jueves 22 de octubre de 2020, se presentan los avances, entres estos:
1- El Informe del SINAC. La cual en fecha de 28 de octubre de 2020 quien por medio del Informe SINAC-ACC-OT-1473-2020 suscrito por el lng. Sergio Obando Torres de la Oficina de Prevención, Control y Protección sede en Turrialba. En el oficio se indica que la cuartaría se ubica fuera del área de conservación del Río Turrialba, sin embargo, para efectos de mapear el sitio, para fines competentes, procedieron en al lugar a establecer la rivera derecha, aguas abajo, del Río Turrialba para realizar el alineamiento del área de protección, Señala que por las características del Río Turrialba, definir la rivera es complicado, aplicando como criterio lo establecido en el artículo 69 de la Ley de Aguas 276, que define el cauce del río, como el terreno que cubren sus aguas en las mayores crecidas ordinarias.
2- El Área de Salud determinar que la presencia de menores de edad, por lo que resulta elementar involucrar al PANI.
3- Se recibe el oficio MT-DA-LFLA-515-2020 (221020) al Instituto Costarricense de Electricidad (ICE) y se está a la espera de respuesta.
4- La Dirección del Área Rectora de Salud Turrialba a través del oficio MS-DRRSCE. DARST-1127-2020 le solicita a la Dra. Heylin Quesada Alvarado Directora del Área de Salud Turrialba brindar información actualizada de la cantidad de familias que viven en el lugar Lomas del Río en San Rafael de Turrialba.
5- Se solicita por parte del Instituto Costarricense de Electricidad información sobre la situación, y en fecha de 17 da noviembre de 2020 mediante Oficio 1500~ 190-2020 suscrito por el señor Jefry Rafael Alvarado Salas Director Regional, Negocio Distribución y Comercialización de la Dirección Regional Huetar Caribe del Instituto.
respectivo número de medidos y localización ubicados en Lomas del Río San Rafael de Turrialba.
6- Mediante Oficio MS-DRRSCE-DARST-1122-2020, la Dra. Zolla Rojas Guevara Jefatura Enfermaría a.i. le indica al Área de Salud Turrialba Jiménez referente a los grupos familiares y si alquilan cuarto y cuales viven en condicionas precarias.
SEGUNDO:
Como parte de las acciones de coordinación, mediante Oficio MT-DA-LFLA-131-2021 (160221) la Licda. Milagro Rowe Arias Vicealcaldesa de la Municipalidad de Turrialba convoca a reunión y en fecha de 10 de marzo de 2021 a las 10:00 am en la Casa de la Cultura de Turrialba se realizaron acciones de coordinación para abordar el tema objeto del recurso de amparo. En la mesa de trabajo realizada participaron colaboradores de las instituciones Patronato Nacional de la Infancia (PANI), Consejo Nacional de la Persona con Discapacidad (CONAPDIS), Municipalidad de Turrialba, Instituto Mixto de Ayuda Social (IMAS), la Fuerza Publica, Misterio de Salud, funcionarios municipales, como la Asesora Legal de la Municipalidad de Turrialba, el Asesor del Concejo Municipal, Representantes del Instituto Mixto de Ayuda Social (IMAS), la Vicealcaldesa de la Municipalidad de Turrialba, Representantes del Consejo Nacional de la Persona con Discapacidad (CONAPDIS), el Ministerio de Vivienda y Asentamientos Humanos (MIVHA) en donde se toman varios acuerdos con el objetivo de darle seguimiento al tema citado. El 10 de marzo de 2021 mediante Oficio MT-DA-LFLA-206-2021 suscrito por la Licda. Milagro Rowe A. Vicealcaldesa de la Municipalidad de Turrialba, se rinde información correspondiente a las minutas e Insumos, involucradas para el análisis y discusión en la próxima reunión del 17 de marzo de 2021. (ver prueba adjunta).
En la Reunión interinstitucional del 17 de marzo de 2021 se realiza reunión con la participación de Representantes de las Instituciones Área Rectora de Salud Turrialba, Consejo Nacional de la Persona con Discapacidad (CONAPDIS), Instituto de Desarrollo Rural (INDER), Ministerio de Vivienda y Asentamientos Humanos (MIVHA), Patronato Nacional de la Infancia (PANI), Instituto Mixto de Ayuda Social (IMAS) y la Municipalidad de Turrialba con el objetivo de revisar las listas de las familias que habitan en Lomas del Río y dar seguimiento a las tareas asignadas a cada institución. - En fecha de 14 de abril de 2021 se recibe por parte de la Licda. Catherine Aguilar Fonseca Jefa de la Unidad Local de Desarrollo Social Turrialba IMAS Area Regional de Desarrollo Social Cartago y la Licda. Milagro Row Arias Vicealcaldesa Municipal de Turrialba, informe, sobre la solicitud de realizar censo en la localidad Lomas del Río (ver pruebas).
- Mediante Oficio de la Alcaldía Municipal No. MT-DA-LFLA-242-2021 (22321) con fecha 22 de marzo de 2021, dirigido al señor Raymi Padilla Vargas de la Comisión de Atención interinstitucional de Desalojos de la Presidencia de la República y suscrito por la Licda. Milagro Row Arias Vicealcaldesa Municipal de Turrialba en donde solicita la Integración a la Comisión de interinstitucional un representante del Ministerio de Presidencia, a través de la intervención de la Comisión de Atención interinstitucional de Desalojo.
- Mediante Oficio de la Alcaldía Municipal No Oficio MT-DA-LFLA-243-2021 (22321) con fecha 22 de marzo de 2021 dirigido a la Licda. Catherine Aguillar IMAS suscrito por la Licda. Milagro Rowe Arlas Vicealcaldesa Municipal de Turrialba en donde se solicita realizar un censo con el objetivo de verificar en sitio la información real de la población que conforma la comunidad o caserío Lomas del Río a efecto de obtener información más exacta, que detalle aspectos que deben ser referidos y remitidos en la intervención de Desalojo de Lomas del Río. - Mediante Oficio de la Alcaldía Municipal No Oficio MT-DA-LFLA-421 2021 con fecha 17 de mayo de 2021 dirigido al señor Juan Luis Bermúdez Madriz Presidente Ejecutivo del Instituto Mixto de Ayuda Social (IMAS), suscrito por la Licda. Milagro Row Arlas Vicealcaldesa Municipal de Turrialba en donde solicita el apoyo de la institución a efectos de que se autorice el recurso humano del Área de Desarrollo Social Cartago, para llevar a cabo la verificación de la información de la población que conforma la comunidad o caserío Lomas del Río. (Documento adjunto).
TERCERO:
MANIFESTAMOS QUE LA ALCALDIA y CONCEJO MUNICIPAL SE HA REUNIDO PERSONALMENTE CON EL RECURRENTE Y LOS VECINOS INTERESADOS JOHANNY PORRAS RAMOS y personas vecinas de San Rafael que lo acompañaron como fue el Sr Fernando Sandoval Ulate. Franklin Madriz; y Manuel Antonio Zamora. (se adjunta pruebas donde consta en el Acta de la Alcaldía Municipal las firmas de los presentes y sus números de cédula) Se les explicó ampliamente en forma personal por medio de la Alcaldía Municipal las acciones y coordinaciones llevadas a cabo. La Vice Alcaldesa, también se reunió personalmente con el recurrente y sus acompañes, todos vecinos de San Rafael, se les dio una amplia información de los trabajos realizados por la alcaldía y las instituciones de la comisión en búsqueda de alternativas conjuntas. Además de la complejidad del proceso por ser una población altamente vulnerable con condiciones sociales y económicas de alto riesgo. CUARTO: Mediante. resolución 1490- 2020-DM el MSP se suspenden los Desalojos administrativos por el COVID 19.” 6.- Según constancia agregada a los autos, entre el 25 mayo y el 01 de junio del 2021, la Directora Regional de Rectoría de la Salud Central Este, no presentó escrito o documento alguno, a fin de rendir el informe que se le solicitó en la resolución dictada a las veintiún horas doce minutos del diecinueve de mayo de dos mil veintiuno, en el expediente número 20-007892-0007-CO.
7.- En la substanciación de este proceso se han observado las prescripciones de ley.
Redacta la Magistrada Picado Brenes; y,
Considerando:
I.- En el presente asunto, el recurrente acusa que la autoridad accionada no ha cumplido con lo ordenado en sentencia dictada en este proceso. Por lo anterior, mediante auto de a las veintiuno horas doce minutos del diecinueve de mayo de dos mil veintiuno, se dio audiencia a las autoridades accionadas para que se pronunciaran sobre el posible incumplimiento de lo resuelto en la sentencia 2020-015125 de las 09:15 hrs. del 14 de agosto de 2020, en la que se dispuso: "Se ordena a Giselle Solano Fernández y a Mariela Esther Díaz Ríos, así como a Luis Fernando León Alvarado y a Arturo Francisco Rodríguez Morales, respectivamente, en condición de directora del Área Rectora de Salud de Turrialba, de directora Regional de Rectoría de la Salud Central Este, de alcalde y de presidente del Concejo, ambos de Turrialba o a quienes ocupe esos cargo, que dispongan y coordinen lo necesario a efecto que de inmediato se verifique si existen los problemas ambientales y constructivos reclamados, lo cual deberá ser finalizado en el plazo de un mes contado a partir de la notificación de esta sentencia. Cumplido dicho plazo, deberán ordenar, de inmediato, el inicio de los procedimientos respectivos, con el objeto de ajustar a derecho la situación de esas construcciones. A ese efecto, deberán coordinar todas las acciones necesarias a efecto que se integren el Ministerio de la Presidencia, Ministerio de Seguridad Pública, Ministerio de Vivienda y Asentamientos Humanos, Ministerio de Planificación Nacional y Política Económica, Instituto de Desarrollo Agrario e Instituto Mixto de Ayuda Social, en el supuesto que deba realizarse el desalojo del precario Lomas del Río". Al respecto, de lo informado por parte de las autoridades accionadas del Área Rectora de Salud de Turrialba y de la Municipalidad de Turrialba, en relación con el acusado incumplimiento, se aprecia que estas han estado realizando acciones tendientes a dar cumplimiento de lo ordenado en sentencia. Sin embargo, también se logra acreditar que varias de estas acciones fueron realizadas fuera del plazo otorgado y aun no se ha terminado de cumplir lo ordenado en la indicada sentencia. En razón de expuesto, procede reiterar la orden, para que los accionados procedan al cumplimiento efectivo de la sentencia N° 2020-015125 de las 09:15 hrs. del 14 de agosto de 2020. Se apercibe a GISELLE SOLANO FERNÁNDEZ, en su condición de Directora del Área Rectora de Salud Turrialba, así como, a ARTURO FRANCISCO RODRÍGUEZ MORALES, en condición de Presidente del Concejo y, a LUIS FERNANDO LEÓN ALVARADO, en condición de Alcalde, estos últimos de la Municipal del Cantón de Turrialba o, a quienes ocupen esos cargos que en caso de no cumplir con lo ordenado en esta sentencia se ordenará el testimonio de piezas al Ministerio Público conforme lo dispuesto en el artículo 71 de la Ley de la Jurisdicción Constitucional.
II.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se reitera a GISELLE SOLANO FERNÁNDEZ, en su condición de Directora del Área Rectora de Salud Turrialba, así como, a ARTURO FRANCISCO RODRÍGUEZ MORALES, en condición de Presidente del Concejo y a LUIS FERNANDO LEÓN ALVARADO, en condición de Alcalde, estos últimos de la Municipal del Cantón de Turrialba o, a quienes ocupen esos cargos, el cumplimiento INMEDIATO de la sentencia N° 2020-015125 de las 09:15 hrs. del 14 de agosto de 2020, bajo la advertencia de testimoniar piezas al Ministerio Público conforme lo dispuesto en el artículo 71 de la Ley de la Jurisdicción Constitucional.
