Document Review Decision No. 2021012521 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine forty-five on uno de junio de dos mil veintiuno.
Request for an extension of time filed by Mario Rodríguez Vargas, in his capacity as Executive Director of the CONSEJO NACIONAL DE VIALIDAD (CONAVI).
Findings of Fact:
(five million nine hundred sixty-four thousand eight hundred thirty-four dollars and 40/100), an amount that, according to the technical studies prepared by the Implementing Unit (Unidad Ejecutora), is excessive. Indeed, the amount estimated in the technical analyses as proportionate and reasonable for the construction of the wildlife crossings (pasos de fauna) is approximately $3,851,653.00 (three million eight hundred fifty-one thousand six hundred fifty-three thousand dollars and 00/100). From that perspective, during the internal discussion of the matter by the RN32 Implementing Unit team, it was determined that (under the current circumstances and taking into account the cost structure submitted by CHEC for the construction of those civil works), the most advisable course for the Administration is to consider the possibility of resorting to the provisions of Article 25 of the Ley que Aprueba financiamiento al proyecto rehabilitación y extensión de la Ruta Nacional N° 32 sección cruce ruta 4-Limón, N°9293, so that the engagement of a third party to construct the wildlife crossings may be considered.
(…) As a consequence of the proposed solution, the time required to construct the wildlife crossings cannot be estimated at three months, but is considerably longer: the funds to finance these works must be secured; the procurement process (proceso de contratación) for the company that will construct the works must then be conducted; and the execution or construction stage must subsequently be carried out. Regarding budgetary resources, the Administration will need to obtain the funds required to construct the wildlife crossings. It should be noted that the request submitted to the Instituto Costarricense de Acueductos y Alcantarillados for reimbursement of the funds invested in the project for the relocation of the sewer system (which was discussed in the report issued by this RN-32 Implementing Unit in response to the amparo proceeding (Recurso de Amparo)) has not produced the expected results.
Therefore, arrangements must be made to obtain the approximately $3,851,653.00 (three million eight hundred fifty-one thousand six hundred fifty-three thousand United States dollars) estimated for the construction of the wildlife crossings. This process for obtaining the budgetary resources has been estimated to take at least seven months, taking into account the fiscal situation facing the country. Likewise, pursuant to the regulations established in the Ley de Contratación Administrativa and its Reglamento, the procurement procedure must be conducted through a Public Tender (Licitación Pública), subject to its rules, time limits, and principles, and will consequently take at least eleven months from the determination of the administrative need to contract and the preparation of tender specifications (cartel) containing suitably drafted technical requirements, through—if applicable—the appeal process (régimen recursivo) against the award decision; approval (refrendo) by the Contraloría General de la República; and construction of the works.
In addition, the period for executing the works, based on the technical schedule prepared for that purpose, was determined to be twenty-one months. As indicated in the preceding paragraphs, a total of thirty-nine months is required to complete construction of the wildlife crossings, meaning that the probable completion date for the works would be 27 de agosto del 2024 (…) the Administration has undertaken the technical measures necessary to ensure construction of the wildlife crossings by conducting studies intended to provide technical justification for their placement at specific points in the project; supplementary scientific studies are currently being prepared; and warning signs have been installed as a mitigation measure (medida de mitigación) intended to ensure the future continuity of the construction and placement of those structural elements, as well as to protect the biodiversity of the site within the project area.
Because of their technical specifications and characteristics in terms of number and both topographical and structural conditions, the wildlife crossings were ordered by the environmental authorities as an environmental-impact mitigation measure (obra de mitigación de impactos ambientales), long after the Costa Rican State signed the contract with the contractor China Harbour Engineering Company (CHEC). Although the contract stipulated that environmental studies were to be conducted at the project site, the contractual instrument did not provide for the construction of wildlife crossings precisely because, when the contract was signed (2013), they were not commonly used as a mechanism for mitigating environmental impacts. In response to the inquiry submitted to CHEC, the company provided a construction cost for the wildlife crossings of $5,964,834.40. (five million nine hundred sixty-four thousand eight hundred thirty-four dollars and 40/100), an amount that, according to the technical studies prepared by the Implementing Unit, is excessive.
In that context, the Administration is considering the possibility of resorting to the provisions of Article 25 of the Ley que Aprueba financiamiento al proyecto rehabilitación y extensión de la Ruta Nacional N° 32 sección cruce ruta 4-Limón, N°9293, so that the engagement of a third party to construct the wildlife crossings may be considered. The foregoing situation makes it necessary for Conavi to secure financing for the approximately $3,851,653.00 (three million eight hundred fifty-one thousand six hundred fifty-three thousand dollars) estimated for the construction of the wildlife crossings. Thereafter, pursuant to the regulations established in the Ley de Contratación Administrativa and its Reglamento, the procurement procedure must be conducted through a Public Tender, subject to its rules, time limits, and principles, from the determination of the administrative need to contract through construction of the works.
In total, according to the planning prepared by the technical team of the Ruta 32 Implementing Unit, thirty-nine months will be required to complete construction of the wildlife crossings, that is, by 27 de agosto del 2024, taking into account that—as that Chamber is aware—the construction of all civil works is subject to unforeseen events that may affect the development of the project or projects to be carried out, concerning which the Court will be kept informed through semiannual reports. (...) In light of the foregoing and the evidence submitted with this report, an extension of thirty-nine (39) months is requested to complete construction of the wildlife crossings in Dirección02, by 27 de agosto del 2024, taking into account that—as that Chamber is aware—the construction of any civil works is subject to unforeseen events that may affect the development of the project or projects to be carried out. The Constitutional Court will be kept informed of progress through semiannual reports. (...)”.
Justice Araya García writes the opinion; and,
Considering:
I.By judgment No. 2021-001189 at 09:15 hours on 22 de enero de 2021, this Chamber ruled as follows: “(…) The appeal is partially granted, solely against CONAVI. Mario Rodríguez Vargas, in his capacity as Executive Director of the Consejo Nacional de Vialidad (CONAVI), or whoever holds that office, is ordered to take the appropriate measures so that, within THREE MONTHS from notification of this judgment, the wildlife crossings (pasos de fauna) are constructed and opened on the sections of National Route No. 32 that have already been affected by the project to rehabilitate and widen that roadway. He is likewise ordered to make the necessary arrangements so that, within the same period, the construction of the remaining wildlife crossings on the sections of the same route that will soon be affected is designed and planned in the manner prescribed by SETENA and, in due course, duly carried out. (…)”
II.Regarding the request for an extension of time. In this case, the Chamber notes that the authorities of the Consejo Nacional de Vialidad request an extension of the three-month period granted in judgment No. 2021-001189 at 09:15 hours on 22 de enero de 2021, for budgetary reasons, because the resources needed to finance construction of the wildlife crossings must be secured; furthermore, the process of contracting the company that will construct those works must be conducted, after which the execution or construction stage must be carried out.
First, it is important to note that judgment No. 2021-001189 at 09:15 hours on 22 de enero de 2021 was served on the respondent authority on 25 de enero de 2021. It granted a three-month period for compliance, which expired on 25 de abril de 2021.
In this regard, it should be emphasized that the evidence submitted in the record and the report rendered under oath establish that the authority involved has undertaken various actions to comply with this Chamber’s order. The record shows that the following actions have been carried out: a) the relevant studies were performed, determining the location, number, and characteristics of the wildlife-crossing points; b) efforts were made to obtain support from current scientific information for locating or relocating the wildlife-crossing points; c) the establishment of the Technical Committee to study the wildlife-crossing points was finalized and formalized, and, based on the study “Verification of Environmental Measures to reduce the presence of wildlife in the widening of National Highway Route 32 Limón, Costa Rica. 2016.”, nine possible locations for wildlife crossings were identified; d) in marzo de 2021, one of the study’s proposed measures was implemented as a mitigation measure (medida de mitigación) while the wildlife crossings are constructed; e) warning signs regarding the presence of wildlife were installed along the highway, at distances of 200 to 300 meters from areas with a history of wildlife collisions, for a total of 38 signs.
Notwithstanding the foregoing, although it has been established that the respondent authority has undertaken actions aimed at complying with the order, the fact remains that the works completed to date have not been sufficient to fully comply with this Chamber’s order in the aforementioned judgment. Nevertheless, this Court understands the circumstances surrounding the development and construction of the works in question and therefore finds acceptable the explanations for CONAVI’s delay in complying with the order.
It should be clarified that, in this particular case, based on the technical report submitted by the respondent authority, which requests a thirty-nine-month period, this Court finds it appropriate to extend the period granted for a maximum of thirty-six months. During that period, reports must be submitted to this Chamber every six months concerning the actions undertaken, in order to demonstrate full compliance with the order.
In view of the foregoing, it is appropriate to extend the period for compliance with the order issued in judgment No. 2021-001189 at 09:15 hours on 22 de enero de 2021.
III.Documentation submitted to the case file. The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced through new technologies, these must be retrieved from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of 22 de agosto de 2011, article XXVI, and published in Boletín Judicial number 19 of 26 de enero de 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 de mayo de 2012, article LXXXI.
Por tanto:
Mario Rodríguez Vargas, in his capacity as Executive Director of the Consejo Nacional de Vialidad, or whoever holds that office in his stead, is granted a non-extendable period of THIRTY-SIX MONTHS from notification of this ruling to faithfully comply with the provisions of judgment No. 2021-001189 at 09:15 hours on 22 de enero de 2021, with the warning that compliance reports must be submitted to this Court every six months, setting forth the actions demonstrating full compliance with this Chamber’s order in the aforementioned judgment. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas cuarenta y cinco minutos del uno de junio de dos mil veintiuno .
Solicitud de ampliación de plazo interpuesta por Mario Rodríguez Vargas, en su condición de director ejecutivo del CONSEJO NACIONAL DE VIALIDAD (CONAVI).
Resultando:
Redacta el Magistrado Araya García; y,
Considerando:
I.Mediante la sentencia No. 2021-001189 de las 09:15 horas del 22 de enero de 2021, esta Sala resolvió lo siguiente: “(…) Se declara parcialmente con lugar el recurso, únicamente contra el CONAVI. Se ordena a Mario Rodríguez Vargas, en condición de Director Ejecutivo del Consejo Nacional de Vialidad (CONAVI), o a quien ejerza tal cargo, tomar las medidas correspondientes para que en el plazo de TRES MESES, contado a partir de la notificación de esta sentencia, se construyan y habiliten los pasos de fauna en los tramos de la Ruta Nacional No. 32 que ya fueron intervenidos en el proyecto de rehabilitación y ampliación de esa vía. Asimismo, que disponga lo correspondiente para que, en el mismo plazo, se diseñe y planifique la construcción de los demás pasos de fauna en los tramos de la misma ruta que serán intervenidos próximamente, de la forma en que lo ha previsto SETENA, y, en su momento, se ejecute su debida construcción. (…)”
II.Sobre la solicitud de ampliación del plazo. En la especie, la Sala observa que las autoridades del Consejo Nacional de Vialidad solicitan una ampliación del plazo de tres meses concedido en la sentencia No. 2021-001189 de las 09:15 horas del 22 de enero de 2021, ello por motivos de presupuesto, ya que deben gestionarse los recursos para financiar la construcción de los pasos de fauna, además, debe realizarse el proceso de contratación de la empresa que construya dichas obras y, posteriormente, debe llevarse a cabo la etapa de ejecución o construcción de estas.
En primer lugar, es importante denotar que la sentencia No. 2021-001189 de las 09:15 horas del 22 de enero de 2021 fue notificada a la autoridad recurrida el 25 de enero de 2021, en la cual se concedió un plazo de tres meses para el cumplimiento de esta, el cual venció el 25 de abril de 2021.
Sobre el particular, cabe resaltar que, de las pruebas aportadas en autos, y el informe rendido bajo juramento, se constata que la autoridad involucrada ha llevado a cabo diversas actuaciones, en aras de acatar lo ordenado por esta Sala. En ese sentido consta que se han llevado a cabo las siguientes acciones: a) se realizaron los estudios pertinentes que generaron la ubicación, el número y las características de los puntos de pasos de fauna; b) se efectuó la búsqueda del apoyo de información científica actualizada para ubicar o reubicar los puntos de fauna; c) se concretó y formalizó la conformación del Comité Técnico para el estudio de los puntos de fauna, la cual, con base en el estudio “Verificación de Medidas Ambientales para disminuir la presencia de fauna silvestre en la ampliación de la Carretera Nacional Ruta 32 Limón, Costa Rica. 2016.”, se ubicaron nueve puntos para la posible ubicación de pasos de fauna; d) en marzo de 2021, se ejecutó uno de sus productos del estudio con la implementación de una medida de mitigación, en el tanto se construyen los pasos de fauna; e) se colocaron de rótulos de advertencia de la presencia de fauna a lo largo de la carretera, a distancias de 200 a 300 metros de las zonas de atropellos históricos un total de 38 señales.
A pesar de lo anterior, y si bien se tiene por acreditado que la autoridad recurrida ha llevado a cabo acciones en aras de dar cumplimiento a lo ordenado, lo cierto es que las obras ejecutadas, a la fecha, no han sido suficientes para dar cabal cumplimiento con lo ordenado por esta Sala en la sentencia supra indicada; no obstante, este Tribunal entiende el entorno que conlleva el desarrollo y construcción de las obras en cuestión, por lo que se estima que las justificaciones respecto de la demora en la que ha incurrido el CONAVI para cumplir lo ordenado son de recibo por esta Sala.
Cabe aclarar que, en el caso particular, con base en el informe técnico aportado por la autoridad recurrida, donde se solicita una plazo de treinta y nueve meses, este Tribunal estima que lo procedente es ampliar el plazo otorgado por un plazo máximo de treinta y seis meses, siendo que durante dicho plazo deberán informar, de manera semestral, a esta Sala las acciones que vayan realizando durante dicho periodo a efectos de acreditar el pleno cumplimiento a lo ordenado.
En virtud de lo anterior, lo procedente es ampliar el plazo, para el cumplimiento de lo ordenado en la sentencia No. 2021-001189 de las 09:15 horas del 22 de enero de 2021.
III.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 de 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 de 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
Por tanto:
Se le confiere a Mario Rodríguez Vargas, en su condición de director ejecutivo del Consejo Nacional de Vialidad, o a quien en su lugar ocupe dicho cargo, un plazo improrrogable de TREINTA Y SEIS MESES, contado a partir de la notificación de la presente resolución, para dar fiel cumplimiento a lo dispuesto en la sentencia No. 2021-001189 de las 09:15 horas del 22 de enero de 2021, bajo el apercibimiento de que deberán remitir informes semestrales de cumplimiento a este Tribunal, en los que consten las acciones que acrediten el pleno cumplimiento a lo ordenado por esta Sala en la sentencia supra indicada.
