Decision No. 2021012104 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at eight thirty a.m. on the twenty-eighth day of May, two thousand twenty-one.

Amparo action (recurso de amparo) processed under case number 21-006582-0007-CO, filed by Nombre01, identity card CED01, against the JUNTA DE ADMINISTRACIÓN PORTUARIA Y DE DESARROLLO ECONÓMICO DE LA VERTIENTE ATLÁNTICA DE COSTA RICA (JAPDEVA).

Background 1. In a written submission received by the Chamber’s Clerk’s Office on 05 de abril de 2021, the petitioner filed an amparo action against JAPDEVA, stating that he is the president of the Asociación de Desarrollo para la Ecología. He states that on 6 de febrero de 2021, he sent an email to the address ...01, attaching official letter No. AEL-0015-2021, addressed to the Executive President of JAPDEVA, in which he requested: “1. A written report on the legal status of all tugboats currently used for berthing operations, specifying how many of them have current insurance coverage, the renewal date, and the responsible official. 2. A complete copy of all insurance policies for the port equipment, specifying the name of the equipment, the date and processing number under which it was handled, and the license number, if any”; however, he alleges that the statutory period has already elapsed and the respondent authority has not addressed his request.

He emphasizes that his request is related to a potential fuel spill from the tugboat called “don Nombre02,” which lies in the depths of Limón Bay, endangering the aquatic fauna and flora extending from the Central Canton of Limón toward the Southern Caribbean. He explains that the Parque Nacional de Cahuita and the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo are located in the Southern Caribbean Region, toward which the tide flows, and that these are nesting areas for several species of sea turtles, manatees, crocodiles, caimans, and unique coral reefs. Based on the foregoing, he considers that his fundamental rights and those of the environment have been violated.

2. Andrea Centeno Rodríguez, in her capacity as Executive President of JAPDEVA, reports under oath that “official letter AEL-0015-2021, referred to above, was received at my institutional email address and that of the Port Manager; accordingly, through a communication from the Office of the Presidency sent by the Secretary, he was informed of the official who would follow up on his inquiries, not only those raised in this email, but also the various documents he was sending, including via WhatsApp to personal telephone numbers, which included offers from service providers, press releases, and personal messages. He was informed of the proper channel and the person to contact. We must clearly state that, in any event, the appropriate means for submitting any request for information is directly at the offices of the Executive Presidency of JAPDEVA, located at Dirección01 in downtown Limón, or at the document reception office located at the pedestrian entrance to the aforementioned port; email itself is not the appropriate means.

We must inform the Court that the record does show that the petitioner submitted requests in febrero del 2021 by means of official letter AEL-020-2021 and that, on 11 de febrero, on my instructions, he was provided with the following response: I hereby forward acknowledgment of receipt of official letter AEL-0020-2021, and I appreciate your sending it to me by this means so that a record may be kept of the documentation received, because Nombre03’s cell phone is not a formal channel.” “Thank you for your cooperation in sending the names of specialists requested in the previous email. Due to a minor change in Nombre04’s schedule, the meeting on lunes 15 de febrero del presente año is being scheduled for 4:00 p.m.” “Thank you for sending the acknowledgment of receipt.” A formal copy of the specific email is submitted in connection with the foregoing. We must also clarify that, as part of attending to the petitioner, who expanded on the matter by referring to the work of the entity he represents, types of procedures, and concerns, a virtual meeting via Teams was scheduled for 15 de febrero del 2021, a format used to avoid contact because of the pandemic we are currently experiencing.

Subsequently, in an email dated 26 de febrero del 2021, the petitioner sent a new message addressed to the Port Manager, in which he requested a copy of ‘the progress regarding the sunken tugboat,’ which makes it clear not only that he had already been provided with information and that his requests had been addressed, but also that constant, fluid, transparent, and good-faith communication was being maintained regarding the matter of interest to the petitioner. Having reviewed that communication from the petitioner, we place on record that, on 22 de marzo del 2021, as part of the information sent to the petitioner, Port Manager Eng. Jheynold Lunan Williams provided Nombre05 with a comprehensive and effective response by email, stating as follows: ‘Good afternoon, dear Nombre06:’ ‘In the following lines, I am sending you a status report on the actions taken concerning the incident involving the tugboat Nombre02:’ ‘On 5 de febrero del 2021, the Tugboat Don Nombre02 sank at coordinates L10°01’18.6N – Lon 083°04’56.27W. in the access channel of the Moín port complex.

The presence of this tugboat has made it necessary to change the inbound course by using the former access channel that was used before the TCM began operations; however, we have not experienced any significant impact on the entry of vessels into the complex.’ ‘I will now describe the actions taken:’ ‘- Measurement of coordinates, tides, and depth for the issuance of an official notice by the maritime port authority. - Placement of buoys identifying the location of the tugboat Nombre02. - Relocation of buoy 6 in the access channel to widen access to the TCM. - Coordination with MOPT and performance of a bathymetric survey (batimetría). Based on this, the APM and JAPDEVA pilots have determined that conditions exist for berthing and unberthing maneuvers by vessels with drafts of no more than 12 metros. - Environmental monitoring: three daily inspections have been established and are conducted each day together with SINAC/MOPT/Guardacostas at the site of the incident to monitor potential fuel and oil spills.

No spills have been detected to date, only minor traces near the buoys. - Monitoring and photographic records are carried out three times a day with support from Guardacostas. - Together with RECOPE, inter-institutional coordination has been completed so that, if a spill occurs, the response time for deploying barriers, carrying out surface extraction, and securing the site does not exceed one hour. This is being maintained while the following is completed: - Coordination process with specialist companies for the underwater removal of fuel and oil to prevent a spill. - Coordination with authorities to secure budgetary resources. MOPT-CNC-JAPDEVA.’ ‘The process is divided into two parts:’ ‘1- Extraction of fuel and oil.’ ‘2- Removal of the tugboat and placement in a safe area outside the channel.’ ‘The budgetary issue is one of the factors that has delayed the process. Nevertheless, through the efforts we have made, in which MOPT has played an important role, we are close to obtaining the resources needed to complete the project under the conditions established in the terms of reference.’ ‘That is our progress for the time being; we will update you in a timely manner when we move to the next stage.’ As can be seen, we have demonstrated that he was subsequently provided with the requested information, that his requests were expressly addressed, and that he has been kept informed of what occurred and of the steps to be taken to resolve the matter.

It is NOT true that there was any refusal to provide him with information; on the contrary, it should be noted that the information was provided even well before this action was filed, making it incomprehensible that Nombre05 filed this amparo action against us. It should be noted that, with respect to the request for copies of all insurance policies for the port equipment and current navigation certificates, I wish to state that the Port Management Office has been instructed to consult the corresponding Department and to formally clarify the matter for Mr. Nombre05, given his assertion that he has not received that information. SECOND: It is partially true. It should be noted, however, that what the petitioner refers to is an official letter sent to the Capitanía de Puerto, which I do not represent. If the petitioner submitted a request to that Capitanía and did not receive a response, that is a matter for him to assess in determining which authority to approach; however, there is not and cannot be any failure on our part due to a lack of response when the official letter was not addressed to the entity I represent.

THIRD: It is not true. First, we must reiterate that what the petitioner refers to is an official letter sent to the Capitanía de Puerto and that I do not represent the Capitanía de Puerto. If the petitioner submitted a request to that Capitanía and did not receive a response, that is a matter for him to assess in determining which authority to approach; however, there is not and cannot be any failure on our part due to a lack of response when the official letter was not addressed to the entity I represent. We have no connection with that communication and lack standing (legitimación) to provide that response. We have demonstrated that Mr. Nombre06 has been kept informed of what occurred and that virtual meetings with him have even been scheduled. We believe that he could have used those channels to submit any requests he considered appropriate, since there is an active and direct channel of communication between him and the entity I represent, and he has been kept informed.

It has been demonstrated that he has been kept informed and that direct communication has existed since February. We further state that it is not true that the entity I represent failed to take the appropriate measures following the sinking of the tugboat ‘Don Nombre02.’ On the contrary, despite the institution’s difficult financial situation, it has acted responsibly and undertaken various measures, including those specified under Fact One. Additional steps were also taken to address the sinking and prevent further damage or effects, and we submit copies of the requests for quotations that were made, such as the request to ‘SERPORT,’ since recovering the tugboat is not a simple matter and the country does not have the necessary equipment to provide a definitive solution for this type of casualty. FOURTH: It is not true. Mr. Nombre05 has been provided with the requested responses regarding this matter.

It is not true that he failed to receive a timely response, since, apart from the request alleged herein, he subsequently submitted additional communications by email, which were processed and answered in a timely and detailed manner, as stated above and as demonstrated by the documentary evidence submitted with this filing.” She requests that the action be dismissed.

3. On 18 de marzo de 2021, the petitioner addressed the report of the Executive Presidency of JAPDEVA. He alleged that the respondent submitted the report after the applicable deadline. He also states that it did not see fit to provide copies of the insurance policies for the equipment and tugboats. He addressed the merits of the reports. He requests that the action be granted.

4. The statutory requirements have been observed in the proceedings conducted.

Justice Garro Vargas drafts the decision; and,

Considering:

I.Subject matter of the action. The appellant alleges a violation of his fundamental rights (derechos fundamentales), stating that on 06 de febrero de 2021, he sent an email to the electronic address ...01, attaching official letter Nº AEL-OO15-2021, addressed to the Executive President of JAPDEVA, in which he requested: “1. A written report on the legal status of all tugboats currently used for berthing operations, specifying how many of them have current insurance coverage, the renewal date, and the responsible official. 2. A complete copy of all insurance policies for the port equipment, specifying the name of the equipment, the date and processing reference number, and the license number, if any”; however, he alleges that the period established by law has already elapsed and the respondent authority has not addressed his request.

II.Proven facts. For purposes of deciding this matter, the following facts are deemed duly established, either because they have been substantiated or because the respondent failed to address them as ordered in the initial ruling:

  • a)On 06 de febrero de 2021, the appellant sent an email to the electronic address ...01, attaching official letter Nº AEL-OO15-2021, addressed to the Executive President of JAPDEVA, in which he requested: “1. A written report on the legal status of all tugboats currently used for berthing operations, specifying how many of them have current insurance coverage, the renewal date, and the responsible official. 2. A complete copy of all insurance policies for the port equipment, specifying the name of the equipment, the date and processing reference number, and the license number, if any” (undisputed fact).
  • b)The email address ...01 is not an official channel through which JAPDEVA receives submissions from members of the public (administrados) (see the report).
  • c)The channels provided by JAPDEVA for submitting any request for information are the Executive Presidency or the document reception office located at the pedestrian entrance (see the report).
  • d)On 22 de marzo de 2021, the Port Manager of JAPDEVA provided the appellant with an extensive response (sent to the email address ...02), in the following terms: “Good afternoon, dear Nombre06: In the following lines, I am sending you an update on the actions taken concerning the incident involving the tugboat Nombre02:” “On 5 de febrero del 2021, the tugboat Don Nombre02 sank at coordinates L10°01’18.6N – Lon 083°04’56.27W. in the access channel to the Moín port complex. The presence of this tugboat has made it necessary to change the inbound course by using the former access channel that existed before the TCM began operations; however, there has been no significant disruption to vessels entering the complex.” “I will now detail the actions taken: “- Measurement of coordinates, tides, and depth so that the maritime port authority may issue an official notice. - Placement of buoys identifying the location of the tugboat Nombre02. - Relocation of buoy 6 in the access channel to widen access to the TCM. - Coordination with MOPT and completion of a bathymetric survey (batimetría).

Based on this, the APM and JAPDEVA pilots have determined that conditions permit berthing and unberthing maneuvers for vessels with drafts of up to 12 metros máximo. - Environmental monitoring: three inspections per day have been conducted jointly with SINAC/MOPT/Guardacostas at the site of the incident to monitor potential fuel and oil spills. To date, no spills have been detected, only small traces near the buoys. - Monitoring and photographic records are carried out three times a day with support from Guardacostas. - Interinstitutional coordination with RECOPE has been completed so that, should a spill occur, the response time will not exceed one hour for the placement of containment barriers, surface extraction, and securing of the site. This is while the (sic) - Coordination process with specialist companies for the underwater removal of fuel and oil to prevent a spill. Coordination with authorities to secure funding.

MOPT-CNC-JAPDEVA.” “The process is divided into two parts: “1- Extraction of fuel and oil.” “2- Removal of the tugboat and placement in a safe area outside the channel.” “Funding is one of the factors that has delayed the process. Nevertheless, through our efforts, in which MOPT has played an important role, we are close to obtaining the resources needed to complete the project under the conditions established in the terms of reference.” “For the time being, this is the progress made; we will provide timely updates when we move to the next stage” (see the report).

III. Unproven facts. The following facts relevant to this decision are not deemed established

  • a)That JAPDEVA provided a response and the information requested by the appellant in official letter No. AEL-0015-2021.
  • b)That JAPDEVA has established an electronic channel through which members of the public may submit petitions or requests for information.

IV.Regarding the specific case. After analyzing the report and the evidence submitted by the parties, this Chamber finds that the appellant’s fundamental rights were violated, for the reasons set forth below. First, it should be noted that the relief sought in this constitutional relief proceeding (recurso de amparo) is an order “to resolve the specific request for information submitted.” Having clarified the foregoing, it has been established that on 06 de febrero de 2021, the appellant sent an email to the address ...01, attaching official letter (oficio) Nº AEL-OO15-2021, addressed to the Executive President of JAPDEVA, in which he requested: “1. A written report on the legal status of all tugboats currently used for berthing operations, specifying how many of them have current insurance coverage, the renewal date, and the responsible official. 2. A complete copy of all insurance policies for the port equipment, specifying the name of the equipment, the date and request number under which it was processed, and the license number, if any.” The report submitted confirms that the email address ...01 is not an official channel for receiving submissions from members of the public (administrados) by JAPDEVA.

This Chamber, when analyzing whether or not a submission sent by email is admissible, has stated as a general rule that it must be sent to an official account. However, it has also recognized the validity of straightforward requests for information sent through unofficial email addresses when receipt has been acknowledged or when the requests have been processed. Accordingly, two relevant matters emerge from the report: JAPDEVA does not have an electronic channel or email account for receiving submissions from members of the public, and “official letter AEL-0015-2021 was received at my institutional email address and that of the Port Manager; therefore, through a communication from the Office of the Presidency sent by the Secretary, he was informed of the official who would follow up on his inquiries.” The first of these assertions is inadmissible, since this Constitutional Chamber has held that “members of the public have a right to access and interact electronically with Public Administrations.

In this regard, it should be recalled that public administrations have an obligation to transform or adapt their functions, organization, operating methods, and means of interacting with members of the public to the new demands of technological reality. In this connection, this Court has addressed the advancement of technologies and their impact on public administrations” (see judgment No. 2018-18339 at 09:20 hrs. on 02 de noviembre de 2018). Furthermore, in judgment No. 2018-17353 at 09:30 hrs. on 19 de octubre de 2018, this Chamber stated that “(… ) Public administrations have an obligation to transform or adapt their functions, organization, operating methods, and means of interacting with members of the public to the new demands of technological reality. In this connection, this Court has addressed the advancement of technologies and their impact on public administrations as follows: ‘Regarding this last point, it must be said that the advances of the past twenty years in information and communication technologies (ICTs) have revolutionized the social environment of human beings.

It may be stated without fear of error that these technologies have affected the way human beings communicate, facilitating connections among people and institutions worldwide and eliminating barriers of space and time. At present, access to these technologies has become a basic instrument for facilitating the exercise of fundamental rights such as democratic participation (electronic democracy) and citizen oversight, education, freedom of expression and thought, access to information and online public services, the right to interact electronically with public authorities, and administrative transparency, among others’ (see judgment No. 2010-12790 at 08:58 hrs. on 30 de julio de 2010).” In the cited judgment, the Chamber unanimously held that a Municipality’s lack of an email address or other means of interacting with the Public Administration constituted a violation of fundamental rights: “Accordingly, as stated supra, the absence of an email address or other electronic means of interacting with the Public Administration is contrary to the appellant’s fundamental rights and is also contrary to the principles of efficiency and effectiveness that must govern the operation of Public Administrations.” Likewise, taking into account that fundamental rights are not absolute, it may be concluded that, for the exercise of the right to petition and receive a prompt response through the means made available by new technologies, it is important for the request to be submitted through a freely accessible website of the public entity or body.

Additionally, that electronic domain must contain a hyperlink directing users to an email address specifically designated to receive requests, whether concerning a particular subject or serving as a mailbox for submissions of all kinds (see, to that effect, among others, Judgment No.2020-008546 at 09:20 on 8 de mayo de 2020). Therefore, stating that requests for information or petitions may be submitted only in physical form, without providing an email address for receiving submissions from members of the public, is contrary to their rights. It follows from the foregoing that every public institution must have official electronic channels, such as a designated email address, for receiving submissions and petitions from members of the public and any interested party. Institutions are therefore obligated to address and promptly respond to all submissions made through such channels, thereby guaranteeing the right of petition established in article 27 of the Constitución Política.

Accordingly, JAPDEVA must be ordered to take the appropriate measures to implement electronic interaction channels through which persons may submit matters virtually. On the other hand, it is apparent that JADPEVA was indeed aware of the submission at issue in this constitutional relief proceeding, to such an extent that it processed it accordingly. Thus, the submission made by email is valid and may be considered on its merits by this Constitutional Court. Nevertheless, the report of the Executive President of JAPDEVA does not conclusively establish that the appellant was provided with the response and information requested in official letter No. AEL-OO15-2021, as applicable. This is so even though the statutory period has long since expired. Consequently, the petition is granted.

V.Separate reasons of Justice Castillo Víquez. On repeated occasions, I have dissented on the grounds that, if the submission whose lack of response is challenged was not sent to an official channel, the administration is not required to respond to it, and this does not violate the appellant’s rights. In this particular case, however, I would grant relief because the respondent authority has not provided any digital channel for receiving submissions from members of the public, which does violate the protected party’s fundamental rights, for the reasons set forth in the judgment. Accordingly, it is solely on the basis of that reasoning that I concur in granting this constitutional relief proceeding.

VI.Documentation submitted to the case file (expediente). This Chamber must advise the parties that, if they have submitted any paper documents, as well as objects or evidence stored on any additional device or on electronic, computer, magnetic, optical, telematic, or new-technology media, these must be collected from the Clerk’s Office within 30 business days after receipt of notice of this judgment; otherwise, all such materials will be destroyed in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of 22 de agosto del 2011, article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 de mayo del 2012, article LXXXI.

Por tanto:

The petition is granted. Andrea Centeno Rodríguez, in her capacity as Executive President of the Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica, or whoever holds that office in her stead, is ordered, within the scope of her authority, to issue the necessary instructions so that: 1) Within DIEZ DÍAS from notice of this judgment, the response and information requested in official letter No. AEL-0015-2021, except for information of a confidential nature, are provided to the email address designated by the appellant for receiving notices. 2) Within a maximum period of SEIS MESES from notice of this judgment, that agency has the necessary conditions in place and enables an electronic channel for receiving petitions or requests for information. The respondent authority is warned that failure to comply with this order will constitute the offense of disobedience and that, pursuant to article 71 of the Ley de esta jurisdicción, any person who receives an order issued in a constitutional relief proceeding that he or she is required to comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las ocho horas treinta minutos del veintiocho de mayo de dos mil veintiuno .

Recurso de amparo que se tramita en expediente número 21-006582-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra la JUNTA DE ADMINISTRACIÓN PORTUARIA Y DE DESARROLLO ECONÓMICO DE LA VERTIENTE ATLÁNTICA DE COSTA RICA (JAPDEVA).

Resultando

1. Por escrito recibido en la Secretaría de la Sala el 05 de abril de 2021, la parte recurrente interpone recurso de amparo contra JAPDEVA, y manifiesta que es el presidente de la Asociación de Desarrollo para la Ecología. Manifiesta que el 6 de febrero de 2021, envió un correo a la dirección electrónica ...01, en el cual adjuntó el oficio Nº AEL-0015-2021, dirigido a la Presidenta Ejecutiva de JAPDEVA, en el que solicitó: “1. Informe escrito sobre la situación legal de todos los remolcadores que se utilizan actualmente para las labores de atraque, estableciendo en cuántos de ellos se encuentran los seguros vigentes, fecha de renovación y funcionario responsable. 2. Facilitar copia integral de todos los seguros de los equipos portuarios, detallar nombre del equipo, fecha y número de gestión donde se tramitó, número de licencia en caso que exista”; sin embargo, acusa que ya transcurrió el plazo establecido por ley, y la autoridad recurrida no ha atendido su gestión.

Destaca que su gestión se debe a un potencial derrame de combustible del remolcador denominado "don Nombre02", el cual se encuentra en las profundidades de la bahía de Limón, poniendo en riesgo la fauna y flora acuática que se extiende del Cantón Central de Limón hacía el Caribe Sur. Detalla que en la Región del Caribe Sur, hacia donde fluye la marea, se ubica el Parque Nacional de Cahuita y el Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, áreas de anidación de varias especies de tortugas marinas, manatíes, cocodrilos, caimanes y arrecifes coralinos únicos. Por lo expuesto, considera lesionados sus derechos fundamentales y los del medio ambiente.

2. Informa bajo juramento Andrea Centeno Rodríguez, en su condición de Presidenta Ejecutiva de JAPDEVA, que “se recibió el oficio AEL-0015-2021 señalado a mi correo institucional y al del Gerente Portuario por lo que mediante comunicación del Despacho de la Presidencia por la Secretaria, se le indicó el funcionario que daría seguimiento a sus consultas, no sólo las planteadas en este correo sino a los diferentes documentos que además estaba enviando incluyendo vía Whatsapp a los teléfonos personales incluyendo ofertas de proveedores de servicios, notas de prensa y mensajes de carácter personal. Se le indicó el medio correcto y la persona con quien comunicarse. Debemos señalar de forma clara que en todo caso el medio idóneo para presentar cualquier solicitud de información es de forma directa en las oficinas de Presidencia Ejecutiva de JAPDEVA ubicada en la Dirección01 en Limón Centro, o bien en recepción de documentos ubicado en el acceso peatonal del mismo puerto precitado, el correo en sí no es el medio idóneo.

Debemos hacer de su conocimiento que si consta que el recurrente realizó gestiones en el mes de febrero del 2021 mediante oficio AEL-020-2021, y en fecha 11 de febrero, por instrucciones de la suscrita se le da respuesta indicándole lo siguiente: Me permito remitir el acuso recibido del oficio AEL-0020-2021 y agradezco que me remita por esta vía para llevar un registro de la documentación recibida, debido a que el celular de Nombre03 no es una vía formal.” “Agradezco la colaboración con el envío de los nombres de especialista, solicitado en el correo anterior. Por un pequeño cambio en la agenda de Nombre04 la reunión del lunes 15 de febrero del presente año, se está agendando a las 4:00 p.m..” “Agradezco su envío del recibido conforme”. De lo anterior se remite formal copia de Correo especifico. Debemos aclarar que además, como parte de la atención al recurrente quien amplió en el tema refiriéndose al trabajo de su representada, tipos de procedimientos y preocupaciones, se programó reunión virtual en modalidad Teams para el 15 de febrero del 2021, modalidad utilizada por un tema de evitar contacto por el tema de pandemia que actualmente vivimos.

Posteriormente, mediante correo de fecha 26 de febrero del 2021 el recurrente envía nuevo correo dirigido al señor Gerente Portuario, en el cual solicita copia de “los avances en el asunto del remolcador hundido”, lo cual deja claro que no solo ya se le había dado información y atendido sus gestiones, sino que además se mantenía comunicación constante, fluida, transparente y de buena fe en el tema de interés del señor recurrente. Vista dicha Misiva del recurrente, hacemos constar que en fecha 22 de marzo del 2021 consta que, como parte de la información remitida al recurrente, el Señor Gerente Portuario Ing. Jheynold Lunan Williams, da una amplia respuesta efectiva por la vía del correo al recurrente Nombre05, en el cual le manifiesta lo siguiente: “Buenas tardes estimado Nombre06: “Mediante las siguientes líneas le envío un estado de lo actuado en cuanto a los concerniente al incidente con el remolcador Nombre02:” “El pasado 5 de febrero del 2021 ocurrió el hundimiento del Remolcador Don Nombre02 en las coordenadas L10°01’18.6N – Lon 083°04’56.27W. del canal de acceso del complejo portuario de Moín.

La presencia de dicho remolcador ha ocasionado la necesidad de cambiar el rumbo de ingreso utilizando el antiguo canal de acceso antes del inicio en operación de la TCM, sin embargo no hemos tenido afectación significativa en la entrada de los buques que ingresan al complejo.” “Procedo a detallar las acciones tomadas: “- Medición de coordenadas, mareas y profundidad para generar comunicado oficial por parte de la autoridad marítimo portuaria. - Colocación de boyas que identifiquen el punto de ubicación del remolcador Nombre02. - Reubicación de la boya 6 del canal de acceso para ampliar acceso a la TCM. - Coordinación con el MOPT y realización de batimetría. Con esto los prácticos de APM y JAPDEVA han determinado que existen condiciones para maniobras de atraque y desatraque de buques con calados de 12 metros máximo. - Vigilancia ambiental: diariamente se han establecido tres revisiones diarias en conjunto con SINAC/MOPT/Guardacostas en el sitio del acontecimiento para monitorear potenciales derrames de combustibles y aceites.

No se detectan derrames a la fecha solamente pequeños brotes cercanos a las boyas. - Se realizan monitoreos y registro fotográficos tres veces al día con apoyo de Guardacostas. - Junto con RECOPE se ha finalizado la coordinación interinstitucional de manera que de presentarse un derrame, el tiempo de acción no supere la hora para colocar barreras, realizar la extracción superficial y asegurar el sitio. Esto mientras finaliza la - Proceso de coordinación con empresas especialistas para remoción bajo el mar de combustibles y aceite para evitar derrame. - Coordinación con autoridades para consecución presupuestaria. MOPT-CNC-JAPDEVA.” “El proceso se divide en dos: “1- Extracción de combustibles y aceites.” “2- Remoción del remolcador y colocación en zona segura fuera del canal.” “El tema presupuestario es uno de los factores que ha atrasado el proceso. Sin embargo, por los esfuerzos que hemos realizado donde el MOPT ha sido un actor importante, estamos cerca de obtener los recursos para completar el proyecto bajo las condiciones que dicten los términos de referencia.” “Por el momento es lo que llevamos, estaremos actualizándolo en forma oportuna cuando pasemos a la siguiente etapa.” Como puede observarse, sí demostramos que al mismo se le ha dado la información solicitada posteriormente, se le ha atendido de forma expresa y se le ha mantenido informado de lo acontecido y de los pasos a seguir en la solución de dicho tema, NO es cierto que no se le haya querido brindar información, a contrario sensu, nótese que la misma se le brindó incluso mucho antes de haber presentado este recurso, por lo que es incomprensible que el Nombre05 haya presentado en nuestra contra el presente recurso de amparo.

Cabe señalar que con respecto a la solicitud de copia de todos los seguros de los equipos portuarios y certificados de navegación vigentes, me permito indica que se ha instruido a la Gerencia Portuaria a realizar la consulta al Departamento respectivo y aclarar vía formal al Sr. Nombre05 dado que manifiesta no ha recibido dicha información. SEGUNDO: Es parcialmente cierto. Sin embargo debe notarse que lo que señala el recurrente un oficio remitido a la Capitanía de Puerto de la cual no ostento representación de ella. Si el recurrente realiza una petición a dicha Capitanía y no obtuvo respuesta a la misma, ese e un tema que debe analizar a cual instancia acudir, pero no hay ni puede haber un incumplimiento por no respuesta de parte nuestra cuando el oficio no era dirigido a mi representada. TERCERO: No es cierto. En primer término debemos reiterar que lo que señala el recurrente un oficio remitido a la Capitanía de Puerto, y la suscrita no posee representación respeto a la Capitanía de Puerto, si el recurrente realiza una petición a dicha Capitanía y no obtuvo respuesta a la misma, ese es un tema que debe analizar a cual instancia acudir, pero no hay ni puede haber un incumplimiento por no respuesta de parte nuestra cuando el oficio no era dirigido a mi representada, no tenemos relación con dicha nota, carecemos de legitimación para dar dicha respuesta.

Hemos demostrado que al señor Nombre06 se le ha mantenido informado de lo acontecido y hasta se han programado reuniones virtuales con el mismo, estimamos que por esos medios pudo haber realizado las gestiones que estimare pertinentes, toda vez que existe un canal de comunicación activo y directo entre el mismo y mi representada y se le han mantenido informado, y queda demostrado que desde febrero al mismo se le mantiene informado y hay comunicación directa. Señalamos adicionalmente que no es cierto que mi representada no haya tomado las medidas del caso por el hundimiento del remolcador “Don Nombre02”, a contrario sensu, pese a la difícil situación de las finanzas de la institución, se ha actuado de forma responsable y se han realizado distintas gestiones, como las que se han especificado en el Hecho Primero, adicionalmente se realizaron las gestiones para solucionar el tema del hundimiento y evitar otros daños o efectos, de lo cual aportamos copia de gestiones de cotización realizadas como la de “SERPORT”, toda vez que la solución de recuperación del remolcador no es un tema sencillo de solucionar ni se cuenta a nivel país con las herramientas necesarias para dar solución definitiva en este tipo de siniestros.

CUARTO: No es cierto. Al señor Nombre05 se le han brindado las respuestas solicitadas sobre este tema, no es cierto que no se le haya dado respuesta oportuna, toda vez que el mismo al margen de la gestión alegada, realiza posterior actuaciones por la vía del correo y se le dan trámite, se le da respuesta oportuna y detallada, como consta en lo antes señalado y como lo demostramos con la prueba documental que aportamos en este acto”. Solicita se declare sin lugar el recurso.

3. El 18 de marzo de 2021, el recurrente se refirió al informe de la Presidencia Ejecutiva de JAPDEVA. Acusó que la recurrida rindió el informe de forma extemporánea. Además, dice que no se dignó a facilitar las copias de las pólizas de seguros de los equipos y remolcadores. Se refirió al fondo de los informes. Solicita se declare con lugar el recurso.

4. En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Garro Vargas; y,

Considerando:

I.Objeto del recurso. El recurrente reclama la vulneración a sus derechos fundamentales, pues acusa que el 06 de febrero de 2021, envió un correo a la dirección electrónica ...01, en el cual adjuntó el oficio Nº AEL-OO15-2021, dirigido a la Presidenta Ejecutiva de JAPDEVA, en el que solicitó: “1. Informe escrito sobre la situación legal de todos los remolcadores que se utilizan actualmente para las labores de atraque, estableciendo en cuántos de ellos se encuentran los seguros vigentes, fecha de renovación y funcionario responsable. 2. Facilitar copia integral de todos los seguros de los equipos portuarios, detallar nombre del equipo, fecha y número de gestión donde se tramitó, número de licencia en caso que exista”; sin embargo, acusa que ya transcurrió el plazo establecido por ley, y la autoridad recurrida no ha atendido su gestión.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la parte recurrida haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • a)El 06 de febrero de 2021, el recurrente envió un correo a la dirección electrónica ...01, en el cual adjuntó el oficio Nº AEL-OO15-2021, dirigido a la Presidenta Ejecutiva de JAPDEVA, en el que solicitó: “1. Informe escrito sobre la situación legal de todos los remolcadores que se utilizan actualmente para las labores de atraque, estableciendo en cuántos de ellos se encuentran los seguros vigentes, fecha de renovación y funcionario responsable. 2. Facilitar copia integral de todos los seguros de los equipos portuarios, detallar nombre del equipo, fecha y número de gestión donde se tramitó, número de licencia en caso que exista” (hecho no controvertido).
  • b)El correo electrónico ...01 no es un medio oficial para recibir gestiones de los administrados por JAPDEVA (véase el informe).
  • c)El medio que tiene JAPDEVA para presentar cualquier solicitud de información es en la Presidencia Ejecutiva o bien, en la recepción de documentos ubicado en el acceso peatonal (véase el informe).
  • d)El 22 de marzo de 2021, el Gerente Portuario de JAPDEVA le brindó una amplia respuesta a la parte recurrente (dirigido al correo electrónico ...02), en los siguientes términos: “Buenas tardes estimado Nombre06: Mediante las siguientes líneas le envío un estado de lo actuado en cuanto a los concerniente al incidente con el remolcador Nombre02:” “El pasado 5 de febrero del 2021 ocurrió el hundimiento del Remolcador Don Nombre02 en las coordenadas L10°01’18.6N – Lon 083°04’56.27W. del canal de acceso del complejo portuario de Moín. La presencia de dicho remolcador ha ocasionado la necesidad de cambiar el rumbo de ingreso utilizando el antiguo canal de acceso antes del inicio en operación de la TCM, sin embargo no hemos tenido afectación significativa en la entrada de los buques que ingresan al complejo.” “Procedo a detallar las acciones tomadas: “- Medición de coordenadas, mareas y profundidad para generar comunicado oficial por parte de la autoridad marítimo portuaria. - Colocación de boyas que identifiquen el punto de ubicación del remolcador Nombre02. - Reubicación de la boya 6 del canal de acceso para ampliar acceso a la TCM. - Coordinación con el MOPT y realización de batimetría.

Con esto los prácticos de APM y JAPDEVA han determinado que existen condiciones para maniobras de atraque y desatraque de buques con calados de 12 metros máximo. - Vigilancia ambiental: diariamente se han establecido tres revisiones diarias en conjunto con SINAC/MOPT/Guardacostas en el sitio del acontecimiento para monitorear potenciales derrames de combustibles y aceites. No se detectan derrames a la fecha solamente pequeños brotes cercanos a las boyas. - Se realizan monitoreos y registro fotográficos tres veces al día con apoyo de Guardacostas. - Junto con RECOPE se ha finalizado la coordinación interinstitucional de manera que de presentarse un derrame, el tiempo de acción no supere la hora para colocar barreras, realizar la extracción superficial y asegurar el sitio. Esto mientras finaliza la (sic) - Proceso de coordinación con empresas especialistas para remoción bajo el mar de combustibles y aceite para evitar derrame.

Coordinación con autoridades para consecución presupuestaria. MOPT-CNC-JAPDEVA.” “El proceso se divide en dos: “1- Extracción de combustibles y aceites.” “2- Remoción del remolcador y colocación en zona segura fuera del canal.” “El tema presupuestario es uno de los factores que ha atrasado el proceso. Sin embargo, por los esfuerzos que hemos realizado donde el MOPT ha sido un actor importante, estamos cerca de obtener los recursos para completar el proyecto bajo las condiciones que dicten los términos de referencia.” “Por el momento es lo que llevamos, estaremos actualizándolo en forma oportuna cuando pasemos a la siguiente etapa” (véase el informe).

III. Hechos no probados. No se estiman demostrados los siguientes hechos de relevancia para esta resolución

  • a)Que JAPDEVA haya brindado respuesta y la información requerida por el recurrente en el oficio No. AEL-0015-2021.
  • b)Que JAPDEVA tenga habilitado un medio electrónico para que los administrados puedan realizar peticiones o solicitudes de información.

IV.Sobre el caso concreto. Después de haber analizado el informe y las pruebas aportadas por las partes, esta Sala verifica la vulneración a los derechos fundamentales de la parte recurrente, por las razones que a continuación serán expuestas. Primeramente, conviene advertir que la pretensión de este recurso de amparo radica en que se ordene “resolver la solicitud de información planteada en específico”. Aclarado lo anterior, se ha tenido por demostrado que el 06 de febrero de 2021, el recurrente envió un correo a la dirección electrónica ...01, en el cual adjuntó el oficio Nº AEL-OO15-2021, dirigido a la Presidenta Ejecutiva de JAPDEVA, en el que solicitó: “1. Informe escrito sobre la situación legal de todos los remolcadores que se utilizan actualmente para las labores de atraque, estableciendo en cuántos de ellos se encuentran los seguros vigentes, fecha de renovación y funcionario responsable. 2.

Facilitar copia integral de todos los seguros de los equipos portuarios, detallar nombre del equipo, fecha y número de gestión donde se tramitó, número de licencia en caso que exista”. Del informe rendido, se constata que el correo electrónico ...01 no es un medio oficial para recibir gestiones de los administrados por JAPDEVA. Ahora, esta Sala -para analizar la procedencia o no de una gestión remitida por correo electrónico- ha señalado como regla de principio que la misma debe ser remitida a una cuenta oficial. Sin embargo, también ha admitido la validez de peticiones puras y simples de información, a través de correos no oficiales, pero a los cuáles se les haya dado acuse de recibido o bien, que se hayan tramitado. Así las cosas, del informe se desprenden dos cuestiones de relevancia: que JAPDEVA no tiene un medio electrónico o cuenta de correo para recibir gestiones de los administrados y, “que se recibió el oficio AEL-0015-2021 señalado a mi correo institucional y al del Gerente Portuario por lo que mediante comunicación del Despacho de la Presidencia por la Secretaria, se le indicó el funcionario que daría seguimiento a sus consultas”.

El primero de los extremos, deviene en improcedente, pues esta Sala Constitucional ha sostenido que “existe un derecho de los administrados a acceder y relacionarse por medios electrónicos con las Administraciones Públicas. Sobre lo anterior, recuérdese que las administraciones públicas tienen la obligación de transformar o adaptar su función, organización, formas de actuación y de relacionarse con los administrados a las nuevas exigencias de la realidad tecnológica. En cuanto a esto, este Tribunal ha desarrollado el avance de las tecnologías y su impacto en las administraciones públicas” (véase sentencia No. 2018-18339 de las 09:20 hrs. del 02 de noviembre de 2018). Aunado a ello, en la sentencia No. 2018-17353 de las 09:30 hrs. del 19 de octubre de 2018, esta Sala indicó que “(… ) Las administraciones públicas tienen la obligación de transformar o adaptar su función, organización, formas de actuación y de relacionarse con los administrados a las nuevas exigencias de la realidad tecnológica.

En cuanto a esto, este Tribunal ha desarrollado el avance de las tecnologías y su impacto en las administraciones públicas, de la siguiente manera: “En cuanto a este último punto, debe decirse que el avance en los últimos veinte años en materia de tecnologías de la información y comunicación (TIC´s) ha revolucionado el entorno social del ser humano. Sin temor a equívocos, puede afirmarse que estas tecnologías han impactado el modo en que el ser humano se comunica, facilitando la conexión entre personas e instituciones a nivel mundial y eliminando las barreras de espacio y tiempo. En este momento, el acceso a estas tecnologías se convierte en un instrumento básico para facilitar el ejercicio de derechos fundamentales como la participación democrática (democracia electrónica) y el control ciudadano, la educación, la libertad de expresión y pensamiento, el acceso a la información y los servicios públicos en línea, el derecho a relacionarse con los poderes públicos por medios electrónicos y la transparencia administrativa, entre otros” (véase sentencia No. 2010-12790 de las 08:58 hrs. del 30 de julio de 2010)”.

En la sentencia citada, la Sala por unanimidad sostuvo que se configuró una infracción a los derechos fundamentales por parte de una Municipalidad por carecer de un correo electrónico o medio para relacionarse con la Administración Pública: “Así las cosas, como se indicó supra, resulta contrario a los derechos fundamentales de la parte recurrente, la ausencia de un correo electrónico o algún medio electrónico para relacionarse con la Administración Pública y además, es contrario a los principios de eficiencia y eficacia que deben regir al funcionamiento de las Administraciones Públicas”. Asimismo, tomando en cuenta el carácter no absoluto de los derechos fundamentales, es posible concluir que, para el ejercicio del derecho de petición y pronta respuesta, empleando los medios que las nuevas tecnologías facilitan, es importante, que el requerimiento sea canalizado a través de una página web de libre acceso del ente o el órgano público.

Adicionalmente, ese dominio electrónico debe contar con un hipervínculo direccionado hacia un correo electrónico dispuesto, específicamente, para recibir solicitudes, sea sobre un tema particular o bien que sirva como buzón para todo tipo gestiones (ver en ese sentido, entre otras, Sentencia No.2020-008546 de las 09:20 horas de 8 de mayo de 2020). Por ende, resulta contrario a los derechos de los administrados indicar que las solicitudes de información o petición solo pueden ser entregadas de forma física, sin que exista un correo para recibir gestiones de los administrados. A partir de lo anterior, se colige que cada institución pública debe contar con medios electrónicos oficiales, como lo podría ser un correo electrónico específico, con el fin de recibir gestiones y peticiones por parte de los administrados y cualquier interesado. De tal forma, las instituciones tienen la obligación de atender y responder con prontitud todas las gestiones presentadas por tales medios, en garantía del derecho de petición, contemplado en el artículo 27 de la Constitución Política.

Así, lo que corresponde es ordenar a JAPDEVA que tome las medidas correspondientes para que implemente los canales de interacción electrónicos para que las personas presenten gestiones virtualmente. Por otro lado, se aprecia que JADPEVA sí tuvo conocimiento de la gestión objeto de este recurso de amparo, tanto así que le dio el trámite correspondiente. Así, la gestión planteada por correo electrónico sí es válida para ser conocida por el fondo por este Tribunal Constitucional. Ahora bien, del análisis del informe de la Presidenta Ejecutiva de JAPDEVA no se constata de forma fehaciente que al recurrente se le haya brindado la respuesta y la información pretendida en el oficio No. AEL-OO15-2021, según procediera. Todo esto, pese a que el plazo de ley se encuentra completamente superado. En consecuencia, se declara con lugar el recurso.

V.Razones separadas del Magistrado Castillo Víquez. En reiteradas ocasiones he salvado el voto indicando que, si la gestión cuya falta de respuesta se reclama no fue remitida a un medio oficial, la administración no está conminada a contestarla y ello no violenta los derechos de la parte recurrente. Sin embargo, en este caso, en particular, estimo el amparo, por cuanto la autoridad recurrida no tiene previsto medio digital alguno para recibir gestiones de los administrados, lo que sí lesiona los derechos fundamentales del amparado, según los argumentos expuestos en la sentencia. De ahí que sea únicamente con base en ese razonamiento, que coincido en la estimatoria de este amparo.

VI.Documentación aportada al expediente. Debe prevenir esta Sala a las partes que de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. Se le ordena a Andrea Centeno Rodríguez, en su condición de Presidenta Ejecutiva de la Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica, o a quien en su lugar ejerza ese cargo, para que dentro del ámbito de sus competencias gire las órdenes necesarias con el fin de que: 1) En el plazo de DIEZ DÍAS, contados a partir de la notificación de esta sentencia, se brinde la respuesta y la información requerida en el oficio No. AEL-0015-2021, excepto la que sea de naturaleza confidencial, al correo electrónico señalado por el recurrente para recibir notificaciones. 2) En el plazo máximo de SEIS MESES contados a partir de la notificación de esta sentencia, esa dependencia cuente con las condiciones y habilite un medio electrónico para recibir las peticiones o solicitudes de información. Se le advierte a la autoridad recurrida que, de no acatar la orden dicha, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71, de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena a la JUNTA DE ADMINISTRACIÓN PORTUARIA Y DE DESARROLLO ECONÓMICO DE LA VERTIENTE ATLÁNTICA DE COSTA RICA al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El Magistrado Castillo Víquez consigna razones diferentes. Notifíquese.
