Review of the Document Res. No. 2021011976 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty hours on the twenty-sixth of May of two thousand twenty-one.
An acción de inconstitucionalidad brought by the ASOCIACIÓN DE ACUEDUCTO DE BUENOS AIRES DE VENECIA DE SAN CARLOS, legal identification No. 3002300168, represented by OMAR MORALES SOLÍS, of legal age, bearer of identity card number 0103520447, resident of Buenos Aires de Venecia de San Carlos, against articles 21, subsection 13, and 22, subsection 11, of the Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, Decree No. 32529, and article 61, subsection g), of the Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, Decreto Ejecutivo No. 42582-S-MINAE.
Resultando:
1.- Through a brief received in the Secretariat of the Chamber at 8:36 a.m. on May 4, 2021, the representative of the petitioner Association requests that the unconstitutionality of articles 21, subsection 13, and 22, subsection 11, of the Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, Decree No. 32529, and article 61, subsection g), of the Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, Decreto Ejecutivo No. 42582-S-MINAE, be declared. He alleges that Decree No. 32529 of February 2, 2005, came into effect as of August 2005. For its part, Decree No. 42582-S-MINAE came into effect on September 4, 2020. Article 61, subsection g), provides that once the dissolution of an ASADA is ordered, the AyA must initiate the process for declaring its extinction (extinción) and liquidation. All assets required for the continuity of the service, including lands and easements (servidumbres), must be transferred to the AyA for the purpose of ensuring they continue to be used in providing the services to the community for which they were acquired or constructed. Such assets shall become part of the public domain, pursuant to the provisions of article 18 of the Ley Orgánica del AyA. This norm, for its part, indicates that all properties and installations of State entities intended for the provision of services related to the capture, treatment, and disposal of drinking water and the evacuation of wastewater or stormwater in the country are national heritage. It is thus how the public heritage referred to in that norm is that belonging to the entities of the State, and ASADAS are not found among these, as they are private associations constituted under the protection of the Ley de Asociaciones, No. 218, for which reason their heritage constitutes private property, with all the legal effects and scopes that this implies. Decree 32529, which was in force until September 4, 2020, established the possibility of a delegation agreement (convenio de delegación) between the AyA and the ASADAS, for the administration, operation, maintenance, and development of the community aqueduct and/or sewage systems, once the works are completed. This agreement can be unilaterally rescinded by the AyA, to take over the system together with all the association's heritage, the utility of which passes to the AyA regardless of whether those assets were transferred to the respective ASADA with the delegation agreement or whether they were acquired thanks to the effort, work, and human and economic resources contributed by the associates. The constitutional protection that the right of property holds excludes the regulatory path as an instrument for regulating and/or restricting the constitutional right of property. On the other hand, but always in relation to the issue of legal reservation, the principle of legality, provided for in article 11 of the Constitución Política, requires that officials may not arrogate powers that the law does not grant them, said article being complemented by article 11 of the Ley General de la Administración Pública. Only through a formal law, emanating from the Legislative Branch, is it possible to regulate and limit fundamental rights. In this sense, a decree issued by the Executive Branch does not have the potency and legal rank required to affect the right of property. Works performed with economic resources unrelated to those of the AyA may not be the object of delegation, much less if they concern assets or rights procured by the ASADA itself. In any case, it must be interpreted that the assets the ASADA should return to the AyA are those components of the system that had been delegated by the AyA and that the latter had handed over with the respective agreement. In application of the provisions of constitutional article 45, if the AyA were to take over the aqueduct administered by an ASADA, it could not dispossess it of its property except by mutual agreement or expropriation, with prior compensation.
2.- For legitimacy purposes, he indicates that it derives from article 75, paragraph 2°, of the Ley de la Jurisdicción Constitucional, insofar as he comes in defense of diffuse interests. He believes that his represented party is legitimately entitled, individually, to bring an action in defense of its interests. The defense of these interests is also the defense of the interests of other ASADAS, which have historically developed their own aqueduct services and configured their own heritage, independently of the AyA. By reason of the foregoing, he believes that a prior pending matter is not necessary.
3.- Article 9 of the Ley de la Jurisdicción Constitucional empowers the Chamber to flatly reject or reject on the merits, at any time, even from its filing, any proceeding submitted to its consideration that turns out to be manifestly improper, or when it considers that there are sufficient grounds for judgment to reject it, or that it is a simple reiteration or reproduction of a previous equal or similar matter already rejected.
Magistrate Castillo Víquez writes; and,
Considerando:
I.- ON THE ADMISSIBILITY OF THE ACCIÓN.- Article 75, paragraph 1°, of the Law governing this jurisdiction establishes that the admissibility of an acción de inconstitucionalidad is conditioned on the existence of a prior matter pending resolution before the courts or in the procedure to exhaust the administrative route, in which the unconstitutionality of the challenged norm or norms has been invoked, in such a way that the acción serves as a reasonable means for protecting the right or interest that is deemed injured. The only possible exceptions to the foregoing are those indicated in the subsequent paragraphs of the same norm, in the sense that the existence of the prior matter is not required in cases where the acción is brought by the Contralor, Procurador, or Fiscal General de la República or, further, by the Defensor de los Habitantes. Nor is it required in those cases where, by the nature of the matter, there is no individual and direct injury, or it concerns the defense of diffuse interests or those that concern the community as a whole. The situations contained in paragraph 2° of article 75 constitute an exception to the rule established in paragraph 1° (incidental route) which must be analyzed carefully. Regarding the diffuse interest, it is a species of the so-called "collective interests." It deals with the interest held by an unincorporated group, even if organized in fact. The Chamber has indicated that it is "(…) a special type of interest, the manifestation of which is less concrete and individualizable than that of the collective interest just defined in the preceding recital, but which cannot become so broad and generic that it merges with that recognized to all members of society to ensure constitutional legality, since the latter—as has been repeatedly stated—is excluded from the current system of constitutional review. It is, therefore, an interest distributed among each of the administered, mediate if you will, and diluted, but no less verifiable for that, for the defense, before this Chamber, of certain constitutional rights of singular relevance for the adequate and harmonious development of society. Although there is no exhaustive list of these rights, the Constitutional Chamber has identified various ones that enjoy such characteristics, such as the defense of the right to a healthy and balanced environment, the protection and defense of cultural and historical heritage, the constitutional public domain and territorial integrity of the country, the proper management of public finances, and electoral matters, among others. In light of the foregoing, it is evident that the interest defended by the petitioner does not fit within this situation, neither as a representative of the ASADA nor on behalf of other ASADAS, as he cannot arrogate to himself, without more, the de facto representation of an organization.
II.- CONCLUSION.- For lacking legitimacy, the acción must be flatly rejected.
III.- DOCUMENTATION PROVIDED TO THE EXPEDIENTE. The parties are cautioned that if any document on paper was provided, along with objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology-produced device, these must be withdrawn from the office within a maximum period of 30 working days counted from the notification of this judgment. Otherwise, all material not withdrawn within this period shall be destroyed, according to the provisions in the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in session No. 27-11 of August 22, 2011, article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial, in session No. 43-12 held on May 3, 2012, article LXXXI.

In any case, it must be interpreted that the property the ASADA should return to AyA are those components of the system that had been delegated by AyA and which it had delivered under the respective agreement. In application of the provisions of Article 45 of the Constitution, if AyA were to assume the aqueduct administered by an ASADA, it could not dispossess it of its property except by agreement of the parties or expropriation, with prior indemnification.
**2.-** For purposes of standing, it is noted that it derives from Article 75, paragraph 2 of the Constitutional Jurisdiction Law, insofar as it appears in defense of diffuse interests. It considers that its represented party has standing, individually, to bring an action in defense of its interests. The defense of those interests is also the defense of the interests of other ASADAs, which have historically developed their own aqueduct services and configured their own assets, independently of AyA. By reason of the foregoing, it considers that the pending prior matter is not necessary.
**3.-** Article 9 of the Constitutional Jurisdiction Law empowers this Chamber to reject outright or on the merits, at any time, even from its presentation, any action brought to its attention that proves to be manifestly improper, or when it considers that there are sufficient elements of judgment to reject it, or that it is a mere reiteration or reproduction of a previous, identical or similar action that was rejected.

Nor is it required in those cases where, due to the nature of the matter, there is no individual and direct injury, or it involves the defense of diffuse interests or those that concern the community as a whole. The cases contained in paragraph 2 of Article 75 constitute an exception to the rule established in paragraph 1 (incidental route) that must be analyzed carefully. While there is no exhaustive list of these rights, the Constitutional Chamber has identified several that possess such characteristics, such as the defense of the right to a healthy and balanced environment, the protection and defense of the cultural and historical heritage, of the constitutional public domain and territorial integrity of the country, the sound management of public finances, and electoral matters, among others. In light of the foregoing, it is evident that the interest defended by the petitioner does not fit within this case, neither as the representative of the ASADA, nor on behalf of other ASADAs, as it cannot arrogate, without more, the de facto representation of an organization.
**II.- CONCLUSION.-** For lack of standing, the action must be rejected outright.

Action of unconstitutionality brought by ASOCIACIÓN DE ACUEDUCTO DE BUENOS AIRES DE VENECIA DE SAN CARLOS, legal identification number 3002300168, represented by OMAR MORALES SOLÍS, of legal age, bearer of identity card number 0103520447, resident of Buenos Aires de Venecia de San Carlos, against articles 21, subsection 13 and 22, subsection 11 of the Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, Decree No. 32529 and article 61, subsection g), of the Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, Decreto Ejecutivo No. 42582-S-MINAE.
**Resultando:** **1.-** By document received in the Secretariat of the Chamber at 8:36 a.m. on May 4, 2021, the representative of the plaintiff Association requests that the unconstitutionality of articles 21, subsection 13 and 22, subsection 11 of the Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, Decree No. 32529 and article 61, subsection g), of the Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, Decreto Ejecutivo No. 42582-S-MINAE be declared. He alleges that Decree No. 32529 of February 2, 2005, entered into force as of August 2005. For its part, Decree No. 42582-S-MINAE entered into force on September 4, 2020. Article 61, subsection g), provides that once the dissolution (disolución) of an ASADA is ordered, the AyA must initiate the process of declaration of extinction (extinción) and liquidation (liquidación). All assets required for the continuity of the service, including lands and easements (servidumbres), must be transferred to AyA for the purpose of ensuring that they continue to be used in the provision of services to the community for which they were acquired or built. Such assets shall be affected by public domain (dominio público), as provided by article 18 of the Organic Law of AyA. This provision, for its part, indicates that all properties and installations of State bodies destined for the provision of services related to the collection, treatment, and disposal of potable water and the evacuation of wastewater or stormwater in the country, are national patrimony. It is thus that the public patrimony referred to in that provision is that belonging to State bodies, ASADAS not being found within these, as they are private associations constituted under the Law of Associations, No. 218, for which reason their patrimony constitutes private property, with all the legal effects and scopes that this implies. Decree 32529, which was in force until September 4, 2020, established the possibility of a delegation agreement (convenio de delegación) between AyA and the ASADAS, for the administration, operation, maintenance and development of the communal aqueduct and/or sewer systems, once the works are completed. That agreement can be unilaterally terminated by AyA, to assume the system along with all the association's patrimony, whose utility passes to AyA regardless of whether those assets were transferred to the respective ASADA with the delegation agreement or if they were acquired thanks to the effort, work and human and economic resources contributed by the associates. The constitutional protection afforded to the right of property excludes the regulatory route as an instrument for regulating and/or restricting the constitutional right of property. Moreover, but always in relation to the subject of legal reserve, the principle of legality (principio de legalidad), provided for in article 11 of the Political Constitution, dictates that public officials cannot arrogate powers that the law does not grant them, this article being complemented by article 11 of the General Public Administration Law. Only by means of a formal law, emanating from the Legislative Branch, is it possible to regulate and limit fundamental rights. In this sense, a decree issued by the Executive Branch does not have the legal force and ranking required to affect the right of property. Works carried out with economic resources other than those of AyA cannot be subject to delegation, much less if they involve assets or rights procured by the ASADA itself. In any event, it must be interpreted that the assets the ASADA should return to AyA are those system components that had been delegated by AyA and that it had delivered with the respective agreement. In application of the precepts of constitutional article 45, if AyA were to take over the aqueduct administered by an ASADA, it could not dispossess it of its property except by mutual agreement or expropriation (expropiación), with prior compensation.
**2.-** For purposes of standing (legitimación), he indicates that it derives from article 75, paragraph 2 of the Constitutional Jurisdiction Law, insofar as he appears in defense of diffuse interests (intereses difusos). He considers that his client is standing, individually, to bring an action in defense of its interests. The defense of those interests is also the defense of the interests of other ASADAs, which have historically developed their own aqueduct services and configured their own patrimonies, independently of AyA. By reason of the foregoing, he considers that a pending prior matter is not necessary.
**3.-** Article 9 of the Constitutional Jurisdiction Law empowers the Chamber to reject outright or on the merits, at any time, even from its presentation, any proceeding presented to its knowledge that proves to be manifestly unfounded, or when it considers that there are sufficient elements of judgment to reject it, or that it is the mere reiteration or reproduction of a prior, identical or similar proceeding that was rejected.
Drafted by Magistrate Castillo Víquez; and, **Considerando:** **I.- ON THE ADMISSIBILITY OF THE ACTION.-** Article 75, paragraph 1, of the Law that governs this jurisdiction establishes that the admissibility of an action of unconstitutionality is conditioned on the existence of a prior matter pending resolution before the courts or in the procedure to exhaust the administrative route, in which the unconstitutionality of the contested norm or norms has been invoked, so that the action serves as a reasonable means for the protection of the right or interest considered to be harmed.
The only possible exceptions to the foregoing are those indicated in the following paragraphs of the same provision, to the effect that the existence of the prior matter is not required in cases where the action is brought by the Comptroller General, Attorney General, or Chief Prosecutor of the Republic, or by the Ombudsman. Nor are those assumptions required where, by the nature of the matter, there is no individual and direct injury, or it involves the defense of diffuse interests (intereses difusos) or those that concern the community as a whole. The assumptions contained in paragraph 2 of Article 75 constitute an exception to the rule established in paragraph 1 (incidental channel) that must be carefully analyzed. As for the diffuse interest, it is a species of the so-called "collective interests." It is the interest held by a group lacking legal personality, even if organized in fact. The Chamber has indicated that it is "(...) a special type of interest, the manifestation of which is less concrete and individualizable than that of the collective interest just defined in the preceding recital, but which cannot become so broad and generic that it is confused with that recognized to all members of society to ensure constitutional legality, since the latter—as has been repeatedly stated—is excluded from the current system of constitutional review. It is therefore an interest distributed in each of the administered persons, mediate if you will, and diluted, but no less verifiable for that reason, for the defense, in this Chamber, of certain constitutional rights of singular relevance for the adequate and harmonious development of society. Although there is no exhaustive list of these rights, the Constitutional Chamber has identified various ones that enjoy such characteristics, such as the defense of the right to a healthy and balanced environment, the protection and defense of cultural and historical heritage, of the constitutional public domain and territorial integrity of the country, the sound management of public finances, and electoral matters, among others. In light of the foregoing, it is evident that the interest defended by the claimant does not fit this assumption, neither as representative of the ASADA, nor on behalf of other ASADAs, insofar as he cannot arrogate to himself, without more, the de facto representation of an organization.
**II.- CONCLUSION.-** For lack of standing (legitimación), the action must be rejected outright.
**III.- DOCUMENTATION PROVIDED TO THE CASE FILE.** The parties are warned that if they have provided any paper document, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic device or one produced by new technologies, these must be withdrawn from the office within a maximum period of 30 business days counted from the notification of this judgment.

Revisión del Documento Res. Nº 2021011976 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del veintiseis de mayo de dos mil veintiuno .
Acción de inconstitucionalidad promovida por ASOCIACIÓN DE ACUEDUCTO DE BUENOS AIRES DE VENECIA DE SAN CARLOS, cédula jurídica No. 3002300168, representada por OMAR MORALES SOLÍS, mayor, portador de la cédula de identidad número 0103520447, vecino de Buenos Aires de Venecia de San Carlos contra los artículos 21, inciso 13 y 22, inciso 11 del Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, Decreto No. 32529 y artículo 61, inciso g), del Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, Decreto Ejecutivo No. 42582-S-MINAE.
Resultando:
1.-Por escrito recibido en la Secretaría de la Sala a las 8:36 hrs. del 4 de mayo de 2021, el representante de la Asociación accionante solicita que se declare la inconstitucionalidad de los artículos 21, inciso 13 y 22, inciso 11 del Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, Decreto No. 32529 y artículo 61, inciso g), del Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, Decreto Ejecutivo No. 42582-S-MINAE. Alega que el Decreto No. 32529 del 2 de febrero de 2005 entró a regir a partir de agosto del 2005. Por su parte, el Decreto No. 42582-S-MINAE entró a regir el 4 de setiembre de 2020. El artículo 61, inciso g), dispone que dispuesta la disolución de una ASADA, el AyA deberá iniciar el proceso de declaratoria de extinción y liquidación. Todos los bienes requeridos para la continuidad del servicio, incluyendo terrenos y servidumbres, deberán trasladarse al AyA con el propósito de garantizar que sigan siendo utilizados en la prestación de los servicios de la comunidad para la cual fueron adquiridos o construidos. Tales bienes quedarán afectados al dominio público, según lo dispone el artículo 18 de la Ley Orgánica del AyA. Esta norma, por su parte, indica que todas las propiedades e instalaciones de los organismos del Estado destinados a la prestación de servicios relativos a la captación, tratamiento y disposición de aguas potables y evacuación de aguas servidas o pluviales en el país, son patrimonio nacional. Es así como, el patrimonio público a que se refiere esa norma, es el perteneciente a los organismos del Estado, no encontrándose dentro de éstos las Asadas, que son asociaciones particulares constituidas al amparo de la Ley de Asociaciones, No. 218, por lo que su patrimonio constituye propiedad privada, con todos los efectos y alcances jurídicos que ello implica. El Decreto 32529, que rigió hasta el 4 de setiembre de 2020, estableció la posibilidad de un convenio de delegación entre el AyA y las ASADAS, para la administración, operación, mantenimiento y desarrollo de los sistemas de acueductos y/o alcantarillados comunales, una vez terminadas las obras. Ese convenio puede ser rescindido unilateralmente por el AyA, para asumir el sistema junto con todo el patrimonio de la asociación, cuya utilidad pasa al AyA independientemente de si esos bienes fueron trasladados a la ASADA respectiva con el convenio de delegación o si fueron adquiridos gracias al esfuerzo, trabajo y recursos humanos y económicos aportados por los asociados. La tutela constitucional que tiene el derecho de propiedad, excluye la vía reglamentaria como instrumento de regulación y/o restricción del derecho constitucional de propiedad. Por otra parte, pero siempre en relación con el tema de la reserva de ley, el principio de legalidad, previsto en el artículo 11 de la Constitución Política, impone que los funcionarios no se pueden arrogar potestades que la ley no les concede, siendo complementado tal artículo por el 11 de la Ley General de la Administración Pública. Solamente mediante ley formal, emanada del Poder Legislativo es posible regular y limitar derechos fundamentales. En tal sentido, un decreto emitido por el Poder Ejecutivo no tiene la potencia y el rango jurídico que ser requiere para afectar el derecho de propiedad. No pueden ser objeto de delegación obras realizadas con recurso ajenos económico ajenos a los del AyA, mucho menos si se trata de bienes o derechos procurados por la propia ASADA. En todo caso, debe interpretarse que los bienes que la ASADA debería devolver al AyA son aquellos componentes del sistema que habían sido delegados por el AyA y que esta había entregado con el respectivo convenio. En aplicación de lo preceptuado por el artículo 45 constitucional, si el AyA llegara a asumir el acueducto administrado por un ASADA, no podría despojarla de su propiedad salvo acuerdo de partes o expropiación, previa indemnización.
2.- Para efectos de legitimación, señala que deriva del artículo 75, párrafo 2° de la Ley de la Jurisdicción Constitucional, en tanto acude en defensa de intereses difusos. Estima que su representada está legitimada, de manera individual, para accionar en defensa de sus intereses. La defensa de esos intereses, es también la defensa de los intereses de otras ASADAS, que han desarrollado históricamente sus propios servicios de acueductos y configurado sus propios patrimonios, de manera independiente al AyA. En razón de lo expuesto, estima que no es necesario el asunto previo, pendiente de resolver.
3.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.
Redacta el Magistrado Castillo Víquez; y,
Considerando:
I.- SOBRE LA ADMISIBILIDAD DE LA ACCIÓN.- El artículo 75, párrafo 1°, de la Ley que rige esta jurisdicción, establece que la admisibilidad de una acción de inconstitucionalidad está condicionada a la existencia de un asunto previo pendiente de resolver ante los tribunales o en el procedimiento para agotar la vía administrativa, en el que se haya invocado la inconstitucionalidad de la norma o normas impugnadas, de modo tal que la acción sirva como un medio razonable para la tutela del derecho o interés que se estima lesionado. Las únicas excepciones posibles a lo anterior, son las que señalan los párrafos siguientes de la misma norma, en el sentido que no precisa la existencia del asunto previo en los casos en que la acción sea planteada por el Contralor, Procurador o Fiscal General de la República o bien, por el Defensor de los Habitantes. Tampoco se requiere aquellos supuestos en que, por la naturaleza del asunto no exista lesión individual y directa, o se trate de la defensa de intereses difusos o que atañen a la colectividad en su conjunto. Los supuestos contenidos en el párrafo 2° del artículo 75 constituyen una excepción a la regla establecida en el párrafo 1° (vía incidental) que deben ser analizados cuidadosamente. En cuanto al interés difuso, es una especie de los denominados “intereses colectivos”. Se trata del interés que ostenta un grupo sin personificación, aunque se encuentre organizado de hecho. La Sala ha señalado que resulta “(…)un tipo especial de interés, cuya manifestación es menos concreta e individualizable que la del colectivo recién definido en el considerando anterior, pero que no puede llegar a ser tan amplio y genérico que se confunda con el reconocido a todos los miembros de la sociedad de velar por la legalidad constitucional, ya que éste último -como se ha dicho reiteradamente- está excluido del actual sistema de revisión constitucional. Se trata pues de un interés distribuido en cada uno de los administrados, mediato si se quiere, y diluido, pero no por ello menos constatable, para la defensa, en esta Sala, de ciertos derechos constitucionales de una singular relevancia para el adecuado y armónico desarrollo de la sociedad. (sentencia No. 360-99 de las 15:51 hrs. del 20 de enero de 1999). Si bien no hay una lista exhaustiva de estos derechos, la Sala Constitucional ha identificado diversos que gozan de tales características, como la defensa del derecho a un ambiente sano y equilibrado, la tutela y defensa del patrimonio cultural e histórico, del dominio público constitucional e integridad territorial del país, el buen manejo de la hacienda pública y la materia electoral, entre otros. A la luz de lo expuesto, es evidente que el interés que defiende el accionante no encuadra en este supuesto, ni como representante de la ASADA, ni en nombre de otras ASADAS, en tanto no puede arrogarse, sin más, la representación de hecho de una organización.
II.- CONCLUSIÓN.- Por carecer de legitimación, la acción debe ser rechazada de plano.
III.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se rechaza de plano la acción.
