Findings of Fact (Resultando):
I.In a filing entered into this Court’s Electronic Case Management System on April 30, 2021, the petitioners (recurrentes) allege for the second time a failure to comply with this Chamber’s order in decision No. 2018-001540, issued at 09:15 on February 02, 2018, since that judgment provided as follows: “...The petition is partially granted, solely with respect to the Municipalidad de Curridabat, for failure to comply with health order (orden sanitaria) No. 042-10 of August 18, 2010, as provided in Voto 2010-020634, issued at fourteen hours and one minute on December 14, 2010. Alicia Borja Rodríguez, Mayor of Curridabat, or whoever holds that office in her stead, is ordered to take all necessary measures to ensure immediate compliance with health order No. 042-10 of August 18, 2010, and with the provisions of this Chamber’s Voto No. 2010-020634, issued at fourteen hours and one minute on December 14, 2010, and she shall report thereon to this Chamber.
The respondent (recurrida) is hereby advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that they are required to comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years or to a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipalidad de Curridabat is ordered to pay the legal costs, damages, and losses caused by the acts underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative courts (ejecución de sentencia de lo contencioso administrativo). This decision shall be personally served on Alicia Borja Rodríguez, Mayor of Curridabat, or whoever holds that office in her stead. With respect to the Ministerio de Ambiente y Energía and the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, the petition is denied...”;

Whereas:
SOLE MATTER. REGARDING THE ACTIONS OF THE MUNICIPALITY OF CURRIDABAT IN CONNECTION WITH JUDGMENT NO. 2018-001540, AT 09:15 HOURS ON 02 DE FEBRERO DE 2019, COMPLIANCE WITH WHICH WAS REITERATED BY JUDGMENT NO. 2019-022417 AT 9:30 HOURS ON 13 DE NOVIEMBRE DE 2019, AND THE COMPLAINT OF DISOBEDIENCE FILED BY THE PETITIONERS.- The petitioners (recurrentes) appear before this Constitutional Court, alleging that the respondent authority (autoridad recurrida) has disobeyed the provisions of judgments Nos 2018001540 at 9:15 hours on 02 de febrero de 2018 and 2019-022417 at 9:30 hours on 13 de noviembre de 2019. In this regard, Jimmy Cruz Jiménez, current Mayor of the Municipality of Curridabat, argues that the municipal corporation he represents has undertaken actions intended to resolve the problems faced by the petitioner residents of -Residencial Tulipanes del cantón de Curridabat- and thereby comply with Ministry of Health Health Order (Orden Sanitaria) No. 042-2010 and this Chamber’s judgments Nos. 2018-001540 at 9:15 hours on 02 de febrero de 2019 and 2019-022417 at 9:30 hours on 13 de noviembre de 2019.
The actions undertaken include: 1- Preparation of the schedule, 2- Submission of the schedule to the Área Rectora de Salud de Curridabat, 3- Additional Contract No. 2016LA000014-01, Procurement of Professional Engineering Services to prepare a hazard and flooding study (riverine and stormwater) for the cantón de Curridabat Urbanización Tulipanes, 4- Analysis of the final report by Engineer Javier Saborío Bejarano (C2293: Topographical, geomorphological, hydrological, hydraulic, and geotechnical study and preliminary solution for the site “Urbanización Los Tulipanes, diciembre 2018), 5- Geographic Analysis, 6- Request for a legal opinion: Before notifying the owners, determine legally whether the construction work in tulipanes must be performed solely by the municipality or by the owners, 7- Community support: meeting with residents, workshops, and delivery of preliminary information, 8- Preparation of technical specifications for the construction design of a soil-nailed retaining structure (muro de suelo cosido) on the upper portion of the slope (talud), 9- Regarding the demolition of house No. 50, 9.1- Due process (debido proceso) for notifying the owner before any municipal action.
He further stated that there are two relevant points: 1- CONSTRUCTION OF SOIL-NAILED EARTH ON THE UPPER PORTION OF THE SLOPE and 2- DEMOLITION OF HOUSE No. 50 AND DUE PROCESS FOR NOTIFICATION BEFORE ANY MUNICIPAL ACTION. He stated that “…an unknown person carried out the demolition of the house No. 50 in question, without having the municipal permit required for that purpose…” and concluded by stating that, in view of the foregoing and the actions undertaken, there has been no failure to comply with the judgment in question. He adds that the total cost of the work and the investment being made by the Municipality amounts to: ₡282.681.031.32, solely with respect to the construction component. Accordingly, the Municipality set in motion everything required to carry out a project of this magnitude. Once the corresponding studies and the project design had been obtained, the next step consisted of obtaining the Project’s Environmental Viability (Viabilidad Ambiental) and the Permit for Works in a Public-Domain Watercourse (Permiso de Obra en Cauce de Dominio Público) from the Secretaría Técnica Ambiental, for which procurement process 2020CD-000036-0023100001 remains underway.
That procurement process began on 27 de mayo de 2020, and from the outset work was undertaken to obtain each and every requirement imposed by SETENA for performing this type of work. Some of these requirements have been difficult to satisfy because it has been necessary to prepare a series of reports and documents in digital format (in accordance with the specifications of the Secretaría Técnica Ambiental) that form part of the supporting materials for the environmental viability application. These include: a hydrological study, geotechnical study, forestry study, environmental study, structural design, etc. He explained that several of the requirements imposed by that government entity have caused delays in the project; for example, it required a permit from the Juzgado Agrario to fell the trees located within the intervention area. The Municipality led this proceeding before the Segundo Circuito Judicial de San José, which had to proceed through the final level of review before authorization to cut the trees could be obtained.
The proceeding lasted from agosto de 2020 until finales de febrero de 2021, when the Tribunal Agrario, through resolution N° 164-F-2021, at 8:49 hours on 24 de febrero de 2021, granted the protective measure (medida de seguridad) requested by the Municipalidad de Curridabat and authorized the cutting of approximately 24 trees located on the slope of the Río María Aguilar. Along the same lines, another requirement imposed on the Municipality was to submit duly authenticated letters of consent (cartas de anuencias) from the owners of the private areas through which the wall must necessarily be constructed. In view of this situation, house 50 (which has collapsed by 90%) is registered in the name of a foreign national who does not reside in the country and is presumed deceased; consequently, formal efforts to provide notice and obtain the required document have been impossible to carry out.
Notice by publication (notificación por edicto) is currently underway following completion of the corresponding notification procedure. This has required proposing specific measures to the Secretaría Técnica Ambiental in an effort to cure the deficiencies in the requirements. In conclusion, the respondent stated that it has not been possible to commence the administrative procurement procedure (procedimiento de contratación administrativa), because contractual commitments cannot be made until the technical and legal certainty needed to guarantee full execution of the project is available, which entails obtaining the preliminary approvals and permits described above. Nevertheless, work has been undertaken on the technical and administrative materials necessary so that, once the preliminary approvals are available, the procurement process may begin as promptly as possible.
In this regard, although this Chamber does not disregard the fact that the respondent municipality has indeed undertaken actions in pursuit of the aforementioned compliance, both with Ministry of Health Health Order No. 042-2010 and with judgments Nos. 2018-001540 at 9:15 hours on 02 de febrero de 2018 and 2019-022417 at 9:30 hours on 13 de noviembre de 2019, the fact remains that the first judgment in question clearly required that all necessary measures be taken to ensure immediate compliance with health order Nº 042-10 of 18 de agosto de 2010 and with the provisions of this Chamber’s judgment number 2010-020634 at catorce horas y uno minutos on catorce de diciembre del dos mil diez. It was also ordered that this Chamber be informed of such compliance. As of the date on which the Mayor of Curridabat submitted his report –7 de mayo de 2021-, the aforementioned judgments had not been complied with, which is precisely what the petitioners allege.
Accordingly, the respondent authority’s failure to comply with the order issued by this Court has been established.
POR TANTO:
Jimmy Cruz Jiménez, Mayor of the Municipalidad de Curridabat, or whoever serves in that position in his stead, is again ordered to comply with the provisions of this Chamber’s resolutions No. 2018-001540 at 9:15 hours on 02 de febrero de 2018, which stated: “…Alicia Borja Rodríguez, Mayor of Curridabat, or whoever serves in that position in her stead, is ordered to take all necessary measures to ensure immediate compliance with health order Nº 042-10 of 18 de agosto de 2010 and with the provisions of this Chamber’s judgment number 2010-020634 at catorce horas y uno minutos on catorce de diciembre del dos mil diez, regarding which she shall report to this Chamber…”. He is likewise ordered to comply with the provisions of Judgment No. y 2019-022417 at 9:30 hours on 13 de noviembre de 2019, which stated: “Alicia Borja Rodríguez, Mayor of the Municipalidad de Curridabat, or whoever serves in that position in her stead, is again ordered to comply with the provisions of this Chamber’s resolution No. 2018001540 at 9:15 hours on 02 de febrero de 2018 (…)”. The foregoing is ordered with the warning that certified copies of the record (testimonio de piezas) shall be forwarded to the Ministerio Público if he fails to comply. Let notice be given.

Resultando:
I.Por escrito agregado al Sistema Electrónico de Gestión de este Despacho el 30 de abril de 2021, los recurrentes, acusan por segunda ocasión desobediencia a lo ordenado por esta Sala en la resolución No. 2018-001540 de las de las 09:15 horas del 02 de febrero de 2018, toda vez que en esa sentencia se dispuso lo siguiente: "...Se declara parcialmente con lugar el recurso, únicamente en cuanto se refiere a la Municipalidad de Curridabat, por el incumplimiento de la orden sanitaria Nº 042-10 de 18 de agosto de 2010, según lo dispuesto, en el Voto 2010-020634 de las catorce horas y uno minutos del catorce de diciembre del dos mil diez. Se ordena a Alicia Borja Rodríguez, Alcaldesa de Curridabat, o a quien en su lugar ejerza ese cargo, que disponga lo necesario para que de manera inmediata, se cumpla la orden sanitaria Nº 042-10 de 18 de agosto de 2010, y lo dispuesto, en el Voto de esta Sala número 2010-020634 de las catorce horas y uno minutos del catorce de diciembre del dos mil diez, sobre lo cual deberá informar a esta Sala.
Se advierte a la recurrida que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Curridabat al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese esta resolución a Alicia Borja Rodríguez, Alcaldesa de Curridabat, o a quien en su lugar ejerza ese cargo, en forma personal. En lo respecta al Ministerio de Ambiente y Energía y a la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, se declara sin lugar el recurso...";
Redacta el Magistrado Chacón Jiménez; y,
Considerando:
ÚNICO. SOBRE LA ACTUACIÓN DE LA MUNICIPALIDAD DE CURRIDABAT EN RELACIÓN CON LA SENTENCIA NO. 2018-001540, DE LAS 09:15 HORAS DEL 02 DE FEBRERO DE 2019, LA CUAL FUE REITERADO SU CUMPLIMIENTO POR SENTENCIA NO. 2019-022417 DE LAS 9:30 HORAS DEL 13 DE NOVIEMBRE DE 2019 Y LA ACUSACIÓN DE DESOBEDIENCIA INTERPUESTA POR PARTE DE LOS RECURRENTES.- Los recurrentes acuden ante este Tribunal Constitucional, aduciendo la desobediencia a lo dispuesto en los votos Nos 2018001540 de las 9:15 horas del 02 de febrero de 2018 y 2019-022417 de las 9:30 horas del 13 de noviembre de 2019, por parte de la autoridad recurrida. Al respecto, Jimmy Cruz Jiménez, actual Alcalde de la Municipalidad de Curridabat, argumenta que la corporación municipal que representa, ha llevado a cabo las acciones tendentes a dar la solución a la problemática que enfrentan los recurrentes vecinos del -Residencial Tulipanes del cantón de Curridabat- y dar cumplimiento así a la Orden Sanitaria del Ministerio de Salud No. 042-2010 y a los votos de esta Sala Nos. 2018-001540 de las 9:15 horas del 02 de febrero de 2019 y 2019-022417 de las 9:30 horas del 13 de noviembre de 2019.
Dentro de las acciones realizadas menciona: 1- Elaboración del cronograma, 2- Remisión del cronograma al Área Rectora de Salud de Curridabat, 3- Contrato adicional No. 2016LA000014-01, Contratación de Servicios Profesionales de Ingeniería para la elaboración de un estudio de amenazas e inundación (fluvial y pluvial) para el cantón de Curridabat Urbanización Tulipanes, 4- Análisis del informe final del Ingeniero Javier Saborío Bejarano (C2293: Estudio topográfico, geomorfológico, hidrológico, hidráulico, geotécnico y solución preliminar del sitio "Urbanización Los Tulipanes, diciembre 2018), 5- Análisis Geográfico, 6- Solicitud de criterio legal: Previo a notificar a los propietarios, determinar jurídicamente si la obra constructiva en tulipanes debe de ser realizada únicamente por la municipalidad o en por los propietarios, 7- Acompañamiento comunitario: reunión con vecinos, talleres y entrega de información preliminar, 8- Elaboración de especificaciones técnicas para el diseño de la construcción de una obra de retención de muro de suelo cosido de la parte alta del talud, 9- Sobre demolición casa No. 50, 9.1- Debido proceso de notificación a propietaria previo a cualquier acción municipal.
Indicó además, que existen dos puntos de relevancia, siendo 1- LA CONSTRUCCIÓN DE SUELO COSIDO EN LA PARTE ALTA DEL TALUD y 2- DEMOLICIÓN DE LA CASA No. 50 Y EL DEBIDO PROCESO DE NOTIFICACIÓN PREVIO A CUALQUIER ACCIÓN MUNICIPAL. Mencionó que "…un desconocido llevó a cabo la demolición de la casa No. 50 en cuestión, sin contar con el permiso municipal para tal efecto…" y finalizó diciendo que por lo expuesto y las acciones realizadas no existe un incumplimiento de la sentencia en cuestión. Adiciona que el costo total de la obra y la inversión que la Municipalidad está realizando asciende a la suma de: ₡282.681.031.32, únicamente en cuanto a la parte constructiva se refiere. Por lo anterior la Municipalidad puso en marcha todo lo que conlleva realizar una obra de esta magnitud. Ya contando con los estudios correspondientes y el diseño de la obra, el siguiente paso consistió en la obtención de la Viabilidad Ambiental del Proyecto y el Permiso de Obra en Cauce de Dominio Público, ante la Secretaría Técnica Ambiental, para el cual se mantiene en ejecución la contratación 2020CD-000036-0023100001.
El 27 de mayo de 2020 se inició con dicha contratación, donde desde un primer momento se trabajó con la obtención de todos y cada uno de los requisitos exigidos por SETENA para la realización de este tipo de obras. Algunos de estos requisitos han sido complicados de cumplir, puesto que ha sido necesaria la preparación de una serie de informes y documentos en formato digital (de acuerdo a las especificaciones de la Secretaría Técnica Ambiental) que forman parte de los insumos de respaldo a la solicitud de viabilidad ambiental. Dentro de estos se pueden citar: estudio hidrológico, estudio geotécnico, estudio forestal, estudio ambiental, diseño estructural, etc.. Explicó que varios de los requisitos exigidos por ese ente gubernamental, han implicado atrasos en el proyecto, por ejemplo, solicitaron que se debía contar con el permiso del Juzgado Agrario para derribar los árboles que están en la zona de intervención.
La Municipalidad lideró este procedimiento ante el Segundo Circuito Judicial de San José, el cual tuvo que llegar hasta su última instancia para lograr la corta de los árboles, teniendo una duración desde agosto de 2020 hasta finales de febrero de 2021, donde el Tribunal Agrario mediante resolución N° 164-F-2021, de las 8:49 horas del 24 de febrero de 2021, donde se acogió la medida de seguridad solicitada por la Municipalidad de Curridabat y se autorizó la corta de aproximadamente 24 árboles que se encuentran sobre el talud del Río María Aguilar. Por otro lado, bajo la misma línea de pensamiento, otro de los requisitos exigidos fue solicitar a la Municipalidad presentar las cartas de anuencias por los propietarios en zonas privadas debidamente autenticadas, por donde obligatoriamente el muro deba ser construido. Ante esa situación el propietario de la casa 50 (la cual está 90% colapsada) se encuentra a nombre de una persona extranjera, sin residencia en el país y presuntamente fallecida, por lo que las gestiones formales de notificación y obtención del requisito han sido imposibles de realizar, actualmente se encuentra en proceso de notificación por edicto, luego de realizar el procedimiento de notificación correspondiente.
Esto ha implicado que deban plantearse medidas particulares a la Secretaría Técnica Ambiental para intentar subsanar los requerimientos. En conclusión, indicó el recurrido que no ha sido posible iniciar con el procedimiento de contratación administrativa, puesto que no se pueden generar compromisos contractuales hasta que no se disponga de la seguridad técnica y jurídica para garantizar una ejecución completa del proyecto y esto implica obtener los avales y permisos preliminares ya desarrollados, sin embargo, si se ha trabajado en los insumos técnicos y administrativos necesarios para que, en el momento de que se cuente con los avales preliminares, se pueda iniciar el proceso de contratación con la brevedad posible.
Al respecto, si bien es cierto, no desconoce esta Sala, que en efecto la municipalidad recurrida ha realizado acciones en busca de dar el cumplimiento referido, tanto a la Orden Sanitaria del Ministerio de Salud No. 042-2010, como a los votos Nos. 2018-001540 de las 9:15 horas del 02 de febrero de 2018 y 2019-022417 de las 9:30 horas del 13 de noviembre de 2019, lo cierto es, que la primera sentencia en cuestión, es clara en cuanto a que se dispusiera lo necesario para que de manera inmediata se diera cumplimiento a la orden sanitaria Nº 042-10 de 18 de agosto de 2010, y lo dispuesto, en el Voto de esta Sala número 2010-020634 de las catorce horas y uno minutos del catorce de diciembre del dos mil diez, sobre lo cual, se indicó también, que se debería informar a esta Sala, situación que a la fecha de rendición del informe, por parte del Alcalde de Curridabat –7 de mayo de 2021-, no se ha dado el cumplimiento de las sentencias referidas, lo cual precisamente acusan los recurrentes.
Así las cosas, se logra acreditar el incumplimiento de la autoridad recurrida, de la orden emanada por este Tribunal.
POR TANTO:
Se le reitera a Jimmy Cruz Jiménez, Alcalde de la Municipalidad de Curridabat, o a quien en su lugar ejerza ese cargo, que proceda al cumplimiento de lo dispuesto por esta Sala en las resoluciones No. 2018-001540 de las 9:15 horas del 02 de febrero de 2018, en la cual se indicó: "…Se ordena a Alicia Borja Rodríguez, Alcaldesa de Curridabat, o a quien en su lugar ejerza ese cargo, que disponga lo necesario para que de manera inmediata, se cumpla la orden sanitaria Nº 042-10 de 18 de agosto de 2010, y lo dispuesto, en el Voto de esta Sala número 2010-020634 de las catorce horas y uno minutos del catorce de diciembre del dos mil diez, sobre lo cual deberá informar a esta Sala…". Así como a lo dispuesto en la Sentencia No. y 2019-022417 de las 9:30 horas del 13 de noviembre de 2019, en la cual se dispuso: “Se le reitera a Alicia Borja Rodríguez, Alcaldesa de la Municipalidad de Curridabat, o a quien en su lugar ejerza ese cargo, que proceda al cumplimiento de lo dispuesto por esta Sala en la resolución No. 2018001540 de las 9:15 horas del 02 de febrero de 2018 (…)”. Lo anterior, bajo la advertencia de ordenarse un testimonio de piezas al Ministerio Público si no lo hiciere. Notifíquese.
