Constitutional challenge (acción de inconstitucionalidad) brought by Nombre01, of legal age, married, holder of a degree in Geology and a Doctorate in Natural Sciences, resident of San Rafael de Montes de Oca, bearer of identity card CED01; Nombre02, of legal age, married for the second time, an Architect specializing in Urban Planning and Land-Use Planning, and holder of a Master’s Degree in Urban Design, resident of San José, bearer of identity card N° CED02; and Nombre03, of legal age, married, attorney, resident of Palmares de Alajuela, bearer of identity card N° CED03; against Decreto Ejecutivo 38334-PLAN-MINAE-MIVAH-MOPT-S-MAG of March 10, 2014, Approving Plan GAM 2013-2030, Update of the Regional Plan for the Greater Metropolitan Area, published in La Gaceta N° 82 of April 30, 2014, and specifically Articles 25, 35, 39, and 69. Participating in the proceedings are the Procuraduría General de la República, the Ministerio de Ambiente y Energía (MINAE), the Secretaría Técnica Nacional Ambiental (SETENA), the Ministerio de Obras Públicas y Transportes (MOPT), the Ministerio de Agricultura y Ganadería (MAG), the Ministerio de Planificación Nacional y Política Económica (MIDEPLAN), the Ministerio de Vivienda y Asentamientos Humanos (MIVAH), the Ministerio de Salud (MS), the Instituto Nacional de Vivienda y Urbanismo (INVU), the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), the Instituto Costarricense de Acueductos y Alcantarillados (ICAA), the Sistema Nacional de Áreas de Conservación (SINAC), and the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE). Also participating as an intervening supporting party (coadyuvante) is Mr. Nombre04, in his capacity as Executive Secretary of the Plan Nacional de Desarrollo Urbano.

Findings:

  1. 1Judgment N° 2020-023743, issued at 12:10 hours on December 9, 2020, states the following in the operative portion of the challenge:

“Unanimously, the challenge is GRANTED. Consequently, Decreto Ejecutivo Nº 38334-PLAN-MINAE-MIVAH-MOPT-S-MOPT of March 10, 2014, is declared unconstitutional for violating the principle prohibiting the singular repeal of regulations (principio de inderogabilidad singular de las normas) and the right to a healthy and ecologically balanced environment, safeguarded by Article 50 of the Constitución Política. This judgment shall have declaratory and retroactive effect as of the date on which the annulled regulations entered into force, without prejudice to rights acquired in good faith. However, pursuant to Article 91 of the Ley de la Jurisdicción Constitucional, the effects of the judgment are tailored to avoid serious disruption to order and security, and Decreto Ejecutivo Nº 38334-PLAN-MINAE-MIVAH-MOPT-S-MOPT of March 10, 2014, the regulations declared unconstitutional, shall remain in force for a period of up to thirty-six months from the full publication of the judgment in the official gazette La Gaceta, so that new regulations may be issued containing a strategic environmental assessment (evaluación ambiental estratégica) or another technical study that adequately incorporates the environmental variable (variable ambiental) into the plan challenged in this action, before the Secretaría Técnica Nacional Ambiental.

If the foregoing does not occur within that period, Decreto Ejecutivo N° 38334-PLAN-MINAE-MIVAH-MOPT-S-MAG of March 10, 2014, shall be deemed definitively removed from the legal system. Given the manner in which the matter is decided, no ruling is made on the remaining substantive arguments raised in this challenge. Justice Nombre05 provides additional reasons. Justice Nombre06 and Justice Nombre07 submit separate notes. Justice Nombre08 dissents with respect to the tailoring of the effects of this judgment and, pursuant to Article 91 of the Ley de la Jurisdicción Constitucional, states that the Poder Ejecutivo must submit the plan provided for in the aforementioned decree to the strategic environmental assessment process or another study incorporating the environmental variable before the Secretaria Técnica Nacional Ambiental, which must issue the corresponding decision. All of the foregoing must be completed within a maximum period of thirty-six months from the full publication of this judgment in the Boletín Judicial.

Enforcement of this ruling shall take place before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of the Código Procesal Contencioso Administrativo. The decree shall remain in force during the period granted. If the obligation imposed herein is not fulfilled within the stated period, the declaration of nullity shall take full legal effect. A copy of the judgment shall be sent to the Área de Ejecución del Tribunal de lo Contencioso Administrativo y Civil de Hacienda so that it may commence proceedings to enforce this ruling. Justice Nombre08 also submits a note. This ruling shall be communicated to the Poderes Legislativo, Ejecutivo y Judicial, as well as to the institutions appearing in the case file. A summary of this ruling shall be published in the official gazette La Gaceta, and the full text shall be published in the Boletín Judicial.

Notice shall be given.” It has now been noted, on the Court’s own motion, that the operative portion of this judgment did not include the separate note submitted by Justice Nombre09, although it should have done so; accordingly, the foregoing must be added pursuant to Article 12 of the Ley de la Jurisdicción Constitucional, in order to give full effect to the content of the ruling.

  1. 2Furthermore, before the judgment was served, the petitioner filed several submissions entitled requests for clarification and supplementation (aclaración y adición), in which he alleges that the implications of keeping Plan GAM 2013-2030 in force for an additional thirty-six months must be corrected because this causes a denial of the right to a defense, serious harm, and injustice by failing to use the official PRUGAM Environmental Fragility Index (Índice de Fragilidad Ambiental, IFA) Geo-suitability—Landslide Hazard Factor map, among other arguments. He believes that the aforementioned period should be reversed on the basis of scientific and technical arguments that he considers support his position.
  2. 3Article 12 of the Ley de la Jurisdicción Constitucional provides that judgments issued by the Sala may be clarified or supplemented, at the request of a party, if requested within three days, and on the Court’s own motion at any time, including during enforcement proceedings, insofar as necessary to give full effect to the content of the ruling.

Justice Nombre10 drafts the opinion; and,

Considerations:

I.Concerning the need to amend Judgment N° 2020-023743 on the Court’s own motion. In accordance with the doctrine underlying Article 12 of the Ley de la Jurisdicción Constitucional, it is necessary to supplement the content of the operative portion of Judgment N° 2020-023743, issued at 12:10 hours on December 9, 2020, because the note of Justice Nombre09, which forms an integral part of the judgment’s text, was omitted. Accordingly, the Sala considers that, in order to reflect the will of the members of the Court, the operative portion of Judgment N° 2020-023743, issued at 12:10 hours on December 9, 2020, must be supplemented; consequently, the supplemented Por tanto shall read as transcribed in the operative portion of this judgment.

II.Concerning the submissions filed. The requests for clarification and supplementation filed by petitioner Nombre11 on December 20, the reiteration of those and other arguments on January 3, as well as on January 22, are not intended to have this Court supplement or clarify the content of the ruling, but rather to have it modify or revoke the judgment issued in these proceedings because he considers that deciding otherwise leaves the inhabitants of the GAM without a defense and that this Court must replace the instruments currently in force with those of the PRUGAM, among other matters. That request is inadmissible because the full text of Judgment N° 2020-023743, issued at 12:10 hours on December 9, 2020, has not been served on the parties; that text contains the factual and legal grounds on which the Sala declared the challenged Decreto Ejecutivo unconstitutional. Therefore, he has filed prematurely because he has not had an opportunity to learn the reasons why this Court decided as it did, and the Sala should consequently not entertain the submissions filed (see, to similar effect, Judgments N° 2001-1478 issued at 15:15 hours on February 21, 2001, N° 2003-06918 issued at 14:37 hours on July 15, 2003, N° 2003-07263 issued at 8:45 hours on July 18, 2003, and N° 2004-03290 issued at 15:04 hours on March 30, 2004, among others).

Furthermore, the petitioner is hereby informed that, although in the jurisdiction for the protection of liberty (jurisdicción de la libertad), which hears habeas corpus and amparo petitions, submissions may be entertained without authentication, the situation is different in constitutional challenges. Thus, the first paragraph of Article 78 of the Ley de la Jurisdicción Constitucional establishes the obligation to file submissions in constitutional challenges duly authenticated by a legal professional in order for them to be entertained by the Court at the appropriate time and with the legal reasoning of the legal professional who assumes responsibility for the respective pleading; professional legal representation is therefore required to direct the technical and legal content of the submission and ensure its soundness from a legal standpoint. None of the submissions was filed with the corresponding authentication.

Consequently, the submissions filed are denied.

III.Documentation submitted to the case file. The parties are advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device, or produced using new technologies, these must be collected from the Court’s offices within a maximum period of thirty business days from service of this judgment. Otherwise, any material not collected within this period shall be destroyed, in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena in Session N° 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial N° 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at Session N° 43-12 held on May 3, 2012, Article LXXXI.

Consequently, Decreto Ejecutivo Nº 38334-PLAN-MINAE-MIVAH-MOPT-S-MOPT of 10 de marzo de 2014 is declared unconstitutional for violating the principle that rules may not be derogated from in individual cases (principio de inderogabilidad singular de las normas) and the right to a healthy and ecologically balanced environment, protected under artículo 50 of the Constitución Política. This judgment has declaratory and retroactive effect as of the effective date of the annulled regulations, without prejudice to rights acquired in good faith. However, pursuant to artículo 91 of the Ley de la Jurisdicción Constitucional, the effects of the judgment are tailored to prevent serious disruption to public order and security, and Decreto Ejecutivo Nº 38334-PLAN-MINAE-MIVAH-MOPT-S-MOPT of 10 de marzo de 2014, the regulations declared unconstitutional, shall remain in force for up to thirty-six months from the full publication of the judgment in the official gazette La Gaceta, so that new regulations may be issued containing a strategic environmental assessment (evaluación ambiental estratégica) process or another technical study that adequately incorporates the environmental variable (variable ambiental) into the plan challenged in this action, before the Secretaría Técnica Nacional Ambiental.

Resultando:

  1. 1Por Sentencia N° 2020-023743 de las 12:10 horas del 9 de diciembre de 2020, consta en la parte dispositiva de la acción, lo siguiente:

“Por unanimidad, se declara CON LUGAR la acción. En consecuencia, se declara inconstitucional el Decreto Ejecutivo Nº 38334-PLAN-MINAE-MIVAH-MOPT-S-MOPT del 10 de marzo de 2014, por violación al principio de inderogabilidad singular de las normas y al derecho al ambiente sano y ecológicamente equilibrado, resguardado en el artículo 50 de la Constitución Política. Esta sentencia tiene efectos declarativos y retroactivos a la fecha de vigencia de la normativa anulada, sin perjuicio de los derechos adquiridos de buena fe. Sin embargo, de conformidad con lo dispuesto por el artículo 91 de la Ley de la Jurisdicción Constitucional, se dimensionan los efectos de la sentencia para evitar serias dislocaciones al orden y la seguridad, y se mantiene la vigencia del Decreto Ejecutivo Nº 38334-PLAN-MINAE-MIVAH-MOPT-S-MOPT del 10 de marzo de 2014 normativa declarada inconstitucional, hasta por un plazo de treinta y seis meses a partir de la publicación íntegra de la sentencia en el diario oficial La Gaceta, para que se emita una nueva normativa que contenga un proceso de evaluación ambiental estratégica u otro estudio técnico que incorpore adecuadamente la variable ambiental al plan objeto de esta acción, ante la Secretaría Técnica Nacional Ambiental.

De no producirse lo anterior, en ese plazo, se tendrá por expulsado -definitivamente- del ordenamiento jurídico el Decreto Ejecutivo N° 38334-PLAN-MINAE-MIVAH-MOPT-S-MAG del 10 de marzo de 2014. Por la forma en que se resuelve, se omite pronunciamiento sobre el resto de los argumentos de fondo esgrimidos en esta acción. El Magistrado Nombre05 da razones adicionales. El Magistrado Nombre06 y la Magistrada Nombre07 consigan notas separadas. La Magistrada Nombre08 salva el voto respecto del dimensionamiento de los efectos de esta sentencia y de conformidad el artículo 91 de la Ley de la Jurisdicción Constitucional, indica que el Poder Ejecutivo deberá proceder a someter el plan previsto en el mencionado decreto al proceso de evaluación ambiental estratégica u otro estudio que incorpore la variable ambiental ante la Secretaria Técnica Nacional Ambiental, la que deberá dictar una resolución que corresponda.

Todo anterior deberá estar concluido dentro del plazo máximo de treinta y seis meses contado a partir de la publicación integra de esta sentencia en el Boletín Judicial. La ejecución de este pronunciamiento se realizará ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia del Código Procesal Contencioso Administrativo. Durante el plazo otorgado el decreto se mantendrá vigente. En caso de no cumplirse con la obligación aquí impuesta dentro del plazo indicado, la declaración de nulidad surtirá plenos efectos jurídicos. Remítasele copia de la sentencia al Área de Ejecución del Tribunal de lo Contencioso Administrativo y Civil de Hacienda para que inicie los procedimientos de ejecución de este fallo. Además, la Magistrada Nombre08 consigna nota. Comuníquese este pronunciamiento a los Poderes Legislativo, Ejecutivo y Judicial, así como a las instituciones apersonas al expediente. Reséñese este pronunciamiento en el diario oficial La Gaceta y publíquese íntegramente en el Boletín Judicial. Notifíquese”.

Ahora bien, se ha advertido -de oficio- que, en la parte dispositiva de esta sentencia, no se consignó la nota separada consignada por el Magistrado Nombre09, cuando así debía hacerse; de modo que debe adicionarse, lo anterior, al tenor del artículo 12, de la Ley de la Jurisdicción Constitucional, con el fin de dar cabal cumplimiento al contenido del fallo.

  1. 2Por otra parte, antes de la notificación de la sentencia, el accionante presentó varios escritos intitulados como aclaración y adición, en los que alega que las implicaciones de mantener vigente el Plan GAM 2013-2030 por treinta y seis meses más, debe corregirse porque causa indefensión, grave perjuicio e injusticia, al no utilizar el mapa oficial de Índice de Fragilidad Ambiental (IFA) Geoaptitud – Factor Amenaza por Deslizamientos del PRUGAM, entre otros razonamientos. Estima, que se debe revertir el mencionado plazo con fundamento en argumentos científicos y técnicos que considera le asisten.
  2. 3El artículo 12, de la Ley de la Jurisdicción Constitucional, establece que las sentencias que dicte la Sala podrán ser aclaradas o adicionadas, a petición de parte, si se solicitare dentro de tercero día, y de oficio en cualquier tiempo, incluso en los procedimientos de ejecución, en la medida en que sea necesario para dar cabal cumplimiento al contenido del fallo.

Redacta el Magistrado Nombre10; y,

Considerando:

I.Sobre la necesidad de enmendar de oficio la sentencia N° 2020-023743. De conformidad con la doctrina que informa al artículo 12, de la Ley de la Jurisdicción Constitucional, se hace necesario adicionar el contenido en la parte dispositiva de la Sentencia N° 2020-023743 de las 12:10 horas del 9 de diciembre de 2020, toda vez que, se omitió consignar la nota del Magistrado Nombre09, que es parte integral del texto de la sentencia. De este modo, la Sala estima que, para reflejar la voluntad de los integrantes del Tribunal, debe adicionarse la parte dispositiva de la Sentencia N° 2020-023743 de las 12:10 horas del 9 de diciembre de 2020; de manera tal, que el por tanto adicionado deberá quedar como se transcribe en la parte dispositiva de esta sentencia.

II.Sobre las gestiones presentadas. Mediante gestiones de aclaración y adición presentadas por el accionante Nombre11 el 20 de diciembre, y la reiteración de esos y otros argumentos del 3 de enero, así como el 22 de ese mes, no tienen como fin que este Tribunal adicione o aclare el contenido del fallo, sino que modifique o revoque la sentencia dictada en este proceso por cuanto considera que resolver de otra manera pone en indefensión a los habitantes del GAM, y que este Tribunal debe sustituir los instrumentos vigentes por los del PRUGAM, entre otras cosas. Esa pretensión no resulta procedente, toda vez que el texto íntegro de la Sentencia N° 2020-023743 de las 12:10 horas del 9 de diciembre de 2020, no ha sido notificada a las partes, donde constan las razones de hecho y de derecho por las cuales la Sala declaró la inconstitucionalidad del Decreto Ejecutivo impugnado. De ahí que, gestiona de forma prematura porque no le ha sido posible enterarse de las razones por las cuales este Tribunal resolvió de la manera que lo hizo, razón por la cual la Sala no debe atender las gestiones presentadas (véase en sentido similar las Sentencias N° 2001-1478 de las 15:15 horas del 21 de febrero del 2001, N° 2003-06918 de las 14:37 horas del 15 de julio de 2003, N° 2003-07263 de las 8:45 horas del 18 de julio de 2003 y N° 2004-03290 de las 15:04 horas del 30 de marzo del 2004, entre otras).

Por otra parte, se le hace saber al accionante, que se bien en la jurisdicción de la libertad, que conoce de los recursos de hábeas corpus y de amparo, si es posible atender los escritos sin la necesidad de autenticación, en las acciones de inconstitucionalidad es diferente. Así, el artículo 78, párrafo primero, de la Ley de la Jurisdicción Constitucional, establece la obligación de incoar el escrito en las acciones de inconstitucionalidad debidamente autenticados por un profesional de derecho, con el fin de que sean atendidas por el Tribunal, y en el momento oportuno y con el razonamiento jurídico del profesional en Derecho que se hace responsable del respectivo libelo, de ahí que se requiere de la necesidad de la dirección profesional como director del contenido técnico-jurídico de la gestión, así como su solidez desde el punto de vista jurídico. Ninguno de los escritos, fue incoado con la autenticación respectiva.

En consecuencia de lo anterior, no ha lugar a las gestiones presentadas.

III.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se adiciona la parte dispositiva de la Sentencia 2020-023743 de las 12:10 horas del 9 de diciembre de 2020, para que se lea de la siguiente manera:

“Por unanimidad, se declara CON LUGAR la acción. En consecuencia, se declara inconstitucional el Decreto Ejecutivo Nº 38334-PLAN-MINAE-MIVAH-MOPT-S-MOPT del 10 de marzo de 2014, por violación al principio de inderogabilidad singular de las normas y al derecho al ambiente sano y ecológicamente equilibrado, resguardado en el artículo 50 de la Constitución Política. Esta sentencia tiene efectos declarativos y retroactivos a la fecha de vigencia de la normativa anulada, sin perjuicio de los derechos adquiridos de buena fe.
