Findings:

  1. 1By a written submission received by the Secretariat of the Chamber at 16:15 on 12 de marzo de 2021, the petitioners filed an application for amparo relief against the Consejo Nacional de Vialidad (CONAVI) and the Municipalidad de Tibás. They state that they are residents of the community known as séptima etapa de Cuatro Reinas de Tibás, Distrito Colima, and that their residential development (urbanización) borders to the southwest on the carretera de circunvalación norte, which is currently under construction. They explain that they have been dealing with all the inconveniences caused by that development, which they understand is for the good of the country; however, no consideration has been given to the health of the population, even though they have contacted both the mayor and UNOPS since enero de 2018. They state that they have had to contend with construction noise in the early morning hours, vibrations in their windows, and even objects falling inside some homes.They assert that there are now piles of sand next to the walls of the homes; the piles are higher than the walls, and the wind blows the sand into their homes. There is also water seepage from the construction, and their greatest concern is that no retaining wall (muro de contención) has been built to prevent a vehicle leaving the roadway from causing an accident inside the residential development or in the children’s playground, because the side road runs at the height of their walls and vehicles travel downhill from east to west. They state that they have taken the following steps:1) a letter to Mayor Nombre36 dated 28 de enero de 2018, the response contained in the mayor’s official letter (oficio) MT-AL-0078-2018, and the community’s reply dated 8 de febrero; a meeting was then held with the participation of the mayor and representatives of the contractor Estrella Hernán Solís, but no solution to their requests was achieved.2) Through social liaison (regente social) Manuel Antonio Villalobos, a meeting with the community was arranged for 11 de diciembre de 2018. He was given a letter setting out their concerns, and a chat group was also created to report any irregularity; however, although repeated reports were made that the agreed working hours were not being respected—not working beyond 10:00 at night—the work continued until late at night, disturbing the sleep of those living nearby. The same occurred with the accumulations of sand, because not even shade netting (sarán) was installed to prevent contamination.3) A letter to Mayor Nombre36 dated 22 de enero de 2020, reiterating the two foregoing points and expressing their concern about the danger caused by the lack of walls along the boundaries with the roadway, including the children’s playground, which is completely exposed; that letter received no response.4) An email to Mayor Nombre36 dated 15 de setiembre de 2020, copied to Manuel Antonio Villalobos of UNOPS, raising the issue of water seepage through the walls and the problems caused by the partial “wall” built by the construction company parallel to the residents’ walls, which left an open space between them that merely encourages mosquito breeding and provides shelter for other animals. They explain that Mr. Manuel Villalobos responded to that email, but addressed only the issue of seepage through the walls. In that regard, he reported that Unidad Funcional II B, the section bordering their residential development, had been suspended and that all they could do was wait.5) An email to Mr. Manuel Villalobos of UNOPS in which they expressed concern about the announced opening of that section of the roadway during the first quarter of 2021 without the reported problems having been resolved, particularly the danger caused by the failure to build a wall protecting the community. They state that they were told a response would be sent through the “Whatsapp” chat, but they have received no communication. They complain that the sand causes them constant allergies, adversely affecting the residents’ health, and that work continuing until late at night deprives them of sleep. They argue that they need to rest, especially now that classes are beginning, and that older adults’ health is being affected because they live near the last entrances—the fourth and fifth—which are most affected by the construction. They request that the appropriate authority, whether the Consejo Nacional de Vialidad or the Municipalidad de Nombre36, be ordered, before that section of roadway is delivered and placed into operation, to build a wall with sufficient structural support and higher than the community’s walls, including along the boundary of the children’s playground, to protect the homes, common areas, and the general population from any traffic accident caused by a vehicle leaving that roadway, as well as from any vibration or excessive noise caused by the traffic that will begin flowing as soon as it is opened. Regarding the remainder of the construction, they request that the Consejo Nacional de Vialidad be ordered to supervise the contractor Estrella Hernán Solís and ensure that it takes the appropriate measures to: 1) cover the accumulated piles of sand so that the sand does not harm the residents’ health; and 2) limit working hours to 10:00 at night.
  2. 2By an order issued at 19:57 on 15 de marzo de 2021, the proceeding was admitted, and the respondent authorities were ordered to submit a report concerning the facts alleged by the petitioners.
  3. 3In a written submission added to the digital case file at 9:45 hours on 23 March 2021, Carlos Luis Cascante Duarte, in his capacity as Mayor of the Municipalidad de Tibás, reports under oath. He states that, as the residents indicate, they did indeed approach him, and he assisted them by providing space inside the municipal building where they could meet and raise, during the various meetings held, all their concerns regarding the road project under development. He states that, by note dated 29 January 2018, the residents requested this Municipality’s intervention before the corresponding authorities. He explains that, through official letter N° MT-AL-0078-2018 of 07 February 2018, the executive director of CONAVI was asked to:1) Conduct a study of the impact of noise pollution (contaminación sónica);2) analyze and construct walls with barriers that would mitigate the noise caused by passing vehicles;3) verify that the elevated bridge had adequate guardrails to provide protection in the event of an accident; and4) assess and eliminate any possibility of vacant spaces being created between the highway wall and the perimeter wall of the residential development, because, according to the plans and the site visit conducted, a wedge-shaped parcel was identified within the final 30 meters of the 7th Stage residential development that could remain at the site, which would create a strong temptation for informal settlements or criminal hideouts to be established there.” He asserts that copies of that official letter were sent to the Ministerio de Obras Públicas y Transportes, CONAVI, the supervisor of the Circunvalación Norte Project, and UNOPS, because those institutions are responsible for providing a solution, as this is a national public work outside the Municipality’s jurisdiction. Nevertheless, he states that the Municipalidad de Nombre36 has sought to secure the corresponding interinstitutional cooperation. He further indicates that, on 22 January 2020, the petitioners sent a note requesting the Local Government’s assistance, specifically the construction of a wall or high perimeter wall near the children’s playground to protect the children and other users, in order to prevent any vehicle accident from affecting the vicinity of the recreation area. They also requested the construction of higher perimeter walls in the entrance areas adjoining the highway under construction, or the installation of higher fencing, in order to prevent criminals from entering the residential development. He adds that, on 15 March 2021, through official letter N° MT-AL-0087-2021, he informed the Ministro de Obras Públicas y Transportes, Ing. Rodolfo Méndez Mata, of the situation described by the petitioners and reminded him of the matters stated in official letter N° MTE-AL-0078-2018 of 07 February 2018. He adds that, through official letter N° MT-AL-0086-2021 dated 15 March 2021, the petitioners were informed of the communication sent to MOPT. Lastly, he states that the matter concerning the well has already been addressed by the company H Solís. He requests that the petition be denied.
  4. 4In a written submission added to the digital case file at 11:11 hours on 24 March 2021, Mario Rodríguez Vargas, in his capacity as executive director of the Consejo Nacional de Vialidad (COSEVI), reports under oath. He states that the Consejo Nacional de Vialidad is indeed carrying out the project entitled “Design and Construction of the ‘Circunvalación Norte’ Road Corridor, Dirección01 (Intersection with National Route No.108)-Dirección02 (Intersection with National Route No.109),” arising from International Public Tender 2013LI-000008-0DE00, whose route passes near the district of Colima and, therefore, near the area known as the seventh stage of the Cuatro Reinas residential development. He states that the arguments set forth by the petitioners in their initial filing reveal three points of disagreement, namely: “noise from work performed during the early-morning hours, stockpiling of material near the residential development that causes dust and water-seepage problems, and the construction of a retaining wall (muro de contención).” He indicates that, to address this petition, a technical report was requested from the entity responsible for supervising the project, namely the Oficina de las Naciones Unidas de Servicios para Proyectos (UNOPS), which has also undertaken responsibility for matters related to the environmental and social management of the Circunvalación Norte project (Anexo No. 1).He explains that, regarding the first two points raised, when the project management received the complaint, the Project Implementation Unit (Unidad Ejecutora) responsible for the project sent official letter POE-08-20021-0062, dated 20 January 2021, to the project’s environmental manager (regencia ambiental), referring to the two situations identified—the stockpiling of material where the project adjoins the residential development and excessive noise—and requesting that the corresponding measures be taken to remedy the situation and thereby prevent inconvenience to the residents. He states that the machinery noise occurring after 10:00 pm resulted from an exceptional incident involving the contractor’s transportation of material at Dirección03 and does not correspond to the project’s normal nighttime operations, whose working hours may not extend beyond 10:00 pm. He adds that, regarding the noise inherent to the project, the social-management team continuously conducts noise measurements or monitoring throughout the entire project, reaching the following conclusion: “…In addition to the ongoing social management, noise monitoring is conducted during daytime hours at various points throughout the project to verify decibel levels in areas adjacent to the construction work.The reports for December 2020 and January 2021 are attached as Annex 4, Noise Measurements December 2020, January 2021. The December 2020 results show that, in the residential area for the month of January, the applicable standard’s requirements were not exceeded at the time of measurement. In the commercial area, levels remain close to the limit, although it must be considered that there is ambient background noise that does not necessarily originate exclusively from the project. The same situation can be observed in the January 2021 measurements, except for the reading taken at the plant site, where the mitigation measure applies to personnel working on-site, who must use hearing protection because this point was measured on-site next to the plant.” He further states that, regarding the accumulation of sand near the residential development that was affecting residents, the cited report indicated that, according to the information received, the stockpiled material was used to construct the viaduct’s ascending ramp.That work has since been completed, and the relevant section has even been paved with asphalt; consequently, there is no longer any dust-related impact at the site. Regarding the allegations of water seepage through the walls of the properties adjoining the project, he states that the project-supervision team, and specifically the social-management team, has addressed reports of alleged water seepage. These reports have been discussed at meetings and during field visits by the social-management team, during which the temporary drainage installed pending completion of the work in that area has been assessed. He further reports that the area has now been waterproofed with an asphalt surface and that a storm drain has been constructed to prevent water from potentially flowing toward the area. He adds that the third point is the request made in the petition for the construction of a “(…) wall with sufficient structural support and higher than the perimeter walls of our Community, including along the boundary of the children’s playground, to protect our homes, common areas, and the population in general from any traffic accident caused by a collision or by a vehicle leaving that highway and entering our Community.” Regarding this specific point, he states that, during meetings held with the community, residents were informed that a solution to their concern would be analyzed.Nevertheless, as stated in the attached technical report, that functional unit has been suspended; therefore, a technical road-safety solution for that location will be analyzed once the project work at the site resumes, thereby allowing the residents’ stated concern to be addressed in a timely manner. He notes that the Administration has responded promptly to the concerns and complaints of the residents of the seventh stage of the Urbanización Cuatro Reinas, including the noise problems, which have been continuously monitored to ensure that authorized limits are not exceeded. When an incident has exceptionally occurred outside authorized nighttime hours, the appropriate steps have been taken before the environmental manager, as the contractor’s representative, so that corrective measures may be adopted. He asserts that, as demonstrated by the photographs submitted of the site, the issue involving the stockpiling of material that caused dust-related inconvenience in the community has now been resolved, because the section in question—the ramp—has been properly paved with asphalt.Likewise, regarding the request to construct a wall along the boundary between the project and the community, the most suitable road-safety solution for that location will be analyzed in response to the residents’ concern. He requests that the petition be denied.
  5. 5In a written submission added to the digital case file at 18:42 hours on 24 March 2021, Mario Rodríguez Vargas, in his capacity as president of the Concejo Municipal de Tibás, reports under oath. He states that it must be noted that the Circunvalación Norte project forms part of the national road network and that the construction, upgrading, and maintenance of those roads fall within the jurisdiction of the Central Government, through the Ministerio de Obras Públicas y Transportes. Consequently, the Concejo Municipal over which he presides has no authority over the project’s overall aspects, such as road safety, construction matters within the right-of-way (derecho de vía), and similar matters relating to the complaints made by the residents of the seventh stage of Cuatro Reinas. He states that, notwithstanding the foregoing, as shown by official letters MTAL-0087-2021 and MT-AL~0086-202l, during the current year the municipal government, acting through the Municipal Mayor, formally used its good offices to convey to the responsible parties the residents’ concerns, which it had previously conveyed as well.He clarifies that the Municipality has not failed to address the residents’ requests and shares their concerns. Nevertheless, because of the specific allocation of jurisdiction, it is unable to invest resources or issue orders to expand or alter the designs and work carried out by the competent public institutions in order to address the concerns of the petitioning residents. Accordingly, he requests that the petition be denied.
  6. 6The legal requirements have been observed in the proceedings followed.

Justice Salazar Alvarado drafts the opinion; and,

Considering:

I. PRELIMINARY CLARIFICATION

Before analyzing the merits of the matter, it must be clarified that, since Judgment N° 2008-02545 of 8:55 a.m. on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with some exceptions—those matters in which it is disputed whether the Public Administration has complied with the time limits established in the Ley General de la Administración Pública (Articles 261 and 325) or in sector-specific laws governing special administrative proceedings, either to conclude through a final decision an administrative proceeding initiated ex officio or at the request of a party, or to hear the applicable administrative appeals. Specifically, the sub lite presents an exceptional circumstance, since it concerns the alleged failure to maintain a street and infrastructure works, which the Chamber understands may endanger persons traveling through the area. Having clarified this point, the Chamber proceeds to rule on the specific situation raised in this amparo proceeding (amparo).

II. SUBJECT MATTER OF THE PETITION

The petitioners state that they are residents of the community known as the seventh stage of Cuatro Reinas de Tibás, Distrito Colima, and that their residential development (urbanización) borders to the southwest on the northern beltway, which is currently under construction. According to their statements, they have had to endure construction noise during the early-morning hours. They assert that there are now piles of sand next to the walls of the homes, that the piles rise above the walls, and that the wind carries the sand into their homes. There is also seepage of water from the construction site, and what concerns them most is that no retaining wall (muro de contención) has been built to prevent a vehicle leaving the roadway from causing an accident within the residential development or in the children’s park, because the frontage road runs at the height of their walls and vehicles travel downhill from east to west.

III. PROVEN FACTS

The following facts are deemed duly established and relevant to the decision in this matter, either because they have been substantiated or because the respondent failed to address them as ordered in the initial order:

  • a)The Consejo Nacional de Vialidad (COSEVI) is carrying out the project entitled “Design and Construction of the ‘Circunvalación Norte’ Road Corridor, National Route No.Dirección04 (Junction with National Route No.108)–Dirección02 (Junction with National Route No.109),” resulting from International Public Tender 2013LI-000008-0DE00, whose route passes near Distrito Colima and, consequently, the area known as the seventh stage of the Cuatro Reinas residential development (see the sworn report submitted by COSEVI and the attached evidence).
  • b)On 29 de enero de 2018, the petitioners sent a letter to Mayor Nombre36 requesting his intervention before the authorities responsible for building the road, because there was sand next to the walls of the homes and the piles rose above the walls. In addition, the wind carried the sand into their homes, there was seepage of water from the construction site, and what concerned them most was that no retaining wall had been built to prevent a vehicle from leaving the roadway and causing an accident within the residential development or in the children’s park, because the frontage road ran at the height of their walls and vehicles traveled from east to west (see the petition and attached evidence).
  • c)On 07 de febrero de 2018, in response to the official communication dated 29 de enero de 2018, through official communication N° MT-AL-0078-2018, the mayor of the Municipalidad de Tibás requested that the executive director of CONAVI: “…1) Conduct a study of the impact of noise pollution; 2) Analyze and build walls with barriers that mitigate the noise caused by passing vehicles; 3) Verify that the elevated bridge has appropriate guardrails to provide protection in the event of an accident; 4) Evaluate and eliminate any possibility of vacant areas being created between the roadway wall and the wall of the residential development, since, based on the plans and the site visit, a wedge-shaped parcel was identified in the final 30 meters of the 7th Stage residential development that might remain at the site, which would create a strong temptation for informal settlements or criminal hideouts to be established there.” A copy of that official communication was sent to the Ministerio de Obras Públicas y Transportes, CONAVI, the supervisor of the Proyecto de Circunvalación Norte, and UNOPS, as these are the institutions responsible for providing a solution because it is a national project (see the sworn report submitted by the municipal entity and the attached evidence).
  • d)On 08 de febrero de 2018, a meeting was held with the participation of the mayor and representatives of the contractor Estrella Hernán Solís (see the petition and attached evidence).
  • e)Through social compliance officer (regente social) Manuel Antonio Villalobos, a meeting with the community was arranged for 11 de diciembre de 2018. The petitioner residents delivered a letter outlining their concerns to Mr. Villalobos, and a chat group was also created to report any irregularities (see the petition and attached evidence).
  • f)On 20 de enero de 2021, the Project Implementation Unit sent an official communication (POE-08-20021-0062) to the project’s environmental oversight office (regencia ambiental), referring to two situations identified by the petitioners—material stockpiling (acopio de material) along the boundary between the project and the residential development, and excessive noise—and requesting that the appropriate measures be taken to remedy the situation (see the sworn report submitted by COSEVI and the attached evidence).
  • g)On 22 de enero de 2020, the petitioners sent a letter to the mayor of Tibás reiterating the situation described and expressing their concern about the unsafe conditions caused by the absence of walls along the boundaries with the roadway, including at the children’s park, which was completely exposed (see the petition and attached evidence).
  • h)On 15 de marzo de 2021, through official communication N° MT-AL-0087-2021, the mayor of Nombre36 informed the Minister of Public Works and Transportation, Eng. Rodolfo Méndez Mata, of the situation described by the petitioners and also reminded him of the matters stated in official communication N° MTE-AL-0078-2018 of 07 de febrero de 2018 (see the sworn report submitted by the municipal entity and the attached evidence).
  • i)On 15 de marzo de 2021, through official communication N° MT-AL-0086-2021, the mayor of Tibás informed the petitioners of the action taken before MOPT (see the sworn report submitted by the municipal entity and the attached evidence).
  • j)With regard to machinery noise occurring after 22:00 hours, this was an exceptional situation involving the contractor’s transportation of material in Dirección03 and is not part of the project’s normal nighttime operations, whose working hours may not extend beyond 22:00 hours. As to the noise generated by the project itself, the social management team continuously conducts noise measurements or monitoring throughout the entire project, reaching the following conclusion: “…In addition to the ongoing social management activities, noise monitoring is conducted during daytime hours at various points throughout the project to verify decibel levels in areas adjacent to the work. The reports for diciembre de 2020 and enero de 2021 are attached as Annex 4, Noise measurements for diciembre de 2020 and enero de 2021. The results from diciembre de 2020 show that, in the residential area for the month of enero, the applicable standard was not exceeded at the time of measurement.

In the commercial area, the readings remain close to the limit, although it must be considered that there is ambient background noise that does not necessarily originate exclusively from the project. The same situation is observed in the enero de 2021 measurements, except for the reading taken at the plant site, where the mitigation measure applies to personnel working on-site, who must use hearing protection because that reading was taken at the site next to the plant.” (see the sworn report submitted by COSEVI and the attached evidence—photographs of the measurements and graphical decibel scales).

  • k)With regard to the accumulation of sand near the residential development that affected residents, the stockpiled material was used to construct the viaduct’s ascending ramp. That work has now been completed and the relevant section has even been paved with asphalt; consequently, the site is no longer affected by dust (see the sworn report submitted by COSEVI and the attached evidence).
  • l)With regard to water seepage through the walls of the properties bordering the project, reports of alleged water seepage have been addressed. These reports have been discussed during meetings and field visits conducted by the social management team, during which the temporary drainage installed pending completion of the work in the area was evaluated. Moreover, the area has now been waterproofed with an asphalt surface (carpeta asfáltica), and a storm drain (tragante) has been built to prevent the possible flow of water toward the residential area (see the sworn report submitted by COSEVI and the attached evidence).

IV. UNPROVEN FACT

The following fact relevant to this decision is not deemed established:

  • a)That a wall with sufficient structural support and rising above the walls of the community in which the petitioners reside, as well as along the boundary of the children’s park, has been erected to protect their homes, common areas, and the general population from any traffic accident caused by a collision or by a vehicle leaving that roadway and entering the area known as the seventh stage of the Cuatro Reinas residential development.
  • b)That machinery noise does not extend beyond the established working hours ending at 22:00 hours.

V. REGARDING THE SPECIFIC CASE

In the case before us, the report submitted by the representatives of the respondent authorities—deemed to have been given under oath, with due warning of the criminal consequences provided for in Article 44 of the Law governing this jurisdiction—establishes that the Consejo Nacional de Vialidad (COSEVI) is indeed carrying out the project entitled “Design and Construction of the ‘Circunvalación Norte’ Road Corridor, Dirección01 (Junction with National Route No.108)–Dirección02 (Junction with National Route No.109),” arising from International Public Tender (Licitación Pública Internacional) 2013LI-000008-0DE00, whose route passes near the district of Colima and, consequently, the area known as the seventh phase of the Cuatro Reinas residential development. It is established that, on January 29, 2018, the petitioners sent a letter to Mayor Nombre36 requesting his intervention with the authorities responsible for constructing the highway, because sand had accumulated beside the walls of the homes and the piles were higher than those walls.

In addition, the wind carried the sand into their homes; there was also seepage of water from the construction site; and their greatest concern was that no retaining wall (muro de contención) had been built to prevent a vehicle from leaving the roadway and causing an accident within the residential development or in the children’s park, because the frontage road runs at the height of their walls and vehicles travel east to west. It is verified that, on February 07, 2018, in response to the communication dated January 29, 2018, by official letter N° MT-AL-0078-2018, the mayor of the Municipalidad de Tibás requested that the executive director of CONAVI: “…1) Conduct a noise-pollution impact study,

  • 2)Analyze and construct walls with barriers that would mitigate the noise caused by passing vehicles,
  • 3)Verify that the elevated bridge had adequate guardrails to provide protection in the event of an accident.
  • 4)Assess and eliminate any possibility of creating vacant spaces between the highway wall and the wall of the residential development, because, according to the plans and the site visit conducted, within the final 30 meters of the 7th Phase of the residential development, a wedge-shaped parcel of land was identified that might remain at the site, which would be a strong temptation for the establishment of informal settlements or criminals’ hideouts.” A copy of that official letter was sent to the Ministerio de Obras Públicas y Transportes, CONAVI, the supervisor of the Circunvalación Norte Project, and UNOPS, because those institutions are responsible for providing a solution, as this is a national public works project. In turn, on February 08, 2018, a meeting was held with the participation of the mayor and representatives of the contractor, Estrella Hernán Solís. Likewise, through the project’s social officer (regente social), Manuel Antonio Villalobos, a meeting with the community was arranged for December 11, 2018. The petitioning residents delivered a letter setting out their concerns to Mr. Villalobos, and a chat group was also created to report any irregularities. It is established that, on January 20, 2021, the Implementing Unit responsible for the project sent an official letter (POE-08-20021-0062) to the project’s environmental officer (regencia ambiental), referring to two situations identified by the petitioners—the stockpiling of material along the boundary between the project and the residential development and excessive noise—and requesting that the appropriate measures be taken to remedy the situation. It is verified that, on January 22, 2020, the petitioners sent a letter to the mayor of Tibás reiterating the situation described and expressing their concern about the danger caused by the absence of walls along the boundaries with the highway, including the children’s park, which was completely exposed. It is established that, on March 15, 2021, by official letter N° MT-AL-0087-2021, the mayor of Nombre36 informed the Ministro de Obras Públicas y Transportes, Eng. Rodolfo Méndez Mata, of the situation described by the petitioners and also reminded him of the matters stated in official letter N° MTE-AL-0078-2018 of February 07, 2018. Likewise, on March 15, 2021, through official letter N° MT-AL-0086-2021, the mayor of Tibás informed the petitioners of the action taken before MOPT.

Finally, it is corroborated that the machinery noise occurring after 22:00 hours resulted from an exceptional incident involving the contractor’s transportation of material in Dirección03 and was not part of the project’s normal nighttime operations, whose working hours may not extend beyond 22:00 hours. Regarding the noise inherent to the project, the social-management team permanently conducts noise measurements or monitoring throughout the project, reaching the following conclusion: “…In addition to the ongoing social-management work, noise monitoring is conducted at various points throughout the project during daytime hours to verify decibel levels in areas adjacent to the works. The reports for December 2020 and January 2021 are attached as Annex 4, Noise Measurements for December 2020 and January 2021. The December 2020 results show that, in the residential zone for the month of January, the regulatory requirements were not exceeded at the time of measurement.

In the commercial zone, the level remains close to the limit, although it must be taken into account that there is baseline ambient noise that does not necessarily originate exclusively from the project. The same situation is observed in the January 2021 measurements, except for the reading at the plant site, where the mitigation measure applies to personnel working at the site, who must use hearing protection because this point was measured on-site beside the plant.” (See the report submitted under oath by COSEVI and the attached evidence—photographs of the measurements and graphical decibel scales.) In turn, regarding the accumulation of sand near the residential development that affected the residents, the stockpiled material was used to construct the viaduct’s ascending ramp, an activity that has now been completed; indeed, that section has already been paved with asphalt, and therefore dust no longer affects the site.

In addition, regarding water seepage through the walls of the properties adjoining the project, notices of alleged water seepage have been addressed; these have been discussed during meetings and field visits by the social-management team, during which the temporary drainage installed pending completion of the works in the area was evaluated. Likewise, the area has now been waterproofed with an asphalt layer, and a storm drain (tragante) has been constructed to prevent the possible flow of water toward the residential area.

Based on the foregoing, it should first be noted that, although the Municipalidad de Nombre36 is not the competent entity to address the situation described by the protected parties with respect to the management of the project entitled “Design and Construction of the ‘Circunvalación Norte’ Road Corridor, National Route No.Dirección04 (Junction with National Route No.108)–Dirección02 (Junction with National Route No.109),” because it is under the responsibility of the central government, as the project is located on a national rather than a cantonal route, the respondent local government has nevertheless made certain efforts—within its functional authority—to coordinate among institutions with COSEVI and MOPT in order to convey the petitioners’ needs and concerns regarding the disturbances and worries they state they have experienced since this road project began. This Court therefore considers that the actions taken by the municipal government of Nombre36 have sought to comprehensively address the petitioners’ needs. Accordingly, no infringement of fundamental rights by the respondent municipal entity is found, and the petition for constitutional relief (recurso de amparo) is therefore dismissed as against the Municipalidad de Nombre36.

Now, regarding the response to the problems described by the protected parties in the application instituting these constitutional-relief proceedings, it should be noted that their claims are limited to three specific matters: “noise from work performed in the early-morning hours, stockpiling of material near the residential development that causes dust and water-seepage problems, and construction of a retaining wall.” Regarding the first issue, according to the sworn report of the executive director of CONAVI, the project’s social-management team has conducted noise monitoring at various points throughout the project during daytime hours to verify decibel levels in areas adjacent to the works. (The reports for December 2020 and January 2021 are attached as Annex 4, Noise Measurements for December 2020 and January 2021.) The results observed pertain to the residential zone for the months of December 2020 and January 2021. However, it has not been established that machinery noise does not extend beyond the permitted working hours ending at 22:00 hours, or that this was an exceptional occurrence. Accordingly, it is determined that the residents have been adversely affected by nighttime work extending beyond the established working hours.

Regarding the second issue, it is established that the accumulation of sand near the residential development did indeed affect the residents; however, the stockpiled material was used to construct the viaduct’s ascending ramp, an activity that has now been completed, and that section has even been paved with asphalt. Therefore, according to COSEVI’s sworn report and the photographs entered into the record, dust no longer affects the site. In addition, regarding water seepage through the walls of the properties adjoining the project, temporary drainage was installed pending completion of the works in the area. Likewise, COSEVI’s report indicates that the area has now been waterproofed with an asphalt layer and that a storm drain was constructed to prevent the possible flow of water toward the residential area. Accordingly, no actual infringement of the protected parties’ rights is found with respect to this claim.

Finally, regarding construction of a retaining wall, the evidentiary record does not establish that such a wall has been erected with sufficient structural support and to a height exceeding the walls of the community where the petitioners reside, including along the boundary of the children’s park, so as to protect their homes, common areas, and the general population from any traffic accident caused by a collision or by a vehicle leaving that highway and entering the area known as the seventh phase of the Cuatro Reinas residential development. Accordingly, the petition is granted with respect to this claim, as provided in the operative part of this judgment.

VI. CONCLUSION

In view of the foregoing, the petition must be partially granted with respect to the adverse effects on the residents caused by nighttime work extending beyond the established working hours and the absence of a wall with sufficient structural support and a height exceeding the walls of the community so as to protect the area where the petitioners reside.

VII. NOTE BY JUSTICE SALAZAR ALVARADO

As a matter of principle, I consider that cases involving inaction by the Public Administration (Administración Pública) in the repair, construction, modification, or demolition of any infrastructure project should be dismissed, because such omission is a matter of legality that must be adjudicated by the ordinary courts (jurisdicción ordinaria), before which the interested person may more fully contest the matters with which he or she disagrees. However, when such administrative inaction results in a violation of other fundamental rights protected by this constitutional jurisdiction (jurisdicción constitucional), or affects groups considered vulnerable, I do examine the merits of the matter, as this situation constitutes an exception to my position on this issue, as occurs in this amparo proceeding (amparo), in which the petitioners complain of construction noise during the early morning hours, the stockpiling of material near the Cuatro Reinas residential development that causes dust and water-seepage problems, and the failure to construct a retaining wall (muro de contención), which endangers the physical safety of the petitioners, who are residents of the community in the seventh phase of the Cuatro Reinas residential development.

VIII. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the court office within a maximum period of thirty business days following notice of this judgment. Otherwise, any such material not retrieved within this period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at Session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial N° 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at Session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.

Por tanto:

The amparo action is partially granted, solely with respect to the impact on the residents caused by nighttime work conducted beyond the established hours, and the absence of a wall with sufficient structural support and a height exceeding that of the community’s boundary walls to protect the location where the petitioners reside. Mario Rodríguez Vargas, in his capacity as executive director of the Consejo Nacional de Vialidad (COSEVI), or whoever holds that office in his stead, is ordered to ensure immediately that no work is performed in the area adjoining the sector known as the seventh phase of the Cuatro Reinas residential development after 22:00 hours (agreed schedule). Likewise, within no more than CINCO MESES following notice of this judgment, the necessary arrangements shall be coordinated with the company awarded the project known as “Diseño y construcción del Corredor Vial “Circunvalación Norte”, Dirección01 (Ent.

Ruta Nacional No.108) - Dirección02 (Ent. Ruta Nacional No.109),” so that construction begins on a wall with sufficient structural support and a height exceeding that of the community’s boundary walls in the seventh phase of the Cuatro Reinas residential development, in order to protect the location where the petitioners reside. The foregoing is ordered with the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo action that he or she is required to comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years, or a fine of twenty to sixty days, provided that the offense is not punishable by a more severe penalty. Justice Salazar Alvarado files a note. In all other respects, the amparo action is denied. The State is ordered to pay the damages and losses caused by the facts underlying this ruling, which shall be assessed in proceedings to enforce the judgment before the contentious-administrative jurisdiction (jurisdicción de lo contencioso administrativo). Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 16:15 horas del 12 de marzo de 2021, los recurrentes interponen recurso de amparo contra el Consejo Nacional de Vialidad (CONAVI) y la Municipalidad de Tibás. Manifiestan, que son vecinos de la comunidad denominada séptima etapa de Cuatro Reinas de Tibás, Distrito Colima y su urbanización tiene colindancia al suroeste con la carretera de circunvalación norte, actualmente en construcción. Según expresan, vienen enfrentando todos los inconvenientes de ese desarrollo, que entienden es por el bien del país; sin embargo, no han conseguido ninguna consideración a la salud de la población, pese a que han acudido desde enero de 2018, tanto al alcalde como a la UNOPS. Expresan, que han lidiado con el ruido de los trabajos en las madrugadas, las vibraciones en los ventanales y hasta la caída de objetos de algunas casas. Afirman, que recientemente hay montañas de arena junto a las tapias de las viviendas, la altura de los montículos supera la de las tapias y el viento trae a sus casas la arena, también hay filtración de aguas provenientes de la construcción y lo que más les preocupa es que no se haya construido un muro de contención para prevenir que algún vehículo salido de la carretera cause un accidente dentro de la urbanización, o en el parque infantil, porque la carretera lateral pasa a la altura de sus tapias y los vehículos circulan en sentido este-oeste en bajada. Exponen, que han realizado las siguientes gestiones:1) carta al alcalde Nombre36 de 28 de enero de 2018 y la respuesta contenida en oficio MT-AL-0078-2018 del alcalde y contra respuesta de la comunidad de fecha 8 de febrero, luego se realizó una reunión con la participación del alcalde y personeros de la empresa contratista Estrella Hernán Solís, pero no se logró ninguna solución a sus peticiones.2) A través del regente social Manuel Antonio Villalobos, se coordinó reunión con la comunidad el 11 de diciembre de 2018, a esa persona le fue entregada una carta con las inquietudes, además se creó un chat para reportar cualquier anomalía; sin embargo, por más que se reportó el irrespeto a los horarios convenidos (no trabajar más allá de las 10:00 de la noche), lo hicieron hasta altas horas perturbando el sueño de los que viven cerca, lo mismo ocurrió con las acumulaciones de arena, porque ni siquiera fue colocado un sarán para prevenir la contaminación.3) carta al alcalde de Nombre36 fechada 22 de enero de 2020, insistiendo en los dos puntos anteriores y en la cual mostraron su preocupación por la inseguridad originada en la falta de muros en las colindancias con la carretera, incluido el parque infantil que está totalmente expuesto, carta a la que no dieron respuesta.4) correo al alcalde Nombre36 fechado 15 de setiembre de 2020, con copia a Manuel Antonio Villalobos de la UNOPS, documento en el cual se planteó el problema de las filtraciones de agua a través de las tapias, los inconvenientes de la "tapia" parcial que hizo la constructora, paralela a las tapias de los vecinos, dejó un espacio libre entre ambas que solo fomenta criaderos de zancudos y es guarida de otros animales. Explican que a ese correo les dio respuesta el señor Manuel Villalobos, pero enfocándose únicamente en el tema de las filtraciones por las tapias, al respecto comunicó que la Unidad Funcional II B, tramo que colinda con su urbanización, está suspendida y solo queda esperar.5) correo al señor Manuel Villalobos de la UNOPS en el cual expusieron su preocupación ante el anuncio de la apertura de ese tramo de la carretera en el primer trimestre de 2021 sin que hayan solucionado los problemas expuestos, especialmente por la inseguridad provocada por la omisión de construir un muro que proteja a la comunidad. Según expresan, les dijeron que por el chat de “Whatsapp” enviarían una respuesta, pero no han recibido comunicación alguna. Reclaman, que la arena les origina constantes alergias, lo cual va en detrimento de la salud de los vecinos y los trabajos hasta altas horas de la noche les ocasiona falta de sueño, aducen que necesitan descansar, sobre todo ahora que inician las lecciones y hay adultos mayores que ven afectada su salud, porque viven en las últimas entradas (la cuarta y la quinta) que son las más afectadas por los trabajos. Solicitan, que se ordene a quien corresponda, ya sea al Consejo Nacional de Vialidad o a la Municipalidad de Nombre36 que, antes de que ese tramo de carretera sea entregado y puesto en funcionamiento, construyan un muro con soporte suficiente y a una altura superior a las tapias de la comunidad, así como en la colindancia del parque infantil que proteja las casas y áreas comunes y a la población en general de cualquier accidente de tránsito que provoque la salida de algún vehículo de esa carretera, así como cualquier vibración o exceso de ruido ocasionado por el tránsito que fluirá tan pronto sea inaugurada. En cuanto al resto de la construcción, pide se ordene al Consejo Nacional de Vialidad supervisar que la constructora Estrella Hernán Solís tome las medidas pertinentes para: 1) cubrir los montículos de arena acumulada para que esta no dañe la salud de los vecinos y 2) sean limitados los horarios de las labores hasta las 10:00 de la noche.
  2. 2Mediante resolución de las 19:57 horas del 15 de marzo de 2021, se dio curso al proceso, y se solicitó informe a las autoridades recurridas, sobre los hechos alegados por los recurrentes.
  3. 3Por escrito incorporado al expediente digital a las 9:45 horas del 23 de marzo de 2021, informa bajo juramento Carlos Luis Cascante Duarte, en su condición de Alcalde de la Municipalidad de Tibás. Menciona, que efectivamente, tal y como indican los vecinos, acudieron ante su persona, quien colaboró con ellos dándoles un espacio dentro del edificio municipal donde podían reunirse y plantear en las diferentes reuniones que se sostuvieron todas las inquietudes que tenían respecto al proyecto vial que se desarrollaba. Acusa, que mediante nota de fecha 29 de enero de 2018, los vecinos solicitaron la intervención de este Municipio con las autoridades correspondientes. Explica, que mediante el oficio N° MT-AL-0078-2018 del 07 de febrero de 2018, se le solicitó al director ejecutivo del CONAVI:1) Un estudio de impacto de la contaminación sónicas,2) Se analizara y se construyeran muros con paredes que mitigaran el ruido que ocasiona el paso de los vehículos,3) Se revisara que el puente levado contara con barandas adecuadas que protejan en caso de accidente.4) Se avalué y se elimine cualquier posibilidad de que generen espacios baldíos entre el muro de la carretera y la tapia de la urbanización, ya que conforme a los planos y a la visita realizada, en los últimos 30 metros de la urbanización 7° Etapa se identificó un terreno tipo cuchilla que eventualmente quedaría en el lugar lo que será una gran tentación para se instalen precarios o guarida de delincuentes.”. Afirma, que dicho oficio se remitió con copia al Ministerio de Obras Públicas y Transportes, el CONAVI, el supervisor del Proyecto de Circunvalación Norte, UNOPS, ya que son las instituciones responsables de dar solución al tratarse de una obra nacional, que no le compete al municipio. Sin embargo, asegura, que la Municipalidad de Nombre36 ha procurado gestionar la colaboración interinstitucional correspondiente. Por otra parte, señala que el 22 de enero de 2020, los recurrentes enviaron una nota solicitando la colaboración del Gobierno Local, específicamente la construcción de un muro o tapia alta cerca del parque infantil que proteja a los niños y usuarios de este, a fin de prevenir cualquier accidente vehicular que impacte cerca de la zona de recreación. Asimismo, se requirió que se construyeran tapias más altas en los sectores de las entradas que colindan con la carretera en construcción, o sea colocada una malla más alta, a fin de evitar el ingreso de delincuentes a la urbanización. Agrega, que el 15 de marzo de 2021, mediante el oficio N° MT-AL-0087-2021, puso en conocimiento de la situación descrita por los accionantes al Ministro de Obras Públicas y Transportes. Ing. Rodolfo Méndez Mata, además de un recordatorio de los indicado en el oficio N° MTE-AL-0078-2018 del 07 de febrero de 2018. Añade que, a través del oficio N° MT-AL-0086-2021 de fecha 15 de marzo de 2021, se les comunicó a los recurrentes la comunicación enviada al MOPT. Finalmente, afirma, que en el caso del pozo, ya fue atendido por la empresa H Solís. Solicita, que declare sin lugar el recurso.
  4. 4Por escrito incorporado al expediente digital a las 11:11 horas del 24 de marzo de 2021, informa bajo juramento Mario Rodríguez Vargas, en su condición de director ejecutivo del Consejo Nacional de Vialidad (COSEVI). Señala, que efectivamente, el Consejo Nacional de Vialidad, se encuentra ejecutando el proyecto denominado “Diseño y construcción del Corredor Vial “Circunvalación Norte”, Dirección01 (Ent. Ruta Nacional No.108)-Dirección02 (Ent. Ruta Nacional No.109)”, producto de la Licitación Pública Internacional 2013LI-000008-0DE00, siendo que en su trayectoria pasa por las cercanías del distrito Colima, y por ende de la denominada séptima etapa de la urbanización Cuatro Reinas. Afirma, que dentro de las argumentaciones esbozadas por los recurrentes en el escrito de interposición, se desprenden tres puntos de inconformidad, a saber: “ruido de trabajos en las madrugadas, acopio de material cercano a la urbanización que genera problemas de polvo y filtración de aguas, y la construcción de un muro de contención.”.Señala, que para la atención del presente recurso se solicitó un informe técnico al organismo encargado de la supervisión del proyecto, sea la Oficina de las Naciones Unidas de Servicios para Proyectos (UNOPS), quienes, a su vez han asumido los temas relacionados con la gestión ambiental y social del proyecto de Circunvalación Norte (Anexo No. 1). Expone, que en cuanto a los dos primeros puntos señalados, se tiene que al recibirse la denuncia por parte de la gestión del proyecto, la Unidad Ejecutora a cargo del proyecto, procedió a enviar un oficio (POE-08-20021-0062) de fecha 20 de enero de 2021, dirigido a la regencia ambiental del proyecto, en donde se hace mención de las dos situaciones apuntadas (acopio de material en la colindancia del proyecto con la urbanización y el exceso de ruido), y se solicitó tomar las medidas correspondientes para solventar la situación y de esa manera evitar inconvenientes a los vecinos.Menciona, que con respecto al ruido de maquinaria en un horario que sobrepasaba las 10:00 pm, el mismo correspondió a una situación excepcional ocurrida por parte del contratista en el transporte del material en la Dirección03, pero no corresponde a la actividad normal del proyecto en horas nocturnas, cuyo horario de trabajo no puede exceder las 10:00 pm. Agrega, que en cuanto al ruido propio del proyecto, la gestión social de manera permanente lleva a cabo mediciones o monitoreos de ruido a lo largo de todo el proyecto, en donde se arriba a la siguiente conclusión: “…Adicionalmente, a la gestión social permanente, se realiza un monitoreo de ruido en diferentes puntos a lo largo del proyecto, en horario diurno, para verificar los noveles de decibeles en sectores aledaños a la obra. Se adjuntan los reportes de diciembre de 2020 y enero de 2021, en el anexo 4, Mediciones de ruido diciembre 2020, enero 2021.De los resultados en diciembre 2020, se observa en que zona residencial para el mes de enero, no se superan los requerimientos de la norma en el momento de la medición. En zona comercial se mantiene cerca del límite, aunque hay que tomar en cuenta que existe ruido base ambiente que no necesariamente proviene exclusivamente del proyecto. La misma situación se observa en las mediciones de enero de 2021, excepción de la toma en el sitio de la planta donde la medida de mitigación se establece para el personal que labora en sitio y que debe utilizar protectores auditivos ya que este punto se midió en el sitio a la par de la planta.”. Por otra parte, en el citado informe se indicó con respecto a una acumulación de arena en las cercanías de la urbanización que provocaba afectación a los vecinos, señala que de acuerdo a lo informado, el acopio de material fue utilizado para la construcción de la rampa de ascenso del viaducto, actividad que a la fecha ha finalizado e incluso, dicho tramo cuenta con asfalto, por lo cual no se tiene una afectación por polvo en el sitio.Acusa, que, en cuanto a los alegatos sobre filtraciones de agua por los muros de los inmuebles que colindan con el proyecto, señala que la supervisión del proyecto y de manera específica la gestión social, han procedido con la atención de las notificaciones de una presunta filtración de aguas; las cuales han sido tratadas en reuniones y visitas de campo de la gestión social; en donde se ha valorado el drenaje temporal realizado, en el tanto se finalicen las obras en el sector. Asimismo, informa que a la fecha se ha impermeabilizado la zona con carpeta asfáltica y, se ha construido un tragante, con la finalidad de evitar el posible flujo de agua hacia el sector. Añade, que como tercer punto, se tiene la petición que se hace en el recurso planteado para la construcción de un “(…) muro con soporte suficiente y a una altura superior a las tapias de nuestra Comunidad, así como en la colindancia del parque infantil, que proteja nuestras casas y áreas comunes y población en general, de cualquier accidente de tránsito por colisión o salida de algún vehículo de esa carretera hacia nuestra Comunidad.”.Con respecto a este punto en específico, señala que en reuniones sostenidas con la comunidad se les ha indicado que se estaría analizando brindar una solución a la inquietud por ellos planteada, sin embargo, tal y como se ha mencionado en el informe técnico que se adjunta, dicha unidad funcional se encuentra suspendida por lo cual, se estaría analizando una solución técnica de seguridad vial en el punto, una vez que sea reiniciado el proyecto en el sitio, y de esta manera dar atención oportuna a la inquietud manifiesta de los vecinos. Acota, que la Administración ha dado atención oportuna a las inquietudes e inconformidades de los vecinos de la séptima etapa de la Urbanización Cuatro Reinas, tanto en cuanto a problemas de ruido que ha sido monitoreado de manera permanente con la finalidad que no excedan los límites autorizados, y en el momento que de manera excepcional, se ha presentado un evento fuera de las horas de la noche autorizado, se ha procedido a realizar las gestiones ante la regencia ambiental como representante del contratista, y que de esa manera sean tomadas las medidas correctivas.Afirma, que tal y como queda evidenciado con las fotografías aportadas del sitio, el acopio de material que ocasionó molestias por polvo en la comunidad, a la fecha se tiene solventado el tema, siendo que el tramo en cuestión (rampa) se encuentra debidamente asfaltado. Asimismo, en cuanto al tema de la solicitud de construcción de un muro en la colindancia del proyecto y la comunidad, se estará analizando la solución de seguridad vial en el punto que resulte más óptima ante la inquietud de los vecinos. Solicita, que se declare sin lugar el recurso.
  5. 5Por escrito incorporado al expediente digital a las 18:42 horas del 24 de marzo de 2021, informa bajo juramento Mario Rodríguez Vargas, en su condición de presidente del Concejo Municipal de Tibás. Manifiesta, que es necesario hacer ver que el proyecto de Circunvalación Norte, es parte de la red vial Nacional y la construcción, readecuación y mantenimiento de estas vías resultan ser competencia del Estado Central, a cargo del Ministerio de Obras Públicas y Transportes, por lo que el Concejo Municipal que preside no tiene injerencia alguna en los aspectos integrales del tal proyecto, como lo es el tema de la seguridad vial, aspectos constructivos dentro del derecho de vía, etc., en torno a los reclamos que realizan los vecinos de la séptima etapa de Cuatro Reinas. Afirma, que no obstante, lo anterior, tal y como consta en los oficios MTAL-0087-2021 y MT-AL~0086-202l, durante el presente año la corporación municipal en la cabeza del Alcaide Municipal, ha interpuesto de manera formal sus buenos oficios, para canalizar ante los responsables las inquietudes que han tenido los vecinos, las cuales ya había realizado con anterioridad.Aclara, que la Municipalidad no ha sido omisa en atender las solicitudes de los vecinos y comparte sus preocupaciones, no obstante. por un tema específico de competencias, no está en la posibilidad de invertir recursos o girar órdenes, para ampliar o cambiar los diseños e intervenciones realizadas por las instituciones públicas competentes para atender las inquietudes de los vecinos recurrentes. Por lo anterior, solicita que se declare sin lugar el recurso.
  6. 6En los procedimientos seguidos se ha observado las prescripciones legales

Redacta el Magistrado Salazar Alvarado; y,

Considerando

I. ACLARACIÓN PREVIA

Antes de analizar el fondo del asunto debe aclararse que, a partir de la Sentencia N° 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones aquellos asuntos en los que se discute si la Administración Pública ha cumplido o no los plazos pautados en la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues, se está ante la supuesta falta de mantenimiento de una calle, así como obras de infraestructura, lo que la Sala entiende que puede poner en riesgo a las personas que por ahí transitan. Aclarado el punto, se entra a resolver, la situación concreta planteada en este amparo.

II. OBJETO DEL RECURSO

Los recurrentes manifiestan, que son vecinos de la comunidad denominada séptima etapa de Cuatro Reinas de Tibás, Distrito Colima y su urbanización tiene colindancia al suroeste con la carretera de circunvalación norte, actualmente en construcción. Según expresan, han lidiado con el ruido de los trabajos en las madrugadas. Afirman, que recientemente hay montañas de arena junto a las tapias de las viviendas, la altura de los montículos supera la de las tapias y el viento trae a sus casas la arena, también hay filtración de aguas provenientes de la construcción y lo que más les preocupa es que no se haya construido un muro de contención para prevenir que algún vehículo salido de la carretera cause un accidente dentro de la urbanización, o en el parque infantil, porque la carretera lateral pasa a la altura de sus tapias y los vehículos circulan en sentido este-oeste en bajada.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • a)El Consejo Nacional de Vialidad (COSEVI), se encuentra ejecutando el proyecto denominado “Diseño y construcción del Corredor Vial “Circunvalación Norte”, Ruta Nacional No.Dirección04 (Ent. Ruta Nacional No.108) - Dirección02 (Ent. Ruta Nacional No.109)”, producto de la Licitación Pública Internacional 2013LI-000008-0DE00, cuya trayectoria pasa por las cercanías del distrito Colima, y por ende de la denominada séptima etapa de la urbanización Cuatro Reinas (ver informe rendido bajo juramento por el COSEVI y pruebas adjuntas).
  • b)El 29 de enero de 2018 los recurrentes enviaron una carta al alcalde Nombre36 solicitando su intervención ante las autoridades encargadas de construir la carretera, pues existe arena junto a las tapias de las viviendas y la altura de los montículos supera la de las tapias. Además, el viento trae a sus casas la arena, también hay filtración de aguas provenientes de la construcción y lo que más les preocupa es que no se haya construido un muro de contención para prevenir que algún vehículo se salga de la carretera y cause un accidente dentro de la urbanización, o en el parque infantil, porque la carretera lateral pasa a la altura de sus tapias y los vehículos circulan en sentido este-oeste (ver escrito de interposición y prueba adjunta).
  • c)El 07 de febrero de 2018, en atención al oficio de fecha 29 de enero de 2018, mediante el oficio N° MT-AL-0078-2018 el alcalde de la Municipalidad de Tibás, le solicitó al director ejecutivo del CONAVI: “…1) Un estudio de impacto de la contaminación sónicas, 2) Se analizara y se construyeran muros con paredes que mitigaran el ruido que ocasiona el paso de los vehículos, 3) Se revisara que el puente levado contara con barandas adecuadas que protejan en caso de accidente. 4) Se avalué y se elimine cualquier posibilidad de que generen espacios baldíos entre el muro de la carretera y la tapia de la urbanización, ya que conforme a los planos y a la visita realizada, en los últimos 30 metros de la urbanización 7° Etapa se identificó un terreno tipo cuchilla que eventualmente quedaría en el lugar lo que será una gran tentación para se instalen precarios o guarida de delincuentes.”. Dicho oficio se remitió con copia al Ministerio de Obras Públicas y Transportes, el CONAVI, al supervisor del Proyecto de Circunvalación Norte, UNOPS, ya que son las instituciones responsables de dar solución, al tratarse de una obra nacional (ver informe rendido bajo juramento por el ente municipal y prueba adjunta).
  • d)El 08 de febrero de 2018, se realizó una reunión con la participación del alcalde y personeros de la empresa contratista Estrella Hernán Solís (ver escrito de interposición y prueba adjunta).
  • e)A través del regente social Manuel Antonio Villalobos, se coordinó una reunión con la comunidad para el 11 de diciembre de 2018. Los vecinos accionantes le entregaron al señor Villalobos una carta con inquietudes, además se creó un chat para reportar cualquier anomalía (ver escrito de interposición y prueba adjunta).
  • f)El 20 de enero de 2021, la Unidad Ejecutora a cargo del proyecto, procedió a enviar un oficio (POE-08-20021-0062) dirigido a la regencia ambiental del proyecto, en donde se hace mención a dos situaciones apuntadas por los recurrentes (acopio de material en la colindancia del proyecto con la urbanización y el exceso de ruido), y se solicitó tomar las medidas correspondientes para solventar tal situación (ver informe rendido bajo juramento por el COSEVI y prueba adjunta).
  • g)El 22 de enero de 2020, lo recurrentes le enviaron una carta al alcalde de Tibás, insistiendo en la situación descrita y, en la cual mostraron su preocupación por la inseguridad originada por la falta de muros en las colindancias con la carretera, incluido el parque infantil que está totalmente expuesto (ver escrito de interposición y prueba adjunta).
  • h)El 15 de marzo de 2021, mediante el oficio N° MT-AL-0087-2021, el alcalde de Nombre36 puso en conocimiento de la situación descrita por los accionantes al Ministro de Obras Públicas y Transportes. Ing. Rodolfo Méndez Mata, además de un recordatorio de lo indicado en el oficio N° MTE-AL-0078-2018 del 07 de febrero de 2018 (ver informe rendido bajo juramento por el ente municipal y prueba adjunta).
  • i)El 15 de marzo de 2021, a través del oficio N° MT-AL-0086-2021, el alcalde de Tibás, les comunicó a los recurrentes la gestión realizada ante el MOPT (ver informe rendido bajo juramento por el ente municipal y prueba adjunta).
  • j)Respecto al ruido de maquinaria en un horario que sobrepasaba las 22:00 horas, correspondió a una situación excepcional ocurrida por parte del contratista en el transporte del material en la Dirección03, pero no es parte a la actividad normal del proyecto en horas nocturnas, cuyo horario de trabajo no puede exceder las 22:00 horas. En cuanto al ruido propio del proyecto, la gestión social de manera permanente lleva a cabo mediciones o monitoreos de ruido a lo largo de todo el proyecto, en donde se arriba a la siguiente conclusión: “…Adicionalmente, a la gestión social permanente, se realiza un monitoreo de ruido en diferentes puntos a lo largo del proyecto, en horario diurno, para verificar los noveles de decibeles en sectores aledaños a la obra. Se adjuntan los reportes de diciembre de 2020 y enero de 2021, en el anexo 4, Mediciones de ruido diciembre 2020, enero 2021. De los resultados en diciembre 2020, se observa en que zona residencial para el mes de enero, no se superan los requerimientos de la norma en el momento de la medición.

En zona comercial se mantiene cerca del límite, aunque hay que tomar en cuenta que existe ruido base ambiente que no necesariamente proviene exclusivamente del proyecto. La misma situación se observa en las mediciones de enero de 2021, excepción de la toma en el sitio de la planta donde la medida de mitigación se establece para el personal que labora en sitio y que debe utilizar protectores auditivos ya que este punto se midió en el sitio a la par de la planta.”. (ver informe rendido bajo juramento por el COSEVI y prueba adjunta -fotografías de las mediciones y escalas graficas por decibeles-).

  • k)En relación con la acumulación de arena en las cercanías de la urbanización que provocaba afectación a los vecinos, el acopio de material fue utilizado para la construcción de la rampa de ascenso del viaducto, actividad que a la fecha ha finalizado e incluso, dicho tramo cuenta con asfalto, por lo cual no se tiene una afectación por polvo en el sitio (ver informe rendido bajo juramento por el COSEVI y prueba adjunta) l) En cuanto a las filtraciones de agua por los muros de los inmuebles que colindan con el proyecto, se ha procedido con la atención de las notificaciones de una presunta filtración de aguas; las cuales han sido tratadas en reuniones y visitas de campo de la gestión social; en donde se ha valorado el drenaje temporal realizado, en el tanto se finalicen las obras en el sector. Asimismo, a la fecha se ha impermeabilizado la zona con carpeta asfáltica y, se ha construido un tragante, con la finalidad de evitar el posible flujo de agua hacia el sector vecinal (ver informe rendido bajo juramento por el COSEVI y prueba adjunta)

IV. HECHO NO PROBADO

No se estima demostrado el siguiente hecho de relevancia para esta resolución:

  • a)Que se haya levantado un muro con soporte suficiente y a una altura superior a las tapias de la Comunidad en donde residen los recurrentes, así como en la colindancia del parque infantil, que proteja sus casas, áreas comunes y población en general, de cualquier accidente de tránsito por colisión o salida de algún vehículo de esa carretera hacia el sector de denominada séptima etapa de la urbanización Cuatro Reinas.
  • b)Que el ruido de la maquinaria no sobrepasa el horario establecido hasta las 22:00 horas.

V. SOBRE EL CASO CONCRETO

En el caso que nos ocupa, del informe rendido por los representantes de las autoridades recurridas -que se tiene dado bajo fe de juramento, con oportuno apercibimiento de las consecuencias penales, previstas en el artículo 44, de la Ley que rige esta jurisdicción-, se acredita, que, efectivamente, el Consejo Nacional de Vialidad (COSEVI), se encuentra ejecutando el proyecto denominado “Diseño y construcción del Corredor Vial “Circunvalación Norte”, Dirección01 (Ent. Ruta Nacional No.108) - Dirección02 (Ent. Ruta Nacional No.109)”, producto de la Licitación Pública Internacional 2013LI-000008-0DE00, cuya trayectoria pasa por las cercanías del distrito Colima, y por ende de la denominada séptima etapa de la urbanización Cuatro Reinas. Se constata, que el 29 de enero de 2018 los recurrentes enviaron una carta al alcalde Nombre36 solicitando su intervención ante las autoridades encargadas de construir la carretera, pues existe arena junto a las tapias de las viviendas y la altura de los montículos supera la de las tapias.

Además, el viento trae a sus casas la arena, también hay filtración de aguas provenientes de la construcción y lo que más les preocupa es que no se haya construido un muro de contención para prevenir que algún vehículo se salga de la carretera y cause un accidente dentro de la urbanización, o en el parque infantil, porque la carretera lateral pasa a la altura de sus tapias y los vehículos circulan en sentido este-oeste. Se verifica, que el 07 de febrero de 2018, en atención al oficio de fecha 29 de enero de 2018, mediante el oficio N° MT-AL-0078-2018 el alcalde de la Municipalidad de Tibás, le solicitó al director ejecutivo del CONAVI: “…1) Un estudio de impacto de la contaminación sónicas,

  • 2)Se analizara y se construyeran muros con paredes que mitigaran el ruido que ocasiona el paso de los vehículos,
  • 3)Se revisara que el puente levado contara con barandas adecuadas que protejan en caso de accidente.
  • 4)Se avalué y se elimine cualquier posibilidad de que generen espacios baldíos entre el muro de la carretera y la tapia de la urbanización, ya que conforme a los planos y a la visita realizada, en los últimos 30 metros de la urbanización 7° Etapa se identificó un terreno tipo cuchilla que eventualmente quedaría en el lugar lo que será una gran tentación para se instalen precarios o guarida de delincuentes.”. Dicho oficio se remitió con copia al Ministerio de Obras Públicas y Transportes, el CONAVI, al supervisor del Proyecto de Circunvalación Norte, UNOPS, ya que son las instituciones responsables de dar solución, al tratarse de una obra nacional. A su vez, el 08 de febrero de 2018, se realizó una reunión con la participación del alcalde y personeros de la empresa contratista Estrella Hernán Solís. Asimismo, a través del regente social del proyecto Manuel Antonio Villalobos, se coordinó una reunión con la comunidad para el 11 de diciembre de 2018. Los vecinos accionantes le entregaron al señor Villalobos una carta con inquietudes, además se creó un chat para reportar cualquier anomalía. Se comprueba que, el 20 de enero de 2021, la Unidad Ejecutora a cargo del proyecto, procedió a enviar un oficio (POE-08-20021-0062) dirigido a la regencia ambiental del proyecto, en donde se hace mención a dos situaciones apuntadas por los recurrentes (acopio de material en la colindancia del proyecto con la urbanización y el exceso de ruido), y se solicitó tomar las medidas correspondientes para solventar tal situación. Se verifica, que el 22 de enero de 2020, lo recurrentes le enviaron una carta al alcalde de Tibás, insistiendo en la situación descrita y, en la cual mostraron su preocupación por la inseguridad originada por la falta de muros en las colindancias con la carretera, incluido el parque infantil que está totalmente expuesto. Se constata, que el 15 de marzo de 2021, mediante el oficio N° MT-AL-0087-2021, el alcalde de Nombre36 puso en conocimiento de la situación descrita por los accionantes al Ministro de Obras Públicas y Transportes. Ing. Rodolfo Méndez Mata, además de un recordatorio de lo indicado en el oficio N° MTE-AL-0078-2018 del 07 de febrero de 2018. Asimismo, el 15 de marzo de 2021, a través del oficio N° MT-AL-0086-2021, el alcalde de Tibás, les comunicó a los recurrentes la gestión realizada ante el MOPT.

Finalmente se corrobora, que respecto al ruido de maquinaria en un horario que sobrepasaba las 22:00 horas, correspondió a una situación excepcional ocurrida por parte del contratista en el transporte del material en la Dirección03, pero no es parte a la actividad normal del proyecto en horas nocturnas, cuyo horario de trabajo no puede exceder las 22:00 horas. En cuanto al ruido propio del proyecto, la gestión social de manera permanente lleva a cabo mediciones o monitoreos de ruido a lo largo de todo el proyecto, en donde se arriba a la siguiente conclusión: “…Adicionalmente, a la gestión social permanente, se realiza un monitoreo de ruido en diferentes puntos a lo largo del proyecto, en horario diurno, para verificar los noveles de decibeles en sectores aledaños a la obra. Asu vez, en relación con la acumulación de arena en las cercanías de la urbanización que provocaba afectación a los vecinos, el acopio de material fue utilizado para la construcción de la rampa de ascenso del viaducto, actividad que a la fecha ha finalizado e incluso, dicho tramo cuenta con asfalto, por lo cual no se tiene una afectación por polvo en el sitio.

Aunado a ello, en cuanto a las filtraciones de agua por los muros de los inmuebles que colindan con el proyecto, se ha procedido con la atención de las notificaciones de una presunta filtración de aguas; las cuales han sido tratadas en reuniones y visitas de campo de la gestión social; en donde se ha valorado el drenaje temporal realizado, en el tanto se finalicen las obras en el sector. Asimismo, a la fecha se ha impermeabilizado la zona con carpeta asfáltica y, se ha construido un tragante, con la finalidad de evitar el posible flujo de agua hacia el sector vecinal.

De lo anterior, cabe señalar en primer lugar, que a pesar de que la Municipalidad de Nombre36 no es el ente competente para atender la situación descrita por los amparados, respecto al manejo del proyecto denominado “Diseño y construcción del Corredor Vial “Circunvalación Norte”, Ruta Nacional No.Dirección04 (Ent. Ruta Nacional No.108) - Dirección02 (Ent. Ruta Nacional No.109)”, por estar a cargo del Estado central, al ubicarse dicho proyecto sobre una ruta nacional y no cantonal, lo cierto es que el gobierno local recurrido a realizado algunos esfuerzos -dentro de sus competencias funcionales- de coordinación interinstitucional con el COSEVI y el MOPT, a fin de trasladar las necesidades e inquietudes de los recurrentes respecto a la molestias y preocupaciones que manifiestan haber tenido desde que dio inicio dicho proyecto de carácter vial; por lo que estima este Tribunal que las acciones ejecutadas por el ayuntamiento de Nombre36 han buscado una solucionar de manera integral las necesidades de lo accionantes, razón por la que no se estima, ninguna afectación de derechos fundamentales, por parte del ente municipal accionado, por lo que en cuanto a la Municipalidad de Nombre36 se desestima el recurso planteado.

Ahora bien, en cuanto a la atención de la problemática descrita por los tutelados en el libelo de interposición de este amparo, cabe indicar que se reduce a tres pretensiones en concreto: “ruido de trabajos en las madrugadas, acopio de material cercano a la urbanización que genera problemas de polvo y filtración de aguas, y la construcción de un muro de contención.”.

Sobre el primer punto, según informa bajo juramento el director ejecutivo del CONAVI, a través de la gestión social del proyecto, se ha realizado un monitoreo de ruido en diferentes puntos a lo largo del proyecto, en horario diurno, para verificar los noveles de decibeles en sectores aledaños a la obra. (Se adjuntan los reportes de diciembre de 2020 y enero de 2021, en el anexo 4, Mediciones de ruido diciembre 2020, enero 2021) Cuyos resultados se observan, que en la zona residencial para los meses de diciembre de 2020 y enero de 2021. Sin embargo, no constata que respecto al ruido de maquinaria no sobrepasa el horario establecido hasta las 22:00 horas, y que esto sea una situación de carácter excepcional. Así las cosas, se determina una afectación de los vecinos respecto a trabajos nocturnos que supera el horario establecido.

En cuanto al puntos dos, se constata que, efectivamente, respecto a la acumulación de arena en las cercanías de la urbanización que provocaba afectación a los vecinos, el acopio de material fue utilizado para la construcción de la rampa de ascenso del viaducto, actividad que a la fecha finalizó e incluso, dicho tramo cuenta con asfalto, por lo que, según informa bajo juramento el COSEVI y, de acuerdo con las fotografías aportadas a los autos, no se tiene una afectación por polvo en el sitio. Aunado a ello, en cuanto a las filtraciones de agua por los muros de los inmuebles que colindan con el proyecto, se realizó un drenaje temporal, en el tanto se finalicen las obras en el sector. Asimismo, del informe rendido por el COSEVI, se desprende que a la fecha se ha impermeabilizado la zona con carpeta asfáltica y, se construyó un tragante, con la finalidad de evitar el posible flujo de agua hacia el sector vecinal. Así las cosas, en cuanto a este extremo, no se observa una afectación real a los derechos de los amparados.

Finalmente, en cuanto a la construcción de un muro de contención, no se consta en el acervo probatorio, que se haya levantado dicho muro con soporte suficiente y a una altura superior a las tapias de la Comunidad en donde residen los recurrentes, así como en la colindancia del parque infantil, que proteja sus casas, áreas comunes y población en general, de cualquier accidente de tránsito por colisión o salida de algún vehículo de esa carretera hacia el sector de denominada séptima etapa de la urbanización Cuatro Reinas, por lo que en cuanto a este extremo, se declara con lugar el recurso, según lo establecido en la parte dispositiva de esta sentencia.

VI. COROLARIO

En mérito de lo expuesto, lo correspondiente es declarar parcialmente con lugar el recurso, respecto a la afectación de los vecinos con los trabajos nocturnos que superan el horario establecido, y la falta de un muro con soporte suficiente y a una altura superior a las tapias de la Comunidad que proteja el sitio en donde residen los recurrentes.

VII. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En tesis de principio, considero que los casos relacionados con la inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa omisiva se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este amparo, en que los recurrentes acusan ruido de trabajos en las madrugadas, acopio de material cercano a la urbanización que genera problemas de polvo y filtración de aguas, y la falta de construcción de un muro de contención, lo que pone en peligro la integridad física de los recurrentes, vecinos de la comunidad séptima etapa de la urbanización Cuatro Reinas.

VIII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara parcialmente con lugar el recurso, únicamente, en cuanto a la afectación de los vecinos con los trabajos nocturnos que superan el horario establecido, y la falta de un muro con soporte suficiente y a una altura superior a las tapias de la comunidad que proteja el sitio en donde residen los recurrentes. Se ordena a Mario Rodríguez Vargas, en su condición de director ejecutivo del Consejo Nacional de Vialidad (COSEVI). o a quien en su lugar ocupe dicho cargo, que de manera inmediata no se realicen trabajos en la zona colindante con el sector de denominado séptima etapa de la urbanización Cuatro Reinas, después de las 22:00 horas (horario acordado). Asimismo, en el plazo no mayor a CINCO MESES, contado a partir de la notificación de esta sentencia, se coordine lo necesario con la empresa adjudicataria del proyecto denominado “Diseño y construcción del Corredor Vial “Circunvalación Norte”, Dirección01 (Ent.

Ruta Nacional No.108) - Dirección02 (Ent. Ruta Nacional No.109)”, para que den inicio a la construcción de un muro con soporte suficiente y a una altura superior a las tapias de la comunidad de la séptima etapa de la urbanización Cuatro Reinas, que proteja el sitio en donde residen los recurrentes. Lo anterior, bajo el apercibimiento de que, con base en lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. El Magistrado Salazar Alvarado pone nota. En lo demás, se declara sin lugar el recurso. Se condena al Estado al pago de daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
