Document Review SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine fifteen a.m. on April sixteenth, two thousand twenty-one.

Amparo proceeding (recurso de amparo) filed by JOSEPH DOUGLAS ROBERTSON JR., passport CED01, on behalf of the ASOCIACIÓN CÁMARA DE TURISMO DE PAVONES, legal entity identification number CED02, against the ÁREA DE CONSERVACIÓN DE OSA (SINAC-ACOSA), LA MUNICIPALIDAD DE GOLFITO, AND EL MINISTERIO DE SALUD.

BACKGROUND:

  1. 1By written submission filed at 13:16 hours on January 29, 2021, the petitioner filed an amparo proceeding against the Área de Conservación Osa, the Municipalidad de Golfito, and the Ministerio de Salud. He states that he is the President of the Asociación Cámara de Turismo de Pavones and, in compliance with a final resolution of the Board of Directors of the entity he represents, seeks amparo relief against the Director of the SINAC-ACOSA Wildlife Refuge, the Mayor, and the President of the Concejo, both of Golfito, because those authorities have done nothing regarding the situation brought to their attention by the Área Rectora de Salud de Golfito, as follows: Field inspection reports Nos. SINAC-ACOSA-RNFSG-AD-086-2020, MS-DRRSBRU-URS-IT-0140-2020, and MS-DRRSBRU-ARSG-IT-0573-2020 showed encroachment within the maritime-terrestrial zone (zona marítimo terrestre) of Playa Pilón, where structures were found within the inalienable area under municipal administration, in the public zone (zona pública) and State Natural Heritage (Patrimonio Natural del Estado).The respondent authorities were therefore asked, by official letters addressed to them, to prepare a plan for addressing this issue, including a schedule of actions and the corresponding budget, and to keep the authorities of the Ministerio de Salud informed of the measures issued. The petitioner expresses concern about how this situation affects the beaches, local residents, and tourists; he alleges that the Ministerio de Salud has not processed any matter related to the complaint filed by that Cámara de Turismo and has failed to safeguard the right to health. On the contrary, the repeated declarations of emergency demonstrate that we are in a second wave of the Covid-19 pandemic and that the pollution problem has worsened. They stated this in a communication sent to the authorities of the Ministerio de Salud at email addresses ...01 and ...02 on December 11, 2020. The petitioner expresses his disagreement because more than five months have elapsed since August 19, 2020, when the Ministerio de Salud ordered the other authorities to address the issue raised within a reasonable period, and they have not acted.He considers this a violation of the principle of prompt response and his right to a prompt and complete response. He further alleges that the respondent authorities have been negligent in addressing the public-health problem and responding to the requests of the Ministerio de Salud. He requests that the respondents be ordered to address immediately the public-health problems identified by the Ministerio de Salud and be ordered to pay costs and damages.
  2. 2By order issued at 10:20 hours on February 1, 2021, the amparo proceeding was served and a report concerning those facts was requested from the Director of the Refugio de Vida Silvestre del Área de Conservación de Osa (Sinac-Acosa); the Mayor and the President of the Concejo, both of Golfito; the Ministro de Salud; and the Director of the Área Rectora de Salud de Golfito.
  3. 3Daniel Salas Peraza, in his capacity as Ministro de Salud, reports under oath and states that he submits this statutory report on the basis of Official Letter No. MS-DRRSBRU-1921-2021 dated February 4, 2021, issued by Dr. Christian Valverde in his capacity as Director Regional de Rectoría de la Salud Brunca, who states, in summary, as follows:

“(…) 1. In March 2020, this Ministerio received an unsigned letter reporting makeshift buildings and shelters at Playa Higuito and Playa Pilón in which several families reside. This complaint was also forwarded to the Dirección de Atención al Cliente. The letter indicates that it was submitted on behalf of the Board of Directors of the Asociación de Cámara de Turismo, and the email was sent by Mr. Joseph Robertson.

2. By Official Letter MS-DRRSBRU-ARSGO 0295-2020, Dr. Fernando Mata informed Mr. Robertson that he had received the letter and that the complaint had been forwarded to the Municipalidad de Golfito so that it could address the matter within the scope of its authority. (folio 11) 3. On June 09, 2020, an interinstitutional operation was conducted with the participation of officials from the Municipalidad de Golfito, SINAC, and the Ministerio de Salud. At the site, the Instrument for Verification of Complaints Concerning Wastewater in Housing Developments or Residential Areas was applied. (Folio 13 and 14).

4. By Official Letter SINAC-ACOSA-RNFSG-AD-086-2020, Licda. Ana Cecilia Medina Gutiérrez submitted an inspection report concerning Puerto Pilón, concluding that structures existed within the public zone of the area certified as State Natural Heritage; in addition, six structures within the Public Zone of the area certified as State Natural Heritage (under SINAC-MINAE administration), one structure outside the Public Zone but within State Natural Heritage, and seven structures within the Public Zone but outside State Natural Heritage (under the administration of the Municipalidad de Golfito) were georeferenced. (folio 15 to 18) 5. Licda. Jovita Morera and Ing. Marvin Salamanca, officials of the Unidad de Rectoría de la Salud, issued Report MS-DRRSBRU-URS-IT-140-2020 dated June 11, 2020, in which they stated that the settlement located at Playa Pilón failed to comply with the provisions governing wastewater management and that its residents used wells to obtain water for human consumption, but that those wells did not comply with the legally required setback (retiro de ley), and that the Municipalidad de Golfito was responsible for issuing the corresponding administrative acts (actos administrativos).

(folio 20 and 21) 6. Technical Report MS-DRRSBRU-ARSG-IT-0573-2020 dated June 22, 2020, signed by Ing. Hellen Rodríguez, an official of the ARS de Golfito, stated that the visit conducted on June 09, 2020, to Playa Pilón showed that the reported situation persisted; there were a total of thirteen structures without a wastewater treatment system; and, because the structures were located within State Natural Heritage, the Municipalidad de Golfito and SINAC were responsible for issuing the administrative acts necessary to remedy the ongoing pollution. (Folio 22 to 24).

7. Report MS-DRRSBRU-ARSG-IT-0574-2020 dated June 22, 2020, signed by Ing. Hellen Rodríguez, an official of the ARS de Golfito, stated that during the visit conducted on June 09, 2020, to Playa Higuito, the reported situation was no longer present and there were no persons continuing to camp at the site. (Folio 25 and 26).

8. By Official Letter MS-DRRSBRU-ARSGO-0710-2020 dated August 18, 2020, Dr. Fernando Mata requested from Máster Laura Rivera Quintanilla, Director of the Refugio de Vida Silvestre Golfito SINAC-ACOSA, a plan for addressing the issue that would establish a schedule and corresponding budget. (Folio 28).

9. By Official Letter MS-DRRSBRU-ARSGO-0711-2020 dated August 18, 2020, Dr. Fernando Mata requested from Lic. Freiner Lara Blanco, Mayor of the Municipalidad de Golfito, a plan for addressing the issue that would establish a schedule and corresponding budget. (Folio 29).

10. By Official Letter MS-DRRSBRU-ARSGO-0711-2020, Dr. Fernando Mata informed Mr. Joseph Robertson of the actions taken to date. (Folio 31).

11. By Official Letter MS-DRRSBRU-ARSGO-O-1218-2020, dated November 13, 2020, Dr. Fernando Mata requested from Máster Laura Rivera, Director of the Refugio de Vida Silvestre Golfito SINAC-ACOSA, a report on the actions taken, given that a public-health problem and environmental harm existed. (Folio 33).

12. By Official Letter MS-DRRSBRU-ARSGO-O-1219-2020, dated November 13, 2020, Dr. Fernando Mata requested from Lic. Freiner Lara Blanco, Mayor of the Municipalidad de Golfito, a report on the actions taken, given that a public-health problem and environmental harm existed. (Folio 34).

13. By Official Letter MS-DRRSBRU-ARSG-0043-2021, dated January 20, 2021, addressed to Lic. Freiner Lara Blanco, Mayor of the Municipalidad de Golfito, and Máster Laura Rivera, Director of the Refugio de Vida Silvestre Golfito SINAC-ACOSA, Dr. Fernando Mata, in follow-up to Official Letters MS-DRRSBRU-ARSGO-0710-2020 and MS-DRRSBRU-ARSGO-0711-2020, requested that they inform him of the actions taken. (Folio 40 and 41).

14. By Official Letter MS-DRRSBRU-ARSG-0044-2021, dated January 20, 2021, Dr. Fernando Mata informed the undersigned of the actions taken.

15. By means of Official Letter SINAC-ACOSA-D-033-2021, dated January 21, 2021, Máster Laura Rivera Quintanilla forwarded to Dr. Fernando Mata Report SINACACOSA-RNFSG-AD-086-2020, to which I referred in point four of this letter. (Folio 49 to 53) 16. By Official Letter AM-MG-O-0024-2021 dated January 25, 2021, Lic. Freiner Lara Blanco, Mayor of the Municipalidad de Golfito, informed Dr. Fernando Mata that Official Letter MS-DRRSBRU-ARSGO-0711-2020 had been forwarded to the Departamento de Valoraciones and the Departamento de Zona Marítimo Terrestre, attached Reports MG-OV-INT-043-20200 and MS-OV-IT-026-2019, and concluded his letter by stating that they were awaiting the opinion of the Comisión de Ambientales. (Folio 54-114).

17. On January 26, 2021, Dr. Fernando Mata sent an email to Máster Laura Rivera Quintanilla requesting that she provide the information he had previously requested so that he could respond to the complainant and the higher authorities. (Folio 115).

18. By Official Letter MS-DRRSBRU-ARSGO-0056-2021 dated January 28, 2021, Dr. Fernando Mata informed the complainant of the actions taken in response to his complaint. (Folio 117) 19. By Official Letter MS-DRRSBRU-1503-2021, and in response to Official Letter MS-DGS-0046-2021, the undersigned informed the complainant of the actions taken (…)” In accordance with the foregoing, the Ministerio, through the authorities of the Área Rectora de Salud de Golfito and the Dirección Regional de Rectoría de Salud Brunca, has addressed and followed up on the matter at issue and has sent a response to the protected party, keeping him informed of the actions taken by this Ministerio within the scope of its authority, as shown by the notices delivered to the protected party herein according to the record of the matter at issue, which the Área Rectora de Salud de Golfito will submit to this Chamber. It should also be noted that matters concerning the ownership, development, exploitation, and use of maritime-terrestrial zones fall within municipal jurisdiction, in this case that of the Municipalidad de Golfito.

  1. 4Freiner Lara Blanco, in his capacity as Mayor of Golfito, reports under oath and states that, through the resolution transcribed in Official Letter SMG-T-0479-08-2020 dated August 27, 2020, the Concejo considered Official Letter MS-DRRSBRU-ARSGO-0711-2020 dated August 18, 2020, and resolved to forward the complaint to the administration so that the appropriate actions could be taken and a report submitted to that body. Official Letter No. MG-OV-INT-043-2020 dated October 1, 2020, states:

“The report attached as an annex shows that the problem has existed since 2007, since in that sector the inspection staff conducted an inventory of the structures in the same area. The Legal Advisory, Service Platform, Inspections, and Mayor’s Office departments have been consulted verbally, and no documentation concerning the case is known to exist that would establish whether there is evidence that the occupants of the area were relocated at that time or whether there are eviction records. Our colleague, Licda. Victoria Blanco Moraga, located a copy of a case file containing some information on proceedings carried out in 2009 concerning the same problem, with no record that the project was implemented.

The case file contains a series of sketches of areas proposed for the relocation of persons classified as fishers who live there.

Regarding these areas, we must indicate that the area is currently occupied (the administrative case files, their current status, and whether those persons previously occupied the disputed sector are unknown) … and therefore it is not recommended as a solution to the problem …

1.1. Recent proposal Although the applicable rule is clear as to how to proceed with illegal occupations, the institution must not overlook the social problem that exists in this specific sector; a solution to both problems may be sought if the necessary resources are available.

At one point, this department worked on a proposal to provide an option for relocating these illegal occupants. The proposal that was prepared consists of opening up a sector within the Restricted Zone (Zona Restringida) of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre), which is currently zoned under the coastal Regulatory Plan (Plan Regulador), Sector A Puerto Pilón, as a Community Facilities Zone and Tourist Accommodation Zone. This area is located 500 linear meters from the location that is currently occupied; a general image of the site is shown.

The reason for proposing this area is that work was underway on the development of the Plan Regular Integral de Pavones (PRI), jointly with ICT, and a proposal has been made to implement secondary and tertiary roadways in the sector outlined in green as the proposed relocation area, given that this area currently lacks actual access.

The PRC proposes a roadway originating on titled land. The necessary expropriations have not yet been carried out, and structures exist along its proposed route.

Image 3 shows in green the roadway proposed in the PRI, which continues to enter through the Restricted Zone. The tertiary streets shown in front of Dirección01 are those that would provide access to the Public Zone (Zona Pública) defined by the estuary of Quebrada Pavón, the same location where the local cemetery is situated, to which access has been requested on other occasions. These roads would make it possible to subdivide the sector into lots if the zoning is changed.

Image 4 shows an example of a subdivision layout (lotificación); the described area would have its land use changed to a Residential Zone under the PRC. It must be emphasized that this is only a proposal that was taken into account for the PRI process; it cannot be implemented immediately, since the process of implementing that Regulatory Plan would first have to be completed, which is estimated to take 2 or 3 years. Furthermore, the solution would consist of giving local residents the option, if they so wish, to apply for one of the proposed lots under a concession (concesión), without being permitted to develop the land until the concession has been duly recorded in the Registro Nacional (sic).

2. Conclusions and Recommendations.

The preceding points show that the Municipalidad’s technical team has carried out the necessary processes (surveying and inspection) requested for a proceeding whose course is unknown but which nevertheless enables the Administration to take the necessary action. The eviction proceeding and the manner in which intervention should occur are unknown; I therefore suggest requesting an opinion from the Legal Advisory Office on how to proceed in these cases.

I also consider it necessary to determine whether there are social-welfare projects through which, after conducting a socioeconomic assessment of each household, another housing option could be provided to the occupants. This work must be performed by the Municipalidad’s social worker or social outreach officer.

The case file provided by the person in charge of the Plataforma de Servicios also shows that the Instituto Mixto de Ayuda Social was notified in 2009. Advice may be sought from that and other institutions, and projects that could provide housing options to the affected persons may also be identified.

The following conclusion is drawn from Appraisal Report MG-OV-IT-026-2019, dated 06 de Agosto del 2019, signed by Ing. Bryan Tenorio Sánchez in his capacity as Surveyor for the Oficina de Valoraciones, concerning the Survey of Structures in the Public Zone, Pavones: “…all the structures (except those occupied by Mr. Nombre01, for which, due to their proximity to the monument line (línea de mojones), a survey using specialized equipment is planned) are located within the Public Zone of the Maritime-Terrestrial Zone. Some of these structures were already documented in Official Letter No. MGPS-20175-2007, prepared by our colleagues in Inspections, although on some occasions the occupants and even the improvements to the land have changed.

The survey will be conducted on 07 de agosto del 2019 jointly with the inspectors. In addition, a second site visit will be made in those cases in which the occupants of the structures were not found.

Other structures located in the Restricted Zone of the Maritime-Terrestrial Zone within the same sector were also analyzed. However, they are addressed in another report because of their direct relationship to pending concession applications before the Municipalidad.

3. Subsequently, through Official Letter No. AM-MG-O-0024-2021 dated 25 de Enero del 2021, reference was made to the actions taken in response to Official Letter No. MS-DRRSBRU-ARSGO-0711-2020 dated 18 de Agosto del 2020, to which were attached the proposals issued through Official Letter No. MG-OV-INT-043-2020 dated 01 de Octubre del 2020, signed by Ing. Bryan Tenorio Sánchez in his capacity as Surveyor for the Oficina de Valoración and by María del Carmen Vargas Arrieta in her capacity as Acting Head of the Departamento de Zona Marítimo Terrestre, both of the Municipalidad de Golfito.” Accordingly, it has been established that the Municipal Administration has been taking action concerning the encroachments in the Public Zone of the Maritime-Terrestrial Zone. Therefore, it is not true that the petitioner received no response, much less that no action was taken concerning the complaint filed by the petitioner.

  1. 5Gustavo Mayorga Mayorga, in his capacity as President of the Concejo de Golfito, states under oath and reiterates the assertions made by the Mayor of that canton.
  2. 6Fernando Mata Castro, in his capacity as Director of the Área Rectora de Salud de Golfito, reports under oath and states that, in March 2020, an unsigned letter was received by email reporting improvised structures and shacks at Playa Higuito and Playa Pilón, where several families reside. This complaint was likewise forwarded to the Dirección de Atención al Cliente. The letter states that it was submitted on behalf of the Board of Directors of the Asociación Cámara de Turismo, and the email was sent by Joseph Robertson. Through Official Letter No. MS-DRRSBRU-ARSGO 0295-2020 of 23 de abril de 2020, he responded to the appellant, acknowledging receipt of the letter and reporting that it had been forwarded to the Municipalidad de Golfito so that it could address the case within the scope of its authority. On 9 de junio 2020, an interinstitutional site inspection was conducted with the participation of officials from the Municipalidad de Golfito, SINAC, and Ministerio de Salud.The Ministerio applied the Complaint Verification Instrument for Wastewater in Urban Developments or Residential Communities. Through Official Letter No. SINAC-ACOSA-RNFSG-AD-086-2020 of 10 de junio de 2020, a report on the site inspection was issued, concluding that six structures were georeferenced in the Public Zone (Zona Pública) of the certified State Natural Heritage (Patrimonio Natural del Estado) polygon administered by SINAC-MINAE; one structure was located outside the Public Zone within State Natural Heritage; and seven structures were georeferenced in the Public Zone, outside State Natural Heritage, under the administration of the Municipalidad de Golfito. It further stated that, in the case of Play Higuito de Pavones, the persons who had at one time occupied that site on a precarious basis (condición precaria) had already left. Licda. Jovita Morera and Ing. Marvin Salamanca, officials of the Unidad de Rectoría de la Salud of the Dirección Regional Brunca del Ministerio de Salud, issued Report MS-DRRSBRUURS-IT-140-2020 of 11 de junio de 2020, in which they stated that the settlement located at Playa Pilón failed to comply with the provisions governing wastewater management and that its residents used wells as a source of water for human consumption, but those wells did not comply with the legally required setback (retiro de ley), and that it was the responsibility of the Municipalidad de Golfito to issue the corresponding administrative acts (actos administrativos).Technical Report No. MS-DRRSBRU-ARSG-IT-0573-2020 of the Área Rectora de Salud de Golfito, dated 22 de junio 2020, states that the visit of 9 de junio del 2020 to Playa Pilón showed that the reported situation persisted, since there were a total of thirteen structures lacking wastewater treatment systems and that, because the structures are located within State Natural Heritage, it is the responsibility of the Municipalidad de Golfito and SINAC to issue the administrative acts necessary to remedy the ongoing pollution. Report MS-DRRSBRU-ARSG-IT-0574-2020 of 22 de junio 2020 states that, during the visit conducted on 9 de junio to Playa Higuito, the reported situation was no longer present because there were no persons camping at the site. Through Official Letters Nos. MS-DRRSBRU-ARSGO-0710-2020 and MS-DRRSBRU-ARSGO-0711-2020, both dated 18 de agosto 2020, the respondents were ordered to prepare a plan for addressing the problem that established a schedule of actions and the corresponding budget, and to keep him informed of any measures issued.Through Official Letter MS-DRRSBRU-ARSGO-0712-2020 of 18 de agosto 2020, the appellant was informed for a second time of the actions taken to date. In the absence of a response, through Official Letters Nos. MS-DRRSBRU-ARSGO-O-1218-2020 and MS-DRRSBRU-ARSGO-O-1219-2020, both dated 13 de noviembre de 2020, a report on the actions taken was requested from the Alcalde de Golfito, with the understanding that a public-health problem and environmental harm existed. Through Official Letter No. MS-DRRSBRU-ARSG-0043-2021 of 20 de enero 2021, addressed to the Alcalde de Golfito and the Directora del Refugio de Vida Silvestre Golfito SINAC-ACOSA, as a follow-up to the aforementioned Official Letters MS-DRRSBRU-ARSGO-0710-2020 and MSDRRSBRU- ARSGO-0711-2020, a report on the measures taken was requested for a third time. Through Official Letter No. MS-DRRSBRU-ARSG-0044-2021 of 20 de enero 2021, he informed the Director Regional de Rectoría de La Salud Brunca of the actions taken.In response to the request, Report SINAC-ACOSARNFSG-AD-086-2020 was forwarded through Official Letter No. SINAC-ACOSA-D-033-2021 of 21 de enero de 2021. In response to the request, Official Letter No. AM-MG-O-0024-2021 of 25 de enero 2021 from the respondent Alcalde reported that Official Letter MS-DRRSBRU-ARSGO- 0711-2020 had been forwarded to the Departamento de Valoraciones and the Departamento de Zona Marítimo Terrestre, attached reports MG-OV-INT-043-2020 and MS-OV-IT-026-2019, and stated that the opinion of the Comisión de Ambientales was pending. On 26 de enero 2021, he sent an email to the master’s-degree-holding Directora del Área de Conservación requesting the information previously sought so that a response could be provided to the complainant and the higher authorities. Through Official Letter No. MS-DRRSBRU-ARSGO-0056-2021 of 28 de enero 2021, the appellant was informed for a third time of the actions taken in response to his letter.Through Official Letter No. MS-DRRSBRU-1503-2021 of 27 de enero de 2021, and in response to Official Letter No. MS-DGS-0046- 2021, the Director Regional de Rectoría de la Salud Brunca informed the appellant. After being notified of this proceeding, on 3 de febrero de 2021, he ordered the Técnico de Regulación de La Salud of the Área Rectora de Salud to conduct an inspection at Playa Pilón. Technical Report MS-DRRSBRU-ARSG-IT-0058-2021 was issued concerning that visit and concluded that a settlement of persons was observed on the beach, with permanent residential structures and subsistence activities being carried out there (fishing and fishing-related activities). It further concluded that the identified conditions persisted. He has acted diligently in addressing the case and the reported circumstances; consequently, insofar as this entity is concerned, the amparo proceeding (recurso de amparo) must be dismissed, as hereby requested.
  3. 7Laura Rivera Quintanilla, in her capacity as Acting Director of the Área de Conservación Osa del Sistema Nacional de Áreas de Conservación, reports under oath and states that it is not true that she failed to act to address the problem complained of. The following may be inferred from report SINAC-ACOSA-RNFSG-AD-086-2020:

“…Six structures were georeferenced in the Public Zone of the certified State Natural Heritage polygon, administered by SINAC-MINAE.

One structure outside the Public Zone, within PNE.

Seven structures were georeferenced in the ZP, outside PNE, under the administration of the Municipalidad de Golfito…” In the cases mentioned in Official Letter No. SINAC-ACOSA-RNFSG-AD-086-2020, all but one of the structures are located in the Public Zone; therefore, it is not possible to process or grant a use permit (permiso de uso). As regards the structure said to be located in the restricted area (área restringida), it would be necessary to determine whether it is under concession (concesionada) and, if so, in whose name, because the report is not sufficiently clear to determine whether any application for a use permit may exist. It can be certified that no use permit has been granted in this sector belonging to Pavones. Furthermore, pursuant to Ley 6043, ICT is responsible for the general supervision and oversight of the maritime-terrestrial zone (zona marítimo terrestre). Under Article 3, the municipalities are directly responsible for ensuring compliance with the provisions of that law.

SINAC’s authority would be limited solely to the area classified as State Natural Heritage. As stated in Official Letter No. SINACACOSA-PNE-AD-019-2021, the information gathered to prepare Report No. SINACACOSA-RNFSG-AD-086-2020 is unclear and may be outdated; it is therefore essential to characterize the occupation so that action may be taken once the Ley de Protección de ocupantes de zonas clasificadas como Especiales No 9577 is no longer in force. That law was published in the Diario Oficial La Gaceta No 132 Alcance No 133 of 20 de julio de 2018 and has a term of 36 months. The current actions are also designed and directed toward efficient use of ACOSA’s available resources because, as Official Letter SINAC-ACOSA-D-059-2021 indicates, appropriations for travel allowances and fuel have been reduced by 50% and 62.5%, respectively. The Área de Conservación Osa (ACOSA) will address the problem as follows:

"Objectives of the first stage of the action plan:

Prepare a georeferenced survey of the occupation within polygon B3.

Prepare a technical and legal analysis of the information to establish the course of action.

Stage 1.

As stated in the report by Licda. Ginette Jiménez Soto, Official Letter SINAC-ACOSAPNE-AD-019-2021, the information gathered to prepare Report SINAC-ACOSARNFSGAD-086-2020 is unclear and may be outdated; accordingly, a new information survey will be conducted. The following information will be collected during that survey:

1. GPS points for both corners of the structure or occupation nearest to the Public Zone.

2. Perimeters of the structure and the parcel.

3. Construction materials.

4. Estimated value of the structure.

5. Occupants’ information.

6. Type and duration of the occupation.

7. Whether they have land-use permits (permisos de uso de suelo) from the municipality.

8. Whether they hold a concession (concesión) from the municipality.

9. Whether they applied for a use permit from SINAC-ACOSA.

This stage will be carried out on 13 y 14 de febrero de 2021. Lic. Joel García Medina will be responsible for the survey.

Stage 2.

During this stage, the information will be tabulated and the corresponding report will be prepared, through which a technical and legal analysis will be requested from the PNE and Legal departments. Based on the results, the steps to be taken by ACOSA will be established. This report will be delivered at the end of this month.

Stage 3 Preparation of the technical and legal analysis. The purpose is to indicate the status of the occupation. This report must be completed during the first half of marzo.

Stage 4 Preparation of the Operational Action Plan. Its purpose is to evict the illegal occupation from PNE. The plan will be submitted by the end of marzo."

  1. 8The legal requirements have been observed in the proceedings conducted.

Magistrada Sánchez Navarro drafts the opinion; and,

WHEREAS:

I. SUBJECT MATTER OF THE PROCEEDING

The appellant complains that, one year after he reported to the respondent agencies and local entity the existence of improvised structures and shacks at Playas Higuito y Pilón, and the resulting sanitation problems, his complaint has not been addressed. He asserts that this omission violates his fundamental rights.

II. PRELIMINARY MATTER

Before analyzing the merits of the case, it must be clarified that, since Judgment No. 2008-02545 issued at 08:55 on February 22, 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those matters in which it is disputed whether the administration has complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws for concluding, by means of a final decision, an administrative proceeding (procedimiento administrativo)—initiated sua sponte or at the request of a party—or for hearing the applicable administrative appeals (recursos administrativos). Specifically, the case at hand (sub lite) presents an exception, because it concerns a complaint relating to the environment that allegedly has neither been addressed nor resolved within a reasonable period. In view of the fundamental rights invoked, this Chamber assesses possible delays in resolving complaints of this type. Having clarified this point, the Chamber proceeds to decide the specific situation raised in this amparo proceeding (amparo).

III. PROVEN FACTS

The following facts relevant to the decision in this amparo proceeding are deemed proven:

  • 1)On March 26, 2020, the petitioner filed a complaint with the Ministerio de Salud concerning the existence of improvised structures and shacks at Playas Higuito and Pilón (copy attached to the report).
  • 2)By email dated April 14, 2020, the petitioner reiterated his complaint to the Ministro de Salud (copy attached to the report).
  • 3)By official letter from the Área Rectora de Salud de Golfito, No. MS-DRRSBRU-ARSGO-0294-2020 dated April 23, 2020, that complaint was forwarded to the Municipalidad de Golfito (report submitted under oath).
  • 4)By official letter from that Área de Salud, No. MS-DRRSBRU-ARSGO-0295-2020 dated April 23, 2020, the petitioner was informed that his complaint had been forwarded to the respondent local authority (report submitted under oath).
  • 5)On June 9, 2020, an inter-institutional operation was conducted at the reported locations, with the participation of officials from the Municipalidad de Golfito, SINAC, and Ministerio de Salud, and the Instrumento de Verificación de Denuncias por Aguas Residuales en Urbanizaciones o Residenciales was applied (report submitted under oath).
  • 6)By official letter from the Área de Conservación Osa, No. SINAC-ACOSA-RNFSG-AD-086-2020 dated June 10, 2020, a report on that inspection was submitted, concluding that structures existed in the public zone (zona pública) of the polygon certified as Patrimonio Natural del Estado. In addition, six structures were georeferenced within the Public Zone of the polygon certified as Patrimonio Natural del Estado (administered by SINAC-MINAE), one structure outside the Public Zone but within Patrimonio Natural del Estado, and seven structures within the Public Zone but outside Patrimonio Natural del Estado (report submitted under oath and copy attached to the report).
  • 7)Report No. MS-DRRSBRU-URS-IT-140-2020 dated June 11, 2020, from the respondent Área Rectora de Salud concluded that the settlement located at Playa Pilón failed to comply with provisions governing wastewater management and that its inhabitants used wells to obtain water for human consumption that did not comply with the legally required setback (retiro de ley), and that the Municipalidad de Golfito was responsible for issuing the corresponding administrative acts (actos administrativos) (report submitted under oath and copy attached to the report).
  • 8)By official letter from the Área Rectora de Salud de Golfito, No. MS-DRRSBRU-ARSG-IT-0573-2020 dated June 22, 2020, a technical report was provided concerning the visit conducted on June 9 to Playa Pilón, which showed that the reported situation persisted, since a total of thirteen structures lacked wastewater treatment systems and, because the structures were located within Patrimonio Natural del Estado, the Municipalidad de Golfito and SINAC were responsible for issuing the administrative acts necessary to remedy the ongoing pollution (report submitted under oath and copy attached to the report).
  • 9)Report No. MS-DRRSBRU-ARSG-IT-0574-2020 dated June 22, 2020, from that Área Rectora de Salud stated that no persons were camping at Playa Higuito during the visit conducted on June 9 (report submitted under oath).

IV. FACTS NOT PROVEN

The following relevant fact is deemed unproven: Sole fact.- That the Área de Conservación Osa provided any response to the petitioner or ordered any measure to address the complaint.

V. ON THE RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT

On repeated occasions, the case law of this Chamber has recognized that public health and the right to a healthy and ecologically balanced environment are recognized both constitutionally and under international law. It has been held that the legitimate exercise of that right requires resources to be used rationally and that the State is responsible for protecting the environment, in accordance with the precautionary principle (principio precautorio) governing environmental matters. This principle obligates the State to take all necessary measures, within the scope permitted by law, to prevent irreversible environmental damage; to that end, it is responsible for creating favorable social conditions so that every person may enjoy health, understood as a state of physical, psychological (or mental), and social well-being (see Judgment No. 1998-0180 of 16:24 hours on 13 de enero de 1998). The State’s objective obligation concerning environmental protection does not necessarily entail a subjective right (derecho subjetivo) of individuals to demand, through judicial bodies, that a specific measure be taken, but it does entail a right to the adoption of measures suitable for safeguarding that right in the face of openly negligent conduct by public authorities or by natural and legal persons.

Accordingly, the State assumes the obligation to regulate those areas of social life from which dangers to the physical existence of the inhabitants of its territory may arise, as well as those that harm the environment, which it may do through statutes, regulations, agreements, or other measures related to administrative organization and procedures. Consequently, the possibility of judicially demanding, through an amparo action (recurso de amparo), a specific type of affirmative action by the State in fulfillment of its duty to protect the life, health, or environmental rights of its inhabitants is restricted to cases in which an imminent threat to those individual rights has been clearly established. It follows that intervention by the constitutional jurisdiction is viable only when the State’s failure, through its competent bodies, to address demands made by the country’s inhabitants in the exercise of their rights has been proven.

VI. SPECIFIC CASE

In this case, the petitioner alleges that, one year after he reported to the respondent agencies and local government entity the existence of improvised structures and shacks at Playas Higuito y Pilón, as well as the resulting sanitation problems, his complaint has not been addressed. He asserts that this omission violates his fundamental rights.

With respect to the Ministerio de Salud, the record establishes that, on 26 de marzo de 2020, the petitioner reported to the Ministerio de Salud the existence of improvised structures and shacks at Playas Higuito y Pilón and that, on 14 de abril of that same year, he reiterated that complaint to the Ministro de Salud. It was also shown that, by memorandum No. MS-DRRSBRU-ARSGO-0295-2020 of 23 de abril de 2020 from that Área de Salud, the petitioner was informed that his complaint had been forwarded to the Municipalidad de Golfito. It was likewise established that, on 9 de junio 2020, an interagency operation was conducted at the reported sites, with the participation of officials from the Municipalidad de Golfito, SINAC, and Ministerio de Salud, during which the Verification Instrument for Complaints Concerning Wastewater in Housing Developments or Residential Areas was applied. Report No. MS-DRRSBRU-URS-IT-140-2020 of 11 de junio de 2020 from the respondent Área Rectora de Salud indicates that the settlement located at Playa Pilón has problems with wastewater management and that its residents use wells to obtain water for human consumption, which fail to comply with the legally required setback (retiro de ley).

It was further established that, through memoranda Nos. MS-DRRSBRU-ARSG-IT-0573-2020 and MS-DRRSBRU-ARSG-IT-0574-2020, both dated 22 de junio 2020, the Área Rectora de Salud de Golfito issued a technical report concerning the inspections conducted at the reported sites. According to those inspections, the reported situation persisted at Playa Pilón because thirteen structures lacked wastewater treatment systems, whereas no persons were camping at Playa Higuito. In addition, the record shows that the petitioner was informed at various times during the intervention that the Área Rectora de Salud had ordered the Municipalidad de Golfito and the Área de Conservación Osa to prepare a plan for addressing the problem, together with the corresponding timetable and budget, and that those authorities had repeatedly been asked to report on the actions taken. Notwithstanding the foregoing, although, following service of the order admitting the proceeding (auto de curso), the Área Rectora de Salud de Golfito ordered an inspection at Playa Pilón to determine whether the previously existing conditions at that location had changed, and that inspection established that the reported problem persisted at Playa Pilón, it was not shown that the petitioner had been informed thereof. For precisely this reason, this Court finds that the alleged omission occurred.

As to the respondent local government entity, the record establishes that, in the resolution adopted by the Concejo de Golfito at ordinary session No. 12-ORD 32-2020 of 19 de agosto de 2021, memorandum No. MS-DRRSBRU-ARSGO-0711-2020 from the Área de Salud de Golfito was considered, and it was resolved “to forward it to the administration and to have a report submitted to this Concejo regarding the actions to be taken.” It was also established that, by Memorandum No. MG-OV-INT-043-2020 of 1 de octubre de 2020, the Oficina de Valoraciones and the Departamento de Zona Marítimo Terrestre of the respondent Municipalidad submitted a report to the Alcalde de Golfito regarding the reported facts. The record further establishes that, through Alcaldía memorandum No. AM-MG-0027-2021 of 26 de enero de 2021, a report concerning the facts reported by the petitioner was submitted to the Concejo de Golfito. In addition, although, following service of the order admitting the proceeding upon the respondent local authorities, a report concerning the actions intended to be implemented in response to his complaint was provided to and served upon the petitioner, the record does not show that the reported problem has been addressed. Accordingly, the Chamber finds that the alleged violation occurred.

With regard to the Área de Conservación Osa, it was shown that, by memorandum No. SINAC-ACOSA-RNFSG-AD-086-2020 of 10 de junio de 2020, a report was issued concerning the interagency inspection conducted on 9 of that same month, which concluded that structures existed in the public zone (zona pública) of the polygon certified as Patrimonio Natural del Estado. In addition, six structures were georeferenced in the Zona Pública of the polygon certified as Patrimonio Natural del Estado (administered by SINAC-MINAE), one structure outside the Zona Pública within Patrimonio Natural del Estado, and seven structures in the Zona Pública outside Patrimonio Natural del Estado. For that reason, according to the Acting Director of the Área de Conservación Osa, it is necessary to require the ICT, on behalf of the State, and the respondent Municipalidad to comply with the applicable statutes and regulations, because SINAC’s jurisdiction would be limited solely to the area classified as Patrimonio Natural del Estado.

She further explains that, because the information gathered to prepare that report is unclear and may be outdated, it is essential to characterize the occupancy so that action may be taken once Ley de Protección de ocupantes de zonas clasificadas como Especiales, 9577 is no longer in force. Although it was established that an action plan had been ordered for those purposes to determine the course to be followed, the record contains no adequate and reliable evidence that the complainant was informed of anything in that regard or that any measure was ordered to resolve the problem. On this understanding, the Chamber finds that the alleged injury occurred.

VII. NOTE BY JUSTICE RUEDA LEAL

I must note that, since judgment No. 2019-2355 of 9:30 on 12 de febrero de 2019, my position regarding amparo actions filed on behalf of a legal person (persona jurídica) has been as follows:

“…in Advisory Opinion 22-16 of 26 de febrero de 2016, the Corte Interamericana de Derechos Humanos stated that, although some States recognize the right of petition for legal persons subject to special conditions, such as labor unions, political parties, or representatives of indigenous peoples, Afro-descendant communities, or specific groups, the fact remains that ‘Article 1.2 of the American Convention enshrines rights only in favor of natural persons, and therefore legal persons are not holders of the rights enshrined in that treaty.’ Moreover, in the same advisory opinion, the Corte Interamericana held that, in certain particular contexts, natural persons may exercise their rights through legal persons (for example, through a media outlet, as occurred in the case of Nombre02 et al. v. Venezuela); however, for this to be eligible for protection under the Inter-American system, ‘the exercise of the right through a legal person must involve an essential and direct relationship between the natural person requiring protection from the Inter-American system and the legal person through which the violation occurred, since a mere connection between the two persons is insufficient to conclude that the rights of natural persons, rather than those of legal persons, are in fact being protected.

Indeed, proof must extend beyond the natural person’s mere participation in the legal person’s activities, such that such participation is substantially related to the rights alleged to have been violated.’ (emphasis added) (OC. 22/16).” Although the action at issue was filed on behalf of a legal person, it is nonetheless true that, in the case under consideration (sub iudice), the alleged violation is the failure to address an environmental complaint filed with the respondent authorities, alleging the existence of improvised structures and shacks at Playas Higuito y Pilón. In view of the foregoing, it should be noted that this Court has recognized vicarious standing (legitimación vicaria) in environmental matters, as reflected in judgment No. 2018-018870 of 9:40 hours on 13 de noviembre de 2018: “(…) in environmental matters, such as those at issue in this action, the Chamber has indeed accepted vicarious standing, in accordance with section 105 of the Ley de Biodiversidad, which recognizes a citizen action (acción popular) by providing: ‘Every person has standing in administrative or judicial proceedings to defend and protect biodiversity’ (see judgments No. 2018-1185 and 2018-1794).

Consequently, the petition is admitted and the merits of the claim shall be considered.” In light of the foregoing, because this is a case of vicarious standing, I consider it appropriate to hear the action filed on behalf of the protected legal person.

VIII. NOTE BY JUSTICE SALAZAR ALVARADO

In environmental matters, it is the undersigned’s view that, if the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the administrative courts (jurisdicción contenciosa administrativa). Nevertheless, I do address the merits of the matter when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy environment free of pollution (Article 50 of the Political Constitution), as is the case here, in which alleged pollution caused by makeshift structures and shacks at Playas Higuito and Pilón is asserted. This was reported to the Municipalidad de Golfito and the Ministerio de Salud, yet the problem has not been definitively resolved, thereby impairing the right to a healthy and ecologically balanced environment.

IX. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced through new technologies, they must retrieve them from the court within a maximum period of 30 business days from the date notice of this judgment is served. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on May 3, 2012, Article LXXXI.

POR TANTO:

The amparo petition (recurso de amparo) is granted. Daniel Salas Peraza, Fernando Mata Castro, Freiner Lara Blanco, Gustavo Mayorga Mayorga, and Laura Rivera Quintanilla, respectively, in their capacities as Ministro de Salud, Director del Área Rectora de Salud de Golfito, Alcalde and Presidente del Concejo—both of Golfito—and Acting Directora del Área de Conservación Osa, or whoever holds those offices, are ordered to take and coordinate the measures necessary to issue a final decision on the petitioner’s complaint within THREE MONTHS from the date notice of this judgment is served. The respondents are warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that they must comply with or enforce, and fails to comply with or enforce it, shall be subject to imprisonment for three months to two years, or a fine of twenty to sixty day-fines, provided that the offense is not punishable by a more severe penalty. The State and the Municipalidad de Golfito are ordered to pay the legal costs, damages, and losses (costas, daños y perjuicios) caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative courts. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del dieciseis de abril de dos mil veintiuno .

Recurso de amparo promovido por JOSEPH DOUGLAS ROBERTSON JR., pasaporte CED01, a favor de la ASOCIACIÓN CÁMARA DE TURISMO DE PAVONES, cédula jurídica CED02, contra el ÁREA DE CONSERVACIÓN DE OSA (SINAC-ACOSA), LA MUNICIPALIDAD DE GOLFITO Y EL MINISTERIO DE SALUD.

RESULTANDO:

  1. 1Mediante memorial presentado a las 13:16 horas de 29 de enero de 2021, el recurrente promovió recurso de amparo, contra el Área de Conservación Osa, la Municipalidad de Golfito y el Ministerio de Salud, pues, según afirma, es el Presidente de la Asociación Cámara de Turismo de Pavones y, cumpliendo el acuerdo firme de la Junta Directiva de su representada, acude en amparo contra la Directora del refugio de Vida Silvestre SINAC- ACOSA, el Alcalde y el Presidente del Concejo, ambos de Golfito, debido a que esas autoridades no han hecho nada en relación con la situación que les pusiera en conocimiento el Área Rectora de Salud de Golfito, en el siguiente sentido: Los informes de inspección de campo Nos. SINAC-ACOSA-RNFSG-AD-086-2020, MS-DRRSBRU-URS-IT-0140-2020 y MS-DRRSBRU-ARSG-IT-0573-2020 evidenciaron la invasión en la zona marítimo terrestre de Playa Pilón, lugar donde encontraron estructuras ubicadas en el espacio inalienable de administración municipal, en zona pública y patrimonio natural del Estado, por lo que se solicitó a las autoridades recurridas, en oficios a ellas dirigidos, generar un plan de abordaje de esa problemática, con un cronograma de acción y el presupuesto respectivo, así como mantener informadas a las autoridades del Ministerio de Salud sobre las acciones que se emitan.El recurrente manifiesta su preocupación por la forma en que esta situación afecta las playas, a los vecinos y a los turistas; alega que el Ministerio de Salud tampoco ha tramitado nada relacionado con la denuncia interpuesta por esa Cámara de Turismo, ni ha velado por el derecho a la salud; por el contrario, las reiteradas declaratorias de emergencia demuestran que estamos en una segunda ola de la pandemia de la Covid-19 y el problema de contaminación se ha incrementado. Así lo hicieron ver en un comunicado dirigido a las autoridades del Ministerio de Salud, a las direcciones de correo electrónico ...01 y ...02 el 11 de diciembre de 2020. El recurrente manifiesta su disconformidad porque desde el 19 de agosto de 2020, cuando el Ministerio de Salud emplazó a las otras autoridades para abordar dentro de un plazo razonable la problemática planteada; han transcurrido más de cinco meses y no han actuado.Considera violentando el principio de pronta respuesta y su derecho a una respuesta pronta y cumplida. Además, reprocha que hay negligencia de las autoridades recurridas en atender el problema de salud pública y responder los requerimientos del Ministerio de Salud. Solicita se ordene a los recurridos abordar de forma inmediata los problemas de salud pública expresados por el Ministerio de Salud y se les condene al pago de costas, daños y perjuicios.
  2. 2Por resolución de las 10:20 horas de 1 de febrero de 2021, se dio traslado al recurso y requirió un informe a la Directora del Refugio de Vida Silvestre del Área de Conservación de Osa (Sinac- Acosa), al Alcalde y al Presidente del Concejo, ambos de Golfito, al Ministro de Salud y a la Directora del Área Rectora de Salud de Golfito, sobre esos hechos.
  3. 3Informa bajo juramento Daniel Salas Peraza, en condición de Ministro de Salud, e indica que atiende el presente informe de ley con sustento en el Oficio No. MS-DRRSBRU-1921-2021 de 4 de febrero del 2021, emitido por el Dr. Christian Valverde, en su condición de Director Regional de Rectoría de la Salud Brunca, quien, en síntesis, afirma lo siguiente:

“(…) 1. En marzo del 2020, este Ministerio recibe nota sin firma en la cual se denuncia construcciones y ranchos improvisados en Playa Higuito y Playa Pilón en donde residen algunas familias. Esta denuncia fue remitida también a la Dirección de Atención al Cliente. La nota indica que es en nombre de la Junta Directiva de la Asociación de Cámara de Turismo y el correo lo remite el señor Joseph Robertson.

2. Por oficio MS-DRRSBRU-ARSGO 0295-2020, el Dr. Fernando Mata le comunica al señor Robertson que ha recibido la nota, que la denuncia fue trasladada a la Municipalidad de Golfito para que atiendan el caso dentro de sus competencias. (folio 11) 3. En fecha 09 de junio 2020, se realiza un operativo interinstitucional, en el cual participan funcionarios de la Municipalidad de Golfito, SINAC y Ministerio de Salud, en sitio se aplicó el Instrumento de Verificación de a Denuncias por Aguas Residuales en Urbanizaciones o Residenciales. (Folio 13 y 14).

4. Por oficio SINAC-ACOSA-RNFSG-AD-086-2020, la Licda. Ana Cecilia Medina Gutiérrez rinde un informe de inspección de Puerto Pilón, en el mismo se concluye que existe construcciones en la zona pública del polígono certificado Patrimonio Natural del Estado; además se georreferenció seis construcciones en la Zona Pública del polígono Certificado Patrimonio Natural del Estado (administración SINAC-MINAE), una construcciones fuera de la Zona Pública en Patrimonio Natural del Estado y siete construcciones en Zona Pública, fuera del Patrimonio Natural del Estado (administración dela Municipalidad de Golfito). (folio 15 al 18) 5. La Licda. Jovita Morera y el Ing. Marvin Salamanca, funcionarios de la Unidad de Rectoría de la Salud, emiten el informe MS-DRRSBRU-URS-IT-140-2020 del 11 de junio del 2020, en el cual refieren que el caserío que se ubica en Playa Pilón incumple las disposiciones en cuanto al manejo de aguas residuales y que utilizan pozos para abastecerse de agua para el consumo humano, pero que éstos pozos no respetan el retiro de ley y que corresponde a la Municipalidad de Golfito girar los actos administrativos correspondientes (folio 20 y 21) 6.

Informe técnico MS-DRRSBRU-ARSG-IT-0573-2020 del 22 de junio 2020, suscrito por la Ing. Hellen Rodríguez, funcionaria del ARS de Golfito en el cual refiere que en la visita realizada el 09 de junio del 2020 a Playa Pilón, se evidencia que la situación denuncia se mantiene, existe un total de trece estructuras que carecen de sistema de tratamiento de aguas residuales y que, siendo que las estructuras se encuentran dentro de Patrimonio Natural del Estado, corresponde a la Municipalidad de Golfito y SINAC emitir los actos administrativos necesarios a fin de solventar la contaminación que se está presentando (Folio 22 al 24).

7. Informe MS-DRRSBRU-ARSG-IT-0574-2020 del 22 de junio 2020, suscrito por la Ing. Hellen Rodríguez, funcionaria del ARS de Golfito en el cual refiere que en la visita realizada el 09 de junio del 2020 a Playa Higuito, no se mantiene la situación denunciada y que no se mantiene personas acampando en el lugar. (Folio 25 y 26).

8. Por oficio MS-DRRSBRU-ARSGO-0710-2020 del 18 de agosto 2020, el Dr. Fernando Mata, solicita a la Máster Laura Rivera Quintanilla, Directora del Refugio de Vida Silvestre Golfito SINAC-ACOSA, plan de abordaje de la problemática en el cual establezca un cronograma y presupuesto respectivo. (Folio 28).

9. Por oficio MS-DRRSBRU-ARSGO-0711-2020 del 18 de agosto 2020, el Dr. Fernando Mata, solicita al Lic. Freiner Lara Blanco, Alcalde de la Municipalidad de Golfito, plan de abordaje de la problemática en el cual establezca un cronograma y presupuesto respectivo. (Folio 29).

10. Por oficio MS-DRRSBRU-ARSGO-0711-2020, el Dr. Fernando Mata informa al señor Joseph Robertson lo actuado a la fecha. (Folio 31).

11. Por oficio MS-DRRSBRU-ARSGO-O-1218-2020, del 13 de noviembre del 2020, el Dr. Fernando Mata solicita a la Máster Laura Rivera, Directora del Refugio de Vida Silvestre Golfito SINAC-ACOSA, informe sobre las acciones realizadas, en el entendido de que existe una problemática de salud pública y una afectación al ambiente. (Folio 33).

12. Por oficio MS-DRRSBRU-ARSGO-O-1219-2020, del 13 de noviembre del 2020, el Dr. Fernando Mata solicita al Lic. Freiner Lara Blanco, Alcalde la Municipalidad de Golfito, informe sobre las acciones realizadas, en el entendido de que existe una problemática de salud pública y una afectación al ambiente. (Folio 34).

13. Por oficio MS-DRRSBRU-ARSG-0043-2021, del 20 de enero 2021, dirigido al Lic. Freiner Lara Blanco, Alcalde la Municipalidad de Golfito y la Máster Laura Rivera, Directora del Refugio de Vida Silvestre Golfito SINAC-ACOSA, el Dr. Fernando Mata, en seguimiento a los oficios MS-DRRSBRU-ARSGO-0710-2020 y MS-DRRSBRU-ARSGO-0711-2020, les solicita le informen sobre las gestiones realizadas. (Folio 40 y 41).

14. Por oficio MS-DRRSBRU-ARSG-0044-2021, del 20 de enero 2021 el Dr. Fernando Mata informa al suscrito sobre las actuaciones realizadas.

15. Por medio de oficio SINAC-ACOSA-D-033-2021, de fecha 21 de enero 2021, la máster Laura Rivera Quintanilla, traslada al Dr. Fernando Mata el informe SINACACOSA-RNFSG-AD-086-2020, al que me referí en el punto cuatro de este oficio. (Folio 49 al 53) 16. Por oficio AM-MG-O-0024-2021 del 25 de enero 2021, el Lic. Freiner Lara Blanco, Alcalde de la Municipalidad de Golfito, informa al Dr. Fernando Mata que el oficio MS-DRRSBRU-ARSGO-0711-2020 fue remitido al Departamento de Valoraciones y al Departamento de Zona Marítimo Terrestre, adjunta los informe MG-OV-INT-043-20200 y MS-OV-IT-026-2019 y concluye su oficio indicando que se encuentran a la espera del dictamen de la Comisión de Ambientales. (Folio 54-114).

17. El 26 de enero 2021 el Dr. Fernando Mata remite correo electrónico a la máster Laura Rivera Quintanilla, en el cual solicita le brinde la información que ha solicitado anteriormente a fin de dar respuesta al denunciante a las autoridades superiores. (Folio 115).

18. Por oficio MS-DRRSBRU-ARSGO-0056-2021 del 28 de enero 2021, el Dr. Fernando Mata informa al denunciante las actuaciones realizadas en atención a su denuncia. (Folio 117) 19. Por oficio MS-DRRSBRU-1503-2021, y en atención al oficio MS-DGS-0046-2021, el suscrito informa al denunciante lo actuado (…)” De conformidad con lo expuesto, el Ministerio, a través de las autoridades del Área Rectora de Salud de Golfito y de la Dirección Regional de Rectoría de Salud Brunca, han brindado atención y seguimiento al caso de marras y se le ha enviado respuesta al amparado, manteniéndole informado sobre lo actuado por este Ministerio conforme a sus competencias, ello consta en notificaciones realizadas al aquí amparado, según el expediente del caso de marras, el cual el Área Rectora de Salud de Golfito hará llegar a esta Sala. No está de más indicar que lo relacionado con el dominio, desarrollo, aprovechamiento y uso de las zonas marítimo terrestre, constituye competencia municipal, en este caso de la Municipalidad de Golfito.

  1. 4Informa bajo juramento Freiner Lara Blanco, en condición de Alcalde de Golfito, e indica que indica que mediante acuerdo transcrito por oficio SMG-T-0479-08-2020 de 27 de agosto de 2020, el Consejo conoció el oficio MS-DRRSBRU-ARSGO-0711-2020 de 18 de agosto de 2020, en el cual se acordó trasladar a la administración la denuncia a efecto que se tomaran las acciones del caso y se rindiera un informe a ese órgano. Por oficio No. MG-OV-INT-043-2020 de 1 de octubre de 2020, se indica:

“En el informe adjunto como anexo se evidencia que la problemática se da desde el 2007, ya que en ese sector el cuerpo de inspectores realizó un inventario de las construcciones en el mismo sector, se ha consultado de manera verbal a los departamentos de Asesoría Legal, Plataforma de Servicios, Inspecciones y Alcaldía y se conoce documentación alguna del caso, para saber si hay evidencia de reubicación a los ocupantes de la zona en aquel entonces o actas de desalojo, la compañera Licda. Victoria Blanco Moraga localizó copia de expediente en el cual consta alguna información de procedimientos llevados a cabo en el 2009 sobe la misma problemática, no constando ejecución alguna del proyecto.

En el expediente se observa una serie de croquis sobre zonas propuestas para la reubicación de las personas clasificadas como pescadores, que habitan en el lugar.

Sobre estas debemos indicar que la zona actualmente se encuentra ocupada (se desconocen expedientes administrativos, estado actual de los mismos y si anteriormente eran ocupantes del sector en conflicto) … por lo que no se recomienda como solución a la problemática …

1.1. Propuesta reciente Si bien la Norma es clara en cómo proceder con las ocupaciones ilegales, la institución no debe de obviar la problemática social que hay en este sector en específico, puede buscarse una solución a ambos problemas si se tienen los recursos necesarios.

Este departamento en su momento trabajó en una propuesta para dar opción de reubicar a estos ocupantes ilegales, la propuesta de esta realizado consiste en habilitar un sector en la Zona Restringida de la Zona Marítimo Terrestre que actualmente se encuentra zonificado en el Plan Regular costero Sector A Puerto Pilón como Zona de Facilidades Comunales y Zona de Alojamiento Turístico, esta zona se encuentra a 500 metros lineales del lugar que actualmente se tiene ocupado, se muestra imagen general del lugar.

La razón de proponer esta zona que se estaba trabajando en el desarrollo del Plan Regular Integral de Pavones (PRI), en conjunto con el ICT y en el sector que se demarca en verde como zona propuesta par reubicación se ha hecho la propuesta de implementar vialidad secundaria y terciaria, dado que actualmente esta zona carece de acceso real.

El PRC propone una vialidad la cual viene desde terreno escriturado, actualmente no se han realizado las expropiaciones necesarias y existen construcciones sobre el trazado de estas.

En la imagen 3 se observa en verde la vialidad propuesta en el PRI, esta hace ingreso siempre por la zona restringida, las calles terciarias que se ven frente a los Dirección01 son las que darían acceso a la zona pública definida la Ría de la quebrada Pavón, mismo lugar donde se encuentra el cementerio del lugar al cual se ha solicitado en otras ocasiones dar acceso y son estas vías la que se darían opción de lotificar el sector si se hace un cambio en la zonificación.

En la imagen 4 se observa un ejemplo de trazado de lotificación, la zona que se describe se cambiaria de uso a Zona Residencial al PRC. Es necesario hacer énfasis en que esto es solo una propuesta que se tomó en cuenta parara el proceso del PRI, no es de implementación inmediata ya que para eso se debería concluir con el proceso de implementación de dicho Plan Regulador, el cual se estima en 2 o 3 años. Además, la solución sería de dar una opción a los pobladores locales para que si así lo desean soliciten uno de los lotes propuestos mediante la figura de la concesión, no pudiendo desarrollar el terreno hasta que se obtengan la concesión debidamente inscrita en el Registro Nacional (sic).

2. Conclusiones y Recomendaciones.

Se ha evidenciado en los puntos anteriores que el equipo técnico de la Municipalidad ha realizado los procesos necesarios (levantamiento e inspección) solicitados para un proceso al cual se desconoce su línea, pero que, sin embargo, sirve para que la Administración tome las acciones necesarias, se desconoce el proceso de trámite de desalojo y como se debe intervenir, por lo que sugiero solicitar a la asesoría legal criterio de cómo proceder en estos casos.

También considero necesario que se verifique si existen proyectos de bien social en los cuales después de realizar la valoración de socioeconómica de cada núcleo familiar se pueda dar otra opción de vivienda a los ocupantes, labor que debe ser realizada por el trabajador social o promotora social de la Municipalidad.

Se puede observar también en el expediente facilitado por la encargada de la Plataforma de Servicios, que se puso en conocimiento en el 2009 al Instituto Mixto de Ayuda Social, puede buscarse asesoría con este y otras instituciones e incluso conocer proyectos que puedan dar opciones de vivienda a las personas afectadas.

Del Informe de Avalúo MG-OV-IT-026-2019 de fecha 06 de Agosto del 2019 suscrito por el funcionario Ing. Bryan Tenorio Sánchez en calidad de Topógrafo de la Oficina de Valoraciones referente al Levantamiento de Construcciones en Zona Pública, Pavones, se concluye lo siguiente: “…todas las construcciones (excepto las ocupadas por el señor Nombre01, que por la cercanía con la línea de mojones se pretende realizar un levantamiento con equipo especializado), se encuentran en la Zona Pública de la Zona Marítimo Terrestre. Algunas de estas ya constatadas en el Oficio No. MGPS-20175-2007, elaborado por los compañeros inspecciones cambiando algunas ocasiones los ocupantes e incluso las mejoras en el terreno.

El levantamiento se realizará el día 07 de agosto del 2019 en conjunto con los inspectores adicionalmente se hará una segunda visita en el sitio para los casos en los que no se encontraron los ocupantes de las construcciones.

Se analizaron otras construcciones que se encuentran en la Zona Restringida de la zona marítimo terrestre en el mismo sector. Sin embargo, se tratan en otro informe por la relación directa con solicitudes de concesión abiertas en el municipio.

3. Posteriormente, mediante Oficio No. AM-MG-O-0024-2021 de fecha 25 de Enero del 2021, se refieren a las acciones realizadas en contestación del Oficio No. MS-DRRSBRU-ARSGO-0711-2020 de fecha 18 de Agosto del 2020, en el cual se adjuntan las propuestas emitidas mediante Oficio No. MG-OV-INT-043-2020 de fecha 01 de Octubre del 2020, firmado por el Ing. Bryan Tenorio Sánchez en calidad de Topógrafo de la Oficina de Valoración y la funcionaria María del Carmen Vargas Arrieta en calidad de Encargada a.i. de Departamento de Zona Marítimo Terrestre, ambos de la Municipalidad de Golfito” Así las cosas, se acredita que la Administración Municipal ha estado tomando acciones con respecto al caso de las invasiones en zona pública de la zona marítimo terrestre, razón por la cual, no es cierto que no se haya dado respuesta al recurrente, ni mucho menos que no se hayan tomado acciones con respecto a la denuncia interpuesta por el recurrente.

  1. 5Informa bajo juramento Gustavo Mayorga Mayorga, en condición de Presidente del Concejo de Golfito, y reitera lo alegado por el Alcalde de ese cantón.
  2. 6Informa bajo juramento Fernando Mata Castro, en condición de Director del Área Rectora de Salud de Golfito, e indica que en marzo de 2020, vía correo electrónico, se recibió una nota sin firma, en la cual se denuncian construcciones y ranchos improvisados en Playa Higuito y Playa Pilón, donde residen algunas familias. Esta denuncia fue remitida, de la misma forma, también a la Dirección de Atención al Cliente. La nota indica que es en nombre de la Junta Directiva de la Asociación Cámara de Turismo y el correo lo remite Joseph Robertson. Con Oficio No. MS-DRRSBRU-ARSGO 0295-2020 de 23 de abril de 2020, le brindó respuesta al recurrente, dando acuse de recibido de la nota, e informando que fue trasladada a la Municipalidad de Golfito para que atendieran el caso dentro de sus competencias. El 9 de junio 2020, se realizó un operativo interinstitucional de verificación en el sitio, en el cual participaron funcionarios de la Municipalidad de Golfito, SINAC y Ministerio de Salud.El Ministerio aplicó el Instrumento de Verificación a Denuncias por Aguas Residuales en Urbanizaciones o Residenciales. Mediante el Oficio No. SINAC-ACOSA-RNFSG-AD-086-2020 de 10 de junio de 2020, se rindió un informe de la verificación en el sitio, el cual concluye que, se georreferenció seis construcciones en la Zona Pública del polígono certificado Patrimonio Natural del Estado, administración SINAC-MINAE; una construcción fuera de la Zona Pública en Patrimonio Natural del Estado, y se georreferenció siete construcciones en Zona Pública, fuera del Patrimonio Natural del Estado, en administración de la Municipalidad de Golfito. Además, que el caso en Play Higuito de Pavones, las personas que en algún momento ocuparon en condición precaria en ese sitio, ya se habían retirado del lugar. La Licda. Jovita Morera y el Ing. Marvin Salamanca, funcionarios de la Unidad de Rectoría de la Salud de la Dirección Regional Brunca del Ministerio de Salud, emiten el Informe MS-DRRSBRUURS-IT-140-2020 de 11 de junio de 2020, en el cual refieren que el caserío que se ubica en Playa Pilón, incumple las disposiciones en cuanto al manejo de aguas residuales y que utilizan pozos para abastecerse de agua para el consumo humano, pero que esos pozos no respetaban el retiro de ley y que correspondía a la Municipalidad de Golfito girar los actos administrativos correspondientes.El Informe Técnico del Área Rectora de Salud de Golfito, No. MS-DRRSBRU-ARSG-IT-0573-2020 de 22 de junio 2020, señala que la visita de 9 de junio del 2020 a Playa Pilón, evidenció que la situación denuncia se mantenía, pues existía un total de trece estructuras que carecen de sistema de tratamiento de aguas residuales y que, siendo que las estructuras se encuentran dentro de Patrimonio Natural del Estado, corresponde a la Municipalidad de Golfito y SINAC, emitir los actos administrativos necesarios a fin de solventar la contaminación que se está presentando. El Informe MS-DRRSBRU-ARSG-IT-0574-2020 de 22 de junio 2020, refiere que en la visita realizada el 9 de junio a Playa Higuito, no se mantiene la situación denunciada, puesto que no habían personas acampando en el lugar. Por Oficios Nos. MS-DRRSBRU-ARSGO-0710-2020 y MS-DRRSBRU-ARSGO-0711-2020, ambos de 18 de agosto 2020, se ordenó a los recurridos que realizaran un plan de abordaje de la problemática, el cual estableciera un cronograma de acción y el presupuesto respectivo, además que mantuviera informado sobre las acciones que se emitan.Por Oficio MS-DRRSBRU-ARSGO-0712-2020 de 18 de agosto 2020, informó por segunda vez, al recurrente, lo actuado a la fecha. Ante ausencia de respuesta, por Oficios Nos. MS-DRRSBRU-ARSGO-O-1218-2020 y MS-DRRSBRU-ARSGO-O-1219-2020, ambos de 13 de noviembre de 2020, se requirió y al Alcalde de Golfito, un informe sobre las acciones realizadas, en el entendido de que existe una problemática de salud pública y una afectación al ambiente. Mediante el Oficio No. MS-DRRSBRU-ARSG-0043-2021 de 20 de enero 2021, dirigido al Alcalde de Golfito y la Directora del Refugio de Vida Silvestre Golfito SINAC-ACOSA, en seguimiento a los Oficios MS-DRRSBRU-ARSGO-0710-2020 y MSDRRSBRU- ARSGO-0711-2020 antes citados, se solicitó un informe por tercera vez sobre las gestiones realizadas. Mediante el oficio No. MS-DRRSBRU-ARSG-0044-2021 de 20 de enero 2021, informó al Director Regional de Rectoría de La Salud Brunca, sobre las actuaciones realizadas.En respuesta a lo solicitado, por oficio No. SINAC-ACOSA-D-033-2021 de 21 de enero de 2021, se trasladó el Informe SINAC-ACOSARNFSG-AD-086-2020. En respuesta a lo solicitado, por Oficio del Alcalde recurrido, No. AM-MG-O-0024-2021 de 25 de enero 2021, se informó que el Oficio MS-DRRSBRU-ARSGO- 0711-2020 había remitido al Departamento de Valoraciones y al Departamento de Zona Marítimo Terrestre, adjunta los informe MG-OV-INT-043-2020 y MS-OV-IT-026-2019 y que se estaba a la espera del dictamen de la Comisión de Ambientales. El 26 de enero 2021, remitió un correo electrónico a la máster Directora del Área de Conservación solicitando que brindara la información que se ha solicitado, a fin de dar respuesta al denunciante y a las autoridades superiores. Por Oficio No. MS-DRRSBRU-ARSGO-0056-2021 de 28 de enero 2021, informó por tercera vez, al recurrente de las actuaciones realizadas en atención a su nota.Mediante Oficio No. MS-DRRSBRU-1503-2021 de 27 de enero de 2021, y en atención al Oficio No. MS-DGS-0046- 2021, el Director Regional de Rectoría de la Salud Brunca, informó al recurrente. Habiendo sido notificado de este recurso, el 3 de febrero de 2021, ordenó al Técnico de Regulación de La Salud del Área Rectora de Salud, que realizara una verificación en Playa Pilón. Por Informe TécnicoMS-DRRSBRU-ARSG-IT-0058-2021, se rindió un informe de esa visita, el cual concluye que se observó un asentamiento de personas en la playa, contando con estructuras permanentes para habitar y la realización de actividades de subsistencia (pesca y lo relacionado a la pesca). Además, que las condiciones detectadas se mantienen. Ha sido diligente en la atención del caso y las situaciones formuladas, debido a lo cual, el recurso de amparo, en lo que a esta entidad corresponde, debe ser desestimado y así se solicita.
  3. 7Informa bajo juramento Laura Rivera Quintanilla, en condición de Directora a.i. del Área de Conservación Osa del Sistema Nacional de Áreas de Conservación, e indica que no es cierto que no haya actuado para atender la problemática reclamada. Del informe SINAC-ACOSA-RNFSG-AD-086-2020, se colige lo siguiente:

“…Se georeferenció seis construcciones en la Zona Pública del polígono certificado Patrimonio Natural del Estado, administración SINAC-MINAE.

Una construcción fuera de la Zona Pública, en PNE.

Se georeferenció siete construcciones en la ZP, fuera de PNE, en administración de la Municipalidad de Golfito…” En los casos mencionados en el oficio No. SINAC-ACOSA-RNFSG-AD-086-2020, todas las construcciones menos una se ubican en Zona Pública, por tanto, no es posible tramitar ni otorgar un permiso de uso. En lo que respecta a la construcción que se menciona está en el área restringida, sería necesario determinar si está concesionada y de ser así, a nombre de quién lo está, porque no hay mucha claridad en el informe, para conocer si tendría alguna solicitud de permiso de uso. Es posible certificar que no se ha otorgado ningún permiso de uso en este sector perteneciente a Pavones. Asimismo, de conformidad con la Ley 6043, es al ICT al que le corresponde la supervisión y vigilancia general de la zona marítimo terrestre. Compete a las municipalidades velar directamente por el cumplimiento de las normas de esa ley según establece el artículo 3.

La competencia del SINAC se enfocaría únicamente al área clasificada como patrimonio natural del estado. Tal y como se indica en el oficio No. SINACACOSA-PNE-AD-019-2021, la información que se levantó para la elaboración del informe No. SINACACOSA-RNFSG-AD-086-2020 es poco clara y podría estar desactualizada, por lo que es imprescindible establecer una caracterización de la ocupación con el objetivo de que una vez se no esté vigente la Ley de Protección de ocupantes de zonas clasificadas como Especiales No 9577, la cual fue publicada en el Diario Oficial La Gaceta No 132 Alcance No 133 de 20 de julio de 2018, con una vigencia de 36 meses. También las presentes acciones están ajustadas y orientadas para ser eficientes en el uso del recurso con que cuenta el ACOSA, ya que como lo indica el oficio SINAC-ACOSA-D-059-2021 hay un recorte en las partidas de viáticos por 50% y combustible 62.5%. El Área de Conservación Osa (ACOSA), abordará la problemática de la siguiente manera:

"Objetivos del plan de acción primera etapa:

Elaborar un levantamiento de la ocupación georreferenciado dentro del polígono B3.

Elaborar un análisis técnico legal de la información, que permita establecer la ruta a seguir.

Etapa 1.

Tal y como lo indica el informe de la Licda. Ginette Jiménez Soto, oficio SINAC-ACOSAPNE-AD-019-2021, la información que se levantó para la elaboración del informe SINAC-ACOSARNFSGAD-086-2020, es poco clara y podría estar desactualizada por lo que se procederá a realizar un nuevo levantamiento de la información. En dicho levantamiento se procederá a recoger la siguiente información:

1. Puntos GPS, de ambas esquinas de la construcción u ocupación, cercanas a la zona pública.

2. Perímetros de la construcción y del predio.

3. Materiales de construcción.

4. Valor estimado de la construcción.

5. Datos de los ocupantes.

6. Tipo y tiempo de la ocupación.

7. Si cuentan con permisos de uso de suelo por parte de la municipalidad.

8. Si cuentan con concesión por parte de la municipalidad.

9. Si gestionaron permiso de uso de ante SINAC-ACOSA.

Esta etapa se realizará el realizará los días 13 y 14 de febrero de 2021. Responsable del levantamiento Lic. Joel García Medina.

Etapa 2.

Esta etapa se tabulará la información y se realizará el informe correspondiente por el cual se solicitará el análisis técnico legal a los departamentos de PNE y Legal. A partir de los resultados se establecerá los pasos a seguir por parte de ACOSA. Este informe se entregará a finales del presente mes.

Etapa 3 Elaboración del análisis técnico legal. El objetivo es indicar el estatus de la ocupación. Este informe deberá estar finalizado en la primera quincena del mes de marzo.

Etapa 4 Elaboración del Plan de acción Operativo. El objetivo de este es desalojar la ocupación ilegal del PNE. El plan estará presentado para finales de marzo".

  1. 8En los procedimientos seguidos se han observado las prescripciones legales.

Redacta la Magistrada Sánchez Navarro; y,

CONSIDERANDO:

I. OBJETO DEL RECURSO

El recurrente reprocha que un año después de que denunció ante las dependencias y el ente local recurrido, la existencia de construcciones y ranchos improvisados en Playas Higuito y Pilón, y los consecuentes problemas sanitarios que esto supone, esta no ha sido atendida. Afirma que esa omisión, vulnera sus derechos fundamentales.

II. CUESTIÓN PRELIMINAR

Antes de analizar el fondo del asunto, debe aclararse que, a partir de la Sentencia No. 2008-02545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute, si la administración ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o por leyes sectoriales para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues se está frente a una denuncia, relacionada con el medio ambiente, la cual, presuntamente, no ha sido atendida, ni resuelta dentro de un plazo razonable. Atendiendo a los derechos fundamentales que se invocan, esta Sala valora las posibles dilaciones en la resolución de las denuncias de este tipo. Clarificado el punto, se entra a resolver la situación concreta planteada en este amparo.

III. HECHOS PROBADOS

De relevancia para la decisión del presente amparo se tienen por demostrados los siguientes:

  • 1)El 26 de marzo de 2020, el recurrente denunció ante el Ministerio de Salud la existencia de construcciones y ranchos improvisados en Playas Higuito y Pilón (copia adjunta al informe).
  • 2)Mediante correo electrónico de 14 de abril de 2020, el recurrente reiteró su denuncia ante el Ministro de Salud (copia adjunta al informe).
  • 3)Mediante oficio del Área Rectora de Salud de Golfito, No. MS-DRRSBRU-ARSGO-0294-2020 de 23 de abril de 2020, se trasladó dicha denuncia a la Municipalidad de Golfito (informe rendido bajo juramento).
  • 4)Por oficio de esa Área de Salud, No. MS-DRRSBRU-ARSGO-0295-2020 de 23 de abril de 2020, se comunicó al recurrente que su denuncia había sido trasladada al ente local recurrido (informe rendido bajo juramento).
  • 5)El 9 de junio 2020, se realizó un operativo interinstitucional en los lugares denunciados, en el cual participaron funcionarios de la Municipalidad de Golfito, SINAC y Ministerio de Salud, y aplicó el Instrumento de Verificación de a Denuncias por Aguas Residuales en Urbanizaciones o Residenciales (informe rendido bajo juramento).
  • 6)Por oficio del Área de Conservación Osa, No. SINAC-ACOSA-RNFSG-AD-086-2020 de 10 de junio de 2020, se rindió un informe de esa inspección, el cual concluyó que existían construcciones en la zona pública del polígono certificado Patrimonio Natural del Estado. Además, se georreferenciaron seis construcciones en la Zona Pública del polígono Certificado Patrimonio Natural del Estado (administración SINAC-MINAE), una construcción fuera de la Zona Pública en Patrimonio Natural del Estado y siete construcciones en Zona Pública, fuera del Patrimonio Natural del Estado (informe rendido bajo juramento y copia adjunta al informe).
  • 7)El informe del Área Rectora de Salud recurrida, No. MS-DRRSBRU-URS-IT-140-2020 de 11 de junio de 2020, concluyó que el caserío que se ubica en Playa Pilón incumple las disposiciones en cuanto al manejo de aguas residuales y que utilizan pozos para abastecerse de agua para el consumo humano, los cuales irrespetan el retiro de ley y que corresponde a la Municipalidad de Golfito girar los actos administrativos correspondientes (informe rendido bajo juramento y copia adjunta al informe).
  • 8)Por oficio del Área Rectora de Salud de Golfito, No. MS-DRRSBRU-ARSG-IT-0573-2020 de 22 de junio 2020, se brindó un informe técnico de la visita que se realizó el 9 de junio a Playa Pilón, el cual evidenciaba que la situación denuncia se mantenía, puesto que existían un total de trece estructuras que carecían de sistema de tratamiento de aguas residuales y que, en vista que las estructuras se encuentran dentro de Patrimonio Natural del Estado, corresponde a la Municipalidad de Golfito y SINAC emitir los actos administrativos necesarios a fin de solventar la contaminación que se está presentando (informe rendido bajo juramento y copia adjunta al informe).
  • 9)Por Informe de esa Área Rectora de Salud, No. MS-DRRSBRU-ARSG-IT-0574-2020 de 22 de junio 2020, se informó que en la visita que se realizó el 9 de junio a Playa Higuito, no existían personas acampando en el lugar (informe rendido bajo juramento).
  • 10)Por oficio No. MS-DRRSBRU-ARSGO-0710-2020 de 18 de agosto 2020, se solicitó a la Directora del Refugio de Vida Silvestre Golfito SINAC-ACOSA que elabora una plan de abordaje de la problemática en el cual establezca un cronograma y presupuesto respectivo (informe rendido bajo juramento y copia adjunta al informe).
  • 11)Por oficio MS-DRRSBRU-ARSGO-0711-2020 de 18 de agosto 2020, se solicita al Alcalde de Golfito que realizara un plan de abordaje de la problemática en el cual establezca un cronograma y presupuesto respectivo (informe rendido bajo juramento y copia adjunta al informe).
  • 12)Por oficio del Área Rectora de Salud recurrida, No. MS-DRRSBRU-ARSGO-0712-2020 de 18 de agosto 2020, se informó al recurrente de lo actuado a ese momento (copia adjunta al informe).
  • 13)Por acuerdo tomado por el Concejo de Golfito en la sesión ordinaria No. 12-ORD 32-2020 de 19 de agosto de 2021, se conoció el oficio de esa Área de Salud de Golfito, No. MS-DRRSBRU-ARSGO-0711-2020, y dispuso “trasladarlo a la administración y de las acciones a tomar se rinda un informe a este Concejo” (copia adjunta al informe).
  • 14)Mediante Oficio de la Oficina de Valoraciones y del Departamento de Zona Marítimo Terrestre, ambos de la Municipalidad recurrida, No. MG-OV-INT-043-2020 de 1 de octubre de 2020, se rindió un informe al Alcalde de Golfito, respecto de los hechos denunciados (copia adjunta al informe).
  • 14)Por oficio MS-DRRSBRU-ARSGO-O-1218-2020 de 13 de noviembre de 2020, se requirió un informe a la Directora del Refugio de Vida Silvestre Golfito SINAC-ACOSA, sobre las acciones realizadas, en el entendido de que existía un problema de salud pública y una afectación al ambiente (informe rendido bajo juramento y copia adjunta al informe).
  • 15)Por oficio MS-DRRSBRU-ARSGO-O-1219-2020 de 13 de noviembre de 2020, se solicitó un informe al Alcalde recurrido, sobre las acciones realizadas (informe rendido bajo juramento y copia adjunta al informe).
  • 16)El 11 de diciembre de 2020, el recurrente reiteró su denuncia ante el Ministro de Salud (copia adjunta al informe).
  • 17)Mediante el oficio de la Dirección General de Salud, No. MS-DGS-0046-2021 de 8 de enero de 2021, se trasladó esa gestión del recurrente a la Rectoría de la Dirección Regional Brunca, para lo de su cargo (copia adjunta al informe).
  • 18)Por oficio MS-DRRSBRU-ARSG-0043-2021 de 20 de enero de 2021, se requirió un informe la Alcalde de Golfito y la Directora del Refugio de Vida Silvestre Golfito SINAC-ACOSA, sobre las gestiones realizadas (informe rendido bajo juramento y copia adjunta al informe).
  • 19)Por oficio del Área Rectora de Salud recurrida, No. MS-DRRSBRU-ARSG-0044-2021 de 20 de enero de 2021 se brindó un informe al Ministro de Salud sobre las actuaciones realizadas (informe rendido bajo juramento y copia adjunta al informe).
  • 20)Por oficio No. SINAC-ACOSA-D-033-2021 de 21 de enero de 2021, se rindió el informe solicitado (informe rendido bajo juramento y copia adjunta al informe).
  • 21)Por oficio del Alcalde de Golfito, No. AM-MG-O-0024-2021 de 25 de enero 2021, se informó que el oficio MS-DRRSBRU-ARSGO-0711-2020 había sido remitido al Departamento de Valoraciones y al Departamento de Zona Marítimo Terrestre (informe rendido bajo juramento y copia adjunta al informe).
  • 22)El 26 de enero de 2021 se reiteró a la Directora del Refugio de Vida Silvestre del Área de Conservación de Osa que brindara la información que ha solicitado anteriormente a fin de dar respuesta al denunciante a las autoridades superiores (informe rendido bajo juramento).
  • 23)Mediante el oficio de la Alcaldía, No. AM-MG-0027-2021 de 26 de enero de 2021, se rindió un informe al Concejo de Golfito respecto de los hechos denunciados por el recurrente (copia adjunta al informe).
  • 24)Por oficio MS-DRRSBRU-1503-2021 de 27 de enero de 2021, se informó al denunciante de lo actuado (informe rendido bajo juramento y copia adjunta al informe).
  • 25)Por oficio MS-DRRSBRU-ARSGO-0056-2021 de 28 de enero de 2021, se informó al denunciante las actuaciones realizadas en atención a su denuncia (informe rendido bajo juramento).
  • 26)El 3 de febrero de 2021, el Área Rectora de Salud de Golfito, ordenó que se realizara una inspección en Playa Pilón, para verificar si habían variado las condiciones previamente existentes en ese lugar (informe rendido bajo juramento).
  • 27)El Informe Técnico del Área Rectora de Salud recurrida, No. MS-DRRSBRU-ARSG-IT-0058-2021 de 3 de febrero de 2021, concluyó que las condiciones detectadas en Playa Pilón persistían (informe rendido bajo juramento).
  • 28)Mediante el oficio de la Alcaldía de Golfito, No. AM-MG-O-0050-2021 de 8 de febrero del 2021, se brindó un informe al recurrente de las acciones que se pretenden implementación con ocasión de su denuncia (copia adjunta al informe).
  • 29)El 3 de febrero de 2021, se notificó el auto de curso a la Municipalidad y al Área de Salud recurridas (actas de notificación visibles en el Historial de Acontecimientos del Expediente Electrónico).
  • 30)El 8 de febrero de 2021, se notificó es oficio al recurrente, a través del correo electrónico ...03 (copia adjunta al informe).

IV. HECHOS NO PROBADOS

Se estima no demostrado, el siguiente de relevancia: Único.- Que el Área de Conservación Osa haya brindado respuesta alguna al recurrente, ni que haya dispuesto medida alguna para abordar la denuncia.

V. SOBRE EL DERECHO A UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO

En reiteradas ocasiones, la jurisprudencia de esta Sala ha reconocido que la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos tanto a nivel constitucional como a través de la normativa internacional. Se ha indicado que el ejercicio legítimo de ese derecho requiere que los recursos sean utilizados de manera racional, y que corresponde al Estado la protección del ambiente, según el principio precautorio que rige en materia ambiental. Este principio obliga al Estado a disponer todo lo que sea necesario, dentro del ámbito permitido por la ley, a efectos de impedir que se produzcan daños irreversibles al ambiente, para cuyo efecto es responsable de lograr las condiciones sociales propicias a fin de que cada persona pueda disfrutar de su salud, entendido este derecho como una situación de bienestar físico, psíquico (o mental) y social (véase Sentencia No. 1998-0180 de las 16:24 horas del 13 de enero de 1998).

La obligación objetiva del Estado en materia de protección ambiental no apareja, ineludiblemente, un derecho subjetivo de las personas a exigir, a través de los organismos judiciales, que se tome una medida determinada, pero sí a que se adopten las que sean idóneas en tutela de ese derecho, ante actitudes abiertamente negligentes de las autoridades públicas, o bien, de personas físicas y jurídicas. De este modo, el Estado adquiere la obligación de regular las áreas de la vida social de las cuales puedan surgir peligros para la existencia física de los habitantes de su territorio, así como también aquellas que vulneren el ambiente, lo cual puede hacer a través de leyes, reglamentos, acuerdos u otras medidas relacionadas con la organización y los procedimientos administrativos. En consecuencia, la posibilidad de exigir judicialmente, a través del recurso de amparo, un tipo específico de actividad prestacional por parte del Estado en cumplimiento de su deber de protección a la vida, salud o derecho al ambiente en beneficio de sus habitantes, está restringida a la clara verificación de un peligro inminente contra esos derechos de las personas.

De lo que se desprende que la injerencia de la jurisdicción constitucional solamente es viable ante la inercia comprobada del Estado, a través de sus órganos competentes, en atender las demandas que en ejercicio de sus derechos realicen los habitantes del país.

VI. CASO CONCRETO

En la especie, el recurrente reprocha que un año después de que denunció ante las dependencias y el ente local recurrido, la existencia de construcciones y ranchos improvisados en Playas Higuito y Pilón, y los consecuentes problemas sanitarios que esto supone, esta no ha sido atendida. Afirma que esa omisión, vulnera sus derechos fundamentales.

En lo que respecta al Ministerio de Salud, los autos permiten constatar que, el 26 de marzo de 2020, el recurrente denunció ante el Ministerio de Salud la existencia de construcciones y ranchos improvisados en Playas Higuito y Pilón y que el 14 de abril de ese mismo año, el recurrente reiteró esa denuncia ante el Ministro de Salud. También, se demostró que mediante el oficio de esa Área de Salud, No. MS-DRRSBRU-ARSGO-0295-2020 de 23 de abril de 2020, se comunicó al recurrente que su denuncia había sido trasladada a la Municipalidad de Golfito. Igualmente, se verificó que el 9 de junio 2020, se realizó un operativo interinstitucional en los sitios denunciados, en el cual participaron funcionarios de la Municipalidad de Golfito, SINAC y Ministerio de Salud, el cual aplicó el Instrumento de Verificación de a Denuncias por Aguas Residuales en Urbanizaciones o Residenciales. El informe del Área Rectora de Salud recurrida, No. MS-DRRSBRU-URS-IT-140-2020 de 11 de junio de 2020, arroja que el caserío que se ubica en Playa Pilón presenta problemas en cuanto al manejo de aguas residuales y que utilizan pozos para abastecerse de agua para el consumo humano, los cuales irrespetan el retiro de ley.

Asimismo, se verificó que por oficios del Área Rectora de Salud de Golfito, Nos. MS-DRRSBRU-ARSG-IT-0573-2020 y MS-DRRSBRU-ARSG-IT-0574-2020, ambos de 22 de junio 2020, se brindó un informe técnico de las inspecciones que se realizaron en los sitios denunciados, según las cuales, en Playa Pilón la situación denunciada se mantenía, puesto que existían trece estructuras que carecían de sistema de tratamiento de aguas residuales, en tanto que en Playa Higuito, no existían personas acampando en el lugar. Aunado a lo anterior, consta que el recurrente ha sido informado en distintos momentos de la intervención que el Área Rectora de Salud ordenó a la Municipalidad de Golfito y al Área de Conservación Osa, la elaboración de un plan de abordaje del problema, con su respectivo cronograma y presupuesto, así como que se ha requerido reiteradamente un informe a esas autoridades de lo actuado. Pese a lo anterior, si bien con ocasión de la notificación del auto de curso, el Área Rectora de Salud de Golfito, ordenó la realización de una inspección en Playa Pilón, para verificar si habían variado las condiciones previamente existentes en ese lugar, la cual permite verificar que el problema denunciado persistía en Playa Pilón, no se demostró que el recurrente haya sido informado de ello. Precisamente, por lo anterior, estima este Tribunal que se produjo la omisión reclamada.

En cuanto al ente local recurrido, de los autos se acredita que, en el acuerdo tomado por el Concejo de Golfito en la sesión ordinaria No. 12-ORD 32-2020 de 19 de agosto de 2021, se conoció el oficio del Área de Salud de Golfito, No. MS-DRRSBRU-ARSGO-0711-2020, y dispuso “trasladarlo a la administración y de las acciones a tomar se rinda un informe a este Concejo”. También, se verificó que por Oficio de la Oficina de Valoraciones y del Departamento de Zona Marítimo Terrestre de la Municipalidad recurrida, No. MG-OV-INT-043-2020 de 1 de octubre de 2020, se rindió un informe al Alcalde de Golfito, respecto de los hechos denunciados. Además, se constata que mediante el oficio de la Alcaldía, No. AM-MG-0027-2021 de 26 de enero de 2021, se rindió un informe al Concejo de Golfito respecto de los hechos denunciados por el recurrente. Aunado a lo anterior, si bien con ocasión de la notificación del auto de curso a las autoridades locales recurridas, se brindó y notificó un informe al recurrente de las acciones que se pretenden implementar con ocasión de su denuncia, no consta que el problema denunciado haya sido atendido. Así las cosas, estima la Sala que se produjo la infracción reclamada.

En lo que atañe al Área de Conservación Osa, se demostró que por oficio No. SINAC-ACOSA-RNFSG-AD-086-2020 de 10 de junio de 2020, se rindió un informe de la inspección interinstitucional que se realizó el 9 de ese mismo mes, la cual concluyó que existían construcciones en la zona pública del polígono certificado Patrimonio Natural del Estado. Además, se georreferenciaron seis construcciones en la Zona Pública del polígono Certificado Patrimonio Natural del Estado (administración SINAC-MINAE), una construcción fuera de la Zona Pública en Patrimonio Natural del Estado y siete construcciones en Zona Pública, fuera del Patrimonio Natural del Estado. Por lo anterior, según afirma la Directora a.i. de esa Área de Conservación Osa, es necesario exigir al ICT en nombre del Estado y a la municipalidad recurrida el cumplimiento de la normativa legal y reglamentaria, pues la competencia del SINAC se enfocaría únicamente al área clasificada como Patrimonio Natural del Estado.

Aunado a lo anterior, explica, en vista de que la información que se levantó para la elaboración de ese informe es poco clara y podría estar desactualizada, es imprescindible establecer una caracterización de la ocupación con el objetivo de que una vez se no esté vigente la Ley de Protección de ocupantes de zonas clasificadas como Especiales, 9577. Si bien, se verificó que a esos efectos se dispuso un plan de acción que permita establecer la ruta a seguir, no consta idónea y fehacientemente que al denunciante se le haya informado nada sobre el particular, ni que haya dispuesto medida alguna para resolver el problema. Bajo esta inteligencia, aprecia la Sala se produjo el agravio reclamado.

VII. NOTA DEL MAGISTRADO RUEDA LEAL

Debo advertir que desde la sentencia n.° 2019-2355 de las 9:30 de 12 de febrero de 2019, mi postura ha sido la siguiente en relación con los recursos de amparo cuando estos han sido planteados a favor de una persona jurídica:

“…en la Opinión Consultiva 22-16 del 26 de febrero de 2016, la Corte Interamericana de Derechos Humanos indicó que si bien algunos Estados reconocen el derecho de petición a personas jurídicas con condiciones especiales, como lo son los sindicatos, partidos políticos o representantes de pueblos indígenas, comunidades afrodescendientes o grupos específicos, lo cierto es que “El artículo 1.2 de la Convención Americana sólo consagra derechos a favor de personas físicas, por lo que las personas jurídicas no son titulares de los derechos consagrados en dicho tratado”. Por otro lado, en la misma opinión consultiva, la Corte Interamericana dispuso que, en ciertos contextos particulares, las personas físicas pueden llegar a ejercer sus derechos a través de personas jurídicas (verbigracia, a través de un medio de comunicación, como acaeció en el caso Nombre02 y otros contra Venezuela); empero, a efectos de que ello sea tutelable ante el sistema interamericano, “el ejercicio del derecho a través de una persona jurídica debe involucrar una relación esencial y directa entre la persona natural que requiere protección por parte del sistema interamericano y la persona jurídica a través de la cual se produjo la violación, por cuanto no es suficiente con un simple vínculo entre ambas personas para concluir que efectivamente se están protegiendo los derechos de personas físicas y no de las personas jurídicas.

En efecto, se debe probar más allá de la simple participación de la persona natural en las actividades propias de la persona jurídica, de forma que dicha participación se relacione de manera sustancial con los derechos alegados como vulnerados.” (énfasis agregado) (OC. 22/16)”.

Ahora, si bien el recurso de marras está planteado a favor de una persona jurídica, no menos cierto es que en el sub iudice se acusa la falta de atención de una denuncia ambiental interpuesta ante las autoridades accionadas, mediante la cual se alegó la existencia de construcciones y ranchos improvisados en Playas Higuito y Pilón. Visto lo anterior, conviene señalar que este Tribunal ha validado la legitimación vicaria en materia ambiental, tal como se aprecia en la sentencia n.° 2018-018870 de las 9:40 horas del 13 de noviembre de 2018: “(…) tratándose de materia ambiental, como la que es objeto en este recurso, la Sala sí ha aceptado la legitimación vicaria, de conformidad con lo dispuesto en el ordinal 105 de la Ley de Biodiversidad, que reconoce una acción popular al señalar: “Toda persona está legitimada en sede administrativa o jurisdiccional, en defensa y protección de la biodiversidad” (ver sentencias No. 2018-1185 y 2018-1794). Por consiguiente, se admite la gestión y se procede a conocer por el fondo lo reclamado”. En mérito de lo anterior, dado que se está frente a un supuesto de legitimación vicaria, considero pertinente conocer el recurso planteado a favor de la persona jurídica amparada.

VIII. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusa la presunta contaminación, producida por construcciones y ranchos improvisados en Playas Higuito y Pilón, lo cual fue denunciado ante la Municipalidad de Golfito, y el Ministerio de Salud, sin que la problemática sea resuelta de forma definitiva, provocando afectación de un ambiente sano y ecológicamente equilibrado.

IX. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara con lugar el recurso. Se ordena a Daniel Salas Peraza, a Fernando Mata Castro, a Freiner Lara Blanco, a Gustavo Mayorga Mayorga y a Laura Rivera Quintanilla, respectivamente, en condición de Ministro de Salud y de Director del Área Rectora de Salud de Golfito, de Alcalde y de Presidente del Concejo, ambos de Golfito, y de Directora a.i. del Área de Conservación Osa, o a quienes ejerzan esos cargos, que dispongan y coordinen lo necesario a efecto que en el plazo de TRES MESES, contado a partir de la notificación de esta sentencia, resuelva en definitiva la denuncia del recurrente. Se advierte a los recurridos que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y a la Municipalidad de Golfito, al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
