CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at ten hours five minutes on the fifth of March two thousand twenty-one.

Noncompliance proceeding for the Amparo petition processed under case file number 20-007892-0007-CO, filed by JOHANNY PORRAS RAMOS, identity card 0302230643, against the MUNICIPALITY OF TURRIALBA AND THE MINISTRY OF HEALTH.

Whereas:

1.- By filing presented before this Constitutional Jurisdiction on February 18, 2021, the petitioner alleges that the respondent authority has not complied with the order issued in the judgment rendered in this proceeding.

2.- By order of 21:22 hrs. on February 19, 2021, the respondent authorities were granted a hearing so that they could pronounce themselves on the possible noncompliance with what was resolved in judgment 2020-015125 of 09:15 hrs. on August 14, 2020, in which it was ordered: "It is ordered that Giselle Solano Fernández and Mariela Esther Díaz Ríos, as well as Luis Fernando León Alvarado and Arturo Francisco Rodríguez Morales, respectively, in their capacity as Director of the Área Rectora de Salud de Turrialba, Regional Director of Rectoría de la Salud Central Este, Mayor and President of the Municipal Council (Concejo), both of Turrialba, or whoever holds those positions, arrange and coordinate whatever is necessary so that it is immediately verified whether the alleged environmental and construction problems exist, which must be completed within a period of one month starting from the notification of this judgment. Once that period has elapsed, they must immediately order the initiation of the respective procedures for the purpose of bringing the situation of those constructions into conformity with the law. To that end, they must coordinate all necessary actions so that the Ministry of the Presidency (Ministerio de la Presidencia), Ministry of Public Security (Ministerio de Seguridad Pública), Ministry of Housing and Human Settlements (Ministerio de Vivienda y Asentamientos Humanos), Ministry of National Planning and Economic Policy (Ministerio de Planificación Nacional y Política Económica), Institute of Agrarian Development (Instituto de Desarrollo Agrario), and Joint Institute of Social Assistance (Instituto Mixto de Ayuda Social) are integrated, in the event that the eviction of the Lomas del Río squatter settlement (precario Lomas del Río) must be carried out." 4.- By filing presented on February 25, 2021, GISELLE SOLANO FERNÁNDEZ, in her capacity as Director of the Área Rectora de Salud Turrialba, reports under oath, and states that: “(...) the Directorate of the Área Rectora de Salud Turrialba, through official letter MS-DRRSCE-DARST-1122- 2020 sent on November 13, 2020 by email to the address [email protected], reported the following:

- On Thursday, August 20, 2020, Official Letter MS-DRRSCE-DARST-0775-2020 (copy attached) was sent by email to the Municipal Council (Concejo Municipal) of Turrialba, with a copy to the Constitutional Chamber, in which the undersigned requested the Municipal Council (Concejo Municipal) of Turrialba for immediate coordination and to visit the site with the objective of carrying out a diagnosis of the environmental situation and the constructions at the reported location. The response from the Municipal Council (Concejo Municipal) is awaited, with the deadline stipulated in accordance with Article 32 of the Law of Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional).

- On September 11, 2020, a copy of Official Letter Nº SM-897-2020 was received at the Área Rectora de Salud Turrialba, showing that the Municipal Council (Concejo Municipal) of Turrialba analyzed Official Letter MS-DRRSCE-DARST-0775-2020 and agreed to forward it to Mr. Carlos Calvo Sánchez, Legal Advisor to the Council (Concejo), to Mayor Master Luis Femando León A/varado, to Engineer Gerardo Sequeria Pereira of the Urban Development Department (Departamento de Desarrollo Urbano), and to the Municipal Environmental Commission (Comisión Municipal de Ambiente) of the Municipality of Turrialba, so that within ten business days they provide a report to the Council (Concejo) on what is appropriate in the case in question.

- On October 7, 2020, Official Letter MT-DA-LFLA438-2020 (5920) was received via email, in which the Deputy Mayor of the Municipality of Turrialba requested a hearing with the undersigned to discuss the referenced matter. The undersigned responded on October 9, 2020 through Official Letter MS-DRRSCE-DARST-0978-2020, summoning her to a meeting at the Casa de la Cultura on Thursday, October 22, 2020.

- On October 6, 2020, Official Letter SM-979-2020 was received via email from the Municipal Council (Concejo Municipal) of Turrialba, in which they inform the Directorate of the Área Rectora de Salud Turrialba, Engineer Gerardo Sequeira Pereira of the Urban Development Department (Departamento de Desarrollo Urbano), and the Census and Cadastre Department (Departamento de Censo y Catastro)—the latter two from the Municipality of Turrialba—that they approve the report submitted by Mr. Carlos Calvo Sánchez, Legal Advisor to the Council (Concejo), which indicates that the Municipal Council (Concejo Municipal) finds it difficult to carry out the task of analyzing the environmental or construction problems at the Lomas del Río site because it lacks the technical, environmental, and construction knowledge to resolve what was requested. Therefore, the support of the technical staff that the Administration possesses is essential, just as this matter has always been handled, which is even already known by the Special Commission (Comisión Especial).

Likewise, Mr. Carlos Calvo Sánchez, Legal Advisor to the Council (Concejo), indicates that he recommends the Municipal Council (Concejo Municipal) coordinate with the Municipal Mayor's Office, Ministry of Health, and other related public institutions to analyze and provide a definitive solution to the purpose of the petition, and that it is important to know the report from Engineer Gerardo Sequeira Pereira and that of the Census and Cadastre Department (Departamento de Censo y Catastro) so that, once they are known, a meeting with all the institutions involved can be convened.

- After learning of the report from the Municipal Council (Concejo Municipal), the Directorate of the Área Rectora de Salud Turrialba initiated the convening of the institutions involved in the matter.

- On October 9, 2020, via email, the undersigned sent Official Letter MS-DRRSCE-DARST-0975-2020 to Captain Manuel Chinchilla Chaves, Chief of the Public Force (Fuerza Pública) of Turria/ba, explaining the situation and convening a meeting on Thursday, October 22, 2020, to establish a site intervention strategy.

- On October 9, 2020, via email, the undersigned sent Official Letter MS-DRRSCE-DARST-0976-2020 to Ms. Catherine Aguilar Fonseca, Representative of the Offices of the Joint Institute of Social Assistance (IMAS) in Turria/ba, explaining the situation in question and convening her to a meeting on Thursday, October 22, 2020, to establish an intervention strategy on the matter.

- On October 9, 2020, via email, the undersigned sent Official Letter MS-DRRSCE-DARST-0977-2020 to Mr. Fernando Mata, Chief of the Ministry of Environment and Energy of Costa Rica (MINAE), explaining the problem and convening him to a meeting on Thursday, October 22, 2020, to establish an intervention strategy in the case.

- On October 9, 2020, via email, the undersigned sent Official Letter MS-DRRSCE-DARST-0979-2020 to Ms. Milagro Rowe Arias, Deputy Mayor of the Municipality of Turrialba, requesting approval to use the Casa de la Cultura for the purpose of holding the meeting scheduled for October 22, 2020, in that space, where the case of Lomas del Río in the Barrio San Rafael of Turrialba would be addressed and in which several institutions would participate.

- On October 22, 2020, the scheduled meeting was held, with participation from Representatives of the Area Rectora de Salud Turrialba, Ministry of Environment and Energy, Joint Institute of Social Assistance (IMAS), and the Municipality of Turrialba. Background, actions to be taken, and responsible parties were discussed, and action timelines were established. (Meeting minutes attached) Likewise, in accordance with the attached minutes, the following was agreed:

• 1)A census already exists, conducted by the Costa Rican Institute of Electricity (Instituto Costarricense de Electricidad), so the Costa Rican Social Security Fund, Area de Salud Turria/ba Jiménez (Caja Costarricense de Seguro Social), will be requested to help update the census through the Primary Care Assistants (Asistentes de Atención Primaria, ATAPS) to obtain the current number of people.
• 2)Following point one, the Joint Institute of Social Assistance (IMAS) headquarters in Turrialba will verify the situation of each family and analyze whether they are candidates for socioeconomic assistance from said institution.
• 3)As soon as the information from the two previous points is available, the Municipality of Turrialba will proceed with the notification of evictions for being on municipal property.
• 4)The Ministry of Environment and Energy will conduct inspections of each family's properties to determine whether the constructions are located within protection zones of the Turrialba River (Río Turrialba).
• 5)In the event that the families must vacate the properties, coordination will be established with the Public Force (Fuerza Pública) of Turrialba, the Fire Department, and the Red Cross of Turrialba so that they are present during the eviction for any eventuality.

- On October 23, 2020, an email was received from Ms. Milagro Rowe Arias, Deputy Mayor of the Municipality of Turrialba, communicating to the institutions involved in the matter that, following the meeting on Thursday, October 22, 2020, the following progress is presented:

• a)The inspection by the National System of Conservation Areas (SINAC) is awaited.
• b)With the attached, updated list from the Área de Salud, it can be determined that there are minors.
• c)Official Letter MT-DA-LFLA-515-2020 (221020) was sent to the Costa Rican Institute of Electricity (ICE) and a response is awaited.
• d)The Deputy Mayor met with the Council's lawyer, and together with the lawyer from the Municipality of Turrialba, they will send the information on progress as of October 23, 2020, to the Constitutional Chamber.

- On October 27, 2020, the undersigned sent Official Letter MS-DRRSCE-DARST- 1049-2020 to the Constitutional Chamber, informing it of the actions taken by this Área Rectora de Salud Turrialba in response to the problem presented.

- On Wednesday, October 28, 2020, a copy of report SINAC-ACC-OT-1473-2020 was received by email, signed by Engineer Sergio Obando Torres of the Prevention, Control, and Protection Office (Oficina de Prevención, Control y Protección) headquartered in Turrialba, stating that, according to the analysis, it is evident that the tenement is located outside the conservation area of the Turrialba River (Río Turrialba); however, for the purposes of mapping the site, for competent purposes, they proceeded at the site to establish the right bank, downstream, of the Turrialba River (Río Turrialba) to align the protection area. He points out that due to the characteristics of the Turrialba River (Río Turrialba), defining the bank is complicated, applying as a criterion what is established in Article 69 of Law of Waters 276 (Ley de Aguas 276), which defines the riverbed as the ground covered by its waters during the highest ordinary floods.

Third: The Directorate of the Área Rectora de Salud Turrialba, through Official Letter MS-DRRSCE-DARST-1127-2020, requested Dr. Heylin Quesada A/varado, Director of the Área de Salud Turrialba, to provide updated information on the number of families living in the Lomas del Río area in San Rafael de Turrialba.

Fourth: The report from the Costa Rican Institute of Electricity (Instituto Costarricense de Electricidad) and the Área de Salud Turrialba Jiménez is awaited to define the actions to be taken in the referenced case.

After Official Letter MS-DRRSCE-DARST-1122-2020 was sent to the Constitutional Chamber; on Friday, November 13, 2020, the Directorate of the Área Rectora de Salud Turrialba received, via email, information from Dr. Zoila Rojas Guevara, Acting Head of Nursing of the Área de Salud Turrialba Jiménez, regarding family groups, whether they rent rooms, and which ones live in precarious conditions.

On November 17, 2020, Official Letter 1500-190-2020 was received, signed by Mr. Jefry Rafael Alvarado Salas, Regional Director, Distribution and Commercialization Business of the Huetar Caribe Regional Directorate of the Costa Rican Institute of Electricity (Instituto Costarricense de Electricidad), indicating the list of services with the respective meter numbers and locations situated in Lomas del Río, San Rafael de Turrialba.

On November 25, 2020, Resolution Nº 2020022620 of nine hours thirty minutes on November twenty-four, two thousand twenty was received, which states: "It is reiterated to GISELLE SOLANO FERNÁNDEZ, in her capacity as Director of the Área Rectora de Salud Turria/ba, as well as to ARTURO FRANCISCO RODRÍGUEZ MORALES, in his capacity as President of the Municipal Council (Concejo), and to LUIS FERNANDO LEÓN ALVARADO, in his capacity as Mayor, the IMMEDIATE compliance with judgment Nº 2020-015125 of 09:15 hrs. On August 14, 2020, under the warning of certifying excerpts to the Public Ministry (Ministerio Público) in accordance with the provisions of Article 71 of the Law of Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional)." On Monday, February 22, 2021, Official Letter MT-DA-LFLA-131-2021 (160221) was received, in which Ms. Milagro Row Arias, Deputy Mayor of the Municipality of Turrialba, convenes a meeting on March 3, 2021, at 10:00 am at the Casa de la Cultura de Turrialba, to continue coordinating the necessary actions and unifying efforts in the referenced case.

On Monday, February 22, 2021, the Área Rectora de Salud Turrialba received the Amparo Petition, Case File Nº 20-007892-0007-CO, filed by Johanny Porras Ramos, against the Mayor of the Municipality of Turrialba, which states that "... a hearing is granted for THREE DAYS, counted from the notification of this resolution, to Giselle Solano Fernández and Mariela Esther Díaz Ríos, as well as to Luis Femando León Alvarado and Arturo Francisco Rodríguez Morales, respectively, in their capacity as Director of the Área Rectora de Salud Turrialba, Regional Director of Rectoría de la Salud Central Este, Mayor, and President of the Municipal Council (Concejo), both of Turrialba, or whoever holds those positions, so that they may address and provide the corresponding evidence regarding the acts and omissions attributed to them.". It requests that the proceeding be dismissed.

5.- According to the record added to the case file, between February 22 and 28, 2021, the Regional Director of Rectoría de la Salud Central Este, the Mayor, and the President of the Municipal Council (Concejo), the latter two from Turrialba, did not submit any filing or document in order to render the report requested in the resolution issued at twenty-one hours twenty-two minutes on February nineteen, two thousand twenty-one, in case file number 20-007892-0007-CO.

6.- In the processing of this case, the legal requirements have been observed.

Considering:

I.- In the present matter, the petitioner alleges that the respondent authority has not complied with the order issued in the judgment rendered in this proceeding. Therefore, by order of 21:22 hrs. on February 19, 2021, the respondent authorities were granted a hearing so that they could pronounce themselves on the possible noncompliance with what was resolved in judgment 2020-015125 of 09:15 hrs. on August 14, 2020, in which it was ordered: "It is ordered that Giselle Solano Fernández and Mariela Esther Díaz Ríos, as well as Luis Fernando León Alvarado and Arturo Francisco Rodríguez Morales, respectively, in their capacity as Director of the Área Rectora de Salud de Turrialba, Regional Director of Rectoría de la Salud Central Este, Mayor and President of the Municipal Council (Concejo), both of Turrialba, or whoever holds those positions, arrange and coordinate whatever is necessary so that it is immediately verified whether the alleged environmental and construction problems exist, which must be completed within a period of one month starting from the notification of this judgment. Once that period has elapsed, they must immediately order the initiation of the respective procedures for the purpose of bringing the situation of those constructions into conformity with the law. To that end, they must coordinate all necessary actions so that the Ministry of the Presidency (Ministerio de la Presidencia), Ministry of Public Security (Ministerio de Seguridad Pública), Ministry of Housing and Human Settlements (Ministerio de Vivienda y Asentamientos Humanos), Ministry of National Planning and Economic Policy (Ministerio de Planificación Nacional y Política Económica), Institute of Agrarian Development (Instituto de Desarrollo Agrario), and Joint Institute of Social Assistance (Instituto Mixto de Ayuda Social) are integrated, in the event that the eviction of the Lomas del Río squatter settlement (precario Lomas del Río) must be carried out." In this regard, from what was reported by the respondent authorities of the Área Rectora de Salud de Turrialba in relation to the alleged noncompliance, it is observed that they have been carrying out actions aimed at complying with what was ordered in the judgment. However, it is also proven that several of these actions were carried out outside the period granted and that compliance with what was ordered in the indicated judgment has not yet been completed. Likewise, according to the record added to the case file, it was proven that the respondent authorities of the Municipality of Turrialba did not respond to the hearing granted by this Constitutional Tribunal. Therefore, in accordance with the provisions of Article 45 of the Law of Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional), the facts alleged by the petitioner are taken as true. By reason of the foregoing, it is appropriate to reiterate the order, so that the respondents proceed with effective compliance with judgment N° 2020-015125 of 09:15 hrs. on August 14, 2020. GISELLE SOLANO FERNÁNDEZ, in her capacity as Director of the Área Rectora de Salud Turrialba, as well as ARTURO FRANCISCO RODRÍGUEZ MORALES, in his capacity as President of the Municipal Council (Concejo), and LUIS FERNANDO LEÓN ALVARADO, in his capacity as Mayor, the latter two of the Municipality of the Canton of Turrialba, or whoever holds those positions, are warned that if they fail to comply with what is ordered in this judgment, the certification of excerpts to the Public Ministry (Ministerio Público) will be ordered, in accordance with the provisions of Article 71 of the Law of Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional).

II.- DOCUMENTATION PROVIDED TO THE CASE FILE. The parties are advised that, if any paper documents, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic device, or one produced by new technologies, have been provided, these must be withdrawn from the office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, any material not withdrawn within this period will be destroyed, in accordance with the "Regulation on Electronic Case Files before the Judicial Branch (Reglamento sobre Expediente Electrónico ante el Poder Judicial)", approved by the Full Court (Corte Plena) in session N° 27-11 of August 22, 2011, Article XXVI and published in the Judicial Bulletin number 19 of January 26, 2012, as well as in the agreement approved by the Superior Council of the Judicial Branch (Consejo Superior del Poder Judicial), in session N° 43-12 held on May 3, 2012, Article LXXXI.

It is reiterated to GISELLE SOLANO FERNÁNDEZ, in her capacity as Director of the Área Rectora de Salud Turrialba, as well as to ARTURO FRANCISCO RODRÍGUEZ MORALES, in his capacity as President of the Municipal Council (Concejo) and to LUIS FERNANDO LEÓN ALVARADO, in his capacity as Mayor, the latter two of the Municipality of the Canton of Turrialba, or whoever holds those positions, the IMMEDIATE compliance with judgment N° 2020-015125 of 09:15 hrs. on August 14, 2020, under the warning of certifying excerpts to the Public Ministry (Ministerio Público) in accordance with the provisions of Article 71 of the Law of Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional). Sala Constitucional Analizado por: SALA CONSTITUCIONAL  Res. Nº 2021004475 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las diez horas cinco minutos del cinco de marzo de dos mil veintiuno .

Gestión de incumplimiento del Recurso de amparo que se tramita en expediente número 20-007892-0007-CO, interpuesto por JOHANNY PORRAS RAMOS, cédula de identidad 0302230643, contra la MUNICIPALIDAD DE TURRIALBA Y EL MINISTERIO DE SALUD.

Resultando:

1.- Mediante escrito presentado ante esta Jurisdicción Constitucional el 18 de febrero de 2021, el recurrente acusa que la autoridad accionada no ha cumplido con lo ordenado en sentencia dictada en este proceso.

2.- Mediante auto de las 21:22 hrs. del 19 de febrero de 2021 se dio audiencia a las autoridades accionadas para que se pronunciaran sobre el posible incumplimiento de lo resuelto en la sentencia 2020-015125 de las 09:15 hrs. del 14 de agosto de 2020, en la que se dispuso: "Se ordena a Giselle Solano Fernández y a Mariela Esther Díaz Ríos, así como a Luis Fernando León Alvarado y a Arturo Francisco Rodríguez Morales, respectivamente, en condición de directora del Área Rectora de Salud de Turrialba, de directora Regional de Rectoría de la Salud Central Este, de alcalde y de presidente del Concejo, ambos de Turrialba o a quienes ocupe esos cargo, que dispongan y coordinen lo necesario a efecto que de inmediato se verifique si existen los problemas ambientales y constructivos reclamados, lo cual deberá ser finalizado en el plazo de un mes contado a partir de la notificación de esta sentencia. Cumplido dicho plazo, deberán ordenar, de inmediato, el inicio de los procedimientos respectivos, con el objeto de ajustar a derecho la situación de esas construcciones. A ese efecto, deberán coordinar todas las acciones necesarias a efecto que se integren el Ministerio de la Presidencia, Ministerio de Seguridad Pública, Ministerio de Vivienda y Asentamientos Humanos, Ministerio de Planificación Nacional y Política Económica, Instituto de Desarrollo Agrario e Instituto Mixto de Ayuda Social, en el supuesto que deba realizarse el desalojo del precario Lomas del Río".

4.- Por escrito presentado el 25 de febrero de 2021, informa bajo juramento GISELLE SOLANO FERNÁNDEZ, en su condición de Directora del Área Rectora de Salud Turrialba, y señala que: “(...) la Dirección del Área Rectora de Salud Turrialba a través del oficio MS-DRRSCE-DARST-1122- 2020 enviado el 13 de noviembre de 2020 por correo electrónico a la dirección [email protected] informó lo siguiente:

- El jueves 20 de agosto de 2020 se envía por correo electrónico al Concejo Municipal de Turrialba con copia a la Sala Constitucional el Oficio MS-DRRSCE-DARST-0775-2020 (copia adjunta) en donde la suscrita le solicita al Concejo Municipal de Turrialba la coordinación inmediata y visitar el lugar con el objetivo de realizar un diagnóstico de la situación ambiental y las construcciones del lugar denunciado. Se espera la respuesta del Concejo Municipal dejando como el plazo estipulado de acuerdo con el artículo 32 de la Ley de la Jurisdicción Constitucional.

- El 11 de setiembre de 2020 ingresa al Área Rectora de Salud Turrialba copia del Oficio Nº SM-897-2020 en donde se demuestra que el Concejo Municipal de Turrialba analiza el oficio MS-DRRSCE-DARST-0775-2020 y acuerda trasladarlo al Lic. Carlos Calvo Sánchez Asesor Legal del Concejo, al señor Alcalde Master Luis Femando León A/varado, al lng. Gerardo Sequeria Pereira del Departamento de Desarrollo Urbano y a la Comisión Municipal de Ambiente de Municipalidad de Turrialba, para que un plazo de diez días hábiles brinden un informe al Concejo de lo que procede en el caso en cuestión.

- El 07 de octubre de 2020 se recibe a través del correo electrónico el oficio MT-DA-LFLA438-2020 (5920) en donde la Vicealcaldesa de la Municipalidad de Turrialba solicita audiencia a la suscrita para conversar sobre el tema citado. La suscrita le contesta el 09 de octubre de 2020 a través del oficio MS-DRRSCE-DARST-0978-2020 que se le convoca a reunión en la Casa de la Cultura el jueves 22 de octubre de 2020.

- El 06 de octubre de 2020 se recibe a través del correo electrónico el Oficio SM-979-2020 del Concejo Municipal de Turrialba en donde informan a la Dirección del Área Rectora de Salud Turrialba, al lng. Gerardo Sequeira Pereira del Departamento de Desarrollo Urbano y al Departamento de Censo y Catastro los dos últimos de la Municipalidad de Turrialba que aprueban el informe presentado por el Lic. Carlos Calvo Sánchez Asesor Legal del Concejo en donde indica que al Concejo Municipal se Je dificulta realizar la labor de analizar los problemas ambienta/es o constructivos en el lugar Lomas del Río en virtud de que no cuentan con los conocimientos técnicos, ambientales ni constructivos, para solventar lo solicitado. Por lo tanto, es fundamental el apoyo de los técnicos que posee la Administración, tal y como siempre se ha manejado dicho asunto, que incluso ya es conocido por la Comisión Especial.

Asimismo, indica el Lic. Carlos Calvo Sánchez Asesor Legal de Concejo que recomienda al Concejo Municipal coordinar con la Alcaldía Municipal, Ministerio de Salud y demás instituciones públicas relacionadas, analizar y dar solución definitiva al objeto del recurso y que es importante conocer el informe del lng. Gerardo Sequeira Pereira y el del Departamento de Censo y Catastro para que una vez conocidos convocar a una reunión con todas las instituciones involucradas.

- Después de conocido el informe del Concejo Municipal, la Dirección del Área Rectora de Salud Turrialba, inicia con la convocatoria a las instituciones involucradas en el asunto.

- El 09 de octubre de 2020 a través de correo electrónico, la suscrita envía el oficio MS-DRRSCE-DARST-0975-2020, al Capitán Manuel Chinchilla Chaves Jefe de la Fuerza Pública de Turria/ba en donde le explica la situación y convoca a una reunión el jueves 22 de octubre de 2020 para tomar una estrategia de intervención en el sitio.

- El 09 de octubre de 2020 a través de correo electrónico, la suscrita envía el oficio MS-DRRSCE-DARST-0976-2020 a la Licda. Catherine Aguilar Fonseca Representante de las Oficinas del Instituto Mixto de Ayuda Social /MAS en Turria/ba en donde le explica la situación en cuestión y le convoca a reunión el jueves 22 de octubre de 2020 para tomar una estrategia de intervención en el asunto.

- El 09 de octubre de 2020 a través de correo electrónico, la suscrita envía el oficio MS-DRRSCE-DARST-0977-2020 al señor Fernando Mata Jefe del Ministerio de Ambiente y Energía de Costa Rica (MINAE) en donde le explica la problemática y le convoca a reunión el jueves 22 de octubre de 2020 para tomar una estrategia de intervención en el caso.

- El 09 de octubre de 2020 a través de correo electrónico, la suscrita envía el oficio MS-DRRSCE-DARST-0979-2020 a la Licda. Milagro Rowe Arias Vicealcaldesa de la Municipalidad de Turrialba en donde le solicita la aprobación para utilizar la Casa de la Cultura, con el objetivo de efectuar en ese espacio la reunión programada para el 22 de octubre de 2020 en donde se tratara el caso de Lomas del Río en el Barrio San Rafael de Turrialba y en la cual participaran varias instituciones.

- El 22 de octubre de 2020 se realiza la reunión programada, participan Representantes del Area Rectora de Salud Turrialba, Ministerio de Ambiente y Energía, Instituto Mixto de Ayuda Social (/MAS) y de la Municipalidad de Turrialba. Se conversa sobre los antecedentes, acciones a tomar y responsables y se establecen los tiempos de acción. (Acta de reunión adjunta) Asimismo, de acuerdo con el acta adjunta se acuerda lo siguiente:

• 1)Ya existe un censo realizado por el Instituto Costarricense de Electricidad, por lo que se le solicitará a la Caja Costarricense de Seguro Social Area de Salud Turria/ba Jiménez que a través de los Asistentes de Atención Primaria (ATAPS) ayuden a actualizar el censo para tener la cantidad actual de personas.
• 2)Posterior al punto uno, el Instituto Mixto de Ayuda Social sede en Turrialba (/MAS) verificará la situación de cada familia y analizar si son candidatas para ayuda socioeconómica por parte de dicha institución.
• 3)En cuanto se tenga la información de los dos puntos anteriores, la Municipalidad de Turrialba procederá con la notificación de desalojos por estar en propiedad municipal.
• 4)El Ministerio de Ambiente y Energía realizará inspecciones a las propiedades de cada familia para determinar si las construcciones se encuentran en zonas de protección del Río Turrialba.
• 5)En caso de que las familias deban desalojar las propiedades, se coordinará con la Fuerza Pública de Turrialba, Bombero y Cruz Roja de Turrialba para que estén presentes durante el desalojo por cualquier eventualidad.

- El 23 de octubre de 2020 se recibe correo electrónico de la Licda. Milagro Rowe Arias Vicealca/desa de la Municipalidad de Turrialba en donde comunica a las instituciones involucradas en el asunto que después de la reunión del jueves 22 de octubre de 2020 se presentan los avances:

• a)Se está a la espera de la inspección por parte del Sistema Nacional de Áreas de Conservación (S/NAC).
• b)Con la lista adjunta y actualizada del Área de Salud se puede determinar que hay menores de edad.
• c)Se envió el oficio MT-DA-LFLA-515-2020 (221020) al Instituto Costarricense de Electricidad (ICE) y se está a la espera de respuesta.
• d)La Vicealcaldesa se reúne con el abogad del Concejo y en conjunto con la abogada de la Municipalidad de Turrialba enviaran los avances al día 23 de octubre de 2020 la información a la Sala Constitucional.

- El 27 de octubre de 2020 la suscrita envía el oficio MS-DRRSCE-DARST- 1049-2020 a la Sala Constitucional en donde Je informa lo actuado por esta Área Rectora de Salud Turrialba en atención a la problemática presentada.

- El miércoles 28 de octubre de 2020 se recibe por correo electrónico copia del informe SINAC-ACC-OT-1473-2020 suscrito por el lng. Sergio Obando Torres de la Oficina de Prevención, Control y Protección sede en Turrialba en donde indica que de acuerdo a Jo analizado es evidente que la cuartería se ubica fuera del área de conservación del Río Turrialba, sin embargo, para efectos de mapear el sitio, para fines competentes, procedieron en el lugar a establecer la rivera derecha, aguas abajo, del Río Turrialba para realizar el alineamiento del área de protección, Señala que por las características del Río Turrialba, definir la rivera es complicado, aplicando como criterio lo establecido en el artículo 69 de la Ley de Aguas 276, que define el cauce del río, como el terreno que cubren sus aguas en las mayores crecidas ordinarias.

Tercero: La Dirección del Área Rectora de Salud Turrialba a través del oficio MS-DRRSCE-DARST-1127-2020 Je solicita a la Dra. Heylin Quesada A/varado Directora del Área de Salud Turrialba brindar información actualizada de la cantidad de familias que viven en el Jugar Lomas del Río en San Rafael de Turrialba.

Cuarto: Se está a la espera del informe por parte del Instituto Costarricense de Electricidad y del Área de Salud Turrialba Jiménez para definir las acciones a seguir en el caso citado.

Después de enviado el oficio MS-DRRSCE-DARST-1122-2020 a la Sala Constitucional; la Dirección del Área Rectora de Salud Turrialba recibe el viernes 13 de noviembre de 2020 vía correo electrónico información por parte de la Dra. Zoila Rojas Guevara Jefatura Enfermería a.i. del Área de Salud Turrialba Jiménez referente a los grupos familiares y si alquilan cuarto y cuales viven en condiciones precarias.

El 17 de noviembre de 2020 se recibe el oficio 1500-190-2020 suscrito por el señor Jefry Rafael Alvarado Salas Director Regional, Negocio Distribución y Comercialización de la Dirección Regional Huetar Caribe del Instituto Costarricense de Electricidad, en donde se indica la lista de servicios con el respectivo número de medidos y localización ubicados en Lomas del Río San Rafael de Turrialba.

El 25 de noviembre de 2020 se recibe la Resolución Nº 2020022620 de las nueve horas treinta minutos del veinticuatro de noviembre de dos mil veinte que indica "Se reitera a GISELLE SOLANO FERNÁNDEZ, en su condición de Directora del Área Rectora de Salud Turria/ba, así como, a ARTURO FRANCISCO RODRIGUEZ MORALES, en condición de Presidente del Concejo y a LUIS FERNANDO LEON AL VARADO, en condición de Alcalde, el cumplimiento INMEDIATO de la sentencia Nº 2020-015125 de las 09:15 hrs. Del 14 de agosto de 2020, bajo la advertencia de testimoniar piezas al Ministerio Publico conforme lo dispuesto en el artículo 71 de la Ley de la Jurisdicción Constitucional".

El lunes 22 de febrero de 2021 se recibe el oficio MT-DA-LFLA-131-2021 (160221) en donde la Licda. Milagro Row Arias Vicealcaldesa de la Municipalidad de Turrialba convoca a reunión el 03 de marzo de 2021 a las 10:00 am en la Casa de la Cultura de Turrialba para continuar con la coordinación de las acciones necesarias y la unificación de esfuerzos, en caso de referencia.

El lunes 22 de febrero de 2021el Área Rectora de Salud Turrialba recibe el Recurso de Amparo, Expediente Nº 20-007892-0007-CO, Recurrido Johanny Porras Ramos, Recurrido Alcalde de la Municipalidad de Turrialba en donde se indica que ... se confiere audiencia por TRES O/AS contando a partir de la notificación de esta resolución, a Giselle Solano Femandez y a Mariela Esther Diaz Ríos, así como a Luis Femando León Alvarado y a Arturo Francisco Rodríguez Morales, respectivamente, en condición de directora del Area Rectora de Salud Turrialba, de directora Regional de Rectoría de la Salud Central Este, de alcalde y de presidente del Concejo, ambos de la Turrialba o a quienes ocupen esos cargos, para que se refieran y aporten las pruebas correspondientes respecto a los hechos y omisiones que se les atribuyen.”. Solicita se desestime la gestión.

5.- Según constancia agregada a los autos, entre el 22 y el 28 de febrero del 2021, la Directora Regional de Rectoría de la Salud Central Este, alcalde y de presidente del Concejo, estos últimos de Turrialba, no presentaron escrito o documento alguno, a fin de rendir el informe que se le solicitó en la resolución dictada a las veintiún horas veintidós minutos del diecinueve de febrero de dos mil veintiuno, en el expediente número 20-007892-0007-CO.

6.- En la substanciación de este proceso se han observado las prescripciones de ley.

Redacta la Magistrada Sánchez Navarro; y,

Considerando:

I.- En el presente asunto, el recurrente acusa que la autoridad accionada no ha cumplido con lo ordenado en sentencia dictada en este proceso. Por lo anterior, mediante auto de las 21:22 hrs. del 19 de febrero de 2021 se dio audiencia a las autoridades accionadas para que se pronunciaran sobre el posible incumplimiento de lo resuelto en la sentencia 2020-015125 de las 09:15 hrs. del 14 de agosto de 2020, en la que se dispuso: "Se ordena a Giselle Solano Fernández y a Mariela Esther Díaz Ríos, así como a Luis Fernando León Alvarado y a Arturo Francisco Rodríguez Morales, respectivamente, en condición de directora del Área Rectora de Salud de Turrialba, de directora Regional de Rectoría de la Salud Central Este, de alcalde y de presidente del Concejo, ambos de Turrialba o a quienes ocupe esos cargo, que dispongan y coordinen lo necesario a efecto que de inmediato se verifique si existen los problemas ambientales y constructivos reclamados, lo cual deberá ser finalizado en el plazo de un mes contado a partir de la notificación de esta sentencia. Cumplido dicho plazo, deberán ordenar, de inmediato, el inicio de los procedimientos respectivos, con el objeto de ajustar a derecho la situación de esas construcciones. A ese efecto, deberán coordinar todas las acciones necesarias a efecto que se integren el Ministerio de la Presidencia, Ministerio de Seguridad Pública, Ministerio de Vivienda y Asentamientos Humanos, Ministerio de Planificación Nacional y Política Económica, Instituto de Desarrollo Agrario e Instituto Mixto de Ayuda Social, en el supuesto que deba realizarse el desalojo del precario Lomas del Río". Al respecto, de lo informado por parte de las autoridades accionadas del Área Rectora de Salud de Turrialba, en relación con el acusado incumplimiento, se aprecia que estas han estado realizando acciones tendientes a dar cumplimiento de lo ordenado en sentencia. Sin embargo, también se logra acreditar que varias de estas acciones fueron realizadas fuera del plazo otorgado y aun no se ha terminado de cumplir lo ordenado en la indicada sentencia. Asimismo, según constancia agregada a los autos, se acreditó que las autoridades accionadas de la Municipalidad de Turrialba no contestaron la audiencia conferida por parte de este Tribunal Constitucional. Por lo anterior, de conformidad con lo indicado en el artículo 45 de la Ley de la Jurisdicción Constitucional, se tienen por ciertos los hechos acusados por la parte recurrente. En razón de expuesto, procede reiterar la orden, para que los accionados procedan al cumplimiento efectivo de la sentencia N° 2020-015125 de las 09:15 hrs. del 14 de agosto de 2020. Se apercibe a GISELLE SOLANO FERNÁNDEZ, en su condición de Directora del Área Rectora de Salud Turrialba, así como, a ARTURO FRANCISCO RODRÍGUEZ MORALES, en condición de Presidente del Concejo y, a LUIS FERNANDO LEÓN ALVARADO, en condición de Alcalde, estos últimos de la Municipal del Cantón de Turrialba o, a quienes ocupen esos cargos que en caso de no cumplir con lo ordenado en esta sentencia se ordenará el testimonio de piezas al Ministerio Público conforme lo dispuesto en el artículo 71 de la Ley de la Jurisdicción Constitucional.

II.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se reitera a GISELLE SOLANO FERNÁNDEZ, en su condición de Directora del Área Rectora de Salud Turrialba, así como, a ARTURO FRANCISCO RODRÍGUEZ MORALES, en condición de Presidente del Concejo y a LUIS FERNANDO LEÓN ALVARADO, en condición de Alcalde, estos últimos de la Municipal del Cantón de Turrialba o, a quienes ocupen esos cargos, el cumplimiento INMEDIATO de la sentencia N° 2020-015125 de las 09:15 hrs. del 14 de agosto de 2020, bajo la advertencia de testimoniar piezas al Ministerio Público conforme lo dispuesto en el artículo 71 de la Ley de la Jurisdicción Constitucional.
