Writ of amparo (recurso de amparo) filed by JEINER ANTONIO TREJOS MUÑOZ, national identity card (cédula de identidad) 0205730059, against the MINISTERIO DE SALUD AND THE MUNICIPALIDAD DE ALAJUELA.

Whereas:

  1. 1By written submission incorporated into the digital case file at 16:33 hours on November 27, 2020, the petitioner files a writ of amparo against the Ministerio de Salud and the Municipalidad de Alajuela. He states that he is a resident of La Guácima de Arriba de Alajuela, and that in said area several clandestine workshops are operating in the yards of private homes, despite the fact that the respondent municipality confirmed that they do not hold operating permits (permisos de funcionamiento). He indicates that this activity affects his own health, that of his family, and that of his neighbors, since due to the proximity one can hear intense noise, foul odors, and exhaust fumes from the engines of trucks, automobiles, motorcycles, and all-terrain vehicles (cuadraciclos). He states that the properties where the workshops operate belong to Víctor Enrique Quirós Méndez, who is the person responsible for renting them out.In light of this situation, last May the petitioner and the neighbors filed complaint No. 2030 with the Área de Salud de Alajuela, but the official who handled the case ignored the evidence submitted and simply archived the matter, arguing that one of the offenders had told him that the existence of the workshop was false and that the activity had been carried out by the previous tenant. Furthermore, the inspector in charge explained in the report that the cars and trucks parked at the location are registered in the name of the person residing there. Faced with this situation, they refuted the arguments presented without the matter being resolved; on the contrary, as a result of the complaint, the mechanics began playing music through high-capacity speakers at full volume and brought in dogs of an aggressive breed, which was understood as a form of intimidation intended to discourage further complaints.Additionally, another person filed complaint No. 261 with that same authority, which has not been attended to, and when they consulted the health authorities they were refused information on the follow-up status of that complaint. He adds that when they submitted the complaint in May, the official María Fernanda Fernández told them that at the time the review was to take place they would be contacted to coordinate the inspection and to provide personal information and contact details; however, they were never called nor given the opportunity to address any questions the inspector might have had. He alleges that the Ministerio de Salud has not followed up on the case and has not enforced their rights, leaving them defenseless against a problem that harms them every day due to the noise pollution (contaminación sónica) and environmental pollution (contaminación ambiental) caused by the described activity.On the other hand, he states that in light of this situation they also went to the Municipalidad de Alajuela starting in January of the current year to report the activity, but the described problem has equally not been resolved. He states that from January to May, every report sent by the respondent municipality indicated that the activity had not been observed, and they attached only a photograph of one of the front gates of the house, without including the workshop shed (galerón) where the work is performed. He notes that on June 11 he observed a Fiscal and Urban Control (Control Fiscal y Urbano) inspector stop in front of the workshop, and although a disassembled truck and mechanics carrying out their work were present, the inspector did not even take photographs of the location; in response to this, they sent a complaint that same day through the respondent corporation's online complaints platform, but after that complaint the municipality disabled the online complaints tool.On June 12, according to a neighbor's account, an inspector arrived at the location and spoke with one of the mechanics; at that point the mechanics began to cover the trucks and cars from view, but the inspector likewise did not take photographs to document the alleged facts. On June 18, when they contacted official Silvia Herra of Fiscal and Urban Control, she informed them that in the reports from June 11 and 12 the inspectors stated they had not observed any workshop activity at the location, even though they had spoken with the mechanics. For this reason, on June 22, they submitted a complaint to the Contraloría de Servicios of that municipal office explaining the situation regarding the inspectors' visits, and to date no response has been provided. He states that on July 30 two Fiscal Control inspectors arrived at the location and informed the mechanics that the following day they would conduct an inspection at 9:00 a.m. On July 31 the inspectors appeared at the location and their report stated that the mechanic's activity consists of buying, repairing, and reselling cars, and for that reason he had several vehicles parked out front.Accordingly, on August 25 they asked inspector Freddy Moya González to clarify several points from the report and regarding the municipality's conduct, but he did not clarify any of the points. In the report dated August 27, the Fiscal and Urban Control Department included a photograph showing that the interior of the property cannot be seen, explaining that there is no visibility due to the shade cloth (sarán) and black plastic sheeting covering the location. On October 22 he communicated with the head of the Fiscal and Urban Control Department, which led to that official conducting a visit to the location on the 23rd of that same month; the official subsequently informed them by email that: "it was communicated to him that there are complaints regarding the workshop activity he carries out on his property. To which he stated that what he does is repair his own cars, which he buys and repairs to put them to work as UBER services." On November 17, it appears the head of that department delivered a notice, but in the same manner the report indicates that the activity could not be confirmed, despite the fact that the official had told them by email that the mechanic acknowledged repairing vehicles at the location.Additionally, on two occasions they called the municipal police to attend to the case, but the first time they were told that it would be best handled by the Fiscal and Urban Control Office, and the second time they called, no one came. He maintains that this situation affects them, since in his particular case he suffers from auditory and respiratory problems, is furthermore unable to work, and having to exist in such a harmful environment has also affected his mental health. Several elderly residents, children, and young people also live in the area, all of whom are affected daily by the intense noise and pollution caused by this activity. He requests that the writ be granted, with the legal consequences thereof.
  2. 2By resolution of the Presidency issued at 14:19 hours on December 16, 2020, the proceedings were initiated.
  3. 3By written submission incorporated into the digital case file at 16:15 hours on January 12, 2021, Humberto Soto Herrera, in his capacity as Mayor of Alajuela, and Emerson Bone Moya, in his capacity as Coordinator of the Fiscal and Urban Control Process, both of the Municipalidad de Alajuela, report under oath that by means of official memorandum No MA-PCFU-0021-2021 dated January 11, 2021, it was stated: "That Mr. Trejos Muñoz did indeed file several complaints with this Process through the channels available for that purpose — by email and through the Contraloría de Servicios — in which he expressed his dissatisfaction regarding certain auto repair workshops operating without a municipal business license (licencia municipal), which are harming his health and that of his neighbors; however, the workshops were visited on several occasions and it was not possible to confirm that the activity was being carried out, a fact that was communicated to Mr.Trejos Muñoz on several occasions, with a response being provided to each of the complaints he filed. Nevertheless, last November, municipal officials went to the location to follow up on the complaints filed by Mr. Trejos Muñoz; we arrived at one of the workshops, where some relatives were observed on a balcony of the dwelling generating a great deal of noise from speakers being used at very high volume; we also managed to speak with the owner of the workshop, who identified himself as Heimuf González Días, who stated that he does not carry out any for-profit activity, that the vehicles he repairs are his own property and that he repairs them to put them in service. He also told us that he buys vehicles in poor condition and repairs them in order to put them in service after investing some money; however, despite not finding anyone working there at the time of our visit, we proceeded to notify him of his obligation to hold a municipal business license by means of notification slip (boleta de notificación) No. 013506, giving him 8 days to bring his activity into compliance, as established by the applicable regulations.After visiting the first workshop, we proceeded to another workshop located approximately 50 meters from the first; at this location we were able to identify a person repairing a vehicle, who identified himself by the name of Dani Jesús Salas Zumbado, to whom a notification was issued by means of slip No. 0/4796, granting him the 8 business days established by the applicable regulations to bring his activity into compliance. Following the respective notifications issued to both individuals, follow-up has been conducted on the notification slips with the objective of determining whether the activity continues to be carried out, with a view to shutting down (clausurar) the workshops if they are not in compliance by the relevant date; however, on November 13, 2020, the officials of this Process visited the site as recorded in the inspection slip (boleta de inspección) and no commercial activity was observed at that time.Subsequently, on January 8, 2021, another inspection was conducted at the site, and the inspection slip records that no commercial activity was observed or perceived. To date, it has not been possible to confirm that workshop activities are being carried out. It is important to emphasize that, because none of the visits conducted have detected the activity being performed, it has not been possible to identify foul odors, exhaust fumes, or noise from engines or vehicles at the location; there is, however, as noted at the outset, a great deal of noise perceived coming from speakers used on a balcony of the dwelling. In the attached Police Observation Record (acta de observación Policial), No. 011-2021 dated January 8, 2021, at thirteen hours and twenty-eight minutes, the two officers were granted access to the property, where Señor Helmuth González Díaz, identity card 2-0541-0292, was also present. It should be noted that the procedure carried out was recorded on video." He requests that the Sala dismiss the writ.
  4. 4By written statement entered into the digital case file (expediente) at 12:03 hours on January 13, 2021, Ronald Enrique Mora Solano, in his capacity as Director of the Health Governing Area (Área Rectora de Salud) Alajuela 2, reports under oath that on May 25, 2020, a complaint (denuncia) filed by the petitioner was submitted by email. In that complaint, the tenants of a residential dwelling owned by Víctor Enrique Quirós Méndez were reported for operating an alleged informal workshop that produced noise and vibrations, as well as generating smoke and fumes. He clarifies that due to the public health situation caused by COVID-19, complaints directly related to COVID issues were prioritized, and all inspections of pre-existing complaints were rescheduled accordingly. As a result, the inspection for complaint 230-2020 was scheduled for August 14, 2020. On August 3, 2020, official memorandum (oficio) N° 09093-2020-DHR from the Defensoría de los Habitantes was received by that office under proceeding N° 2569-2020, requesting a report on the actions taken by that office to address complaint N° 230-2020.On August 14, 2020, the inspection of the reported residential dwelling was carried out, which matched the photographs submitted. As recorded in ocular inspection report (acta de inspección ocular) N° DRRSCN-DARSA2-1558-2020, it was stated that upon arrival, authorization to enter the reported property was not obtained. A conversation was held with Ms. González Salas, who indicated that Mr. Helmuth Gonzáles Díaz is the owner of the property. After a phone call, Mr. Gonzáles indicated that he would arrive at the location within ten minutes to authorize entry. Mr. González arrived at the location and authorized entry; upon entering the property, no signs of any mechanical activity were observed. No pneumatic, hydraulic, or manual tools were observed, and no mechanical, structural, or interior indicators such as floor stains were visible. In addition, three vehicles were found at the location — a sedan, an SUV, and a light truck — and Mr.González showed vehicle registration (derecho de circulación) documents for the vehicles, which showed they were owned by Hemult González Días; this ruled out the presence of vehicles belonging to persons other than the tenants of the property. On August 31, 2020, official memorandum N° MS-DRRSCN-IT-1710-2020 was delivered to the Director of the Health Area Alajuela 2, containing the technical report of the inspection of the complaint, which described the actions taken during that inspection and stated that at the time of the inspection visit to the reported location, the allegations set forth in the complaint could not be verified, and accordingly the complaint was closed and filed. On September 3, 2020, the Director of the Health Governing Area sent official memorandum N° MS-DRRSCN-DARSA2-1713-2020 by email, in response to official memorandum N° 09093-2020-DHR previously sent by the Director of Quality of Life. He requests that the Constitutional Chamber (Sala) dismiss the writ.

Whereas:

I.Subject of the writ. The petitioner alleges that in May 2020, they filed complaint No. 2030 with the Health Area of Alajuela for noise pollution (contaminación sónica) and smoke produced by certain workshops. He alleges that the Ministry of Health has not followed up on the case, leaving them unprotected against a problem that harms them daily, due to the noise and environmental pollution caused by the described activity. Furthermore, he states that in response to this situation, they also turned to the Municipalidad de Alajuela beginning in January of the current year to report this activity, but the described problem has likewise not been resolved.

II.On the merits. In the present case, by written statement entered into the digital case file at 13:02 hours on January 19, 2021, the petitioner appeared to state that he wished to withdraw the writ of amparo. Article 52 of the Constitutional Jurisdiction Law (Ley de la Jurisdicción Constitucional) provides that the petitioning party may withdraw the writ of amparo when the writ involves patrimonial rights or other waivable rights, or when the withdrawal is based on an out-of-court satisfaction (satisfacción extraprocesal) of the rights or freedoms claimed by the interested party, noting that the case file may be reopened at any time if it is shown that the agreed satisfaction has been unfulfilled or untimely. In light of the foregoing, and as expressly requested by the petitioner (amparado), the appropriate course is to accept the withdrawal (desistimiento) on the stated terms and order the case file to be closed.

III.Documentation submitted to the case file. The parties are hereby notified that if they have submitted any paper documents, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the court office (despacho) within a maximum period of thirty business days counted from the date of notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, as provided in the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in Session N° 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial N° 19 of January 26, 2012, as well as in the resolution approved by the Consejo Superior del Poder Judicial, in Session N° 43-12 held on May 3, 2012, Article LXXXI.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del diecinueve de febrero de dos mil veintiuno .

Recurso de amparo interpuesto por JEINER ANTONIO TREJOS MUÑOZ, cédula de identidad 0205730059, contra el MINISTERIO DE SALUD Y LA MUNICIPALIDAD DE ALAJUELA.

Resultando:

  1. 1Por escrito incorporado al expediente digital a las 16:33 horas del 27 de noviembre de 2020, la parte recurrente interpone recurso de amparo contra el Ministerio de Salud y la Municipalidad de Alajuela. Comenta que es vecino de La Guácima de Arriba de Alajuela, y en dicha zona están operando varios talleres clandestinos en los patios de las casas, pese a que la municipalidad recurrida confirmó que no cuentan con los permisos de funcionamiento. Indica que dicha actividad afecta la salud de su persona, la de la familia y de los vecinos, ya que por la cercanía se escucha la intensidad de ruido, los malos olores y el humo de los motores de los camiones, automóviles, motocicletas y cuadraciclos. Afirma que los inmuebles donde funcionan los talleres pertenecen a Víctor Enrique Quirós Méndez, quien es la persona responsable de alquilarlos. Ante dicha situación, en mayo pasado el recurrente y los vecinos interpusieron la denuncia N° 2030 en el Área de Salud de Alajuela, pero el funcionario que tramitó el caso ignoró las pruebas aportadas y simplemente archivó el asunto, argumentando que uno de los infractores le indicó que la existencia del taller era falsa y que dicha actividad la realizaba el inquilino anterior.Además, el inspector a cargo explicó en el reporte que los carros y camiones que estaban parqueados en el lugar están a nombre de la persona que habita en ese lugar. Ante dicha situación refutaron los argumentos expuestos, sin que se solucionara la situación y, por el contrario, a raíz de la denuncia, los mecánicos empezaron a poner música con parlantes de alta capacidad a todo volumen y trajeron unos perros de raza agresiva, entendiéndose como una manera de intimidación para que no continuaran denunciando. Adicionalmente, otra persona gestionó la denuncia No. 261 ante esa misma autoridad, la cual no ha sido atendida, y al consultar a las autoridades de salud no le quieren dar información del seguimiento de la misma. Añade que al presentar la queja en el mes de mayo, la funcionaria María Fernanda Fernández, les indicó que en el momento que se fuera a hacer la revisión, se les estarían contactando para coordinar la inspección y agregar los documentos de información personal y de los contactos; sin embargo, nunca los llamaron ni tuvieron la oportunidad de evacuar alguna duda que tuviera el inspector.Alega que el Ministerio de Salud no le ha dado seguimiento al caso y no ha hecho valer sus derechos, dejándolos desprotegidos ante un problema que les perjudica cada día, debido a la contaminación sónica y ambiental que provocada por la actividad descrita. Por otra parte, afirma que ante dicha situación también acudieron ante la Municipalidad de Alajuela desde enero del presente año, denunciando dicha actividad, pero de igual manera no se ha resuelto el problema descrito. Dice que de enero a mayo cada reporte enviado por la municipalidad recurrida informaba que no se había podido ver la actividad y adjuntan una foto de uno de los portones del frente de la casa nada más, sin incluir el galerón donde trabajan. Señala que el 11 de junio observó a un inspector de Control Fiscal y Urbano detenerse en frente del taller y pese a que había un camión desarmado y mecánicos realizando su actividad, ni siquiera tomó fotos del lugar, ante dicha situación enviaron una denuncia ese mismo día a la página de la corporación recurrida habilitada para tales efectos, pero luego de esa denuncia, la municipalidad deshabilitó la herramienta de denuncias en línea.El 12 de junio, de acuerdo con lo manifestado por uno de los vecinos, un inspector llegó al lugar y habló con uno de los mecánicos; momento en el que empezaron a cubrir la vista de los camiones y de los carros, pero de igual el inspector tampoco tomó fotografías para evidenciar los hechos alegados. El 18 de junio, al comunicarse con la funcionaria Silvia Herra de Control Fiscal y Urbano le indicó que en los reportes del 11 y 12 de junio, los inspectores indicaron no haber visto ninguna actividad del taller en el lugar, a pesar de que conversaron con los mecánicos. En razón de lo anterior, el 22 de junio, enviaron un reclamo a la Contraloría de Servicios de esa alcaldía, explicando la situación de las visitas de los inspectores, sin que a la fecha se le haya brindado respuesta. Afirma que el 30 de julio dos inspectores de control fiscal llegaron al lugar, poniendo en autos a los mecánicos de que al siguiente día iban a hacer una inspección a las 9:00 a.m. El 31 de julio los inspectores se apersonaron al lugar y en su reporte indicaron que el mecánico se dedica a comprar, arreglar y revender autos, y por esa razón tenía varios vehículos estacionados en frente.Por lo anterior el 25 de agosto, le solicitaron al inspector Freddy Moya González que les aclarara varios puntos del reporte y el actuar de la municipalidad, pero no les aclaró ningún punto. En el reporte de fecha 27 de agosto, el Departamento de Control Fiscal y Urbano incluyó una foto evidenciando que no se puede ver el interior de la propiedad, explicando que no tienen visibilidad debido al sarán y los plásticos negros que tapan el lugar. El 22 de octubre se comunicó con el jefe del Departamento de Control Fiscal y Urbano, logrando que el 23 del mismo mes realizara una visita al lugar, y según informó luego por correo electrónico que: "se le manifestó que existen denuncias por la actividad que él realiza en su propiedad, de taller. A lo que manifestó que él lo que realiza es reparar los carros de él, que los compra los repara para ponerlos a trabajar como servicios UBER". El 17 de noviembre al parecer el jefe de ese departamento entregó una notificación, pero de la misma manera el reporte indica que no se pudo confirmar la actividad, a pesar de que por correo les indicó que el mecánico manifestó que sí arregla vehículos en el lugar.Adicionalmente, en dos ocasiones han llamado a la policía municipal para que lleguen a atender el caso, pero la primera vez, les dijeron que lo mejor era que lo atendiera la Oficina de Control Fiscal y Urbano, y la segunda vez, que llamaron, simplemente no llegaron. Sostiene que dicha situación los afecta, pues en su caso particular sufre de problemas auditivos y respiratorios, además no puede trabajar, y al estar en ese ambiente tan perjudicial, su salud mental también se ha visto afectada. También en el lugar viven varios vecinos adultos mayores, niños y jóvenes, los cuales se ven afectados diariamente por el ruido intenso y la contaminación que ocasiona dicha actividad. Solicita que se declare con lugar el recurso, con las consecuencias de ley.
  2. 2Mediante resolución de Presidencia de las 14:19 horas del 16 de diciembre de 2020, se dio curso al proceso.
  3. 3Por escrito incorporado al expediente digital a las 16:15 horas del 12 de enero de 2021, informa bajo juramento Humberto Soto Herrera, en su condición de Alcalde de Alajuela y Emerson Bone Moya, en su calidad de Coordinador del Proceso de Control Fiscal y Urbano, ambos de la Municipalidad de Alajuela, que mediante oficio No MA-PCFU-0021-2021 de fecha 11 de enero de 2021, se indicó: "Que efectivamente el Sr. Trejos Muñoz interpuso varias denuncias ante este Proceso, por los medios habilitados para ese fin, vía correo electrónico, por medio de Contraloría de Servicios, donde expuso su inconformidad por unos talleres mecánicos que realizaban la actividad sin contar con la licencia municipal, los cuales perjudican su salud y la de los vecinos, sin embargo en barias oportunidades se visitaron los talleres y no fue posible identificar que se estuviera ejerciendo la actividad, situación que le fue informado en varias ocasiones al Sr. Trejos Muñoz, donde se le daba respuesta a cada una de las denuncias que él planteó.Sin embargo, el pasado mes de noviembre se presentaron al lugar funcionarios municipales, dando seguimiento a las denuncias planteadas por el Sr. Tejos Muñoz, llegamos a uno de los talleres, donde se logró observar unos parientes sobre un balcón de la vivienda, los cuales generaban mucho ruido, utilizados a muy alto volumen, así mismo se logró conversar con el propietario del taller, el cual se identificó como Heimuf González Días, el cual nos manifestó que el no ejerce ninguna actividad lucrativa, que los vehículos que el repara son de su propiedad y que los repara para ponerlos a funcionar. Además, nos manifestó que compra los vehículos en mal estado y los repara para luego invertir un poco de dinero y ponerlos a funcionar, sin embargo, a pesar de no encontrar a nadie laborando en el momento que llega al lugar, procedimos a notificarle su obligación de contar con una licencia municipal, mediante la boleta de notificación N° 013506, otorgándole 8 días, para poner a derecho la actividad, como lo establece la normativa vigente.Luego de visitar el primer taller nos dirigirnos a otro taller ubicado a unos 50 metros de distancia del primero, en este lugar logramos identificar a una persona reparando un vehículo, al cual se identificó con el nombre de Dani Jesús Salas Zumbado, al cual se le identificó mediante la boleta N° 0/4796, otorgándole los 8 días hábiles, como lo establece la normativa vigente para que ponga a derecho su actividad. Luego de realizadas las notificaciones respectivas a ambos familiares, se ha venido realizando seguimiento a las boletas de notificaciones efectuadas con el objetivo de poder identificar si la actividad se sigue realizando con el fin de clausurar los talleres si a la fecha no se encuentran a derecho, sin embargo, el pasado 13 de noviembre de 2020, los funcionarios de este Proceso, vista al sitio como consta en la boleta de inspección y no se observó ninguna actividad comercial en ese momento.Posteriormente el pasado 08 de enero de 2021, vuelven a realizar inspección al sitio, donde hacen constar en la boleta de inspección que no se observa ni se percibe ninguna actividad comercial. A la fecha no se ha podido identificar que las actividades de taller se estén efectuando. Es importante recalcar, que debido a que en ninguna de las vistas realizadas se ha podido detectar que la actividad se esté realizando, no se ha podido identificar malos olores, humo y ruido por motores o vehículos en el lugar, no así como lo manifesté al inicio, se percibe mucho ruido que proviene de unos parlantes que utilizan en un balcón de la vivienda. En el acta de observación Policial adjunta, N° 011-2021 de fecha 08 de enero de 2021, al ser las trece horas con veintiocho minutos, que, se les permitió a los dos oficiales el ingreso a la propiedad, donde se encontraba también el señor Helmuth González Díaz, cedula 2-0541-0292. Es menester señalar que el procedimiento realizado quedó grabado en el video. Solicita a la Sala que declare sin lugar el recurso.
  4. 4Por escrito incorporado al expediente digital a las 12:03 horas del 13 de enero de 2021, informa bajo juramento Ronald Enrique Mora Solano, en su condición de Director del Área Rectora de Salud Alajuela 2, que el 25 de mayo de 2020, mediante correo electrónico ingresó una denuncia interpuesta por el recurrente. En esta denunció a los inquilinos de una casa de habitación propiedad de Víctor Enrique Quirós Méndez, por la operación de un supuesto taller de naturaleza informal que producía ruido y vibraciones, así como la generación de humo y gases. Aclara que debido a la situación sanitaria provocada por COVID-19, se priorizaron las denuncias directamente relacionadas con la problemática por COVID, reprogramándose así todas las inspecciones de las denuncias preexistentes. Ante esto, la inspección de la denuncia 230-2020 fue agendada para el 14 de agosto de 2020. En fecha 3 de agosto de 2020, mediante trámite N° 2569-2020 ingresó a esa oficina el oficio N° 09093-2020-DHR de la Defensoría de los Habitantes, solicitando un informe de las acciones realizadas por esa dependencia para dar atención a la denuncia N° 230-2020.El 14 de agosto de 2020, se realizó la inspección a la casa de habitación denunciada, la cual coincide con las fotografías aportadas. Según consta en el acta de inspección ocular N° DRRSCN-DARSA2-1558-2020 se indicó que al llegar no se obtuvo autorización para ingresar a la propiedad denunciada. Se conversó con la señora González Salas indicando que el señor Helmuth Gonzáles Díaz es el propietario del terreno. Luego de una llamada telefónica el señor Gonzáles les indicó que en diez minutos se apersonaría al lugar para autorizar el ingreso. El señor González se apersonó al lugar y autorizó el ingreso, al ingresar a la propiedad no se observaron indicios de que se realizara alguna actividad mecánica. No se observa herramientas de tipo neumáticas, hidráulicas o manuales, no se visualizaron partes mecánicas, estructurales o de interior como manchas en el piso. Sumado a esto, en el lugar se encontraron tres vehículos, uno tipo sedán, un SUV, y un camión liviano, el señor González mostró documentos de derecho de circulación de los vehículos y los mismos eran propiedad de Hemult González Días, con esto se descartó la presencia de vehículos ajenos a los de los inquilinos de la propiedad.El 31 de agosto de 2020 se entregó al Director del Área de Salud Alajuela 2, el oficio N° MS-DRRSCN-IT-1710-2020, con el informe técnico de la inspección a la denuncia, mismo que señala las acciones realizadas a dicha inspección y donde se indicó que al momento de realizar la visita de inspección en el lugar denunciado no se logró comprobar lo expuesto en la denuncia, por lo que se procedió a realizar el archivo de la misma. El 3 de setiembre de 2020, el Director del Área Rectora remitió vía correo electrónico el oficio N° MS-DRRSCN-DARSA2-1713-2020, dando respuesta al oficio N° 09093-2020-DHR, enviado previamente por el Director de Calidad de Vida. Solicita a la Sala que declare sin lugar el recurso.
  5. 5Por escrito incorporado al expediente digital a las 13:02 horas del 19 de enero de 2021, se apersona el recurrente con el fin de manifestar que desea retirar el recurso de amparo.
  6. 6En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Salazar Alvarado; y,

Considerando:

I.Objeto del recurso. El recurrente alega que en mayo de 2020, interpusieron la denuncia No. 2030 en el Área de Salud de Alajuela, por contaminación sónica, y de humo producida por unos talleres. Alega que el Ministerio de Salud no le ha dado seguimiento al caso, dejándolos desprotegidos ante un problema que les perjudica cada día, debido a la contaminación sónica y ambiental que provocada por la actividad descrita. Por otra parte, afirma que ante dicha situación también acudieron ante la Municipalidad de Alajuela desde enero del presente año, denunciando dicha actividad, pero de igual manera no se ha resuelto el problema descrito.

II.Sobre el fondo. En el sub lite, por escrito incorporado al expediente digital a las 13:02 horas del 19 de enero de 2021, se apersona el recurrente con el fin de manifestar que desea retirar el recurso de amparo. El artículo 52, de la Ley de la Jurisdicción Constitucional, establece que la parte recurrente podrá desistir del amparo cuando el recurso involucrare derechos patrimoniales u otros renunciables, y cuando el desistimiento se funde en una satisfacción extraprocesal de los derechos o libertades reclamados por el interesado, advirtiendo que el expediente podrá reabrirse en cualquier tiempo si se demuestra que la satisfacción acordada ha resultado incumplida o tardía. En virtud de ello, y por haberlo solicitado expresamente el amparado, lo procedente es acoger el desistimiento en los términos planteados y ordenar el archivo el expediente.

III.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se tiene por desistido el recurso. Archívese el expediente.- Fernando Castillo V.
