ACTION OF UNCONSTITUTIONALITY (ACCIÓN DE INCONSTITUCIONALIDAD) PETITIONER:

[Nombre01 001] CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and one minute on the twelfth of February, two thousand twenty-one.

The action of unconstitutionality filed by [Nombre01 001], identity card [CED01], in his capacity as president with the powers of an unlimited general power of attorney (apoderado generalísimo sin límite de suma) of HACIENDA CIRUELAS S P S.A., corporate identification number CED02, is hereby admitted for processing, seeking a declaration that Law No. 9610 of 17 de octubre de 2018, “Amendment of the Boundaries of the Lomas de Barbudal Biological Reserve for Development of the Water Supply Project for the Middle Basin of the Río Tempisque and Coastal Communities,” is unconstitutional on the grounds that it violates Article 45 of the Political Constitution, as well as the procedure established in Article 208 bis of the Rules of Procedure of the Legislative Assembly and the principle of legal certainty (principio de seguridad jurídica). The Attorney General of the Republic, the President of the Legislative Assembly, the Minister of Environment and Energy, and the General Manager of the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento are granted a period of fifteen days to submit their views.

The provisions are challenged insofar as the petitioner alleges a violation of Article 45 of the Political Constitution because, in its view, Hacienda Ciruelas S P S.A. is deprived of private property without any public interest having been legally established. That private property is affected without prior compensation. The encumbrance (afectación) (the 25 hectáreas and the remainder of the property, which is also affected) arises upon the entry into force of the challenged Law, since that 25-hectare portion of the property of the company it represents, #34.930-000, has been incorporated into a biological reserve whose level of environmental protection is absolute. This constitutes interference with private property, while the Law fails to state that the property of the company it represents will be acquired through expropriation (expropiación), leaving that parcel within the new boundaries of the Reserva Biológica Lomas de Barbudal and subject to environmental restrictions.

It complains that no official appraisal (avalúo oficial) has been conducted and that the corresponding budget appropriation (partida presupuestaria) for payment of the expropriation of the property belonging to the company it represents was unavailable. It asserts that this appropriation is still unavailable because no appraisal has been conducted for each of the private properties incorporated within the new boundaries of the biological reserve, or for the 25 private properties that must be expropriated because they are located within the area intended to be flooded for construction of the Río Piedras reservoir, and there is no indication of the amount the State will ultimately be required to pay for those properties. It next alleges a violation of Article 208 bis of the Rules of Procedure of the Legislative Assembly, which provides that, by means of an “…order motion (moción de orden), approved by two-thirds of its votes, the Legislative Assembly may establish special procedures for processing amendments to its Rules of Procedure and bills whose approval requires an absolute majority, except for the approval of administrative contracts, matters relating to the sale of State assets or the opening of its monopolies, and international treaties and conventions, regardless of the vote required for their approval.

Every special procedure shall respect the democratic principle and safeguard the right of amendment. (Added by Agreement No 6231 of 8 de marzo de 2005).” It alleges that Article 208 bis of the Rules of Procedure of the Legislative Assembly may not be applied to bills requiring a qualified majority (mayoría calificada); accordingly, its application to the bill that became Law n° 9610 is entirely contrary to those Rules of Procedure, which constitute a constitutional benchmark (parámetro de constitucionalidad), thereby rendering the challenged Law unconstitutional because of a violation of the parliamentary procedure that must be followed when enacting laws. It further alleges a violation of the principle of legal certainty, based on the letter that the Instituto Geográfico Nacional (IGN) sent to the Legislative Assembly (official letter DIG-0388-2018 of 6 de setiembre pasado, responding to the consultation submitted by the Legislative Assembly to IGN through official letter AL-DSDI-OFI-0313-2018 of 23 de agosto), which states, in relevant part, as follows: “…the observations and suggestions issued in technical opinions… are intended to improve the bill with respect to its established boundary description, so that said boundary description is compatible with the official land-registry and cadastral information currently in force for the proper administration of the territory, is consistent with the morphological conditions of the geographic environment of the area in which the biological reserve is located, and enables its subsequent accurate representation in official national cartography….” In that official letter, IGN explains, for example, in point 3, that in “…Article 1 of bill Nº 20.645, we have made the adjustments to the text indicated against a yellow background, emphasizing that the initial Coordinates 350792,224 and 1163050,33 should be replaced by coordinates 350789,96 EAST and 1163037,02 NORTH, which more accurately locate the geographic point on río Cabuyo based on verification using cartography at a scale of 1:5.000….” Furthermore, in point 4 of that letter, IGN is even more emphatic in stating as follows: “…Official letter DIG-0283-2018 of 06 de julio de 2018, section IV, point 3, referred to the following issue, which, because of its importance, we reiterate.

In the northern sector of the new area proposed for the reserve, based on the mosaic of cadastral plans prepared by the Cadastral Subdirectorate of the Real Property Registry concerning the properties of La Hacienda Ciruelas SP Sociedad Anónima, Brindis de Amor de Liberia Sociedad Anónima, Pijije Land & Cattle Sociedad Anónima and Pecuaria Burro Blanco Sociedad Anónima, and the boundary proposed in the bill, we have identified two sectors designated as Case 1 and Case 2, shown in Figure Nº 1, where: a) there may be an inconsistency between the property boundaries versus the boundary of the new area proposed for the reserve; or b) the proposed line follows some technical, legal, or other policy-based criterion beyond the knowledge of this Institute. If the actual situation is that described in point 4. a), we request that we be informed of that circumstance so that we may propose new coordinates to correct the error.” It states that, upon reading the foregoing observations by IGN, it considers there can be no doubt that the principle of legal certainty has been violated.

However, to eliminate any possible doubt, it quotes IGN’s statement in point 5 of that official letter: “Part of the boundary of the new area proposed for the Reserva Biológica Lomas de Barbudal in its western sector uses the boundary of the Canal del Oeste as a reference. Based on the plotting performed by this Institute of that canal and the proposed boundary, we have found that the proposed boundary does not follow or correspond to the canal bank itself but is set back from it, thereby forming a type of protection zone. If the legislature intends the area of the new reserve to extend specifically to the bank of the Canal del Oeste, the coordinates defining it in the text would have to be corrected; if the actual situation is the second one cited (a protection zone adjacent to the canal), the coordinates in the text are correct. It is recommended that the coordinates corresponding to the vertices that, solely for practical purposes, we have numbered from 45 to 96 be reviewed, deleted and/or adjusted.

That sector should coincide with the proposed new boundary of the Reserva Biológica Lomas de Barbudal, which would be reasonable because the area removed from protected status (área desafectada) would be the area of the storage reservoir.” It states that, additionally, with respect to point 5, IGN states the following in the observations section: “Correct the coordinates of the northern sector of the reservoir area, as they do not match the written description.” It alleges that the stated legal uncertainty makes it impossible to know with certainty how many hectares must be expropriated and what the true boundaries of the Reserva Biológica Lomas Barbudal are, thereby rendering Law n° 9610 unconstitutional for that reason. Based on the foregoing, the petitioner requests that the Law challenged herein be declared unconstitutional. This action is admitted because it satisfies the requirements set forth in Articles 73 to 79 of the Law on Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional).

The petitioner’s standing (legitimación) derives from Article 75, first paragraph, of the Law on Constitutional Jurisdiction, because it identifies expediente n° 18-010534-1027-CA as the underlying matter (asunto previo), which is pending before the Administrative and Civil Court of the Treasury (according to the digital copy and certification submitted). This is a special incidental proceeding (proceso especial incidental) in which the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) seeks authorization to conduct preliminary studies on the property Dirección01. It is likewise established that, in a submission received on 1° de septiembre de 2020 through Gestión en Línea, the requesting party raised the unconstitutionality of Law n°9610 in the underlying matter in question. A notice concerning the filing of the action shall be published in the Judicial Bulletin for three consecutive times.

Legal effects of filing the action: The terms of Articles 81 and 82 of the Law on Constitutional Jurisdiction are recalled, which provide as follows: “Article 81. If the President deems the aforementioned requirements to have been satisfied, the Office of the Attorney General of the Republic and the opposing party appearing in the principal matter shall be granted a period of fifteen days to submit whatever statements they deem appropriate. At the same time, the President shall direct that a notice be sent to the court or body hearing the matter so that it does not issue a final decision before the Chamber has ruled on the action, and shall order publication of a notice in the Judicial Bulletin for three consecutive times, informing the courts and bodies that exhaust administrative remedies that this action has been filed, so that, in proceedings or procedures in which the application of the law, decree, provision, agreement, or decision is at issue, no final decision shall be issued until the Chamber has rendered the appropriate ruling.

If the action was filed by the Attorney General of the Republic, the hearing shall be granted to the person appearing as the opposing party in the principal matter.” “Article 82. In pending proceedings, no stage other than the issuance of the final decision shall be stayed, unless the action of unconstitutionality concerns provisions that must be applied during the proceeding.” Within fifteen days following the first publication of the aforementioned notice, persons appearing as parties in matters pending as of the date this action was filed, in which the application of the challenged provisions is at issue, or persons with a legitimate interest, may enter an appearance (apersonarse) in order to support either its admissibility or inadmissibility or, where appropriate, to expand upon the grounds of unconstitutionality in relation to the matter in which they have an interest. Revisión del Documento ACCIÓN DE INCONSTITUCIONALIDAD [Nombre01 001] SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas uno minutos del doce de febrero de dos mil veintiuno.

Se da curso a la acción de inconstitucionalidad interpuesta por [Nombre01 001], cédula de identidad [CED01], en su condición de presidente con facultades de apoderado generalísimo sin límite de suma de HACIENDA CIRUELAS S P S.A., cédula de persona jurídica n° CED02, para que se declare inconstitucional la Ley No. 9610 del 17 de octubre de 2018, “Modificación de límites de la Reserva Biológica Lomas de Barbudal para el desarrollo del Proyecto de Abastecimiento de Agua para la Cuenca Media del Río Tempisque y Comunidades Costeras”, por estimar que lesiona el artículo 45 de la Constitución Política, así como el procedimiento establecido en el artículo 208 bis del Reglamento de la Asamblea Legislativa y el principio de seguridad jurídica. Se confiere audiencia por quince días al Procurador General de la República, al Presidente de la Asamblea Legislativa, al Ministro de Ambiente y Energía y al Gerente General del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento.

Las normas se impugnan en cuanto la parte accionante alega la violación al artículo 45 de la Constitución Política, porque en su criterio se priva de propiedad privada a Hacienda Ciruelas S P S.A. sin que haya un interés público que hubiere sido legalmente comprobado. Se afecta esa propiedad privada sin indemnización previa. La afectación (las 25 hectáreas y el resto de finca que también es afectado) es a partir de la entrada en vigencia de la Ley que se impugna, ya que esa porción de 25 hectáreas de la propiedad de su representada #34.930-000 ha sido incorporada dentro de una reserva biológica, cuyo nivel de protección ambiental es absoluto. Se está frente a la intervención de la propiedad privada, siendo omisa la Ley en indicar que la propiedad de su representada será adquirida por expropiación, quedando ese fundo en los nuevos límites de la Reserva Biológica Lomas de Barbudal bajo limitaciones ambientales.

Reclama que no se ha realizado un avalúo oficial, ni se contaba con la partida presupuestaria correspondiente para pagar por la expropiación de la propiedad perteneciente a su representada. Afirma que tampoco actualmente se cuenta con esa partida, ya que no se ha realizado el avalúo de cada una de las propiedades privadas que se incorporaron dentro de los nuevos límites de la reserva biológica, ni de las 25 propiedades privadas que deben ser expropiadas por estar ubicadas dentro del área que se pretende inundar para construir el embalse de Río Piedras, y no se tiene idea de cuánto será finalmente lo que deba cancelar el Estado por esas propiedades. Seguidamente, alega la violación al artículo 208 bis del Reglamento de la Asamblea Legislativa, el cual establece que mediante “…moción de orden, aprobada por dos tercios de sus votos, la Asamblea Legislativa podrá establecer procedimientos especiales para tramitar las reformas a su Reglamento y proyectos de ley cuya aprobación requiera mayoría absoluta, exceptuando la aprobación de contratos administrativos, los relacionados a la venta de activos del Estado o apertura de sus monopolios y los tratados y convenios internacionales sin importar la votación requerida para su aprobación.

Todo procedimiento especial deberá respetar el principio democrático, y salvaguardar el derecho de enmienda. (Adicionado mediante Acuerdo No 6231 del 8 de marzo de 2005)”. Alega que la aplicación del artículo 208 bis del Reglamento de la Asamblea Legislativa le está vedado a proyectos que requieren mayoría calificada, por lo que su aplicación al proyecto de Ley que derivó en la Ley n° 9610 es totalmente contrario a dicho reglamento, el cual es parámetro de constitucionalidad, lo que hace que la Ley impugnada sea inconstitucional por violación al procedimiento parlamentario que debe seguirse para la formación de las leyes. Además, reclama la violación al principio de seguridad jurídica, con base en la nota que el Instituto Geográfico Nacional (IGN) envía a la Asamblea Legislativa (oficio DIG-0388-2018 del 6 de setiembre pasado, el cual responde a la consulta que la Asamblea Legislativa le hace al IGN mediante oficio AL-DSDI-OFI-0313-2018 del 23 de agosto), que señala en lo conducente lo siguiente: “…las observaciones y sugerencias emitidas en criterios técnicos… tienen como finalidad la mejora del proyecto de ley respecto a la delimitación establecida, de manera tal que dicho delimitación esté compatibilizada con la información registral-catastral oficial vigente para adecuada administración del territorio, sea concordante con las condiciones morfológicas del medio geográfico de la zona donde se ubica la reserva biológica, y lograr su precisa representación posterior en la cartografía nacional oficial…”.

En dicho oficio, el IGN detalla, por ejemplo, en el punto 3, que en “…el artículo 1 del proyecto de ley Nº 20.645, hemos realizado los ajustes al texto indicados en fondo color amarillo, destacando que las Coordenadas iniciales 350792,224 y 1163050,33, deberían ser reemplazadas por las coordenadas 350789,96 ESTE y 1163037,02 NORTE que ubican de manera más precisa el punto geográfico en río Cabuyo con base a verificación en cartografía escala 1:5.000…”. Por otro lado, en el punto 4 de esa nota, el IGN es aún más contundente al señalar lo siguiente: “…En el oficio DIG-0283-2018 del 06 de julio de 2018, apartado IV, punto 3, se hizo referencia al siguiente aspecto, que por su importancia, reiteramos nuevamente. En el sector norte de la nueva área propuesta para la reserva detectamos, conforme al mosaico planos catastrados realizado por la Subdirección Catastral del Registro Inmobiliario, referente a las propiedades de La Hacienda Ciruelas SP Sociedad Anónima, Brindis de Amor de Liberia Sociedad Anónima, Pijije Land & Cattle Sociedad Anónima y Pecuaria Burro Blanco Sociedad Anónima, y el límite propuesto en el proyecto de ley, hemos detectado dos sectores identificados como Caso 1 y Caso 2, los que se muestra en la Figura Nº 1, donde: a) podría estarse dando una inconsistencia entre lindero de propiedades versos límite de nueva área propuesta para la reserva; o, b) el trazo propuesto obedece a algún criterio técnico, legal u otro de oportunidad que escapa al conocimiento de este Instituto.

Si lo real es lo anotado en el punto 4. a) requerimos se nos indique esa situación, a efecto de proponer nuevas coordenadas que subsanen el error.” Manifiesta que al leer las observaciones anteriores del IGN, considera que no hay duda de la violación al principio de seguridad jurídica. Pero, para que no haya duda alguna, cita lo que el IGN señala en el punto 5 de ese oficio: “Parte del límite de loa nueva área propuesta para la Reserva Biológica Lomas de Barbudal en el sector oeste de la misma, toma como referencia el límite del Canal del Oeste, con base en ploteo realizado por este Instituto de dicho canal y el límite propuesto, hemos detectado que el límite propuesto no sigue o corresponde a la propia margen del canal, sino que está alejado del mismo, conformándose una tipología de zona de protección. Si la intención del legislador es que el área de la nueva reserva corresponda propiamente a la margen del canal del oeste, habría que corregir en el texto las coordenadas que lo definen, si lo real es lo segundo citado (zona de protección anexa al canal), las coordenadas que están en el texto son las correctas.

Se recomienda se revise, elimine y/o ajuste las coordenadas que corresponden a los vértices que solo para efectos prácticos hemos enumerado del 45 al 96. Dicho sector debería coincidir con el nuevo límite propuesta de la Reserva Biológica Lomas de Barbudal, siendo esto lo razonable puesto que el área desafectada sería el área del embalse de almacenamiento”. Indica que, adicionalmente, sobre este punto 5 el IGN señala lo siguiente en la sección de las observaciones: “Corregir las coordenadas del sector norte del área del embalse ya que no concuerdan con la descripción literal.” Alega que la inseguridad jurídica señalada impide saber a ciencia cierta cuántas hectáreas deben expropiarse y cuáles son los límites verdaderos de la Reserva Biológica Lomas Barbudal, lo que hace que la Ley n° 9610 sea inconstitucional por esa razón. Con base en lo anterior, la parte accionante solicita que se declare la inconstitucionalidad de la Ley aquí impugnada.

Esta acción se admite por reunir los requisitos a que se refiere la Ley de la Jurisdicción Constitucional en sus artículos 73 a 79. La legitimación del accionante proviene del en el artículo 75, párrafo primero, de la Ley de la Jurisdicción Constitucional, toda vez que indica como asunto previo el expediente n° 18-010534-1027-CA, el cual se encuentra en trámite ante el Juzgado Contencioso Administrativo y Civil de Hacienda (según copia digital y certificación aportadas). Se trata de un proceso especial incidental, donde el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) pretende la autorización para realizar los estudios previos sobre el inmueble Dirección01. Asimismo, se constata que, por escrito recibido el 1° de septiembre de 2020, mediante Gestión en Línea, la parte gestionante invocó la inconstitucionalidad de la Ley n°9610 dentro del asunto base en cuestión. Publíquese por tres veces consecutivas un aviso en el Boletín Judicial sobre la interposición de la acción.

Efectos jurídicos de la interposición de la acción: Se recuerdan los términos de los artículos 81 y 82 de la Ley de la Jurisdicción Constitucional que disponen lo siguiente “Artículo 81. Si el Presidente considerare cumplidos los requisitos de que se ha hecho mérito, conferirá audiencia a la Procuraduría General de la República y a la contraparte que figure en el asunto principal, por un plazo de quince días, a fin de que manifiesten lo que estimen conveniente. Al mismo tiempo dispondrá enviar nota al tribunal u órgano que conozca del asunto, para que no dicte la resolución final antes de que la Sala se haya pronunciado sobre la acción, y ordenará que se publique un aviso en el Boletín Judicial, por tres veces consecutivas, haciendo saber a los tribunales y a los órganos que agotan la vía administrativa que esa demanda ha sido establecida, a efecto de que en los procesos o procedimientos en que se discuta la aplicación de la ley, decreto, disposición, acuerdo o resolución, tampoco se dicte resolución final mientras la Sala no haya hecho el pronunciamiento del caso.

Si la acción fuere planteada por el Procurador General de la República, la audiencia se le dará a la persona que figure como parte contraria en el asunto principal.”, “Artículo 82. En los procesos en trámite no se suspenderá ninguna etapa diferente a la de dictar la resolución final, salvo que la acción de inconstitucionalidad se refiera a normas que deban aplicarse durante la tramitación”. Dentro de los quince días posteriores a la primera publicación del citado aviso, podrán apersonarse quienes figuren como partes en asuntos pendientes a la fecha de interposición de esta acción, en los que se discuta la aplicación de lo impugnado o aquellos con interés legítimo, a fin de coadyuvar en cuanto a su procedencia o improcedencia, o para ampliar, en su caso, los motivos de inconstitucionalidad en relación con el asunto que les interese. Se hace saber además, que de conformidad con los artículos 81 y 82 de la Ley de Jurisdicción Constitucional y conforme lo ha resuelto en forma reiterada la Sala (resoluciones 0536-91, 0537-91, 0554-91 y 0881-91) esta publicación no suspende la vigencia de la norma en general, sino únicamente su aplicación en los casos y condiciones señaladas.
