Document Review Decision No. 2021000684 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine fifteen a.m. on fifteen January two thousand twenty-one.

Amparo proceeding (recurso de amparo) processed under expediente número 20-021902-0007-CO, filed by Nombre01, identity card CED01, and Nombre02, identity card CED02, against MINISTERIO DE SALUD DE SAN RAMÓN and MUNICIPALIDAD DE SAN RAMÓN.

Findings:

1. In a brief received by the Office of the Clerk of the Chamber at 15:46 hours on 27 November 2020, the petitioners filed an amparo proceeding against the director of the Área Rectora de Salud de San Ramón of the Ministerio de Salud, as well as the mayor and the head of Servicios Municipales Ambientales, both of the Municipalidad de San Ramón, stating that on 18 September 2020 they filed a complaint with the local government of San Ramón regarding the presence of a large illegal waste dump located at Dirección01, west of the San Ramón neighborhood known as Las Lomas, in the district of Piedades Norte, canton of San Ramón, Alajuela. They indicate that cement rubble, concrete blocks, broken washing-machine parts, plastic bucket lids, old clothes, washing-machine drums, gallon containers, glass, and other items can be seen at that location. The location is also used to burn waste and discard dead animals, as parts of animal carcasses are scattered throughout the area.

In addition, water accumulates in washing-machine drums, which could lead to the formation of breeding grounds for dengue mosquitoes, posing a potential and imminent risk to residents who live only a few meters from the area. The remains of dead animals have attracted other scavenging animals to the area, such as rats and stray dogs. This poses a particular danger because the road is regularly used by pedestrians walking in the area, in addition to creating insecurity for the local community. By official letter No. MSR-AM-DDUSMA-216-2020 of 30 September of the current year, the Municipalidad stated that an inspection of the area had been conducted on 24 September of that year, during which several waste dumps were discovered on both sides of the road. They complain that, despite that response, the municipal authority failed to address many of the requests made in the aforementioned municipal environmental complaint, which had still not been fulfilled as of the date the proceeding was filed.

They contend that the only action taken was an inspection to take photographs, but the area has not been cleaned, the waste scattered there has not been collected, and signs stating “Dumping waste prohibited” have not been posted; it was merely stated that those measures would be adopted later, along with monthly inspections. Similarly, they allege that the respondent local government refused to notify or issue a warning (apercibimiento) to the owner of the property in question, on the ground that he was not responsible for depositing the waste there. Thus, in their view, it is clear that there is a problem affecting health and the environment, yet the municipal authorities have done nothing to remedy the situation. They state that, on the same date, 18 September 2020, they filed a complaint with the Área Rectora de Salud de San Ramón for the same reasons and requested that a health order (orden sanitaria) requiring waste collection be issued to the Municipalidad de San Ramón, as well as an order requiring it to send the waste to a site for proper treatment.

By official letter No. MS-DRRSCO-DARS-SR-2120-2020 of 6 October of the current year, the Área Rectora de Salud de San Ramón replied that it was not responsible for addressing the reported problem because it considered the matter to fall solely and exclusively within the jurisdiction of the local government of San Ramón, and no one else. They complain that, as of the date the proceeding was filed, the problem had not been addressed. They believe that the foregoing violates their fundamental rights. They request that the proceeding be granted, with the consequences established by law.

2. By order issued at 23:11 hours on 02 December 2020, the present proceeding was admitted for consideration, and the respondents were notified on 04 December 2020.

3. Marvin Quesada Elizondo, in his capacity as acting director of the Área Rectora de Salud San Ramón and regional director of the Rectoría de la Salud Central Occidente, both of the Ministerio de Salud (folio 55 of the electronic case file), states under oath that, as the complainants were informed, the matter was referred to the Oficina de Gestión Ambiental of the Municipalidad de San Ramón because the reported problem falls within that institution’s jurisdiction, and they were provided with that office’s telephone number. He adds that it was confirmed with the municipal entity that the complaint had been addressed and that measures would be taken to address the reported environmental problem. He requests that the proceeding be dismissed.

4. Oria Cecilia Ruiz Murillo, in her capacity as first deputy mayor, substituting for the mayor of San Ramón (folio 102 of the electronic case file), states under oath that the petitioners’ complaint was addressed by conducting cleanup activities—with the support of institutions and community groups—and that further cleanups and the posting of signs in the area were recommended. She explains that it is privately owned land accessed by a secluded road, which facilitates people’s use of the property as a dump, irrespective of the solid-waste collection programs, recycling campaigns, and the existence of a waste transfer center. She states that the signage will be addressed in 2021 because there is no budget available this year to deal with that matter. She considers that no duty has been neglected because cleanups and waste collections have been conducted in the area within the corporation’s sphere of authority, and the complainants have been informed of the actions taken. She adds that the principle of interinstitutional coordination (principio de coordinación interinstitucional) has not been violated either, because the Ministerio de Salud was informed of the actions taken regarding the matter. She requests that the proceeding be dismissed.

5. By certification issued on 14 December 2020, the Office of the Clerk of the Sala Constitucional certifies that the head of Servicios Municipales Ambientales of the Municipalidad de San Ramón did not submit any brief or document in order to provide the report requested in the initial order in the amparo proceeding (folio 135 of the electronic case file).

6. Allan Francisco Artavia Jiménez, in his capacity as coordinator of the Área de Servicios Municipales Ambientales of the Municipalidad de San Ramón, reports under oath to the same effect as the first deputy mayor of San Ramón.

7. The applicable legal requirements have been observed in the proceedings conducted.

Justice Garro Vargas drafted the decision; and,

Considerations:

I.Subject matter of the proceeding. The petitioners consider their fundamental rights to have been violated because they allege that the respondent authorities have not fully addressed the complaint filed on 18 September 2020 concerning the existence of an illegal dump.

II.Proven facts. The following facts are deemed duly established and relevant to the decision in this matter, either because they have been substantiated or because the respondent failed to address them as required by the initial order:

Municipalidad de San Ramón a) On 18 September 2020, the petitioners reported to the Municipalidad de San Ramón the presence of a large illegal waste dump located at Dirección01 (folios 13 and 109 of the electronic case file).

  • b)By official letter No. MSR-AM-DDUSMA-216-2020 of 30 September of the current year, the Municipalidad replied that an inspection of the area had been conducted on 24 September of that year, during which several waste dumps were discovered on both sides of the road, and that the following measures would be taken: “1. Conduct another cleanup in this area for the purpose of collecting and properly disposing of the waste illegally deposited there. 2. Maintain monthly monitoring of the area to identify possible new illegal dumps. 3. Post preventive signage at the site again. 4. Request the support of the residents nearest the site so that they may report when vehicles enter to deposit waste there” (folios 37 and 122 of the electronic case file).
  • c)By official letter MSR-AM-DDU-SMA-2233-2020, dated 06 October 2020, the head of Servicios Municipales Ambientales responded to the request from the Ministerio de Salud, reporting the actions taken by the municipal corporation (folio 129 of the electronic case file).

Área Rectora de Salud de San Ramón d) On 18 September 2020, the petitioners reported to the Área Rectora de Salud de San Ramón the existence of a large illegal garbage dump (folios 25, 62 and 88 of the electronic case file).

  • e)By official letter No. MS-DRRSCO-DARS-SR-2120-2020 of 06 October of the current year, the Área Rectora de Salud de San Ramón replied that the complaint had been referred to the Oficina de Gestión Ambiental of the Municipalidad de San Ramón (by official letter MS-DRRSCO-DARS-SR-2116-2020, of the same date), which is the competent entity, and included the telephone number of that office (folios 42, 96 and 100 of the electronic case file).

III.On the Fundamental Right to a Healthy and Ecologically Balanced Environment. On repeated occasions, this Court has elaborated upon the content of this right, which is enshrined in Article 50 of the Constitución Política. Environmental protection is an appropriate mechanism for safeguarding and improving everyone’s quality of life, making intervention by the public authorities necessary with respect to factors that may disrupt its balance and prevent individuals from developing and functioning in a healthy environment. The State serves as guarantor of the protection and safeguarding of the environment and natural resources. In this regard, oversight and enforcement in environmental matters and activities constitute an essential function of the State; accordingly, where environmental protection is concerned, the functions of governance, oversight, and enforcement in environmental matters belong to the State and are entrusted to its various administrative agencies. In summary, the fundamental right to health and to a healthy and ecologically balanced environment has been extensively developed, as has the obligation of the State and the various public authorities to preserve, defend, and guarantee that right (see judgment N°2006-005928).

IV.Regarding the specific case. In the present matter, the petitioners allege that the respondent authorities failed to address the environmental problem reported in submissions dated 18 de setiembre de 2020. They allege that, although their submission received a response, not all possible actions have been taken to resolve the problem caused by the reported illegal dump (basurero clandestino). After analyzing the evidence submitted, this Tribunal finds that the rights of the protected parties have been violated. The reports rendered under oath and the list of facts—proven and unproven—show that the complaint filed by the petitioners was addressed by the respondent authorities; however, it has not been established that a comprehensive solution was provided for the problem identified in that submission. It is established that the municipal authorities conducted an inspection at the site and determined the actions to be taken (see proven fact b), but there is no record of any subsequent action aimed at providing a definitive solution to the reported problem.

It is clear, therefore, that the situation persists and that no concrete solution has been provided. The local government has the authority to hold accountable those who deposit garbage at the site, as well as those who acquiesce in the situation (that is, it can and must hold the property owner to account). Clearly, the actions taken have been insufficient to resolve the reported problem. In other words, the existence of the illegal dump was verified, and there is no record that concrete measures were implemented to resolve that situation. With respect to the health authorities, it has been established that they referred the applicants’ complaint to the municipality; however, despite having been informed of a persistent problem of this nature that can clearly affect public health, they took no action in response. In this context, it must be noted that it is not for this Tribunal to determine which alternative should be adopted to resolve the reported problems, because this Chamber is not a supervisory body charged with reviewing the legality of the Administration’s actions or decisions.

Accordingly, it is not within its jurisdiction to determine whether the measures adopted comply with the applicable statutory or regulatory provisions, as that task belongs to the ordinary administrative or judicial proceedings (vía común, administrativa o jurisdiccional). Nevertheless, the respondent authorities must be reminded of their obligation to verify or rule out the existence of the reported problem and, if necessary, to resolve that situation definitively and in a coordinated manner. This Tribunal has recognized that one of the guiding principles of administrative organization is the coordination that must exist among all public entities and bodies when exercising their powers and providing the services assigned to them by the legal system. Coordination, insofar as it ensures administrative efficiency and effectiveness, is a virtual or implicit constitutional principle that permeates the entire body of administrative law and binds all public entities.

It may be inter-organizational (interorgánica)—among the various bodies comprising a public entity that are not subject to a hierarchical relationship—or inter-entity (intersubjetiva)—that is, among public entities, each having legal personality, its own budget, autonomy, and specific powers. Its purpose is to prevent duplication and omissions in the exercise of each public entity’s administrative functions, that is, to ensure that they are performed rationally and systematically (see, to that effect, judgment Nº 2007-015218, among others). In this Chamber’s view, the present case involves a serious health problem affecting the environment and the health of the community’s residents, and it is established that the respondent authorities have demonstrated an inability to enforce the applicable laws and fulfill their obligation to guarantee the area’s residents the enjoyment of a healthy and ecologically balanced environment, with the resulting consequences for their health due to the nature of the health problem afflicting them.

In its settled case law, the Chamber has stated that human beings cannot be denied the right to a healthy environment and the right to health because the competent public authorities are unable to exercise effectively the oversight and problem-solving powers granted to them by law. It is not enough to schedule inspections months in advance or to ask residents whether they agree to such inspections. Both authorities have sufficient and varied powers to ensure the performance of their duties. Nevertheless, despite having long been aware of the reported problem, the few actions they have taken have not been sufficient to resolve it. The persistence of the problem demonstrates that the few actions taken have clearly been insufficient, thereby giving rise to liability for failure to exercise those powers (responsabilidad por omisión), which in turn violates the constitutional right of those subject to the Administration to receive efficient and effective public services.

In view of the foregoing, the application for amparo (recurso de amparo) must be granted so that both the respondent Municipality and the Ministerio de Salud coordinate with each other and take the actions necessary to provide an effective solution to this problem.

V. NOTE BY JUSTICE HERNÁNDEZ LÓPEZ REGARDING THE CLAIM OF VIOLATION OF ARTICLE 50 OF THE CONSTITUCIÓN POLÍTICA

1. The historical context that once prompted the Chamber’s extensive involvement in environmental matters has changed considerably, requiring this body to reconsider the conditions governing its participation in safeguarding the right of persons to a healthy and balanced environment, as protected by Article 50 of the Constitución Política. Indeed, the current situation—characterized by an extremely extensive body of statutory and regulatory provisions that includes substantive rules, procedures, and the creation of bodies to ensure compliance with the Fundamental Charter (Carta Fundamental)—is radically different from the previous situation, in which the absence of regulations and of state bodies with appropriate jurisdiction compelled the Chamber to assume a leading, virtually exclusive role in defending the aforementioned constitutional right.

2. Today, we face a “dense framework” of environmental regulations, which has produced two significant phenomena. The first and most obvious is the emergence of comprehensive legal regulation of activities whose effects on the environment were previously subject to little or no regulation, as well as the creation of state bodies with powers to oversee and control the effects of human activity on the environment. The second phenomenon is that this increasing juridification (juridificación)—predominantly through statutes and regulations—necessarily entails the involvement of both administrative justice and the ordinary courts, primarily the administrative litigation courts, but also the criminal courts. In keeping with the importance of environmental law, these jurisdictions have established broad procedural avenues and inclusive rules of standing (medios de legitimación), enabling those subject to the Administration to enforce the provisions of the extensive legal framework relating to environmental matters.

3. In that context, it is neither legally nor functionally appropriate for the Sala Constitucional to displace—or, worse still, replace—the ordinary judicial bodies in performing their task, which is also constitutional in rank, of ensuring effective compliance with statutes and regulations. It is legally improper because, in the vast majority of these cases, the Chamber is asked to interpret and enforce statutory and regulatory provisions, thereby risking an overlap between its jurisdiction and that of other judicial bodies that were specifically created to perform such tasks. It is also functionally unsound because the design of its proceedings is ill-suited to the complexity present in numerous environmental disputes involving sequences of technically and legally complex facts and actions. Regarding both issues, there are well-known examples in which the Chamber has issued a partial or technically incomplete ruling, or in which unnecessary friction and adverse effects on legal certainty have arisen.

4. Among the technical considerations I have assessed, I would add that this jurisdiction does not have judges responsible for enforcing judgments (jueces ejecutores de sentencia) who could adequately monitor compliance with such judgments—which are generally complex—and which sometimes require monitoring remediation plans (planes remediales), among other measures, involving inter-institutional coordination and oversight lasting months or even years.

5. From that perspective, this Tribunal’s decision to step aside in environmental matters should not be viewed as abandoning such matters but, on the contrary, as ensuring their proper protection before the forum best suited to their complex and diverse nature. Nor should it be viewed as this body declining to perform the task of protecting constitutional rights imposed upon it by the Constitución Política and its Ley Orgánica, which, in my view, remains reserved in this field for specific cases. Rather, it entails reallocating the burdens and tasks assigned to the various state bodies so that each may fully perform its work within its assigned sphere, as well as exercising the power to define its own jurisdiction, as established in Article 7 of its Ley Orgánica.

6. It is clear that the Chamber does not propose to leave the protection of persons’ rights in environmental matters entirely to other jurisdictions. It is well established that, although any claim alleging a violation of statutory or regulatory provisions may ultimately be framed as a constitutional matter, some cases require nothing more for their resolution than the application of constitutional law (derecho de la Constitución). The objective, therefore, is for the Chamber to become one leading participant among others, so that—collectively, and each within its own sphere—they can address the full range of situations involved in protecting the right to a healthy and balanced environment within a society that also has other equally pressing needs. I firmly believe that, under this approach, citizens do not lose the slightest degree of protection, while substantial gains are made in breadth, perspective, and respect for the balance and distribution of powers, the latter being a principle that must necessarily be considered because it governs the constitutional dynamics of any liberal and democratic system such as ours.- 7.

In line with the foregoing, I maintain that this Chamber should refrain from hearing claims brought before it for alleged infringement of Article 50 of the Political Constitution, leaving them to be heard by the administrative justice system and the administrative litigation jurisdiction (jurisdicción contencioso-administrativa). The foregoing is stated as a general principle, without prejudice to recognizing the existence of particular cases or categories of cases that, in my opinion, would still be better protected by this Chamber and therefore should be heard and decided by it.- Among such categories of cases, and without this enumeration being considered a closed and definitive list, I would indicate that the Chamber should retain jurisdiction over situations such as claims concerning environmental violations that also directly endanger human health or access to or the quality of water; cases involving gross and direct violations of the environment in which there is a manifest absence of protection by the State authorities, provided, moreover, that the nature of the claim permits it to be addressed through the remedy of amparo (amparo) as a summary and special procedural mechanism, since I also consider that amparo proceedings should not be converted into ordinary proceedings to address, even in the cases cited, matters exceeding their capacity to provide adequate relief.

8. In this specific case, in accordance with the facts found to have been proven, the appellant’s claim could potentially affect the health and physical integrity of the residents of the community of Dirección01 in San Ramón due to the existence of an illegal waste dump in that locality. Consequently, it is clear that this case falls within the exceptions mentioned, and for that reason I have considered it necessary for the Chamber to exercise its jurisdiction in order to determine whether the alleged omissions violate the fundamental rights of the protected persons.

VI. NOTE BY JUSTICE SALAZAR ALVARADO

In environmental matters, it is also the undersigned’s view that, where the Public Administration has already intervened, the matter should be heard and decided by the administrative litigation jurisdiction. Nevertheless, I do address the merits of the matter when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy environment free from pollution (Article 50 of the Political Constitution), as occurs in this case, in which the appellants allege that the respondent authorities have failed to address in full the complaint filed on September 18, 2020 regarding the existence of an illegal waste dump located in Dirección01, west of the San Ramón neighborhood known as Las Lomas, in the district of Piedades Norte, canton of San Ramón, Alajuela, which endangers persons traveling through the area. The foregoing violates the right to enjoy a healthy and ecologically balanced environment and a dignified standard of quality of life.

VII. DOCUMENTATION SUBMITTED TO THE CASE FILE

This Chamber must advise the appellant that, if any documents in paper form, as well as objects or evidence stored on any additional device or on electronic, computer, magnetic, optical, or telematic media or produced using new technologies, have been submitted, they must be retrieved from the Court’s offices within 30 business days after receipt of notice of this judgment; otherwise, all such materials will be destroyed in accordance with the provisions of the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of August 22, 2011, Article XXVI, and published in Judicial Bulletin number 19 of January 26, 2012, as well as the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on May 3, 2012, Article LXXXI.

Por tanto:

The appeal is granted. Consequently, the following is ordered: 1) Oria Cecilia Ruiz Murillo and Allan Francisco Artavia Jiménez, in their respective capacities as First Deputy Mayor and Coordinator of the Municipal Environmental Services Department, both of the Municipality of San Ramón, or whoever holds those positions, shall take the actions within the scope of their authority to ensure compliance with the following: a) Within one month from notice of this judgment, arrangements shall be made for the collection of the waste present on the reported property; b) Within three months from notice of this judgment, the risk to the environment and public health posed by the accumulation of solid waste on the property reported by the protected persons shall be effectively eliminated, and the collection activity conducted there shall be regulated. 2) Marvin Quesada Elizondo, in his capacity as Acting Director of the San Ramón Health Governing Area and Regional Director of the Central-Western Health Governing Directorate, both of the Ministry of Health, or whoever holds those positions, is ordered to do the following: a) Monitor the Municipality of San Ramón’s effective compliance with the foregoing orders and take the corresponding administrative measures within the scope of his legal authority; b) Submit a monthly report to this Chamber on the actions taken by the respondent municipality until full compliance with the provisions herein has been achieved.

They are advised that failure to comply with the aforementioned order will constitute the offense of disobedience and that, pursuant to Article 71 of the Law governing this jurisdiction, any person who receives an order issued in amparo proceedings that the person must comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State and the Municipality of San Ramón are ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, the amounts of which shall be determined in proceedings to enforce the judgment before the administrative litigation jurisdiction. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del quince de enero de dos mil veintiuno .

Recurso de amparo que se tramita en expediente número 20-021902-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, Nombre02, cédula de identidad CED02, contra MINISTERIO DE SALUD DE SAN RAMÓN, MUNICIPALIDAD DE SAN RAMÓN.

Resultando:

1. Por escrito recibido en la Secretaría de la Sala a las 15:46 horas del 27 de noviembre de 2020, la parte recurrente interpone recurso de amparo contra el director del Área Rectora de Salud de San Ramón del Ministerio de Salud, así como el alcalde y el jefe de Servicios Municipales Ambientales, ambos de la Municipalidad de San Ramón, y manifiesta que el 18 de septiembre de 2020 interpusieron una denuncia ante el gobierno local de San Ramón por la presencia de un gran botadero clandestino de desechos ubicado en Dirección01, al oeste del barrio ramonense conocido como Las Lomas, en el distrito de Piedades Norte, cantón San Ramón, Alajuela. Indican que en dicho lugar se observa la presencia de escombros de cemento, blocks, pedazos rotos de lavadora, tapas plásticas de baldes, ropa vieja, tambores de lavadoras, galones, vidrio, etc. Dicho lugar también es utilizado para quemar los residuos y para tirar animales muertos, pues hay partes de cuerpos de animales disgregados por el lugar.

Además, se encuentran tambores de lavadoras donde se acumula agua, lo que podría desembocar en la formación de criaderos de mosquitos de dengue, hecho de potencial e inminente riesgo para los vecinos que viven a escasos metros de la zona. Los restos de animales muertos han propiciado que se acerquen otros animales de carroña a la zona, como ratas y perros callejeros. Esto, representa un particular peligro, pues la calle es utilizada con regularidad por transeúntes que realizan caminatas en el área, además de que implica inseguridad para la comunidad de la zona. Por oficio No. MSR-AM-DDUSMA-216-2020 de 30 de septiembre en curso, la municipalidad contestó que el 24 de septiembre del presente año se realizó una inspección a la zona, en la que descubrieron varios botaderos de desechos ubicados a ambos lados de la vía. Reclaman que, pese a dicha contestación, la autoridad municipal dejó por fuera muchas de las peticiones hechas en la denuncia municipal ambiental mencionada, las cuales a la fecha de la interposición del recurso aún no habían sido satisfechas.

Sostienen que lo único que se hizo fue una inspección para tomar fotos, pero no se ha limpiado el área, ni recogido los desechos que hay allí disgregados, ni colocado letreros de "Prohibido lanzar desechos", simplemente se mencionó que esas serían medidas a adoptar luego, al lado de supervisiones mensuales. En igual sentido, acusan que el gobierno local recurrido se negó a notificar o hacer un apercibimiento al dueño del terreno en cuestión, bajo el alegato de que él no es responsable de depositar los residuos en ese lugar. De manera tal que, para ellos, es claro que existe un problema que afecta a la salud y al ambiente, pero las autoridades municipales no han hecho nada para solucionar la situación. Refieren que, en la misma fecha, 18 de setiembre de 2020, interpusieron una denuncia ante el Área Rectora de Salud de San Ramón por las mismas razones manifestadas y solicitaron que se girara una orden sanitaria de recolección de residuos a la Municipalidad de San Ramón, así como ordenarle enviar los residuos a un sitio para su debido tratamiento.

Por oficio No. MS-DRRSCO-DARS-SR-2120-2020 de 6 de octubre en curso, el Área Rectora de Salud de San Ramón, contestó que no le correspondía atender la problemática denunciada, por considerar que el asunto denunciado es de única y exclusiva competencia de gobierno local de San Ramón, y nada más. Reclaman que, a la fecha de interposición del recurso, no se ha atendido el problema. Estiman que lo anterior es violatorio de sus derechos fundamentales. Solicitan que se declare con lugar el recurso, con las consecuencias de ley.

2. Mediante resolución de las 23:11 horas del 02 de diciembre de 2020 se dio curso al presente recurso, lo cual se notificó a los recurridos en fecha 04 de diciembre de 2020.

3. Informan bajo juramento Marvin Quesada Elizondo, en su condición de director a. i. del Área Rectora de Salud San Ramón y director regional de la Rectoría de la Salud Central Occidente, ambas del Ministerio de Salud (folio 55 del expediente electrónico), que tal y como se contestó a los denunciantes, la gestión fue trasladada a la Oficina de Gestión Ambiental de la Municipalidad de San Ramón, en virtud que la problemática denunciada es competencia de esa institución y se les facilitó el número telefónico de dicha dependencia. Añaden que se confirmó con la entidad municipal que se atendió la denuncia y que se tomarán medidas para atender la problemática ambiental denunciada. Solicitan se desestime el recurso planteado.

4. Informa bajo juramento Oria Cecilia Ruiz Murillo, en su condición de vicealcaldesa primera, sustituyendo al alcalde de San Ramón (folio 102 del expediente electrónico), que la denuncia de los recurrentes fue atendida con la realización de actividades de limpieza -con el apoyo de instituciones y grupos comunales- y se recomendó efectuar nuevas limpiezas y rotular la zona. Explican que se trata de un fundo privado al que se accede por un camino solitario, lo que se presta para que las personas utilicen el terreno como botadero; independientemente de los programas de recolección de residuos sólidos, las campañas de reciclaje y la existencia de un centro de transferencia de residuos. Afirman que la rotulación se solventará en el 2021, pues este año no se cuenta con presupuesto para atender dicha situación. Consideran que no se ha omitido ningún deber, pues se han realizado limpiezas y recolecciones en la zona dentro del ámbito competencial de la corporación, y que de lo actuado se ha informado a los denunciantes. Añaden que tampoco se ha lesionado el principio de coordinación interinstitucional, pues se comunicó al Ministerio de Salud las acciones tomadas en relación al tema. Solicita se desestime el recurso planteado.

5. Por constancia extendida el 14 de diciembre de 2020, la Secretaría de la Sala Constitucional, hace constar que el jefe de Servicios Municipales Ambientales de la Municipalidad de San Ramón no presentó escrito o documento alguno, a fin de rendir el informe que se le solicitó en el auto inicial del amparo (folio 135 del expediente electrónico).

6. Informa bajo juramento Allan Francisco Artavia Jiménez, en su condición de coordinador del Área de Servicios Municipales Ambientales de la Municipalidad de San Ramón, y lo hace en el mismo sentido que la vicealcaldesa primera de San Ramón.

7. En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Garro Vargas; y,

Considerando:

I.Objeto del recurso. Los recurrentes consideran lesionados sus derechos fundamentales pues acusan que no se ha atendido en forma íntegra, por parte de las autoridades recurridas, la denuncia planteada desde el 18 de setiembre de 2020 por la existencia de un botadero clandestino.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

Municipalidad de San Ramón a) El 18 de setiembre de 2020, los recurrentes denunciaron ante la Municipalidad de San Ramón la presencia de un gran botadero clandestino de desechos ubicado en Dirección01 (folios 13 y 109 del expediente electrónico).

  • b)Por oficio No. MSR-AM-DDUSMA-216-2020 de 30 de septiembre en curso, la municipalidad contestó que el 24 de septiembre del presente año se realizó una inspección a la zona, en la que descubrieron varios botaderos de desechos ubicados a ambos lados de la vía, y que se estarán tomando las siguientes disposiciones: “1. Efectuar nuevamente una limpieza en esta área, con el propósito de recoger y disponer adecuadamente los deshechos que allí se hayan depositado ilegalmente. 2. Mantener una supervisión mensual del área, para identificar posibles nuevos botaderos clandestinos. 3. Colocar nuevamente rotulación preventiva en el sitio. 4. Solicitar el apoyo de los habitantes más próximos al lugar, con el objetivo de que puedan informar cuando ingresen vehículos a depositar residuos al lugar” (folios 37 y 122 del expediente electrónico).
  • c)Por oficio MSR-AM-DDU-SMA-2233-2020, de 06 de octubre de 2020, el jefe de Servicios Municipales Ambientales respondió la gestión del Ministerio de Salud, informando lo actuado por la corporación municipal (folio 129 del expediente electrónico).

Área Rectora de Salud de San Ramón d) El 18 de setiembre de 2020, los recurrentes denunciaron ante el Área Rectora de Salud de San Ramón la existencia de un gran botadero clandestino de basura (folios 25, 62 y 88 del expediente electrónico).

  • e)Por oficio No. MS-DRRSCO-DARS-SR-2120-2020 de 06 de octubre en curso, el Área Rectora de Salud de San Ramón contestó indicando que la denuncia fue trasladada a la oficina de Gestión Ambiental de la Municipalidad de San Ramón (mediante oficio MS-DRRSCO-DARS-SR-2116-2020, de la misma fecha), que es la entidad competente, e incluyó el número telefónico de dicha dependencia (folios 42, 96 y 100 del expediente electrónico).

III.Sobre el Derecho Fundamental a un Ambiente Sano y Ecológicamente Equilibrado. En reiteradas ocasiones este Tribunal ha desarrollado el contenido de este derecho, contemplado en el artículo 50 de la Constitución Política. La protección del ambiente es un mecanismo adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los Poderes Públicos sobre los factores que pueden alterar su equilibrio y obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano. El Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. En este sentido, el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado, por lo que tratándose de la protección ambiental, las funciones de rectoría, control y fiscalización de la materia ambiental, corresponden al Estado, a cargo de las diversas dependencias administrativas. En resumen, se ha desarrollado ampliamente el derecho fundamental a la salud y a un ambiente sano y ecológicamente equilibrado, así como la obligación del Estado y las distintas autoridades públicas de preservar, defender y garantizar dicho derecho (véase la sentencia N°2006-005928).

IV.Sobre el caso concreto. En el presente asunto, los recurrentes acusan omisión de las autoridades recurridas en atender la problemática ambiental denunciada mediante gestiones de 18 de setiembre de 2020. Acusan que, si bien su trámite fue respondido, no se han desplegado todas las actuaciones posibles para resolver el problema que ocasiona el basurero clandestino denunciado. Después de analizar los elementos probatorios aportados, este Tribunal verifica la lesión a los derechos de las partes amparadas. De los informes rendidos bajo fe de juramento y del elenco de hechos -probados y no probados-, se desprende que la denuncia planteada por los recurrentes fue atendida por las autoridades recurridas, sin embargo, no se logra acreditar que se haya dado una solución integral a la problemática acusada en dicha gestión. Se constata que las autoridades municipales realizaron una inspección en el sitio y determinaron las acciones a seguir (véase el hecho probado b), sin que conste ninguna acción posterior tendente a brindar una solución definitiva a la problemática denunciada.

Es claro, entonces, que la situación persiste y no han dado ninguna solución concreta. El gobierno local tiene potestad para responsabilizar a las personas que depositan basura en el lugar y también a quienes cohonestan con la situación (es decir, puede y debe llamar a cuentas al dueño del inmueble). Claramente, las acciones adoptadas han sido insuficientes para resolver la problemática denunciada. Dicho de otro modo, se constata que se verificó la existencia del basurero clandestino y no consta que se hayan implementado medidas concretas para resolver dicha situación. En lo que respecta a las autoridades sanitarias, se comprueba que estas remitieron la denuncia de los accionantes a la municipalidad, pero a pesar de haber sido impuestos de un problema persistente, de esta naturaleza y que claramente puede afectar la salud pública; no tomaron ninguna medida al respecto. En este contexto, se impone advertir que no le corresponde a este Tribunal determinar cuál es la alternativa que se debe adoptar para solucionar los problemas denunciados, ya que esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones de la Administración, de modo que no le compete determinar si las medidas adoptadas se ajustan o no a la normativa legal o reglamentaria vigente, labor propia de la vía común, administrativa o jurisdiccional.

Sin embargo, se impone recordar a las autoridades recurridas su obligación de verificar o descartar la existencia de la problemática denunciada, y de ser necesario, de resolver de manera definitiva y coordinada dicha situación. Este Tribunal ha reconocido que uno de los principios rectores de la organización administrativa lo constituye la coordinación que debe mediar entre todos los entes y órganos públicos al ejercer sus competencias y prestar los servicios que el ordenamiento jurídico les ha asignado. La coordinación, en cuanto asegura la eficiencia y eficacia administrativas, es un principio constitucional virtual o implícito que permea el entero ordenamiento jurídico administrativo y obliga a todos los entes públicos; puede ser interorgánica -entre los diversos órganos que conforman un ente público no sujetos a una relación de jerarquía- o intersubjetiva -esto es, entre los entes públicos, cada uno con personalidad jurídica, presupuesto propio, autonomía y competencias específicas-; y tiene por propósito evitar las duplicidades y omisiones en el ejercicio de las funciones administrativas de cada ente público, esto es, que sean desempeñadas de forma racional y ordenada (véase, al efecto, la sentencia Nº 2007-015218, entre otras).

A juicio de esta Sala, en la especie nos encontramos ante un problema sanitario grave que afecta al medio ambiente y la salud de los habitantes de la comunidad, y se constata que las autoridades accionadas han mostrado incapacidad para hacer cumplir las leyes en la materia y su obligación de garantizar el disfrute de los habitantes de la zona a un ambiente sano y ecológicamente equilibrado, con las consecuencias para la salud de esas personas debido a la naturaleza del problema sanitario que les aqueja. En reiterada jurisprudencia la Sala ha dicho que no se puede aceptar que a los seres humanos se les niegue el derecho a un ambiente sano, el derecho a la salud, debido a la incapacidad de las autoridades públicas correspondientes para ejercer efectivamente las potestades de vigilancia y la solución a los problemas otorgadas por ley. No basta con programar a meses plazo la realización de inspecciones o consultar a los vecinos si están conformes con que se realicen dichas inspecciones.

Ambas autoridades poseen suficientes y variadas competencias para asegurar el cumplimiento de sus funciones. Sin embargo, a pesar de conocer de larga data la problemática denunciada, las pocas acciones que han desplegado no han sido suficientes para resolver la problemática ambiental denunciada. La persistencia del problema demuestra que las pocas acciones realizadas han sido claramente insuficientes, incurriendo así en responsabilidad por omisión en el ejercicio de esas potestades que, a su vez, lesionan el derecho constitucional de los administrados a que les presten servicios públicos eficientes y eficaces. En razón de lo anterior, procede declarar con lugar el recurso, a fin que tanto la Municipalidad accionada como el Ministerio de Salud, coordinen entre sí y ejerzan las acciones necesarias para darle una solución efectiva a dicha problemática.

V. NOTA DE LA MAGISTRADA HERNÁNDEZ LÓPEZ RESPECTO DEL RECLAMO POR INFRACCIÓN DEL ARTÍCULO 50 DE LA CONSTITUCIÓN POLÍTICA

1. El contexto histórico que motivó en su momento la amplia intervención de la Sala en materia ambiental, ha tenido una considerable variación que impone a este órgano reconsiderar las condiciones para su participación en el aseguramiento del derecho de las personas a un ambiente sano y equilibrado, tal y como ha sido tutelado en el artículo 50 de la Constitución Política. En efecto, la situación actual –caracterizada por una amplísima producción legal y reglamentaria que incluye reglas de fondo, procedimientos y creación de órganos para el cumplimiento de lo ordenado en la Carta Fundamental- es radicalmente diferente de la anterior, en la cual la ausencia de normativa y de instancias estatales con competencia apropiada, le impuso a la Sala un papel de protagonista, casi único, en la defensa del precitado derecho constitucional.

2. Hoy en día, nos encontramos frente a un “denso entramado” de normativa ambiental, lo cual ha producido dos fenómenos relevantes: el primero y más obvio, es el surgimiento de una abarcadora regulación jurídica respecto de actividades cuya incidencia en el ambiente estaba poco o nada ordenada, así la creación de órganos estatales con potestades de vigilancia y control sobre los efectos de la actividad humana en el entorno. El segundo fenómeno consiste en que esa creciente juridificación –predominantemente legislativa y reglamentaria– trae aparejada una ineludible entrada en escena tanto de la justicia administrativa como de la jurisdicción ordinaria -prioritariamente la contencioso administrativa, pero también la penal. En ellas, acorde con la importancia del derecho ambiental, se han regulado de forma amplia vías procesales y medios de legitimación incluyentes, de manera que los administrados puedan hacer valer lo establecido en ese amplio orden jurídico que se relaciona con el tema ambiental.

3. En ese contexto, no resulta apropiado jurídicamente, ni desde el punto de vista funcional, que la Sala Constitucional desplace, o -peor aún- sustituya, a los órganos de justicia ordinarios en la realización de su tarea, también de rango constitucional, de velar por el efectivo cumplimiento de leyes y reglamentos. Es impropio jurídicamente porque en la inmensa mayoría de estos casos lo que se solicita es que interprete y haga valer normas legales y reglamentarias con lo que arriesga traslapar sus competencias con las de otros órganos jurisdiccionales que –ellos sí- han sido creados para ejecutar tales tareas; y resulta también funcionalmente incorrecto, porque el diseño de sus procesos se aviene mal con la complejidad que está presente en numerosos conflictos ambientales que se componen de series de hechos y actos técnica y jurídicamente complejos. Sobre ambas cuestiones existen conocidos ejemplos en los que la Sala ha arrojado una resolución a medias o técnicamente incompleta, o bien se han generado fricciones innecesarias y afectación de la seguridad jurídica.

4. Como parte de los aspectos técnicos que he valorado, añado que está el hecho de que esta jurisdicción no cuenta con jueces ejecutores de sentencia que permitan darle seguimiento adecuado a las mismas -generalmente complejas-, que implican en ocasiones el seguimiento de planes remediales, entre otros, con coordinación interinstitucional y seguimiento de meses y hasta años.

5. Desde esa perspectiva, la decisión de dar un paso al lado en la materia ambiental por parte de este Tribunal no debe ser vista como un abandono de la materia ambiental, sino al contrario, de su adecuada tutela en la instancia que mejor se aviene a la naturaleza de su complejidad y diversidad. Asimismo tampoco debe ser visto como la declinación de esta instancia en su tarea de protección de los derechos constitucionales que le imponen la Constitución Política y su Ley Orgánica, que desde mi punto de vista, queda reservada en esta materia para casos específicos. Se trata más bien, de un ejercicio de reacomodo de las cargas y tareas que corresponden a los distintos órganos estatales, de manera que cada uno de ellos, pueda desplegar plenamente su labor dentro del ámbito que se le ha asignado, así como del ejercicio de fijar su propia competencia, según lo establece el artículo 7 de su Ley Orgánica.

6. Queda claro que la Sala no se plantea abandonar a otras jurisdicciones la labor de protección de los derechos de las personas en materia ambiental. Es conocido que si bien todo reclamo por infracción de normas legales y reglamentarias puede ser reconducido hasta el ámbito constitucional, existen casos cuya resolución no exige más que la aplicación del derecho de la Constitución. Se trata entonces de lograr que la Sala se convierta en protagonista junto con otros, de manera que –entre todos y cada uno en su espacio- se pueda cubrir toda la variedad de situaciones que presenta una protección del derecho a un medio ambiente sano y equilibrado dentro de una sociedad en la que también existen otras necesidades igual de acuciantes. Con esta posición creo firmemente que el ciudadano no pierde un ápice de protección pero se gana sustancialmente en amplitud, en perspectiva y en respeto al equilibrio y distribución de poderes, principio este último de obligada consideración, puesto que rige la dinámica constitucional de cualquier sistema liberal y democrático como el nuestro.- 7.

En línea con lo anterior, sostengo que esta Sala debe abstenerse de conocer los reclamos que se le presenten por supuesta infracción al artículo 50 de la Constitución Política para dejar en manos de la justicia administrativa y la jurisdicción contenciosa administrativa su conocimiento. Lo anterior se deja afirmado con carácter general, sin perjuicio de reconocer la existencia de casos particulares o grupos de casos que, según mi criterio, si resultarían aún mejor tutelados por esta Sala y por tanto deben ser conocidos y resueltos por ella.- Dentro de tales grupos de casos, y sin que esta enunciación pueda considerarse como una lista cerrada y definitiva, puedo señalar que la Sala debe reservarse el conocimiento de situaciones como por ejemplo los reclamos por infracciones ambientales que además pongan en riesgo directo la salud de las personas, o el acceso o calidad del agua; los casos de violaciones groseras y directas al ambiente y en los cuales se constate una palmaria ausencia de la protección por parte de las autoridades estatales, siempre y cuando además la naturaleza del reclamo permita ser abordado mediante el instrumento del amparo como instituto procesal sumario y especial, ya que estimo que tampoco se debe “ordinariar” el amparo para abordar, aún en estos casos citados, temas que rebasen la capacidad de ser atendidos adecuadamente en el mismo.

En el caso concreto, de conformidad con los hechos probados, el reclamo de la parte recurrente, podría eventualmente incidir en la salud e integridad física de los vecinos de la comunidad de Dirección01 en San Ramón por la existencia de un botadero clandestino de desechos en dicha localidad. En consecuencia, es claro que estamos ante las excepciones que mencionan y por esa razón he considerado necesario que la Sala ejerciera su competencia, para comprobar o descartar si las omisiones señaladas, vulneran los derechos fundamentales de las personas amparadas.

VI. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que los recurrentes acusan que no se ha atendido en forma íntegra, por parte de las autoridades recurridas, la denuncia planteada desde el 18 de setiembre de 2020 por la existencia de un botadero clandestino de desechos ubicado en Dirección01, al oeste del barrio ramonense conocido como Las Lomas, en el distrito de Piedades Norte, cantón San Ramón, Alajuela, que pone en peligro a quienes transitan la zona. Lo anterior, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.

VII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. En consecuencia, se ordena lo siguiente: 1) A Oria Cecilia Ruiz Murillo y a Allan Francisco Artavia Jiménez, en su condición de vicealcaldesa primera y de coordinador del Área de Servicios Municipales Ambientales, ambos de la Municipalidad de San Ramón, o a quienes ocupen esos cargos, realizar las acciones que se encuentren dentro del ámbito de sus competencias para que cumplan lo siguiente: a) En el plazo de un mes, contado a partir de la notificación de esta sentencia, se disponga la recolección de los desechos existentes en el terreno denunciado; b) En el plazo de tres meses, contado a partir de la notificación de esta sentencia, de forma efectiva se elimine el riesgo que para el ambiente y la salud pública representa la acumulación de desechos sólidos en el inmueble denunciado por los amparados, así como regular la actividad de acopio que allí se presenta. 2) Se ordena a Marvin Quesada Elizondo, en su condición de director a. i. del Área Rectora de Salud San Ramón y director regional de la Rectoría de la Salud Central Occidente, ambos del Ministerio de Salud o a quien ocupe esos cargos, lo siguiente: a) Vigilar el efectivo cumplimiento por parte de la Municipalidad de San Ramón de lo antes ordenado, debiendo tomar las medidas administrativas que correspondan dentro de sus competencias legales; b) Rendir mensualmente un informe a esta Sala de las actuaciones del ayuntamiento recurrido hasta el efectivo cumplimiento de lo aquí dispuesto.

Se les advierte que de no acatar la orden dicha, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y a la Municipalidad de San Ramón al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
