Amparo proceeding (recurso de amparo) filed by ALEJANDRA TERCERO SEGURA, identity card 0112400152, AND OTHERS, against the MINISTERIO DE SALUD, EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA), AND LA MUNICIPALIDAD DE MONTES DE OCA.

Findings (Resultando):

  1. 1By means of the brief added to the digital case file at 09:58 hours on 9 de octubre de 2020, Alejandra Tercero Segura and others filed an amparo proceeding against the Ministerio de Salud, the Instituto Costarricense de Acueductos y Alcantarillados (ICAA), and the Municipalidad de Montes de Oca. They explained that, for years, the respondent authorities have failed to resolve the problem of sewage surfacing on Calle Radial La Cosecha and Calle C. They asserted that applications have been filed in this regard; however, they have not been addressed because none of the respondent institutions has assumed its corresponding responsibility. They stated that the paving work performed by the Consejo Nacional de Vialidad -CONAVI- on Radial La Cosecha had to be suspended due to the sewage outbreak. They state that, in order to continue the work, CONAVI required the Municipalidad to correct the problem, but the effort was unsuccessful.They explained that, during work previously performed by the respondent municipal entity, an aqueduct that was not in operation and that crossed Calle C de Alma Máter was opened, causing the water to surface through the inspection chambers that had been built for when the aqueduct became operational and that, until then, had remained sealed. Specifically, they state that on 4 de noviembre del 2013, a letter signed by local resident María Castro Chaves was submitted to the Ministerio de Salud, in which she expressed her concern regarding sewage emerging in front of her home. For their part, on 10 de febrero de 2014, area residents sent another letter referring to the previous one because that ministry had failed to respond. Thereafter, on 16 de febrero de 2014, 2 inspectors from the Ministerio de Salud appeared at the site and conducted a test at Mrs. María Castro’s home to rule out the possibility that the sewage spill originated from that structure; they stated that they would return to conduct the test at 4 additional homes.That inspection produced the following results: “They stated that Mrs. María Castro was in compliance with the law, while they required the owner of the house adjacent to Mrs. Castro’s home to construct a septic tank and ordered the owner of the Gran Casa Universitaria to have the septic tank cleaned periodically.” They stated that in 2018, a new sewage spill occurred on Radial La Cosecha. On that occasion, the Municipalidad and the Ministerio de Salud required residents whose properties fronted Radial La Cosecha to construct and place septic tanks into operation; however, the front area of many of those homes proved insufficient for the drainage area required by a septic tank. Consequently, the water discharged from the septic tanks seeped through the granular material beneath the sidewalk and street, continuously surfacing on Radial La Cosecha, or Calle La Cosecha, from which it flowed onto Calle C, located at a lower elevation.Thus, while CONAVI was carrying out resurfacing work in 2018, it encountered a sewage leak on the eastern side of the radial road, and the work had to be suspended for several months until the Municipalidad de Montes de Oca, which was responsible for correcting the problem, informed CONAVI that it had repaired the sewage outlet. Nevertheless, they asserted that the western side of that radial road, precisely where Calle C is located, remained unattended. On 18 de julio del 2019, the Comité de Vecinos submitted a letter to the Ministerio de Salud explaining that only 4 months after the work had been completed, the sewage problem began developing again on both sides of Radial La Cosecha and extended to Calle C, west of the radial road. They emphasized that in marzo de 2019, the Vicealcalde de Montes de Oca appeared at the site and, together with several residents, verified the situation that had been reported repeatedly.They contend that, after understanding the situation, that official undertook to send a Municipalidad team to address the matter, which never happened. In febrero de 2020, they filed applications with ICAA, the Municipalidad de Montes de Oca, and the Ministerio de Salud, none of which were ever addressed or resolved. They complained that there is currently a depression in the new asphalt surface and that sewage continues to spill onto the surface of the 2 aforementioned streets. Based on the foregoing, they considered that the actions of the respondent authorities violated their fundamental rights. They requested that the amparo proceeding be granted.
  2. 2By order issued at 09:19 hours on 21 de octubre de 2020, the Presidency of the Sala Constitucional admitted the amparo proceeding and served it upon the Alcalde and the Presidente del Concejo, both of the Municipalidad de Montes de Oca, as well as upon the Director del Área Rectora de Salud del Ministerio de Salud en Montes de Oca and the Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados (ICAA).
  3. 3By means of the submission added to the digital case file at 18:01 hours on 26 de noviembre de 2020, Yamilette Astorga Espeleta, Executive President of the Instituto Costarricense de Acueductos y Alcantarillados (ICAA), reported: “(…) Regarding the specific case of sewage flowing onto Calle Radial La Cosecha and Calle C in Urbanización Alma Mater, in Mercedes de Montes de Oca, the Water Collection and Treatment Strategic Business Unit (UEN Recolección y Tratamiento) conducted an on-site inspection, primarily to determine whether there was any particular problem with the sanitary sewer system (alcantarillado sanitario). That UEN forwarded, through memorandum No. DRyT-2020-00302, the report prepared (…) Based on the appellant’s statements and the documentation submitted to the case file, it is evident that there is a serious problem involving the storm sewer system (alcantarillado pluvial) and wastewater (aguas residuales), which the competent institutions—specifically, the Municipalidad de Montes de Oca and Ministerio de Salud—must address and coordinate in order to provide a comprehensive and permanent solution.It is advisable for the Municipalidad, within its regulatory authority over the storm sewer system in the area, to coordinate with CONAVI, which would be responsible for stormwater drainage along national routes, in order to conduct a study of the storm sewer systems, analyzing the number, condition, and capacity of the catch basins (tragantes) existing in the area, as well as the hydraulic capacity of the network, which must comply with the technical standard establishing the maximum hydraulic-depth-to-pipe-diameter ratio. It is likewise recommended that, in coordination with the Ministerio de Salud, the respective sanitary orders (órdenes sanitarias) be issued to eliminate unlawful stormwater connections (…) Regarding the handling of the complaint reportedly filed in febrero 2020, the claimants have submitted no documentary evidence proving that it was filed; they submitted a processing form, but it dates from julio 2019 and lists María Eugenia Rojas Morera, identification number 2-279-908, mobile telephone 88540865, [email protected].The follow-up conducted by AyA’s Dirección de Recolección y Tratamiento established that the request was duly processed and answered through document DRyT-OMSR-2019-00473 (attached), dated 26 de julio de 2019, by Eng. William Leninger Sancho, following an inspection conducted on 25 de julio del 2019, and that the applicant was duly notified by email, all of which is demonstrated by the attached documentation (…) the storm sewer system is under the responsibility of the Municipalidad de Montes de Oca. A solution must be found for the stormwater drainage system that simultaneously relieves the sewage system, so that both operate independently and without affecting or interfering with one another. It bears emphasizing that, pursuant to Article 83 of the Código Municipal, the Local Government is responsible for—and charges the corresponding fee for—the cleaning, maintenance, and proper operation of the storm sewer network, which, if it collapses due to lack of maintenance, may affect sanitation generally and the sanitary sewer network.The Municipalidad de Montes de Oca is indeed required to ensure that its jurisdiction has an adequate storm sewer system because that matter falls within its authority; all the more so, it is responsible for ensuring that properties within its jurisdiction comply with the regulations in force, so that neighboring lots are not affected by runoff (escorrentía) or by the vulnerability of their land, or, worse still, that the physical, material, and environmental integrity of surrounding properties is not compromised by the lack of stabilization works or stormwater disposal systems (…) responsibility for the storm sewer system rests with the Municipalidad de Montes de Oca and with the Ministerio de Salud, as the entities responsible for ensuring, through inspections or the corresponding sanitary orders, the proper operation and disposal of community residents’ wastewater into the septic tanks (tanques sépticos) of each home, thereby preventing a pollution problem.THE FACTS DESCRIBED ARE CAUSED BY THE PROPERTY OWNERS’ FAILURE TO MAKE PROPER USE OF SEPTIC TANKS; THOSE OWNERS ARE, IN TURN, UNLAWFULLY CONNECTED TO THE STORM SEWER SYSTEM, WHICH WAS NOT BUILT TO RECEIVE WASTEWATER (…) The problem in this community arises because some residents, without any authorization and in violation of the laws in force, have connected wastewater from their homes to the roadside drains instead of directing it to septic tanks and drainage fields (drenajes). Because this water has no outlet, it saturates the roadways to the point that it surfaces, affecting their own homes, their neighbors’ homes, and the health of everyone involved. Although it is true that, pursuant to its Ley Constitutiva, AyA is responsible for resolving all matters related to the supply of drinking water and the collection and discharge of wastewater, it must also be understood that AyA cannot technically or financially resolve every problem involving the unlawful disposal of wastewater by the residents of a residential development themselves, as is the case with the problem that has arisen in the community of Montes de Oca. de Ciruelas.In keeping with the foregoing, the regulations established in Article 287 of the Ley General de Salud cannot be disregarded; that provision establishes the responsibility of each owner of a residence or business to have a system for disposing of their own wastewater in places where no operational sanitary sewer system is available (…) In this particular case, it is clear that a sanitary sewer network was planned, but technically it cannot be used, because that development or those developments should have been approved with septic tanks and drainage fields, and the works should have been accepted at the proper time by the Municipalidad. Under no circumstances may it be presumed or intended that wastewater may be discharged into the curbside gutters, thereby themselves causing the environmental pollution and harm to health now alleged. To address such unlawful acts, a coordinated procedure has been developed in practice among the Municipalidad, the Ministerio de Salud, and AyA.Under that procedure, before these discharges are eliminated, residents are notified and given a period in which to disconnect the bypasses (“bypass”) and dispose of their wastewater through individual systems, such as a septic tank system and its respective drainage fields. Once that period has expired, the corresponding sealing is performed. This procedure and the granting of a period to residents are carried out in this manner to respect the due process (debido proceso) to which every citizen is entitled (…) In support of the preceding point and pursuant to Article 286 of the Ley General de Salud, the Ministerio de Salud has the authority to order the construction of drainage works to prevent the formation of unsanitary conditions and sources of infection (…) the Ministerio de Salud has a legal mechanism through which it may compel, by means of a sanitary order, the owners of properties in residential developments to rehabilitate, reconstruct, or, if necessary, even build their respective septic tanks and drainage fields (…) it is clear that, from the outset of construction, those homes are presumed to have been approved with a wastewater treatment system consisting of a septic tank plus a drainage field, which, when properly used, provides adequate treatment and prevents environmental pollution and public-health problems.But when the requirements are breached, the improper practice arises of connecting to planned sanitary sewer networks or curbside gutters in order to avoid, in this case, the costs of septic-tank maintenance, thereby causing their own health problem while transferring the environmental-pollution problem to third parties so that others must resolve it for them (…) At the appropriate time, the Municipalidad was responsible for verifying noncompliance with the technical and legal regulations in force concerning those matters. It bears emphasizing that the Local Government has constitutional authority over land-use planning (Ordenamiento Territorial) and, accordingly, is responsible for verifying that what is built conforms to the approved plans. It must not authorize construction in highly vulnerable areas without an adequate soil study, in areas prone to flooding or even landslides that therefore should not support any construction posing a risk or danger to their owners or third parties. From that standpoint, the Municipalidad, as the entity responsible for land-use planning, bears an enormous responsibility for preventing situations that place a community at risk (…)”.
  4. 4By means of the submission added to the digital case file at 20:47 hours on 28 de octubre de 2020, Marcel Soler Rubio, Mayor of the Municipalidad de Montes de Oca, explained: “(…) Within the scope of the Municipalidad de Montes de Oca’s authority, the action taken was to forward the corresponding complaint to the Ministerio de Salud in 2018 (…) Johnny Barrios and Gustavo Lara state that they did in fact conduct an on-site inspection (they did not meet with any of the residents) and that a sewage problem does indeed exist. This year, we met with officials from the Ministerio de Salud and discussed the sewage problem in the area. At that meeting, it was stated that the Municipalidad was fully willing to provide work crews and that we were merely awaiting notice from the Ministerio de Salud as to when it would intervene (…) Since 2018, the Municipalidad de Montes de Oca has forwarded the complaint in this case to the Ministerio de Salud, and we are currently awaiting notice from the Ministerio de Salud of the dates on which the respective work will begin (…) In view of the foregoing, it has been demonstrated that, within the scope of its authority, the Municipalidad de Montes de Oca has cooperated with the Ministerio de Salud regarding the situation reported by the appellants since 2018.Furthermore, it is important to recall that Articles 287, 288, and 289 of the Ley General de Salud clearly establish the obligation of property owners to provide for the proper disposal of excreta, sewage, and graywater (aguas servidas). The Municipalidad de Montes de Oca has at no time violated any right of the appellants herein (…)”.
  5. 5By means of the submission added to the digital case file at 11:54 hours on 29 de octubre de 2020, Mauricio Antonio Salas Vargas, Secretary of the Concejo Municipal de Montes de Oca, informed the Sala Constitucional of the resolution adopted by the Concejo Municipal de Montes de Oca at ordinary session No. 26-2020, through which it approved the report submitted by the presiding officer of that body, stating that resolving the underlying problem falls within the authority of the municipal administration.
  6. 6By means of the submission added to the digital case file at 09:22 hours on 29 de octubre de 2020, the Acting Secretary of the Constitutional Chamber certified that there is no record that, from 26 al 28 de octubre de 2020, the Director of the Montes de Oca Governing Health Area of the Ministry of Health filed any submission or document for the purpose of providing the report ordered from him.
  7. 7The legal requirements have been observed in the proceedings conducted.

Justice Araya García writes the opinion; and,

Whereas:

I.Subject matter of the appeal. The appellants asserted that, despite the complaints filed, the Municipalidad de Montes de Oca, the Ministerio de Salud, and the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) have not resolved the problem of improper wastewater (aguas residuales) disposal in the area of radial La Cosecha and calle C, Alma Máter.

II.Preliminary matter. Because the Director of the Montes de Oca Governing Health Area of the Ministry of Health failed to provide the report ordered in the initial ruling in these proceedings, the facts concerning that official are deemed true, and the amparo appeal (recurso de amparo) is decided as required by law, based on the evidence contained in the case file.

III.Preliminary clarification. Before analyzing the merits of the matter, it must be clarified that, since judgment No. 2008-02545 at 08:55 hours on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those matters involving disputes as to whether the Public Administration has complied with the reasonably established time limits for deciding requests submitted by individuals subject to the Administration, in light of the provisions of article 41 of the Political Constitution. The specific case presents an exception, because it concerns the alleged delay in implementing the solution to a wastewater-channeling problem that endangers the lives, physical integrity, and health of local residents. In view of the foregoing, the Chamber proceeds to decide the specific situation raised in this appeal.

IV. Proven facts. The following facts are deemed duly established and relevant to the decision in this matter

IV.A.- Regarding the Montes de Oca Governing Health Area of the Ministry of Health.

On 4 de noviembre de 2013, María Castro Chaves filed a complaint with the Montes de Oca Governing Health Area of the Ministry of Health concerning sewage (aguas negras) contamination on calle 3 in Barrio Alma Mater, 3 blocks north and 25 meters west of súper La Cosecha (see the evidence submitted by the appellants and added to the digital case file).

On 10 de febrero de 2014, several local residents renewed the complaint before the Directorate of the Montes de Oca Governing Health Area of the Ministry of Health (see the evidence submitted by the appellants and added to the digital case file).

On 16 de febrero de 2014, officials from the Montes de Oca Governing Health Area appeared at María Castro Chaves’s residence to conduct an inspection; that day, they stated that they would return later to perform the corresponding tests at the remaining properties (see the filing initiating the amparo appeal and the evidence submitted by the appellants and added to the digital case file).

On 19 de febrero de 2014, María Castro Chaves complained to the Directorate of the Montes de Oca Governing Health Area of the Ministry of Health that the officials had not returned; she reiterated that the problem persisted (see the evidence submitted by the appellants and added to the digital case file).

On 18 de julio de 2019, María Eugenia Rojas Morera, President of the Comité de Vecinos Alma Mater Calle C, submitted a new request for intervention to the Directorate of the Montes de Oca Governing Health Area of the Ministry of Health concerning sewage that continued to seep through the pavement at radial La Cosecha, Urbanización Alma Mater (see the evidence submitted by the appellants and added to the digital case file).

IV.B.- Regarding the Instituto Costarricense de Acueductos y Alcantarillados (ICAA).

On 18 de julio de 2019, María Eugenia Rojas Morera, President of the Comité de Vecinos Alma Mater Calle C, filed a complaint with the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) concerning the aforementioned sewage seepage; she designated the email address [email protected] for receipt of notices (see the evidence submitted by the appellants, as well as the report provided by the Executive President of ICAA, which were added to the digital case file).

On 26 de julio de 2019, in an email sent to [email protected], ICAA replied to María Eugenia Rojas as follows: “(…) I am hereby attaching a letter containing the results of the inspection conducted at the site by our technical supervisors. I also wish to inform you that the case was forwarded, with a copy, to the Montes de Oca Governing Health Area for appropriate action (…)”. In official letter No. DRyT-OMSR-2019-00473, attached to the email, the Head of Op. and Maint. of ICAA’s RyT Collection System explained: “(…) Greetings. We hereby inform you that an inspection was conducted at the site (at Radial La Cosecha, on calle Alma Mater C) on 25 de julio del 2019, and water was found surfacing on the public roadway (…) It should be noted that AyA does not have a sanitary sewer system (Red de Alcantarillado Sanitario) on this road. It is estimated that this water may be coming from the private drainage systems of the neighboring properties. Accordingly, the case is hereby referred to the Ministry of Health for appropriate action (…)” (see the evidence submitted by the Executive President of ICAA and added to the digital case file).

By official letter No. DRyT-DSRT-2020-00107 of 31 de marzo de 2020, the Head of ICAA’s Department of Development and Investigation of RyT Collection and Treatment Systems informed the Environmental Management Office of the Municipalidad de Montes de Oca as follows: “(…) • The sanitary sewer network of Urb. Alma Mater is considered a ‘planned network’ (red prevista), since it has no outlet at its lower end. • Because it is being used irregularly by the residents, the wastewater that the homes discharge into this network ultimately emerges at various points along the street precisely because the network has no outlet. • AyA, through the Proyecto de Mejoramiento Ambiental para San José, is aware of this situation and has included in its work program the interconnection of this development’s network with the existing operational sanitary sewer system; however (sic), several rights-of-way easements (servidumbres de paso) had to be purchased in order to carry out the work, which required considerable time and resources. • Although the easement issue has now been resolved, according to information provided by the Unidad Ejecutora del Proyecto de Mejoramiento Ambiental, the interconnection of this development is currently awaiting approval of new funding, since the financing required to undertake the necessary civil works is presently unavailable. • During the time required to develop the interconnection works, and with a view to eliminating the existing public-health hazard at the site, the proposal is to ‘plug’ the sanitary sewer network and require the homes at the site to resume using septic tanks and drainage systems as the only authorized means of disposing of domestic wastewater. • In order to proceed with this plugging, and in accordance with due process (debido proceso), the Montes de Oca Governing Health Area must inform and notify the residents of the development that use of septic tanks is mandatory and grant them a period of time to repair or construct, as applicable, their own septic-tank and drainage systems before AyA proceeds to close the planned sanitary sewer network. • As a matter of legality, AyA would not plug the network until it has first carried out, jointly with MINSA, the notification and time-limit due process applicable to this type of situation. • To that end, it is considered necessary for the Environmental Management Office of the Municipalidad de Montes de Oca to coordinate between MINSA and AyA so that the residents of the development may be notified as soon as possible (…)” (see the evidence submitted by the Executive President of ICAA and added to the digital case file).

Through official letter No. DRyT-DSRT-2020-00184 of 16 de junio de 2020, the Head of ICAA’s Department of Development and Investigation of RyT Collection and Treatment Systems informed the Montes de Oca Governing Health Area of the Ministry of Health as follows: “(…) Greetings. I hereby wish to bring to your office’s attention a wastewater spill occurring in Distrito Mercedes of Cantón de Montes de Oca, specifically on calle La Cosecha, 300 meters north of Gimnasio del Este. There is a sanitary sewer network in this area that is currently disabled because it has no outlet or interconnection with operational collection systems. Consequently, local residents are not authorized by AyA to use it; rather, the only approved means of disposing of domestic wastewater is through septic tanks and their respective drainage systems. Several homes in the area are currently connected to this sanitary sewer network, and because it has no outlet, the network has filled with wastewater, which has begun to emerge through the asphalt surface, thereby affecting the health of the neighborhood’s own residents.

AyA has inspected the sanitary sewer network at the site and verified that it is not operational and that the manholes (pozos de registro) in this network are sealed (because it is a planned network), which is presumed to be the reason the water is surfacing directly on the street. Under these circumstances, and in order to resolve the spill on the street, it is considered necessary to request the intervention of the Ministry of Health so that inspections may be conducted inside the homes in this area (See image N°1) to determine which of them are connected to this planned network. The Ministry of Health must then issue Health Orders (Ordenes Sanitarias) requiring those homes to dispose of their wastewater through the only means currently approved, namely septic tanks and their drainage systems (…)” (see the evidence submitted by the Executive President of ICAA and added to the digital case file).

On 21 de octubre de 2020, the initial order in the amparo proceeding (recurso de amparo) was served on the Executive President of ICAA (see the certificate of service included in the digital case file).

Through the technical report dated 22 de octubre de 2020, after conducting an inspection, the Director of Collection and Treatment for the Greater Metropolitan Area of ICAA concluded: “(…) 1. Urbanización Alma Mater is a residential development that does not have an operational sanitary sewer system (red de alcantarillado sanitario); therefore, when the respective entities granted the construction permits for that housing development, the approved wastewater disposal system consisted of septic tanks with their corresponding drainfields for each dwelling. 2. Near the area where Urbanización Alma Mater is located, there is no operational sanitary sewer main (colector sanitario) managed by AyA to which this development could be connected; for that reason, the dwellings were approved with individual systems (septic tanks). 3. When construction of that residential development was authorized, the developer was required to install a planned sanitary sewer network (NOT IN USE) so that, when a sanitary sewer main is built in the future, the streets of the residential development will not have to be disturbed (broken up) to install those systems, thereby expediting the process of connecting the dwellings. 4.

It is absolutely essential that, until there is a sanitary sewer main to which this residential development can be connected, residents continue using the approved septic-tank systems, based on the provisions of the Ley General de Salud in this regard (…) 5. In the particular case of Urbanización Alma Mater, an inspection was conducted and it was determined that the manholes of the planned sanitary sewer system, which is not in use, had been filled with ballast and sand (we do not know by whom); it is therefore presumed that, because of the described burial, no wastewater flows through that sanitary sewer network. In this regard, see photographs N° 1 and 2 (…) 6. During the inspection, it was established that some residents are not properly disposing of their wastewater through septic-tank systems and instead discharge their wastewater into the curb-and-gutter channel or directly onto the sidewalks.

As the water flows downhill, it affects other dwellings that do properly use their septic-tank systems. See photographs N° 3, 4, 5, 6, 7 and 8 (…) Based on the inspection conducted, the main point at which wastewater surfaces is located in front of the dwelling shown in Photograph N° 9, where a constant outflow of water can be seen on the sidewalk itself (as detailed in Photograph N°6.). The surfacing on the sidewalk is aligned with the main spill point on the street (…) In addition to the foregoing, one possible explanation for what is occurring at the site is that the dwellings located along Calle La Cosecha may not have adequate and sufficient drainfields in their individual treatment systems, causing their effluent to ‘drain’ improperly toward the sidewalk and the street itself. This, together with the steep slope observed at the site, may be causing wastewater to surface at various points along the street, the main one being located in front of the dwelling shown in Photograph N°9 (…) 7.

Likewise, during the inspection it was not possible to verify illegal connections to the stormwater system managed by the Municipality of that canton or to the sanitary sewer network managed by AyA, since both networks are located beneath the asphalt surface. Nevertheless, cuts were observed in the sidewalks of certain dwellings, suggesting the existence of illegal connections to one of the two systems that may be causing this type of spill. In this regard, the Ley General de Salud provides (…) 8. As part of the coordination processes that must prevail among State-owned public utilities in order to resolve problems such as those caused by the residents of this Urbanización through their improper actions relating to inadequate wastewater disposal, the Instituto Costarricense de Acueductos y Alcantarillados has taken steps before the Municipalidad de Montes de Oca and the Área Rectora de Salud of that canton so that, in their respective capacities as Local Government and Health Regulatory Authority, they will promote corrective measures and order residents who have made illegal connections to remove them.

The foregoing is evidenced by the attached Official Letters N° DRyT-DSRT-2020-00184 and DRyT-DSRT-2020-00107. Accordingly, and pursuant to the foregoing, the residents of that Urbanización must cease the improper practice of discharging wastewater from their dwellings onto the sidewalks and into the curb-and-gutter channel, because through their own improper actions they are causing pollution and affecting other dwellings that operate properly using individual systems (septic tanks). It is also advisable for the Municipalidad de Montes de Oca, in its capacity as Local Government, to coordinate with the Área Rectora de Salud so that dye tests are conducted at all dwellings for the purpose of identifying possible improper connections to the stormwater sewer system or, alternatively, determining whether wastewater is infiltrating onto the sidewalks and consequently into the street. After conducting the respective tests and determining which residents are improperly discharging their wastewater illegally, health orders (órdenes sanitarias) must be issued (Ley General de Salud artículos 320 y 321) for those dwellings that are violating the Ley General de Salud, in order to prevent contamination of other dwellings that properly use their septic tanks.

With respect to AyA, as stated above, the sanitary sewer network located in Urbanización Alma Mater was built by the developer of that residential development but was not placed in operation; therefore, it is physically impossible to connect it to an operational sewer main managed by AyA. To resolve this and other similar cases, AyA is developing the Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José, which provides for the construction of extensions to sewer mains and submains that will facilitate the connection of this and other nearby urbanizaciones. Although the designs for that project are at an advanced stage, arrangements must still be made to finance part of these works, and efforts to that end are currently underway. In the following image, the proposed route of the pipelines under the Proyecto de Mejoramiento Ambiental is shown in light blue; these pipelines are intended to connect Urbanización Alma Mater to the operational systems in the future (…)” (see the evidence submitted by the Executive President of ICAA and included in the digital case file).

IV.C.- Regarding the Municipalidad de Montes de Oca.

On 10 de julio de 2018, the Municipalidad de Montes de Oca informed the Área Rectora de Salud de Montes de Oca of the Ministerio de Salud of the following problem occurring in the area where the protected parties reside: “(…) the existence of sanitary wastewater pipes from neighboring dwellings connected (sic) to drains in the public right-of-way, evidencing illegal connections and discharges into a well that empties into quebrada Sabanilla (…)” (see the evidence submitted by the Mayor of the Municipalidad de Montes de Oca and included in the digital case file).

On undetermined dates, in response to the information provided by the Municipalidad, the Ministerio de Salud issued various health orders (see the report and evidence submitted by the Mayor of the Municipalidad de Montes de Oca and included in the digital case file).

V.Unproven fact. The following fact, which is relevant to resolving this matter, is deemed not to have been established: sole fact.- that the petitioners or any other resident of the locality affected by the problem filed any other complaint with the Ministerio de Salud, the Municipalidad de Montes de Oca, or the Instituto Costarricense de Acueductos y Alcantarillados (ICAA).

VI.Regarding the Instituto Costarricense de Acueductos y Alcantarillados (ICAA). The established facts show that the complaint filed by María Eugenia Rojas Morera, President of the Comité de Vecinos Alma Mater Calle C, with the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) on 18 de julio de 2019 was addressed on the following 26 de julio. However, concurrently, in the technical report of 22 de octubre de 2020, after conducting an inspection, the Director de Recolección y Tratamiento GAM of ICAA concluded: “(…) 1. Urbanización Alma Mater is a residential development that does not have an operational sanitary sewer system (red de alcantarillado sanitario); therefore, the system approved by the respective entities for wastewater disposal (disposición de las aguas residuales), when the construction permits for that residential development were granted, consisted of septic tanks and the corresponding drainage system for each dwelling. 2.

Near the sector where Urbanización Alma Mater is located, there is no operational sanitary sewer collector (colector sanitario) administered by AyA to which this development could be connected; for that reason, the dwellings were approved with individual systems (septic tanks). 3. When construction of that residential development was authorized, the developer was required to install a planned sanitary sewer network (NOT IN USE), so that when a sanitary sewer collector is built in the future, the streets of the development will not have to be disturbed (broken up) to install those systems, thereby expediting the process of connecting the dwellings. 4. It is absolutely essential that, until there is a sanitary sewer collector to which this development can be connected, the residents continue using the approved septic-tank systems, based on the provisions of the Ley General de Salud in this regard (…) 5.

In the specific case of Urbanización Alma Mater, an inspection was conducted, and it was determined that the manholes (pozos de registro) of the planned sanitary sewer system that is not in use had been filled with ballast and sand (we do not know by whom); it is therefore presumed that, because of the described sediment accumulation, no wastewater flows through that sanitary sewer network. In this regard, see photographs N° 1 and 2 (…) 6. During the inspection, it was established that some residents are not properly disposing of their wastewater through septic-tank systems and are discharging it into the curb-and-gutter channel (cordón de caño), or directly onto the sidewalks; as that water flows downhill, it adversely affects other dwellings that do properly use their septic-tank systems. See photographs N° 3, 4, 5, 6, 7 and 8 (…) According to the inspection, the principal point at which wastewater surfaces is located in front of the dwelling shown in Photograph N° 9, where a constant outflow of water can be seen on the sidewalk itself (as detailed in Photograph N°6.).

The direction of that surfacing on the sidewalk coincides with the principal point of spillage onto the street (…) In addition, one possible explanation for what is occurring at the site is that the dwellings located along calle La Cosecha may not have adequate and sufficient drainage systems as part of their individual treatment systems, causing their effluent to ‘drain’ improperly toward the sidewalk and the street itself. This, together with the steep slope observed at the site, could be causing wastewater to surface at different points along the street, the principal one being located in front of the dwelling shown in Photograph N°9 (…) 7. Similarly, the inspection did not reveal any illegal connections to the storm-sewer network (red pluvial) administered by the Municipalidad de ese cantón or to the sanitary sewer network administered by AyA, because both networks are located beneath the asphalt surface.

Nevertheless, cuts were observed in the sidewalks of some dwellings, suggesting that illegal connections exist to one of the two systems and may be causing this type of spillage (…) 8. As part of the coordination processes that must prevail among State-owned public utilities in order to solve problems such as those caused by the residents of this development through their improper actions related to inadequate wastewater disposal, the Instituto Costarricense de Acueductos y Alcantarillados has made representations to the Municipalidad de Montes de Oca and the Área Rectora de Salud de ese cantón so that, in their respective capacities as Local Government and Health Regulatory Authority, they may promote corrective measures and order the residents who have made illegal connections to remove them. (…) Based on the foregoing and as indicated above, the residents of that development must cease the improper practice of discharging wastewater from their dwellings onto the sidewalks and into the curb-and-gutter channel, because their own improper conduct is causing pollution and adversely affecting other dwellings that operate correctly through individual systems (septic tanks).

It is also advisable for the Municipalidad de Montes de Oca, in its capacity as Local Government, to coordinate with the Área Rectora de Salud so that dye tests (pruebas de coloración) may be performed in all dwellings to identify possible irregular connections to the storm-sewer system or, alternatively, to determine whether wastewater is infiltrating toward the sidewalks and, consequently, toward the street. After performing the respective tests and determining which residents are engaging in the improper practice of illegally discharging their wastewater, health orders (órdenes sanitarias) must be issued (Ley General de Salud artículos 320 y 321) for those dwellings that are violating the Ley General de Salud, in order to prevent pollution affecting other dwellings that properly use their septic tanks. As regards AyA, as previously stated, the sanitary sewer network located in Urbanización Alma Mater was built by the developer of that residential development but was not placed into operation; therefore, it is physically impossible to connect it to an operational collector administered by AyA.

To address this case and other similar cases, AyA is developing the Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José, which provides for the construction of extensions to collectors and subcollectors that will facilitate the connection of this and other nearby developments. Although the designs for that project are at an advanced stage, steps must still be taken to obtain financing for part of these works, and efforts are currently being made in that regard. In the following image, the proposed route of the pipelines under the Proyecto de Mejoramiento Ambiental is shown in light blue; these pipelines would connect Urbanización Alma Mater to the operational systems in the future (…)” (emphasis not in the original). It is therefore clear that the source of the problem reported by the petitioners is apparent illegal connections that cause wastewater to overflow. In this regard, the Presidenta Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados (ICAA) emphasized in her report: “(…) there is a serious problem concerning the storm-sewer system and wastewater that the competent institutions, specifically the Municipalidad de Montes de Oca and Ministerio de Salud, must address and coordinate in order to provide a comprehensive and permanent solution.

It is advisable for the Municipalidad, within the scope of its regulatory authority over the storm-sewer system in the area, to coordinate with CONAVI, which would be responsible for storm drainage along national routes, in order to conduct a study of the storm-sewer systems, analyzing the number, condition, and capacity of the existing storm drains (tragantes) in the area, as well as the hydraulic capacity of the network, which must comply with the technical standard establishing the maximum hydraulic-depth value relative to the pipe diameter. It is likewise recommended that, in coordination with the Ministerio de Salud, the corresponding health orders be issued to eliminate the illegal stormwater connections (…) THE FACTS DESCRIBED ARE DUE TO THE PROPERTY OWNERS’ FAILURE TO MAKE PROPER USE OF SEPTIC TANKS; THOSE OWNERS ARE, IN TURN, ILLEGALLY CONNECTED TO THE STORM-SEWER SYSTEM, WHICH WAS NOT BUILT TO RECEIVE WASTEWATER (…)”.

Although, in the report submitted to this Court, the Presidenta Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados (ICAA) attempts to hold the Municipalidad de Montes de Oca and the Ministerio de Salud responsible for the existing problem, she also acknowledged the following: “(…) To address unlawful acts of this kind, a coordinated procedure has been developed in practice among the Municipalidad, the Ministerio de Salud, and AyA, under which, before these discharges are eliminated, notice is sent to the residents and they are given a period in which to disconnect the ‘bypasses’ and dispose of their wastewater through individual systems, such as a septic-tank system and its corresponding drainage systems. Once that period has expired, the corresponding sealing is performed. This procedure and the granting of a period to the residents are carried out in this manner to respect the due process (debido proceso) to which every citizen is entitled (…)” (emphasis not in the original).

Consistent with the foregoing, in official letter No. DRyT-DSRT-2020-00107 of 31 de marzo de 2020, the Jefe del Departamento de Desarrollo e Inv. Sistemas Recol. y Tratamiento RyT del Instituto Costarricense de Acueductos y Alcantarillados (ICAA) informed the Oficina de Gestión Ambiental de la Municipalidad de Montes de Oca: “(…) • AyA, through the Proyecto de Mejoramiento Ambiental para San José, being aware of this situation, has included in its work program the connection of this development’s network to the existing operational sanitary sewer system. Nevertheless (sic), carrying out the works required the purchase of several rights-of-way (servidumbres de paso), which took considerable time and resources. • Although the rights-of-way issue has now been resolved, according to information provided by the Unidad Ejecutora del Proyecto de Mejoramiento Ambiental, the connection of this development is currently awaiting approval of new funding, because the financing required to carry out the necessary civil works is not currently available. • For the period required to develop the connection works, and with a view to eliminating the existing public-health impact at the site, it is proposed that the sanitary sewer network be ‘plugged’ and that the dwellings at the site be required to resume using septic tanks and drainage systems as the sole authorized means of disposing of household wastewater.

• That, in order to proceed with this sealing (taponamiento), in accordance with due process (debido proceso), the Área Rectora de Salud de Montes de Oca must inform and notify the residents of the urbanización about the mandatory use of a septic tank (tanque séptico) and grant them a period of time to repair or construct, as applicable, their own septic-tank and drainage systems, before AyA proceeds to close the planned sanitary sewer network (red sanitaria). • That, as a matter of legality, AyA would not seal the network without first carrying out, jointly with MINSA, the notification and time-period due process applicable to these types of situations. • That, for this purpose, it is deemed necessary for the Oficina de Gestión Ambiental de la Municipalidad de Montes de Oca to coordinate between MINSA and AyA so that the residents of the urbanización may be notified as soon as possible (…)” (emphasis not in the original). Consequently, ICAA bears a share of responsibility for the fact that the illegal connections and wastewater (aguas residuales) seepage are still occurring; moreover, its actions are necessary for the problem to be resolved provisionally while the project to which it refers is completed.

VII.Regarding the Área Rectora de Salud de Montes de Oca of the Ministerio de Salud. In the case at bar (sub lite), it was fully demonstrated that local residents filed the respective complaints with the Área Rectora de Salud de Montes de Oca of the Ministerio de Salud on November 4, 2013, February 10 and 19, 2014, and July 18, 2019. Additionally, the Municipality of Montes de Oca brought the problem to the attention of the respondent agency on July 10, 2018, as did the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) on June 16, 2020. In light of the foregoing, it appears that, according to the appellants themselves and the Mayor of the Municipality of Montes de Oca, officials from the Área Rectora de Salud de Montes de Oca of the Ministerio de Salud conducted inspections and issued sanitary orders (órdenes sanitarias). Despite the foregoing, the problem has not been resolved.

VIII.Regarding the Municipality of Montes de Oca. Although it was not established in this matter that the appellants had filed a complaint directly with the Municipality of Montes de Oca regarding the wastewater channeling (canalización de aguas residuales) problem described above, the fact remains that the Municipal Corporation became aware of it in 2018 and brought it to the attention of the Ministerio de Salud for appropriate action. Now, given its position as guarantor of local interests and services, pursuant to Article 169 of the Constitución Política and the provisions of constitutional case law (jurisprudencia constitucional), the Municipality of Montes de Oca cannot disregard the situation affecting local residents and simply place all responsibility on the Ministerio de Salud. Without question, it was required to maintain much more diligent oversight and coordination among the various competent authorities.

IX.Conclusion. In view of the foregoing, the appeal must be granted, with the consequences specified in the operative portion (parte dispositiva) of this judgment.

X.Note by Justice Salazar Alvarado. As a matter of principle, I believe that cases concerning action or inaction by the Public Administration (Administración Pública) in the repair, construction, modification, or demolition of any infrastructure project must be dismissed, because such an omission raises an issue of legality whose adjudication falls within the ordinary jurisdiction (jurisdicción ordinaria), before which the interested person may address their objections more fully. However, when such administrative conduct, whether by omission or otherwise, results in a violation of other fundamental rights protected under this constitutional jurisdiction (jurisdicción constitucional), or affects groups considered vulnerable, I do address the merits of the matter, because this constitutes an exception to my position on this subject, as is the case here, where the appellants allege that the respondent authorities have failed to definitively resolve a wastewater channeling problem that endangers the life, health, and physical integrity of the residents of Urbanización Alma Mater.

XI.Documentation submitted to the case file (expediente). The parties are hereby advised that any paper document, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, must be retrieved from the court within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on May 3, 2012, Article LXXXI.

Por tanto:

The appeal is granted. The person holding the position of Director of the Área Rectora de Salud de Montes de Oca of the Ministerio de Salud, as well as Marcel Soler Rubio and Yamilette Astorga Espeleta, in their respective capacities as Mayor of the Municipality of Montes de Oca and Executive President of the Instituto Costarricense de Acueductos y Alcantarillados (ICAA), or whoever may serve in those capacities, are ordered to undertake all actions within the scope of their authority and coordinate as necessary so that, within SIX MONTHS from notification of this judgment, the wastewater seepage (filtración de las aguas residuales) problem in the area of calle radial La Cosecha and calle C, Alma Máter, is resolved, and the complainants are notified of the measures ordered. They are warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding (recurso de amparo) that they are required to comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.

The State, the Municipality of Montes de Oca, and the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) are ordered to pay the legal costs, damages, and losses caused by the events underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative-law jurisdiction (contencioso administrativo). *200186000007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las catorce horas cinco minutos del diez de diciembre de dos mil veinte .

Recurso de amparo interpuesto por ALEJANDRA TERCERO SEGURA, cédula de identidad 0112400152, Y OTROS, contra el MINISTERIO DE SALUD, EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA), Y LA MUNICIPALIDAD DE MONTES DE OCA.

Resultando:

  1. 1Por medio del escrito agregado al expediente digital a las 09:58 horas de 9 de octubre de 2020, Alejandra Tercero Segura y otros, presentaron un recurso de amparo en contra del Ministerio de Salud, el Instituto Costarricense de Acueductos y Alcantarillados (ICAA), y la Municipalidad de Montes de Oca. Explicaron las autoridades recurridas han omitido, por años, solucionar el problema de afloramiento de aguas negras que salen en la Calle Radial La Cosecha y en calle C. Adujeron que se han incoado gestiones al respecto; sin embargo, las mismas no han sido atendidas, pues, ninguna de las instituciones accionadas han asumido la responsabilidad que les atañe. Indicaron que el trabajo de asfaltado realizado por el Consejo Nacional de Vialidad -CONAVI- en la radial La Cosecha, debió suspenderse debido al brote de aguas negras. Para continuar con las obras, indican que el CONAVI requirió a la Municipalidad corregirlo, pero, el resultado no fue exitoso.Expusieron que en un trabajo ejecutado con anterioridad por parte del ente municipal accionado, se habilitó un acueducto que no estaba en operación y que cruzaba a la Calle C de Alma Máter, generando que esas aguas afloraran por la previstas que se habían construido para cuando estuviera en operación el acueducto y, que hasta ese momento, estuvieron selladas. En concreto, mencionan que el 4 de noviembre del 2013, se entregó ante el Ministerio de Salud una carta firmada por la vecina María Castro Chaves, quien manifestó su preocupación por la salida de aguas negras frente a su casa de habitación. De su parte, el 10 de febrero de 2014, vecinos de la zona remitieron otra misiva, haciendo alusión a la anterior, debido a la falta de respuesta de esa cartera. Posterior a eso, el 16 de febrero de 2014, se apersonaron al sitio 2 inspectores del Ministerio de Salud, quienes realizaron una prueba en la casa de la señora María Castro con el fin de descartar que el problema de derrame de aguas negras proviniera de esa estructura, e indicaron que regresarían para realizar la prueba en 4 casas más.Esa inspección tuvo los siguientes resultados: “Manifestaron que la Sra. María Castro se encontraba a derecho en tanto que solicitaron a la propietaria de la casa vecina a la de la señora Castro, la construcción de un tanque séptico y ordenaron al propietario de la Gran Casa Universitaria realizar limpiezas periódicas del tanque séptico”. Indicaron que para el año 2018, hubo un nuevo derrame de aguas negras sobre la Radial La Cosecha. En esa oportunidad, la Municipalidad y el Ministerio de Salud obligaron a los vecinos con inmuebles frente a la Radial La Cosecha, a construir y poner en operación tanques sépticos; empero, resultó que el área frontal de muchas de esas viviendas era insuficiente para el área de drenaje que requiere un tanque séptico, razón por la cual, el agua que sale de los tanques sépticos se filtró a través del material granular de la acera y de la calle, aflorando continuamente en la Radial o calle La Cosecha de donde escurren a la Calle C, que se ubica en un punto más bajo.De esa forma, mientras el CONAVI efectuaba obras de recarpeteo en el año 2018, se encontró con una fuga de aguas negras en el costado este de la radial, con lo que el trabajo debió suspenderse por varios meses, hasta que la Municipalidad de Montes de Oca, encargada de corregir el problema, indicó al CONAVI que ya había reparado la salida de aguas negras. No obstante, adujeron que quedó pendiente de atención el costado oeste de dicha radial, que es precisamente donde se ubica la Calle C. El 18 de julio del 2019, el Comité de Vecinos presentó una nota ante el Ministerio de Salud explicando que apenas 4 meses después de realizados los trabajos, comenzó de nuevo a gestarse el problema de aguas negras a ambos costados de la Radial La Cosecha, tema que se extendió a la Calle C, hacia el oeste de la Radial. Destacaron que para el mes de marzo de 2019, se apersonó al sitio el Vicealcalde de Montes de Oca, quien junto con algunos vecinos constató la situación que había sido expuesta en repetidas ocasiones.Ese funcionario, esgrimen, al comprender la situación, se comprometió a enviar un equipo de la Municipalidad para atender el caso; lo que nunca sucedió. Para el mes de febrero de 2020, plantearon gestiones ante el ICAA, la Municipalidad de Montes de Oca y el Ministerio de Salud, mismas que nunca fueron atendidas ni resueltas. Actualmente, reclamaron, hay un hundimiento en la nueva carpeta asfáltica y el derrame de aguas negras continúa en la superficie en las 2 calles mencionadas. Con base en lo aludido, estimaron que con la actuación de las autoridades recurridas, fueron lesionados sus derechos fundamentales. Solicitaron que se declare con lugar el recurso.
  2. 2Mediante el auto de las 09:19 horas de 21 de octubre de 2020, la Presidencia de la Sala Constitucional admitió el recurso de amparo y le dio traslado al Alcalde, al Presidente del Concejo, ambos de Municipalidad de Montes de Oca, así como al Director del Área Rectora de Salud del Ministerio de Salud en Montes de Oca, y al Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados (ICAA).
  3. 3Mediante el escrito agregado al expediente digital a las 18:01 horas de 26 de noviembre de 2020, Yamilette Astorga Espeleta, Presidenta Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados (ICAA), informó: “(…) Respecto al caso concreto de aguas negras que salen en la Calle Radial La Cosecha y en calle C Urbanización Alma Mater en Mercedes de Montes de Oca, se procedió a realizar una inspección en el lugar, por parte de la UEN Recolección y Tratamiento, sobre todo para verificar si se daba algún problema especial con el alcantarillado sanitario, dicha UEN remite mediante memorando No. DRyT-2020-00302, el informe realizado (…) De lo indicado por el recurrente y según la documentación aportada al expediente se evidencia, que existe una seria problemática en relación con el alcantarillado pluvial y las aguas residuales que deben resolver y coordinar las instituciones competentes, precisamente la Municipalidad de Montes de Oca y Ministerio de Salud, para dar una solución integral y permanente.Es recomendable que la Municipalidad, dentro de su competencia normativa del alcantarillado pluvial en la zona, coordine con CONAVI que sería el responsable del pluvial en rutas nacionales, a efectos de realizar un estudio de los sistemas de alcantarillado pluvial, analizando el número, el estado y la capacidad de los tragantes existentes en la zona, así como la capacidad hidráulica de la red, que debe ser acorde con la norma técnica que establece valor máximo del tirante hidráulico del diámetro de la tubería. Igualmente se recomienda que en coordinación con el Ministerio de Salud se giren las órdenes sanitarias respectivas para eliminar las conexiones ilícitas de aguas pluviales (…) En lo que respecta a la atención de la denuncia que se cita fuera presentada en febrero 2020, se indica que los actores no presentan prueba documental que así lo demuestre, aportan una boleta de trámite pero la misma es de julio 2019, donde se indica a María Eugenia Rojas Morera, cédula 2-279-908, celular 88540865, [email protected], y del seguimiento realizado en la Dirección de Recolección y Tratamiento del AyA, se determinó que a dicha solicitud se le dio trámite correspondiente y se contestó mediante el documento DRyT-OMSR-2019-00473 (adjunto) de fecha 26 de julio de 2019 por parte del Ing. William Leninger Sancho, luego de una inspección realizada el 25 de julio del 2019, y que fue debidamente notificada mediante correo electrónico a la solicitante, todo lo cual se demuestra con la documentación adjunta (…) el alcantarillado pluvial se encuentra bajo responsabilidad de la Municipalidad de Montes de Oca.Se debe buscar una solución respecto al sistema de evacuación de aguas pluviales que al mismo tiempo libere el sistema de aguas negras, para que ambos funcionen de manera independiente y sin afectación o interferencia entre uno y otro. Recalcando que de acuerdo con lo que establece el Código Municipal en su artículo 83 es obligación del Gobierno Local, y; para ello cobra la tasa correspondiente, tanto la limpieza como el mantenimiento y adecuada operación de la red pluvial, que al colapsar por falta de mantenimiento puede afectar el saneamiento en general y la red sanitaria. Efectivamente, la Municipalidad de Montes de Oca es la obligada a velar porque en su jurisdicción se cuente con un adecuado alcantarillado pluvial por ser un asunto de su competencia, pero con mayor razón es la responsable, de velar porque los terrenos en su jurisdicción, cumplan con la normativa vigente, de manera que predios vecinos no se vean afectados por la escorrentía o por la vulnerabilidad de sus terrenos, o peor aún, que por no contar con obras de estabilización o disposición de aguas pluviales, se altere la integridad física, material y ambiental de los predios circunvecinos (…) es responsabilidad de la Municipalidad de Montes de Oca el alcantarillado pluvial y del Ministerio de Salud, como entes encargado de velar a través de inspecciones u ordenes sanitarias correspondientes, para el correcto funcionamiento y disposición de las aguas residuales de los vecinos de la comunidad hacia los tanques sépticos de cada vivienda y así evitar un problema de contaminación.LOS HECHOS QUE SE DETALLAN OBEDECEN A LA FALTA DE UTILIZACIÓN DEBIDA DE TANQUE SÉPTICO POR PARTE DE LOS PROPIETARIOS, QUIENES A SU VEZ SE ENCUENTRAN CONECTADOS DE FORMA ILICITA AL ALCANTARILLADO PLUVIAL QUE NO ESTA CONSTRUIDO CON LA FINALIDAD DE RECIBIR AGUAS RESIDUALES (…) El problema en esta comunidad responde a que algunos vecinos, sin ninguna autorización y al margen de las leyes vigentes, han conectado las aguas residuales provenientes de sus viviendas a los caños en lugar de dirigirlas hacia el tanque séptico y drenajes. Esta situación hace que esas aguas por no tener salida saturen las vías hasta el extremo de que las aguas llegan a salir, afectando con sus propias viviendas, las de los vecinos y la salud de todos los involucrados. Que, si bien es cierto, de acuerdo con su Ley Constitutiva, le corresponde al AyA resolver todo lo relacionado con el suministro de agua potable y la recolección y evacuación de las aguas residuales, debe también ser entendido que para el AyA no es posible resolver técnica, ni financieramente todos los problemas de disposición ilegales de aguas residuales que realizan los mismos vecinos de una urbanización, tal como es el caso de la problemática suscitada en la comunidad de Montes de Oca. de Ciruelas.Que, en apego a lo anterior, no puede obviarse la normativa establecida en la Ley General de Salud en su artículo 287, en el que se señala la responsabilidad de cada propietario de vivienda o comercio a contar con un sistema de disposición para sus propias aguas residuales en aquellos lugares en donde no se cuente con el sistema de alcantarillado sanitario en funcionamiento (…) En el caso particular, es claro que existe red prevista de alcantarillado sanitario, pero la misma técnicamente no puede ser utilizada, pues ese desarrollo o desarrollos, debieron haber sido aprobados con sistema de tanque séptico y drenajes y en su oportunidad haber existido recibo de obras por parte de la Municipalidad, y en ningún momento, se puede presumir, ni pretender lanzar las aguas residuales a los cordones de caño, ocasionando por su propia cuenta el problema de contaminación al ambiente y afectación a la salud que ahora se alega.Que para resolver este tipo de actos ilícitos, en la práctica se ha desarrollado un procedimiento coordinado entre la Municipalidad, el Ministerio de Salud y el AyA, mediante el cual, de previo a proceder a eliminar estos derrames, se remite una notificación a los vecinos y se les brinda un plazo para que desconecten los “ bypass” y dispongan de sus aguas residuales a través de sistemas individuales como lo es por ejemplo el sistema de tanque séptico y sus respectivos drenajes. Una vez vencido ese plazo se procede con el sellado correspondiente. Este procedimiento y el otorgamiento del plazo a los vecinos se realiza de esta manera para respetar el debido proceso al cual tiene derecho todo ciudadano (…) Que en sustento al punto anterior y de conformidad con el artículo 286 de la Ley General de Salud, el Ministerio de Salud tiene la potestad de ordenar la realización de las obras de drenaje mediante las cuales se evite la formación de focos insalubres y de infección (…) el Ministerio de Salud cuenta con una herramienta legal a partir de la cual puede obligar vía orden sanitaria a aquellos propietarios de las urbanizaciones a rehabilitar, reconstruir o en su defecto, hasta construir sus respectivos tanques sépticos y drenajes (…) resulta claro que, desde el inicio de las obras, se presume que esas viviendas fueron aprobadas con un sistema de tratamiento de aguas residuales que corresponde a tanque séptico, más drenaje, el cual utilizado de manera correcta permite dar tratamiento adecuado y evita problemas de contaminación ambiental y de salud pública.Pero si se incumple lo ordenado, se da la mala práctica de conectarse a redes sanitarias previstas o a cordones de caño, buscando evitar los costos en este caso de mantenimiento de tanques sépticos, ocasionando su propio problema de salud y a la vez, trasladando el problema de contaminación ambiental a terceros, para que otros le resuelvan el asunto (…) En su oportunidad la Municipalidad le correspondía verificar el incumplimiento de la normativa técnica y legal vigente en esos aspectos. Se recalca, que el Gobierno Local ostenta a nivel constitucional la potestad en materia de Ordenamiento Territorial, y en ese sentido, le corresponde verificar que lo construido se apegue a lo aprobado en planos, no debe autorizar construcciones en zonas muy vulnerables sin un adecuado estudio de suelos, propensos a inundaciones o incluso derrumbes y que, por tanto, no deberían soportar ninguna construcción, que implique un riesgo o alguna peligrosidad para sus propietarios y para terceros. Desde ese punto de vista la Municipalidad como encargado del Ordenamiento Territorial tiene una enorme responsabilidad para evitar situaciones de riesgo para una comunidad (…)”.
  4. 4Mediante el escrito agregado al expediente digital a las 20:47 horas de 28 de octubre de 2020, Marcel Soler Rubio, Alcalde de la Municipalidad de Montes de Oca, explicó: “(…) Dentro de las competencias de la Municipalidad de Montes de Oca, las acciones que se realizaron fue enviar la denuncia correspondiente al Ministerio de Salud, desde el 2018 (…) Indican los señores Johnny Barrios y Gustavo Lara que efectivamente ellos realizaron la inspección en el sitio (No se reunieron con ninguno de los vecinos) y que efectivamente existe un problema de aguas negras. Este año nos reunimos con personeros del Ministerio de Salud, donde se tocó el tema del problema de las aguas negras en la zona, en dicha reunión, se indicó que la Municipalidad se encuentra en la mejor disposición de prestar las cuadrillas de trabajadores, encontrándonos a la espera nada más de que el Ministerio de Salud indique cuando va a intervenir (…) la Municipalidad de Montes de Oca, desde el año 2018, envió la denuncia del caso al Ministerio de Salud y en este momento nos encontramos a la espera de que el Ministerio de Salud nos indique las fechas en que se iniciaran los trabajos respectivos (…) En razón de lo anteriormente dentro de sus competencias ha brindado colaboración al Ministerio de Salud, ante la situación que denuncian los recurrentes, desde el 2018.Por otro lado es importante recordar que la Ley General de Salud a tenor de los artículos 287, 288 y 289 establece claramente la obligatoriedad de los propietarios de los inmuebles a tener una disposición adecuada de excretas y de aguas negras y servidas. Siendo que en ningún momento la Municipalidad de Montes de Oca, ha vulnerado ningún derecho a los aquí recurrentes (…)”.
  5. 5Por medio del escrito agregado al expediente digital a las 11:54 horas de 29 de octubre de 2020, Mauricio Antonio Salas Vargas, Secretario del Concejo Municipal de Montes de Oca, puso en conocimiento de la Sala Constitucional, el acuerdo tomado por el Concejo Municipal de Montes de Oca en la sesión ordinaria No. 26-2020, mediante el cual se aprobó el informe rendido por la Presidencia del órgano, en el sentido de que la solución del problema de fondo, es competencia de la Administración municipal.
  6. 6Mediante el escrito agregado al expediente digital a las 09:22 horas de 29 de octubre de 2020, el Secretario a.i. de la Sala Constitucional hizo constar que no aparece que del 26 al 28 de octubre de 2020, el Director del Área Rectora de Salud de Montes de Oca del Ministerio de Salud, haya presentado escrito o documento alguno, con el fin de rendir el informe que se le ordenó.
  7. 7En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Araya García; y,

Considerando:

I.Objeto del recurso. Los recurrentes aseguraron que, pese a las denuncias interpuestas, la Municipalidad de Montes de Oca, el Ministerio de Salud y el Instituto Costarricense de Acueductos y Alcantarillados (ICAA), no han solucionado el problema de mala disposición de aguas residuales, en el sector de la calle radial La Cosecha, y en calle C, Alma Máter.

II.Cuestión preliminar. Dado que el Director del Área Rectora de Salud de Montes de Oca del Ministerio de Salud, omitió rendir el informe que se le ordenó en el auto inicial del presente proceso, se tienen por ciertos los hechos en lo que a dicho funcionario a tañe, y se resuelve el recurso de amparo, conforme a Derecho corresponde, a partir de los elementos de juicio que constan en el expediente.

III.Aclaración previa. Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia No. 2008-02545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute si la Administración Pública ha cumplido o no los plazos razonablemente pautados para resolver las solicitudes planteadas por los administrados a la luz de lo dispuesto por el artículo 41, de la Constitución Política. En el caso concreto, se plantea un supuesto de excepción, pues, se trata de la supuesta tardanza en ejecutar la solución de un problema de canalización de aguas residuales que pone en peligro la vida, integridad y salud de los vecinos del lugar. Atendiendo a lo expuesto, se entra a resolver la situación concreta planteada en este recurso.

IV.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

IV.A.- Sobre el Área Rectora de Salud de Montes de Oca del Ministerio de Salud.

El 4 de noviembre de 2013, María Castro Chaves, presentó ante el Área Rectora de Salud de Montes de Oca del Ministerio de Salud, una denuncia por contaminación con aguas negras en la calle 3 del Barrio Alma Mater, del súper La Cosecha 3 cuadras al norte y 25 metros al oeste (ver la prueba aportada por los recurrentes, agregada al expediente digital).

El 10 de febrero de 2014, varios vecinos de la localidad, reiteraron la denuncia ante la Dirección del Área Rectora de Salud de Montes de Oca del Ministerio de Salud (ver la prueba aportada por los recurrentes, agregada al expediente digital).

El 16 de febrero de 2014, funcionarios del Área Rectora de Salud de Montes de Oca, se apersonaron a la vivienda de María Castro Chaves, con el propósito de realizar una inspección; ese día señalaron que posteriormente regresarían con el fin de efectuar las pruebas correspondientes en los restantes inmuebles (ver el escrito de interposición del recurso de amparo y la prueba aportada por los recurrentes, agregada al expediente digital).

El 19 de febrero de 2014, María Castro Chaves reclamó ante la Dirección del Área Rectora de Salud de Montes de Oca del Ministerio de Salud, que los funcionarios no regresaron; reiteró que la problemática se continuaba presentando (ver la prueba aportada por los recurrentes, agregada al expediente digital).

El 18 de julio de 2019, María Eugenia Rojas Morera, Presidenta del Comité de Vecinos Alma Mater Calle C, presentó ante la Dirección del Área Rectora de Salud de Montes de Oca del Ministerio de Salud, una nueva solicitud de intervención en radial La Cosecha, Urbanización Alma Mater, por aguas negras que continuaban filtrándose por el pavimento (ver la prueba aportada por los recurrentes, agregada al expediente digital).

IV.B.- Sobre el Instituto Costarricense de Acueductos y Alcantarillados (ICAA).

El 18 de julio de 2019, María Eugenia Rojas Morera, Presidenta del Comité de Vecinos Alma Mater Calle C, presentó ante el Instituto Costarricense de Acueductos y Alcantarillados (ICAA), una denuncia por la filtración de aguas negras apuntada; señaló como medio para recibir notificaciones la dirección electrónica [email protected] (ver la prueba aportada por los recurrentes, así como el informe rendido por la Presidenta Ejecutiva del ICAA, agregados al expediente digital).

El 26 de julio de 2019, mediante un correo electrónico enviado a la dirección [email protected] , el ICAA contestó a María Eugenia Rojas, lo siguiente: “(…) Por este medio adjunto nota del resultado de la inspección realizada por nuestros jefes técnicos en el lugar. Además deseo informarle que el caso fue enviado con copia al Área Rectora de Salud de Montes de Oca para que se proceda según corresponda (…)”. En el oficio No. DRyT-OMSR-2019-00473, adjunto al correo electróncio, el Encargado de Op. Y Mant. Del Sistema de Recolección RyT del ICAA, vez de (sic) le informa que el día 25 de julio del 2019, se realiza inspección en el lugar (De la Radial La Cosecha, en la calle Alma Mater C), encontrando un afloramiento de agua en la vía pública (…) Cabe mencionar que en esta vía el AyA, no cuenta con Red de Alcantarillado Sanitario. Se estima que estas aguas pueden venir de los drenajes privados de las propiedades aledañas. Conforme a lo anterior, por este medio se le traslada el caso al Ministerio de Salud, para que se proceda según corresponde (…)” (ver la prueba aportada por la Presidenta Ejecutiva del ICAA, agregada al expediente digital).

Mediante el oficio No. DRyT-DSRT-2020-00107 de 31 de marzo de 2020, el Jefe del Departamento de Desarrollo e Inv. Sistemas Recol. y Tratamiento RyT del ICAA, comunicó a la Oficina de Gestión Ambiental de la Municipalidad de Montes de Oca, lo siguiente: “(…) • Que la red sanitaria de la Urb. Alma Mater, tiene un carácter de “red prevista” dado que que (sic) la misma no cuenta con ninguna salida en su parte baja. • Al estar siendo usada por los vecinos de forma irregular, las aguas residuales que las casas dirigen a esta red, terminan saliendo en varios puntos de la calle, justamente por el hecho de no tener salida. • Que el AyA, a través del Proyecto de Mejoramiento Ambiental para San José, y siendo conocedor de esta situación, tiene contemplada dentro de su programa de trabajo, la interconexión de la red de esta urbanización al sistema sanitario existente en operación, no obstante (sic), para llevar a cabo las obras fue requerida la compra de varias servidumbres de paso, lo cual tomó bastante tiempo y recursos. • Que aunque el tema de servidumbres actualmente se encuentra superado, de conformidad con información aportada por la Unidad Ejecutora del Proyecto de Mejoramiento Ambiental, la interconexión de esta urbanización en este momento esta a la espera de que se aprueben nuevos fondos económicos, ya que en la actualidad se carece del financiamiento requerido para desarrollar las obras civiles requeridas. • Que durante el tiempo que se tarde el desarrollo de las obras de interconexión,y con miras a eliminar la afectación a la salud pública que existe en el lugar, lo que se propone es que se lleve a cabo un “taponamiento” de la red sanitaria y obligar a las viviendas del sitio a volver a utilizar el tanque séptico y los drenajes como único medio autorizado para la disposición de las aguas residuales domiciliares. • Que para proceder con este taponamiento, de conformidad con el debido proceso, es requerido que el Área Rectora de Salud de Montes de Oca, informe y notifique a los vecinos de la urbanización acerca de la obligatoriedad en el uso del tanque séptico y les otorgue un plazo de tiempo para que los vecinos reparen o construyan según sea el caso sus propios sistemas de tanque séptico y drenajes, antes de que el AyA proceda con el cierre de la red sanitaria prevista. • Que por un tema de legalidad, el AyA no llevaría a cabo el taponamiento de la red sin antes haber desarrollado en conjunto con el MINSA el debido proceso de notificación y de plazo que aplica para este tipo de situaciones. • Que para tal efecto, se estima necesario que la Oficina de Gestión Ambiental de la Municipalidad de Montes de Oca, articule una coordinación entre el MINSA y el AyA, para efectos de que se pueda notificar a los vecinos de la urbanización lo más antes posible (…)” (ver la prueba aportada por la Presidenta Ejecutiva del ICAA, agregada al expediente digital).

Por medio del oficio No. DRyT-DSRT-2020-00184 de 16 de junio de 2020, el Jefe del Departamento de Desarrollo e Inv. Sistemas Recol. y Tratamiento RyT del ICAA, puso en conocimiento del Área Rectora de Salud de Montes de Oca, del Ministerio de Salud, lo siguiente: “(…) Por este medio me permito saludarle y al mismo tiempo hacer del conocimiento de su despacho una situación de derrame de aguas residuales que esta sucediendo en el Distrito Mercedes del Cantón de Montes de Oca, concretamente sobre la calle La Cosecha, 300 metros Norte del Gimnasio del Este. En este sector, existe una red sanitaria la cual en este momento se encuentra deshabilitada ya que la misma no cuenta con ninguna salida o interconexión a sistemas de recolección en operación, razón por la cual los vecinos del lugar no cuentan con autorización por parte del AyA para su uso, siendo que más bien el único medio aprobado para la disposición de las aguas residuales domiciliares es el tanque séptico y sus respectivos drenajes.

Actualmente hay varias viviendas de la zona que se encuentran conectados a este red sanitaria y debido al hecho de que la misma no cuenta con salida alguna, al estar esta red llena de aguas residuales, lo que es esta sucediendo es que las mismas han empezado a brotar a través de la carpeta asfáltica, provocando con ello una afectación a la salud de las mismas personas del barrio. Por parte del AyA, se ha procedido a revisar la red sanitaria del sitio y se ha verificado que la misma se encuentra fuera de operación, siendo que los pozos de registro de esta red se encuentran sellados (por su misma condición de red prevista), lo cual se presume que es la causa de que el agua aflore directamente en la calle. Bajo este escenario y con el ánimo de solucionar esta situación de derrame en la calle, se estima necesario solicitar la intervención del Ministerio de Salud para que se proceda a determinar por medio de inspecciones a lo interno de las viviendas de este sector(Ver imagen N°1), cuales de éstas se encuentran conectadas a esta red prevista, para que posteriormente el mismo Ministerio de Salud, proceda a notificarles Ordenes Sanitarias por medio de las cuales se les obligue a estas viviendas a disponer de sus aguas residuales a partir del único medio aprobado por el momento cuales el uso del tanque séptico y sus drenajes (…)” (ver la prueba aportada por la Presidenta Ejecutiva del ICAA, agregada al expediente digital).

El 21 de octubre de 2020, se notificó a la Presidenta Ejecutiva del ICAA, el auto inicial del recurso de amparo (ver el acta de notificación, agregada al expediente digital).

Mediante el informe técnico de 22 de octubre de 2020, luego de realizar una inspección, el Director de Recolección y Tratamiento GAM del ICAA, concluyó: “(…) 1. La Urbanización Alma Mater es un residencial que no cuenta con red de alcantarillado sanitario en operación, por lo que el sistema aprobado para la disposición de las aguas residuales por parte de las entidades respectivas cuando se otorgaron los permisos de construcción para ese desarrollo habitacional fue el sistema de tanques sépticos más su respectivo drenaje para cada una de las viviendas. 2. En las cercanías del sector donde se ubica la urbanización Alma Mater, no existe con un colector sanitario en operación administrado por el AyA, al cual interconectar este desarrollo, razón por la cual las viviendas se aprobaron con sistemas individuales (tanques sépticos). 3. Cuando se autorizó la construcción de ese residencial, se le solicitó al desarrollador que colocara una red sanitaria prevista (NO EN USO) con el fin de que cuando a futuro se construya un colector sanitario, no se tengan que intervenir (romper) las calles de la urbanización para la instalación de dichos sistemas y agilizar el proceso de interconexión de las viviendas. 4.

Que es definitivamente indispensable, que mientras no exista un colector sanitario al cual se pueda interconectar esta urbanización, los vecinos continúen utilizando el sistema de tanques sépticos aprobados, lo anterior sustentado en lo que al respecto establece la Ley General de Salud (…) 5. En el caso particular de la Urbanización Alma Mater, se realizó una inspección y se determinó que los pozos de registro del sistema de alcantarillado sanitario previsto que no está en uso fueron rellenados de lastre y arena (desconocemos por quien), por lo que se presupone que, por esta situación de aterramiento descrita, por esa red sanitaria no circulan aguas residuales. Al respecto ver fotografías N° 1 y 2 (…) 6. En la inspección realizada, se logró evidenciar que algunos vecinos no están disponiendo sus aguas residuales correctamente mediante sistemas de tanques sépticos y descargan sus aguas residuales al cordón de caño, o directamente a las aceras, agua que, al bajar por la pendiente, provoca la afectación de otras viviendas que si hacen uso correcto del sistema de tanques sépticos de sus viviendas.

Ver fotografías N° 3, 4, 5, 6, 7 y 8 (…) De conformidad con la inspección realizada, se aprecia que el principal punto de afloramiento de aguas residuales se ubica frente a la casa de habitación que se muestra en la Fotografía N° 9, donde se aprecia una salida de aguas constante en la misma acera (conforme se detalla en la Fotografía N°6.). Dicho afloramiento en la acera es coincidente en dirección, con el punto principal de derrame en calle (…) En complemento a lo anterior, una posible explicación a lo que sucede en el sitio es la posibilidad de que las viviendas ubicadas sobre la calle La Cosecha, no cuenten con drenajes adecuados y suficientes en sus sistemas de tratamiento individual y esto hace que el efluente de los mismos “drene” de forma indebida hacia la acera y hacia la misma calle. Esto, aunado a la fuerte pendiente que se observa en el sitio, podría estar ocasionando el afloramiento de aguas residuales en diferentes puntos de la calle, siendo el principal el que se ubica frente a la vivienda mostrada en la Fotografía N°9 (…) 7.

De igual manera en la inspección realizada no se lograron evidenciar conexiones ilegales a la red pluvial administrada por la Municipalidad de ese cantón o a la red sanitaria administrada por el AyA, ya que ambas redes están ubicadas debajo de la carpeta asfáltica, no obstante, se evidenciaron cortes en las aceras de algunas viviendas, que hacen suponer que existen conexiones ilegales en algunos de los dos sistemas que podrían estar provocando este tipo de derrames. Al respecto señala Ley General de Salud (…) 8. Como parte de los procesos de coordinación que deben prevalecer entre las empresas públicas del estado, para solucionar problemas como los que han generado los mismos vecinos de esta Urbanización con sus actuaciones incorrectas relacionadas con la inadecuada disposición de las aguas residuales, el Instituto Costarricense de Acueductos y Alcantarillados ha realizado gestiones ante la Municipalidad de Montes de Oca y ante el Área Rectora de Salud de ese cantón, con el fin de que promuevan acciones correctivas en su condición de Gobierno Local y en su condición de Autoridad Reguladora de la Salud respetivamente, para que conminen a los vecinos que se han conectado ilegalmente a eliminar dichas conexiones.

Lo anterior se evidencia mediante Oficios N° DRyT-DSRT-2020-00184 y DRyT-DSRT-2020-00107 adjuntos. Conforme lo anterior y de acuerdo con lo indicado supra, procede que los vecinos de esa urbanización eliminen la práctica indebida de descargar las aguas residuales de sus viviendas a las aceras y al cordón de caño, ya que ellos mismos con sus actuaciones indebidas, están provocando contaminación y afectando a otras viviendas que si operan correctamente mediante sistemas individuales (tanque séptico). Asimismo, es recomendable que la Municipalidad de Montes de Oca en su condición de Gobierno Local coordine con el Área Rectora de Salud, para que realicen las pruebas de coloración en todas las viviendas con el objetivo de establecer posibles conexiones irregulares al alcantarillado pluvial o en su defecto verificar si existe infiltración de aguas residuales hacia las aceras y por ende hacia la calle.

Después de realizar las pruebas respectivas y determinar cuáles vecinos están realizando la práctica indebida de descargas ilegales de sus aguas residuales, deberán girar ordenes sanitarias (Ley General de Salud artículos 320 y 321) para aquellas viviendas que están incumpliendo la Ley General de Salud, con el fin de evitar la contaminación de otras viviendas que si cumplen con el adecuado uso del tanque séptico. En lo que respecta al AyA, tal como se mencionó anteriormente, la red sanitaria ubicada en la Urbanización Alma Mater es una red que fue construida por el desarrollador de ese residencial pero la misma no quedó en uso, por lo que es materialmente imposible conectarla a un colector en operación administrado por el AyA. Para resolver este caso y otros casos similares, el AyA está desarrollando el Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José, el cual tiene contemplado construir extensiones de colectores y subcolectores que facilitarán la conexión de esta y otras urbanizaciones cercanas.

Dicho proyecto a pesar de que tiene avanzados los diseños aún debe realizar gestiones que permitan financiar parte de estas obras, por lo que actualmente se realizan gestiones en esa dirección. En la siguiente imagen en color celeste, se muestra el trazado de las tuberías propuestas por el Proyecto de Mejoramiento Ambiental para interconectar a futuro la urbanización Alma Mater a los sistemas en operación (…)” (ver la prueba aportada por la Presidenta Ejecutiva del ICAA, agregada al expediente digital).

IV.C.- Sobre la Municipalidad de Montes de Oca.

El 10 de julio de 2018, la Municipalidad de Montes de Oca, puso en conocimiento del Área Rectora de Salud de Montes de Oca del Ministerio de Salud, el siguiente problema que se presenta en el sector donde residente los tutelados: “(…) la existencia de tuberías de aguas sanitarias de las viviendas colindantes conectas (sic) a drenajes en vía pública, que evidencia conexiones ilegales y descargas a un pozo el cual vierte a la quebrada Sabanilla (…)” (ver la prueba aportada por el Alcalde de la Municipalidad de Montes de Oca, agregada al expediente digital).

En fechas indeterminadas, atendiendo a lo indicado por la Municipalidad, el Ministerio de Salud giró diversas órdenes sanitarias (ver el informe y la prueba aportada por el Alcalde de la Municipalidad de Montes de Oca, agregados al

V.Hecho no probado. De importancia para resolver el presente asunto, se estima no demostrado el siguiente hecho: único.- que los recurrentes u algún otro vecino de la localidad afectada por la problemática, haya presentado alguna otra denuncia ante el Ministerio de Salud, la Municipalidad de Montes de Oca, y el Instituto Costarricense de Acueductos y Alcantarillados (ICAA).

VI.Sobre el Instituto Costarricense de Acueductos y Alcantarillados (ICAA). De la relación de hechos probados se desprende que la denuncia formulada por María Eugenia Rojas Morera, Presidenta del Comité de Vecinos Alma Mater Calle C, presentó ante el Instituto Costarricense de Acueductos y Alcantarillados (ICAA), el 18 de julio de 2019, fue atendida el 26 de julio siguiente. Sin embargo, paralelamente, mediante el informe técnico de 22 de octubre de 2020, luego de realizar una inspección, el Director de Recolección y Tratamiento GAM del ICAA, concluyó: “(…) 1. La Urbanización Alma Mater es un residencial que no cuenta con red de alcantarillado sanitario en operación, por lo que el sistema aprobado para la disposición de las aguas residuales por parte de las entidades respectivas cuando se otorgaron los permisos de construcción para ese desarrollo habitacional fue el sistema de tanques sépticos más su respectivo drenaje para cada una de las viviendas. 2.

En las cercanías del sector donde se ubica la urbanización Alma Mater, no existe con un colector sanitario en operación administrado por el AyA, al cual interconectar este desarrollo, razón por la cual las viviendas se aprobaron con sistemas individuales (tanques sépticos). 3. Que es definitivamente indispensable, que mientras no exista un colector sanitario al cual se pueda interconectar esta urbanización, los vecinos continúen utilizando el sistema de tanques sépticos aprobados, lo anterior sustentado en lo que al respecto establece la Ley General de Salud (…) 5.

(…) Conforme lo anterior y de acuerdo con lo indicado supra, procede que los vecinos de esa urbanización eliminen la práctica indebida de descargar las aguas residuales de sus viviendas a las aceras y al cordón de caño, ya que ellos mismos con sus actuaciones indebidas, están provocando contaminación y afectando a otras viviendas que si operan correctamente mediante sistemas individuales (tanque séptico).

Asimismo, es recomendable que la Municipalidad de Montes de Oca en su condición de Gobierno Local coordine con el Área Rectora de Salud, para que realicen las pruebas de coloración en todas las viviendas con el objetivo de establecer posibles conexiones irregulares al alcantarillado pluvial o en su defecto verificar si existe infiltración de aguas residuales hacia las aceras y por ende hacia la calle. Después de realizar las pruebas respectivas y determinar cuáles vecinos están realizando la práctica indebida de descargas ilegales de sus aguas residuales, deberán girar ordenes sanitarias (Ley General de Salud artículos 320 y 321) para aquellas viviendas que están incumpliendo la Ley General de Salud, con el fin de evitar la contaminación de otras viviendas que si cumplen con el adecuado uso del tanque séptico. En lo que respecta al AyA, tal como se mencionó anteriormente, la red sanitaria ubicada en la Urbanización Alma Mater es una red que fue construida por el desarrollador de ese residencial pero la misma no quedó en uso, por lo que es materialmente imposible conectarla a un colector en operación administrado por el AyA.

Para resolver este caso y otros casos similares, el AyA está desarrollando el Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José, el cual tiene contemplado construir extensiones de colectores y subcolectores que facilitarán la conexión de esta y otras urbanizaciones cercanas. Dicho proyecto a pesar de que tiene avanzados los diseños aún debe realizar gestiones que permitan financiar parte de estas obras, por lo que actualmente se realizan gestiones en esa dirección. En la siguiente imagen en color celeste, se muestra el trazado de las tuberías propuestas por el Proyecto de Mejoramiento Ambiental para interconectar a futuro la urbanización Alma Mater a los sistemas en operación (…)” (el énfasis no pertenece al original). Resulta claro, entonces, que el origen del problema denunciado por los recurrentes, son aparentes conexiones ilegales que producen un rebasamiento de las aguas residuales.

Al respecto, en su informe, la Presidenta Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados (ICAA) subrayó: “(…) existe una seria problemática en relación con el alcantarillado pluvial y las aguas residuales que deben resolver y coordinar las instituciones competentes, precisamente la Municipalidad de Montes de Oca y Ministerio de Salud, para dar una solución integral y permanente. Es recomendable que la Municipalidad, dentro de su competencia normativa del alcantarillado pluvial en la zona, coordine con CONAVI que sería el responsable del pluvial en rutas nacionales, a efectos de realizar un estudio de los sistemas de alcantarillado pluvial, analizando el número, el estado y la capacidad de los tragantes existentes en la zona, así como la capacidad hidráulica de la red, que debe ser acorde con la norma técnica que establece valor máximo del tirante hidráulico del diámetro de la tubería.

Igualmente se recomienda que en coordinación con el Ministerio de Salud se giren las órdenes sanitarias respectivas para eliminar las conexiones ilícitas de aguas pluviales (…) LOS HECHOS QUE SE DETALLAN OBEDECEN A LA FALTA DE UTILIZACIÓN DEBIDA DE TANQUE SÉPTICO POR PARTE DE LOS PROPIETARIOS, QUIENES A SU VEZ SE ENCUENTRAN CONECTADOS DE FORMA ILICITA AL ALCANTARILLADO PLUVIAL QUE NO ESTA CONSTRUIDO CON LA FINALIDAD DE RECIBIR AGUAS RESIDUALES (…)”. Aunque en el informe rendido ante este Tribunal, la Presidenta Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados (ICAA), pretenda responsabilizar a la Municipalidad de Montes de Oca y al Ministerio de Salud, por el problema existente, lo cierto es que también aceptó lo siguiente: “(…) Que para resolver este tipo de actos ilícitos, en la práctica se ha desarrollado un procedimiento coordinado entre la Municipalidad, el Ministerio de Salud y el AyA, mediante el cual, de previo a proceder a eliminar estos derrames, se remite una notificación a los vecinos y se les brinda un plazo para que desconecten los “bypass” y dispongan de sus aguas residuales a través de sistemas individuales como lo es por ejemplo el sistema de tanque séptico y sus respectivos drenajes.

Una vez vencido ese plazo se procede con el sellado correspondiente. Este procedimiento y el otorgamiento del plazo a los vecinos se realiza de esta manera para respetar el debido proceso al cual tiene derecho todo ciudadano (…)” (el énfasis no pertenece al original) . En consonancia con lo expuesto, en el oficio No. DRyT-DSRT-2020-00107 de 31 de marzo de 2020, el Jefe del Departamento de Desarrollo e Inv. Sistemas Recol. y Tratamiento RyT del Instituto Costarricense de Acueductos y Alcantarillados (ICAA), comunicó a la Oficina de Gestión Ambiental de la Municipalidad de Montes de Oca: “(…) • Que el AyA, a través del Proyecto de Mejoramiento Ambiental para San José, y siendo conocedor de esta situación, tiene contemplada dentro de su programa de trabajo, la interconexión de la red de esta urbanización al sistema sanitario existente en operación, no obstante (sic), para llevar a cabo las obras fue requerida la compra de varias servidumbres de paso, lo cual tomó bastante tiempo y recursos. • Que aunque el tema de servidumbres actualmente se encuentra superado, de conformidad con información aportada por la Unidad Ejecutora del Proyecto de Mejoramiento Ambiental, la interconexión de esta urbanización en este momento esta a la espera de que se aprueben nuevos fondos económicos, ya que en la actualidad se carece del financiamiento requerido para desarrollar las obras civiles requeridas. • Que durante el tiempo que se tarde el desarrollo de las obras de interconexión, y con miras a eliminar la afectación a la salud pública que existe en el lugar, lo que se propone es que se lleve a cabo un “taponamiento” de la red sanitaria y obligar a las viviendas del sitio a volver a utilizar el tanque séptico y los drenajes como único medio autorizado para la disposición de las aguas residuales domiciliares. • Que para proceder con este taponamiento, de conformidad con el debido proceso, es requerido que el Área Rectora de Salud de Montes de Oca, informe y notifique a los vecinos de la urbanización acerca de la obligatoriedad en el uso del tanque séptico y les otorgue un plazo de tiempo para que los vecinos reparen o construyan según sea el caso sus propios sistemas de tanque séptico y drenajes, antes de que el AyA proceda con el cierre de la red sanitaria prevista. • Que por un tema de legalidad, el AyA no llevaría a cabo el taponamiento de la red sin antes haber desarrollado en conjunto con el MINSA el debido proceso de notificación y de plazo que aplica para este tipo de situaciones. • Que para tal efecto, se estima necesario que la Oficina de Gestión Ambiental de la Municipalidad de Montes de Oca, articule una coordinación entre el MINSA y el AyA, para efectos de que se pueda notificar a los vecinos de la urbanización lo más antes posible (…)” (el énfasis no pertenece al original).

Por consiguiente, el ICAA tiene una cuota de responsabilidad en el hecho que las conexiones ilegales y la filtración de aguas residuales, todavía se estén presentando; además, sus actuaciones son necesarias para que el problema se solucione de forma provisional, mientras se culmina el proyecto al cual hace mención.

VII.Sobre el Área Rectora de Salud de Montes de Oca del Ministerio de Salud. En el sub lite quedó plenamente demostrado que los vecinos de la localidad, presentaron ante el Área Rectora de Salud de Montes de Oca del Ministerio de Salud, las denuncias respectivas el 4 de noviembre de 2013, 10 y 19 de febrero de 2014, así como el 18 de julio de 2019. Adicionalmente, la problemática fue puesta en conocimiento de la dependencia recurrida, por parte de la Municipalidad de Montes de Oca, el 10 de julio de 2018, y por el Instituto Costarricense de Acueductos y Alcantarillados (ICAA), el 16 de junio de 2020. En función de lo expuesto, aparentemente, de acuerdo con lo indicado por los propios recurrentes y el Alcalde de la Municipalidad de Montes de Oca, funcionarios del Área Rectora de Salud de Montes de Oca del Ministerio de Salud, realizaron inspecciones y giraron órdenes sanitarias. Pese a lo descrito, el problema no se ha solucionado.

VIII.Sobre la Municipalidad de Montes de Oca. Si bien en el presente asunto no se acreditó que los recurrentes hayan formulado ante la Municipalidad de Montes de Oca, directamente, una denuncia por el problema de canalización de aguas residuales apuntado; lo cierto es que la Corporación tuvo conocimiento del mismo en el año 2018 y, lo puso en conocimiento del Ministerio de Salud para lo correspondiente. Ahora bien, atendiendo a su posición como garante de los intereses y servicios locales, a partir de lo regulado por el artículo 169 de la Constitución Política, así como por lo dispuesto en la jurisprudencia constitucional, la Municipalidad de Montes de Oca no puede desentenderse de la situación que afecta a los vecinos de la localidad, y descargar sin más, toda la responsabilidad sobre el Ministerio de Salud. Sin lugar a dudas, le es exigible haber mantenido una fiscalización y coordinación muchísimo más acuciosa, entre las diversas instancias competentes.

IX.Conclusión. En mérito de lo expuesto, se impone declarar con lugar el recurso, con las consecuencias que se especifican en la parte dispositiva de esta sentencia.

X.Nota del Magistrado Salazar Alvarado. En tesis de principio, considero que los casos relacionados con la actividad o inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa (omisiva o no) se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en que los recurrentes acusan que las autoridades recurridas, no han solucionado en definitiva un problema de canalización de aguas residuales, que pone en peligro la vida, salud e integridad física de los vecinos de la Urbanización Alma Mater.

XI.Documentación aportada al expediente . Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. Se ordena a quien ocupe el cargo de Director del Área Rectora de Salud de Montes de Oca del Ministerio de Salud, así como a Marcel Soler Rubio y a Yamilette Astorga Espeleta, en sus calidades respectivas de Alcalde de la Municipalidad de Montes de Oca y, Presidenta Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados (ICAA), o a quienes funjan como tales, que lleven a cabo todas las actuaciones dentro del ámbito de sus competencias y coordinen lo necesario, para que en el plazo de SEIS MESES, contado a partir de la notificación de esta sentencia, se solucione el problema de filtración de las aguas residuales en en el sector de la calle radial La Cosecha, y en calle C, Alma Máter; y se notifique a los denunciantes lo dispuesto. Se advierte que, de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena al Estado, a la Municipalidad de Montes de Oca, así como al Instituto Costarricense de Acueductos y Alcantarillados (ICAA), al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
