*200192490007CO* CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at ten hours and five minutes on November twenty-seven, two thousand twenty.
Writ of amparo (recurso de amparo) processed under expediente N° 20-019249-0007-CO, filed by [Nombre 001], identity card [Valor 001], against the MUNICIPALIDAD DE DESAMPARADOS.
FINDINGS:
3.- Gilberth Jiménez Siles, in his capacity as Municipal Mayor; Álvaro Antonio Fallas Segura, in his capacity as Council Member and President of the Municipal Council; and Pablo Brenes Azofeifa, in his capacity as Coordinator of the Urban and Rural Enforcement Process, all officials of the Municipalidad de Desamparados, report under oath as follows: first, for the purpose of responding as required to the appellant’s allegations, the respondent municipality requested a clarifying report from Jesús Chinchilla, Engineer with the Road Infrastructure and Public Works Process, who provided official letter DT- IV- 854- 2020, which states:
“(…) 1. Background 1.1. The case referred to by Ms. Mora concerns the functioning and operation of the storm sewer systems (sistemas de alcantarillado pluvial) in the Gravilias sector, including the system serving Urb. La Fortuna, which, together with other developments, forms a general network extending from the La Cartonera and Cementerio La Piedad sector, where stormwater recharge begins, to the final discharge into the río Damas in the Plaza sector. 1.2. As part of the urban growth that began in the 1960s, urban development projects of various scales were developed over time along the course of that stormwater artery, ranging from individual houses and subdivisions (lotificaciones) along an easement (servidumbre) or public street to housing developments (urbanizaciones). 1.3. The most significant of these projects was Urb. Gravilias, which was developed by INVU in the 1960s and was subsequently joined by other adjacent projects, including Urb.
La Fortuna. 1.4. All these developments discharged their stormwater into this drainage ditch (acequia), which had flowed openly since long ago but was gradually piped as the metropolitan area of Desamparados expanded. 1.5. The use of this drainage ditch as a stormwater collector (colector pluvial) was not governed by the regulations of a Regulatory Plan (Plan Regulador); consequently, the urban developments that used it built their stormwater collectors with only the capacity required for their own projects, giving partial or no consideration to flow contributions from upstream sectors or to the capacities of downstream conduits. 1.6. In this regard, the use of this drainage ditch by the developers who used it as a receiving water body (cuerpo receptor) for discharging the stormwater generated may have been uncoordinated because they did not consider this water body as a watershed system (sistema de cuenca) throughout the full extent defining its drainage area. 1.7.
In the context of urban growth, this contributed significantly to the Gravilias sector being characterized for decades by recurring stormwater overflow events, problems that intensified beginning in the 1980s and whose impacts have been progressively corrected since 2007, as shown by the evidence attached in Anexo 1 and Anexo 2. 1.8. All of this occurred in a national context in which the country was only beginning to confront the challenge of urban growth caused by exponential population growth, without the urban-planning tools available today, such as maps, geographic information systems, and, above all, a Regulatory Plan such as the one currently in effect in the Municipalidad de Desamparados. 2. Measures for the assessment, design, and implementation of projects and interventions 2.1. Beginning in 2007, the Municipalidad de Desamparados began analyzing in greater depth the causes of the overflow and waterlogging events that had characterized the district of Gravilias.
These investigations produced the first assessments of the problem, which have already been described in the preceding sections of this report and concern the micro-watershed (microcuenca) known as Fortuna, located in the western sector of Gravilias. This name has been used to distinguish it from the eastern sector of Gravilias, which is drained by Quebrada Chilamate. 2.2. Once the assessment of the La Fortuna micro-watershed—which encompasses the sector reported by Ms. Mora and at issue in this writ of amparo (recurso de amparo)—had been completed, various interventions were undertaken, ranging from cleaning and the reconstruction or expansion of existing stormwater infrastructure components to new projects for constructing additional networks. Fig. 1 of this report shows the route of the La Fortuna collector. A red line shows the route of the main collector in the La Fortuna sector. The sectors located east and west of this street discharge their water into this collector, which in earlier times was a drainage ditch or minor water body. 3.
Final Considerations 3.1. As may be seen throughout this report, the deficiencies affecting the stormwater drainage systems (sistemas de evacuación pluvial) of Gravilias, specifically in the La Fortuna sub-watershed (subcuenca) or micro-watershed, have been eliminated, and technical and regulatory support is now provided through the Regulatory Plan in effect in the Municipalidad de Desamparados. 3.2. Through its technical teams, this local government has determined that urban developments located in upstream sectors may have caused impacts in downstream sectors. During the 1970s and 1980s, when the La Fortuna housing development where the appellant resides was developed, no urban-development regulations existed, particularly an instrument such as the Land-Use Plan (Plan de Ordenamiento Territorial) currently in effect in the Municipalidad de Desamparados, which now prevents urban developments from being built if they would cause downstream impacts.
Moreover, even if a project discharges directly into a river or stream without passing through an urban collector, under current municipal regulations the developer must construct a stormwater-flow retention and attenuation volume (volumen de retención y amortiguamiento de los caudales pluviales). 3.3. In response to the former circumstances and impacts, the Municipalidad de Desamparados began conducting assessments that served as input for designs, which in turn enabled projects to be formulated. Using these tools, it proceeded to secure funding for the designed projects and interventions from various sources, including municipal budgets themselves, Ministry of Finance Appropriations (Partidas de Hacienda), District Appropriations (Partidas de Distrito), and even the submission of projects to the Dirección Nacional de Desarrollo Comunal (Dinadeco). 3.4. Once funding was obtained for each project—which required a lengthy technical and administrative process to secure those resources—the projects were implemented, as reported in Anexo 1 and Anexo 2. 3.5.
As may be seen, the Municipalidad de Desamparados has duly exercised its powers and, since 2007, has carried out various studies, designs, and projects to resolve the deficiencies that existed in the stormwater systems of the La Fortuna sector. 3.6. Despite these interventions and projects, isolated points remain where hydraulic-capacity deficiencies (deficiencias de capacidad hidráulica) occur; accordingly, since 2007, the Municipalidad de Desamparados has continued making improvements and expansions in this area. 3.7. This Administration places on record that the flooding incidents occurring in the canton of Desamparados have been less severe and less frequent because of the municipal stormwater-infrastructure projects undertaken over the past several years. 3.8. It is important to note that the completed projects required assessment, design, and budgeting work, as well as efforts to obtain the financial resources needed to perform the works identified during the assessment and design stages, followed finally by the performance of those works. 3.9.
The administrative and technical work carried out since 2007 to provide suitable pipelines and ensure the safety of the new stormwater-system infrastructure must comply with the entire financial procedure applicable to civil works of this kind, including budgeting the financial resources and observing all the administrative logistics required in municipal matters, as well as everything involved in planning the medium-term performance of work of this nature; however, this does not constitute inefficiency, neglect, or noncompliance by the municipal administration. 4. Conclusions 4.1. As may be seen, and based on the inventory of works and interventions carried out in the La Fortuna sector over the past 12 years, the Municipalidad de Desamparados has made significant efforts to correct deficiencies accumulated over the past 60 years. 4.2. In this regard, it may be seen that the Municipalidad de Desamparados has not exhibited inaction or indifference toward the problems mentioned by Ms.
Mora in her writ of amparo. On the contrary, in recent years the Municipalidad de Desamparados has been working in this area, as well as throughout the rest of the canton, to resolve flooding problems. 4.3. This Administration is undertaking the final assessment, design, budgeting, financial-management, and implementation efforts needed to resolve the matter and continue carrying out works to improve the stormwater drainage system for the benefit of all residents of Desamparados. 4.4. It is therefore established that the Municipalidad de Desamparados has not been indifferent to the problems described by Ms. Mora. On the contrary, the interventions and projects carried out in the La Fortuna area, as documented in Anexo 1 and Anexo 2 to this official letter, have had a positive effect on the sector where Ms. Mora’s residence is located; indeed, at this location, the severity and frequency of flooding events have decreased significantly. 4.5.
Finally, it is important to advise the Legal Counsel’s Office of the Municipalidad de Desamparados that the Sala Constitucional must be informed of the efforts undertaken in the La Fortuna area, which have had a positive effect on the residents of this micro-watershed, including Ms. Mora. 4.6. In view of the evidence of those efforts, no judgment against the Municipalidad de Desamparados is warranted on grounds of inaction or indifference in pursuing and implementing solutions to the flooding problems in the La Fortuna area. 4.7. The Municipalidad de Desamparados is fully aware of the circumstances and impacts caused by flooding; however, as stated above, this stormwater-system problem has been progressively corrected, successfully resolving these impacts for all residents living near the La Fortuna sector. This has been an operational process lasting more than 12 years and encompassing various sectors.
The process has not yet concluded because it forms part of the municipality’s ordinary exercise of its powers. 4.8. Nevertheless, this civil-works project process has been carried out to provide an effective solution to the problem reported by the appellant.
The Municipalidad de Desamparados has, for several years, as already indicated, [worked on this matter], given that construction of the stormwater system (sistema pluvial) has been an initiative of the municipal administration aimed at providing a solution to flooding and ensuring the safety and well-being of the residents of this community, while adhering to the time frames required to resolve the problem described. 4.9. It is important to recognize the efforts made to date by the Municipalidad de Desamparados to safeguard the safety and well-being of its residents—matters that, in the Municipality’s view and based on the works and interventions carried out, have indeed resulted in a solution to the problem. 4.10. The undersigned has documented, in work reports, the progress and works carried out by the Proceso de Infraestructura Vial toward resolving the stormwater-system problem in the La Fortuna and Gravilias area; accordingly, I attach and attest to the accuracy of the information stated in the compilation of projects and interventions carried out in the La Fortuna, Gravilias micro-watershed (microcuenca).
(…)” As specified in the quoted portion of report DT- IV- 854- 2020, provided by Jesús Chinchilla, Engineer for the Road Infrastructure and Public Works Process, the Municipal Administration has found it necessary to carry out stormwater-system infrastructure work in several areas of the canton, including the area where the protected party (amparada) resides, because the canton of Desamparados has been among those most affected by hydrometeorological phenomena, which have caused several rivers to overflow and, consequently, severe flash flooding when the capacity of the existing old stormwater collectors is exceeded. The micro-watershed (microcuenca) in which the Municipality has undertaken interventions has an area of 0,60 km2 (sesenta hectáreas), and it is the considerable extent of this area that has led the respondent municipality (municipio recurrido) to continue making repairs and investing financial resources.
Furthermore, as the petitioner (recurrente) in the present proceeding also emphasizes: “(…) it is true that the Municipality has performed a great deal of costly work. But the money has been wasted because, as I understand from explanations given to me by knowledgeable experts, the problem lies with the sewer system… (…)”; this demonstrates that the protected party herself acknowledges all the infrastructure work undertaken by this Municipality. In light of the foregoing, having demonstrated that the respondent municipality has taken every possible measure to remedy the environmental problem alleged by the protected party, they request that this application for amparo relief (recurso de amparo) be denied.
Justice Salazar Alvarado drafts the opinion; and,
WHEREAS:
Before examining the merits of the matter, it must be clarified that, since Judgment N° 2008-02545 at 08:55 hours on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contenciosa administrativa)—with certain exceptions—those matters in which it is disputed whether the administration has complied with the time limits established by the Ley General de la Administración Pública (articles 261 and 325) or by sector-specific laws for concluding an administrative proceeding (procedimiento administrativo)—initiated ex officio or at the request of a party—by issuing a final administrative act (acto final), or for deciding the applicable administrative appeals (recursos administrativos). Specifically, the case at bar (sub lite) presents an exception because it concerns a complaint regarding pollution and flooding that affects human health, circumstances that have not been resolved within a reasonable period. In view of the fundamental rights invoked, particularly the right to health, this Chamber assesses possible delays in resolving complaints of this kind. With that point clarified, the Chamber proceeds to decide the specific situation raised in this amparo proceeding.
The petitioner states that she is a resident of Desamparados and that, for several years, the rainy season has affected her home because the area where it is located floods, as do other residences and the park situated across from her property. She states that when it rains, the nearby stream overflows and flows toward the street and nearby shops because the sanitary sewer system is insufficient for the volume of water passing through the area. She explains that, as a result, sewage and water from Quebrada Quilimate, together with mud and other waste, enter her home, damaging the carpets, furniture, and other items on her property. She adds that fecal matter from the flooding remains embedded in the walls, roadway, and sidewalks. She argues that the situation described endangers her health and therefore requests the intervention of this Chamber to protect her fundamental rights.
For purposes of deciding this application, the following relevant facts are deemed duly proven:
Under current municipal regulations, the developer must construct a retention and attenuation volume for stormwater flows (caudales pluviales) (see sworn report and evidence submitted); e) The municipality of the canton of Desamparados has remedied the deficiencies identified in Gravilias’s stormwater drainage systems, specifically in the La Fortuna sub-watershed (subcuenca) or micro-watershed; and it currently has technical and regulatory support through the Plan Regulador maintained by that municipality (see sworn report and evidence submitted); f) According to report DT-IV-854-2020, provided by Jesús Chinchilla, Engineer for the Road Infrastructure and Public Works Process, to the respondent Municipal Administration, it has become necessary to carry out stormwater-system infrastructure work in several areas of the canton, including the area where the protected party resides, because the canton of Desamparados has been among those most affected by hydrometeorological phenomena, which have caused several rivers to overflow and, consequently, severe flash flooding when the capacity of the existing old stormwater collectors is exceeded (see reports and attached evidence).
IV.The right to a healthy and ecologically balanced environment. Article 50 of the Constitución Política establishes every person’s right to a healthy and ecologically balanced environment as a fundamental right. Even before Article 50 was amended to expressly address the environment, this Chamber had already derived that right through its case law from the constitutional provisions contained in Articles 21—the right to life and health—69—the rational use of land—and 89—the protection of natural beauty. The Chamber has adopted an expansive or macro-level understanding of the concept of the environment and the protection afforded to it, extending beyond the basic or primary protection of soil, air, water, marine and coastal resources, minerals, forests, the diversity of flora and fauna, and the landscape, to include elements relating to the economy, the generation of foreign currency through tourism, agricultural production, and other matters.
Following the amendment of Article 50 of the Constitution, which expressly enshrined the environmental right as a fundamental right, the State’s obligation to guarantee, defend, and protect that right was also established in categorical terms, thereby making the State the guarantor of the protection and preservation of the environment and natural resources. Pursuant to this provision, read in conjunction with Articles 20, 69, and 89 of the Constitución Política, the State’s responsibility to exercise a protective and governing function in this field was derived, as provided by the constitutional rule under discussion, a function implemented through environmental legislation. Thus, the constitutional mandate establishes the State’s duty to guarantee, defend, and preserve that right.
V.The role of municipalities in environmental matters. In accordance with the foregoing, municipalities, as an integral part of the whole that constitutes the State, bear a significant share of responsibility for environmental matters within the scope of their powers and obligations, whether through the direct approval of permits or licenses for which prior compliance with requirements demonstrating proper environmental management before other public authorities is required, or through regular inspections and the referral of hazardous situations to the authorities having greater powers of intervention. It has already been established that local governments are subject to the duty of coordination and prevention in environmental matters within their territorial jurisdiction; consequently, municipalities are indeed important actors in the task of environmental protection. The authority of local governments to establish their own land-use planning (ordenación territorial) through regulatory plans (planes reguladores) is beyond dispute; however, the existence of such plans—which for the most part lack supplementary planning provisions addressing a healthy and ecologically balanced environment (ambiente sano y ecológicamente equilibrado)—does not render protective environmental legislation inapplicable.
On the contrary, the Chamber (Sala) considers it a fundamental requirement, one that does not infringe the constitutional principle of municipal autonomy (autonomía municipal), that every regulatory plan, before being approved and implemented, undergo an environmental impact assessment (examen del impacto ambiental) from the perspective afforded by Article 50 of the Constitution, so that land-use regulation and its various regimes are compatible with the scope of the higher-ranking provision, particularly in view of the fact that this provision establishes the right of all inhabitants to receive an environmental response from all public authorities. This unquestionably includes municipalities, which are not exempt from application of the constitutional provision and its implementing legislation. It is evident that, in this case, the national and local interests fully coincide; local governments therefore may and must require compliance with environmental requirements within their territory and, in the event of a conflict with the governing environmental authorities, may submit the disputes to the appropriate court for judicial review, depending on the nature of the violation (see, to this effect, Judgment No. 2006-7994, at eight fifty-seven a.m. on June 2, 2006).
The petitioner (recurrente) states that she is a sixty-three-year-old adult with a disability, a survivor of groin cancer, and that she has several problems with her legs that make it difficult for her to move, requiring her to use a cane. She adds that she resides in Desamparados and that, for several years, the rainy season has affected her home because the area in which it is located floods. She states that, when it rains, the nearby stream overflows and flows toward the street and nearby stores because the sanitary sewer system (alcantarillado sanitario) is inadequate for the volume of water passing through the area. As a result, sewage and water from Quebrada Quilimate, together with mud and other waste, enter her home and damage her personal property. She adds that fecal matter from those floods remains embedded in the walls, roadway, and sidewalks. She argues that the situation described endangers her health and therefore requests the intervention of this Chamber in defense of her fundamental rights (derechos fundamentales).
VII.Now, the report submitted under oath by the respondent authorities (autoridades recurridas) of the Municipalidad de Desamparados, after due warning of the consequences established in Article 44 of the Ley de la Jurisdicción Constitucional, together with the other evidence presented, shows that the entity has undertaken and carried out a series of activities, ranging from economic and financial measures to completed infrastructure works, to remedy the environmental problem affecting that canton. As part of those efforts, the respondent municipality has a Territorial Land-Use Plan (Plan de Ordenamiento Territorial), which prevents urban developments that would cause adverse downstream impacts, including where a project discharges directly into a river or stream without passing through an urban collector. Thus, under current municipal regulations, the developer must construct a structure to retain and buffer stormwater flows (caudales pluviales).
The municipality has also undertaken the cleaning, reconstruction, or expansion of existing stormwater infrastructure, as well as new projects to build additional networks, work that continues to be performed at present. Nevertheless, although the Municipalidad de Desamparados has acted since 2007 in response to the needs arising from flooding in the community of Gravilias, the fact remains that the environmental impact has not been completely remedied, thereby placing the protected party in these proceedings (tutelada), as well as the other residents of that area, at risk with respect to their health and quality of life. The respondent authorities refer to the works performed; however, they acknowledge that it has not been possible to provide a definitive solution to the problem reported by the protected party because: “(…) it has been one of the cantons most affected by hydrometeorological phenomena (fenómenos hidrometeorológicos), which cause several rivers to overflow and consequently generate severe flash flooding when the capacity of the existing old stormwater collectors (colectores pluviales) is exceeded (…)”.
In this regard, report DT-IV-854-2020, provided to the respondent Municipal Administration by Jesús Chinchilla, Engineer for the Road Infrastructure and Public Works Process, is of particular interest. It states that a need has arisen to carry out stormwater-system infrastructure work in several areas of the canton, including the area where the protected party resides, because the canton of Desamparados has been one of those most affected by hydrometeorological phenomena, which have caused several rivers to overflow and consequently generated severe flash flooding when the capacity of the existing old stormwater collectors is exceeded. The evidence presented makes it clear that the measures taken have been insufficient and that there is a deficit in the protection of the petitioner’s fundamental rights; this is also a public-health problem because it affects residents of the area. The respondent authorities do not deny the allegations that, at present, despite the measures adopted and the investment made in infrastructure, Quebrada Quilimate—near the protected party’s home—overflows during the rainy season and flows toward the street and nearby stores because the sanitary sewer system is inadequate for the volume of water passing through the area.
As a result, sewage and water from that stream, together with mud and other waste, enter her home and cause property damage. Likewise, fecal matter from those floods remains embedded in the walls, roadway, and sidewalks, which clearly endangers her health. Although this Chamber does not disregard the intervention undertaken by the respondent Municipalidad since 2007, as demonstrated by the documentary evidence submitted in this amparo proceeding (recurso), the fact remains that the environmental situation described by the protected party continues to occur and the respondent authorities have not adopted specific measures to provide a definitive solution to those environmental problems. Consequently, a violation of the right to a healthy and ecologically balanced environment, as well as of the right to health, enshrined in Articles 21 and 50 of the Constitución Política, is deemed established.
Furthermore, the evidence reveals no valid justification on the part of the municipal entity for failing to provide an effective solution to the problem raised. This is because, pursuant to Article 169 of the Constitución Política, municipalities are responsible for the “administration of local interests and services in each canton”; therefore, this Court finds it unacceptable that they are aware of the facts reported by the petitioner—which also constitute a public-health problem affecting that area—without having sought a definitive solution to that problem. That situation specifically violates the fundamental rights of the claimant (promovente) and the inhabitants of that sector, to the detriment of their rights to health and to an environment free from pollution. In light of the foregoing, a violation of the fundamental right to a healthy and ecologically balanced environment, as well as of the right to health, is established to the detriment of the petitioner and the residents of the affected area (district of Gravilias). Accordingly, the proper course is to grant the petition, as will be ordered in the operative part (parte dispositiva) of this Judgment.
1. The historical context that originally prompted the Chamber’s broad intervention in environmental matters has changed considerably, requiring this body to reconsider the conditions governing its participation in safeguarding the right of individuals to a healthy and balanced environment, as protected by Article 50 of the Constitución Política. Indeed, the current situation—characterized by an extremely extensive body of statutory and regulatory law that includes substantive rules, procedures, and the creation of bodies responsible for ensuring compliance with the Fundamental Charter (Carta Fundamental)—is radically different from the earlier situation, in which the absence of regulations and of state bodies with appropriate jurisdiction compelled the Chamber to assume a leading, nearly exclusive role in defending the aforementioned constitutional right.
2. Today, we face a “dense web” of environmental regulations, which has produced two significant phenomena. The first and most obvious is the emergence of comprehensive legal regulation of activities whose environmental impact had previously been subject to little or no regulation, as well as the creation of state bodies with authority to monitor and control the effects of human activity on the environment. The second phenomenon is that this increasing legalization (juridificación)—predominantly through statutes and regulations—inevitably brings both administrative justice and the ordinary courts (jurisdicción ordinaria) into play, primarily the contentious-administrative courts (jurisdicción contencioso administrativa), but also the criminal courts. Consistent with the importance of environmental law, these jurisdictions have been provided with broad procedural avenues and inclusive means of standing (medios de legitimación), enabling private parties subject to the Administration (administrados) to enforce the provisions of the extensive body of law governing environmental matters.
3. In that context, it is not legally appropriate, nor appropriate from a functional standpoint, for the Sala Constitucional to displace—or, worse still, replace—the ordinary courts (órganos de justicia ordinarios) in carrying out their task, which is also constitutional in rank, of ensuring effective compliance with statutes and regulations. It is legally improper because, in the vast majority of these cases, the Court is asked to interpret and enforce statutory and regulatory provisions, thereby risking an overlap between its jurisdiction and that of other judicial bodies that were specifically created to perform such tasks; and it is also functionally inappropriate because the design of its proceedings is ill-suited to the complexity present in numerous environmental disputes, which consist of series of technically and legally complex facts and acts. There are well-known examples concerning both issues in which the Sala has issued a partial or technically incomplete ruling, or in which unnecessary friction and harm to legal certainty have arisen.
4. Among the technical aspects that I have considered, I would add the fact that this jurisdiction does not have judgment-enforcement judges (jueces ejecutores de sentencia) capable of adequately monitoring such judgments—which are generally complex—and which sometimes involve monitoring remediation plans (planes remediales), among other matters, with interinstitutional coordination and follow-up lasting months or even years.
5. From that perspective, this Tribunal’s decision to step aside in environmental matters should not be viewed as an abandonment of such matters, but rather as ensuring their proper protection before the forum best suited to their complexity and diversity. Nor should it be viewed as this body’s relinquishment of its duty to protect the constitutional rights entrusted to it by the Constitución Política and its Ley Orgánica; in my view, its role in this area remains reserved for specific cases. Rather, this is an exercise in reallocating the burdens and duties assigned to the various State bodies so that each may fully perform its work within its assigned sphere, as well as an exercise of determining its own jurisdiction, as established by Article 7 of its Ley Orgánica.
6. It is clear that the Sala does not contemplate leaving the protection of individuals’ environmental rights to other jurisdictions. It is well known that, although any claim concerning a violation of statutory or regulatory provisions may be brought within the constitutional sphere, there are cases whose resolution requires nothing more than the application of constitutional law. The aim, therefore, is for the Sala to become one of several key participants so that—collectively, and each within its own sphere—the full range of situations involved in protecting the right to a healthy and balanced environment may be addressed within a society in which other equally pressing needs also exist. I firmly believe that, under this approach, citizens do not lose the slightest degree of protection, while substantial gains are made in breadth, perspective, and respect for the balance and distribution of powers, the latter being a principle that must be taken into account because it governs the constitutional dynamics of any liberal and democratic system such as ours.- 7.
Consistent with the foregoing, I maintain that this Sala should refrain from hearing claims brought before it for alleged violations of Article 50 of the Constitución Política, leaving their adjudication to administrative justice and the administrative litigation jurisdiction (jurisdicción contenciosa administrativa). The foregoing is stated as a general rule, without prejudice to recognizing the existence of particular cases or categories of cases which, in my judgment, would still be better protected by this Sala and should therefore be heard and resolved by it.- Among such categories, and without this enumeration being regarded as a closed and definitive list, I may note that the Sala should retain jurisdiction over situations such as claims involving environmental violations that also directly endanger individuals’ health or the availability or quality of water; and cases involving gross and direct violations of the environment in which there is a manifest absence of protection by State authorities, provided, furthermore, that the nature of the claim allows it to be addressed through the remedy of amparo (amparo) as a summary and special procedural mechanism, since I also believe that amparo proceedings should not be converted into ordinary proceedings in order to address, even in the cases cited, matters exceeding their capacity to be adequately handled through that remedy.
8. In this specific case, in accordance with the facts found proven, the appellant’s claim could potentially affect the appellant’s health and that of the appellant’s family. Consequently, it is clear that this case falls within the aforementioned exceptions, and for that reason I considered it necessary for the Sala to exercise its jurisdiction in order to determine whether the alleged omissions violate the fundamental rights of the protected persons.
In environmental matters, it is the undersigned’s position that, if the Public Administration has already intervened, jurisdiction to hear and resolve the matter lies with the administrative litigation jurisdiction. Nevertheless, I do address the merits when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Constitución Política), as in this case, in which the appellant alleges that the Municipalidad de Desamparados has failed to provide a solution to the problem of sewage pollution and the overflowing of a stream, a situation that affects the homes and health of local residents, without the problem having been definitively resolved, thereby impairing a healthy and ecologically balanced environment.
The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the court office within a maximum period of thirty business days from the date of notice of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at Session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial N° 19 of 26 de enero del 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial at Session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.
POR TANTO:
This appeal for constitutional relief (recurso) is granted. Gilberth Jiménez Siles, in his capacity as Alcalde Municipal; Álvaro Antonio Fallas Segura, in his capacity as Regidor and Presidente del Concejo Municipal; and Pablo Brenes Azofeifa, in his capacity as Coordinador del Proceso de Fiscalización Urbana y Rural, all officials of the Municipalidad de Desamparados, or whoever may hold those positions in their stead, are ordered to undertake the necessary measures, within the scope of their respective powers, so that, within TWELVE MONTHS from notice of this judgment, all appropriate action is taken to completely remedy the environmental harm caused by the flooding occurring in the community of Gravilias, Desamparados. This order is issued with the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order from this Sala that they are required to comply with or enforce and who fails to do so shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The Municipalidad de Desamparados is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed in administrative-litigation judgment-enforcement proceedings (ejecución de sentencia de lo contencioso administrativo). *200192490007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las diez horas cinco minutos del veintisiete de noviembre de dos mil veinte .
Recurso de amparo que se tramita en expediente N° 20-019249-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001] , en contra de la MUNICIPALIDAD DE DESAMPARADOS.
RESULTANDO:
Tal y como se puntualiza en lo transcrito del informe DT- IV- 854- 2020, proporcionado por Jesús Chinchilla, Ingeniero del Proceso de Infraestructura Vial y Obras Públicas, a la Administración Municipal, le ha surgido la necesidad de ejecutar labores de infraestructura del sistema pluvial, en varias zonas del cantón, dentro de las cuales se encuentra la zona en la que habita la amparada, esto, por cuanto el cantón de Desamparados, ha sido uno de los más afectados por fenómenos hidrometereológicos, los cuales, han provocado desbordamientos en varios ríos y consecuentemente, se generan fuertes inundaciones repentinas, a raíz de la superación de la capacidad de colectores pluviales antiguos existentes. La microcuenca que ha sido objeto de intervenciones por la Municipalidad, tiene una superficie de 0,60 km2 (sesenta hectáreas), siendo este extenso tramo, lo que ha acaecido, para que el municipio recurrido se mantenga corrigiendo e invirtiendo recursos económicos.
Asimismo, como lo recalca también la recurrente de la presente causa: “(…) es cierto que la Municipalidad ha realizado muchos trabajos costosos. Pero el dinero ha sido perdido porque entiendo según me han explicado expertos conocedores que el problema es de alcantarillado… (…)”, se deja prueba que la misma amparada reconoce toda la gestión en obras de infraestructura que ha realizado esta Municipalidad. Por lo expuesto con anterioridad, al haber demostrado que el municipio recurrido ha gestionado todo lo posible, para solventar el problema ambiental que acusa la tutelada, solicitan se declare sin lugar el presente recurso de amparo.
Redacta el Magistrado Salazar Alvarado; y,
CONSIDERANDO:
Antes de analizar el fondo del asunto, debe aclararse que, a partir de la Sentencia N° 2008-02545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contenciosa administrativa -con algunas excepciones- aquellos asuntos en los que se discute, si la administración ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o por leyes sectoriales para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite , se plantea un supuesto de excepción, pues se está frente a una denuncia por contaminación e inundaciones, que afectan la salud de las personas, cuyas situaciones, no han sido resueltas dentro de un plazo razonable. Atendiendo a los derechos fundamentales que se invocan, sobre todo, la salud, esta Sala valora las posibles dilaciones en la resolución de las denuncias de este tipo. Clarificado el punto, se entra a resolver la situación concreta planteada en este amparo.
La parte recurrente manifiesta, que es vecina de Desamparados, y que desde hace varios años, la época lluviosa afecta su vivienda, debido a que en el sector en el que se encuentra su casa de habitación se inunda, al igual otras residencias; y el parque que se ubica frente a su propiedad. Señala, que con las lluvias, la quebrada cercana se desborda, discurre hacia la calle y tiendas cercanas, puesto que, el alcantarillado sanitario resulta insuficiente para la cantidad de agua que pasa por la zona. Menciona, que por tal situación las aguas negras y las provenientes de la Quebrada Quilimate, además de lodo y otros desechos, ingresan en su casa de habitación, y las alfombras, muebles y otros artículos en su propiedad se dañan. Añade, que el material fecal proveniente de dichas inundaciones, queda impregnado en los muros, carretera y aceras. Arguye, que la situación descrita pone en riesgo su salud, y por ende, solicita la intervención de esta Sala, en defensa de sus derechos fundamentales.
De importancia para la resolución del presente recurso, se estiman como debidamente demostrados los siguientes hechos de relevancia:
a)A partir del año 2007, la Municipalidad de Desamparados empezó a analizar con mayor profundidad, las causas de los eventos de desbordamiento y anegamiento que han caracterizado al distrito de Gravilias. Fue a partir de dichas investigaciones, que se obtienen los primeros diagnósticos del problema, los cuales corresponden a la microcuenca denominada Fortuna, ubicada en el sector oeste de Gravilias (ver informe rendido bajo juramento y prueba aportada); b)Ante la problemática ambiental expuesta, la Municipalidad de Desamparados comenzó a realizar diagnósticos que sirvieron de insumo para la generación de diseños que permitieron a su vez, la formulación de proyectos. A partir de dichas herramientas, se prosiguió con la consecución del financiamiento para los proyectos e intervenciones diseñadas, cuyas fuentes han sido diversas, desde presupuestos municipales propiamente, Partidas de Hacienda, Partidas de Distrito e incluso la formulación de proyectos ante la Dirección Nacional de Desarrollo Comunal (Dinadeco) (ver informe rendido bajo juramento y prueba aportada); c)A raíz de la aprobación de dicho financiamiento, la Municipalidad de Desamparados ha procedido con la ejecución de una serie de proyectos, desde labores de limpieza y reconstrucción o ampliación de componentes pluviales existentes, hasta proyectos nuevos de construcción de nuevas redes, enfocados en solventar la problemática ambiental provocada por las lluvias, en el sector de Gravilias (ver informe rendido bajo juramento y prueba aportada); d)La Municipalidad de Desamparados, cuenta con un Plan de Ordenamiento Territorial, el cual impide que se generen desarrollos urbanísticos que vayan a provocar afectaciones aguas abajo e incluso, si un proyecto desfoga directamente a un río o quebrada sin tener que pasar por un colector urbano.
Bajo las regulaciones municipales actuales, el desarrollador debe construir un volumen de retención y amortiguamiento de los caudales pluviales (ver informe rendido bajo juramento y prueba aportada); e)El municipio del cantón de Desamparados ha eliminado las deficiencias que se han presentado en los sistemas de evacuación pluvial de Gravilias, propiamente en la subcuenca o microcuenca de La Fortuna; y, actualmente, se dispone del respaldo técnico y normativo, por medio del Plan Regulador con el que cuenta dicha municipalidad (ver informe rendido bajo juramento y prueba aportada); f)Según informe DT-IV-854-2020, proporcionado por Jesús Chinchilla, Ingeniero del Proceso de Infraestructura Vial y Obras Públicas, a la Administración Municipal recurrida, ha surgido la necesidad de ejecutar labores de infraestructura del sistema pluvial, en varias zonas del cantón, dentro de las cuales se encuentra la zona en la que habita la amparada, esto, por cuanto el cantón de Desamparados, ha sido uno de los más afectados por fenómenos hidrometereológicos, los cuales, han provocado desbordamientos en varios ríos y consecuentemente, se generan fuertes inundaciones repentinas, a raíz de la superación de la capacidad de colectores pluviales antiguos existentes (ver informes y prueba adjunta).
g)El 25 de mayo de 2020, la amparada presentó ante la Municipalidad de Desamparados, una denuncia, de los eventos ambientales que afectan su propiedad (ver prueba aportada por la parte recurrente); h)El 26 de agosto de 2020, mediante correo electrónico remitido a la dirección electrónica [email protected] , la amparada, reitera los reclamos correspondientes a la problemática ambiental que le atañe. Dichas manifestaciones, fueron expedidas a Ana Gabriela Picado, funcionaria de la Municipalidad de Desamparados (ver prueba aportada por la parte recurrente).
IV.Sobre el derecho a un ambiente sano y ecológicamente equilibrado. El artículo 50, de la Constitución Política, establece como fundamental el derecho de toda persona a un ambiente sano y ecológicamente equilibrado. De previo a la modificación de este artículo 50 para considerar de manera partir de las disposiciones constitucionales de los artículos 21 -derecho a la vida y a la salud-, 69 -explotación racional de la tierra- y 89 -protección de las bellezas naturales-. La Sala ha optado por una consideración abierta o macro del concepto ambiente y de la protección que se brinda al mismo, trascendiendo de la protección básica o primaria del suelo, el aire, el agua, los recursos marinos y costeros, minerales, bosques, diversidad de flora y fauna, y paisaje, para considerar también elementos referentes a la economía, a la generación de divisas a través del turismo, la explotación agrícola y otros.
A partir de la reforma del artículo 50 Constitucional, en la cual se consagró expresamente el derecho ambiental como un derecho fundamental, se estableció también -en forma terminante- la obligación del Estado de garantizar, defender y tutelar este derecho, con lo cual, el Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. Es a tenor de esta disposición, en relación con los artículos 20, 69 y 89, de la Constitución Política, que se derivó la responsabilidad del Estado de ejercer una función tutelar y rectora en esta materia, según lo dispone la propia norma constitucional en comentario, función que desarrolla la legislación ambiental. Es así como el mandato constitucional establece el deber para el Estado de garantizar, defender y preservar ese derecho.
V.El papel de las municipalidades en materia ambiental. De conformidad con lo dicho, las municipalidades, como parte integrante del todo que es el Estado, tienen dentro del ámbito de sus competencias y obligaciones una alta cuota de responsabilidad en materia ambiental, sea mediante la aprobación directa de permisos o licencias para las cuales se exija el previo cumplimiento de requisitos que acrediten ante otras instancias del poder público el adecuado manejo ambiental, como mediante inspecciones regulares y canalización de situaciones de riesgo ante las instancias con mayor competencia de intervención. Ha quedado establecido ya que a los gobiernos locales les alcanza la obligación de coordinación y prevención en materia ambiental dentro del ámbito de su jurisdicción territorial, de donde resulta que ciertamente las municipalidades son actores importantes en la tarea de protección al ambiente.
Es indubitable la facultad de los gobiernos locales para darse su propia ordenación territorial a través de los planes reguladores; pero la existencia de éstos -que en su mayoría carecen de complementos de ordenación desde el punto de vista del ambiente sano y ecológicamente equilibrado- no produce la desaplicación de la legislación tutelar ambiental. Por el contrario, estima la Sala que debe ser requisito fundamental, que no atenta contra el principio constitucional de la autonomía municipal, el que todo plan regulador deba considerar, de previo a ser aprobado y desarrollado, con un examen del impacto ambiental desde la perspectiva que da el artículo cincuenta constitucional, para que el ordenamiento del suelo y sus diversos regímenes sean compatibles con los alcances de la norma superior, sobre todo, valorando que esta disposición establece el derecho de todos los habitantes a obtener una respuesta ambiental de todas las autoridades públicas y ello incluye, sin duda, a las municipalidades, quienes no están exentas de la aplicación de la norma constitucional y de su legislación de desarrollo.
Es evidente que en este caso, es totalmente coincidente el interés nacional y el local, y por ello los gobiernos locales pueden y deben exigir el cumplimiento de requisitos ambientales en su territorio, y en caso de conflicto con las autoridades rectoras de la materia ambiental, pueden someter las controversias al contralor jurisdiccional que corresponda según la naturaleza de la infracción (ver, en este sentido, Sentencia N° 2006-7994, de las ocho horas cincuenta y siete minutos del 2 de junio de 2006).
La recurrente manifiesta que es una persona adulta de sesenta y tres años, con discapacidad, sobreviviente de cáncer en la ingle, y tiene varios problemas en sus piernas que le dificultan movilizarse, por lo que, debe utilizar un bastón. Acota, que es vecina de Desamparados, y que, desde hace varios años, la época lluviosa afecta su vivienda, debido a que en el sector en el que se encuentra su casa de habitación se inunda. Señala, que, con las lluvias, la quebrada cercana se desborda, discurre hacia la calle y tiendas cercanas, puesto que, el alcantarillado sanitario resulta insuficiente para la cantidad de agua que pasa por la zona. Por tal situación, las aguas negras y las provenientes de la Quebrada Quilimate, además de lodo y otros desechos, ingresan en su casa de habitación, y sus bienes materiales resultan dañados. Añade, que el material fecal proveniente de dichas inundaciones, queda impregnado en los muros, carretera y aceras. Arguye, que la situación descrita pone en riesgo su salud, y, por ende, solicita la intervención de esta Sala, en defensa de sus derechos fundamentales.
VII.Ahora bien, del informe rendido bajo juramento por las autoridades recurridas de la Municipalidad de Desamparados, con oportuno apercibimiento de las consecuencias previstas en el artículo 44, de la Ley de la Jurisdicción Constitucional, y demás elementos probatorios aportados, se desprende que dicho ente ha gestionado y ejercido una serie de actividades, que abarcan desde la parte económica – financiera, hasta infraestructuras realizadas, con el fin, de solventar la problemática ambiental que afecta a ese cantón. Dentro de dichas gestiones, el municipio recurrido, cuenta con un Plan de Ordenamiento Territorial, el cual impide que se generen desarrollos urbanísticos que vayan a provocar afectaciones aguas abajo e incluso, si un proyecto desfoga directamente a un río o quebrada sin tener que pasar por un colector urbano. Es así, como bajo las regulaciones municipales actuales, el desarrollador debe construir un volumen de retención y amortiguamiento de los caudales pluviales, así como, ha puesto en práctica labores de limpieza y reconstrucción o ampliación de componentes pluviales existentes, y hasta proyectos nuevos de construcción de nuevas redes, cuyas labores, continúan ejecutándose en la actualidad.
Sin embargo, a pesar de que la Municipalidad de Desamparados, desde el año 2007, ha actuado conforme a las necesidades que se han presentado a raíz de las inundaciones que se generan en la comunidad de Gravilias, lo cierto es, que la afectación ambiental, no ha logrado ser solventada por completo, lo cual, coloca a la tutelada de la presente causa, y demás vecinos de dicha zona, en riesgo respecto a su salud, y calidad de vida. Las autoridades recurridas hacen referencia a las obras realizadas; sin embargo, reconocen que no ha sido posible brindar una solución definitiva a lo denunciado por la tutelada, debido a que: “(…) ha sido uno de los cantones más afectados por fenómenos hidrometeorológicos los cuales provocan desbordamientos en varios ríos y consecuentemente se generan fuertes inundaciones repentinas, a raíz de la superación de la capacidad de los colectores pluviales antiguos existentes (…)”.
En ese sentido, de especial interés resulta el informe DT-IV-854-2020, proporcionado por Jesús Chinchilla, Ingeniero del Proceso de Infraestructura Vial y Obras Públicas, a la Administración Municipal recurrida, en el cual se indica que ha surgido la necesidad de ejecutar labores de infraestructura del sistema pluvial, en varias zonas del cantón, dentro de las cuales se encuentra la zona en la que habita la amparada, esto, por cuanto el cantón de Desamparados, ha sido uno de los más afectados por fenómenos hidrometereológicos, los cuales, han provocado desbordamientos en varios ríos y consecuentemente, se generan fuertes inundaciones repentinas, a raíz de la superación de la capacidad de colectores pluviales antiguos existentes. Ahora bien, de los elementos probatorios aportados resulta evidente que lo realizado ha sido insuficiente, y existe un déficit en la tutela de los derechos fundamentales de la recurrente, que además es un problema de salud pública, porque afecta a los vecinos de la zona, toda vez que las autoridades recurridas no niegan los alegatos planteados, en el sentido de que, actualmente, a pesar de las medidas adoptadas, y la inversión realizada en infraestructura, durante la época lluviosa, la Quebrada Quilimate -cercana a la vivienda de la amparada- se desborda, discurre hacia la calle y tiendas cercanas, debido a que el alcantarillado sanitario resulta insuficiente para la cantidad de agua que pasa por la zona.
Por tal situación, las aguas negras y las provenientes de dicha quebrada, además de lodo y otros desechos, ingresan en su casa de habitación, causando daños materiales. Asimismo, el material fecal proveniente de dichas inundaciones, queda impregnado en los muros, carretera y aceras, lo que evidentemente pone en riesgo su salud. Si bien esta Sala no desconoce la intervención realizada por la Municipalidad recurrida desde el año 2007, que se ha demostrado con la prueba documental aportada en el presente recurso, lo cierto es que la situación ambiental descrita por la tutelada continúa sucediendo, y las autoridades recurridas no han adoptado medidas precisas para darle una solución definitiva a dichos problemas ambientales. En consecuencia, se tiene por acreditada la violación al derecho a un medio ambiente sano y ecológicamente equilibrado, así como al derecho a la salud, contenidos en los artículos 21, y, 50, de la Constitución Política.
Asimismo, de los elementos probatorios, no es posible encontrar justificaci ón válida por parte del ente municipal en brindar una solución efectiva al problema planteado. Lo anterior por cuanto, en atención a lo dispuesto en el artículo 169, de la Constitución Política, a las municipalidades les corresponde la “administración de los intereses y servicios locales en cada cantón” , de manera que para este Tribunal resulta inaceptable que tengan conocimiento de los hechos denunciados por la recurrente, que además constituye un problema de salud pública que afecta esa zona, sin que haya buscado una solución definitiva a dicho problema. Precisamente, dicha situación vulnera los derechos fundamentales del promovente y los habitantes de ese sector, en detrimento de los derechos a la salud y a un ambiente libre de contaminación. Por lo expuesto, se evidencia una violación al derecho fundamental a un ambiente sano y ecológicamente equilibrado, así como al derecho a la salud, en perjuicio de la recurrente, así como de los vecinos de la zona afectada (distrito de Gravilias). En razón de lo expuesto, lo procedente es declarar con lugar el recurso, como se dispondrá en la parte dispositiva de esta Sentencia.
1. El contexto histórico que motivó en su momento la amplia intervención de la Sala en materia ambiental, ha tenido una considerable variación que impone a este órgano reconsiderar las condiciones para su participación en el aseguramiento del derecho de las personas a un ambiente sano y equilibrado, tal y como ha sido tutelado en el artículo 50 de la Constituci ón Política. En efecto, la situación actual –caracterizada por una amplísima producción legal y reglamentaria que incluye reglas de fondo, procedimientos y creación de órganos para el cumplimiento de lo ordenado en la Carta Fundamental- es radicalmente diferente de la anterior, en la cual la ausencia de normativa y de instancias estatales con competencia apropiada, le impuso a la Sala un papel de protagonista, casi único, en la defensa del precitado derecho constitucional.
2. Hoy en día, nos encontramos frente a un “denso entramado” de normativa ambiental, lo cual ha producido dos fenómenos relevantes: el primero y más obvio, es el surgimiento de una abarcadora regulación jurídica respecto de actividades cuya incidencia en el ambiente estaba poco o nada ordenada, así la creación de órganos estatales con potestades de vigilancia y control sobre los efectos de la actividad humana en el entorno. El segundo fenómeno consiste en que esa creciente juridificación – predominantemente legislativa y reglamentaria– trae aparejada una ineludible entrada en escena tanto de la justicia administrativa como de la jurisdicción ordinaria -prioritariamente la contencioso administrativa, pero también la penal. En ellas, acorde con la importancia del derecho ambiental, se han regulado de forma amplia vías procesales y medios de legitimación incluyentes, de manera que los administrados puedan hacer valer lo establecido en ese amplio orden jurídico que se relaciona con el tema ambiental.
3. En ese contexto, no resulta apropiado jurídicamente, ni desde el punto de vista funcional, que la Sala Constitucional desplace, o -peor aún- sustituya, a los órganos de justicia ordinarios en la realización de su tarea, también de rango constitucional, de velar por el efectivo cumplimiento de leyes y reglamentos. Es impropio jurídicamente porque en la inmensa mayoría de estos casos lo que se solicita es que interprete y haga valer normas legales y reglamentarias con lo que arriesga traslapar sus competencias con las de otros órganos jurisdiccionales que –ellos sí- han sido creados para ejecutar tales tareas; y resulta también funcionalmente incorrecto, porque el diseño de sus procesos se aviene mal con la complejidad que está presente en numerosos conflictos ambientales que se componen de series de hechos y actos técnica y jurídicamente complejos. Sobre ambas cuestiones existen conocidos ejemplos en los que la Sala ha arrojado una resolución a medias o técnicamente incompleta, o bien se han generado fricciones innecesarias y afectación de la seguridad jurídica.
4. Como parte de los aspectos técnicos que he valorado, añado que está el hecho de que esta jurisdicción no cuenta con jueces ejecutores de sentencia que permitan darle seguimiento adecuado a las mismas -generalmente complejas-, que implican en ocasiones el seguimiento de planes remediales, entre otros, con coordinación interinstitucional y seguimiento de meses y hasta años.
5. Desde esa perspectiva, la decisión de dar un paso al lado en la materia ambiental por parte de este Tribunal no debe ser vista como un abandono de la materia ambiental, sino al contrario, de su adecuada tutela en la instancia que mejor se aviene a la naturaleza de su complejidad y diversidad. Asimismo tampoco debe ser visto como la declinación de esta instancia en su tarea de protección de los derechos constitucionales que le imponen la Constitución Política y su Ley Orgánica, que desde mi punto de vista, queda reservada en esta materia para casos específicos. Se trata más bien, de un ejercicio de reacomodo de las cargas y tareas que corresponden a los distintos órganos estatales, de manera que cada uno de ellos, pueda desplegar plenamente su labor dentro del ámbito que se le ha asignado, así como del ejercicio de fijar su propia competencia, según lo establece el artículo 7 de su Ley Orgánica.
6. Queda claro que la Sala no se plantea abandonar a otras jurisdicciones la labor de protección de los derechos de las personas en materia ambiental. Es conocido que si bien todo reclamo por infracción de normas legales y reglamentarias puede ser reconducido hasta el ámbito constitucional, existen casos cuya resolución no exige más que la aplicación del derecho de la Constitución. Se trata entonces de lograr que la Sala se convierta en protagonista junto con otros, de manera que –entre todos y cada uno en su espacio- se pueda cubrir toda la variedad de situaciones que presenta una protección del derecho a un medio ambiente sano y equilibrado dentro de una sociedad en la que también existen otras necesidades igual de acuciantes. Con esta posición creo firmemente que el ciudadano no pierde un ápice de protección pero se gana sustancialmente en amplitud, en perspectiva y en respeto al equilibrio y distribución de poderes, principio este último de obligada consideración, puesto que rige la dinámica constitucional de cualquier sistema liberal y democrático como el nuestro.- 7.
En línea con lo anterior, sostengo que esta Sala debe abstenerse de conocer los reclamos que se le presenten por supuesta infracción al artículo 50 de la Constitución Política para dejar en manos de la justicia administrativa y la jurisdicción contenciosa administrativa su conocimiento. Lo anterior se deja afirmado con carácter general, sin perjuicio de reconocer la existencia de casos particulares o grupos de casos que, según mi criterio, si resultarían aún mejor tutelados por esta Sala y por tanto deben ser conocidos y resueltos por ella.- Dentro de tales grupos de casos, y sin que esta enunciación pueda considerarse como una lista cerrada y definitiva, puedo señalar que la Sala debe reservarse el conocimiento de situaciones como por ejemplo los reclamos por infracciones ambientales que además pongan en riesgo directo la salud de las personas, o el acceso o calidad del agua; los casos de violaciones groseras y directas al ambiente y en los cuales se constate una palmaria ausencia de la protección por parte de las autoridades estatales, siempre y cuando además la naturaleza del reclamo permita ser abordado mediante el instrumento del amparo como instituto procesal sumario y especial, ya que estimo que tampoco se debe “ordinariar” el amparo para abordar, aún en estos casos citados, temas que rebasen la capacidad de ser atendidos adecuadamente en el mismo.
8. En el caso concreto, de conformidad con los hechos probados, el reclamo de la parte recurrente, podría eventualmente incidir en su salud y la de la su familia. En consecuencia, es claro que estamos ante las excepciones que mencionan y por esa razón he considerado necesario que la Sala ejerciera su competencia, para comprobar o descartar si las omisiones señaladas, vulneran los derechos fundamentales de las personas amparadas.
En asuntos ambientales, es criterio del suscrito, que, si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente acusa que la Municipalidad de Desamparados no ha brindado una solución al problema de contaminación por aguas negras y desbordamiento de una quebrada, situación que afecta las viviendas y salud de los vecinos del lugar, sin que la problem ática sea resuelta de forma definitiva, provocando afectación de un ambiente sano y ecológicamente equilibrado.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara con lugar el presente recurso. Se ordena a Gilberth Jiménez Siles, en su condici ón de Alcalde Municipal, a Álvaro Antonio Fallas Segura, en su condición de Regidor y Presidente del Concejo Municipal y a Pablo Brenes Azofeifa, en su condición de Coordinador del Proceso de Fiscalización Urbana y Rural, todos funcionarios de la Municipalidad de Desamparados, o a quienes en sus lugares ejerzan dichos cargos, que realicen las gestiones necesarias, dentro del ámbito de sus competencias, a efectos de que dentro del plazo de DOCE MESES, contado a partir de la notificación de esta sentencia, se realice lo pertinente, para que la afectación ambiental, producida por las inundaciones que se generan en la comunidad de Gravilias, Desamparados, sean solventadas por completo. Lo anterior se dicta con la advertencia de que, de conformidad con el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá pena de prisión de tres meses a dos a ños o de veinte a sesenta días multa a quien reciba una orden de esta Sala que deba cumplir o hacer cumplir y la inobserve, siempre que el delito no esté más gravemente penado.
Se condena a la Municipalidad de Desamparados al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. La Magistrada Hernández López, pone nota sobre el reclamo por infracción del artículo 50 de la constituci ón política. El Magistrado Salazar Alvarado pone nota. Notifíquese.- Fernando Castillo V.
