Constitutional challenge (acción de inconstitucionalidad) brought in case number 18-004023-0007-CO by [Nombre 001] AND [Nombre 002] against the Manual for Regulatory Plans as a Land-Use Planning Instrument, issued by the Junta Directiva del Instituto Nacional de Vivienda y Urbanismo at ordinary session No. 6296, Article II, subsection 1), of 14 de diciembre de 2017.
Findings of Fact (Resultando):
1.- In a filing received by the Sala on 9 de marzo de 2018, the petitioners brought a constitutional challenge against the Manual for Regulatory Plans as a Land-Use Planning Instrument, issued by the Junta Directiva del Instituto Nacional de Vivienda y Urbanismo at ordinary session No. 6296, Article II, subsection 1), of 14 de diciembre de 2017. The provision is challenged on the ground that it violates the precautionary, non-regression, progressivity, and objectification principles in environmental matters. These regulations repeal the Procedural Manual for the Preparation and Drafting of Regulatory Plans and, therefore, relax the requirements and create confusion and legal uncertainty regarding the inclusion of the environmental variable (variable ambiental) in regulatory plans. That manual contains a definition of land-use planning (ordenamiento territorial) that is regressive and contrary to the principle of progressivity, to the detriment of the rights protected by Articles 21 and 50 of the Constitución Política.
This is because it takes only an anthropocentric approach and entirely disregards the environmental variable and environmental matters. They contend that the repealed regulations did provide for the environmental variable when regulatory plans were adopted. The new regulations lower the previously existing environmental standards and, to that extent, are regressive and violate the principle of progressivity. These regulations also contradict the scope of Advisory Opinion OC-23/17 of 15 de noviembre de 2017, issued on environmental matters by the Corte Interamericana de Derechos Humanos. Under the concept of environmental land-use planning (ordenamiento ambiental del territorio), human activities (or human actions) are distributed according to the land’s natural suitability and environmental limitations, rather than on the basis of political bargaining or the negotiation, coordination, or harmonization of decisions among the various stakeholders.
In their view, the rationale of land-use planning is the environmental sustainability of human activities and the rational use of land and its natural resources within a balanced framework, in order to promote the socioeconomic development of regions and improve quality of life. They assert that the manner in which SETENA’s role is addressed in the challenged manual is confusing and misleads its users regarding the inclusion of the environmental variable. They contend that the prior regulations referred to environmental fragility (fragilidad ambiental), whereas the current regulations do not. This situation contradicts the scope of the aforementioned advisory opinion. The manner in which the environmental variable is referenced in the challenged manual is also regressive. In their view, instead of referring to the Environmental Fragility Map (Mapa de Fragilidad Ambiental) established by Decreto Ejecutivo n.° 32967- MINAE, that manual describes the “Preparation, analysis, and integration into the Regulatory Plan of the products requested by the Secretaría Técnica Nacional Ambiental and the Servicio Nacional de Riesgo y Avenamiento.” And it is precisely here that the principle of non-regression is violated because, instead of requiring the Environmental Fragility Map in accordance with the concept of Environmental Land-Use Planning established in Decreto 32.967-MINAE (…), it establishes something not governed by that decree, namely the “Environmental axis and its products,” thereby creating a kind of “technical mixture” with the issue of SENARA’s requirements concerning the application of its Hydrogeological Vulnerability Matrix (Matriz de Vulnerabilidad Hidrogeológica).
They consider that, in this respect, that manual contradicts the scope of Decreto Ejecutivo No. 32967-MINAE and thereby violates the principle that regulations may not be derogated from in individual cases (principio de inderogabilidad singular de los reglamentos). They assert that the manner in which the challenged regulations address hydrogeological vulnerability (vulnerabilidad hidrogeológica) and SENARA’s role creates confusion and legal uncertainty in the procedure for integrating the environmental variable. They assert that the Instituto Nacional de Vivienda y Urbanismo creates a contradiction by requiring SENARA’s generic matrix for all regulatory plans. Finally, they allege that, because this constitutes a new land-use planning policy, it should have undergone a prior review known as a strategic environmental assessment (evaluación ambiental estratégica), which did not occur in this case, to the detriment of Constitutional Law (Derecho de la Constitución).
2.- In a filing submitted to the Sala on 12 de marzo de 2018, petitioner Astorga clarified the initial application.
3.- By an order issued at 9:40 a.m. on 9 de mayo de 2018, the Sala stayed the proceedings in this action pending resolution of the constitutional challenge in case No. 15-014450-0007-CO.
4.- In a filing received by the Sala on 17 de mayo de 2018, petitioner Astorga requested that the preceding order be revoked.
6.- By an order issued at 9:20 a.m. on 20 de marzo de 2019, the Sala continued the proceedings in this matter because the challenge in case 15-014450-0007-CO had been denied.
It refers to the Sustainable Development Goals adopted by Costa Rica, as well as its commitment to sustainable urbanization through the United Nations New Urban Agenda in the context of the Third United Nations Conference on Housing and Sustainable Urban Development (Habitat III). That Agenda incorporates a new recognition of the correlation between sound urbanization and development, further highlighting the connection between the New Urban Agenda and the 2030 Agenda for Sustainable Development. It states that the challenged Manual is an action aimed at fulfilling those commitments. It partially transcribes the aforementioned advisory opinion. It reiterates that the State must integrate the environmental variable with the other factors. It considers that the Manual should not be limited to a single perspective, but should adopt a broad and objective approach. The conception of land-use planning (ordenamiento territorial) set forth in the Manual encompasses and incorporates all these sectoral perspectives, but transcends them through a comprehensive approach or model, respecting the weight that each carries within the process.
The Manual adopts a more global, integrative, and systemic approach involving economic, social, cultural, aesthetic, spatial and physical, and natural aspects, seeking balance in the final land-use planning proposal, which will be provided by scientific and technical studies, the multidisciplinary and interinstitutional working team, and the legal framework in force. It notes that this approach is more difficult to implement and manage, but is also more rational and better aligned with reality than sectoral or reductionist approaches that seek to impose only one perspective according to their interests and needs. Under this approach, land-use planning constitutes the process of organizing Land Use and Territorial Occupation (Uso del Suelo y la Ocupación del Territorio) according to its biophysical, socioeconomic, cultural, environmental, and political-institutional characteristics, for the purpose of promoting sustainable development.
Although land-use planning, whether at the local, regional, or national level, is not per se the final or definitive solution to all the socio-territorial contradictions of the prevailing economic development model, it does seek, based on this novel theoretical, conceptual, and methodological approach of a comprehensive and multidisciplinary nature, to play a fundamental role in resolving and preventing significant conflicts through its regulatory rules and spatial-planning instruments (instrumentos de planificación territorial). With respect to the alleged anthropocentrism, it asserts that land-use planning and planning cannot disregard or abstract themselves from other social processes—apart from environmental matters. It refers to the Manual de Instrumentos Técnicos para el Proceso de Evaluación del Impacto Ambienta: “The IFA Zoning Map MUST NOT be regarded as the land-use zoning map (mapa de zonificación de uso del suelo) produced by the Regulatory Plan (Plan Regulador) or the Land-Use Plan (Plan de Uso del Suelo); rather, it is an input for the diagnostic component, which applies the environmental premise and establishes the basis for the authorities, together with the other social stakeholders involved, to decide on the most suitable and appropriate uses to be assigned to the land within the territory being planned.” It refers to the concepts of “territory.” It explains that they share a common space and interact with and affect one another simultaneously within a close dialectical relationship.
Accordingly, the concept incorporated into the Manual—taking all these perspectives into account—remains within a conception that views nature as a condition governing human activities, in terms of the potential and limitations derived from the Environmental Fragility Maps (Mapas de Fragilidad Ambiental) and other regulations and methodologies in force, thereby resolving sectoral contradictions and approaches without causing either the definition or concept of land-use planning, or the Manual itself, to become “regressive or permissive,” much less deserving of the term used pejoratively by the parties: “urbanizing developmentalist.” It notes that the Ley Orgánica del Ambiente itself (Articles 29, 30, and 31) incorporates the need for the participation of residents and other social processes. Based on the hierarchy of laws (jerarquía normativa), it asserts that the Manual is subordinate and neither contravenes nor supersedes the provisions of Executive Decree No. 32967-MINAE, as the technical procedure currently in force for introducing the environmental variable into regulatory plans or other land-use planning; the Manual supplements it.
It reiterates that the challenged Manual is an update that does not repeal the previous Manual de procedimientos para la elaboración y redacción de Planes Reguladores (La Gaceta No. 58 of March 22, 2007). It is based on the approach contained in that document and incorporates the amendments necessary to respond adequately to the conceptual, regulatory, procedural, and other transformations that the country has experienced in the fields of urban planning and land-use planning. It also sets forth the mandatory guidelines established in Urban Planning Law No. 4240 and other regulations in force on the subject, as well as guidelines of an advisory nature. It lists the background to the Manual. To update the previous Manual, INVU formed an internal commission charged with carrying out the task. It cites the commission’s objectives. It describes the structure of the Manual (five chapters). It asserts that both the IFAs and hydrogeological studies are inherent elements of the assessment (diagnóstico) for any regulatory plan; both help define the most appropriate uses to be assigned to the territory being planned.
They cannot issue land-use planning guidelines on their own because the professional teams responsible for preparing a regulatory plan must be multidisciplinary and multiinstitutional. Likewise, Land-Use Planning and Urban Planning processes are dynamic over time and space; hence the pressing need to update the regulation through publication of the Manual de Planes Reguladores como Instrumento de Ordenamiento Territorial, without diminishing environmental analysis or reference to the protection of hydrogeological resources, in accordance with constitutional case law. It mentions that, in addition to SETENA and SENARA, approximately 27 government bodies participated. It requests that the action be dismissed.
Then, with regard to the alleged erroneous interpretation of Constitutional Chamber ruling No. 8892-2012, insofar as, in the applicants’ view, it was unnecessary to issue a generic aquifer-protection matrix, it should be emphasized that the issuance of a general standard on hydrogeological vulnerability (vulnerabilidad hidrogeológica), applicable to all cantons in the country, increases the level of protection afforded to that resource and, moreover, that the Constitutional Chamber endorsed the possibility of issuing a new matrix in that same ruling. Regarding the alleged lack of administrative coordination caused by SENARA Agreement No. 4967 at ordinary session 668-15 of 13 de abril de 2015 and the agreement of the INVU Board of Directors adopted under Article IV, subsection 1, of the minutes of ordinary session No. 6113 of 26 de marzo de 2015, it states that those provisions were part of the transitional procedure for preparing regulatory plans (planes reguladores), which ultimately took form in Executive Decree 39150 and was upheld by the Constitutional Chamber in ruling No. 20341-2018.
Lastly, it considers equally untenable the applicants’ argument that the challenged Manual is unconstitutional because it was not subjected to a strategic environmental assessment (evaluación ambiental estratégica). According to Article 1 of Decree 32967, every land-use planning process (planificación de uso de suelo) carried out in the country, including public or private cantonal or local regulatory plans, in which the development of activities, works, or projects that could affect the environment is planned, must incorporate the environmental variable (variable ambiental) in accordance with the Procedure for Introducing the Environmental Variable into Regulatory Plans or Other Land-Use Planning established in Anexo 1 of the aforementioned Decree. According to that same Decree, strategic environmental assessment consists of the “Environmental Impact Assessment Process (Proceso de Evaluación de Impacto Ambiental) applied to policies, plans, and programs.
Given its characteristics and nature, this type of process may also be applied to projects of national, binational, or Central American regional significance, or pursuant to multilateral agreements.” (Article 3.7 of Anexo I of Executive Decree No. 32967). From a reading of Anexo 1, it concludes that, in general terms, such an assessment is conducted using the environmental fragility index methodology (metodología de índices de fragilidad ambiental), such indices being understood as “the total balance of the environmental load (carga ambiental) of a given geographical area, summarizing its natural suitability (biotic, geological, and potential land use), the induced environmental-load condition, and the capacity to absorb additional environmental load associated with resource demand.” (Article 3.12 of Anexo I). After conducting the technical analysis of the various factors set forth in the Decree, it is possible to determine which areas are environmentally fragile areas (áreas ambientalmente frágiles), understood as a “geographical area that, based on its geosuitability conditions, land-use capacity, constituent ecosystems, and particular sociocultural characteristics, has a restricted carrying capacity and certain technical limitations that must be considered when it is used for human activities.” (Article 3.2 of Anexo I of Executive Decree No. 32967).
In light of the foregoing, it is clear that strategic environmental assessment must be applied to plans and policies that have a direct impact on land use, but it cannot be applied to a general standard of an advisory and optional nature such as the one challenged, which, far from planning land use, provides guidance on the procedure to be followed in preparing regulatory plans, which must indeed undergo such an assessment. It recommends dismissing the action.
Justice Rueda Leal delivers the opinion; and,
Whereas:
I.Admissibility of the action. Numeral 75 of the Ley de la Jurisdicción Constitucional establishes that the existence of a pending matter requiring resolution is unnecessary when the action seeks to protect diffuse interests (intereses difusos). In the case under review (sub examine), the petitioners state that their standing (legitimación) arises from the protection of the right to a healthy and ecologically balanced environment. Since this is indeed a diffuse interest, the Chamber finds the action admissible pursuant to ordinal 75 of the Ley de la Jurisdicción Constitucional.
II.Subject matter of the challenge. The petitioners allege the unconstitutionality of the Manual de Planes Reguladores como Instrumento de Ordenamiento Territorial, issued by the Board of Directors of the Instituto Nacional de Vivienda y Urbanismo at ordinary session n.° 6296, Article II, subsection 1) of 14 de diciembre de 2017.
III.Merits. The first ground of unconstitutionality asserted by the petitioners concerns the effects of the order admitting the constitutional action (auto de curso de la acción de inconstitucionalidad) 15-014450-0007-CO. In their view, because the provision challenged in that proceeding—decree n.° 39150-MINAE-MAG-MIVAH-PLAN-TUR—was suspended by order of the Chamber, the Manual at issue here could not be issued using that decree as its legal basis. This Court notes that it addressed that point when ruling on the application filed by the petitioners on 17 de mayo de 2018. Indeed, by decision 2018-9215 issued at 9:20 hours on 13 de junio de 2018, it stated:
“III.- It should be noted that the alleged noncompliance, in this specific case, with the suspensive effects of the decision issued by the Presidency of the Constitutional Chamber when it admitted action No. 15-014450-0007-CO must be addressed in that case file and not in the present proceeding; therefore, no ruling on those issues is issued at this time. Consequently, the application filed must be denied.-“ Furthermore, by judgment n.° 2018-20341 issued at 9:45 hours on 7 de diciembre de 2018, the action filed in expediente 15-014450-0007-CO was dismissed. Accordingly, the validity and effectiveness of the provision challenged in that proceeding have not been affected, and there is therefore no current interest in discussing whether it may serve as the basis for the Manual challenged here.
IV.As a second point, the petitioners contend that the Manual violates the principle of non-regression (principio de no regresión) and the principle of progressivity (principio de progresividad), insofar as the definition of “land-use planning (ordenamiento territorial)” provided by the Manual disregards and diminishes the requirements of the current definition of “environmental land-use planning (ordenamiento ambiental del territorio),” established in decree 32967-MINAE.
The definition cited by the petitioners reads:
“3.2. LAND-USE PLANNING Land-use planning is an administrative process through which the State, municipal governments, and other public entities regulate, guide, and promote various actions within the territory. It is also a political and participatory process, based on legal, technical, and scientific support, which is implemented through negotiation, coordination, consensus-building, and decision-making among the different social actors associated with a territory. (…)” They allege that this definition takes an anthropocentric approach and disregards environmental matters.
In this regard, INVU stated that the petitioners presented a biased and partial definition of land-use planning in order to claim that it is regressive. For its part, the Office of the Attorney General (Procuraduría) asserts that the challenged provision does not disregard the connection between land-use planning and the environment, because it expressly refers to that connection in the definition of land-use planning set forth in point 1.3.49, stating that this administrative, political, and participatory process makes it possible to harmonize the well-being of the population with the use and conservation of environmental resources, serves as a guide for the sustainable use of environmental components, and makes it possible to balance the sustainable development of the country’s different regions. Likewise, the Manual refers to the environmental variable (variable ambiental) in point 1.3.67 and expressly cites, in point 2.5, the concept of land-use planning established by the Ley Orgánica del Ambiente.
After analyzing the arguments, the Chamber rejects the claim for the following reasons. First, this Court finds that the environmental aspect was indeed addressed in the definition challenged by the petitioners. As the INVU representative indicates, they provided a partial transcription that omitted environmental matters. Point 3.2, when transcribed in full, states:
“3.2. LAND-USE PLANNING Land-use planning is an administrative process through which the State, municipal governments, and other public entities regulate, guide, and promote various actions within the territory. It is also a political and participatory process, based on legal, technical, and scientific support, which is implemented through negotiation, coordination, consensus-building, and decision-making among the different social actors associated with a territory.
According to the Ley Orgánica del Ambiente, the purposes of land-use planning include the following:
- Harmonizing the well-being of the population with the use and conservation of environmental resources - Optimally locating economic and productive activities, human settlements, public areas, public services, Protected Wildlife Areas (Áreas Silvestres Protegidas, ASP), infrastructure projects, among others - Serving as a guide for the sustainable use of environmental components - Balancing the sustainable development of the country’s different regions - Promoting citizen participation in territorial planning That Law states in its Article 31 that, to fulfill the stated purposes, the development and reorganization of cities must be promoted through the intensive use of urban space. This highlights the role of urban planning as a central component of land-use planning.” (Underlining added).
It is apparent that the complete definition does refer to environmental matters, creating a link with the purposes established in the Ley Orgánica del Ambiente. The inclusion of the environmental component in the definition of land-use planning is also evident in the definition contained in section 1.3 of the Manual:
“49) Land-use planning: An administrative, political, and participatory process, based on legal, technical, and scientific support, through which the State, municipal governments, and other public entities manage, regulate, guide, and promote various actions within the territory to fulfill their purposes. It makes it possible to harmonize the well-being of the population with the use and conservation of environmental resources, as well as to optimally locate economic and productive activities, human settlements, public areas, public services, among others. It serves as a guide for the sustainable use of environmental components. It makes it possible to balance the sustainable development of the country’s different regions. It promotes citizen participation in territorial planning.” (Underlining added).
Furthermore, the existence of a definition of land-use planning in this Manual does not entail the automatic repeal of the definition of Environmental Land-Use Planning in decree 32967-MINAE, because the hierarchy of legal norms (jerarquía normativa) precludes it—one is an executive decree, while the other is an institute’s manual—and because such a conclusion also disregards the possibility of a systematic interpretation (interpretación sistemática) based on the specialized subject matter of each provision.
V.In the third factual allegation of the initiating pleading, the petitioners contend that the challenged Manual is confusing because it does not expressly incorporate decree 32967-MINAE. They complain of a lack of clarity regarding the incorporation of the environmental variable and environmental fragility (fragilidad ambiental) established in that decree. They then compare the introduction of the environmental variable into regulatory plans (planes reguladores), pursuant to the cited decree, with the environmental component (eje ambiental) of the challenged Manual, concluding that the principle of non-regression is violated because the latter does not include elements required by the former. In analyzing this issue, the Office of the Attorney General stated that the challenged provision is a nonmandatory guidance instrument addressing the concepts and procedures for preparing and managing regulatory plans; by its nature, it cannot render an executive decree currently in force ineffective.
It also referred to point 2.6, which cites the related regulations and expressly mentions the Manual de Instrumentos Técnicos para el Proceso de Evaluación del Impacto Ambiental Parte III (executive decree n.° 32967), concerning the procedure for incorporating the environmental variable into regulatory plans. It stated that, in governing the procedure for preparing such plans, the Manual specifies that the techniques and procedures established by SETENA and SENARA in their current regulations must be used and followed when analyzing the environmental component.
In analyzing this issue, the Chamber agrees with the assessment of the Procuraduría General de la República. As a starting point, this Court explains that it is not a legal advisory body; therefore, the petitioners’ “confusion” does not per se constitute a constitutional violation, but merely raises a question of ordinary legality. Similarly, it is irrelevant to count—as the petitioners do—the number of times the concepts of “fragility” and “introduction of the environmental variable” are used in one provision or the other.
Without prejudice to the foregoing, the Chamber recognizes the importance of determining whether the challenged provision constitutes regression in environmental matters, as the petitioners argue. On this point, the petitioners compare the guidelines in decree 32967-MINAE with the incorporation of the “environmental component” into the challenged Manual. This analysis leads them to conclude that the decree is broader and more protective of the environment.
Irrespective of the comparison made by the applicants, this Court finds that their objection is inadmissible for two reasons. The first concerns the aforementioned hierarchy of norms (jerarquía normativa): the Manual neither repeals nor amends decree 32967-MINAE, since the latter has a higher normative rank. Moreover, the Chamber notes that said decree is treated as legislation related to the Manual (expressly cited in section 2.6). The second reason is the explicit subordination of the application of the Manual to the legislation in force and to the criteria of SETENA and SENARA within their respective fields.
Indeed, the Manual states:
“Each of the dimensions is discussed in greater detail below, indicating the topics to be considered under each one. Certain variables associated with each topic are also identified. This list is not exhaustive, and it is advisable to adapt it to the specific requirements of each territory, except for the Environmental Dimension, whose variables must conform to those defined by SETENA and SENARA in their legislation in force.” (Underlining in the original).
Then, in the section devoted to analysis by dimension (activity 2.5), the challenged Manual reiterates that provision:
“As indicated in Activity 2.1, the techniques and procedures defined by the Planning Team in the Methodological Framework may be used to analyze the Social, Physical-Spatial, Economic, and Political-Institutional Dimensions. By contrast, the analysis of the Environmental Dimension must use those established by SETENA and SENARA in their legislation in force.” (Underlining in the original).
When specifically addressing the environmental dimension, the Manual once again states that the provisions of the legislation in force must be observed, in accordance with the criteria of SETENA and SENARA:
“The analysis of the Environmental Dimension (Environmental Variable) carried out in this activity corresponds to that required by SETENA and SENARA; therefore, the procedures established by those institutions in their legislation in force must be followed.” Given that the challenged Manual expressly refers to the legislation in force—which includes decree 32967-MINAE—as required by SETENA and SENARA, the Chamber dismisses the claim raised.
VI.In the fourth factual allegation of the application, the applicants express their disagreement with SENARA’s role in the challenged Manual, because they believe it creates confusion in the procedure for integrating the environmental variable (variable ambiental). They state that hydrogeological vulnerability maps (mapas de vulnerabilidad hidrogeológica) should be submitted to SETENA rather than SENARA. In its report on this issue, the Procuraduría General de la República stated that the Manual did not modify the procedure established by Decreto Ejecutivo 32967 for incorporating the environmental variable, because that provision remains in force. On the contrary, with regard to the inclusion of the environmental variable and the analysis of hydrogeological vulnerability, it refers to the legislation currently in force for that purpose. It further states that the Manual refers to the Metodología General para la Elaboración de los Estudios Hidrogeológicos para los Planes Reguladores (SENARA resolution No. 4975), rather than to the generic matrix mentioned by the applicants; therefore, the objections concerning that matrix cannot be accepted.
With respect to this point, the Chamber considers the claim inadmissible for the following reasons. As the Procuraduría has stated and as has been reiterated on several occasions, the Manual does not repeal Decreto Ejecutivo 32967 or the legislation governing this matter. Accordingly, it cannot be determined that any modification has been made to the current legal framework or to the powers it assigns to SENARA and SETENA. It should be recalled that the Chamber resolves only jurisdictional disputes involving the public-law entities established in the Ley de la Jurisdicción Constitucional (article 109). Should disputes arise between SENARA and SETENA concerning the powers assigned to each, recourse must be had to the ordinary courts so that they may issue the appropriate ruling.
VII.The fifth point of the action concerns the apparent contradiction resulting from the application of SENARA’s generic matrix to all regulatory plans (planes reguladores). The applicants contend that the Manual does not clearly specify which matrix it refers to (the 2006 or 2017 matrix) and that it contradicts article IV, subsection 1, of the minutes of ordinary session No. 6113 of March 26, 2015, of the INVU Board of Directors, because it imposes requirements that were not required, given that SENARA resolution 4967 exempted municipalities from the obligation to prepare vulnerability maps. In this regard, the Chamber notes that the cited resolutions are not being challenged in these proceedings. Nevertheless, it clarifies that the issue of the five-year transition period referred to by the applicants—which, at bottom, constitutes the basis for their disagreement—was addressed in judgment No. 2018-20341, issued at 9:45 a.m. on December 7, 2018, whose reasoning is incorporated by reference. Finally, it emphasizes that the grievance asserted by the applicants is confined to a question of statutory interpretation, which falls outside the jurisdiction of this Chamber.
VIII.Finally, the applicants allege that the strategic environmental assessment (evaluación ambiental estratégica, EAE) required by the Reglamento de Procedimientos de SETENA was not applied to the challenged provision. The Procuraduría, for its part, rejected that argument because it considers that such an assessment must be applied to plans and policies that directly affect land use, but not to a general provision of a guiding and optional nature that does not plan the use of a territory, but instead establishes guidance on the procedure to be followed when preparing regulatory plans; the latter must indeed undergo such an assessment. After analyzing the parties’ arguments and the relevant legislation, the Chamber agrees with the State’s representative in its assessment of the issue. The Chamber observes that the Manual de Instrumentos Técnicos para el Proceso de Evaluación del Impacto Ambiental (Manual de EIA-Parte III) defines strategic environmental assessment as follows:
“3.7 Strategic Environmental Assessment (EAE): An environmental impact assessment process (Proceso de Evaluación de Impacto Ambiental) applied to policies, plans, and programs. Given its characteristics and nature, this type of process may also be applied to projects of national, binational, or Central American regional significance, or pursuant to multilateral agreements, in accordance with the provisions of these regulations.” However, that definition must be understood within the overall framework of the Manual de Instrumentos Técnicos para el Proceso de Evaluación del Impacto Ambiental. The objectives of the procedure established by that manual are as follows:
“2.1 Objectives of the procedure 2.1.1 The primary purpose of the Procedure is to provide the principal and basic technical guidelines that the municipality, competent authority, or user of the instrument must follow in order to incorporate the environmental impact variable (variable de impacto ambiental), or environmental variable, into land-use planning (planificación del uso del suelo) for the territory under its jurisdiction or of interest to it, and to identify the technical guidelines that SETENA will follow in reviewing and assessing the incorporation of that environmental variable, so that it may ultimately grant Environmental Viability (License) (Viabilidad [Licencia] Ambiental) to the proposal, provided that the defined procedures are fulfilled. (…)” (Underlining added).
This paragraph highlights the connection between the procedure established in that manual and specific territorial planning (…the territory under its jurisdiction or of interest to it…). This connection is a recurring feature of the procedure, including when strategic environmental assessment is specifically discussed:
“6.2 Basic conceptual framework and technical limitations 6.2.1 The Environmental Impact Assessment (Evaluación de Impacto Ambiental, EIA) of projects, works, or activities, including their environmental monitoring once environmental authorization has been granted, may be supplemented by an instrument thereof, namely the Strategic Environmental Assessment (EAE), which is applied to policies, plans, and programs and which, by virtue of its nature and theoretical-methodological principles, is used at an earlier stage in the planning process and has a broader temporal and geographic scope than the traditional EIA.” Note again—as the Procuraduría points out—that strategic environmental assessment is used in a process (policy, plan, or program) having a particular, albeit broad, geographic scope. The same conclusion follows from reading the subsequent sections of that manual (6.2.2 onward).
The Chamber also emphasizes that the challenged Manual was established as a supplement to the Manual de Instrumentos Técnicos para el Proceso de Evaluación del Impacto Ambiental:
“6.3 Procedure for conducting the environmental analysis 6.3.1 The manner in which the objectives identified in the preceding section are achieved and the integration of the environmental impact variable into land-use planning, particularly regulatory plans, is implemented follows a logical sequence that SETENA, together with the authorities of the Instituto Nacional de Vivienda y Urbanismo, has harmonized in the Manual para la elaboración de Planes Reguladores, which supplements this instrument. (…)” This Court observes that both manuals constitute “meta-rules” (metanormas) governing territorial regulation; that is, they do not directly regulate a geographic area, as regulatory plans do, but instead regulate regulatory plans. It bears repeating that strategic environmental assessment is linked to this second group—for example, regulatory plans—which concerns a particular geographic area.
This argument is confirmed by reference to the related legislation, specifically the Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental, article 62 of which states:
“Article 62.-Purpose and scope of the Strategic Environmental Assessment. The purpose of the Strategic Environmental Assessment is to integrate the environmental impact variable into the planning of the country’s economic development. It applies to national, regional, and local development plans, programs, and policies developed by State entities, including municipalities, watersheds, and specific regions, whose purpose is land-use planning, infrastructure development (including urban, roadway, port, communications, energy, tourism, and agricultural infrastructure), or the use of natural resources (mining, energy, hydrocarbons, water, flora, and fauna).” (Underlining added).
A reading of the relevant legislation makes clear that the promulgation of the challenged Manual is free of constitutional defects, because there is no apparent need to conduct a strategic environmental assessment prior to its promulgation.
IX.Conclusion. In view of the arguments set forth above, the Chamber rejects the grievances raised by the applicants and, consequently, dismisses the action.

Acción de inconstitucionalidad promovida en el expediente número 18-004023-0007-CO, interpuesta por [Nombre 001] Y [Nombre 002], contra el Manual de Planes Reguladores como Instrumento de Ordenamiento Territorial, emitido por la Junta Directiva del Instituto Nacional de Vivienda y Urbanismo en la sesión ordinaria n.° 6296, artículo II, inciso 1) del 14 de diciembre de 2017.
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
I.Sobre la admisibilidad de la acci ón. El numeral 75 de la Ley de la Jurisdicción Constitucional establece que no es necesaria la existencia de un asunto pendiente de resolver cuando la acción pretenda la defensa de intereses difusos. En el sub examine, los accionantes refieren que su legitimación proviene de la tutela del derecho al ambiente sano y ecológicamente equilibrado. Dado que efectivamente se trata de un interés difuso, la Sala estima que la acción resulta admisible, en virtud de lo establecido en el ordinal 75 de la Ley de la Jurisdicción Constitucional.
II.Objeto de la impugnación. Los accionantes acusan la inconstitucionalidad del Manual de Planes Reguladores como Instrumento de Ordenamiento Territorial, emitido por la Junta Directiva del Instituto Nacional de Vivienda y Urbanismo en la sesión ordinaria n.° 6296, artículo II, inciso 1) del 14 de diciembre de 2017.
III.Sobre el fondo. El primer motivo de inconstitucionalidad argüido por los accionantes se refiere a los efectos del auto de curso de la acción de inconstitucionalidad 15-014450-0007-CO. En su criterio, dada la suspensión de la norma impugnada en ese proceso –el decreto n.° 39150-MINAE-MAG-MIVAH-PLAN-TUR- por orden de la Sala, entonces no podía emitirse el Manual aqu í discutido utilizando ese decreto como fundamento jurídico. Este Tribunal nota que atendió ese punto al resolver sobre la gestión planteada por los accionantes el 17 de mayo de 2018. Efectivamente, mediante resolución 2018-9215 de las 9:20 horas del 13 de junio de 2018 se indicó al efecto:
“ III.- Cabe mencionar que la desobediencia que se alega, en el caso concreto, con respecto a los efectos suspensivos de la resolución emitida por la Presidencia de la Sala Constitucional, al dar trámite a la acción No. 15-014450-0007-CO, debe ser discutida en ese expediente y no en el presente, motivo por el cual, en esta oportunidad se omite pronunciamiento sobre esos extremos. Por consiguiente, se debe denegar la gestión formulada.-“ Por otro lado, mediante sentencia n.° 2018-20341de las 9:45 horas del 7 de diciembre de 2018 se declaró sin lugar la acción formulada en el expediente 15-014450-0007-CO. En ese tanto, la vigencia y eficacia de la norma cuestionada en ese proceso no ha sido afectada, por lo carece de interés actual discutir si ella puede servir de base al Manual aquí impugnado.
IV.Como segundo punto, los accionantes estiman que el Manual incumple el principio de no regresión y el de progresividad, en la medida en que la definición de “ ordenamiento territorial” que brinda el Manual ignora y disminuye las exigencias de la definición vigente de “ordenamiento ambiental del territorio”, establecida en el decreto 32967-MINAE.
La definición planteada por los actores reza:
“ 3.2. ORDENAMIENTO TERRITORIAL El ordenamiento territorial es un proceso administrativo a través del cual el Estado, los gobiernos municipales y demás entes públicos regulan, orientan y promueven diversas acciones en el territorio. Tambi én es un proceso político y participativo, basado en un soporte legal, técnico y científico, que se implementa mediante la negociación, coordinación, concertación y toma de decisiones entre los diferentes actores sociales vinculados a un territorio. (…)” Acusan que esta definición tiene un enfoque antropoc éntrico e ignora el tema ambiental.
Al respecto, el INVU se ñaló que los accionantes expusieron una definición sesgada y parcial de ordenamiento, a fin de establecer que es regresivo. Por su parte, la Procuraduría afirma que la norma impugnada no desconoce la vinculación del ordenamiento territorial con el ambiente, pues de manera 1.3.49, al indicar que ese proceso administrativo, político y participativo permite armonizar el bienestar de la población con el aprovechamiento y conservación de los recursos ambientales, sirve de guía para el uso sostenible de los elementos del ambiente y hace posible equilibrar el desarrollo sostenible de las diferentes zonas del país. Asimismo, el Manual hace referencia a la variable ambiental en el punto 1.3.67 y cita, de manera expresa, el concepto de ordenamiento territorial que establece la Ley Orgánica del Ambiente en el punto 2.5.
Tras analizar los argumentos, la Sala desestima el reclamo planteado por los siguientes motivos. Por un lado, este Tribunal determina que el aspecto ambiental sí fue contemplado en la definición cuestionada por los accionantes. Tal como indica el representante del INVU, ellos efectuaron una transcripción parcial que no inclu ía el tema ambiental. El punto 3.2, en una transcripción íntegra, señala:
“ 3.2. ORDENAMIENTO TERRITORIAL El ordenamiento territorial es un proceso administrativo a través del cual el Estado, los gobiernos municipales y demás entes públicos regulan, orientan y promueven diversas acciones en el territorio. También es un proceso político y participativo, basado en un soporte legal, técnico y científico, que se implementa mediante la negociación, coordinación, concertación y toma de decisiones entre los diferentes actores sociales vinculados a un territorio.
Según la Ley Orgánica del Ambiente, entre los fines del ordenamiento territorial se encuentran los siguientes:
- Armonizar el bienestar de la población con el aprovechamiento y conservación de los recursos ambientales - Ubicar de forma óptima las actividades económicas, productivas, los asentamientos humanos, las áreas públicas, los servicios públicos, las Áreas Silvestres Protegidas (ASP), las obras de infraestructura, entre otras - Servir de guía para el uso sostenible de los elementos del ambiente - Equilibrar el desarrollo sostenible de las diferentes zonas del país - Promover la participación ciudadana en la planificaci ón de los territorios Dicha Ley indica en su Artículo 31 que, para alcanzar el cumplimiento de los fines señalados se debe promover el desarrollo y reordenamiento de las ciudades, mediante el uso intensivo del espacio urbano. Lo anterior destaca el papel de la planificación urbana como un componente central en el ordenamiento territorial.” (El subrayado es agregado).
Se nota que la definici ón completa sí hace referencia al tema ambiental, creando un vínculo con los fines establecidos en la Ley Orgánica del Ambiente. La vinculación del elemento ambiental en la definición de ordenamiento territorial también sale a la luz en la definición del apartado 1.3 del Manual:
“ 49) Ordenamiento territorial: Proceso administrativo, político y participativo, basado en un soporte legal, técnico y científico, a través del cual el Estado, los gobiernos municipales y demás entes públicos gestionan, regulan, orientan y promueven diversas acciones en el territorio para el cumplimiento de sus fines. Posibilita armonizar el bienestar de la población, con el aprovechamiento y conservación de los recursos ambientales, así como ubicar de forma óptima las actividades económicas, productivas, los asentamientos humanos, las áreas públicas, los servicios públicos, entre otras. Sirve de guía para el uso sostenible de los elementos del ambiente. Hace posible equilibrar el desarrollo sostenible de las diferentes zonas del país. Promueve la participaci ón ciudadana en la planificación de los territorios.” (El subrayado es agregado).
Por otro lado, la existencia de una definición de ordenamiento territorial en este Manual no significa la derogatoria automática de la definición de Ordenamiento Ambiental del Territorio del decreto 32967-MINAE, dado que la jerarquía normativa lo impide –uno es un decreto ejecutivo, el otro un manual de un instituto- y, además, ignora la posibilidad de una interpretación sistemática, basada en la especialidad de cada norma.
V.En el hecho tercero del escrito de interposición, los actores consideran que el Manual impugnado es confuso por no integrar expresamente el decreto 32967-MINAE. Reclaman falta de claridad en cuanto a la integración de la variable ambiental, así como la fragilidad ambiental, establecidas en ese decreto. Luego, comparan la introducción de la variable ambiental en los planes reguladores, según el decreto de cita, con el eje ambiental del Manual impugnado para concluir que se incumple el principio de no regresión, toda vez que el último no incluye elementos que sí requiere el primero. Al analizar este tema, la Procuraduría manifestó que la norma impugnada es un instrumento orientador de aplicación facultativa, sobre los conceptos y procedimientos para la elaboración y gestión de planes reguladores; por su naturaleza, no puede dejar sin efecto un decreto ejecutivo vigente. Además, remitió al punto 2.6, en el que se cita la normativa relacionada y se menciona expresamente el Manual de Instrumentos Técnicos para el Proceso de Evaluación del Impacto Ambiental Parte III (decreto ejecutivo n.° 32967) relativo al procedimiento para incluir la variable ambiental a los planes reguladores.
Señaló que el Manual, al regular el procedimiento de elaboración de los planes, indica que se deben utilizar y acatar las técnicas y procedimientos establecidos por SETENA y SENARA en su normativa vigente para el análisis del eje ambiental.
Al analizar este extremo, la Sala coincide con la valoración de la Procuraduría General de la República. Como punto de partida, este Tribunal explica que no es una instancia de asesoría jurídica, por lo que la “confusión” de los accionantes no produce per se una lesión constitucional, sino una duda de mera legalidad. En un sentido similar, carece de relevancia efectuar un conteo -como efectúan los accionantes- de la cantidad de veces que se utilizan los conceptos “fragilidad ” e “introducción de la variable ambiental ” en una u otra norma.
Sin detrimento de lo expuesto, la Sala reconoce la importancia de determinar si la norma impugnada constituye una regresión en materia ambiental, como arguyen los accionantes. En este punto, los actores comparan los lineamientos del decreto 32967-MINAE con la incorporación del “ eje ambiental” del Manual impugnado. Tal análisis los lleva a concluir que el decreto es más amplio y protector del ambiente.
Independientemente de la comparación efectuada por los accionantes, este Tribunal establece que su reparo es improcedente por dos motivos. El primero se refiere a la ya mencionada jerarquía normativa: el Manual no deroga ni reforma el decreto 32967-MINAE, dado que el segundo es de rango normativo superior. Más aún, la Sala nota que dicho decreto es tomado como normativa relacionada con el Manual (citada expresamente en el punto 2.6). El segundo se debe a la subordinación explícita de la aplicación del Manual a la normativa vigente y los criterios de SETENA y SENARA en sus respectivos ámbitos. Efectivamente, el Manual señala:
“ A continuación, se amplía sobre cada uno de los ejes, indicando los temas por considerar en cada uno. También se señalan algunas variables asociadas a cada tema. Dicho listado no es taxativo y es recomendable que se adecúe a los requerimientos particulares de cada territorio; con excepción del Eje Ambiental, cuyas variables deben responder a las definidas por SETENA y SENARA en su normativa vigente.” (Subrayado en el original).
Luego, en el apartado dedicado al análisis por eje (actividad 2.5), el Manual impugnado reitera tal disposición:
“ Tal como se indicó en la Actividad 2.1; para el análisis de los ejes Social, Físico espacial, Económico y Político Institucional se pueden utilizar las técnicas y procedimientos definidos por el Equipo Planificador en el Marco Metodológico. Mientras que para el análisis del Eje Ambiental se deben utilizar los establecidos por SETENA y SENARA en su normativa vigente.” (Subrayado en el original).
Al tocar el eje ambiental en concreto, el Manual afirma una vez más que debe atenderse a lo dispuesto en la normativa vigente, según los criterios de SETENA y SENARA:
“ El análisis del Eje Ambiental (Variable Ambiental) realizado en esta actividad corresponde al solicitado por la SETENA y el SENARA, por lo que deben acatarse los procedimientos establecidos por dichas instituciones en su normativa vigente.” Visto que el Manual cuestionado remite expresamente a la normativa vigente –la que incluye el decreto 32967-MINAE- según sea solicitado por SETENA y SENARA, la Sala desestima el reclamo planteado.
VI.En el hecho cuarto del escrito de interposición, los actores manifiestan su disconformidad con respecto al papel del SENARA en el Manual impugnado, pues estiman que genera confusión en el procedimiento de integración de la variable ambiental. Señalan que los mapas de vulnerabilidad hidrogeológica deberían ser presentados a la SETENA y no al SENARA. Al informar sobre este extremo, la Procuraduría General de la República señaló que el Manual no modificó el procedimiento fijado por el Decreto Ejecutivo 32967 para la incorporación de la variable ambiental, pues esa norma se mantiene vigente. Por el contrario, para la inclusión de la variable ambiental y el análisis de la vulnerabilidad hidrogeológica, remite a la normativa vigente al efecto. Además, expresa que el Manual hace referencia a la Metodología General para la Elaboración de los Estudios Hidrogeol ógicos para los Planes Reguladores (acuerdo n.° 4975 de SENARA), y no a la matriz genérica a que hacen alusión los accionantes, y, por tanto, no son atendibles los reproches referidos a esa matriz.
Atinente a este punto, la Sala considera que el reclamo es improcedente por los siguientes motivos. Tal como señala la Procuraduría y se ha reiterado en varias oportunidades, el Manual no significa una derogatoria del Decreto Ejecutivo 32967 ni de la normativa que regula esta materia. En ese tanto, no se determina que haya operado una modificación del marco legal vigente, ni de las competencias establecidas por este para SENARA y SETENA. Recuérdese que la Sala únicamente resuelve conflictos de competencia con respecto a los sujetos de derecho público establecidos en la Ley de la Jurisdicción Constitucional (art ículo 109). En caso de surgir conflictos entre SENARA y SETENA en lo que respecta a las competencias asignadas a cada uno, se deberá acudir a la jurisdicci ón ordinaria, a fin de que resuelva lo procedente.
VII.El quinto punto de la acción se relaciona con la aparente contradicción que genera la aplicación de la matriz genérica del SENARA a todos los planes reguladores. Consideran que el Manual no especifica con claridad a cuál matriz se refiere (la de 2006 o 2017) y contradice el artículo IV, inciso 1 del acta de la sesión ordinaria n.° 6113 del 26 de marzo de 2015 de la Junta Directiva del INVU, dado que exige requisitos no exigidos, visto que el acuerdo 4967 del SENARA eximió a los municipios del cumplimiento de elaborar mapas de vulnerabilidad. Al respecto, la Sala nota que los citados acuerdos no son objeto de impugnación en este proceso. Sin embargo, se aclara que el tema del periodo de transici ón de cinco años a que hacen referencia los accionantes -lo que constituye, en el fondo, el motivo de disconformidad- fue conocido en la sentencia n.° 2018-20341 de las 9:45 horas del 7 de diciembre de 2018, a cuyos razonamientos se remite. Finalmente, se destaca que el agravio expresado por los accionantes se circunscribe a una cuestión de interpretación de legalidad, ajena a esta Sala.
VIII.Finalmente, los actores acusan que no se aplicó la evaluación ambiental estratégica a la norma impugnada, de conformidad con el Reglamento de Procedimientos de SETENA. Por su parte, la Procuraduría rechazó el argumento, pues considera que tal evaluación debe ser aplicada a los planes y políticas que tengan incidencia directa en el uso del territorio, pero no a una norma general, de carácter orientativo y facultativo, que no planifica el uso de un territorio, sino que establece una guía acerca del procedimiento que se debe seguir para la elaboración de planes reguladores; estos últimos sí deben ser sometidos a esa evaluación. Luego de analizar los argumentos de las partes y la normativa atinente, la Sala coincide con la representación estatal en su valoraci ón del tema. La Sala observa que el Manual de Instrumentos T écnicos para el Proceso de Evaluación del Impacto Ambiental (Manual de EIA-Parte III) define la evaluación ambiental estratégica así:
“ 3.7 Evaluación Ambiental Estratégica (EAE): Proceso de Evaluación de Impacto Ambiental aplicado a políticas, planes y programas. Por su característica y naturaleza, este tipo de proceso, se puede aplicar, además, a los proyectos de trascendencia nacional, binacional, regional centroamericano, o por acuerdos multilaterales, conforme a lo establecido en este reglamento.” Empero, tal definición debe enmarcarse en la sistemática del Manual de Instrumentos Técnicos para el Proceso de Evaluación del Impacto Ambiental. Los objetivos del procedimiento establecido por ese manual son los siguientes:
“ 2.1 Objetivos del procedimiento 2.1.1 La finalidad primordial del Procedimiento es el de aportar los lineamientos técnicos principales y básicos que deberá cumplir la municipalidad, autoridad correspondiente o usuario del instrumento, para incorporar la variable de impacto ambiental o variable ambiental en la planificación del uso del suelo de su territorio jurisdiccional o de interés, así como indicar los lineamientos técnicos que seguirá la SETENA para revisar y evaluar dicha introducción de variable ambiental, a fin de otorgar en definitiva, y en caso de que se cumplan los procedimientos definidos, la Viabilidad (Licencia) Ambiental a la propuesta. (…)” (El subrayado es agregado).
Se resalta en este párrafo la vinculación del procedimiento establecido en ese manual con la planificación territorial concreta ( …su territorio jurisdiccional o de interés …). Esta vinculación es la tónica del procedimiento, incluso cuando se habla en concreto de la evaluación ambiental estratégica:
“ 6.2 Marco conceptual básico y limitantes técnicas 6.2.1 La Evaluación de Impacto Ambiental (EIA) de proyectos, obras o actividades, incluyendo su seguimiento ambiental una vez que las mismas son autorizadas ambientalmente, puede ser complementada por un instrumento de la misma, que es la Evaluación Ambiental Estratégica (EAE) y que se aplica a políticas, planes y programas, la cual por su naturaleza y principios teórico-metodológicos es utilizada de una forma más temprana en el proceso de planificación y con un alcance temporal-geográfico de una escala mayor que la EIA clásica. ” Nótese nuevamente -tal como lo hace ver la Procuraduría- que la evaluación ambiental estratégica es utilizada en un proceso (política, plan o programa) con un determinado (si bien, amplio) alcance geográfico. La misma conclusi ón se extrae si se continúa la lectura de ese manual en sus puntos siguientes (6.2.2 en adelante).
La Sala también resalta que el Manual impugnado ha sido establecido como complemento del Manual de Instrumentos Técnicos para el Proceso de Evaluación del Impacto Ambiental:
“ 6.3 Procedimiento para realizar el análisis ambiental 6.3.1 La forma en que se logran los objetivos señalados en la sección previa y se materializa la integración de la variable de impacto ambiental en la planificación del uso del suelo, y en particular de los planes reguladores, sigue una sucesión lógica que la SETENA, ha armonizado en conjunto con las autoridades del Instituto Nacional de Vivienda y Urbanismo en el Manual para la elaboración de Planes Reguladores que complementa al presente instrumento. (…)” Este Tribunal observa que ambos manuales constituyen “ metanormas” en materia de regulación territorial; es decir, ellos no regulan directamente un espacio geográfico, como lo hacen los planes reguladores, sino que regulan a los planes reguladores. Se reitera que la evaluación ambiental estratégica está vinculada a este segundo grupo (por ejemplo, planes reguladores), relacionados con un determinado espacio geográfico.
Este argumento se verifica si se acude a la normativa concordante, en concreto, el Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental, cuyo artículo 62 señala:
“ Artículo 62.-Objetivo y alcance de la Evaluación Ambiental Estratégica. La Evaluación Ambiental Estratégica tiene como objetivo integrar la variable de impacto ambiental a la planificación del desarrollo económico del país. Se aplica a los planes, programas y políticas de desarrollo nacional, regional y local; generados en entidades del Estado incluyendo municipios, cuencas hidrográficas y regiones específicas; y cuyo fin sea el planeamiento del uso del suelo, el desarrollo de infraestructura (urbana, vial, portuaria, comunicaciones, energética, turística y agrícola, entre otros), o bien el aprovechamiento de los recursos naturales (minería, energía, hidrocarburos, agua, flora y fauna). ” (El subrayado es agregado).
La lectura de la normativa atinente aclara que la promulgación del Manual cuestionado carece de vicios de constitucionalidad, dado que no se aprecia la necesidad de efectuar una evaluación ambiental estratégica previa a tal promulgación.
IX.Corolario. En virtud de los argumentos expuestos, la Sala descarta los agravios planteados por los accionantes y, en consecuencia, declara sin lugar la acción.
Por tanto:
