San José, at nine twenty in the morning on 30 de octubre de dos mil veinte.
Amparo proceeding (recurso de amparo) processed under expediente número 20-017094-0007-CO, filed by YANCY DE LOS ÁNGELES SILVA SILVA, identity card 0108300861, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Findings:
Regarding official letter N° SUB-G-GSC-UNE-GA-FA-ORAC-RPC-2012 del 19 de junio del 2012, del 19 de junio del 2012, mentioned by the petitioner, she acknowledges that the official letter is in the record. Nevertheless, she clarifies that it concerns water-service availability for the development of a “Private Project,” an urban development called “RANCHO LAS LOMAS,” in connection with which reference was made at the time to the need for a technical study to determine the development’s needs, the system required, and the approximate cost. Geographically, that project is located separately and does not include—and is entirely unrelated to—the location of the property in the Puntarenas registry district, property record number 231660-000, with cadastral plan number P-1024433-2005, for which the water-service request underlying this claim was submitted. Regarding official letter N° JDLP-002-2020-OF del 13 de febrero del 2020 cited by the petitioner, at the Junta Directiva meeting of jueves 13 de febrero del 2020, Ms.
Yancy Silva Silva was indeed provided with the transcript of minutes number 450, article four, reception of visitors, and minutes number 463, article 4, reception of visitors; in the latter, it was indeed resolved to provide the petitioner with the requested documentation. She adds that the petitioner refers to requests for potable-water-service availability dated 21 de agosto and 11 de setiembre de este año, and that, by official letter JDLP-012-2020-OF del 09 de octubre del 2020, she was informed: “…no authorization or power of attorney signed by the property’s registered owner can be verified as empowering Ms. YANCY SILVA SILVA, holder of identity card number 1-0831-0861, to submit that request, nor can it be established that the applicant holds any title or registered right over the property in the Puntarenas registry district, property record number 231660-000; therefore, the applicant lacks legal capacity to act.
In view of the foregoing, before ruling on the merits of the matter, we respectfully inform you—in compliance with the legal and formal requirements governing the submission of public documents—that the aforementioned deficiency must be cured (subsanar), or else the corresponding request must be submitted by the property’s registered owner, so that we may proceed as required by law (…)”. She requests that the proceeding filed be dismissed.
“1.-The only written request submitted by Ms. Yancy Silva was received by email on 24 de agosto del 2020, bearing the date 23 de marzo del 2020 on the document she sent. It was received as correspondence for the ordinary Junta Directiva meeting of 12 de setiembre del2020, minutes # 474. The response pursuant to official letter JDLP-013-2020-OF is attached.” (image 21 of the evidentiary record). Furthermore, as evidenced by images 21 and 22 of the submission received by the Sala Constitucional on 18 de setiembre del 2020, documentation provided by the petitioner, the ASADA informed her through official letter No. JDLP-002-2020, dated 13 de febrero del 2020, that:
“Minutes number four hundred sixty-three, article four: reception of visitors: The following persons are received: Yansy Silva Silva, identity card one eight three zero eight six one, and the young man Emerson Aguilar Gamboa, identity card six zero four zero four zero zero three three; subject: water availability. Ms. Yanci Silva asks whether potable-water service can be provided to her, because she purchased a parcel measuring five thousand two hundred ninety-seven point zero nine square meters from Mr. Mario Andrey Elizondo Molina and believes that she is entitled to, and emphasizes the importance of, having this water resource in order to fulfill her dream of completing the house located on her land near the Grosseto Palma Real entrance. Ms. Silva shows us a document containing the response given to Mr. Rafael Azofeifa Agüero, which discusses the Assessment of the Current Water Situation and Proposed Improvements, prepared by Engineer Arturo Rodríguez in julio del dos mil once, stating that the current system cannot supply new requests.
Based on this documentation, Ms. Silva says that, according to her attorney, it is insufficient grounds for filing an amparo proceeding against the ASADA if water is denied to her. She requests a copy of the document from julio del dos mil once, a photocopy of the minutes of catorce de junio del dos mil diecinueve, and a photocopy of the minutes concerning the visit of veinte y nueve enero del dos mil veinte. Lastly, they stated that they intend to become involved in order to collaborate with the ASADA. It is further clarified that all the aforementioned documentation is intended to formalize an amparo proceeding. The president explains the situation affecting the ASADA and the developments, since the latter do not wish to make improvements to the aqueduct and mislead all their customers when selling them a lot or parcel by claiming that water service is available, whereas at present the well we have supplies only Las Lomas, part of Rancho Las Lomas, Hotel Grosseto, and some nearby residents.
She also states that, if we had water available, we would gladly provide water-service availability. Regarding this matter, it is resolved A): That, for the time being, a water-service connection cannot be provided because the improvements to the Las Lomas aqueduct (well, tank, and distribution network) have not been made. B) It is resolved to provide Ms. Yanci Silva Silva with all the necessary documentation she requests in order to file an amparo proceeding against us if water is denied to her.” Lastly, according to National Registry certification N° RNPDIGITAL-1639382-2020, issued at 09 hours 46 minutes on 14 de octubre del 2020, property Folio Real No. 6-231660-000 is registered in the name of Ms. Valeria Silva Silva, identity card No. 1-1785-0984, and not in the name of the appellant. In this regard, the Regulations for the Provision of AyA Services (Reglamento para la prestación de los Servicios de AyA), Institute Board of Directors Resolution N° 2019-0461, published in Supplement No. 285 of La Gaceta No. 242 of 19 de diciembre del 2019, states the following with respect to Certificates of Service Availability (Constancias de Disponibilidad de Servicios):
“Article 20.- Admissibility requirements and conditions for applications for a certificate of service availability. An application for a certificate of service availability must be submitted by the property owner or the owner’s legal representative to the AyA Service Platforms. For such purposes, the following requirements must be submitted physically or digitally:
a. The application form provided by AyA, available physically or digitally, completed and signed by the registered owner, possessor, representative, or legally authorized person, stating the purpose of the availability request and providing a detailed description of the project.
b. Presentation of an identification document belonging to the property owner or the owner’s legal representative. If technologically feasible, AyA shall exempt the applicant from presenting this requirement by verifying identity through the official digital platform.
For properties registered as undivided interests (derechos), the application may be submitted by the co-owner requiring the service, without requiring authorization from, or the presentation of identification documents belonging to, the other holders of the remaining interests, together with the presentation of a registered cadastral survey (plano catastrado). If the property does not have a registered cadastral survey, a land-survey plan (plano de agrimensura) must be submitted that complies with Article 2 subsection q) of the current Regulations to the National Cadastre Law (Reglamento de la Ley de Catastro Nacional), along with the corresponding CFIA seal pursuant to the current Special Regulations for the Surveying Project Administrator (APT) of CFIA (Reglamento Especial del Administrador de Proyectos de Topografía (APT) del CFIA), as amended, or any regulations replacing them.
c. When the application concerns urban development (urbanización) or subdivision (fraccionamiento) projects classified under the Reglamento de Fraccionamiento y Urbanizaciones del INVU, the applicant must expressly state the number of services requested and the type of project for which the certificate of service availability is sought. If the property consists of undivided interests, the applicant must provide the registered cadastral survey or land-survey plan describing the location of the interest.
Applications involving unregistered properties: In the case of service applications associated with unregistered properties, the possessor must execute before the service-platform officer a sworn declaration (declaración jurada), using a form to be supplied by AyA, which shall be signed by the applicant and two witnesses and shall include a description of the nature of the property, specifying the acts of possession exercised, the existence of any building, the improvements made, and the fact that the property is not registered.
Territories administered by the State or its institutions under a special legal regime: In the case of applications associated with properties classified as territories administered by the State or its institutions under a special legal regime—maritime-terrestrial zone (zona marítimo terrestre), border zones, indigenous territories, tourism development hubs, among others—which are granted through concessions, leases, or allocations, applicants must submit express authorization from the corresponding entity endorsing the application for the procedure, in accordance with the applicable governing rule.
Applications for certificates of availability for plots intended for agricultural, livestock, forestry, or mixed purposes: In the case of applications associated with plots intended for agricultural, livestock, forestry, or mixed purposes on which houses or buildings are intended to be constructed and supplied with water for human use, the applicant must submit the authorization issued by INVU in accordance with the provisions established for that purpose in the Reglamento de Fraccionamiento. For this purpose, the interested party must have a soil and land-use-capability study (estudio de suelos y de capacidad de uso de las tierras) prepared by an authorized Certifier of Conforming Land Use (Certificador de Uso Conforme del suelo), in accordance with the provisions established in the Regulations to the Soil Use, Management, and Conservation Law (Reglamento a la Ley de Uso, Manejo y Conservación de Suelos), Decreto Ejecutivo N°29375-MAG-MINAE-S-HACIENDA-MOPT, and Decreto Ejecutivo N°30636-MAG, entitled Crea el Registro Oficial de Certificadores de Uso Conforme del Suelo, as amended, or any regulations replacing them.
AyA may coordinate with other State institutions any actions it considers appropriate to verify the nature of the plot, as well as any other condition it considers relevant for purposes of granting the requested availability.
Applications for certificates of availability for service stations: In the case of applications associated with properties on which fuel stations are intended to be developed, AyA, through the Environmental Management UEN, shall verify within a period of 10 calendar days whether there is a potential impact on water sources. If an impact is detected, the respective Region shall issue a Water Capacity Letter (Carta de Capacidad Hídrica) indicating that the necessary studies must be conducted based on the methodology in the “Términos de Referencia para Presentar Estudios Hidrogeológicos a la Dirección de Investigación y Gestión Hídrica (DIGH) del SENARA,” published in the Official Gazette La Gaceta Nº 137 of 19 de julio del2017, and Reglamento 510-06 Del Servicio Nacional De Aguas Subterráneas, Riego Y Avenamiento, published in La Gaceta N° 6 of 9 de enero del 2007, including any subsequent regulatory and jurisdictional amendments. If no impact is detected, the applicable recommendations shall be communicated so that a determination may be made regarding whether availability is appropriate. In addition, the respective analysis shall be conducted during the plan-approval (visado de planos) phase of the APC Platform. (As amended by Board of Directors Resolution No. 2018-351 on 24/10/18, Published in La Gaceta Nº 220 of Tuesday, 27 de noviembre del 2018).
Likewise, the respective analysis shall be conducted during the plan-approval phase on the Administrador de Proyectos de Construcción (APC) platform of the Colegio Federado de Ingenieros y Arquitectos (CFIA).
For all circumstances established in this article, and in accordance with the verification and correction (subsanación) of the conditions necessary for service approval, as generally indicated in article 14 of these Regulations, AyA shall verify the following conditions through the available official virtual platforms:
I Property registry certifications.
II Registry certifications of Registered Cadastral Surveys.
III Registry or administrative certifications of current legal representation of legal entities, attorneys-in-fact vested with authority as judicial and extrajudicial representatives or otherwise authorized for such purposes, executors, guardians, and conservators.
Admission of the application shall be subject to compliance with the requirements that the applicant must provide and to the information obtained by AyA from the Official Digital Platforms.
In all cases provided for in this rule, AyA shall verify that the property owner and/or possessor is not in arrears with AyA. The foregoing is intended to enable the applicant to bring the debt into good standing. Cases defined by other rules or agreements are excepted.
Operators acting under delegation from AyA that do not have the aforementioned official digital tools and/or platforms must require interested parties to submit all documentation established in this provision, as required by the respective procedure, as a condition for the admissibility of their application.” The foregoing is based on the fact that, according to the Real Property Section of the Registro Nacional, the appellant has no property registered in her name. He reiterates that the system is operated by ASADA Urbanización Las Lomas de Parrita and that, with respect to Ms. Yancy de los Ángeles Silva Silva, the ASADA Service Office has no pending matter to resolve. He adds that Hotel Grosseto Palma Real has had service since 2007, predating the study conducted by Engineer Arturo Rodríguez. He further states that engineering technical studies are issued and signed by the officials responsible for the Engineering Department.
In this regard, technical report N° SUB-G-GSC-UEN-GA-FA-ORAC-PC-2012-227, dated 19 de junio del 2012, visible in image 8 of the filing received by the Sala Constitucional on 18 de setiembre del 2020, on the basis of which the certificate of service availability for lot Folio Real N° 6-231660-000 has been denied on multiple occasions, bears the signature of Engineer Giovanni García Flores, Área de Ingeniería Sistemas Comunales, RPC. Furthermore, Engineer José Marcial Tinoco Gutiérrez, UEN Gestión de Acueductos Rurales, by official letter No. GSD-UEN-GAR-2020-04349, dated 14 de octubre del 2020 and addressed to the Board of Directors of ASADA Lomas de Parrita, concludes:
“The water balance (balance hídrico) for the ASADA de Lomas Parrita system was requested. Based on the information supplied by the administration, the following conclusions were reached:
Water balance -0.67 for this year 2020 Required storage volume 176 m3 Por tanto, it has been determined that they do not have sufficient water capacity (capacidad hídrica) to grant any further availability. Nor do they have sufficient hydraulic capacity (capacidad hidráulica), given that the current storage volume is 90m3y while 176 m3 is required. It is recommended that new sources be sought.” He requests that the appeal filed be dismissed.
Justice Salazar Alvarado drafted the decision; and,
Considerando:
Because of its exceptional nature, the ordinary processing of amparo proceedings (recursos de amparo) against private-law entities requires first examining whether the matter falls within any of the circumstances that make such a proceeding admissible and, subsequently, if so, determining whether it should be granted. Article 57 of the Ley de la Jurisdicción Constitucional establishes that an amparo proceeding may be brought against the acts or omissions of private-law entities when they act or are required to act in the exercise of public functions or powers, or when, as a matter of law or fact, they occupy a position of power against which ordinary judicial remedies are clearly insufficient or untimely to guarantee the fundamental rights or freedoms referred to in article two, subsection a), of that same Law. In this specific case, those conditions are clearly satisfied because the entity is a private-law entity exercising public powers by providing a public service—namely, the supply of drinking water—and, under the particular circumstances, is in a position to infringe the appellant’s constitutional rights to a drinking-water supply, without ordinary judicial remedies being sufficient or timely.
II.Subject matter of the appeal. The appellant states that she is a resident of Puntarenas, Parrita, La Loma. She indicates that she has requested availability of drinking-water service from the local ASADA on four occasions but has been denied each time. She asserts that the respondent ASADA has four hundred seventy water-service connections (pajas de agua). She alleges that the respondents do not make the improvements required by the system and therefore cannot provide her with the service.
III.Proven facts (hechos probados). Of importance to the decision in this matter, the following facts are deemed duly established, either because they have been proven or because the respondent failed to address them as ordered in the initial ruling:
“(…) A water balance (balance hídrico) was requested for the ASADA de Lomas Parrita system. Based on the information provided by the administration, the following conclusions were reached:
-Water balance -0.67 for this year 2020 -Required storage volume 176 m3 Por tanto, it is determined that they lack the water-supply capacity (capacidad hídrica) to grant additional service availability approvals. They also lack hydraulic capacity (capacidad hidráulica), given that the current storage volume is 90m3y whereas 176 m3 is required. It is recommended that new sources be sought.” (see reports and attached evidence).
The Constitutional Chamber (Sala Constitucional) has repeatedly recognized that the Instituto Costarricense de Acueductos y Alcantarillados, the associations administering aqueducts and sewer systems, and the municipalities that provide drinking water service are fully authorized, before approving or denying requests for drinking water service availability submitted to them, to require compliance with the requirements established by the legal system and to weigh legal and technical considerations. For this reason, in Judgment N° 2010-010768, issued at 10:52 hours on 18 de junio de 2010, this Court ruled as follows:
“(...) Access to public services, including drinking water, which is linked to the fundamental right to health, is subject to requests for their provision meeting minimum formal and technical conditions. In this case, the interested party was informed that, because the property where she resides is not registered in the Public Property Registry, she must provide other information for installation of the service. The Chamber notes that the request was not summarily denied and that the applicant was offered reasonable means of processing her request, given the informal status of the property for which the service was requested. Through those minimum requirements, and by installing a public water source near the residence, her right to drinking water has been adequately protected; accordingly, the proper course is to dismiss the amparo proceeding (amparo).” (See, to the same effect, Judgments N° 2012-005722, issued at 09:05 hours on 4 de mayo de 2012, and N° 2014-001394, issued at 09:05 hours on 31 de enero de 2014, N° 2020-005049, issued at nine hours forty-five minutes on trece de marzo del 2020).
Having established the foregoing, it must be noted that verifying compliance with the legal or technical requirements for obtaining water service availability falls to the respective administrative authorities, and this Chamber may not venture into that subject matter because it pertains to ordinary legality (legalidad ordinaria) and lies outside its jurisdiction. Consequently, it must first be noted that the Constitutional Chamber may not usurp the powers of that ASADA in its role as the active administrative authority (Administración activa) and, once the applicable statutory and regulatory requirements have been verified, order that such availability be granted. Moreover, given that the petitioner expresses disagreement with the requirements without offering any objective and legally cognizable reason for finding that a fundamental right has been directly violated, it is clarified that this Court, for obvious reasons, cannot exempt her from complying with any statutory or regulatory requirement simply because she finds it subjectively inconvenient, since this Chamber has no authority to grant water service availability contra legem, that is, contrary to law.
VI.Regarding the material impossibility of granting new services. This Chamber has also held that, although there is a fundamental right to drinking water, its exercise is not indiscriminate to the point that entities providing that service are obligated to provide it under any conditions and at any time. Specifically, this Chamber has recognized that the Instituto Costarricense de Acueductos y Alcantarillados, municipalities, or associations administering aqueducts and sewer systems may deny drinking water service availability when justified by technical reasons. In this regard, through Judgment N° 2009-003825, issued at 16:49 hours on 10 de marzo de 2009, this Chamber ruled as follows:
“ (...) It is therefore understood that, although there is a fundamental right to water that may be asserted against the corresponding administrative authority, provision of the service may properly be made subject to compliance with the requirements established for granting it and to the material feasibility of supply; that is, there must be no technical circumstances that make it impossible or inadvisable for the administrative authority to provide drinking water service. This means that the administrative authority has no obligation to provide drinking water service when technical reasons make doing so inadvisable or impossible, but it must adequately inform the applicant of the reasons why the request cannot be granted… ”.
The holding in that precedent applies to the case under consideration, since this Court finds no reason to depart from the standard set forth in that judgment or any grounds for assessing the situation presented differently.
VII.Specific case. From the response submitted by the President of the Asociación Administradora del Acueducto Urbanización Las Lomas Parrita and the evidence entered into the case record for resolution of the matter, it has been duly established that the denial of water service availability challenged by the petitioner was not issued arbitrarily. On the contrary, the denial is based on the aqueduct’s current lack of hydraulic and water-supply capacity, pursuant to the Reglamento de Prestación de Servicios del AyA; granting it could therefore impair the service already being provided, in violation of the fundamental rights of those who already receive the service and even of future users. That technical assessment is set forth in official letter N° GSD-UEN-GAR-2020-04349, of 14 de octubre del 2020, addressed to the Board of Directors of ASADA Lomas de Parrita and signed by Engineer José Marcial Tinoco Gutiérrez, UEN Gestión de Acueductos Rurales, of the ICAA, which concludes:
“(…) A water balance was requested for the ASADA de Lomas Parrita system. Based on the information provided by the administration, the following conclusions were reached:
-Water balance -0.67 for this year 2020 -Required storage volume 176 m3 Por tanto, it is determined that they lack the water-supply capacity to grant additional service availability approvals. They also lack hydraulic capacity, given that the current storage volume is 90m3y whereas 176 m3 is required. It is recommended that new sources be sought.” Additionally, the evidence establishes that, by official letter Nº JDLP-002-2020-OF of 13 de febrero de 2020, the president of the Asociación Administradora del Acueducto de Parrita informed the petitioner during her visit as follows:
“At the Board of Directors meeting held on Wednesday, the twenty-ninth of January, two thousand twenty: (…) With respect to this matter, it is resolved A): That, for the time being, she cannot be provided with a water service connection, because improvements have not been made to the Las Lomas aqueduct (well, tank, and distribution network).” Por tanto, the application was denied because it was not technically feasible, pursuant to Article 75 of the Reglamento de Prestación de Servicio de Acueducto. Additionally, on 21 de agosto and 11 de setiembre of this year, the petitioner submitted applications for the availability of drinking-water service to the respondent ASADA, and by official letter JDLP-012-2020-OF dated 09 de octubre del 2020, she was informed: “...no authorization or power of attorney executed by the registered owner of the property could be verified as authorizing Ms. YANCY SILVA SILVA, holder of identity card number 1-0831-0861, to undertake said procedure; nor could it be established that the applicant holds any title or registered right over the property in the province of Puntarenas, registration number 231660-000.
Therefore, the applicant lacks legal capacity to act. In light of the foregoing, before ruling on the merits of the matter, and in the most courteous manner, while complying with the legal and formal requirements governing the submission of public documents, we hereby inform you that the aforementioned deficiencies must be cured or, alternatively, that the corresponding application must be submitted by the registered owner of the property, so that the matter may proceed as required by law (...)”.
Nevertheless, the evidence does not establish that the petitioner complied with the order to cure the deficiencies (prevención) issued by the respondent ASADA through official letter JDLP-012-2020-OF dated 09 de octubre del 2020. Additionally, in the report submitted by the President of the respondent ASADA, she stated under oath that the Technical Regulation “Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes, AR-PSAYA-2013,” approved by ARESEP and published in La Gaceta N° 186 of 29 de septiembre del 2014, Supplement 50, is mandatorily applicable to that ASADA and, insofar as relevant, establishes the obligation of drinking-water service providers to comply with its provisions, as well as with “all current technical regulations governing this subject matter,” Article 6. Article 75(g) provides that drinking-water service providers may deny the service when it “is not technically feasible.” Regarding this issue, it must be borne in mind that the issuance of a service-availability certificate or the connection of a new service entails the present and actual existence of both water-supply capacity (capacidad hídrica) and hydraulic capacity (capacidad hidráulica) within the supply system.
It is evident from the technical assessment that, in the petitioner’s case, she has not complied with the order to cure the deficiencies, because she is not the owner of the real property for which she is requesting the service, in accordance with the Reglamento para la prestación de los Servicios de AyA, Board of Directors Resolution of the Institute N° 2019-0461, published in Supplement N° 285 of La Gaceta N° 242 of 19 de diciembre del 2019, which, with respect to Service-Availability Certificates (Constancias de Disponibilidad de Servicios), states:
“Article 20.- Admissibility requirements and conditions for applying for a service-availability certificate. The application for a service-availability certificate must be submitted by the property owner or the owner’s legal representative to the AyA Service Platforms. For such purposes, the following requirements must be submitted in physical or digital form:
a. The application form provided by AyA and available in physical or digital form, duly completed and signed by the registered owner, possessor, representative, or legally authorized person, indicating the purpose of the availability request and providing a detailed description of the project.
b. Submission of the identification document of the property owner or the owner’s legal representative. If technologically feasible, AyA shall exempt the applicant from submitting this requirement by verifying the applicant’s identity through the official digital platform.” Additionally, there is no technical feasibility (factibilidad técnica) for issuing new service-availability certificates or connecting new services, because there is no certainty that the prerequisites for such feasibility—hydraulic capacity and water-supply capacity—have been met. Lastly, the petitioner’s allegation of purported discrimination, based on the fact that Hotel Grosseto Palma Real is supplied with drinking-water service, is likewise without merit, because it was stated under oath that said Hotel has received service since 2007, a date preceding the studies conducted by ICAA that identified the water-supply-capacity and hydraulic-capacity problems preventing the granting of additional service availability. For the reasons stated, there has been no violation of fundamental rights; accordingly, the appropriate course is to dismiss the application for amparo relief (recurso de amparo), as is hereby ordered.
The parties are advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, such materials must be collected from the court office within a maximum period of thirty business days counted from service of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court at Session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial N° 19 of 26 de enero del 2012, as well as pursuant to the resolution approved by the Superior Council of the Judiciary at Session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.
Por tanto:

*200170940007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del treinta de octubre de dos mil veinte .
Recurso de amparo que se tramita en expediente número 20-017094-0007-CO, interpuesto por YANCY DE LOS ÁNGELES SILVA SILVA, cédula de identidad 0108300861, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Resultando:
En cuanto al oficio N° SUB-G-GSC-UNE-GA-FA-ORAC-RPC-2012 del 19 de junio del 2012, del 19 de junio del 2012, del que hace mención la recurrente, acepta que el oficio consta en autos. No obstante, aclara que el mismo se refiere a disponibilidades de agua para el desarrollo de un “Proyecto de índole Privado”, urbanístico denominado “RANCHO LAS LOMAS”, en donde en su oportunidad se hizo mención de la necesidad de un estudio técnico que determine las necesidades del desarrollo, el sistema requerido y el costo aproximado. Geográficamente, el citado proyecto se ubica de manera independiente, no incluye y es totalmente ajeno con la ubicación de la finca del partido de Puntarenas, matrícula número 231660-000, con plano catastrado número P-1024433-2005, misma sobre la cual se presentó la solicitud de servicio de agua del presente reclamo. En cuanto al oficio N° JDLP-002-2020-OF del 13 de febrero del 2020 que aduce la recurrente, efectivamente, en la sesión de Junta Directiva del jueves 13 de febrero del 2020, hace entrega a la señora Yancy Silva Silva, la transcripción del acta número 450, artículo cuatro, atención de visitas, y del acta número 463, artículo 4, atención de visitas, en este último, efectivamente, se acuerdan brindar a la recurrente la documentación requerida.
Agrega que la recurrente señala solicitudes de disponibilidad de servicio de agua potable, en fechas 21 de agosto y 11 de setiembre de este año, y mediante oficio JDLP-012-2020-OF del 09 de octubre del 2020, se le hizo saber: “…no se logra constatar autorización o poder alguno suscrito por la propietaria registral del inmueble, que faculte a la señora YANCY SILVA SILVA, portadora de la cédula de identidad número 1-0831-0861, a realizar dicha gestión, ni tampoco se logra acreditar que la solicitante ostente titularidad o derecho registral alguno sobre la finca del del partido de Puntarenas, matrícula número 231660-000, por lo tanto, no existe capacidad jurídica en el actuar de la solicitante. A raíz de lo anterior, previo a resolver el fondo del asunto, de la manera más atenta, y cumpliendo con los requisitos de legalidad y forma en la presentación de documentos públicos, le hacemos saber que se debe subsanar lo antes planteado, o bien, que la respectiva solicitud sea gestionada por la propietaria registrad del inmueble, para así, proceder como en derecho corresponde (…)”. Solicita que se desestime el recurso planteado.
“1.-La única solicitud escrita presentada por la señora Yancy Silva, se recibió por correo electrónico el día 24 de agosto del 2020, con fecha en el documento enviado por ella del 23 de marzo del 2020. Recibida en la correspondencia para la reunión ordinaria de Junta Directiva del 12 de setiembre del2020, acta # 474. Se adjunta respuesta según oficio JDLP-013-2020-OF.”(imagen 21 del legajo de pruebas). Además, según se desprende de las imágenes 21 y 22 del escrito recibido por la Sala Constitucional el día 18 de setiembre del 2020, documentación aportada por la recurrente, mediante oficio No. JDLP-002-2020, de fecha 13 de febrero del 2020, se le indicó por parte de la ASADA que:
“Acta número cuatrocientos sesenta y tres, artículo cuarto: atención a visitas: Se atiende las siguientes personas Yansy Silva Silva cédula uno ocho tres cero ocho seis uno y el joven Emerson Aguilar Gamboa cédula seis cero cuatro cero cuatro cero cero tres tres, asunto disponibilidad de agua, la señora Yanci Silva nos comenta que posibilidad hay que se le brinda el servicio de agua potable, ya que ella le compró una parcela de cinco mil doscientos noventa y siete con cero nueve metros cuadrados al señor Mario Andrey Elizondo Molina y considera que tiene derecho y la importancia de contar con este recurso hídrico, para realizar su sueño en poder terminar su casa que está en su terreno y se encuentra por la entrada Grosseto Palma Real. La señora silva nos muestra un documento en donde de que el señor Rafael Azofeifa Agüero se le dio respuesta donde habla sobre el Diagnóstico de la situación del agua actual y mejoras propuestas, elaborado por el Ing. Arturo Rodríguez en julio del dos mil once en donde se le dice que el sistema actual no permite abastecer nuevas solicitudes y con base a esta documentación la señora Silva dice que no es suficiente como para presentar un recurso de amparo a la ASADA, según le dijo su abogado, si se le negara el agua, quiere copia de julio del dos mil once, la fotocopia del acta del catorce de junio del dos mil diecinueve y fotocopia de la acta de la visita del veinte y nueve enero del dos mil veinte y por último comentaron que sus intenciones son involucrarse para colaborar con la ASADA.
Además, se aclara que con toda esa documentación que se mencionan anteriormente es para formalizar un recurso de amparo. La presidenta le explica la situación que está pasando la ASADA y los desarrollos ya que estos no quieren dar mejoras al acueducto y les mienten a todos sus clientes al venderle un lote o una parcela que, si hay disponibilidad de agua, donde la actualidad el pozo que tenemos solo abastece Las Lomas, una parte de Rancho Las Lomas y el Hotel Grosseto y algunos vecinos de ahí. También menciona que si tuviéramos agua con gusto se le brindaría la disponibilidad de agua. Con relación a este asunto se acuerda A): Que por el momento no se le puede dar prevista de agua, ya que no se le ha podido darle mejoras al acueducto de Las Lomas (pozo, tanque y red de distribución). B) Se acuerda brindarle toda la documentación necesaria que pide la señora Yanci Silva Silva para abrirnos un recurso de amparo si se le niega el agua.” Por último, según certificación del Registro Nacional N° RNPDIGITAL-1639382-2020, de las 09 horas 46 minutos del 14 de octubre del 2020, la finca Folio Real No. 6-231660-000 se encuentra a nombre de la Sra. Valeria Silva Silva, cédula de identidad No. 1-1785-0984, y no de la recurrente, en este sentido el Reglamento para la prestación de los Servicios de AyA, Acuerdo de Junta Directiva del Instituto N° 2019-0461, publicado en el Alcance No. 285, de la Gaceta No. 242 del 19 de diciembre del 2019, con relación a las Constancias de Disponibilidad de Servicios, señala:
“Artículo 20.- De los requisitos de admisibilidad y condiciones para la solicitud de la constancia de disponibilidad de servicios. La solicitud de la constancia de disponibilidad de servicios debe ser realizada por propietario del inmueble o su representante legal ante las Plataformas de Servicios de AyA. Para tales efectos se deben presentar de forma física o digital, los siguientes requisitos:
a. Formulario de solicitud proporcionado por AyA, física o digitalmente disponibles, completo y firmado por el propietario registral, poseedor o representante o autorizado legal, en donde se indicará el propósito de la disponibilidad y una descripción detallada del proyecto.
b. Presentación de documento de identificación del propietario del inmueble o su representante legal. De existir factibilidad tecnológica, AyA eximirá al solicitante de la presentación de este requisito con la verificación de identidad a través de la plataforma digital oficial.
En caso de inmuebles registrados en derechos la solicitud podrá realizarla el copropietario que requiera el servicio, sin que sea necesaria la autorización, ni presentación de documentos de identificación de los demás titulares de los derechos restantes y Presentación de plano catastrado. En caso de que la propiedad no cuente con plano catastrado, deberá presentar un plano de agrimensura que cumpla con lo estipulado en el Artículo 2 inciso q) del Reglamento de la Ley de Catastro Nacional vigente y el correspondiente sello del CFIA conforme a lo dispuesto en el Reglamento Especial del Administrador de Proyectos de Topografía (APT) del CFIA vigente y sus reformas o las normativas que los sustituya.
c. Cuando la solicitud refiera a proyectos de urbanización o fraccionamiento tipificados en el Reglamento de Fraccionamiento y Urbanizaciones del INVU el solicitante deberá indicar expresamente el número de servicios solicitados y la tipología de proyecto para el cual se gestiona la constancia de disponibilidad de servicios. En el caso de estar la propiedad en derechos el solicitante deberá aportar el plano catastrado o el plano de agrimensura que describa la localización del derecho.
Solicitudes en inmuebles sin inscribir: Para el caso de solicitudes de servicios asociadas a inmuebles sin inscribir, el poseedor deberá suscribir ante el plataformista, la declaración jurada cuyo formulario será suplido por AyA, la cual será firmada por el solicitante y dos testigos con una descripción de la naturaleza del inmueble, señalando en qué consisten sus actos posesorios, la existencia de edificación, las mejoras realizadas y que la propiedad no se encuentra inscrita.
Territorios administrados por el Estado o sus instituciones con régimen jurídico especial: Para el caso de solicitudes asociadas a inmuebles bajo la modalidad de territorios administrados por el Estado o sus instituciones con régimen jurídico especial: zona marítimo terrestre, zonas fronterizas, territorios indígenas, polos de desarrollo turístico, entre otros; que se otorgan mediante concesiones, arriendos y asignaciones; los solicitantes deberán presentar la autorización expresa del ente correspondiente, en la cual se avale la solicitud del trámite, de conformidad con la norma que los regule.
Solicitudes de constancias de disponibilidad para parcelas con fines agrícolas, pecuarios, forestal eso mixtos: Para el caso de solicitudes asociadas a parcelas con fines agrícolas, pecuarios, forestales o mixtos, donde se pretendan construir viviendas o edificaciones, para ser abastecidas con agua para uso poblacional, el solicitante deberá presentar la autorización emitida por el INVU conforme a lo dispuesto para tal efecto en el Reglamento de Fraccionamiento y, para lo cual el interesado debe contar con un estudio de suelos y de capacidad de uso de las tierras elaborado por un Certificador de Uso Conforme del suelo autorizado según las disposiciones establecidas en el Reglamento a la Ley de Uso, Manejo y Conservación de Suelos, Decreto Ejecutivo N°29375-MAG-MINAE-S-HACIENDA-MOPT y el Decreto Ejecutivo N°30636-MAG, denominado Crea el Registro Oficial de Certificadores de Uso Conforme del Suelo y sus reformas o la normativa que les sustituya.
El AyA podrá coordinar con otras Instituciones del Estado, las acciones que considere pertinentes a fin de verificar la naturaleza de la parcela, así como cualquier otra condición que considere relevante para efectos del otorgamiento de la disponibilidad solicitada.
Solicitudes de constancias de disponibilidad para estaciones de servicio: Para el caso de solicitudes asociadas a inmuebles donde se pretendan desarrollar estaciones de combustible, AyA por medio de la UEN de Gestión Ambiental, en un plazo de 10 días naturales, verificará si existe potencial afectación a fuentes de agua. Si se detecta la afectación, la Región respectiva emitirá una Carta de Capacidad Hídrica en la que indicará que deben realizarse los estudios necesarios, con fundamento en la metodología de los “Términos de Referencia para Presentar Estudios Hidrogeológicos a la Dirección de Investigación y Gestión Hídrica (DIGH) del SENARA”, publicado en el Diario Oficial La Gaceta Nº 137 del 19 de julio del2017, y el Reglamento 510-06 Del Servicio Nacional De Aguas Subterráneas, Riego Y Avenamiento, publicado en La Gaceta N° 6 del 9 de enero del 2007 y sus eventuales reformas normativas y de competencias. En caso de que no se detecte afectación, se comunicará con las recomendaciones del caso para que se proceda a resolver la procedencia de la disponibilidad. Además, se procederá con el análisis respectivo de la fase de visado de planos de la Plataforma APC. (Así reformado mediante Acuerdo de Junta Directiva No. 2018-351 el 24/10/18, Publicado en La Gaceta Nº 220 del martes 27 de noviembre del 2018).
Igualmente, se procederá con el análisis respectivo de la fase de visado de planos en la plataforma Administrador de Proyectos de Construcción (APC) del Colegio Federado de Ingenieros y Arquitectos (CFIA).
Para todos los supuestos establecidos en este artículo, y de acuerdo con la verificación y subsanación de las condiciones necesarias para la aprobación de los servicios indicadas de manera general en el artículo 14 de este Reglamento, AyA verificará a través de las plataformas virtuales oficiales y disponibles, las siguientes condiciones:
I Certificaciones registrales de inmuebles.
II Certificaciones registrales de Planos Catastrados.
III Certificaciones registrales o administrativas de personerías jurídicas vigentes, apoderados con facultades de representantes judiciales y extrajudiciales o facultados al efecto, albaceas, tutores, curadores.
La admisión de la solicitud quedará sujeta al cumplimiento de los requisitos que debe aportar el solicitante y a la información obtenida por parte de AyA en las Plataformas Digitales Oficiales.
Para todos los casos previstos en esta norma, el AyA verificará que el propietario y/o el poseedor del inmueble no se encuentre en mora con AyA. Lo anterior con la finalidad que de que el solicitante normalice la deuda. Se exceptúan los casos definidos por otras normas o convenios.
Los operadores por delegación del AyA que no cuenten con las herramientas y/o plataformas digitales oficiales indicadas previamente, deberán solicitar a los interesados la presentación de la totalidad de la documentación que se establece en el presente numeral según lo requiera el trámite respectivo como condición parala admisibilidad de su gestión.” Lo anterior, siendo que, según la Sección de Bienes Inmuebles del Registro Nacional, la recurrente no cuenta con finca inscrita a su nombre. Reitera que dicho sistema es operado por la ASADA Urbanización Las Lomas de Parrita, y en cuanto a la Sra. Yancy de los Ángeles Silva Silva, la oficina de Atención de ASADA no tiene asunto pendiente que resolver. Agrega que el Hotel Grosseto Palma Real cuenta con servicio desde el año 2007, anterior al estudio realizado por el Ing. Arturo Rodríguez. Añade que los estudios técnicos de ingeniería son emitidos y firmados por los responsables del Área de Ingeniería, en este sentido el informe técnico N° SUB-G-GSC-UEN-GA-FA-ORAC-PC-2012-227, de fecha 19 de junio del 2012, visible a imagen 8 del escrito recibido por la Sala Constitucional el 18 de setiembre del 2020, y sobre el cual se le ha rechazado en múltiples oportunidades la constancia de disponibilidad de servicios al lote Folio Real N° 6-231660-000, el mismo se encuentra rubricado por el Ing. Giovanni García Flores, Área de Ingeniería Sistemas Comunales, RPC.
Además, el Ing. José Marcial Tinoco Gutiérrez, UEN Gestión de Acueductos Rurales, mediante oficio No. GSD-UEN-GAR-2020-04349, del 14 de octubre del 2020, dirigido a la Junta Directiva de la ASADA Lomas de Parrita, concluye:
“Se solicitó el balance hídrico para el sistema de la ASADA de Lomas Parrita, se determina con la información suministrada por la administración, las siguientes conclusiones:
Balance hídrico -0.67 para este año 2020 Volumen de almacenamiento necesario 176 m3 Por tanto, se logra determinar que no cuentan con capacidad hídrica para otorgar más disponibilidades. Tampoco cuenta con capacidad hidráulica dado que con el volumen de almacenamiento actual es de 90m3y se requiere 176 m3. Se recomienda buscar nuevas fuentes”. Solicita que se desestime el recurso planteado.
Redacta el Magistrado Salazar Alvarado; y,
Considerando:
Por su excepcional naturaleza, el trámite ordinario de los recursos de amparo contra sujetos de derecho privado exige comenzar por examinar si, en la especie, se está ante alguno de los supuestos que lo hacen admisible, para -posteriormente y en caso afirmativo- dilucidar si es estimable o no. El artículo 57, de la Ley de la Jurisdicción Constitucional, establece que procede el recurso de amparo contra las acciones u omisiones de sujetos de derecho privado, cuando éstos actúen o deban actuar en ejercicio de funciones o potestades públicas, o, se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo dos, inciso a), de la misma Ley. En el caso concreto, es claro el cumplimiento de esos presupuestos, pues se trata de un sujeto de derecho privado que está ejerciendo potestades públicas al prestar un servicio público, como lo es el suministro de agua potable, y por las circunstancias concretas está en la posibilidad de infringir los derechos constitucionales del recurrente al abastecimiento de agua potable, sin que los remedios jurisdiccionales comunes sean suficientes u oportunos.
II.Objeto del recurso. La recurrente manifiesta que es vecina de Puntarenas, Parrita, La Loma. Indica que en cuatro ocasiones ha solicitado disponibilidad del servicio de agua potable a la ASADA de la localidad, pero se lo han negado. Asegura que la ASADA recurrida cuenta con cuatrocientos setenta pajas de agua. Alega que los recurridos no hacen las mejoras que el sistema requiere y por ello, no le pueden brindar el servicio.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
“(…) Se solicitó el balance hídrico para el sistema de la ASADA de Lomas Parrita, se determina con la información suministrada por la administración, las siguientes conclusiones:
-Balance hídrico -0.67 para este año 2020 -Volumen de almacenamiento necesario 176 m3 Por tanto, se logra determinar que no cuentan con capacidad hídrica para otorgar más disponibilidades. Tampoco cuenta con capacidad hidráulica dado que con el volumen de almacenamiento actual es de 90m3y se requiere 176 m3. Se recomienda buscar nuevas fuentes.” (ver informes y prueba adjunta).
La Sala Constitucional ha reconocido, reiteradamente, que el Instituto Costarricense de Acueductos y Alcantarillados, las asociaciones administradoras de acueductos y alcantarillados y las municipalidades que prestan el servicio de suministro de agua potable, de previo a aprobar o rechazar las solicitudes de disponibilidad de agua potable que les sean formuladas, están en plena capacidad de exigir el cumplimiento de requisitos establecidos en el ordenamiento jurídico, y ponderar razones de orden legal y técnico. Por esta razón, en Sentencia N° 2010-010768 de las 10:52 horas del 18 de junio de 2010, este Tribunal resolvió lo siguiente:
“(...) El acceso a los servicios públicos, aún al del agua potable, vinculado al derecho fundamental a la salud, está sujeto a que las solicitudes para su provisión reúnan condiciones mínimas formales y técnicas. En este caso se explicó a la interesada que, en vista de que el inmueble donde habita no está inscrito en el Registro Público de la Propiedad, debe aportar otros datos para la instalación del servicio. Nota la Sala que la petición no se deniega de plano y que se ofrece, a la administrada, vías razonables de manejo de su solicitud, debido a la situación informal del inmueble para el que se pide el servicio. Con esas exigencias mínimas, y al haber instalado en las proximidades de la vivienda una fuente pública, se ha tutelado de manera adecuada su derecho al agua potable, siendo lo procedente desestimar el amparo”. (Véanse en el mismo sentido las Sentencias N° 2012-005722 de las 09:05 horas del 4 de mayo de 2012 y N° 2014-001394 de las 09:05 horas del 31 de enero de 2014, N° 2020-005049, de las nueve horas cuarenta y cinco minutos del trece de marzo del 2020).
Establecido lo anterior, se impone mencionar que la verificación del cumplimiento de requisitos legales o técnicos para obtener una disponibilidad de agua, le corresponde a las autoridades administrativas respectivas, sin que esta Sala pueda incursionar en la materia, porque es propia de la legalidad ordinaria y ajena a su competencia. Por consiguiente, debe advertirse, en primer lugar, que la Sala Constitucional no puede usurpar las atribuciones de dicha ASADA, en su rol de Administración activa, y previa comprobación de los requisitos legales y reglamentarios del caso, ordenar que dicha disponibilidad le sea otorgada. Por lo demás, dado que se expone su disconformidad con los requisitos, sin ofrecer ninguna razón objetiva y jurídicamente atendible que permita considerar violentado directamente algún derecho fundamental, se le aclara que este Tribunal, por obvias razones, no los puede eximir de cumplir algún requisito legal o reglamentario, simplemente porque les resulta subjetivamente inconveniente, puesto que no es del resorte de esta Cámara el otorgar disponibilidades de agua contra legem, sea en forma contraria al derecho.
VI.En cuanto a la imposibilidad material de otorgar nuevos servicios. También esta Sala ha considerado que, si bien existe un derecho fundamental al agua potable, su ejercicio no es indiscriminado al punto de que exista una obligación de los entes que prestan ese servicio de brindarlo en cualquier condición y oportunidad. En concreto, esta Sala ha reconocido que el Instituto Costarricense de Acueductos y Alcantarillados, las municipalidades, o bien, las asociaciones administradoras de acueductos y alcantarillados, pueden denegar la disponibilidad de agua potable si existen razones técnicas que así lo justifiquen. Al respecto, mediante Sentencia N° 2009-003825 de las 16:49 horas del 10 de marzo de 2009, esta Sala resolvió lo siguiente:
“ (...) Se entiende entonces, que si bien existe un derecho fundamental al agua que puede ser exigido a la administración correspondiente, la prestación del servicio bien puede sujetarse al cumplimiento de los requisitos establecidos para su otorgamiento y a que exista posibilidad material de suministro, esto es, que no existan situaciones técnicas que imposibiliten o desaconsejen a la administración a brindar el servicio de agua potable, situación que determina que la administración carece de la obligación de prestar el servicio de agua potable en caso de existir razones técnicas que lo desaconsejen o imposibiliten, debiendo informar adecuadamente al gestionante las razones por las cuales no puede atenderse su solicitud… ”.
Lo señalado en dicho precedente, es aplicable al caso de estudio, pues este Tribunal no encuentra razones para variar el criterio vertido en dicha sentencia, ni motivos que lo hagan valorar de manera distinta la situación planteada.
VII.Caso concreto. De la contestación presentada por la Presidenta de la Asociación Administradora del Acueducto Urbanización Las Lomas Parrita, y la prueba aportada a los autos para la resolución del asunto, ha sido debidamente acreditado que el rechazo a la disponibilidad de agua que reprocha la recurrente, no ha sido dictado de forma antojadiza. Por el contrario, el rechazo obedece a la falta actual de capacidad hidráulica e hídrica del acueducto, en aplicación del Reglamento de Prestación de Servicios del AyA, por lo que hacerlo podría implicar la desmejora del servicio ya prestado, todo en contraposición de los derechos fundamentales de quienes ya reciben el servicio y hasta de futuros usuarios. Dicho criterio técnico consta en el oficio N° GSD-UEN-GAR-2020-04349, del 14 de octubre del 2020, dirigido a la Junta Directiva de la ASADA Lomas de Parrita, suscrito por el Ing. José Marcial Tinoco Gutiérrez, UEN Gestión de Acueductos Rurales, del ICAA, se concluye:
“(…) Se solicitó el balance hídrico para el sistema de la ASADA de Lomas Parrita, se determina con la información suministrada por la administración, las siguientes conclusiones:
-Balance hídrico -0.67 para este año 2020 -Volumen de almacenamiento necesario 176 m3 Por tanto, se logra determinar que no cuentan con capacidad hídrica para otorgar más disponibilidades. Tampoco cuenta con capacidad hidráulica dado que con el volumen de almacenamiento actual es de 90m3y se requiere 176 m3. Se recomienda buscar nuevas fuentes”.
Adicionalmente, de los elementos probatorios, se acredita que por oficio Nº JDLP-002-2020-OF de 13 de febrero de 2020, la presidenta de la Asociación Administradora del Acueducto de Parrita ante la visita de la recurrente, le indicó lo siguiente:
“En sesión de Junta Directiva del día miércoles veintinueve de enero del año dos mil veinte: (…) Con relación a este asunto se acuerda A): Que por el momento no se le puede dar prevista de agua, ya que no se le ha podido darle mejoras al acueducto de Las Lomas (pozo, tanque y red de distribución)”.
Por tanto, se le rechazó la solicitud, por no ser técnicamente factible, según lo dispuesto en el artículo 75, del Reglamento de Prestación de Servicio de Acueducto. Adicionalmente, en fechas 21 de agosto, y 11 de setiembre de este año, la recurrente presentó solicitudes de disponibilidad de servicio de agua potable, ante la ASADA recurrida, y mediante oficio JDLP-012-2020-OF del 09 de octubre del 2020, se le indicó: “…no se logra constatar autorización o poder alguno suscrito por la propietaria registral del inmueble, que faculte a la señora YANCY SILVA SILVA, portadora de la cédula de identidad número 1-0831-0861, a realizar dicha gestión, ni tampoco se logra acreditar que la solicitante ostente titularidad o derecho registral alguno sobre la finca del del partido de Puntarenas, matrícula número 231660-000, por lo tanto, no existe capacidad jurídica en el actuar de la solicitante. A raíz de lo anterior, previo a resolver el fondo del asunto, de la manera más atenta, y cumpliendo con los requisitos de legalidad y forma en la presentación de documentos públicos, le hacemos saber que se debe subsanar lo antes planteado, o bien, que la respectiva solicitud sea gestionada por la propietaria registrad del inmueble, para así, proceder como en derecho corresponde (…)”.
No obstante, de los elementos probatorios, no se logra acreditar que la recurrente haya atendido la prevención que se le realizó mediante oficio JDLP-012-2020-OF del 09 de octubre del 2020, por parte de la ASADA recurrida. Adicionalmente, en el informe rendido por la Presidenta de la ASADA recurrida, se indicó bajo juramento, que el Reglamento Técnico “ Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes, AR-PSAYA-2013” , aprobado por la ARESEP y publicado en La Gaceta N° 186 del 29 de septiembre del 2014, Alcance 50, es normativa de aplicación obligatoria para esa ASADA, y en lo que interesa, establece la obligación que tienen los prestadores de los servicios de suministro de agua potable, de acatar sus disposiciones, como “toda la normativa técnica vigente que regula esta materia” artículo 6. En su artículo 75, inciso g), se establece que los prestadores de los servicios de suministro de agua potable podrán negarlo cuanto “no sea técnicamente factible”.
Sobre el tema, debe tenerse presente que la emisión de una disponibilidad de servicios o bien, la conexión para un nuevo servicio, implica la existencia actual y real tanto de capacidad hídrica como de capacidad hidráulica del sistema de abastecimiento. De la lectura del criterio técnico, es evidente que, en el caso de la recurrente, no ha atendido la prevención que se le realizó, en razón de no ser la titular del bien inmueble para el cual solicita el servicio, de acuerdo a lo estipulado en el Reglamento para la prestación de los Servicios de AyA, Acuerdo de Junta Directiva del Instituto N° 2019-0461, publicado en el Alcance N° 285, de la Gaceta N° 242 del 19 de diciembre del 2019, con relación a las Constancias de Disponibilidad de Servicios, señala:
“Artículo 20.- De los requisitos de admisibilidad y condiciones para la solicitud de la constancia de disponibilidad de servicios. La solicitud de la constancia de disponibilidad de servicios debe ser realizada por propietario del inmueble o su representante legal ante las Plataformas de Servicios de AyA. Para tales efectos se deben presentar de forma física o digital, los siguientes requisitos:
a. Formulario de solicitud proporcionado por AyA, física o digitalmente disponibles, completo y firmado por el propietario registral, poseedor o representante o autorizado legal, en donde se indicará el propósito de la disponibilidad y una descripción detallada del proyecto.
b. Presentación de documento de identificación del propietario del inmueble o su representante legal. De existir factibilidad tecnológica, AyA eximirá al solicitante de la presentación de este requisito con la verificación de identidad a través de la plataforma digital oficial”.
Adicionalmente, no existe factibilidad técnica para la emisión de nuevas disponibilidades de servicios ni para la conexión de nuevos servicios, puesto que no existe certeza de que se cumplan los presupuestos de dicha factibilidad: la capacidad hidráulica y la capacidad hídrica. Por último, tampoco es de recibo el alegato de la recurrente -sobre una presunta discriminación- debido a que al Hotel Grosseto Palma Real sí se le suministra el servicio de agua potable, por cuanto, bajo juramento, se indica que dicho Hotel cuenta con servicio desde el año 2007, fecha anterior a los estudios realizados por en ICAA, que determinan los problemas de capacidad hídrica, y capacidad hidráulica para otorgar más disponibilidades. Por las razones expuestas, no estamos frente a la infracción de derechos fundamentales y, en virtud de ello, lo pertinente es desestimar el recurso de amparo, como en efecto se dispone.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
