Background:
Justice Salazar Murillo drafts the opinion; and,
Whereas:
I.Preliminary matter (De previo).- This jurisdiction is governed by the Ley de la Jurisdicción Constitucional; consequently, motions for nullity and defenses based on absence of a legal right or lack of standing may not be raised. Therefore, the requests made by the INDER representative must be denied, and this Chamber is not required to examine those arguments. The motions filed by INDER are not proper in this jurisdiction.
II.Subject matter of the appeal (Objeto del recurso).- The appellants, residents of Chitaría and Alto de la Perica, consider that their fundamental right to drinking water has been violated because their communities experience drinking-water shortages. Recently, on 21 de agosto del 2020, because of landslides on national highway n°10, they had to wait many hours to obtain access to water. Since the year 2000, residents have filed requests for water, but the Instituto Costarricense de Acueductos y Alcantarillados (AYA) merely sends some pipes and tanks, without any development project for the construction of an aqueduct. All of this is exacerbated by the current pandemic.
II.Proven facts (Hechos probados).- The following facts are deemed duly established and relevant to the decision in this matter, either because they have been proven or because the respondent failed to address them as ordered in the initial order:
Comunidad Chitaría a) The aqueduct system is administered by the Municipalidad de Turrialba. It is not included within the project or the actions undertaken jointly by AYA, INDER, and the community (see report).
Comunidad Alto de la Perica b) Construction of the Alto de la Perica aqueduct system could be undertaken, for its future administration, operation, maintenance, and development, by ASADA Tres Equis, which has a delegation agreement signed with AYA (see report).
Easement rights must be registered in the name of the ASADA. 5. Permits to break open national and municipal roads through which the project will pass. 6. All properties on which the water-storage tanks will be built must be registered in the name of the ASADA. 7. Because this project requires water to be propelled by pumping, electrical power must be available for the pumps, with at least a single-phase line and the corresponding engineering study by ICE. 8. Environmental feasibility from SETENA. 9. Permits from Recope and ICE because fiber-optic cable and a multiproduct pipeline are located within the project area. 10. Specific, detailed design plans endorsed by the Colegio de Ingenieros y Arquitectos. 11. Every river or stream crossing must have the corresponding permit for bridges from the Municipalidad or MOPT. 12. Construction plans and designs endorsed by AyA (see report).
IV.Merits.- As can be seen, the complaint in this case concerns the lack of an aqueduct (acueducto) to convey drinking water (agua potable) to the communities of Chitaría and Alto de la Perica, since the appellants state that AYA has only contributed some pipes and tanks, but that no development project exists for the construction of this aqueduct. In this regard, the reports submitted by the representatives of the respondent authorities—which are deemed to have been given under oath, with the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for the resolution of this matter show that there are two different situations in each of the communities concerned. In the case of the Community of Chitaría, it is reported that an aqueduct already exists and that it is administered by the Municipalidad de Turrialba.
Accordingly, with respect to this issue, since the allegation does not concern the lack of an aqueduct, the appeal must be denied. The situation of the Community of Alto de la Perica is different, since the information provided shows that there is indeed no aqueduct in the area; instead, the residents themselves have constructed certain facilities using pipes and tanks provided by AYA. This entity states that most of the community of Alto de la Perica currently relies on household self-supply (autoabastecimiento domiciliar), since it does not have an extensive formal aqueduct. It is stated that they have a water collection and storage point with access to a national highway. With regard specifically to the aqueduct, it is reported that several meetings have been held among the community, AYA officials, Asada Tres Equis, and INDER to consider the construction of an aqueduct system in Alto de la Perica, which could be taken over by the aforementioned Asada.
AYA states that constructing an aqueduct system is not a short-term development project, but entails a large number of activities that must be carried out. Progress has already been made in acquiring the land for construction of the storage tank, and AYA and INDER have prepared several recommendations and follow-up actions, including a series of steps such as the following: 1. Declaration of rights to the spring (naciente) in favor of the Asada that will take over the project. 2. The Asada must be in good standing or compliant with AyA. 3. The minimum protection areas must be registered in the name of the Asada. 4. Easement rights (derechos de servidumbre) must be registered in the name of the Asada. 5. Permits to break through national and municipal roads along which the project will pass. 6. All properties on which the water storage tanks will be constructed must be registered in the name of the Asada. 7.
Because this project requires water to be propelled by pumping, electrical power must be available for the pumps, at a minimum through a single-phase line, with the corresponding engineering study conducted by ICE. 8. Environmental feasibility approval (viabilidad ambiental) from Setena. 9. Permits from Recope and ICE because fiber-optic lines and a multiproduct pipeline are located within the project area. 10. Specific and detailed design plans endorsed by the Colegio de Ingenieros y Arquitectos. 11. Every river or stream crossing must have the corresponding permit for bridges from the Municipalidad or MOPT. 12. Construction plans and designs endorsed by AyA. It follows from all the foregoing that, despite the meetings and certain actions, there is still no aqueduct system supplying drinking water to the community of Alto de la Perica. Although it is indeed stated that the implementation and completion of this project require cooperation among institutions and from the community (AYA reports that the interested parties must finalize the easement and project-site permits before proceeding with the application for INDER financing), the fact remains that AYA, by statutory delegation, is the governing authority in this field and cannot simply take refuge in the assertion that the community must undertake all the necessary actions.
Regarding the right to drinking water, this Constitutional Court has recognized in its case law that the rights to life and health are fundamental rights whose enjoyment requires access to drinking water. For human beings to enjoy health, they must be guaranteed a set of minimum conditions necessary to attain an adequate and harmonious mental, physical, and environmental balance, as well as to prevent the emergence of dysfunctions that impair their full growth and development. One of those conditions is precisely the supply of water fit for human consumption. Hence the duty of the Costa Rican State in general, and of the Instituto Costarricense de Acueductos y Alcantarillados in particular (see Articles 1 and 2 of Law No. 2726 of 14 de abril de 1961), to guarantee every person progressive and nondiscriminatory access to drinking water in order to meet their basic needs (judgment No. 2012-010712 at 9:15 hrs on 10 de agosto del 2012).
In the present matter submitted to this Chamber, after analyzing the evidence entered into the record, this Court finds an infringement of the right to water that affects the right to health of the protected parties, residents of the community of Alto de la Perica, who have had to resort to household self-supply, with all the difficulties that this entails, in order to obtain drinking water. It is apparent that the respondent authorities have been well aware of the situation for several years; nevertheless, there is still no governance or plan, with a schedule and completion date, for a formal aqueduct system for the area. The protected parties have thus been placed in a serious state of uncertainty, since no probable or foreseeable date has been given for achieving a solution to the aforementioned lack of access to drinking water. Furthermore, although the existence of material and financial obstacles and the need for the community itself to cooperate—factors that may hinder the full realization of the right to water—are acknowledged, they neither weaken nor extinguish the constant and continuing duty of the Costa Rican State to advance as rapidly and effectively as possible toward the full realization of that right.
This duty does not appear to have been fulfilled in the case under review, since the necessary steps have not been taken promptly to provide the protected parties with an aqueduct and drinking-water service. Although meetings have been held and recommendations issued, the respondents’ primary responsibility in this regard is not evident; instead, a large portion of the necessary actions is sought to be delegated to the community, when in fact it is primarily the State that is obligated to assume responsibility for supplying drinking water. Accordingly, this petition for constitutional relief (amparo) must be granted with respect to this issue, as hereby ordered. In conclusion:
The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computing, magnetic, optical, or telematic device or produced through new technologies, these must be retrieved from the court office within a maximum period of 30 business days following notification of this judgment. Otherwise, any material not retrieved within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.
Por tanto:
The appeal is declared PARTIALLY GRANTED with respect to the lack of an aqueduct providing drinking-water service to the community of Alto de la Perica. Consequently, the following persons are ordered: 1) YAMILETH ASTORGA ESPELETA, in her capacity as Executive President of the Instituto Costarricense de Acueductos y Alcantarillados, and HARYS REGIDOR BARBOZA, in his capacity as Executive President of the Instituto de Desarrollo Rural, or whoever may hold those offices in their stead, shall coordinate actions so that, within three months following notification of this judgment, an action schedule is prepared establishing a completion date for the implementation of an aqueduct project supplying drinking water to the community of Alto de la Perica. That schedule may not exceed a maximum period of eighteen months following notification of this judgment. 2) YAMILETH ASTORGA ESPELETA, in her capacity as Executive President of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever may hold that office in her stead, shall take action to prepare an immediate plan so that the community of Alto de la Perica can be supplied with drinking water while the aqueduct is being constructed, whether by tanker trucks, a public water source, or any other necessary system.
All the foregoing is ordered with the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that they are required to comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years, or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay the legal costs, damages, and losses caused by the events underlying this ruling, the amounts of which shall be determined in proceedings to enforce the judgment before the administrative-litigation jurisdiction. To the extent that the appeal is brought against the Municipalidad de Turrialba and INDER, it is denied. Let notice be given.

Resultando:
Redacta el Magistrado Salazar Murillo; y,
Considerando:
I.De previo.- Esta jurisdicción se rige por la Ley de la Jurisdicción Constitucional, así no es válido oponer incidentes de nulidad, ni excepciones de derecho o falta de legitimación. Por ello, respecto de tales solicitudes, realizadas por el representante del INDER, procede su rechazo, sin que corresponda a esta Sala analizar dichos alegatos. Las gestiones planteadas por el INDER no son propias de esta jurisdicción.
II.Objeto del recurso.- Los recurrentes, vecinos de Chitaría y el Alto de la Perica, consideran violado su derecho fundamental al agua potable por cuanto, sus comunidades tienen faltantes de agua potable. Recientemente el 21 de agosto del 2020, debido a derrumbes en la carretera nacional n°10, tuvieron que esperar muchas horas para tener acceso al agua. Siendo que desde el año 2000 los vecinos han presentado gestiones de solicitud de agua, pero el Instituto Costarricense de Acueductos y Alcantarillados (AYA) solo envía unos tubos y tanques, sin que existe un proyecto de desarrollo para la construcción de un acueducto. Todo lo cual se agrava con la situación actual de pandemia.
II.Hechos probados.- De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
Comunidad Chitaría a) Que el sistema de acueducto es administrado por la Municipalidad de Turrialba. Que no se encuentra dentro del proyecto ni de las acciones que ha llevado a cabo el AYA en conjunto con el INDER y la comunidad (ver informe).
Comunidad Alto de la Perica b) Que la construcción del sistema de acueducto de Alto de la Perica podría ser asumido para la futura administración, operación, mantenimiento y desarrollo por la Asada Tres Equis, quienes cuentan con convenio de delegación suscrito con AYA (ver informe).
Permisos de ruptura de vías nacionales y municipales por donde atravesará el proyecto. 6. Todas aquellas propiedades donde se construirán los tanques de almacenamiento de agua deben estar inscritas a nombre de la Asada. 7. Por tratarse de un proyecto que requiere impulso del agua por bombeo, es necesario contar con la energía eléctrica para las bombas mínimo línea monofásica, con el respectivo estudio de ingeniería por parte del ICE. 8. Viabilidad ambiental por parte de Setena. 9. Permisos de Recope, ICE por ubicarse en la zona del proyecto fibra óptica y poliducto. 10. Planos específicos y detallados de diseño avalados por el Colegio de Ingenieros y Arquitectos. 11. Todo cruce de río o quebrada debe contar con el respectivo permiso (puentes) por parte de la Municipalidad o del MOPT. 12. Planos constructivos y diseño avalados por el AyA (ver informe).
IV.Sobre el fondo.- Tal como se observa, en este caso lo que se reclama es la falta de un acueducto que lleve el agua potable a las comunidades de Chitaría y Alto de la Perica, pues indican los recurrentes que el AYA solamente ha colaborado con algunos tubos y tanques, pero no existe un proyecto de desarrollo para la construcción de este acueducto. Al respecto, de los informes rendidos por los representantes de las autoridades recurridas -que se tienen por dados bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción-, y la prueba aportada para la resolución del presente asunto, se observa que tenemos dos situaciones distintas en cada una de las comunidades en cuestión. En el caso de la Comunidad de Chitaría se informa que ya existe un acueducto, y que este es administrado por la Municipalidad de Turrialba. Así entonces, en cuanto a este aspecto, por no tratarse del alegato de falta de acueducto, el recurso debe declararse sin lugar.
Distinto es el caso de la Comunidad de Alto de la Perica, pues de lo informado se desprende que, ciertamente no existe un acueducto en la zona, sino que los vecinos han procedido ellos mismos a hacer algunas construcciones con tubos y tanques dados por el AYA. Indica este ente que actualmente la comunidad de Alto de la Perica, en su mayoría, cuenta con autoabastecimiento domiciliares, ya que no cuenta con un acueducto formal de larga extensión. Se indica que cuentan con un punto de acopio y almacenamiento de agua con acceso a ruta nacional. Ahora bien, propiamente sobre el acueducto, se informa que se han realizado varios reuniones entre la comunidad, funcionarios del AYA, la Asada Tres Equis y el INDER, a efectos de considerar la construcción de un sistema de acueducto en Alto de la Perica, el cual podría ser asumido por la Asada en mención. Indica el AYA que la construcción de un sistema de acueducto no es un proyecto de desarrollo a corto plazo, sino que conlleva gran cantidad de actividades que se deben ejecutar.
Avanzándose ya en la adquisición del terreno para la construcción del tanque de almacenamiento, y elaborándose por parte del AYA y de parte del INDER varias recomendaciones, y acciones a seguir, que incluyen una serie de pasos tales como los siguientes: 1. Declaratoria de derecho de la naciente a favor de la Asada que asumirá el proyecto. 2. La Asada debe estar al día o en regla con el AyA. 3. Las áreas de protección mínimas deben estar a nombre de la Asada. 4. Derechos de servidumbre a nombre de la Asada. 5. Permisos de ruptura de vías nacionales y municipales por donde atravesará el proyecto. 6. Todas aquellas propiedades donde se construirán los tanques de almacenamiento de agua deben estar inscritas a nombre de la Asada. 7. Por tratarse de un proyecto que requiere impulso del agua por bombeo, es necesario contar con la energía eléctrica para las bombas mínimo línea monofásica, con el respectivo estudio de ingeniería por parte del ICE. 8.
Viabilidad ambiental por parte de Setena. 9. Permisos de Recope, ICE por ubicarse en la zona del proyecto fibra óptica y poliducto. 10. Planos específicos y detallados de diseño avalados por el Colegio de Ingenieros y Arquitectos. 11. De todo lo cual se desprende que, pese a reuniones y algunas acciones, todavía no hay un sistema de acueducto para el suministro de agua potable en la comunidad de Alto de la Perica. Aunque ciertamente se indica que la ejecución y conclusión de este proyecto conlleva una cooperación interinstitucional y de la comunidad (informa el AYA que los interesados deben finiquitar los permisos de servidumbres y ubicación de las obras, para luego continuar con la solicitud de financiamiento del INDER).
Es lo cierto que el AYA tiene, por delegación legal, la rectoría en esta materia, y no puede simplemente escudarse en que es la comunidad quien debe tomar todas las acciones. Sobre el derecho al agua potable, este Tribunal Constitucional ha reconocido en su jurisprudencia que el derecho a la vida y a la salud son derechos fundamentales cuyo goce exige el acceso al agua potable. Para que el ser humano disfrute de salud requiere que se le garanticen un conjunto de condiciones mínimas necesarias para alcanzar un adecuado y armónico equilibrio psíquico, físico y ambiental, así como para impedir el surgimiento de disfunciones que alteren su pleno crecimiento y desarrollo. Una de esas condiciones es precisamente el suministro de agua apta para el consumo humano. De allí el deber del Estado costarricense, en general, y del Instituto Costarricense de Acueductos y Alcantarillados, en particular (véanse los artículos 1 y 2 de la Ley No. 2726 de 14 de abril de 1961), de garantizar a toda persona, de forma progresiva y sin discriminación, el acceso al agua potable, para satisfacer sus necesidades básicas (sentencia No. 2012-010712 de las 9:15 hrs del 10 de agosto del 2012).
En el presente asunto sometido a conocimiento de esta Sala, tras analizar los elementos aportados a los autos, este Tribunal constata una lesión al derecho al agua que incide en el derecho a la salud de los tutelados, vecinos de la comunidad del Alto de la Perica, quienes han tenido que recurrir al autoabastecimiento domiciliar, con todas las dificultades que ello conlleva, para poder abastecerse de agua potable. Se denota que la situación es bien conocida por las autoridades recurridas, desde hace ya varios años, y sin embargo, todavía no existe una rectoría, un plan, con cronograma y una fecha de finalización, de un sistema de acueducto formal para la zona. Con lo que se verifica que se ha colocado a los amparados en un grave estado de incertidumbre, pues no señala una fecha probable o previsible para lograr una solución al citado problema de falta de acceso al agua potable. Además, si bien se reconoce la existencia de obstáculos materiales y financieros, y de la necesidad de que la misma comunidad colabore, que pueden dificultar la plena realización del derecho al agua, ello no enerva ni anula el deber constante y continuo del Estado Costarricense de avanzar con la mayor rapidez y efectividad posibles hacia la plena realización de tal derecho.
Lo que no se observa se haya cumplido en el caso en estudio, pues no se ha procurado con celeridad lo necesario para proveer de un acueducto y del servicio de agua potable a los tutelados. Si bien se han dado reuniones y recomendaciones, no se constata la responsabilidad primordial de los recurridos en ello, sino que gran parte de las acciones se pretenden delegar en la comunidad, cuando en realidad, es prioritariamente el Estado quien tiene la obligación de asumir el suministro del agua potable. Por lo que procede, en cuanto a este aspecto, acoger este amparo, como así se dispone. En conclusión,
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara PARCIALMENTE CON lugar el recurso, en cuanto a la falta de acueducto que brinde el servicio de agua potable en la comunidad de Alto de la Perica. En consecuencia, se le ordena a: 1) YAMILETH ASTORGA ESPELETA, en su condición de Presidenta Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados, y a HARYS REGIDOR BARBOZA, en su calidad de Presidente Ejecutivo del Instituto de Desarrollo Rural, o quienes en su lugar ocupen dichos cargos, proceder a coordinar acciones para que, en el plazo de tres meses, contado a partir de la notificación de esta sentencia, se elabore un cronograma de acción a efectos de ponerle un fecha de finalización a la ejecución de un proyecto de acueducto que suministre agua potable a la comunidad de Alto de la Perica. Cronograma que no puede exceder el plazo máximo de dieciocho meses, contados desde la notificación de esta sentencia. 2) YAMILETH ASTORGA ESPELETA, en su condición de Presidenta Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados, o quien en su lugar ocupe dicho cargo, proceder a tomar acciones para elaborar un plan inmediato para que la comunidad de Alto de la Perica pueda ser abastecida de agua potable, entretanto se construye el acueducto, sea con camiones cisternas, fuente pública o cualquier otro sistema que sea necesario.
Todo lo anterior, bajo el apercibimiento de que, de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El recurso, en tanto es planteado en contra de la Municipalidad de Turrialba y en contra del INDER, se declara sin lugar. Notifíquese.
