Appeal in cassation (recurso de casación) filed in these proceedings against Alfredo Enrique Paz Aberle, [...]; for the offense of violating the Ley Forestal, committed to the detriment of Natural Resources. Justices Jesús Alberto Ramírez Quirós, Patricia Solano Castro, Álvaro Burgos Mata, Gerardo Rubén Alfaro Vargas, and Sandra Eugenia Zúñiga Morales participated in deciding the appeal. Also appearing at this stage was attorney Mario Sánchez Hernández, as private defense counsel for the accused. Marcela Araya Rojas appeared as the representative of the Public Prosecutor’s Office; and attorney Randall Aguirre Mena appeared as the representative of the Office of the Attorney General of the Republic.
Findings of Fact:
1. By Judgment N° 2019-00264, issued at fourteen hours and twenty-five minutes on diez de abril de dos mil diecinueve, the Criminal Judgment Appeals Court of the Third Judicial Circuit of Alajuela, San Ramón, ruled: “THEREFORE: The appeal against the judgment filed by the representative of the Office of the Attorney General of the Republic is denied.- NOTICE SHALL BE GIVEN.- Jorge Luis Morales García.- María Gabriela Rodríguez Morales.- Martín Alfonso Rodríguez Miranda.- Criminal Judgment Appeals Judges.- (sic)”.
2. Attorney Randall Aguirre Mena, criminal prosecutor, filed an appeal in cassation against the foregoing ruling.
3. After the respective deliberation was completed, the Chamber proceeded to consider the appeal.
4. The relevant legal requirements have been observed in the appeal.

Considering:
I.Attorney Randall Aguirre Mena, in his capacity as Criminal Prosecutor, files an appeal in cassation against Judgment N° 264-2019 of the Criminal Judgment Appeals Court of the Third Judicial Circuit of Alajuela, San Ramón, issued at 14:25 hours on 10 de abril de 2019. By that judgment, the appeal filed by the Office of the Attorney General of the Republic was denied, thereby affirming the acquittal entered in favor of the accused by the Trial Court for the offense of violating the Ley Forestal; that acquittal having been entered under the standard of certainty.
II.By Decision Nº 2019-01076, issued at eleven hours and ten minutes on cuatro de setiembre de dos mil diecinueve, this Chamber declared admissible for a decision on the merits only the first ground of the appeal in cassation filed by attorney Randall Aguirre Mena, in his capacity as representative of the Office of the Attorney General of the Republic. The Chamber now proceeds to consider its merits and issues the decision required by law, in accordance with the grounds set forth in this decision.
III.In the first ground raised—the only one admitted for consideration on the merits—the appellant alleged the erroneous application of a legal provision, specifically Article 25 of Ley de Construcciones, N° 833, of November 2, 1949. Attorney Aguirre Mena states that, in this matter, the acquittal was affirmed and the civil action for damages (acción civil resarcitoria) was dismissed based on an erroneous application and interpretation of Article 25 of Ley de Construcciones and a failure to observe the provisions of Articles 33 and 34 of Ley Forestal, resulting in an unlawful basis for the judgment. He explains that, although it was established that the accused ordered and carried out the construction of five houses within the 50-meter protected area (área de protección) of the river located at the site, thereby violating Article 33 of Ley Forestal, he was acquitted based on the erroneous interpretation that Article 25 of Ley de Construcciones provides that alignments (alineamientos) of any kind established by INVU remain in force indefinitely.
Specifically, the appellant considers the appellate judges’ interpretation erroneous when they state that, in this matter, “… Article 25 of ley de construcciones (sic) prevails because it is a general provision that makes no distinction regarding the type of alignment; since the INVU alignment is an official alignment, no distinction should be made where the law makes none, and it therefore concludes that the drainage alignment (alineamiento pluvial) has no expiration date, despite the fact that the plans bore an INVU stamp stating that the alignment was valid for one year (…) The interpretation given by the Court of Appeal to Article 25 cited supra leads to the conclusion that authorization existed to carry out the earthworks (movimientos de tierra) and construction and that, therefore, the accused’s conduct was lawful…” (folio 646). He explains that it is erroneous to consider that Article 25 of Ley de Construcciones N° 833 of 1949 can regulate drainage alignments in protected areas, whereas the correct interpretation is that this legislation regulates road alignments (alineamientos viales) issued by the Municipality or the Ministry of Public Works, dating from 1949, as also established by Article 18 of Reglamento de Construcciones of INVU, in force as of March 22, 1983, but not alignments corresponding to protected areas.
He points out that Ley de Construcciones could never be deemed applicable to drainage alignments in protected areas because the latter were created upon the enactment of Ley Forestal, N° 7575 of February 13, 1996; that is, they did not exist when the provision of Ley de Construcciones was enacted. Under Ley Forestal, in the case of rivers, springs (nacientes), and streams with a slope exceeding forty percent, as in this case, the protected area extends to 50 meters, meaning that the alignment established is contrary to law. He insists that, when Ley de Construcciones entered into force, neither protected areas nor drainage alignments existed, and he therefore considers it erroneous to state that said 1949 Law applies to drainage alignments. He argues that Ley Forestal is later-enacted and specific legislation governing the subject matter at issue. He further notes that the Trial Judgment Court of Appeal’s interpretation of the applicable legislation violates the precautionary and pro natura principles, which govern environmental matters.
He also states that the appellate court’s interpretation “…disapplies the provisions of Article 132, subsection 4), of Ley General de la Administración Pública, which authorizes INVU, for example, to set a specific term when issuing an administrative act (acto administrativo), such as the river alignment (alineamiento fluvial), as was done in this matter by granting the alignment a term of one year…” (folio 648). As grounds for relief, he maintains that the erroneous application of Article 25 of Ley de Construcciones resulted in the dismissal of the appeal filed and the affirmance of the trial judgment, thereby harming the interests of the State as private prosecutor (querellante) and civil plaintiff (actor civil). The claim is granted. Regarding the application of Ley Forestal and the impropriety of applying Ley de Construcciones. This Criminal Cassation Chamber finds the objection raised by the appellant well-founded.
It can be determined that the appellate court erroneously applied and interpreted Article 25 of Ley de Construcciones, N° 833, and failed to observe Articles 33 and 34 of Ley Forestal. In that regard, the Criminal Trial Judgment Court of Appeal ruled as follows in the challenged judgment: “[…] having reviewed the aforementioned ley de Construcciones, the cited provision literally states: ‘Official alignments shall remain in force indefinitely.’ (Ley 833 of November 2, 1949). As can clearly be seen, the cited article is a general provision and makes no distinction regarding the nature or type of alignment; the INVU alignment is indeed an ‘official alignment,’ and this Trial Judgment Court of Appeal therefore finds, contrary to the argument advanced by the appellant herein, that no distinction may be made where the law makes none. Although Ley de Construcciones refers predominantly to the road alignments of the Municipality and the Ministry of Public Works and Transportation, this specific article uses general language that is fully applicable to drainage alignments.
There is another legal reason for considering this to be the proper conclusion in regulating relations between governed persons (administrados) and the State: these ‘official alignments’ unquestionably do nothing more than establish limitations on the constitutional right to property, and under the principle of legal certainty (seguridad jurídica), a governed person must have a definite standard by which to conduct himself; constant changes in that regard could, even in a case such as this one, have a fundamental consequence for the constitutional right to property. It should be noted that, given the alleged change in the standard governing drainage alignment in these cases, an increase from 15 to 50 meters entails, as the accused himself noted in his statement, an indirect expropriation. Accordingly, this Trial Judgment Court of Appeal finds that Article 25 of Ley de Construcciones is applicable in this case as a general provision intended to protect the rights of governed persons and the principle of legal certainty.
Thus, if Instituto Nacional de Vivienda y Urbanismo, whether based on a correct standard or not, set the alignment at 15 meters, that determination must be respected pursuant to the principles of legal certainty and property, both of which are constitutionally rooted. Nor is it as the challenger herein would have it appear, namely, that the accused sought to deceive the Trial Court in that regard. The defendant was clear that this matter involved entities that, like him, relied on that institutional determination in concluding that there was no impediment not only to carrying out the construction, but also to disbursing public funds from the housing loan and building the low-income housing constructed in this case on each of those properties. From that perspective, this Trial Judgment Court of Appeal finds that the defendant herein should have been acquitted, not through the application of reasonable doubt, but based on a clear certainty of innocence, and that, consequently, the request for demolition of the homes at issue is likewise unwarranted, since construction in the area where they were built had the respective permits and the corresponding drainage alignment from the entity legally responsible for making such determinations.
For the foregoing reasons, the proper course is to deny the appeal from the judgment filed by the representative of Procuraduría General de la República.-” (cf. folio 639). It may be inferred from that reasoning that the court ad quem failed to consider the effective date of Ley de Construcciones N° 833, which dates from November 2, 1949, as well as its scope and coverage; doing so would have allowed it to conclude that it could not be applied to the case at bar (subjudice) and that Ley Forestal should instead have been applied. As the appellant correctly notes, the latter was enacted after Ley de Construcciones, since it entered into force on April 16, 1996; moreover, it is also specific legislation protecting the legal interest (bien jurídico) alleged to have been infringed by defining and regulating the criminal conduct attributed to the defendant Paz Aberle. Regarding the application of later-enacted and specific criminal legislation, this Chamber has previously held: “[…] The issue is, in principle, readily resolved.
In this regard, although both provisions have condemned conduct intended to affect or that does affect the administration of justice, it is clear that, in matters involving drugs or drug trafficking, the legislature established specific legislation intended to impose more severe penalties for harm to the legally protected interest. This is because trafficking in psychotropic substances or narcotics, as well as any activity related to this problem, was deemed to constitute a serious social problem requiring criminal penalties under specific legislation, even though some of the conduct covered therein had already been addressed in other laws or in the Criminal Code itself (the principle of specificity in applying criminal law, or ‘lex specialis derogat lex generalis’). Given the specific nature of this law, the criminal offenses (tipos penales) established therein prevail over any other legislation that had previously defined and punished similar conduct.
In addition, the referenced body of law prevails not only because it is specific legislation, but also because it is more recent, since a later law repeals an earlier one.[…]” (Resolution 2003-212, at 11:26 a.m., on March 28, 2003. Panel: Rodrigo Castro, Jesús Ramírez, José Manuel Arroyo, Rafael Madaglia, and Alfredo Chirino). It is evident, as explained supra, that Ley Forestal, rather than Ley de Construcciones, applies in the matter under examination (sub examine), because the former is both later-enacted and specific legislation. In that same regard, it is also apparent that the appellate court erred in interpreting and applying the aforementioned Article 25, which provides: “Official alignments shall remain in force indefinitely,” when it found that, because this was a general provision, no distinction could be made in its application, and therefore the alignment issued by INVU was official and had consequently not expired.
It is thus evident that it failed to consider that this legal provision does not encompass river alignments because it does not regulate matters relating to protected zones (zonas de protección), which are governed by Ley Forestal. Indeed, in the case under review, the acts attributed to the accused Paz Aberle occurred on land encompassing the protected area of Río Mastate, and the provisions of Ley Forestal alleged to have been disregarded were therefore applicable, namely Articles 33(b) and 34, which respectively provide, insofar as relevant: “Protected areas. The following are declared protected areas:[…] (b) A strip of fifteen meters in rural areas and ten meters in urban areas, measured horizontally on both sides along the banks of rivers, streams, or brooks, if the land is flat, and fifty horizontal meters if the terrain is rugged. […]”; and “Prohibition against felling trees in protected areas.
The cutting or removal of trees in the protection areas (áreas de protección) described in the preceding article is prohibited […] The boundary alignments (alineamientos) that must be processed in connection with these areas shall be established by the Instituto Nacional de Vivienda y Urbanismo.” Given the foregoing circumstances, this Criminal Cassation Chamber determines that the Ley Forestal must be applied to the case at bar (subjudice). Based on the foregoing considerations, Judgment N° 2019-00264 of the Tribunal de Apelación de Sentencia del Tercer Circuito Judicial de Alajuela, San Ramón, Sección Segunda, issued at 14:25 hours on 10 de abril de 2019, is vacated; and the case is remanded to that court for new proceedings in accordance with law.
Therefore:
The claim filed by the Procuraduría General de la República is granted. Judgment N°2019-00264, issued by the Second Section of the Court of Appeals for Criminal Judgments of the Third Judicial Circuit of Alajuela, San Ramón, at 14:25 hours on 10 de abril de 2019, is vacated; and the case is remanded to that judicial authority for new proceedings in accordance with law. Notice shall be given.

Recurso de casación interpuesto en la presente causa seguida contra Alfredo Enrique Paz Aberle, [...]; por el delito de infracción a la Ley Forestal, cometido en perjuicio de los Recursos Naturales. Intervienen en la decisión del recurso las Magistradas y los Magistrados Jesús Alberto Ramírez Quirós, Patricia Solano Castro, Álvaro Burgos Mata, Gerardo Rubén Alfaro Vargas y Sandra Eugenia Zúñiga Morales. Además, en esta instancia, el licenciado Mario Sánchez Hernández, como defensor particular del encartado. Se apersonó la representante del Ministerio Público, Marcela Araya Rojas; y el representante de la Procuraduría General de la República, licenciado Randall Aguirre Mena.
Resultando:
1. Mediante sentencia N° 2019-00264 de las catorce horas veinticinco minutos del diez de abril de dos mil diecinueve, el Tribunal de Apelación de Sentencia Penal del Tercer Circuito Judicial de Alajuela, San Ramón, resolvió: “POR TANTO: Se declara sin lugar el recurso de apelación de sentencia interpuesto por el representante de la Procuraduría General de la República.- NOTIFÍQUESE.- Jorge Luis Morales García.- María Gabriela Rodríguez Morales.- Martín Alfonso Rodríguez Miranda.- Jueces y Jueza de Apelación de Sentencia.- (sic)”.
2. Contra el anterior pronunciamiento el licenciado Randall Aguirre Mena, procurador penal, interpuso recurso de casación.
3. Verificada la deliberaci ón respectiva, la Sala entró a conocer del recurso.
4. En el recurso se han observado las prescripciones legales pertinentes.
Informa el Magistrado Burgos Mata; y,
Considerando:
I.El licenciado Randall Aguirre Mena, en su calidad de Procurador Penal, formula recurso de casación contra el fallo del Tribunal de Apelación de Sentencia Penal del Tercer Circuito Judicial de Alajuela, San Ramón, N° 264-2019, de las 14:25 horas, del 10 de abril de 2019. Mediante dicha sentencia, se declaró sin lugar el recurso de apelación interpuesto por la Procuraduría General de la República, confirmándose así la absolutoria dictada a favor del encartado por el Tribunal de Juicio, por un delito de Infracción a la Ley Forestal; misma que se dispuso en grado de certeza.
II.Mediante resolución Nº 2019-01076, de las once horas y diez minutos, del cuatro de setiembre de dos mil diecinueve, esta Sala declaró admisible, para su conocimiento de fondo, únicamente el primer motivo del recurso de casación formulado por el licenciado Randall Aguirre Mena, en su calidad de representante de la Procuraduría General de la República. De seguido se procede con el conocimiento de fondo de éste, y se emite la decisión que corresponde a derecho, de acuerdo con los fundamentos de la presente resolución.
III.En el primer motivo interpuesto, -único admitido para su conocimiento de fondo- el recurrente alegó la errónea aplicación de un precepto legal, específicamente del artículo 25 de la Ley de Construcciones, N° 833, del 2 de noviembre de 1949. Señala el licenciado Aguirre Mena, que en este asunto se ratifica la absolutoria y se rechaza la acción civil resarcitoria, con base en una errada aplicación e interpretación del artículo 25 de la Ley de Construcciones, e inobservancia de lo preceptuado en los artículos 33 y 34 de la Ley Forestal, lo que incide en ilegítima fundamentación del fallo. Explica que a pesar de que se tuvo por acreditado que el imputado ordenó y materializó la construcción de cinco casas dentro del área de protección de 50 metros del río existente en el lugar, infringiendo así el artículo 33 de la Ley Forestal, se le absuelve, al interpretarse erróneamente que el artículo 25 de la Ley de Construcciones, dispone que los alineamientos de cualquier naturaleza, efectuados por el INVU, se dictan por tiempo indefinido.
Puntualmente, estima el recurrente equivocada la interpretación de los jueces de apelación, cuando afirman que en este asunto “… priva el artículo 25 de la ley de construcciones (sic) al ser una norma de orden genérico y que no hace ninguna distinción respecto al tipo de alineamiento, que al ser el del INVU un alineamiento oficial no hay que hacer distinción donde no la ley no lo hace y concluye entonces que el alineamiento pluvial no tiene vigencia ello a pesar que los planos indicaran en el sello del INVU que el alineamiento era de un año (…) La interpretación dada por el Tribunal de apelación al artículo 25 citado supra es para concluir que existía autorización para realizar los movimientos de tierra y las construcciones y que por lo tanto la conducta del imputado fue ajustada a derecho…” (folio 646). Explica que es errado considerar que el artículo 25 de la Ley de Construcciones N° 833 del año 1949, puede regular los alineamientos pluviales en zonas protegidas, siendo lo correcto que esta normativa regula los alineamientos viales emitidos por la Municipalidad o por el Ministerio de Obras Públicas, que data de 1949, como también lo establece el artículo 18 del Reglamento de Construcciones del INVU, vigente a partir del 22 de marzo de 1983, pero no aquellos que corresponden a zonas protegidas.
Hace ver que nunca podría estimarse que la Ley de Construcciones aplica a alineamientos pluviales en zonas protegidas, porque estas últimas fueron creadas al aprobarse la Ley Forestal, N° 7575 de 13 de febrero de 1996, es decir, no existían cuando fue dictada la norma de la Ley de Construcciones. De acuerdo con la Ley Forestal, en el caso de ríos, nacientes y quebradas con inclinación de más de cuarenta por ciento, como es el caso, el área de protección se amplía a 50 metros, de manera que la alineación dictada va en contra de la ley. Insiste en que para el momento de la entrada en vigencia de la Ley de Construcciones, no existían áreas protegidas ni alineamientos pluviales, por lo que considera un error que se afirme que dicha Ley de 1949, aplica para los alineamientos pluviales. Aduce que la Ley Forestal es posterior y especial en cuanto a la materia de interés. Acota, además, que la interpretación del Tribunal de Apelación de Sentencia en cuanto a la normativa aplicable, vulnera los principios precautorio y pro natura , los cuales rigen en materia ambiental.
Señala, por otro lado, que la interpretación del Tribunal de alzada “…desaplica lo que establece el artículo 132 inciso 4) de la Ley General de la Administración Pública el cual faculta por ejemplo al INVU a fijar un plazo determinado al emitir un acto administrativo como lo constituye el alineamiento fluvial tal y como se hizo en el presente asunto al otorgarle al alineamiento un plazo de un año…” (folio 648). Como agravio, sostiene que la errónea aplicación del artículo 25 de la Ley de Construcciones, provocó que se rechazara el recurso de apelación formulado y se confirmara la sentencia de juicio, lo que lesiona los intereses del Estado como querellante y actor civil. Se declara con lugar el reclamo. Sobre la aplicación de la Ley Forestal y la improcedencia de emplear la Ley de Construcciones. Esta Sala de Casación Penal estima que el reproche planteado por el recurrente es procedente.
Logra determinarse que el tribunal de alzada incurrió en la errónea aplicación e interpretación del artículo 25 de la Ley de Construcciones, N° 833; así como en la inobservancia de los numerales 33 y 34 de la Ley Forestal. En ese sentido, el Tribunal de Apelación de Sentencia Penal, en la sentencia impugnada resolvió: “ [… ] revisada la relacionada ley de Construcciones, en el numeral citado, tenemos que literalmente se dispone: “La vigencia de los alineamientos oficiales será indefinida”. (Ley 833 del 2 de noviembre de 1949). Como puede claramente verse, el artículo citado resulta de orden genérico y no hace ninguna distinción al respecto de la calidad o tipo del alineamiento, el del INVU en efecto es un “ alineamiento oficial” y, por ello, estima esta Cámara de Apelación de Sentencia que, a diferencia de la tesis expuesta por el aquí apelante, no cabe distinguir donde la ley no distingue.
Si bien es cierto la Ley de Construcciones predominantemente hace referencia a los alineamientos viales de la Municipalidad y el Ministerio de Obras Públicas y Transportes, en este artículo específico hace una alusión genérica, que perfectamente resulta aplicable a los alineamientos pluviales. Hay otra razón de derecho para considerar que dicha situación debe de ser la adecuada, en la regulación de las relaciones entre los administradores y el Estado y es que, definitivamente, estos “ alineamientos oficiales” lo que establecen no es otra cosa que limitaciones al derecho constitucional de propiedad y de acuerdo con el principio de Seguridad Jurídica el administrado debe tener un criterio definido a qué atenerse, la variabilidad constante a ese respecto podría, incluso en un caso como el que aquí ocupa una consecuencia fundamental respecto del derecho constitucional de propiedad, nótese que, en atención a la supuesta variación de criterio sobre el alineamiento pluvial para estos casos, el pasar de 15 a 50 metros implica, tal y como lo apunto el mismo imputado en su declaración, una expropiación por vía indirecta.
Por ello, esta Cámara de Apelación de Sentencia valora que en este caso sí resulta aplicable el artículo 25 de la Ley de Construcciones, como una norma genérica, que pretende tutelar los derechos del administrado y el principio de seguridad jurídica, así que si el Instituto Nacional de Vivienda y Urbanismo, con un criterio correcto o no, determinó el alineamiento en 15 metros, este criterio debe respetarse en orden al principio de seguridad jurídica y propiedad, ambos de raigambre constitucional. Y no es como lo pretende hacer ver el aquí impugnante, que el imputado pretenda engañar al Tribunal de Sentencia al respecto, es claro el justiciable en que en esta materia intervienen entidades que, al igual que él, se atuvieron a dicho señalamiento institucional para considerar que no había ningún impedimento, no sólo en que se llevara a cabo la construcción, sino en liberar recursos públicos del préstamos para vivienda y que se realizaran las casas de interés social que en este caso se construyeron en cada una de esas propiedades.
Desde tal perspectiva, estima esta Cámara de Apelación de Sentencia, que no en aplicación de la duda racional, sino por un claro supuesto de certeza de inocencia, debió haberse absuelto al aquí justiciable y que, por ende, tampoco resulta procedente la solicitud que se formula de demolición de las viviendas en cuestión, toda vez que la construcción en el área donde se establecieron contó con los respectivos permisos y la alineación pluvial correspondiente del ente encargado por ley para pronunciarse al respecto. Por lo dicho, lo procedente es declarar sin lugar el recurso de apelación de sentencia que formulara el representante de la Procuraduría General de la República.-” (cfr. folio 639). De dicho razonamiento es posible inferir, que el tribunal ad quem omitió ponderar la vigencia de la Ley de Construcciones N° 833, que data desde 2 de noviembre de 1949, así como los alcances y cobertura de la misma; lo que le hubiera permitido derivar que no era posible aplicar ésta al subjudice; y que por el contrario debía emplear la Ley Forestal, que como bien lo advierte el recurrente, es ley posterior a la Ley de Construcciones, toda vez que entró en vigencia el 16 de abril de 1996; aunado a que es también ley especial, que tutela el bien jurídico que se acusa vulnerado, al preceptuar y regular lo concerniente a la delincuencia atribuida al justiciable Paz Aberle.
Con referencia a la aplicación de la ley penal posterior y especial, esta Sala se ha pronunciado con anterioridad señalando: “ [… ]El problema, en tesis de principio, es de fácil resolución. En este sentido, si bien las dos disposiciones han desvalorado la conducta que pretende afectar o afecta la administración de justicia, queda claro que, en materia de drogas o narcotráfico, el legislador estableció una normativa específica que viniera a sancionar de manera más severa la lesión al bien jurídico a tutelar. Lo anterior, por cuanto se estimó que el tráfico de psicotrópicos o estupefacientes, lo mismo que cualquier actividad relacionada con esta problemática, en tanto constituye un grave problema social, requería ser penalizada en una normativa especial, aun cuando, algunos de los comportamientos que en ella se recogen ya estaban previstos en otras leyes o en el propio Código Penal (criterio de especialidad en la aplicación de la norma penal o “ lex specialis derogat lex generalis ”).
Ahora, dada la especialidad de esta ley, se tiene que los tipos penales que en dicha legislación se contemplan prevalecen sobre cualquier otra normativa que haya previsto y sancionado un comportamiento similar con anterioridad. Unido a ello, se tiene que el cuerpo legal referido no solo prevalece por tratarse de una ley especial, sino también por cuanto es más reciente, toda vez que la ley posterior deroga la anterior.[…]” (Resolución 2003-212, de las 11:26 horas, del 28 de marzo de 2003. Integran: Rodrigo Castro, Jesús Ramírez, José Manuel Arroyo, Rafael Madaglia y Alfredo Chirino). Es evidente, como se expuso supra, que en sub examine corresponde aplicar la Ley Forestal y no la Ley de Construcciones, toda vez que la primera es ley posterior y especial. En ese mismo sentido, se verifica también que el tribunal de alzada yerra al interpretar y aplicar el numeral 25 al que se ha hecho referencia; que dispone: “ La vigencia de los alineamientos oficiales será indefinida” , cuando consideró que siendo aquella una norma genérica, no podía hacerse distinción para su utilización, en razón de lo cual el alineamiento dado por el INVU era oficial, y que por ende no estaba caduco.
Desde lo cual, es evidente entonces que dejó de considerar que ese precepto legal no contempla los alineamientos fluviales, por cuanto no regula lo atinente a zonas de protección, ya que ello está tutelado en la Ley Forestal. En efecto, en el caso en estudio, los hechos que se atribuyeron al encartado Paz Aberle acaecen en un terreno que abarca el área de protección del Río Mastate, de manera tal que eran de aplicación los preceptos de la Ley Forestal que se acusan inobservados, sean los artículos 33 inciso b) y 34, que disponen respectivamente y en lo que interesan: “Áreas de protección. Se declaran áreas de protección las siguientes:[…] b) Una franja de quince metros en zona rural y de diez metros en zona urbana, medidas horizontalmente a ambos lados, en las riberas de los ríos, quebradas o arroyos, si el terreno es plano, y de cincuenta metros horizontales, si el terreno es quebrado. [… ]” ; y, “ Prohibición para talar en áreas protegidas.
Se prohíbe la corta o eliminación de árboles en las áreas de protección descritas en el artículo anterior […] Los alineamientos que deban tramitarse en relación con éstas áreas serán realizados por el Instituto Nacional de Vivienda y Urbanismo” . Dadas las condiciones que anteceden, determina esta Sala de Casación Penal que lo procedente es aplicar al subjudice la Ley Forestal. Sobre la base de las consideraciones anteriores, se anula la sentencia: N° 2019-00264 del Tribunal de Apelación de Sentencia del Tercer Circuito Judicial de Alajuela, San Ramón, Sección Segunda, a las 14:25 horas, del 10 de abril de 2019; y se dispone el reenvío ante esa autoridad jurisdiccional para una nueva sustanciación conforme a derecho.
Por Tanto:
Se acoge el reclamo planteado por la Procuraduría General de la República. Se anula la sentencia: N°2019-00264 del Tribunal de Apelación de Sentencia del Tercer Circuito Judicial de Alajuela, San Ramón, Sección Segunda, a las 14:25 horas, del 10 de abril de 2019; y se dispone el reenvío ante esa autoridad jurisdiccional para una nueva sustanciación conforme a derecho. Notifíquese.
