Having reviewed the appeal in cassation (Recurso de Casación) filed in these proceedings against Alfredo Paz Aberle for the offense of violating the Ley Forestal, to the detriment of Ministerio del Ambiente Energía y Telecomunicaciones; and,
Whereas:
I.Attorney Randall Aguirre Mena, in his capacity as Criminal State Attorney (Procurador Penal), files an appeal in cassation against judgment N° 264-2019 of the Tribunal de Apelación de Sentencia Penal del Tercer Circuito Judicial de Alajuela, San Ramón, issued at 14:25 hours on 10 de abril de 2019. Through that judgment, the appeal (recurso de apelación) filed by the Procuraduría General de la República was denied, thereby affirming the acquittal entered in favor of the accused by the Trial Court (Tribunal de Juicio) for the offense of violating the Ley Forestal.
II.First ground of the appeal in cassation filed: Erroneous application of a legal provision, specifically Article 25 of the Ley de Construcciones, N° 833 del 2 de noviembre de 1949: Attorney Aguirre Mena states that, in this matter, the acquittal was affirmed and the civil claim for damages (acción civil resarcitoria) was denied based on an erroneous application and interpretation of Article 25 of the Ley de Construcciones and a failure to observe the provisions of Articles 33 and 34 of the Ley Forestal, resulting in an unlawful statement of reasons for the judgment. He explains that, although it was established that the defendant ordered and carried out the construction of five houses within the 50-meter protection area (área de protección) of the river located at the site, thereby violating Article 33 of the Ley Forestal, he was acquitted based on the erroneous interpretation that Article 25 of the Ley de Construcciones provides that setback lines (alineamientos) of any kind established by INVU remain in effect indefinitely.
Specifically, the appellant considers the appellate judges’ interpretation erroneous when they state that, in this matter, “…Article 25 of the ley de construcciones (sic) prevails because it is a general provision that makes no distinction regarding the type of setback line; because the INVU setback line is an official setback line, no distinction should be made where the law makes none, and it therefore concludes that the stormwater setback line (alineamiento pluvial) has no term of validity, even though the plans indicated in the INVU stamp that the setback line was valid for one year (…) The interpretation given by the Court of Appeal to Article 25 cited supra leads to the conclusion that authorization existed to perform the earthworks (movimientos de tierra) and construction and that, therefore, the defendant’s conduct was lawful…” (f. 646). He explains that it is erroneous to consider that Article 25 of Ley de Construcciones N° 833 del año 1949 may regulate stormwater setback lines in protected areas (zonas protegidas), because the correct interpretation is that this legislation regulates road setback lines (alineamientos viales) issued by the Municipality or by the Ministerio de Obras Públicas; it dates from 1949, as is also established by Article 18 of the Reglamento de Construcciones del INVU, effective as of 22 de marzo de 1983, but it does not regulate setback lines corresponding to protected areas.
He notes that the Ley de Construcciones could never be deemed applicable to stormwater setback lines in protected areas because the latter were created when Ley Forestal, N° 7575 de 13 de febrero de 1996, was enacted; that is, they did not exist when the provision of the Ley de Construcciones was issued. Under the Ley Forestal, in the case of rivers, springs (nacientes), and streams (quebradas) with a slope greater than forty percent, as in this case, the protection area extends to 50 meters, and therefore the established setback line violates the law. He insists that when the Ley de Construcciones entered into force, neither protected areas nor stormwater setback lines existed, and he therefore considers it erroneous to state that this 1949 Law applies to stormwater setback lines. He argues that the Ley Forestal is later-enacted and specific legislation governing the subject matter at issue.
He further notes that the Tribunal de Apelación de Sentencia’s interpretation of the applicable legislation violates the precautionary principle (principio precautorio) and the pro natura principle (principio pro natura), which govern environmental matters. He further states that the appellate court’s interpretation “…disregards the provisions of Article 132 subsection 4) of the Ley General de la Administración Pública, which authorizes INVU, for example, to establish a specific term when issuing an administrative act (acto administrativo), such as the river setback line (alineamiento fluvial), as was done in the present matter by granting the setback line a term of one year…” (f. 648). As grounds for prejudice, he maintains that the erroneous application of Article 25 of the Ley de Construcciones resulted in the denial of the appeal filed and the affirmation of the trial judgment, thereby harming the interests of the State as private prosecutor (querellante) and civil claimant (actor civil).
The claim is admitted for consideration on the merits: It is established that the appeal at issue was filed in a timely manner by one of the parties to the proceedings legally entitled to do so—the representative of the Procuraduría General de la República. Furthermore, the challenge is directed against the judgment that decided the appeal from a criminal judgment, and it alleges erroneous application of substantive law (ley sustantiva), which constitutes a valid ground for filing the appeal under subsection b) of Article 468 of the Código Procesal Penal. The appeal also explains why Article 25 of the Ley de Construcciones is considered to have been erroneously applied in this matter and why the provisions of Articles 33 and 34 of the Ley Forestal should have been applied, leading to the conclusion that the construction carried out with a buffer zone (zona de retiro) smaller than that required by law was legally compliant.
It is also established that the alleged prejudice rests on the assertion that the erroneous application of substantive law in this case resulted in the affirmation of a criminal acquittal and the dismissal of the civil claim for damages, which the appellant maintains was improper. Because it satisfies the formal requirements stipulated in Articles 467, 468 subsection b), 469, and 471 of the Código Procesal Penal, the first ground of the appeal in cassation filed by Attorney Randall Aguirre Mena is admitted for consideration on the merits.
III.Second ground of the challenge filed: Lack of reasoning (falta de fundamentación) in the judgment upon rejection of the third ground of the appeal concerning the request for demolition: The appellant states that Article 142 of the Código Procesal Penal was violated when the third claim on cassation (queja de casación) was rejected. That claim alleged that, because it had been proven that the homes were built within the protection area (área de protección) of the Mastate River, the demolition of those structures should have been ordered pursuant to Articles 140 and 367 of the Código Procesal Penal. He explains that the denial of demolition is based on the acquittal (absolutoria), which established that the structures had the corresponding permits because they were built within the limits of the watercourse setback line (alineamiento pluvial) issued by the entity legally empowered to do so.
Ultimately, they reasoned that “…the existence of the protection area beyond fifteen meters could not be established…” (f. 683). However, Mr. Aguirre Mena maintains that the criminal acquittal does not preclude ordering demolition and that “…whether or not a building was constructed within the protection area is a matter that may be determined through reports from MINAE or from Forensic Engineering; such evidence is useful and relevant for proving that a structure encroaches upon the protection area referred to in Article 33 of the Ley Forestal. Nevertheless, relying on a setback line that was invalid, the Court concludes that the stamp on the plan is the only means of determining whether or not a project is located within the protection area, an argument that is entirely erroneous…” (f. 684). In addition to the expert reports (informes periciales), the State Attorney states that the witnesses Carlos Gutiérrez and Eliden Alcázar “…corroborate that the protection area is indeed 50 meters and that the homes were built in encroachment upon that area…” (ibid).
The appellant argues that it is incorrect to state that a criminal conviction is required for demolition; proof of unlawfulness (antijuridicidad) is sufficient, as it is in this case because the alleged conduct violated the Ley Forestal. He states that the existence of construction permits and a setback line (whether valid or not) does not eliminate the duty to verify whether the homes were built within the protection area of the Mastate River, and that “…it is not valid to maintain, as the Court of Appeal contends, that an issued permit or a setback line may prevail over the provisions of the Ley Forestal concerning compliance with the setback from a body of water to which the legislature has granted special protection…” (f. 687). He explains that the lack of reasoning arises from the failure to analyze the arguments on appeal, particularly the evidence indicating that the buildings are within the protection area of the Mastate River, and from the absence of legal reasoning concerning Articles 140 and 267 of the Código Procesal Penal, 103 of the Código Penal, and 33 and 34 of the Ley Forestal.
As prejudice (agravio), he states that if the appellate judges had properly analyzed the aforementioned provisions, an order would have been issued for the demolition of the homes in question. The claim is inadmissible: As this Chamber has repeatedly stated (judgments N° 1149-2015, of 9:19 hours on September 4, 2015, N° 608-2014 of 8:54 hours on April 4, 2014, N° 1616-2012 of 15:35 hours on October 23, 2012, and N° 1477-2011 of 15:32 hours on December 12, 2011, among others), the defect of inadequate reasoning (vicio de falta de motivación) is admissible as a derivative of the ground of erroneous application of procedural law (errónea aplicación de la ley procesal), provided that it is demonstrated that: 1) a serious logical error exists; or 2) the judgment omitted a response to an issue raised on appeal that is relevant to the correct resolution of the matter. In this particular case, the appellant’s arguments do not establish the presence of either form of inadequate reasoning identified above.
Rather, his arguments are directed at asserting that substantive law (ley sustantiva) was erroneously applied because the provisions contained in the Ley Forestal were not applied. According to his reasoning, those provisions supported a finding that a protected zone (zona protegida) of 50 meters existed, contrary to the finding that the conduct was not unlawful, which the court below (ad quem) derived from the watercourse setback line approved by INVU. With respect to the request for demolition, the Court of Appeal of the Judgment (Tribunal de Apelación de Sentencia) explained that its rejection was based on the fact that “…construction in the area where the buildings were erected had the respective permits and the corresponding watercourse setback line from the entity legally responsible for ruling on the matter…” (f. 639 vto.). This is supplemented by its statement that: “…this Chamber of Appeal of the Judgment finds that Article 25 of the Ley de Construcciones is applicable in this case as a general provision intended to safeguard the rights of the governed party (administrado) and the principle of legal certainty (principio de seguridad jurídica).
Therefore, if the Instituto Nacional de Vivienda y Urbanismo, whether based on a correct criterion or not, set the setback line at 15 meters, that determination must be respected pursuant to the principles of legal certainty and property, both of which are constitutionally rooted…” (f. 639). Thus, the court below did explain why it considered that, in this matter, the protection zone (zona de protección) with respect to the Mastate River had to be set at 15 rather than 50 meters (as indicated by the Ley Forestal), making a statutory interpretation (interpretación normativa) that must be analyzed under the already-admitted ground concerning the merits (motivo por el fondo), without prejudging at this time whether it is correct or incorrect. Consequently, it is concluded that the appellant failed to demonstrate the existence of a serious logical defect or an omission of reasoning, and the second ground of the challenge filed by the representative of the Procuraduría General de la República is therefore declared inadmissible.
IV.In responding to the cassation hearing (audiencia de casación), the accused (encartado) submits a “special request” (f. 703) that costs be awarded against the State pursuant to Article 267 of the Código Procesal Penal, on the ground that he has been subjected to prosecution by the Procuraduría General de la República, which filed a challenge in this case despite the Ministerio Público’s request for a final dismissal (sobreseimiento definitivo) and the acquittals (for reasonable doubt and with certainty) entered respectively by the Trial Court (Tribunal de Juicio) and the Tribunal de Apelación de Sentencia. For the reasons set forth below, the request must be denied: Unlike the informal and flexible nature of an appeal (recurso de apelación), a cassation appeal (recurso de casación) is formal, limited in the scope of matters subject to review, and available only on the exhaustive grounds stipulated in Article 468 of the Código Procesal Penal.
In this matter, the Tribunal de Juicio acquitted the defendant (justiciable) on the basis of reasonable doubt and, upon hearing the appeal filed, the court below ordered that the accused (sindicado) be acquitted with certainty. Although it is true that, under those circumstances, neither defense counsel nor the defendant personally (defensa técnica o material) was required to challenge the ruling on costs from the outset, the appellate ruling opened the possibility for the interested party to file a cassation appeal (within fifteen days after notice of the appellate judgment or by means of an adhesional cassation appeal (casación por adhesión)), alleging as grounds for its admissibility the change in the reasons for entering the acquittal. Nevertheless, because this is a formal appeal, raising a cassation claim requires compliance with the basic formalities demanded of any party to the proceedings, namely: invoking a valid ground for filing, substantiating the arguments, specifying the prejudice, and separately stating the relief sought for each objection.
The defense has met none of these obligations. Thus, even if the request submitted as part of the response to the cassation hearing were construed as an adhesional cassation appeal, it is inadmissible for failure to satisfy the statutory requirements for admissibility set forth in Articles 471 and 469 of the governing procedural code (Código de rito).

Visto el Recurso de Casación interpuesto en la presente causa seguida contra Alfredo Paz Aberle, por el delito de Infracción a la Ley Forestal, en perjuicio de Ministerio del Ambiente Energía y Telecomunicaciones, y;
Considerando:
I.El licenciado Randall Aguirre Mena, en su calidad de Procurador Penal, formula recurso de casación contra el fallo del Tribunal de Apelación de Sentencia Penal del Tercer Circuito Judicial de Alajuela, San Ramón, N° 264-2019, de las 14:25 horas del 10 de abril de 2019. Mediante dicha sentencia, se declaró sin lugar el recurso de apelación interpuesto por la Procuraduría General de la República, confirmándose así la absolutoria dictada a favor del encartado por el Tribunal de Juicio, por un delito de infracción a la Ley Forestal.
II.Primer motivo del recurso de casación incoado: Errónea aplicación de un precepto legal, específicamente del artículo 25 de la Ley de Construcciones, N° 833 del 2 de noviembre de 1949: Señala el licenciado Aguirre Mena, que en este asunto se ratifica la absolutoria y se rechaza la acción civil resarcitoria, con base en una errada aplicación e interpretación del artículo 25 de la Ley de Construcciones, e inobservancia de lo preceptuado en los artículos 33 y 34 de la Ley Forestal, lo que incide en ilegítima fundamentación del fallo. Explica que a pesar de que se tuvo por acreditado que el imputado ordenó y materializó la construcción de cinco casas dentro del área de protección de 50 metros del río existente en el lugar, infringiendo así el artículo 33 de la Ley Forestal, se le absuelve, al interpretarse erróneamente que el artículo 25 de la Ley de Construcciones, dispone que los alineamientos de cualquier naturaleza, efectuados por el INVU, se dictan por tiempo indefinido.
Puntualmente, estima el recurrente equivocada la interpretación de los jueces de apelación, cuando afirman que en este asunto “…priva el artículo 25 de la ley de construcciones (sic) al ser una norma de orden genérico y que no hace ninguna distinción respecto al tipo de alineamiento, que al ser el del INVU un alineamiento oficial no hay que hacer distinción donde no la ley no lo hace y concluye entonces que el alineamiento pluvial no tiene vigencia ello a pesar que los planos indicaran en el sello del INVU que el alineamiento era de un año (…) La interpretación dada por el Tribunal de apelación al artículo 25 citado supra es para concluir que existía autorización para realizar los movimientos de tierra y las construcciones y que por lo tanto la conducta del imputado fue ajustada a derecho…” (f. 646). Explica que es errado considerar que el artículo 25 de la Ley de Construcciones N° 833 del año 1949, puede regular los alineamientos pluviales en zonas protegidas, siendo lo correcto que esta normativa regula los alineamientos viales emitidos por la Municipalidad o por el Ministerio de Obras Públicas, que data de 1949, como también lo establece el artículo 18 del Reglamento de Construcciones del INVU, vigente a partir del 22 de marzo de 1983, pero no aquellos que corresponden a zonas protegidas.
Hace ver que nunca podría estimarse que la Ley de Construcciones aplica a alineamientos pluviales en zonas protegidas, porque estas últimas fueron creadas al aprobarse la Ley Forestal, N° 7575 de 13 de febrero de 1996, es decir, no existían cuando fue dictada la norma de la Ley de Construcciones. De acuerdo con la Ley Forestal, en el caso de ríos, nacientes y quebradas con inclinación de más de cuarenta por ciento, como es el caso, el área de protección se amplía a 50 metros, de manera que la alineación dictada va en contra de la ley. Insiste que para el momento de la entrada en vigencia de la Ley de Construcciones, no existían áreas protegidas ni alineamientos pluviales, por lo que considera un error que se afirme que dicha Ley de 1949, aplica para los alineamientos pluviales. Aduce que la Ley Forestal es posterior y especial en cuanto a la materia de interés. Acota, además, que la interpretación del Tribunal de Apelación de Sentencia en cuanto a la normativa aplicable, vulnera los principios precautorio y pro natura, los cuales rigen en materia ambiental.
Señala, por otro lado, que la interpretación del Tribunal de alzada “…desaplica lo que establece el artículo 132 inciso 4) de la Ley General de la Administración Pública el cual faculta por ejemplo al INVU a fijar un plazo determinado al emitir un acto administrativo como lo constituye el alineamiento fluvial tal y como se hizo en el presente asunto al otorgarle al alineamiento un plazo de un año…” (f. 648). Como agravio, sostiene que la errónea aplicación del artículo 25 de la Ley de Construcciones, provocó que se rechazara el recurso de apelación formulado y se confirmara la sentencia de juicio, lo que lesiona los intereses del Estado como querellante y actor civil. El reclamo se admite para su conocimiento de fondo: Se constata que el recurso en cuestión fue formulado en tiempo, por uno de los intervinientes en el proceso que válidamente puede hacerlo – el representante de la Procuraduría General de la República –.
Además, la impugnación se dirige contra el fallo que resolvió la apelación de una sentencia penal, y se alega errónea aplicación de la ley sustantiva, lo que constituye una causal válida de interposición del recurso, según lo establece el inciso b) del artículo 468 del Código Procesal Penal. Se menciona en el recurso, además, por qué se estima que en este asunto se aplicó erróneamente el artículo 25 de la Ley de Construcciones, y se omitió aplicar lo establecido en los numerales 33 y 34 de la Ley Forestal, lo que condujo a estimar que la construcción efectuada con una zona de retiro menor a la que correspondía, según la ley, se encontraba conforme a Derecho. Se constata también, que el agravio se afinca en que la errónea aplicación de la ley sustantiva, en este caso, condujo a confirmar una absolutoria penal y declaratoria sin lugar de la acción civil resarcitoria, que a juicio del impugnante no procedía.
Por cumplir con los requisitos formales estipulados en los artículos 467, 468 inciso b), 469 y 471 del Código Procesal Penal, se admite para su conocimiento de fondo, el primer motivo del recurso de casación formulado por el licenciado Randall Aguirre Mena.
III.Segundo motivo de la impugnación interpuesta: Falta de fundamentación de la sentencia, al rechazar el tercer motivo del recurso de apelación, en cuanto a la solicitud de derribo: El recurrente señala que se vulneró el ordinal 142 del Código Procesal Penal, al rechazarse la tercera queja de casación, en el que se alegaba que por haberse demostrado que las viviendas fueron construidas dentro del área de protección del río Mastate, debía ordenarse el derribo de dichas construcciones al amparo de los artículos 140 y 367 del Código Procesal Penal. Explica que la denegatoria del derribo, se sustenta en la absolutoria, en que se estableció que las construcciones contaron con los permisos correspondientes, pues se realizaron dentro de los límites del alineamiento pluvial otorgado por el ente competente según la ley. En definitiva, razonaron que “…no se logró determinar la existencia del área de protección más allá de los quince metros…” (f. 683).
Sin embargo, sostiene el licenciado Aguirre Mena que la absolutoria penal no es óbice para disponer el derribo y que “…si una edificación fue construida o no dentro del área de protección es un aspecto que puede determinarse mediante informes del MINAE o bien de ingeniería Forense, prueba que es útil y pertinente para poder demostrar que existe una construcción que se encuentra invadiendo el área de protección al que (sic) hace alusión el numeral 33 de la Ley Forestal, no obstante el Tribunal amparado en un alineamiento que no tenía validez, llega a la conclusión que dicho sello en el plano es la única forma de determinar si una obra se encuentra o no dentro del área de protección, argumento que es completamente errado…” (f. 684). Además de los informes periciales, el procurador señala que los testigos Carlos Gutiérrez y Eliden Alcázar “…corroboran que en efecto el área de protección es de 50 metros y que las viviendas fueron construidas invadiendo dicha área…” (ibid).
Aduce el recurrente, que es incorrecto señalar que es necesaria una condena penal para el derribo, bastando comprobar la antijuridicidad, lo que sucede en este caso porque las conductas acusadas violentaron la Ley Forestal. Indica que el hecho de que se contara con permisos de construcción y un alineamiento (válido o no), no excluye el deber de verificar si las viviendas fueron construidas dentro del área de protección del Río Mastate, “…no es válido sostener como lo pretende el Tribunal de Apelación que un permiso emitido o bien un alineamiento puedan estar sobre lo que dispone la ley forestal (sic) en cuanto al respeto de un retiro de un cuerpo de agua al cual el legislador le ha otorgado una protección especial…” (f. 687). Explica que la falta de fundamentación se origina en la ausencia de análisis de los argumentos de apelación, especialmente la prueba que señala que las edificaciones están dentro del área de protección del Río Mastate, y ausencia de fundamentación jurídica en cuanto a lo que señalan los artículos 140 y 267 del Código Procesal Penal, 103 del Código Penal, y 33 y 34 de la Ley Forestal.
Como agravio, señala que si los jueces de apelación hubiesen analizado debidamente la normativa antes mencionada, se habría dispuesto la orden de derribo de las viviendas en cuestión. La queja no resulta admisible: Según ha señalado reiteradamente esta Sala (fallos N° 1149-2015, de las 9:19 horas del 4 de septiembre de 2015, N° 608-2014 de las 8:54 horas del 4 de abril de 2014, N° 1616-2012 de las 15:35 horas del 23 de octubre de 2012, y N° 1477-2011 de las 15:32 horas del 12 de diciembre de 2011, entre otros), el vicio de falta de motivación resulta admisible, como un derivado de la hipótesis de errónea aplicación de la ley procesal, siempre y cuando se demuestre: 1) la existencia de un error lógico grave, o bien; 2) la omisión de dar respuesta a algún extremo alegado en apelación, que resulte relevante para la correcta resolución el asunto. En el caso particular, la argumentación del recurrente no permite establecer la concurrencia de alguno de los supuestos de falta de motivación indicados.
Sus alegatos más bien, se dirigen a señalar que existió una errónea aplicación de la ley sustantiva, porque se desaplicaron las normas contenidas en la Ley Forestal, que según se razona, permitían afirmar la existencia de una zona protegida de 50 metros, en contra de la falta de antijuridicidad de la conducta, que el ad quem deriva del alineamiento pluvial aprobado por el INVU. En cuanto a la solicitud de derribo, el Tribunal de Apelación de Sentencia expuso que su rechazo se sustenta en “…la construcción en el área donde se establecieron contó con los respectivos permisos y la alineación pluvial correspondiente del ente encargado por ley para pronunciarse al respecto…” (f. 639 vto.). Lo que se complementa con su afirmación consistente en que: “…esta Cámara de Apelación de Sentencia valora que en este caso sí resulta aplicable el artículo 25 de la Ley de Construcciones, como una norma genérica, que pretende tutelar los derechos del administrado y el principio de seguridad jurídica, así que si el Instituto Nacional de Vivienda y Urbanismo, con un criterio correcto o no, determinó el alineamiento en 15 metros, ese principio debe respetarse en orden al principio de seguridad jurídica y propiedad, ambos de raigambre constitucional…” (f. 639).
De manera que el ad quem sí explicó por qué razón consideraba que en este asunto la zona de protección con respecto al río Mastate debía establecerse en 15 y no 50 metros (como lo indica la Ley Forestal), realizando una interpretación normativa que deberá ser analizada en el motivo por el fondo ya admitido, sin prejuzgarse ahora sobre su corrección o incorrección. En consecuencia de lo expuesto, se concluye que el recurrente no logró demostrar la existencia de un vicio lógico grave, o de motivación omisa, razón por la cual se declara inadmisible el segundo motivo de la impugnación interpuesta por el representante de la Procuraduría General de la República.
IV.Al contestar la audiencia de casación, el encartado efectúa una “solicitud especial” (f. 703) para que se condene en costas al Estado, con sustento en el artículo 267 del Código Procesal Penal, al estimar que ha existido una persecución en su contra por parte de la Procuraduría General de la República, al impugnar en este caso a pesar de la solicitud de sobreseimiento definitivo del Ministerio Público, y las absolutorias (por duda y por certeza) dictadas respectivamente, por el Tribunal de Juicio y el Tribunal de Apelación de Sentencia. Por las razones que se dirán, el requerimiento debe rechazarse: Contrario al carácter informal y flexible del recurso de apelación, el recurso de casación resulta ser formal, limitado en cuanto a su objeto de conocimiento, y procede solo por las causales taxativas estipuladas en el artículo 468 del Código Procesal Penal. En este asunto, el Tribunal de Juicio absolvió al justiciable por duda, y al conocer del recurso de apelación formulado, el ad quem dispuso absolver al sindicado por certeza.
Si bien es cierto, ante dicha situación no era exigible que la defensa técnica o material hubiesen impugnado lo resuelto en cuanto a las costas desde un inicio, a partir del pronunciamiento de alzada, se abrió la posibilidad de que la parte interesada interpusiese recurso de casación (en el plazo de quince días a partir de la notificación del fallo de apelación o bien, por vía de la casación por adhesión), alegándose para su procedencia, el cambio en cuanto a las razones para dictar la absolutoria. Sin embargo, tratándose de un recurso formal, la interposición de un alegato de casación supone el cumplimiento de las formalidades básicas exigibles a cualquier parte procesal como lo son: invocar una causal de interposición válida, fundamentar sus alegatos, concretar el agravio y la pretensión de cada uno de sus reparos en forma separada. Ninguna de estas obligaciones las cumple la defensa, por lo que aún si se interpretase la solicitud efectuada como parte de la contestación de la audiencia de casación, como un recurso de casación por adhesión, la gestión resulta inadmisible por incumplir los requisitos legales para su procedencia, que señalan los ordinales 471 y 469 del Código de rito.
Por Tanto:
Se admite para su conocimiento de fondo, el primer motivo correspondiente al recurso de casación formulado por el licenciado Randall Aguirre Mena, en calidad de representante de la Procuraduría General de la República. Se declara inadmisible la segunda queja del recurso incoado por el licenciado Aguirre Mena, así como la “solicitud especial” de condena en costas al Estado, efectuada por la defensa. Notifíquese.
