Appeal in cassation (recurso de casación) filed in the present proceedings against [Nombre 001], of legal age, Costa Rican, married, holder of identity card [...], for the offense of Violation of the Ley Forestal in the Form of Illegal Transportation of Timber, to the detriment of Natural Resources. Participating in this proceeding are Justices Jesús Alberto Ramírez Quirós, Patricia Solano Castro, Jorge Enrique Desanti Henderson, Sandra Eugenia Zúñiga Morales, and Rafael Segura Bonilla, the latter three as alternate justices. By Judgment N° 66-18, issued at fourteen hours on the twenty-first day of February, two thousand eighteen, the Criminal Judgment Appeals Court of the Second Judicial Circuit of Guanacaste, Santa Cruz seat, ruled: “POR TANTO The appeal filed by Ronald Guevara Chavarría, attorney-at-law and representative of the Public Prosecution Service, is denied. NOTICE SHALL BE GIVEN. CYNTHIA DUMANI STRADTMANN MARÍA LUCILA MONGE PIZARRO GERARDO RUBÉN ALFARO VARGAS CRIMINAL JUDGMENT APPEALS JUDGES” (sic).

2. José Ronald Guevara Chavarría, attorney-at-law and representative of the Environmental Prosecutor’s Office of the Second Judicial Circuit of Guanacaste, filed an appeal in cassation against the foregoing ruling.

3. After the corresponding deliberation, the Chamber considered the issues raised in the appeal.

4. The relevant legal requirements have been observed in the appeal.

Justice Ramírez Quirós reporting; and,

Considering:

I.By Decision number 2018-567 of this Chamber, issued at 10:06 hours on August 24, 2018, the present appeal in cassation filed by Jose Ronald Guevara Chavarría, assistant prosecutor of Santa Cruz, Guanacaste, against Judgment number 66-2018, issued by the Criminal Judgment Appeals Court of the Second Judicial Circuit of Guanacaste at 14:00 hours on February 21, 2018, which denied the appeal against judgment filed by that same representative, was admitted for consideration on the merits.

II.In the first ground, pursuant to Article 468(b) of the Code of Criminal Procedure, the appellant alleges the erroneous application of substantive legal provisions, specifically Articles 56 and 63(a) of the Ley Forestal. He contends that this defect arose from agreeing with the Trial Court’s view that the offense is established when timber is transported without the corresponding documentation, whereas if the legal documents exist but are not carried at the time of transportation, the conduct does not satisfy the statutory definition of the offense (conducta atípica), because the actus reus (hecho típico) requires the absence of an authorization or certificate of origin. According to the appellant, this is a formal offense (delito formal), established by the failure to carry documents proving or supporting the origin of the timber, regardless of whether those documents exist and are located elsewhere, or are even submitted later.

This is because the legally protected interest (bien jurídico) is the security of trade in forest products, and the appellate court’s interpretation of the criminal provision could give rise to irregularities in obtaining documentation supporting a forest product—for example, the recycling of transport forms, a practice used by timber merchants to reuse documents for other shipments and thereby remove a quantity of timber exceeding that authorized. He adds that the principles of progressive protection and non-regression (principios de progresividad y no regresión de la tutela), which inform environmental law and have been recognized by the Constitutional Chamber in Decisions 2012-13367 and 2010-18702, are violated. The requirement to carry the documents when transporting timber is established in Executive Decree 30918-MINAE-MOPT-SP and responds to the need for the authorities to verify whether the information in the transport form matches what is being transported.

The decision prejudices the Public Prosecution Service’s punitive claims as a consequence of the erroneous application of substantive law. The appellant requests that the claim be granted. In the second ground, he alleges the existence of conflicting precedents between the ruling of the Criminal Judgment Appeals Court of Santa Cruz and Decision number 2014-1043 of the Criminal Cassation Chamber, from which he transcribes an excerpt. In the appellant’s view, the conflict arises because the appellate court holds that if the documents concerning the origin of and authorization to transport the timber exist, but the transporter does not carry them when moving the timber, the offense is not established; whereas the decision of this Chamber cited by the appellant states that, pursuant to Articles 31 and 56 of the Ley Forestal, the person transporting the forest product must carry the documents authorizing the activity.

The appellant argues that protecting the legally protected interest, which in this case is the security of the timber trade, makes it necessary for transporters to carry the aforementioned documentation in order to prevent illegal logging and the removal of forest products from private properties through government inspections conducted on public roads. Requiring the documents to be carried prevents timber from being transported illegally in collusion with corrupt forestry supervisors and its origin and transportation from being justified after the fact following government intervention. He argues that the regulations implementing the Ley Forestal supplement Articles 31 and 55 of that statute regarding the requirements for transporting forest products, which include the certificate of origin. He adds that it makes no sense to complete the transport forms but not carry them when moving the timber.

He requests that, given the existence of two conflicting decisions, the case law be unified according to the position consistently maintained by the Third Chamber, under which carrying the certificate of origin and transport form is mandatory when timber is moved. He considers that prejudice has been caused because the stated conflict violates the constitutional principles of equality and effective judicial protection (tutela judicial efectiva) and prevents the Public Prosecution Service from understanding and reviewing the Criminal Judgment Appeals Court’s interpretation of the offense of illegal transportation of timber. Both grounds are denied. Under two different grounds, the same issue is raised: the scope and interpretation of Articles 56 and 63(a) of the Ley Forestal regarding the requirements for moving or transporting timber originating from a plantation. As to the claim based on conflicting precedents, this Chamber finds that the alleged conflict does not exist because, in this case, it was found proven that the defendant “had an invoice for said timber and, according to the document appearing at folio 23, did have a certificate of origin for transporting logs or sawn timber, which certificate was prepared by forestry supervisor Herminio Rodríguez, whose supervisory appointment remained valid until (sic) October 10, 2011 and until October 10, 2012” (folio 147, emphasis added).

As to the precedents cited by the appellant, Decision 2014-1043 of this Chamber states that the proven facts in the judgment described the following: “…the accused … transported 328 logs of plantation-grown timber of the species Teutona Grandis, commonly called Teca, aboard a Mack truck, license plate C133042. Second: the foregoing occurred without the defendant [Nombre 002], at the time of his detention, having a transport form, certificate of origin, or any type of permit or authorization from the State forestry authority…” (emphasis added). As can be seen, the factual basis of the two proceedings differs in an essential respect that forms part of the objective elements of the offense (tipo objetivo), namely, whether the corresponding documentation existed. Article 56 of the Ley Forestal, Ley 7575 of April 16, 1996, provides the following regarding the transportation of timber: “Logs, squared timber, or sawn timber originating from a forest or plantation may not be transported without the corresponding documentation.” Therefore, anyone who transports logs, whether squared or sawn, originating from a forest or plantation, without the corresponding documentation commits the offense of violating the Ley Forestal and is subject to imprisonment for one month to one year.

A joint analysis of Articles 56, 31, and 63 of the Ley Forestal leads to the conclusion that, in order to transport timber, whether originating from a forest or a forest plantation, the person must have the certificate of origin issued by the forestry supervisor or the Regional Environmental Council. In this case, it was established that the defendant had the certificate of origin—which had been processed previously and was submitted into the record—required by law to transport the timber. Accordingly, this Chamber finds that the alleged defect in the application of substantive law is likewise not established, and the proper course is therefore to deny the appeal filed by the Public Prosecution Service.

Recurso de Casación interpuesto en la presente causa seguida contra [Nombre 001], mayor, costarricense, casado, portador de la cédula [...] por el delito de Infracción a la Ley Forestal en su Modalidad de Transporte Ilegal de Madera, en perjuicio de Los Recursos Naturales. Intervienen en esta instancia los magistrados y magistradas Jesús Alberto Ramírez Quirós, Patricia Solano Castro, Jorge Enrique Desanti Henderson, Sandra Eugenia Zúñiga Morales y Rafael Segura Bonilla, estos últimos tres como magistrados suplentes. También intervienen en esta instancia la licenciada Michelle Pérez Ruiz, en su condición de defensora pública del imputado, el licenciado José Ronald Guevara Chavarría como representante de la Fiscalía Ambiental del Segundo Circuito Judicial de Guanacaste y el Licenciado Elvis López Matarrita como representante de la Fiscalía Adjunta de Impugnaciones del Ministerio Público.

Resultando:

1. Mediante sentencia N° 66-18, dictada las catorce horas del veintiuno de febrero del dos mil dieciocho, el Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de Guanacaste, sede Santa Cruz, resolvió: “POR TANTO Se declara sin lugar el recurso planteado por el licenciado Ronald Guevara Chavarría, representante del Ministerio Público. NOTIFÍQUESE. CYNTHIA DUMANI STRADTMANN MARÍA LUCILA MONGE PIZARRO GERARDO RUBÉN ALFARO VARGAS JUEZAS Y JUEZ DE APELACIÓN DE SENTENCIA " (sic).

2. Contra el anterior pronunciamiento, el licenciado José Ronald Guevara Chavarría, representante de la Fiscalía Ambiental del Segundo Circuito Judicial de Guanacaste, interpuso recurso de casación.

3. Verificada la deliberación respectiva, la Sala se planteó las cuestiones formuladas en el recurso.

4. En el recurso se han observado las prescripciones legales pertinentes.

Informa el magistrado Ramírez Quirós; y,

Considerando:

I.Mediante resolución de esta Sala número 2018-567, de las 10:06 horas, del 24 de agosto de 2018 se admitió para estudio de fondo el presente recurso de casación formulado por el licenciado Jose Ronald Guevara Chavarría, fiscal auxiliar de Santa Cruz, Guanacaste, contra la sentencia número 66-2018, emitida por el Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de Guanacaste, a las 14:00 horas, del 21 de febrero del 2018, misma que declaró sin lugar el recurso de apelación de sentencia formulado por esa misma representación.

II.En el primer motivo, con fundamento en el numeral 468 inciso b) del Código Procesal Penal, alega errónea aplicación de preceptos legales sustantivos, específicamente los artículos 56 y 63 inciso a) de la Ley Forestal, vicio que se da al coincidir con el criterio esbozado por el Tribunal de Juicio en cuanto a que el delito se configura cuando se moviliza madera sin contar con la documentación respectiva, y que si se cuenta con los documentos legales pero no se portan al momento del transporte la conducta es atípica, pues lo que el hecho típico requiere es que no se cuente con la autorización o certificado de origen. Para el recurrente se trata de un delito formal que se constituye al no portarse los documentos que acrediten o respalden el origen de la madera, independientemente de que esos documentos existan y se encuentren en otro lugar, e incluso que se aporten con posterioridad. Lo anterior por cuanto el bien jurídico que se protege es la seguridad en el tráfico de productos forestales y la interpretación del tipo penal que se hace por el ad quem podría dar lugar a irregularidades en la adquisición de la documentación para respaldar el producto forestal por ejemplo el reciclaje de guías, práctica utilizada por los madereros para utilizar los documentos en otros transportes y así sacar una cantidad de madera mayor a la autorizada.

Agrega que se transgreden los principios de progresividad y no regresión de la tutela que informan en derecho ambiental los que han sido reconocidos por la Sala Constitucional en los votos 2012-13367 y 2010-18702. La obligatoriedad de portar los documentos al momento de transportar la madera, se establece en el decreto ejecutivo 30918-MINAE-MOPT-SP y responde a la necesidad de que las autoridades puedan corroborar si la información de la guía coincide con lo que se transporta. La decisión produce un agravio a las pretensiones punitivas del Ministerio Público como consecuencia de la errónea aplicación de la ley sustantiva. El recurrente solicita declarar con lugar el reclamo. En el segundo motivo, alega la existencia de precedentes contradictorios entre lo resuelto por el Tribunal de Apelación de Sentencia de Santa Cruz y el voto de la Sala de Casación Penal número 2014-1043, del cual transcribe un fragmento.

En criterio del impugnante, la oposición se da en cuanto el ad quem sostiene que si los documentos sobre el origen y autorización para transportar la madera existen pero el transportista no los porta al momento de movilizar la madera, el delito no se configura; en tanto que el voto de esta Sala que cita el recurrente, señala que conforme los artículos 31 y 56 de la Ley Forestal, quien traslada el producto forestal debe llevar los documentos que autorizan la actividad. El recurrente expone que la protección del bien jurídico, que en este caso es la seguridad en el tráfico de madera, hace necesario que los transportistas porten la documentación dicha, para evitar la tala ilegal y la sustracción de productos forestales de propiedades privadas, ello mediante el control estatal realizado en vía pública. Con la exigencia de portar los documentos se impide que, en contubernio con regentes forestales corruptos, se transporte madera de forma ilegal y ante la intervención estatal se justifique a posteriori el origen y transporte del producto forestal.

Aduce que el reglamento a la Ley Forestal complementa los artículos 31 y 55 de dicho cuerpo normativo, en cuanto a los requisitos para el transporte forestal entre los que se encuentra el certificado de origen. Agrega que no tiene sentido llenar las guías de transporte y no portarlas al momento de movilizar la madera. Solicita que ante la existencia de dos votos contradictorios se unifique con el criterio que ha venido sosteniendo la Sala Tercera según el cual es obligatorio portar el certificado de origen y la guía de transporte cuando se movilice la madera. Considera que se ha causado un agravio pues la contradicción apuntada violenta el principio constitucional de igualdad y tutela judicial efectiva e impide al Ministerio Público comprender y controlar la interpretación que hace el Tribunal de Apelación de Sentencia del delito de movilización ilegal de madera. Sin lugar ambos motivos.

A partir de dos causales diversas se viene alegando un mismo punto, cual es el alcance y interpretación de los artículos 56 y 63 a) de la Ley Forestal, en cuanto a los requisitos para la movilización o transporte de madera proveniente de una plantación. En lo referente al alegato por precedentes contradictorios encuentra esta Sala que no existe la oposición alegada, por cuanto en la especie lo que se tuvo por demostrado fue que el encartado “contaba con una factura de dicha madera, además según documento visible a folio 23 sí contaba con un certificado de origen para la movilización de madera en troza o aserrada, mismo certificado que es elaborado por el regente forestal Herminio Rodríguez, cuya regencia se encontraba vigente hasta (sic) el día 10 de octubre del 2011 y hasta el 10 de octubre de 2012” (folio 147, la negrita es suplida). En los precedentes citados por el recurrente tenemos que según se consigna en el voto 2014-1043 de esta Sala, los hechos probados de la sentencia describían: “… el acusado … movilizó 328 trozas de madera de plantación de la especia Teutona Grandis, comúnmente llamada Teca, a bordo del camión marca Mack placas C133042.

Segundo: lo anterior sin contar el encartado [Nombre 002] al momento de su detención con guía de transporte, certificado de origen ni ningún tipo de permiso ni autorización por parte de la autoridad forestal del Estado… ” (la negrita es suplida). Como se advierte el sustento fáctico de ambos procesos difiere en un aspecto esencial que forma parte del tipo objetivo, cual es si se contaba con la documentación respectiva o no. El artículo 56 de la Ley Forestal, ley 7575 del 16 de abril de 1996, indica respecto a la movilización de madera: “No se podrá movilizar madera en trozas, escuadrada ni aserrada proveniente de bosque ni de plantación, si no se cuenta con la documentación respectiva.” Tenemos entonces que quien movilice madera en trozas, sea escuadrada o aserrada, proveniente de bosque o de plantación, sin contar con la documentación respectiva, incurre en el delito de infracción a la ley forestal y se hace acreedor a una pena de prisión de un mes a un año.
