Appeal on points of law (recurso de casación) filed in the present proceedings against Jenny Isabel Sabine Blandón, single, identity card number 6-171-904, born on December 1, 1962 in Golfito, daughter of Juana Sabine Blandón, resident of Drake de osa, for the offenses of violation of the Ley de Zona Maritímo Terrestre and usurpation of public-domain property (Usurpación de Bienes de Dominio Público), to the detriment of La Zona Maritíma Terrestre. Participating at this stage are Justices Patricia Solano Castro, Jorge Enrique Desanti Henderson, Sandra Eugenia Zúñiga Morales, Rafael Segura Bonilla, and Gerardo Rubén Alfaro Vargas, the latter four serving as Alternate Justices. Also participating at this stage are Roberto Matamoros, Esq., in his capacity as private defense counsel (Defensor Particular) for the defendant, Ileana Bolaños Cubillo, Esq., as representative of the Procuraduría General de la República, and Johanna Villarevia Umaña, Esq., as representative of the Fiscalía de Osa.

Background:

1. By judgment N° 2018-0261, issued at eleven thirty-seven a.m. on May thirtieth, two thousand eighteen, the Tribunal de Apelación de Sentencia Penal de Cartago ruled: “Por tanto: The first claim in the appeal filed by Roberto Matamoros Ramírez, private defense counsel for the accused Jenny Sabine Blandón, is granted. Consequently, the accused is acquitted on the ground that the conduct was not unlawful, and the civil claim for damages (acción civil resarcitoria) filed against Sabine Blandón by the Procuraduría General de la República is denied. Because the State entity is deemed to have acted in good faith, it is exempted from the payment of costs. Notice shall be given.- IVETTE CARRANZA CAMBRONERO DECIDING JUDGE CHRISTIAN FERNANDEZ MORA DECIDING JUDGE GIOVANNI MENA ARTAVIA DECIDING JUDGE” (sic).

2. Ileana Bolaños Cubillo, Esq., representative of the Procuraduría General de la República, filed an appeal on points of law against the foregoing ruling.

3. After the corresponding deliberation, the Chamber considered the issues raised in the appeal.

4. The pertinent legal requirements have been observed in the appeal; and,

Considering:

I.By decision of this Chamber, N° 2018-0454, issued at eleven oh-five a.m. on December 7, 2018, the appeal on points of law filed by Criminal Prosecutor Ileana Bolaños Cubillo against judgment 2018-261 of the Tribunal de Apelación de Sentencia Penal de Cartago, issued at eleven thirty-seven a.m. on May 30, 2018, was declared admissible for a decision on the merits.

II.In the first ground admitted, the appellant alleges failure to apply Article 468(b) of the Código Procesal Penal, in relation to Articles 40 and 142 of the same body of law, due to failure to observe procedural rules and lack of reasoning (falta de fundamentación). She states that the court below (ad quem) acknowledged the existence of a structure erected before the precarious permit (permiso precario) was granted but, based on the local government’s authorization, concluded that the conduct was not unlawful and therefore rejected the civil claim for damages. In her view, that decision violated Article 142 of the Código Procesal Penal because its reasoning was insufficient, as it merely stated that the civil claim for damages was based on the commission of a criminal offense and therefore had to be denied. She cites decision 2004-00334 of the Sala Tercera de la Corte Suprema de Justica, which discussed the scope of the duty to provide reasons.

She specifies that the facts alleged in the civil complaint established that the construction took place between the beginning of 2003 and February 18, 2004, whereas the Municipality granted the precarious permit on February 2, 2017, that is, thirteen years after the defendant completed the construction. Accordingly, during that period she possessed that strip of land without any authorization and caused environmental damage as a consequence of the construction. She cites excerpts from the trial-court judgment and the challenged judgment, concluding that both found it proven that the defendant constructed illegally in the restricted area (zona restringida) of the maritime-terrestrial zone (zona marítimo terrestre) between 2003 and February 18, 2004. Notwithstanding the foregoing, when addressing the civil claim, the Tribunal de Apelación de Sentencia merely stated: “because the decision granting the civil claim for damages was also challenged in the second ground, and because that claim (sic) was based on the commission of the criminal offense, it is denied.” She maintains that the three lines of reasoning in the judgment devoted to the civil claim for damages fail to consider that civil and criminal actions are independent, and in support she cites decision 3603-93 of the Sala Constitucional, specifying that this principle of independence is governed by Article 40 of the Código Procesal Penal.

From this perspective, she considers that the civil liability of the accused should have been assessed even though a circumstance subsequently arose that led to her criminal acquittal, because civil liability could have survived. She states that her claim is supported by substantive legal provisions and by the protection established in Article 50 of the Constitución Política, Article 1045 of the Código Civil, and Articles 98 and 101 of the Ley Orgánica del Ambiente. She reiterates that a criminal acquittal does not entail an acquittal from civil liability, because the permit was granted after the event and eliminates only the criminal wrong, not the civil consequences. She alleges that the resulting error harmed the interests of the State because the civil claim was denied, thereby depriving it of monetary compensation or an award of damages to be quantified later (condena en abstracto). Because of the lack of reasoning, she requests that the judgment be vacated.

III.In the second ground admitted, she alleges failure to apply Article 468(b) of the Código Procesal Penal, in relation to Article 1045 of the Código Civil and Articles 98 and 101 of the Ley Orgánica del Ambiente. She states that, under the cited provisions, a civil judgment could be imposed regardless of the absence of criminal liability and that, if the civil claim were rejected, the court below was required to provide adequate reasons explaining why the civil claim for damages was rejected independently of criminal liability. She cites an excerpt from the challenged judgment and explains that the decision establishes the existence of environmental damage, as well as the defendant’s knowledge of her actions, since she was responsible for the construction in the maritime-terrestrial zone. She notes that civil liability differs from criminal liability and cites decision 2009-00851 of the Sala Tercera de la Corte Suprema de Justicia in support.

She explains that the environmental damage was in fact proven at trial and confirmed by the court below, which, referring to the trial court (a quo), acknowledged that the defendant prevented nature from taking its course and regenerating on its own, thereby causing environmental damage to biodiversity. She notes that civil liability is supported by other non-criminal legal provisions and cites decision 2012-001806 of the Sala Tercera in support. She specifies that filing a civil claim for damages in criminal proceedings entails choosing a forum for the purpose of having the claim decided there, irrespective of the ultimate disposition of the criminal action. She states that, notwithstanding the trial court’s award of damages to be quantified later, the acts committed by the defendant did harm the environment, since the mere occupation of an area that must remain free itself harms the environment, as recognized in decision 740-2015 of the Tribunal de Apelación de Sentencia Penal de Cartago.

She concludes that, by failing to assess the merits of the civil claim for damages, the court failed to apply Article 1045 of the Código Civil and Articles 98 and 101 of the Ley Orgánica del Ambiente. In her view, had those provisions been applied, a civil judgment would have been possible regardless of the existence of criminal liability. She states that the error by the court below resulted in the denial of the civil claim and rendered ineffective the possibility of obtaining monetary compensation or an award of damages to be quantified later. In a general section entitled “Harm,” she states that her client suffered harm and notes that the Tribunal de Apelación de Sentencia had a duty to administer justice under the effective judicial protection (tutela efectiva) of judges and courts. Under the heading “Relief Sought,” she requests that the appeal be admitted, granted, and a new judgment issued.

IV.Because of the close relationship between both grounds for challenge (motivos de impugnación), insofar as they concern the denial of the civil action, they will be resolved jointly. The claims are denied. To properly resolve the issue raised in the grounds for cassation (motivos de casación), we must begin with Article 40 of the Code of Criminal Procedure (Código Procesal Penal), which provides: “In criminal proceedings, the civil action for damages (acción civil resarcitoria) may be pursued only while the criminal prosecution remains pending.- If the accused is provisionally dismissed or the proceedings are stayed, in accordance with the provisions of the law, the pursuit of the civil action shall be stayed until the criminal prosecution resumes, without prejudice to the right to file the claim before the competent courts.- An acquittal shall not prevent the court from ruling on a validly pursued civil action for damages, where appropriate.” (Emphasis not in the original).

It follows from the foregoing that the ancillary nature of the civil action in the criminal jurisdiction is not limited solely to the possibility of litigating the damages and losses that may arise from the criminal conduct; rather, its scope encompasses a broader framework, provided that the civil action was validly pursued and that relief is appropriate. This Chamber has so held, stating: “…The phrase ‘where appropriate,’ contained in the third paragraph of Article 40 of the Code of Criminal Procedure, must necessarily be interpreted to mean that, despite a criminal acquittal, the court may rule on the civil action when other legal grounds distinct from the offense remain upon which that duty to compensate may be based. That is, when the established facts are sufficient to demonstrate the existence of civil liability, without requiring that the substantive rule giving rise to the obligation to compensate for the harm derive from Criminal Law, and without requiring proof of the criminal or administrative liability of a specific public official.

The foregoing interpretation is the only one that can be derived from the principles of Procedural Economy and Restrictive Interpretation, in harmony with our constitutional legal system, subject only to the requirement that the defendant be afforded an opportunity to present a defense…”. (Third Chamber of the Supreme Court of Justice. Judgment N° 2007-00102, at 09:00 hours, on February 23, 2007). Now, upon reviewing the factual allegations set forth in the civil action for damages, it is apparent that the alleged basis giving rise to civil liability rests on the harm caused by the accused in 2003 by constructing and occupying a building located in the restricted zone of the Maritime-Terrestrial Zone without having a permit to do so (see page 3 of the civil-action-for-damages file), facts that were described as constituting the offense of Violation of the Maritime-Terrestrial Zone Law, specifically Article 62 thereof, for which the trial court (tribunal a quo) entered a conviction that was subsequently reversed by the Criminal Judgment Appeals Court, which acquitted the accused of that violation.

In this regard, the appellate decision, which must be read as a logically and legally integrated whole, states: “As is readily apparent, the challenged judgment contains contradictory reasoning, because it simultaneously finds that the accused lacked a permit to build in the aforementioned maritime-terrestrial zone but that, at the same time, she holds a temporary tenure authorization (título precario) granted by the municipal authority. This is certainly not a minor issue, but rather an absolutely central matter that determines the case with respect to the culpability of the conduct and the legitimacy of the sentence imposed. The trial judge overlooked the fact that, although at the time the inspections were conducted by municipal officials, as documented in official communications AZM-0226-2014 and AZM -0220-2014, respectively, at pages 103 and 104, which report that the accused was overseeing the construction of a building first while it was in progress and later after it had been completed, the same municipal authority validated her actions in 2017, even after the complaint had been filed.

Therefore, because this concerns a single unlawful act—the encroachment upon public-domain property (bien demanial), which continues to this day—it must be understood that such legal authorization affects the entirety of the conduct undertaken, thereby eliminating the unlawfulness (antijuricidad) of the conduct. In this regard, it is appropriate to reiterate that, as the appellant notes, Law 9242, Law for the Regularization of Existing Structures in the Restricted Zone of the Maritime-Terrestrial Zone, of May 6, 2014, published in La Gaceta N. 109 of June 09, 2014, permits municipal authorizations in the form of land-use permits until the respective regulatory plan is prepared. To that effect, Article 4 of that law expressly provides: ‘…Municipalities having jurisdiction over the restricted zone of the maritime-terrestrial zone that do not have a current Coastal Regulatory Plan shall have four years to secure approval of the plan.

During that period, municipalities may allow existing structures to remain, provided that the competent administrative or judicial authority does not establish that environmental harm has been committed or that there is a danger or threat of harm to the environment. Likewise, those structures may be used under temporary tenure, provided that a fee for temporary land use is paid in an amount set by the municipality having jurisdiction. Payment for temporary land use shall not create any right. From the entry into force of the Coastal Regulatory Plan for the respective jurisdiction, structures allowed to remain within the restricted zone of the maritime-terrestrial zone must conform to that planning instrument…’ Accordingly, the Municipalidad de Osa, through the decision cited in the judgment, dated February 2, 2017, appearing at pages 361 and 362, signed by the Mayor of Osa, Alberto Cole de León, and issued in administrative proceedings against Sabine Blandón concerning the same structure now under investigation, provides: ‘…Por tanto.

Based (sic) on Article 4 of Law 9242, those structures may be used under temporary tenure, provided that a fee for temporary land use is paid in an amount set by the municipality having jurisdiction. Payment for temporary land use shall not create any right.” (cf. cited page 362). That same administrative decision states that the basis for the determination was the finding that the building had been constructed approximately twenty years before Law 9242 entered into force. Thus, there can be no doubt that, as the accused and her defense counsel have consistently maintained, she clearly does have authorization to remain in the maritime-terrestrial zone in the manner charged until the regulatory plan—which, as the judgment acknowledges, still does not exist—is prepared.” (pages 477-478 of the main case file). Based on the foregoing, given the existence of a justification defense (causal de justificación) under the particular facts deemed proven in this case, a civil judgment cannot be entered against her.

As a matter of principle, despite the entry of an acquittal, the damages and losses claimed in the civil action may be awarded in certain circumstances, as this Chamber has held, because: “... the basis for ordering compensation or restitution does not lie in proof of the existence of an unlawful act; rather, even where there is no conduct deserving of that characterization, a duty to provide redress may be imposed by applying the rules that directly require it (e.g., civil wrong, strict liability, etc.). In both situations, the subject matter of the dispute consists of non-contractual civil liability (responsabilidad civil extracontractual), and this is the boundary defining the jurisdiction and powers of the criminal judge when hearing the civil action”. (Third Chamber of the Supreme Court of Justice, judgment N° 1461-99, at 09:38 hours, on November 19, 1999, and judgment N° 201-F, at 10:00 hours, on June 3, 1994).

However, in the present case, because Article 25 of the Criminal Code (Código Penal) applies—the lawful exercise of a right (ejercicio legítimo de un derecho)—and the unlawfulness of the conduct is therefore excluded, there would be no so-called “criminal wrong” (injusto penal) as the minimum basis for awarding civil compensation. Although the reasoning of the appellate court (ad quem) regarding the denial of civil relief is not extensive, that error does not affect the final outcome of this matter because, under the circumstances of the case, civil liability could not be established, since it was shown here that the party subject to adjudication acted under the protection of a justification defense. As has been stated by this Court: “…For the duty to provide redress to survive despite the lawfulness of the act, it is essential to identify a specific legal source expressly providing for such a duty.

Now, in the case of a private individual’s non-contractual conduct, the governing rule in this regard is Article 1045 of the Civil Code (Código Civil), which provides: ‘…Anyone who, through willful misconduct, fault, negligence, or imprudence, causes harm to another is obligated to repair it together with the resulting losses…’ That provision is closely related to Article 632 of the same body of law: ‘…The sources giving rise to obligations are contracts, quasi-contracts, quasi-delicts, and the law…’ Thus, if there is no special provision in this case establishing that, despite the civil defendant’s conduct being consistent with the legal system—as would occur when acting under the protection of a justification defense—the governing rule under such circumstances is the one that exempts the person from that obligation. In this regard, a distinction must be drawn between strict civil liability (responsabilidad civil objetiva) and fault-based civil liability (responsabilidad civil subjetiva).

According to Loutayf and Costas, the latter: ‘…arises when the obligation to compensate for harm is based on the voluntary conduct of a person who acted with fault in the broad sense, encompassing both intent and negligence, whereas strict liability is based on circumstances other than culpable conduct and takes objective factors into account, such as whether the harm was caused by things used by that person, the risk created…and so forth…The requirements for fault-based liability are: a) an unlawful act, that is, one that violates the legal system…b) moral imputability of the act to its author, that is, that it be a voluntary act (sic)….c) fault or intent on the part of the author of the act…d) harm caused by the unlawful act…and e) the ability to establish a causal relationship between the unlawful act and the harm…’ (La Acción Civil en Sede Penal, Astrea, Buenos Aires, 2002, pp 756-757).

In this particular matter, we are clearly dealing with a case of fault-based liability, or liability for one’s own conduct, in which the Court correctly ruled out that Q. F. acted with the intent to harm O., relying instead on the reasons why her conduct was considered merely defensive and why, to that extent, she acted with justification. Elaborating upon the requirement of unlawfulness for fault-based civil liability to arise, the previously cited authors state: ‘…This is an element characterizing all unlawful acts, whether offenses or quasi-delicts…Once harm has occurred, it may be presumed to have resulted from unlawful conduct insofar as the duty to act prudently so as not to cause harm to third parties would have been breached.

However, the person responsible for that act may allege and prove a justification (causa de justificación) (e.g., necessity (estado de necesidad), self-defense (legítima defensa)…) or that the conduct constituted the lawful exercise of a right (ejercicio regular de un derecho propio) or compliance with a legal obligation (cumplimiento de una obligación legal), thereby excluding unlawfulness (ilicitud)…’ (Op. Cit., pp 757-758)…” (Sala Tercera de la Corte Suprema de Justicia, Nº 2007-01097, at 10:05 hours, 26 de setiembre de 2007). In this particular case, it was established that the accused acted under a justification; however, strictly from the standpoint of civil law, it was not possible to prove that harm had been caused intentionally or negligently (dolo o culpa), as provided in artículo 1045 del Código Civil, because this was a civil claim based on the agent’s subjective liability (responsabilidad subjetiva del agente).

Likewise, no other sources of strict civil liability (responsabilidad civil de tipo objetivo) were found to exist; in the case of persons governed by private law (sujetos de derecho privado), such liability is limited to civil liability for created risk (responsabilidad civil por riesgo creado) (artículo 1048 párrafo quinto del Código Civil) or consumer protection concerning products or services (protección al consumidor de productos o servicios) (numeral 35 de la Ley N° 7472). Accordingly, because none of the exceptional circumstances permitting the imposition of civil liability despite a criminal acquittal (absolutoria penal) is present, the rejection of the civil claim (demanda civil) must be affirmed.

Therefore:

The appeal on points of law filed by the Criminal Prosecutor is denied. Let notice be served.- Patricia Solano C.

Revisión del Documento *052008780454PE* Res: 2019-00870 SALA TERCERA DE LA CORTE SUPREMA DE JUSTICIA. San José, a las doce horas y diez minutos del diecinueve de julio del dos mil diecinueve.

Recurso de Casación interpuesto en la presente causa seguida contra Jenny Isabel Sabine Blandón, soltera, con cédula de identidad 6-171-904, nacida el 1 de diciembre de 1962 en Golfito, hija de Juana Sabine Blandón, vecina de Drake de osa, por el delito de infracción a la Ley de Zona Maritímo Terrestre y Usurpación de Bienes de Dominio Público, en perjuicio de La Zona Maritíma Terrestre. Intervienen en esta instancia las Magistradas y Magistrados Patricia Solano Castro, Jorge Enrique Desanti Henderson, Sandra Eugenia Zúñiga Morales, Rafael Segura Bonilla y Gerardo Rubén Alfaro Vargas, estos últimos cuatro como Magistrados Suplentes. También intervienen en esta instancia el Licenciado Roberto Matamoros en su condición de Defensor Particular del imputado, la Licenciada Ileana Bolaños Cubillo como representante de la Procuraduría General de la República y la Licenciada Johanna Villarevia Umaña como representante de la Fiscalía de Osa.

Resultando:

1. Mediante sentencia N° 2018-0261, dictada a las once horas treinta y siete minutos del treinta de mayo del dos mil dieciocho, el Tribunal de Apelación de Sentencia Penal de Cartago, resolvió: “Por tanto: Se declara con lugar el reclamo primero de la impugnación incoada por Roberto Matamoros Ramírez, defensor particular de la endilgada Jenny Sabine Blandón. En consecuencia, se ordena la absolutoria de la acusada por antijuridicidad de la conducta y se declara sin lugar la acción civil resarcitoria interpuesta contra Sabine Blandón, por parte de la Procuraduría General de la República. Por considerarse que el ente estatal actúo bajo el principio de buena fe, se exime del pago de costas. Notifíquese.- IVETTE CARRANZA CAMBRONERO JUEZ/A DECISOR/A CHRISTIAN FERNANDEZ MORA JUEZ/A DECISOR/A GIOVANNI MENA ARTAVIA JUEZ/A DECISOR/A" (sic).

2. Contra el anterior pronunciamiento, la Licenciada Ileana Bolaños Cubillo, representante de la Procuraduría General de la República, interpuso recurso de casación.

3. Verificada la deliberación respectiva, la Sala se planteó las cuestiones formuladas en el recurso.

4. En el recurso se han observado las prescripciones legales pertinentes; y,

Considerando:

I.Mediante resolución de esta Sala, N° 2018-0454, de las once horas y cinco minutos, del 7 de diciembre de 2018, se declaró admisible para su conocimiento de fondo, el recurso de casación, incoado por la Procuradora Penal Ileana Bolaños Cubillo, en contra de la sentencia 2018-261 del Tribunal de Apelación de Sentencia Penal de Cartago, de las once horas con treinta y siete minutos, del 30 de mayo de 2018.

II.En el primer motivo admitido, se reprocha inobservancia del artículo 468 inciso b) del Código Procesal Penal, en relación con los artículos 40 y 142 del mismo cuerpo normativo, por inobservancia de normas procesales y falta de fundamentación. Refiere que el ad quem reconoció la existencia de una construcción edificada previo al otorgamiento del permiso precario, pero con base en la autorización del gobierno local, concluyó que no existió antijuridicidad de la conducta y por ello, rechazó la acción civil resarcitoria. A su criterio, dicha resolución violentó el artículo 142 del Código Procesal Penal por insuficiente fundamentación, al limitarse a indicar que la base de la acción civil resarcitoria era la comisión de un ilícito penal y por ello, se debía declarar sin lugar. Cita el voto 2004-00334 de la Sala Tercera de la Corte Suprema de Justica, donde se desarrollaron los alcances del deber de fundamentación.

Precisa que en los hechos de la demanda civil, se estableció que la construcción se efectúo entre inicios del 2003 y el 18 de febrero de 2004, mientras que el permiso precario de la Municipalidad se otorgó el 2 de febrero de 2017, es decir, trece años después de que la imputada realizara la construcción, por lo que durante dicho período detentó esa franja sin autorización alguna y causó daño ambiental como consecuencia de la edificación. Cita un extracto de la sentencia de primera instancia y de la sentencia impugnada, concluyendo que en ambas se tuvo por acreditado que la imputada construyó ilegalmente en la zona restringida de la zona marítimo terrestre entre los años 2003 y el 18 de febrero de 2004. A pesar de lo anterior, el Tribunal de Apelación de Sentencia al referirse a la acción civil, se limitó a señalar que: “al haberse cuestionado también, en el motivo segundo, la declaratoria con lugar de la acción civil resarcitoria y teniendo esta (sic) como base la comisión del ilícito penal, se declara sin lugar la misma”.

Valora que las tres líneas de la fundamentación de la sentencia dedicadas a la acción civil resarcitoria, omiten considerar que la acción civil y penal son independientes y cita como respaldo el voto 3603-93 de la Sala Constitucional, precisando que dicho principio de independencia, está regulado en el numeral 40 del Código Procesal Penal. Desde esta óptica, considera que se debió valorar la responsabilidad civil de la encartada, aún cuando con posterioridad sobrevino una circunstancia que llevó a su absolutoria penal, porque pudo subsistir la responsabilidad civil. Refiere que su pretensión se encuentra amparada en normas propias del derecho y su protección establecida en el artículo 50 de la Constitución Política, los ordinales 1045 del Código Civil, así como los numerales 98 y 101 de la Ley Orgánica del Ambiente. Reitera que la absolutoria penal no implica una absolutoria civil, ya que el permiso se otorga después del hecho y solo elimina el injusto penal, no así las consecuencias civiles.

Reclama que el error ocasionado, generó un agravio para los intereses del Estado, ya que la pretensión civil fue declarada sin lugar y se privó de este modo del resarcimiento pecuniario o la condena en abstracto. Ante la falta de fundamentación, solicita que se case la sentencia.

III.En el segundo motivo admitido, reclama inobservancia del artículo 468 inciso b) del Código Procesal Penal, en relación con el artículo 1045 del Código Civil, así como los ordinales 98 y 101 de la Ley Orgánica del Ambiente. Señala que con base en la normativa citada, era viable imponer una condena civil sin importar la ausencia de responsabilidad penal y en caso de rechazarse la pretensión civil, el ad quem debió fundamentar adecuadamente las razones por las que con independencia de la responsabilidad penal, se rechazó la acción civil resarcitoria. Cita un extracto de la sentencia impugnada y explica que en dicha resolución, se acredita la existencia de un daño al medio ambiente, así como el conocimiento de la actuación de la imputada, quien estuvo a cargo de la edificación en la zona marítimo terrestre. Advierte que la responsabilidad civil es distinta de la penal y cita como respaldo el voto 2009-00851 de la Sala Tercera de la Corte Suprema de Justicia.

Expone que el daño ambiental fue efectivamente probado en la etapa de juicio y ratificado por el ad quem, quien haciendo referencia al a quo reconoció que la imputada evitó que la naturaleza tomara su curso, se regenerara por sí misma y creó un daño ambiental a la biodiversidad. Advierte que la responsabilidad civil se encuentra amparada en otras normas de carácter no penal y cita como respaldo el voto 2012-001806 de la Sala Tercera. Precisa que la interposición de la acción civil resarcitoria en sede penal, implica la escogencia de una vía con la finalidad de ver resuelta su petición en dicha sede, sin tomar en consideración el destino final de la acción penal. Refiere que a pesar de la condena civil en abstracto en primera instancia, los actos realizados por la imputada sí lesionaron el medio ambiente, ya que el solo hecho de ocupar una zona que debe estar libre, lesiona por sí mismo el medio ambiente, según fue reconocido en el voto 740-2015 del Tribunal de Apelación de Sentencia Penal de Cartago.

Concluye que al no valorar la pertinencia de la acción civil resarcitoria, se inobservaron los numerales 1045 del Código Civil, así como los artículos 98 y 101 de la Ley Orgánica del Ambiente. A su criterio, de haberse aplicado la normativa, la condena civil era viable sin importar la existencia de responsabilidad penal. Señala que el yerro del ad quem, ocasionó la denegatoria de la pretensión civil y tornó nugatoria la posibilidad de obtener el resarcimiento pecuniario o la condena en abstracto. En un apartado general titulado agravio, indica que se produjo un daño a su representado y advierte que el Tribunal de Apelación de Sentencia tenía el deber de administrar justicia bajo la tutela efectiva de los jueces y tribunales. Bajo el título de pretensión, solicita acoger el recurso, declararlo con lugar y dictar un nuevo fallo.

IV.Por la estrecha relación entre ambos motivos de impugnación, al referirse a la denegatoria de la acción civil, los mismos serán resueltos de forma conjunta. Los reclamos se declaran sin lugar. Para una adecuada solución del tema propuesto en los motivos de casación, debemos partir del artículo 40 del Código Procesal Penal, el cual establece que: “En el procedimiento penal, la acción civil resarcitoria sólo podrá ser ejercida mientras esté pendiente la persecución penal.- Sobreseído provisionalmente el imputado o suspendido el procedimiento, conforme a las previsiones de la ley, el ejercicio de la acción civil se suspenderá hasta que la persecución penal continúe y quedará a salvo el derecho de interponer la demanda ante los tribunales competentes.- La sentencia absolutoria no impedirá al tribunal pronunciarse sobre la acción civil resarcitoria válidamente ejercida, cuando proceda.” (El resaltado no es del original).

De lo anterior, se desprende que el carácter accesorio de la acción civil en la jurisdicción penal, no se limita únicamente a la posibilidad de litigar sobre los daños y perjuicios que puedan derivarse de la acción delictiva, sino que sus alcances abarcan un marco más amplio, siempre y cuando, la acción civil haya sido válidamente ejercida y en aquellos casos que proceda. Así lo ha entendido esta Cámara, al señalar que: “…La frase ‘cuando proceda’, contenida en el párrafo tercero del artículo 40 del Código Procesal Penal debe necesariamente interpretarse en el sentido de que, a pesar de la absolutoria penal, el tribunal puede pronunciarse sobre la acción civil cuando subsistan otros supuestos normativos distintos al delito en los cuales pueda sustentarse ese deber de indemnizar. Es decir, cuando los hechos acreditados sean suficientes para demostrar la existencia de responsabilidad civil, sin necesidad de que la norma sustantiva que genera la obligación de indemnizar el daño proceda del Derecho Penal, y sin necesidad de que se demuestre la responsabilidad penal o administrativa de un funcionario público determinado.

La anterior interpretación es la única posible a derivar de los principios de Economía Procesal e Interpretación Restrictiva, en consonancia con nuestro ordenamiento constitucional, con el único requisito de que debe concederse al demandado oportunidad de defensa…”. (Sala Tercera de la Corte Suprema de Justicia. Voto N° 2007-00102, de las 09:00 horas, del 23 de febrero de 2007). Ahora bien, revisado el cuadro fáctico planteado en la acción civil resarcitoria, se observa que el dispositivo generador de responsabilidad civil alegado, se sustenta en el daño causado por la acusada en el año 2003, al construir y ocupar una edificación que se ubica en la zona restringida de la Zona Marítimo Terrestre, careciendo de permiso para ello (ver folio 3 del legajo de acción civil resarcitoria), hechos que fueron descritos como configurativos del delito de Infracción a la Ley de la Zona Marítimo Terrestre, propiamente en su artículo 62, sobre los cuales, el tribunal a quo, dictó una sentencia condenatoria, misma que fue revocada por el Tribunal de Apelación de Sentencia Penal, absolviéndose a la imputada por dicha infracción.

Al respecto, señala el fallo de alzada, mismo que debe verse como una unidad lógico jurídica, que: “Como salta a la vista, la sentencia impugnada contiene un razonamiento contradictorio, puesto que entiende simultáneamente que la imputada carecía de permiso para construir en la repetida zona marítimo terrestre, pero que, al mismo tiempo, cuenta con un título precario otorgado por el ente municipal. Ciertamente, no se trata de un tema menor, sino, más bien, de un extremo absolutamente medular que define el asunto en cuanto a la culpabilidad de la conducta y la legitimidad de la pena impuesta. La juzgadora de instancia obvió que, si bien para el momento en que se realizaron las inspecciones por parte de los funcionarios municipales, documentadas en los oficios AZM-0226-2014 y AZM -0220-2014, respectivamente, de folios 103 y 104, que dan cuenta de que la encartada se encontraba al mando de la construcción de una edificación en progreso, primero, y terminada, después, el mismo ente municipal validó su actuación en el año 2017, incluso con posterioridad a la interposición de la denuncia.

De ahí que, al tratarse de un único ilícito, la invasión de un bien demanial que se verifica al día de hoy, debe entenderse que tal autorización legal incide sobre la totalidad de la acción desplegada, lo que elimina la antijuricidad de la conducta. Al respecto, conviene retomar que, como lo apunta el recurrente, la ley 9242, Ley para la regularización de las construcciones existentes en la zona restringida de la zona marítimo terrestre, de 6 de mayo de 2014, publicada en La Gaceta N. 109 de 09 de junio de 2014, permite las autorizaciones municipales, bajo la figura de permiso de uso de suelo, hasta la elaboración del respectivo plan regulador. Al efecto, el artículo 4 de esa norma dispone expresamente: ‘…Las municipalidades con jurisdicción en la zona restringida de la zona marítimo terrestre que no cuenten con un Plan Regulador Costero vigente dispondrán de cuatro años para concretar la aprobación del plan.

Durante dicho plazo, las municipalidades podrán conservar las construcciones existentes, en tanto la autoridad administrativa o judicial competente no acredite la comisión de daño ambiental o peligro o amenaza de daño al medio ambiente. Asimismo, dichas construcciones podrán ser utilizadas a título precario siempre que medie el pago de un canon por uso de suelo a título precario, fijado por la municipalidad de la respectiva jurisdicción. El pago por uso del suelo en precario no generará derecho alguno. A partir de la entrada en vigencia del Plan Regulador Costero de la respectiva jurisdicción, las construcciones que se conserven dentro de la zona restringida de la zona marítimo terrestre deberán ajustarse a dicha planificación…’ Es así como, la Municipalidad de Osa, mediante la resolución que se cita en el fallo, de fecha 2 de febrero de 2017, visible a folios 361 y 362, suscrita por el Alcalde de Osa, Alberto Cole de León, dictada dentro de procedimiento administrativo contra Sabine Blandón, por la misma construcción que ahora se investiga, dispone: ‘…Por tanto.

En base (sic) al artículo 4 de la Ley 9242 que dichas construcciones podrán ser utilizadas a título precario, siempre que medie el pago de un canon por uso de suelo a título precario, fijado por la municipalidad de la respectiva jurisdicción. El pago por uso de suelo en precario no generará derecho alguno.” (cfr. folio 362 citado). En esa misma resolución administrativa, consta que el fundamento de la decisión adoptada deviene de haberse verificado que la edificación se hizo aproximadamente veinte años antes de la entrada en vigencia de la ley 9242. De modo que no cabe duda de que, como lo ha venido sosteniendo la imputada y su defensa técnica, es claro que ella si cuenta con autorización para permanecer de la forma en que se acusa en la zona marítimo terrestre, hasta tanto sea elaborado el plan regulador que, a la fecha, aún no existe, según lo admite el fallo.” (folios 477-478 del expediente principal).

Con base en lo anterior, ante la concurrencia de una causal de justificación con las particularidades fácticas tenidas por ciertas en este caso, no es posible acceder a la condena en el aspecto civil. Como tesis de principio, pese al dictado de una sentencia absolutoria, es posible en algunos supuestos reconocer los daños y perjuicios reclamados en la acción civil, tal y como lo ha resuelto esta Sala, ya que: “... el fundamento para que en efecto se ordene, la indemnización o restitución, no estriba en que se compruebe la existencia del ilícito, sino que, aún en que caso de que no exista conducta merecedora de tal calificativo, puede imponerse el deber de resarcir, aplicando las normas que de modo directo lo ordenen (v.gr. ilícito civil, responsabilidad objetiva, etc.) En ambos supuestos el objeto de la litis está constituido por la responsabilidad civil extracontractual y es éste el límite que define la competencia y atribuciones del juzgador penal, en su conocimiento de la acción civil”.

(Sala Tercera de la Corte Suprema de Justicia voto N° 1461-99, de las 09:38 horas, del 19 de noviembre de 1999, y voto N° 201-F, de las 10:00 horas, del 3 de junio de 1994). Sin embargo, como en el presente caso, al aplicar el artículo 25 del Código Penal (ejercicio legítimo de un derecho), y excluirse la antijuricidad de la acción, no existiría el llamado “injusto penal”, como minimum para reconocer el resarcimiento civil. Si bien es cierto, la fundamentación del ad quem, no es amplia en torno a la denegatoria del reparación civil, lo cierto es que tal yerro no incide en el resultado final de este asunto, pues dadas las circunstancias del caso, no sería posible acreditar responsabilidad civil, ya que en la especie se demostró que la justiciable actuó amparada a una causa de justificación. Véase que, tal y como se ha dicho en esta sede: “…Para que subsista el deber de resarcir pese a la juridicidad del hecho, es imprescindible verificar una fuente normativa específica que así lo disponga expresamente.

Ahora bien, tratándose del comportamiento extracontractual de un particular, la máxima aplicable en este sentido, es el artículo 1045 del Código Civil, que dispone: ‘…Todo aquel que por dolo, falta, negligencia o imprudencia, causa a otro un daño, está obligado a repararlo junto con los perjuicios…’ Dicha norma se relaciona estrechamente con el numeral 632 del mismo cuerpo normativo: ‘…Las causas productoras de obligación son: los contratos, los cuasicontratos, los cuasidelitos y la ley…’ De esta manera, si en la especie no existe una disposición especial que disponga que, pese a la conformidad del comportamiento del accionado civilmente con el ordenamiento jurídico (como lo sería obrar al abrigo de una causa de justificación), la máxima aplicable en tales condiciones, es la que exime de dicha obligación. En este sentido, debe diferenciarse entre responsabilidad civil objetiva y subjetiva.

Según Loutayf y Costas, la última: ‘…tiene lugar cuando la obligación de resarcir los daños se funda en el actuar voluntario del sujeto que ha obrado por culpa en un sentido amplio (comprensiva de dolo y culpa), y la responsabilidad objetiva, que se funda en circunstancias distintas del actuar culposo y que tienen en cuenta factores objetivos, como que el daño haya sido causado por cosas de las que se sirve, el riesgo creado…etcétera…Son requisitos para que exista responsabilidad subjetiva: a) que sea un acto antijurídico, es decir, que transgrede el ordenamiento jurídico…b) que haya imputabilidad moral del acto a su autor, es decir, que se trata de un acto voluntrio (sic)….c) que haya culpa o dolo en el autor del acto…d) que haya un daño causado con el acto antijurídico…y e) que se pueda establecer una relación de causalidad entre el acto antijurídico y el daño…’ (La Acción Civil en Sede Penal, Astrea, Buenos Aires, 2002, pp 756-757).

En el particular, nos encontramos evidentemente ante un caso de responsabilidad subjetiva o responsabilidad por el propio actuar en el cual, de manera acertada, el Tribunal excluye que Q. F. haya actuado con dolo de lesionar a O., sustentándose más bien los motivos por los cuales se estima que su conducta fue meramente defensiva y, en este tanto, actuó justificadamente. Ahondando en el requisito de la antijuridicidad para que concurra la responsabilidad civil subjetiva, mencionan los autores ya citados, que: ‘…Se trata de un elemento que caracteriza a todos los actos ilícitos, ya sean delitos o cuasidelitos…Producido un daño cabe presumir que ha derivado de una conducta antijurídica en cuanto se habría violado la obligación de obrar con prudencia para no causar daños a terceros. Sin embargo, el autor de aquél tiene la posibilidad de alegar y acreditar una causa de justificación (p.ej., estado de necesidad, legítima defensa…) o que su conducta ha sido el ejercicio regular de un derecho propio o el cumplimiento de una obligación legal que excluye la ilicitud…’ (Op.

Cit., pp 757-758)…” (Sala Tercera de la Corte Suprema de Justicia, Nº 2007-01097, de las 10:05 horas, del 26 de setiembre de 2007). En el caso concreto, se logró demostrar que la acusada actuó amparada en una causa de justificación, sin embargo, desde el punto de vista estrictamente de derecho civil, no se pudo probar la causación de un daño por dolo o culpa, en los términos previstos en el artículo 1045 del Código Civil, al tratarse de un reclamo civil por responsabilidad subjetiva del agente. Asimismo, no se determinó que existiera otras fuentes de responsabilidad civil de tipo objetivo, la cuales, tratándose de sujetos de derecho privado, se circunscriben a la responsabilidad civil por riesgo creado (artículo 1048 párrafo quinto del Código Civil) o de protección al consumidor de productos o servicios (numeral 35 de la Ley N° 7472). Así las cosas, al no encontrarnos ante alguno de los supuestos excepcionales para proceder a la condena civil, pese a la absolutoria penal, lo procedente es confirmar el rechazo de la demanda civil.

Por Tanto:

Se declara sin lugar, el recurso de casación interpuesto por la Procuradora Penal. Notifíquese.- Patricia Solano C.
