Having reviewed the present appeal in cassation (recurso de casación), in the proceedings brought against Heliodoro Pérez Brenes for the offense of Violation of the Ley Forestal (Infracción a la Ley Forestal), to the detriment of Los Recursos Naturales; and,
Whereas:
I.Licenciado Carlos Lizano Rodríguez, in his capacity as representative of the State acting as Private Prosecutor and Civil Claimant (Querellante y Actor Civil), and Licenciado Luis Alonso Bonilla Guzmán, in his capacity as Prosecutor with the Fiscalía Adjunta de Impugnaciones del Ministerio Público, separately filed appeals in cassation against judgment Nº 2018-00432, issued at ocho horas diez minutos on treinta de mayo del dos mil dieciocho by the Tribunal de Apelación de Sentencia del Tercer Circuito Judicial de Alajuela, Sección Tercera, which upheld the first ground of appeal submitted by the Defensa Pública and acquitted the accused, Heliodoro Pérez Brenes, of the offense established in artículo 58 inciso b) of the Ley Forestal. It likewise rendered ineffective the forfeiture order (orden de comiso) issued with respect to the chainsaw and ordered its return to whoever proves to be its owner. It also upheld the second ground of appeal filed by the public defender, vacated the judgment insofar as it concerned the civil claims, and remanded the case for new proceedings on that issue.
II.Appeal in cassation by the Private Prosecutor and Civil Claimant. As his first ground, he alleges failure to apply or erroneous application of the provisions of numerales 3 inciso a) and 58 inciso b), both of the Ley Forestal. He states that, on behalf of the State, he filed a private criminal complaint (querella) against Heliodoro Pérez Brenes because he was caught in flagrante delicto while felling and processing with a chainsaw a Manú tree located within a protection area (zona de protección). On account of this act, he was accused of violating artículo 58 inciso b) of the Ley Forestal, in conjunction with numeral 3 inciso a) of the same legislation. He considers that the issue of timber harvesting (aprovechamiento forestal maderable) is not the disputed point, because the complaint he filed uses the verb “to process,” which constitutes a form of timber harvesting, and it was for the Court to determine, in light of the evidence received, whether the accused’s conversion of the tree into logs was capable of providing him, or could provide him, with any advantage, benefit, gain, use, or profit, in accordance with the definition contained in the law.
He states that, according to the third meaning of the word “procesar” contained in the Diccionario de la Real Academia de la Lengua Española, processing trees to convert them into logs is a form of timber harvesting. Accordingly, establishment of the offense of Forest Harvesting of Forest Resources in Protection Areas (Aprovechamiento Forestal de Recursos Forestales en Áreas de Protección) does not “per se” require the express allegation in the charging instrument, and the resulting proof at trial, of the intent to obtain or the actual receipt of any type of benefit expressed in economic terms. This is because, under the definition of harvesting (aprovechamiento) contained in numeral 3 inciso a) of the Ley Forestal, “…it may consist of a broad range of concepts, such as generating an advantage, benefit, gain, use, or profit, whether present or future; it is therefore sufficient that it be duly proven in the adversarial proceedings, as occurred in the present case, that the processing charged was (sic) capable of providing him with some advantage, benefit, gain, use, or profit.” (f. 23, electronic case file).
He argues that, in the specific case, the term “to process” referred to the accused’s activity of producing logs to enable timber harvesting, since it was proven that the accused is a well-known timber operator in the area and that the activity he was carrying out involved significant economic expense, as it required assistance from other persons and the use of a chainsaw and a wheeled tractor. For that reason, he believes that it was for the trial judge to determine, based on the evidence received in the adversarial proceedings (contradictorio), whether the processing of the Manú tree constituted timber harvesting, as concluded, for example, by the Tribunal de Juicio de Ciudad Quesada in judgment Nº 644-2017, issued at 16:45 horas, on 31 de agosto del 2017, which found that the processing performed by the defendant was timber harvesting through which he intended to generate, or could generate, some advantage, benefit, gain, use, or profit.
The petitioner criticizes the position adopted in the challenged decision, which stated that, to establish the offense of illegal harvesting of forest resources in protection areas (aprovechamiento ilegal de recursos forestales en áreas de protección), it is not sufficient to prove what the act of processing the forest resource entailed and the environmental damage it caused; rather, the specific advantage, benefit, profit, or use that the activity generated or could have generated for the accused must also be described and proven. In doing so, the appellate court (Tribunal de alzada) overlooked that processing a tree to convert it into logs is itself an activity characteristic of the timber harvesting referred to in the Ley Forestal, without any need to link it to the sale of those logs or to prove a financial profit, irrespective of whether an economic value had been assigned to them. Under that theory, the petitioner argues, it is illogical to process a Manú tree into logs and believe that they are not intended for harvesting.
Consequently, the provisions of numerales 3 inciso a) and 58 inciso b) of the Ley Forestal were not observed and were erroneously applied, and he therefore requests that the ruling be vacated and the decision of the Tribunal de Juicio be upheld. The claim is admitted. The ground raised by the Private Prosecutor and Civil Claimant on behalf of the State satisfies the formal admissibility requirements. It is confirmed that it was filed within the statutory period by a duly authorized party, in a properly authorized written submission identifying the legal provisions that he considers not to have been observed and setting out the grounds supporting his argument. The petitioner challenges the decision of the Tribunal de Apelación de Sentencia Penal del Tercer Circuito Judicial de Alajuela on the basis that it erroneously interpreted, as applied to the specific case, the provisions of artículos 3 inciso a) and 58 inciso b), both of the Ley Forestal, by stating that the complaint failed to describe what constituted the illegal harvesting of forest resources in protection areas attributed to the accused.
In the opinion of the appellate panel (Cámara ad quem), this is an element required to establish the offense referred to in numeral 58 inciso b) of the Ley Forestal; that is, it is not sufficient to describe the acts of cutting and processing the forest resource and the environmental damage caused, but it is also necessary to establish and prove specifically the advantage, benefit, profit, or use that the activity generated or could have generated for the accused. The petitioner disputes this position, maintaining that establishment of the unlawful act (ilícito) examined in the adversarial proceedings does not require the express allegation in the charging instrument or any proof at trial of an intent to obtain, or the actual receipt of, any type of benefit expressed in economic terms. This is because the definition set forth in numeral 3 inciso a) concerning the concept of “harvesting” refers to a broad range of concepts, and it is sufficient that the processing charged be capable of providing the accused with some advantage, benefit, gain, use, or profit.
He identifies the legal provisions infringed, explains the harm caused by the challenged decision, and states the relief sought. Accordingly, it is ordered that this claim be processed pursuant to artículos 467, 468, 469 and 471 of the Código Procesal Penal and that its merits be examined, including a more thorough analysis of whether the asserted ground exists, whether it is essential and affects the operative provisions of the decision, and whether the relief sought by the party is warranted.
III.As a second objection, he alleges the existence of conflicting precedents issued by the Judgment Appeals Courts. He notes that decision Nº 21-16, issued at 15:00 hours on February 4, 2016, by the Criminal Judgment Appeals Court of the II Judicial Circuit of Guanacaste, addresses the matter of forest utilization (aprovechamiento forestal), establishing the scope of the definition contained in section 3(a) of the Ley Forestal. After quoting an excerpt from that decision, he states that it confirms the position that the offense of Unlawful Utilization of Forest Resources in Protected Areas does not require, for its commission, proof of the existence of any specific purpose or profit motive, understood as the intent to obtain, or the actual obtaining of, some type of benefit that can be expressed in economic terms; rather, it is sufficient that the adversarial proceedings duly establish the existence of actions by the perpetrator aimed at obtaining some advantage, benefit, gain, use, or profit, given that many other advantages may result from such utilization.
He considers that the alleged conduct must be assessed by the Court in accordance with the rules of sound judicial reasoning (sana crítica), in order to determine whether the accused was or was not engaging in timber utilization as defined in the Ley Forestal. Accordingly, he requests that this objection based on conflicting precedents be granted, because the judgment of the San Ramón Appeals Court “violates the substantive legislation currently in force.” (f. 27, virtual case file). As prejudice, he states that the defect identified in judgment 2018-00432 of the appellate court affects the interests of the State, as complainant and civil plaintiff in the proceedings against defendant Pérez Brenes. He requests that the trial and appellate decisions, as well as the aforementioned decision 21-16, be admitted as evidence. The argument is inadmissible because it is entirely unfounded. Upon analyzing the objection raised by the representative of the State, it must be noted that it does not satisfy the statutory requirements for admission.
In the case before us, the appellant invokes the ground of conflicting precedents, citing decision Nº 21-16 of the Judgment Appeals Court of the II Judicial Circuit of Guanacaste. However, at no point does he undertake the required comparison of that decision with the ruling issued by the Criminal Judgment Appeals Court of the III Judicial Circuit of Alajuela in order to establish the likeness, identity, or similarity of the essential aspects of the factual circumstances addressed in each case. This Cassation Chamber cannot conduct the relevant analysis of the asserted ground because the dissatisfied party merely sets out what the Guanacaste Appeals Court decision says regarding Forest Utilization, but at no point formally compares it with the appellate ruling being challenged so as to identify the central issue that, in his view, is contradictory. Given that deficiency, it is impossible to determine the identity of the factual circumstances and the elements that conflict.
That analysis is the minimum required of parties who file a cassation appeal (recurso de casación) pursuant to section 468(a) of the Code of Criminal Procedure, since a precedent is understood solely as an interpretation and application of law directly related to the subject matter of the decision, on the understanding that the complaining party is required to show the contents of both the precedent and the challenged decision that the party considers contradictory. A mere reading of the arguments supporting the second objection reveals that the representative of the State focused solely on explaining what the precedent states, without comparing it with the appellate decision. It is insufficient merely to state that the judgment of the San Ramón Judgment Appeals Court “violates the substantive legislation currently in force,” as though that assertion “per se” established the statutory admissibility of the asserted ground; instead, he was required to identify specifically the issue on which the decisions conflict.
To expect this Chamber to infer, identify, and determine the subject matter of the appellate ruling that supposedly conflicts with the cited precedent would disregard the formal requirements governing the filing of a claim based on conflicting precedents; the appellant cannot overlook the fact that each ground for cassation must be supported separately by its corresponding reasoning. Furthermore, the appellant improperly overlaps the arguments presented under the first ground of appeal, concerning failure to apply or erroneous application of substantive law, thereby combining separate grounds. Accordingly, the second ground is declared inadmissible.
IV.Cassation appeal by the representative of the Public Prosecutor’s Office. As the first ground for his challenge, attorney Luis Alonso Bonilla Guzmán alleges failure to apply a procedural legal provision, due to violation of the “right to two levels of adjudication,” pursuant to sections 439, 465, and 468(b) of the Code of Criminal Procedure, section 41 of the Political Constitution, and section 8(2)(h) of the American Convention on Human Rights. He complains that the appellate court granted the appeal filed by the defense; however, instead of remanding the case for new proceedings, it ordered an acquittal directly. He considers that, even in light of the appellate judges’ argument that neither the charging document nor the complaint describes what advantage the accused obtained or could have obtained through his prohibited conduct, the case should have been remanded for new proceedings, since the possibility that the prosecution’s claims might succeed in a retrial cannot be ruled out.
He maintains that the appellate judges exceeded their jurisdiction under section 465 of the Code of Criminal Procedure, because they should not have ruled on the merits of this case. He considers that their action prevents the Public Prosecutor’s Office from challenging the acquittal that they improperly entered directly when deciding the defense appeal, because they disregarded the effective protection of fundamental rights and guarantees by denying the prosecuting authority the right to two levels of adjudication. As prejudice, he states that the acquittal entered at the appellate level prevented the prosecution from appealing it, also impairing the State’s punitive claims, rendering the protection of Natural Resources ineffective, and resulting in impunity. He requests that the challenged decision be vacated and that the case consequently be remanded to the Criminal Judgment Appeals Court of the III Judicial Circuit of Alajuela for a differently constituted panel to rule in accordance with law.
The argument is inadmissible because it is entirely unfounded. Article 471 of the Code of Criminal Procedure provides that the Criminal Cassation Chamber shall declare the cassation appeal inadmissible “…when the statutory filing requirements are not met, as established in the preceding Article 469; also, when the decision is not appealable, the party has no right to appeal, the appeal seeks to modify the proven facts, or the appeal is entirely unfounded, in which case it shall so declare and return the proceedings to the court of origin.” (underlining not in the original). In the present matter, the claimant states that the Third Section of the Criminal Judgment Appeals Court of the Third Judicial Circuit of Alajuela acquitted the accused of all punishment and liability for the offense of utilization of forest resources with which he was charged, as provided in Article 58(b) of the Ley Forestal, thereby preventing the claimant from relitigating the proof of the acts attributed to the accused Heliodoro Pérez Brenes and violating his right to the principle of two levels of adjudication because, in his view, he is denied the possibility of challenging the acquittal entered.
He states that the appellate judges exceeded the jurisdiction conferred upon them by section 465 of the procedural Code, disregarding the protection of the parties’ procedural and fundamental rights. However, the claim is inadmissible because this Chamber has already held in several prior rulings that there is no absolute impediment to an Appeals Court entering an acquittal on appeal, a possibility arising from the third paragraph of section 465 of the Code of Criminal Procedure, specifically where it provides that, upon granting an appeal, the court ad quem may vacate the challenged judgment in whole or in part and order a retrial, or may correct the defect “…and decide the matter in accordance with the applicable law…” On this issue, it has stated: “…an error may be corrected directly on appeal when, for example, the change made by the Judgment Appeals Court neither modifies facts nor reassesses the evidence, but merely applies substantive law (among other circumstances that must be assessed case by case).
Failure to apply or erroneous application of substantive rules has always been reviewable in cassation and is not restricted by the prohibition against examining the evidence and determining the facts that applies at this level. This is so because that ground presupposes acceptance of the established factual findings.” (Resolution Nº 2017-00967, nine hours and forty-two minutes on October 20, 2017, with Judges Doris Arias Madrigal, María Elena Gómez Cortés, Sandra Zúñiga Morales, Rosibel López Madrigal, and Judge Jorge Enrique Desanti Henderson sitting). The appellant maintains that the court ad quem should have remanded the case for new proceedings rather than directly acquitting the defendant, that the appellate judges exceeded their jurisdiction, and that, in his view, the guarantee of comprehensive review of the challenged judgment was violated. In this particular case, the claim is manifestly unfounded because, in the same appeal, the claimant specifically asserts a ground based on erroneous application of substantive law, thereby depriving of meaning the prejudice alleged here regarding the inability to seek appellate review of the issue and the resulting impairment of the Public Prosecutor’s Office’s claims.
The objection is inadmissible because the challenged ruling shows that the judges analyzed the application of substantive law to the alleged facts, and there is no impediment whatsoever to a party that considers itself harmed by the Appeals Court’s decision challenging on cassation the acquittal entered at the appellate level with respect to the interpretation given to the criminal offense established in Article 58(b) of the Ley Forestal. Accordingly, the objection raised does not establish prejudice, it being understood that the acquittal entered by the appellate judges does not prevent the prosecuting authority in this case from challenging the decision in cassation proceedings on the ground of erroneous application of a substantive legal provision—the ground established in section 468(b) of the procedural Code—as it does in the following ground. For the foregoing reasons, the first ground of the cassation appeal filed by the prosecution is declared inadmissible.
V.As a second argument, he alleges the erroneous application of a substantive legal provision, specifically Article 58(b), in relation to Article 3(a) of the Ley Forestal. He states that the Tribunal de Apelación de Sentencia Penal del III Circuito judicial de Alajuela erroneously interpreted the provisions of both articles concerning the offense of Exploitation of Forest Resources (Aprovechamiento de Recursos Forestales), by incorrectly concluding that, in this matter, the charges brought by the Ministerio Público and the Procuraduría General de la República did not fully describe the prohibited conduct, finding that the Trial Judge was legally barred from modifying the factual framework (cuadro fáctico) in the manner she did. He indicates that the facts attributed to the defendant (encartado)—those set forth in the indictment (acusación) and the private complaint (querella)—fully correspond to the statutory description of the offense of Exploitation of Forest Resources, established and punishable under Article 58(b) of the Ley Forestal, in relation to the concept of exploitation (aprovechamiento) set forth in Article 3 of the same law.
He states that commission of the aforementioned offense “…does not require proof of an actual profit, benefit, advantage, utility, or gain; the possibility thereof is sufficient.” (f. 34, virtual case file). He considers that the objective elements of the offense (elementos objetivos del tipo penal) can be derived from the factual framework set forth in the prosecution’s charging document and the private complaint. Furthermore, from the description of actions corresponding to the concept of exploitation set forth in Article 3 of the Ley Forestal, the extent of the benefit—in this case, an economic benefit—may be derived on the basis of the value of the timber—more than one million eight hundred thousand colones—as established by expert evidence. He believes that the charged facts and those found proven by the Trial Judge are identical in all essential respects. He disagrees with the appellate court’s position criticizing the judge for modifying the charged facts in her legal analysis by stating that the exploitation of the forest product was economic in nature.
The complainant argues that this did not constitute a modification of the factual framework, but rather a clarification reached by the judge when analyzing the evidence regarding the form of exploitation, which is not an essential component of the normative elements of the offense (elementos normativos del tipo), unlike the actions described in the referenced Article 3. The grievance lies in the incorrect interpretation of the substantive provision, by erroneously treating the failure to describe the specific benefit that would be obtained from exploiting forest resources as determinative, when a description of the prohibited acts is in fact sufficient. This creates legal uncertainty by foreclosing the possibility of prosecuting offenses of this kind when they are detected in flagrante delicto (flagrancia). He requests that the appellate judgment be vacated and that the conviction entered at first instance be affirmed.
The ground is admissible. The second claim asserted also satisfies the statutory filing requirements identified in the preceding Whereas clause (Considerando). The petitioner challenges the decision of the Tribunal de Apelación de Sentencia Penal to apply substantive law incorrectly in this specific case, as it found that the prosecution’s charging document and the private complaint did not fully describe the prohibited conduct contained in Article 58(b), in relation to Article 3(a), both of the Ley Forestal. The prosecution representative disagrees with that position and maintains that both charges fully correspond to the statutory description of the offense of Exploitation of Forest Resources, without any requirement to prove the existence of a profit, benefit, advantage, utility, or gain, an issue that must be examined carefully on the merits. The statutory provisions violated, the specific grievance, and the relief sought are identified. Accordingly, this claim is also ordered to proceed pursuant to Articles 467, 468, 469, and 471 of the Código Procesal Penal.

Revisión del Documento *160000260288PE* Res: 2019-00225 SALA TERCERA DE LA CORTE SUPREMA DE JUSTICIA. San José, a las diez horas y cuarenta y cinco minutos del veintidós de febrero del dos mil diecinueve.
Visto el presente recurso de casación, en causa seguida contra Heliodoro Pérez Brenes, por el delito de Infracción a la Ley Forestal, en perjuicio de Los Recursos Naturales; y,
Considerando:
I.El licenciado Carlos Lizano Rodríguez, en su condición de representante del Estado actuando como Querellante y Actor Civil, y el licenciado Luis Alonso Bonilla Guzmán, en su calidad de Fiscal de la Fiscalía Adjunta de Impugnaciones del Ministerio Público, formulan por separado sendos recursos de casación contra la sentencia Nº 2018-00432, de las ocho horas diez minutos del treinta de mayo del dos mil dieciocho, dictada por el Tribunal de Apelación de Sentencia del Tercer Circuito Judicial de Alajuela, Sección Tercera, que declaró con lugar el primer motivo de apelación presentado por la Defensa Pública, absolviendo al encartado Heliodoro Pérez Brenes, por el delito previsto en el artículo 58 inciso b) de la Ley Forestal; asimismo, declaró ineficaz la orden de comiso que se decretó sobre la motosierra, ordenando su devolución a quien demuestre ser su titular; también acogió el segundo motivo de apelación interpuesto por el defensor público, anulando la sentencia en lo atinente a los extremos civiles, y ordenó el reenvío para una nueva sustanciación de ese extremo.
II.Recurso de casación del Querellante y Actor Civil. Como primer motivo, reclama inobservancia ó errónea aplicación del contenido de los numerales 3 inciso a) y 58 inciso b), ambos de la Ley Forestal. Indica que en representación del Estado querelló al señor Heliodoro Pérez Brenes porque fue sorprendido en flagrancia mientras talaba y procesaba con una motosierra, un árbol de la especie Manú que se encontraba dentro de una zona de protección; por este hecho se le acusó de haber infringido el artículo 58 inciso b) de la Ley Forestal, en relación con el numeral 3 inciso a) de la misma normativa. Considera que el tema del aprovechamiento forestal maderable no es el punto controvertido, puesto que en la querella que presentó, se utiliza el verbo procesar, que constituye una forma de aprovechamiento maderable, correspondiendo al Tribunal determinar si acorde con la prueba recibida, la transformación en trozas que realizó el imputado del árbol, era capaz de generarle o podía generar algún provecho, beneficio, ventaja, utilidad o ganancia, conforme a la definición que contiene la ley.
Señala que según la tercera acepción de la palabra “procesar” que contiene el Diccionario de la Real Academia de la Lengua Española, se aprecia que el procesamiento de árboles para convertirlos en trozas es una forma de aprovechamiento maderable, de manera tal que para la configuración del delito de Aprovechamiento Forestal de Recursos Forestales en Áreas de Protección, no se requiere “per se” la indicación expresa en la acusación y la consecuente demostración en debate, de la intención o la obtención actual de algún tipo de beneficio que se traduzca en términos económicos, pues conforme a la definición que contiene el numeral 3 inciso a) de la Ley Forestal sobre aprovechamiento, “…el mismo puede consistir en una amplia gama de términos como son la generación de un provecho, beneficio, ventaja, utilidad o ganancia, ya sean éstos presentes o futuros; bastando entonces con que quede debidamente probado en el contradictorio, como ocurrió en el presente proceso, que el procesamiento acusado esa (sic) capaz de generarle algún provecho, beneficio, ventaja, utilidad o ganancia.” (f. 23, expediente virtual).
Aduce que en el caso concreto, el término procesar consistió en la actividad del imputado de hacer trozas para permitir el aprovechamiento maderable, al probarse que el encartado es un reconocido maderero de la zona y que la actividad que estaba realizando tenía un importante costo económico, al requerirse de la ayuda de otras personas, el uso de una motosierra y un tractor de ruedas. En razón de lo anterior, es del criterio que corresponde al Juzgador de Juicio determinar según la prueba recibida en el contradictorio, si el procesamiento del árbol de Manú realizado implicaba un aprovechamiento maderable, tal y como lo concluyó por ejemplo, el Tribunal de Juicio de Ciudad Quesada en la sentencia Nº 644-2017, de las 16:45 horas, del 31 de agosto del 2017, el cual estableció que el procesamiento que efectuaba el querellado, era un aprovechamiento maderable con el que pretendía generar o se podía generar algún provecho, beneficio, ventaja, utilidad o ganancia.
Fustiga el petente la posición que asumió el voto impugnado, quien indicó que para la configuración del delito de aprovechamiento ilegal de recursos forestales en áreas de protección, no basta con probar en qué consistió la acción de procesar el recurso forestal y el daño ambiental que provocó, sino que además, debe describirse y demostrarse en forma concreta en qué consistió el provecho, ventaja, ganancia o utilidad que dicha actividad generó o pudo generar para el acusado, obviando el Tribunal de alzada que la acción de procesar un árbol para transformarlo en trozas, constituye en sí mismo una actividad propia de aprovechamiento maderable del que habla la Ley Forestal, sin que se requiera un ligamen a venta de esas trozas o a la demostración de un lucro, con independencia de que se les haya fijado un valor económico; en esa tesis, resulta ilógico según el gestionante, procesar en trozas un árbol de Manú y pensar que no son para su aprovechamiento.
En consecuencia, se inobservó y aplicó en forma errónea el contenido de los numerales 3 inciso a) y 58 inciso b) de la Ley Forestal, razón por la cual solicita se anule el fallo y se mantenga lo resuelto por el Tribunal de Juicio. El reclamo se admite. El motivo que interpone el Querellante y Actor Civil en representación del Estado, cumple con los requisitos formales de procedencia en su presentación. Se constata que fue interpuesto dentro del plazo de ley, por quien válidamente está legitimado, en escrito debidamente autorizado, con la indicación de los preceptos legales que considera inobservados, a la vez que ofrece los fundamentos que sustentan su alegato. El gestionante dirige su inconformidad contra la resolución del Tribunal de Apelación de Sentencia Penal del Tercer Circuito Judicial de Alajuela, de realizar una errónea interpretación para el caso concreto de lo dispuesto en los artículos 3 inciso a) y 58 inciso b), ambos de la Ley Forestal, al indicar que la querella fue omisa en describir en qué consistió el aprovechamiento ilegal de los recursos forestales en áreas de protección que se le atribuye al imputado, ya que en criterio de la Cámara ad quem, se trata de un elemento necesario para que se configure el delito referido en el numeral 58 inciso b) de la Ley Forestal; es decir, que no basta con que se describa la acción de cortar y de procesar el recurso forestal y el daño ambiental que provocó, sino que además, se debe establecer y probar en forma concreta, en qué consistió el provecho, ventaja, ganancia o utilidad que dicha actividad generó o pudo generar para el acusado, tesis que refuta el inconforme quien sostiene que para la configuración del ilícito discutido en el contradictorio, no se requiere la indicación expresa en la acusación y demostración alguna en debate, de la intención u obtención actual de algún tipo de beneficio traducido en términos económicos, pues la misma definición consignada en el referido numeral 3 inciso a) sobre el concepto “aprovechamiento”, alude a una amplia gama de términos, siendo suficiente que el procesamiento acusado sea capaz de generarle algún provecho, beneficio, ventaja, utilidad o ganancia al encartado.
Indica las disposiciones legales infringidas, la exposición del agravio causado por la decisión impugnada y la pretensión. Por lo anterior, se ordena darle trámite a este reclamo, de conformidad con lo señalado por los artículos 467, 468, 469 y 471 del Código Procesal Penal, procediendo al conocimiento de fondo respectivo, en el que se profundizará en la eventual existencia de la causal invocada, su esencialidad e incidencia sobre el dispositivo, así como sobre la procedencia de la pretensión de la parte.
III.Como segundo reparo, acusa la existencia de precedentes contradictorios dictados por los Tribunales de Apelación de Sentencia. Señala que el voto Nº 21-16, de las 15:00 horas, del 4 de febrero del 2016, dictado por el Tribunal de Apelación de Sentencia Penal del II Circuito Judicial de Guanacaste, refiere el tema del aprovechamiento forestal estableciendo los alcances de la definición contenida en el numeral 3 inciso a) de la ley Forestal. Luego de citar un fragmento de ese voto, señala que el mismo ratifica la tesis de que el delito de Aprovechamiento Ilegal de Recursos Forestales en Áreas de Protección no precisa para su configuración la demostración de la existencia de algún tipo concreto de fin o ánimo de lucro, entendido como la intención o la obtención actual de algún tipo de beneficio que sea traducible en términos económicos, sino que basta con que en el contradictorio quede debidamente probada la existencia de actuaciones por parte del sujeto activo dirigidas a obtener algún provecho, beneficio, ventaja, utilidad o ganancia, dado que pueden existir otras muchas ventajas como resultado de ese aprovechamiento.
Estima que la acción acusada debe ser valorada por el Tribunal conforme a las reglas de la sana crítica, a efecto de tener por demostrado si el imputado estaba realizando o no un aprovechamiento maderable de acuerdo a lo definido en la Ley Forestal. En consecuencia, pide se acoja este reparo por precedentes contradictorios, ya que la sentencia del Tribunal de Apelación de San Ramón “violenta la legislación de fondo vigente.” (f. 27, exp. virtual). Como agravio, señala que el vicio apuntado de la sentencia 2018-00432 del Tribunal de alzada afecta los intereses del Estado, como querellante y actor civil en el proceso seguido contra el justiciable Pérez Brenes. Solicita se tenga como prueba las resoluciones de primera y segunda instancia, y el voto 21-16 referido. El alegato es inadmisible por ser absolutamente infundado. Analizado el reparo incoado por el representante del Estado, se debe indicar que no cumple con los requisitos legales para ser admitido.
En el caso que nos ocupa, el recurrente plantea la causal de precedentes contradictorios citando el voto Nº 21-16, del Tribunal de Apelación de Sentencia del II Circuito Judicial de Guanacaste. Sin embargo, en ningún momento realiza el ejercicio exigido de confrontar dicha resolución, con lo dispuesto en el fallo dictado por el Tribunal de Apelación de Sentencia Penal del III Circuito Judicial de Alajuela, con el fin de acreditar la semejanza, identidad o similitud en los aspectos esenciales de los supuestos fácticos abordados en cada caso. No es posible para esta Cámara casacional efectuar el estudio correspondiente de la causal invocada toda vez que el inconforme se limita a exponer lo que dice el voto del Tribunal de Apelación de Guanacaste sobre el tema del Aprovechamiento Forestal, más en ningún momento se ocupó de contrastarlo formalmente con el fallo de alzada que impugna y fijar así el tema central que en su criterio, es contradictorio.
Con dicha carencia, resulta entonces imposible determinar la identidad de los supuestos de hecho y los elementos que se contradicen. Ese ejercicio es lo mínimo que deben efectuar las partes que interponen su demanda casacional con base en el numeral 468 inciso a) del Código Procesal Penal, pues se entiende por precedente únicamente la interpretación y aplicación de derecho que se relaciona directamente con el objeto de la resolución, lo anterior, en el entendido de que la parte quejosa está obligada a mostrar los contenidos del precedente y del voto cuestionado, que considere contradictorio. Basta una lectura de la exposición de los argumentos del segundo reparo para darse cuenta que el representante del Estado centró su interés en exponer lo que refiere solamente el voto precedente, pero sin confrontarlo con el voto de alzada, no siendo de recibo indicar solamente que la sentencia del Tribunal de Apelación de Sentencia de San Ramón “violenta la legislación de fondo vigente”, como si esa afirmación justificara “per se” el carácter legal de admisibilidad de la causal señalada, sino que debió señalar de manera concreta en qué tema es que resulta opuesto.
Pretender que sea esta Sala quien deba intuir, fijar y determinar el contenido temático del fallo de segunda instancia que supuestamente contradice al precedente citado, conlleva desconocer los requisitos formales que se deben observar en la interposición de la causal de precedentes contradictorios; no puede soslayar el impugnante que cada motivo de casación lleva su correspondiente fundamentación por separado. Además, se observa que el recurrente incurre en un traslape de los argumentos expuestos en el primer motivo del recurso por inobservancia o errónea aplicación de la ley de fondo, incurriendo de esta manera en una mezcla de motivos. En consecuencia, se declara inadmisible el segundo motivo.
IV.Recurso de casación del representante del Ministerio Público. En el primer motivo de su disconformidad, el licenciado Luis Alonso Bonilla Guzmán plantea inobservancia de un precepto legal procesal, por quebranto a la “doble instancia”, con base en los numerales 439, 465 y 468 inciso b) del Código Procesal Penal, 41 de la Constitución Política y el numeral 8 inciso 2.h de la Convención Americana sobre Derechos Humanos. Reclama que el Tribunal de alzada declaró con lugar el recurso de apelación que formuló la defensa; sin embargo, en vez de reenviar para una nueva sustanciación, dispuso absolver directamente. Estima que aún ante el argumento de las juezas de alzada de que en la pieza acusatoria y en la querella no se describe en qué consistió o pudo consistir el provecho que el encartado obtuvo o pudo obtener con su acción prohibida, debió reenviar para una nueva sustanciación, ya que no se descarta la posibilidad de que en un juicio de reenvío puedan prosperar las pretensiones del ente acusador.
Considera que el actuar de las juzgadoras de apelación excede su competencia según lo que dispone el numeral 465 del Código Procesal Penal, dado que no se debió resolver por el fondo el presente asunto; considera que dicha actuación imposibilita al Ministerio Público de impugnar la absolutoria que de forma improcedente dictó de manera directa, cuando resolvió el recurso de apelación de la defensa, pues soslayó la efectiva tutela de los derechos y garantías fundamentales, al negar al Órgano acusador el derecho a la doble instancia. Como agravio, señala que la absolutoria dictada en segunda instancia imposibilitó al ente fiscal de recurrirla en alzada, lo que afectó también las pretensiones punitivas del Estado, torna nugatoria la tutela de los Recursos Naturales, y genera impunidad. Pide se anule la resolución impugnada, se ordene el consecuente reenvío ante el Tribunal de Apelación de Sentencia Penal del III Circuito Judicial de Alajuela, para que con otra integración resuelva conforme a derecho.
El alegato es inadmisible por ser absolutamente infundado. El artículo 471 del Código Procesal Penal establece que la Sala de Casación Penal declarará inadmisible el recurso de casación formulado, “…cuando no se cumplan los requisitos legales para su interposición, según lo establece el artículo 469 anterior; además, cuando la resolución no sea recurrible, la parte no tenga el derecho de recurrir, cuando el recurso tenga como finalidad modificar los hechos probados o cuando el recurso sea absolutamente infundado, en cuyo caso lo declarará así y devolverá las actuaciones al tribunal de origen.” (el subrayado no es del original) . En el presente asunto, el reclamante señala que el Tribunal de Apelación de Sentencia Penal del Tercer Circuito Judicial de Alajuela, Sección Tercera absolvió de toda pena y responsabilidad al encartado, por el delito de aprovechamiento de recursos forestales que se le atribuyó, contemplado en el artículo 58 inciso b) de la Ley Forestal, impidiéndole discutir de nuevo, la acreditación de los hechos que le endilga al acriminado Heliodoro Pérez Brenes, violentándose su derecho al principio de doble instancia pues se le obstaculiza en su criterio, la posibilidad de impugnar la absolutoria dictada.
Indica que las juezas de alzada excedieron su competencia, fijada en el numeral 465 del Código adjetivo, soslayando la tutela de los derechos procesales y fundamentales de las partes. Sin embargo, el reclamo no resulta admisible en razón de que ya esta Cámara ha señalado en diversos fallos anteriores, que no existe obstáculo -en términos absolutos-, para que el Tribunal de Apelación pueda absolver en alzada, posibilidad que se deriva de lo establecido en el párrafo tercero del numeral 465 del Código Procesal Penal, concretamente, cuando indica que ante la declaratoria con lugar del recurso, el ad quem puede anular parcial o totalmente el fallo incoado, y ordenar la reposición del juicio, o bien, enmendar el vicio “…y resolver el asunto de acuerdo con la ley aplicable…” Sobre el particular ha indicado: “…es posible resolver en alzada directamente el yerro, cuando, por ejemplo, la variación efectuada por el Tribunal de Apelación de Sentencia, no modifica hechos ni revalora la prueba, sino (entre otros supuestos que deberán valorarse caso por caso) simplemente aplica la ley sustantiva.
La inobservancia o errónea aplicación normas de fondo, siempre ha sido revisable en casación, y no se ve limitada por el impedimento de descender a la prueba y a la determinación de los hechos, que rige en esta sede. Ello es así, porque dicha causal supone el respeto del cuadro fáctico acreditado.” (Resolución Nº 2017-00967, nueve horas y cuarenta y dos minutos del veinte de octubre del dos mil diecisiete, con integración de las Magistradas Doris Arias Madrigal, María Elena Gómez Cortés, Sandra Zúñiga Morales, Rosibel López Madrigal y el Magistrado Jorge Enrique Desanti Henderson). El impugnante sostiene que el tribunal ad quem debió reenviar para una nueva sustanciación y no disponer la absolutoria directa del justiciable, excediendo las juzgadoras de alzada en su competencia, y quebrantándose en su criterio la garantía de una revisión amplia de la sentencia recurrida. En este caso en particular, el reclamo es manifiestamente improcedente porque el gestionante, en el mismo recurso, formula precisamente un motivo por errónea aplicación de la ley sustantiva, dejando sin sentido el agravio aquí planteado sobre la imposibilidad de acudir en alzada a discutir el tema, afectando las pretensiones del Ministerio Público.
No es admisible el reproche ya que del fallo impugnado se colige que las juzgadoras realizan un análisis de aplicación de ley sustantiva a los hechos acusados, no existiendo impedimento alguno para que la parte que se estime perjudicada, por la decisión del Tribunal de Apelación, impugne en casación la absolutoria dictada en segunda instancia, con relación a la interpretación dada al tipo penal contemplado en el artículo 58 inciso b) de la Ley Forestal. En esa tesitura, el reparo incoado carece de agravio, en el entendido de que la absolutoria dictada por las juezas en alzada, no impide en este caso al ente acusador de recurrir lo resuelto en sede de casación por aplicación errónea de un precepto legal sustantivo -causal establecida en el inciso b) del numeral 468 del Código adjetivo-, tal y como lo plantea en el siguiente motivo. Por lo expuesto se declara inadmisible el primer motivo del recurso de casación formulado por la representación fiscal.
V.Como segundo alegato, reclama aplicación errónea de un precepto legal sustantivo, específicamente del artículo 58 inciso b), en relación con el numeral 3 inciso a) de la Ley Forestal. Señala que el Tribunal de Apelación de Sentencia Penal del III Circuito judicial de Alajuela, interpretó erróneamente lo dispuesto en ambos numerales en relación al delito de Aprovechamiento de Recursos Forestales, al concluir de forma equivocada que en este asunto, las imputaciones realizadas por el Ministerio Público y la Procuraduría General de la República, no describen a cabalidad la conducta típica, estimando que la Jueza de Juicio tenía una imposibilidad legal para modificar el cuadro fáctico en la forma en que lo hizo. Indica que los hechos que le fueron atribuidos al encartado -los de la acusación y la querella-, concuerdan plenamente con la descripción típica del delito de Aprovechamiento de Recursos Forestales, previsto y sancionado en el artículo 58 inciso b) de la Ley Forestal, en relación con el concepto de aprovechamiento, plasmado en el numeral 3 del mismo cuerpo legal.
Señala que para la configuración del citado ilícito, “…no se requiere que se verifique el provecho, beneficio, ventaja, utilidad o ganancia, sino que basta con la posibilidad.” (f. 34, exp. virtual). Considera que del cuadro fáctico que se plasma en la pieza acusatoria fiscal y la querella, se extraen los elementos objetivos del tipo penal. Además, de la descripción de acciones coincidentes con el concepto de aprovechamiento, plasmado en el artículo 3 de la Ley Forestal, se puede derivar la magnitud del provecho -en este caso económico-, en función del valor de la madera -superior al millón ochocientos mil colones-, que se estableció pericialmente. Estima que entre los hechos acusados y los que tuvo por acreditados la Jueza de Juicio, hay identidad en los aspectos esenciales. Discrepa del criterio del tribunal de alzada, quien fustigó que la jueza modificó los hechos acusados en el análisis intelectivo, al indicar que el aprovechamiento del producto forestal era de índole económico, estimando el quejoso que ello no implica modificar el cuadro fáctico, sino una precisión obtenida por la juzgadora cuando analizó la prueba, respecto de la modalidad del aprovechamiento, lo cual no es un componente esencial de los elementos normativos del tipo, como sí lo son las acciones descritas en el artículo 3 referenciado.
El agravio radica en la interpretación incorrecta de la norma sustantiva, al otorgar un alcance erróneo a la falta de descripción del beneficio concreto que se obtendría del provecho de los recursos forestales, cuando en realidad es suficiente la descripción de los actos típicos, generándose inseguridad jurídica al cercenarse la posibilidad de perseguir este tipo de delitos cuando son detectados en flagrancia. Solicita se anule el fallo de alzada y se confirme la sentencia condenatoria dictada en primera instancia. El motivo es admisible. El segundo reclamo formulado cumple también con los requisitos legales de interposición indicados en el Considerando anterior. El petente dirige su inconformidad contra la decisión del Tribunal de Apelación de Sentencia Penal, de aplicar de manera errónea la ley sustantiva en el caso concreto, pues consideró que la pieza fiscal y la querella no describen a cabalidad la conducta típica contenida en el artículo 58 inciso b), en relación con el artículo 3 inciso a), ambos de la Ley Forestal, tesis que no comparte el representante fiscal, quien sostiene que ambas imputaciones concuerdan plenamente con la descripción típica del delito de Aprovechamiento de Recursos Forestales, sin que se requiera verificar que existe un provecho, beneficio, ventaja, utilidad o ganancia, tópico que se deberá analizar con detenimiento por el fondo.
Se indican las disposiciones legales infringidas, la exposición del agravio específico y la pretensión. Por lo anterior, se ordena darle trámite también a este reclamo, de conformidad con lo señalado por los artículos 467, 468, 469 y 471 del Código Procesal Penal.
Por tanto:
Se admite para su estudio de fondo el primer motivo del recurso de casación del representante del Estado en su condición de Querellante y Actor Civil. Se declara inadmisible el segundo motivo de su impugnación. En cuanto al recurso de casación del Ministerio Público, se admite para su estudio de fondo el segundo motivo formulado; asimismo, se inadmite el primer motivo de su impugnación. Notifíquese.
