Appeal in cassation (recurso de casación), filed in the present proceedings against Luis Ángel Sánchez Duran, of legal age, married, Costa Rican, forestry engineer, identification card number 02-0350-0320, son of Róger Sánchez Hernández and María Isabel Duran González, resident of Guápiles, for the offense of false statements in a public instrument (Falsedad Ideológica), committed to the detriment of La Fe Pública and the Ley Forestal. Justices José Manuel Arroyo Gutiérrez, Jesús Ramírez Quirós, Magda Pereira Villalobos, Carlos Chinchilla Sandí, and Doris Arias Madrigal participated in deciding the appeal. By judgment N° 126-G-2010, issued at thirteen hundred hours on cuatro de mayo del año dos mil diez, the Tribunal del II Circuito Judicial de la Zona Atlántica ruled: “THEREFORE: In accordance with the rules of reasoned sound judgment (sana crítica racional) and Articles 39 and 41 of the Constitución Política, 1, 21, 30, 31, 71, 75, and 360 of the Código Penal, 1, 6, 9, 142, 268, 360, 361, and 363 through 366 of the Código Procesal Penal, and 57 subsection 2) and 61 subsection a) of the Ley Forestal, it is hereby ordered: Luis Ángel Sánchez Duran is ACQUITTED of one offense of violating the Ley Forestal and one offense of false statements in a public instrument, which the Ministerio Público and the Procuraduría General de la República had charged him with committing to the detriment of the environment and public faith, the former because the criminal action (acción penal) was extinguished by the statute of limitations (prescripción), and the latter pursuant to the principle of in dubio pro reo (indubio pro reo); likewise, the civil action for damages (acción civil resarcitoria) brought by the Procuraduría General de la República is dismissed in its entirety. Whereas
I- An oral hearing was held in this matter with the participation of permanent Justices José Manuel Arroyo Gutiérrez, Jesús Ramírez Quirós, and Magda Pereira Villalobos, as well as alternate Justices Rafael Sanabria Rojas and Lilliana García Vargas, as recorded on folio 521. However, the appointment terms of alternates Sanabria Rojas and García Vargas have expired, thereby warranting the participation of permanent Justices Carlos Chinchilla Sandí and Doris Arias Madrigal. It is also taken into account that, at the oral hearing, the arguments already submitted in writing were not expanded and no evidence was received; therefore, the substitution does not affect the parties’ interests or rights. II.Attorney Amira Suñol Ocampo, representative of the State in her capacity as private prosecutor (querellante) and civil claimant (actora civil), and Attorney Gustavo Santamaría Jiménez, prosecutor for the Public Prosecutor’s Office (Ministerio Público), challenge the judgment acquitting defendant Luis Sánchez Durán of the offenses of violation of the Ley Forestal and making false statements in a public document (falsedad ideológica), while also dismissing the civil action brought. In her sole procedural ground for appeal (motivo por la forma), Attorney Suñol Ocampo alleges that the judgment lacked adequate reasoning, because the trial court (a quo) resolved its doubt in favor of the defendant without taking into account that it was he, in his capacity as forestry regent (regente), who enabled the damage to the natural resources, because he allowed the logger to cut and drag sixty trees to the log yard without any care whatsoever, thereby causing the environmental damage observed by Minaet officials, while inserting the false statement in his first regency report (informe de regencia) that appropriate work was being performed in the area in accordance with the approved management plan (plan de manejo).
Those officials found that the work had begun one month earlier, according to what they observed during that visit, which contradicts the false statement made by the defendant, who certified as true something that was not. She considers it insufficient to argue that, despite the damage caused, the reopening was authorized and the harvesting operation (aprovechamiento) continued, since a complaint concerning that event had already been filed. She cites several articles of Decreto Ejecutivo 26870-MINAE concerning the participation of Forestry Regents (Regentes Forestales), which, in her opinion, the accused failed to observe, specifically with respect to the management plan approved for the property for which the corresponding authorization to extract timber had been requested. Specifically, he failed to ensure strict compliance with the technical and legal standards established in the management plan during the harvesting phase; he failed to visit the site before the extraction work began, as required; and he failed to report the environmental damage that he must have witnessed when the sixty trees were cut.
For his part, also as his sole procedural claim, the representative of the Public Prosecutor’s Office alleges that the judgment contains insufficient analytical reasoning because its reasoning is contradictory. The Court did not deem the third allegation in the indictment to have been proven, stating that the accused had been charged with omitting from his regency report a series of environmentally harmful events and that, therefore, the offense of making false statements in a public document was not established, because omitting information is not the same as entering false information. Nevertheless, this is contrary to legal scholarship and case law, which hold that this offense may indeed be committed by omission. Furthermore, the prosecution pleading makes it possible to understand which actions he failed to identify in his regency report and which caused environmental harm, thereby rendering the document false.
In support of his claim, he cites decision number 2007-01056 of this Chamber, issued at sixteen hundred hours on 17 September two thousand seven. He adds that the Court failed to explain why the defendant’s conduct did not constitute an offense, limiting itself to discussing possible administrative liability, which it likewise failed to clarify. Another contradiction in the judgment lies in the finding that, under the approved management plan, the timber extraction was lawful, except for the five trees in the protection zone (zona de protección). The Court, however, failed to recognize that those very trees were not reported by the defendant as having been felled and form part of the events that he omitted from his report. Moreover, it is contradictory to state that the acquittal was based on defects in the indictment and then add that it was based on insufficient evidence, which is untrue because there was abundant evidence supporting the accused’s conviction.
According to witnesses Claudio Mendoza Castro and Miguel Araya Montero, officials of Minaet, it would have been impossible to devastate such a large part of the property covered by the approved management plan in one week. Although both stated that the prevailing weather conditions made it possible to extract a large quantity of timber in a short period, the judges likewise failed to identify the other evidence on which they based their assertion that it had not been proven that the regent knew of the environmentally damaging conditions when he inspected the land and issued the report. They did not indicate what constituted the brief period within which the timber could have been extracted. Another violation of the rules of sound judicial assessment (sana crítica) consists of the fact that the Court gave full credence to the prosecution witnesses but did not believe them regarding the approximate time when the destruction of the forest had begun—one and a half or two months before their inspection—which is logical when one considers that the management plan was authorized in January 2003, meaning that harvesting could have begun that same month or in February, since, according to the inspection performed by the forestry officials, the damage was inconsistent with a shorter period.
This contradicts the Court’s statement that the damage could have occurred during the week following the defendant’s visit. Another deficiency in the reasoning of the judgment is that it made no reference whatsoever to the defendant’s obligation to report the irregularities committed by the party under his supervision and by the logger, which he himself detected and recorded in his report, merely offering simple recommendations, contrary to the provisions of the then-current forestry-regency regulations, number 26870-MINAE. Regarding the fact that, after the reported events, the exploitation of the site was permitted to continue and the defendant was allowed to remain in charge of supervision, the appellant states that this is purely an administrative matter that does not affect the charges, particularly because the case file does not show that another person was assigned to be in charge, which explains why the defendant continued his work.
Finally, he objects that the accused breached his professional duties because he made no visit after the management plan was authorized in January 2003, thereby preventing him from becoming aware of the serious irregularities that were committed. The party under his supervision took advantage of his failure to monitor the work being performed to cause the alleged harm. Because the two claims are connected by their subject matter, they will be considered jointly, and they must be denied for the following reasons. First, it is appropriate to examine the specific acts with which the defendant is charged. In summary, both representatives—using identical language—charge him with entering false statements in his regency report, prepared in connection with the approval of the management plan for Mr. Ramón Solís Mata, under which the cutting and harvesting of two hundred eighty-eight trees in a forested area of his property, located in Zacatales de Colorado, Pococí, were authorized.
Specifically, the information alleged to be false is as follows: i)- that the timber-cutting and skidding operations (empateado) began after the relevant documentation had been reviewed (list of trees to be cut, access routes, base map, etc.); ii)- that, at the time of his visit, a total of sixty trees had been cut and skidded; iii)- that the cut timber was skidded to a loading yard outside the forest; iv)- that the affected area was 15 hectares; and v)- that two swamp crawler tractors, a D4 and a D5, were used for those operations to skid and load the timber and were performing appropriate work in the area. In addition, the pleading states that, as a result of the inspection of the extraction site performed by Minaet officials, a series of environmental harms were observed. Those harms are listed in the third allegation, and the defendant omitted them from his respective report, thereby causing serious environmental harm because the area was a primary forest (bosque primario) and allowing its indiscriminate logging (see folios 458-460).
A reading of the pleading makes it possible to identify clearly which statements the accusers contend were false. Its wording can certainly cause some confusion because, on the one hand, the defendant is charged with making false statements in his report concerning events related to his inspection of the property, while at the same time he is charged with failing to record a series of environmental harms that were proven to have occurred and that support the allegation that the former statements were false. In fact, when its content is read as a whole, it is apparent that the charge is that Sánchez Durán inserted several items of information characterized as false because, according to the prosecution’s theory, his statements were shown to be untrue by the verification of the harms cited in the third allegation of the charging pleadings. From this perspective, the Court’s assessment was incorrect insofar as one of the arguments on which it relied to acquit the accused was that the series of harmful events in the third allegation bore no relationship to the content of the regency report, leading it to conclude at the outset that no offense had occurred because omitting information is not the same as entering false information.
In reality, the list of harms set out in the third allegation is understood to be what, in theory, disproves the statements in the report. At this point, and before proceeding further with this judgment, it is appropriate to clarify for the prosecution that its assertion that the offense of making false statements in a public document may be committed by omission, as maintained in its appellate brief, is incorrect. Article 360 of the Criminal Code states verbatim: “The penalties established in the preceding article shall apply to anyone who inserts or causes to be inserted into a public or authentic document false statements concerning a fact that the document is intended to prove, in such a manner that harm may result.” Given its structure, the presence of the verbs “inserts” and “causes to be inserted” is readily apparent, and both entail the performance of a specific act. In that regard, making false statements in a public document constitutes a particular category of forgery of a public document (falsificación de documento público) in which explicit and categorical reference is made to false information introduced into the document, which is precisely what must be proven.
It is not possible to accept as a valid theory that this specific offense may also be committed by “omitting to insert” that which must itself be proven false, since this would plainly be self-contradictory. From this perspective, the offense does not simultaneously possess the characteristics of omission and commission, as the appellant appears to understand it, but only those of an affirmative act, as is clear from the content of the very decision of this Chamber that the appellant mistakenly invokes in support of his objection. In view of its semantic structure and intended purpose (telos), making false statements in a public document cannot be subsumed under the clause in the second paragraph of Article 18 of the Criminal Code, which equates acts and omissions under certain circumstances that do not apply to this offense, because the conduct sought to be punished is the falsity of statements inserted into a document, whether public or authentic, rather than statements omitted from it.
Something that has not been recorded cannot be alleged to be false, for the simple reason that it does not exist and, consequently, its truthfulness cannot be determined. In any event, having clarified one of the points raised by the prosecution representative, this is not, according to the judgment, the decisive issue in its analysis of the merits.
They warn that the decisive factor in this case is the insufficiency of the evidence submitted by the prosecutors, who failed to establish with certainty that the statements entered by the defendant in the forestry supervision report (informe regencial) were false or that he was aware of the environmental damage documented by other Minaet officials one week after the accused conducted the field inspection of the authorized area and prepared the disputed document. Focusing specifically on the statements characterized as false in the report, which provided the basis for investigating the possible commission of the offenses of violating the Ley Forestal and making a false statement in a public document (falsedad ideológica), there is, in fact, no evidence whatsoever proving the contrary. First, it should be clarified that, with respect to the offense defined in sections 57 and 61(a) of the Ley Forestal, with which the accused was charged and which carries a sentence of one month to three years’ imprisonment, the Court sustained the statute-of-limitations defense (excepción de prescripción) raised by defense counsel at the beginning of the trial, because the applicable period had been amply exceeded between the accused’s first formal statement (11 de setiembre de 2003, folios 24 y 25) and the date on which notice was given of the first setting of the preliminary hearing (25 de abril de 2006, folio 257), as properly explained in section IV of its judgment (folios 466-467).
Second, and continuing with the findings of the court below (a quo), the investigation established that the authorized timber had been felled and assembled into rafts (empateado), specifically timber from sixty trees, as stated by witness Miguel Araya Montero. Although he initially stated that the inspection did not locate the sixty felled trees reported by the forestry supervisor (regente), they were subsequently found in the yard of a neighboring property: “…a considerable quantity of logs, consistent with 60 trees” (folio 463). This evidence confirms another of the accused’s statements—that the felled timber was assembled outside the forest in a loading yard—and thus correspondingly rules out its falsity. Nor could it be established that the affected area exceeded 15 hectares, as Sánchez Durán perceived during his inspection. In this regard, one of the factors considered by the Court in finding reasonable doubt in favor of the defense was that, after the detected irregularities were reported, the accused was not suspended from performing his duties; instead, he continued working as the forestry supervisor for the plan approved for that site.
The record even contains subsequent forestry supervision reports prepared by the accused that refer to details concerning the harvesting operations (aprovechamiento). Specifically, the judges highlight the report dated 13 de diciembre de 2003 (folio 98 fte y vto), which states that, as of that period, only approximately forty hectares of the property had been affected and only one hundred fifty-two trees had been felled out of the two hundred eighty-two approved. This deprives of substance the assertion made by the prosecution witnesses that, by the date on which the accused conducted his inspection and prepared the corresponding report—24 de marzo—the logging operations had progressed beyond 50 % of the approved amount, as alleged in paragraph three of the charging document. As a significant detail, the judges emphasize that the December report they reference was not challenged by the prosecution, demonstrating that, despite the criticism of Sánchez Durán’s work and the criminal complaint filed against him, he continued without difficulty to perform his duties as forestry supervisor for the forest management plan (plan de manejo) authorized for that property.
This also casts doubt on the alleged “indiscriminate logging” of the forest attributed to the accused as part of a criminal plan to benefit the timber operator. Under the same reasoning, as to the five trees felled within a protection zone (zona de protección), it likewise could not be determined whether the defendant knew of this when he conducted his inspection, since he expressly stated that they were felled after his first visit and that he therefore did not authorize their felling (folio 466), a point that was not disproved. Regarding the use of two swamp crawler tractors, specifically to assemble and load the timber, although witness Araya Montero questioned their use on the ground that such equipment was too large for those conditions, witness Mendoza Castro contradicted that assertion by acknowledging that “two swamp tractors” could have been used (folio 465). This precludes accepting the accusation that this information was apparently false, particularly because the photographs introduced as prosecution evidence themselves show that this type of machinery did in fact operate at the site to extract the timber.
The central issue emphasized by both the State’s representative and the prosecution in support of their objections concerns the work performed by those tractors, which carried out “appropriate work in the area,” a phrase they also dispute as false because of the serious environmental damage documented in the area. However, as may be inferred from the underlying reasoning, this statement likewise was not disproved by the evidence. In this matter, witnesses Miguel Araya Montero, a Minaet forestry engineer, and Claudio Mendoza Castro, a former official of that institution, stated at trial that they had inspected the forest management plan approved for the property at issue. That inspection was conducted on 31 de marzo de 2003, as may be inferred from official letter # ACTo-OSRPG-FO-060-03 (folios 1-4), which reports on the visit concerning forestry permit B1-00098 and the approved forest management plan.
Although they detected noncompliance with several technical aspects of the forest management plan, which in their view caused damage to the ecosystem, that same evidence does not establish that the damage occurred before the accused prepared his technical report. The appellants strongly direct their accusation toward showing that the scale and extent of the damage detected by the forestry inspectors could not have arisen during the week between the accused’s report—24 de marzo—and the visit conducted by those inspectors—31 de marzo—but must instead have occurred much earlier, as much as two months beforehand in their estimation. Although the environmental devastation was corroborated, the Court could not determine with certainty that Sánchez Durán knew of that situation when he prepared his report. It is true that witness Araya Montero stated that the extensive harvesting impact he observed during the visit to the property “…could have begun one month or several months earlier…” (folio 463).
Nevertheless, he also acknowledged that some of the damage observed was no more than two days old at the time of his visit. When shown the photographs introduced into evidence, he expressly stated: “photo 9 shows that the damage is only a few days old, more than two days…,” while also clarifying that it was difficult for him to determine the date of the effects on the forest (folio 464). This assertion is fundamental to supporting reasonable doubt in favor of the accused, given the allegation that the damage already existed before he prepared his report. In the exculpatory account he gave before the judges, the accused stated that the breaches of the forest management plan that were established had been committed by the timber operator after his visit to the site. Thus, as the court below noted, his statement could not be disproved, because the same official who prepared the report documenting the environmental damage that subsequently served as the basis for bringing charges against the accused also indicated that the damage could have occurred after the defendant’s inspection and preparation of his forestry supervision report.
Consequently, this excludes his knowledge of the damage at the time of his first visit to the site. As the judges observe, it is logical to assume that, because of the climatic conditions prevailing in the area, the timber operator sought to take advantage of the environmental conditions to extract the greatest possible quantity of timber within a short period. This is consistent with the accused’s assertion—which forestry engineer Araya Montero himself did not disprove—that the extraction occurred after the inspection conducted by the accused. As the judgment states, this detail proved consistent with the contents of the inspection report that gave rise to the complaint concerning these events, which indicated that “as of the date of the inspection, recent skidding operations were observed, because the forest floor and the extraction trail show signs that timber was dragged no earlier than the previous day” (folio 99).
Under this reasoning, it is therefore apparent that the accused did not know of some of the documented environmental damage, while he did note other damage in his report, with the prosecution’s own evidence resolving the prosecution theory in his favor. Likewise, the representative of the Public Prosecutor’s Office (Ministerio Público) acknowledges in his submission that, because of the climatic conditions at the time, it was possible to extract a large quantity of timber within a short period, according to the testimony of Claudio Mendoza Castro and Miguel Araya Montero (folio 506), further validating the Court’s finding of reasonable doubt. Consistent with the judgment’s reasoning, it is therefore impossible to conclude with certainty that the damage documented by the Minaet inspectors occurred before the defendant’s visit to the area or, equivalently, that he had prior knowledge of that devastation.
This precludes finding false his statement that, at the time of his visit, appropriate work was being performed in the area. Another factor properly weighed by the Court concerns the detected damage to the river channel, which was obstructed by the transportation of timber—a detail that, according to the allegations, the accused omitted from his report. That assertion is not true, however, because a careful reading of the disputed document establishes that Sánchez Durán did report the situation, expressly stating in item number 3.10, entitled “Impact of Harvesting on Protection Areas,” as follows: “initially, a river channel (former access route) was used for timber extraction, a practice that was clearly determined to be improper, and therefore that extraction route will not be used again for skidding timber” (folio 13 vto). Contrary to the allegation made against him in the third charged act, it is therefore untrue that the forestry supervisor omitted this matter, much less that what he recorded was false, since it was instead one of the facts documented by the other inspectors.
Moreover, he recommended constructing a corduroy road (ruta empalada) for timber extraction because he had identified damage at the site, thus noting the need to change the extraction route due to excessive moisture. Anyone who carefully reads his report will therefore realize that he did refer to the use of the waterway, made recommendations for correcting the problem, and even warned that it should no longer be used. This precludes accepting the assertions in the charging documents because, as the judgment states, “…the forestry supervision report reflects a reality different from that alleged in the charge…” (folio 471).
Underlying the challenges raised by the State’s representative and the Public Prosecutor’s Office in their briefs of complaint is dissatisfaction and serious criticism regarding irregularities in the work performed by the accused (imputado) in his capacity as forestry regent (regente forestal), which they in fact associate with circumstances that might give rise to administrative liability, or even criminal liability, but for an offense different from the one charged. This is apparent even from the evidence presented. In this regard, witness Claudio Mendoza Castro stated that the damage found resulted from the failure to properly comply with the forest management plan (plan de manejo forestal), responsibility for which rests with the accused pursuant to Article 21 of the Ley Forestal. He also clearly stated: “I do not know whether the regent consented to that damage, but the regent must remain vigilant regarding the logger’s actions.
It may be that the regent did not visit or was not able (sic) careful […] The forestry regent is responsible for ensuring that it is properly carried out […] Accordingb (sic) to the law, the regent must monitor all activities under the management plan; he will know how many times he visits and how it is scheduled” (folios 464-465). According to his account, the concern is instead directed at questioning the accused’s apparent negligence in his professional duties, based on the view that he failed to fulfill his obligations as regent of the forest management plan because he did not properly monitor it, either because he did not conduct the necessary visits or because he failed to exercise due care. These matters concern conduct different from that expressly attributed to the accused as false certification (falsedad ideológica), since, as already stated, the statute of limitations had expired for the offense of violating the Ley Forestal, with which he had also been charged as an accomplice.
Whether or not he conducted the necessary inspection visits to the site, whether he failed to exercise the necessary oversight to prevent any improper forest harvesting (aprovechamiento forestal), or even whether he discovered irregularities in the implementation of the approved plan and failed to report them, merely recording simple recommendations, are in fact matters that must be investigated internally by the institution where the official works in order to determine whether his conduct entails any degree of administrative disciplinary liability or even criminal liability, such as a possible breach of his duties. However, the defendant was charged with making false statements in his regency report (informe de regencia), while also failing to record in that document damage that he apparently should have observed during his inspection visit; these matters were not established by the evidence introduced at trial.
It is important to clarify that the Trial Court found the prosecution witnesses credible with respect to the damage they observed in situ when they visited the property where the approved forest management plan was being implemented, environmental harm that was demonstrated through the photographs introduced into evidence. At the same time, however, the Trial Court made clear that it did not share their conclusion that the accused was also aware of the environmental impacts and omitted them from his first regency report. These two findings are not mutually contradictory, as the prosecutor asserts in his appeal, because nothing precludes the established violations of the management plan from having been committed by the logger after the inspection conducted by the accused on March 24, as shown by the evidence introduced at trial. In light of the considerations set forth by the Trial Court in its reasoning on the merits, no violations of the rules of sound judicial reasoning (sana crítica), nor any other error in its statement of reasons, are found that must be remedied at this stage; accordingly, the objections raised by the complainants are denied.
III.As a claim on the merits, the private complainant and civil plaintiff (querellante y actora civil) alleges an error in the application of sections 58 and 61 of the Ley Forestal, because the challenged judgment finds proven all the facts demonstrating the damage caused to natural resources. However, the analysis of the defendant’s conduct disregards Decreto Ejecutivo 26870-MINAE, the Forestry Supervision Regulations (Reglamento de Regencias Forestales), even though the insertion of false information into the forestry supervisor’s report (informe regencial) depends on the manner in which those regulations are applied. The claim cannot succeed. Quite apart from the fact that the argument is defectively drafted because it does not clearly explain the error of substantive law (vicio in iudicando) in the judgment, the fact remains that, as stated in the preceding Whereas Clause (Considerando), the judgment did not find it proven that the accused had inserted false statements into his forestry supervisor’s report relating to the forest management plan (plan de manejo forestal).
Likewise, although it was found that natural resources had been damaged on the property where that plan was being implemented, as described in the third allegation of fact in both charging instruments (acusaciones), it could not be established that the forestry supervisor (regente) was aware of such damage when he visited the site and prepared his report. Moreover, a careful reading of the report in question is sufficient to show that the irregularities detected by the defendant during his inspection were recorded in his written report. Therefore, regardless of whether he failed to file the corresponding complaint with the authority responsible for addressing them, or whether, in the appellant’s view, he failed to exercise due diligence in performing his duties by monitoring the implementation of the approved management plan, as established in the Reglamento de Regencias Forestales referred to above, the fact remains that these matters would be unrelated to the charged offense, as the Court correctly states in its judgment.
If the claim is that the offense was committed because the regulations under the cited executive decree allowed false information to be inserted, that fact was likewise not proven, as explained in this decision. Accordingly, the argument advanced by the complainant cannot support a finding that the judgment contains substantive errors, and the objection is therefore denied.

Recurso de Casación, interpuesto en la presente causa seguida contra Luis Ángel Sánchez Duran, mayor, casado, costarricense, ingeniero forestal, cédula número 02-0350-0320, hijo de Róger Sánchez Hernández y de María Isabel Duran González, vecino de Guápiles, por el delito de Falsedad Ideológica, cometido en perjuicio de La Fe Pública y la Ley Forestal. Intervienen en la decisión del recurso, los Magistrados José Manuel Arroyo Gutiérrez, Jesús Ramírez Quirós, Magda Pereira Villalobos, Carlos Chinchilla Sandí y Doris Arias Madrigal. También intervienen en esta instancia, los licenciados Gustavo Santamaría Jiménez y Amira Suñol Ocampo condición de representante del Ministerio Público y Procuraduría General de la República.
Resultando
1. Mediante sentencia N° 126-G-2010, dictada a las trece horas del cuatro de mayo del año dos mil diez, el Tribunal del II Circuito Judicial de la Zona Atlántica, resolvió: “POR TANTO: De conformidad con las reglas de la sana critica racional y artículos 39 y 41 de la Constitución Política , 1, 21, 30, 31, 71 y 75 y 360 del Código Penal, 1, 6, 9, 142, 268, 360, 361, 363 a 366 del Código Procesal Penal y 57 inciso 2) y 61 inciso a) de la Ley Forestal, al resolver se acuerda: ABSOLVER a Luis ángel Sánchez Duran por Un delito de Infracción a la Ley Forestal y Un delito de Falsedad Ideológica, que en perjuicio del medio ambiente y la fe pública le venía atribuyendo el Ministerio Público y la Procuraduría General de la República, el primero por extinción de la acción penal por prescripción y el segundo en aplicación del principio indubio pro reo; igualmente se declara sin lugar en todos sus extremos la acción civil resarcitoria establecida por la Procuraduría General de la República. Se resuelve sin especial condenatoria en costas, absolviendo a la Procuraduría por las costas de la acción civil por haber litigado de buena fe. Por lectura notifíquese. ENELSON GARITA VINDAS GUSTAVO CEDEÑO MONGE JOSE MARIA ARGUEDAS SALAZAR. JUECES.” (sic).
2. Contra el anterior pronunciamiento, los licenciados Gustavo Santamaría Jiménez y Amira Suñol Ocampo, Representantes del Ministerio Público y Procuraduría General de la República, interpusieron Recurso de Casación.
3. Se realizó audiencia oral y pública al ser las catorce horas del veinticinco de enero de dos mil once.
4. Verificada la deliberación respectiva, la Sala se planteó las cuestiones formuladas en el recurso.
5. En los procedimientos se han observado las prescripciones legales pertinentes.
Informa el Magistrado Ramírez Quirós; y,
Considerando
I- En este asunto se realizó una audiencia oral en la que intervinieron los magistrados titulares José Manuel Arroyo Gutiérrez, Jesús Ramírez Quirós y Magda Pereira Villalobos, así como los magistrados suplentes Rafael Sanabria Rojas y Lilliana García Vargas, según consta en el folio 521. Sin embargo, el período del nombramiento de los suplentes Sanabria Rojas y García Vargas ya feneció, motivo por el cual se justifica la intervención de los magistrados titulares Carlos Chinchilla Sandí y Doris Arias Madrigal. Se toma en cuenta, además, que en la audiencia oral no fueron ampliados los argumentos ya expuestos por escrito ni se evacuó prueba alguna, por lo que la sustitución no afecta los intereses ni los derechos de las partes. (Voto No. 17553-07, de 30 de noviembre de de 2007, de la Sala Constitucional).
II.La licenciada Amira Suñol Ocampo, representante del Estado, en su condición de querellante y actora civil, y el licenciado Gustavo Santamaría Jiménez, fiscal del Ministerio Público, impugnan el fallo a través del cual se absolvió al imputado Luis Sánchez Durán de los delitos de Infracción a la Ley Forestal y falsedad ideológica, a la vez que declaró sin lugar la acción civil incoada. En el único motivo por la forma, la licenciada Suñol Ocampo alega falta de fundamentación de la sentencia, en virtud de que el a quo sustentó la duda a favor del acusado, sin tomar en cuenta que fue él, en su condición de regente, quien facilitó que se realizara el daño a los recursos naturales, pues le permitió al maderero cortar y arrastrar hacia el patio sesenta árboles, sin cuidado alguno, lo que provocó el daño ambiental observado por los funcionarios del Minaet, insertando como dato falso en su primer informe de regencia, que se estaba desempeñando una labor adecuada en el área, según el plan de manejo aprobado.
Dichos funcionarios encontraron que los trabajos habían iniciado un mes antes, según lo que apreciaron en esa visita, lo que resulta contrario a lo que consignó falsamente el imputado, quien acreditó como verdadero algo que no era. Estima que no es suficiente argumentar que a pesar del daño causado, se autorizara la reapertura y continuara con el aprovechamiento, pues ya existía una denuncia sobre ese hecho. Cita varios artículos del Decreto Ejecutivo 26870-MINAE, relacionados con la participación de los Regentes Forestales, que en su opinión, fueron inobservados por el encartado, específicamente en lo que concierne al plan de manejo aprobado para la finca que solicitó la respectiva autorización de extraer madera. Concretamente, que no veló por el estricto cumplimiento de las normas técnicas y legales establecidas en el plan de manejo durante la fase de aprovechamiento, que no realizó la visita al sitio antes de iniciar los trabajos de extracción como está indicado, y que no denunció los daños al ambiente que tuvo que haber presenciado con la corta de sesenta árboles.
Por su parte, también como único reclamo por la forma, el representante del Ministerio Público alega insuficiente fundamentación analítica del fallo, por existir un razonamiento contradictorio en su contenido. El Tribunal no tuvo por acreditado el hecho tercero de la acusación, al indicar que se atribuyó al encartado omitir en su informe de regencia, una serie de hechos dañinos del medio ambiente, por lo que no se configuró el delito de falsedad ideológica, ya que no es lo mismo omitir que consignar un dato falso. No obstante, ello resulta contrario a lo que señala la doctrina y la jurisprudencia, al afirmar que este delito sí admite la comisión por omisión. Además, de la pieza fiscal es posible entender qué acciones fue las que no indicó en su informe de regencia, y que causaron un perjuicio al ambiente, resultando falso el documento. En sustento de su reclamo, cita el voto de esta Sala número 2007-01056, de las dieciséis horas, del 17 de septiembre de dos mil siete.
Añade que el Tribunal es omiso en explicar por qué la conducta del acusado no es delito, limitándose a hablar de una eventual responsabilidad administrativa, que tampoco aclara. Otra contradicción del fallo radica en que, de acuerdo con el plan de manejo aprobado, existió una extracción lícita de madera, con excepción de los cinco árboles en zona de protección. Sin embargo, el Tribunal no observa que justamente esos árboles no fueron reportados por el imputado como talados y forman parte de los hechos que omitió indicar en su informe. Por otro lado, resulta contrario afirmar que se absuelve por defectos en la acusación pero luego se añade que es por insuficiencia probatoria, lo que no es cierto, pues existió prueba abundante para condenar al encartado. Según los testigos Claudio Mendoza Castro y Miguel Araya Montero, funcionarios del Minaet, manifestaron que es imposible que en una semana se devastara un área tan grande de la finca donde se autorizó el plan de manejo.
Si bien es cierto ambos indicaron que por razones climáticas del momento es posible extraer mucha madera en un breve lapso de tiempo, los jueces tampoco señalan en qué otros elementos probatorios basan su afirmación de que no se acreditó que el estado dañoso del ambiente fuera conocido por el regente cuando hizo la inspección al terreno y emitió el informe. No indican cuál es ese lapso breve en que puede extraerse la madera. Otro quebranto a las reglas de la sana crítica, consiste en que el Tribunal dio plena credibilidad a los testigos de cargo, pero no les creen en lo referente al tiempo aproximado en que se había iniciado la destrucción del bosque -mes y medio o dos meses antes de la inspección realizada por ellos-, lo que resulta lógico si se toma en cuenta que el plan de manejo se autorizó en el mes de enero del 2003, por lo que el aprovechamiento pudo iniciar en ese mismo mes o bien en febrero, pues según la inspección realizada por los funcionarios forestales, los daños no calzaban con un tiempo menor, lo que es contrario al decir del Tribunal de que se pudieron hacer en la semana posterior a la visita del imputado.
Otra falta de fundamentación del fallo radica en que no se hizo referencia alguna a la obligación del acusado de denunciar las irregularidades por parte del regentado y del maderero que él mismo detectó y consignó en su informe, limitándose a sugerir simples recomendaciones, lo que es contrario a lo que establece el reglamento de regencia vigente número 26870-MINAE. Con relación a que luego de los hechos denunciados se permitió continuar con la explotación del lugar y al imputado con la supervisión, indica el quejoso que eso es un aspecto meramente administrativo, que no afecta lo acusado, amén de que no consta en el expediente que se haya asignado a otro encargado, lo que explica que el acusado continuara con su labor. Por último, reprocha que el encartado faltó a sus deberes como profesional, pues no realizó ninguna visita luego de que se autorizó el plan de manejo en enero de 2003, impidiendo percatarse de las graves anomalías que se cometieron.
El no estar pendiente de los trabajos que se realizaban, lo aprovechó el encartado para causar el perjuicio que se acusó. Por existir conexión entre ambos reclamos por la temática que plantean, se entran a conocer en forma conjunta, indicándose que deben ser declarados sin lugar por lo siguiente. En primer término, conviene analizar cuáles son los hechos concretos que se acusan al imputado. En resumen, se le atribuye por ambas representaciones -con idéntico contenido-, haber consignado declaraciones falsas en su informe de regencia, elaborado con ocasión de la aprobación del plan de manejo para el señor Ramón Solís Mata, en el que se le autorizó la corta y aprovechamiento de doscientos ochenta y ocho árboles en un área de bosque de su finca, ubicada en Zacatales de Colorado, Pococí. Concretamente, la información que se tilda de falsa es la siguiente: i)- que las labores de corta y empateado de la madera se iniciaron luego de haber analizado la documentación correspondiente (listado de árboles a cortar, rutas de acceso, mapa base, etc.); ii)- que al momento de la visita que él realizó estaban cortados y empateados un total de sesenta árboles; iii)- la madera cortada se empatea fuera de bosque en un patio de carga; iv)- el área intervenida es de 15 hectáreas; v)- que para dichas labores se utilizaron dos tractores de oruga pantaneros, un D4 y un D5 para el empateado y carga de la madera, desempeñando una labor adecuada en el área.
Además, la pieza indica que a raíz de la inspección realizada por funcionarios del Minaet al sitio de la extracción, se observaron una serie de daños al ambiente, mismos que se enlistan en el hecho tercero, los que el imputado omitió señalar en su respectivo informe, generando con ello un grave perjuicio al medio ambiente al ser un bosque primario, permitiéndose su tala indiscriminada (ver folios 458-460). De su lectura es posible advertir con claridad cuáles son las afirmaciones que son argüidas como falsas por los acusadores. Ciertamente, su redacción puede generar algún tipo de confusión, ya que, por un lado, se atribuye al justiciable declarar falsamente en su informe unos hechos relacionados con la inspección que realizó a la propiedad, acusándolo al mismo tiempo de haber omitido consignar una serie de daños ambientales que se acreditaron como ciertos, en sustento de la falsedad de los primeros.
En realidad, haciendo una lectura integral de su contenido, se aprecia que la imputación consiste en que Sánchez Durán insertó varios datos que son calificados de falsos, en razón de que, según la hipótesis acusatoria, se verificó que no eran ciertas sus afirmaciones, en virtud de la constatación de los daños que se citan en el punto tercero de las requisitorias. Desde esta perspectiva, no resulta correcta la apreciación del Tribunal, al tomar en cuenta como uno de los argumentos para absolver al encartado, que la serie de hechos dañosos del punto tres no guardan relación alguna con el contenido del informe de regencia, razón por la que concluyen de entrada que no hay delito porque no es lo mismo omitir que consignar un dato falso, cuando en realidad lo que se entiende es que esa lista de daños que se enuncian en el punto tercero, son los que, en teoría, desacreditan las afirmaciones del informe.
En este punto, y antes de proseguir con el desarrollo de esta sentencia, conviene aclarar a la representación fiscal que no es cierta su afirmación de que el delito de falsedad ideológica admite la forma de comisión por omisión, como lo sostiene en su libelo impugnaticio. El artículo 360 del Código Penal a la letra señala, “las penas previstas en el artículo anterior son aplicables al que insertare o hiciere insertar en un documento público o auténtico declaraciones falsas, concernientes a un hecho que el documento deba probar, de modo que pueda resultar perjuicio”. Acorde con su estructura salta a la vista la presencia de los verbos “insertare” o “hacer insertar”, mismos que implican la ejecución de un acto específico. En ese sentido, la falsedad ideológica constituye una categoría particular de falsificación de documento público, en el que de modo expreso y categórico se habla de información falsa que se introduce en el documento, y que son las que precisamente se deben probar.
No es posible aceptar como hipótesis válida que este ilícito específico también se cometa “omitiendo insertar” aquello que justamente debe probarse como falso, lo que evidentemente sería un contrasentido. Desde esta perspectiva, su contenido no tiene características de la omisión y de la comisión al mismo tiempo, como parece entenderlo el quejoso, sino solamente de acción, tal y como se desprende del contenido del mismo pronunciamiento jurisprudencial de esta Sala que erróneamente invoca el recurrente en sustento de su reproche. En atención a su estructura semántica y el telos que persigue, la falsedad ideológica no es posible subsumirla en la cláusula del párrafo segundo del artículo 18 del Código Penal, que equipara la acción y la omisión bajo determinados supuestos, que no son de aplicación a esta figura, toda vez que lo que se busca sancionar es la falsedad de las declaraciones que se insertan en un documento, sea público o auténtico, no las que se omitan insertar, pues no se puede argüir de falso lo que no se consigna, por la sencilla razón de que no existe y por ende, no se puede determinar su veracidad.
En todo caso, y habiéndose aclarado uno de los puntos que reclama el representante fiscal, en realidad, se trata de un aspecto que, según el fallo, no resulta ser el decisivo en su análisis de fondo. Advierten que lo determinante en este caso es la insuficiencia probatoria aportada por los acusadores, quienes no lograron acreditar con certeza que fueran falsas las afirmaciones introducidas por el justiciable en el informe regencial, y que conocía de los daños ambientales que se constataron por otros funcionarios del Minaet una semana después de que el imputado realizó la inspección de campo al área autorizada y realizó el cuestionado documento. Atendiendo específicamente a las afirmaciones que se califican de falsas en el informe, y que dieron base a que se investigara la posible comisión de los delitos de infracción a la Ley Forestal y el de falsedad ideológica, en realidad no existe elemento de prueba alguno que haya comprobado lo contrario.
En primer lugar, conviene aclarar que en relación al delito tipificado en los numerales 57, en relación con el 61 inciso a) de la Ley Forestal, que acusaron al encartado, con pena de un mes a tres años de prisión, el Tribunal acogió la excepción de prescripción plantada por el defensor del encartado al inicio del debate, en razón de haber transcurrido el plazo sobradamente entre el momento de la primer declaración formal del acusado (11 de setiembre de 2003, folios 24 y 25), y la fecha de notificación del primer señalamiento de la audiencia preliminar (25 de abril de 2006, folio 257), tal y como lo expone adecuadamente en el apartado IV de su sentencia (folios 466-467). En segundo término y continuando con lo establecido por el a quo, véase que de acuerdo con las pesquisas realizadas, se logró comprobar las labores de corta y empateado de la madera autorizada, concretamente de sesenta árboles, tal y como lo refirió el testigo Miguel Araya Montero, el cual si bien en un inicio manifestó que durante la inspección no localizaron los sesenta árboles cortados que indicó el regente, posteriormente se ubicaron en el patio de una propiedad vecinal, “…cantidad considerable de trozas, congruente con 60 árboles” (folio 463), indicio que confirma otra de las afirmaciones realizadas por el imputado, de que la madera cortada se empatea fuera del bosque en un patio de carga, lo que en forma correlativa, descarta entonces su falsedad.
Tampoco se pudo demostrar que el área intervenida fuera más de 15 hectáreas como lo apreció Sánchez Durán durante su inspección. Sobre el particular, uno de los aspectos considerados por el Tribunal para fundamentar la duda a favor de la defensa, radica en que luego de que se denunciaron las anomalías detectadas, no se suspendió al imputado en el ejercicio de sus labores sino que el mismo continuó laborando como regente del plan aprobado para ese sitio. Incluso constan informes de regencia posteriores que fueron elaborados por el acusado, en los que se alude a detalles relacionados con el aprovechamiento. Concretamente, los juzgadores resaltan el que lleva fecha 13 de diciembre de 2003 (folio 98 fte y vto), el cual indica que hasta ese período, sólo se han afectado apenas unas cuarenta hectáreas de la finca y tan solo se habían cortado un total de ciento cincuenta y dos árboles, de los doscientos ochenta y dos que fueron aprobados, lo que deja sin contenido el reproche asumido por los testigos de cargo, de que para la fecha en que el imputado realizó su inspección y el respectivo informe -24 de marzo-, el avance de las operaciones de tala constituían más del 50 % de lo aprobado, tal y como se consigna en el punto tercero de la pieza fiscal.
Como un detalle significativo, los jueces destacan que el informe de diciembre al que hacen mención, no fue cuestionado por la parte acusadora, lo que denota que a pesar de las críticas a la labor de Sánchez Durán y la denuncia penal incoada en su contra, éste siguió con sus obligaciones como regente del plan de manejo autorizado a esa finca, sin inconvenientes, poniéndose también en tela de duda la esgrimida “tala indiscriminada” del bosque que le fue atribuida al encartado, como parte del plan delictivo para beneficiar al maderero. Bajo este mismo argumento se aprecia que en cuanto a los cinco árboles cortados en zona de protección, tampoco se pudo determinar si era de conocimiento del justiciable cuando hizo su inspección, pues él mismo expresamente declara que son posteriores a su primera visita y que, por tanto, no autorizó su corta (folio 466), aspecto que no logró ser desvirtuado.
Con relación a que se utilizaron dos tractores de oruga pantaneros, específicamente para el empateado y carga de la madera, si bien el testigo Araya Montero cuestiona su uso en razón de que es demasiado grande para utilizarlo en esas condiciones, el testigo Mendoza Castro contradice su aseveración, pues admitió como posible que usaran “dos tractores pantaneros” (folio 465), lo que impide tener por cierta la acusación sobre la aparente falsedad de ese dato, amén que de las propias fotografías que se aportaron como prueba de cargo, se logra extraer que en el sitio operó ciertamente este tipo de maquinaria para la extracción de la madera. El punto de fondo que resaltan tanto la representante del Estado como el ente fiscal para sustentar sus reproches, es con relación al trabajo que realizaron esos tractores, quienes desempeñaron “una labor adecuada en el área”, frase que también discuten como falsa en tanto se constataron los graves daños ocasionados al ambiente en la zona.
Pero, como se colige del razonamiento de fondo, tampoco fue desvirtuado por las probanzas. En este asunto, los testigos Miguel Araya Montero, ingeniero forestal del Minaet y Claudio Mendoza Castro, ex funcionario de esa institución, indicaron en el debate haber realizado una inspección al plan de manejo aprobado en la finca en cuestión. Dicha diligencia fue realizada el 31 de marzo de 2003, según se colige del oficio # ACTo-OSRPG-FO-060-03 (folios 1-4), en el que dan cuenta de la visita al permiso forestal B1-00098, concerniente al plan de manejo aprobado. A pesar de que detectaron incumplimientos de varios aspectos técnicos del plan de manejo, generándose en su criterio daños al ecosistema, no se logra extraer de esa misma prueba que fueran causados antes de que el imputado realizara su informe técnico. Los impugnantes dirigen fuertemente su acusación a mostrar que la magnitud y dimensión de los daños detectados por los inspectores forestales, no es posible ubicarlos en el lapso de la semana transcurrido entre el informe del imputado -24 de marzo-, y la visita efectuada por aquellos -31 de marzo-, sino mucho tiempo antes de esas inspecciones, a lo sumo estiman desde dos meses antes.
A pesar de corroborarse los desastres al ambiente, el Tribunal no logró extraer con certeza que Sánchez Durán conocía esa situación cuando realizó su informe. Es cierto que el testigo Araya Montero señaló que el elevado impacto de aprovechamiento que observó en la gira a la finca, “…pudo haberse iniciado un mes o meses atrás…” (folio 463). Sin embargo, también aceptó que algunos de los daños apreciados, no pasaban de más de dos días anteriores a su visita. Cuando se le mostraron las fotografías aportadas como prueba, expresamente dijo que: “la foto 9 evidencia que es de pocos días el daño, más de dos días…”, aclarando también que respecto a las afectaciones relacionadas con el bosque, le es difícil determinar la fecha (folio 464). Esta aseveración resulta fundamental para sustentar la duda a favor del acusado, en virtud de achacársele que ya existían esos daños antes de que elaborara su informe.
En su relato de descargo ante los jueces, el encartado manifestó que las faltas al plan de manejo que se acreditaron, fueron ejecutadas por el maderero con posterioridad a su visita al sitio, de modo que su dicho no pudo ser desvirtuado como lo señala el a quo, pues el mismo funcionario que elaboró el informe -en el que hizo constar esos daños ambientales que posteriormente sirvieron como base para formular la requisitoria contra el acriminado-, también dejó ver que pudieron darse posterior a la inspección y elaboración del informe regencial del justiciable, lo que, en consecuencia, excluye su conocimiento al momento de su primer visita al sitio. Como lo señalan los juzgadores, resulta lógico asumir que debido a las condiciones climatológicas imperantes en la zona, el maderero tratara de aprovechar las condiciones ambientales para extraer la mayor cantidad posible de madera en un breve lapso de tiempo, lo que resulta congruente con lo afirmado por el imputado y que no fue desvirtuado por el mismo ingeniero forestal Araya Montero, de que esas extracciones se realizaron posterior a la inspección efectuada por el acusado.
Como lo refiere la sentencia, resultó ser un detalle que está en línea con el contenido del informe de inspección que dio lugar a la denuncia de estos hechos, al referir que “a la fecha de la inspección se observó que realizaron operaciones de arrastre recientes, debido a que el suelo del bosque y la trocha de extracción muestran signos de que se arrastró madera a lo sumo el día anterior” (folio 99). Bajo esta tesitura, salta a la vista entonces que algunos de los daños ambientales establecidos, no eran conocidos por el imputado, en tanto que otros sí los advirtió en su reporte, encargándose la misma prueba de cargo de despejar en su favor, la hipótesis acusatoria. Asimismo, el representante del Ministerio Público acepta en su escrito la posibilidad de que por razones climáticas del momento, es posible extraer mucha madera en un breve lapso de tiempo, de acuerdo con lo manifestado por los testigos Claudio Mendoza Castro y Miguel Araya Montero (folio 506), validando aún más la conclusión de duda a la que arribó el Tribunal.
Acorde con el razonamiento del fallo, no es posible entonces concluir con certeza que los daños constatados por los inspectores del Minaet, fueran realizados antes de la visita del justiciable a la zona, o lo que es lo mismo, que éste conocía de antes la existencia de esos desastres, impidiendo tener por falsa su afirmación de que, al momento de su visita, se desempeñaba una labor adecuada en el área. Otro de los factores que pondera con acierto el Tribunal, tiene que ver con el daño detectado al cauce del río, el cual se obstruyó por el transporte de madera, detalle que el imputado omitió consignar en su informe, según los hechos acusados. Sin embargo, ello no es cierto pues de una lectura atenta del documento cuestionado, se constata que Sánchez Durán sí reportó esa situación, afirmando expresamente en el punto número 3.10 denominado “Impacto del aprovechamiento sobre las Áreas de Protección”, lo siguiente: “inicialmente se usó un cauce de río (vía de acceso anterior) para la extracción de madera, asunto que se determinó claramente que no era correcto, por lo que no se volverá a utilizar esa vía de extracción para rastrear madera” (folio 13 vto).
Contrario entonces a lo que se le endilga en el hecho tercero, no resulta verdadero que el regente omitiera ese aspecto, y menos aún que lo consignado fuera falso, puesto que se trató más bien de uno de los hechos que fueron constatados por los otros inspectores. Es más, recomienda hacer una ruta empalada para la extracción de la madera, ya que determinó daños en el sitio, haciendo ver la necesidad de cambios en la ruta en la extracción, debido al exceso de humedad. Cualquier persona que lea atentamente su informe, se dará cuenta entonces que sí hizo alusión al uso de la vía acuática, dando recomendaciones para solucionar el problema y advirtiendo incluso que no se usara más, lo que impide tener por cierto lo señalado en las piezas acusatorias, toda vez que, como lo asevera el fallo, “…en el informe de regencia se plasma una realidad distinta a lo que señala la acusación…” (folio 471). En el trasfondo de los cuestionamientos que exponen la representante del Estado y el Ministerio Público en sus escritos de queja, se detecta una insatisfacción y seria crítica contra las anomalías en el trabajo desempeñado por el imputado en su condición de regente forestal, mismas que en realidad asocian con circunstancias que serían propias de una eventual responsabilidad administrativa, o incluso penal pero distinta a la figura acusada.
Ello se desprende incluso de las probanzas evacuadas. Sobre el particular, el testigo Claudio Mendoza Castro advierte que los daños constatados eran porque no se estaba cumpliendo debidamente el plan de manejo forestal, cuya responsabilidad le compete al imputado, según lo establece el artículo 21 de la Ley Forestal. Además, es claro en indicar que: “yo no sé si el regente consintió en esos daños, pero el regente debe estar vigilante de las acciones del maderero. Puede ser que el regente no visitó o no pudo (sic) cuidado […] El regente forestal es responsable de que se haga debidamente […] Segúnb (sic) la ley el regente debe darle seguimiento a todas las actividades del plan de manejo, el sabrá cuántas veces visita, como se programa” (folios 464-465). Acorde con su relato, la inquietud más bien se dirige a cuestionar una aparente negligencia del imputado en su labor profesional, al considerar que no cumplió con sus obligaciones como regente del plan de manejo forestal, pues le achaca el no haberle dado el seguimiento adecuado, sea porque no realizó las visitas necesarias o porque no puso la debida atención, aspectos que son propios de un comportamiento ajeno al que expresamente se le endilga al acriminado como falsedad ideológica, toda vez que, como ya se dijo, prescribió el delito de Infracción a la Ley Forestal que también le atribuyeron como cómplice.
Si realizó o no las visitas de inspección necesarias al lugar, si fue omiso en realizar el control necesario para evitar que se diera algún aprovechamiento forestal indebido, o incluso si encontró irregularidades en la aplicación del plan aprobado y no lo denunció, limitándose a consignar simples recomendaciones, en realidad son aspectos que deben ser investigados al interno de la institución en la que labora el funcionario, y determinar si su actuación conlleva algún grado de responsabilidad disciplinar administrativo o incluso de naturaleza penal, como podría ser un eventual incumplimiento de sus obligaciones. Sin embargo, lo acusado al justiciable fue que realizó declaraciones falsas en su informe de regencia, a la vez que omitió consignar en su documento los daños que en apariencia él tendría que haber conocido en su visita de inspección, aspectos que no resultaron acreditados de las mismas pruebas aportadas al debate.
Es importante aclarar que la credibilidad que el Tribunal otorga los testigos de cargo, lo es en cuanto a los daños que ellos apreciaron in situ cuando realizaron la visita a la propiedad en la que se implementaba el plan de manejo forestal aprobado, lesión ambiental que resulta demostrada a través de las fotografías que se aportaron como prueba. Sin embargo, al mismo tiempo dejan claro que no comparten la conclusión de ellos en cuanto que las afectaciones al ambiente también eran de conocimiento del acusado, y que omitió plasmar en su primer informe regencial. Ambas consideraciones no son contradictorias entre sí como lo afirma el fiscal en su impugnación, ya que nada obsta para que las faltas al plan de manejo que se acreditaron, fueran hechas por el maderero con posterioridad a la inspección que hizo el encartado el 24 de marzo, según se desprendió de las probanzas allegadas al debate.
En consideración a las reflexiones esbozadas por el Tribunal en el razonamiento de fondo, no se constata faltas a la sana crítica ni yerro alguno en su fundamentación que deba ser subsanado en esta sede, por lo que se declaran sin lugar los reproches invocados por los quejosos.
III.Como reclamo por el fondo, la querellante y actora civil alega un vicio en la aplicación de los numerales 58 y 61 de la Ley Forestal, pues la sentencia impugnada tiene como probado todos los hechos que muestran los daños ocasionados a los recursos naturales. Sin embargo, en el análisis de la conducta del imputado, se deja de lado el Decreto Ejecutivo 26870-MINAE, Reglamento de Regencias Forestales, pues la inserción de los datos falsos en el informe regencial, depende de la dinámica de la aplicación de dicho reglamento. El reclamo no puede prosperar. Al margen de que la redacción del alegato es defectuoso pues no explica claramente cuál es el vicio in iudicando que existe en la sentencia, lo cierto es que, como se indica en el anterior Considerando, el fallo no tuvo por demostrado que el acusado haya insertado declaraciones falsas en su informe regencial, relacionado con el plan de manejo forestal.
Asimismo, no obstante que se tuvo por cierto que hubo daños ocasionados a los recursos naturales en la propiedad donde se estaba ejecutando el referido plan, que son los que se citan en el hecho tercero de ambas acusaciones, tampoco se pudo acreditar que fueran conocidos por el regente al momento de visitar el sitio y elaborar su respectivo informe. Por otro lado, basta una atenta lectura del cuestionado informe para darse cuenta que los hechos irregulares que detectó el imputado en su inspección, aparecen consignados en su escrito, razón por la que, independientemente de que no haya interpuesto la respectiva denuncia ante quien correspondía conocerlos, o a criterio de quien recurre no fue diligente en su funciones de estar atento a la ejecución del plan de manejo aprobado, según lo establecido en el Reglamento de Regencias Forestales al que se alude, lo cierto es que se trataría de asuntos que no guardan relación con el delito acusado, como bien lo refiere el Tribunal en su sentencia.
Si lo que reclama es que se cometió el delito en virtud de que el reglamento del citado decreto ejecutivo permitió la inserción de los datos falsos, tampoco fue un hecho que resultó comprobado, como se expone en esta resolución. Así las cosas, el argumento esgrimido por la quejosa no resulta viable para sostener que el fallo contiene vicios de fondo, por lo que se declara sin lugar el reproche.

Se declaran sin lugar los recursos de casación que interponen la representante del Estado y el Ministerio Público. NOTIFIQUESE.
