Appeal on points of law (recurso de casación) filed in the present proceedings against Domingo Francisco Argentini Alfayate, of legal age, Costa Rican, single, businessman, identity card number eight-sixty-six-seven hundred three, for the offenses of land-use change (cambio de uso de suelo) and encroachment into a protected area (invasión a zona de protección), to the detriment of Natural Resources. Justices Carlos Chinchilla Sandí, Jesús Alberto Ramírez Quirós, Magda Pereira Villalobos, Doris Arias Madrigal, and Sandra Eugenia Zúñiga Morales, the latter sitting as an Alternate Justice, participated in deciding the appeal. Also appearing at this stage were attorney José Luis Campos Vargas, as counsel for defendant, private criminal respondent, and civil defendant Argentini Alfayate, and attorney Margot Avellán Ruíz, State Attorney representing the interests of the State. Considerations:
I.Before ruling on the substantive ground raised in the appeal on points of law, this Chamber deems that the following must be considered. Not all the Justices participating in the issuance of this decision concurred in finding the present matter admissible. This change in the composition of this Chamber does not in any way affect the decision issued below; therefore, in accordance with the principles of legality, the natural judge (juez natural), judicial independence and impartiality, as well as the right of defense and due process, there is no impediment to the Justices participating in the adjudication of this case issuing the decision required by law, as set forth below.
II.In decision Nº 2014-00904, at 15:14 hours, on 17 June 2014, the Chamber admitted for the corresponding substantive review the sole ground for appeal on points of law raised by attorney José Luis Campos Vargas, as legal counsel for defendant, private criminal respondent, and civil defendant Domingo Francisco Argentini Alfayate, against judgment Nº 2014-0610, at 14:15 hours, on 28 March 2014, issued by the Criminal Judgment Appeals Court of the Second Judicial Circuit of San José, which granted the appeal filed by the representative of the Procuraduría General de la República, exempting the State from payment of the procedural costs and attorney’s fees of the civil action and the private criminal complaint filed (cf. pages 529 to 530 and 500 to 506).
III.Subject matter of the appeal on points of law. The appellant alleges a failure to apply substantive law because the Judgment Appeals Court omitted to apply the statutory provisions establishing the requirements for exemption from payment of costs. The appellant states that the legal system imposes upon the losing party the obligation to pay the costs incurred in connection with a civil claim, as recognized by the case law of the First Chamber and mandated by law. He specifies that, in this matter, the losing party is the Procuraduría General de la República because the judgment dismissed the private criminal complaint and the civil action brought against Argentini Alfayate; consequently, he considers that an award of costs against it was mandatory under Articles 222 of the Code of Civil Procedure, in conjunction with Article 267 of the Code of Criminal Procedure, unless it had been shown that it litigated in good faith, which did not occur.
On the contrary, he emphasizes that the Trial Court determined that this representative of the State litigated recklessly, lacking sufficient grounds to treat his client as a defendant, much less to justify a custodial sentence, compounded by a disproportionate amount sought as compensation. He emphasizes that the Appeals Court merely justified the Procuraduría’s actions based on its duty to protect the environment and to bring criminal and civil claims against potential perpetrators of environmental damage, while disregarding the minimum legal basis required to exempt the Procuraduría from costs, an error causing irreparable harm to the private criminal respondent (cf. page 512) by compelling him to bear the financial consequences of the actions taken against him despite the acquittal. He requests that the appeal be granted, that judgment Nº 2014-610, at 14:15 hours, on 28 March 2014, be quashed, and that decision Nº 08-2014, at 13:13 hours, on 11 February 2014, of the Criminal Court of Heredia, Sarapiquí seat, be affirmed instead, ordering the Procuraduría General de la República to pay the attorney’s fees and procedural costs of the private criminal complaint and the civil action for damages (acción civil resarcitoria).
IV.The ground is without merit. The litigant alleges the incorrect application of a substantive provision, arguing that, in these criminal proceedings, the Procuraduría General de la República acted in an “arbitrary, reckless, and uncompromising manner” (cf. pages 515 et seq.) because there was no plausible reason to litigate and, consequently, that party must bear the attorney’s fees (those for the private criminal complaint in the amount of four hundred thousand colones, and those for the civil action for damages in the amount of five million fourteen thousand one hundred ninety-one colones and fifteen céntimos, amounts shown on pages 456 and 457), awards that were reversed by appellate judgment number 2014-0610 (cf. pages 500 to 506). Defense counsel bases this argument on procedural provisions, Articles 221 and 222 of the Code of Civil Procedure and 267 and 268 of the Code of Criminal Procedure.
For the reasons stated below, the appeal on points of law must be denied. The Chamber finds that the reasoning developed by the Judgment Appeals Court when reviewing the legality of the first-instance ruling is reasonable because, through a coherent and sufficient decision, it clearly states the reasons justifying its decision to grant the appellate argument advanced by the Procuraduría General de la República (Articles 2, 142, and 184 of the Code of Criminal Procedure). In that regard, the challenged judgment states: “…it is noted that the Ministerio Público pursued the case against defendant Domingo Argentini Alfayate on the basis that he was the holder of an unrestricted general power of attorney (apoderado generalísimo sin limitación de suma) for Collin Street Bakery Incorporated, known as Corsicana, and, in that capacity, charged him with having caused, through intermediaries, the change in the use of land designated for protection, converting it into plantation land for pineapple cultivation (see indictment on pages 341 to 350); moreover, that indictment was based (sic) on extensive reports by officials of the Ministry of Environment, Energy and Telecommunications (MINAET) of the Conservation Areas System, which corroborated the change in land use and the environmental damage caused by that activity, principally within the protected area of the spring (naciente).” It should be noted that the appellate court (ad quem), pursuant to Articles 459, 462, and 465 of the Code of Criminal Procedure, identified the investigative approach of the Public Prosecutor’s Office and the Ministry of Environment, Energy and Telecommunications (MINAET) of the Conservation Areas System, which had identified the alleged irregularity in the change in land use on the property owned by the company “Corsicana,” for the purpose of using it as a pineapple plantation, and whose holder of an unrestricted general power of attorney was Argentini Alfayate.
In other words, from that perspective and in accordance with the controlling reasoning, the Appellate Judges rejected the contention that the civil action and the private criminal complaint brought by the Procuraduría General de la República were “arbitrary, reckless, and uncompromising.” In this respect, they determined that, in the specific case, significant indicia existed that justified directing the investigation against the defendant, a decision that was not the product of whim or happenstance but, rather, was based, in accordance with the rules of sound judicial reasoning (sana crítica), on understandable elements of probability supporting the view that he was responsible for the environmental damage caused. The duty imposed by the legislature on the Procuraduría General de la República to defend the interests of the State was likewise taken into account. In this regard, the judgment states: “…there is a legal obligation of the State not only to protect the environment but also to pursue criminal and civil claims against those considered potential perpetrators of damage thereto.
That is, the State’s action, irrespective of the determination that the accused bore no responsibility, was justified, which constitutes sufficient grounds to establish that it did have plausible reason to litigate…” (cf. pages 505 to 506). Such action is supported by subsection d) of Article 3, in conjunction with provisions 1º, 7, 20, and 21 of the Organic Law governing the aforementioned entity, a body of law that expressly establishes its respective powers as the highest advisory and technical-legal body of the Public Administration and as the legal representative of the State in matters within its jurisdiction, with the obligation to intervene in criminal proceedings pursuant to the law and the Code of Criminal Procedure. Consistent with the foregoing, the error alleged by the litigant regarding the reasons set forth by the Criminal Judgment Appeals Court—which ultimately exempted the Procuraduría General de la República from payment of costs—is refuted, because a factual and legal basis exists that excludes reckless practices tending to create unnecessary risks to the detriment of fundamental rights.
In other words, no violation of the right to a fair judgment has been established (Decisions numbers: 2009-13284, at 15:17 hours, on 25 August 2009; 2009-018769, at 14:49 hours, on 15 December 2009; and 2008-008645, at 17:36 hours, on 21 May 2008, all issued by the Constitutional Chamber of the Supreme Court of Justice). In summary, the appeal on points of law filed by private defense counsel for Domingo Argentini Alfayate must be denied, pursuant to Article 41 of the Political Constitution.

Recurso de casación interpuesto en la presente causa seguida contra Domingo Francisco Argentini Alfayate, mayor, costarricense, soltero, empresario, cédula de identidad número ocho- sesenta y seis- setecientos tres; por el delito de cambio de uso de suelo e invasión a zona de protección, en perjuicio de los Recursos Naturales. Intervienen en la decisión del recurso los Magistrados Carlos Chinchilla Sandí, Jesús Alberto Ramírez Quirós, Magda Pereira Villalobos, Doris Arias Madrigal y Sandra Eugenia Zúñiga Morales, esta última como Magistrada Suplente. Además, en esta instancia, el licenciado José Luis Campos Vargas, como representante del imputado, querellado y demandado civil Argentini Alfayate, la licenciada Margot Avellán Ruíz, procuradora en representación de los intereses del Estado. Se apersonó el representante del Ministerio Público, licenciado Manuel Gómez Delgado.
Resultando:
Informa el Magistrado Ramírez Quirós, y;
Considerando:
I.De previo a resolver el motivo por el fondo planteado en el recurso de casación formulado, estima esta Sala que se debe considerar lo siguiente. No todos los Magistrados y Magistradas que participamos en el dictado de la presente resolución, concurrimos en la admisibilidad del presente asunto. Tal cambio en la integración de este Despacho, no afecta en modo alguno, la resolución que de seguido se dicta, por lo que de conformidad con los principios de legalidad, juez natural, independencia e imparcialidad judicial, así como del derecho de defensa y el debido proceso, no existe impedimento alguno para que las Magistradas y Magistrados que participamos en el conocimiento de esta causa, emitamos la decisión que conforme a derecho corresponde, según lo que a continuación se resuelve.
II.En resolución Nº 2014-00904, de las 15:14 horas, del 17 de junio de 2014, la Sala admitió para el correspondiente estudio de fondo, el único motivo de casación formulado por el licenciado José Luis Campos Vargas, en patrocinio letrado del imputado, querellado y demandado civil Domingo Francisco Argentini Alfayate, contra la sentencia Nº 2014-0610, de las 14:15 horas, del 28 de marzo de 2014, dictada por el Tribunal de Apelación de la Sentencia Penal del Segundo Circuito Judicial de San José, que declaró con lugar el recurso de apelación planteado por la representante de la Procuraduría General de la República, eximiendo al Estado del pago de las costas procesales y personales de la acción civil y la querella formulada (cfr. folios 529 a 530 y 500 a 506).
III.Objeto del recurso de casación. Reclama el impugnante inobservancia de la ley sustantiva, por cuanto el Tribunal de Apelación de Sentencia, omitió aplicar las disposiciones normativas que establecen los requisitos para la exoneración de pago de costas. Refiere el recurrente que el ordenamiento jurídico establece la obligación a la parte vencida de asumir la condena en el pago de las costas producidas ante una demanda civil, aspecto asentido por la jurisprudencia de la Sala Primera y por mandato legal. Puntualiza que en este asunto, la parte vencida es la Procuraduría General de la República, por cuanto en sentencia se desestimó la querella y la acción civil establecida contra Argentini Alfayate, en consecuencia estima que era obligatorio condenarla en costas, de conformidad con los artículos 222 del Código Procesal Civil, en relación con el artículo 267 del Código Procesal Penal, salvo que se hubiese demostrado que litigó de buena fe, situación que no acontenció, por el contrario destaca que el Tribunal de Juicio precisó que tal representante del Estado litigó temerariamente, al carecer de razones suficientes para tener a su cliente como imputado, y mucho menos justificar una condena privativa de libertad, aunado a un monto desproporcionado por resarcimiento.
Enfatiza que el Tribunal de Apelación se limitó a justificar el proceder de la Procuraduría, en apego de su deber de proteger el medio ambiente y de presentar los reclamos de naturaleza penal y civil en contra de los eventuales causantes del daño ambiental, soslayando el mínimo fundamento legal a fin de eximir en costas a la Procuraduría, error que conlleva un agravio irreparable contra el querellado (cfr. folio 512), al confinarlo a soportar los efectos económicos de las acciones realizadas en su contra, pese al dictado de la absolutoria. Solicita declarar con lugar la impugnación, se case la sentencia Nº 2014-610, de las 14:15 horas, del 28 de marzo de 2014, y en su lugar se proceda a confirmar la resolución Nº 08-2014, de las 13:13 horas, de 11 de febrero de 2014, del Tribunal Penal de Heredia, sede Sarapiquí, condenándose a la Procuraduría General de la República al pago de las costas personales, procesales de la querella y de la acción civil resarcitoria.
IV.El motivo no es de recibo. El litigante reclama la incorrecta aplicación de un precepto sustantivo, argumentando que en dicho proceso penal, la Procuraduría General de la República actúo de forma “arbitraria, temeraria y a ultranza” (cfr. folios 515 y siguientes), al no existir razón plausible para litigar y en consecuencia, debe tal parte soportar las costas personales (de la querella en la suma de cuatrocientos mil colones, y las costas personales de la demanda civil resarcitoria en cinco millones, catorce mil ciento noventa y un colones con quince céntimos, rubros que se constatan a folios 456 y 457), extremos que fueron revocados por la sentencia de apelación número 2014-0610 (cfr. folios 500 a 506). Alegato que sustenta el defensor particular en normas adjetivas, artículos 221 y 222 del Código Procesal Civil; 267 y 268 del Código Procesal Penal. Por las razones que se dirán, el recurso de casación debe declararse sin lugar.
La Sala considera que el ejercicio intelectivo desarrollado por el Tribunal de Apelación de Sentencia, al controlar la legalidad de lo resuelto en primera instancia, es razonable porque mediante una resolución armónica y suficiente, emite una clara exposición de motivos que permiten justificar la decisión de haber declarado con lugar el alegato de apelación propuesto por la Procuraduría General de la República (artículos 2, 142 y 184 del Código Procesal Penal), en ese sentido, el fallo cuestionado refiere: “…se advierte que el Ministerio Público siguió la causa contra el imputado Domingo Argentini Alfayate a partir de que éste era el apoderado generalísimo sin limitación de suma de la empresa Collin Street Bakery Incorporated, conocida como Corsicana, y como tal lo acusó de que propició por intermedias personas el uso del cambio de suelo de naturaleza para la protección convirtiéndola en terreno de plantación para el cultivo de piñas (ver acusación de folios 341 a 350), pero además esa acusación se sustento (sic) en sendos informes de los funcionarios del Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET) del Sistema de Áreas de Conservación, que corroboraron la variación del uso del suelo y el daño ambiental que esa actividad produjo, principalmente sobre el área de protección de la naciente”.
Obsérvese, como el ad quem, según los artículos 459, 462 y 465 del Código Procesal Penal, precisó la línea de investigación de la representación Fiscal y del Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET) del Sistema de Áreas de Conservación, que identificaron la supuesta irregularidad en el cambio del uso de suelo, en el inmueble propiedad de la empresa “Corsicana”, en aras de destinarla a la plantación de piña, cuyo apoderado generalísimo era Argentini Alfayate, es decir, bajo esa óptica, la Jueza y los Jueces de Apelación, de acuerdo con el ejercicio intelectivo imperante, descartaron que la acción civil y la querella promovida por la Procuraduría General de la República fuese "arbitraria, temeraria y a ultranza", al respecto ponderaron que en el caso concreto prevalecieron indicios importantes que permitieron dirigir la investigación contra el imputado, disposición que no obedeció a una ocurrencia o casualidad, sino más bien que se sustentó de acuerdo a las reglas de la sana crítica, en elementos de probabilidad entendibles para considerar su responsabilidad ante el daño ambiental producido.
A su vez, se estimó el deber -impuesto por el legislador a la Procuraduría General de la República-, de defender los intereses Estatales, en ese orden, el fallo señala: “… existe una obligación legal del Estado no solo de proteger el medio ambiente sino de gestionar los reclamos, penales y civiles, para quienes se consideren potenciales causantes de daños al mismo. Es decir, la acción del Estado, independientemente de que se resolviera que el acusado no tenía responsabilidad, estuvo justificada, motivación suficiente para que se acredite que si tuvo razón plausible para litigar...” (cfr. folios 505 a 506). Actuar que encuentra respaldo en el inciso d) del artículo 3, en concordancia con los numerales 1º, 7, 20 y 21 de la Ley Orgánica del invocado ente, cuerpo de leyes que expresamente estipula sus respectivas atribuciones como órgano superior consultivo, técnico-jurídico, de la Administración Pública, y el representante legal del Estado en las materias propias de su competencia, teniendo la obligación de intervenir en las causas penales según la ley y el Código Procesal Penal.
Acorde con lo esgrimido, se logra desvirtuar el error que aboga el litigante en cuanto a las razones esbozadas por el Tribunal de Apelación de Sentencia Penal, que en definitiva eximieron a la Procuraduría General de la República del pago de las costas, pues prevalece un fundamento de hecho y de derecho, que excluye prácticas imprudentes tendientes a crear riesgos innecesarios en detrimento de derechos fundamentales, en otras palabras, no se determina la vulneración del derecho a una sentencia justa (Resoluciones números: 2009-13284, de las 15:17 horas, del 25 de agosto del 2009; 2009-018769, de las 14:49 horas, del 15 de diciembre de 2009 y 2008-008645, de las 17:36 horas, del 21 de mayo de 2008, todas de la Sala Constitucional, de la Corte Suprema de Justicia). En resumen, debe declararse sin lugar el recurso de casación incoado por la defensa privada de Domingo Argentini Alfayate, de conformidad con el artículo 41 de la Constitución Política.

Se declara sin lugar el recurso de casación interpuesto por la defensa particular de D.F.A.A. Notifíquese.
