Appeal on points of law (Recurso de Casación), filed in the present proceeding brought against Fabio Alberto Cordero Céspedes, of legal age, Costa Rican, married, holder of identity card 7-0094-0318, born on April 28, 1969, and Rigoberto Calderón Chinchilla, of legal age, Costa Rican, resident of Ticabán, holder of identity card 1-0598-0120, born on April 19, 1962; for the offense of Violation of the Ley Forestal (Infracción a la Ley Forestal), committed to the detriment of La Ley Forestal. Participating in the decision on the appeal are Justices Carlos Chinchilla Sandí, Jesús Ramírez Quirós, José Manuel Arroyo Gutiérrez, Magda Pereira Villalobos, and Doris Arias Madrigal. Also participating at this stage are attorney José Salazar Monge, in his capacity as public defender for Rigoberto Calderón Chinchilla, and attorney Victor Manuel Loría Guadamuz, in his capacity as private defense counsel for Fabio Alberto Cordero Céspedes; attorney Mario Guzmán García, representing the private complainant and civil plaintiff (querellante y actora civil), the "Procuraduría General de la República." Findings:

  1. 1By judgment N° 2012-02222, issued at nine hours and forty minutes on November 2, 2012, the Tribunal de Apelación de Sentencia Penal. Segundo Circuito Judicial de San José. Goicoechea ruled: “THEREFORE (POR TANTO): The appeals filed by attorneys José Salazar Monge and Víctor Manuel Loría Guadamuz are denied.-SERVE NOTICE. Edwin Salinas Durán Lilliana García Vargas-Rosaura Chinchilla Calderón. Appellate judges.

2. José Salazar Monge, public defender for Rigoberto Calderón Chinchilla, filed an appeal on points of law against the foregoing ruling.

3. After the corresponding deliberation, the Chamber considered the issues raised in the appeal.

4. The relevant statutory requirements have been observed in the proceedings.

Whereas:

I.By written submission dated 04 de diciembre de 2012, attorney José Salazar Monge, in his capacity as public defender for the accused (imputado) Rigoberto Calderón Chinchilla, files an appeal on points of law against decision number 2222-2012, issued at 09:40 hours on 02 de noviembre de 2012 by the Tribunal de Apelación de la Sentencia Penal del Segundo Circuito Judicial de San José.

II.As to the sole ground asserted, by admissibility decision (voto de admisibilidad) 00904-2013, issued at 10:52 hours on 12 de julio de 2013, this Chamber admitted the sole ground of the appeal on points of law. The merits of the objection will therefore be considered.

III.Position of the Ministerio Público. Attorney Cristian Fernández Mora, in his capacity as representative of the Ministerio Público, agrees with the position presented by the defense counsel for the defendants. In this regard, during the oral hearing held before the Tribunal de Apelación at 09:00 hours on 31 de octubre de 2012, he stated, regarding the first ground raised by the defense, that it should be granted, finding persuasive the argument concerning the failure to provide the specific circumstances of the charged offense (falta de circunstanciación del hecho acusado) (cf. 531). Likewise, when responding to the notice of the appeal on points of law filed by the defendants’ counsel, at folios 577 to 582, the Fiscalía Adjunta de Impugnaciones again stated that, pursuant to the principle of objectivity (principio de objetividad), the prosecution’s position was to support granting the appeal, specifically the claim that the charge failed to specify the temporal circumstances of the events.

It stated in this regard: “This representative of the Ministerio Público considers the appellant’s claim well-founded and therefore believes that the appeal on points of law should be granted. […] Notwithstanding the foregoing, in accordance with the principle of objectivity established in Article 63 of the Código Procesal Penal, this representative pointed out at the oral hearing that the lack of specificity in the charge regarding the relevant time range or an approximate date on which the events allegedly occurred was not an inconsequential defect, but, on the contrary, was fundamental given the specific circumstances of this case. […] This prosecution representative likewise considers that the challenged decision violates Article 363(c) of the Código Procesal Penal because it affirms the judgment of the Tribunal de Juicio, which does not contain a ‘precise and detailed determination of the act that the court deems proven,’ but merely establishes that the illegal logging occurred ‘simultaneously’ with the cutting of the trees covered by the certificate of origin (certificado de origen), even though nowhere is it alleged when the trees whose timber was to be transported under a certificate of origin were cut; and because that logging could have occurred at any time, since no permit was required for it (Article 28 of the Ley Forestal), the charging instrument (pieza acusatoria) is manifestly imprecise.

The only fact made clear by the charge is the date on which authorization was requested to transport timber covered by the certificate of origin (29 de octubre de 2007), but never when those trees were cut. It is therefore impossible to establish the ‘simultaneous’ date of the illegal logging carried out on the flooded land (swamp), an imprecision that did, in fact, impair the defendants’ right to a defense, as this representative informed the Tribunal de Apelación de Sentencia Penal at the oral hearing.” (cf. 577 to 581).

IV.The appellant is correct. Article 303(b) of the Code of Criminal Procedure establishes the mandatory requirement that, when drafting the charging instrument, the Public Prosecutor’s Office precisely and circumstantially state the punishable act that it seeks to attribute; likewise, the formalities established for a private criminal complaint (querella) in Article 76 of the Code of Criminal Procedure set forth the same filing requirements, and therefore the alleged act must also be described clearly, precisely, and circumstantially. In this regard, this Chamber observes that the accusation merely states: “Statement of Facts: 1.- On October 26, 2007, before the Ministry of Environment and Energy, Guápiles Regional Office, Pococi, Mr. Leonel Aguilar Fong, in his capacity as forest manager (Regente Forestal), submitted Forest Management Report number 0019006 C for certificate of origin 038-2007 concerning the property of Eduardo Villagra Carrillo, which belongs to Mr.

Rigoberto Calderón Chinchilla, where three hectares were to be harvested, with a volume of 20.20 cubic (sic) to be extracted. The report was evaluated by Engineer Miguel Araya Montero and requested a transport permit for a species known as Vara Alta, which was not included in the certificate of origin and was not among the species accepted by the Área de Conservación Tortuguero for certificates of origin based on natural regeneration. This circumstance aroused suspicion, and issuance of the transport permits was therefore suspended. 2.- As a result, on October 31, 2007, Engineer Miguel Araya Montero, a MINAE official, traveled to the property of the accused RIGOBERTO CALDEROM CHINCHILLA, located in the San Gerardo de Ticaban sector, and conducted a supervisory inspection of the area from which the timber had been extracted. After conducting that supervisory inspection, he determined that the accused FABIO CORDERO CÉSPEDES AND RIGOBERTO CALDERÓN CHINCHILLA had illegally felled forest products in a small forest of approximately 2 hectares, where brush clearing and tree cutting had taken place in order to change the land use (cambio de uso).

It was verified that the trees in the forest were cut simultaneously with the trees covered by the certificate of origin. The accused FABIO CORDERO CÉSPEDES AND RIGOBERTO CALDERÓN CHINCHILLA cut a total of 46 trees, of which 03 were of the botijo species, 01 tree of the chilamate species, 19 trees of the gavilán species, 01 trees (sic) of the Guacimo Blanco species, 03 trees of the guacimo colorado species, 01 tree of the ira species, 02 trees of the laurel species, 15 trees of the Sangrilla (sic) species, and 01 tree of an unknown species. The forest products were cut with knowledge that the State Forestry Administration does not authorize timber cutting in protection zones. The cutting of the ajillo species was also observed; it was passed off as the vainillo species, a species that is not authorized by the conservation area. 3.- On November 8, 2007, Engineer Leonel Aguilar Fong submitted a forest management report using form number 19274, in which he stated that the 35 trees listed in the certificate of origin had been cut and marked and that an additional 24 trees not authorized in the certificate of origin had also been cut.” (cf. fols. 89 to 90).

In view of that circumstance, the public defender argued before the Judgment Appeals Court of the Second Judicial Circuit of San José that the judgment was neither clear, precise, nor circumstantial in its determination of the act, in violation of Articles 142 and 363(c) of the Code of Criminal Procedure. The Judgment Appeals Court addressed that claim by stating: “...Although the judgment is drafted in a manner that makes the decision difficult to understand, due to the technique used by the trial judge, it is nevertheless sufficient to explain the reasoning that led to the conviction and that, consequently, renders the appellants’ arguments insufficient to alter that decision. Thus, although neither the accusation nor the private criminal complaint states the date on which the cutting occurred, it is clear that this information is readily ascertainable and that the absence of a specific date does not impair the defense of the accused, as prosecuting attorney Fernández Mora concluded, because both the date on which the forest manager requested the certificate of origin, October 29, 2007, and the fact that, on October 31 of that same year, MINAET official Miguel Araya Montero traveled to the site to conduct the inspection are stated.

He found that the trees for which the certificate had been sought had been cut, together with 46 additional trees located in the forested area, for which no permit could be granted. He verified that all those trees had been cut simultaneously because their degree of freshness was similar. It is therefore evident that the date of the events can be placed within those same days, particularly because the photographic sequence accompanying the complaint (folios 9 to 16) confirms that the trees had recently been felled. This circumstance is relevant to placing the events in time and, it should be stated now, to rejecting the claim made by attorney Loría Guadamuz in his appeal that the trees had been felled more than thirty years ago. Consequently, it is untrue that the accusation and the private criminal complaint do not make it possible to determine when the reported acts occurred, because the cutting took place immediately after the certificate of origin was sought, and this was also established through testimonial evidence, particularly the testimony of forest manager Leonel Aguilar Fong, who confirmed it.

It follows from the foregoing that a position such as that taken by the Public Prosecutor’s Office at the oral hearing seeks nullity merely for nullity’s sake. In a different vein, the Court was able to determine beyond any doubt that the accused Rigoberto Calderón Chinchilla owns the site where the felling occurred, as verified by the former owner, Eduardo Villagra Carrillo, and by forest manager Aguilar Fong. It was therefore established that Calderón Chinchilla derived an economic benefit from the forest products that gave rise to the illegal felling, regardless of the fact that, although he maintained a charcoal kiln at the site, it was not established with certainty that some of those products ended up there, given the evidence that many neighbors gave him branches and logs that were unsuitable for use as timber. It was the co-accused Fabio Cordero Céspedes, a timber operator from the area, who carried out the felling and who would therefore benefit from the timber, including that obtained under the permit.

He admitted this during his participation in the oral hearing, expressing his interest in having it determined that only the authorized number of trees had been felled. As established in the judgment, however, that was not the case, because it was determined that he also removed trees from the forested area. It is clear that both accused persons’ utilization (aprovechamiento) of the forest products was established. Forest manager Aguilar Fong stated that both accused persons were present when he conducted the inspection for purposes of obtaining the certificate of origin. Thus, Calderón Chinchilla joined him in identifying which trees were to be cut, which was an evident expression of his consent, while Cordero Céspedes was the person who brought him to the farm, with the understanding that he would be the one cutting the timber. Likewise, when forestry inspector Araya Montero arrived to inspect the site, he found Calderón Chinchilla arranging wood in the kiln and also confirmed that Cordero Céspedes was responsible for the felling.

Based on the foregoing, if one was the owner of the farm for which the permit was processed and the other was the timber operator, then, given such evident acts on their part to obtain authorization for the permit, it is not reasonable to infer that there was no prior agreement between them, especially since it was verified that both benefited from the timber. In other words, even if the circumstances of time, manner, and place of that agreement are unknown, as are the financial amount of the transaction and even how Calderón Chinchilla gave Cordero Céspedes the order, the manner in which he ordered the felling, or when or how he did so, this does not mean, as attorney Salazar Monge argues, that the accused Calderón Chinchilla had no involvement whatsoever in the tree cutting. It was established that he remained at the site throughout, which likewise rules out any lack of knowledge regarding the felling carried out in the forested area, particularly in view of the number of trees cut.

The evidence clearly showed that Calderón Chinchilla, as owner of the farm, was interested in benefiting from the forest products resulting from the illegal felling carried out by co-accused Cordero Céspedes. Thus, as the Court properly found, both benefited from the felling, from both the authorized and unauthorized trees.” (cf. fols. 537 to 540, emphasis supplied). This Chamber does not, however, agree that the error committed in drafting the charging instrument, as the Appeals Court itself acknowledged, could be cured by that procedural body on the ground that the defect should be treated as nullity merely for nullity’s sake. This is because the criterion used by the Appeals Court to establish, in its view, the temporal circumstances of the commission of the offense was derived subjectively. It interpreted the date on which the trees at issue were felled as being established by the application for the “Certificate of Origin” and the physical inspection performed by MINAET official Mr.

Miguel Araya Montero, based on the conclusion that the trees had been felled simultaneously because their degree of freshness was similar. In addition to this reasoning by Mr. Araya Montero, the Appeals Court visually corroborated, by examining the photographic sequences (cf. fols. 9 to 16), that the trees had recently been felled, and from those circumstances inferred a possible time frame for the alleged commission of the offense. In doing so, it proceeded to cure, as it itself acknowledged, the Public Prosecutor’s Office’s defective charging technique, because the accusation did not establish with certainty when the reported acts occurred. Notwithstanding that interpretation, the Court confidently stated that the cutting took place immediately after the certificate of origin was sought (cf. fol. 538), a circumstance it linked to the testimony of forest manager Aguilar Fong. That circumstance, however, cannot be inferred or asserted from the literal wording of the accusation, which is the issue under consideration here.

The accusation states only that on October 26, 2007, Mr. Aguilar Fong submitted report 0019006 C for certificate of origin 038-2007, and that it was only when that report was evaluated by Engineer Miguel Araya Montero, a MINAET official, that issuance of the requested transport permits was suspended. For a better understanding of the present case, it is important to clarify that an application for a “Certificate of Origin” is not an application for a tree-felling permit; rather, it is an application for authorization to transport trees that have already been felled, as established in Article 31 of the Ley Forestal, which provides: “Permit to transport timber. To remove from a farm and transport to any location within the national territory logs, squared timber, or sawn timber originating from forest plantations, a certificate of origin issued by the forest manager or the Regional Environmental Council for the area shall be required.

If this document is issued by the forest manager (regente forestal), the copy must bear the receipt stamp of the Administración Forestal del Estado…” (The underlining and highlighting are not in the original). What is requested in a “Certificate of Origin” (Certificado de Origen) is not a permit or authorization, but rather a document demonstrating that the felled timber comes from the plantation and is therefore exempt from any permit requirement. In this regard, even the Ministerio Público itself, in circular 01-2005, entitled Environmental Criminal Prosecution Policy (Política de Persecución Penal Ambiental), states the following concerning the certificate of origin: “This document is expressly established by law as indispensable for transporting timber originating from a plantation, and its absence constitutes the offense of illegal transportation.” Consequently, this Chamber does not agree with the position adopted by the Court of Appeal (Tribunal de Apelación) when it attempts to interpret the indictment (acusación) in order to determine that the trees are felled immediately upon the application for this certificate of origin, thereby curing the deficiency found in the charging document (pieza acusatoria).

Once the preparatory proceedings (procedimiento preparatorio) have concluded, if the requesting authority (órgano requirente) decides to file an indictment but submits it with deficiencies concerning matters that are no longer merely formal or substantive but instead relate to the core of the allegations—namely, the substantial and necessary conditions for that document to be admissible—the fundamental rights of the person subject to trial (justiciable) must be respected. In an adversarial system (sistema acusatorio) such as ours, that person has the right to know, fully and in detail, the circumstances of the acts attributed to him, so that, on an equal footing, he may effectively conduct both his personal and legal defense (defensa material y técnica). Because the charging document does not state with the required certainty that this is what occurred, the reasoning used by the Court of Appeal amounts to mere speculation, which is not permitted in our criminal justice system.

By making that interpretation, the Court of Appeal seeks to cure the charging document, thereby violating the principle of impartiality (principio de imparcialidad). Regarding this point, this Chamber has held: “Imposing a criminal penalty on the basis of the factual allegations (cuadro fáctico) charged by the Ministerio Público would entail modifying, on the court’s own initiative, essential elements of the indictment, thereby violating the principles of judicial impartiality and objectivity (imparcialidad y objetividad judicial). Moreover, modifying the factual allegations in that manner would violate the principle of legality (principio de legalidad), because the Criminal Court (Tribunal Penal) would effectively have to formulate a new indictment at the trial stage (fase de juicio), a function reserved by law exclusively to the Ministerio Público. Clearly, such a situation is absolutely unlawful and improper and would restrict the defendant’s exercise of the right of defense (derecho de defensa) under the terms protected by the Constitución Política and criminal law...” (Resolution number 2008-0069, at 10:15 hours, on 01 de febrero de 2008, Sala Tercera de la Corte Suprema de Justicia).

It is established that the failure to provide a proper account of the circumstances of the acts (circunstanciación de los hechos) in the indictment clearly leaves the accused persons (encartados) without an adequate defense, particularly in the present case, because the temporal circumstances were supplied at a later stage through interpretations and speculation intended to cure an absolute defect (vicio de carácter absoluto). Regarding the expansive interpretation (interpretación extensiva) of a charging document by a court, it has been held: “Something entirely different from the foregoing, however, is the proof of facts not included in the pleading filed by the Ministerio Público—or by the private prosecutor (querellante), as applicable. This is no longer a matter of legal reclassification (recalificación jurídica), but rather an overstepping of the boundaries established by the charging document.

As a rule, this excess gives rise to an absolute defect in the judgment (defecto absoluto de la sentencia) (see the first paragraph of Article 365 of the Código Procesal Penal). Nevertheless, under the law—the same statutory provision cited—such an overstepping would be admissible, but only when it benefits the defendant. When reliance is placed on facts not charged, however, a conviction could never be regarded as more favorable to the accused, even if it is entered for an offense less serious than the one stated in the indictment. To hold otherwise would confuse the scope of the first paragraph with that of the second paragraph of Article 365 of the Código Procesal Penal, which, as already stated, concern different matters. The defendant derives no benefit when uncharged facts are deemed proven in order to support a conviction. Such a course would be equivalent to convicting a person on the basis of anything other than the indictment—or, in other words, punishing a person without first having charged that person—which is unlawful because it violates due process (debido proceso), insofar as it contravenes Articles 8:2:b and 8:2:c of the Convención Americana sobre Derechos Humanos; 14:3:a and 14:3:b of the Pacto Internacional de Derechos Civiles y Políticos; 39 of the Constitución Política; and 1, 326, and 365 of the Código Procesal Penal.” (Resolution number 2005-01136, at 10:10 hours, on 30 de setiembre de 2005, Sala Tercera de la Corte Suprema de Justicia).

The foregoing arguments allow us to conclude that, in the case under review, proceedings reached the trial stage and culminated in a judgment convicting Rigoberto Calderón Chinchilla and Fabio Cordero Céspedes as the perpetrators responsible for the offense of violating the Ley Forestal, committed against the State, as counsel for the accused stated in this appeal. Beginning at the intermediate stage (etapa intermedia), defective procedural activity (actividad procesal defectuosa) occurred and was resolved to the detriment of counsel’s clients, in flagrant violation of their fundamental guarantees relating to due process and the right of defense, because the Ministerio Público filed a defective indictment that did not adequately describe the circumstances of the acts charged, as previously noted. Because the temporal indeterminacy of the act constituting the alleged offense is an essential error, it would not permit amendment of the charging document (ampliación de la pieza acusatoria) under the requirements established in Article 347 of the Código Procesal Penal.

That provision allows such an amendment when it is necessary to include a new fact or a new description of circumstances not mentioned in the indictment or the complaint by a private prosecutor (querella) that changes the legal classification or establishes a continuing offense (delito continuado). Those requirements are not met in the matter under review, since the correction would have concerned a specific, essential fact constituting the alleged offense. Therefore, although the asserted ground for cassation (motivo de casación) concerns the failure to observe and the violation of procedural rules, in light of the circumstances surrounding the act, returning the case file to the court of origin and ordering a retrial upon remand (juicio de reenvío) would serve no purpose. Accordingly, for reasons of procedural economy (economía procesal), this Chamber proceeds to decide the merits, grants the appeal, and, because the indictment filed by the Pococí Prosecutor, Licenciada Giselle Bermúdez Huette, appearing at folios 89 to 93, remains in effect but does not contain a precise and circumstantial account of the punishable act attributed to the defendants, as required under the aforementioned Article 303, and because the case may not be returned to procedural stages that have already concluded, grants the claim and acquits Rigoberto Calderón Chinchilla and Fabio Cordero Céspedes of all punishment and liability as the perpetrators responsible for the offense of violating the Ley Forestal, committed against the State. As to the civil matters, because they are not the subject of this appeal, the judgment’s disposition remains undisturbed.

Therefore:

The appeal on points of law (recurso de casación) filed by public defender José Salazar Monge is granted. In the interest of judicial economy (economía procesal), this Court hereby acquits Rigoberto Calderón Chinchilla and Fabio Cordero Céspedes of all punishment and liability for the offense of Violation of the Ley Forestal with which they were charged, to the detriment of the State. As to the civil matters, because they are not at issue in this appeal, the judgment remains undisturbed. Let notice be given.

*072026380485PE* Res: 2013-01705 SALA TERCERA DE LA CORTE SUPREMA DE JUSTICIA. San José, a las catorce horas y cero minutos del veintidós de noviembre del dos mil trece.

Recurso de Casación, interpuesto en la presente causa seguida contra Fabio Alberto Cordero Céspedes, mayor, costarricense casado, con cédula de identidad 7-0094-0318, nacido el 28 de abril de 1969 y Rigoberto Calderón Chinchilla, mayor de edad, costarricense, vecino de Ticabán, con cédula de identidad 1-0598-0120, nacido el 19 de abril de 1962; por el delito de Infracción a la Ley Forestal, cometido en perjuicio de La Ley Forestal. Intervienen en la decisión del recurso, los Magistrados Carlos Chinchilla Sandí, Jesús Ramírez Quirós, José Manuel Arroyo Gutiérrez, Magda Pereira Villalobos, y Doris Arias Madrigal. También intervienen en esta instancia el licenciado José Salazar Monge, en su condición de defensor público de Rigoberto Calderón Chinchilla, y el licenciado Victor Manuel Loría Guadamuz en su condición de defensor privado Fabio Alberto Cordero Céspedes, en representación de la querellante y actora civil "Procuraduría General de la República" el licenciado Mario Guzmán García. Se apersonó el representante del Ministerio Público.

Resultando:

  1. 1Mediante sentencia N° 2012-02222, dictada a las nueve horas cuarenta minutos del dos de noviembre de dos mil doce, el Tribunal de Apelación de Sentencia Penal. Segundo Circuito Judicial de San José. Goicoechea resolvió: “POR TANTO: Se declaran sin lugar los recursos presentados por los licenciados José Salazar Monge y Víctor Manuel Loría Guadamuz..-NOTIFÍQUESE. Edwin Salinas Durán Lilliana García Vargas-Rosaura Chinchilla Calderón. Juez y juezas de apelación.

2. Contra el anterior pronunciamiento José Salazar Monge defensor público de Rigoberto Calderón Chinchilla, interpuso recurso de casación.

3. Verificada la deliberación respectiva, la Sala se planteó las cuestiones formuladas en el recurso.

4. En los procedimientos se han observado las prescripciones legales pertinentes.

Considerando:

I.Mediante memorial de fecha 04 de diciembre de 2012, el licenciado José Salazar Monge, en condición de defensor público del imputado Rigoberto Calderón Chinchilla, interpone recurso de casación en contra de la resolución número 2222-2012, de las 09:40 horas, de 02 de noviembre de 2012, dictada por el Tribunal de Apelación de la Sentencia Penal del Segundo Circuito Judicial de San José.

II.En el único motivo interpuesto, mediante voto de admisibilidad 00904-2013, de las 10:52 horas, del 12 de julio de 2013, esta Cámara procedió a admitir el único motivo del recurso de casación. Razón por la cual se procede a conocer el fondo del reproche.

III.Posición del Ministerio Público. El licenciado Cristian Fernández Mora, en su condición de representante del Ministerio Público, comparte la posición expuesta por la defensa de los encartados. Al respecto, durante la audiencia oral, realizada ante el Tribunal de Apelación al ser las 09:00 horas, del 31 de octubre de 2012. Indico respecto al primer motivo planteado por la defensa, que el mismo, debía ser declarado con lugar, considerando que llevaba razón el argumento esbozado de la falta de circunstanciación del hecho acusado (cfr. 531). De igual forma, el criterio expuesto por parte de la Fiscalía Adjunta de Impugnaciones, cuando contesta el emplazamiento del Recurso de Casación, presentado por la defensa de los imputados, en visible de folios 577 a 582, vuelve a indicar que la posición del ente fiscal, amparado en el principio de objetividad, es apoyar la declaratoria con lugar del recurso presentado, respectivamente el alegato de falta de circunstanciación temporal de los hechos en la acusación.

Indicando en lo que respecta: “Considera esta representación del Ministerio Público que lleva razón el recurrente en su alegato, por lo que el recurso de casación debe de ser declarado con lugar. […] No obstante lo anterior, en atención al principio de objetividad dispuesto por el artículo 63 del Código Procesal Penal, esta representación hizo ver en la audiencia oral, que la falta de precisión en la acusación respecto al rango temporal o de una fecha aproximada en donde habrían ocurrido los hechos, no consistía en un vicio intrascendente, sino que por el contrario resultaba fundamental, dadas las condiciones específicas del caso concreto. […] Esta representación fiscal, igualmente considera que la resolución recurrida violenta el artículo 363 inciso c) del Código Procesal Penal, pues confirma la sentencia del Tribunal de Juicio que no contiene una “determinación precisa y circunstanciada del hecho que el tribunal estima acreditado”, sino que se contenta con establecer que la tala ilegal se dio de forma “simultanea” con la corta de árboles del certificado de origen, pese a que en ninguna parte se atribuye cuándo se habría dado la tala de árboles cuya madera se iba a transportar al amparo de un certificado de origen, y como esa tala pudo haberse dado en cualquier momento, al no requerirse permiso alguno para la tala (art. 28 de la Ley Forestal), la pieza acusatoria resulta abiertamente imprecisa, pues lo único que queda claro de la acusación es a partir de cuándo se solicitó permiso para el transporte de madera amparado por el certificado de origen (29 de octubre de 2007), pero nunca cuándo se dio la tala de esos árboles, por lo que resulta imposible establecer la fecha “simultanea” de la tala ilegal realizada en el terreno anegado (ciénaga), imprecisión que en efecto afectaba el derecho de defensa de los imputados, como fue informado por este representante en la audiencia oral realizada ante el tribunal de Apelación de Sentencia Penal.” (cfr 577 a 581).

IV.Lleva razón el recurrente. El artículo 303 en su inciso b del Código Procesal Penal, determina la necesidad obligatoria de que el Ministerio Público en la formulación de la pieza acusatoria indique de forma precisa y circunstanciada el hecho punible que se pretenda atribuir y en este mismo sentido las formalidades establecidas para la querella en el artículo 76 del Código Procesal Penal, establecen por consiguiente los mismos requisitos de presentación, razón por la cual también se debe de circunstanciar el hecho atribuible de forma clara y precisa. En este sentido aprecia esta Sala que la acusación únicamente indica: “Relación de Hechos: 1.- El día 26 de octubre del 2007, ante el Ministerio de Ambiente y Energía, Regional de Guápiles, Pococi, el señor Leonel Aguilar Fong, en su calidad de Regente Forestal presenta el Informe de Regencia Forestal número 0019006 C para el certificado de origen 038-2007 en la propiedad de Eduardo Villagra Carrillo la cual pertenece al señor Rigoberto Calderón Chinchilla, en la que se debía aprovechar tres hectáreas, con un volumen a extraer de 20.20 cúbicos (sic).

Siendo evaluado el mismo por el Ingeniero Miguel Araya Montero, donde se solicitaba guía para una especie denominada Vara Alta, la cual no estaba incluida el certificado de origen ni correspondía a las especies aceptadas por el Área de Conservación Tortuguero para los certificados de origen de regeneración natural, generando tal situación sospecha, por lo que se suspendió la entrega de guías. 2.- Por lo anterior el 31 de octubre del 2007, el ingeniero Miguel Araya Montero, funcionario del MINAE se desplazó hasta la propiedad del imputado RIGOBERTO CALDEROM CHINCHILLA, ubicada en el sector de San Gerardo de Ticaban y realizó una inspección de supervisión del área de donde se extrajo la madera, quien luego de realizar dicha inspección se supervisión logra determinar que los imputados FABIO CORDERO CÉSPEDES Y RIGOBERTO CALDERÓN CHINCHILLA, talaron en forma ilegal productos forestales en un bosque pequeño de aproximadamente 2 hectáreas el cual presentaba acciones de chapea y corta de árboles para cambiar el uso.

Verificándose que la corta de los árboles en bosque, se dio en forma simultánea a la corta de los árboles del certificado de origen. Cortando los endilgados FABIO CORDERO CÉSPEDES Y RIGOBERTO CALDERÓN CHINCHILLA, 46 árboles en total, de los cuales 03 son de la especie botijo, 01 árbol de la especie chilamate, 19 árboles de la especie gavilán, 01 árboles (sic) de la especie Guacimo Blanco, 03 árboles de la especie guacimo colorado, 01 árbol de la especiE ira, 02 árboles de la especie laurel, 15 árboles de la Sangrilla (sic), 01 árbol de especie desconocida. Productos forestales cortados a sabiendas de que la Administración Forestal del estado no autoriza corta de madera en zonas de protección. Además se observa la corta de la especie ajillo, la cual se hizo pasar por especie de vainillo, especie que no esta autorizada por él (sic) área de conservación. 3.- En fecha ocho de noviembre de 2007 el ingeniero Leonel Aguilar Fong presentó informe de regencia con el formulario número 19274 en el que indica que se cortaron y se marcaron los 35 árboles contemplados en el certificado de origen y que además se cortaron 24 árboles no autorizados en el certificado de origen.” (cfr.f. 89 a 90).

Ante tal circunstancia, el defensor público alegó ante el Tribunal de Apelación de Sentencia del II Circuito Judicial de San José, que la sentencia no es clara, ni precisa, ni circunstanciada en cuanto a la determinación del hecho, violentando los artículos 142 y 363 inc c) del Código Procesal Penal. Ahora bien, el Tribunal de Apelación de Sentencia le resuelve respecto a tal reclamo indicando que: “...Si bien la redacción de la sentencia es de una calidad tal que dificulta comprender lo resuelto, ello en virtud de la técnica utilizada por la juzgadora de mérito, sí resulta suficiente para explicar los razonamientos por los cuales se arriba a la decisión condenatoria y que, entonces, hacen que los argumentos de los recurrentes no resulten de peso para variar esa decisión. De allí que, aunque ni la acusación, ni la querella, establecen la fecha en que se produjo la corta, sí es claro que ese dato es fácilmente verificable, y la ausencia de una cita puntual no produce ninguna indefensión a los encartados, como lo estimó el representante fiscal Fernández Mora, pues tanto se señala la fecha en que el regente forestal solicitó el certificado de origen, el 29 de octubre de 2007, como que en fecha 31 de octubre de ese mismo año, el funcionario del MINAET Miguel Araya Montero se desplazó al sitio para realizar la inspección, encontrándose con que se cortaron los árboles para los que se gestionó el certificado, más 46 árboles, los que estaban en el área boscosa, y sobre la cual no se podía otorgar permiso alguno.

Verificando que todos esos árboles fueron cortados en forma simultánea, ya que el grado de frescura era similar. De allí que resulte evidente que la data de los hechos puede establecerse en esos mismos días, y tan es así, que a la luz de la secuencia fotográfica que acompaña la denuncia (folios 9 a 16), se corrobora que son árboles de reciente tala. Situación que resulta de interés, para ubicar temporalmente los hechos y, dicho de una vez, para desestimar que se trate de árboles talados hace más de treinta años, como lo sostiene el licenciado Loría Guadamuz en su recurso. Consecuentemente, no es cierto que de la acusación y de la querella no se pueda desprender cuándo ocurren los hechos denunciados, pues la corta se realizó en forma inmediata a que se gestionó el certificado de origen, y ello también se acreditó con la prueba testimonial, particularmente del propio regente forestal Leonel Aguilar Fong, quien así lo aseguró.

De lo anterior se determina que una posición como la asumida por la Fiscalía en la audiencia oral, solo persigue la nulidad por la nulidad misma. En otro orden de ideas, el Tribunal logró determinar, sin ninguna duda, que el imputado Rigoberto Calderón Chinchilla es el dueño del sitio donde se produce la tala, lo que fue verificado por el anterior propietario Eduardo Villagra Carrillo y por el regente forestal Aguilar Fong, por lo que se evidenció que Calderón Chinchilla tuvo un aprovechamiento económico de esos productos forestales que originó la tala ilegal, indistintamente de que manteniendo en el sitio una carbonera, no se haya establecido, con certeza, que allí fueron a parar algunos de esos productos, al acreditarse que muchos vecinos le regalaban ramas y troncos que no fueran útiles como madera, y que fue el coimputado Fabio Cordero Céspedes, un maderero de la zona, quien se ocupó de la tala y, por, ende aprovecharía la madera, tanto la que se obtuvo amparado a aquel permiso, lo que éste admitió en su intervención en la audiencia oral, manifestando su interés en que se determinara que solo se taló la suma de árboles que estaba autorizada, lo que, como acreditó la sentencia, no fue así, pues se determinó que también los extrajo del área boscosa, Es claro, que el aprovechamiento de los productos forestales por parte de ambos imputados se logró establecer.

El regente forestal Aguilar Fong señaló la presencia de los dos encartados cuando hizo la inspección para gestionar el certificado de origen. Así Calderón Chinchilla verificó junto con éste qué árboles cortar, evidente manifestación de su consentimiento, cómo Cordero Céspedes fue quien lo llevó a la finca en el entendido de que era quien iba a cortar la madera. De igual modo, cuando se presentó el inspector forestal Araya Montero a hacer la inspección del sitio, encontró a Calderón Chinchilla acomodando madera en el horno, como también corroboró que era Cordero Céspedes el encargado de la tala. De lo anterior, si el uno es el propietario de la finca para la cual se tramita el permiso, y el otro es el maderero, no es necesario, ante actos tan evidentes de su parte para que se autorice el permiso, desprender que no haya un acuerdo previo entre ellos, máxime que se verifica cómo ambos aprovechaban esa madera.

Es decir, aun y cuando no se conozcan las condiciones de tiempo, modo y lugar de ese convenio, o cuál fue el monto económico de ese negocio o, incluso, cómo Calderón Chinchilla le giró la orden a Cordero Céspedes, o en qué forma ordenó la tala, ni cuándo, ni cómo, no por ello, como lo argumenta el licenciado Salazar Monge, el imputado Calderón Chinchilla no tuvo ninguna relación con la corta de árboles, pues se comprobó que siempre se mantuvo en el sitio, lo que descarta, igualmente, algún desconocimiento acerca de la tala efectuada en la zona boscosa, máxime la cantidad de árboles que se cortó. La prueba señaló, con claridad, que Calderón Chinchilla, como propietario de la finca, estuvo interesado en el aprovechamiento de los productos forestales originados en la corta ilegal ejecutada por el coimputado Cordero Céspedes. De modo tal que, como bien lo establece el Tribunal, ambos se beneficiaron de la tala, de los árboles que fueron autorizados como de los que no.” (cfr. f. 537 a 540, el subrayado es suplido).

Ahora bien, no comparte criterio esta Cámara que el error cometido en la formulación de la pieza acusatoria, tal y como lo hace ver el mismo Tribunal de Apelación, pueda venir a ser subsanado por esa instancia procesal, bajo la argumentación de que el vicio cometido sea interpretado como una nulidad por la nulidad misma, esto por cuanto el parámetro utilizado por el Tribunal de Apelación para que en su criterio se establezca la circunstanciación temporal de la comisión del ilícito es derivado de forma subjetiva, interpretando que es a partir de la solicitud del “Certificado de Origen” y la inspección física del funcionario del MINAET el señor Miguel Araya Montero, que se determina la fecha de la tala de los árboles cuestionados, y basándose en el criterio de que los mismos fueron talados de forma simultanea, ya que el grado de frescura era similar. Aunado a este razonamiento realizado por el señor Araya Montero, el Tribunal de Apelación corrobora visualizando las secuencias fotográficas (cfr. f. 9 a 16), que son árboles de reciente tala, concluyendo de tales circunstancias un espacio temporal posible de la supuesta comisión del ilícito.

Procediendo a subsanar, como ellos mismos reconocen, la errónea técnica acusatoria del Ministerio Público ya que no se establece con certeza cuándo ocurren los hechos denunciados. No obstante esa interpretación, indican con seguridad que la corta se realizó en forma inmediata a que se gestionó el certificado de origen (cfr. f. 538), circunstancia que vinculan con el testimonio del regente forestal Aguilar Fong. No obstante, tal circunstancia no puede desprenderse y asegurarse de la literalidad de la acusación, que es el tema aquí debatido. Ya que en la acusación lo único que se indica es que en fecha 26 de octubre del 2007, el señor Aguilar Fong, procede a presentar el informe 0019006 C para el certificado de origen 038-2007, siendo hasta que dicho informe es evaluado por el ingeniero Miguel Araya Montero funcionario del MINAET, que se suspende la entrega de la guías solicitadas. Ahora bien, para una mayor comprensión del presente caso, es importante aclarar que la solicitud del “Certificado de Origen” no es una solicitud de permiso de tala de árboles, por el contrario, es la solicitud de permiso de transporte de árboles ya talados, como se establece en el artículo 31 de la Ley Forestal el cual indica: “Permiso para trasegar madera.

Para sacar de la finca hacia cualquier parte del territorio nacional, madera en trozas, escuadrada o aserrada, proveniente de plantaciones forestales, se requerirá un certificado de origen expedido por el regente forestal o el Consejo Regional Ambiental de la zona. En caso de que este documento sea expedido por el regente forestal, la copia deberá contar con el sello de recibido de la Administración Forestal del Estado…” (El subrayado y resaltado no pertenece al original). Lo que se solicita en un “Certificado de Origen” no es un permiso o autorización, sino un documento que demuestre que la madera talada proviene de la plantación y por ende está exenta de todo permiso, en este sentido inclusive el mismo Ministerio Público en la circular 01-2005, denominada Política de Persecución Penal Ambiental, indica lo relativo al certificado de origen que: “Este documento está expresamente establecido por la ley como indispensable para movilizar madera proveniente de plantación y su ausencia constituye el delito de transporte ilegal.” Por consiguiente, esta Sala no comparte el criterio otorgado por el Tribunal de Apelación, cuando este pretende interpretar la acusación, para determinar que es con la solicitud de este certificado de origen, que se realiza la corta de árboles de forma inmediata y así subsanar la falencia encontrada en la pieza acusatoria.

Ya que cuando se ha finalizado el procedimiento preparatorio, el órgano requirente, decidiéndose por el planteamiento de una acusación, la presenta en forma deficiente en aspectos, ya no eminentemente formales o materiales, sino referidos al fondo de la articulación, es decir sobre condiciones sustanciales y necesarias para que esa pieza sea admisible, en respeto a los derechos fundamentales del justiciable, quien dentro de un sistema acusatorio como el nuestro, tiene derecho a conocer en forma amplia y detallada la circunstanciación de los hechos que se le imputan, a efecto de que, en un plano de igualdad pueda desarrollar eficientemente su defensa tanto material como técnica. Ya que del texto de la pieza acusatoria no se indica con la certeza requerida que así se realizó, convierte el razonamiento utilizado por el tribunal de Apelación en una mera especulación, situación que no es permitida en nuestro sistema penal.

El Tribunal de Apelación al realizar esa interpretación lo que pretende es subsanar la pieza acusatoria, violentando su principio de imparcialidad, y respecto a este punto esta sala ha establecido: “imponer una sanción penal, según el cuadro fáctico acusado por parte del Ministerio Público, implicaría variar de oficio, elementos esenciales de la acusación, lo cual determina la violación del principio de imparcialidad y objetividad judicial. Incluso, una variación del cuadro fáctico en tal sentido, implicaría la violación del principio de legalidad, ya que prácticamente, el Tribunal Penal tendría que formular una nueva acusación en fase de juicio, función que por reserva de ley, le corresponde exclusivamente al Ministerio Público. Es claro, que tal situación es absolutamente ilegal e improcedente, y limitaría al imputado el ejercicio de su derecho de defensa en los términos que la Constitución Política y la Ley Penal amparan...” (Resolución número 2008-0069, de las 10:15 horas, del 01 de febrero de 2008, Sala Tercera de la Corte Suprema de Justicia).

Ahora bien, se tiene por establecido que la carencia de una correcta circunstanciación de los hechos en la acusación, produce una clara indefensión a los encartados, más aún en el presente caso, ya que la circunstanciación temporal se da en una instancia posterior, a base de interpretaciones y especulaciones que intentan subsanar la existencia de un vicio de carácter absoluto. Respecto a la interpretación extensiva de la pieza acusatoria, por parte de un Tribunal, se ha establecido: “Ahora bien, otra cosa muy distinta de la anterior es la relativa a la demostración de hechos no incluidos en el requerimiento del Ministerio Público (o del querellante, según el caso). Aquí ya no se está ante el supuesto de la recalificación jurídica, sino que se está en presencia de una extralimitación del marco establecido en la pieza acusatoria. Este exceso, como regla, acarrea un defecto absoluto de la sentencia (ver párrafo primero del artículo 365 del Código Procesal Penal).

Sin embargo, legalmente (mismo texto legal de cita) sería admisible esa extralimitación, pero sólo cuando con ello se beneficie al imputado. Mas, cuando de basarse en hechos no acusados se trata, una condena jamás podría ser considerada una situación más favorable para el encartado, ni siquiera si esta se dicta por un delito menos grave que el enunciado en la acusación (ello implicaría confundir los alcances del párrafo primero con los del segundo, ambos del artículo 365 del Código Procesal Penal, los cuales, como ya se dijo, se refieren a cosas distintas). En nada se beneficia al imputado si se tienen por acreditados hechos no acusados, si ello se hace para sustentar una condena. Esto porque tal proceder equivaldría condenar a una persona sobre la base de cualquier cosa menos la acusación (o, lo que es lo mismo, se sanciona a una persona sin habérsele acusado previamente), lo cual es ilegítimo por ser violatorio del debido proceso, en el tanto contraviene lo dispuesto en los artículos: 8:2:b y 8:2:c de la Convención Americana sobre Derechos Humanos; 14:3:a y 14:3:b del Pacto Internacional de Derechos Civiles y Políticos; 39 de la Constitución Política; 1, 326 y 365 del Código Procesal Penal.” (Resolución número 2005-01136, de las 10:10 horas, del 30 de setiembre de 2005, Sala Tercera de la Corte Suprema de Justicia).

Los argumentos expuestos nos permiten concluir que en la causa examinada, donde se arribó hasta la etapa de juicio culminando con una sentencia condenatoria contra de Rigoberto Calderón Chinchilla y Fabio Cordero Céspedes, como autores responsables del delito de Infracción a la Ley Forestal cometido en perjuicio del Estado, tal y como lo expuso la defensa técnica de los incriminados en esta impugnación. Desde la etapa intermedia se produjo una actividad procesal defectuosa, resuelta en perjuicio de los intereses de sus patrocinados, en flagrante violación a sus garantías fundamentales atinentes al debido proceso y el derecho de defensa, toda vez que el Ministerio Público formuló una acusación defectuosa que no contenía una adecuada circunstanciación de los hechos imputados, según se ha señalado. La indeterminación temporal del hecho constitutivo del ilícito imputado, por ser un error esencial, no permitiría la ampliación de la pieza acusatoria, conforme a los presupuestos establecidos en el numeral 347 del Código Procesal Penal, que prevé tal posibilidad cuando se requiera la inclusión de un hecho nuevo o una nueva circunstanciación que no haya sido mencionada en la acusación o la querella, que modifique la calificación legal o integre un delito continuado, presupuestos que no se cumplen en el asunto examinado, en el tanto la corrección habría versado sobre un hecho concreto, esencial, constitutivo del delito atribuido.

Por ello, no obstante que el motivo de casación invocado se refiere a la inobservancia y violación de normas procesales, dadas las circunstancias que rodean el hecho, deviene en ociosa la devolución de los autos a su oficina de origen ordenando un juicio de reenvío; consecuentemente, por razones de economía procesal, entra esta Sala a resolver el fondo del asunto, declarando con lugar el recurso interpuesto, de modo tal que al quedar subsistente la acusación formulada por la Fiscal de Pococí, la Licenciada Giselle Bermúdez Huette, visible a folios 89 a 93, la que no contiene una relación precisa y circunstanciada del hecho punible atribuido a los imputados conforme a los presupuestos establecidos en el citado artículo 303, y sin que sea admisible devolver los autos a momentos procesales finalizados, se acoge el reclamo interpuesto y se absuelve de toda pena y responsabilidad a Rigoberto Calderón Chinchilla y Fabio Cordero Céspedes como autores responsables del delito de Infracción a la Ley Forestal cometido en perjuicio del Estado. En lo relativo a los aspectos civiles, al no ser objeto del presente recurso, se mantiene incólume lo resuelto en sentencia.

Por Tanto:

Se declara con lugar el recurso de casación interpuesto por el defensor público el licenciado José Salazar Monge. Por economía procesal, se procede en esta instancia a absolver de toda pena y responsabilidad a Rigoberto Calderón Chinchilla y Fabio Cordero Céspedes del delito de Infracción a la Ley Forestal que les fue atribuido en perjuicio del Estado. En lo relativo a los aspectos civiles, al no ser objeto del presente recurso, se mantiene incólume lo resuelto en sentencia. Notifíquese.
