Document Review Decision No.: 2024-00058 SALA DE CASACIÓN PENAL. San José, at fourteen hours and forty-two minutes on dieciocho de enero de dos mil veinticuatro.

Appeal in cassation (recurso de casación) filed in the present proceedings against [Nombre 006], a Costa Rican national, identity card [Valor 002], born on 04 de abril de 1962, daughter of [Nombre 001] and [Nombre 002], and [Nombre 007], a Costa Rican national, identity card [Valor 004], born on 18 de julio de 1959, daughter of [Nombre 001] and [Nombre 002], for the offense of violating the Ley Forestal (infracción a la ley forestal), committed to the detriment of the Natural Resources. Magistrates Patricia Solano Castro, Jesús Alberto Ramírez Quirós, Gerardo Rubén Alfaro Vargas, Sandra Eugenia Zúñiga Morales, and Rafael Segura Bonilla, the latter serving as an alternate Magistrate, participated in deciding the appeal. Also appearing at this stage was attorney Kasandra Mora Salguero, as representative of the Procuraduria General de la República. Attorney Rodrigo Rosales Arce appeared as representative of both the civil plaintiff (actora civil) and the civil defendant (demandada civil).

Findings:

  1. 1By judgment N° 2022-1794 at 14:35 on 13 de diciembre de 2022, the Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José, Goicoechea, ruled: “POR TANTO: For reasons other than those stated, the appeal filed by counsel for the civil defendant is granted, and the challenged judgment is reversed insofar as it: i) ordered the mayor of Santa Ana to demolish the house built on the property owned by [Nombre 007] and remove the debris; ii) directed that the decision be served personally on the aforementioned mayor and warned him that, if he failed to comply with the order, certified records would be forwarded for prosecution for the offense of disobedience to authority (desobediencia a la autoridad). In its place, the court, on its own motion, declares that it lacks subject-matter jurisdiction (incompetencia material) to hear the claim filed by the Procuraduría General de la República and refrains from ruling on it.This party to the proceedings shall, if it deems appropriate, take the corresponding steps so that the issue of the nullity of the administrative acts involved and the requested demolition may be litigated before the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa). Considerations:

I.By decision Nº 2023-00452, issued at 10:11 on 19 de mayo del 2023, appearing on the front of folios 873 through 877 of Volume II of the principal case file, this Chamber admitted for consideration on the merits the two grounds of the appeal in cassation filed by attorney Kasandra Mora Salguero, Criminal State Attorney (Procuradora Penal), acting on behalf of the State as private prosecutor (querellante) and civil plaintiff (folios 848 through 851), against decision N° 2022-1794, issued by the Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José at 14:35 on 13 de diciembre de 2022, as recorded at folios 827 through 844, which ordered as follows: “For reasons other than those stated, the appeal filed by counsel for the civil defendant is granted, and the challenged judgment is reversed insofar as it: 1) ordered the mayor of Santa Ana to demolish the house built on the property owned by [Nombre 007] and remove the debris; ii) directed that the decision be served personally on the aforementioned mayor and warned him that, if he failed to comply with the order, certified records would be forwarded for prosecution for the offense of disobedience to authority.

In its place, the court, on its own motion, declares that it lacks subject-matter jurisdiction to hear the claim filed by the Procuraduría General de la República and refrains from ruling on it. This party to the proceedings shall, if it deems appropriate, take the corresponding steps so that the issue of the nullity of the administrative acts involved and the requested demolition may be litigated before the contentious-administrative jurisdiction. II.The oral and public hearing convened at the request of civil defendant [Nombre 007] was held—as recorded on the front and reverse of folio 893 of Volume II of the principal case file, as well as in the corresponding digital-file recording—on 8 de junio de 2023, in the Sala de Vistas located on the second floor of the Corte Suprema de Justicia building, with the parties present, as well as the Magistrates participating in the decision on the merits of this matter. At the oral hearing, no taking of evidence (evacuación de prueba) was requested, and the parties confined themselves to presenting a summary of the claims raised in the appeal and the response they had submitted in writing.

III.In the first ground for cassation, the appellant alleges a lack of reasoning and failure to apply the procedural rules established in Articles 140 and 366 of the Code of Criminal Procedure, in relation to Article 103 of the Criminal Code. By way of introduction, the appellant transcribes a passage from the facts found proven in judgment N° 48-2022, issued at 09:30 hours on 26 de enero de 2022 by the Tribunal Penal del Tercer Circuito Judicial de San José, in which it was established that Ms. [Nombre 006] constructed a dwelling that encroached upon the protection area (área de protección) of the Urracas (Amarilla) spring (naciente), which has a permanent channel and is a tributary of the Río Caraña. She then reproduces a passage from the appellate judgment establishing that Ms. [Nombre 006] had acted in good faith, relying on the permits granted to her by the Public Administration itself for the establishment of a residential development (urbanización) and the construction of a dwelling.

She notes that the appellate court (ad quem) concluded that the trial court had disregarded the principle of the inviolability of administrative acts, as well as the procedure provided by the legal system for their review or annulment—namely, administrative judicial proceedings for a declaration of injury to the public interest (proceso contencioso administrativo de lesividad). She next argues that the second-instance judgment violates Articles 140 and 366 of the Code of Criminal Procedure, as well as Article 103 of the substantive Code, because it fails to rule on the merits of the action based on a premise that was not at issue—lack of subject-matter jurisdiction (incompetencia material)—thereby disregarding the provisions authorizing the civil action and the obligation to restore matters to their prior condition. She considers the appellate court’s interpretation erroneous insofar as the State’s representative validly asserted a civil claim seeking restoration of matters to their prior condition; that is, demolition of the offending structure.

On that basis, she maintains that it is neither appropriate nor lawful to send the interested party (in this case, the civil plaintiff) to another jurisdiction (the administrative courts, through proceedings for a declaration of injury to the public interest), when more than ten years have elapsed since the criminal proceedings began and more than seven years since the civil action for damages (acción civil resarcitoria) was filed. She argues that this line of decision severely infringes the principle of “electa una vía,” under which the State chose the criminal forum to bring its civil claim. She emphasizes that jurisdiction to adjudicate the action was determined when it was filed more than seven years ago and that, in accordance with the right of petition and effective judicial protection, it must be resolved in the criminal courts. She notes that the legal system currently authorizes the pursuit of a civil action in criminal proceedings in accordance with Articles 37, 111, and 112 of the Code of Criminal Procedure and 61.2 of the Code of Civil Procedure, and that courts are required to rule on its merits as a mandatory component of the judgment, whether the judgment is wholly or partially convicting or wholly or partially acquitting.

She criticizes the appellate court for departing from the claims of error raised in the appeal to address, on its own motion and without giving the parties an opportunity to be heard, an issue that had already been procedurally foreclosed, deciding to refer the State to the administrative courts to institute proceedings for a declaration of injury to the public interest, even though such proceedings must be instituted by the administrative body that issued the purported administrative acts; namely, the Municipalidad de Santa Ana. She criticizes the appellate court’s reasoning that the Procuraduría General de la República is not authorized to request demolition of the structure, because this runs counter to the State’s authority to defend and guarantee the right to a healthy environment for the benefit of the community pursuant to Article 50 of the Constitution. She argues that this restriction is novel, is incongruous because it is “ultra petita,” and also disregards decisions 114-2019, issued at 14:30 hours on 25 de enero de 2019, and 2301-2019, issued at 09:45 hours on 19 de diciembre de 2019, by the Tribunal de Apelación de Sentencia del Segundo Circuito Judicial de San José itself, which, sitting in different compositions in this same case, ordered that the claim be decided on its merits.

She summarizes her argument by stating that the appellate court’s judgment is fallacious and fails to satisfy the duties of reasoning and congruence, thereby violating Article 140 of the Code of Criminal Procedure; and that, by failing to decide her action, it violates Articles 366 ibid.; 103, 122, and 123 of the Criminal Code; and 98 and 101 of the Ley Orgánica del Ambiente, because the environmental damage was not remedied. As the harm alleged, she states that the appellate court annulled and dismissed the civil claim upon declaring that it lacked subject-matter jurisdiction, thereby failing to apply several provisions of the legal system and causing harm to the State and, consequently, to the environment. As relief, she requests that the appeal be granted and that matters be restored to their prior condition within a reasonable period for removal of the structures located within the protection area or, alternatively, that the challenged decision be annulled and the case remanded for new proceedings.

The claim is denied. In this matter, the discussion will focus on determining whether it is legally valid for a Tribunal de Apelación de Sentencia Penal, acting on its own motion and after it had been established that the Municipality granted a person both the land-use permit (permiso de uso de suelo) and the permit to construct a dwelling in an area apparently subject to protection, to declare that it lacks subject-matter jurisdiction to hear the request made by the Procuraduría General de la República for restoration of matters to their original condition (demolition of the dwelling), referring that party to take such action as it may deem appropriate so that the nullity of the administrative acts involved and the requested demolition may be litigated in the administrative courts. To answer this question, the background leading to the issuance of the decision challenged here will first be set out; next, the position adopted by the Tribunal de Apelación de Sentencia del Penal del Segundo Circuito Judicial de San José in decision N° 2022-1794 (challenged here); and, finally, the arguments leading this Chamber to deny the cassation appeal filed by the representative of the Procuraduría General de la República.

A. Background of the specific case. In this case, by oral judgment N°1009-2018, issued at 13:13 hours on 17 de agosto de 2018, the Tribunal Penal del Tercer Circuito Judicial de San José, sede Suroeste, Pavas, acquitted the defendants [Nombre 006] and [Nombre 007], with certainty, of all punishment and liability for the offense of Infracción a la Ley Forestal, to the detriment of natural resources; it also denied the civil action for damages and absolved the State from payment of procedural costs and attorneys’ fees because there was a plausible basis for litigation; finally, it ordered that the costs of the private prosecution (querella) be borne by the State (folios 421 to 424 of volume I of the main case file). This decision was challenged by the representative of the Procuraduría General de la República (folios 425 to 438 of volume I of the main case file), whereupon the Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José issued decision number 2019-0114 at 14:30 hours on 25 de enero de 2019, ordering as follows: “The appeal filed by attorney Kasandra Mora Salguero, in her capacity as representative of the Procuraduría General de la República, is granted and, consequently, the judgment is partially annulled solely as to the request to restore matters to the condition in which they stood before the act, and a retrial upon remand (juicio de reenvío) is ordered before the same Tribunal, sitting with a different composition, so that it may rule as provided by law as promptly as possible.

The judgment remains undisturbed in all other respects” (folios 460 front to 466 of volume I of the main case file). With this decision, the criminal acquittal of Ms. [Nombre 006] and Ms. [Nombre 007] became final. By judgment N° 587-2019, issued at 14:23 hours on 23 de mayo de 2019, the Tribunal Penal del Tercer Circuito Judicial de San José, sede Suroeste, Pavas, denied the request to restore matters to their original condition and resolved the proceedings upon remand without a specific award of costs (folios 499 front to 511 of volume I of the main case file). This judgment was appealed by the representative of the Procuraduría General de la República (folios 517 to 540 of volume I of the main case file), resulting in judgment N° 2019-2301, issued at 09:45 hours on 19 de diciembre de 2019 by the Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José, which ruled: “The three grounds contained in the appeal filed by attorney Kasandra Mora Salguero, as representative of the Procuraduría General de la República, are (sic) granted.

The judgment under appeal is annulled in its entirety. A retrial upon remand is ordered, in which it must be determined whether the measure sought by the Procuraduría General de la República should be applied. Because it is unnecessary, no ruling is made on the fourth ground of appeal” (folios 583 front to 591 reverse of volume I of the main case file). Following the ordered remand, by judgment N° 048-2022, issued at 09:30 hours on 26 de enero de 2022, the Tribunal Penal del Tercer Circuito Judicial de San José, Sede Puriscal, held: “RESTORATION OF MATTERS TO THEIR ORIGINAL CONDITION, as requested by the Procuraduría General de la Republica, IS ORDERED; a period of three months from the date this judgment becomes final is established for the Mayor of the Municipalidad de Santa Ana to carry out the demolition of the house constructed on property 1-607385-000, specifically lot 92, owned by Ms. [Nombre 007], and to remove the debris; before demolition, it must be verified that the house at the site corresponds to the one identified in these proceedings.

The Alcalde Municipal de Santa Ana must be personally served with this judgment. If this order is not complied with, certified copies shall be forwarded for prosecution of the offense of 3 Disobedience of Authority. The proceedings upon remand are resolved without a specific award of costs” (folios 754 front to 766 reverse of Volume II of the main case file). B. Position adopted by the Tribunal de Apelación de Sentencia del Penal del Segundo Circuito Judicial de San José in the decision challenged here (voto N° 2022-1794). In judgment N° 2022-1794, the Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José (hearing the appeal filed by civil defendant [Nombre 007], appearing at folios 767 to 782 of volume II of the main case file) explained that it had been proven in this matter that, in the year 2012, a 135-square-meter dwelling was constructed on property registered in the San José registry district under real property folio number 1-607385-000, belonging to [Nombre 007] (the sole civil defendant), and that, in the ordered proceedings upon remand, the issue was whether the dwelling encroached upon the protection area of either of the two springs in the sector (the defendants’ acquittal with certainty had already become final), for which it was necessary to determine whether they were permanent or temporary, since the size of the protection area depends on that determination (the trial court (a quo) concluded that it was permanent and ordered demolition of the property).

Having provided that preamble, the appellate judges held: “…Now, this Chamber notes that the court overlooked a fact of the utmost importance that emerges from the evidence examined (and that, without including it under the heading of proven facts, it did consider in the intellectual reasoning of the judgment, specifically, on the front of folio 766), namely, that the Municipalidad de Santa Ana granted the corresponding permits, both for land use and construction (cf. ff. 117 to 119, years 2010 and 2011. See also the permits granted to [Nombre 006], f. 97 et seq.). It should be noted here that the property is one of those comprising the Urbanización Hacienda Paraíso, created years earlier, whose plan (which was approved by the INVU) also received the endorsement of the municipal entity, to such an extent that construction permits were subsequently granted at that location (cf. ff. 18, 97 to 120 of volume I).

From the foregoing, it is clear that the civil defendant [Nombre 007] acted (as did her sister Sonia) in good faith, relying on the permits granted by the Public Administration itself, first for the establishment of the aforementioned residential development and later for the construction of a dwelling on the property purchased by Ms. [Nombre 007] in the year 2010 (cited f. 18). In other words (and unlike what usually occurs in most cases involving encroachment upon conservation or protection areas), several administrative acts (actos administrativos) were issued in favor of the person who now appears as the civil defendant, which first the Procuraduría General de la República and then the court seek to disregard by ordering the demolition of the dwelling, in violation of the principle of the inviolability of administrative acts (principio de intangibilidad de los actos) and the procedure provided by the Costa Rican legal system for reviewing or annulling them, namely, the administrative judicial action for annulment on grounds of harm to the public interest (proceso contencioso administrativo de lesividad)…” (folios 838 verso to 839 recto).

In support of its decision, the Court of Appeals quoted—in extenso—several excerpts from two decisions of the Tribunal Contencioso Administrativo referring to actions for annulment on grounds of harm to the public interest (procesos de lesividad). In that regard, the ad quem court stated: “…Regarding this action, the Sixth Section of the Tribunal Contencioso Administrativo of the Segundo Circuito Judicial de San José stated the following in judgment number 134-2021-VI: “Generally speaking, annulment on grounds of harm to the public interest (lesividad) constitutes a judicial mechanism whereby the Administration seeks the revocation of one of its own final acts which, in principle, produces a favorable effect for a third-party addressee. From that perspective, in disputes of this kind, annulment on grounds of harm to the public interest is subjective in nature, insofar as it seeks the annulment of conduct that grants a right or, generally, a beneficial status to a person.

Although the validity of specific (rather than general) public conduct having favorable content is examined, such review requires the participation of its addressee so that the addressee may exercise the right of defense and adversarial process with respect to claims seeking to alter the addressee’s legal status. This mechanism is codified in provision 34 of the Código Procesal Contencioso Administrativo, which establishes its prerequisites and procedural regulations. It is also referenced, however, in paragraph 173.6 in relation to (sic) 183 of the Ley General de la Administración Pública. From the standpoint of procedural prerequisites (presupuestos procesales), subjective, objective, procedural, and temporal conditions are imposed. Regarding the subjective aspect, standing to bring the action (legitimación activa) is granted to the Administration that issued the challenged act, while the party with standing to be sued (legitimado pasivo) is the recipient of the effects of the conduct, that is, the person who benefits from it.

Regarding the objective aspect, annulment on grounds of harm to the public interest constitutes a mechanism for the legal elimination of individual administrative acts that are final and favorable but substantially inconsistent with the legal system, that is, acts affected by absolute invalidity (invalidez de grado absoluto) (articles 128, 158, 165, and related provisions of the aforementioned Ley General No. 6227). Accordingly, the Administration must declare that conduct harmful to the public interest, which must be established within a framework of internal actions by the Administration that cannot be postponed before the action is filed. Indeed, procedurally, the highest-ranking superior authority of the respective Public Administration must declare the act harmful, whether because it impairs economic, fiscal, or other interests arising from the public interest. This must be done through proper reasoning setting forth the grounds supporting those considerations, for which purpose it may rely on an underlying legal and technical opinion supporting that determination.

Unlike other mechanisms for eliminating public conduct (such as ex officio annulment (nulidad oficiosa) provided for in article 173 LGAP), it does not require a hearing for the third party, but only internal actions within the Administration intended to verify the express existence of administrative intent issued by the highest-ranking authority to seek the elimination of the act. It is during the judicial proceeding that the third party may present arguments in defense. However, when the act originates from the State (see art. 1 Ley General), that is, from the Central Administration, the action may be filed only by the Procuraduría General de la República (provision 16 of Ley No. 8508), following a request by the highest-ranking superior authority and an internal declaration that the act is harmful to the public interest, detailing the grounds for that determination. Such representation is also required in the case of acts of the Poder Judicial issued in the exercise of its administrative function, such as acts issued by the Consejo Superior, which must be declared harmful to the public interest by the Corte Plena.

When the act originates from a public entity, the rules governing legal representation are those set forth in provision 17 of the same code. As to the temporal dimension, the new procedural legislation establishes a period of one year, calculated from the business day following issuance (not notification), within which the act must be administratively declared harmful to the public interest. The foregoing does not apply where the act is affected by absolute nullity (nulidad absoluta), in which case, pursuant to provision 34.1 of the CPCA, that internal declaration may be made for as long as the effects of the act continue. In that event, the year is calculated from the cessation of its effects, and any judgment declaring its nullity shall do so solely for purposes of annulling the conduct and rendering it inapplicable in the future. Following that declaration (and not from the expiration of that first year), a period of one year is granted to file the administrative judicial action, as a mandatory limitations period (plazo fatal de caducidad), pursuant to article 39 of the Código Procesal Contencioso Administrativo.

The exception applies to the protection of public-domain property (dominio público), in which case the action for annulment on grounds of harm to the public interest is not subject to a time limit because of the general rule that such property is not subject to prescription (imprescriptibilidad), as follows from provision 261 of the Código Civil; consequently, neither the declaration that the act is harmful to the public interest nor the filing of the corresponding judicial action is time-barred.” (emphasis in the original). The Seventh Section of that same court, in judgment 081-2021-VII at 8:00 hours on August 31, 2021, states the following on the subject: “VI.- REGARDING ACTIONS FOR ANNULMENT ON GROUNDS OF HARM TO THE PUBLIC INTEREST IN GENERAL. As a starting point, it must be emphasized that, generally speaking, an action for annulment on grounds of harm to the public interest is a judicial mechanism through which the ordinary legislature authorized Public Administrations to bring claims for annulment (pretensiones anulatorias) concerning acts issued by them that confer subjective rights (derechos subjetivos).

In judicial proceedings of this kind, the validity of specific formal conduct that has generated subjective rights in favor of an administered party (administrado)—a natural or legal person—is examined. It is precisely for this reason that the participation of the addressee of the act whose nullity is sought is mandatory, in order to guarantee not only adversarial proceedings but also the timely exercise of the right of defense. In our legal system, article 34 of the Código Procesal Contencioso Administrativo—CPCA—is the provision establishing the prerequisites and procedural regulations for this mechanism; nevertheless, that provision must be read together with paragraphs 173.6 and 183, both of the Ley General de la Administración Pública—LGAP—in order to obtain a complete understanding of the matter under consideration. A harmonious reading of those provisions leads to the conclusion that, in proceedings of this kind, standing to bring the action is granted to the Administration that issued the challenged act, while the party with standing to be sued is the administered party to whom the effects of that formal conduct are addressed.

This is so because, as indicated above, annulment on grounds of harm to the public interest constitutes an instrument for the legal elimination of specific administrative acts creating subjective rights, insofar as those acts are substantially inconsistent with the legal system—acts affected by absolute or relative nullity (nulidad relativa)—(articles 128, 158, 165, and related provisions of the LGAP). Thus, an action for annulment on grounds of harm to the public interest constitutes an additional safeguard for the administered party, whereby, pursuant to the principle of the inviolability of the Administration’s own acts (principio de intangibilidad de los actos propios), the Administration may not itself eliminate the effects of an act conferring subjective rights; rather, such acts generating rights may be eliminated only through this proceeding and by a court, independently of the Administration that issued the act whose annulment is sought because it is harmful to the public interest.” (Emphasis added)…” (folios 839 recto to 840 verso).

According to the Tribunal de Apelación, in the present matter it is not appropriate to order the demolition of the property until the nullity of the administrative acts issued for the benefit of Ms. [Nombre 007], whose effects remain in force to date, has been adjudicated and, if warranted, declared. On this point, it held: “…the Ley General de Administración Pública provides, as a general rule, that the Administration is liable to administered parties for its actions, whether lawful or unlawful (arts. 191 and 194 LGAP); that is, it has a duty to provide compensation, especially in cases such as the present one, where construction of the dwelling in question had the corresponding permits issued by the municipality, the entity empowered to oversee such private-party processes or investments. Furthermore, although it is true that the Ley General de Administración Pública provides that the absolute nullity of an act may be declared through administrative proceedings, without the need to resort to an administrative judicial action for annulment on grounds of harm to the public interest, it is also clear in stating that this is permissible only in cases of evident and manifest nullity (nulidades evidentes y manifiestas) (art. 173 subsection 1), which prima facie may be ruled out in this matter because, although three trials have been held, two of them concerning whether the spring (naciente) involved is (and was, when construction took place) permanent or intermittent, the size of the protection area (which depends on the foregoing issue), and the location of the property in relation to that area, the matter still has not been clarified with precision…” (folio 840 verso).

The Appellate Court (Tribunal de Alzada) proceeded to transcribe several excerpts from Sala Constitucional resolution N° 2002-09239 of 11:02 hours, dated 20 de setiembre de 2002 (reiterated in decision N° 2010-9077, of 08:36 hours, dated 21 de mayo de 2010), emphasizing that the general rule is that the respective public administration may not annul an act conferring rights (acto declaratorio de derechos) upon the administered party (administrado) (the nullity that justifies ex officio review (revisión de oficio), as a qualified exception to the doctrine of the irrevocability of the administration’s own acts favorable to the administered party (inderogabilidad de los actos propios y favorables para el administrado), or the principle of the inviolability of the administration’s own acts (intangibilidad de los actos propios), must be of such significance and magnitude that, pursuant to numeral 173, paragraph 1°, of the Ley General de la Administración Pública, it must be “evident and manifest” (evidente y manifiesta)); therefore, as a general principle, the public administration must bring an action, as plaintiff and after declaring the act adverse to public, economic, or other interests (declaratoria de lesividad), through judicial proceedings for annulment of an adverse act (proceso jurisdiccional de lesividad).

With respect to absolute nullity in administrative proceedings (nulidad absoluta en sede administrativa), as well as the declaration of adverse effect, the court below (ad quem) stated: “…both absolute nullity in administrative proceedings and the declaration of adverse effect that must precede the complaint before the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa) are not matters within the authority of the Procuraduría General de la República, but rather of the corresponding administration, subject to the following rules: “Article 173.-

  • 1)When the absolute nullity of an act conferring rights is evident and manifest, it may be declared by the Administration through administrative proceedings, without the need to resort to contentious-administrative proceedings for annulment of an adverse act, as provided for in the Código Procesal Contencioso-Administrativo, following a favorable opinion from the Procuraduría General de la República; this opinion is mandatory and binding. When the absolute nullity concerns administrative acts directly related to the budgetary process or administrative procurement, the Contraloría General de la República shall issue the opinion. In both cases, the respective opinions must expressly address the absolute, evident, and manifest nature of the alleged nullity.
  • 2)In the case of the State’s central Administration, the minister responsible for the sector that issued the respective act shall declare the nullity. In the case of other public entities or Branches of Government, it shall be declared by the highest body in the administrative hierarchy. A motion for reversal or reconsideration (recurso de reposición o de reconsideración) may be filed against the decision, under the terms of the Código Procesal Contencioso-Administrativo.
  • 3)Before issuing the final act annulling the acts referred to in this article, the Administration shall grant a hearing to the parties involved and comply with the ordinary administrative procedure (procedimiento administrativo ordinario) established in this Law.
  • 4)The power of ex officio review established in this article shall lapse one year after the act is adopted, unless its effects continue.
  • 5)The administrative annulment of an act in contravention of this article, whether because the prescribed formalities were omitted or because the nullity is not absolute, evident, and manifest, shall be absolutely null, and the Administration shall also be required to pay damages, losses, and costs, without prejudice to the personal liability of the public servant responsible, in accordance with the second paragraph of article 199.
  • 6)In cases where the issuance of the administrative act affected by absolute, evident, and manifest nullity is attributable to two or more ministries, or where the declaration of nullity concerns interrelated administrative acts issued by different bodies, the provisions of subsection d) of article 26 of this Law shall apply.
  • 7)A claim seeking annulment of an adverse act (pretensión de lesividad) may not be brought by way of counterclaim.” (art. 173, LGAP, emphasis added). “Article 34.-
  • 1)When the Administration itself, as the author of an act conferring rights, seeks to bring an action for its annulment before the Jurisdicción Contencioso-Administrativa, the highest hierarchical authority must first declare it adverse to public, economic, or any other interests. The maximum period for doing so shall be one year, calculated from the day following the date on which it was issued, except where the act contains defects of absolute nullity, in which case such a declaration may be made for as long as its effects continue. In the latter situation, the one-year period shall run from the date on which its effects cease, and the judgment declaring nullity shall do so solely for purposes of its annulment and future inapplicability.
  • 2)A declaration of adverse effect concerning the protection of public-domain property (bienes del dominio público) shall not be subject to any time limit.
  • 3)The Consejo de Gobierno shall be responsible for declaring adverse the administrative acts issued by two or more ministries, or by such ministries together with a decentralized entity. In such cases, they may not be declared adverse by a minister from a different sector.
  • 4)The declaration of adverse effect regarding acts issued by administrative bodies with instrumental legal personality (personalidad jurídica instrumental) shall be made by the highest hierarchical authority.
  • 5)A claim seeking annulment of an adverse act may not be brought by way of counterclaim.” (art. 34, Código Procesal Contencioso-Administrativo, emphasis added)…” (folios 842, front and back). In reaching its decision in the specific case, the Tribunal de Apelación concluded: “…even if this court were to disregard the fact that the Asamblea Legislativa has not granted the criminal courts jurisdiction to revoke administrative acts to the detriment of a person’s subjective rights (derechos subjetivos) (at least not as occurred here, after the commission of a crime had been ruled out in a final judgment, namely number 1009-2018, in which both Guiselle and her sister Sonia, both [Nombre 006], were acquitted), it likewise could not overlook the fact that the Procuraduría General de la República is not empowered to request the demolition of the structure, which in any event—it bears repeating—would be plausible only after the competent judicial authority had declared null the municipal acts that granted rights to [Nombre 007]. In other words, Attorney Mora Salguero cannot disregard the procedure mentioned supra and seek to have a criminal court, by ordering the demolition, tacitly declare said nullity, particularly when a decision of such magnitude could affect third parties who have also built their homes in reliance upon those acts, such as the act approving the subdivision plan. For all the foregoing reasons, this court grants the appeal filed by counsel for the civil defendant and reverses the judgment under appeal solely insofar as it: i) ordered the mayor of Santa Ana to demolish the house built on the property owned by [Nombre 007] and remove the debris; ii) ordered that the decision be served personally on the aforementioned mayor and warned him that, should he fail to comply with the order, certified records would be transmitted for prosecution for the offense of disobedience to authority. In its place, the court, on its own motion, declares that it lacks subject-matter jurisdiction (incompetencia material) to hear the claim filed by the Procuraduría General de la República and makes no ruling on it, while maintaining the ruling that neither party shall be ordered to pay costs because there was a reasonable basis for litigation, although not in this forum. That party shall, if it deems appropriate, pursue the corresponding proceedings so that the issue of the nullity of the administrative acts involved and the requested demolition may be litigated before the contentious-administrative jurisdiction…” (folios 842, front and back). C. Arguments leading this Chamber to deny the first ground of the appeal on points of law (recurso de casación) filed by the representative of the Procuraduría General de la República. In the view of this Sala, the decision issued by the Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José through resolution N° 2022-1794 is consistent with the law. That ruling granted the appeal filed by counsel for the civil defendant (for reasons different from those alleged) and, consequently, ordered the reversal of judgment N° 048-2022 of the Tribunal Penal del Tercer Circuito Judicial de San José, sede Puriscal, insofar as it: i) ordered the mayor of Santa Ana to demolish the house built on the property owned by [Nombre 007] and remove the debris; ii) ordered that the decision be served personally on the aforementioned mayor, warning him that, should he fail to comply with the order, certified records would be transmitted for prosecution for the offense of disobedience to authority. As an initial matter, it should be clarified that the ruling of the ad quem in this particular case is consistent with the powers granted to it by law. Numeral 465 of the Código Procesal Penal provides: “Admissibility of the appeal. An appeal against a judgment shall permit a comprehensive review of the decision when the interested party alleges disagreement with the determination of the facts, the admission and assessment of evidence, the legal reasoning, or the determination of the sentence. The appellate court shall rule on the points expressly challenged, but shall declare, even on its own motion, any absolute defects and violations of due process (debido proceso) that it identifies in the judgment.” Consistent with the foregoing, article 465 of that same body of law states: “Review and decision. The appellate court reviewing the judgment shall assess the merits of the claims raised in the appeal and their grounds, so that it may evaluate the manner in which the trial judges assessed the evidence and supported their decision. It shall use the records available to it, reproduce the oral evidence from the trial when it deems this necessary, relevant, and useful to decide the claim, and conduct the corresponding comprehensive assessment together with the remaining proceedings and the evidence submitted in writing. If the appellate court finds the appeal meritorious, it shall annul the challenged decision in whole or in part and order a retrial or the issuance of a new decision. When the annulment is partial, the specific subject matter of the new trial or decision shall be stated. In all other cases, it shall correct the defect and decide the matter in accordance with the applicable law…”. In examining these provisions, this Chamber has stated on other occasions: “…Based on a joint analysis of both provisions, it is clear that the judges of the second instance, in addition to having jurisdiction to annul the challenged judgment in whole or in part and thereby order remand proceedings (juicio de reenvío), may also directly correct the defect and decide the matter in accordance with the applicable law…” (Sala de Casación Penal, resolution N° 2023-00087, of 10:09 hours, dated 26 de enero de 2023; composed of Solano, Ramírez, Alfaro, Zúñiga, and Segura). It bears noting at the outset that a review of the decision issued by the Tribunal de Alzada, far from revealing the prejudice alleged by the appellant, confirms that the ruling is based on the systematic application of legal provisions contained in the Ley General de la Administración Pública and the Código Procesal Contencioso Administrativo, in accordance with the constitutional principle of due process. It is therefore apparent that the Tribunal de Apelación conducted a comprehensive review, addressing the legal reasoning coherently and sufficiently; consequently, it cannot be concluded that it exceeded its powers by deciding the merits of the present matter. It must be borne in mind that, although restoration of matters to their prior state (restitución de las cosas al estado anterior) may be ordered on the court’s own motion, this does not mean that it must always be granted (as the appellant appears to understand).

Although, in this particular case, the State’s representative (Procuraduría General de la República) asserted a claim for restoration to the prior state (restitución de las cosas al estado anterior), we do not agree with the appellant on cassation’s assertion that referring the interested party to another jurisdiction (administrative litigation jurisdiction (jurisdicción contenciosa administrativa)) to institute a judicial proceeding for annulment of an act detrimental to the public interest (proceso jurisdiccional de lesividad) is contrary to law. Contrary to the argument advanced by the señora Procuradora, the fact that the Court of Appeal did not grant her claim for restoration to the prior state (demolition of the dwelling and removal of the debris) in no way implies that it thereby violated the provisions of Articles 103 of the Criminal Code and 140 and 366 of the Code of Criminal Procedure, since the General Law on Public Administration (Ley General de la Administración Pública, LGAP) and the Code of Administrative Litigation Procedure contain statutory provisions that, given the course of the events that occurred, prevail in this particular case.

The LGAP establishes that the Administration is liable to those subject to its authority “…for all damage caused by its lawful or unlawful, normal or abnormal operation, except in cases of force majeure, fault of the victim, or an act of a third party…” (Article 190, subsection 1); and must compensate “…all damage caused to the subjective rights (derechos subjetivos) of others by wrongful acts of its public servants committed in the performance of their official duties or in connection therewith…” (Article 191). Likewise, the Administration is liable “…for its lawful acts and its normal operation when they cause special harm to the rights of an individual subject to the Administration, due to the small proportion of persons affected or the exceptional severity of the injury…” (Article 194, subsection 1). Although the LGAP provides that the absolute nullity (nulidad absoluta) of an act may be declared in administrative proceedings without resorting to an administrative litigation proceeding for annulment of an act detrimental to the public interest, it clearly establishes that this is permissible only in cases of evident and manifest nullity (Article 173, subsection 1), which, prima facie, has been ruled out in this matter, because it was established that, prior to construction of the dwelling, the respective land-use and construction permits were requested and issued by the Municipalidad de Santa Ana.

By oral judgment N°1009-2018, at 13:13, on August 17, 2018, the Tribunal Penal del Tercer Circuito Judicial de San José, sede Suroeste, Pavas, acquitted [Nombre 006] and [Nombre 007], with certainty, of all punishment and liability for the offense of Violation of the Ley Forestal, a decision that—as regards the criminal offense—became final in 2018. On that occasion, when issuing that judgment, the judge of the Tribunal Penal who acquitted señoras Argüello Venegas reasoned: “…Now then, in the case of doña Guiselle, doña Guiselle is clear and unequivocal; at no time does she deny having carried out the construction, nor does she attempt to conceal that situation, and she states: I build under the protection of the law; I build with the appropriate permits. The State was the entity that had to grant me the permits through the municipal authority, and that is what I do; the engineer begins construction exactly as I hired him to do, exactly as I am authorized to do, and I do it; even as of the date on which I begin the work, I have not even been notified, nor am I notified of any irregularity after the work is completed…” ( ) “…don [Nombre 005] himself was very clear that he is the person responsible for the matter of the municipal permits, and he comes before us and clarifies the issue, explaining that, in doña Guiselle’s case, she definitely did have them, as he understood it, because initially he told us that he did not know whether she had been granted the permits, but later he said that she had indeed been granted the construction permit, because her land-use permit had not even been made subject to conditions, and that if her land-use permit had been made subject to conditions, she would not have been granted the construction permits.

Don [Nombre 005] even elaborated for us on whether the Municipalidad would have become aware of this situation, and it was precisely because of a construction project; accordingly, we have no doubt—I personally have no doubt—that doña Guiselle built with permits. And why? Because don [Nombre 005] is very clear and unequivocal in telling us that when doña Sonia builds, her land-use permit is neither denied nor restricted and that, even by the date on which doña Sonia completes that construction, the Municipalidad was not aware that the spring (naciente) was located there or that certain areas or properties might be encroaching upon the protection area (área de protección). Had it not been for señor [Nombre 004], he would not have begun the inquiries and this entire situation would not have commenced. Thus, he is clear that the permits granted both to doña Guiselle and for any other existing construction at that location were properly granted…” (Digital file 120014210283PE-17082018011227-2_MultiMedia—0 corresponding to the oral judgment, minutes 01:20:15 to 01:21:00 and 01:23:15 to 01:25:10).

Furthermore, after several remands had been ordered (exclusively in connection with the request for restoration to the state existing before the events), the Tribunal Penal del Tercer Circuito Judicial de San José, Sede Puriscal, issued judgment N° 048-2022, at 09:30, on January 26, 2022 (which is precisely the judgment reviewed on appeal by the Tribunal de Apelación in decision N° 2022-1794), which stated: “…The record shows that, for construction of the dwelling in question, señora [Nombre 006] had municipal approvals and permits, so much so that this was one of the grounds on which the Tribunal Penal de Pavas acquitted her with certainty of the offense of Violation of the Ley Forestal with which she had been charged…” (folio 766, front). Regarding this specific issue, the Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José stated in decision N° 2022-1794 (challenged here): “…Now, this chamber notes that the trial court overlooked a fact of the utmost importance that emerges from the evidence examined (and which, although it did not include it in the section on proven facts, it did consider in the court’s evaluative reasoning, specifically at folio 766, front), namely, that the Municipalidad de Santa Ana granted the corresponding permits, both for land use and construction…” (folio 838, reverse).

The position of the representative of the Procuraduría General de la República—that, in the context in which the events occurred, demolition of the dwelling must be ordered in the criminal proceedings (hence her disagreement with the decision of the ad quem)—cannot be accepted. This Chamber agrees with the appellate court that, in a case such as this one, in which it was shown that defendant [Nombre 006] (who was acquitted with certainty in the criminal proceedings) had the construction permits required by the Administration (Municipalidad) to build, the issue of razing or demolishing the dwelling at issue in the litigation must be addressed in the administrative litigation jurisdiction through a proceeding for annulment of an act detrimental to the public interest (which, in addition to the right of defense, guarantees potential compensation to the party harmed by the Administration’s acts), rather than in the criminal jurisdiction.

In this regard, Article 34 of the Code of Administrative Litigation Procedure provides: “…1) When the Administration itself, as the issuer of an act conferring rights, seeks to bring an action for its annulment before the Administrative Litigation Jurisdiction, the supreme hierarchical authority must first declare it detrimental to public, economic, or other interests. The maximum period for doing so shall be one year, counted from the day following that on which it was issued, unless the act contains defects of absolute nullity, in which case that declaration may be made for as long as its effects continue. In the latter case, the one-year period shall run from the time its effects cease, and the judgment declaring its nullity shall do so solely for purposes of its annulment and future inapplicability. 2) A declaration that an act is detrimental insofar as it concerns the protection of public-domain property shall not be subject to any time limit…”.

In relation to proceedings for annulment of an act detrimental to the public interest, the Tribunal Contencioso Administrativo recently stated: “…it is a judicial mechanism through which the ordinary legislature authorized Public Administrations to assert claims seeking annulment of acts issued by them that confer subjective rights. In these types of judicial proceedings, the validity of specific formal conduct is examined which, as stated above, creates subjective rights in favor of a person subject to the Administration—whether a natural person or legal entity. Precisely for that reason, the participation of the addressee of the act whose nullity is sought is mandatory, in order to guarantee not only adversarial proceedings but also the timely exercise of the right of defense. Article 34 of the Code of Administrative Litigation Procedure is the provision that establishes the prerequisites and procedural rules governing this mechanism.

However, that statutory provision must be read in conjunction with Articles 173.6 and 183 of the General Law on Public Administration in order to obtain a complete view of the matter under consideration. It follows precisely from that combined reading that, in this type of Proceeding, standing to sue (legitimación activa) is granted to the Administration that issued the challenged act, while the party with standing to be sued (legitimado pasivo) is the person subject to the Administration to whom the effects of that formal conduct are addressed. This is so because, as stated above, a proceeding for annulment of an act detrimental to the public interest constitutes an instrument for the legal elimination of specific administrative acts that create subjective rights, insofar as those acts are substantially inconsistent with the legal order—acts affected by absolute or relative nullity (nulidad relativa)—(Articles 128, 158, 165, and related provisions of the General Law on Public Administration).

Thus, a proceeding for annulment of an act detrimental to the public interest is an additional safeguard for the person subject to the Administration, under which, pursuant to the principle that an authority’s own acts may not be disregarded (principio de intangibilidad de los actos propios), the Administration may not itself eliminate the effects of an act conferring subjective rights, except through this proceeding and by means of a Tribunal independent of the Administration that issued the act whose annulment is sought on the ground that it is detrimental to the public interest…” ( ) “…In summary, in accordance with the foregoing, institution of a Proceeding for Annulment of an Act Detrimental to the Public Interest and the resulting decision on the merits require: i) the existence of a specific, final administrative act conferring subjective rights; ii) that such formal conduct be affected by defects of absolute or relative nullity; iii) that the act in question have been declared detrimental to public, economic, or other interests in administrative proceedings by the Supreme Hierarchical Authority of the Administration that issued it; iv) that such declaration of detrimental effect be made within the one-year period established in Article 34 of the CPCA—except with respect to the protection of public-domain property, which is not subject to a time limit—Article 34.2 of the CPCA; v) that the Administrative Litigation Proceeding for Annulment of an Act Detrimental to the Public Interest be instituted by the Public Administration that issued the act, within the one-year period established by Article 39.1.e of the CPCA—subject to the aforementioned exception regarding public-domain property—…” (decision N° 39-2023-IV, at 15:00, on April 24, 2023, of the Tribunal Contencioso Administrativo, Sección Cuarta, del Segundo Circuito Judicial de San José, Goicoechea).

In the case at hand, although the State’s representative (Procuraduría General de la República) asserted a claim (pretensión) seeking restoration of matters to their prior state (restitución de las cosas al estado anterior), this Court does not agree with the appellant in cassation’s assertion that referring the interested party to another jurisdiction (the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa)) to initiate a lesividad proceeding (proceso de lesividad) is contrary to law (and thereby leaves unprotected the State’s authority to defend and guarantee the right to a healthy environment for the benefit of the community). It must be borne in mind that valid administrative acts (actos administrativos) cannot be annulled in criminal proceedings (proceso penal). This court lacks the jurisdiction (competencia) vested specifically in the contentious-administrative courts (Tribunales contenciosos-administrativos) (for which formal and time-related requirements, among others, must be satisfied).

It should be noted, for example, that criminal proceedings likewise cannot award compensation to a person who obtains a right as a result of an error by the Administration, whereas such compensation is available in the contentious-administrative jurisdiction. In summary, in a case such as the one before us and under the circumstances described, demolition of the dwelling would be possible only if the competent judicial authority declares the municipal acts (administrative permits) that allowed the civil defendants (demandadas civiles) to build the dwelling at issue in the dispute (litis) null and void. Accordingly, should the interested party deem it appropriate (in seeking to defend potential environmental interests), it must pursue the relevant remedies in the contentious-administrative jurisdiction. Therefore, because the appellant’s first ground of challenge (reproche) is without merit for the reasons stated, it is denied.

IV.In its second claim, the State’s counsel alleges that the judgment was improperly reasoned due to the failure to apply Article 464 of the Code of Criminal Procedure. It states that the decision challenged herein declares a lack of subject-matter jurisdiction (incompetencia material) and fails to rule on the request for restoration (restitución) concerning the structures used by Ms. [Nombre 007]. The appellant adds that the appellate court (ad quem) refers to the permits granted by the Municipalidad de Santa Ana, which it identifies at folios 117 to 119. It argues that the judgment violates the legal system by assessing documents that were neither admitted nor discussed at trial, thereby infringing the most basic principles governing the assessment of evidence and the rules of sound judicial evaluation (sana crítica), as well as violating the duty of fairness, not only between the opposing parties but also on the part of the adjudicator toward them.

Counsel Mora Salguero then lists the documentary evidence admitted by the Tribunal Penal de Juicio del Tercer Circuito Judicial de San José when deciding the matter concerning restoration of the property to its prior condition (see folio 850, front and back). She notes that the trial record shows that the parties agreed to the admission of that evidence, making it clear that the documents at folios 117 to 119 were not admitted for discussion at trial. She challenges the fact that, despite the foregoing, judgment N° 1794-2022 relies on those written submissions to declare a lack of subject-matter jurisdiction, thereby violating the rules governing the admission of evidence and the rules for its corresponding assessment. She concludes that the trial court (a quo) cannot be faulted for failing to analyze those documents because they were not part of the admitted body of evidence. She points out that Article 464 of the procedural Code provides that the appellate court—at the request of a party—shall have the authority to examine the records of the evidence produced at trial; therefore, as a corollary, it is prohibited from assessing evidence other than that admitted.

She concludes her argument by emphasizing that the challenged judgment failed to apply Articles 464 and 465 ibid, because it based its decision on evidence that had not been admitted. As grounds for grievance (agravio), she asserts a violation of Article 142 of the Code of Criminal Procedure, because a decision is not duly reasoned if the rules of sound judicial evaluation are infringed with respect to the evidentiary means or elements considered in reaching it. She considers that the ruling, supported by evidence not offered for trial, adversely affected the State’s interests in protecting the environment, in breach of the requirement that a judgment be based on valid evidence debated by the parties. She requests that the claim be granted, that the challenged judgment be vacated, and that decision N° 48-2022, issued at 09:30 on January 26, 2022 by the Tribunal Penal de Juicio del Tercer Circuito Judicial de San José, be affirmed or, alternatively, that the case be remanded for the appeal to be decided on the merits, as required by law.

The second ground raised is denied. The appellant’s central contention is that the Tribunal de Apelación de Sentencia decided the appeal by assessing documentary evidence—permits granted by the Municipalidad de Santa Ana, appearing at folios 117 to 119 of volume I of the main case file—that was neither admitted nor discussed at trial, thereby infringing basic principles governing the assessment of evidence and the rules of sound judicial evaluation. To explain why there is no improper reasoning in the judgment sufficient to warrant vacating the appellate ruling, it is first necessary to examine what the trial court decided in order to understand the appellate court’s reasoning. As noted when deciding the first claim in the appeal on points of law (recurso de casación), in oral judgment N°1009-2018, issued at 13:13 on August 17, 2018, the Tribunal Penal del Tercer Circuito Judicial de San José, sede Suroeste, Pavas, acquitted [Nombre 006] and [Nombre 007], with certainty, of all punishment and liability for the offense of violating the Ley Forestal, to the detriment of natural resources.

That decision, as to that issue, became final in 2018. The judge of the Tribunal Penal who issued that judgment stated: “…At no time during the administrative proceedings concerning the obtaining of construction permits was she, as the owner of the property, informed that there was any type of prohibition or restriction either on the location of the structure on the land or on the construction area authorized by the Municipality at that time. Although it is true that the documentary evidence concerning land use and the municipal permits was rejected, it was possible to establish this through other means because it was the manager himself, Mr. [Nombre 005], who came here and told us that he was thoroughly familiar with this entire dispute, this whole situation involving both Arguello sisters, because at that time he served as the municipal environmental manager, or rather as a municipal official, and subsequently moved to another position…” ( ) “…Now, in the case of Ms.

Guiselle, Ms. Guiselle is clear and unequivocal; she does not deny at any time that she carried out the construction, she does not attempt to conceal that circumstance, and she states: I am building under the protection of the law; I am building with the appropriate permits. The State was the entity required to grant me the permits through the municipal authority, and that is what I did; the engineer began construction exactly as I hired him to do, exactly as I was legally entitled to do, and I did so. Indeed, as of the date on which I began the work, I had not even been notified, nor was I notified of any irregularity after the work was completed…” ( ) “…Mr. [Nombre 005] himself was very clear that he was the person responsible for the matter involving the municipal permits, and he came and clarified the issue for us: in the case of Ms. Guiselle, she unquestionably did have them, to his understanding, because although at first he told us that he did not know whether she had been granted the permits, he later said that she had indeed been granted the construction permit because her land use had not even been made subject to conditions, and that if her land use had been made subject to conditions, she would not have been granted the construction permits.

Mr. [Nombre 005] even elaborated on the issue of whether the Municipality would have learned of this situation, explaining that it was precisely because of a construction project, and that is why we have no doubt—I personally have no doubt—that Ms. Guiselle built with permits. And why? Because Mr. [Nombre 005] is very clear and unequivocal in telling us that when Ms. Sonia built, her land-use permit was neither denied nor restricted, and that, as of the date on which Ms. Sonia completed that construction, the Municipality was not even aware that the spring (naciente) was there or that some areas or properties might be encroaching upon the protected area (área de protección). Had it not been for Mr. [Nombre 004], he would not have begun the inquiries and this entire situation would not have arisen. Therefore, he is clear that the permits granted both for Ms. Guiselle and for any other existing construction at the site were properly issued…” (Digital file 120014210283PE-17082018011227-2_MultiMedia—0 corresponding to the oral judgment, minutes 01:15:10 to 01:16:15, 01:20:15 to 01:21:00 and 01:23:15 to 01:25:10; the boldface and underlining emphasize the importance of those statements).

Following several remands—which related solely to the request to restore the property to its condition before the events—the Tribunal Penal del Tercer Circuito Judicial de San José, Sede Puriscal, issued judgment N° 048-2022 at 09:30 on January 26, 2022 (reviewed on appeal by the Tribunal de Apelación through decision N° 2022-1794), stating at the end of the ruling: “…The record shows that, for the construction of the dwelling in question, Ms. [Nombre 006] had municipal approvals and permits, so much so that this constituted one of the reasons why the Tribunal Penal de Pavas acquitted her with certainty of the offense of violating the Ley Forestal with which she had been charged…” (folio 766, front). It follows from the passage just quoted that the court of first instance fully established that the [Nombre 006] sisters acted under the authority of the permits granted to them by the Municipality itself for the development of a residential subdivision and the construction of a dwelling.

Regarding this issue, the Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José, in decision N° 2022-1794 (challenged herein), held: “…this panel notes that the judicial body overlooked a highly significant fact arising from the evidence examined—and which, although not included in the section setting forth the proven facts, it accepted in the judgment’s assessment of the evidence, specifically at folio 766, front—namely, that the Municipalidad de Santa Ana granted the corresponding permits for both land use and construction (see folios 117 to 119, years 2010 and 2011. See also the permits granted to [Nombre 006], folio 97 et seq.). It should be noted here that the property is one of several comprising the Urbanización Hacienda Paraíso, created years earlier, whose plan—which was approved by the INVU—also received the endorsement of the municipal authority, to such an extent that construction permits were subsequently granted at that location (see folios 18 and 97 to 120 of volume I).

The foregoing makes clear that the civil defendant (demandada civil), [Nombre 007], acted—or would have acted—just as her sister Sonia did, in good faith and under the authority of the permits granted by the Public Administration itself, first for establishing the aforementioned residential subdivision and then for constructing a dwelling on the property purchased by Ms. [Nombre 007] in 2010 (folio 18, cited above). Stated differently—and unlike what generally occurs in most cases involving encroachment upon conservation or protected areas—several administrative acts (actos administrativos) benefiting the person who now appears as the civil defendant were issued in this matter. First the Procuraduría General de la República and then the court seek to disregard those acts by ordering the demolition of the dwelling, ignoring the principle that such acts may not be disturbed and the procedure established by the Costa Rican legal system for reviewing or annulling them, namely, contentious-administrative proceedings for a declaration of injury to the public interest (proceso contencioso administrativo de lesividad)…” (folios 838, back, to 839, front).

Indeed, as the representative of the Procuraduría General de la República maintains, the permits granted by the Municipalidad de Santa Ana, appearing at folios 117 to 119 of volume I of the main case file, were not accepted and admitted into evidence at trial. Nevertheless, the appellant on points of law fails to mention that this point was acknowledged even by the Tribunal Penal del Tercer Circuito Judicial de San José when it issued oral judgment N° 1009-2018, at which time it stated that the existence of those permits had been corroborated by other evidence—including, for example, the statements of Ms. [Nombre 006] and witness [Nombre 005]. On this point, judgment N° 1009-2018 stated: “…At no time during the administrative proceedings concerning the obtaining of construction permits was she, as the owner of the property, informed that there was any type of prohibition or restriction either on the location of the structure on the land or on the construction area authorized by the Municipality at that time.

Although it is true that the documentary evidence of land use (uso de suelo) and the municipal permits was rejected, their existence was established through other means, because it was the Manager himself, Mr. [Nombre 005], who came here and told us that he is fully aware of this entire dispute, this whole situation involving both Arguello sisters, because at that time he was serving as the municipal environmental manager (gestor ambiental), in fact…” (Digital file 120014210283PE-17082018011227-2_MultiMedia—0 corresponding to the oral judgment, minutes 01:15:10 to 01:16:15). The issue of the municipal permits was always known to counsel for the Procuraduría General de la República. Indeed, as recorded beginning on the front of folio 829 of appellate judgment N° 2022-1794, at the oral appellate hearing held on August 10, 2022, during the presentation by attorney Rodrigo Rosales Arce, counsel for the civil defendants, the following was recorded: “…The official plan, which dates from 1982, authorized his clients to build and the municipality to grant the permits…” ( ) “…Folios 117 and 118 indicate that the designated use complies with the regulations for the area (from which it follows that the sisters acted in reliance on the principle of legitimate expectations (principio de confianza))…” (reverse of folio 829 to front of folio 830).

Appellate judgment N° 2022-1794 also recorded the statements made at the oral appellate hearing by [Nombre 006] and [Nombre 007]. With respect to the former, it stated: “…My sister and I purchased land as part of a life plan; she built in 2011 in full compliance with the law, with land-use authorization, etc. In 2012, I was going to build, so I requested land-use authorization, had the plans prepared, and the Colegio de Ingenieros granted the permit; on June 1, 2012, the bank was going to conduct the appraisal, so I had the land cleared for the bank’s appraiser. [Nombre 004] saw the clearing and filed his complaint. On July 1, they granted me the permit. On the 13th of that month, I received a fax stating that I had to stop the work because a neighbor had reported the existence of a spring (naciente) near the property and they had to consult MINAE. Ms. Sonia says that this was when she learned that there was a spring.

She went to the municipality, where Mr. [Nombre 005] assisted her and told her that a neighbor had reported a spring nearby and that MINAE had to define the restrictions. Mr. [Nombre 005] said there were 100-meter restrictions; she asked him why subdivisions (segregaciones) were allowed and why cadastral plans (planos catastrales) were allowed to be processed. She pointed out that she had not purchased land as an ornament, but in order to build. The construction permit had been issued by the municipality itself; that entity did not know what the actual circumstances were…” (reverse of folio 830). With respect to [Nombre 007], it stated: “In 2010, they purchased two parcels of land in Hacienda Paraíso, and the municipality issued the land-use certificate stating that they were intended for the construction of single-family homes. In 2011, she took out a construction loan that she is still repaying, with 15 years remaining.

She processed the permits; she had the plans approved by the CFIA and had the land-use certificate, which confirms what the zoning plan provides. The land is located in a residential zone, and water service is available through Acueductos y Alcantarillados. The construction permit issued by the Municipalidad de Santa Ana contains no restriction. She built in 2011 and her sister in 2012. Her sister applied for a loan and obtained plans and permits (without any restriction), all in the same manner…” (reverse of folio 831). In this specific case, it is true that the appellate court’s treatment of the issue in question may cause confusion as to how the matter was framed, because the documentary evidence appearing at folios 117 to 119 of volume I of the main case file (permits granted by the Municipalidad de Santa Ana) was not formally admitted into the proceedings; nevertheless, the existence of the municipal permits was established at trial.

In other words, even if the Appellate Court’s statements concerning the information contained in those folios were hypothetically excluded, the fact remains that the cassation appellant’s (casacionista) objection does not substantially affect the reasoning underlying the challenged decision, because other fully valid evidence—admitted at trial—supports the decision adopted by the Appellate Court (demolition of the house would be plausible only if the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa) declares null and void the administrative acts that allowed the civil defendants to build the house at issue in the dispute (litis)). As this Chamber recently stated: “…The intellectual operation of hypothetical exclusion (supresión hipotética), which courts sometimes apply in their decisions, constitutes a valid analytical tool for determining whether, upon mentally excluding or eliminating evidence that is subject to dispute, other items of evidence remain that are themselves lawful and capable of supporting the decision reached in the proceedings, thereby preserving the validity of the judgment…” (Sala de Casación Penal, resolution N° 2023-00553, at 10:17 hours, on June 15, 2023; composed of Solano, Alfaro, Zúñiga, Segura and Acón).

Accordingly, based on the foregoing, because no material defect warranting a declaration has been established and, consequently, there is no reason to declare the appellate judgment null and void, the second ground for cassation raised by the representative of the Procuraduría General de la República must be denied.

Therefore:

The first and second grounds of the appeal in cassation filed by the representative of the Procuraduría General de la República are denied. Let notice be given.

Revisión del Documento Res: 2024-00058 SALA DE CASACIÓN PENAL. San José, a las catorce horas cuarenta y dos minutos del dieciocho de enero de dos mil veinticuatro.

Recruso de casación interpuesto en la presente causa seguida contra [Nombre 006], costarricense, cédula de identidad [Valor 002], nacida el 04 de abril de 1962, hija de [Nombre 001] y [Nombre 002], y [Nombre 007], costarricense, cédula de identidad [Valor 004], nacida el 18 de julio de 1959, hija de [Nombre 001] y [Nombre 002], por el delito de infracción a la ley forestal, cometido en perjuicio de los Recursos Naturales. Intervienen en la decisión del recurso los Magistrados y las Magistradas Patricia Solano Castro, Jesús Alberto Ramírez Quirós, Gerardo Rubén Alfaro Vargas, Sandra Eugenia Zúñiga Morales y Rafael Segura Bonilla, este último como Magistrado suplente. Además, en esta instancia la licenciada Kasandra Mora Salguero, como representante de la Procuraduria General de la República. Se apersonó el licenciado Rodrigo Rosales Arce, representante de la actora civil asi como de la demandada civil.

Resultando:

  1. 1Mediante sentencia N° 2022-1794 de las 14:35 horas del 13 de diciembre de 2022, el Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José, Goicoechea, resolvió: “POR TANTO: Por razones distintas a las expuestas, se declara con lugar el recurso que formula la defensa técnica de la parte demandada civil y se revoca la sentencia recurrida en cuanto: i) ordenó al alcalde de Santa Ana derribar la casa construida en la finca propiedad de [Nombre 007] y retirar los escombros; ii) dispuso que la resolución le fuese notificada al citado alcalde de manera personal y advirtió a este acerca de que, de no cumplir con lo ordenado, se le testimoniarán piezas por el delito de desobediencia a la autoridad. En su lugar, de oficio de decreta la incompetencia material para conocer la demanda formulada por la Procuraduría General de la República y se omite pronunciamiento en cuanto a ella.Deberá esta parte procesal, si asi lo estima oportuno, gestionar lo que corresponda a efectos de que se discuta el tema de nulidad de los actos administrativos involucrados y el derribo pretendido en la jurisdicción contencioso-administrativa. En lo restante (a saber, en cuanto se resolvió el proceso de reenvío sin especial condenatoria en costas de ambas partes) la decisión se mantiene incólume. NOTIFÍQUESE. Patricia Vargas González - Rosaura Chinchilla Calderón - Kathya Jiménez Fernández. Juezas de apelación de sentencia penal.” (sic)
  2. 2Contra el anterior pronunciamiento la licenciada Kasandra Mora Salguero, interpuso recurso de casación.
  3. 3Verificada la deliberación respectiva, la Sala entró a concer del recurso.
  4. 4Se llevó a cabo la audiencia oral y pública a las once horas del ocho de junio de dos mil veintitrés.
  5. 5En los procedimientos se han observado las prescripciones legales pertinentes.

Informa la Magistrada Zúñiga Morales ; y,

Considerando:

I.Esta Sala mediante resolución Nº 2023-00452, de las 10:11 horas, del 19 de mayo del 2023, visible de folios 873 frente a 877 del tomo II del expediente principal, admitió para estudio de fondo los dos motivos del recurso de casación, formulado por la licenciada Kasandra Mora Salguero, Procuradora Penal, actuando en representación del Estado como querellante y actora civil (folios 848 frente a 851), contra la resolución N° 2022-1794, dictada por el Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José, a las 14:35 horas, del 13 de diciembre de 2022, según rola de folios 827 frente a 844, mediante la cual se dispuso lo siguiente: “Por razones distintas a las expuestas, se declara con lugar el recurso que formula la defensa técnica de la parte demandada civil y se revoca la sentencia recurrida en cuanto: 1) ordenó al alcalde de Santa Ana derribar la casa construida en la finca propiedad de [Nombre 007] y retirar los escombros; ii) dispuso que la resolución le fuese notificada al citado alcalde de manera personal y advirtió a este acerca de que, de no cumplir con lo ordenado, se le testimoniarán piezas por el delito de desobediencia a la autoridad.

En su lugar, de oficio se decreta la incompetencia material para conocer la demanda formulada por la Procuraduría General de la República y se omite pronunciamiento en cuanto a ella. Deberá esta parte procesal, si así lo estima oportuno, gestionar lo que corresponda a efectos de que se discuta el tema de la nulidad de los actos administrativos involucrados y el derribo pretendido en la jurisdicción contencioso-administrativa. En lo restante (a saber, en cuanto se resolvió el proceso de reenvío sin especial condenatoria en costas de ambas partes) la decisión se mantiene incólume” (folios 843 vuelto a 844).

II.La audiencia oral y pública convocada a solicitud de la demandada civil [Nombre 007], se realizó –según consta a folios 893 frente y vuelto del Tomo II del expediente principal, así como en la respectiva grabación del archivo digital– el 8 de junio de 2023, en la Sala de Vistas ubicada en el segundo piso del edificio de la Corte Suprema de Justicia, con la presencia de las partes, así como de las Magistradas y los Magistrados que concurrimos a resolver por el fondo el presente asunto. En la audiencia oral no se solicitó la evacuación de prueba y las partes se limitaron a exponer una síntesis de los reclamos del recurso y de la contestación que presentaron por escrito.

III.En el primer motivo de casación se aduce falta de fundamentación e inaplicación de las normas procesales previstas en los artículos 140 y 366 del Código Procesal Penal en relación con el ordinal 103 del Código Penal. A modo de introducción, la recurrente trascribe un fragmento de los hechos probados de la sentencia N° 48-2022, de las 09:30 horas del 26 de enero de 2022, del Tribunal Penal del Tercer Circuito Judicial de San José, en donde se tuvo por acreditado que la señora [Nombre 006] llevó a cabo una construcción de una casa de habitación, invadiendo el área de protección de la naciente Urracas (Amarilla), que es de cauce permanente y afluente del Río Caraña. Seguidamente reproduce un pasaje de la sentencia de alzada en donde se estableció que la señora [Nombre 006] habría actuado de buena fe, amparada en los permisos que la propia Administración Pública le otorgó para el establecimiento de una urbanización y la construcción de una casa de habitación.

Acota que el ad quem concluyó que el tribunal de mérito desconoció el principio de intangibilidad de los actos, así como la vía que el ordenamiento jurídico dispone para su revisión o anulación; a saber: el proceso contencioso administrativo de lesividad. A continuación, aduce que el fallo de segunda instancia infringe los artículos 140 y 366 del Código Procesal Penal, así como el numeral 103 del Código sustantivo, toda vez que omite pronunciarse sobre el fondo de la acción bajo una premisa no objeto de debate -una incompetencia material- inobservando los preceptos que dan cabida a la acción civil y a la obligación de restitución de las cosas a su estado anterior. Considera errada la lectura del ad quem en el tanto la representación estatal válidamente ejerció una pretensión civil relativa a la restitución de las cosas al estado anterior; es decir, al derribo de la obra infractora. Con base en lo anterior, sostiene que no resulta acorde, ni ajustado a Derecho enviar a la parte interesada (en este caso actora civil) a otra jurisdicción (la contenciosa administrativa, vía de lesividad) habiendo transcurrido más de diez años desde el inicio del proceso penal y más de siete años desde que se formuló la acción civil resarcitoria.

Aduce que esta línea de resolución lesiona severamente el principio de “electa una vía” mediante el cual el Estado optó por la vía penal para incoar su pretensión civil. Subraya que la competencia para dirimir su acción fue determinada desde su interposición hace más de siete años, y conforme al derecho de petición y tutela judicial efectiva, ha de resolverse en el ámbito penal. Apunta que hoy el ordenamiento jurídico faculta el ejercicio de una acción civil en sede penal con observancia de los artículos 37, 111 y 112 del Código Procesal Penal y 61.2 del Código Procesal Civil, siendo obligación de los tribunales resolverla por el fondo como requisitos preceptivos de la sentencia, sea condenatoria, en todo o en parte, o absolutoria total o parcial. Fustiga que el tribunal de apelación se apartó de los agravios expuestos en el recurso para incursionar de oficio y sin conceder a las partes en un tema precluido, decidiendo remitir al Estado a la sede contenciosa administrativa para interponer un proceso de lesividad, cuando ese tipo de proceso corresponde interponerlo a la administración activa que emitió los supuestos actos administrativos; es decir, a la Municipalidad de Santa Ana.

Critica la línea de resolución del ad quem según la cual la Procuraduría General de la República no está facultada para solicitar el derribo de la obra; toda vez que ello va contra la potestad del Estado de defender y garantizar el derecho a un ambiente sano para beneficio de la colectividad conforme al artículo 50 constitucional. Arguye que esta restricción es novedosa, resulta incongruente por ser “ultra petita” y además desconoce los votos 114-2019, de las 14:30 horas del 25 de enero de 2019; y 2301-2019, de las 09:45 horas, del 19 de diciembre de 2019, del propio Tribunal de Apelación de Sentencia del Segundo Circuito Judicial de San José, el cual con diversas conformaciones (en este mismo expediente) emitió criterio ordenando resolver la pretensión de fondo. Sintetiza su alegato indicando que la sentencia del ad quem es falaz y falta al deber de fundamentación y congruencia, transgrediendo así el artículo 140 del Código Procesal Penal, y al no resolver su acción lesiona los artículos 366 ibid; 103, 122 y 123 del Código Penal; 98 y 101 de la Ley Orgánica del Ambiente, por no repararse el daño al ambiente.

Como agravio, indica que el tribunal de apelación anuló y rechazó la petitoria civil al declarar una incompetencia material; dejando así de aplicar varias normas del ordenamiento jurídico; causando una afectación al Estado y consecuentemente al medio ambiente. Como pretensión, solicita acoger el recurso y disponer la restitución de cosas al estadio anterior dentro del plazo razonable para el retiro de las obras que están dentro del área de protección o, en su defecto, se anule la resolución impugnada y se reenvíen los autos para su nueva sustanciación. Se declara sin lugar el reclamo. En el presente asunto, la discusión se centrará en determinar si es válido jurídicamente que un Tribunal de Apelación de Sentencia Penal, de oficio, habiéndose establecido que la Municipalidad concedió a una persona los permisos, tanto de uso de suelo como de construcción de una casa de habitación (en un área aparentemente de protección), decrete la incompetencia material para conocer la solicitud de restitución de las cosas al estado original (demolición de vivienda), formulada por la Procuraduría General de la República, remitiendo a dicha parte procesal, para que, si así lo estima oportuno, gestione lo que corresponda, a efectos de que se discuta el tema de la nulidad de los actos administrativos involucrados y el derribo pretendido en la jurisdicción contencioso-administrativa.

Para dar una respuesta a esta cuestión, se expondrán, en primer lugar, los antecedentes que llevaron al dictado de la resolución que aquí se impugna; luego, el criterio que asumió el Tribunal de Apelación de Sentencia del Penal del Segundo Circuito Judicial de San José en la resolución N° 2022-1794 (aquí impugnada) y, finalmente, se presentarán los argumentos que llevan a esta Cámara a declarar sin lugar el recurso de casación interpuesto por la representación de la Procuraduría General de la República. A. Antecedentes del caso concreto. En la especie, mediante sentencia oral N°1009-2018, de las 13:13 horas, del 17 de agosto de 2018, el Tribunal Penal del Tercer Circuito Judicial de San José, sede Suroeste, Pavas, absolvió por certeza, de toda pena y responsabilidad, a las encartadas [Nombre 006] y [Nombre 007], de un delito de Infracción a la Ley Forestal, en perjuicio de los recursos naturales; a su vez, declaró sin lugar la acción civil resarcitoria y absolvió al Estado del pago de las costas procesales y personales por existir razón plausible para litigar; finalmente, dispuso que las costas de la querella quedaban a cargo del Estado (folios 421 a 424 del tomo I del expediente principal).

Esta decisión fue impugnada por la representante de la Procuraduría General de la República (folios 425 a 438 del tomo I del expediente principal), siendo que, el Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José, emitió la resolución número 2019-0114 de las 14:30 horas del 25 de enero de 2019, mediante la cual dispuso: “Se declara con lugar el recurso de apelación incoado por la licenciada Kasandra Mora Salguero, en su condición de representante de la Procuraduría General de la República y, en consecuencia se anula parcialmente la sentencia, únicamente en cuanto a la solicitud de la restitución de las cosas al estado que tenían antes del hecho, ordenándose el juicio de reenvío ante el mismo Tribunal para que, con una diferente integración, proceda, a la mayor brevedad posible, a resolver lo que corresponda en Derecho. En lo demás se mantiene incólume el fallo” (folios 460 frente a 466 del tomo I del expediente principal).

Con esta decisión, la absolutoria penal de las señoras [Nombre 006] y [Nombre 007] adquirió firmeza. Por sentencia N° 587-2019, de las 14:23 horas, del 23 de mayo de 2019, el Tribunal Penal del Tercer Circuito Judicial de San José, sede Suroeste, Pavas, rechazó la solicitud de restitución de las cosas a su estado original y resolvió el proceso de reenvío sin especial condenatoria en costas (folios 499 frente a 511 del tomo I del expediente principal). Esta sentencia fue recurrida por la representante de la Procuraduría General de la República (folios 517 a 540 del tomo I del expediente principal), lo que dio lugar al dictado de la sentencia N° 2019-2301, de las 09:45 horas, del 19 de diciembre de 2019, del Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José, la cual resolvió: “Se declara (sic) con lugar los tres motivos contenidos en el recurso que formuló la licenciada Kasandra Mora Salguero, como representante de la Procuraduría General de la República.

Se anula integralmente la sentencia venida en alzada. Se ordena el juicio de reenvío, en donde debe determinarse si procede, o no, aplicar la medida gestionada por la Procuraduría General de la República. Por innecesario, se omite pronunciarse sobre el cuarto motivo de impugnación” (folios 583 frente a 591 vuelto del tomo I del expediente principal). Ante el reenvío dispuesto, por sentencia N° 048-2022, de las 09:30 horas, del 26 de enero de 2022, el Tribunal Penal del Tercer Circuito Judicial de San José, Sede Puriscal, estableció: “ Se ORDENA EL RESTABLECIMIENTO DE LAS COSAS A SU ESTADO ORIGINAL solicitado por la Procuraduría General de la Republica; disponiéndose un plazo de tres meses a partir de la firmeza de esta sentencia para que el Alcalde de la Municipalidad de Santa Ana, haga efectivo el derribo de la casa que se encuentra construida en la finca 1-607385-000, propiamente lote 92, propiedad de la señora [Nombre 007] y a la vez retire los escombros; debiendo de previo a la demolición verificarse la correspondencia de la casa en el sitio con la que figura en este proceso.

EI Alcalde Municipal de Santa Ana deberá ser notificado de esta sentencia de manera personal. En caso de no cumplirse con lo aquí ordenado, se le testimoniaran piezas por el delito de 3 Desobediencia a la Autoridad. Se resuelve el proceso de reenvío sin especial condenatoria en costas” (folios 754 frente a 766 vuelto del Tomo II del expediente principal). B. Criterio asumido por el Tribunal de Apelación de Sentencia del Penal del Segundo Circuito Judicial de San José en la resolución aquí impugnada (voto N° 2022-1794). El Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José, en la sentencia N° 2022-1794 (conociendo el recurso de apelación interpuesto por la demandada civil [Nombre 007], visible de folios 767 a 782 del tomo II del expediente principal), explicó que en este asunto se tuvo por demostrado que, en el año 2012, se llevó a cabo una construcción de una casa de habitación de 135 metros cuadrados, en la finca del partido de San José, folio real número 1-607385-000, perteneciente a [Nombre 007] (única demandada civil), siendo que, en el reenvío que se había dispuesto, la discusión versó acerca de si la vivienda estaba invadiendo el área de protección de alguna de las dos nacientes del sector (la absolutoria penal por certeza de las imputadas ya había adquirido firmeza), tema para el cual era necesario establecer si eran permanentes o temporales, pues de ello depende el tamaño del área de protección (el a quo concluyó que era permanente y dispuso el derribo del inmueble).

Habiendo realizado dicho preámbulo, las juezas de apelación sostuvieron: “…Ahora, nota esta cámara que el órgano jurisdiccional pasó por alto un hecho de suma importancia y que se desprende de la prueba examinada (y que, sin incorporarlo al acápite de hechos probados, lo consideró así en la fundamentación intelectiva de la sentencia, en concreto, a folio 766 frente), a saber, que la Municipalidad de Santa Ana concedió los permisos correspondientes, tanto de uso de suelo como de construcción (cfr. f. 117 a 119, años 2010 y 2011. Véase también los permisos otorgados a [Nombre 006], f. 97 en adelante). Cabe apuntar aquí que el inmueble es uno más de los que integran la Urbanización Hacienda Paraíso, creada años antes y cuyo plano (que fue visado por el INVU) también contó con el aval del ente municipal al punto que, luego, se otorgaron permisos de construcción en ese lugar (cfr. f. 18, 97 a 120 del tomo I).

De lo expuesto, queda claro que la demandada civil [Nombre 007] habría actuado (al igual que su hermana Sonia) de buena fe, amparada en los permisos que la propia Administración Pública otorgó, primero para que se estableciese la urbanización citada y luego para que, en el inmueble que compró doña [Nombre 007] en el año 2010 (f. 18 citado), se construyese una casa de habitación. Dicho en otras palabras (y a diferencia de lo que suele suceder en la mayoría de casos de invasión a áreas de conservación o protección) en este asunto tuvieron lugar varios actos administrativos en favor de quien ahora figura como demandada civil, mismos que primero la Procuraduría General de la República y luego el tribunal, pretenden ignorar, al ordenar el derribo de la casa de habitación desconociendo el principio de intangibilidad de tales actos y la vía que el ordenamiento jurídico costarricense dispone para revisarlos o anularlos, a saber, el proceso contencioso administrativo de lesividad…” (folios 838 vuelto a 839 frente).

Para sustentar su decisión, el Tribunal de Alzada, citó -in extenso- varios extractos de dos resoluciones del Tribunal Contencioso Administrativo en las que se hace referencia a los procesos de lesividad. Al respecto, el ad quem apuntó: “…Sobre este proceso, ha dicho el Tribunal Contencioso Administrativo, sección Sexta, del Segundo Circuito Judicial de San José, en la sentencia número 134-2021-VI lo siguiente: “De manera general, la lesividad se constituye en un mecanismo jurisdiccional en virtud del cual la Administración pretende la supresión de un acto suyo, propio, firme, que, en tesis de principio, genera un efecto favorable a un tercero destinatario. Desde ese plano, en este tipo de contiendas, la lesividad es de corte subjetivo, en tanto pretende la anulación de una conducta que concede un derecho o en general, una situación de beneficio a una persona. Si bien se analiza la validez de una conducta pública concreta (y no general) de contenido favorable, ese control exige la participación del destinatario de aquella, a efectos de que pueda ejercitar su derecho de defensa y contradictorio respecto de pretensiones que buscan la alteración de su situación jurídica.

Tal figura se encuentra positivizada en el canon 34 del Código Procesal Contencioso Administrativo, norma que fija los elementos previos y regulaciones procesales de esta figura. Empero, se encuentra referenciada, además, en el numeral 173.6 en relación al (sic) 183 de la Ley General de la Administración Pública. Desde la óptica de los presupuestos procesales, se imponen condiciones subjetivas, objetivas, procedimentales y temporales. En cuanto a la arista subjetiva, la legitimación activa se concede a la Administración emisora del acto cuestionado, en tanto que el legitimado pasivo es el receptor de los efectos de la conducta, sea, quien obtiene sus bondades. En lo atinente a la arista objetiva, la lesividad se constituye como un mecanismo de eliminación jurídica de actos administrativos de alcance particular y de contenido firme y favorable, que sean disconformes sustancialmente con el ordenamiento jurídico, sea, los actos que padezcan de una invalidez de grado absoluto (artículos 128, 158, 165 y concordantes de la citada Ley General No. 6227).

En esa línea, la Administración debe declarar lesivo a los intereses públicos esa conducta, lo que debe ser establecido dentro de un marco de acciones internas de la Administración que son impostergables para formular la acción. En efecto, en el orden procedimental, se impone que el jerarca máximo supremo de la Administración Pública respectiva, declare la lesividad del acto, sea por lesión a intereses económicos, fiscales o de otra índole que se desprendan del interés público. Lo anterior mediante la debida motivación de las causas que sustentan esas consideraciones, para lo cual, bien puede ampararse en un criterio jurídico-técnico de base que sustente esa determinación. A diferencia de otras figuras de supresión de conductas públicas (como es el caso de la nulidad oficiosa prevista en el artículo 173 LGAP), no requiere de audiencia al tercero, sino solo de acciones a lo interno de la Administración que buscan verificar la existencia expresa de voluntad administrativa emitida por el jerarca máximo, en el sentido de pretender la supresión del acto.

Es dentro del proceso judicial que el tercero podrá establecer sus alegatos de defensa. Ahora bien, cuando el acto emane del Estado (ver art. 1 Ley General), sea, de la Administración Central, la demanda solo podrá ser incoada por la Procuraduría General de la República (canon 16 de la Ley No. 8508), previo pedimento del jerarca máximo supremo y declaratoria interna de lesividad, con detalle de los motivos de ese criterio. Tal representación se impone además en el caso de los actos del Poder Judicial emitidos en el ejercicio de su función administrativa, como es el caso de los actos dictados por el Consejo Superior, cuya lesividad debe declararse por Corte Plena. Cuando dimane de un ente público, las reglas de representación judicial son las establecidas en el ordinal 17 de esa misma codificación. En cuanto a la dimensión temporal, la nueva normativa procesal establece un plazo de un año contado a partir del día hábil siguiente a su emisión (que no de su comunicación) para declarar lesivo el acto a los intereses públicos en sede administrativa.

Lo anterior, salvo los supuestos en que el acto padeciere de nulidad absoluta, en cuyo caso, al tenor de lo regulado por el ordinal 34.1 del CPCA, esa declaratoria interna puede hacerse mientras perduren los efectos del acto. En tal hipótesis, el año se computa desde el cese de sus efectos, y la sentencia que disponga la eventual nulidad, lo hará únicamente para la anulación e inaplicabilidad futura de la conducta. Luego de esa declaratoria (y no a partir del vencimiento de ese primer año), se otorga un plazo de un año para plantear la acción contenciosa administrativa a modo de plazo fatal de caducidad, según lo estatuye el artículo 39 del Código Procesal Contencioso Administrativo. La excepción se configura en tutela de dominio público, caso en el que la acción de lesividad no está sujeta a plazo por la aplicación de la cláusula general de imprescriptibilidad de ese tipo de bienes, según se deriva del canon 261 del Código Civil, de suerte que, tanto la declaración de lesividad, como la formulación de la correspondiente acción judicial, no se condicionan por virtud del tiempo.” (el destacado es del original).

La sección séptima de ese mismo tribunal, en la sentencia 081-2021-VII de las 8:00 horas del 31 de agosto de 2021, señala sobre el tema: "VI.- SOBRE EL PROCESO DE LESIVIDAD EN GENERAL. Como punto de partida es menester resaltar, que en términos generales, el proceso de lesividad es un mecanismo jurisdiccional, por medio del cual el legislador ordinario autorizó a las Administraciones Públicas, a deducir pretensiones anulatorias respecto de actos declaratorios de derechos subjetivos dictados por ellas. En estos tipos de procesos judiciales, se analiza la validez de una conducta formal concreta, que ha generado derechos subjetivos a favor de un administrado -persona física o jurídica-. Justamente por ello, es que se hace necesaria la obligada participación del destinatario del acto cuya nulidad se pretende, a efectos de garantizar no solamente el contradictorio, sino el ejercicio oportuno de su derecho de defensa.

En nuestro ordenamiento jurídico, el artículo 34 del Código Procesal Contencioso Administrativo -CPCA-, es la norma que fija los elementos previos y regulaciones procesales de esta figura; sin embargo, dicho precepto normativo debe concordarse con los numerales 173.6 y 183, ambos de la Ley General de la Administración Pública -LGAP-, a efecto de tener un panorama completo sobre la temática que se aborda. De la combinación armónica de dichas normas, se concluye que en este tipo de procesos la legitimación activa se concede a la Administración emisora del acto atacado, en tanto que el legitimado pasivo es el administrado destinatario de los efectos de esa conducta formal. Ello es así, por cuanto como se indicó líneas atrás, la lesividad se constituye en un instrumento de supresión jurídica de actos administrativos concretos creadores de derechos subjetivos, en el tanto los mismos sean sustancialmente disconformes con el ordenamiento jurídico -actos viciados de nulidad absoluta o relativa- (artículos 128, 158, 165 y concordantes de la LGAP).

Así entonces, el proceso de lesividad es una garantía más para el administrado, en el que en aplicación del principio de intangibilidad de los actos propios, la Administración no puede por sí misma eliminar los efectos de un acto declaratorio de derechos subjetivos, sino que es a través de este proceso y por parte de un órgano jurisdiccional, que pueden suprimirse tales actos generadores de derechos, independiente de la Administración autora del acto que se pide anular por lesivo al interés público”. (El destacado es suplido)…” (folios 839 frente a 840 vuelto). Para el Tribunal de Apelación, en el presente asunto no resulta procedente la orden de derribo del inmueble hasta tanto se discuta y decrete, de ser ese el caso, la nulidad de los actos administrativos dictados en beneficio de la señora [Nombre 007] y cuyos efectos siguen manteniéndose a la fecha. Sobre el particular estableció: “…la Ley General de Administración Pública prevé, como regla general, que la administración es responsable frente a sus administrados por sus actuaciones, sean estas lícitas e ilícitas (arts. 191 y 194 LGAP), entiéndase, tiene un deber de indemnización, máxime en casos como el presente, donde la edificación de la vivienda en cuestión contaba con los permisos correspondientes, emitidos por la municipalidad, ente que tiene competencia para fiscalizar estos procesos o inversiones de particulares.

Además, si bien es cierto la Ley General de Administración Pública prevé que la nulidad absoluta de un acto puede ser declarada en vía administrativa, sin necesidad de recurrir al contencioso-administrativo de lesividad, también es clara al apuntar que ello solo es así en caso de nulidades evidentes y manifiestas (art. 173 inciso 1), lo cual prima facie puede descartarse en este asunto, pues no obstante que se han celebrado tres juicios, dos de ellos en relación con el tema de si la naciente involucrada es (y era, para cuando se efectúa la construcción) permanente o intermitente, la medida del área de protección (que depende del aspecto antes mencionado) y la ubicación del inmueble en relación con esa área, el tema sigue sin aclararse con precisión…” (folio 840 vuelto). El Tribunal de Alzada, procedió a trascribir varios fragmentos de la resolución N° 2002-09239 de las 11:02 horas, del 20 de setiembre de 2002 (reiterada en el voto N° 2010-9077, de las 08:36 horas, del 21 de mayo de 2010) de la Sala Constitucional, en la que se destaca que la regla general es que la administración pública respectiva no puede anular un acto declaratorio de derechos para el administrado (la nulidad que justifica la revisión de oficio, como excepción calificada a la doctrina de la inderogabilidad de los actos propios y favorables para el administrado o del principio de intangibilidad de los actos propios, debe tener tal trascendencia y magnitud que debe ser, a tenor de lo establecido en el numeral 173, párrafo 1°, de la Ley General de la Administración Pública, "evidente y manifiesta"), por lo que, como principio general, la administración pública, debe acudir, en calidad de parte actora y previa declaratoria de lesividad del acto a los intereses públicos, económicos o de otra índole, al proceso jurisdiccional de lesividad.

En relación con la nulidad absoluta en sede administrativa, así como la declaratoria de lesividad, el ad quem indicó: “…tanto la nulidad absoluta en sede administrativa como la declaratoria de lesividad que debe preceder la demanda ante la jurisdicción contencioso-administrativa, no son resorte de la Procuraduría General de la República, sino de la administración correspondiente, siguiendo estas reglas: “Artículo 173.-

  • 1)Cuando la nulidad absoluta de un acto declaratorio de derechos sea evidente y manifiesta, podrá ser declarada por la Administración en la vía administrativa, sin necesidad de recurrir al contencioso-administrativo de lesividad, previsto en el Código Procesal Contencioso-Administrativo, previo dictamen favorable de la Procuraduría General de la República; este dictamen es obligatorio y vinculante. Cuando la nulidad absoluta verse sobre actos administrativos directamente relacionados con el proceso presupuestario o la contratación administrativa, la Contraloría General de la República deberá rendir el dictamen. En ambos casos, los dictámenes respectivos deberán pronunciarse expresamente sobre el carácter absoluto, evidente y manifiesto de la nulidad invocada.
  • 2)Cuando se trate de la Administración central del Estado, el ministro del ramo que dictó el respectivo acto deberá declarar la nulidad. Cuando se trate de otros entes públicos o Poderes del Estado, deberá declararla el órgano superior supremo de la jerarquía administrativa. Contra lo resuelto cabrá recurso de reposición o de reconsideración, en los términos del Código Procesal Contencioso-Administrativo.
  • 3)Previo al acto final de anulación de los actos a que se refiere este artículo, la Administración deberá dar audiencia a las partes involucradas y cumplir con el debido procedimiento administrativo ordinario dispuesto en esta Ley.
  • 4)La potestad de revisión oficiosa consagrada en este artículo, caducará en un año, a partir de la adopción del acto, salvo que sus efectos perduren.
  • 5)La anulación administrativa de un acto contra lo dispuesto en este artículo, sea por omisión de las formalidades previstas o por no ser absoluta, evidente y manifiesta, será absolutamente nula, y la Administración estará obligada, además, al pago por daños, perjuicios y costas; todo sin perjuicio de las responsabilidades personales del servidor agente, de conformidad con el segundo párrafo del artículo 199.
  • 6)Para los casos en que el dictado del acto administrativo viciado de nulidad absoluta, evidente y manifiesta corresponda a dos o más ministerios, o cuando se trate de la declaratoria de nulidad de actos administrativos relacionados entre sí, pero dictados por órganos distintos, regirá lo dispuesto en el inciso d) del artículo 26 de esta Ley.
  • 7)La pretensión de lesividad no podrá deducirse por la vía de la contrademanda.” (art. 173, LGAP, negritas agregadas). “Artículo 34.-
  • 1)Cuando la propia Administración, autora de algún acto declarativo de derechos, pretenda demandar su anulación ante la Jurisdicción Contencioso-Administrativa, previamente el superior jerárquico supremo deberá declararlo lesivo a los intereses públicos, económicos o de cualquier otra naturaleza. El plazo máximo para ello será de un año, contado a partir del día siguiente a aquel en que haya sido dictado, salvo si el acto contiene vicios de nulidad absoluta, en cuyo caso, dicha declaratoria podrá hacerse mientras perduren sus efectos. En este último supuesto, el plazo de un año correrá a partir de que cesen sus efectos y la sentencia que declare la nulidad lo hará, únicamente, para fines de su anulación e inaplicabilidad futura.
  • 2)La lesividad referente a la tutela de bienes del dominio público no estará sujeta a plazo.
  • 3)Corresponderá al Consejo de Gobierno la declaratoria de lesividad de los actos administrativos dictados por dos o más ministerios, o por estos con algún ente descentralizado. En tales supuestos, no podrán ser declarados lesivos por un ministro de distinto ramo.
  • 4)La declaratoria de lesividad de los actos dictados por órganos administrativos con personalidad jurídica instrumental, será emitida por el superior jerárquico supremo.
  • 5)La pretensión de lesividad no podrá deducirse por la vía de la contrademanda.” (art. 34, Código Procesal Contencioso-Administrativo, negritas agregadas)…” (folios 842 frente y vuelto). A la hora de adoptar la decisión en el caso concreto, el Tribunal de Apelación concluyó: “…incluso si esta cámara deja de lado que la Asamblea Legislativa no ha otorgado a la sede penal la competencia para revocar actos administrativos en detrimento de los derechos subjetivos de una persona (al menos no como sucede aquí, tras haberse descartado la comisión de un delito en una sentencia firme, a saber, la número 1009-2018, donde tanto Guiselle como su hermana, Sonia, ambas [Nombre 006], fueron absueltas), tampoco podría soslayarse que la Procuraduría General de la República no está facultada para solicitar el derribo de la obra, lo cual en todo caso -se insiste- solo sería plausible luego de que la autoridad jurisdiccional competente haya decretado la nulidad de los actos municipales que otorgaron derechos a [Nombre 007]. Dicho en otras palabras, no puede la licenciada Mora Salguero obviar el trámite que se mencionó supra y pretender que un tribunal penal, al ordenar el derribo, disponga tácitamente la nulidad dicha, máxime cuando una decisión de semejante envergadura puede afectar a terceros que también han construido sus viviendas al amparo de esos actos, por ejemplo, aquel donde se avaló el plano de la urbanización. Por todo lo expuesto, esta cámara dispone acoger el recurso que formula la defensa técnica de la parte demandada civil y revocar la sentencia recurrida, únicamente en cuanto: i) ordenó al alcalde de Santa Ana derribar la casa construida en la finca propiedad de [Nombre 007] y retirar los escombros; ii) dispuso que la resolución le fuese notificada al citado alcalde de manera personal y advirtió a este acerca de que, de no cumplir con lo ordenado, se le testimoniarán piezas por el delito de desobediencia a la autoridad. En su lugar, de oficio se decreta la incompetencia material para conocer la demanda formulada por la Procuraduría General de la República y se omite pronunciamiento en cuanto a ella, manteniendo lo resuelto sobre la ausencia de condena en costas de ambas partes por haber razón plausible de litigio, aunque no en esta vía. Deberá esta parte procesal, si así lo estima oportuno, gestionar lo que corresponda a efectos de que se discuta el tema de la nulidad de los actos administrativos involucrados y el derribo pretendido en la jurisdicción contencioso-administrativa…” (folios 842 frente y vuelto). C. Argumentos que llevan a esta Cámara a declarar sin lugar el primer motivo del recurso de casación formulado por la representante de la Procuraduría General de la República. Para esta Sala, la decisión tomada por el Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José mediante resolución N° 2022-1794, se encuentra ajustada a Derecho. Dicho pronunciamiento declaró con lugar el recurso de apelación formulado por la defensa técnica de la parte demandada civil (por razones distintas a las alegadas) y, en consecuencia, dispuso la revocatoria de la sentencia N° 048-2022, del Tribunal Penal del Tercer Circuito Judicial de San José, sede Puriscal, en cuanto: i) ordenó al alcalde de Santa Ana derribar la casa construida en la finca propiedad de [Nombre 007] y retirar los escombros; ii) dispuso que la resolución le fuese notificada al citado alcalde de manera personal, advirtiendo a este acerca de que, de no cumplir con lo ordenado, se le testimoniarán piezas por el delito de desobediencia a la autoridad. Como un primer aspecto, cabe aclarar que lo resuelto por el ad quem, en el caso particular, se ajusta a las facultades que se le han concedido legalmente. El numeral 465 del Código Procesal Penal dispone: “Procedencia del recurso de apelación. El recurso de apelación de sentencia permitirá el examen integral del fallo, cuando la parte interesada alegue inconformidad con la determinación de los hechos, la incorporación y valoración de la prueba, la fundamentación jurídica o la fijación de la pena. El tribunal de alzada se pronunciará sobre los puntos que le sean expresamente cuestionados, pero declarará, aun de oficio, los defectos absolutos y quebrantos al debido proceso que encuentren en la sentencia”. En concordancia con lo anterior, el artículo 465 de ese mismo cuerpo normativo, señala: “Examen y resolución. El tribunal de apelación de sentencia apreciará la procedencia de los reclamos invocados en el recurso y sus fundamentos, de modo que pueda valorar la forma en que los jueces de juicio apreciaron la prueba y fundamentaron su decisión. Hará uso de los registros que tenga disponibles, reproducirá la prueba oral del juicio cuando lo estime necesario, pertinente y útil para la procedencia del reclamo, y hará la valoración integral que corresponda con el resto de las actuaciones y la prueba introducida por escrito. Si el tribunal de apelación estima procedente el recurso, anulará total o parcialmente la resolución impugnada y ordenará la reposición del juicio o de la resolución. Cuando la anulación sea parcial, se indicará el objeto concreto del nuevo juicio o resolución. En los demás casos, enmendará el vicio y resolverá el asunto de acuerdo con la ley aplicable…”. Al estudiar estas disposiciones, en otras oportunidades esta Cámara ha apuntado: “…A partir, de un análisis conjunto de ambas normas, es claro que los jueces de segunda instancia, además de tener competencia para anular, sea parcial o totalmente la sentencia objeto de impugnación y ordenar con ello el juicio de reenvío, también pueden de manera directa enmendar el vicio y resolver conforme a la ley aplicable…” (Sala de Casación Penal, resolución N° 2023-00087, de las 10:09 horas, del 26 de enero de 2023; integrada por Solano, Ramírez, Alfaro, Zúñiga y Segura). Valga adelantar, que, del estudio de la resolución emitida por el Tribunal de Alzada, lejos de colegirse la afectación alegada por la impugnante, se ratifica que lo resuelto tiene como sustento la aplicación sistemática de disposiciones jurídicas contenidas en la Ley General de la Administración Pública y el Código Procesal Contencioso Administrativo, lo anterior, acorde con el principio constitucional del debido proceso. Se advierte, entonces, que el Tribunal de Apelación cumplió con el examen integral, de tal suerte, que se detuvo de forma armónica y suficiente en la fundamentación jurídica, descartándose, en consecuencia, que se haya excedido sus potestades al dirimir por el fondo el presente asunto. Debe tenerse presente que, aunque la restitución de las cosas al estado anterior puede disponerse de manera oficiosa, no por ello debe pensarse que, siempre debe concederse (como pareciera entenderlo la recurrente). Si bien, en el caso concreto, la representación estatal (Procuraduría General de la República) ejerció una pretensión relativa a la restitución de las cosas al estado anterior, no se comparte la afirmación de la casacionista, en el sentido de que no se ajusta a Derecho el remitir a la parte interesada a otra jurisdicción (contenciosa administrativa), para que inicie un proceso jurisdiccional de lesividad. Contrario a lo que plantea la señora Procuradora, la circunstancia de que el Tribunal de Apelación no acogiera su pretensión de restitución de las cosas a su estado anterior (derribo de la vivienda y retiro de los escombros), de manera alguna implica que con ello se infringiera lo estipulado por los ordinales 103 del Código Penal y 140 y 366 del Código Procesal Penal, por cuanto existen disposiciones normativas contenidas en la Ley General de la Administración Pública (LGAP) y el Código Procesal Contencioso Administrativo que, ante la dinámica de los hechos acontecidos, prevalecen en el caso concreto. La LGAP establece que la Administración es responsable frente a los administrados “…por todos los daños que cause su funcionamiento legítimo o ilegítimo, normal o anormal, salvo fuerza mayor, culpa de la víctima o hecho de un tercero…” (artículo 190 inciso 1)); debiendo reparar “…todo daño causado a los derechos subjetivos ajenos por faltas de sus servidores cometidas durante el desempeño de los deberes del cargo o con ocasión del mismo…” (numeral 191). Asimismo, la Administración debe responder “…por sus actos lícitos y por su funcionamiento normal cuando los mismos causen daño a los derechos del administrado en forma especial, por la pequeña proporción de afectados o por la intensidad excepcional de la lesión…” (ordinal 194 inciso 1)). Aunque la LGAP prevé que la nulidad absoluta de un acto puede declararse en vía administrativa, sin necesidad de recurrir al proceso contencioso-administrativo de lesividad, claramente establece que ello sólo es así en caso de nulidades evidentes y manifiestas (artículo 173 inciso 1)), lo cual, prima facie se ha descartado este asunto, pues se acreditó que, de previo a la construcción de la vivienda, se solicitaron los respectivos permisos de uso de suelo y de construcción, los cuales fueron emitidos por la Municipalidad de Santa Ana. Mediante sentencia oral N°1009-2018, de las 13:13 horas, del 17 de agosto de 2018, el Tribunal Penal del Tercer Circuito Judicial de San José, sede Suroeste, Pavas, absolvió, por certeza, de toda pena y responsabilidad, de un delito de Infracción a la Ley Forestal, a las encartadas [Nombre 006] y [Nombre 007], decisión que -en lo que respecta al hecho delictivo- adquirió firmeza desde el año 2018. En esa oportunidad, la jueza del Tribunal Penal que absolvió a las señoras Argüello Venegas, al emitir dicha sentencia argumentó: “…Ahora bien, en el caso de doña Guiselle, doña Guiselle es clara, es contundente, no niega en ningún momento que ella haya realizado la construcción, no trata de ocultar esa situación y ella indica yo construyo al amparo de la ley, yo construyo con los permisos que correspondían. El Estado era la persona que me tenía que otorgar los permisos a través del ente municipal y eso es lo que yo hago, el ingeniero empieza la construcción tal y como yo lo contrato, tal y como yo estoy legitimada para hacerlo y yo lo hago; incluso a la fecha en que inicio las obras, ni siquiera a esa fecha soy notificada, tampoco soy notificada de ninguna anomalía posterior a la finalización de las obras…” ( ) “…el mismo don [Nombre 005] fue muy claro, que es la persona responsable, de la situación, de los permisos municipales, y él nos viene y nos esclarece el tema, de que en el caso de doña Guiselle, ella definitivamente sí contaba, en su entender, porque en un primer inicio, nos dijo que él desconocía si le habían dado los permisos o no, pero después él dijo que sí se le había dado el permiso de construcción, porque el uso de suelo no se le había ni siquiera condicionado, y que si el uso de suelo a ella se le hubiere condicionado, a ella no se le hubiesen dado los permisos de construcción. Don [Nombre 005] nos amplió incluso el tema de si la Municipalidad se hubiere enterado de esta situación y es por un tema precisamente de una construcción y por eso nosotros no tenemos duda, mi persona no tiene duda en cuanto a que doña Guiselle construyó con permisos. ¿Y por qué? Porque don [Nombre 005] es muy claro y es contundente en decirnos que cuando doña Sonia construye, a ella no se le deniega ni se le limita el permiso de uso de suelo, y que incluso, ni siquiera la Municipalidad, tenía para la fecha en que doña Sonia termina esa construcción, conocimiento de que esa naciente estuviera ahí, y que hubiese algunas áreas, algunas propiedades que pudiesen estar invadiendo el área de protección. Si no es por el señor [Nombre 004], él no empieza las averiguaciones y no se empieza toda esta situación. Entonces de ahí que él tiene claro que los permisos que se dieron, tanto de doña Guiselle como de cualquier otra construcción existente en el lugar se dieron correctamente…” (Archivo digital 120014210283PE-17082018011227-2_MultiMedia—0 correspondiente a la sentencia oral, minutos 01:20:15 a 01:21:00 y 01:23:15 a 01:25:10). Por su parte, se tiene que, habiéndose dispuesto varios reenvíos (vinculados exclusivamente con la solicitud de la restitución de las cosas al estado previo a los hechos), el Tribunal Penal del Tercer Circuito Judicial de San José, Sede Puriscal, dictó la sentencia N° 048-2022, de las 09:30 horas, del 26 de enero de 2022 (que es precisamente la que fue conocida en alzada por el Tribunal de Apelación en el voto N° 2022-1794), en la cual se consignó: “…De los autos se desprende que para la edificación de la vivienda en cuestión, la señora [Nombre 006] contaba con visados y permisos municipales, tan es así, que ello constituyó uno de los motivos para que el Tribunal Penal de Pavas la absolviera por certeza en el delito de Infracción a la Ley Forestal que se le venía atribuyendo…” (folio 766 frente). Sobre este extremo, precisamente el Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José, en la resolución N° 2022-1794 (aquí recurrida), refirió: “…Ahora, nota esta cámara que el órgano jurisdiccional pasó por alto un hecho de suma importancia y que se desprende de la prueba examinada (y que, sin incorporarlo al acápite de hechos probados, lo consideró así en la fundamentación intelectiva de la sentencia, en concreto, a folio 766 frente), a saber, que la Municipalidad de Santa Ana concedió los permisos correspondientes, tanto de uso de suelo como de construcción…” (folio 838 vuelto). No resulta atendible la posición de la representante de la Procuraduría General de la República, para quien, en el contexto en que acontecieron los hechos, debe disponerse el derribo de la vivienda en sede penal (de ahí que esté en desacuerdo con la decisión del ad quem). Coincide esta Sala con el Tribunal de Alzada, en que, en un caso como el presente, en el que se demostró que las encartadas [Nombre 006] (se les absolvió por certeza penalmente) contaban con los permisos de construcción requeridos por la Administración (Municipalidad) para construir, el tema del derribo o demolición de la vivienda objeto de la litis, es una discusión que debe hacerse en la vía contenciosa-administrativa mediante un proceso de lesividad (que garantice, además del derecho de defensa, un eventual resarcimiento a la parte perjudicada por los actos de la Administración) y no en la vía penal. Al respecto, el numeral 34 del Código Procesal Contencioso Administrativo establece: “…1) Cuando la propia Administración, autora de algún acto declarativo de derechos, pretenda demandar su anulación ante la Jurisdicción Contencioso-Administrativa, previamente el superior jerárquico supremo deberá declararlo lesivo a los intereses públicos, económicos o de cualquier otra naturaleza. El plazo máximo para ello será de un año, contado a partir del día siguiente a aquel en que haya sido dictado, salvo si el acto contiene vicios de nulidad absoluta, en cuyo caso, dicha declaratoria podrá hacerse mientras perduren sus efectos. En este último supuesto, el plazo de un año correrá a partir de que cesen sus efectos y la sentencia que declare la nulidad lo hará, únicamente, para fines de su anulación e inaplicabilidad futura. 2) La lesividad referente a la tutela de bienes del dominio público no estará sujeta a plazo…”. En relación con el proceso de lesividad, el Tribunal Contencioso Administrativo recientemente ha dicho: “…es un mecanismo jurisdiccional, por medio del cual el legislador ordinario autorizó a las Administraciones Públicas, a deducir pretensiones anulatorias respecto de actos declaratorios de derechos subjetivos dictados por ellas. En estos tipos de procesos judiciales, se analiza la validez de una conducta formal concreta, que tal y como se indicó líneas atrás, genera derechos subjetivos a favor de un administrado -persona física o jurídica-. Precisamente por ello, se hace necesaria la obligada participación del destinatario del acto cuya nulidad se pretende, a efectos de garantizar no solamente el contradictorio, sino el ejercicio oportuno de su derecho de defensa. El artículo 34 del Código Procesal Contencioso Administrativo, es la norma que fija los elementos previos y regulaciones procesales de esta figura. Sin embargo, dicho precepto normativo debe concordarse con los numerales 173.6 y 183, ambos de la Ley General de la Administración Pública a efecto de tener un panorama completo sobre la temática que se aborda. Precisamente de la referida concordancia, se concluye que en este tipo de Procesos la legitimación activa se concede a la Administración emisora del acto atacado, en tanto que el legitimado pasivo es el administrado destinatario de los efectos de esa conducta formal. Ello es así, por cuanto como se indicó líneas atrás, la lesividad se constituye en un instrumento de supresión jurídica de actos administrativos concretos creadores de derechos subjetivos, en el tanto los mismos sean sustancialmente disconformes con el ordenamiento jurídico -actos viciados de nulidad absoluta o relativa- (artículos 128, 158, 165 y concordantes de la Ley General de la Administración Pública). Así entonces, el proceso de lesividad, es una garantía más para el administrado, en el que en aplicación del principio de intangibilidad de los actos propios, la Administración no puede por sí misma eliminar los efectos de una acto declaratorio de derechos subjetivos, sino es a través de este proceso y por parte de un Tribunal, independiente de la Administración autora del acto que se pide anular por lesivo al interés público…” ( ) “…En síntesis, conforme lo hasta aquí señalado, para la instauración de un Proceso de Lesividad y consecuente pronunciamiento sobre el fondo del asunto, se requiere: i) la existencia de un acto administrativo concreto, firme y declaratorio de derechos subjetivos; ii) que dicha conducta formal, tenga vicios de nulidad absoluta o relativa; iii) que el referido acto haya sido declarado lesivo a los intereses públicos, económicos o de cualquier otra naturaleza en sede administrativa, por el Superior Jerárquico Supremo de la Administración emisora del mismo; iv) que tal declaratoria de lesividad se realice dentro del plazo del año previsto en el numeral 34 del CPCA -salvo en lo relativo a la tutela de bienes de dominio público que no está sujeto a plazo -artículo 34.2 del CPCA; v) que el Proceso Contencioso de Lesividad se incoe por la Administración Pública emisora del acto, en el plazo del año previsto por el artículo 39.1.e del CPCA -con la salvedad dicha en cuanto a los bienes de dominio público-…” (voto N° 39-2023-IV, de las 15:00 horas, del 24 de abril del 2023, del Tribunal Contencioso Administrativo, Sección Cuarta, del Segundo Circuito Judicial de San José, Goicoechea). En la especie, si bien, la representación estatal (Procuraduría General de la República) ejerció una pretensión relativa a la restitución de las cosas al estado anterior, no se comparte la afirmación de la casacionista, en el sentido de que no se ajusta a Derecho (y que con ello se esté desprotegiendo la potestad del Estado de defender y garantizar el derecho a un ambiente sano para beneficio de la colectividad) el remitir a la parte interesada a otra jurisdicción (contenciosa administrativa), para que inicie un proceso de lesividad. Debe tenerse presente que en el proceso penal no es posible anular actos administrativos válidos. En esta sede se carece de la competencia que precisamente sí tienen los Tribunales contenciosos-administrativos (para lo cual se deben cumplir requisitos formales, temporales, etc.). Véase, que, por ejemplo, tampoco es posible indemnizar, en la vía penal, a la persona que, por error de la Administración, obtiene un derecho, lo que sí resulta procedente en la jurisdicción contencioso-administrativa. En resumen, ante un caso como el que nos encontramos, en los términos expuestos, el derribo de la vivienda, sólo sería plausible en caso de que la autoridad jurisdiccional competente decrete la nulidad de los actos municipales (permisos administrativos) que les permitieron a las demandadas civiles construir la vivienda objeto de la litis. De ahí que deberá la parte interesada, si así lo estima oportuno (en procura de la defensa de eventuales intereses ambientales), gestionar lo correspondiente, en la jurisdicción contencioso-administrativa. Así las cosas, al no resultar atendible el primer reproche de la impugnante, con base en las consideraciones expuestas, se declara sin lugar.

IV.En su segundo reclamo, la representación del Estado aduce errónea fundamentación de la sentencia por inaplicación del artículo 464 del Código Procesal Penal. Señala que la resolución aquí impugnada, declara una incompetencia material y omite pronunciamiento sobre la solicitud de restitución respecto a las obras constructivas utilizadas por la señora [Nombre 007]. Agrega la recurrente que el ad quem remite a los permisos concedidos por la Municipalidad de Santa Ana, los cuales ubica en folios 117 al 119. Arguye que la sentencia quebranta el ordenamiento jurídico al valorar documentos que no fueron incorporados ni discutidos en juicio, conculcando así los principios más elementales de apreciación de la prueba y las reglas de la sana crítica, lo mismo que una transgresión a la lealtad, no solo entre las partes adversas, sino también del juzgador hacia estas. Seguidamente, la licenciada Mora Salguero enlista la prueba documental incorporada por el Tribunal Penal de Juicio del Tercer Circuito Judicial de San José al resolver lo concerniente a la restitución de las cosas a su estado anterior (cfr. folio 850 frente y vuelto).

Acota que en el acta de debate consta que las partes estuvieron de acuerdo con la incorporación de dicha prueba, siendo claro que los documentos de folios 117 al 119 no fueron admitidos para su discusión en juicio. Cuestiona que a pesar de lo anterior la sentencia N° 1794-2022 emplea esos memoriales para declarar la incompetencia material, lesionando así las normas de incorporación de la prueba y las reglas para su respectiva valoración. Concluye que no se puede reprochar al a quo ausencia de análisis de dichos documentos toda vez que no fueron parte del elenco probatorio admitido. Advierte que el artículo 464 del Código de rito dispone que el tribunal de apelación -a petición de parte tendrá la facultad de examinar los registros de las pruebas producidas en el juicio; de manera que -como corolario- le está vedado valorar otras pruebas distintas de las admitidas. Finaliza su exposición enfatizando que la sentencia recurrida inaplicó el contenido de los artículos 464 y 465 ibid, pues basó su decisión en prueba no admitida.

Como agravio, apunta que hay un quebranto del artículo 142 del Código Procesal Penal, puesto que no hay una debida fundamentación si se infringen las reglas de la sana crítica respecto a los medios o elementos probatorios considerados para adoptar la decisión. Estima que el fallo, respaldado en prueba que no se ofreció para juicio, incidió negativamente en los intereses del Estado para la protección del ambiente, quebrantando la obligación de la sentencia de fundamentarse en prueba válida y objeto de debate por las partes. Solicita se declare con lugar el reclamo, se anule la sentencia recurrida y se confirme la resolución N° 48-2022, de las 09:30 horas del 26 de enero de 2022 del Tribunal Penal de Juicio del Tercer Circuito Judicial de San José, o en su defecto, se ordene el reenvío para que por el fondo se resuelva la apelación, como en Derecho corresponde. Se declara sin lugar el segundo motivo presentado.

La tesis fundamental invocada por la impugnante consiste en señalar que el Tribunal de Apelación de Sentencia, resolvió el recurso de apelación valorando prueba documental (permisos concedidos por la Municipalidad de Santa Ana, visibles a folios 117 al 119 del tomo I del expediente principal) que no fue incorporada ni discutida en juicio, conculcando principios elementales de apreciación de la prueba y las reglas de la sana crítica. Con el fin de precisar por qué no existe una errónea fundamentación de la sentencia capaz de declarar la nulidad del fallo de alzada, se debe acudir primeramente a lo que resolvió el a quo para tener claridad de lo expuesto por el ad quem. Conforme se adelantó al resolver el primer reclamo del recurso de casación, por sentencia oral N°1009-2018, de las 13:13 horas, del 17 de agosto de 2018, el Tribunal Penal del Tercer Circuito Judicial de San José, sede Suroeste, Pavas, absolvió, por certeza, de toda pena y responsabilidad, a [Nombre 006] y a [Nombre 007], de un delito de Infracción a la Ley Forestal, en perjuicio de los recursos naturales.

Esa decisión, en cuanto a dicho extremo, quedó firme desde el año 2018. La jueza del Tribunal Penal que emitió dicha sentencia, afirmó: “…En ningún momento, en el transcurso administrativo, tema administrativo de obtener los permisos de construcción, ella fue informada como propietaria del inmueble que existiese ningún tipo de prohibición o de condicionamiento tanto a la ubicación de la construcción en el terreno como ni al área de construcción que la Municipalidad le otorgó en ese momento. Si bien es cierto, la prueba documental del uso de suelo y los permisos municipales fue rechazada por otras vías se logró determinar, porque fue el mismo Gestor, don [Nombre 005], quien nos vino a relatar aquí que él tiene muy claro todo este conflicto, toda esta situación, de ambas hermanas Arguello, porque él en ese momento era quien fungía como gestor ambiental, Municipal, más bien, y que posteriormente pasó a otro cargo…” ( ) “…Ahora bien, en el caso de doña Guiselle, doña Guiselle es clara, es contundente, no niega en ningún momento que ella haya realizado la construcción, no trata de ocultar esa situación y ella indica yo construyo al amparo de la ley, yo construyo con los permisos que correspondían.

El Estado era la persona que me tenía que otorgar los permisos a través del ente municipal y eso es lo que yo hago, el ingeniero empieza la construcción tal y como yo lo contrato, tal y como yo estoy legitimada para hacerlo y yo lo hago; incluso a la fecha en que inicio las obras, ni siquiera a esa fecha soy notificada, tampoco soy notificada de ninguna anomalía posterior a la finalización de las obras…” ( ) “…el mismo don [Nombre 005] fue muy claro, que es la persona responsable, de la situación, de los permisos municipales, y él nos viene y nos esclarece el tema, de que en el caso de doña Guiselle, ella definitivamente sí contaba, en su entender, porque en un primer inicio, nos dijo que él desconocía si le habían dado los permisos o no, pero después él dijo que sí se le había dado el permiso de construcción, porque el uso de suelo no se le había ni siquiera condicionado, y que si el uso de suelo a ella se le hubiere condicionado, a ella no se le hubiesen dado los permisos de construcción.

Don [Nombre 005] nos amplió incluso el tema de si la Municipalidad se hubiere enterado de esta situación y es por un tema precisamente de una construcción y por eso nosotros no tenemos duda, mi persona no tiene duda en cuanto a que doña Guiselle construyó con permisos. ¿Y por qué? Porque don [Nombre 005] es muy claro y es contundente en decirnos que cuando doña Sonia construye, a ella no se le deniega ni se le limita el permiso de uso de suelo, y que incluso, ni siquiera la Municipalidad, tenía para la fecha en que doña Sonia termina esa construcción, conocimiento de que esa naciente estuviera ahí, y que hubiese algunas áreas, algunas propiedades que pudiesen estar invadiendo el área de protección. Si no es por el señor [Nombre 004], él no empieza las averiguaciones y no se empieza toda esta situación. Entonces de ahí que él tiene claro que los permisos que se dieron, tanto de doña Guiselle como de cualquier otra construcción existente en el lugar se dieron correctamente…” (Archivo digital 120014210283PE-17082018011227-2_MultiMedia—0 correspondiente a la sentencia oral, minutos 01:15:10 a 01:16:15, 01:20:15 a 01:21:00 y 01:23:15 a 01:25:10, la negrita y el subrayado resaltan la importancia de dichas afirmaciones).

Habiéndose dispuesto diversos reenvíos (relacionados únicamente con la solicitud de la restitución de las cosas al estado previo a los hechos), el Tribunal Penal del Tercer Circuito Judicial de San José, Sede Puriscal, dictó la sentencia N° 048-2022, de las 09:30 horas, del 26 de enero de 2022 (conocida en alzada por el Tribunal de Apelación mediante el voto N° 2022-1794), señaló al final del fallo: “…De los autos se desprende que para la edificación de la vivienda en cuestión, la señora [Nombre 006] contaba con visados y permisos municipales, tan es así, que ello constituyó uno de los motivos para que el Tribunal Penal de Pavas la absolviera por certeza en el delito de Infracción a la Ley Forestal que se le venía atribuyendo…” (folio 766 frente). De lo recién trascrito se colige que, en primera instancia quedó plenamente establecido que las señoras [Nombre 006] actuaron amparadas por los permisos que la propia Municipalidad les concedió para el establecimiento de una urbanización y la construcción de una vivienda.

En relación con este tópico, el Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José, en la resolución N° 2022-1794 (aquí impugnada), sostuvo: “…nota esta cámara que el órgano jurisdiccional pasó por alto un hecho de suma importancia y que se desprende de la prueba examinada (y que, sin incorporarlo al acápite de hechos probados, lo consideró así en la fundamentación intelectiva de la sentencia, en concreto, a folio 766 frente), a saber, que la Municipalidad de Santa Ana concedió los permisos correspondientes, tanto de uso de suelo como de construcción (cfr. f. 117 a 119, años 2010 y 2011. Véase también los permisos otorgados a [Nombre 006], f. 97 en adelante). Cabe apuntar aquí que el inmueble es uno más de los que integran la Urbanización Hacienda Paraíso, creada años antes y cuyo plano (que fue visado por el INVU) también contó con el aval del ente municipal al punto que, luego, se otorgaron permisos de construcción en ese lugar (cfr. f. 18, 97 a 120 del tomo I).

De lo expuesto, queda claro que la demandada civil [Nombre 007] habría actuado (al igual que su hermana Sonia) de buena fe, amparada en los permisos que la propia Administración Pública otorgó, primero para que se estableciese la urbanización citada y luego para que, en el inmueble que compró doña [Nombre 007] en el año 2010 (f. 18 citado), se construyese una casa de habitación. Dicho en otras palabras (y a diferencia de lo que suele suceder en la mayoría de casos de invasión a áreas de conservación o protección) en este asunto tuvieron lugar varios actos administrativos en favor de quien ahora figura como demandada civil, mismos que primero la Procuraduría General de la República y luego el tribunal, pretenden ignorar, al ordenar el derribo de la casa de habitación desconociendo el principio de intangibilidad de tales actos y la vía que el ordenamiento jurídico costarricense dispone para revisarlos o anularlos, a saber, el proceso contencioso administrativo de lesividad…” (folios 838 vuelto a 839 frente).

Efectivamente, tal y como lo sostiene la representante de la Procuraduría General de la República, los permisos concedidos por la Municipalidad de Santa Ana, visibles a folios 117 al 119 del tomo I del expediente principal, no fueron aceptados e incorporados al debate, sin embargo, la casacionista omite indicar que este punto incluso fue aceptado por el Tribunal Penal del Tercer Circuito Judicial de San José al dictar la sentencia oral N° 1009-2018, oportunidad en que se dijo que la existencia de esos permisos fue corroborada por otros elementos de prueba (valga citar las declaraciones de las señoras [Nombre 006] y del testigo [Nombre 005]). Sobre el particular, en la sentencia N° 1009-2018 se dijo: “…En ningún momento, en el transcurso administrativo, tema administrativo de obtener los permisos de construcción, ella fue informada como propietaria del inmueble que existiese ningún tipo de prohibición o de condicionamiento tanto a la ubicación de la construcción en el terreno como ni al área de construcción que la Municipalidad le otorgó en ese momento.

Si bien es cierto, la prueba documental del uso de suelo y los permisos municipales fue rechazada por otras vías se logró determinar, porque fue el mismo Gestor, don [Nombre 005], quien nos vino a relatar aquí que él tiene muy claro todo este conflicto, toda esta situación, de ambas hermanas Arguello, porque él en ese momento era quien fungía como gestor ambiental, Municipal, más bien…” (Archivo digital 120014210283PE-17082018011227-2_MultiMedia—0 correspondiente a la sentencia oral, minutos 01:15:10 a 01:16:15). El tema de los permisos municipales siempre fue de conocimiento de la representación de la Procuraduría General de la República. Incluso, tal y como se consigna a partir del folio 829 frente de la sentencia de apelación N° 2022-1794, en la vista oral de apelación efectuada el 10 de agosto de 2022, ante la intervención del licenciado Rodrigo Rosales Arce, abogado de la parte demandada civil, se consignó: “…El plano oficial, que data de 1982, legitimó a sus representadas a construir y a la municipalidad a otorgar los permisos…” ( ) “…A folios 117 y 118 se indica que el uso dado cumple con las regulaciones de la zona (de lo que se desprende que las hermanas actuaron basadas en el principio de confianza)…” (folios 829 vuelto a 830 frente).

En la sentencia de apelación N° 2022-1794, también se consignaron las manifestaciones realizadas, en la vista oral de apelación, por parte de [Nombre 006] y [Nombre 007]. Con respecto a la primera se anotó: “…Mi hermana y yo compramos terrenos por un plan de vida, ella construyó en 2011 con todo lo de ley, uso de suelo, etc., en 2012 voy a construir, pido uso de suelo, hago los planos, el Colegio de Ingenieros da el permiso; el 1 de junio de 2012 el banco haría el avalúo, mandé chapear el terreno para el perito del banco. [Nombre 004] vio la chapea y empezó su denuncia. El 1 de julio me dan el permiso. El 13 de ese mes me llega un fax indicando que debía parar las obras porque un vecino denunció sobre la existencia de una naciente cercana a la propiedad y debían preguntar al MINAE. Dice doña Sonia que fue entonces cuando se da cuenta de que tenía una naciente. Fue a la municipalidad, don [Nombre 005] la atiende y le cuenta que un vecino denuncia que hay una naciente cerca y el MINAE debe concretar las limitaciones.

Don [Nombre 005] dice que hay limitaciones de 100 metros, le pregunta por qué permiten segregaciones y que se tramiten los planos catastrales. Le hace ver que ella no compra un terreno por adorno, lo hace para construir. El permiso de construcción se lo dio la misma municipalidad, ese ente no sabía cómo estaban las cosas…” (folio 830 vuelto). En relación con [Nombre 007] se apuntó: "En 2010 compran dos terrenos en Hacienda Paraíso, la municipalidad extiende la certificación de uso de suelo, señalando que es para construcción de viviendas unifamillares. En 2011 pide un préstamo para construir que aún está pagando, le quedan 15 años. Tramita permisos; tiene la aprobación de planos por el CFIA y la certificación de uso de suelo, una que avala lo que dice el plan regulador. El terreno se ubica en zona residencial, hay disponibilidad de agua por Acueductos y Alcantarillados. El permiso de construcción que da la municipalidad de Santa Ana no tiene limitación.

Construyó en 2011 y su hermana en 2012. Ella solicitó un préstamo, sacó planos y permisos (sin restricción alguna), todo igual…” (folio 831 vuelto). En el caso concreto, es cierto que el abordaje del ad quem sobre el extremo en cuestión puede generar confusión en el planteamiento del tema, pues formalmente no se incorporó al proceso la prueba documental visible de folios 117 al 119 del tomo I del expediente principal (permisos concedidos por la Municipalidad de Santa Ana), sin embargo, la existencia de los permisos municipales es una circunstancia que quedó acreditada en juicio. En otras palabras, aún si se suprimieren hipotéticamente las afirmaciones del Tribunal de Apelación en lo que respecta a la información contenida en dichos folios, lo cierto es que el reproche de la casacionista no incide sustancialmente en la fundamentación intelectiva de la resolución cuestionada porque existen otras probanzas con plena validez -que se incorporaron al debate- que permiten sostener la decisión adoptada por el Tribunal de Alzada (el derribo de la vivienda, sólo sería plausible en caso de que en la jurisdicción contencioso-administrativa se decrete la nulidad de los actos administrativos dictados que les permitió a las demandadas civiles construir la vivienda objeto de la litis).

Conforme recientemente lo ha dicho esta Sala: “…La operación intelectual de la supresión hipotética que a veces aplican los tribunales en sus resoluciones, se constituye en un instrumento válido de análisis con el objetivo de examinar si, al suprimir o eliminar mentalmente la prueba que presente alguna controversia, subsisten otros elementos probatorios, legítimos en sí, capaces de sostener lo que se resuelve en el proceso, para que la sentencia mantenga su validez…” (Sala de Casación Penal, resolución N° 2023-00553, de las 10:17 horas, del 15 de junio de 2023; integrada por Solano, Alfaro, Zúñiga, Segura y Acón). Así las cosas, con base en lo expuesto, al no verificarse un vicio esencial que declarar y, por ende, no existiendo, razón alguna para declarar la nulidad del fallo de alzada, corresponde declarar sin lugar el segundo motivo de casación formulado por la representante de la Procuraduría General de la República.

Por Tanto:

Se declaran sin lugar los motivos primero y segundo del recurso de casación incoado por la representante de la Procuraduría General de la República. Notifíquese.
