Document Review Case File: 03-001647-0283-PE Decision: 2021-01385 CRIMINAL CASSATION CHAMBER. San José, a las diez horas cuarenta y cinco minutos del veintiséis de noviembre de dos mil veintiuno.

Appeal on points of law (recurso de casación) filed in the present case brought against [Nombre 001], of legal age, Costa Rican, identity card number [Nombre 001], for the offenses of aggravated fraud (estafa mayor), committed to the detriment of [Nombre 003]. Justices Patricia Solano Castro, Álvaro Burgos Mata, Gerardo Rubén Alfaro Vargas, Cynthia Dumuni Stradtmann, and Rosa Acón Ng participated in deciding the appeal, the latter two serving as alternate justices. Also appearing at this stage were attorney Segismundo Araya Zúñiga, as private defense counsel for the convicted person, and attorney Jeannette Salazar Araya, as private prosecutor (querellante) and civil claimant (actora civil) representing the injured party. Attorney Carlos Meléndez Lugo appeared as representative of the Public Prosecutor’s Office (Ministerio Público).

Findings:

Whereas:

I.By decision Nº 2020-01641, de las 18:55 horas, de 27 de noviembre de 2020, the Chamber admitted for review on the merits the first ground of the appeal on points of law filed by attorney Segismundo Araya Zúñiga in his capacity as private defense counsel for the defendant [Nombre 001], as well as the first argument in the cross-appeal on points of law (casación por adhesión) submitted by the representative of the Public Prosecutor’s Office, attorney Carlos Meléndez Lugo, against decision Nº 2020-0770, de las 10:50 horas, de 18 de mayo de 2020, issued by the Criminal Judgment Appeals Court of the Second Judicial Circuit of San José, Goicoechea, which, by majority vote, partially granted the first and fourth grounds of the appeal filed by private defense counsel. Consequently, it granted the statute-of-limitations defense extinguishing the criminal action and, by majority vote, proceeded to acquit the accused of the criminal penalty imposed by the trial court (a quo). II.Appeal in Cassation (Recurso de Casación) filed by private defense counsel for the accused [Nombre 001]. Admitted ground. First. Violation of the principle of impartiality. Counsel for the accused argues that the ruling issued by the Court of Criminal Judgment Appeals (Tribunal de Apelación de Sentencia) violates provisions 7, 35, 39, 41, 121, subsection 20, 152 and 153 of the Political Constitution; articles 1, 3, 175, 178 subsection a), and subsection b) of provision 468 of the Code of Criminal Procedure (Código Procesal Penal), because it disregards the principles of the natural judge, impartiality, and due process, since, before deciding the appeal, Criminal Court Judge Jiménez Fernández, “… had opened one of the trials in this same case; and, acting as a Trial Judge, annulled the order committing the case for trial (auto de apertura a juicio); they decide (sic) to issue the judgment that I now challenge through this avenue…” (compare folio 1165 of Volume III).

In that regard, he explains that, at the opening of trial on 4 March 2010, at which the case was remanded for a preliminary hearing (audiencia preliminar) in order to cure absolute defects arising “from the declaration of invalidity and ineffectiveness of the aforementioned order committing the case for trial” (compare folio 1166), Jiménez Fernández sat on the Criminal Court together with Attorney Ramírez Angulo, identified at that time as Cinthya Angulo Angulo, who issued conviction judgment N° 1355-2019, at 17:00 hours, on 10 December 2019, of the Tribunal de Juicio de Pavas. He explains that it was not until the issuance of the challenged judgment by the Court of Criminal Judgment Appeals that he was able to determine that Judge Cinthya Angulo Angulo was the same person as Judge Cinthya Ramírez Angulo, because of the judge’s change of name and physical appearance, as well as the time that had elapsed, compounded by the fact that the official did not inform the parties in this case of her prior involvement, which, from his perspective, would have been proper.

Attorney Araya Zuñiga contends that, in the view of the Court of Criminal Judgment Appeals, the participation of Judges Jiménez Fernández and Ramírez Ángulo in the opening of trial on 4 March 2010 did not prevent the latter from serving again as a trial judge and the former as an appellate judge, because, according to that legal view, they did not express any opinion on the merits of the case when they annulled the order committing the case for trial and directed that a new preliminary hearing be held. In opposition to that position, the appellant states that, when the adversarial proceedings began, with both judicial officers already participating, they heard the facts contained in the private criminal complaint (querella) and the charging instrument (pieza acusatoria) read aloud, listened both to the defense’s strategy or theory of the case and to the discussion arising from the presentation of testimonial evidence, and even considered the possibility of reclassifying the alleged factual circumstances under a different legal characterization (recalificar el cuadro fáctico reprochado) (compare folios 1171 to 1172).

Furthermore, he states that those judges “…considered evidence, facts, and arguments, and even annulled an order committing the case for trial, stating that (sic) facts were not included and that there were errors in the legal characterization; and, under the pretext of safeguarding the rights of the accused, what they did was remand the matter for another preliminary hearing so that the defects could be cured; a function that did not belong to the trial court because they were there to adjudicate what had been brought before the court, not to order the instruments or omissions to be patched up…” (compare folio 1174). In that vein, he seeks review of the trial minutes appearing at folios 506 to 508 of the case record, which relate to the opening of trial in March 2010 in which Judges Ramírez Ángulo and Jiménez Fernández participated (compare folios 1175 and 1208). He adds that he wishes the audio recording of the opening of trial on 4 and 5 March 2010 to be assessed in order to establish that those officials familiarized themselves with the facts at issue in the trial and ruled on matters going to the merits.

From the challenger’s perspective, this warranted their recusal (inhibitoria), hence the violation he alleges of the principles of the natural judge and impartiality (compare folio 1208). In support of his argument, he invokes judgment N° 1954-2012 of the Sala de Casación Penal. He considers that the grievance arises from the violation of article 35 of the Political Constitution, reflecting an indifference toward safeguarding “the judicial authority vested in the judges,” thereby giving rise to an absolute defect (defecto absoluto) contemplated in provision 178 of the Code of Criminal Procedure, which he regards as the only possible conclusion. He requests that the challenged judgment be annulled. He seeks a ruling sustaining the ground and annulling the decisions issued by the a quo and the ad quem (compare folios 1180 and 1258, front and back, of the case file, Volume III). The ground is denied.

Defense counsel for the accused asserts that an absolute defect has arisen in these criminal proceedings due to the violation of the principles of the natural judge and impartiality, because, on 4 and 5 March 2010, Judges Kathya Jiménez Fernández and Cinthya Ramírez Ángulo considered the facts alleged in the private criminal complaint and the charging instrument, heard the defense theory of the case, considered the possibility of presenting testimonial evidence and even the eventual possibility of reclassifying the alleged factual circumstances, and familiarized themselves with matters pertaining to the trial and resolved the merits of the dispute; in the opinion of private defense counsel, these circumstances would render null and void ruling N° 2020-0770, at 10:50 hours, on 18 May 2020, issued by the Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José. In that regard, it may be inferred that the central thrust of his argument concerns the events that he expressly identifies as verifiable in the trial minutes dated 4 and 5 March 2010, appearing at folios 506 to 508 of the record.

First, it should be noted that a substantive examination of that specific period reveals the objection based on defective procedural activity (actividad procesal defectuosa) raised by Attorney Araya Zuñiga on the following grounds: i.-) Failure to satisfy the requirements applicable to the special power of attorney (poder especial) granted by the victim to Attorney Álvaro Rodríguez Alfaro, thus emphasizing his lack of standing (legitimación). ii.-) Absence of an examination of the accused (declaración indagatoria) concerning the facts contained in the private prosecution. iii.-) Following the rejection of the private criminal complaint at the preliminary hearing, the factual circumstances read at the beginning of trial by Attorney Rodríguez Alfaro should have been deemed nonexistent, and his participation in the trial should have been disallowed. These issues were resolved by the Tribunal Penal del Tercer Circuito Judicial de San José, Sede Suroeste, composed of Judges Gabriela Rodríguez Morales, Kathya Jiménez Fernández, and Cinthya Ramírez Ángulo, on 5 March 2010, at 10:20 hours, on the grounds set forth below: “First, it should be emphasized that, when articles 179, 422, and 424 of the Code of Criminal Procedure are read together, they establish that rulings and proceedings may be challenged only by the means and in the cases expressly provided for, and that ‘the parties may challenge only judicial decisions that cause them prejudice (…)’ Under that premise, and because the applicant’s arguments consist of assessments compatible with grounds warranting consideration of procedural defects (vicios en el procedimiento), the Court shall rule on the issues raised as follows: The Special Judicial Power of Attorney granted by [Nombre 003], in his capacity as complainant, to Attorney Álvaro Rodríguez Alfaro satisfies the minimum formal requirements and, consequently, the requirement established by article 76 of the Code of Criminal Procedure to the effect that… ‘the private prosecutor (querellante) must act with the assistance of an attorney.

The private criminal complaint may be initiated and pursued by an agent holding a special power of attorney for the case.’ The Court reaches this conclusion upon examining the Special Judicial Power of Attorney appearing at folio 30, dated September 2003, signed by the complainant and authenticated by Attorney Fiorella Flores Rivera. Note that, specifically as relevant here, it states: …to act in my name and on my behalf in these criminal proceedings, with authority to file complaints, as well as to act at all levels of proceedings, pursue ordinary and extraordinary remedies, settle, waive any proceeding or hearing, and seek the recusal of officials (…) This authorization shall remain in effect until the judgment becomes final… The Court further observes that Attorney Rodríguez Alfaro has acted during the preparatory and intermediate stages (compare minutes of the preliminary hearing at folio 391) on behalf of the principal without the interested party having raised any objection to or protested his representation, and he even appeared at trial today accompanied by his attorney.

Accordingly, not only does the literal wording of the document establish the authority that the interested party, as private prosecutor, granted Attorney Rodríguez from the outset of the investigation, but the interested party has also had Attorney Rodríguez represent or accompany him throughout the proceedings. Under these circumstances, the objection is denied and Attorney Rodríguez Alfaro shall remain counsel for the private prosecutor” (compare folio 507, front and back, Volume II). With respect to the second part of the objection based on defective procedural activity, the a quo stated in its ruling: “b) Regarding the failure to examine the accused [Nombre 001] concerning the facts in the private criminal complaint, it must be noted that the Public Prosecutor’s Office did in fact commit that omission by failing to comply with the requirement in the final paragraph of article 300 of the Code of Criminal Procedure.

Based on the proceedings conducted, it has been determined that the examination of the accused [Nombre 001] took place on 19 April 2004, the private criminal complaint was filed on 08 May 2004, and the public prosecutor’s charging instrument was filed with the Criminal Court Judge on 3 March 2008 (compare 179 to 182 of Volume I, folio 50 of the private-criminal-complaint file, folio 339 back of Volume I), without the accused being examined regarding any of the facts not contained in the public prosecutor’s charging instrument. Nevertheless, this is a procedural error that was cured over the course of the proceedings by virtue of the participatory rights afforded to the Defense. In other words, in the Court’s view, although an act was omitted that under other circumstances would violate the right of defense, in this case, and based on articles 91, 95, 300, 316, and 317 of the Code of Criminal Procedure read together, it is deemed that the participatory rights of the accused and his defense counsel have not been limited, diminished, or violated.

First, when he was examined, virtually all the evidence underlying both the public prosecutor’s charging instrument and the private criminal complaint had already been added to the record; a complaint had been filed (folios 1 to 29) that was as detailed as the private criminal complaint subsequently filed, and it therefore came as no surprise to the accused. Second, under article 91 read in conjunction with the cited article 95, the accused may give a statement at any stage of the proceedings and whenever he deems it indispensable, the only requirement being the presence of defense counsel, who has assisted him throughout the proceedings. The Court has also considered that, when the Defense and the other parties were notified of all proceedings pursuant to article 316 of the Code, as reflected in the certificate of service at folio 341, executed at 16:37 hours on 10 March 2008, the accused had the opportunity to become acquainted with and respond to them.

This follows from the motions appearing at folios 343 and 347, filed by the accused’s former private defense counsel, who at that time was also the defendant in the private prosecution, in which she referred to evidence disclosed with the notice convening the preliminary hearing. Lastly, both during the five-day period specified in the order issued at fifteen hours thirty minutes on diez de marzo de dos mil ocho and during the preliminary hearing, the accused had the opportunity to exercise or request any of the powers granted by Article 317 of the Code of Criminal Procedure (Código Procesal Penal). Under the circumstances described, as no violation is found of the Constitutional Right to a Defense enshrined in Article 39 of the Political Constitution (Constitución Política) or Articles 1, 30, 91, 93, and 95 of the Code of Criminal Procedure, the claim of defective procedural activity (actividad procesal defectuosa) is denied” (compare folios 507 verso to 508 recto, Volume II).

Lastly, concerning the statement of the alleged facts (cuadro de hechos acusados) and its treatment at the preliminary hearing, that panel of the Pavas Trial Court determined: “c) Having examined the order issued at fifteen hours on cuatro de agosto de dos mil ocho directing that the case proceed to trial (Apertura a Juicio), the Court considers that it contains defects that cannot be remedied at this stage, because the lower court (a quo) committed serious contradictions and omissions that make it impossible to determine the factual allegations (cuadro fáctico) to be addressed at the oral and public trial and, consequently, prevent defense counsel (Defensa Técnica) from establishing its strategy, make it difficult for the accused to know the facts against which he must defend himself, and confuse the position of the private prosecutor (querellante), because the court admits him as a private prosecutor and civil claimant (actor civil) but does not admit the private accusation (acusación particular) he filed, on the ground that it is imprecise or unclear; moreover, it arbitrarily recharacterizes the facts in a manner unsupported by a technical analysis.

Specifically, regarding the admissibility of the public accusation (acusación) and private prosecution (querella), Judge Juan José Solano Valverde erroneously stated that the facts alleged in the private prosecution are the same as those alleged by the Public Prosecution Service (Ministerio Público), a wholly false assertion, as would be evident from simply reading both pleadings. Furthermore, he states that because the facts in the private prosecution are insufficiently clear and specific, only the facts alleged by the Public Prosecution Service are accepted, while the Private Prosecutor remains a party and his evidence is admitted, and the request to declare the private prosecution and civil action implicitly abandoned is denied. Thus, through an erroneous application of the law and of the powers granted to him by Article 319 of the Code of Criminal Procedure, he admits the private prosecutor’s participation on the one hand, but rejects the accusation that is precisely the filing by which that party acquires such status and standing to act.

On the other hand, he recharacterizes the facts; although that recharacterization is not final, if accepted by the Court and the Public Prosecution Service, it would require prior notice to the accused informing him that the facts could be legally characterized differently. Accordingly, although the spirit of procedural law is not to return proceedings to foreclosed stages, the Court finds that the errors contained in the order committing the case to trial cannot be remedied because they substantially impair the parties’ right to participate; in any event, it is not for the Court to establish the facts on which it will itself conduct the oral trial. Consequently, the order committing the case to trial, issued at fifteen hours on cuatro de agosto del dos mil ocho, as well as the preceding hearing, is declared ineffective. The matter is ordered reconsidered by a judge other than the judge who ordered the case to proceed to trial.

By virtue of this ruling, the proceedings conducted at yesterday’s hearing, cuatro de marzo de dos mil diez, are annulled, and the case is remanded to the criminal judge to conduct the Preliminary Hearing again and issue the appropriate ruling” (compare folio 508 recto and verso, Volume II). By way of summary, in an order issued at 8:30 hours on 11 de marzo de 2010, the Pavas Criminal Court scheduled the preliminary hearing for 13:30 hours on 11 de junio de 2010 (compare folio 509, Volume II); on 9 de junio de 2010, it was rescheduled for 14 de setiembre de 2010, when it was stayed for consideration of possible alternative measures (medidas alternas). However, a new hearing was scheduled for 8 de febrero del 2011 (compare folios 547, 555, 563 and 564, 568 to 570, Volume II). Consequently, in a ruling issued at 10:00 hours on 16 de febrero del 2011, the Pavas Criminal Court, through attorney Nancy Fernández Rodríguez, ruled on the parties’ motions argued at the preliminary hearing and issued the order committing the case to trial (compare folios 570 to 576, Volume II); the trial proceedings began on 11 de noviembre del 2019 before a panel composed of Judge Cinthya Ramírez Ángulo and fellow judges Pedro Méndez Aguilar and Jhon Tapia Salazar (compare folios 839 recto and verso, 842 recto and verso, 874 to 875, 887 to 889).

It is clear from the assessment cited above that the Criminal Court then hearing the matter, on which Judges Jiménez Fernández and Ramírez Ángulo served at the time, merely identified the deficiencies and contradictions in the Criminal Judge’s assessment at the preliminary hearing concerning the factual allegations on the basis of which the order committing the case to trial had been admitted, as well as the series of irregularities involving both the rejection of the private prosecution and, despite that rejection, the decision to retain the private prosecutor as a party; the Court determined that those errors could not be remedied because they violated the parties’ right to participate. Thus, Rodríguez Morales, Jiménez Fernández, and Ramírez Angulo correctly pointed out that the lower court lacked the authority to establish the factual allegations on which—within that context—the oral and public trial depended.

Accordingly, in light of the constitutional principle of due process (debido proceso), Jiménez Fernández, Ramírez Ángulo, and Rodríguez Morales elected to declare ineffective the order committing the case to trial challenged by the defendant’s counsel. In this regard, pursuant to the comprehensive review of the judgment on the merits (fallo de mérito) provided for in statutory provisions 459, 462, and 465 of the Code of Criminal Procedure, the Criminal Judgment Appeals Court (Tribunal de Apelación de Sentencia Penal) fully considered the proceedings already reviewed concerning the Judges’ conduct and ruled out the occurrence of any essential defect that, under the principles of judicial objectivity and impartiality, would have affected the validity of what that judicial authority had ordered. After carefully reviewing the record, the appellate court (ad quem) stated: “As may be determined from the foregoing quotation, the trial court’s ruling addressed only formal issues and, although at one point it referred to the charging document and its legal characterization, it did so solely to verify whether it was clear and whether, as a result of the recharacterization performed (because the private prosecution alleged offenses involving forgery of documents and related crimes), the right to a defense was observed.

Those matters were ultimately remedied at the subsequent preliminary hearing and are neither the matters challenged here nor related to them. Accordingly, there was no impediment to Judge Jiménez Fernández serving on this court, which heard the oral hearing and rules (sic) on the appeals; nor, from the perspective of the principle of judicial impartiality, was there any impediment to Judge Angulo Angulo or Ramírez Angulo (who is the same person) serving on that court and subsequently forming part of the judicial panel that decided the matter in the judgment on the merits” (compare folio 1092 recto). (The bold emphasis does not appear in the original text). It should be added regarding that reasoning that, at the oral hearing held on 22 de abril de 2020—which had been scheduled to hear the parties concerning the appeal filed by attorney Araya Zuñiga—the Criminal Judgment Appeals Court noted that no objection was raised to the composition of the appellate panel (compare folio 1090 recto, Volume III).

Accordingly, it ruled out the possibility that any of the participating Judges had prejudged substantive issues or other matters relevant to the challenged judgment. This Chamber unquestionably affirms that legal position in its entirety, because the cassation appellant’s (casacionista) claim of an alleged violation of the principles of the natural judge (juez natural) and due process by Judges Jiménez Fernández and Ramírez Ángulo, arising from the ruling on the claims of defective procedural activity—hearing the defense strategy, the discussion prompted by the taking of testimonial evidence, the possibility of recharacterizing the facts, and even rendering value judgments on the merits—merely reflects dissatisfaction with the affirmed judgment (compare folios 1257 to 1259 recto, Volume III). That contention fails to establish the essential nature of the alleged defect because, in this case, there is no necessary connection to the occurrence of irreparable harm, as required by Article 439 of the Code of Criminal Procedure.

In other words, based on the appellant’s arguments and the review of the record, no doubt can be established as to the impartiality of Judges Jiménez Fernández and Angulo Ramírez in relation to the ruling; that is, no personal interest whatsoever is discernible on their part. On the contrary, their conduct was confined to the performance of genuine judicial functions as custodians of justice, preserving the highest degree of objectivity regarding strictly formal matters that, within reasonable bounds and free from any prejudice, led to the annulment of the order committing the case to trial. This determination was made without any influence inherent in or arising from their psyches in forming value judgments concerning the defendant’s legal status (compare folios 506 to 508, Volume II of the case file), and that conduct accords with Article 8.1 of the American Convention on Human Rights (Convención Americana sobre Derechos Humanos); provisions 34, 39, and 42 of the Political Constitution; and Articles 5 and 6 of the Code of Criminal Procedure.

Moreover, our case law has emphasized that the principle of impartiality is not violated where the adjudicator previously participated as a judge in proceedings in which the judge neither examined evidence nor made substantive assessments. More fully, it states: “ … Regarding the material possibility that an adjudicator may begin the intellectual assessment on the basis of facts, evidence, or an item of evidence (elemento de prueba) previously considered, legal scholarship has stated the following: ‘Abstention and recusal are grounded—he continues—in an assessment of the average level of psychological fortitude. Thus—he states—where one or more elements exist that would render a judge suspect when viewed as an average human being, the judge must be excluded from the proceedings without considering that person’s particular degree of moral strength…’ (Clariá Olmedo, Jorge. Tratado de Derecho Procesal Penal, Buenos Aires, Argentina, 1964, Volume II, p. 242).

Therefore, the objective aspect of impartiality must arise from an ascertainable or verifiable circumstance that creates doubt concerning the Judge’s objectivity, such that not every judicial participation in a prior proceeding constitutes a violation of the principle of impartiality from an objective standpoint.

With regard to the subjective aspect of the aforementioned principle, the Sala Constitucional, in ruling 05301-2005 of May 4, 2005, stated the following: “The fact that the judges who participate in the trial and render judgment previously intervened in the proceedings through actions involving an analysis and assessment of the merits of the matter, or that similarly compromise their impartiality, constitutes a violation of due process (debido proceso), all of which must be verified by the consulting authority.” (Emphasis not in the original). In the same vein, this Chamber, in a case similar to the one under review, held as follows: “This demonstrates that their impartiality was never challenged and is not compromised by the fact that they heard the accused and the victim twice (it should be noted that they became acquainted with the remaining evidence only at the second trial, which was completed).

That is the only criticism leveled against them by the appellant; however, it should be noted that, since they never expressed an opinion regarding the import of those statements, they did not lose their impartiality and had no reason to recuse themselves from hearing the case.” (Sala Tercera, ruling number 2007-00763, at 9:15 a.m. on July 27, 2007 (emphasis supplied; panel composed of: Arroyo, Chinchilla, Ramírez, Chaves, and García)). It bears noting that this Sala de Casación, like the Sala Constitucional, has held, for example, that the mere fact that a judge participated in rulings imposing, extending, or affirming a precautionary measure (medida cautelar) is not, by itself, a circumstance entailing a violation of the principle of objectivity that must govern the judicial function. Following this line of case law, it may likewise be maintained that this principle is not violated when a judge has participated as a judge in proceedings in which the judge neither assessed evidence nor issued an opinion on the merits.” (Ruling N° 2021-01026, at 12:35 p.m. on August 27, 2021, Solano Castro, Ramírez Quirós, Burgos Mata, Alfaro Vargas, and Acón Ng, Sala Tercera de la Corte Suprema de Justicia).

Consistent with that interpretive approach, voto N° 2021-01120, at 11:29 a.m. on September 24, 2021, states: “… the Sala Tercera de la Corte Suprema de Justicia has maintained the approach of determining, through an analysis of the specific case, whether the alleged violation of the principle of judicial impartiality exists. Along this line of reasoning, it has held as follows: “As this Chamber has repeatedly held, a judge’s impartiality is not compromised merely by participating in the preliminary stages of the proceedings; each specific case must be carefully analyzed to determine whether the prior action required or involved an analysis of the evidentiary elements such that it would inevitably lead to the formation of an opinion regarding the case, or whether the judge stated conclusions or assessments concerning the merits of the matter. As the analysis of both rulings demonstrates, the judge’s impartiality was not compromised, because in neither case was it necessary to examine the evidentiary basis of the charge; nor are there any statements concerning the defendant’s responsibility or guilt, and no issues concerning the merits of the case were addressed.

Accordingly, there was no impediment to the aforementioned officials sitting, as they did, on the trial court. Consequently, there was no reason for the defense to object to the composition of the court, nor is there evidence of deficiencies in the work performed by Ms. Gutiérrez Sancho that could have caused prejudice to the accused; the claim is therefore denied.” (Sala de Casación Penal, judgment number 576-2010, at 9:05 a.m. on June 4, 2010). It is appropriate to add “… that legal scholarship understands an impartial judge to be one who applies the law without pursuing a predetermined end, whether the judge’s own or another’s (this implicates independence), and who is therefore prohibited from engaging in activities proper to the parties (this implicates impartiality). The importance of judicial impartiality lies in the necessity of its existence for proceedings to qualify as due process.

This is justified by the legitimacy it confers upon the judge, as a third party removed from the dispute, to resolve it. The parties can conceive of the resolution of an intersubjective conflict of interests by a third party only if that party acts on the basis of respect for the rights of both plaintiff and defendant, conducting proceedings in accordance with the constitution (...) The adjudication by a third party (heterocomposición) of contentious proceedings requires that they be resolved by an impartial third party, removed from the conflicting interests. This impartiality, of course, is not equivalent to neutrality, because judges are required to be committed to truth and justice, a commitment ultimately expressed in value judgments that question or contradict the parties’ positions.” (PICADO VARGAS, The Right to Be Tried by an Impartial Judge. In: Revista IUDEX, N°2, August 2014, pp. 38 and 39).

It follows from all of the foregoing that respect for due process is of great importance within the judicial system. Due process consists of principles and safeguards, including the principles mentioned here—impartiality, objectivity, and the natural judge (juez natural)—which are decisive for criminal justice. For a violation of the principle of judicial impartiality to exist, however, it is necessary, prima facie, to examine the judicial actions in which the judge participated in order to determine, in the specific case, whether the judge’s assessments required a substantive analysis of core issues relating to the charge brought and on which the judge ruled, or whether the review concerned procedural matters or compliance with formal requirements entailing a cursory assessment to decide a specific procedural issue that does not involve substantive scrutiny. With respect to the natural judge, it must also be determined whether that judge was appointed for the specific case or whether hearing it fell within the ordinary duties of the judicial office to which the judge had been lawfully appointed …” (Solano Castro, Ramírez Quirós, Burgos Mata, Alfaro Vargas, and Segura Bonilla, Sala Tercera de la Corte Suprema de Justicia).

(Capitalization and boldface appear in the original text). In view of the factual and legal grounds presented, the argument advanced by counsel in this ground of appeal cannot be sustained, because the existence of any decisive and evident judicial error concerning a (speculative) assessment of the evidentiary elements that might have materially affected the objectivity and impartiality of the member of the Tribunal de Pavas and the member of the Tribunal de Apelación de Sentencia Penal, who participated in the trial and in affirming the declaration of guilt against the accused herein (compare folios 890 to 966, and 1089 to 1154 of the case file, Volume III), to the detriment of the accused’s fundamental rights, has been disproved. On the contrary, this appellate action reflects an attempt to obtain annulment for annulment’s sake (nulidad por la nulidad misma) of the criminal judgment and the appellate ruling.

In any event, based on the examination of the merits, it is relevant that the incidents that occurred on March 4, 2010 (compare the front and reverse of folio 506), and were resolved on March 5, 2010 (compare folios 507 to the reverse of 508, Volume II), in which Judges Jiménez Fernández and Ramírez Angulo participated, disclose no ascertainable facts giving rise to doubts concerning their impartiality, particularly because, as will be discussed in greater depth, at that time they had no connection whatsoever with the body of evidence (acervo probatorio). A contrario sensu, the criminal responsibility subsequently proven against the accused is based on a logical progression (iter lógico) whose statement of proven facts (compare the front of folio 917 to the reverse of folio 922) was constructed through the reasoned interrelation of the value judgments assigned to each item of evidence presented in adversarial proceedings (contradictorio), in light of the principles of oral proceedings (oralidad), immediacy (inmediación), and due process, pursuant to statutory provisions 180 to 184, 326, 328, 330, 333, 335, 341 to 343, 345, 349, 350 to 353, 356 to 358, 360 to 365, and 368 of the Código Procesal Penal, namely: the testimony of [Nombre 004] (compare the reverse of folio 926 to the reverse of folio 927), [Nombre 005] (compare the reverse of folio 927 to the reverse of folio 930), [Nombre 003] (compare the reverse of folio 930 to the reverse of folio 937), and [Nombre 006] (compare the reverse of folio 937 to the reverse of folio 939), together with the personal defense (defensa material) of [Nombre 001] (compare folio 923 to the reverse of folio 926); and the documentary evidence admitted at trial, appearing from the reverse of folio 939 to the front of folio 942); in strict application of the rules of sound reasoning (reglas del correcto entendimiento humano), which enabled the panel of judges to establish the accused’s responsibility with certainty (compare folio 942 to the reverse of folio 953), impose the sentence (compare the reverse of folio 953 to the reverse of folio 958), resolve each of the defense’s challenges concerning communications made by email, etc. (compare the reverse of folio 948 to folio 960), decide the claim for civil damages (acción civil resarcitoria) (compare folios 961 to 962), and enter acquittals on other charges (compare folios 963 to 966).

In this regard, following that line of reasoning, the lower court (a quo) concluded, among other things: “… The accused proceeds to deceive [Nombre 003] and simulates the existence of judicial proceedings, carrying out the deception in an extremely thorough manner, because through electronic communications he informs the victim of procedural acts that must be performed, which purportedly justified the deposits he requested; he even proceeds to prepare purported judicial rulings justifying the nonexistent procedural acts in order to mislead the victim and obtain the disposition of assets through the making of the various deposits. As we can see, this involved a simulation or deception whereby the victim was led to believe that judicial proceedings had been instituted to attach properties, thereby enabling the victim to halt their sale and subsequently making it possible for the properties to be awarded to him for later sale; in reality, however, this person never instituted those proceedings, all of this being part of the development of the deceptive conduct through which the respective deposits of money were obtained for the benefit of the accused.

This deceptive situation indisputably caused the victim to fall into error, which could not readily be detected because of the sophisticated and seamless artifice of simulating an unreal situation in order to create the appearance of procedural acts that were never performed, causing the victim an economic loss amounting to EIGHTY-SEVEN THOUSAND TWO HUNDRED THIRTY-EIGHT DOLLARS (at today’s exchange rate, this would be the sum of FIFTY MILLION SEVENTY-FOUR THOUSAND SIX HUNDRED COLONES”). (compare the reverse of folio 956). (Capitalization appears in the original text).

For its part, regarding the finding of guilt, the court of appeals (ad quem) describes it as resulting from the scope of the adversarial proceedings (contradictorio), for example: “…the judgment was not based exclusively on the documents, whether communications, faxes, or bank statements; rather, the victim’s testimony was also deemed credible, as was that of the other witnesses (his partner, [Nombre 005], who had direct knowledge of what had occurred, and Luis Alfredo Montes Solano, an attorney retained by the private complainant (querellante) to investigate the status of the judicial proceedings that the accused had described to him and that he determined did not exist). The defense theory, presented by the defendant and his former assistant, [Nombre 006], was not afforded the same treatment (for reasons extensively explained in the judgment and correctly inferred by the court). That theory concerned the assertion that the defendant and the injured party had been romantically involved and that, by virtue of that relationship, the latter transferred various sums of money to the former as gifts or loans, which the accused repaid without retaining proof of payment.

However, even if all the documentary evidence were hypothetically excluded, given the freedom of proof (libertad probatoria) governing criminal proceedings and the compelling nature of the complainant’s account when contrasted with the inconsistencies in the defense theory, the factual findings would remain undisturbed. This means that none of the complaints raised is capable of causing actual prejudice to the defense’s interests” (compare the front and reverse of folio 1131, Volume III). Finally, regarding voto N° 2012-01954, de las 14:16 horas, of this Chamber, which counsel invokes in support of his ground for cassation (motivo de casación), it is important to clarify that the circumstance for which the decision of the ad quem was vacated sua sponte (de oficio) in that matter concerned a manifest violation of the principle of judicial impartiality. It was established that the same appellate judge had issued two decisions on the merits: in the first, he vacated the acquittal and ordered a remand; and in the second, he upheld the conviction and denied the defense’s appeal.

The Chamber therefore concluded that the judge’s dual participation in decisions comprehensively evaluating each of the acts and items of evidence presented at trial seriously compromised the principles of impartiality and objectivity that must prevail in the exercise of the judicial function (Ramírez Quirós, Chinchilla Sandí, Pereira Villalobos, Arias Madrigal, and Arroyo Gutiérrez, Sala Tercera de la Corte Suprema de Justicia). Accordingly, in the present case, there is no absolute defect (defecto absoluto) affecting the accused’s fundamental rights. The violation of the principles of objectivity and impartiality alleged by private defense counsel is rejected because, as properly explained above, the annulment of the order committing the case for trial (auto de apertura a juicio) (compare folios 506 to 508, Volume II of the case file) did not entail prejudgment regarding issues on the merits or other matters addressed by the challenged ruling. In summary, the ground asserted must be denied.

III.Appeal in cassation (recurso de casación) filed by the representative of the Public Prosecution Service (Ministerio Público). Ground admitted. Erroneous application of substantive legal provision 77 of the Criminal Code (Código Penal). The appellant states that the Criminal Judgment Appeals Court (Tribunal de Apelación de Sentencia Penal), in its majority opinion, erroneously applies the substantive provision with respect to the scope of a continuing offense (delito continuado), by holding that, according to the factual circumstances at issue, this constitutes a real concurrence of offenses (concurso material), given a series of unlawful acts extending over time, and that, under this view, the facts had to be analyzed independently. Thus, he challenges the practice of adding together each of the fraudulent acts to treat the loss as a single amount, which—erroneously—makes it possible to establish the sentence used to calculate the limitations period (prescripción) (see reverse of folio 1216).

The appellant in cassation (casacionista) observes from the ruling that the correct approach would have been to interpret, in accordance with the factual context, that the defendant’s knowledge and intent permitted the fraudulent acts to be linked or joined because, although all those acts of fraud or deceit constituted an offense, it was precisely [Nombre 001]’s criminal intent (dolo) that integrated them into a single offense, which should be understood as a single typical and unlawful act (acción típica y antijurídica); consequently, they could not be assessed independently for purposes of calculating the statute of limitations. He concludes that the decision caused prejudice by misinterpreting the concurrence of various punishable acts attributed to the perpetrator in question, such that, despite the fact that the sentencing range remained unchanged, the acquittal entered as to various acts for which the Prosecutor’s Office sought a conviction directly affects the correct application of substantive criminal law.

He requests that the acquittal be vacated and that further proceedings be conducted as required by law (see reverse of folios 1268 to 1270 and front of folios 1216 to 1217). The ground is sustained. The appellant asserts that, in this specific case, the Criminal Judgment Appeals Court, in a majority decision, incorrectly applied legal provision 77 of the Criminal Code, which concerns the scope of a continuing offense, by interpreting the specific factual circumstances as “a mere plurality of acts extending over time; it therefore found that each act was distinct from the others and, accordingly, that the amount involved in each had to be examined independently in order to determine the statute of limitations” (see reverse of folio 1216. Volume III). In this regard, he transcribes a portion of the majority’s reasoning, appearing at folios 1118 and 1120, and then challenges the decision to stipulate that each fraudulent act had to be viewed in isolation from the ultimate objective, treating them as separate acts without considering the perpetrator’s plan, which was directed toward a single fraud continuing over time and caused a single financial loss to the victim.

Now then, according to the background contained in the record, strictly in relation to the issue disputed by the appellant, the Criminal Judgment Appeals Court’s examination reveals the following established factual findings: “C) Proven facts. Accordingly, because the judgment also acquitted the accused of certain events (and the prohibition against reformatio in peius (prohibición de reforma en perjuicio) applies in that regard), it is necessary to transcribe the facts found to have been established in order to determine, solely with respect to those facts (and without losing sight of the trial court’s classification regarding the existence of a continuing offense, an issue that will, in any event, be revisited in other sections of this decision), how they were charged and whether the criminal action (acción penal) remained timely when that ruling was issued. The list is as follows: «1) The defendant [Nombre 001] and the victim [Nombre 003] met approximately six years before the events described below, through mutual friends who introduced them; the accused came to earn the victim’s trust, and the victim also retained him for legal advice as an attorney. 2) The defendant herein (...) knowing that his acts were unlawful, taking advantage of the relationship of trust and friendship he had with the victim (...) as the latter’s attorney and notary, and for the sole purpose of obtaining an unlawful financial benefit, devised and carried out an unlawful plan consisting of fraudulently offering to file civil lawsuits and conduct the respective judicial proceedings on the victim’s behalf in cases in which the victim had commercial disputes with certain partners in companies in which he held shares, all in exchange for the victim paying the defendant (...) large sums of money as fees and litigation expenses to pursue those proceedings.

Those representations were entirely false, since the judicial proceedings to which the accused (...) referred did not exist. 3) The victim (...) owns twenty-five shares in (...) E.X.T. Promociones Sociedad Anónima, (…) the registered owner of the property in the Province of San José, registration number 96926-000, located in Escazú, measuring 8622.17 square meters, which forms part of the assets of that legal entity and is located almost adjacent to Hotel Real Intercontinental near Multiplaza. The company’s share capital was one hundred thousand colones, represented by one hundred shares; of the remaining share capital, sixty shares belonged to Promociones JT S.A., and another fifteen shares to Mr. [Nombre 007]. 3.1 In connection with a possible sale of the property at issue and the possible exclusion of Mr. [Nombre 003] from the profits generated by that transaction because he was a minority shareholder, on an unspecified date during the month of September 2002 and before October 10, 2002, he informed the person who at that time was his trusted attorney, the accused herein, [Nombre 001], of that situation. 3.2 Immediately thereafter, the accused (...) knowing that his acts were unlawful, pursuant to the criminal plan described above, taking advantage of the victim’s lack of knowledge of civil and commercial law, and for the purpose of obtaining an unlawful financial benefit, during the aforementioned period and at Mr. [Nombre 003]’s residence in Escazú, falsely told him that the advisable course was to initiate civil proceedings to “attach” the property and prevent the shareholders of the company that owned it from selling it. 3.3 Believing the accused’s statement to be true, Mr. [Nombre 003], having been induced into error, instructed the person brought to trial (...) to initiate the aforementioned civil attachment proceedings. 3.4 In this manner, the accused (...), taking advantage of the fact that the victim was in Switzerland on the dates of the events described below, and as part of his criminal plan, began demanding large sums of money in dollars from the victim by email, telephone, or fax, falsely representing that they were for procedural steps and requesting that the victim deposit them by bank transfer into Banco Nacional de Costa Rica account number 200-2-002-508984-2, held by FC Inmobiliaria Playa Negra Sociedad Anónima, of which the accused [Nombre 001] is the holder of a general power of attorney without limitation (Apoderado Generalísimo), as detailed below: A) On October 2, 2002, by email, the accused [Nombre 001] falsely demanded from the victim the sum of six thousand five hundred United States dollars ($6500) in order to secure the attachment of the property in question, whereupon Mr. [Nombre 003], having been induced into error and believing that the civil proceedings at issue actually existed, made an electronic transfer from Switzerland to pay the accused [Nombre 001] the sum of six thousand five hundred United States dollars ($6500) by means of a deposit into the account (...) of FC Inmobiliaria Playa Negra Sociedad Anónima, of which the accused [Nombre 001] is the holder of a general power of attorney without limitation.

  • B)On October 8, 2002, by telephone, the accused [Nombre 001] falsely demanded from the victim the sum of four thousand two hundred United States dollars ($4200) in order to make a court deposit in connection with the attachment he was seeking against the property in question, whereupon Mr. [Nombre 003], having been induced into error and believing that the civil proceedings at issue actually existed, made an electronic transfer from Switzerland to pay the accused (…) the sum of four thousand two hundred United States dollars ($4200) (...) C) On October 15, 2002, by fax, the accused [Nombre 001] falsely demanded from the victim the sum of five thousand eight hundred United States dollars ($5800) in order to guarantee the price of the property while the attachment remained in effect, whereupon Mr. [Nombre 003], having been induced into error and believing that the civil proceedings at issue actually existed, made an electronic transfer from Switzerland to pay the accused (...) the sum of five thousand eight hundred United States dollars ($5800) (...) D) On October 22, 2002, by fax, the accused (...) falsely demanded from the victim the sum of two thousand United States dollars ($2000) so that he would have additional funds available in the event that the court handling the “attachment” required more money for the judicial proceedings, whereupon Mr. [Nombre 003], having been induced into error and believing that the civil proceedings at issue actually existed, made an electronic transfer from Switzerland to pay the accused [Nombre 001] the sum of two thousand United States dollars ($2000) by means of a deposit (...) E) On November 4, 2002, by fax, the accused (...) falsely demanded from the victim the sum of three thousand four hundred thirty United States dollars ($3430) because the Juzgado Civil de Mayor Cuantía de San José had increased the amount of the security for the prejudgment attachment (embargo preventivo) that he had sought, whereupon Mr. [Nombre 003], having been induced into error and believing that the civil proceedings at issue actually existed, made an electronic transfer from Switzerland to pay the accused (...) the sum of three thousand four hundred thirty United States dollars ($3430) by means of a deposit (...) 3.5 To keep the victim in error and thereby continue his scheme, the person brought to trial (...) gave Mr. [Nombre 003] deposit slips falsely stating that the funds entrusted to him had in fact been deposited with the Juzgado Civil de Mayor Cuantía de San José, which was entirely untrue. 3.6 On an unspecified date during (...) July 2003, because the victim began to suspect whether the civil proceedings in question and the “attachment” allegedly imposed on the property actually existed, he learned through his own inquiries that the accused’s statements (...) were false, that the civil proceedings in question did not exist, and that the information was false, thereby causing him a financial loss from these specific acts in the sum of twenty-one thousand nine hundred thirty United States dollars ($21930).
  • 4)The injured party, [Nombre 003], holds an ownership interest as a shareholder in (...) La Esquina Ideal Sociedad Anónima, the registered owner of the property in the Province of San José, registration number 1638-000, the lot on which the condominium property (propiedad condominal) (…) Centro Comercial Boulevard is located in Escazú, with the commercial premises organized and distributed among twenty-four condominium units or premises that had their own separate administration (…) 4.1 By reason of a series of disputes that Mr. [Nombre 003] had, as a shareholder of that company, regarding its administration and management, on an unspecified date during the month of November 2002 and before December 4, 2002, he informed the person who was then his trusted attorney, namely the accused herein (...), of that situation. 4.2 Immediately thereafter, the accused (...), knowing that his actions were unlawful, in accordance with the criminal plan described above, taking advantage of the injured party’s lack of knowledge of civil and commercial law, and for the purpose of obtaining an unlawful financial benefit, during the aforementioned period and at the residence of Mr. [Nombre 003] in Escazú, falsely told the injured party (...) that the advisable course of action was to initiate civil proceedings to “attach” (“embargar”) that property, after which, once the asset had been “frozen,” another civil proceeding would be initiated in which, likewise falsely and wholly contrary to reality, the defendant (...) told Mr. [Nombre 003] that he would succeed in obtaining full control over the administration of the shopping center and the aforementioned company. 4.3 Believing the defendant’s statement to be true, Mr. [Nombre 003], having been induced into error, instructed the accused (...) to initiate the aforementioned civil proceeding for the “attachment” of that property. 4.4 Thus, still in Escazú and during the period specified below, the defendant (...), as part of his criminal scheme, began demanding large sums of money in dollars from the injured party, falsely claiming that they were required for procedural acts and legal fees, and asking the injured party to deposit them by bank transfer into Banco Nacional de Costa Rica account number 200-2-002- 508984-2, held by FC Inmobiliaria Playa Negra Sociedad Anónima, of which the defendant (...) is a general attorney-in-fact with full powers (Apoderado Generalísimo). 4.5 Accordingly, the injured party, having been induced into error by the fraudulent scheme devised by the defendant (...) and firmly believing in the existence of the civil attachment proceeding against the property in question, as well as in the legitimacy of the costs, legal fees, and procedural acts demanded by the accused (...) in his capacity as attorney in the purported proceeding, proceeded to pay him the amounts detailed below:

July (...) 2003, and because the injured party began to suspect the actual existence of the civil proceeding in question and the “attachment” (embargo) allegedly imposed on said property, through his own inquiries he learned that the defendant’s statements (...) were false, that the civil proceeding in question did not exist, and that the information was false, thereby causing him financial loss in the amount already indicated.

  • 5)Caramar Matter: In parallel with the frauds mentioned in the preceding points of this private criminal complaint (querella), on November 11, 2002, the accused [Nombre 011] sent the injured party [Nombre 003] a fax at his home in Switzerland, dated November 10, 2002, stating that he needed his help because he had won a lawsuit that entitled him to collect fees of “one hundred thirty-three million six hundred forty-six thousand five hundred sixty-three colones,” which, according to what he stated in the fax, amounted at that time to slightly more than four hundred thousand dollars. The accused [Nombre 011] also stated in the fax that, to collect those fees, he had attached properties belonging to each of his clients: from one of them, an eighty-hectare property entirely planted with teak trees, and from the other client, ten lots in a residential development located in Playa Negra called Caramar; he further stated in that document that each of those lots had an approximate value of fifty thousand dollars. In that document, the accused stated that this was a place where foreign retirees owned homes valued at between three hundred thousand and four hundred thousand dollars. In the document, he told him that he could access the website www.caramar, which the injured party visited and where he was able to confirm the project’s existence. The fax sent to the injured party [Nombre 003] proposed that, to maintain the attachment on the ten lots owned by an American named [Nombre 009], he had to deposit the sum of “two million two hundred thousand colones” with the Court, which at that time, according to the accused, was equivalent to “five thousand nine hundred ten dollars.” The accused asked the injured party to provide him with that money under an agreement that, if [Nombre 009], the American whose lots had been attached, paid him, the injured party would earn fifteen thousand dollars. If he did not pay and the accused had to take possession of the lots, he would then give one of the lots to the injured party. Erroneously believing the accused’s statements to be true, and wishing to help him, on November 12, 2002, the injured party sent a fax to Mr. [Nombre 012], an employee of Banco Nacional, instructing him to transfer six thousand dollars to the account of the company controlled by the accused, FC Inmobiliaria Playa Negra Sociedad Anónima; he never recovered that money.
  • 6)As a consequence of the accused’s unlawful conduct (...), the injured party [Nombre 003] suffered total loss stipulated at eighty-seven thousand two hundred thirty-eight dollars.
  • 7)As a result of the frauds perpetrated against the injured party [Nombre 003] by the accused (...), he suffered non-pecuniary harm (daño moral) due to the anguish, disappointment, and suffering they caused him.” (compare folios 917 recto through 922 verso. The text is exact in content, but the typography has been modified; spelling or typing errors have been corrected; repetitive portions have been omitted by means of parentheses and ellipses; the table for fact 4.5 has been added while preserving the information presented in the text; and the emphasis has been supplied).” (compare folios 1094 verso through 1097 recto, Volume III). (The bold emphasis appears in the original text). On the basis of that factual account, it follows that the accused [Nombre 001] was charged with and held responsible for having engaged, from October 2002 through November 2003, in a series of acts characterized by a prior scheme through which he caused loss to the victim by unlawfully obtaining various sums of money in dollars, classified as fraud (estafa) under Article 216 of the Código Penal. Under those factual circumstances, according to the majority, the appellate court (ad quem) erred in interpreting the substantive law concerning Article 77 of the procedural code, by holding that, under the applicable legal framework, a continued offense (delito continuado) constitutes a real concurrence of offenses (concurso material) because it entails multiple acts carried out over time, such that each act must be regarded as distinct from the others and the amount involved must therefore be analyzed separately for statute-of-limitations (prescripción) purposes (compare folios 1113 through 1120, Volume III). Consistent with that line of reasoning, the majority’s argument states: “In summary: it follows from all the foregoing that a continued offense is a real concurrence of offenses (multiple acts) in which each act must be assessed independently for purposes of the statute of limitations on criminal prosecution (prescripción de la acción penal), as required by Article 32 in fine of the Código Procesal Penal. […] This means that the penalty to be considered is the one prescribed for the offense, and not the enhancement established in Article 77 of the Código Penal….” (compare folio 1117 verso, Volume III). (The underlining and bold emphasis appear in the original text). Along the same lines, they argue: “E.6) Specifically, regarding the statute of limitations in this case (majority opinion, with Judge Vargas González dissenting). The entire analysis set out at length above makes it possible to identify the premises that must be used to resolve the issue of the statute of limitations on criminal prosecution in this case, which may be summarized as follows: i) only the proven facts (not all those charged) from the period between October 2002 and November 2003 must be considered, and they must be treated as a continued offense; ii) during that period and until October 12, the country was governed by the original, unamended Article 32 of the Código Procesal Penal […] This means that the limitation period must begin to run when each continuing group of offenses ceased, according to the judgment, and, in the worst-case scenario, in November 2003, when the final act occurred; iii) in Costa Rica, a continued offense is a form of real concurrence of offenses involving independent acts (it is not a single act). Therefore, each act—as the appellant correctly argues—must be considered individually with respect to the amount defrauded, the applicable penalty, and the date on which it occurred, provided that date is later than November 2003, as stated above. It is therefore improper to aggregate all the frauds in order to estimate the loss as a single amount establishing the penalty used to calculate the limitation period …” (compare folio 1118 recto, Volume III). (The bold emphasis has not been supplied). After assessing the procedural acts, dates, applicable period of the law, and elapsed time, Judges Chinchilla Calderón and Jiménez Fernández state: “The foregoing means that, on at least three occasions (four if calculated from the date of some of the initial acts rather than from the final date of the offenses comprising the continued offense, depending on how the amendment to Article 32 of the Código Procesal is interpreted), during the proceedings the shortened period between one tolling event and another was exceeded; that is, more than one year and six months elapsed between tolling events with respect to the lower-value frauds, and it cannot be maintained that the failure to detect or raise this situation in a timely manner cured it, because the statute of limitations may be waived only expressly (Article 35 of the Código Procesal Penal). This supports the conclusion that all the lower-value frauds were time-barred when judgment was rendered and that the absence of a ruling on that matter did, in fact, prejudice the appellant, since it is well established that a decision on the merits may be issued only if the criminal prosecution has not been extinguished …” (compare folios 1120 recto and verso, Volume III). (The bold emphasis appears in the original text). Contrary to the majority’s position, the factual account already described establishes that the conduct undertaken by the defendant, although its component acts might separately be regarded as unlawful, constitutes a single offense (the continued offense) because those acts were linked by the perpetrator’s knowledge and intent; therefore, those various acts, unified by the defendant’s willful conduct, are not time-barred. It should be noted that, because of the erroneous interpretation of substantive criminal law adopted in the majority opinion, the defense’s request to uphold the statute-of-limitations objection (excepción de prescripción) was granted in this matter and the accused was acquitted, based on Judges Chinchilla Calderón and Jiménez Fernández’s view that each act had to become time-barred independently, irrespective of whether it formed part of a continued offense, a situation that necessarily entails prejudice under Article 439 of the Código Procesal Penal because it prevented the Ministerio Público from pursuing the criminal prosecution. Criminal cassation case law, addressing the appellate issue of whether acts carried out separately or at different times may be regarded as criminal when linked by the knowledge and intent displayed by the perpetrator so as to comprise a single continued offense, has stated: “..... In view of the foregoing, this Sala de Casación proceeds to unify the standard concerning the possibility of adjudicating a continued offense in two or more proceedings separated in time, as follows: under Article 77 of the Código Penal, a continued offense is a doctrine whose application depends on three specific characteristics: the offenses must be of the same kind and committed over time, the perpetrator must pursue a specific common objective, and the offenses must affect proprietary legal interests (bienes jurídicos de orden patrimonial). On that basis, there is unquestionably a plurality of acts that, for sentencing purposes, are classified as a continued offense, meaning that the accused benefits from this doctrine when the sentence is imposed because, for those purposes, ‘…the penalty prescribed for the most serious offense shall apply, increased by up to the same amount….’ This Sala concludes that, given the characteristics of this doctrine and the guarantee of a single penalty for the aggregate criminal offenses, when the acts constituting a continued offense are adjudicated and another set of acts belonging to that same offense is subsequently brought before a court, judgment must also be rendered on the latter acts so that they will be subject to res judicata (cosa juzgada) once the judgment becomes final, because even in cases involving one or more injured parties and the same prosecutorial accusation, each act is temporally independent and the accused’s responsibility for it must be determined. Even when the prosecutorial charging instrument (requisitoria fiscal) describes the perpetrators’ modus operandi for unlawfully obtaining the injured parties’ money—as in this case—each injured party’s proprietary legal interests were affected through the method of action and the perpetrator’s plan described therein; it is therefore not possible to assert that all the acts described in the accusation have already been adjudicated when a prior ruling resolved the legal situation only as to some of the injured parties and not all of them. Accordingly, the principle of non bis in idem does not apply, nor does res judicata exist.

This is also consistent with the principle of legal certainty (seguridad jurídica), since the parties have the right to obtain a response to the dispute they have brought before the Administration of Justice, both as to the criminal aspect and as to the civil aspect, if the corresponding civil claims have been asserted. Regarding the penalty. This Court of Cassation likewise maintains the majority position established in resolution N°444-F-96. The penalty for a continuing offense (delito continuado) adjudicated at a second procedural stage and resulting in a second judgment must certainly comply with the rules of article 77 of the Criminal Code; however, it must be consolidated retrospectively with the penalty previously imposed, provided that the first judgment did not exceed the maximum penalties specified in article 77 in question, namely, “…the penalty prescribed for the most serious offense, increased by up to an equal amount…,” and that the consolidation remains within those limits.

The contrary approach—declining to punish the continuing offense in the second conviction and determining that res judicata (cosa juzgada) applies with respect to the penalty imposed in the first judgment—would render inapplicable the aforementioned provision concerning continuing offenses and would turn that construct into a double guarantee for the accused (imputado), who, in the first judgment, would receive the penalty appropriate to the continuing offense, which would become final regardless of how many other acts remained to be adjudicated and the potential penalty to be imposed ..." (For a similar position regarding the continuing offense, see voto N° 2012-001204, de las 11:26 horas, de 17 de agosto de 2012, Ramírez Quirós, Zúñiga Morales, Pereira Villalobos, Arroyo Gutiérrez, y Sanabria Rojas, Sala Tercera de la Corte Suprema de Justicia).

Accordingly, in the matter at issue in this litigation, the appellant is correct: based strictly on the established facts (hechos probados) (compare folios 1113 verso through 1118 recto), and II.E.6 (compare folios 1118 recto through 1121 recto), the actions manifested by the accused, although considered separately to be criminal offenses (and constituting the legal basis for imposing the penalty applicable to a continuing offense), are, under those factual circumstances, joined or linked precisely by the accused’s knowledge and exercised intent, thereby comprising a single unlawful act (the continuing offense). Consequently, article 77 of the Criminal Code was clearly applied erroneously, and the rules contained in that statutory provision were also incorrectly interpreted for purposes of calculating the limitation period (prescripción). In this regard, to assess whether the criminal action (acción penal) is time-barred, the adjudicator must consider the penalty applicable to the continuing offense, which is the penalty established for the most serious offense increased by an equal amount.

It should be noted that, under our legal framework, the aforementioned 77, read together with subsection 2) of section 216 of the Criminal Code, whose sentencing ranges provide for a minimum penalty of six months and a maximum of ten years (where the amount defrauded exceeds ten times the base salary), in this case, based on the aggregate amounts obtained through higher-value fraud (estafa de mayor cuantía) (compare folios 1094 verso through 1098 recto), and because those limits are doubled, the penalty would range from one year to twenty years’ imprisonment (Resoluciones números 2003-673, de las 10:00 horas, de 7 de agosto de 2003 (Ramírez Q., González A., Castro M., Arroyo Gutiérrez y Dall´Anese R.), y 2004-007, de las 9:15 horas, de 16 de enero de 2004, Ramírez Q., González A., Castro M., Arroyo Gutiérrez, y Chirino S., Sala Tercera de la Corte Suprema de Justicia). Therefore, pursuant to criminal procedural law, the criminal action has not been extinguished by expiration of the limitation period.

Under subsection a) of section 31 of the Code of Criminal Procedure, the limitation period for the criminal action under the circumstances of the present case is ten years; reduced by half, as prescribed by the first paragraph of article 33 of the procedural code, it is five years. Thus, the charged continuing offense, which, in light of the factual circumstances already described, comprises various acts joined together by [Nombre 001], who willfully intended (article 31 of the Criminal Code) to commit the act defined in subsection 2) of the aforementioned substantive section 216, is not time-barred. It bears noting that the specific reclassification made by the court below (ad quem), in its majority opinion, of the established facts as seven higher-value offenses committed as a continuing offense is erroneous for the factual and legal reasons stated. In summary, the sole admitted ground of the cassation appeal filed by the representative of the Ministerio Público is granted; resolution N° 2020-0770, de las 10:50 horas, de 18 de mayo de 2020, del Tribunal de Apelación de Sentencia Penal de Goicoechea, is vacated solely with respect to the determinations reached by the majority in Considerando II., puntos E.5., y II.E.6., and section C) of Considerado V, concerning the acquittal entered with respect to the manner in which the continuing-offense doctrine was applied.

Consequently, as to those determinations reversed by the court below, pursuant to article 473 párrafo segundo, and because the claim asserted was the erroneous application of a substantive statutory provision, judgment N° 1355-2019, de las 17:00 horas, de 10 de diciembre de 2019, del Tribunal Penal del Tercer Circuito Judicial de San José, Sede oeste, Pavas, Sección Vespertina, must remain undisturbed.

Por Tanto:

The first admitted ground (motivo) of the appeal in cassation (recurso de casación) filed by the private defense counsel (defensor particular) of [Nombre 001]. is denied. The sole admitted ground of the appeal in cassation filed by the representative of the Ministerio Público is granted, and resolution N° 2020-0770, issued at 10:50 hours on 18 de mayo de 2020 by the Tribunal de Apelación de Sentencia Penal de Goicoechea, is partially vacated, solely with respect to the ruling adopted by majority opinion (criterio de mayoría) in Considerando II., points E.5. and II.E.6., and section C) of Considerado V., concerning the acquittal (absolutoria) entered regarding the manner of application of the continuing-offense doctrine (delito continuado). Revisión del Documento Res: 2021-01385 SALA DE CASACIÓN PENAL. San José, a las diez horas cuarenta y cinco minutos del veintiséis de noviembre de dos mil veintiuno.

Recurso de casación interpuesto en la presente causa seguida contra [Nombre 001], mayor, costarricense, cédula de identidad número [Nombre 001], por los delitos de estafa mayor, cometido en perjuicio de [Nombre 003]. Interviene en la decisión del recurso las magistradas y magistrados Patricia Solano Castro, Álvaro Burgos Mata, Gerardo Rubén Alfaro Vargas, Cynthia Dumuni Stradtmann y Rosa Acón Ng, estas dos ultimas en condición de suplentes. Además, en esta instancia, el licenciado Segismundo Araya Zúñiga, como defensor particular del sentenciado, la licenciada Jeannette Salazar Araya, querellante y actora civil en representación de la parte ofendida. Se apersonó el licenciado Carlos Meléndez Lugo, como representante del Ministerio Público.

Resultando:

  1. 1Mediante sentencia N° 2020-0770 de las diez horas con cincuenta minutos del dieciocho de mayo de dos mil veinte, el Tribunal de Apelación de Sentencia Penal. Segundo Circuito Judicial de San José, resolvió: "POR TANTO: Por mayoría, se declara parcialmente con lugar el primer y el cuarto alegato del recurso interpuesto por el licenciado Segismundo Araya Zúñiga, defensor particular del encartado. En consecuencia, por mayoría: a) se revoca la sentencia solo en cuanto condenó penalmente al encartado por los hechos probados constitutivos de estafa de menor cuantía, enumerados como 3.4.D del 22 de octubre de 2002 por $2000; 3.4.E del 04 de noviembre de 2002 por $3430; 4.5 del 06 de enero 2003 por $1100; 4.5 del 20 de enero 2003 por $2532; 4.5 del 03 de febrero 2003 por $900; 4.5 del 07 de febrero 2003 por $1500; 4.5 del 10 de febrero 2003 por $2352; 4.5 del 24 de febrero 2003 por $3400; 4.5 del 3 de marzo de 2003 por $700; 4.5 del 04 de marzo de 2003 por $3000; 4.5 del 19 de marzo 2003 por $1500; 4.5 del 24 de marzo 2003 por $1 900; 4.5 del 01 de abril de 2003 por $2100; 4.5 del 04 de abril de 2003 por $470; 4.5 del 07 de abril de 2003 por $2300; 4.5 del 08 de abril de 2003 por $2300; 4.5 del 28 de abril 2003 por $3000; 4.5 del 06 de mayo de 2003 por $3000; 4.5 del 08 de mayo de 2003 por $1400; 4.5 del 13 de mayo de 2003 por $1800; 4.5 del 16 de mayo de 2003 por $460; 4.5 del 19 de mayo de 2003 por $1500; 4.5 del 27 de mayo de 2003 por $824 y 4.5 del 07 de julio de 2003 por $500.Respecto de tales sucesos, en su lugar, se acoge la excepción de extinción de la acción penal por prescripción y se absuelve al encartado de toda sanción punitiva. Por unanimidad se rechaza la excepción de prescripción respecto del resto de sucesos de mayor cuantía y en relación con el tema de civil; b) se revoca la sentencia solo en cuanto estipuló la calificación de los hechos probados (no prescritos penalmente) indicados en el apartado 3.4. [A del 02 de octubre de 2002 por $6500 (₡2397460); B del 08 de octubre de 2002 por $4200 (₡1551312) y C del 15 de octubre de 2002 por $5800 (₡2146464) todos del caso Ext Promociones S.A.]; 4.5 [sucedidos el 14 de enero de 2003 por $5270 (₡3054386,60); el 04 de febrero de 2003 por $4500 (₡1719180,00) y el 26 de marzo de 2003 por $ 4000 (₡1550640,00) todos del caso Boulevard o La Esquina Ideal] y en el acápite número 5 de la sentencia de mérito [de fecha 12 de noviembre de 2002 por $6000 (₡2238850,00) asunto Caramar, a siete delitos de estafa de mayor cuantía en modalidad de delito continuado.Por unanimidad, se mantiene incólume la pena; el beneficio otorgado; lo dispuesto sobre la acción civil y las costas. Por unanimidad, se declaran sin lugar los restantes alegatos. La jueza Vargas González salva parcialmente el voto solo en cuanto lo resuelto en los considerandos II.E.5., II.E.6. y V.C. NOTIFÍQUESE. Rosaura Chinchilla Calderón Patricia Vargas González Kathya Jiménez Fernández Juezas. (sic) ".
  2. 2Contra el anterior pronunciamiento el licenciado Segismundo Araya Zúñiga y el licenciado Carlos Meléndez Lugo, interpusieron recurso de casación.
  3. 3Verificada la deliberación respectiva, la Sala entró a conocer del recurso.
  4. 4En los procedimientos se han observado las prescripciones legales pertinentes.

Informa la Magistrada Solano Castro; y,

Considerando:

I.Mediante voto Nº 2020-01641, de las 18:55 horas, de 27 de noviembre de 2020, la Sala, admitió para estudio de fondo el primer motivo del recurso de casación planteado por el licenciado Segismundo Araya Zúñiga, en su condición de defensor particular del imputado [Nombre 001], y el primer alegato de casación por adhesión que formula el representante del Ministerio Público, licenciado Carlos Meléndez Lugo, contra la resolución Nº 2020-0770, de las 10:50 horas, de 18 de mayo de 2020, del Tribunal de Apelación de Sentencia del Segundo Circuito Judicial de San José, Goicoechea, que por mayoría, declaró parcialmente con lugar los motivos primero y cuarto del recurso de apelación incoado por la defensa particular. Así las cosas, el ad quem mayoritariamente revocó del fallo N° 1355-2019, de las 17:00 horas, de 10 de diciembre de 2019, del Tribunal Penal del Tercer Circuito Judicial de San José, sede oeste, el extremo de la condena, en lo siguiente: a.-) Los hechos probados configurativos de estafa de menor cuantía, enumerados como 3.4.D de fecha 22 de octubre de 2002, por la suma de $2000; 3.4.E del 4 de noviembre de 2002, por el monto de $3430; 4.5 de fecha 6 de enero de 2003, por $1100; 4.5 de 20 de enero de 2003, por la suma de $2532; 4.5 de 3 de febrero de 2003, por $900; 4.5 del 7 de febrero de 2003, por $1500; 4.5 de 10 de febrero de 2003, por $2352; 4.5 de 24 de febrero de 2003, por $3400; 4.5 de 3 de marzo de 2003, por el monto de $700; 4.5 de 4 de marzo de 2003, por $3000; 4.5 de 19 de marzo de 2003, por la suma de $1500; 4.5 de 24 de marzo de 2003, por $1900; 4.5 del 1° de abril de 2003, por $2100; 4.5 de 4 de abril de 2003, por $470; 4.5 de 7 de abril de 2003, por $2300; 4.5 de 8 de abril de 2003, por $2300; 4.5 de 28 de abril de 2003, por $3000; 4.5 de 6 de mayo de 2003, por $3000; 4.5 del 8 de mayo de 2003, por $1400; 4.5 de 13 de mayo del 2003, por $1800; 4.5 del día 16 de mayo de 2003, por el monto de $460; 4.5 de fecha 19 de mayo de 2003, por $1500; 4.5 de 27 de mayo de 2003, por la suma de $824, y 4.5 del 7 de julio de 2003, por $500.

En consecuencia, acogió la excepción de extinción de la acción penal por prescripción, y por mayoría, procede a absolver al endilgado de la sanción punitiva impuesta por el a quo. Por criterio unánime rechaza la excepción de prescripción en lo atinente a los restantes hechos de mayor cuantía y en torno al tema civil; b.-) Revoca además, la calificación jurídica de los hechos probados (“no prescritos penalmente”), contenidos en el acápite 3.4 A de fecha 2 de octubre de 2002 por $6500 (2397460 colones); B del 8 de octubre de 2002, por la suma de $4200 (1551312 colones), y C del 15 de octubre de 2002, por $5800 (2146464 colones), todos del caso Ext Promociones S.A.J; 4.5 acontecido el 14 de enero del 2003, por $5270 (3054386,60); el 4 de febrero de 2003 por $4500 (1719180,00), y el 26 de marzo de 2003, por la suma de $4000 (1550640,00), correspondiente del asunto Boulevard o La Esquina Ideal, y en el apartado número 5 de la resolución de primera instancia del 12 de noviembre del año 2002, por $6000 (2238850,00), caso Caramar, mismos que por mayoría, recalifica a siete delitos de estafa de mayor cuantía en modalidad de delito continuado (confrontar folios 1089 a 1154, y 1156 a 1159).

II.Recurso de Casación planteado por el defensor particular del imputado [Nombre 001]. Motivo admitido. Primero. Quebranto al principio de imparcialidad. Arguye el patrocinio letrado de la persona imputada que, la resolución dictada por el Tribunal de Apelación de Sentencia, vulnera los preceptos 7, 35, 39, 41, 121, inciso 20, 152 y 153 de la Constitución Política; artículos 1, 3, 175, 178 incisos a), e inciso b) del numeral 468 del Código Procesal Penal, por cuanto, soslaya los principios de juez natural, imparcialidad y del debido proceso, puesto que con anterioridad a dirimir el recurso de apelación, la Jueza Penal Jiménez Fernández, “… había aperturado uno de los debates bajo esta misma causa; y en funciones de Juez de Juicio anuló el auto de apertura a juicio; deciden (sic) dictar el fallo que hoy cuestiono en esta vía…” (confrontar folio 1165 de Tomo III). En ese sentido, expone que en la apertura de juicio de fecha 4 de marzo de 2010, en la cual, se ordenó el reenvío de la causa a audiencia preliminar, con el propósito de subsanar defectos absolutos derivados “de la declaratoria de invalidez e ineficacia del referido auto de apertura a juicio” (confrontar folio 1166), Jiménez Fernández, integró el Tribunal Penal, junto con la licenciada Ramírez Angulo, identificada para aquel momento como Cinthya Angulo Angulo, quien dictó la sentencia condenatoria N° 1355-2019, de las 17:00 horas, de 10 de diciembre de 2019, del Tribunal de Juicio de Pavas.

Detalla que, hasta la emisión del fallo del Tribunal de Apelación de Sentencia impugnado, logra determinar que la jueza Cinthya Angulo Angulo, era la misma persona que la jueza Cinthya Ramírez Angulo, debido al cambio de nombre y de apariencia física de la juzgadora, así como el tiempo transcurrido, aunado a que dicha funcionaria no comunicó a las partes, en tal sumaria, su intervención previa que desde su perspectiva, era lo correcto. Aduce el licenciado Araya Zuñiga, que para el Tribunal de Apelación de Sentencia, el actuar de las juezas Jiménez Fernández y Ramírez Ángulo, en la apertura de debate del 4 de marzo del año 2010, no constituyó inconveniente para que la segunda, fungiera de nuevo como jueza de debate, y la primera, como jueza de apelación, puesto que según ese criterio jurídico, no externaron del caso, razones de fondo al anular el auto de apertura a juicio y disponer la realización de una nueva audiencia preliminar.

En contraposición a esa tesis, indica el recurrente que al iniciarse el contradictorio, ya con la intervención de ambas administradoras de justicia, en virtud de la lectura a los hechos contenidos en la querella y en la pieza acusatoria, escucharon tanto, la estrategia o teoría de la defensa técnica, a su vez, la discusión surgida de evacuar prueba testimonial, e incluso, de la posibilidad de recalificar el cuadro fáctico reprochado (confrontar folios 1171 a 1172). A mayor abundamiento, señala que dichas juezas “…conocieron prueba, hechos, alegatos y hasta anularon un auto de apertura a juicio, indicando que (sic) hechos no estaban contenidos y que había errores en la calificación jurídica; y bajo pretexto de garantizar derechos del imputado, lo que hicieron fue remitir de nuevo a la audiencia preliminar para que subsanaran los defectos; función que no era propia del tribunal de Juicio porque estaban para juzgar lo judicializado; no ordenar remendar las piezas u omisiones…” (confrontar folio 1174).

En ese orden de ideas, pretende que se analicen las actas de juicio, visibles de folios 506 a 508 de la sumaria, mismas que obedecen a la apertura de debate del mes de marzo del año 2010, en la que intervienen las juzgadoras Ramírez Ángulo y Jiménez Fernández (confrontar folios 1175 y 1208). Agrega que es de su interés, la valoración del audio de la apertura del juicio de fechas 4 y 5 de marzo de 2010, con la finalidad de acreditar que dichas funcionarias, se impusieron de los hechos propios del debate y resolvieron temas de fondo. Aspecto que, desde la óptica del impugnante, justificaba la inhibitoria, de ahí, el quebranto que reclama de los principios de juez natural y de imparcialidad (confrontar folio 1208). En respaldo de su argumento, invoca el voto N° 1954-2012 de la Sala de Casación Penal. Estima que el agravio surge ante el menoscabo del artículo 35 de la Constitución Política, al reflejar la indiferencia de garantizar “la investidura de los jueces”, por lo que surge un defecto absoluto, contemplado en el numeral 178 del Código Procesal Penal, circunstancia que visualiza como única solución.

Solicita anular el fallo cuestionado. Pretende que se declare con lugar el motivo, y se anulen las resoluciones dictadas por el a quo y por el ad quem (confrontar folios 1180 y 1258 frente y vuelto del expediente, Tomo III). El motivo se declara sin lugar. Refiere la defensa técnica de la persona imputada, que en este proceso penal, ha surgido un defecto de carácter absoluto, ante el menoscabo de los principios de juez natural y de imparcialidad, pues, las Juezas Kathya Jiménez Fernández, y Cinthya Ramírez Ángulo, en fechas 4 y 5 de marzo del año 2010, conocieron de los hechos de la querella y de la pieza acusatoria, escucharon la teoría defensiva del caso, aunado a la posibilidad de evacuar prueba testimonial, e incluso, de la eventual circunstancia de recalificar el cuadro fáctico incriminado, así como, de imponerse de temas propios del juicio, y zanjar el fondo de la litis, particularidades que en el parecer del defensor privado, generarían la nulidad de la resolución N° 2020-0770, de las 10:50 horas, de 18 de mayo de 2020, emitida por el Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José.

Al respecto, se infiere que el eje medular de su discurso lo enmarca a los acontecimientos que expresamente señala como verificables en las actas de juicio, de fechas 4 y 5 de marzo de 2010, visibles de folios 506 a 508 de los autos. Nótese en primer término, que del estudio de fondo a ese puntual ámbito temporal, se colige la gestión de protesta por actividad procesal defectuosa realizada por el licenciado Araya Zuñiga, bajo los siguientes consideraciones: i.-) Incumplimiento de requisitos en el poder especial concedido por la víctima, al licenciado Álvaro Rodríguez Alfaro, por lo que se enfatiza su falta de legitimación. ii.-) Ausencia de la declaración indagatoria de su representado, sobre los hechos contenidos en la acusación privada. iii.-) Ante el rechazo de la querella surgida en la audiencia preliminar, se debió tener como inexistente las circunstancias fácticas leídas al inicio del juicio, por el licenciado Rodríguez Alfaro, y declinarse su intervención en el debate.

Extremos que fueron resueltos por el Tribunal Penal del Tercer Circuito Judicial de San José, Sede Suroeste, a cargo de las Juzgadoras Gabriela Rodríguez Morales, Kathya Jiménez Fernández, y Cinthya Ramírez Ángulo, el día 5 de marzo del 2010, a las 10:20 horas, de acuerdo a las consideraciones que de seguido se detallan: “En primer término, cabe destacar que de la relación de los artículos 179, 422, 424 del Código Procesal Penal se extrae que las resoluciones y actuaciones serán recurribles solo por los medios y en los casos expresamente establecidas, y “las partes solo podrán impugnar las decisiones judiciales que les causen agravio (…)” Bajo esa premisa, y siendo que los argumentos del gestionante corresponden a valoraciones compatibles con motivos que fundamentarían entrar a conocer sobre vicios en el procedimiento procede el Tribunal a pronunciarse sobre los extremos planteados, en los siguientes términos: El Poder Especial Judicial otorgado por [Nombre 003] en calidad de denunciante, al Licenciado Álvaro Rodríguez Alfaro reúne las formalidades mínimas requeridas y en consecuencia la exigencia que establece el artículo 76 del Código Procesal Penal en el sentido de que…

“el querellante deberá actuar con el patrocinio de un abogado. La querella podrá ser iniciada y perseguida por un mandatario, con poder especial para el caso.” Tal afirmación se extrae el Tribunal al examinar el Poder Especial Judicial visible en folio 30, fechado setiembre 2003, firmado por el denunciante y autenticado por la Licenciada Fiorella Flores Rivera. Nótese que específicamente en lo que interesa, señala: …para que actúe en mi nombre y representación en el presente proceso penal, con la facultad de denunciar, así como de actuar en todas las instancias, recursos ordinarios y extraordinarios, transigir, renunciar a cualquier trámite o audiencia, recusar funcionarios (…) Este mandato tiene vigencia hasta que la sentencia quede firme… Por otro lado, observa el Tribunal que el licenciado Rodríguez Alfaro ha venido actuando durante la fase preparatoria e intermedia (confrontar acta de audiencia preliminar de folio 391) en representación del poderdante sin que se haya planteado por el interesado alguna renuncia o protesta a que éste lo represente, e incluso se ha presentado a debate el día de hoy acompañado de su abogado.

Así las cosas, no solo de la transcripción literal del documento permite establecer las facultades que como querellante ha otorgado el interesado al licenciado Rodríguez desde el inicio de la investigación, sino que se ha hecho representar o acompañar por él a lo largo del proceso. Bajo estas circunstancias se declara sin lugar la protesta y se mantiene como abogado del querellante al Licenciado Rodríguez Alfaro” (confrontar folio 507 frente y vuelto, Tomo II). (La mayúscula pertenece al texto original). Con relación al segundo acápite de la actividad procesal defectuosa, el a quo al resolverla, indica: “b) Respecto de la no indagatoria del acusado [Nombre 001] por los hechos de la querella, debe señalarse que efectivamente se incurrió en esa omisión por parte del Ministerio Público al no haber cumplido con la exigencia del último párrafo del artículo 300 del Código Procesal Penal. De acuerdo a las diligencias realizadas se determina que la indagatoria del acusado [Nombre 001] se practicó el 19 de abril de 2004, la querella se planteó el 08 de mayo de 2004 y la acusación fiscal fue formulada ante el Juez Penal el 3 de marzo de 2008 (confrontar 179 a 182 del Tomo I, folio 50 del legajo de querella, folio 339 vuelto del Tomo I) sin que se procediera a indagar al acusado por alguno de los hechos que no estaban contenidos en la acusación fiscal.

No obstante, resulta un error en el procedimiento que ha sido subsanado a lo largo de la tramitación del proceso dado de las facultades de intervención que se otorgan a la Defensa. Es decir, a criterio del Tribunal pese a que se omitió un acto que bajo otras condiciones vulneraría el derecho de defensa, en este caso y de acuerdo a la relación de los artículos 91, 95, 300, 316 y 317 del Código Procesal Penal se estima que no se han limitado, disminuido o violentado las facultades de intervención del acusado y su defensa técnica. En primer lugar, para el momento que fue indagado se encontraba agregada prácticamente la totalidad de la prueba en la que se fundamenta tanto la acusación fiscal como la querella, se había presentado una denuncia (folio 1 a 29) tan detallada como la querella que se presentó posteriormente; por lo que no resulta sorpresivo para el acusado. En segundo término, de acuerdo al artículo 91 en relación con el 95 citados, el acusado tiene la posibilidad de declarar en cualquier fase del proceso y cuando lo estime indispensable, exigiéndose únicamente la presencia del defensor, defensa técnica que le ha acompañado durante toda la tramitación del proceso.

Ha valorado además el Tribunal que, al ponerse en conocimiento de la Defensa y demás partes todas las actuaciones conforme el artículo 316 del Código Procesal según consta en acta de notificación de folio 341 practicada a las 16:37 horas del 10 de marzo de 2008; el acusado tuvo la posibilidad de manifestarse en relación con las mismas y conocerlas. Así se desprende de las gestiones de folio 343 y 347 realizadas por la anterior Defensora Particular del acusado, para ese momento también querellado, en las que hizo referencia a pruebas que se pusieron en conocimiento con la convocatoria de audiencia preliminar. Por último, tanto de los cinco días que señalaba el auto de las quince horas treinta minutos del diez de marzo de dos mil ocho como durante el desarrollo de la audiencia preliminar, el acusado tuvo la oportunidad de ejercer o solicitar cualquiera de las facultades concedidas por el artículo 317 del Código Procesal Penal.

Bajo las circunstancias expuestas, al no observarse vulneración al Derecho Constitucional de Defensa consagrado en el artículo 39 de la Constitución Política o 1, 30, 91, 93, 95 del Código Procesal Penal, se declara sin lugar la actividad procesal defectuosa incoada” (confrontar folios 507 vuelto a 508 frente, Tomo II). Por último, en lo que concierne al cuadro de hechos acusados y su tratamiento en la audiencia preliminar, dicha integración del Tribunal de Juicio de Pavas, determinó: “c) Examinado el auto de las quince horas del cuatro de agosto de dos mil ocho mediante el que se dispuso la Apertura a Juicio, considera el Tribunal que contiene vicios no susceptible de ser subsanados en esta instancia, pues el a quo incurre en serias contradicciones y omisiones que impiden determinar el cuadro fáctico sobre el que versará el juicio oral y público, y con ello no permite a la Defensa Técnica fijar su estrategia, dificulta al acusado conocer los hechos de los que se defenderá, confunde la posición del querellante debido a que lo admite como querellante y actor civil pero no le admite la acusación particular que presentó porque su criterio es imprecisa o poco clara, y además realiza una antojadiza recalificación de los hechos que no se ajusta a un análisis técnico.

Específicamente, sobre la procedencia de la acusación y la querella el juez Juan José Solano Valverde indicó, erróneamente, que los hechos querellados son los mismos que los que acusa el Ministerio Público, afirmación que es totalmente falsa y se extraería de una simple lectura de ambas piezas. Por otro lado, señala que al no ser tan claros y concretos los hechos de la querella, solo se aceptan los hechos acusados por el Ministerio Público, pero manteniendo al Querellante como parte y le admite su prueba, rechazando la solicitud de declarar tácitamente desistida la querella y acción civil. Entonces, con una errada aplicación de la ley y de las facultades que le concede el artículo 319 del Código Procesal Penal, por un lado, admite la constitución del querellante, pero le rechaza la acusación que precisamente constituye la gestión que le lleva a ostentar esa condición y a legitimarlo para actuar.

Por otro realiza una recalificación de los hechos, la cual, si bien no es definitiva, de aceptarse por el Tribunal y el Ministerio Público requeriría de una advertencia previa al acusado poniéndole en conocimiento que los hechos podrían ser calificados de otra manera. Así las cosas, si bien es cierto el espíritu de la legislación procesal no es retrotraer el proceso a estadios precluidos, el Tribunal estima que los errores contenidos en el auto de apertura a juicio no admiten ser subsanados por lesionar ampliamente el derecho de intervención de las partes, y en todo caso no corresponde al Tribunal fijar los hechos sobre los que él mismo realizará el juicio oral. En consecuencia, se declara ineficaz el auto de apertura a juicio dictado a las quince horas del cuatro de agosto del dos mil ocho así como la audiencia que le precedió. Se ordena nueva sustanciación por parte de Juez distinto al que decretó la apertura a juicio.

En virtud de lo resuelto, se anula lo actuado en la audiencia del día de ayer cuatro de marzo de dos mil diez y se ordena remitir las diligencias al juez penal para que realice nuevamente la Audiencia Preliminar y disponga lo que corresponda” (confrontar folio 508 frente y vuelto, Tomo II). A modo de recuento, posteriormente, en auto de las 8:30 horas, del 11 de marzo de 2010, el Juzgado Penal de Pavas, señaló la audiencia preliminar para las 13:30 horas, de 11 de junio de 2010 (confrontar folio 509, Tomo II), reprogramada el 9 de junio de 2010, para el 14 de setiembre de 2010, misma que se suspendió para el análisis de eventuales medidas alternas, empero, surge un nuevo señalamiento para el 8 de febrero del 2011 (confrontar folios 547, 555, 563 y 564, 568 a 570. Tomo II). En consecuencia, mediante pronunciamiento de las 10:00 horas, del 16 de febrero del 2011, el Juzgado Penal de Pavas, por medio de la licenciada Nancy Fernández Rodríguez, resuelve las gestiones ventiladas de las partes en la audiencia preliminar y dicta el auto de apertura a juicio (confrontar folios 570 a 576, Tomo II), cuyo debate se celebra desde el 11 de noviembre del 2019, con la integración de la Jueza Cinthya Ramírez Ángulo, y de sus homólogos Pedro Méndez Aguilar, y Jhon Tapia Salazar (confrontar folios 839 frente y vuelto, 842 frente y vuelto, 874 a 875, 887 a 889).

Queda claro de la valoración supra citada, que el Tribunal Penal interviniente, donde en su momento, figuran las Juezas Jiménez Fernández y Ramírez Ángulo, se limitó a enunciar las falencias y contradicciones de lo valorado por el Juez Penal en la audiencia preliminar, en torno al cuadro fáctico, del cual, se admitió el auto de apertura a juicio, y de la serie de vicisitudes, tanto sobre el rechazo de la querella y pese a eso, mantener al querellante como parte, estableciéndose que esos yerros, no eran factibles de ser subsanados ante la vulneración al derecho de intervención de las partes. Así, de forma atinada puntualizan ( Rodríguez Morales, Jiménez Fernández, y Ramírez Angulo), que no se encontraba entre las potestades del a quo estipular el cuadro fáctico del que dependía -para aquel contexto- la realización del debate oral y público. Por lo anterior, Jiménez Fernández, Ramírez Ángulo, y Rodríguez Morales, se decantan a la luz del principio constitucional del debido proceso, en decretar ineficaz el auto de apertura a juicio cuestionado por la defensa del imputado.

Sobre el particular, y en virtud del examen integral del fallo de mérito, previsto en las disposiciones normativas 459, 462 y 465 del Código Procesal Penal, el Tribunal de Apelación de Sentencia Penal, se impuso en su totalidad, de las actuaciones ya evaluadas sobre el proceder de las Juzgadoras, y descartaron el advenimiento de algún vicio esencial, que en apego de los principios de objetividad e imparcialidad de Juzgador, hubiese afectado la validez de lo ordenado por la referida administración de justicia. Producto de la revisión cuidadosa de los autos, el ad quem, señala: “Como puede determinarse de lo transcrito, el pronunciamiento del órgano de juicio versó únicamente sobre temas formales y si bien en algún instante aludió a la pieza acusatoria y a su calificación, lo hizo únicamente en función de verificar si esta era clara y si, producto de la recalificación efectuada (pues en la querella se atribuían delitos de falsificación de documento y afines), se cumplía con el derecho de defensa, temas que, finalmente, quedaron subsanados en la siguiente audiencia preliminar y que no son los que aquí se reclaman, ni tienen relación con ellos, razón por lo que no existía impedimento alguno para que la jueza Jiménez Fernández integrara este tribunal que conoció la audiencia oral y se pronuncia (sic) sobre los recursos ni la hay, tampoco, desde la perspectiva del principio de imparcialidad del tribunal, para que la jueza Angulo Angulo o Ramírez Angulo (que es la misma persona) haya integrado aquel tribunal y, luego, formara parte del órgano jurisdiccional que resolvió el asunto en la sentencia de mérito” (confrontar folio 1092 frente).

(Lo destacado con negrita no pertenece al texto original). Valga agregar sobre tal argumentación, que el Tribunal de Apelación de Sentencia Penal, consideró en la audiencia oral, llevada a cabo el 22 de abril de 2020 (programada para escuchar a las partes sobre la apelación incoada por el licenciado Araya Zuñiga), la no objeción de la integración del tribunal de alzada (confrontar folio 1090 frente, Tomo III). Por lo expuesto, descarta que alguna de las Juezas intervinientes, hubiese adelantado criterio sobre aspectos de fondo, u otros temas pertinentes a la sentencia cuestionada. Posición jurídica que sin duda esta Sala, ratifica en un todo, porque el alegato que entraña el casacionista, sobre la supuesta vulneración a los principios de juez natural y del debido proceso de las Juzgadoras Jiménez Fernández, y Ramírez Ángulo, propio de lo resuelto en torno a los reclamos de la actividad procesal defectuosa (de escuchar tanto la estrategia de la defensa, la discusión ocasionada de evacuar prueba testimonial, de la posibilidad de recalificarse los hechos, y de incluso, proferir juicios de valor sobre el fondo), responde a un simple descontento con el fallo confirmado (confrontar folios 1257 a 1259 frente, Tomo III), propuesta que no logra alcanzar la esencialidad del vicio aludido, pues, el ineludible vínculo con la materialización de un agravio irreparable, según el artículo 439 del Código Procesal Penal, en este caso, es inexistente.

En otras palabras, de acuerdo con la propuesta del impugnante y del análisis de los autos, no es posible evidenciar alguna duda de imparcialidad de las Juezas Jiménez Fernández, y Angulo Ramírez, frente a lo resuelto; es decir, se desapercibe en ellas, interés personal alguno, circunscribiéndose su desempeño, por el contrario, al ejercicio de genuinas funciones como depositarias de justicia, preservando la mayor objetividad sobre aspectos estrictamente formales, que dentro de un parámetro razonable, lejos de todo prejuicio, conllevó a la anulación del auto de apertura a juicio. Criterio tomado sin la inherencia propia o derivada de sus psiquis, en el desarrollo de juicios de valor hacia la condición jurídica del imputado (confrontar folios 506 a 508, Tomo II del expediente), siendo que dicho proceder, se encuentra apegado en el numeral 8.1 de la Convención Americana sobre Derechos Humanos; en los preceptos 34, 39 y 42 de la Constitución Política; y artículos 5 y 6 del Código Procesal Penal.

Más aún, nuestra jurisprudencia ha enfatizado que no existe vulneración al principio de imparcialidad, si la persona juzgadora interviene como juez, en un proceso en el cual, no analizó prueba, ni realizó valoraciones de fondo, a mayor amplitud, se destaca: “ … En relación a la posibilidad material que tiene la persona juzgadora de iniciar el ejercicio intelectivo sobre la base de los hechos, evidencias o elemento de prueba que conoció previamente, la doctrina ha señalado lo siguiente: “La abstención y recusación se fundan –continúa diciendo- en la valoración del término medio de las energías psíquicas. Así –señala- cuando consten uno o más elementos que hagan sospechoso al juez como tipo humano medio, se lo debe excluir del proceso sin tener en consideración el grado particular de fuerza moral…” (Clariá Olmedo, Jorge. Tratado de Derecho Procesal Penal, Buenos Aires, Argentina, 1964, Tomo II, pág. 242).

Por ello, la existencia del aspecto objetivo de la imparcialidad parte de una circunstancia constatable o averiguable que origina la duda sobre la objetividad del Juez, de tal forma que no cualquier intervención jurisdiccional en un acto previo, produce lesión al principio de imparcialidad desde la óptica objetiva. En relación al aspecto subjetivo del citado principio, la Sala Constitucional, en la resolución 05301-2005 del 4 de mayo de 2005, señaló lo siguiente: “Constituye una lesión al debido proceso el hecho de que los jueces que participan en el debate y dictan sentencia, hayan intervenido antes en el proceso con actuaciones que impliquen un análisis y valoración sobre el fondo del asunto o que, de forma similar, comprometan su imparcialidad, todo lo cual deberá constatar la autoridad consultante.” (El destacado no corresponde al original). En el mismo sentido, esta Cámara, en un caso similar al que se analiza, dispuso lo siguiente: “Esto evidencia que no se cuestionó en ningún momento su imparcialidad y esta no se ve comprometida por el hecho de que hayan escuchado dos veces al justiciable y a la ofendida (nótese que la restante prueba sólo la conocieron en el segundo juicio, que sí se completó).

Ese es el único reproche que les hace la recurrente, pero adviértase que si no expresaron nunca opinión sobre los alcances de esas declaraciones, entonces no perdieron su condición de imparcialidad y no tenían razón alguna para no conocer.”. (Sala Tercera, resolución número 2007-00763, de las 9:15 horas de 27 de julio de 2007 (el destacado es suplido, integrado por: Arroyo, Chinchilla, Ramírez, Chaves y García)). Conviene reseñar que esta Sala de Casación, como la Sala Constitucional, han señalado por ejemplo, que el solo hecho de que un juzgador haya participado en resoluciones que impongan, prorroguen o confirmen una medida cautelar, no es, por sí sola, una circunstancia que implique vulneración al principio de objetividad que debe regir la función jurisdiccional. Siguiendo esta línea jurisprudencial, se puede sostener que tampoco se vulnera dicho principio si una persona juzgadora ha participado como juez en un proceso en el cual no valoró prueba, ni emitió criterio de fondo.” (Resolución N° 2021-01026, de las 12:35 horas, de 27 de agosto de 2021, Solano Castro, Ramírez Quirós, Burgos Mata, Alfaro Vargas, y Acón Ng, Sala Tercera de la Corte Suprema de Justicia).

Acorde con dicha línea interpretativa, en el voto N° 2021-01120, de las 11:29 horas, de 24 de setiembre de 2021, se afirma: “… la Sala Tercera de la Corte Suprema de Justicia, ha mantenido el criterio de determinar, mediante el análisis del caso concreto, si existe la reprochada violación del principio de imparcialidad del juez. En esta línea argumentativa, ha considerado lo siguiente: “Tal como lo ha sostenido de manera reiterada esta Sala, la imparcialidad del Juez no se ve comprometida por el solo hecho de participar en las etapas previas del proceso, debiéndose analizar cuidadosamente cada caso en concreto a fin de verificar si la actuación previa exigía o contenía un análisis de los elementos probatorios, de forma tal que llevaran ineludiblemente a la formación de un criterio en cuanto al caso, o bien se enunciara por parte del juzgador, conclusiones o valoraciones en cuanto al fondo del asunto.

Como se comprueba del análisis de sendas resoluciones, la imparcialidad del Juez no se vio comprometida ya que en ningún caso hubo necesidad de realizar un examen del sustento probatorio de la acusación, tampoco se observan afirmaciones en torno a la responsabilidad o culpabilidad del imputado, ni se abordaron aspectos del fondo del caso, de ahí que no existía impedimento alguno para que los referidos funcionarios integraran, como lo hicieron, el Tribunal sentenciador. Consecuentemente, no existía motivo para que la defensa objetara la conformación del Tribunal, ni se encuentra evidencia de deficiencias en la labor desempeñada por la licenciada Gutiérrez Sancho, que pudiesen generar un perjuicio al encartado, por lo cual se declara sin lugar el reclamo.” (Sala de Casación Penal, sentencia número 576-2010, de las 9:05 horas del 4 de junio de 2010). Resulta oportuno agregar, “… que la doctrina entiende que un juez imparcial es aquel que aplica la ley sin tender a un fin determinado, sea propio o ajeno (acá juega la independencia) y para esto tiene vedada la realización de actividades propias de las partes (acá juega la imparcialidad).

La importancia de la imparcialidad judicial radica en la necesidad de su existencia para tener por configurado un proceso como debido. Y esto se justifica en la legitimidad que ella otorga al juez como tercero ajeno al litigio para resolverlo. Las partes solo pueden concebir la resolución de un conflicto intersubjetivo de intereses por un tercero si este actúa en base al respeto de los derechos de ambas, actor y demandado, llevando a cabo un proceso según constitución (...) La heterocomposición de los procesos contenciosos implica la necesidad de que sean resueltos por un tercero imparcial, ajeno a los intereses en conflicto. Esta imparcialidad, desde luego, no se equipara con la neutralidad, puesto que al Juez se le exige un compromiso con la verdad y la justicia, que a la postre se expresa en juicios de valor que cuestionan o contravienen la posición de las partes.” (PICADO VARGAS, El derecho a ser juzgado por un juez imparcial.

En: Revista IUDEX, N°2, agosto 2014, pp. 38 y 39). De todo lo anterior se colige, la importancia que tiene en el sistema judicial el respeto al debido proceso, el cual se conforma de principios y garantías, dentro de las que se encuentran las aquí mencionadas de imparcialidad, objetividad y juez natural, que son determinantes para la justicia penal. Ahora bien, para que exista una vulneración del principio de imparcialidad del juez, se requiere, prima facie, llevar a cabo un estudio de las actuaciones jurisdiccionales en las cuales ha participado la persona juzgadora para determinar, en el caso concreto, si sus valoraciones han requerido un análisis de fondo respecto a cuestiones medulares de la imputación formulada y sobre las cuales emitió pronunciamiento, o bien, si el examen ha versado sobre aspectos de trámite o de cumplimiento de requisitos formales que conllevan una evaluación somera para decidir sobre un aspecto específico del procedimiento, que no contempla un escrutinio sustancial.

Y, con respecto al juez natural, si este fue nombrado para el caso concreto, o bien, estaba dentro de sus funciones ordinarias para el nombramiento legal que desempeñaba …” (Solano Castro, Ramírez Quirós, Burgos Mata, Alfaro Vargas, y Segura Bonilla, Sala Tercera de la Corte Suprema de Justicia). (La Mayúscula y negrita pertenece al texto original). En virtud de las razones de hecho y de derecho planteadas, resulta inexpugnable aseverar el contenido recursivo que elige el litigante en su motivo, al desacreditarse la concurrencia de algún error judicial determinante y evidente en torno a una (especulativa) valoración de los elementos de prueba que hubiese afectado de forma sensible la objetividad e imparcialidad de la integrante del Tribunal de Pavas, y de la miembro del Tribunal de Apelación de Sentencia Penal, que coparticiparon en el juzgamiento y en la confirmación de la declaratoria de culpabilidad del aquí encartado (confrontar folios 890 a 966, y 1089 a 1154 del expediente, Tomo III), en detrimento de los derechos fundamentales del enjuiciado.

Actuar recursivo, que por el contrario, refleja la promoción de la nulidad por la nulidad misma de la sentencia penal, y del voto de alzada. En todo caso, con base en el examen de fondo, se infiere como aspecto relevante que, de las incidencias acontecidas el día 4 de marzo de 2010 (confrontar folios 506 frente y vuelto), y resueltas el 5 de marzo de 2010 (confrontar folios 507 a 508 vuelto, Tomo II), donde intervienen las Juezas Jiménez Fernández y Ramírez Angulo, no surgen hechos averiguables que suscite dudas en relación a su imparcialidad, máxime que como se ahondará, para aquel entonces, no tuvieron el menor vínculo con el acervo probatorio. A contrario sensu, la responsabilidad penal -posteriormente- demostrada contra el justiciable, se funda en un iter lógico cuyo cuadro de hechos probados (confrontar folios 917 frente a 922 vuelto), es construido a partir de la concatenación razonada de juicios de valor asignados a cada uno de los elementos de prueba, evacuados en el contradictorio, a la luz de los principios de la oralidad, de inmediación, y de debido proceso, según las disposiciones normativas 180 a 184, 326, 328, 330, 333, 335, 341 a 343, 345, 349, 350 a 353, 356 a 358, 360 a 365, y 368 del Código Procesal Penal, a saber: testimonial de [Nombre 004] (confrontar folios 926 vuelto a 927 vuelto), [Nombre 005] (confrontar folios 927 vuelto a 930 vuelto), [Nombre 003] (confrontar folios 930 vuelto a 937 vuelto), y [Nombre 006] (confrontar folios 937 vuelto a 939 vuelto), en suma a la defensa material de [Nombre 001] (confrontar folios 923 a 926 vuelto); y a la prueba documental incorporada al juicio, visible de folios 939 vuelto a 942 frente); en estricta aplicación a las reglas del correcto entendimiento humano, que permitieron al Tribunal Colegiado, atribuir con certeza la responsabilidad del acusado (confrontar folios 942 a 953 vuelto), imponer la pena (confrontar folios 953 vuelto a 958 vuelto), dirimir cada uno de los cuestionamientos de la defensa relativo a las comunicaciones realizadas mediante correo electrónico, etc. (confrontar. folios 948 vuelto a 960), resolver el extremo de la acción civil resarcitoria (confrontar folios 961 a 962), y absolutorias por otras imputaciones (confrontar folios 963 a 966).

Al respecto, según ese orden de ideas, el a quo, entre otros aspectos, concluye: “… El imputado procede a engañar a [Nombre 003] y simula la existencia de procesos judiciales, engaño que realiza de forma sumamente completa, pues mediante comunicaciones electrónicas va imponiendo al ofendido de actos procesales que deben realizarse los que supuestamente justificaban los depósitos que le solicitaba, incluso, procede a confeccionar supuestas resoluciones judiciales que justifican los inexistentes actos del proceso, para dirigir a error al ofendido y lograr la disposición patrimonial por medio del otorgamiento de los distintos depositos (sic) que realizo (sic). Como vemos se trata de una simulación o engaño en el que se procedió a hacer pensar al ofendido que se instauraron procesos judiciales para embargar propiedades que le permitieran al ofendido detener la venta de las mismas y posteriormente se posibilitara su adjudicación para posterior venta, pero en realidad estos procesos nunca fueron instaurados por esta persona, siendo todo ello parte del desarrollo de la actuación engañosa, donde se obtuvo los respectivos depositos (sic) de dinero a favor del imputado.

Esta situación de engaño hizo incurrir al ofendido, indiscutiblemente, en error, el cual no podía ser percibido sencillamente debido al sofisticado y limpio artificio de simulación de una situación irreal para aparentar actos procesales que nunca se realizaron, generando al ofendido un perjuicio economico (sic) que ascendio (sic) a OCHENTA Y SIETE MIL DOSCIENTOS TREINTA Y OCHO DOLARES (al tipo de cambio de hoy sería la suma de CINCUENTA MILLONES SETENTA Y CUATRO MIL SEISCIENTOS COLONES”). (confrontar folio 956 vuelto). (La Mayúscula pertenece al texto original). Por su parte, el ad quem en lo que atañe a la declaratoria de culpabilidad, la describe como consecuente de los alcances del contradictorio, verbigracia: “… la sentencia no se apoyó exclusivamente en los documentos, sean estos comunicaciones, fax o estados bancarios, sino que también el dicho del ofendido mereció credibilidad, tanto como el de los otros testigos (la pareja de este [Nombre 005] quien tuvo conocimiento directo de lo sucedido y Luis Alfredo Montes Solano, abogado contratado por el querellante para que investigara cómo iban los procesos judiciales que el endilgado le describía a este y que él determinó que no existían) y no tuvo el mismo trato (por razones ampliamente explicadas en la sentencia y que fueron correctamente derivadas por el tribunal) la tesis defensiva, expuesta por el encartado y quien fuera su asistente [Nombre 006] (que versó sobre el hecho de que entre el encartado y el perjudicado existió una relación amorosa y, en virtud de ella, este giró diferentes sumas de dinero a aquel, por liberalidades o préstamos y que el endilgado satisfizo sin dejar constancia de los pagos).

Sin embargo, inclusive suprimida hipotéticamente toda la prueba documental, dada la libertad probatoria que rige el proceso penal y la contundencia del relato del denunciante frente a las incoherencias de la tesis defensiva, la determinación fáctica permanecería incólume, lo que significa que ninguna de las quejas expuestas es idónea para generar un perjuicio efectivo a los intereses defensivos” (confrontar folio 1131 frente y vuelto, Tomo III). Finalmente, con respecto al voto N° 2012-01954, de las 14:16 horas, de esta Sala, que evoca el litigante en apoyo de su motivo de casación, es importante aclarar que el supuesto por el cual, de oficio -en ese asunto- se anula la resolución del ad quem, gira en torno a un manifiesto quebranto al principio de imparcialidad del juez, al comprobarse la existencia de dos fallos de fondo esgrimidos por el mismo juzgador de alzada, donde en el primero, se anula la sentencia absolutoria y estipula el reenvío; y en el segundo, ratifica la condena y estima sin lugar el recurso de apelación de la defensa.

Así, concluye la Sala, que, ante la doble intervención del Juez, en resoluciones que evaluaron de manera integral cada una de las actuaciones y pruebas sometidas al juicio, imperó un notable compromiso a los principios de imparcialidad y de objetividad que tienen que prevalecer en la función jurisdiccional (Ramírez Quirós, Chinchilla Sandí, Pereira Villalobos, Arias Madrigal, y Arroyo Gutiérrez, Sala Tercera de la Corte Suprema de Justicia). Así las cosas, en el presente estudio, no existe defecto absoluto que afecte los derechos fundamentales del imputado. Se descarta el quebranto de los principios de objetividad y de imparcialidad que cita la defensa privada, por cuanto, como bien se expuso líneas atrás, la anulación del auto de apertura a juicio (confrontar folios 506 a 508, Tomo II del expediente), no implicó adelanto de criterio, en relación a temas de fondo, u otros aspectos sobre los que versa el fallo impugnado. En resumen, el motivo incoado debe declararse sin lugar.

III.Recurso de Casación formulado por el representante del Ministerio Público. Motivo admitido. Aplicación equívoca del precepto legal sustantivo 77 del Código Penal. Expone el impugnante que el Tribunal de Apelación de Sentencia Penal, en su criterio de mayoría, aplica de manera errada la norma sustantiva, en lo que concierne a los alcances del delito continuado, al sostener dicho órgano jurisdiccional, que según el cuadro fáctico de marras, se trata de un concurso material, ante un conjunto de ilicitudes prolongadas en el tiempo, y bajo esa percepción, imperaba realizar el análisis de hechos de modo independiente. Así, refuta el proceder de realizar la sumatoria de cada una de las defraudaciones para considerar el perjuicio en un solo rubro, que -equívocamente- permite establecer la pena utilizada en el cómputo del plazo (confrontar folio 1216 vuelto). De lo decidido, advierte el casacionista, que lo correcto era interpretar de acuerdo al contexto fáctico, que el conocimiento y la voluntad del imputado, facultaba el enlace o la unión de las defraudaciones, puesto si bien, todas esas estafas o fraudes, constituían un delito, precisamente el dolo de [Nombre 001], las integraba en un único delito, debiéndose entender como una sola acción típica y antijurídica, por ende, no cabía la posibilidad de valorarse independientemente para el cálculo de prescripción.

Concluye, que la decisión tomada, ocasiona un perjuicio, al mal interpretar la concurrencia de diversas acciones punibles atribuidas al sujeto activo en mención, de forma que, pese a lo invariable del extremo de la pena, la absolutoria emitida por distintas conductas por las cuales, la Fiscalía gestó la condena, directamente incide en la aplicación correcta de la ley penal sustantiva. Solicita anular la absolutoria y se proceda conforme a derecho corresponde (confrontar folios 1268 vuelto a 1270 y 1216 a 1217 frente). El motivo se declara con lugar. Afirma el recurrente que en el caso concreto, el Tribunal de Apelación de Sentencia Penal, en decisión de mayoría, incurre en incorrecta aplicación del precepto legal 77 del Código Penal, que concierne a los alcances del delito continuado, al interpretar el cuadro fáctico específico como "una mera pluralidad de acciones, que fue prolongada en el tiempo, por lo que consideró, que cada acción fue distinta una de otra y por lo tanto, debió estudiarse su cuantía de forma independiente, para establecer la prescripción" (confrontar folio 1216 vuelto.

Tomo III). En ese sentido, transcribe un segmento de la tesis mayoritaria, visible de folios 1118 y 1120, para de seguido, refutar la decisión de estipular que cada conducta defraudatoria debía concebirse de manera aislada del factor final, percibiéndose como acciones diferentes, sin detenerse en el plan de autor, que fue direccionado, como una sola estafa, permanente en el tiempo, que provocó un único perjuicio patrimonial a la víctima. Ahora bien, de acuerdo con los antecedentes que consta en autos, en relación estricta al extremo que discute el impugnante, de lo examinado por el Tribunal de Apelación de Sentencia Penal, se desprende el siguiente cuadro fáctico acreditado: “C) Hechos probados. Así las cosas, dado que la sentencia también absolvió al encartado por unos eventos (y rige, al respecto, el principio de prohibición de reforma en perjuicio) es menester transcribir los hechos que se tuvieron por acreditados, para verificar, solo respecto de ellos (y sin perder de vista, tampoco, la calificación dada por el tribunal referente a la existencia de un delito continuado, aspecto que, en todo caso, se retomará en otros apartados de esta decisión), cómo fueron imputados y si la acción penal se encontraba vigente al hacer dicho pronunciamiento.

Ese elenco es el siguiente: «1) El imputado [Nombre 001] y el ofendido [Nombre 003], se conocieron unos seis años antes de los hechos que posteriormente se indicarán, a través de amigos comunes que los presentaron, llegando el acusado a ganarse la confianza del ofendido, quien además acudió a él para que lo asesorara como abogado.

  • 2)El aquí imputado (...) a sabiendas del carácter ilícito de sus actos, aprovechándose de la relación de confianza y amistad que mediaba con el ofendido (...) al ser abogado y notario de este último, y con el exclusivo fin de obtener un beneficio patrimonial antijurídico ideó y ejecutó un plan ilícito consistente en el ofrecimiento fraudulento de interponer demandas civiles y llevar los respectivos procesos judiciales a nombre del ofendido en casos donde el ofendido tenía diferendos mercantiles con algunos socios de empresas en las cuales éste tenía participación accionaria, todo lo anterior a cambio de que el ofendido le desembolsase al imputado (...) a título de honorarios y gastos procesales, altas sumas de dinero con el fin de hacerle frente a dichos procesos. Tales ofrecimientos eran totalmente falsos toda vez que los procesos judiciales a los que el encartado (...) hacía referencia eran inexistentes.
  • 3)El ofendido (...) es dueño de veinticinco acciones de (...) E.X.T. Promociones Sociedad Anónima, (…) propietaria registral de la finca del Partido de San José, matrícula número 96926-000, ubicada en Escazú, con una medida de 8622.17 metros cuadrados, la cual es parte del haber social de dicha persona jurídica y se ubica casi contiguo a Hotel Real Intercontinental en las cercanías de Multiplaza. El capital social de dicha sociedad era la suma de cien mil colones, representado por cien acciones, correspondiendo el resto del capital social, sesenta acciones a la compañía Promociones JT S.A., y al señor [Nombre 007] otras quince acciones. 3.1 En virtud de una posible venta del inmueble de marras y sobre la posible exclusión del señor [Nombre 003] como socio de las ganancias que dicho negocio generara, por ser socio minoritario, sin precisar fecha exacta pero sí durante el mes de setiembre del año 2002 y antes del 10 de octubre del año 2002, éste comunicó de dicha situación a quien para la época era su abogado de confianza el aquí sindicado [Nombre 001]. 3.2 Acto seguido, el sindicado (...) a sabiendas de la ilicitud de sus actos, conforme al plan criminal descrito supra, aprovechándose de la ignorancia que en materia legal civil y mercantil tenía el ofendido, y con el fin de obtener un beneficio patrimonial antijurídico, siempre en el período precitado y en la residencia del señor [Nombre 003] en Escazú, le indicó a este de manera ajena a la verdad que lo recomendable era iniciar un proceso civil para "embargar" dicho inmueble e impedir que los socios de la sociedad dueña del inmueble lo pudieran vender. 3.3 Creyendo en la veracidad del dicho del encartado, el señor [Nombre 003] inducido a error le indica al justiciable (...) que inicie el mencionado proceso civil de "embargo" de dicho inmueble. 3.4 De esta manera, el encartado (...) aprovechándose de que para la fecha de los hechos que se dirán, el ofendido se encontraba en Suiza, como parte de su plan delictivo, comenzó a requerir al ofendido altas sumas de dinero en dólares vía correo electrónico, teléfono o fax, mismas que falsamente refería que eran para actos procesales, solicitando al ofendido el depósito de las mismas mediante transferencias bancarias a la cuenta del Banco Nacional de Costa Rica número 200-2-002-508984-2 de la sociedad FC Inmobiliaria Playa Negra Sociedad Anónima, de la cual el encartado [Nombre 001] es Apoderado Generalísimo, según el detalle que se dirá: A) En fecha 2 de octubre del año 2002, vía correo electrónico, el encartado [Nombre 001], requirió falsamente al ofendido la suma de seis mil quinientos dólares americanos ($6500) a efecto de poder trabar el embargo en la finca en cuestión, ante lo cual, el señor [Nombre 003], inducido en error y creyendo en la real existencia del proceso civil de marras, procede mediante transferencia electrónica, desde Suiza, a cancelar al encartado [Nombre 001], la suma de seis mil quinientos dólares americanos ($6500) a través de depósito hecho a la cuenta (...) de la sociedad FC Inmobiliaria Playa Negra Sociedad Anónima, de la cual el encartado [Nombre 001] es Apoderado Generalísimo. B) En fecha 8 de octubre del año 2002, vía telefónica, el encartado [Nombre 001], requirió falsamente al ofendido la suma de cuatro mil doscientos dólares americanos ($4200) a efecto de poder realizar un depósito judicial en el embargo que interponía contra la finca en cuestión, ante lo cual, el señor [Nombre 003], inducido en error y creyendo en la real existencia del proceso civil de marras, procede mediante transferencia electrónica, desde Suiza, a cancelar al encartado (…) la suma de cuatro mil doscientos dólares americanos ($4200) (...) C) En fecha 15 de octubre del año 2002, vía fax, el encartado [Nombre 001], requirió falsamente al ofendido la suma de cinco mil ochocientos dólares americanos ($5800) a efecto de poder garantizar el precio de la finca durante el embargo que tenía, ante lo cual, el señor [Nombre 003], inducido en error y creyendo en la real existencia del proceso civil de marras, procede mediante transferencia electrónica, desde Suiza, a cancelar al encartado (...) la suma de cinco mil ochocientos dólares americanos ($5800) (...) D) En fecha 22 de Octubre del año 2002, vía fax, el encartado (...) requirió falsamente al ofendido la suma de dos mil dólares americanos ($2000) a efecto de poder él contar con más dinero en caso de que el Juzgado que conocía del "embargo" requiriese más efectivo para el proceso judicial, ante lo cual, el señor [Nombre 003], inducido en error y creyendo en la real existencia del proceso civil de marras, procede mediante transferencia electrónica, desde Suiza, a cancelar al encartado [Nombre 001], la suma de dos mil dólares americanos ($2000) a través de depósito (...) E) En fecha 4 de noviembre del año 2002, vía fax, el encartado (...) requirió falsamente al ofendido la suma de tres mil cuatrocientos treinta dólares americanos ($3430) debido a que el Juzgado Civil de Mayor Cuantía de San José había aumentado el monto de la garantía por el embargo preventivo que él había interpuesto, ante lo cual, el señor [Nombre 003], inducido en error y creyendo en la real existencia del proceso civil de marras, procede mediante transferencia electrónica, desde Suiza, a cancelar al encartado (...) la suma de tres mil cuatrocientos treinta dólares americanos ($3430) a través de depósito (...) 3.5 Con el fin de mantener en error al ofendido y así continuar con su matráfula, el justiciable (...) entregaba al señor [Nombre 003] colillas de depósito en las cuales falsamente se indicaba que los dineros a él confiados habían sido efectivamente depositados en el Juzgado Civil de Mayor Cuantía de San José, situación la cual era totalmente ajena a la verdad. 3.6 Sin precisar fecha exacta pero sí durante (...) julio del año 2003 y debido a que el ofendido comenzó a entrar en sospechas sobre la efectiva existencia del proceso civil en cuestión y sobre el "embargo" que presuntamente recaía sobre dicho bien, por averiguaciones propia entró en conocimiento sobre la falsedad del dicho del encartado (...) sobre la inexistencia del proceso civil en cuestión y sobre la falsedad de los datos, generándose consigo un perjuicio financiero para su persona por estos hechos en específico en la suma de veintiún mil novecientos treinta dólares americanos ($21930).
  • 4)El ofendido [Nombre 003], tiene participación como socio dentro de (...) La Esquina Ideal Sociedad Anónima, propietaria registral del inmueble del Partido de San José, matrícula 1638-000, lote en el cual reside la propiedad condominal (…) Centro Comercial Boulevard, ubicado en Escazú, siendo la organización y distribución de locales comerciales en veinticuatro filiales o locales que tenían una administración propia diferente (…) 4.1 En virtud de una serie de diferendos que tenía el señor [Nombre 003] como socio de tal empresa en cuanto a su administración y manejo, sin precisar fecha exacta pero sí durante el mes de noviembre del año 2002 y antes del 4 de diciembre del año 2002, éste comunicó de dicha situación a quien para la época era su abogado de confianza el aquí sindicado (...) 4.2 Acto seguido, el sindicado (...) a sabiendas de la ilicitud de sus actos, conforme al plan criminal descrito supra, aprovechándose de la ignorancia que en materia legal civil y mercantil tenía el ofendido, y con el fin de obtener un beneficio patrimonial antijurídico, siempre en el período precitado y en la residencia del señor [Nombre 003] en Escazú, le indicó al ofendido (...) de manera ajena a la verdad que lo recomendable era iniciar un proceso civil para "embargar' dicho inmueble luego de lo cual y una vez "inmovilizado" tal bien, se abriría otro proceso civil en el cual también de manera falsa y totalmente alejado de la realidad, el encartado (...) le señaló al señor [Nombre 003] que él lograría entrar en la total administración del Centro Comercial y de la empresa en mención. 4.3 Creyendo en la veracidad del dicho del encartado, el señor [Nombre 003] inducido a error le indica al justiciable (...) que inicie el mencionado proceso civil de "embargo" de dicho inmueble. 4.4 De esta manera, siempre en la localidad de Escazú y dentro del período que de seguido se señalará, el encartado (...) como parte de su plan delictivo, comenzó a requerir al ofendido altas sumas de dinero en dólares, mismas que falsamente refería que eran para actos procesales y honorarios, solicitando al ofendido el depósito de las mismas mediante transferencias bancarias a la cuenta del Banco Nacional de Costa Rica número 200-2-002- 508984-2 de la sociedad FC Inmobiliaria Playa Negra Sociedad Anónima, de la cual el encartado (...) es Apoderado Generalísimo. 4.5 Así las cosas, el ofendido, inducido a error por la matráfula creada por el encartado (...) creyendo firmemente en la existencia del proceso civil de "embargo" contra la finca de marras y creyendo a su vez en la realidad de los costos, honorarios y actos procesales que como abogado del supuesto proceso exigía el sindicado (...) procedió a cancelar a éste los montos que de seguido se detallan:

  • 5)Asunto Caramar: Paralelamente a los fraudes mencionados en los puntos anteriores de esta querella, el día 11 de noviembre del año 2002, el imputado [Nombre 011] le envió al ofendido [Nombre 003] un fax a su casa en Suiza el cual tenía fecha 10 de noviembre del año dos mil dos, manifestándole que necesitaba su ayuda, dado que había ganado un juicio que le daba la posibilidad de cobrar honorarios por "ciento treinta y tres millones seiscientos cuarenta y seis mil quinientos sesenta y tres colones", que según lo que él establecía en el fax, a la fecha eran un poco más de cuatrocientos mil dólares. También manifestó el acusado [Nombre 011] en el fax que para cobrar esos honorarios le había embargado a sus clientes sendas fincas, a uno de ellos una finca de ochenta hectáreas toda sembrada en madera de teca y al otro cliente diez lotes en una urbanización ubicada en Playa Negra, denominada Caramar, diciendo además en ese documento que cada uno de esos lotes tenían un precio aproximado a los cincuenta mil dólares. En ese documento, el imputado manifestó que ese es un lugar donde tienen casas pensionados extranjeros, cuyo valor oscilaba entre los trescientos mil y cuatrocientos mil dólares. En el documento le dice que puede acceder una página de internet www.caramar, a la cual el ofendido ingresó y pudo corroborar la existencia del proyecto. En el fax enviado se le planteaba al ofendido [Nombre 003] que para mantener el embargo sobre los diez lotes propiedad de un norteamericano de nombre [Nombre 009], debía depositar la suma "dos millones doscientos mil colones", a favor del Juzgado, que en ese momento, según lo manifiesta el imputado, correspondía a la suma de "cinco mil novecientos diez dólares". El imputado le pidió al ofendido facilitarle ese dinero bajo el acuerdo de que si [Nombre 009] que es el norteamericano al que le tenía embargados los lotes le pagaba el ofendido se ganaría quince mil dólares. Si él no le cancelaba y debía recoger los lotes, entonces le daría uno de los lotes a su favor. Creyendo el ofendido erróneamente que lo manifestado por el acusado era cierto, y con el afán de ayudarlo, en fecha 12 de noviembre del año 2002 envió un fax al señor [Nombre 012], empleado del Banco Nacional, para que le transfiriera a la cuenta a la sociedad controlada por el imputado FC Inmobiliaria Playa Negra Sociedad Anónima la suma de seis mil dólares, dinero que nunca recuperó.
  • 6)Como consecuencia del ilícito actuar del imputado (...) se le generó al ofendido [Nombre 003] un perjuicio total que se estipula en la suma de ochenta y siete mil doscientos treinta y ocho dólares.
  • 7)Que a raíz de las estafas de las cuales fue víctima el ofendido [Nombre 003], por parte del imputado (...) sufrió un daño moral debido a la angustia, decepción y sufrimiento que ello le ocasionó.» (confrontar folios 917 frente a 922 vuelto. El texto es exacto en su contenido, pero se modifica la tipografía; se rectifican errores ortográficos o de digitación; se suprimen, mediante paréntesis y puntos suspensivos, partes reiterativas; se agrega el cuadro para el hecho 4.5 manteniendo la información presentada en texto y los destacados son suplidos)”. (confrontar folios 1094 vuelto a 1097 frente, Tomo III). (Lo resaltado con negrita pertenece al texto original). En virtud de dicho cuadro fáctico, se colige que al imputado [Nombre 001], se le incriminó y responsabilizó de haber desplegado en el período del mes de octubre del 2002, al mes de noviembre de 2003, una serie de conductas caracterizadas por un ardid previo mediante, el cual, ocasionó un perjuicio contra la víctima, al obtener ilícitamente diversos rubros de dinero en dólares, calificado como estafa, según el artículo 216 del Código Penal. Bajo esas circunstancias fácticas, en el criterio de mayoría, el ad quem incurre en un yerro en la interpretación de la ley sustantiva, referente al precepto 77 del código de rito, al afirmarse que según el marco de legalidad vigente, el delito continuado constituye un concurso material ante el advenimiento de una pluralidad de acciones, que se materializó en el tiempo, por lo que cada conducta debe concebirse como distinta una de otra, y de ahí la procedencia de analizar la cuantía de modo autónomo para los efectos de la prescripción (confrontar folios 1113 a 1120, Tomo III). Acorde a tal línea de pensamiento, el argumento mayoritario, indica: “En síntesis: de todo lo anterior se deriva que el delito continuado es un concurso material (pluralidad de acciones) en donde cada hecho debe valorarse de forma independiente para efectos de prescripción de la acción penal, pues a ello obliga al artículo 32 in fine del Código Procesal Penal. […] Ello implica que la pena a considerar es la del tipo penal y no la ampliación que estipula el numeral 77 del Código Penal….” (confrontar folio 1117 vuelto, Tomo III). (Lo subrayado y destacado con negrita pertenece al texto original). En igual sentido, arguyen: “E.6) En concreto, sobre la prescripción en esta causa (pronunciamiento de mayoría, con el voto disidente de la jueza Vargas González). Todo el panorama atrás ampliamente razonado permite extraer las premisas que deben usarse para resolver, en esta causa, el tema de la prescripción de la acción penal y que, en resumen son las siguientes: i) ha de tenerse en cuenta los hechos probados únicamente (no todos los acusados) del lapso entre octubre 2002 a noviembre de 2003 y deben ser considerados como delito continuado; ii) para ese lapso y hasta el 12 de octubre regía en el país el artículo 32 del Código Procesal Penal original, no reformado […] Eso hace que la prescripción deba iniciar su cómputo cuando cese cada permanencia de grupo de delitos, según la sentencia y, en el peor de los casos, en noviembre de 2003, en que se dio el último acto; iii) el delito continuado, en Costa Rica, es una especie de concurso material, con acciones independientes (no se trata de una sola acción). Por ende cada acción -como bien expone la parte recurrente- debe verse individualmente en su monto de defraudación y de sanción y en la fecha en que se produjo, siempre que esta sea posterior a noviembre de 2003 según lo dicho atrás. No es procedente, por ello, hacer una sumatoria de todas las defraudaciones para estimar el perjuicio en una cifra única que fije la pena usada para computar el plazo prescriptivo …” (confrontar folio 1118 frente, Tomo III). (La negrita no es suplida). Luego de la valoración de los actos procesales, fechas, vigencia de la ley y espacio temporal transcurrido, las Juezas Chinchilla Calderón y Jiménez Fernández, señalan: “Lo anterior implica que, al menos en tres ocasiones (cuatro si se partiera de la fecha de algunos hechos iniciales y no de la data final de los ilícitos que integran el delito continuado, según se interprete la reforma sufrida por el numeral 32 del Código Procesal), durante la tramitación del proceso se superó el plazo reducido entre una causal y otra, es decir, corrió más del año y seis meses entre causas interruptoras respecto a las estafas de menor cuantía, sin que sea posible sostener que, al no haberse detectado o alegado dicha situación oportunamente se convalidara, pues la prescripción solo puede renunciarse expresamente (artículo 35 del Código Procesal Penal). Eso permite concluir que todas las estafas de menor cuantía estaban prescritas cuando se dictó la sentencia y que, en efecto, la no existencia de un pronunciamiento al respecto generó un gravamen a la parte impugnante, pues es sabido que, para que pueda emitirse una decisión de fondo es imprescindible que la acción penal no se haya extinguido …” (confrontar folios 1120 frente y vuelto, Tomo III). (La negrita se contiene en el texto original). En contraposición a la postura de mayoría, del cuadro fáctico ya descrito, se constata que la conducta desarrollada por el encartado, pese a que por separado podrían estimarse ilícitas, al encontrarse vinculadas por el conocimiento y voluntad propia del agente, conforman un único delito (el continuado), por ello, precisamente esas diversas acciones unificadas por el actuar doloso del aquí encartado, no se encuentran prescritas. Véase que debido a la equívoca interpretación del derecho penal sustantivo que se efectúa en el voto mayoritario, en este asunto se avaló la pretensión de la defensa técnica de acoger la excepción de prescripción, dictándose la absolutoria del endilgado, al ponderarse desde la perspectiva de las Juzgadoras Chinchilla Calderón y Jiménez Fernández, que cada hecho tenía que prescribir de modo autónomo, indistintamente de si se trató de un delito continuo, situación que lleva aparejada la concurrencia de un perjuicio al tenor del ordinal 439 del Código Procesal Penal, al impedirse a la representación del Ministerio Público, ejercer la persecución penal. La jurisprudencia de casación penal, sobre el tópico recursivo referente a si las conductas ejecutadas de forma aislada o separadas en el tiempo, pueden estimarse delictivas encontrándose vinculadas por el conocimiento y la voluntad desplegada por el sujeto activo al integrar un único delito continuado, ha señalado: "..... Visto lo anterior, esta Sala de Casación procede a unificar el criterio sobre la posibilidad de juzgar el delito continuado en dos o más procesos separados en el tiempo, de la siguiente manera: el delito continuado, de conformidad con el artículo 77 del Código Penal, es una figura que para su aplicación, responde a tres características específicas: que se trate de delitos de la misma especie cometidos a lo largo del tiempo, que el autor persiga una finalidad común específica y que afecte bienes jurídicos de orden patrimonial. Con base en ello, tenemos que sin duda se está ante una pluralidad de acciones, que para efectos de pena, entran a calificar como delito continuado, lo que implica que el imputado, ante este instituto, se ve beneficiado al momento de la imposición de la sanción, pues para esos efectos “…se aplicará la pena prevista para el más grave, aumentada hasta en otro tanto…”. Se decanta esta Sala por afirmar que, bajo las características de esta figura y la garantía de una pena única para el conjunto de infracciones delictivas, cuando los hechos constitutivos de un delito continuado se juzguen y posteriormente se conozcan en sede judicial otro conjunto de hechos que pertenezcan al mismo, lo procedente es dictar también sentencia sobre los segundos, para que sobre los mismos pese la cosa juzgada cuando la sentencia se encuentre firme, pues aún tratándose de casos en los que se cuente con uno o varios ofendidos y la misma acusación fiscal, cada hecho es independiente en el tiempo y debe determinarse la autoría del acusado en los mismos. Aún cuando la requisitoria fiscal relate el modus operandi de los autores para obtener en forma ilícita los dineros de los ofendidos –como en este caso-, cada una de los ofendidos vio afectados sus bienes jurídicos patrimoniales por ese medio de acción y plan de autor allí descrito, por lo que no es factible afirmar que todos los hechos descritos en la acusación ya fueron juzgados si hubo un fallo previo que definió la situación jurídica solo para algunos de los ofendidos y no para la totalidad de ellos, no operando así el principio de non bis in idem y con ello la inexistencia de cosa juzgada. Esto, atendiendo también al principio de seguridad jurídica, pues las partes cuentan con el derecho a obtener una respuesta al conflicto que han planteado ante la Administración de Justicia, tanto en la parte penal, como en la parte civil, de haberse planteado los reclamos civiles respectivos. Sobre la penalidad. Esta Sala de Casación igualmente mantiene el criterio de mayoría establecido en la resolución N°444-F-96. La penalidad del delito continuado que se juzga en un segundo momento procesal y del que mana un segundo fallo, debe atenerse, ciertamente, a las reglas del artículo 77 del Código Penal, más procede unificar la misma, de manera retrospectiva con la sanción impuesta de previo, siempre y cuando no se hayan superado en la primera sentencia los máximos de pena que se señala el artículo 77 en cuestión, sea, “…la pena prevista para el más grave, aumentada hasta en otro tanto…”, y la unificación se dé dentro de éstos márgenes. Lo contrario – no penalizar el delito continuado en el segundo fallo condenatorio y determinar que existe cosa juzgada con respecto a la sanción impuesta en la primera sentencia-, dejaría en desaplicación la norma relativa al delito continuado ya indicada y se tornaría la figura en una doble garantía para el imputado, al que se le aplica, en el primer fallo, la sanción adecuada al delito continuado, la cual quedaría firme, sin importar cuántos otros hechos queden pendientes de juzgar y la posible pena a imponer ..." (Voto N° 2017-00374, de las 11:28 horas, del 28 de abril de 2017, Ramírez Quirós, Chinchilla Sandí, Arias Madrigal, Gamboa Sánchez y Desanti Henderson, Sala Tercera de la Corte Suprema de Justicia). (En similar sentido, sobre el delito continuando, pueden consultarse el voto N° 2012-001204, de las 11:26 horas, de 17 de agosto de 2012, Ramírez Quirós, Zúñiga Morales, Pereira Villalobos, Arroyo Gutiérrez, y Sanabria Rojas, Sala Tercera de la Corte Suprema de Justicia). Así las cosas, en el asunto objeto de esta litis, lleva razón el recurrente, con base al estricto cuadro de hechos probados (confrontar folios 1113 vuelto a 1118 frente), y II.E.6 (confrontar folios 1118 frente a 1121 frente), las acciones exteriorizadas por el imputado, pese a estimarse de modo aislado como delictivas (que configuran el fundamento legal para imponer la penalidad del delito continuado), se encuentran en dichas circunstancias fácticas, unidas o vinculadas justamente por el conocimiento y la voluntad practicada por el encartado, integrando un único ilícito (el continuado). En consecuencia, es evidente la aplicación errónea del artículo 77 del Código Penal, así como de la fallida interpretación de las reglas contenidas en tal disposición normativa para el cálculo de la prescripción. Al respecto, para valorar si la acción penal se encuentra prescrita, el operador jurídico debe detenerse en la sanción que atañe al delito continuado, que es aquélla establecida para el delito más grave incrementada en otro tanto. Notése que con sustento en nuestro marco de legalidad, el descrito 77, en concordancia al inciso 2) del numeral 216 del Código Penal, cuyos rangos punitivos refieren una pena mínima de seis meses, y máxima de diez años (ante una defraudación superior de diez veces el salario base), en este caso, por la suma de los rubros defraudados de estafa de mayor cuantía (confrontar folios 1094 vuelto a 1098 frente), y debido a la duplicación de los citados extremos, la pena sería entre un año y veinte años de prisión (Resoluciones números 2003-673, de las 10:00 horas, de 7 de agosto de 2003 (Ramírez Q., González A., Castro M., Arroyo Gutiérrez y Dall´Anese R.), y 2004-007, de las 9:15 horas, de 16 de enero de 2004, Ramírez Q., González A., Castro M., Arroyo Gutiérrez, y Chirino S., Sala Tercera de la Corte Suprema de Justicia). Por lo anterior, en apego a la legislación procesal penal, no ha operado la extinción de la acción penal por prescripción. En virtud del inciso a) del ordinal 31 del Código Procesal Penal, el plazo de prescripción de la acción penal, en la vigente casuística es de diez años, disminuido a la mitad, como lo preceptúa el párrafo primero del artículo 33 del código de rito, es de cinco años, de modo que, el delito continuado reprochado, que a la luz del escenario fáctico ya aludido, está conformado por diversas conductas unidas por [Nombre 001], quien quiso dolosamente (artículo 31 del Código Penal), la realización del hecho tipificado en el inciso 2) del 216, precepto sustantivo reiterado, que no ha prescrito. Valga decir, la recalificación puntual que efectúa el ad quem en su posición de mayoría, sobre los hechos acreditados a siete ilicitudes de mayor cuantía en modalidad de delito continuado, resulta desacertada por los aspectos de hecho y de derechos expuestos. En síntesis, se declara con lugar el único motivo admitido del recurso de casación formulado por el representante del Ministerio Público, se anula la resolución N° 2020-0770, de las 10:50 horas, de 18 de mayo de 2020, del Tribunal de Apelación de Sentencia Penal de Goicoechea, únicamente en cuanto a lo resuelto en criterio de mayoría, en el Considerando II., puntos E.5., y II.E.6., y el acápite C) del Considerado V, pertinente a la absolutoria dictada respecto a la forma de aplicación del delito continuado. En consecuencia, sobre tales extremos revocados por el ad quem, de conformidad con el artículo 473 párrafo segundo, al haberse invocado el alegato de errónea aplicación de un precepto legal sustantivo, debe prevalecer incólume la sentencia N° 1355-2019, de las 17:00 horas, de 10 de diciembre de 2019, del Tribunal Penal del Tercer Circuito Judicial de San José, Sede oeste, Pavas, Sección Vespertina.

Por Tanto:

Se declara sin lugar el primer motivo admitido del recurso de casación interpuesto por el defensor particular de [Nombre 001].. Se declara con lugar el único motivo admitido del recurso de casación formulado por el representante del Ministerio Público, se anula de forma parcial la resolución N° 2020-0770, de las 10:50 horas, de 18 de mayo de 2020, del Tribunal de Apelación de Sentencia Penal de Goicoechea, únicamente en cuanto a lo resuelto en criterio de mayoría, en el Considerando II., puntos E.5., y II.E.6., y el acápite C) del Considerado V., pertinente a la absolutoria dictada respecto a la forma de aplicación del delito continuado. En consecuencia, sobre tales extremos revocados por el ad quem, se mantiene incólume la sentencia N° 1355-2019, de las 17:00 horas, de 10 de diciembre de 2019, del Tribunal Penal del Tercer Circuito Judicial de San José, Sede oeste, Pavas, Sección Vespertina. Notifíquese.
