In the ordinary proceeding (proceso de conocimiento) declared to involve solely questions of law (de puro derecho), brought by AGROMECÁNICA F Y P S.A. against INDACO HORQUETAS S.A., the Court considers the motion for supplementation and clarification (solicitud de adición y aclaración) and motion for reconsideration (recurso de revocatoria) filed by the plaintiff concerning resolution no. 003256-F-S1-2019, issued at 15 horas 30 minutos del 17 de octubre de 2019 by this Chamber, which affirmed the appealed judgment.
WHEREAS
I.The petitioner files a motion for supplementation and clarification and a motion for reconsideration concerning ruling no. 003256-F-S1-2019, issued by this Chamber at 15 horas 30 minutos del 17 de octubre de 2019, which affirmed the appealed judgment.
II.Through the aforementioned motion for supplementation and clarification, Mr. Rafael Fuscaldo Peralta, the plaintiff’s special judicial attorney-in-fact (apoderado especial judicial), requests that the reasoning and operative portions of the cited judgment be supplemented and/or clarified. He states that resolution 003256-F-S1-2019 indicates: “Regarding the first ground of appeal (agravio), this Chamber observes that it was deemed proven in this case that, on the property owned by the petitioner, there is a water source that is actually an emergence of permanent flow from the Puerto Viejo River itself,” which, he says, leaves unclear and incomprehensible why the essential aspect of the dispute, which is a matter of public interest—namely, water sources—was not analyzed so as to distinguish, even where the protection zones are smaller, between a water source and an emergence of flow. He contends that, even though the resolution states that the grounds of appeal could not be proven, it can indeed be determined that mining work involving the extraction of materials from a riverbed is being performed and that this is plainly a resource under State protection.
He further indicates that the trees are affected by the change in the river’s course, which, in his view, although it may have occurred before the concession, clearly meant that a concession aggravating the conditions at the site should not have been granted. He notes that it is also clear that the mitigation works (obras de mitigación) were never performed by the concessionaire. He therefore explains that, pursuant to constitutional mandate 50, since both sources are protected not only under provisions 33 and 34 of Ley Forestal and provision 145 of the Ley de Aguas, as well as the following and concordant provisions, the resolution should have addressed the alleged environmental damage (daño ambiental), the failure to carry out the mitigation works at a State-protected water source, and the emergence of permanent flow from the Puerto Viejo River. Accordingly, he requests clarification and supplementation regarding the water source affected by a private company operating under a State concession, because the resolution is unclear as to the environmental damage both to his property and to the riverbed, as well as the defendant’s failure to comply with technical mitigation plans due to improper exploitation and inadequate oversight of the mineral resource, matters not addressed in the judgment.
III.Section 578 of the Código de Trabajo, applicable to agrarian matters, as well as provision 158 of the Código Procesal Civil, provide that supplementation and clarification may be granted sua sponte or upon a party’s motion in two circumstances: first, where there are omissions or an unclear concept in the operative portion (parte dispositiva) of the judgment; and second, where there are contradictions between the operative portion and the reasoning portion (parte considerativa). Its purpose is therefore to clarify confusing points and aspects and remedy omissions in the operative portion of the resolution; accordingly, it is incompatible with reconsideration or modification of the ruling on the merits.
IV.In the present matter, this adjudicative body finds no omission or confusing aspect in the operative portion of the challenged resolution that must be clarified in the cited resolution. Nor are any contradictions alleged between the reasoning and operative portions. Without prejudice to the foregoing, and by way of further explanation, this Chamber did indeed state that the changes in the morphology of the plaintiff’s land are not attributable to the defendant’s activities under the extraction concession. Nor was there any encroachment upon the plaintiff’s property; furthermore, it was deemed proven that the loss of land from the property at issue began before the defendant’s material-extraction activities and was attributable to a natural event. Regarding the alleged bodies of water on the property, it was established that the “spring” (naciente) is an emergence of permanent flow from the Puerto Viejo River itself.
In accordance with the foregoing, the judgment rejected the argument that it had failed to discuss the necessary protection of the water sources on the property, since no impact on the real property or such sources was found that could have originated from the respondent’s extraction activities. In light of the foregoing, this Chamber considers that the motion must be denied, since it does not concern unclear or contradictory matters requiring clarification, nor does it concern an omission. Consequently, the motion for supplementation and clarification must be denied.
V.With respect to the motion for reconsideration filed, it is clear that provision 599 of the Código de Trabajo, applicable by reference to agrarian matters, establishes that no appeal lies from resolutions of the Sala de Casación. Accordingly, the ruling issued by this Chamber as the court of third instance in the present proceeding is not subject to the motion filed by the plaintiff. Consequently, the challenge must be dismissed as procedurally unavailable.
THEREFORE
The motion for supplementation and clarification is denied. The motion for reconsideration filed against the ruling of this Chamber affirming the Tribunal’s judgment is dismissed.

Revisión del Documento *140002200507AG* Res. 001573-F-S1-2020 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, a las diez horas cuarenta minutos del veintitrés de abril de dos mil veinte.
Dentro de proceso de conocimiento declarado de puro derecho promovido por AGROMECÁNICA F Y P S.A. contra INDACO HORQUETAS S.A., se conoce solicitud de adición y aclaración y recurso de revocatoria, presentados por la parte actora respecto de la resolución no. 003256-F-S1-2019, dictada a las 15 horas 30 minutos del 17 de octubre de 2019, por esta Sala, en la cual se confirma la sentencia recurrida.
CONSIDERANDO
I.La accionante plantea solicitud de adición y aclaración y recurso de revocatoria, respecto del pronunciamiento no. 003256-F-S1-2019, emitido por esta Sala a las 15 horas 30 minutos del 17 de octubre de 2019, en el cual se confirma la sentencia recurrida.
II.Mediante la indicada gestión de adición y aclaración, el señor Rafael Fuscaldo Peralta, apoderado especial judicial de la actora, solicita adicionar y/o aclarar los extremos considerativos y dispositivos de lo resuelto en la sentencia de cita. Refiere, en la resolución 003256-F-S1-2019, se indica que: "Observa esta Cámara, respecto del primer agravio, en la especie se tuvo por acreditado, que en la finca propiedad de la accionante, existe una fuente de agua que corresponde en realidad a un brote decaudal permanente del mismo río Puerto Viejo” lo cual dice, deja oculto y no es entendible, que no se analice el aspecto esencial de la controversia que es de interés público, como lo son las fuentes hídricas, de forma que se logre establecer aún y cuando las zonas de protección sean menores, entre una fuente de agua y un brote de caudal, que aún y cuando en la resolución se indica, no se logran probar los agravios, opina, si se puede determinar, se hacen trabajos mineros de extracción de materiales del cauce de un Río, que evidentemente es recurso con protección Estatal.
Además indica, los arboles son afectados por el cambio de cauce del río, que en su criterio, aunque pudieron darse con anterioridad a la concesión, es evidente, no debía otorgarse una concesión que agravara las circunstancias en el lugar. Apunta, también es claro que las obras de mitigación nunca fueron realizadas por el concesionario. De esta forma, aclara, en aplicación del mandato 50 Constitucional, al estar ambas fuentes protegidas no solo por los cánones 33 y 34 de Ley Forestal y 145 de la Ley de Aguas, siguientes y concordantes, considera, la resolución debió mencionar el daño ambiental alegado, la falta de cumplimiento de las obras de mitigación en fuente hídrica de protección del estado, y, lo referente al brote de caudal permanente del Río Puerto Viejo. De esta forma, requiere, se aclare y adicione lo relativo a la fuente hídrica, afectada, por empresa privada mediante concesión estatal, debido a que no es clara la resolución en cuanto al daño ambiental no solo en su propiedad sino en el cauce del río, así como en cuanto a los incumplimientos de planes técnicos de mitigación por la parte demandada, por mal aprovechamiento y falta de control del recurso minero, a lo cual no alude la sentencia.
III.El numeral 578 del Código de Trabajo, aplicable a la materia agraria, así como el canon 158 del Código Procesal Civil refieren que es procedente la adición y aclaración, de oficio o a gestión de parte, en dos supuestos; el primero, cuando existan omisiones o algún concepto oscuro en la parte dispositiva de la sentencia, y, segundo, respecto de contradicciones entre la parte dispositiva y la considerativa. Su propósito es por tanto esclarecer puntos y aspectos confusos, y suplir omisiones de la parte dispositiva de la resolución, de modo que resulta incompatible con la revocatoria o modificación del pronunciamiento de fondo efectuado.
IV.En el presente asunto, no encuentra este órgano decisor alguna omisión o aspecto confuso en la parte dispositiva de la resolución impugnada, que deba ser aclarado en la resolución de cita. Tampoco que se citen contradicciones entre la parte considerativa y la dispositiva. Sin perjuicio de lo anterior y a mayor abundamiento de razones, esta Sala efectivamente indicó, los cambios en la morfología del terreno de la actora no son atribuibles a las actividades de concesión extractiva de la demandada. Tampoco, que hubiese existido invasión en el fundo de la actora, además se tuvo por demostrado, que la pérdida de terreno de la finca de examen dio inicio antes de las actividades de extracción de material de la demandada, lo cual era atribuible a un evento de la naturaleza. En cuanto a los supuestos cuerpos de agua existentes en la propiedad, se acreditó, dicha “naciente” corresponde a un brote de caudal permanente del propio Río Puerto Viejo.
De conformidad con lo expuesto, en el fallo se rechazó la argumentación en cuanto a que se hubiere obviado discutir sobre la necesaria protección de las fuentes de aguas existentes en la finca, pues no se determinó afectación alguna al inmueble o a tales fuentes que pudiera haberse originado en la actividad extractiva de la accionada. De conformidad con lo expuesto, estima esta Cámara, deberá rechazarse la gestión planteada, toda vez que no se trata de extremos oscuros o contradictorios que requieran aclaración ni omisión. En consecuencia, procede denegar la solicitud de adición y aclaración.
V.Tocante al recurso de revocatoria planteado, es claro, el canon 599 del Código de Trabajo, aplicable por remisión a la materia agraria, establece que las resoluciones de la Sala de Casación no tienen recurso alguno. Así dispuesto, lo resuelto por esta Cámara en calidad de tercera instancia en el presente proceso, carece del recurso presentado por la parte demandante. En consecuencia, se impone rechazar la impugnación planteada por improcedente.
POR TANTO
Se deniega la solicitud de adición y aclaración. Se rechaza el recurso de revocatoria interpuesto contra el fallo de esta Sala que confirmó la sentencia del Tribunal.
