CONSIDERANDO
I.According to the facts that the adjudicating judges deemed proven and that were not challenged by the appellant, Messrs. Pericles De Freitas Druck and Edgar Brenes André served as directors, businesspersons, shareholders, and developers of Desarrollos Inmobiliarios Habitasul S.A. (hereinafter HABITASUL), receiving sums of money as bonuses (gratificaciones). Likewise, during the months of December in the period from 2001 to 2004, that company granted its employees additional sums as bonuses or extraordinary year-end bonuses (aguinaldos extraordinarios). The amounts varied from year to year and from employee to employee. Some employees did not receive any amount under that heading during that period. Inspection Report no. 1232-2619-2006-1 of 30 de enero de 2007, issued by the Dirección de Inspección of the Caja Costarricense de Seguro Social -CCSS-, determined that HABITASUL had omitted and underreported wages (omisión y subdeclaración) in the wage reports for January and February 2001, as well as for December 2001, 2002, 2003 and 2004.
It stated that the total wages affected amounted to ¢203.840.267,40, representing employer-employee contributions (cuotas obrero patronales) of ¢44.844.870,00 to the sickness and maternity and disability, old-age, and death schemes administered by that institution; ¢3.529.344,00 to the labor capitalization fund (fondo de capitalización laboral); ¢999.881,00 to the supplementary pension fund (fondo de pensiones complementarias); ¢1.999.754,00 as the employee contribution to Banco Popular y de Desarrollo Comunal (BPDC); ¢499.947,00 as the employer contribution to BPDC; and ¢1.823.978,00 to Instituto Nacional de Seguros (INS). It was further indicated that the timely reporting to CCSS of employees Édgar Brenes André, from January 2001 through December 2004, and Pericles De Freitas Druck, from January 2001 through December 2002, had been omitted. By Resolution no. 1232-1653-2007-R of 27 de setiembre de 2007, the Dirección de Inspección of CCSS ruled on the motion for reconsideration (recurso de revocatoria).
It declared that HABITASUL had committed violations by omitting and underreporting wage information on CCSS payroll reports concerning compensation earned by several employees during certain months from 2001 through 2004. In Resolution no. 3002-08 of 23 de febrero de 2008, the Gerencia Financiera of CCSS denied the appeal (recurso vertical) filed by HABITASUL. It stated that the company had failed to fulfill its obligation to report to CCSS all wages earned by its employees under the heading of bonuses or additional year-end bonuses. It likewise stated that Messrs. Édgar André and Pericles De Freitas Duck were employees, as evidenced by the general assemblies at which they were granted bonuses. On 1 de agosto de 2008, HABITASUL and CCSS entered into a payment agreement (convenio de pago). Under that agreement, the company—under protest—undertook to pay, within a term of 24 months, the debt of ¢67.531.002,00 at an interest rate of 16%, through a fluctuating monthly installment of ¢3.306.528,00, beginning on 19 de setiembre de 2008 and continuing for 19 months until the debt was paid in full.
II.HABITASUL’s plenary attorney-in-fact without monetary limitation (apoderado generalísimo sin límite de suma) filed the complaint seeking a judgment declaring that CCSS had unlawfully required and imposed supplemental payroll assessments (planillas adicionales) on his principal for January and February 2001 and December of 2001, 2002, 2003 and 2004. Consequently, he seeks the annulment, on the grounds that they are contrary to law and to prevent their future application, of the following administrative acts (actos administrativos): a) 1232-02619-2006-1 of 30 de enero de 2007, b) 1232-1653-2007-R of 27 de setiembre de 2007, and c) 30-02-08 at 9 horas on 26 de febrero de 2008. He likewise seeks the annulment of the administrative payment agreement executed on 25 de agosto de 2008. As a consequence of the foregoing, he seeks a declaration of his principal’s right to restoration of its infringed legal position, without being required to pay any financial obligation arising from those supplemental payroll assessments.
Therefore, his principal is entitled to reimbursement, duly adjusted for inflation, of the sums paid to CCSS under the agreement it signed under protest on 25 de agosto de 2008, plus the corresponding statutory interest. Lastly, he requests that the defendant institution be ordered to pay the costs of the proceedings. Service of the complaint on CCSS, ordered by a ruling entered at 8 horas 55 minutos on 4 de agosto de 2011, was effected on 21 de noviembre of that year. The representative of CCSS opposed the complaint and raised the defense of lack of entitlement (falta de derecho). At the preliminary hearing held on 23 de octubre de 2012, he also raised the preliminary defense of lapse (caducidad). By Resolution no. 1762-2012-T, the Pretrial Judge reserved that defense for determination in the judgment. Furthermore, at that hearing, by Resolution 1764-2012-T, the judge ordered the joinder, as necessary passive co-parties (litis consertes pasivos necesarios), of all persons named in the CCSS supplemental payroll assessments underlying these proceedings.
Only Mr. Luis Eduardo Flores Morera opposed the complaint and raised the substantive defense of the one-year limitations period (prescripción de un año) provided for in provision 56 of the Código de Trabajo. By a ruling entered at 9 horas 5 minutos on 20 de febrero de 2014, the remaining co-defendants were declared in default (rebeldía). The Tribunal rejected the defenses raised. It ordered CCSS, BPDC, INA, and IMAS to reimburse the plaintiff company for the sums paid, duly adjusted for inflation (from the date each payment was made pursuant to the agreement executed on 25 de agosto de 2008 until its actual reimbursement). It likewise awarded net or real interest (intereses netos o puros) on those amounts, which, as it stated, accrues from the time of payment until actual reimbursement. It declared the following administrative acts null and void:
III.In the first admitted ground of appeal, folio 2 verso, the appellant invokes the ground for cassation (motivo casacional) provided for in provision 138 subsection c) of the Code of Administrative Procedure (Código Procesal Contencioso Administrativo—CPCA): “When a legal rule has been improperly applied or interpreted, or has not been applied.” This is because, he explains, Ley no. 4755 del 3 de mayo de 1971, Code of Tax Rules and Procedures (Código de Normas y Procedimientos Tributarios—Código Tributario), was incorrectly assessed. The Court, he recounts, stated in unproven fact number three of the challenged judgment: “That the action brought by the plaintiff is time-barred (the record).” He reproduces, insofar as relevant, the statements made in Considerando III of the challenged ruling. In his view, he states, the Court committed a serious error in applying the legislation on which it based its decision.
It classified employee-employer contributions (cuotas obrero-patronales) as a tax or tax obligation, which is incorrect. An employee-employer contribution, he notes, is a legal obligation. It is an essential condition for the existence of the system. It arose, he explains, for the benefit of the contributors themselves, for the purpose of creating employment benefits already acquired merely by virtue of being in an employment relationship defined by the presence of its basic elements. He quotes, insofar as relevant, the statements made by the Constitutional Chamber in voto no. 7393-98. Since it is not deemed a tax but rather the payment of a legal obligation, he adds, it cannot be included within tax matters. The nature of the social-insurance contributions administered by the CCSS, he asserts, is sui generis and must not be regarded as tax-related. This, he says, is how the Legal Directorate of his principal has regarded it, with the endorsement of the Constitutional Chamber.
This criterion, he insists, has been supported by constitutional case law, specifically in the aforementioned voto no. 7393-98 de las 9 horas 45 minutos del 16 de octubre de 1998, from which he transcribes another excerpt. That precedent, he concludes, remains in force, since social-security contributions are deemed to have their own legal nature, which is not tax-related. In the second and final admitted challenge, folio 3 verso, the appellant in cassation again invokes the ground for cassation provided for in provision 138 subsection c of the CPCA. He states that the following provisions were not applied: 39 ibid.; 141 subsection 1), 175 and 240 subsection
IV.Because of the close relationship between the two grounds of disagreement, this Chamber will analyze them jointly. The crux of the appellant’s argument is that, in his view, the Court erred in stating that employee-employer contributions were tax-related in legal nature and that, therefore, provision 39 of the CPCA did not apply to the expiration defense raised; instead, provision 41 subsection 2) ibid. applied, with the consequent application of the Código Tributario. According to him, employee-employer contributions are a legal obligation, and therefore the expiration period for instituting the proceedings is the one provided for in the aforementioned provision 39 of the CPCA. In this dispute, he states, the final act in the proceeding was served in marzo del año 2008; however, the action was not filed until the year 2011, by which time the one-year period had already elapsed, and the defense raised should therefore be upheld.
V.In this regard, and given its importance to the resolution of the present dispute, it is necessary, notwithstanding its length, to transcribe the relevant portions of the findings of the trial judges: “III) ON THE EXPIRATION (CADUCIDAD) AND LIMITATION (PRESCRIPCIÓN) OF ACTIONS FOR NULLITY OF THE CHALLENGED DECISIONS: The doctrine of expiration is defined as an inexorable procedural time limit within which a legal action must be brought; it cannot be suspended or interrupted, and its procedural prerequisites are inactivity and the existence of a procedural time limit for taking action. With respect to claims seeking the nullity of administrative acts (actos administrativos), the Ley General de la Administración pública has established, in Article 175, that […] On this subject, the Código Procesal Contencioso Administrativo establishes, in Article 39, that the maximum period for commencing proceedings shall be one year, calculated […] In turn, with respect to acts having continuing effects (actos de efecto continuado), Article 40 of the aforementioned Code states that […] In tax matters, Article 41 ibid provides that […] Therefore, because the present matter concerns a challenge to administrative acts determining the tax obligation (obligación tributaria) arising from employer-employee contributions (cuotas obrero patronales), the expiration period applicable to the challenge must be governed by the Código de Normas y de Procedimientos Tributarios, number 4755 of 03 de mayo de 1971, insofar as limitation is concerned, with application of the mechanisms specific to that doctrine.
Accordingly, the tax provision in force when the challenged acts were issued in 1996 is applicable; thus, Law number 7900 of 03 de agosto de 1999, which remained in force until 27 de setiembre del año 2012, applies. In tax matters, that Law, in amending Article 51 concerning limitation, provides that […] In that regard, for purposes of this case, the expiration period applicable to the judicial challenge of administrative acts determining the tax obligation is the period governing the substantive right (derecho de fondo), which at that time was three years, because the four-year period took effect as of 28 de setiembre del 2012, the date on which Ley 9069 of 10 de setiembre del 2012 entered into force, providing that […] Accordingly, the limitation period prescribed by Article 51 ibid must indeed be applied, together with all its mechanisms for calculating, suspending, and interrupting that period; thus, the calculation must be made taking into account the circumstances interrupting or suspending tax limitation, pursuant to Article 53 in force at that time.
In this regard, Article 53 ibid states as follows […] Therefore, as established by Article 52 of the aforementioned Code, the limitation period must be calculated from the first day of January of the calendar year following the year in which the tax must be paid. On this subject, the Sala Primera de la Corte Suprema de Justicia was unequivocal in decision number 31 of 16 de enero del 2015, emphatically stating that […] Applying the foregoing to the present matter, the plaintiff seeks the nullity of the following administrative acts: “2. That the following administrative acts be declared null and void because they are contrary to law and may not be applied in the future: a) 1232-02619-2006-1 of 30 de enero del año 2007. b) 1232-1653-2007-R of 27 de setiembre del año 2007. e) 30-0208 at 9 hours on 26 de febrero del año 2008. 3. That the administrative payment agreement of 25 de agosto del año 2008 be declared null and void.” In this regard, administrative act number 1232-02619-2006-1 of 30 de enero del año 2007 concerns the Inspection Report (Informe de Inspección), signed by the Dirección de Inspección and served on the plaintiff on 14 de febrero de 2007 (The foregoing appears at folios 20 through 52 of the Expediente Administrativo).
Also challenged is Decision number 1232-01653-2007-R, issued by the Dirección de Inspección, Area de Inspección de Servicios, which was served on the plaintiff on 25 de octubre de 2007 (The foregoing appears at folios 60 through 75 of the Expediente Administrativo). Likewise challenged is Decision number 30-02-08, issued by the Gerencia Financiera de la Caja Costarricense de Seguro Social, which was served on the plaintiff on 28 de marzo de 2008. (The foregoing appears at folios 77 through 84 of the Expediente Administrativo). Nullity is also sought with respect to the payment agreement formalized with the plaintiff company on 01 de agosto de 2008 (Folio of administrative file number 2-03101109263-001001 processed by the CCSS, collection notice and inspection reports). Accordingly, the three-year period must be calculated, as established by Article 52 of the aforementioned Code, from the first day of January of the calendar year following the year in which the tax must be paid and through service of the complaint.
In the present case, the digital judicial file, in images 63 through 78, shows that the order serving the complaint, issued by decision at 8:55 hours on 04 de agosto del 2011, was served on the CCSS on 21 de noviembre del 2011; thus, the three-year expiration period for seeking the requested nullity runs from the first day of January of the calendar year following the year in which the tax must be paid. Therefore, because the final, conclusive, and binding decision was issued as Decision number 30-0208 by the Gerencia Financiera de la Caja Costarricense de Seguro Social and was served on the plaintiff on 28 de marzo de 2008, the period for commencing proceedings ran from 01 de enero del 2009 through 01 de enero del 2012. Consequently, because the complaint was served on 21 de noviembre del 2011, the aforementioned expiration period had not elapsed. Nor had any limitation period elapsed, because, as stated, expiration is governed by the doctrine of limitation.” (Only the underlined text has been supplied).
VI.As may be seen, the Court, without further explanation—since this ground for cassation (motivo casacional) was not invoked, this Chamber is precluded from analyzing it—stated that “[…] since the present matter concerns the challenge to administrative acts determining the tax obligation arising from employer-employee contributions, the rules governing the time limit for filing such a challenge must be those of the Código de Normas y de Procedimientos Tributarios, number 4755 of 03 de mayo de 1971, with respect to limitation periods (prescripción), applying the mechanisms specific to that doctrine.” In this regard, the Sala Constitucional de la Corte Suprema de Justicia, in a recent decision, no. 2018013658 at 9 hours 15 minutes on 22 de agosto de 2018, stated, insofar as relevant: “I.- REGARDING ARTICLE 23 OF THE LEY CONSTITUTIVA DE LA CAJA COSTARRICENSE DE SEGURO SOCIAL. […] The issue of parafiscal contributions (contribuciones parafiscales)—in this case, social-security contributions—has generated considerable controversy in legal scholarship and case law.
As concerns the constitutional legal dispute before us, from this Chamber’s perspective, two theories are plausible. The first holds that, because it is a tax—see, in this regard, judgment 2006009568 of this Court—its structural elements—taxable event, rate, assessment basis, taxpayer and taxing authority, etc.—must necessarily be defined by a formal statute; this latter consequence has not been endorsed by the Sala Constitucional. Under this approach, if the structural elements of the parafiscal contribution were not established by formal statute, the principle of tax legality (principio de legalidad tributaria) would be violated, particularly considering that some trace the origins of Parliament and democracy to the English barons’ struggle to acquire taxing authority—there is no democracy without Parliament, nor Parliament without the Opposition. In short, in this specific case, the principle of tax legality must be applied.
The second theory, which has been upheld by this Court—see, among others, judgments numbers 1994003819 and 1998-007393—holds that this is not a parafiscal contribution and, consequently, the principle of tax legality does not apply. ‘Payment of the contribution or assessment, as the case may be, is not a tax, as stated in the preceding paragraphs, but rather payment of a legal obligation that is an essential condition for the very existence of the system, created precisely for the benefit of the contributors themselves…’. / According to the most authoritative tax-law scholarship, parafiscal contributions are taxes because they contain the substantive element of compulsory payment—the duty of persons falling within the scope of the rule creating them to pay them—are specific because they affect a particular and unique social or economic group, and have a sector-specific allocation because the funds collected through this compulsory payment are used exclusively for the benefit of the group that paid the tax.
Thus, this is an exercise of the State’s sovereign authority, imposing monetary payments to fulfill social or economic purposes. Ergo, they may be created only through a formal statute—tributum sine legge. / Now, with respect to employer-employee contributions intended to support social security—health and maternity insurance and disability, old-age, and death insurance—our legal system has a distinctive feature. Indeed, constitutional provision 73 itself creates the parafiscal contribution by requiring compulsory contributions from the State, employers, and workers in order to protect workers against the aforementioned risks and such other contingencies as the law may determine. The constitutional text then establishes that the administration and governance of those social-insurance programs are entrusted to an autonomous institution: the Caja Costarricense de Seguro Social. Finally, insofar as relevant, the constitutional provision prohibits the transfer or use of social-insurance funds and reserves for purposes other than those for which they were created.
As may be seen, this is therefore a parafiscal contribution created by the original constituent authority, thereby satisfying, from this Court’s perspective, the maxim that there can be no taxation without representation. In other words, in the case before us, the principles governing the exercise of taxing authority are fully observed because a representative and pluralistic body exercising supreme authority in a democratic and social State governed by the rule of law—namely, through the exercise of constituent authority—sovereignly and democratically determined that the parafiscal contribution should be created. / A second hurdle that we must overcome concerns determination of the amount of the contribution payable by employers and workers. In this regard, Article 23 of the Ley Constitutiva de la Caja Costarricense de Seguro Social provides that contributions and benefits shall be determined by the Junta Directiva, in accordance with the cost of the services to be provided in each region and the corresponding actuarial calculations.
Workers’ contributions may never exceed those of their employers, except in such circumstances as the Reglamento may establish, on the basis of actuarial recommendations, in order to provide greater benefits to workers and achieve a fairer distribution of the burdens of compulsory social insurance. Viewed in this manner, this Court concludes that the principle of tax legality is not violated, for the fundamental reason that a formal statute imposes objective parameters on the Junta Directiva de la Caja Costarricense de Seguro Social when determining the contribution amount—the cost of the services it provides and the corresponding actuarial calculations. The legislature therefore established for the administrative collegial body the objective elements that it must observe when setting the respective amounts; those administrative acts must also comply with the general principles of law and are subject to review by the Administrative Litigation Court (Juez de lo Contencioso Administrativo).
This same logic is followed by provision 5 of the Código de Normas y Procedimientos Tributarios in relation to fees, since it permits their amounts to be modified by regulation so that their purpose may be fulfilled more appropriately, subject to the prior involvement of the body legally charged with regulating public-service rates. / To summarize, because the parafiscal contribution was created by the original constituent authority, the principle of tax legality is more than satisfied; likewise, because the legislature established objective parameters for determining the amount of the parafiscal contribution, that principle is also respected.”
VII.In light of the foregoing ruling by the Sala Constitucional, it is determined, as the Court stated, that social-security contributions are parafiscal contributions; accordingly, they are tax-related in nature. Ergo, the appellant in cassation (casacionista) is incorrect in arguing that they do not possess that character. Consequently, with respect to the asserted defense based on expiration (caducidad), the applicable provision is rule 41 subsection 2) of the CPCA, thereby applying the provisions of the Código Tributario, rather than those of rule 39 of the CPCA, as the appellant contends. The appellant did not challenge the calculation of the period made by the adjudicators under the tax legislation, which, moreover, is correct. Consequently, because the action is not time-barred, the Court did not commit the errors alleged by the appellant. The challenges under consideration must therefore be rejected.
Without prejudice to the foregoing, it must be noted that, as indicated, the objection lodged by the appellant concerns the denial of the asserted defense based on expiration because, in his view, the action was filed after the one-year period prescribed by rule 39 of the CPCA. The reasons why this Chamber does not agree with that position have already been given; instead, the applicable provision is rule 41 subsection 2) ibid. Following this line of reasoning, the second paragraph of Article 56 of Law no. 17 of 22 de octubre de 1943, Ley Constitutiva de la Caja Costarricense de Seguro Social, is likewise inapplicable. It provides: “Criminal prosecution and penalties for the offenses contemplated in this law shall become time-barred within two years from the time the Institution becomes aware of the offense. The right to claim the amount of the loss and damages caused to the Caja, whether pursued through enforcement of a criminal judgment or directly through civil proceedings, shall become time-barred within ten years.” (Underlining supplied). No amount for loss and damages caused to the CCSS is claimed in this litigation (lite); ergo, that provision is inapplicable.
VIII.In view of the foregoing, the appeal must be denied by majority decision. Regarding its costs, rule 150 subsection 3 of the CPCA provides: “A judgment denying an appeal in cassation shall order the unsuccessful party to pay the personal and procedural costs arising from the appeal, unless, in the opinion of the Sala Primera or the Tribunal de Casación, the nature of the issues disputed in the appeal provided sufficient grounds for filing it.” (Underlining not in the original). As indicated, this judgment is based on the recent decision of the Sala Constitucional, which changed its line of precedent. Therefore, in the view of this adjudicatory body, the CCSS had sufficient grounds to litigate and shall consequently be relieved of paying the costs of the appeal in cassation (Article 150 subsection 3 of the CPCA).
POR TANTO
By majority decision, the appeal in cassation is denied. No award of costs is made. Magistrate Rojas Morales dissents.

Although it is true that, with respect to the defense based on expiration, provision 41 subsection 2) of the Código Procesal Contencioso Administrativo must apply, establishing that the maximum period for initiating proceedings shall be the same limitation period established by the legal system for the substantive right, I must express my disagreement with the application of Article 51 of the Código de Normas y Procedimientos Tributarios, which, before it was amended by Article 1° of Law N° 9069 of 10 de setiembre del 2012, provided that the tax obligation became time-barred after three years.
Instead, I consider the substantive-law limitation provision applicable in this litigation to be Article 56 of the Ley Constitutiva de la Caja Costarricense de Seguro Social (N° 17), which establishes a ten-year period. Although tax-related amounts are involved, this is the special provision governing the collection of the CCSS’s parafiscal amounts and therefore takes precedence over the general provision of the Código de Normas y Procedimientos Tributarios.

CONSIDERANDO
I.Acorde a los hechos que las personas juzgadoras tuvieron por probados y no fueron cuestionados por el recurrente, se tiene que, los señores Pericles De Freitas Druck y Edgar Brenes André, han fungido como directivos, empresarios, socios y desarrolladores de la compañía Desarrollos Inmobiliarios Habitasul S.A. (en lo sucesivo HABITASUL), recibiendo sumas de dinero a título de gratificaciones. De igual manera, durante los meses de diciembre del período comprendido entre el año 2001 al 2004, dicha empresa les concedió sumas extras a sus trabajadores como gratificaciones o aguinaldos extraordinarios. Los montos variaban de año en año y de empleado a empleado. Incluso, algunos no recibieron monto alguno por ese concepto en ese lapso. Mediante informe de inspección no. 1232-2619-2006-1 del 30 de enero de 2007, de la Dirección de Inspección de la Caja Costarricense de Seguro Social -CCSS-, se determinó que HABITASUL incurrió en omisión y subdeclaración en los reportes salariales de los meses de enero y febrero de 2001; así como en los meses de diciembre de 2001, 2002, 2003 y 2004.
Señaló que el total de salarios afectados fue por la suma de ¢203.840.267,40, lo que representa, en cuotas obrero patronales de los regímenes de enfermedad y maternidad, invalidez, vejez y muerte, administrados por esa institución un monto de ¢44.844.870,00; en el fondo de capitalización laboral, ¢3.529.344,00; en el fondo de pensiones complementarias, ¢999.881,00; en el aporte obrero al Banco Popular y de Desarrollo Comunal (BPDC), ¢1.999.754,00; en el aporte patronal al BPDC ¢499.947,00; y el Instituto Nacional de Seguros (INS), ¢1.823.978,00. Se indicó, además, se omitió el reporte oportuno a la CCSS de los trabajadores Édgar Brenes André de enero de 2001 a diciembre del 2004 y de Pericles De Freitas Druck de enero de 2001 a diciembre de 2002. Mediante resolución no. 1232-1653-2007-R del 27 de setiembre de 2007, la Dirección de Inspección de la CCSS resolvió el recurso de revocatoria.
Declaró que HABITASUL incurrió en incumplimientos al omitir y subdeclarar reportes salariales en planillas de la CCSS tocante a las remuneraciones devengadas por varios trabajadores en algunos meses que van del año 2001 al 2004. En resolución no. 3002-08 del 23 de febrero de 2008, la Gerencia Financiera de la CCSS, denegó el recurso vertical interpuesto por HABITASUL. Señaló que incumplió su obligación de reportar ante la CCSS la totalidad de los salarios devengados por los trabajadores por la partida de gratificaciones o aguinaldo adicional. De igual forma, manifiestó que los señores Édgar André y Pericles De Freitas Duck son trabajadores, como se constata de las asambleas generales donde se les otorgaron gratificaciones. El 1 de agosto de 2008, HABITASUL y la CCSS celebran un convenio de pago. Por su medio, la empresa -bajo protesta- se comprometió a cancelar, en un plazo de 24 meses, la deuda por ¢67.531.002,00, a una tasa de interés del 16%, con una cuota de ¢3.306.528,00 mensual fluctuante, iniciando el 19 de setiembre de 2008 y durante 19 meses, hasta cancelar la deuda.
II.El apoderado generalísimo sin límite de suma de HABITASUL formuló la demanda a fin de que en sentencia se declare que la CCSS exigió e impuso, de forma ilegítima, planillas adicionales a su mandante para los meses de enero y febrero de 2001 y los meses de diciembre de los años 2001, 2002, 2003 y 2004. En consecuencia, pide la nulidad, por no ser conformes a derecho y para su inaplicabilidad futura, de los siguientes actos administrativos: a) 1232-02619-2006-1 del 30 de enero de 2007, b) 1232-1653-2007-R del 27 de setiembre de 2007, c) 30-02-08 de las 9 horas del 26 de febrero de 2008. Así como del convenio administrativo de pago celebrado el 25 de agosto de 2008. Como consecuencia de lo anterior, pretende se declare el derecho de su representada al restablecimiento de su situación jurídica vulnerada, sin que deba cancelar ningún tipo de obligación económica derivada de esas planillas adicionales.
Por lo tanto, su mandante tiene derecho al reintegro, debidamente indexadas, de las sumas canceladas a la CCSS por concepto del convenio que firmó bajo protesta el 25 de agosto de 2008, más los respectivos intereses de ley. Por último, pide se le imponga el reconocimiento de las costas del proceso a la institución demandada. El traslado de la demanda a la CCSS, ordenado en resolución de las 8 horas 55 minutos del 4 de agosto de 2011, fue notificado el 21 de noviembre de ese año. El representante de la CCSS se opuso y formuló la defensa de falta de derecho. En la audiencia preliminar, celebrada el 23 de octubre de 2012, también alegó la excepción previa de caducidad. Mediante resolución no. 1762-2012-T, el Juez Tramitador la reservó para ser conocida en sentencia. Asimismo, en dicha audiencia, en resolución 1764-2012-T, ordenó integrar, en calidad de litis consertes pasivos necesarios, a todas aquellas personas mencionadas en las planillas adicionales de la CCSS base de este proceso.
Solo el señor Luis Eduardo Flores Morera se opuso y alegó la defensa de fondo de prescripción de un año prevista en el precepto 56 del Código de Trabajo. Mediante resolución de las 9 horas 5 minutos del 20 de febrero de 2014 se decretó la rebeldía de los demás codemandados. El Tribunal rechazó las excepciones interpuestas. Condenó a la CCSS, al BPDC, al INA y al IMAS a reintegrarle a la empresa actora las sumas canceladas, debidamente indexadas (esto, desde que se realizó cada pago a partir del convenio celebrado el 25 de agosto de 2008 y hasta su efectiva devolución). De igual manera, reconoció, sobre esos montos, los intereses netos o puros, los cuales, según indicó, se generan a partir del momento de pago y hasta su efectiva devolución. Declaró la nulidad de los siguientes actos administrativos:
III.En el primer agravio admitido, folio 2 vuelto, invoca el recurrente el motivo casacional previsto en el precepto 138 inciso c) del Código Procesal Contencioso Administrativo -CPCA-: “Cuando se haya aplicado o interpretado indebidamente una norma jurídica o se haya dejado de aplicar.” Ello por cuanto, explica, se valoró erróneamente la Ley no. 4755 del 3 de mayo de 1971, Código de Normas y Procedimientos Tributarios -Código Tributario-. El Tribunal, relata, en el hecho no probado número tres de la sentencia impugnada indicó: “Que la acción formulada por la actora se encuentre caduca (los autos).” Reproduce, en lo de su interés, lo expuesto en el considerando III del fallo combatido. En su criterio, manifiesta, cometió un grave error de aplicación de la normativa con la que basó su decisión. Encasilló las cuotas obrero-patronales como un tributo u obligación tributaria, lo cual no es cierto.
La cuota obrero patronal, apunta, es una obligación legal. Una condición esencial para la existencia del régimen. Se originó, explica, en beneficio de los mismos contribuyentes, con el fin de crear beneficios laborales ya adquiridos con solo el hecho de encontrarse en una relación laboral determinada por la presencia de sus elementos básicos. Copia, en lo de interés, lo expuesto por la Sala Constitucional en el voto no. 7393-98. Al no considerarse como tributo, sino el pago de una obligación legal, agrega, no puede incluirse dentro de la materia tributaria. La naturaleza de las cuotas de los seguros sociales administrados por la CCSS, asegura, es propia y no debe considerarse tributaria. Así, dice, lo ha considerado la Dirección Jurídica de su poderdante con el aval de la Sala Constitucional. Este criterio, insiste, ha sido respaldado por la jurisprudencia constitucional, específicamente, en el voto indicado, no. 7393-98 de las 9 horas 45 minutos del 16 de octubre de 1998, del cual transcribe otro fragmento.
Tal precedente, concluye, continua vigente, pues se considera que las cuotas de la seguridad social tienen una naturaleza jurídica propia, no tributaria. En la segunda y última censura admitida, folio 3 vuelto, reitera el casacionista la causal de casación prevista en el precepto 138 inciso c del CPCA. Manifiesta, no se aplicaron los siguientes cánones: 39 íbid; 141 inciso 1), 175 y 240 inciso
IV.Debido a la estrecha relación entre ambos motivos de disconformidad, esta Cámara los analizará conjuntamente. El meollo de lo alegado por el recurrente estriba en que, a su entender, el Tribunal erró al indicar que la naturaleza jurídica de la cuotas obrero patronales era tributaria y, por lo tanto, tocante a la defensa de caducidad argüida no le resulta aplicable lo preceptuado en el canon 39 del CPCA; sino lo dispuesto en el numeral 41 inciso 2) íbid; aplicando, en consecuencia, lo previsto en el Código Tributario. Según indica, las cuotas obrero-patronales son una obligación legal, por lo que el plazo de caducidad para incoar el proceso es el previsto en el susodicho precepto 39 del CPCA. En esta lite, manifiesta, el acto final del proceso fue notificado en marzo del año 2008; sin embargo, fue hasta el año 2011 cuando se interpuso la demanda, por lo que el plazo anual ya había transcurrido, razón por la cual es procedente la excepción formulada.
V.Al respecto, y por la importancia que reviste para la solución de la presente lite, es menester transcribir en lo conducente y pese a su extensión, lo considerado por las personas juzgadoras de instancia: “III) SOBRE LA CADUCIDAD Y PRESCRIPCIÓN DE LA NULIDAD DE LAS RESOLUCIONES IMPUGNADAS: El instituto de la caducidad se define como un término procesal inexorable con el que se cuenta para interponer una acción procesal, que no puede ser objeto de suspensión, ni de interrupción, siendo sus presupuestos procesales la inactividad y la existencia de un término procesal para actuar. En materia de alegación de nulidades de actos administrativos, se ha establecido en la Ley General de la Administración pública, en su ordinal 175, que […] Sobre el tema, el Código Procesal Contencioso Administrativo, establece en su numeral 39, que el plazo máximo para incoar el proceso será de un año, el cual se contará […] Por su parte, tratándose de actos de efecto continuado el numeral 40 del Código supracitado, expresa que […] Por su parte, en materia tributaria, establece el numeral 41 ibid, que […] De modo que, al tratarse el presente asunto de la impugnación de actos administrativos determinadores de la obligación tributaria de las cuotas obrero patronales, se debe regir en materia de caducidad para su impugnación por el Código de Normas y de Procedimientos Tributarios, número 4755 del 03 de mayo de 1971, en lo referente a la materia de la prescripción, con aplicación de los instrumentos propios de dicho instituto.
Es por ello, que resulta de aplicación la norma tributaria vigente para el momento del dictado de los actos impugnados en 1996, de modo que se aplica la Ley número 7900 del 03 de agosto de 1999, vigente hasta el 27 de setiembre del año 2012, la cual en materia tributaria dispone al reformar el numeral 51 sobre la prescripción, que […] En ese sentido, para el presente caso, el término de caducidad que debe aplicarse para efecto de la impugnación en sede judicial de los actos administrativos determinadores de la obligación tributaria, es el que rige para el derecho de fondo, siendo para dicha data el de tres años, porque el de cuatro años rigió a partir del 28 de setiembre del 2012, data en que entró en vigencia la Ley 9069 del 10 de setiembre del 2012, la cual vino a disponer que […] En mérito de ello, efectivamente, debe aplicarse el plazo de prescripción que estipula el numeral 51 ibid, así como todos sus institutos de conteo del plazo, de suspensión y de interrupción, de modo tal que el conteo, se deberá de realizar a partir tomando en consideración los supuestos de interrupción o suspensión de la prescripción tributarias, a tenor del numeral 53 vigente para dicha data.
En ese sentido expresa el numeral 53 ibid, lo siguiente […] De forma que el término de la prescripción se debe contar, como lo establece el numeral 52 del Código expresado, desde el primero de enero del calendario siguiente a aquel en que el tributo debe pagarse. Sobre el tema la Sala Primera de la Corte Suprema de Justicia, ha sido clara en el voto número 31 del 16 de enero del 2015, al expresar en forma contundente que […] Aplicado lo indicado al presente asunto, tenemos que la parte actora incoa la nulidad de los siguientes actos administrativos: "2. Que se declaren nulos, por no ser conformes a derecho y para su inaplicabilidad futura los siguientes actos administrativos: a) 1232-02619-2006-1 del 30 de enero del año 2007. b) 1232-1653-2007-R del 27 de setiembre del año 2007. e) 30-0208 de las 9 horas del 26 de febrero del año 2008. 3. Que se declare nulo el convenio administrativo de pago del 25 de agosto del año 2008." En ese sentido, el acto administrativo número 1232-02619-2006-1 del 30 de enero del año 2007, se refiere al Informe de Inspección, suscrito por la Dirección de Inspección, notificado al actor el día 14 de febrero de 2007 (Lo anterior se encuentra visible a folios 20 al 52 del Expediente Administrativo).
Se impugna además, la Resolución número 1232-01653-2007-R, de la Dirección de Inspección, Area de Inspección de Servicios, misma que fue notificada a la actora en fecha 25 de octubre de 2007 (Lo anterior visible a folios 60 al 75 del Expediente Administrativo). De igual forma se cuestiona la Resolución número 30-02-08, de la Gerencia Financiera de la Caja Costarricense de Seguro Social, misma que fue notificada a la actora en fecha 28 de marzo de 2008. (Lo anterior visible a folios 77 al 84 del Expediente Administrativo). Se requiere además por nulidad, el convenio de pago que se formalizó con la Sociedad actora el 01 de agosto de 2008 (Folio del expediente administrativo tramitado por la CCSS número 2-03101109263-001001, aviso de cobro e informes de inspección). En mérito de ello, debe contabilizarse el plazo de los tres años, conforme lo establece el numeral 52 del Código expresado, desde el primero de enero del calendario siguiente a aquel en que el tributo debe pagarse y hasta la notificación de la demanda.
En el presente caso, se constata en el expediente digital judicial en las imágenes que van de la 63 a la 78, que el traslado de la demanda emitido mediante resolución de las 8:55 horas del 04 de agosto del 2011, se notifica a la CCSS el día 21 de noviembre del 2011, de modo que el término de caducidad de tres años para requerir la nulidad peticionada, cuenta desde el primero de enero del calendario siguiente a aquel en que el tributo debe pagarse, es por ello que al haberse dictado la resolución final, definitiva y firme mediante resolución número 30-0208, de la Gerencia Financiera de la Caja Costarricense de Seguro Social, misma que fue notificada a la actora en fecha 28 de marzo de 2008, regía el término para incoar el proceso desde el primero de enero del 2009 y hasta el primero de enero del 2012, en razón lo cual al notificarse la demanda el día 21 de noviembre del 2011, no había acaecido el plazo de caducidad aludido. Sin que acontezca prescripción alguna, ello así debido a que como se expresó, la caducidad se regirá por el instituto de la prescripción.” (Solo lo subrayado es suplido).
VI.Como se aprecia, el Tribunal, sin mayor motivación -al no invocarse este motivo casacional, esta Sala se encuentra imposibilitada de analizarlo-, señaló que “[…] al tratarse el presente asunto de la impugnación de actos administrativos determinadores de la obligación tributaria de las cuotas obrero patronales, se debe regir en materia de caducidad para su impugnación por el Código de Normas y de Procedimientos Tributarios, número 4755 del 03 de mayo de 1971, en lo referente a la materia de la prescripción, con aplicación de los instrumentos propios de dicho instituto.” Al respecto, la Sala Constitucional de la Corte Suprema de Justicia, en un reciente voto, no. 2018013658 de las 9 horas 15 minutos del 22 de agosto de 2018, en lo de interés, señaló: “I.- SOBRE EL ARTÍCULO 23 DE LA LEY CONSTITUTIVA DE LA CAJA COSTARRICENSE DE SEGURO SOCIAL. […] La cuestión de las contribuciones parafiscales –en este caso las aportaciones a la seguridad social- ha provocado no poca polémica en el ámbito doctrinario y jurisprudencial.
En lo que atañe a la controversia jurídica constitucional que tenemos entre manos, desde la perspectiva de esta Sala, son plausibles dos tesis. La primera, que considera que al ser un tributo –véase al respecto la sentencia 2006009568 de este Tribunal- irremediablemente sus elementos estructurales –hecho generador, tarifa, base de cálculo, sujeto activo y pasivo, etc.- deben ser definidos por Ley formal-; esta última consecuencia que no ha sido validada por la Sala Constitucional-. En esta dirección, si los elementos estructurales de la contribución parafiscal no estuviesen establecidos por Ley formal, se estaría vulnerando el principio de legalidad tributaria, máxime si se toma en cuenta que en la lucha de los barones ingleses por hacerse de la potestad tributaria algunos encuentran el origen del Parlamento y la democracia – no hay democracia sin Parlamento, ni de éste sin la Oposición-.
En resumidas cuentas, en este caso específico, se debe de aplicar el principio de legalidad tributaria. La segunda tesis, la cual ha sido sostenida por este Tribunal –véanse, entre otras, las sentencias números 1994003819 y 1998-007393-, es la que considera que no estamos en presencia de una contribución parafiscal y, por consiguiente, no se debe aplicar el principio de legalidad tributaria. “El pago de la cuota o contribución, según sea el caso, no es un tributo, como quedó dicho en párrafos anteriores, sino el pago de una obligación legal, que es condición esencial para la existencia misma del régimen, creada precisamente, en beneficio de los mismos contribuyentes…”. / Según la doctrina más autorizada en materia tributaria las contribuciones parafiscales son un tributo, pues contienen los elementos materiales de la obligatoriedad –el deber de pagarlas quienes se encuentren en el supuesto de la norma creadora-, de singularidad debido a que afecta un determinado y único grupo social o económico y la destinación sectorial a causa de lo que se recauda a través de esta prestación obligatoria se utiliza en beneficio exclusivo del grupo que pagó el tributo.
Estamos, pues, ante el ejercicio de una potestad de imperio del Estado que impone prestaciones pecuniarias para el cumplimiento de fines sociales o económicos. Ergo, solo a través de una Ley formal se pueden crear –tributum sine legge-. / Ahora bien, en el caso de las cuotas obrero-patronales destinadas al sostenimiento de la seguridad social –seguro de enfermedad y maternidad y seguro de invalidez, vejez y muerte-, nuestro ordenamiento jurídico tiene una singularidad. En efecto, y es que el numeral 73 constitucional es el que crea la contribución parafiscal al disponer una contribución forzosa del Estado, patronos y trabajadores, a fin de proteger a éstos contra los riesgos citados y demás contingencias que la ley determine. Acto seguido, el texto constitucional establece que la administración y el gobierno de esos seguros sociales corresponde a una institución autónoma: la Caja Costarricense de Seguro Social.
Finalmente, en lo que interesa, la norma constitucional impone la prohibición de transferir o emplear en finalidades distintas a las que motivaron su creación, los fondos y las reservas de los seguros sociales. Como puede observarse, estamos, pues, ante una contribución parafiscal creada por el Constituyente originario, con lo que, desde la perspectiva de este Tribunal, se cumple la máxima de que no puede haber imposición sin representación –no taxation without representation-. En otras palabras, en el caso que nos ocupa, el apego a los principios que regentan el ejercicio de la potestad tributaria se cumple satisfactoriamente, toda vez que un órgano representativo, plural, que ejerce el máximo poder en un Estado democrático y social de Derecho, como lo es el ejercicio de la potestad constituyente, determinó soberana y democráticamente crear la contribución parafiscal. / Un segundo escollo que debemos superar, es el relativo a la fijación del monto de la cuota a pagar por patronos y trabajadores.
Al respecto, el artículo 23 de la Ley Constitutiva de la Caja Costarricense de Seguro Social estatuye que las cuotas y prestaciones serán determinadas por la Junta Directiva, de acuerdo con el costo de los servicios que hayan de prestarse en cada región y de conformidad con los respectivos cálculos actuariales. La contribución de los trabajadores no puede ser nunca mayor de la contribución de sus patronos, salvo los casos de excepción que para dar mayores beneficios a aquéllos, y para obtener una más justa distribución de las cargas del seguro social obligatorio señale el Reglamento, con base en recomendaciones actuariales. Vista así las cosas, concluye este Tribunal que no se vulnera el principio de legalidad tributaria, por la elemental razón que mediante Ley formal se le impone a la Junta Directiva de la Caja Costarricense de Seguro Social parámetros objetivos a la hora de determinar el monto de la cuota – el costo de los servicios que presta y los respectivos cálculos actuariales-, por lo que el legislador le fijó al órgano colegiado administrativo los elementos objetivos que debe observar a la hora de fijar los respectivos montos, actos administrativos que también deben ceñirse a los principios generales de Derecho y son controlables a través del Juez de lo Contencioso Administrativo.
Esta misma lógica sigue el Código de Normas y Procedimientos Tributarios en su numeral 5, en relación con las tasas, pues permite variar su monto por vía de Reglamento para que se cumpla su destino en forma más idónea, previa intervención del organismo que por ley sea el encargado de regular las tarifas de los servicios Públicos. / Recapitulando, al ser creada la contribución parafiscal por el Constituyente originario, se cumple, con creces, el principio de legalidad tributaria, por un lado, y al fijar el legislador parámetros objetivos para determinar monto de la cuota de la contribución parafiscal, también se respeta ese principio.”
VII.A la luz del anterior fallo de la Sala Constitucional, se determina, como lo señaló el Tribunal, los aportes a la seguridad social son contribuciones parafiscales; por ende, su naturaleza es tributaria. Ergo, no lleva razón el casacionista en su alegato al negarle esa condición. En consecuencia, tocante a la defensa de caducidad argüida, la norma actuable es la contenida en el precepto 41 inciso 2) del CPCA, aplicando, por ende, lo previsto en el Código Tributario; no así lo señalado en el canon 39 del CPCA como lo indica el recurrente. El casacionista no objetó el cómputo del plazo efectuado por las personas juzgadoras a la luz de lo dispuesto en la normativa tributaria; el cual, por demás, es correcto. En consecuencia, al no estar prescrita la acción, no incurre el Tribunal en los yerros alegados por el casacionista. Por lo tanto, se impone el rechazo de las censuras en estudio. Sin perjuicio de lo expuesto, es menester señalar, como se ha indicado, la objeción interpuesta por el recurrente estriba en la denegatoria de la defensa de caducidad interpuesta, ya que, a su entender, la acción se interpuso pasado el año previsto en el canon 39 del CPCA.
Ya se brindaron las razones por las cuales esta Cámara no comparte esa tesis; sino que el numeral actuable es el 41 inciso 2) íbid. Dentro de esta línea de pensamiento, tampoco resulta aplicable lo dispuesto en el párrafo segundo del artículo 56 de la Ley no. 17 del 22 de octubre de 1943, Ley Constitutiva de la Caja Costarricense de Seguro Social, el cual dispone: “La acción penal y la pena en cuanto a las faltas contempladas en esta ley, prescribirán en el término de dos años contados a partir del momento en que la Institución tenga conocimientos de la falta. El derecho a reclamar el monto de los daños y perjuicios irrogados a la Caja, sea que se ejercite la vía de ejecución de sentencia penal o directamente la vía civil, prescribirá en el término de diez años.” (Lo subrayado es suplido). En esta lite no se reclama ningún monto por daños y perjuicios irrogados a la CCSS; ergo, tal disposición no resulta aplicable.
VIII.En mérito de lo expuesto, por mayoría, débese rechazar el recurso formulado. En cuanto a sus costas, el precepto 150 inciso 3 del CPCA preceptúa: “La sentencia que declare sin lugar el recurso de casación, condenará a la parte vencida al pago de las cotas personales y procesales causadas por el recurso; salvo que, por la naturaleza de las cuestiones debatidas en el recurso, haya habido, a juicio de la Sala Primera o del Tribunal de Casación, motivo suficiente para recurrir.” (Lo subrayado no es del original). Como se indicó, el sustento de esta sentencia es el reciente voto de la Sala Constitucional, el cual cambió su línea jurisprudencial. Por ello, en criterio de este órgano decisor, a la CCSS le asiste suficiente motivo para litigar, por lo que se le absolverá del pago de las costas del recurso de casación (artículo 150 inciso 3 del CPCA).
POR TANTO
Por mayoría, se declara sin lugar el recurso de casación interpuesto. Se resuelve sin condena en costas. Salva el voto la magistrada Rojas Morales.
Luis Guillermo Rivas Loáiciga Román Solís Zelaya Rocío Rojas Morales Yazmín Aragón Cambronero Maribel Seing Murillo MJIMENEZ Nota de la magistrada Rojas Morales A pesar de que en la sentencia, por error material, se consigna que se trata de un voto salvado, lo cierto es que el criterio que deseo exponer se hace en formato de nota, ya que no afecta ni altera lo dispuesto en la parte dispositiva de la presente resolución. Si bien es cierto, en cuanto a la defensa de caducidad, debe aplicarse el numeral 41 inciso 2) del Código Procesal Contencioso Administrativo que establece que el plazo máximo para incoar el proceso será el mismo que disponga el ordenamiento jurídico como plazo de prescripción del derecho de fondo, debo externar mi desacuerdo con la aplicación del artículo 51 del Código de Normas y Procedimientos Tributarios, el cual, antes de que fuese reformado por el artículo 1° de la ley N° 9069 del 10 de setiembre del 2012, disponía que la obligación tributaria prescribía a los tres años.
En su lugar, considero que la norma de prescripción de derecho de fondo aplicable en la lite es el artículo 56 de la Ley Constitutiva de la Caja Costarricense de Seguro Social (N° 17) que dispone un término de diez años, pues, aunque se trate de extremos tributarios, esta es la norma especial para efectos de cobros de extremos parafiscales de la CCSS, por lo que se antepone a la norma general del Código de Normas y Procedimientos Tributarios.
