CONSIDERING
I.Agromecánica F y P S.A. (hereinafter Agromecánica) sued Sociedad Indaco Horquetas S.A. (hereinafter Indaco). It stated that it owns the Heredia property, land registry folio (matrícula) 109230-000, located in Sarapiquí, measuring 19 hectares 8571.31 m2. It added that the property has been reforested with Melina under Pago de Servicios Ambientales and is in the harvesting phase (fase de aprovechamiento), with Zota Caballo near the river. It asserted that the property is a kind of island, surrounded on all four sides by the Río Puerto Viejo, with no “washout” problems. It emphasized that, through resolution R-80-2012-MINAET, the defendant was granted the right to extract materials from the channel of that river for a term of 10 years. It explained that Indaco was required to comply with the technical recommendations and conditions contained in official letter DGM-CRHA-075-2011 of June 22, 2011, as well as any others issued by the Dirección de Geología y Minas (hereinafter DGM) and the Secretaría Técnica Ambiental.
It recounted that the Registro Nacional Minero was also advised to continue the corresponding procedures for granting the concession (concesión), taking into account the characteristics and recommendations of the Extraction Program (Programa de Explotación) contained in the environmental impact study (Estudio de Impacto Ambiental, hereinafter EIA), as well as the field observations. It further stated that the project coordinates were established, beyond which no work could be performed, excluding the islet located between sections 7 and 14 of the Extraction Program; consequently, machinery could not enter its property. It alleged that the defendant was also required to respect the river’s 15-meter protection zone (zona de protección) regarding the formation of accumulated-material mounds and any other works, as well as roads along the channel. Nevertheless, it argued, the defendant invaded the islet belonging to it with heavy machinery, causing an area of approximately two hectares to disappear, without respecting the protection zones, spring areas (áreas de nacientes), or technical guidelines.
It stressed that the defendant carried out work to divert the river’s natural channel, dredging, material extraction, and extraction of materials from the channel, causing the remainder of the property and neighboring properties to be washed away and knocking down trees that mitigated impacts on the river’s protection zones. It stated that the remainder of its property is currently at risk of being invaded and made to disappear, including springs and reforested trees. It noted that these actions have “potentially caused the damage,” including the loss of approximately two hectares of its property, which it estimates at ¢100.000.000,00, as well as reforested trees of the Melina species valued at ¢3.000.500,00; and, as consequential damages (perjuicios), interest on those amounts until actual payment, plus the cost to be determined by expert appraisal for restoring the new protection zones to be reforested and performing fill work, which it estimates at ¢20.000.000,00.
It requests that the judgment declare: a) that the defendant unjustifiably invaded and “caused to disappear” an area forming part of the property owned by the plaintiff, Heredia Province, land registry folio 109230-000, thereby causing damages and consequential damages (daños y perjuicios); b) that, due to the nature of the damage, it is impossible for the plaintiff to recover the invaded area because Indaco caused it to disappear, even though it was not part of the area granted under the concession, and therefore the defendant must pay the damages and consequential damages stated in the complaint or, alternatively, those determined by expert appraisal, as well as both sets of legal costs (costas); c) that Indaco must adopt technically justifiable mitigation measures to prevent the continued washout of the property’s land and must refrain from entering within the boundaries of the plaintiff’s property, under penalty of committing the offense of disobedience of authority.
The defendant denied the allegations. It raised the defenses (excepciones) of the statute of limitations (prescripción) and lack of legal right and standing, in both respects. The Court rejected the statute-of-limitations defense and upheld the remaining defenses. It dismissed the complaint, ordering the plaintiff to pay the costs of the proceeding and the defendant in the incidental proceeding to pay the costs of the newly alleged facts incident (incidente de hechos nuevos). The Tribunal reversed the judgment only insofar as it ordered the defendant to pay the costs of the newly alleged facts incident, resolving that incident without a specific award of costs. It affirmed the judgment in all other respects. Dissatisfied, the plaintiff appeals on points of law.
II.The appellant in cassation (casacionista) raises three substantive grounds. In the first, she alleges an error of fact (error de hecho) and improper application of the rules governing the assessment of evidence (valoración probatoria), in violation of mandate 54 of the Law on Agrarian Jurisdiction (Ley de la Jurisdicción Agraria, hereinafter LJA), with respect to fact 7 deemed proven. She states that the Tribunal did not assess the evidence as a whole and disregarded in its analysis the judicial inspection (reconocimiento judicial) conducted in the proceedings, which established the proximity of the work performed by the defendant to the springs (nacientes) verified during the inspection of 16 de setiembre de 2014 (which established the existence of the spring and the proximity of the works performed by the defendant), placing it in imminent danger due to how close those activities had come.
She observes that the testimony given by the defendant’s technical experts does not address the danger posed to the spring by the work performed by the defendant; rather, they state that the water outflows (brotes de agua) found on its property do not warrant the protection afforded by mandate 33 of the Ley Forestal (hereinafter LF), because they do not consider them to be springs. Nevertheless, she contends that the record contains sufficient evidence, even cited by the Tribunal itself, to conclude that the spring does require protection, despite which the judges state that the damage could not be established by the expert evidence (prueba pericial) obtained. She outlines that, during the judicial inspection, the suspension of material extraction was ordered precisely because its distance from the spring did not comply with the 100 metros prescribed for that purpose. She contends that the Tribunal ruled contrary to the basic rules of common sense, logic, and the actual truth of the facts, because damage cannot be established solely through one isolated item of evidence (expert evidence), but goes beyond that; hence, the judges erred in analyzing the testimony, particularly that of Mr.
Andrés Villegas, supervising geologist (Geólogo regente). She states that the Ad quem took his testimony out of context because he said that the bodies of water (cuerpos de agua) on her property were not subject to a protection regime (régimen de protección) and that, accordingly, the defendant’s encroachment toward the springs did not contravene Article 33 of the Ley Forestal. She adds that the DGM geologist who approved the defendant’s study expressed the same view. She further offers, as evidence to assist the court in reaching a decision (prueba para mejor proveer), the taking of evidence on 29 de octubre del 2018, conducted in situ within judicial proceeding 14-000220-507-AG at the boundary of the property, where the experts and the DGM official contradict the evidence in the record that was assessed by the Tribunal. She also adds official letter OS-847 from the Water Department, dated 31 de julio del 2013 (folio 500 Tomo ll), which concludes that the waters on the property require the protection regime established under provision 33 of the Ley Forestal.
She notes that, in that evidence, the official responsible for approving the defendant’s mining project expressly states that, for that property (known as la Isla), before environmental viability (viabilidad ambiental) was approved, reports had been prepared by the MINAET Water Department that disqualified the outflows as springs, a conclusion contradicted by the evidence appearing at folio 500. On that basis, she states that the DGM respected none of the water sources (fuentes de agua) on the property when granting the concession. Thus, she comments, any violation of the setback requirements (retiros) established in provision 33 ibídem is deemed to have been accepted by the DGM. She recounts that the damage to the springs became evident during the judicial inspection identified above, but the Tribunal diverted the issue under analysis, overlooking the fact that the defendant did cause damage to the springs and that any impairment of or failure to comply with the setbacks established in Article 33 ibídem is regarded as permissible by both the expert and the geologists, even though the Water Department and the State’s own counsel, in proceeding 13-006026-1027-CA, determined that the springs and water sources on the property were subject to the specified protection regime.
She states that, in this manner, the maxims of experience (máximas de experiencia) and common sense were violated, because the damage to the spring exists and was established through the judicial inspection, and the statutory setbacks were not observed. She concludes that the experts determined that those springs did not require protection, a determination refuted by the Water Department, and that the evidence submitted in expediente 13-006026-1027-CA was not assessed, contrary to Article 54 of the LJA; therefore, her claim should have been granted. In her second objection, she argues that, by diverting the analysis away from the necessary protection of the water sources located within the property, the Tribunal overlooked the fact that the defendant did not establish that it had complied with the setbacks for the protection zones (zonas de protección), but instead claimed that those sources were not subject to a protection regime.
She contends that, on this basis and in light of the Tribunal’s glaring error, it failed to apply provision 11 of the Ley de Biodiversidad, insofar as it provides that preventing and anticipating potential causes of harm (threats) to the components of biodiversity is of vital importance. She further states that there is an imminent threat to components such as springs and protection zones and that the relevant corrective measures must therefore be adopted. She considers that the defendant sought to create doubt as to whether the watercourses (cursos de agua) under examination were protected under provision 33, an issue answered by the Water Department and the State’s own Counsel (PGR). She outlines that, in the proceeding under review, given the uncertainty as to whether these bodies of water were protected, the Tribunal should have granted at least the third claim in the complaint in part.
She argues that the A quo violated the principle of non-regression (principio de no regresión), because a mitigating measure (medida paliativa) had been adopted as an interim measure (medida cautelar), leading the DGM to establish a 30 metros protective buffer for the protection zones on la Isla, which are placed at risk by the dismissal of the complaint in all respects. In the third ground, she alleges that the Tribunal partially reversed the A quo judgment on the basis that, because she had been ordered to pay costs, the appropriate course was to deny the costs arising from the ancillary proceeding concerning new facts (incidente de hechos nuevos). Nevertheless, she contends that it neither substantiated nor justified its ruling under provision 55 of the LJA, and that none of the circumstances provided for in that provision establishes that, merely because the principal complaint was dismissed while an ancillary proceeding concerning new facts was granted, payment of costs in the latter should be waived.
She contends that the provision establishes no such rule and that the Tribunal drew a distinction where the law draws none; moreover, based on improper reasoning, it exempted the defendant from paying the costs of the ancillary proceeding concerning new facts without legal authority.
III.Regarding the first objection, the Court indicated that, in recital IV. 6 of the lower court’s judgment, the scope of the geological expert evidence (prueba pericial geológica) offered (folio 215 a 243 y 275 a 276, ampliada en folios 279) was examined in order to determine the alleged facts, namely, protection of the spring (naciente), noncompliance with the conditions of the concession and the protection areas (áreas de protección), as well as the failure to implement the mitigation measures (medidas de mitigación). It found that the expert opinion showed that technical evidence existed concerning changes in the morphology of the claimant’s land, concluding that they were not attributable to the operation of the mining concession. It noted that there was no evidence as to whether the claimant’s property had been encroached upon or the protection areas disregarded, given the timing of the alleged acts.
It found that no changes were observed along the riverbank and that the mitigation measures established in the environmental impact assessment (evaluación de impacto ambiental, EIA) were unknown. Regarding the springs, it clarified that they existed but were not in imminent danger, although they could have been affected by erosion or anthropogenic causes. It stated that the supplemental opinion (folio 279 a 280) indicated that the loss of land from the claimant’s property began before the defendant’s material-extraction activities and was attributable to a natural factor, rather than to extraction activities, namely, factors involving significant changes in the river dynamics that caused the morphological changes to the claimant’s property. On this basis, which the judgment under appeal relied upon extensively, it held that the damages claimed could not be attributed to the defendant. It considered that article 33 of the Ley Forestal establishes the obligation to safeguard the protection areas of those systems by imposing restrictions on the use of forest resources and on construction or cultivation activities.
In this case, it stated that proven fact no. 7 indicates that a body of water exists on the land and corresponds to an emergence of permanent flow from the Río Puerto Viejo itself, which was also confirmed during the judicial inspection (reconocimiento judicial). It therefore determined that the decision did not decline to apply the cited legislation, because the purpose of the proceeding, according to the relief sought, was to obtain compensation for damage caused to the claimant’s property by the defendant’s machinery encroaching upon areas not authorized under the concession for extracting material from a publicly owned watercourse. In that regard, it emphasized that it had not been proven that the extraction activity of the defendant company caused the losses claimed by the claimant to its property. It rejected the assertion that the testimony of Adrián Villegas Fonseca and Carlos Cervantes Umaña was false when they stated that protecting that water resource was unnecessary because it was not a spring but rather a reemergence of the Río Puerto Viejo.
It explained that this was because the nature of that body of water had been determined through the expert evidence, as well as in MINAE official communication OS-847 del 31 de julio del 2013, which informed the claimant, in connection with the permit it had requested to cut the melina plantation, that according to an opinion issued by that ministry’s Dirección de Aguas, the bodies of water were streams. It added that, pursuant to canon 33 of the Ley Forestal, the 15-meter strips on both sides of the banks of rivers, streams, or brooks are protection areas. It likewise explained that provision 34 thereof prohibits the cutting or removal of trees within the protection areas along the banks of rivers, streams, or brooks. Regarding the testimony of Mr. Andrés Villegas Fonseca (geological officer-in-charge (regente geológico), minuto 31:07 a 50:07 del disco compacto anexo al expediente), he stated (minuto 49:00 misma ubicación anterior) that there were no springs on the property, but rather reemergences of the Río Puerto Viejo, which is consistent with the documentary evidence cited.
Accordingly, it stated that because those bodies of water were not springs, spring-protection measures did not apply to them, as they were surface outcrops of the nature described. It reasoned that such statements did not affect the judgment’s determination—regarding the failure to establish a causal link (nexo causal) between the alleged encroachment by the defendant’s machinery into unauthorized areas and the erosion damage to part of the claimant’s property—because, according to the expert evidence, no damage was detected in those outcrops or during the judicial inspection, and those bodies of water are not located within the concession area. It added that this was reinforced by the environmental officer-in-charge’s (regente ambiental) testimony (minuto 01:43), stating that there were no springs within the concession area and that he did not know whether any existed within the Isla, although water could surface in lower-energy locations.
He also stated that those areas contain channels through which river water flows and that, in seeking its natural level, the water crosses the islet’s land; consequently, the argument concerning the spring and the lack of its protection was unfounded. In any event, it stated that it had not been proven that the defendant’s conduct caused the damages alleged on the claimant’s property or to any bodies of water contained therein, which is important because the action filed seeks damages (1045 del Código Civil). In the Court’s view, the central basis for dismissing the complaint was the absence of evidence of causation, because it was determined that, in carrying out its activity as lawfully authorized by the competent entities, the defendant complied with the technical and legal requirements imposed upon it. Thus, the alleged damage was unrelated to the claimant’s mining activity and instead resulted from a natural circumstance occurring on the claimant’s property before the defendant was granted its extraction concession.
It noted that, in recitals IV and VI, the lower court analyzed the evidence at issue and concluded that the defendant had not used its machinery to encroach upon the claimant’s land or any unauthorized portion of the riverbed in a manner that could have caused the loss of almost two hectares of the property and trees. It argued that the lower court’s judgment stated that, although no mitigation measures were undertaken concerning the washing away of the islet, according to the geological expert evidence, in the southeastern and eastern sectors of the island during el periodo 2003-2007, rainfall in the preceding years had increased the flow and erosion levels, whereas excavation began en el 2012, when rainfall had decreased; accordingly, the mitigation measures were unnecessary. Finally, it rejected any challenge to the geological expert opinion based on witness testimony asserting that it was imprecise as to dates or referred to events occurring on dates other than those of the defendant’s extraction activities.
V.Regarding the first ground of appeal, this Chamber observes that it was established in this case that a water source exists on the claimant company’s property that is actually an emergence of permanent flow from the Río Puerto Viejo itself (proven fact 7). It was also established that the claimant company’s land has been eroding due to the Rio Puerto Viejo river system, which borders the property on all sides, rather than due to the defendant’s activity. By carrying and depositing abundant alluvial lithological material of varying particle sizes along its bank, as well as vegetation resulting from its natural river dynamics, the river has undercut portions of the walls on the eastern side of the “Isla,” leaving exposed tree-root systems and creating sandbanks with remnant vegetation in the southeastern sector. The morphology of the disputed property has therefore been affected by river erosion, a situation occurring since el 2003 y 2007, before the concession granted to the defendant company Indaco began (proven fact nine).
More importantly, the claimant failed to establish that the erosion affecting the property under examination was caused by the defendant’s material-extraction operations. Nor did it establish that the company had disregarded the river’s protection area while carrying out its extraction activity, or that it had conducted that activity through the claimant’s property or directly on that property, affecting its morphology or agricultural production (facts found not proven, del 1 al 9). Consequently, no adverse effect on any springs that may or may not exist on the claimant’s property can be attributed to it. This is especially so regardless of whether the matter could be proven through witness evidence, because distinguishing one type of water emergence from another clearly requires technical evidence. By the same token, it was also not established that mandate 33 of the Ley Forestal had been violated, since the defendant’s operations caused no adverse effect on the property under examination.
This is especially true insofar as the expert evidence and various DGM documents determined that the waters were not springs, but the river itself surfacing at that location. Contrary to the contention raised, this does not conflict with Departamento de Aguas official communication OS-847 del 31 de julio del 2013 (folio 500 Tomo ll), which concludes that the waters existing on the property require the protection regime under canon 33 of the Ley Forestal, because, as the referenced official communication clearly indicates, they are streams whose protection radius is 15 rather than 100 meters, as in the case of springs. Finally, it is noted that no damage could have been caused to the “springs” without proof that the defendant conducted extraction activities “en la Isla,” a circumstance that not only was not established, but also is not challenged by this ground of appeal. Accordingly, there are no grounds in this case for upholding the claim of improper assessment of the evidence.
VI.Regarding the second ground of appeal, as previously stated, the judges found, based on the expert evidence, that the changes in the morphology of the claimant’s land were not attributable to the defendant’s extraction-concession activities. They also found that no encroachment upon the claimant’s property had been proven. Furthermore, they found it established that the loss of land from the claimant’s property began before the defendant’s material-extraction activities and was attributable to a natural event. As for the alleged bodies of water existing on the property, the judges indicated that the purported “spring” corresponds to an emergence of permanent flow originating from the Río Puerto Viejo itself. Accordingly, it cannot be argued that the issue of the necessary protection of the water sources existing within the property was improperly diverted when the evidence discloses no adverse effect on the claimant’s property resulting from the defendant’s extraction activity.
It is therefore clear that relief cannot be granted under provision 11 of the Ley de Biodiversidad without proof of damage, of the defendant’s encroachment upon the property under examination, or that its conduct caused the erosion and other consequences that, according to the expert evidence, were due to natural events rather than to the defendant. Under this line of reasoning, the ground of appeal must be rejected because the proceeding is based on a claim for compensation whose causal link to the alleged damage is not attributable to the defendant. Accordingly, the allegation that the Court diverted attention from the relevant issue is likewise unfounded, because there is a clear absence of evidence of the defendant’s alleged encroachment upon or damage to the claimant’s property. For the reasons stated, the ground of appeal must be rejected.
VII.Regarding the third challenge, the Court partially granted the motion alleging new facts filed by the legal representative of the plaintiff company. It accepted the specific material facts set forth and numbered one through five and rejected facts 6 and 7 because they reiterated fact 6 contained in the initial complaint. With respect to that motion, it ordered the respondent to the motion to pay the procedural costs arising from it. Pursuant to section 55 of the LJA, the Tribunal reversed the award of costs relating to the motion alleging new facts and instead ruled that no special award of costs would be made in this respect, given that the complaint was dismissed. In this regard, this Chamber finds that the Tribunal applied the rule correctly, considering that, because the complaint was dismissed, it made no sense to impose the costs of the motion alleging new facts on the respondent to the motion, since the latter prevailed. Accordingly, there is no indication that the Tribunal violated section 55 of the LJA by making no special award of the costs of the aforementioned motion, since, from its perspective, there were no grounds for imposing them on the prevailing party; the claim must therefore be rejected.
POR TANTO
The judgment under appeal is affirmed.

San José, a las quince horas treinta minutos del diecisiete de octubre de dos mil diecinueve.| Proceso ordinario establecido en el Juzgado Agrario del II Circuito Judicial de San José por AGROMECANICA F y P SOCIEDAD ANÓNIMA, cédula jurídica número 3-101-57066, representada por Rafael Fuscaldo Peralta, casado, empresario, cédula de identidad 9-0012-409, en calidad de apoderado generalísimo sin límite de suma; contra INDACO HORQUETAS, SOCIEDAD ANONIMA, cédula jurídica número 3-101-36437, representada por Helmut Zeuner Beutel, cédula de identidad número 1-0472-0962, en calidad de apoderado generalísimo sin límite de suma. Actúa como apoderado especial judicial de la parte actora, el letrado Roberto Soto Vega, colegiado número 8-1043; como apoderados especiales judiciales de la parte demandada, Ana Lucrecia Quirós Montoya, Colegiada número 5243, y Roberto Garita Chinchilla, Colegiado número 18131.
Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de Limón, Guápiles. Las personas físicas son mayores de edad, abogados y con las salvedades hechas. La representación de la parte actora formula recurso de casación contra la sentencia 1029-F-18, del Tribunal Agrario, Segundo Circuito Judicial de San José, emitida a las 14 horas 17 minutos del 31de octubre de 2018.

CONSIDERANDO
I.Agromecánica F y P S.A. (en adelante Agromecánica), demandó a Sociedad Indaco Horquetas S.A. (en lo que sigue Indaco). Manifestó, es propietaria de la finca de Heredia, matrícula 109230-000, ubicada en Sarapiquí, con una medida de 19 hectáreas 8571.31 m2. Agregó, la heredad está reforestada de Melina con pago de servicios ambientales, en fase de aprovechamiento; y, Zota Caballo en la cercanía del río. Señaló, el inmueble es una especie de isla, rodeada por cuatro costados por el Río Puerto Viejo, sin problemas de “lavado”. Enfatizó, mediante resolución R-80-2012-MINAET, se otorgó a la accionada la explotación de materiales en el cauce del Río en mención, por un plazo de 10 años. Explicó, Indaco debía cumplir con las recomendaciones y condiciones técnicas del oficio DGM-CRHA-075-2011 del 22 de junio de 2011, así como cualquier otra emitida por la Dirección de Geología y Minas (en lo que sigue DGM), y la Secretaría Técnica Ambiental.
Relató, también se recomendó al Registro Nacional Minero continuar con los trámites respectivos para el otorgamiento de la concesión, considerando las características y recomendaciones del Programa de Explotación del Estudio de Impacto Ambiental (en lo consecutivo EIA), así como las observaciones de campo. Además, dijo, ubicó las coordenadas del proyecto, fuera de las cuales no podía realizar labores, excluyéndose el islote ubicado entre las secciones 7 y 14 del programa de explotación, de ahí que la maquinaria no podía entrar a su terreno. Acusó, también debía respetar la zona de protección del río de 15 metros, en lo que se refiere a la conformación de los montículos de acumulación de materiales y cualquier otra obra, además de los caminos a lo largo del cauce. No obstante, argumentó, la demandada invadió la isleta de su propiedad, con maquinaria pesada, despareciendo un área aproximada de dos hectáreas, sin respetar las zonas de protección, áreas de nacientes, ni los lineamientos técnicos.
Recalcó, la accionada realizó labores de desviación del cauce natural del río, dragado, extracción de material y aprovechamiento de materiales en cauce provocando que el resto de la finca y las de los vecinos, se esté lavando, derribando árboles que mitigaban las zonas de protección del río. Manifestó, actualmente el resto de su propiedad corre el peligro de ser invadida y desaparecida, incluyendo nacientes y árboles reforestados. Acotó, estas actuaciones han “podido provocar los daños”, como la pérdida de aproximadamente dos hectáreas de su finca, que estima en ¢100.000.000,00; así como los árboles reforestados de la especie Melina con un valor de ¢3.000.500,00; y, como perjuicios, los intereses sobre dichas sumas, hasta el momento efectivo de su pago, mas el costo que pericialmente se determine para la recuperación de las nuevas zonas de protección a reforestar y labores de relleno, que estima en ¢20.000.000,00.
Solicita en sentencia se declare: a) la demandada invadió injustificadamente y “desapareció” un área que formaba parte de la finca de su propiedad, Partido de Heredia, Matrícula 109230-000, provocando daños y perjuicios; b) por las características del daño no le es posible recuperar el área invadida, pues Indaco la desapareció, pese a no formar parte del área otorgada en concesión, por ende, debe la demandada pagar los daños y perjuicios que se indican en la demanda y en su defecto los que pericialmente se determinen y ambas costas; c) Indaco debe adoptar las medidas de mitigación técnicamente justificables para evitar el lavado continuo del área de la finca así como abstenerse de incursionar en los límites de su propiedad, so pena de incurrir en el delito de desobediencia a la autoridad. La accionada contestó en forma negativa. Opuso las excepciones de prescripción y falta de: derecho y legitimación en su doble modalidad.
El Juzgado rechazó la prescripción, acogió las demás. Declaró sin lugar la demanda, con costas del proceso a cargo de la actora y del incidente de hechos nuevos a cargo de la demandada-incidentada. El Tribunal revocó la sentencia solo en cuanto condenó a la accionada al pago de las costas del incidente de hechos nuevos, el cual resolvió sin especial condenatoria en costas. En lo demás confirmó. Inconforme la actora acude a casación.
II.La casacionista formula tres cargos de naturaleza sustantiva. En el primero, acusa error de hecho e indebida aplicación de las reglas de la valoración probatoria en quebranto del mandato 54 de la Ley de la Jurisdicción Agraria (en adelante LJA), respecto del hecho 7 tenido por probado. Señala, el Tribunal no valora las pruebas en su conjunto y obvia en su análisis el reconocimiento judicial realizado en autos, donde se acredita la cercanía de las labores realizadas por la demandada en relación con las nacientes constatadas en el reconocimiento del 16 de setiembre de 2014, (donde se acredita la naciente y la cercanía de las obras realizadas por la demandada), corriendo un peligro inminente por la cercanía alcanzada por esas tareas. Observa, los testimonios vertidos por los técnicos de la accionada no hacen alusión al peligro que representan para la naciente, las labores realizadas por la demandada, sino que señalan, estos brotes de agua encontrados en su finca no merecen la tutela del mandato 33 de la Ley Forestal (en adelante LF), por considerar no son nacientes.
No obstante, opina, existe prueba suficiente en autos que incluso cita el propio Tribunal, que llevan a concluir, la naciente si requiere protección, a pesar de lo cual, los jueces mencionan, no se pudieron acreditar los daños en la prueba pericial practicada. Esboza, en el reconocimiento judicial se ordenó suspender la extracción de material, precisamente porque su distancia de la naciente no cumple con los 100 metros previstos al efecto. Opina, el Tribunal resuelve en contra de las reglas elementales del sentido común, lógica y verdad real de los hechos, pues el daño no solo se puede acreditar por un medio probatorio aislado (pericial), sino que va más allá, de ahí que exista un error de los jueces al analizar los testimonios, sobre todo el del señor Andrés Villegas Geólogo regente. Expresa, el Ad quem lo descontextualiza por cuanto mencionó, los cuerpos de agua existentes en su propiedad no tienen un régimen de protección, y, en ese sentido, las acciones de acercamiento de la demandada a las nacientes no contrarían lo dispuesto en el artículo 33 de la Ley Forestal.
Agrega, en este mismo sentido se manifestó el Geólogo de la DGM, quien aprobó el estudio de la demandada. Adiciona, ofrece para mejor proveer la recepción de prueba del 29 de octubre del 2018, realizada in situ y en el marco del proceso judicial 14-000220-507-AG, ubicada en la colindancia de la finca, donde los peritos y el funcionario de la DGM, contradice la prueba existente y valorada por el Tribunal. Agrega, también el oficio del Departamento de Aguas OS-847 del 31 de julio del 2013 (folio 500 Tomo ll), donde se dictamina, las aguas existentes en la finca requieren el régimen de protección del canon 33 de la Ley Forestal. Advierte, en dicha prueba, el funcionario encargado de aprobar el proyecto minero de la demandada señala expresamente que para ese inmueble, (conocida como la Isla), antes de la aprobación de la viabilidad ambiental se habían realizado los informes del Departamento de Aguas del MINAET, los cuales descalificaron los brotes como nacientes, de lo cual discrepa la prueba visible a folio 500.
Bajo esta tesitura, apunta, ninguna fuente de agua existente en la finca fue respetada por la DGM al emitir la concesión. Así, comenta, cualquier infracción a los retiros previstos en el ordinal 33 ibídem, se tiene como aceptada por la DGM. Relata, el daño a las nacientes quedó en evidencia durante el reconocimiento judicial supra indicado, desviando el Tribunal el tema de análisis, omitiendo que la demandada si produjo daños a las nacientes y que cualquier menoscabo o irrespeto a los retiros previstos en el artículo 33 ibídem, tanto por el perito como por los geólogos, se concibe como permitido, pese a que el Departamento de Aguas y el propio abogado del Estado, en el marco del proceso 13-006026-1027-CA, dispuso que las nacientes y fuentes de agua existentes en la finca tenían el régimen de protección señalado. De esa forma, expresa, se quebrantan las máximas de experiencia y sentido común, ya que el daño a la naciente existe y se acredita con el reconocimiento judicial, sin que se respetaran los retiros de ley.
Concluye, los peritos establecen que esas nacientes no requieren protección, lo cual desvirtúa el Departamento de Aguas, omitiéndose valorar la prueba aportada en el expediente 13-006026-1027-CA, en perjuicio de lo dispuesto en el artículo 54 de la LJA, por lo cual, su pretensión debió de acogerse. En la segunda inconformidad reclama, al desviar el análisis sobre la necesaria protección de las fuentes de aguas existentes dentro de la finca, el Tribunal obvia que la demandada no acredita haber respetado los retiros de las zonas de protección, sino más bien, que estas fuentes no tienen régimen de protección. Opina, bajo esta tesitura y error de bulto del Tribunal, se omitió aplicar el precepto 11 de la Ley de Biodiversidad en tanto refiere, es de vital importancia prevenir y anticipar las causas potenciales (amenazas) de los elementos de la biodiversidad. También refiere, se da el presupuesto de una amenaza inminente a elementos como nacientes y zonas de protección y por ende deben de adoptarse las medidas correctivas pertinentes.
Considera, la demandada buscó generar dudas sobre si los cursos de agua de análisis tienen o no protección por disposición del canon 33, lo cual contesta el Departamento de Aguas y el propio Abogado del Estado (PGR). Esboza, en el proceso de examen, ante la duda sobre la protección o no de estos cuerpos de agua, el Tribunal debió acoger al menos parcialmente la pretensión tercera de la demanda. Arguye, el A quo quebranta el principio de no regresión, por cuanto existe una medida paliativa adoptada como medida cautelar, que conllevó a la DGM a establecer una barrera de protección de 30 metros para las zonas de protección existentes en la isla, las cuales quedan en peligro al rechazarse la demanda en todos los extremos. En el tercer motivo, endilga, el Tribunal revoca parcialmente la sentencia del A quo, al considerar que como le condenó en costas, lo procedente era denegar las del incidente de hechos nuevos.
No obstante, estima, no fundamenta ni justifica su fallo en el canon 55 de la LJA, sin que en los supuestos de dicho numeral determinen que por el hecho de ser rechazada la demanda principal y existiendo un incidente de hechos nuevos declarado con lugar se deba de eximir en este último el pago de las costas. Opina, esta máxima no la señala la norma, y, el Tribunal distingue donde la ley no lo hace, más aún, en una indebida fundamentación exime a la demandada del pago de las costas del incidente de hechos nuevos sin amparo legal.
III.Tocante a la primera censura, el Tribunal indicó, en el considerando IV. 6 de la sentencia del A quo, se estudian los alcances de la prueba pericial geológica ofrecida (folio 215 a 243 y 275 a 276, ampliada en folios 279), a fin de determinar los hechos acusados, a saber, protección de la naciente, irrespeto de las condiciones de la concesión y de las áreas de protección, además de la omisión de la puesta en marcha de las medidas de mitigación. Opinó, de la experticia se extrae, existe prueba técnica sobre cambios en la morfología del terreno de la actora, que concluye, no son atribuibles a la dinámica de la concesión minera. Apuntó, no existe prueba sobre si hubo invasión en el fundo de la actora o irrespeto a las áreas de protección, dada la temporalidad de los actos acusados. Estimó, no se observan cambios en la ribera del río y se desconocen las medidas de mitigación establecidas en el EIA.
Sobre las nacientes, aclaró, existían, sin que se encontraran en peligro inminente, aunque pudieran haber sido afectadas por la erosión o las causas antrópicas. Dijo, lo que se amplió (folio 279 a 280) y se indicó, fue que la pérdida de terreno de la finca de la actora dio inicio antes de las actividades de extracción de material de la demandada y es atribuible a un factor natural, no como consecuencia de actos extractivos, sino a factores de cambio significativos en la dinámica fluvial que conllevan los cambios morfológicos de la propiedad de la actora. Bajo esta base, estipuló, sobre la cual el fallo apelado se fundó en forma profusa, los daños y perjuicios reclamados no pueden ser achacados a la demandada. Consideró, el artículo 33 de la Ley Forestal establece la obligación del resguardo de las áreas de protección de esos sistemas, mediante la imposición de restricciones de aprovechamiento de recursos forestales, procesos constructivos o de cultivo.
En este caso, afirmó, el hecho probado no. 7 indica que en el terreno existe un cuerpo de agua que corresponde a un brote de caudal permanente proveniente del mismo Río Puerto Viejo, lo cual se constató también en el reconocimiento judicial. Por ello, determinó, lo resuelto no desaplica la normativa citada, pues el objeto del proceso según la pretensión es resarcir los daños ocasionados en la finca de la actora por actos de invasión con maquinaria de la demandada, en zonas no autorizadas en la concesión de extracción de material de cauce de dominio público. En ese sentido resaltó, no se probó que la actividad extractiva de la sociedad accionada ocasionaran las pérdidas reclamadas por la actora en su inmueble. Rechazó el agravio en cuanto a que los testimonios de los señores Adrián Villegas Fonseca y Carlos Cervantes Umaña fueran falsos al afirmar innecesario proteger ese recurso hídrico por no ser una naciente, sino un rebrote del Río Puerto Viejo.
Lo anterior, esbozó, por cuanto la naturaleza de ese cuerpo de agua fue determinada en la prueba pericial, así como en el oficio del MINAE OS-847 del 31 de julio del 2013, donde se informa a la actora en virtud de permiso que solicitaba para la corta de la plantación de melina, que según dictamen emitido por la Dirección de Aguas de ese ministerio, se trataba de quebradas. Agregó, según la Ley Forestal en su canon 33, son áreas de protección las franjas de 15 metros a ambos lados de las riberas de los ríos, quebradas o arroyos, asimismo. Asimismo, expuso, el precepto 34 ibídem prohíbe la corta o eliminación de árboles en las áreas de protección de las riberas de los ríos, quebradas o arroyos. Sobre el testimonio de don Andrés Villegas Fonseca (regente geológico en minuto 31:07 a 50:07 del disco compacto anexo al expediente) este refirió (minuto 49:00 misma ubicación anterior) que no habían nacientes sino rebrotes del Río Puerto Viejo en la propiedad, lo cual coincide con la documental indicada.
Por lo anterior, reveló, al no ser nacientes esos cuerpos de agua, no procede aplicarles medidas de protección pues son afloramientos superficiales de la naturaleza descrita. Argumentó, tales afirmaciones no inciden en lo resuelto en la sentencia, -en cuanto la falta de acreditación del nexo causal entre la acusada invasión con maquinaria de la actora a zonas no permitidas y los daños por erosión de parte de la finca de la accionante-, toda vez que, según la prueba pericial, en tales afloramientos no se detectaron daños, ni en el reconocimiento judicial, además, dentro del área dada en concesión no se ubican esos cuerpos de agua. Agregó, ello fue reforzado por la declaración del regente ambiental (minuto 01:43) quien indicó, en la zona dada en concesión no existen nacientes y que desconocía si dentro de la Isla las había, aunque podían aflorar aguas en lugares de menor energía. También refirió, en esas zonas existen brazos por donde corren las aguas de los ríos y que el agua en búsqueda del nivel natural atraviesa el terreno de islote, por lo cual, no resulta de recibo el alegato respecto a la naciente y su desprotección.
En todo caso afirmó, no se probó que la conducta de la demandada causara los daños y perjuicios alegados en la finca de la actora, ni en cuerpos de agua que contenga ese inmueble, lo cual es importante toda vez que la acción interpuesta es para el reclamo de daños y perjuicios (1045 del Código Civil). A juicio del Tribunal, el tema central del rechazo de la demanda es la ausencia de prueba del nexo causal, pues se determinó, la accionada en el ejercicio de su actividad legalmente autorizada por los entes competentes, cumplió con los requerimientos técnicos y legales que se le impusieron, de ahí que el daño acusado no guarde relación con la actividad minera de la accionante, sino que obedece a una circunstancia natural ocurrida en el inmueble de la actora desde antes del otorgamiento de la concesión de extracción de la accionada. Advirtió, en los considerandos IV y VI, el A quo analiza la prueba en cuestión, concluyendo, la demandada no invadió con su maquinaria los terrenos del actor o cauce no autorizado del río, que pudiera haber generado la pérdida de casi dos hectáreas del inmueble y árboles.
Esgrimió, en la sentencia del A quo se menciona que aunque no se realizaron medidas de mitigación de lavado del islote, acorde a la prueba pericial geológica en el sector sur este y este de la isla durante el periodo 2003-2007 las precipitaciones de los años anteriores aumentaron el caudal y los niveles de erosión, mientras que las excavaciones iniciaron en el 2012 cuando existió una disminución de la precipitación, por lo cual no resultaban necesarias las medidas de mitigación. Finalmente, rechazó cualquier embate en contra de la experticia geológica a través de testigos, por considerarla imprecisa en cuanto a las fechas, o, señalar hechos ocurridos en fechas distintas a la extracción a cargo de la demandada.
V.Observa esta Cámara, respecto del primer agravio, en la especie se tuvo por acreditado, que en la finca propiedad de la accionante, existe una fuente de agua que corresponde en realidad a un brote de caudal permanente del mismo río Puerto Viejo (hecho 7 tenido por acreditado). Asimismo, que el terreno propiedad de la empresa accionante, ha venido erosionándose por el sistema fluvial Rio Puerto Viejo con quien el inmueble colinda en todos sus costados, no por actividad de la accionada. Lo anterior al acarrear y depositar dicho río abundante material litológico aluvial de granulometría diversa en su rivera, lo mismo que vegetación producto de su dinámica natural fluvial, forma en la cual, el río ha socavado en sectores las paredes del costado este de la “Isla”, dejando a su paso exposición del sistema radical de árboles, la aparición de playones con vegetación remanente en el sector sureste.
De ahí que la morfología de la propiedad en conflicto ha tenido erosión por el río, situación que acontece desde el 2003 y 2007, antes del inicio de la concesión a la empresa demandada Indaco (Hecho noveno tenido por demostrado). De mayor importancia aún, no logró acreditar la demandante que la erosión que sufre el inmueble de examen, tuviera su causa en la ejecución de labores de extracción de material por parte de la accionada. Tampoco, que dicha empresa hubiese irrespetado la zona de protección del río al desarrollar su actividad de extracción, o que lo haya hecho a través del fundo del actor, o directamente en esa propiedad, afectando su morfología o su producción agraria (hechos tenidos por no demostrados, del 1 al 9). De esa suerte, no es dable atribuirle afectación alguna a las nacientes que pudieran o no existir en la propiedad de la actora. Menos aún si eso pudo o no probarse mediante prueba testimonial, pues para diferenciar un tipo de brote de agua de otro, claramente se requiere de prueba técnica.
En esa misma línea, tampoco que se haya violentado el mandato 33 de la Ley Forestal, pues, no existió afectación de la finca de examen derivada de obras de la accionada. Más aún en el tanto la prueba pericial y diferentes documentos de la DGM determinaron, no se trata de nacientes, sino del propio río que aflora en el lugar. Lo anterior no contraviene –como se alega-, el oficio del Departamento de Aguas OS-847 del 31 de julio del 2013 (folio 500 Tomo ll), donde se dictamina, las aguas existentes en la finca requieren el régimen de protección del canon 33 de la Ley Forestal, pues es claro, según se indica en el oficio de referencia, se trata de quebradas cuyo radio de protección es de 15 y no de 100 metros, como en el caso de las nacientes. Finalmente, se advierte, no podía generarse daño a las “nacientes”, sin que se acreditara que la demandada realizó actividades extractivas “en la Isla”, situación que no solo no fue acreditada, sino que tampoco ataca el agravio. De esa suerte no existen elementos en la especie para acoger el reclamo por indebida valoración que se apunta.
VI.Tocante al segundo agravio, como se indicara con anterioridad, para los juzgadores acorde a la prueba pericial, los cambios en la morfología del terreno de la actora no son atribuibles a las actividades de concesión extractiva de la demandada. Tampoco, opinan, se probó que hubiese existido invasión en el fundo de la actora. Además, tuvo por un hecho demostrado, que la pérdida de terreno de la finca de la actora dio inicio antes de las actividades de extracción de material de la demandada, lo cual era atribuible a un evento de la naturaleza. En cuanto a los supuestos cuerpos de agua existentes en la propiedad, los juzgadores indicaron, dicha “naciente” corresponde a un brote de caudal permanente que proviene del propio Río Puerto Viejo. Así las cosas, no cabe argumentar un desvío del tema sobre la necesaria protección de las fuentes de aguas existentes dentro de la finca, cuando de las probanzas no se extrae afectación alguna al inmueble de la actora, originada en actividad extractiva por parte de la accionada.
De esa suerte es claro, no pueden acogerse pretensiones conforme al precepto 11 de la Ley de Biodiversidad sin que se haya acreditado el daño, la invasión a la finca de examen por parte de la accionada, o que sus conductas hubiesen causado la erosión y demás consecuencias que según la prueba pericial, se debe a hechos de la naturaleza y no de la demandada. Conforme a dicho esquema argumentativo el cargo deberá de rechazarse, pues el proceso está sustentado en un reclamo indemnizatorio, cuyo nexo causal por los supuestos daños ocasionados, no resulta atribuible a la accionada, de ahí que tampoco sea de recibo el alegato en torno a un desvío del tema de interés por parte del Tribunal, pues es clara la ausencia de prueba de la alegada invasión o daño a la finca de la actora por parte de la demandada. Por las razones expuestas el cargo deberá rechazarse.
VII.Referente al tercer embate, el Juzgado acogió parcialmente el incidente de hechos nuevos formulado por el personero legal de la empresa demandante. Acogió los hechos materiales concretos expuestos numerados del uno al quinto, y rechazó el 6 y 7, por constituir una reiteración del hecho 6 contenido en la demanda inicial. En lo tocante a dicho incidente, impuso a la accionada-incidentada el pago de las costas procesales originadas en el incidente. El Tribunal, con fundamento en el mandato 55 de la LJA revocó la condenatoria en costas del incidente de hechos nuevos, para en su lugar resolver sin especial condenatoria en este extremo, dado que la demanda se declaró sin lugar. Sobre el particular, estima esta Cámara, el Tribunal actuó la norma, considerando que, como la demanda fue declarada sin lugar, carecía de sentido imponer las costas del incidente de hechos nuevos, a la accionada-incidentada, puesto que esta última resultó vendedora. De esa suerte, no se observa el Tribunal haya incurrido en violación alguna a la norma 55 de la LJA al declarar sin especial condenatoria las costas del incidente de cita, pues desde su óptica no existían elementos para imponerlas a la vencedora, razón que obliga al rechazo del cargo.
POR TANTO
Se confirma la sentencia recurrida.
