Document Review *091600690465AG* Res. 002248-C-S1-2019 FIRST CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at thirteen hours fifty-five minutes on the twenty-ninth of August, two thousand nineteen.
In the ordinary proceeding (proceso ordinario) brought by Mr. KURT EUGENE VAN DYKE against RENÉ ANTON KESSLER PORTMANN, VERÓNICA RODRÍGUEZ KELLY, and the STATE, the Agrarian Court of the Second Judicial Circuit of San José rejected the sua sponte declination of jurisdiction based on subject matter (inhibitoria de oficio por razón de la materia) by the Agrarian Court of the First Judicial Circuit of the Atlantic Zone to hear this matter and ordered the case file returned to the court of origin. The State expressed its disagreement, and the matter was therefore referred to this Chamber for review.
CONSIDERING
I.The plaintiff brings an ordinary proceeding seeking a judgment declaring: A) With respect to Mr. René Anton Keesler and Mr. William Verónico Rodríguez Kelly, the following: “Based on the facts stated, the law invoked, and the evidence attached, I respectfully request that this ORDINARY ACTION FOR A DECLARATION OF SUPERIOR RIGHT TO POSSESSION (DEMANDA ORDINARIA DE DECLARATORIA DE POSESIÓN DE MEJOR DERECHO) be granted and that the defendants be ordered not to disturb possession (posesión) of the properties at issue. That it be declared that the defendants have not exercised possession of the properties quietly, openly, peacefully, uninterruptedly, in good faith, and under a claim of ownership. That the defendants be ordered to refrain from disturbing my free use and enjoyment of the properties as their owner in possession. That it be declared that, having acquired the related properties through acquisitive prescription (prescripción positiva), the undersigned is entitled to obtain title through a possessory title proceeding (información posesoria), the instrument transferring title (documento de título traslativo de dominio) being fully valid and effective.
That it be declared that the undersigned has exercised acts of possession (actos posesorios) quietly, openly, peacefully, and continuously, acting as owner of those same properties, such acts of possession consisting of forest regeneration, keeping the boundary lanes clear, and keeping the properties duly demarcated. That the defendants be ordered to pay all costs” (Page 6 of the physical case file). Pursuant to the joinder of an indispensable defendant (integración de Litis Consorcio Pasivo Necesario) ordered by the Agrarian Court of the First Judicial Circuit of the Atlantic Zone in an interlocutory judgment issued at 15 hours on 10 de mayo de 2010, on page 108, the plaintiff requests, with respect to the State, a judgment declaring: “Based on the facts stated, the law invoked, and the evidence attached, I respectfully request that this ORDINARY ACTION FOR SUPERIOR RIGHT TO POSSESSION (ORDINARIO DE POSESIÓN DE MEJOR DERECHO) be granted and that I be restored to the free use and enjoyment of the properties at issue, for which reason I request that possession thereof be returned to me.
That the defendants be ordered to refrain from disturbing my free use and enjoyment of the properties as their owner in possession. That I be permitted to obtain title because all necessary and indispensable requirements for adverse possession (usucapión) to vest have been satisfied. That the defendants be ordered to pay all costs.” (page 123 of the physical case file).
II.By a ruling issued at 9 hours on 06 de marzo de 2018, the Agrarian Court of the First Judicial Circuit of the Atlantic Zone sua sponte declined to hear this matter for lack of subject-matter jurisdiction and referred it to the Agrarian Court for a determination of jurisdiction. The Agrarian Court, in turn, by a ruling issued at 11 hours 28 minutes on 16 de abril de 2018, rejected that declination and ordered the case file returned to the court of origin. It held: “These are claims that, given the nature of the property involved, may and must be resolved by the agrarian courts, which are also required to apply environmental law in cases warranting it. Therefore, because the ruling of the first-instance judge was improper, the ordered declination of jurisdiction must be rejected. It is hereby declared that jurisdiction to conduct these proceedings lies with the Agrarian Court of the First Judicial Circuit of the Atlantic Zone, sitting in Limón (...)”.
The State expressed its disagreement with that ruling and argued: “(…) the land at issue in the proceeding is located within the State Natural Heritage (Patrimonio Natural del Estado) (Refugio Nacional de Vida Silvestre Gandoca Manzanillo) and the maritime-terrestrial zone (zona marítimo terrestre); and under recent rulings of the First Chamber of the Supreme Court of Justice, jurisdiction lies with the contentious-administrative courts (…)”. (electronic case file: “10/05/2018 8:24:01 -Appeals against a Judicial Ruling/File Submission - STATEMENT OF DISAGREEMENT-2,24MB /Add Document -May 10 2018 8:24AM”). Accordingly, the matter was referred to this Chamber for review. III.- Article 13 of Ley Forestal N° 7575 provides: “The State Natural Heritage shall consist of the forests and forestlands (terrenos forestales) within national reserves, areas declared inalienable, properties registered in its name, and properties belonging to municipalities, autonomous institutions, and other Public Administration bodies, except for real property securing credit transactions with the National Banking System that becomes part of their assets.
The Ministry of Environment and Energy shall administer the heritage. When appropriate, through the Office of the Attorney General of the Republic, it shall register the lands in the Public Property Registry as individually identified properties owned by the State. Non-governmental organizations that acquire real property containing forest or suitable for forestry, using funds from donations or the public treasury that were obtained in the name of the State, shall transfer such property into the State’s name”. In turn, Article 14 of that same Law provides: “The forestlands and forests constituting the State Natural Heritage, as detailed in the preceding article, shall be exempt from attachment and inalienable; their possession by private parties shall create no right in their favor, and the State’s action to recover title (acción reivindicatoria) to such lands shall not be subject to any statute of limitations.
Consequently, they may not be registered in the Public Registry through a possessory title proceeding, and both their invasion and occupation shall be punished in accordance with this Law”. In addition, Article 108 of the Biodiversity Law provides that, until specialized environmental courts exist, the Agrarian Jurisdiction shall hear all matters involving private parties, while matters involving the State are reserved for the Contentious-Administrative Jurisdiction. Specifically, it provides: “In biodiversity matters, and until an environmental jurisdiction exists, every dispute shall fall within the exclusive jurisdiction of the contentious-administrative courts. As exceptions to the foregoing rule, offenses against biodiversity shall be adjudicated by the criminal courts; likewise, disputes arising between private parties that involve neither an administrative act nor public-domain property shall fall within the jurisdiction of the agrarian courts”.
It follows from the foregoing that, because the specialized environmental jurisdiction has not yet been created, disputes arising in this area fall, as a general rule, within the jurisdiction of the Contentious-Administrative courts and cannot be deemed to fall exceptionally within the agrarian jurisdiction because the property at issue forms part of the public domain (dominio público).
IV.In the case under consideration, the plaintiff seeks a declaration of superior right to possession over the land described in survey plan L-411060-97, which, according to study ACLAC-PNE-010-2010 issued by the Dirección del Área de Conservación Amistad and appearing on page 267 of the physical case file, is located within the boundaries of the Refugio Nacional de Vida Silvestre Gandoca - Manzanillo. Under these circumstances, because the properties at issue constitute a public-domain area, jurisdiction to hear the proceeding lies with the Contentious-Administrative Jurisdiction (art. 108 Biodiversity Law), which extends to any matter in which the State has a direct interest. Consequently, it is appropriate to declare that jurisdiction to hear this proceeding lies with the Contentious-Administrative and Civil Court of the Treasury of the Second Judicial Circuit of San José.
POR TANTO
It is hereby declared that jurisdiction to hear this proceeding lies with the Contentious-Administrative and Civil Court of the Treasury.

Revisión del Documento *091600690465AG* Res. 002248-C-S1-2019 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, a las trece horas cincuenta y cinco minutos del veintinueve de agosto de dos mil diecinueve.
En proceso ordinario del señor KURT EUGENE VAN DYKE contra RENÉ ANTON KESSLER PORTMANN, VERÓNICA RODRÍGUEZ KELLY y el ESTADO, el Tribunal Agrario del Segundo Circuito Judicial de San José, improbó la inhibitoria de oficio por razón de la materia del Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica para conocer del presente asunto y ordenó devolver el expediente al Juzgado de origen. El Estado manifestó su inconformidad, por lo que se remitió el asunto en consulta ante esta Sala.
CONSIDERANDO
I.La parte actora interpone proceso ordinario para que en sentencia se declare: A) Respecto de los señores René Anton Keesler y William Verónico Rodríguez Kelly, lo siguiente: “Con fundamento en los hechos narrados, derecho invocado y prueba que se acompaña, respetuosamente solicito se declare con lugar la presente DEMANDA ORDINARIA DE DECLARATORIA DE POSESIÓN DE MEJOR DERECHO y se ordene a los demandados a no perturbar la posesión de los inmuebles de marras. Que se declare que los demandados no han ejercido la posesión en forma quieta, pública, pacifica, ininterrumpida, de buena fe y a título de dueños, de los inmuebles. Que se ordene a los demandados se abstengan de perturbar el libre goce que tengo como propietario poseedor de los inmuebles. Que se declare que el suscrito, por haber adquirido mediante prescripción positiva las fincas relacionadas, tenga derecho a titular mediante información posesoria, siendo totalmente válido y eficaz, el documento de título traslativo de dominio.
Que se declare que el suscrito ha ejercido actos posesorios en forma quieta pública, pacifica, continua, comportándome como dueño en los mismos inmuebles, consistiendo esos actos posesorios en regeneración del bosque, manteniendo limpios los carriles, y debidamente delimitados los inmuebles. Se condene a los demandados al pago de ambas costas” (Folio 6 del expediente físico). Por integración de Litis Consorcio Pasivo Necesario dispuesta por el Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica, por auto sentencia de las 15 horas del 10 de mayo de 2010, de folio 108, el actor solicita respecto del Estado, que en sentencia se declare: “Con fundamento en los hechos narrados, derecho invocado y prueba que se acompaña, respetuosamente solicito se declare con lugar el presente ORDINARIO DE POSESIÓN DE MEJOR DERECHO, y se ordene reintegrarme el libre goce y disfrute que tengo en los inmuebles de marras, por lo que solicito se me devuelva la posesión de los mismos.
Que se ordene a los demandados se abstengan de perturbar el libre goce que tengo como propietario poseedor de los inmuebles. Que se me permita titular, por cumplirse todos los requisitos necesarios e indispensables para que la figura de la usucapión se consolide. Se condene a los demandados al pago de ambas costas.” (folio 123 del expediente físico).
II.El Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica mediante resolución de las 9 horas del 06 de marzo de 2018, de oficio, se inhibió de conocer el presente asunto en razón de la materia y lo remitió al Tribunal Agrario para definir la competencia. Por su parte, el Tribunal Agrario, mediante resolución de las 11 horas 28 minutos del 16 de abril de 2018, improbó dicha inhibitoria y ordenó devolver el expediente al Juzgado de origen. Consideró, “Se trata de pretensiones, que por la naturaleza del bien implicado puede y debe ser resueltas por tribunales agrarios, quienes además están obligados a aplicar la normativa ambiental en los casos que lo ameriten. Por ende, al ser improcedente lo dispuesto por la persona juzgadora de primera instancia, debe improbarse la inhibitoria decretada. Se declara este asunto compete tramitarlo al Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica, con sede en Limón (...)”.
El Estado manifestó su inconformidad contra lo resuelto, alegó; “(…) el terreno objeto del proceso se encuentra dentro del Patrimonio Natural del Estado (Refugio Nacional de Vida Silvestre Gandoca Manzanillo) y de la zona marítimo terrestre; y de acuerdo con resoluciones recientes de la Sala Primera de la Corte Suprema de Justicia su conocimiento corresponde a los tribunales contencioso-administrativos (…)”. (expediente electrónico: “10/05/2018 8:24:01 -Recursos contra una resolución Judicial/Incorporar Escrito - ESCRITO DE INCONFORMIDAD-2,24MB /Agregar Documento -May 10 2018 8:24AM”). Por lo anterior, se remitió el asunto en consulta ante esta Sala. III.- El artículo 13 de la Ley Forestal N° 7575 dispone: “El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio.
El Ministerio de Ambiente y Energía administrará el patrimonio. Cuando proceda, por medio de la Procuraduría General de la República, inscribirá los terrenos en el Registro Público de la Propiedad como fincas individualizadas de propiedad del Estado. Las organizaciones no gubernamentales que adquieran bienes inmuebles con bosque o de aptitud forestal, con fondos provenientes de donaciones o del erario, que se hayan obtenido a nombre del Estado, deberán traspasarlos a nombre de éste”. Por su parte, el numeral 14 de esa misma Ley señala: “Los terrenos forestales y bosques que constituyen el patrimonio natural del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley”.
Aunado a lo anterior, el artículo 108 de la Ley de Biodiversidad establece que, mientras no existan tribunales ambientales especializados, corresponderá a la Jurisdicción Agraria todos los asuntos vinculados con particulares, reservando a la Jurisdicción Contenciosa Administrativa, aquellos en los cuales esté involucrado el Estado. Concretamente, dispone: “En materia de biodiversidad y mientras no exista una jurisdicción ambiental, toda controversia será competencia exclusiva de la jurisdicción contenciosa administrativa. Como excepciones de la regla anterior, los delitos contra la biodiversidad serán juzgados por la jurisdicción penal; de igual modo, las controversias que se susciten entre particulares, donde no medie un acto administrativo ni del dominio público, serán competencia de la jurisdicción agraria”. De lo transcrito se deduce, como no se ha creado aún la jurisdicción ambiental especializada, las controversias que se susciten, por regla general, son competencia de la jurisdicción Contenciosa Administrativa, sin que se pueda estimar que es propia de la jurisdicción agraria a manera de excepción, debido a que se está en presencia de bienes que forman parte del dominio público.
IV.El caso de estudio, la parte actora pretende se declare posesión de mejor derecho sobre terreno descrito en plano L-411060-97, el que, según estudio ACLAC-PNE-010-2010 emitido por la Dirección del Área de Conservación Amistad, visible a folio 267 del expediente físico, se ubica dentro de los Límites del Refugio Nacional de Vida Silvestre Gandoca - Manzanillo. Ante esta coyuntura, siendo que estos inmuebles objeto del asunto corresponden a un área de dominio público, es la jurisdicción Contenciosa Administrativa (art. 108 Ley de Biodiversidad), extensiva a cualquier asunto en los que el Estado tenga interés directo, a la que corresponde conocer del proceso. En consecuencia, lo procedente es declarar que el conocimiento del presente proceso corresponde al Tribunal Procesal de lo Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José.
POR TANTO
Se declara que el conocimiento del presente proceso le corresponde al Tribunal de lo Contencioso Administrativo y Civil de Hacienda.
