Ordinary proceeding instituted before the Administrative Litigation Court, Eighth Section, by the State, represented by its counsel, GLORIA SOLANO MARTÍNEZ, identity card 1-0836-0342, attorney, divorced; against VÍCTOR EDUARDO GONZÁLEZ RIVERA, identity card no. 3-0287-0513, married, and GRUPO DE INVERSIONES CORI DE COSTA RICA S.A., corporate identification no. 3-101-132593, represented by Mr. González Rivera and Gustavo Adolfo González Rivera, identity card 9-049-442, marital status not stated. The natural persons are of legal age, their domiciles are unknown, and, with the exception noted, their occupations are unknown.
Justice Aragón Cambronero authored the opinion; and,
WHEREAS
I.On November 4, 2009, the representative of the State, namely the Procuraduría General de la República (hereinafter PGR), filed a contentious-administrative action (demanda contencioso administrativa) against Grupo Inversiones Coris de Costa Rica S.A. (hereinafter Coris). As relevant here, she stated that on August 11, 1973, before notaries public Bernal Ulloa Flores and Jorge Luis Víquez Carvajal, by deed number 524 in volume four of the first notary’s protocol, Mr. Max Blanco Brunetti transferred for consideration to William Carlton Drummond and Muriel Strehlow Empie, both United States citizens residing in Quepos, his “possessory right” (derecho de posesión), allegedly derived from a lease agreement entered into with the Municipalidad de Aguirre, concerning a parcel he occupied in the maritime-terrestrial zone (zona marítimo terrestre) at Playa Rey de Quepos. She stated that on August 8, 1978, by means of a filing submitted to the then Alcaldía de Aguirre y Parrita, both foreign nationals initiated a possessory information proceeding (información posesoria) to obtain title to the land possessed by Mr.
Max Blanco. She stated that the applicants attached cadastral plan number P-15177-74 to their application, which indicated that the property belonged to the Ayuntamiento. She explained that the application was also intended to obtain a lease from the local government. She stated that on May 17, 1979, the Alcaldía de Aguirre y Parrita approved the titling of the land that was the subject of the possessory information proceeding, thereby creating property folio 31355 in the Province of Puntarenas, measuring 120.187,51 square meters, which was recorded in the corresponding Registry on August 28, 1979. She noted that on August 27, 1980, following the death of Mr. William Carlton Drummond, Ms. Muriel Strehlow Empie, as the sole heir and interested party, was awarded the entire property. However, on the following September 4, this possessor sold equal shares of the property to Albert Roland Metz and Josef Pusar, both German nationals, for $100.000,00, creating a first-priority mortgage lien (garantía hipotecaria).
She stated that, because of their default, Ms. Muriel Strehlow Empie instituted mortgage foreclosure proceedings (proceso ejecutivo hipotecario) before the Juzgado Civil de San José, which ordered the property sold at auction; the auction was held on December 13, 1983, at which Muriel Strehlow acquired the property and obtained an order releasing the mortgage. On May 8, 1985, she sold that property for $300.000,00 to Inversiones Corazón S.A., which placed upon it a mortgage secured by mortgage certificates (hipoteca de cédulas) totaling ¢6.000.000,00, represented by six mortgage certificates (cédulas hipotecarias) valued at ¢1.000.000,00 each and maturing on October 31, 1997. She reported that on August 31, 2006, by means of a filing submitted to the Juzgado Civil de Cartago, Mr. Víctor Eduardo González Rivera instituted mortgage foreclosure proceedings against Inversiones Corazón S.A. to enforce the mortgage certificates that had been issued.
She stated that on November 30, 2006, the Court sold the property at auction and awarded it to Víctor González Rivera; the award was approved on April 23, 2007, and the cancellation of the mortgage encumbrance (gravamen hipotecario) was also ordered. She further noted that the Juzgado Civil y de Trabajo de Mayor Cuantía de Aguirre y Parrita was commissioned to place the new owner in possession of the property and that its registration in the Registro Nacional was ordered. She asserted that possession was delivered on August 30, 2007; however, during the proceeding, plan P-15177-74 was submitted, indicating that part of the property to be delivered formed part of Parque Nacional Manuel Antonio, in the Playa el Rey sector. The judge therefore decided to place Mr. Víctor González Rivera in formal possession only and ruled that “material possession shall continue to be exercised by (sic) the Área de Conservación Pacífico Central of the Ministerio de Ambiente y Energía.
Mr. Olger Eduardo Nuñez (sic) Jimenez (sic), in his capacity as Administrator of the Playa El Rey post, is hereby warned that they shall continue (sic) exercising possessory acts over Parque Nacional, including the plaintiff’s property, all relating to the conservation and maintenance of the protected property, without being permitted to carry out any transformation or disposition thereof (sic). It is likewise stated that the rights granted are solely in favor of the plaintiff, and the administration (sic) of the disputed area is authorized to [illegible] […] All the foregoing is so decided in view of a possible conflict between the applicant’s rights and the rights of the Ministerio de Ambiente y Energía with respect to the area, without prejudice to the parties’ right to resort to the appropriate judicial proceedings to resolve their disputes. […]” She asserted that on June 10, 2008, portions of the mortgage proceeding were notarized, submitted to the Registro Nacional, and recorded in the name of Víctor Eduardo González Rivera on October 13, 2008.
She further stated that on November 26, 2008, Mr. Víctor González entered into a trust agreement (contrato de fideicomiso) with Coris, of which he is president and attorney-in-fact with full powers (apoderado generalísimo), for a term of 30 years, transferring to that company ownership of property number 313355, which was duly recorded on January 12, 2009. She alleged that this land is public-domain property (bien de dominio público), because cadastral plan P-15177-74 places it within the maritime-terrestrial zone of Playa Rey, Quepos, in the coastal strip, and it is currently within the boundaries of Parque Nacional Manuel Antonio; consequently, its private registration is legally impossible. She further clarified that, in this matter, no lease agreement, concession (concesión), or use permit (permiso de uso) in the maritime-terrestrial zone of Aguirre was ever granted by the Municipalidad in favor of Max Blanco Brunetti, William Carlton Drummond, or Muriel Strehlow Empie.
Based on this account of the facts, as relevant here, she requested a declaration that property number 31355-000, corresponding to the real property described in plan P-15177-74, lies within lands belonging to the public domain. Accordingly, the ruling of the Alcaldía de Aguirre y Parrita issued at 10 hours 30 minutes on May 16, 1979, which approved the property for registration through possessory information proceedings, is absolutely null and void because it lacks a legal basis, since the land was unlawfully titled within the maritime-terrestrial zone. In this regard, the registration of property 31355 is likewise null and void, and the Registro Nacional must be ordered to cancel it, together with all subsequent registrations. Plan P-15177-74 is also null and void, and the Oficina de Catastro Nacional must therefore be ordered to cancel it. Costs and interest were sought against the defendant.
The defendant denied the allegations and raised the defenses (excepciones) of statute of limitations (prescripción), lapse of the action (caducidad), failure to join a necessary defendant (litis consorcio pasiva necesaria), lack of a legal right (falta de derecho), and the generic plea “sine actioneagit.” In the same filing, it asserted a counterclaim (reconvino). As pertinent here, it stated that on August 11, 1973, Max Blanco Brunetti transferred for consideration to William Carlton Drummond and Muriel Strehlow Empie the possessory rights that he had exercised since October 12, 1970, as well as those of his transferor, Ramón Guevara López, for a period of 10 years, quietly, publicly, peacefully, and under a claim of ownership, over the maritime-terrestrial zone currently known as Playa Rey in Quepos. It stated that the price paid at that time was $25.000,00. It indicated that, following possessory information applications submitted by William Carlton and Muriel Strehlow, the former Alcaldía de Aguirre y Parrita titled the property in question and formalized cadastral plan P-15174-1974.
It clarified that, during that possessory information proceeding, the PGR never objected to the creation of property folio 31355-000, which had been registered in the Registro Nacional for more than 30 years. It also explained that, because Muriel Strehlow was widowed and became the sole owner, on September 4, 1980, she sold the aforementioned property to Albert Roland Metz and Josef Puzar for $100.000,00, and a mortgage lien was created. It stated that, after these purchasers defaulted, the seller sought an auction and acquired the property. It stated that she subsequently sold it to Inversiones Corazón S.A., which issued six mortgage certificates totaling ¢6.000.000,00 and endorsed them to Víctor Eduardo González Rivera on March 21, 2006, who then proceeded to enforce them. It noted that Mr. Víctor González acquired the property at auction and that it was registered in his name on April 23, 2007.
It stated that, in light of the foregoing, the Juzgado Civil y de Trabajo de Aguirre y Parrita was commissioned to deliver possession, which occurred on August 30, 2007, with Mr. Víctor González being placed in formal possession of the property and the Área de Conservación Pacífico Central del Minaet being placed in material possession, because the land was located within Parque Nacional Manuel Antonio at Playa Rey. It stated that this land fell within the exception regime established by the Ley sobre la Zona Marítimo Terrestre (LZMT), insofar as it was deemed part of the city of Quepos under section 6 of that Law. It stated that, when the property was titled, it did not form part of Parque Nacional Manuel Antonio; in fact, according to its expert surveyors, a portion of the property measuring more than 7.000 square meters does not form part of the maritime-terrestrial zone. It further noted that, through Decreto Ejecutivo número 29177-MINAE, published in the official gazette La Gaceta, number 243 of December 19, 2000, the lands encompassing property 31355-000 were incorporated into Parque Nacional Manuel Antonio without any expropriation having occurred, even though the property was then registered in the name of Inversiones Corazón S.A. It asserted that it must not be overlooked that Coris acquired the property through a judicial auction, and the auction notice contained no indication of any restrictions or unlawful acquisitions.
It asserted that since 1979, for more than 30 years, this land had remained registered in the Registro Nacional, that many persons had invested money in the property in reliance on the public registry records (publicidad registral), and that the corresponding municipal taxes had been paid over time. Based on this account of the facts, it requested that it be declared the owner of the land. Accordingly, it maintained that neither the title giving rise to the registration nor the registry entries (asientos registrales) could be annulled. In its counterclaim, it requested that the State be ordered to cease interfering with its property by bringing annulment proceedings. It requested restitution of the property so that it could exercise material possession. It requested payment of the damages and losses (daños y perjuicios) caused, to be assessed during enforcement of the judgment (ejecución de sentencia); notwithstanding the foregoing, it quantified them as follows: ¢100.000.000,00 in damages because it had been prevented from exercising full ownership over the property, since the State held material possession.
The losses consisted of the interest not earned on that amount, which it estimated at ¢5.000.000,00. It requested that the State be ordered to expropriate the property because property 31355-000 had been affected by Decreto Ejecutivo 29177-MINAE, and that it be paid the value of the property. It sought both sets of costs against the State. In the alternative, it requested a declaration that, until this proceeding was filed, the property had no registry notation or warning. It had acquired the property in good faith, in reliance on the public registry records and in its capacity as a good-faith third party (tercero de buena fe). If annulment of the registration entry were ordered, the State would be required to compensate it for damages and losses, which must include the current value of the land and take into account the amounts paid over 30 years, “in accordance with the corresponding inflation and indexation,” to be determined during enforcement of the judgment. It also sought costs against the State.
The latter answered in the negative and raised the defenses (excepciones) of lack of legal entitlement (falta de derecho) with respect to the principal claim; as to the alternative claim, lack of legal entitlement and lack of standing, both active and passive (legitimación activa y pasiva). At the preliminary hearing, Mr. Víctor Eduardo González Rivera was joined to the proceedings in his personal capacity and granted 30 days to answer the complaint. He answered in the negative. He asserted the defenses of failure to join necessary parties (falta de integración de la litis), because, in his view, William Carlton Drumond and Muriel Strehlow Empie know many things about the matter, and at least the latter should be a party to these proceedings; statute of limitations (prescripción); expiration of the statutory period (caducidad); lack of legal entitlement; and the generic plea “sine actione agit.” In that same proceeding, he filed a counterclaim (reconvino).
He alleged the same facts and sought the same relief as Coris in its counterclaim. The State’s counsel answered in the negative, raised the statute of limitations as a preliminary defense (defensa previa), and raised the remaining defenses in terms identical to those asserted against Coris’s counterclaim. At the preliminary hearing, the following ruling was issued: “The preliminary defense raised by counsel for the plaintiff is denied; because it is unnecessary, no ruling is made on the defense asserted by the State.” The Court also reserved for determination in the judgment on the merits the issues of expiration of the statutory period and the statute of limitations raised by the co-defendants, and rejected the statute-of-limitations defense asserted by the State entity against Víctor González Rivera’s counterclaim. The Tribunal rejected the statute-of-limitations and expiration-of-the-statutory-period defenses raised by the co-defendants.
It likewise rejected the defense of lack of legal entitlement and the generic plea “sine actione agit.” It granted the complaint in the following terms: 1- Property 35355-000 lies entirely within the maritime-terrestrial zone (zona marítimo terrestre) and may not be registered in the name of third parties. 2- The resolution issued by the Alcaldía de Aguirre y Parrita at 10 hours 30 minutes on 16 de mayo de 1979, which approved the “proceedings” for possessory title proceedings (información posesoria) instituted in expediente 178-78, is absolutely null and void. 3- The registration of the property is annulled, and the Registro Nacional is ordered to cancel it, as well as all subsequent registrations affecting the property. 4- Given that the land forms part of the public domain (demanialidad), registered cadastral survey plan (plano catastrado) P-15177-74 is annulled, and its cancellation by the Oficina de Catastro del Registro Nacional is ordered.
It ruled without a special award of costs (sin especial condena en costas). With respect to the counterclaims of Coris and Eduardo González Rivera, it rejected the statute-of-limitations defense raised by the State. It upheld the defense of lack of legal entitlement with respect to the principal claims. It rejected the defenses of lack of active and passive standing relating to the alternative claim. It upheld the defense of lack of legal entitlement relating to those requests. It denied the counterclaims in all respects. Without a special award of costs. Once the judgment became final, it ordered the lifting of the interim measure (medida cautelar) consisting of vacating the notice of the complaint entered against the property’s registration; it maintained the order issued to the Ministerio de Ambiente, Energía y Telecomunicaciones to stay any administrative proceeding intended to grant any right or authorization over the property; it ordered the Municipalidad de Aguirre to refrain from issuing construction permits for the land in question unless necessary to maintain the proper balance of the ecosystem and the application had been endorsed by the Área de Conservación Pacífico Central del Ministerio del Ambiente, Energía y Telecomunicaciones; it ordered the defendant company to refrain from building, demarcating boundaries with fences or cleared strips, or carrying out any activity that would alter the property’s current conditions; it ordered that the property’s registration be frozen (inmovilización de la finca); and it maintained physical possession in favor of the Área de Conservación.
The motion for supplementation and clarification (gestión de adición y aclaración) subsequently filed by the co-defendants was denied by the Tribunal. Dissatisfied, both counterclaiming co-defendants jointly filed an appeal on points of law (recurso de casación).
Cassation Appeal on Procedural Grounds
II.They assert the following three grounds of this type. First: they state that there has been a defect in the composition of the necessary joinder of defendants (litisconsorcio pasivo necesario). In this regard, they argue that, because one of the claims seeks cancellation of the registration of the property, all persons who were owners of the property at any time must be joined in these proceedings, since, in their view, the decision directly affects them and, moreover, they might be entitled to compensation. They also contend that these persons, as co-defendants (codemandadas), could consider filing a claim against the person from whom they acquired the property. They cite case law from this Chamber. The foregoing is based on Article 12 of the Code of Administrative Procedure (Código Procesal Contencioso Administrativo, CPCA). Second: they state that they have been left entirely without a defense (indefensión), insofar as the original title to property number 31355-000, as well as the subsequent registry entries, are being ordered annulled, thereby preventing them from bringing an action against the previous owners of the property under the warranty against eviction and warranty of title (garantía de evicción y saneamiento).
They further explain that the Tribunal reversed the burden of proof (carga de la prueba) by finding that the property had not been registered pursuant to the exception established in Article 6 of the LZMT, even though it was proven that the property was acquired in 1979, that the city of Quepos was declared as such in 1969 and included Playa Rey, and that it was not until 1980 that the boundaries of that city were established. They state that the PGR submitted no evidence refuting the foregoing, yet the Tribunal nevertheless found that no evidence demonstrated that the land was located in an urban area (zona urbana). Third: they contend that the judgment lacks reasoning (motivación). They state that the facts deemed proven show that the property was acquired through a possessory title proceeding (proceso de información posesoria), in which the PGR participated without raising any objection.
Likewise, they note that the judgment stated that the property belonged to the public domain (dominio público), even though it had already been demonstrated that Playa Rey was part of the city of Quepos. Thus, the lack of reasoning arises because the adjudicator has a duty to analyze the procedural matters and substantive issues raised by the parties, as stipulated in Articles 119 and 122 subsection m), both of the CPCA, as well as Article 155 of the Code of Civil Procedure (Código Procesal Civil; hereinafter CPC); yet the judgment does not set forth the grounds on which the corresponding decision was adopted.
III.Regarding the first claim of error (agravio), alleging a problem with the necessary joinder of defendants, the appellants in cassation (casacionistas) maintain that, because one of the claims seeks cancellation of the registration of the property, all persons who ever owned it must be joined in the proceedings, given that they might be entitled to compensation. In this regard, it is appropriate to reproduce that request verbatim: “[…]
IV.Regarding the second claim of error, in which the co-defendants allege that they have been left without a defense because, in their view, the judicial decision prevents them from bringing an action against the former owners of the property and from exercising the warranty against eviction and warranty of title, it must be stated that these are remedies available to one person to assert a claim against another in relation to the property, and that such remedies may be enforced through judicial proceedings. In this case, contrary to the appellants’ view, there is no such lack of defense, since they are in no way being deprived of their right to bring a direct claim against whomever they believe must compensate them, much less of their right to institute judicial proceedings against whomever they deem necessary in order to obtain protection of their rights. They also raise a second issue in this objection, relating to an evidentiary matter, but that disagreement concerns an issue on the merits; consequently, its consideration will be deferred until the claims of error of that type are analyzed.
Appeal on Substantive Grounds
V.Under this category, they allege the following five grounds. First: they state that the judges excluded technical evidence favorable to them, thereby contravening the provisions of section 82 of the CPCA. They assert that the record contains documents showing that the land described in survey plan P-15177-74, which corresponds to property 31355-000, lies outside the maritime-terrestrial zone (zona marítimo terrestre); this is also stated in the expert report (peritaje) of surveyor José Ramón Gutiérrez González, which concluded that an approximate portion of 7.000 square kilometers of the property in question was located outside the maritime-terrestrial zone. In addition, they assert that, according to the expert report of professional Luis Ángel González Alfaro, an area of 16.676 square meters of the land lies outside the maritime-terrestrial zone. Therefore, they argue, that strip cannot be treated as though it were subject to that legal regime.
Along these lines, they maintain that if the State wishes to appropriate that parcel, it must expropriate it and may not take advantage of the fact that a portion of the property is subject to that regime in order to take ownership of the whole. They state that the Court did not provide sufficient reasons for its judgment, because it merely asserted that the measurement parameters used to determine the high-tide zone (zona de pleamar) were imprecise. They contend that the judges should have thoroughly explained why they found the expert report less credible (they do not specify which report they mean), instead of accommodating the State’s claims and treating the witnesses called by it as expert witnesses. They clarify that the PGR erred in its conclusions and that this may have confused the Court, insofar as the State’s representative considered that the expert had omitted the mangrove area (zona de manglar), thereby undermining the expert report; the truth, however, is that the mangrove area is not contemplated in the LZMT because Article 10 states that the zone consists of two sections: the public zone (zona pública) and the restricted zone (zona restringida); mangroves constitute only part of the public zone.
They assert that the evidentiary error occurred because greater weight was given to the testimony than to the expert report; moreover, the testimony is ambiguous, imprecise, and entirely accommodating to the plaintiff, and it should be taken into account that the witnesses have at some point been public officials. They argue that it is wholly illogical for the challenged judgment to have rejected as imprecise the expert work produced by Luis Ángel González Alfaro when the inaccuracies leading to error are found in the testimony offered by the PGR. They explain that this is the case with the testimony of Julio Bustamante Bustamante, from which the Court highlighted the following statement: “[...] Parque Manuel Antonio consisted of ninety-eight percent wetlands and two percent (sic) dry land [...]”, without explaining why it assumed that the disputed land falls within that 98%; such an assertion can be made only on the basis of technical evidence.
They add that it must not be forgotten that Parque Nacional Manuel Antonio was expanded in the year 2000, many years after the property in question was registered, by which time a vested legal situation (situación jurídica consolidada) already existed. This must be understood, they state, to mean that before Parque Nacional was expanded, the disputed property did not form part of it. Accordingly, they argue, if the State wishes to appropriate the property, it must expropriate them as required. By proceeding in this manner, sections 352, 353 and 401 of the CPC have been violated by assigning testimonial evidence (prueba testifical) evidentiary weight that it does not possess. They contend that the most serious evidentiary violation involves the witness Bustamante Bustamante, who stated in his testimony that the property was crossed by artificial “criques,” which clearly rules out wetlands or mangroves.
They maintain that, without any evidence, the Court asserts that the property in question lies within the maritime-terrestrial zone and is covered by wetlands; yet it does not accept the position that approximately “seven and one thousand and seventeen thousand (sic) square meters” lie outside that zone, which is consistent with the testimony of Bustamante Bustamante. They state that it cannot be determined that wetlands exist on the land, understood as a surface that is temporarily or permanently flooded, regulated by climatic factors, and in constant interaction with the living beings inhabiting it, as established by the Ramsar Convention. They note that, in this case, there is a dispute as to whether the channels at the site are natural or artificial, an issue that can be resolved only through an expert report. In this regard, they assert that the record contains the expert report of Luis Ángel González Alfaro, to which the judges assigned reduced weight without further explanation, and it should be noted that this expert was appointed by the Court itself.
If the judges believed that Luis Ángel González Alfaro’s technical training was not appropriate, they argue, the proper course would have been to request another expert report. They state that the judgment establishes that a portion of the property is located outside the maritime-terrestrial zone. Nevertheless, it also finds that wetlands belonging to Parque Nacional Manuel Antonio exist in that portion, based on the testimony of one witness, who stated that 98% of the area encompassed by Parque is covered by wetlands, although the State’s representative did not prove this because the land in question is not covered by wetlands. They point out that the Court presumed, based on testimony, that the property lies within the maritime-terrestrial zone, even though the testimony did not specifically concern the parcel at issue (predio en litis) but instead consisted of accounts about Parque, making the statements imprecise and uncertain.
They assert that the judges overlooked the fact that the burden of proof (carga probatoria) in this case rested with the State, because it is the party claiming that the property lies within the maritime-terrestrial zone, yet it never submitted technical evidence supporting its assertions; the PGR’s case, endorsed by the Court, is based solely on testimony. They assert that the record demonstrates, pursuant to official letter ACOPAC-011-11 of 20 de febrero de 2011, issued by Ronald Chaves of Área de Conservación del Pacífico Central, that before the promulgation of Decreto Ejecutivo 29177-MINAE in the year 2000, Playa Rey did not form part of Parque Nacional Manuel Antonio, and that privately owned lands must be expropriated if the State wishes to appropriate them. In addition, in their view, the report issued by José Mattey Fonseca on 18 de febrero de 2011 describes the land depicted in plan P-15177-1974 as not being entirely covered by mangrove; although it states that the land was once entirely mangrove, it does not specify the extent to which it has recovered or provide any basis supporting that assertion.
What must be clear, they state, is that if mangroves have been created at the site, they were created through human activity, which means that they are not natural but artificial. They argue that there is no evidence from which the condition of the land before 1949 can be verified because, they assert, it is common knowledge that aerial photographs did not exist for that date. They note that the testimony of Luis Quirós discounts the knowledge that Cori’s representatives had of the location and extent; however, Luis Quirós testified that he did not know the area or the land in question well, at least before the year 2005, yet he nevertheless asserts that the territory consists of wetlands. They state that this is not proof that the entire disputed property consists of wetlands, although that is the Court’s conclusion. They explain that the judges’ error may lie in believing that Luis Quirós appeared as an expert witness when he actually appeared as a witness; the only expert in this case is Luis Ángel González Alfaro.
They argue that this case concerns a property right (derecho de propiedad) enshrined in section 45 of the Constitución Política; therefore, to annul the title, there must be absolute certainty that the disputed property lies within the maritime-terrestrial zone and is wetland, and the only acceptable evidence for that purpose is an expert report. They further contend that the Instituto Geográfico Nacional report entitled “Photointerpretive study to determine whether the land depicted in cadastral plan no. 15177-1974 is located within an area naturally owned by the State, Quepos district” (“Estudio fotointerpretativo para determinar si terreno en plano catastrado no. 15177-1974, se localiza dentro del área propiedad natural del Estado, lugar distrito Quepos”), issued in undated official letter DEGEO-019-11, was improperly assessed in disregard of the rules of reasoned judgment (sana crítica).
They maintain that the document stated from its introduction that the property under study lay within the maritime-terrestrial zone, which plainly diminishes its credibility. They further state that the report claims, based on “Figure 2,” that the land in question, described in plan 15177-1974 as shown in the 2005 orthophotograph, is located within wetland and mangrove areas, whereas the correct conclusion, readily apparent from visual inspection, is that sections of that area do not possess those characteristics, page 454 of the case file. In any event, they state, the instrument used by that Instituto is unreliable because it used only “Digital Files, Shape format, of mangrove, wetlands, and the boundary of Parque Nacional Manuel Antonio (Quepos-Savegre Cartography, scale 1:50.000”. They note that another deficiency in this study is its conclusion that the land described in plan 15177-1974 lies within wetlands, based on its examination of photographs from the years 1947-1949 and 1961, which are absent and were not attached to the report.
Second: they assert that the ruling is contrary to the legal system because the Court erroneously relied on Article 6 of the LZMT to decide the matter, thereby also violating the principles of legality and non-retroactivity of the law (irretroactividad de la ley) with respect to Ley 3201 of 1963. They argue that the judgment deemed it proven that Quepos was declared a city in 1963 (Ley 3201); that before 1980 there was no boundary demarcation for the city of Quepos excluding Playa Rey; and that the property at issue in these proceedings lies within Quepos, but that when the registration resulting from the possessory information proceeding (información posesoria) occurred, the LZMT was already in force and, therefore, the property could be excluded only if it was located in a coastal city. They state that the foregoing demonstrates that a vested legal situation existed before the city of Quepos was demarcated in 1980 and that, in 1963, when Ley 3201 was promulgated, Playa Rey formed part of Quepos.
They point out that, as established by section 34 of the Constitución Política, a law cannot be applied retroactively; thus, the requirement that urban development exist at the site in order for section 6 of the LZMT to apply was imposed contrary to law, and it must be taken into account that such development does not exist today, much less when the property-ownership situation involving the property described in plan P-15177-74 became vested, by which time Quepos had already been granted city status. They insist that the possessory information proceeding described in that plan, now registered under real-property folio (folio real) 6-31355-000, was conducted in accordance with the legal system. They further maintain that Article 6 itself establishes that the provisions of that law cannot be applied to the property in question because it formed part of the city of Quepos. They emphasize that when the property was registered, it did not lie within the boundaries of Parque Nacional Manuel Antonio; it became part of it only when Parque was expanded in the year 2000.
According to a report dated June 3, 2009, they assert, prepared by the Programa de Regularización de Catastro, the property is located within the land covered by the expansion of the Park, which is a logical consequence. Third: in their view, the rules governing administrative liability (responsabilidad administrativa), as well as sections 455 and 456 of the Código Civil and section 1 of the Ley del Inscripción de Documentos en el Registro Público, have been violated. In this regard, they assert, the Court held that the State bears no financial liability (responsabilidad patrimonial) for improvements that may have been made to the land. The judges themselves, they state, accepted that Coris acquired the property in question in reliance on its registration in the property registry, on the basis of mortgage certificates (cédulas hipotecarias), which are negotiable instruments (títulos valores), duly issued by the Registro Nacional and evidencing a credit right (derecho de crédito) in favor of Víctor Eduardo González.
On this point, they note, the issue is not whether the property in question is public property; the critical issue is trust in the Registro Nacional as the specialized state body with jurisdiction over such matters. They add that public notice through the property registry (publicidad registral) guarantees legal certainty (seguridad jurídica) for those subject to the Administration, who may safely acquire property on the assumption that registry entries are complete, accurate, and lawful; therefore, a good-faith purchaser (adquirente de buena fe) must be compensated for having relied on such public notice. Failure to recognize this compensation, they note, violates the principle of equality in bearing public burdens (principio de igualdad en el sostenimiento de las cargas públicas), because if the registration from which the right arises is subsequently declared void, liability must be imposed.
Thus, they state, Mr. González Rivera acquired and enforced the mortgage certificates secured by the land in question, registration number 313555-000, in good faith and in reliance on the public notice provided by the registry; this created a situation that must be understood in light of the principle of legitimate expectations (principio de confianza legítima), as established in section 1 of the Ley de Inscripción de Documentos en el Registro Público. In this case, they state, state liability arises in two ways: 1- by virtue of the accuracy that the Registro Nacional is presumed to provide; 2- due to the failure of state bodies to take action to recover the property. They explain that this inaction did not cease until 2009, when the PGR filed the complaint, and the counterclaim was filed on October 21, 2010, such that a statute-of-limitations defense (prescripción) could not be asserted.
Article 190 of the Ley General de la Administración Pública (LGAP), they contend, establishes the Administration’s obligation to answer for its operations; in the case at issue, liability is not only fault-based (subjetiva) because of the alleged omission, but also strict (objetiva), because Víctor González acquired the territory in question from Coris through enforcement of the mortgage certificates, which were backed by the Registro Nacional. In this regard, they maintain, the existence of harm is clear because the State’s failure to act and take possession of the property prevented the co-defendants from becoming aware of the possibility that their ownership right might be defeated, which would plainly have influenced their intent to enter into the contract. They reiterate that, in the case of Mr. Víctor González, strict liability arises from the act of registering the property in his name and from the fact that the acquisition was made in good faith in 2007; in the case of Coris, liability would have arisen in 2009 upon registration of the property in its name.
The loss of the real property, they state, constitutes pecuniary damage (daño material); it was acquired for ¢90.000.000,00 in mortgage foreclosure proceedings (proceso ejecutivo hipotecario). Fourth: they allege violations of sections 1, 6, 9, 10, and 11 of the LZMT, as well as misapplication of Ley número 3201 de 1963 (except for the cited section 6, which instead was not applied); they likewise allege violations of the principles of non-retroactivity of the law and legality. The Court, they state, held that the land was in the public domain (dominio público) and, because it was located in the maritime-terrestrial zone (zona marítimo terrestre) and formed part of Parque Nacional Manuel Antonio, it could not have been registered through possessory title proceedings (información posesoria) in 1979. In their view, although the territory in question lies within that area, the fact remains that, under section 6 of the LZMT, the parcel is located in what was considered part of the city of Quepos in that year; in other words, Playa Rey belonged to that city.
It was not until 1980 that the boundaries were changed and Quepos was delimited differently. They further add that, pursuant to section 6, Quepos must be understood to fall within the exception established therein, and that the judges’ conclusion that this provision should not apply because the existence of urban development sufficient to qualify the place as a city had not been proven is invalid. By proceeding in this manner, they state, the judges draw a distinction that the law does not make and construe the ownership right restrictively. They warn that it is unclear what authority the Court relied upon to distinguish the concept of a city using technical and subjective criteria concerning the existence or absence of urban development, when, under the cited article 6, the only thing that can define a city is its designation as such by law. In this regard, they assert, it is likewise unacceptable to reject the possessory title proceedings on the basis of the property survey plan (plano de la finca), which indicated that the real property was municipally owned, or to apply the view that the agreement assigning possessory rights (contrato de cesión de derechos posesorios) held by those who completed the titling process was a lease within the Pacific maritime mile; as has been explained, when the legal system provided for the possibility of acquiring private ownership of a portion of the maritime-terrestrial zone, as indicated in transitory provision II of Ley 4558, which removed 150 meters of the 200 from public-domain status (desafectaron), private parties who had possessed the real property for more than 30 years were authorized to obtain title to it, including those who held leasehold rights with the municipalities.
Fifth: they allege violations of sections 455 and 456 of the Código Civil, article 45 of the Constitución Política, section 1 of the Ley sobre inscripción de documentos en el Registro Público, and section 190 of the LGAP. They state that, because the property was acquired in reliance on the Registro Nacional, was duly registered, and had benefited from public notice through the registry for 40 years, it is clear that if it is now deemed public-domain property, they must be compensated accordingly. The plaintiff, they note, should have prevented registration of the land, and its negligence in failing to do so renders it liable. They further contend that the constitutional principle of equality before the law, established in section 33 of the Carta Magna, has been violated because, if the landowner were a United States national, that person could, under the Tratado de Libre Comercio con Estados Unidos, bring a claim before an international arbitration center for having made an investment in Costa Rica and would most likely prevail.
In addition, they contend, sections 455 and 456 of the Código Civil have been violated because, from 1979 to the present—that is, for more than 40 years—the real property 31355-000 has remained registered in the Registro Nacional; it must therefore be understood and presumed that anything not expressly appearing in the registry entries does not exist as a matter of law. Many people have invested money in that parcel, they assert, always in reliance on good faith in the registry (buena fe registral) and with the understanding that it fell within the exception established in the LZMT. They present a doctrinal discussion of public notice through the registry. Accordingly, they conclude, neither the entry registering property 31355-000 nor the possessory title proceedings from which the title arose may be annulled. In their view, the State is strictly liable because, even if annulment of the registration is legally permissible, it cannot prejudice rights acquired in good faith.
All of this, they assert, is consistent with section 144 of the LGAP, insofar as an administrative act (acto administrativo) may not be enforced to the detriment of good-faith third parties, and any injury to individual rights (derechos subjetivos) must be compensated in full. They state that section 456 of the Código Civil was violated through failure to apply it, insofar as a declaration of nullity (declaratoria de nulidad) issued against property titles held by persons other than those who initiated the titling proceedings cannot prejudice them because they are good-faith purchasers; therefore, if the title is declared void, the property must be “preserved” through its monetary equivalent. This applies, they state, not only to the value of the property but also to the amounts paid in taxes and public utilities, because the State cannot benefit from its own neglect. Relief sought (Petitoria): that the Court’s judgment be reversed and the complaint dismissed. That the counterclaim be granted as to its principal claim or, alternatively, as to its subsidiary claim. That the State be ordered to pay costs.
VI.With regard to the first ground of appeal, it is important to note that the appellants on cassation raise several objections; accordingly, this challenge will be divided into different issues to be analyzed in the following order: a) Failure to state reasons for the judgment: they contend that the judges merely stated that there was a lack of precision in the measurement parameters used to determine the high-tide zone (zona de pleamar). They did not explain in depth why they found the expert report (peritaje) less credible. The Tribunal was accommodating toward the State’s claims because it accorded its witnesses the status of expert witnesses. This occurred with witness Julio Bustamante Bustamante, who stated that 98% of the land consists of wetlands (humedales). However, the Tribunal does not explain why it assumes that the land at issue lies within that 98%, since such an assertion could be based only on technical evidence. b) Failure to consider evidence (preterición de prueba): they also contend that the expert report by surveyor José Ramón Gutiérrez González was improperly assessed; this professional indicated that more than 7.000 square kilometers of the land lie outside the maritime-terrestrial zone (zona marítimo terrestre).
The same applies to the expert report by Luis Ángel González Alfaro, an expert appointed by the Tribunal, who concluded that at least 16.676 square meters of the property at issue do not lie within the maritime-terrestrial zone. These portions of land cannot be treated in the same manner as the remainder of the property. c) Assessment of the evidence (valoración de la prueba): Julio Bustamante Bustamante stated that the parcel was crossed by artificial “creeks” (“criques”), which would logically rule out the presence of wetlands and mangroves (manglares). The dispute over whether those channels are natural or artificial can be resolved only through an expert examination. The proper course was to request additional technical evidence. The Tribunal found that an area of the land did not lie within the maritime-terrestrial zone, but that it contained wetlands and was within the National Park.
In doing so, it relied solely on witness Julio Bustamante Bustamante’s statement that 98% of the area encompassed by the National Park consists of wetlands, which was never proven. Official Letter Acopac-011-11, drafted by Ronald Chaves, stated that before Decreto Ejecutivo 29177-Minae, Playa Rey was not part of Manuel Antonio, which further supports the argument that expropriation was required. Mattey Fonseca’s report concerning plan P-15177-1994 shows that the parcel was not entirely covered by mangroves; it states that the parcel was once covered, but does not specify in what proportion, and there is no basis for that assertion. Luis Quirós, who appears in these proceedings as a witness rather than as an expert, stated that he was not familiar with the land before 2005. Instituto Geográfico Nacional Report Degeo-019-11 establishes that the parcel lies within the maritime-terrestrial zone and is located in wetland and mangrove areas; however, the property does not have such characteristics, and the study is based solely on records and photographs dating from 1949, 1961 and 1974, which were not attached to the report.
As for the expert report by Luis Ángel González Alfaro, he stated in his report that a portion of the land lay outside the maritime-terrestrial zone. The appellants insist that the condition of the land must be considered, since Parque Nacional Manuel Antonio has changed in recent years. By 2000, a vested legal situation (situación jurídica consolidada) already existed, prior to the expansion of the Park, and it must be taken into account that the land at issue was not part of it. The mangroves in the area are man-made. There is no evidence whatsoever indicating what the land was like before 1949. The PGR’s argument that the expert report was flawed because it did not consider the mangrove area is untenable because the mangrove is not within the maritime-terrestrial zone; under the delineation established in Article 10 of the LZMT, mangroves constitute only part of the public zone (zona pública).
The judgment gives greater weight to the witnesses than to the expert report, even though their testimony is ambiguous and imprecise. The burden of proof (carga de la prueba) rests with the State, which was required to demonstrate the condition of the land through technical evidence.
VII.Regarding the failure to state reasons. This Chamber does not agree with the appellants’ assertions, as will be explained. In this specific case, a complete reading of the judgment makes clear that the determinations made by the judges are supported by different items of evidence, which provide the basis for the final decision. In this regard, the judgment sets out a series of arguments based on the report prepared by the Programa de Regularización de Catastro and Official Letter ACOPAC-OT-055-09 from the Programa de Ordenamiento Territorial del Área de Conservación Pacífico Central del Sistema de Áreas de Conservación, which concludes that the property at issue lies within the restricted zone (zona restringida) and the public zone because it is located within the National Park. Along the same lines, the judges refer to the provisions of the contract that gave rise to the possessory title proceeding (información posesoria).
They also rely on the report and sketch prepared by José Ramón Gutiérrez González, as well as the expert opinion (dictamen pericial) of surveyor Luis Ángel González Alfaro. The challenged judgment also relies on the testimony of Luis Alberto Quirós Rodríguez and Julio Bustamante Bustamante. It also contains an analysis of plan P-15177-74. The foregoing demonstrates the examination conducted by the Tribunal, on the basis of which it resolved the dispute submitted for adjudication. The testimony of Mr. Bustamante Bustamante and the expert report are merely part of the evidence supporting the judges’ reasoning. Accordingly, this Chamber finds no failure to state reasons for the judgment, and this challenge must therefore be denied.
VIII.Regarding the failure to consider evidence. The evidence that the appellants claim was not assessed consists specifically of the report by José Ramón Gutiérrez González and that of expert Luis Ángel González Alfaro. However, as can be seen at folio 666 of the case file, the judges clearly refer to both documents and assess each of them. The Tribunal stated: “[…] The evidence offered to refute the location consisted of a sketch and report prepared by surveyor José Ramón Gutiérrez González, appearing at folios 209 and 291 of the court file, and the expert report submitted by Luis Ángel González Alfaro, who stated that part of the property (sixteen thousand six hundred seventy-six square meters) is not located within the inalienable zone (zona inalienable). The Tribunal finds that neither the written expert report nor its explanation in the statement given by the expert at the oral and public trial is credible, for the following reasons: as the Procuradora stated in her closing arguments, there were inaccuracies in the surveyor’s use of the measurement parameters when determining the high-tide zone.
Furthermore, his professional training is in surveying, and his work was therefore limited to measuring the property without taking the mangrove area into account. Even if his assessment was that it was not an estuary (estero), he does not have the professional training required to determine (sic) express an opinion regarding the presence of mangroves within the measured area. That circumstance was established by the witnesses presented by the State, Luis Alberto Quirós Rodríguez and Julio Bustamante Bustamante, who testified regarding their presence and importance in their capacity as Agricultural Engineers. Witness Bustamante Bustamante testified that Parque Manuel Antonio consisted of ninety-eight percent wetlands and two percent dry land (tierra firme). Mention must also be made of cadastral plan (plano catastrado) P-15177-74, which indicates the presence of the estuary along the property’s northern boundary.
The same conclusion must be reached regarding the measurement performed by surveyor Gutiérrez González […]”. It is evident that the Tribunal did address those two items of evidence; that is, it did not ignore them. Consequently, the alleged failure to consider evidence could not have occurred, and therefore the statutory violation claimed by the appellants on cassation does not exist. The ground of appeal must accordingly be denied.
IX.Regarding the improper assessments of evidence (valoraciones de prueba). The judges begin their discussion by stating that, based on the contract signed by Mr. Blanco Brunetti and the spouses Carlton Drummond and Strehlow Empie, the land in question lies within the maritime mile and that the deed executed before notaries Bernal Ulloa Flores and Jorge Luis Víquez Cerdas clearly refers to an unregistered property constituting a “leasehold right” within the Pacific maritime mile. Plan P-15177-74, which serves as the basis for the possessory proceedings (información posesoria), specifies that the land is owned by the Municipalidad de Aguirre. The judges therefore considered it evident that this property had been leased by the Municipalidad, rather than held under a right of possession asserted through possessory proceedings to obtain title to the property. The judgment also states that the report prepared by the Programa de Regularización de Catastro, dated 3 de junio de 2009, which has neither been discredited nor shown to be inaccurate, establishes that the property in question lies within the maritime-terrestrial zone (zona marítimo terrestre), partly within the restricted zone (zona restringida) and partly within the public zone (zona pública).
Following this reasoning, the Court refers to official letter ACOPAC-OT-055-09 of 18 de mayo de 2009, issued by the Programa de Ordenamiento Territorial del Área de Conservación de Pacífico Central del Sistema de Áreas de Conservación, which states that, according to plan P-15177-74, the land lies within Parque Nacional Manuel Antonio, a finding that, in the Court’s view, was likewise not rebutted. Based on these two reports, the decision concludes that the property lies within the maritime-terrestrial zone and contains mangroves (manglares), as well as estuaries (esteros) and marshlands (áreas pantanosas). Accordingly, the judges found the property’s public-domain status (demanialidad) evident, not only because it belongs to Parque Nacional Manuel Antonio, but also because it is located within the lands described above. The judges further state that the property’s status as public-domain property (bien demanial) was not contested by the co-defendants, since they instead request expropriation.
The Court then analyzes the expert report (peritaje) of Luis Ángel González Alfaro, which states that an area of 16.666 square meters of the property in question does not lie within the inalienable zone (zona inalienable). The judges, however, did not find that assertion credible because, in their view, the surveyor used imprecise measurement parameters when determining the high-tide zone (zona de pleamar), as he failed to account for the mangrove area. Moreover, in their view, the fact that the professional was trained as a surveyor and that his work was limited to measuring the property rendered him unqualified to express an opinion concerning the presence of mangroves within the measured area. The judges did find, however, that the existence and status of the area as mangrove and wetland (humedal) had been established by the witnesses Luis Alberto Quirós Rodríguez and Julio Bustamante Bustamante, both agricultural engineers; and the latter’s testimony confirms that Parque Nacional Manuel Antonio consists of 98% wetlands and 2% dry land.
The Court considers this reasoning consistent with plan P-15177-74, which identifies the presence of an estuary along the northern boundary. As for surveyor Gutiérrez González, they state that his report contains no specification whatsoever concerning the mangrove zone. The judges therefore conclude that the property in question lies within the maritime-terrestrial zone, not only because of its extent, but also because of the presence of mangroves and wetlands. All of this, they state, was proven by the State and not rebutted by the co-defendants.
X.Since its enactment, the LZMT of 16 de marzo de 1977 has established, insofar as relevant to this case, in article 1, that the maritime-terrestrial zone forms part of the national patrimony, belongs to the State, and is inalienable and not subject to acquisitive prescription (imprescriptible). It entrusts protection of the zone and its natural resources to the State, its institutions, and all inhabitants of the country. The second paragraph of section 3 of that same law, in turn, provides that the use and administration of the maritime-terrestrial zone, including both the public zone and the restricted zone, are vested in the municipality having jurisdiction. Section 6 states that the provisions of that law do not apply to areas of cities situated along the coasts, to properties lawfully registered in the names of private individuals, or to properties whose lawful status is recognized by statute.
Section 7 thereof provides that land situated within this zone may not be the subject of possessory proceedings and that private individuals may neither appropriate it nor legalize it in their own names by that or any other means. Section 9 thereof defines the maritime-terrestrial zone as the strip 200 meters wide extending along the entire Atlantic and Pacific coasts of the Republic, regardless of its nature, measured horizontally from the ordinary high-tide line (línea de la pleamar ordinaria), together with the land and rocks exposed by the sea at low tide. It also includes maritime islands, islets, and crags, as well as any land or natural formation rising above ocean level within Costa Rica’s territorial sea, except Isla del Coco, which is under the State’s direct ownership and possession, and any other islands whose ownership or administration is determined by that law or by special laws.
Likewise, section 10 LZMT clarifies that the maritime-terrestrial zone comprises two sections: a) the so-called PUBLIC ZONE, consisting of the strip 50 meters wide measured from the ordinary high-tide line and the areas exposed during low tide; and b) the RESTRICTED ZONE, consisting of the remaining strip of 150 meters or, in the case of islands, the remaining land. Islets, crags, and other small areas and natural formations rising above the sea belong to the public zone. Section 11 thereof states that the public zone must also be understood to include, regardless of its extent, the area occupied by all mangroves along the mainland and island coasts and by all estuaries within the national territory. Section 20 thereof provides that, subject to the exceptions established by law, the public zone may not be occupied under any title or under any circumstances. Moreover, no person may claim any right over it.
The first paragraph of section 34 of that same law states that the municipalities must directly oversee the conservation of the maritime-terrestrial zone and its natural resources. Section 39 provides that concessions (concesiones) may be granted only within the restricted zone, except as otherwise specially provided by law; this Chamber must note that precarious permits to use the public domain (permisos de uso de dominio público de contenido precario) are also available, as stipulated in section 154 of the Ley General de la Administración Pública. This is supplemented by article 40 LZMT, which provides that only municipalities may grant such concessions. Section 41 of that law, in turn, establishes that concessions shall be granted solely for the use and enjoyment of specified areas within the restricted zone, for the term and subject to the conditions established by that same law. In this regard, it should be noted that, in the case under review, it has not been shown that any process was undertaken to declare the defendants, or any person who previously occupied the land, to be the concession holder (concesionario) of the parcel.
Accordingly, from this perspective, they cannot be characterized either as concession holders or as lessees (arrendantes). Continuing with the statutory analysis, section 71 thereof establishes the absolute nullity (nulidad absoluta) of all acts, contracts, agreements, and provisions carried out or adopted after the enactment of law number 5602 of 4 de noviembre de 1974 (the law suspending Ley número 4558 of 22 de abril de 1970, known as Ley de Urbanización Turística de la Zona Marítimo Terrestre). Finally, section 82 thereof declares that law to be a matter of public policy (orden público) and repeals law number 4558 and its amendments.
XI.In determining the legally appropriate disposition, it is also important to consider the provisions of the aforementioned Ley 4558 of 22 de abril de 1970. Section 6 established that the 50 meters of the maritime-terrestrial zone measured from the ordinary high-tide line were inalienable and under no circumstances could be leased or sold. Consequently, no person could claim any right over that strip, which was dedicated to public use for leisure, recreation, or free passage. Article 7 stated that the remaining 150 meters inland could be leased, but established certain guidelines. Section 8 provided that, after the maximum lease term of 10 years, municipalities could sell the leased parcels to interested parties who requested their purchase. The third transitory provision of that law, however, removed the public-domain designation (desafectación) from those 150 meters in cases involving private individuals who had possessed lots or properties, requiring only possession for more than 30 years in a quiet, public, peaceful, and uninterrupted manner and allowing them to register those properties through possessory proceedings.
That transitory provision, however, was promptly repealed by Ley 4847 of 4 de octubre de 1971, meaning that it remained in force for only 17 months. Subsequently, as noted, article one of Ley número 5602 of 4 de noviembre de 1974 suspended the effectiveness of Ley 4558 until a new law was enacted. Section 3 thereof further provided, however, that no beach or maritime or river island governed by Ley 4558 could be sold, leased, or subleased during the period in which that law was suspended, without prejudice solely to any extensions of leasehold rights warranted under the legal system. It ordered municipalities to refrain from granting construction permits for buildings on land possessed pursuant to rights conferred by Ley 4558.
XII.In the case under consideration, it is undisputed that Max Blanco Brunetti and the spouses William Carlton and Muriel Strehlow, on August 11, 1973, signed a contract in which they stated, as appears at folio 31 of the case file: “[…] that by this instrument Mr. Blanco Brunetti sells in equal shares to William Carlton Drummond and Muriel Strehlow Empie, who accept, his unregistered property, consisting of a leasehold right in the Pacific Maritime Mile (Milla Marítima del Pacífico), comprising agricultural land with a wooden dwelling, located in ‘El Rey’ of Marítima, first district, canton of Aguirre, Province of Puntarenas, and bounded to the north, with a saltwater estuary between it and Rigo Cardela; South (sic), the Pacific Ocean, with frontage of one thousand three hundred twenty-five meters; east, Bernardo Espinoza Cordero; and West (sic), a public road, with one hundred ninety-five meters (sic) of frontage.- Its area is: twenty-two (sic) hectares, eighty-three meters, twenty-five decimeters, eighty square centimeters.- It is free of encumbrances.- Together with the property, the seller transfers the possession exercised since October twelfth, nineteen seventy, and that of its previous owner, Mr.
Ramón Herrera López, for a period of more than ten years, in all cases quietly, publicly, peacefully, continuously (sic), and under a claim of ownership.- The sale price is the sum of twenty-five thousand dollars […] Both parties expressly acknowledge that this property is located within the Pacific Maritime Mile and therefore shall jointly submit an application to the Municipalidad de Quepos so that Mr. Blanco’s lease may be duly transferred to the Drummonds.- […]”. As shown by the statutory analysis undertaken in the preceding recitals (considerandos), the only time when the 150 meters of the restricted zone (zona restringida) were removed from the public domain (desafectados) was pursuant to transitory provision III of Ley 4558 of April 22, 1970; however, that provision was repealed shortly thereafter, on October 4, 1971, by Ley 4847. The aforementioned contract was entered into on August 11, 1973, that is, outside the 17-month period during which this 150-meter strip could be acquired as private property, and it is evident that Mr.
Max Blanco Brunetti never acquired ownership rights over that zone. At this point, it must be noted that, although the contracting parties asserted in their transaction that the contract was a purchase and sale agreement, as such it had a legally impossible subject matter because Blanco Brunetti was not the owner of the land at issue and, as explained, it has not been established in these proceedings that he held title as the concession holder (concesionario) of the property, since there is no evidence even that proceedings for its recognition had been initiated or, alternatively, that he held any type of permit from the Municipalidad. Notwithstanding the foregoing, he transferred the parcel to the Carlton Strehlow couple. Furthermore, it cannot be overlooked that the contracting parties themselves expressly stated that what they were negotiating was the Maritime Mile and that the appropriate course was to take the necessary steps before the Municipalidad to continue the lease and obtain its assignment, if such a lease existed, which was not established.
Notwithstanding the foregoing, as correctly stated by the plaintiff and the co-defendants, in 1978 those foreign nationals initiated possessory-title proceedings (información posesoria) to obtain title to the land, even though by that time the LZMT of March 16, 1977 had already entered into force and, as shown, precludes the granting of title within the 200 meters of the maritime-terrestrial zone (zona marítimo terrestre). Indeed, it declares such land inalienable and not subject to acquisitive prescription (imprescriptible), as well as not subject to possessory-title proceedings, thereby denying private parties the possibility of appropriating that land or legalizing it in their names. It also clearly establishes that only concessions (concesiones) may be granted in the restricted zone, a matter entrusted to the respective local government. Despite the foregoing, in decision number 138 at 10:30 a.m. on May 17, 1979, the judge of the Alcaldía de Aguirre y Parrita stated that all requirements imposed by the Ley de Informaciones Posesorias had been satisfied in the possessory-title proceedings and deemed it established, insofar as relevant here, that Mr.
William Carlton and Mrs. Muriel Strehlow were the owners of the unregistered property, which they valued at ¢50.000,00 and had acquired by purchase. The judge likewise found that each of them had possessed it publicly, quietly, peacefully, and without interruption, as lawful owners, for more than 10 years. That judge also found that a survey plan (plano) had been duly recorded with the Catastro Nacional. He then approved the registration of the parcel that was the subject of the possessory-title proceedings because, in his view, the requirements established by that Law had been satisfied. He ordered the Registro Público de la Propiedad to register the property in the applicants’ names, without prejudice to third parties having superior rights. It must also be noted that the ruling in those possessory-title proceedings has the effect of formal res judicata (cosa juzgada formal), which is reviewable in proceedings such as these, where the ruling does have the effect of substantive res judicata (cosa juzgada material); for that reason, it is necessary to proceed to the following analysis.
The contract states that the property has 1.325 meters of frontage facing the Pacific Ocean and a depth of 195 meters, with the public road forming its western boundary. From this statement, it is clear and evident that the property, or at least a large portion of it, lies within the 150 meters of the restricted zone provided for in the LZMT. Thus, even though a judicial decision ordering that title to the property be granted was issued, the fact remains that it was a judicial act contrary to law and subject to review in ordinary proceedings, as urged by the Procuraduría General de la República, because the LZMT in force at that time prohibited the issuance of such a decision. Moreover, as shown, section 71 thereof declares null and void all acts (with the law making no distinction limiting them strictly to administrative acts, but also encompassing judicial acts), contracts, agreements, and provisions that contravene that statutory framework.
Accordingly, as the Tribunal correctly held, that judicial decision must be annulled because it is evident that the property at issue lies within the maritime-terrestrial zone and is a protected zone (zona protegida), a circumstance asserted by the appellants on cassation (casacionistas) themselves, who acknowledge it, as is also apparent from the appeal; it is therefore concluded that they hold no ownership rights whatsoever over this portion of the parcel.
XIII.On the other hand, the appellants in cassation (casacionistas) allege that the Tribunal did not find it proven that part of the land was located outside the maritime-terrestrial zone (zona marítimo terrestre), because it improperly assessed several items of evidence. Thus, first, reference must be made to the expert examination (peritaje) conducted by professional Luis Ángel González Alfaro, who carried out the study in February 2013 and submitted his report at the oral and public trial held in July 2014. As appears from folio 522, the expert stated in that study: “[…] IT IS CONFIRMED THAT THE PROPERTY AT ISSUE, REGISTERED UNDER REAL PROPERTY FOLIO NO. 6031355-000, OWNED BY GRUPO DE INVERSIONISTAS DE COSTA RICA SOCIEDAD ANÓNIMA, IS LOCATED OUTSIDE THE BOUNDARIES OF PARQUE NACIONAL MANUEL ANTONIO, BUT WITHIN THE MARITIME-TERRESTRIAL ZONE. / ACCORDING TO MY FIELD STUDY, IT IS ALSO ESTABLISHED THAT THERE IS AN AREA OF THE PROPERTY BORDERING ESTERO GARITA (NORTH OF THE PROPERTY) THAT IS NOT LOCATED WITHIN THAT ZONE. / ITS AREA (sic) IS 16666 SQUARE METERS.
(SEE ATTACHED PLATE). […] CONCLUSION […] IT IS VERY CLEAR THAT A LARGE PART OF THE PROPERTY IS LOCATED WITHIN THE MARITIME-TERRESTRIAL ZONE. / THE PART THAT IS NOT (sic) WITHIN THIS ZONE WAS DETERMINED WITH THE ASSISTANCE OF THE POINTS SURVEYED IN THE FIELD USING GPS. / THIS EXCLUSION ZONE HAS AN AREA OF 16666 SQUARE METERS.” Subsequently, at the oral trial (10:15:15), when asked whether there was an estuary (estero) on the property he visited, the expert stated: “[…] I may be confused at this moment as to whether it is a canal or an estuary; in fact, I would say that it is more likely a canal, because a canal, unlike an estuary—the estuary has a great deal of vegetation, which we are all familiar with: tall roots and all of that, right—and I do not recall having seen that. I simply see it as a canal. […]” It is evident that there is a discrepancy between Mr. Luis Ángel González’s testimony and what was written in his report, and it is unclear whether the feature at the northern boundary of the property is actually an estuary or a canal.
However, this Chamber does not find the expert’s answer during the trial credible, because this change of opinion occurred under particular circumstances. Counsel for the State asked the expert whether he had seen an estuary along the northern boundary, a question to which the co-defendants objected. When the Tribunal allowed counsel to explain the objection, counsel, together with the question itself, prompted the answer by asserting that there was indeed an estuary to the north, whereas their position was that there was a canal at that northern point. This statement was made while the expert was in the courtroom, and it was thereafter that he wavered in his conclusion and gave the answer quoted above. This leads this Chamber to conclude that the professional responded to the co-defendants’ leading question. In addition, it must be noted that throughout his presentation, Mr. Luis Ángel González repeatedly stated that he did not remember the property very well, since he had performed the work a long time before and had not reviewed the study prior to the trial.
This reinforces what was stated in the report, which, it bears clarifying, makes no mention whatsoever of the existence of a canal. Likewise, the weight given to the testimony of witness Luis Alberto Quirós Rodríguez is also challenged; in the appellants’ view, it was treated as expert evidence (prueba pericial), when in fact it was witness testimony. This adjudicatory body does not agree with that assertion, as explained below. The expert witness (testigo perito o experto) (pursuant to Articles 106 and 107 of the CPCA and provision 302 of the LGAP), as shown in the video (11:23:22), is an employee of Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía (abbreviated as Sinac). He is an agricultural engineer and was in charge of the Área de Conservación for a period of almost three years, from November 2006 to June 2009, during which time he was responsible for the administration of Parque Nacional Manuel Antonio.
He stated that Playa Rey was incorporated into the Park precisely because it was a wetland area (zona de humedal). He also stated that it is almost impossible to build there because beyond the beach there is a wetland, consisting of open water and a mangrove swamp (manglar); hence the difficulty of erecting any infrastructure there. When asked about the feasibility of agricultural activity in the area, he answered that the only adaptable crop would be rice, because the area consists of patches on the water’s surface. In fact, he confirmed that what lies beyond the beach is a mangrove swamp, where nothing can be cultivated except mangroves. He further asserted that he had never witnessed agricultural activity on the land in question; had such activity taken place, they, as the responsible authorities, would have acted and prevented it. Expert witness Julio Bustamante Bustamante testified similarly, as may be seen in the video (14:17:20).
He is also an agricultural engineer and holds a master’s degree in agroforestry or forestry. He works for Sinac and, based on his expert knowledge, explained what a wetland consists of. Likewise, he referred to mangrove swamps in the Playa Rey sector associated with estuaries located at the mouth of Río Naranjo, and to mangrove swamps at the mouth of Río Savegre. He stated that Playa Rey is secluded and has no electrical infrastructure, which is why the olive ridley sea turtle (tortuga Lora), in particular, comes there to lay its eggs. He also highlighted the presence of the Pacific black sea turtle (tortuga Negra del Pacífico), as well as the occasional arrival of the leatherback sea turtle (tortuga Baula). He contends that the hawksbill sea turtle (tortuga Carey), which nests in the undergrowth, has also occasionally been seen. Along these lines, he explained that, of the eight species of sea turtles in the world, six come to the Pacific coast to lay their eggs.
He also testified that he was unfamiliar with the property in question, but that there were no houses or other structures in the area. The only thing he mentioned was the existence of a “crique,” which he described as a man-made structure for draining land. Thus, as can be seen from the foregoing evidence, expert witness Quirós Rodríguez was unequivocal in stating that what lies on the northern side of the disputed property is an estuary, which is consistent with the written expert report. Of particular relevance to this Chamber is the fact that this witness knows the location very well and, given his profession, repeatedly stated that the area in question consists of wetlands and mangrove swamp. The fact that he began working in the area in 2005—that is, five years after Playa Rey was incorporated into the Parque Nacional—is irrelevant, because what matters is that his testimony establishes his knowledge of the location.
Now, the expert testimony of Mr. Julio Bustamante Bustamante is ambiguous as regards the property at issue, since he repeatedly stated that he was unfamiliar with it; he therefore could not state with certainty whether there is an estuary or a canal along the northern boundary, or consequently establish whether the location is 98% wetland, as he asserted. Thus, his testimony cannot confirm whether an estuary or mangrove swamp exists along the northern boundary. Nevertheless, this Chamber does not consider these witnesses to be biased in favor of the State; both merely provided a broad explanation of the role and nature of Parque Manuel Antonio in the ecosystem of the locality, the region, the country, and even the continent. Both were unequivocal in stating that a mangrove swamp and an estuary exist there. It is now essential to mention the Ramsar Convention, signed by Costa Rica and in force since April 27, 1992, Article 1 of which defines a wetland as follows: “1.
For the purposes of this Convention, wetlands are areas of marsh, fen, peatland, or water, whether natural or artificial, permanent or temporary, with water that is static or flowing, fresh, brackish, or salt, including areas of marine water whose depth at low tide does not exceed six meters.” This concept resolves a point disputed in these proceedings: for an area to be considered a wetland and thus qualify for protection, it is immaterial whether it was created by nature or by human beings, that is, whether it is natural or artificial. In addition, it is also important to note that an examination of cadastral plan (plano catastrado) P-15177-74 shows that, along its northern boundary, a small portion of the property borders a canal, but another large portion borders an estuary. According to the evidence submitted by the co-defendants themselves, at folios 290 to 292, surveyor Ramón Gutiérrez González states that an area of 7.000 square meters lies outside the maritime-terrestrial zone; he highlights that area on the plan at sheet 292 with red hatching.
The following may be noted from the foregoing: 1- the marked area borders only the estuary and not the canal; 2- an analysis of the dimensions specified on the plan shows that segment 7-8 is stated to measure 40.77 meters from point to point and measures 9 millimeters on the map. The longest portion of the area marked in red by Mr. Ramón Gutiérrez measures 5 millimeters on the map. It may therefore be inferred that the area highlighted by the surveyor must have an actual linear depth of approximately 23 meters. Accordingly, an integrated assessment of all the evidence makes it possible to conclude from the expert examination, reports, and testimony referenced above, as well as from cadastral plan P-15177-74, that what lies along the northern boundary of the property at issue is an estuary and mangrove swamp, and that the land demarcated by surveyor Ramón Gutiérrez González—which the defendants claim lies outside the maritime-terrestrial zone—borders the estuary and mangrove swamp.
This does not entail giving the witnesses the weight of expert evidence in the strict sense, because they are what are known as expert witnesses, recognized as a means of evidence (medio de prueba) since 1978 in Article 302, subsection 4, of the Ley General de la Administración Pública, which provides: “…The parties may present expert witnesses whose statements shall be governed by the rules of witness evidence, but may be supplemented as to technical and evaluative matters.” This means of evidence was expressly recognized by the CPCA in provision 107 and, in any event, must be assessed as a whole under the rules of reasoned judgment (sana crítica racional), pursuant to canon 82, section 4), of the CPCA. The report by Mr. José Mattey Fonseca makes the following assertion: “[…] the area and the comprehensive study cited above, which covered (sic) socioeconomic, biophysical, and legal aspects, were analyzed (sic).
It was determined (sic) that the area’s designated use was conservation and that it held the status of public-domain property (bien demanial) pursuant to law 6043. (For which reason (sic) the Playa El Rey² sector (²That is how the site is known by local residents, and not as Playa Savegre, the name that appears appears (sic) on the Quepos map sheet.) was annexed (sic) to Parque Nacional Manuel Antonio by Decreto Ejecutivo N° 29177-MINAE dated November 17, 2000, followed by the eviction and destruction of structures by order of the sala constitucional (sic), voto 4495-03).” This assertion is consistent with the remainder of the aforementioned body of evidence, since it was the area’s conservation purpose and biophysical condition that determined the need to incorporate Playa Rey into Parque Nacional. In addition, the Instituto Geográfico Nacional Report Degeo-019-11 is further evidence demonstrating the condition and nature of the land, as already explained at length.
In that document, statements are made such as the following: “[…] upon overlaying the property survey plan on the various maps from 1947-1949, 1961, and 2003 of the Proyecto Recreativo Manuel Antonio, Quepos-Savegre 1:50.000 map sheets, it is clearly observed that the property is located within wetland-mangrove areas (áreas de humedal-manglar). (See attached maps) [...]”. A review of the attached maps appearing at folios 490 to 492, issued by the Instituto Geográfico Nacional, clearly shows that those maps were prepared using “Field classification and photoplanimetric updating in 1992 with aerial photographs taken by the IGN in 1991”; the foregoing means that, even though the photographs referred to by the appellants were not submitted, the fact remains that those maps, and the conclusion of that Institute, establish that the land is currently located within the wetland (humedal) and mangrove (manglar) area.
Note that figure number two, at folio 454, clearly shows the existence of wetlands to the north of the property at issue, covering nearly its entirety. Mention must also be made of the video of the judicial inspection (reconocimiento judicial), conducted during the interim-relief stage (etapa de medida cautelar), which clearly shows that the site is a wetland. It also borders the mangrove. At minutes 3:58, 5:22, and 8:49 of the video, the footage of the mangrove and mangrove trees is unmistakable, and during that inspection the co-defendants state that most of the property is like this. During the proceeding, Parque officials also emphasize that shrimp and fish larvae develop at the site, because marine life begins in mangroves. Consequently, at this juncture, the following observations regarding the applicable rules should be made. As stated above, section 11 of the LZMT establishes estuaries (esteros) and mangroves as public zones (zonas públicas); it is therefore appropriate and relevant to consider how the legal system defines them.
The Reglamento a la Ley de Conservación de la Vida Silvestre number 32.633 defines mangrove as follows: “An ecosystem dominated by groups of pantropical plant species, typically trees and shrubs, and associated vegetation, which possess morphological, physiological, and reproductive adaptations that enable them to colonize areas subject to tidal exchange. The overall landscape is dominated by the presence of forests comprising different mangrove species, estuaries, and channels. Salinity concentrations vary according to the climatic season and the inflow of inland waters, with salt concentrations ranging from very low to very high.”. On the other hand, section 2 of the Reglamento a la Ley sobre Zona Marítimo Terrestre, Decreto Ejecutivo number 7841-P, lists a series of definitions relevant to this case: “[…] e) Estuary: Land immediately adjacent to the bank of a tidal river over which tidal waters extend; f) Tidal river (ría): The portion of a river near its entry into the sea and extending to the point reached by the tides; g) Tide (marea): The periodic and alternating rise and fall of seawater due to the combined gravitational pull of the sun and the moon; […]”.
The foregoing is significant because, in the case under review, it must be determined whether the northern portion of the land is part of the maritime-terrestrial zone (zona marítimo terrestre), as this is one of the appellants’ challenges and an issue not addressed in the contested judgment. As has been seen, Article 9 of Ley 6043 establishes that the maritime-terrestrial zone consists of a strip 200 meters wide along the entire Atlantic and Pacific coastline, measured from the ordinary high-tide line (pleamar ordinaria), together with the land and rocks exposed by the sea at low tide. This decision also noted that section 10 thereof establishes that this zone consists of two sections: the Public Zone, which is the strip 50 meters wide measured from the ordinary high-tide line and the areas exposed at low tide, as well as islets, crags, and other small areas and natural formations projecting above the sea; likewise, section 11 thereof provides that, regardless of their extent, areas occupied by mangroves along the mainland and island coasts and by estuaries within the national territory shall also constitute public zones.
Thus, according to the definition set forth in the Convención Ramsar, estuaries and mangroves are necessarily located within wetland areas, a clarification required to conclude that these categories are not mutually exclusive. In addition, in the specific case of mangroves and estuaries, it follows that they are affected by the tides; indeed, they contain salt water entering from the sea. Based on this proposition, it may be stated that they are also subject to an ordinary high tide, because it is easy to determine within them when the tide is low or high. The point is that section 11 of Ley 6043 of 2 de marzo de 1977 provides that estuaries and mangroves are public zones; at the same time, when that statute defines the public zone, it establishes as a sine qua non condition that it consist of a strip 50 meters wide measured from the ordinary high-tide line, which would also apply to estuaries and mangroves.
Accordingly, based on a comprehensive analysis of the rules, it must be interpreted that mangrove and estuary areas are afforded protection extending 50 meters from the ordinary high-tide line, which is the defining characteristic of the public zone and, therefore, of the maritime-terrestrial zone. The foregoing means that, although the study of the land depicted in the survey plan submitted by the co-defendants was prepared by surveyor Gutiérrez González, the land was said to have a linear extent of approximately 23 meters; this means that it lies well within the public zone and was inalienable land (área inalienable). This conclusion is further reinforced by the principles governing environmental matters, particularly Ley de Biodiversidad number 7788, which establishes several standards applicable to such matters. As relevant to this case, recourse must be had to the precautionary principle (principio precautorio), or in dubio pro natura, which provides: “When there is a danger or threat of serious or imminent harm to elements of biodiversity and the associated knowledge, the absence of scientific certainty shall not be used as a reason to postpone the adoption of effective protective measures.”.
There is likewise a public environmental interest standard (criterio de interés público ambiental): “The use of the elements of biodiversity shall safeguard the development options of future generations, food security, ecosystem conservation, the protection of human health, and improvement of citizens’ quality of life.”. Accordingly, the portion of the land in dispute must be treated in the same manner as the remainder of the property, since it falls within the regulations of Ley 6043. For all the foregoing reasons, the cassation appellants’ first ground of challenge (reparo primero) must be rejected.
XIV.The second and fourth grounds of appeal (agravios) will be resolved jointly because they concern, in substance, the same objection. In summary, the appellants argue that it must be taken into account that Playa Rey—and consequently the land in dispute—was not incorporated into Parque Nacional Manuel Antonio until the year 2000, and that a prior property right existed. Furthermore, since the creation of the city of Quepos, which included Playa Rey, it must be regarded as a coastal city and therefore covered by the exception in Article 6 of the LZMT; in any event, because Quepos was created before the enactment of the LZMT, the Court could not apply that later law to it. On this point, the judges found that, by the time the “property” title to the parcel was granted through a possessory information proceeding (información posesoria), the LZMT was already in force; moreover, for property to be excluded under those provisions, it must be located in cities situated within a coastal zone.
In the judges’ view, the codefendants’ argument that Quepos had been declared a city in 1969 and that its boundaries had been demarcated in 1980 by the Instituto Geográfico Nacional is not, by itself, a circumstance that makes the property at issue part of the city of Quepos. The Court states that a city requires urban development, which the parties have not proven. Indeed, the judges conclude that the inclusion of Playa Rey in the Parque Nacional demonstrates that it could not have been considered part of the city. This Chamber agrees with the Court’s ruling, as explained below. As stated in the preceding recitals (considerandos), the maritime-terrestrial zone regime (régimen de zona marítimo terrestre) predates Ley 6043 and dates from 1828; consequently, the argument that the creation of the city of Quepos in 1963 extinguished the public-domain status (demanialidad), immunity from acquisitive prescription (imprescriptibilidad), and inalienability (inalienabilidad) of the land in question is unacceptable.
To clarify the issue further, the Constitutional Chamber’s prior holding is relevant: “[…] public-domain property (bienes demaniales) (also known as government-domain property or public-domain property) consists of property having a nature and legal regime different from private property—which is governed by property law under Article 45 of the Constitution—because, by the legislature’s express intent, it is dedicated to the special purpose of serving the community, that is, the public interest, and therefore cannot be privately owned. It is thus outside private commerce and cannot belong individually either to private parties or, strictly speaking, to the State, because the latter is limited to administering and safeguarding it. […] Accordingly, this is property held by the State in its capacity as administrator; it must be understood as property belonging to the ‘Nation’ and therefore forming part of the public patrimony.
Due to its special legal nature, it has the following attributes: it is not subject to acquisitive or extinctive prescription, meaning that the passage of time cannot give rise to a property right over it, or even mere possession; that is, it cannot be acquired through adverse possession (usucapión), nor can it be lost through prescription. For this reason, the use permits granted over it by the Administration are always precarious and may be revoked by the Administration at any time for reasons of expediency or convenience—under the terms set forth in Articles 154 and 155 of the General Public Administration Law—and concessions granted for its use may likewise be canceled through the applicable proceeding. It is immune from attachment (inembargable), meaning that it cannot be subject to any encumbrance or attachment by either private parties or the Administration; and it is inalienable, meaning that it is outside private commerce and therefore cannot be transferred, sold, or acquired, whether gratuitously or for consideration, by either private parties or the State, so that it is excluded from private commerce and subject to a special, reinforced legal regime.
Its use and exploitation are also subject to the police power because, as property that cannot be possessed, much less owned, it may be used and exploited only through duly authorized acts, whether by a concession or a use permit granted by the competent authority, and under the Public Administration’s continuous oversight. […]” Decision issued at 14 hours 13 minutes on February 21, 2007, corresponding to judgment number 2408. This criterion of the Constitutional Chamber merely reaffirms the position adopted by this adjudicative body regarding the maritime-terrestrial zone. It is untenable to conclude that the declaration of Quepos as a city somehow eliminated the land in dispute’s status as part of the maritime-terrestrial zone. Moreover, as the judges noted, the entire case file contains no evidence demonstrating that, when the boundaries of the city of Quepos were demarcated, Playa Rey was excluded from the maritime-terrestrial zone or that, when Ley 3201 was enacted, it abolished Playa Rey’s public-domain status.
That law consists of two articles: the first refers solely and exclusively to conferring the title of city upon the Villas of Quepos and Golfito, and the second concerns its effective date, which begins upon publication. Thus, there is no basis for construing Playa Rey as falling within the exception established by Article 6 of the LZMT; much less can it be asserted that the location is a coastal city, since, as shown by the testimony of the witnesses mentioned in the preceding recitals, it is clear that the location has always been a nature reserve and an area apart from the town, as well as rich in flora and fauna, which is why it was included within Parque Nacional Manuel Antonio beginning in the year 2000. As explained throughout this decision, this ground of appeal must also be denied, since the Court resolved the matter in this manner in the judgment under review.
XV.The third and fifth objections will also be resolved jointly because they concern the same issue, namely administrative liability (responsabilidad administrativa). The judges found that, because the property is located in the maritime-terrestrial zone and is public-domain property, it is immune from attachment, not subject to prescription, and inalienable. Furthermore, because the registration does not comply with the law, it is not perfected through the passage of time, and third-party rights cannot be asserted against it. They further reasoned that, in exercising its administrative self-enforcement authority (autotutela), the Administration is required to recover the property, and reliance on the principle of good faith in the public registry (buena fe registral) cannot preclude annulment of the property title. They therefore conclude that neither the requested restoration of possession nor the request that the State refrain from interference may be granted.
On the contrary, the property must be regarded as public-domain property, with all the attributes thereof. As stated in previous recitals, in the case under review, the legal situation concerning the parcel at issue arose from the application filed by the married couple Carlton Strehlow to acquire the property through a possessory information proceeding, together with the decision of the Alcaldía de Aguirre y Parrita, which, by decision number 138 issued at 10 hours 30 minutes on May 17, 1979, ordered registration of the property in their names. In other words, what occurred was essentially the result of a judge’s recognition of a property right through such a proceeding and order that it be recorded in the Registro Nacional. What had occurred was not called into question until the judge responsible for carrying out the placement in possession (puesta en posesión) noticed that the property was located in the maritime-terrestrial zone and within a national park, and drew attention to the matter.
As explained, this circumstance is the responsibility of the judge who issued that decision; however, it was also previously stated that the judge’s ruling had the effect of formal res judicata (cosa juzgada formal), but not substantive res judicata (cosa juzgada material), meaning that it could be reviewed in ordinary proceedings, as is occurring in this case. Accordingly, pursuant to Article 4 of the LZMT, the Procuraduría General de la República brings the corresponding actions to recover the public-domain property (reivindicar el bien demanial). Based on this reasoning, and given the manner in which the matter is being resolved, the liability that should have been alleged was not that of the Registro Nacional for complying with the judge’s order, but rather the liability of the State in its judicial capacity (responsabilidad del Estado juez) for having granted private parties a right over property in manifest error and contrary to the legal system.
It is therefore entirely irrelevant to the resolution of this matter to analyze the acts issued by the Registro Nacional, because the consequence of this proceeding is the annulment of the registration ordered by the judge in the possessory information proceeding, not the Registro Nacional’s compliance with the judicial directive to register the property. In the case under review, the harm caused to the defendants resulted from the unlawful declaration made by the judge who handled the possessory information proceeding; it bears noting that, in that proceeding, a hearing was granted to the State’s representative (Procuraduría), who failed to observe that the property was public-domain property. The relief sought is not compensable because it does not fall within the statutory basis for administrative liability arising from the abnormal operation (funcionamiento anormal) of the Registro Público. In light of the foregoing, the objection must be denied.
XVI.A single issue remains to be resolved, which, although the appellants in cassation (casacionistas) do not set forth as a separate ground of appeal, emerges throughout the entire appeal. It concerns a possible expropriation and payment for improvements, which may be summarized as follows. The appellants contend that if the State wishes to take ownership of those portions of land, the proper course is to expropriate them, since the plaintiff cannot take advantage of the fact that part of the property is indeed located within the maritime-terrestrial zone (zona marítimo terrestre) and, on that basis, appropriate the entire estate. According to the appellants in cassation, if the land were deemed to have been within the Park as a result of the expansions that were made, it should be expropriated from them. On this issue, the Court held that expropriation was not appropriate in this case because the Expropriations Law (Ley de Expropiaciones) cannot be applied to public-domain property (bienes de dominio público).
The judges reasoned that, although it is true that the PGR took no action when it was informed of the possessory-information proceeding (proceso de información posesoria), it was not until 30 years later that the civil judge gave notice of the situation; and although the property in question remained throughout that time within “human commerce,” the fact remains that it never lost its public-domain status (condición demanial) or public ownership. Accordingly, the relief sought by the counterclaimants cannot be granted because the land never belonged to them, and its immunity from prescription (imprescriptibilidad) entitles the Procuraduría General de la República to bring this action and recover it. The judges stated that they would be entitled only to compensation for improvements (mejoras), but added that Mr. González Rivera never had actual possession (posesión material) of the property, making it impossible to award such compensation.
The same applies to the trustee Coris. This Chamber fully concurs with the Court’s ruling. Indeed, as has been repeatedly explained, the land in question forms part, in its entirety, of the maritime-terrestrial zone. Consistent with that reasoning and as stated above, it is public-domain property (bien demanial) and therefore is not subject to prescription, alienation, or attachment. This means that the property cannot be acquired through adverse possession (usucapión), nor can it be lost through extinctive prescription (prescripción negativa), which means that the State never ceases to hold title to this type of property. It is also immune from attachment (inembargable), meaning that it cannot be encumbered or attached, which is related to the fact that such property must not leave the ownership of the State. Furthermore, it is inalienable (inalienable), meaning that it lies outside human commerce and therefore cannot be transferred, sold, donated, or subjected to any other type of transaction that would compromise public ownership.
Thus, under this analysis, and given that the title to the land at issue has been proven null and void, expropriation cannot proceed because an indispensable requirement for expropriation is that the person to be compensated own the property, which is not the case here. The appellants in cassation argue that official letter Acopac-011-11, drafted by Mr. Ronald Chaves, which states that before Decreto Ejecutivo 29.177-Minae, Playa Rey was not part of Parque Nacional Manuel Antonio, means that the land belonged to them and reinforces the duty to expropriate. However, as already explained, the issue is not whether the property lies within the boundaries of the Parque Nacional or whether Playa Rey was incorporated into that Park in the year 2000; rather, ever since protection of the maritime-terrestrial zone was established in the year 1828, the area comprising Playa Rey and the property at issue have possessed that status and public-domain character.
This entails all the resulting legal consequences. Furthermore, regarding the improvements, the judges correctly reasoned that none of the co-defendants ever took actual possession of the lot, which necessarily means that they could never have made any improvements there. Accordingly, this ground of appeal must be rejected.
XVII.In view of the foregoing, the appeal in cassation filed by the co-defendant counterclaimants must be denied. The costs of this means of challenge shall be borne by them. Article 150 of the Código Procesal Contencioso Administrativo.

Proceso ordinario establecido en el Tribunal Contencioso Administrativo, Sección Octava, por el Estado, representado por su procuradora GLORIA SOLANO MARTÍNEZ, cédula de identidad 1-0836-0342, abogada, divorciada; contra VÍCTOR EDUARDO GONZÁLEZ RIVERA, cédula de identidad no. 3-0287-0513, casado y GRUPO DE INVERSIONES CORI DE COSTA RICA S.A., cédula jurídica no. 3-101-132593, representada por el señor González Rivera y Gustavo Adolfo González Rivera, cédula de identidad 9-049-442, estado civil no indicado. Las personas físicas son mayores de edad, de domicilio ignorado y, con la salvedad hecha, de oficio ignorado.

CONSIDERANDO
I.El 4 de noviembre de 2009, la representante del Estado, sea Procuraduría General de la República (en adelante PGR), interpuso demanda contencioso administrativa contra la empresa Grupo Inversiones Coris de Costa Rica S.A., (en lo sucesivo Coris). En lo de interés indicó, el 11 de agosto de 1973, ante los notarios públicos Bernal Ulloa Flores y Jorge Luis Víquez Carvajal, en escritura número 524 del tomo cuarto del primer notario, el señor Max Blanco Brunetti le cede de manera onerosa a William Carlton Drummond y Muriel Strehlow Empie, ambos ciudadanos norteamericanos, quienes eran vecinos de Quepos, su “derecho de posesión” derivado de un supuesto contrato de arrendamiento establecido con la Municipalidad de Aguirre, respecto de una parcela que ocupaba en zona marítimo terrestre en Playa Rey de Quepos. El 8 agosto de 1978, dijo, mediante escrito presentado ante la Alcaldía de Aguirre y Parrita de ese entonces, ambos extranjeros iniciaron el trámite de información posesoria a efectos de titular el terreno que poseía el señor Max Blanco.
Expresó, los promoventes aportaron a su solicitud el plano catastrado número P-15177-74, donde se indicaba que el inmueble era propiedad del Ayuntamiento. Explicó, dicha solicitud tenía como fin llevar a cabo también el arrendamiento al Gobierno local. El 17 de mayo de 1979, expuso, la Alcaldía de Aguirre y Parrita, aprobó la titulación del terreno objeto de la información posesoria, lo que dio origen a la finca del partido de Puntarenas, matrícula 31355, de 120.187,51 metros cuadrados, quedando inscrita en el Registro respectivo el 28 de agosto de 1979. El 27 de agosto de 1980, apuntó, dada la muerte de don William Carlton Drummond, la señora Muriel Strehlow Empie, al ser la única heredera e interesada, se adjudicó la totalidad de la finca. Sin embargo, el 4 de septiembre siguiente, esta poseedora, vendió por partes iguales el bien a Albert Roland Metz y Josef Pusar, ambos de nacionalidad alemana, por un monto de $100.000,00, constituyendo garantía hipotecaria en primer grado.
En virtud del incumplimiento, mencionó, la señora Muriel Strehlow Empie, interpuso proceso ejecutivo hipotecario ante el Juzgado Civil de San José, quien ordenó el remate de la finca, acto celebrado el 13 de diciembre de 1983, y donde Muriel Strehlow se la adjudicó y ordenó levantar la hipoteca. El 8 de mayo de 1985, dicho inmueble, lo vendió en $300.000,00 a la compañía Inversiones Corazón S.A., quien constituyó sobre este una hipoteca de cédulas por ¢6.000.000,00, representada por seis cédulas hipotecarias por un valor ¢1.000.000,00 cada una, las cuales vencían el 31 de octubre de 1997. Refirió, el 31 de agosto de 2006, mediante escrito presentado ante el Juzgado Civil de Cartago, el señor Víctor Eduardo González Rivera, interpuso proceso ejecutivo hipotecario contra Inversiones Corazón S.A., con el fin de ejecutar las cédulas hipotecarias constituidas. El 30 de noviembre de 2006, manifestó, el Juzgado remató el bien adjudicándosele a Víctor González Rivera, la cual fue aprobada el 23 de abril de 2007, ordenándose además la cancelación del gravamen hipotecario.
Asimismo, advirtió, comisionó al Juzgado Civil y de Trabajo de Mayor Cuantía de Aguirre y Parrita para que pusiera en posesión del inmueble a su nuevo dueño así como ordenó la inscripción de este en el Registro Nacional. El 30 de agosto de 2007, aseguró, se realizó la puesta en posesión, no obstante, en la diligencia se aportó el plano P-15177-74, donde se indicaba que parte de la finca a poner en posesión forma parte del Parque Nacional Manuel Antonio, sector de Playa el Rey; por ello el juez decidió únicamente poner en posesión formal al señor Víctor González Rivera, y decidió que la “posesión en carácter material la continuará ejerciendo por (sic) el área de Conservación Pacífico Central del Ministerio de Ambiente y Energía.Se le apercibe al señor Olger Eduardo Nuñez (sic) Jimenez (sic) en su calidad de Administrador del puesto de Playa El Rey, que ellos continuaran (sic) ejerciendo los actos posesorios del Parque Nacional incluyendo la finca de la parte actora, todos relacionados con la conservación y mantenimiento del inmueble protegido, sin poder realizar cualquier transformación o enajenación sobre el mismo (sic).
De la misma forma se indica que los derechos concedidos son únicamente a favor de la parte actora, quedando autorizada la administración (sic) del área en litigio para [ilegible] […] Todo lo anterior se resuelve así, en vista de la existencia de una posible colisión entre los derechos del promovente y los derechos del Ministerio de Ambiente y Energía con respecto al área, sin perjuicio de que las partes acudan a la vía judicial respectiva para resolver sus controversias. […]”. El 10 de junio de 2008, aseveró, se protocolizaron piezas del proceso hipotecario, las cuales fueron presentadas al Registro Nacional e inscritas a nombre de Víctor Eduardo González Rivera el 13 de octubre de 2008. Asimismo, afirmó, el 26 de noviembre de 2008, sostuvo, don Víctor González suscribió un contrato de fideicomiso con Coris, de quien es el presidente y apoderado generalísimo, por un plazo de 30 años, traspasándole a esta sociedad la propiedad de la finca número 313355, la cual quedó debidamente inscrito el 12 de enero de 2009.
Dicho terreno, alegó, es un bien de dominio público, pues el plano catastrado P-15177-74, lo ubica dentro de la zona marítimo terrestre de Playa Rey, Quepos, franja costera, actualmente está comprendida dentro de los límites del Parque Nacional Manuel Antonio, por lo que su inscripción particular es jurídicamente imposible. Además, aclaró, en este asunto, no existe ningún contrato de arrendamiento, concesión ni permiso de uso en la zona marítimo terrestre de Aguirre, otorgado por la Municipalidad a favor de Max Blanco Brunetti, William Carlton Drummond o Muriel Strehlow Empie. Con base en esta relación de hechos en lo de interés solicitó se declare que la finca número 31355-000, correspondiente al inmueble descrito en el plano P-15177-74, se encuentra dentro de terrenos pertenecientes al dominio público. En virtud de ello, la resolución de la Alcaldía de Aguirre y Parrita de las 10 horas 30 minutos del 16 de mayo de 1979, que aprobó el bien a inscribir por información posesoria, es absolutamente nula al carecer de fundamento jurídico, ya que se trata de un terreno ilícitamente titulado dentro de zona marítimo terrestre.
En este sentido, también es nula la inscripción registral del predio 31355, debiéndose ordenar al Registro Nacional su cancelación, así como todas las inscripciones posteriores. Asimismo, es nulo el plano P-15177-74 por lo que se debe ordenar a la Oficina de Catastro Nacional su cancelación. Las costas a cargo de la demandada, así como los intereses. Esta contestó de manera negativa e interpuso las excepciones de prescripción, caducidad, litis consorcio pasiva necesaria, falta de derecho y aduce la expresión genérica “sine actioneagit”. En ese mismo acto reconvino. En lo trascendental dijo que el 11 de agosto de 1973, Max Blanco Brunetti, cedió de manera onerosa a William Carlton Drummond y Muriel Strehlow Empie, los derechos de posesión que aquel ejerció desde el 12 de octubre de 1970 así como los de su transmitente Ramón Guevara López por un espacio de 10 años, en forma quieta, pública, pacífica y a título de dueño, sobre la zona marítimo terrestre que actualmente se conoce como Playa Rey en Quepos.
El precio que se pagó en ese momento, expresó, fue de $25.000,00. Ante gestiones de información posesoria, indicó, realizados por William Carlton y Muriel Strehlow, la antigua Alcaldía de Aguirre y Parrita, tituló el inmueble en cuestión y materializó el plano catastrado P-15174-1974. Aclaró, en ese proceso de información posesoria, la PGR nunca manifestó oposición a la creación de la finca matrícula 31355-000, la cual tiene más de 30 años de haberse inscrito en el Registro Nacional. También, explicó, dado que Muriel Strehlow enviudó y quedó como única dueña, vendió a los señores Albert Roland Metz y Josef Puzar, el 4 de septiembre de 1980, la citada finca por un valor de $100.000,00, constituyéndose garantía hipotecaria. Ante el incumplimiento de estos compradores, expuso, la vendedora planteó el remate y se adjudicó el bien. Posteriormente, dijo, se lo vendió a la empresa Inversiones Corazón S.A., quien constituyó seis cédulas hipotecarias, por ¢6.000.000,00 en total, las cuales endosó a Víctor Eduardo González Rivera, el 21 de marzo de 2006, quien procedió a ejecutarlas.
Apuntó, don Víctor González se adjudicó el bien y se inscribió a su nombre el 23 de abril de 2007. Dado lo anterior, mencionó, se comisionó al Juzgado Civil y de Trabajo de Aguirre y Parrita para la puesta en posesión; la cual se llevó a cabo el 30 de agosto de 2007, poniéndosele a don Víctor González en posesión formal del inmueble y la material al Área de Conservación Pacífico Central del Minaet, dado que el terreno se encontraba dentro del Parque Nacional Manuel Antonio en Playa Rey. Refirió, ese terreno se encontraba dentro del régimen de excepción que establece la Ley sobre la Zona Marítimo Terrestre (LZMT), en el tanto fue considerada parte de la ciudad de Quepos, conforme al numeral 6 de dicha Ley. Cuando el bien se tituló, manifestó, no formaba parte del Parque Nacional Manuel Antonio, de hecho, según sus peritos topógrafos, hay una porción del bien que no forma parte de la zona marítimo terrestre, en una extensión de más de 7.000 metros cuadrados.
A su vez, advirtió, mediante Decreto Ejecutivo número 29177-MINAE, publicado en el diario oficial La Gaceta, número 243 del 19 de diciembre de 2000, se incorporó al Parque Nacional Manuel Antonio, los terrenos que incluyen la propiedad 31355-000, sin que hubiese mediado expropiación cuando aparecía inscrita a nombre de Inversiones Corazón S.A. No se debe olvidar, aseguró, que la empresa Coris adquirió el predio mediante remate judicial, sin que en el edicto se reflejara alguna consideración referida a limitaciones o adquisiciones ilegales. Aseveró, desde 1979, más de 30 años, este terreno ha permanecido inscrito en el Registro Nacional, siendo que muchas personas han invertido dinero en el bien, al amparo de la publicidad registral, y se han pagado a través del tiempo los impuestos municipales correspondientes. Con base en esta relación de hechos peticionó se le declare dueña del terreno.
En virtud de ello, concibió no se puede anular el título que dio origen a la inscripción, ni los asientos registrales. Pide al reconvenir, se ordene al Estado deje de perturbar su propiedad, presentando procesos anulatorios. Se le restituya el fundo, para ejercer su posesión material. Se le paguen los daños y perjuicios causados, los cuales se estimarán en ejecución de sentencia; no obstante lo anterior, los cuantifica de la siguiente manera: ¢100.000.000,00 por daños dado que se le ha impedido ejercer el dominio pleno sobre el predio, porque es el Estado quien tiene la posesión material. Los perjuicios son los intereses dejados de percibir por esa suma, los cuales estima en ¢5.000.000,00. Se ordene al Estado la expropiación, pues el inmueble 31355-000 fue afectado por el Decreto Ejecutivo 29177-MINAE, debiéndosele pagar el valor del inmueble. Ambas costas a cargo del Estado. Subsidiariamente solicitó se declare que la finca, hasta antes de la presentación de este proceso, no tenía ninguna anotación o advertencia registral.
La adquisición ha sido de buena fe, al amparo de la publicidad registral y en su condición de tercero de buena fe. En caso de ordenarse la anulación del asiento de inscripción, debe el Estado indemnizarle por daños y perjuicios, dentro de los cuales se ha de tomar en cuenta el valor actual del terreno y tomando en consideración lo pagado a lo largo de 30 años, “conforme a la inflación e indexación correspondiente”, a determinarse en ejecución de sentencia. Además pide las costas a cargo del Estado. Este último, contestó de manera negativa e interpuso las excepciones de falta de derecho, en cuanto a la pretensión principal; respecto de la subsidiaria la de falta de: derecho, legitimación activa y pasiva. En la audiencia preliminar, se incorporó al proceso al señor Víctor Eduardo González Rivera, en su calidad personal otorgándosele un plazo de 30 días para contestar la demanda. Lo hizo de forma negativa.
Aduce las defensas de: falta de integración de la litis, pues en su criterio William Carlton Drumond y Muriel Strehlow Empie, conocen muchas cosas del asunto y al menos la segunda debe formar parte de este proceso. Prescripción, caducidad, falta de derecho y la expresión genérica “sine actione agit”. En ese mismo acto reconvino. Manifestó iguales hechos y pretensión que los plasmados por Coris en su contrademanda. La representación estatal contestó de manera negativa, alegó como defensa previa la de prescripción y las demás en idénticos términos que a la reconvención de Coris. En la audiencia preliminar, se resolvió “Se declara sin lugar la defensa previa interpuesta por la representación de la parte actora, por innecesario se omite pronunciamiento de la defensa opuesta por el Estado”. También, reservó el tema de la caducidad y prescripción aducido por los codemandados para que sean conocidas con la sentencia de fondo y rechazó la de prescripción alegada por el ente estatal contra la reconvención de Víctor González Rivera.
El Tribunal rechazó las excepciones de prescripción y caducidad opuestas por las codemandadas. Asimismo la de falta de derecho, y la expresión genérica “sine actione agit”. Declaró con lugar la demanda en los siguientes términos: 1- la finca 35355-000, se encuentra en su totalidad dentro de la zona marítimo terrestre y no es susceptible de ser inscrita a nombre de terceros. 2- Es absolutamente nula la resolución de la Alcaldía de Aguirre y Parrita de las 10 horas 30 minutos del 16 de mayo de 1979, que aprobó las “diligencias” de información posesoria promovidas en expediente 178-78. 3- Anula la inscripción registral de la finca y ordena al Registro Nacional su cancelación, así como las inscripciones posteriores sobre el bien. 4- Dada la demanialidad del terreno, se anula el plano catastrado P-15177-74 y se ordena su cancelación en la Oficina de Catastro del Registro Nacional. Resuelve sin especial condena en costas.
Respecto de la reconvención de Coris y Eduardo González Rivera, rechazó la excepción de prescripción opuesta por el Estado. Acogió la de falta de derecho respecto de las pretensiones principales. Rechazó la de falta de legitimación activa y pasiva relacionadas con la pretensión subsidiaria. Acogió la defensa de falta de derecho relacionada con estas peticiones. Declaró sin lugar en todos sus extremos las reconvenciones interpuestas. Sin especial condena en costas. Una vez firme el fallo, ordenó el levantamiento de la medida cautelar, consistente en dejar sin efecto la anotación de la demanda al margen de la finca; se mantuvo la orden girada al Ministerio de Ambiente, Energía y Telecomunicaciones de mantener en suspenso cualquier trámite administrativo tendente a otorgar algún derecho o autorización sobre el bien; a la Municipalidad de Aguirre que se abstuviera de otorgar permisos de construcción sobre el referido terreno, a menos que se trate de una necesidad para mantener el justo equilibrio del ecosistema y la solicitud se encuentre avalada por el Área de Conservación Pacífico Central del Ministerio del Ambiente, Energía y Telecomunicaciones; ordenó a la sociedad accionada, abstenerse de construir, deslindar con cercas o carriles y de realizar cualquier tipo de actividad que implique la alteración de sus condiciones actuales; ordenó la inmovilización de la finca; mantuvo la posesión material al Área de Conservación.
La gestión de adición y aclaración solicitada por los codemandados, con posterioridad es rechazada por el Tribunal. Inconformes, ambos codemandados reconvinientes en conjunto, interponen recurso de casación.
Casación por razones procesales
II.De este tipo aducen los siguientes tres motivos. Primero: dicen se ha dado una violación en la composición de la litis consorcio pasivo necesario. En este sentido, expresan, al ser una de las pretensiones la cancelación de la inscripción sobre la finca, se debe llamar a este proceso, a todos los que en algún momento fueron propietarios del bien, pues conciben, la resolución los afecta directamente, además, podría ser que sean susceptibles de indemnización. También, afirman, estas personas como codemandadas, podrían valorar establecer una demanda contra la persona de quien adquirieron. Citan jurisprudencia de esta Sala. Lo anterior con base en el artículo 12 del Código Procesal Contencioso Administrativo (CPCA). Segundo: indican, han quedado en completa indefensión, en el tanto se está ordenando anular el título original de la finca número 31355-000, así como los asientos registrales posteriores, de manera tal que se les impide accionar con los anteriores titulares del inmueble, mediante garantía de evicción y saneamiento.
Asimismo, explican, el Tribunal invirtió la carga de la prueba al considerar que la finca no había sido inscrita conforme la excepción que establece el artículo 6 de la LZMT, aún y cuando ha sido comprobado que la propiedad fue adquirida en el año 1979 y que la ciudad de Quepos fue declarada como tal en 1969 y comprendía Playa Rey, fue hasta en 1980 que se delimitó dicha ciudad. La PGR, exponen, no presentó ninguna prueba que desvirtuara lo anterior, pero aún así, el Tribunal consideró no hubo prueba que demostrara el terreno estaba en zona urbana. Tercero: señalan, el fallo carece de motivación. De la lectura de los hechos tenidos por probados, mencionan, se extrae que la finca fue adquirida conforme al proceso de información posesoria, en el cual participó la PGR, sin que hiciera reproche. En el mismo sentido, refieren, en el fallo se dijo que el bien era de dominio público, pero ya se había demostrado que Playa Rey era parte de la ciudad de Quepos, de tal manera que la falta de motivación se da porque es deber del juzgador analizar las incidencias y cuestiones de fondo planteadas por las partes, según lo estipulan los cardinales 119 y 122 inciso m), ambos del CPCA, así como el canon 155 del Código Procesal Civil (en lo sucesivo CPC); pues el fallo no cuenta con los argumentos sobre los cuales se adoptó la decisión correspondiente.
III.Relativo al primer agravio, donde se aduce un problema de litis consorcio pasivo necesario, consideran los casacionistas que al ser una de las pretensiones la cancelación de la inscripción sobre la finca, se debe llamar al proceso a todos los que alguna vez fueron propietarios del bien, dado que podrían ser susceptibles de indemnización. En este sentido importa copiar textualmente dicha petición: “[…]
IV.Relativo al segundo agravio, donde aducen los codemandados indefensión, pues en su criterio, con la resolución judicial, se les impide accionar contra los anteriores titulares del bien, y; no pueden ejercer la garantía de evicción y saneamiento; ha de indicarse que estas son opciones con que cuenta una persona para reclamar a otra en relación con objeto, pudiendo acudir a la vía judicial a hacerlo valer. En este caso, contrario a la opinión de los recurrentes, no existe tal indefensión, ya que de ninguna manera se les está cercenando su derecho de reclamar directamente a quienes considere deben resarcirle y mucho menos de acudir a la vía judicial a demandar contra quienes consideren necesario, para ver tutelados sus derechos. También mencionan un segundo tema en este reparo, relacionado con un problema probatorio, inconformidad que atañe a un tema de fondo, razón por la cual se reservará su conocimiento para cuando se haga el análisis de los agravios de este tipo.
Recurso por razones sustantivas
V.De este tipo alegan los siguientes cinco motivos. Primero: manifiestan, los juzgadores excluyeron prueba técnica que les favorecía, contraviniendo así lo dispuesto en el precepto 82 del CPCA. En autos consta, aseguran, documentos que evidencian, que el terreno descrito en el plano P-15177-74 el cual corresponde a la finca 31355-000 se encuentra fuera del área marítimo terrestre; y así se consigna en el peritaje del topógrafo José Ramón Gutiérrez González, en donde se concluyó que una porción aproximada de 7.000 kilómetros cuadrados del bien en cuestión, se localizaba fuera de la zona marítimo terrestre. Aunado a lo anterior, aseveran, conforme al peritaje del profesional Luis Ángel González Alfaro, se concluye existe un área de 16.676 metros cuadrados del terreno que no se encuentra dentro de la zona marítima terrestre. Por ello, afirman, a esa franja, no se le puede dar el trato como si estuviera cubierto por tal régimen.
En esta línea de pensamiento, sostienen, si el Estado quiere apropiarse de ese predio, debe expropiar y no aprovecharse de que una parte del inmueble sí está cubierta para adueñarse de su totalidad. El Tribunal, dicen, no motiva de manera suficiente su fallo, pues se limita a afirmar hubo una imprecisión en los parámetros de medición utilizados, a la hora de determinar la zona de pleamar. Los juzgadores, expresan, debieron haber razonado con profundidad, el por qué le restaron credibilidad al peritaje (no específica a cuál se refieren), mostrándose complaciente con las pretensiones del Estado y dio a los testigos por él aportados un rango de peritos. Aclaran, la PGR se equivocó en sus conclusiones y esto podría ser lo que confundió al Tribunal, en el tanto, la representación estatal consideró que el perito había dejado por fuera la zona de manglar, y; ello, desvirtuaba el peritaje; pero lo cierto es, que la zona de manglares no está contemplada en la LZMT, porque en el artículo 10, indica que dicha zona está compuesta por dos secciones: la zona pública y la zona restringida; los manglares forman solo una parte de la zona pública.
El error probatorio, aseveran, ocurre porque se le dio más valor a los testimonios que al peritaje; siendo además que estos, son ambiguos e imprecisos, y totalmente complacientes con la parte actora, debiéndose tomar en cuenta que en algún momento han sido funcionarios públicos. Resulta fuera de toda lógica, exponen, que en la sentencia impugnada, se descartara por impreciso el trabajo pericial emitido por Luis Ángel González Alfaro, cuando las imprecisiones que llevaban a error se encuentran en los testimonios ofrecidos por la PGR. Así sucede, explican, con la declaración de Julio Bustamante Bustamante, el Tribunal destacó la siguiente afirmación: “[...] el Parque Manuel Antonio estaba constituido por noventa y ocho por ciento humedales y dos por cientos (sic) tierra firme [...]”, sin explicar por qué se asume que el terreno en discusión está dentro de ese 98%; afirmación que solo se puede hacer con una prueba técnica.
Agregan, no se debe olvidar, que el Parque Nacional Manuel Antonio fue ampliado en el año 2000, muchos años después de que se inscribiera la finca en cuestión, existiendo ya una situación jurídica consolidada. Esto debe entenderse, señalan, que antes de que se ampliara el Parque Nacional, el bien en discusión no formaba parte de este. De tal manera, aducen, si el Estado quiere apropiarse del bien, debe expropiarlos como corresponde. Con este proceder se han conculcado los numerales 352, 353 y 401 del CPC, al darle a la prueba testifical el valor probatorio que no tiene. Refieren, la peor violación probatoria se da con el testigo Bustamante Bustamante, quien en su declaración afirmó la propiedad estaba atravesada por “criques” artificiales, lo que excluye evidentemente, humedales o manglares. El Tribunal, sostienen, afirma sin prueba alguna que la finca en cuestión se encuentra dentro de la zona marítimo terrestre, cubierta por humedales; pero no avala la posición de que hay aproximadamente “siete y mil y diecisiete mil (sic) metros cuadrados”, fuera de dicha zona, lo cual es conteste con lo manifestado por el testigo Bustamante Bustamante.
No se puede determinar, mencionan, que en el terreno existan humedales, entendidos como una superficie que está temporal o permanentemente inundada, regulada por factores climáticos y en constante interrelación con los seres vivos que la habitan; tal y como lo establece la Convención Ramsar. Advierten, en este caso hay una controversia de si los canales existentes en el lugar, son naturales o artificiales; polémica que solo puede ser solucionada mediante peritaje. En este sentido, afirman, consta en autos el peritaje de Luis Ángel González Alfaro, al cual los juzgadores le restaron valoración sin mayor explicación, debiéndose acotar, dicho perito fue nombrado por el propio Tribunal. Si los jueces pensaron que la formación técnica del señor Luis Ángel González Alfaro no era la idónea, alegan, entonces lo correcto era haber solicitado otro peritaje. En el fallo, indican, se establece localizada una porción de la finca fuera de la zona marítimo terrestre.
Sin embargo, también se considera que en esa parte existen humedales, del Parque Nacional Manuel Antonio, ello con base en uno de los testigos, quien afirmó que el 98% del área está comprendida por el Parque, se encuentra cubierta por humedales, sin que esto haya sido demostrado por la representación estatal, pues el terreno en cuestión no se encuentra cubierto por humedales. El Tribunal, apuntan, presume que la finca está comprendida dentro de la zona marítimo terrestre a partir de los testimonios, que ni siquiera se referían específicamente al predio en litis, sino, se trataba de relatos sobre el Parque, resultando sus declaraciones imprecisas e inseguras. Olvidan los juzgadores, aseguran, que la carga probatoria en este caso correspondía al Estado, pues es quien afirma el bien está dentro de la zona marítimo terrestre, pero en ningún momento presentó una prueba técnica que respaldara sus afirmaciones, el caso de la PGR, avalado por el Tribunal, se basa únicamente en testimonios.
Ha quedado demostrado en autos, aseveran, conforme oficio ACOPAC-011-11 del 20 de febrero de 2011, emitido por Ronald Chaves, del Área de Conservación del Pacífico Central, que antes de la promulgación del Decreto Ejecutivo 29177-MINAE, del año 2000, Playa Rey no formaba parte del Parque Nacional Manuel Antonio, siendo que los terrenos que pertenecían a particulares, deben ser expropiados, si el Estado quiere apropiárselos. Aunado a lo anterior, en su criterio, según el informe emitido por José Mattey Fonseca, del 18 de febrero de 2011, donde se describe que el terreno del plano P-15177-1974, no se encuentra cubierto en su totalidad por manglar; lo cual dice que alguna vez estuvo formado totalmente por manglar, pero no especifica en qué proporción se ha ido recuperando ni tiene base para sustentar tal afirmación. Se debe tener claro, señalan, es que si se han creado manglares en el lugar, ha sido por obra del ser humano, lo cual implica no son naturales, sino, artificiales.
No existe probanza, aducen, en donde se pueda verificar la situación del terreno antes de 1949, porque afirman es consabido, para esa fecha no existían fotografías aéreas. Nótese, dicen, que en la declaración del señor Luis Quirós, se le resta crédito al conocimiento que tenían los representantes de Cori de la ubicación y extensión, sin embargo, don Luis Quirós declaró que no conocía bien la zona ni el terreno en cuestión por lo menos antes del año 2005; no obstante lo anterior, afirma que el territorio es de humedales. Esto, expresan, no es prueba de que la totalidad del bien en litigio sea de humedales, pero, es esta la convicción del Tribunal. Podría ser, explican, que el error de los juzgadores radique en creer que don Luis Quirós se presentó como perito, cuando lo cierto fue como testigo; el único perito en este caso es Luis Ángel González Alfaro. En el caso de estudio, aducen, se está discutiendo un derecho de propiedad, consagrado en el numeral 45 de la Constitución Política, de tal manera, que para poder anular el título, debe haber absoluta certeza que el bien en discusión se encuentra en zona marítimo terrestre y es de humedal, y la única prueba aceptable para ello, es el peritaje.
Ahora bien, refieren, el informe del Instituto Geográfico Nacional denominado “Estudio fotointerpretativo para determinar si terreno en plano catastrado no. 15177-1974, se localiza dentro del área propiedad natural del Estado, lugar distrito Quepos”, emitido en oficio DEGEO-019-11, sin indicar fecha, fue indebidamente valorado, en desapego a las reglas de la sana crítica. En ese documento, sostienen, se consignó desde su introducción que el bien estudiado estaba dentro de la zona marítimo terrestre; lo que a todas luces le resta credibilidad. Asimismo, manifiestan, en ese informe, se garantiza que con base en la “Figura 2”, el terreno en cuestión, descrito en el plano 15177-1974 en ortofoto 2005, se encuentra ubicado dentro de las áreas de humedal y manglar, cuando lo correcto pues a simple vista se desprende, es que las secciones de esa zona no poseen tales características, folio 454 del expediente.
En todo caso, mencionan, el instrumento utilizado por ese Instituto, no es confiable, dado que únicamente se usaron “Archivos Digitales, formato Shape, de mangle, humedales, y límite del Parque Nacional Manuel Antonio (Cartografía Quepos-Savegre, escala 1:50.000”. Otra deficiencia de este estudio, advierten, es que concluye el terreno descrito en el plano 15177-1974, se encuentra dentro de humedales, basado en la observación de las fotografías de los años 1947-1949 y de 1961, las cuales se echan de menos y no fueron adjuntadas al informe. Segundo: afirman, se ha resuelto en contra del ordenamiento jurídico, pues el Tribunal erróneamente se basa en el artículo 6 de la LZMT para resolver el asunto, con lo cual violenta además los principios de legalidad e irretroactividad de la ley, respecto de la Ley 3201 de 1963. En el fallo se tiene por demostrado, alegan, que la declaratoria de Quepos como ciudad data de 1963 (Ley 3201); además, que antes de 1980 no existía una delimitación de la ciudad de Quepos en donde se excluyera Playa Rey; y, que el inmueble objeto de este proceso, se encuentra dentro de Quepos, pero cuando se da la inscripción producto de la información posesoria, ya se encontraba vigente la LZMT, por ende, solo se podía excluir si se tratara de ciudad costera.
Lo anterior evidencia, indican, existió una situación jurídica consolidada antes de que se delimitara la ciudad de Quepos en 1980, y que para 1963 cuando se promulgó la Ley 3201, Playa Rey formaba parte de Quepos. Apuntan, conforme lo establece el numeral 34 de la Constitución Política, no es posible aplicar de manera retroactiva una ley; así, el requisito de que hubiera desarrollo urbano en el lugar, para poder aplicar el numeral 6 de la LZMT, se ha impuesto contra la ley, debiéndose tomar en cuenta que este no existe actualmente, mucho menos cuando se consolidó la situación jurídica de propiedad sobre la finca descrita en el plano P-15177-74, cuando ya se había otorgado a Quepos el título de ciudad. Insisten, la información posesoria descrita en ese plano, que ahora es la matrícula de folio real 6-31355-000, se realizó al amparo del ordenamiento jurídico. Además, opinan, del propio artículo 6 referido, se extrae, no se pueden aplicar las regulaciones de dicha ley a la finca en cuestión, por haber sido esta parte de la ciudad de Quepos.
Recalcan, cuando se inscribió el bien, este no se encontraba dentro de los límites del Parque Nacional Manuel Antonio, sino, que esto sucedió hasta cuando se amplió en el año 2000. Según informe del 3 de junio de 2009, aseguran, realizado por el Programa de Regularización de Catastro, la finca se localiza dentro del terreno cubierto por la ampliación del Parque, lo que es una consecuencia lógica. Tercero: en su criterio, se han violentado las normas que regulan la responsabilidad administrativa, así como los cánones 455 y 456 del Código Civil, como también el numeral 1 de la Ley del Inscripción de Documentos en el Registro Público. En este sentido, aseguran, el Tribunal consideró que el Estado no tiene responsabilidad patrimonial relacionado con mejoras que se hubiesen llevado a cabo en el terreno. Los propios juzgadores, aseveran, aceptaron que Coris adquirió el bien en cuestión al amparo de la inscripción registral, con base en cédulas hipotecarias, que son títulos valores, debidamente expedidas por el Registro Nacional y que evidencian un derecho de crédito a favor de Víctor Eduardo González.
En ese punto, señalan, no se está debatiendo si el bien en cuestión es público o no, lo trascendental es el tema de la confianza en el Registro Nacional, como órgano estatal especializado y competente para ello. Agregan, la publicidad registral, es garante de la seguridad jurídica a favor de los administrados, quienes pueden adquirir con seguridad sus bienes, bajo el supuesto de que los asientos registrales son íntegros, exactos y lícitos; por eso al adquirente de buena fe, debe indemnizársele por haberse amparado a la publicidad registral. No reconocer esta compensación, señalan, es una violación al principio de igualdad, en el sostenimiento de las cargas públicas, pues si la inscripción, de donde emana el derecho, después se declara nula, debe endilgarse responsabilidad. Así, dicen, el señor González Rivera adquirió y ejecutó las cédulas hipotecarias respaldadas por el terreno en cuestión, matrícula 313555-000, de buena fe y al amparo de la publicidad registral; y eso le generó una situación que debe entenderse con base en el principio de confianza legítima, según lo establece el numeral 1 de la Ley de Inscripción de Documentos en el Registro Público.
En este caso, expresan, la responsabilidad estatal se da de dos maneras: 1- en virtud de la veracidad que se supone debe brindar el Registro Nacional; 2- por la inactividad de los órganos estatales en reivindicar el bien. Explican, fue hasta el año 2009, con la presentación de la demanda que hizo la PGR, cuando cesó esa inercia, y la reconvención el 21 de octubre de 2010, de tal manera que no se podría aducir una prescripción. El artículo 190 de la Ley General de la Administración Pública (LGAP), aducen, establece la obligación de que la Administración responda por su funcionamiento; en el caso de estudio, no solo es subjetiva por la omisión aducida, sino también objetiva en virtud de que Víctor González adquirió de Coris el territorio referido por la ejecución de las cédulas hipotecarias, las cuales estaban respaldas por el Registro Nacional. En este sentido, conciben, es clara, la existencia de un daño, pues dada la omisión del Estado para actuar y apoderarse del bien, impidió a los codemandados percatarse de la posibilidad de que se frustrara su derecho de propiedad; lo que evidentemente hubiese influido en su voluntad contractual.
La responsabilidad objetiva se deriva, repiten, en el caso de don Víctor González, del acto de inscripción de la finca a su nombre y dado que dicha adquisición se hizo de buena fe desde el año 2007 y en el caso de Coris, la responsabilidad surgiría en el 2009 con la inscripción del bien a su nombre. La pérdida del inmueble, refieren, es un daño material, el cual adquirió por ¢90.000.000,00 en un proceso ejecutivo hipotecario. Cuarto: sostienen violación de los mandatos 1, 6, 9, 10 y 11 todos de la LZMT, así como transgresión a la Ley número 3201 de 1963, por indebida aplicación (excepto el ordinal 6 citado el cual más bien, se dejó de aplicar); igualmente de los principios de irretroactividad de la ley y de legalidad. El Tribunal, manifiestan, consideró que el terreno era de dominio público, y; por encontrarse en zona marítimo terrestre y formar parte del Parque Nacional Manuel Antonio, no podía ser inscrito por medio de información posesoria en 1979.
En su criterio, si bien el territorio en cuestión se encuentra dentro de dicha área, lo cierto es que, de acuerdo a lo estipulado en el canon 6 de la LZMT, el predio se encuentra en lo que se consideraba parte de la ciudad de Quepos para ese año; en otras palabras, Playa Rey pertenecía a ese pueblo. No fue sino hasta el año 1980, cuando se cambiaron los linderos y se delimitó Quepos de otra manera. Además, agregan, conforme a ese precepto 6, Quepos se debe entender cobijada por la excepción que allí se establece, siendo inválido el criterio utilizado por los juzgadores de que esa norma no se debía utilizar, al no haberse demostrado la existencia de un desarrollo urbano que beneficiara el lugar de categoría de ciudad. Con este proceder, mencionan, los jueces hacen una distinción que la ley no hace e interpretan de manera restrictiva el derecho de propiedad. Desconocen, advierten, en dónde se ampara el Tribunal para distinguir el concepto de ciudad en criterios técnicos y subjetivos referidos al desarrollo urbano o no, cuando lo único que puede definir una ciudad, conforme al artículo 6 referido, es que la ley la declare como tal.
En este sentido, afirman, tampoco es aceptable el rechazo de la información posesoria basado en el plano de la finca donde se indicaba que el inmueble era propiedad municipal, o bien, aplicar el criterio de que el contrato de cesión de derechos posesorios de quienes realizaron la titulación, es de arrendamiento en la milla marítima del pacífico; pues tal y como se ha venido explicando, cuando el ordenamiento jurídico ha dispuesto la posibilidad de adquirir la propiedad privada de una parte de la zona marítimo terrestre, como lo indica el transitorio II de la Ley 4558, donde se desafectaron 150 metros de los 200, se autorizó a particulares quienes poseían los inmuebles por más de 30 años, a titularlos, incluyendo también a quienes tenían un derecho de arrendamiento con las municipalidades. Quinto: alegan conculcados los cardinales 455 y 456 del Código Civil, artículo 45 de la Constitución Política, numeral 1 de la Ley sobre inscripción de documentos en el Registro Público, así como el canon 190 de la LGAP.
Indican, al haber adquirido al amparo del Registro Nacional, dado que la propiedad está debidamente inscrita, gozaba de publicidad registral, desde hace 40 años; es claro que de ser considerado ahora un bien de dominio público, lo correspondiente es que se les indemnice. El actor, apuntan, debió haber evitado que la inscripción del terreno se hubiese llevado a cabo, lo cual le genera responsabilidad por su negligencia. Incluso, opinan, se transgrede el principio constitucional de igualdad ante la ley, precepto 33 de la Carta Magna, dado que si el propietario del terreno fuese un estadunidense, este podría, con base en el Tratado de Libre Comercio con Estados Unidos, acudir ante un centro de arbitraje internacional, por haber realizado una inversión en Costa Rica, siendo lo más probable que resulte vencedor. Aunado a lo anterior, opinan, la violación a los numerales 455 y 456 del Código Civil se da en el tanto durante el tiempo que va del año 1979 a la actualidad, es decir, más de 40 años, el inmueble 31355-000 ha permanecido inscrito en el Registro Nacional, debiéndose entender y presumir que lo que no aparezca explícitamente en las inscripciones registrales, no existe en la realidad jurídica.
Muchas personas han invertido dinero en ese predio, aseguran, siempre al amparo de la buena fe registral; y en el entendido que estaba dentro de la excepción establecida en la LZMT. Llevan a cabo una disertación doctrinaria sobre el tema de la publicidad registral. De esta manera, concluyen, no procede la anulación del asiento de inscripción de la finca 31355-000, así como tampoco de la información posesoria que dio origen al título. En su criterio, existe responsabilidad objetiva del Estado, pues aún y cuando sea viable la anulación de la inscripción, esto no se puede perjudicar los derechos adquiridos de buena fe. Todo lo cual, aseguran, es conteste con lo estipulado en el canon 144 de la LGAP, en el tanto el acto administrativo no puede ser ejercitado en perjuicio de terceros de buena fe, siendo que toda lesión causada a los derechos subjetivos, deberá ser indemnizada en su totalidad.
Señalan, se da la violación del cardinal 456 del Código Civil, por no aplicación, en el tanto la declaratoria de nulidad que pueda establecerse en contra de títulos de propiedad, que se encuentren en poder de personas distintas a quienes promovieron las gestiones de titulación, no puede perjudicarles al ser adquirentes de buena fe, por lo que de declararse la nulidad del título, se debe “preservar la propiedad” mediante el equivalente en dinero. No solo, dicen, sobre el valor del bien, sino igualmente, lo pagado en impuestos y servicios públicos; ello en virtud de que el Estado no puede sacar provecho de su propia incuria. Petitoria: se case la sentencia del Tribunal y se declare sin lugar la demanda. Se acoja la reconvención en su pretensión principal o en su defecto la subsidiaria. El pago de las costas a cargo del Estado.
VI.Relativo al primer agravio, importa indicar que los casacionistas hacen referencia a varias inconformidades; y en virtud de ello este reparo se separará en diferentes temas para analizarse en el siguiente orden: a) Falta de motivación del fallo: aducen, los juzgadores se limitaron a decir que hubo una imprecisión en los parámetros de medición utilizados para determinar cuál era la zona de pleamar. No razonaron con profundidad el por qué restó credibilidad al peritaje. El Tribunal se mostró complaciente con las pretensiones del Estado, pues dio a sus testigos el rango de peritos. Sucede con el testigo Julio Bustamante Bustamante, quien indicó que el 98% del terreno está compuesto de humedales. Sin embargo, el Tribunal no explica por qué asume que el terreno en discusión está dentro de ese 98%, pues esta afirmación solo podría basarse en prueba técnica. b) Preterición de prueba: también aducen mal valorada, y es sobre el peritaje del topógrafo José Ramón Gutiérrez González: profesional, quien indicó había más de 7.000 kilómetros cuadrados del terreno que están fuera de la zona marítimo terrestre.
Igual sucede con el peritaje del señor Luis Ángel González Alfaro, perito nombrado por el Tribunal, quien concluye que al menos 16.676 metros cuadrados del bien en cuestión no están dentro de la zona marítimo terrestre. Siendo que a estas porciones de tierra no se les puede dar igual trato que al resto de la finca. c) Valoración de la prueba: Julio Bustamante Bustamante, dijo que el predio era atravesado por “criques” artificiales, ello lógicamente excluiría humedales y manglares. La polémica de si esos canales son naturales o artificiales, solo se soluciona con un peritaje. Lo correcto era pedir otra prueba técnica. Tribunal consideró que un área del terreno no estaba dentro de la zona marítima terrestre, pero que tenía humedales y estaba dentro del Parque Nacional. Para ello se basa únicamente en lo que dice el testigo Julio Bustamante Bustamante, de que el 98% del área comprendida por el Parque Nacional es de humedal, lo cual nunca fue demostrado.
Oficio Acopac-011-11 redactado por Ronald Chaves, quien dijo que antes del Decreto Ejecutivo 29177-Minae, Playa Rey no formaba parte de Manuel Antonio, lo cual además, refuerza la tesis del deber de expropiar. Informe de Mattey Fonseca sobre el plano P-15177-1994, donde se evidencia que el predio no estaba cubierto en su totalidad por manglar; y manifiesta que alguna vez estuvo cubierto, pero no menciona proporciones; sin embargo, no hay base para tal afirmación. Luis Quirós, quien funge en este proceso como testigo y no como perito, dijo no conocer el terreno antes del año 2005. El Informe del Instituto Geográfico Nacional Degeo-019-11, establece que el predio está en zona marítimo terrestre, ubicado en zonas de humedal y manglar, sin embargo, el bien no posee tales características, este estudio se basa solo en archivos y en fotografías que datan de 1949, 1961 y 1974; las cuales además no están adjuntadas al informe.
El peritaje del profesional Luis Ángel González Alfaro en el tanto, este manifestó en su informe había una porción del terreno que estaba fuera de la zona marítimo terrestre. Debiéndose tomar en cuenta, insisten los recurrentes, la situación del terreno, ya que el Parque Nacional Manuel Antonio ha cambiado en los últimos años. Para el año 2000 ya había una situación jurídica consolidada, previo a la ampliación que se hizo del Parque, y debiéndose tomar en cuenta que el terreno en discusión no formaba parte de este. Los manglares que hay en la zona son obra del ser humano. No existe prueba alguna que diga cómo era el terreno antes de 1949.Argumento de la PGR de que peritaje estaba malo porque no contempló zona de manglar, no es viable porque el manglar no está dentro de la zona marítimo terrestre, conforme la delimitación que hace el artículo 10 de la LZMT, los manglares forman solo una parte de la zona pública.
Da más valor a los testigos que al peritaje, aún y cuando estos testimonios son ambiguos e imprecisos. La carga de la prueba recae sobre el Estado quien debía demostrar de manera técnica cuál es la situación del terreno.
VII.Sobre la falta de motivación. No comparte esta Cámara las afirmaciones hechas por los recurrentes, conforme se explicará. En el caso concreto, al hacer una lectura íntegra de la sentencia, es evidente que las determinaciones tomadas por los juzgadores se sustentan en diferentes pruebas y es lo que da soporte a la resolución final tomada. En este sentido, en el fallo se desarrollan una serie de argumentaciones que tienen como base: el informe elaborado por el Programa de Regularización de Catastro, el oficio ACOPAC-OT-055-09 del Programa de Ordenamiento Territorial del Área de Conservación Pacífico Central del Sistema de Áreas de Conservación; en donde se concluye que el bien en discusión se encuentra dentro de la zona restringida y zona pública, dado que está ubicado dentro del Parque Nacional. En igual línea, los jueces hacen referencia, a lo estipulado en el contrato que dio origen a la información posesoria.
Además, se fundamentan en el informe y croquis del señor José Ramón Gutiérrez González, así como en el dictamen pericial del topógrafo Luis Ángel González Alfaro. Se utiliza en el desarrollo de la sentencia impugnada los testimonios de: Luis Alberto Quirós Rodríguez y Julio Bustamante Bustamante. También hay un análisis del plano P-15177-74. Lo anterior evidencia el estudio hecho por el Tribunal, pues a partir de este resuelve el problema sometido a su juicio. Lo relativo al testimonio del señor Bustamante Bustamante y el peritaje, son solo parte de las probanzas que fundamentan los razonamientos de los juzgadores. Así, en este sentido, no evidencia esta Sala la existencia de falta de motivación de la sentencia, debiéndose denegar este reproche.
VIII.Relativo a la preterición de prueba. Las probanzas que aducen los recurrentes no fueron valoradas, son específicamente el informe del señor José Ramón Gutiérrez González y el del perito Luis Ángel González Alfaro. Sin embargo, tal y como se puede notar a folio 666 del expediente, los juzgadores hacen clara referencia a esos dos documentos y le dan la valoración a cada uno de ellos. Así expuso el Tribunal: “[…] Las pruebas que vinieron a desvirtuar la ubicación, fueron un croquis e informe elaborados por el topógrafo José Ramón Gutiérrez González, visibles a folios 209 y 291 del expediente judicial y el informe pericial vertido por Luis Ángel González Alfaro, quien dijo que parte (dieciséis mil seiscientos setenta y seis metros cuadrados), de la finca no está ubicada dentro de la zona inalienable. Considera el Tribunal, que el informe pericial, tanto escrito, como su explicación en la declaración brindada por el perito en el juicio oral y público, no le merecen crédito a este Tribunal, por las siguientes razones: tal y como lo indicó la señora Procuradora en sus conclusiones, hubo imprecisiones en la forma en los parámetros de medición utilizados por el topógrafo, a la hora de determinar la zona de pleamar.
Por otra parte, su formación es como topógrafo por lo que su labor se limitó a medir la finca, sin tomar en cuenta la zona de manglar, que aún cuando su apreciación fuera de que no era un estero, no cuenta con la formación profesional para establecer (sic) opinar acerca de la existencia de manglar dentro de la superficie medida, situación que sí fue establecida por los testigos aportados por el Estado, Luis Alberto Quirós Rodríguez y Julio Bustamante Bustamante, quienes en su condición de Ingenieros Agrónomos, declararon acerca de su existencia e importancia. El testigo Bustamante Bustamante declaró que el Parque Manuel Antonio estaba constituido por noventa y ocho por ciento humedales y dos por cientos tierra firme. También debe mencionarse el plano catastrado P-15177-74, se indica la presencia del estero en el lindero norte de la propiedad. Igual consideración ha de hacerse respecto de la medición hecha por el topógrafo Gutiérrez González […]”.
Resulta evidente que el Tribunal sí se manifestó sobre esas dos pruebas, es decir, no las ignoró, de tal manera no es posible se diere la alegada preterición probatoria, y por ende, no existe, la violación normativa que aducen los casacionistas, de tal manera que el agravio deberá ser denegado.
IX.Respecto de las indebidas valoraciones de prueba. Las juzgadoras inician su exposición indicando que, con base en el contrato firmado por el señor Blanco Brunetti y los esposos Carlton Drummond y Strehlow Empie, el terreno en cuestión se encuentra dentro de la milla marítima y que en la escritura otorgada ante los notarios Bernal Ulloa Flores y Jorge Luis Víquez Cerdas, se hace clara referencia de una finca sin inscribir que es un “derecho de arrendamiento” en la milla marítima del Pacífico. En el plano P-15177-74, que sirve de base para la información posesoria, se especifica que el terreno es propiedad de la Municipalidad de Aguirre. De tal manera que, consideraron las juezas, era evidente que en este predio lo que se dio fue un arrendamiento por parte de la Municipalidad y no un derecho de posesión mediante el trámite de información posesoria para obtener la titularidad del bien. Asimismo, se indica en el fallo, que el informe elaborado por el Programa de Regularización de Catastro, del 3 de junio de 2009, el cual no ha sido desacreditado ni se ha podido demostrar su inexactitud, establece que el predio en cuestión está dentro de la zona marítimo terrestre, una parte en zona restringida y otra en zona pública.
En esta línea de pensamiento, el Tribunal refiere al oficio ACOPAC-OT-055-09 del 18 de mayo de 2009, del Programa de Ordenamiento Territorial del Área de Conservación de Pacífico Central del Sistema de Áreas de Conservación, donde se indica que conforme al plano P-15177-74, el terreno se encuentra dentro del Parque Nacional Manuel Antonio, lo que en criterio del Tribunal tampoco fue desvirtuado. Con base en estos dos informes, en la resolución se concluye: que el bien está dentro de la zona marítimo terrestre, que contiene manglares, así como los esteros y áreas pantanosas. Por ende, para las juezas, es evidente la demanialidad del bien, no solo por pertenecer al Parque Nacional, sino también, porque se ubica dentro de los terrenos antes descritos. Asimismo, dicen las juzgadoras, la condición de bien demanial no ha sido objetada por los codemandados, ya que más bien estos piden ser expropiados.
Continúa el Tribunal analizando el peritaje de Luis Ángel González Alfaro, en donde se indica hay un área de 16.666 metros cuadrados de la finca en cuestión que no está dentro de la zona inalienable. Sin embargo, a las juezas no les mereció crédito tal afirmación, pues en su criterio, existió imprecisión en los parámetros de medición utilizados por el topógrafo a la hora de determinar la zona de pleamar, pues no tomó en cuenta el área de manglar. Además, para ellas, el hecho de que el profesional tuviese una formación de topógrafo y que su labor se limitase a medir la propiedad, lo hace inidóneo para opinar acerca de la existencia de manglar dentro de la superficie medida. Pero, para las juezas, sí fue establecida, la existencia y condición de manglar y humedal, por los testigos Luis Alberto Quirós Rodríguez y Julio Bustamante Bustamante, ambos ingenieros agrónomos; y, de la declaración del segundo se corrobora que el Parque Nacional Manuel Antonio está constituido en un 98% de humedales y 2% de tierra firme.
En esta línea de pensamiento considera el Tribunal, es conteste con lo que indica el plano P-15177-74, en donde se establece la presencia de un estero en el lindero norte. Ahora bien, sobre el topógrafo Gutiérrez González, indican, de su informe no hay especificación alguna sobre la zona de manglar. De esta manera concluyen las juzgadoras, la finca en cuestión se encuentra dentro de la zona marítimo terrestre, no solo por su extensión, sino también, ante la presencia de manglares y humedales. Todo lo cual, según expresan, fue acreditado por el Estado y no desvirtuado por los codemandados.
X.La LZMT del 16 de marzo de 1977, en lo de interés al caso, desde su promulgación ha establecido en su artículo 1 que la zona marítimo terrestre constituye parte del patrimonio nacional, le pertenece al Estado y es inalienable e imprescriptible. Resguarda su protección, así como la de sus recursos naturales al Estado, sus instituciones y a todos los habitantes del país. Por su parte, el numeral 3 de esa misma ley, en su párrafo segundo impone que el usufructo y administración de la zona marítimo terrestre, tanto de la zona pública como de la restringida, corresponde a la municipalidad de la jurisdicción respectiva. El canon 6 indica que las disposiciones de esa ley no se aplicarían a las áreas de las ciudades situadas en los litorales, ni a las propiedades inscritas, con sujeción a la ley, a nombre de particulares, ni a aquellas cuya legitimación reconozcan las leyes. El precepto 7 ídem, impone que los terrenos situados en esta zona no pueden ser objeto de informaciones posesorias y los particulares no pueden apropiarse de ellos ni legalizarlos a su nombre, por este u otro medio.
Por su parte el mandato 9 ibídem, señala a la zona marítimo terrestre como la franja de 200 metros de ancho a todo lo largo de los litorales Atlántico y Pacífico de la República cualquiera sea su naturaleza, medidos horizontalmente a partir de la línea de la pleamar ordinaria y los terrenos y rocas que deja el mar en descubierto en marea baja. Además comprende las islas, islotes y peñascos marítimos, así como toda tierra o formación natural que sobresalga del nivel del océano dentro del mar territorial de Costa Rica, exceptuándose a la Isla del Coco, la cual está bajo dominio y posesión directos del Estado y aquellas otras islas cuyo dominio o administración se determine en esa ley o leyes especiales. Asimismo, el cardinal 10 LZMT aclara que la zona marítimo terrestre se compone de dos secciones: a) la denominada ZONA PÚBLICA, que es la faja de 50 metros de ancho a contar de la pleamar ordinaria, y las áreas que quedan al descubierto durante la marea baja; b) la ZONA RESTRINGIDA, constituida por la franja de 150 metros restantes o demás terrenos en caso de islas.
Los islotes, peñascos y demás áreas pequeñas y formaciones naturales que sobresalgan del mar corresponden a la zona pública. El mandato 11 ídem señala que zona pública se debe entender también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional. El numeral 20 ibídem, impone que salvo las excepciones que establezca la ley, la zona pública no puede ser objeto de ocupación bajo ningún título ni en ningún caso. Además de que nadie puede alegar derecho sobre esta. El párrafo primero del precepto 34 de esa misma ley, indica que las municipalidades deben atender directamente la conservación de la zona marítimo terrestre y sus recursos naturales. Ahora bien, el canon 39 establece que solamente en la zona restringida se pueden otorgar concesiones, salvo disposiciones especiales de ley; debiendo esta Cámara indicar que también están los permisos de uso de dominio público de contenido precario, conforme lo estipula el numeral 154 de la Ley General de la Administración Pública.
Lo anterior, se complementa con el artículo 40 LZMT el cual prevé, que únicamente las municipalidades pueden otorgar dichas concesiones. Por su parte el numeral 41 de esa ley, establece que las concesiones serán únicamente para el uso y disfrute de áreas determinadas en la zona restringida, por el plazo y bajo las condiciones que esa misma ley establezca. En este sentido, cabe indicar que en el caso de estudio no se ha logrado demostrar se diera el proceso para declarar a los demandados ni a ninguna persona que estuvo antes en el terreno como concesionario de la parcela, de tal manera que no es posible con base en esta perspectiva, referirse a ellos ni como concesionario, ni como arrendantes. Ahora bien, siguiendo con el análisis normativo, el ordinal 71 ídem impone la nulidad absoluta de todos los actos, contratos, acuerdos y disposiciones realizados o tomados a partir de la promulgación de la ley número 5602 del 4 de noviembre de 1974 (esta es la que suspende la vigencia de la Ley número 4558 del 22 de abril de 1970, denominada Ley de Urbanización Turística de la Zona Marítimo Terrestre). Finalmente el precepto 82 ibídem atribuye el carácter de orden público a esta ley, y deroga la número 4558 y sus reformas.
XI.Importa también traer a colación, para resolver lo que en derecho corresponda, lo que disponía la Ley 4558 del 22 de abril de 1970 antes mencionada. En el canon 6 establecía que los 50 metros de la zona marítimo terrestre a partir de la pleamar ordinaria son inalienables y en ningún caso podían ser objeto de arrendamiento o venta. En virtud de lo cual, nadie puede alegar derecho alguno sobre dicha franja, dedicada a uso público para fines de esparcimiento, recreo o libre circulación. El artículo 7 mencionaba que los 150 metros restantes, tierra adentro, sí podían ser objeto de arrendamiento, pero establecía ciertos lineamientos. El numeral 8 instituía que después del máximo de 10 años de arrendamiento, las municipalidades podían vender las parcelas arrendadas a los interesados quienes lo solicitasen. Pero esta ley, en el transitorio tercero impuso la desafectación de los 150 metros en los casos de particulares que hubiesen poseído lotes o fincas, exigiendo únicamente una posesión por más de 30 años de manera quieta, pública, pacífica y sin interrupción y pudiéndolos inscribir mediante el trámite de Informaciones Posesorias.
Sin embargo, este transitorio fue derogado rápidamente, por la Ley 4847 del 4 de octubre de 1971, lo cual significó que solo tuvo vigencia por escasos 17 meses. Posteriormente, con la Ley número 5602 del 4 de noviembre de 1974, según se indicó, en el artículo primero se suspendió la vigencia de la Ley 4558 hasta tanto no se dictase una nueva ley. Pero agregó en el precepto 3 ibídem que ninguna playa ni isla, marítima o fluvial, reguladas en la Ley 4558, podía ser vendida, arrendada ni subarrendada, durante el plazo de suspensión de esa ley, sin perjuicio únicamente de las prórrogas de derechos de arrendamientos que sean procedentes de conformidad con el ordenamiento jurídico. Ordenó a las municipalidades abstenerse de conceder permisos de construcción cuando se trate de edificaciones en terrenos que se poseen como consecuencia de los derechos de la ley 4558.
XII.En el caso de estudio, es un hecho no controvertido que Max Blanco Brunetti y los esposos William Carlton y Muriel Strehlow, el 11 de agosto de 1973, firmaron un contrato en donde indicaron, según se desprende a folio 31 del expediente: “[…] que por este medio el señor Blanco Brunetti vende por iguales partes a los señores William Carlton Drummond y Muriel Strehlow Empie, quienes aceptan, su finca sin inscribir que es un derecho de arrendamiento en la Milla Marítima del Pacífico que es terreno para agricultura con una casa de habitación de madera, sito en “El Rey” de Marítima distrito primero, cantón de Aguirre, Provincia de Puntarenas y lindante norte, estero salado en medio a Rigo Cardela; Sur (sic), Océano Pacífico con un frente de mil trescientos veinticinco metros; este, Bernardo Espinoza Cordero y Oeste (sic), calle pública con ciento noventa y cinco metros (sic) de frente.- Mide: veintidos (sic) hectáreas, ochenta y tres metros, veinticinco decímetros, ochenta centímetros cuadrados.- Está libre de gravámenes.- Junto con la propiedad trasmite el vendedor la posesión ejercida desde el día doce de octubre de mil novecientos setenta y la de su anterior propietario, don Ramón Herrera López, por espacio de más de diez años, todos en forma quieta, pública, pacífica, continúa(n) (sic) y a título de dueño.- El precio de la venta es la suma de veinticinco mil dólares […] Ambas partes aceptan expresamente que la presente finca se encuentra ubicada en la Milla Marítima del Pacífico por lo que presentarán en conjunto una solicitud a la Municipalidad de Quepos, a fin de que el contrato de arrendamiento que tiene el señor Blanco sea debidamente traspasado a los señores Drummond.- […]”.
Según se ha visto del análisis normativo hecho en considerandos anteriores, el único momento cuando los 150 metros de zona restringida fueron desafectados, fue con el transitorio III de la Ley 4558 del 22 de abril de 1970, sin embargo, este fue derogado poco tiempo después, el 4 de octubre de 1971 mediante Ley 4847. El contrato referido supra, fue suscrito el 11 de agosto de 1973, es decir, fuera del lapso de 17 meses cuando se permitió adquirir como propiedad privada, esta franja de los 150 metros y es evidente que el señor Max Blanco Brunetti, nunca adquirió derecho de propiedad sobre esa zona. En este punto, se hace necesario mencionar, que aún y cuando los contratantes, adujeron en su negocio que el contrato era de compra venta, este como tal tiene objeto legalmente imposible, pues Blanco Brunetti, al no ser propietario del terreno en discusión, y que conforme se expuso, no se ha demostrado en este proceso que ostentase el título de concesionario del bien, pues no hay prueba que demuestre siquiera se abrió el procedimiento para su reconocimiento, o bien, en último caso que tuviera algún tipo de permiso por parte de la Municipalidad.
No obstante lo anterior, traspasó el predio al matrimonio Carlton Strehlow. Aunado a lo anterior, no se puede dejar de lado que los mismos contratantes expresamente establecen lo que están negociando es la Milla Marítima y lo correspondiente era hacer las gestiones ante la Municipalidad para continuar con el arrendamiento y su cesión si es que esta existía, lo que no se acreditó. No obstante lo dicho, como bien lo afirman la parte actora y los codemandados, aquellos extranjeros, en el año 1978 inician un trámite de información posesoria para titular el terreno, aún y cuando para ese momento ya había entrado en vigencia la LZMT del 16 de marzo de 1977, la cual, como se ha visto, imposibilita la titulación dentro de los 200 metros de zona marítimo terrestre. De hecho los declara inalienables e imprescriptibles y no sujetos a información posesoria, denegándole la posibilidad a particulares de apropiarse de esos terrenos o legalizarlos a su nombre.
Además con claridad instaura que en la zona restringida solo se pueden otorgar concesiones, lo cual está a cargo del gobierno local respectivo. A pesar de lo anterior, el juez de la Alcaldía de Aguirre y Parrita en resolución número 138 de las 10 horas 30 minutos del 17 de mayo de 1979, manifestó que en el trámite de información posesoria se cumplieron todos los requisitos que exige la Ley de Informaciones Posesorias y tuvo como demostrado, para lo que al caso atañe, que el señor William Carlton y la señora Muriel Strehlow, eran los dueños de la finca sin inscribir, la cual la estimaron en ¢50.000,00 y que adquirieron por compra. Asimismo, consideró el juzgador, que la poseían de manera pública, quieta, pacífica y sin interrupción, como dueños legítimos cada uno y por más de 10 años. Además, consideró ese juez, existía un plano debidamente inscrito en la oficina de Catastro Nacional. A continuación, aprobó, la inscripción del predio objeto de la información posesoria, pues en su criterio se habían cumplido los requisitos que establece dicha Ley.
Ordenó al Registro Público de la Propiedad que inscribiera la finca a nombre de los gestionantes, sin perjuicio de terceros de mejor derecho. Ha de señalarse, además, que lo resuelto en aquel proceso de información posesoria produce cosa juzgada formal, revisable en un proceso como el presente, donde lo dispuesto sí tiene como consecuencia la cosa juzgada material, y es en virtud de ello que importa entrar al siguiente análisis. En el contrato se indica que la propiedad tiene 1.325 metros de frente, que dan al océano Pacífico y 195 metros de fondo cuyo lindero es la calle pública al oeste. De esta afirmación, es claro y evidente que la propiedad, o por lo menos, gran parte de ella, se encuentra dentro de los 150 metros de zona restringida prevista en la LZMT. Entonces, aún y cuando se emitió una decisión judicial que ordenó la titulación del bien, lo cierto es que fue un acto judicial contrario a la ley y revisable por la vía ordinaria como lo ha instado la Procuraduría General de la República.
Dado que la LZMT vigente para ese momento impedía dictar una decisión de ese tipo. Además, según se ha visto, el numeral 71 ídem, califica de nulos todos los actos (sobre los cuales la ley no hace distinción alguna a los estrictamente administrativos, sino también los judiciales), contratos, acuerdos y disposiciones que contravengan lo dispuesto en ese cuerpo normativo, de tal manera, que como bien lo hizo el Tribunal, esa decisión judicial debe ser anulada, pues es evidente, que la finca en cuestión, se encuentra dentro de la zona marítimo terrestre, y es zona protegida, afirmación hecha por los propios casacionistas, quienes reconocen y así se desprende del recurso, tal circunstancia; de manera que se concluye no tienen derecho de propiedad alguno sobre esta parte del predio.
XIII.Por otro lado, alegan los casacionistas el Tribunal no tuvo por demostrado que una parte del terreno se encontrara fuera de la zona marítimo terrestre, por cuanto hizo una valoración indebida de varias pruebas. Así, en primer lugar, corresponde hacer referencia al peritaje emitido por el profesional Luis Ángel González Alfaro, quien llevó a cabo el estudio en febrero de 2013 y rindió su informe en el juicio oral y público celebrado en julio de 2014. Según se desprende de folio 522, en dicho estudio el perito indicó: “[…] SE RATIFICA QUE LA FINCA DE LITIS, LA INSCRITA AL FOLIO REAL N° 6031355-000, PROPIEDAD DE GRUPO DE INVERSIONISTAS DE COSTA RICA SOCIEDAD ANÓNIMA, SE LOCALIZA FUERA DE LOS LÍMITES DEL PARQUE NACIONAL MANUEL ANTONIO, PERO SÍ, DENTRO DE LA ZONA MARÍTIMO TERRESTRE. / SEGÚN MI ESTUDIO DE CAMPO, SE COMPRUEBA TAMBIÉN QUE, HAY UN ÁREA DE LA FINCA COLINDANTE CON EL ESTERO GARITA, (NORTE DE LA FINCA), QUE NO SE ENCUENTRA DENTRO DE DICHA ZONA./ SU AREA (sic) ES DE 16666 METROS CUADRADOS.
(VER LÁMINA ADJUNTA). […] CONCLUSIÓN […] QUEDA MUY CLARO QUE LA FINCA SE UBICA EN GRAN PARTE DENTRO DE LA ZONA MARÍTIMO TERRESTRE. /LA PARTE QUE NO ESTA (sic) DENTRO DE ESTA ZONA FUE DETERMINADA CON AYUDA DE LOS PUNTOS QUE SE LEVANTARON EN EL CAMPO CON GPS. / ESTA ZONA DE EXCLUSIÓN TIENE UN ÁREA DE 16666 METROS CUADRADOS.”. También, con posterioridad, en el juicio oral (10:15:15), el Perito, ante la pregunta de si hay un estero en la propiedad que visitó señaló: “[…] puedo sentirme confundido en este momento si es un canal o un estero, pues en realidad diría yo que más bien es un canal, porque el canal a diferencia del estero, el estero tiene mucha vegetación, que todos conocemos: raíces altas y toda la cuestión, verdad, y no recuerdo haber visto eso. Simplemente lo veo como un canal. […]”. Es evidente que entre la declaración de don Luis Ángel González y lo escrito en su informe, hay una disparidad y no queda claro si en realidad al límite norte de la propiedad lo que hay es un estero o un canal.
Sin embargo, a esta Sala no le merece fe la respuesta dada por el perito durante el juicio debido a que este cambio de parecer se dio en circunstancias particulares. La representación del Estado le consultó al perito si él había visto en el lindero norte un estero, pregunta a la cual los codemandados se opusieron. Cuando el Tribunal permite al abogado explicar su oposición, este junto con la pregunta induce la respuesta, en el sentido de afirmar que efectivamente al norte hay un estero cuando el criterio mantenido por ellos, es que en ese punto boreal hay un canal. Esta alocución, se dio mientras el perito se encontraba en la sala; y posterior a ello es cuando titubea en su decisión, respondiendo lo recientemente transcrito. Lo anterior lleva a esta Cámara a considerar que el profesional respondió a la pregunta sugestiva, de la parte codemandada. Aunado a lo anterior, se debe agregar, que durante toda su disertación, el señor Luis Ángel González, es reiterativo en que no recuerda muy bien la propiedad, ya que el trabajo, lo había realizado mucho tiempo atrás y no revisó el estudio hecho, previo a la celebración del juicio; lo cual refuerza lo establecido en el informe, donde vale aclarar, no hace mención alguna de la existencia de un canal.
Asimismo, también se cuestiona el valor concedido a la declaración del testigo Luis Alberto Quirós Rodríguez, a quien a juicio de los casacionistas se le dio rango pericial, cuando en realidad se trata de un testimonio. Afirmación que no es compartida por este Órgano decisor, como de seguido se explicará. El Testigo perito o experto (conforme artículos 106 y 107 del CPCA y numeral 302 de la LGAP), según consta en vídeo (11:23:22), es funcionario del Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía (por sus siglas Sinac). Es ingeniero agrónomo y fue encargado del Área de Conservación por un período de casi tres años, desde noviembre de 2006 a junio de 2009, período durante el cual se encargó de la administración del Parque Nacional Manuel Antonio. Señaló, que Playa Rey se introdujo al Parque, justamente por ser zona de humedal. También afirmó, es casi imposible construir ahí, porque después de la playa lo que hay es un humedal, lo cual es un espejo de agua y un manglar; de allí la dificultad de que se pueda levantar alguna infraestructura.
Ante la consulta hecha sobre la viabilidad de actividad agraria en la zona, contesta que el único cultivo adaptable sería el arroz, pues se trata de sellos en la superficie de agua. De hecho, confirmó que lo existente después de la playa es un manglar, donde no se puede cultivar nada, salvo mangle. Incluso aseveró que en el terreno en cuestión, nunca presenció actividad de tipo agrícola, de haberse dado, ellos como responsables habrían actuado e impedido se realizara la actividad. En sentido similar declaró el testigo perito o experto Julio Bustamante Bustamante, según se puede apreciar en el vídeo (14:17:20), quien también es ingeniero agrónomo, con una maestría en agroforestería o silvicultura. Labora en el Sinac y con base en su conocimiento experto explicó en qué consistía un humedal. De igual manera, hizo referencia a que en el sector de Playa Rey, hay unos manglares asociados a unos esteros localizados en la bocana del Río Naranjo e igualmente, existen manglares en la bocana del Río Savegre.
Afirmó que Playa Rey es solitaria y no hay desarrollo de instalaciones eléctricas, razón por la cual, llega a desovar, principalmente, la tortuga Lora. Destacó, la presencia también de la tortuga Negra del Pacífico así como, a veces arriba la tortuga Baula. Aduce, en ocasiones se ha visto a la tortuga Carey, la cual hace sus nidos en la maleza. En esta línea de pensamiento, explica que de ocho tortugas marinas que hay en el mundo, seis llegan a desovar al Pacífico. También, testificó no conocer la finca en cuestión. Pero que en la zona no existen casas ni construcciones. Lo único que hace referencia es a la existencia de un “crique”, el cual describe como una construcción hecha por el “hombre” para drenar terrenos. Entonces, tal y como se puede observar, de las anteriores probanzas, el testigo experto Quirós Rodríguez, es contundente al afirmar que del lado norte del predio objeto de contienda, lo que hay es un estero, lo cual es conteste con el informe pericial presentado por escrito.
Siendo, de especial relevancia para esta Sala, que este testigo conoce muy bien el lugar y dada su profesión insistentemente afirma que la zona en cuestión es de humedales y manglar; carece de relevancia el hecho de que iniciare funciones en la zona a partir del año 2005, es decir, cinco años con posterioridad a cuando Playa Rey fue incorporada al Parque Nacional, puesto que lo importante es que con su testimonio se logra determinar el conocimiento que él tiene del lugar. Ahora bien, el testimonio experto de don Julio Bustamante Bustamante, es ambiguo respecto del terreno en litis, dado que, constantemente afirma no conoce el bien; no pudiendo dar certeza sobre si en la margen norte hay un estero o un canal y por ende acreditar si el lugar es un 98% humedal, como lo afirma, de tal manera que con su decir, no hay forma de confirmar si en la margen norte existe un estero o un manglar. Sin embargo, no considera esta Sala, estos testigos sean complacientes con el Estado, simplemente ambos, lo que hacen es explicar de manera amplia el rol y naturaleza del Parque Manuel Antonio en el ecosistema del lugar, de la región, del país, e incluso del continente.
Ambos son contundentes en señalar la existencia de un manglar y un estero. Ahora bien, resulta trascendental, traer a colación la Convención Ramsar, suscrita por Costa Rica y vigente desde el 27 de abril de 1992, la cual en el artículo 1, define como humedal: “1. A los efectos de la presente Convención son humedales las extensiones de marismas, pantanos y turberas, o superficies cubiertas de aguas, sean éstas de régimen natural o artificial, permanentes o temporales, estancadas o corrientes, dulces, salobres o saladas, incluidas las extensiones de agua marina cuya profundidad en marea baja no exceda de seis metros.”. Este concepto dirime un punto debatido en este proceso, y es que para ser considerado humedal y que proceda su protección, carece de importancia si fue creado por obra de la naturaleza o por el ser humano, es decir, natural o artificial. Aunado a lo anterior, importa también mencionar, del estudio que se hace del plano catastrado P-15177-74, se desprende que la propiedad en el lindero norte, en una pequeña porción colinda con un canal, pero otra gran parte es estero.
Conforme la prueba aportada por los propios codemandados, de folios 290 a 292, el topógrafo Ramón Gutiérrez González, afirma existe un área de 7.000 metros cuadrados que está fuera de la zona marítimo terrestre, la cual destaca en el plano en pliego 292, con un interlineado de color rojo. De lo anterior, se puede destacar: 1- la zona marcada colinda únicamente con el estero y no con el canal; 2- haciendo un análisis de las dimensiones establecidas en el plano, el punto 7-8 dice que mide 40.77 metros de distancia de punto a punto, que en mapa mide 9 milímetros. Ahora bien, el punto más largo de lo marcado con rojo por el señor Ramón Gutiérrez, tiene una distancia en mapa de 5 milímetros. De ello, se deduce que la zona destacada por el topógrafo, debe abarcar una medida real lineal de fondo de unos 23 metros aproximadamente. Así las cosas, al hacerse un análisis integral de toda la prueba, es factible colegir, del peritaje, informes y los testimonios referidos, así como de lo que establece el plano catastrado P-15177-74, que en el lindero norte de la propiedad en discusión lo que hay es un estero y manglar; y que el terreno demarcado por el topógrafo Ramón Gutiérrez González, que es lo que alegan los demandados está fuera de la zona marítimo terrestre, tiene colindancia con el estero y manglar.
No se trata de darles a los testigos el valor de prueba pericial en sentido estricto, pues se trata del denominado testigo experto o perito, reconocido como medio de prueba desde 1978 en la Ley General de la Administración Pública, artículo 302 inciso 4, el cual señala: …Las partes podrán presentar testigos peritos cuyas declaraciones se regirán por las reglas de la prueba testimonial, pero podrán ser integrados en aspectos técnicos y de apreciación.”; este medio de prueba fue reconocido por el CPCA de manera expresa en su precepto 107, prueba que en todo caso deberá analizarse en su conjunto, con base en la sana crítica racional, según lo dispuesto en el canon 82 acápite 4) del CPCA. Ahora bien, en el informe del señor José Mattey Fonseca, se hace la siguiente afirmación: “[…] se analizo (sic) el área y el estudio integral, arriba citado, que abarco (sic) aspectos socioeconómicos, biofísicos y legales.
Se determino (sic) que la vocación del área era de protección y que ostentaba el estatus de bien demanial de acuerdo a la ley 6043. (Razón por la cual se anexo (sic) al Parque Nacional Manuel Antonio el sector de Playa El Rey² (²Así se conoce por los locales al sitio y no como Playa Savegre nombre que aparece aparece (sic) en la hoja cartográfica Quepos.) mediante el Decreto Ejecutivo N° 29177-MINAE del 17 de noviembre del 2000 precediéndose al desalojo y destrucción de construcciones por orden de la sala constitucional (sic), voto 4495-03)”. Aseveración que es conteste con el resto del elenco probatorio mencionado, pues es la vocación de área protegida y la condición biofísica, las que determinan la necesidad de que Playa Rey fuese incorporada al Parque Nacional. Además, el Informe del Instituto Geográfico Nacional Degeo-019-11, es un elemento más que demuestra la situación y naturaleza del terreno, ya expuesta de manera amplia.
En ese documento, se hacen afirmaciones como las siguientes: “[…] al sobreponer el plano de la finca en los distintos mapas de los años 1947-1949, 1961 y 2003 del Proyecto Recreativo Manuel Antonio, hojas cartográficas Quepos-Savegre 1:50.000, se observa claramente que dicha propiedad se encuentra de áreas de humedal-manglar. (Ver mapas adjuntos) [...]”. Si se revisan los mapas adjuntos que rolan de folio 490 a 492, emitidos por el Instituto Geográfico Nacional, con claridad se expresa, dichas cartografías, están elaboradas “Clasificación de campo y actualización fotoplanimétrica en 1992 con fotografías aéreas tomadas por el IGN en 1991”; lo anterior implica, aún y cuando no se hayan aportado las fotografías a las que hacen referencia los recurrentes, lo cierto es que en dichos mapas, y la conclusión de ese Instituto, es que efectivamente el terreno se encuentra hoy dentro de la zona de humedal y manglar.
Nótese que en la figura número dos, a folio 454, claramente se observa al norte de la finca en cuestión la existencia de humedales, casi en su totalidad. También, se debe mencionar el vídeo del reconocimiento judicial, practicado en etapa de medida cautelar, en donde con claridad se evidencia que el lugar es un humedal. Además que colinda con el manglar. A los minutos 3:58, 5:22 y 8:49, del vídeo, son notorias las tomas del manglar y de los árboles de mangle, donde los codemandados afirman en ese reconocimiento, que la mayor parte de la finca es así. En el acto se resalta además, por parte de los personeros del Parque, que en el lugar se gestan larvas de camarón y peces, pues es en los manglares donde nace la vida marina. En consecuencia, a este punto, conviene hacer las siguientes acotaciones normativas. Según se expuso, el numeral 11 de la LZMT, establece como zona pública los esteros y manglares, por lo que es prudente y relevante, traer a colación, lo que el ordenamiento jurídico define por tales.
El Reglamento a la Ley de Conservación de la Vida Silvestre número 32.633, define qué se debe entender por manglar: “Ecosistema dominado por grupos de especies vegetales pantropicales y típicamente arbóreas, arbustivas y vegetación asociada, las cuales cuentan con adaptaciones morfológicas, fisiológicas y reproductivas que permiten colonizar áreas sujetas al intercambio de mareas. El paisaje general está dominado por la presencia de bosques de diferentes especies de mangle, esteros y canales. Las concentraciones de salinidad varían según la estación climática y al aporte de aguas continentales encontrándose valores de concentración de las sales desde muy bajos hasta muy altos.”. Por otro lado, el Reglamento a la Ley sobre Zona Marítimo Terrestre, Decreto Ejecutivo número 7841-P, en el numeral 2 enlista una serie de definiciones, que para el caso que interesa: “[…] e) Estero: Terreno inmediato a la orilla de una ría por el cual se extienden las aguas de las mareas; f) Ría: Parte del río próxima a su entrada en el mar y hasta donde llegan las mareas; g) Marea: Movimiento periódico y alternativo de ascenso y descenso de las aguas del mar debido a las atracciones combinadas del sol y la luna; […]”.
Lo anterior cobra relevancia, pues en el caso de estudio se debe definir si la parte norte del terreno, es o no, zona marítimo terrestre, pues es uno de los cuestionamientos de los recurrentes y un punto no desarrollado en el fallo cuestionado. Como se ha visto, el artículo 9 de la Ley 6043, establece que la zona marítimo terrestre está compuesta por la franja de 200 metros de ancho a todo lo largo del litoral Atlántico y Pacífico, lo cual corre a partir de la pleamar ordinaria y los terrenos y rocas que deja el mar en descubierto en la marea baja. También se indicó en esta resolución, que el numeral 10 ídem establece que dicha zona se compone de dos secciones: la Zona Pública, que es la franja de 50 metros de ancho a contar de la pleamar ordinaria y las áreas que quedan en descubierto durante la marea baja, además de los islotes, peñascos y otras áreas pequeñas y formaciones naturales que sobresalgan del mar; en igual sentido, el numeral 11 ibídem, dice que sin importar la extensión, también serán zona pública las ocupadas por los manglares de los litorales continentales e insulares y esteros del territorio nacional.
Entonces, según la definición dada en la Convención Ramsar, necesariamente los esteros y manglares se encuentran en zona de humedal, aclaración necesaria para concluir son tipos no excluyentes. Aunado a ello, en el caso específico de los manglares y esteros, se colige, estos se ven afectados por las mareas; es más, se componen de agua salada que ingresa del mar. Con base en esta tesis, es posible afirmar, estos también se encuentran sujetos a una pleamar ordinaria, dado que en ellos es fácil determinar cuando la marea es baja o alta. El punto radica en que el ordinal 11 de la Ley 6043 del 2 de marzo de 1977 dice que esteros y manglares son zona pública; a la vez, dicho cuerpo legal, cuando define la zona pública establece como condición sine qua non, estar constituida por una franja de 50 metros de ancho que se deben contar a partir de la pleamar ordinaria, lo cual también aplicaría al caso de los esteros y manglares.
Así, partiendo de un análisis integral de las normas, ha de interpretarse que en zona de manglares y esteros, estas cuentan con una protección de 50 metros a partir de la pleamar ordinaria, que es lo que define por excelencia a la zona pública y por tanto zona marítimo terrestre. Lo anterior implica, que si el terreno señalado en el plano aportado por los codemandados, aunque dicho estudio fue elaborado por el topógrafo Gutiérrez González, se dijo tiene una extensión lineal de aproximadamente 23 metros, implica que este se encuentra sobradamente dentro de la zona pública, y era área inalienable. Esta tesis además se ve reforzada por los principios que rigen la materia ambiental, en especial la Ley de Biodiversidad número 7788, donde se establecen varios criterios aplicables cuando se tratan estos temas, en lo de interés al caso, se ha de acudir al principio precautorio o indubio pro natura el cual atiende: “Cuando exista peligro o amenaza de daños graves o inminentes a los elementos de la biodiversidad y al conocimiento asociado con estos, la ausencia de certeza científica no deberá utilizarse como razón para postergar la adopción de medidas eficaces de protección.”, asimismo, también existe un criterio de interés público ambiental: “El uso de los elementos de la biodiversidad deberá garantizar las opciones de desarrollo de las futuras generaciones, la seguridad alimentaria, la conservación de los ecosistemas, la protección de la salud humana y el mejoramiento de la calidad de vida de los ciudadanos.”.
Así las cosas, sobre la parte del terreno en discusión, ha de indicarse, corre la misma suerte que el resto de la propiedad, pues se encuentra contemplado dentro de las regulaciones de la Ley 6043. Por todo lo expuesto, el reparo primero de los casacionistas, deberá ser rechazado.
XIV.Los agravios segundo y cuarto se resolverán en conjunto al tratarse en el fondo de la misma inconformidad. En síntesis alegan los recurrentes se debe tomar en cuenta que Playa Rey, en consecuencia, el terreno en discusión, fue integrado al Parque Nacional Manuel Antonio hasta el año 2000, existiendo un derecho de propiedad anterior. Además, desde la creación de la ciudad de Quepos, que incluía Playa Rey, se debe considerar esta una ciudad costera y por ende incluida en la excepción del artículo 6 de la LZMT pero en todo caso al haber sido Quepos creada antes de la promulgación de la LZMT, no podía el Tribunal aplicarle esa ley por ser posterior. Sobre este punto, consideraron las juzgadoras, que para cuando se otorgó el título “de propiedad” de la finca vía información posesoria, ya se encontraba vigente la LZMT, pero, además para darse la exclusión del bien conforme lo establece esa normativa, debe tratarse de ciudades situadas en zona costara.
Para las juezas, el argumento utilizado por los codemandados de que Quepos fuese declarada ciudad desde 1969 y se haya realizado su delimitación en 1980 por el Instituto Geográfico Nacional, es una circunstancia por sí sola que no convierte al inmueble en cuestión, parte de la ciudad de Quepos. Indica el Tribunal, para que haya ciudad debe haber desarrollo urbano, lo cual no ha sido probado por las partes. De hecho, conciben las juzgadoras, el hecho que se haya incluido Playa Rey al Parque Nacional, evidencia, no podía ser considerada parte de la ciudad. Coincide esta Cámara con lo dispuesto por el Tribunal como de seguido se explicará. Según se ha expuesto en los considerando anteriores, el régimen de zona marítimo terrestre es anterior a la Ley 6043, data de 1828, de tal manera, no es aceptable el argumento que la creación de la ciudad de Quepos en 1963, elimina la demanialidad, imprescriptibilidad e inalienabilidad, del terreno en cuestión.
Con el fin de esclarecer aún más el tema, resulta relevante lo considerado en ocasión anterior por la Sala Constitucional: “[…] los bienes demaniales (o bienes dominicales o de dominio público) son aquellos que tienen una naturaleza y régimen jurídico diverso de los bienes privados –los cuales se rigen por el derecho de propiedad en los términos del artículo 45 de la Constitución Política–, en tanto, por expresa voluntad del legislador se encuentran afectos a un destino especial de servir a la comunidad, sea al interés público, y que por ello, no pueden ser objeto de propiedad privada, de modo que están fuera del comercio de los hombres, por lo cual, no pueden pertenecer individualmente a los particulares, ni al Estado, en sentido estricto, por cuanto éste se limita a su administración y tutela. […] Así, se trata de bienes cuya titularidad ostenta el Estado en su condición de administrador, debe entenderse que se trata de bienes que pertenecen la "Nación", con lo cual, conforman parte del patrimonio público; y que, por su especial naturaleza jurídica, presentan los siguientes atributos: son imprescriptibles, lo cual implica que por el transcurso del tiempo, no puede adquirirse el derecho de propiedad sobre ellos, ni siquiera de mera posesión, es decir, no pueden adquirirse mediante la usucapión, así como tampoco pueden perderse por prescripción; motivo por el cual los permisos de uso que la Administración conceda sobre ellos, siempre tienen un carácter precario, lo cual hace que puedan ser revocadas por motivos de oportunidad o conveniencia en cualquier momento por la Administración –en los términos previstos en los artículos 154 y 155 de la Ley General de la Administración Pública–; y las mismas concesiones que se otorguen sobre ellos para su aprovechamiento, pueden ser canceladas, mediante procedimiento al efecto; son inembargables, que hace que no pueden ser objeto de ningún gravamen o embargo, ni por particulares, ni por la Administración; y son inalienables, lo que se traduce en la condición de que están fuera del comercio de los hombres; de donde no pueden ser enajenados, vendidos o adquiridos, ni a título gratuito ni oneroso, ni por particulares, ni por el Estado, de modo que están excepcionados del comercio los hombres y sujetos a un régimen jurídico especial y reforzado.
Además su uso y aprovechamiento está sujeto al poder de policía, en tanto, por tratarse de bienes que no pueden ser objeto de posesión, y mucho menos de propiedad, su utilización y aprovechamiento es posible únicamente a través de actos debidamente autorizados, sea mediante concesión o permiso de uso, otorgado por la autoridad competente; y al control constante de parte de la Administración Pública. […]”. Resolución de las 14 horas 13 minutos del 21 de febrero de 2007, que responde al voto número 2408. Este criterio de la Sala Constitucional, lo que hace es reafirmar la posición adoptada por este Órgano decisor sobre el tema de la zona marítimo terrestre. No es admisible concluir que la declaratoria de la ciudad de Quepos de alguna manera vino a eliminar la característica de zona marítimo terrestre del terreno en discusión, resultaría inviable. Además, tal y como lo mencionan las juzgadoras, no existe en todo el expediente prueba alguna con la que se pueda demostrar que cuando la ciudad de Quepos se delimitó, se dejó a Playa Rey fuera de la zona marítimo terrestre o bien, que al momento de dictarse la Ley 3201, esta haya eliminado su condición de demanial.
Dicha normativa está compuesta de dos artículos, el primero se refiere única y exclusivamente a conceder a las Villas de Quepos y Golfito el título de ciudad y el segundo atañe a su vigencia, la cual rige a partir de su publicación. Así, no hay manera de interpretar que Playa Rey se encontraba dentro de la excepción que vino a establecer el artículo 6 de la LZMT, mucho menos, se puede aseverar, que el lugar es ciudad costera, pues tal y como se ha visto de las deposiciones de los testigos mencionados en anteriores considerandos, queda claro, el lugar ha sido siempre de reserva natural, y un espacio apartado del pueblo; además, rico en flora y fauna, razón por la cual fue incluido dentro del Parque Nacional Manuel Antonio y desde del año 2000. Conforme se ha expuesto a lo largo de esta resolución, este agravio también deberá ser denegado; ya que en este sentido se resolvió el asunto por el Tribunal en el fallo recurrido.
XV.Los reproches tercero y quinto, también se resolverán en conjunto al versar sobre el mismo tema; el cual se refiere a la responsabilidad administrativa. Consideraron las juzgadoras que al estar el bien en la zona marítimo terrestre, y ser demanial, es inembargable, imprescriptible e inalienable. Y la inscripción, por no estar conforme a derecho, no se consolida a través del tiempo y los derechos de terceros no le pueden ser opuestos. Además razonaron, que la Administración en el ejercicio de su autotutela está obligada a recuperar los bienes, sin que sea posible ampararse a la buena fe registral para no anular el título de propiedad. Así concluyen: no es posible la restitución de la posesión pedida, ni conceder la solicitud de no perturbación por parte del Estado. Al contrario, el bien debe ser considerado demanial, con todos sus atributos. Como se indicó en considerandos anteriores, en el caso de estudio la situación jurídica que se dio con el predio en cuestión nació a raíz de la solicitud del matrimonio Carlton Strehlow para adquirir la propiedad a través del trámite de información posesoria, junto con la resolución de la Alcaldía de Aguirre y Parrita que mediante resolución número 138 de las 10 horas 30 minutos del 17 de mayo de 1979, ordena la inscripción registral de la propiedad a nombre de ellos.
Es decir, lo sucedido se debió en esencia al reconocimiento hecho por un juez que otorga un derecho de propiedad propiedad mediante un proceso de información posesoria, y ordena su inscripción en el Registro Nacional. Lo sucedido no viene a cuestionarse sino hasta que el juez que debe practicar la puesta en posesión nota que se trata de zona marítimo terrestre y de un parque nacional y llama la atención de lo sucedido. Como se explicó, esta circunstancia es responsabilidad del juez que emitió tal resolución; pero, también ya se indicó que lo que este funcionario resolvió, tenía carácter de cosa juzgada formal y no material, lo cual significa que podía ser revisado en la sede ordinaria, como se da en este caso. Es por ello que, la Procuraduría General de la República, al amparo de lo dispuesto en el numeral 4 de la LZMT, ejerce las acciones correspondientes para reivindicar el bien demanial.
Con base en esta tesitura, y dada la forma cómo se está resolviendo el asunto, la responsabilidad que se debió alegar, no es la del Registro Nacional por hacer lo que le ordenó el juez, sino, debió encaminarse por la responsabilidad del Estado juez al haber concedido el derecho sobre una propiedad a particulares fuera del ordenamiento jurídico, con evidente error. Es por ello, que carece de toda relevancia para la resolución de este asunto, entrar al análisis de los actos emitidos por el Registro Nacional, dado que este proceso tiene como consecuencia la anulación de la inscripción que había ordenado el juez en el proceso de información posesoria, no así, el acatamiento del Registro Nacional del mandato judicial de registrar la propiedad. En el caso de estudio lo que le causó un daño a las demandadas, fue la declaratoria ilegal hecha por el juez que tramitó la información posesoria, sobre lo cual, vale mencionar que en ese proceso se le dio audiencia al representante estatal (Procuraduría) quien no observó se trataba de un bien demanial.
Lo solicitado no es indemnizable, ya que no se encuentra en el supuesto normativo de responsabilidad administrativa por funcionamiento anormal del Registro Público. En virtud de lo expuesto, el reparo deberá denegarse.
XVI.Queda pendiente un único punto a dilucidar, el cual, si bien los casacionistas no lo separan en un agravio independiente, se extrae a lo largo de todo el recurso. Es lo concerniente a una posible expropiación, y pago de mejoras, lo cual se puede resumir de la siguiente manera. Consideran los recurrentes, que si el Estado quiere adueñarse de esas porciones de terreno, lo procedente es que se les expropie, dado que no puede el actor aprovecharse de que una parte del bien, sí está en zona marítimo terrestre y valiéndose de ello, apropiarse de toda la heredad. Para los casacionistas, si se considerara que el terreno estaba dentro del Parque, dada las ampliaciones que se hicieron, se les debe expropiar. Sobre este punto consideró el Tribunal no procedía la expropiación en este caso pues no es posible aplicar la Ley de Expropiaciones cuando se trata de bienes de dominio público. Consideraron las juezas: aún y cuando es cierto que la PGR no realizó ninguna gestión cuando se le informó del proceso de información posesoria; no fue sino 30 años después cuando el juez civil pone en aviso de la situación, y aunque el bien en cuestión estuvo todo este tiempo en el “comercio de los seres humanos”, lo cierto es que nunca perdió su condición demanial y de titularidad pública, de tal manera que no se puede acceder a la reparación pedida por los reconventores, ya que le terreno nunca les perteneció y su imprescriptibilidad posibilita a la Procuraduría General de la República para esta acción y para su recuperación.
Solo tendrían derecho a las mejoras, dicen las juzgadoras, pero agregan, nunca hubo de parte del señor González Rivera posesión material del inmueble de tal manera que resulta imposible otorgarlas. Lo mismo ocurre con la fiduciaria Coris. Coincide plenamente esta Sala con lo dispuesto por el Tribunal. Efectivamente, tal y como se ha explicado reiteradamente, la situación del terreno en cuestión, es que en su totalidad es parte de la zona marítimo terrestre, como se ha explicado. En esa línea de pensamiento, y como se informó, es un bien demanial y por ende posee las características de imprescriptible, inalienable e inembargable. Lo anterior implica que el inmueble no está sujeto a ser adquirido por usucapión, pero tampoco es posible se pierda por prescripción negativa, lo que significa que el Estado nunca deja de ser el titular del derecho que tiene sobre este tipo de bienes. Además, es inembargable, lo que implica que no puede estar sujeto a gravamen o embargo, lo cual está relacionado con el hecho de que no deben salir del dominio del Estado.
Y además, es inalienable, lo que implica que se encuentran fuera del comercio del ser humano, de allí que no es posible su enajenación, venta, donación o cualquier otro tipo de negocio que comprometa la titularidad pública. Entonces, bajo esta tesitura, y dado que se ha comprobado que el título de propiedad que recaía sobre el terreno en discusión, es nulo, no hay manera de que pueda proceder la expropiación si para que esta se dé es requisito indispensable que quien deba ser indemnizado sea propietario; lo que no ocurre en este caso. Aducen los casacioncitas que el oficio Acopac-011-11 redactado por el señor Ronald Chaves, donde se indica que antes del Decreto Ejecutivo 29.177-Minae, Playa Rey no formaba parte del Parque Nacional Manuel Antonio, implica que les pertenecía a ellos, lo que refuerza el deber de expropiar. Sin embargo, como ya se ha explicado el punto en cuestión, no radica en si se encuentra o no en la zona límite del Parque Nacional o que Playa Rey fuese incorporada a este Parque en el año 2000, sino, desde que se concibió la protección de la zona marítimo terrestre en el año 1828, el área que comprende Playa Rey y el inmueble en discusión, han ostentado esa condición y el carácter demanial.
Con todas las consecuencias que esto implica. Además, en cuanto a las mejoras, es cierto lo razonado por las juezas de que ninguno de los codemandados en algún momento tomaron posesión material del lote, lo cual implica necesariamente que nunca pudieron realizar ningún tipo de mejoras en el lugar. Así las cosas lo procedente es rechazar este agravio.
XVII.En virtud de lo expuesto, se deberá denegar el recurso de casación presentado por los codemandados reconventores. Son las costas de este medio impugnaticio a su cargo. Artículo 150 del Código Procesal Contencioso Administrativo.
