Ordinary proceeding on a pure question of law (proceso ordinario declarado de puro derecho) brought by SYNGENTA CROP PROTECTION SOCIEDAD ANÓNIMA, represented by its general attorney-in-fact without monetary limit (apoderado generalísimo sin límite de suma), Mario Arrea Sierman, engineer, resident of Heredia; against the SERVICIO FITOSANITARIO DEL ESTADO, represented by its Director, Magda González Arroyo, agronomist, resident of Heredia; the ESTADO, represented by State Attorney (procuradora) Laura Araya Rojas, single, resident of San José; QUÍMICAS COSTARRICENSES QUICOSA SOCIEDAD ANÓNIMA, represented by its president, Marvin Martínez Araya, whose personal particulars are not stated; and DISTRIBUIDORA DE PRODUCTOS AGROPECUARIOS DPA SOCIEDAD ANÓNIMA, most recently represented by José Alberto Castillo Calvo, agronomist, resident of Limón, declared in default (rebelde). BACKGROUND (RESULTANDO)

  1. 1Based on the facts it set forth and the legal provisions it cited, the plaintiff instituted an ordinary proceeding (proceso ordinario), modifying its claims (pretensiones) at the preliminary hearing (audiencia preliminar), seeking a judgment declaring: “(…) the absolute nullity (nulidad absoluta) of the registration of the technical pesticide (plaguicida técnico) bearing the trade name Agromart Fluazifop-b-butil 80TC, under registration number 8702419, ordered by resolution AE-REG-P-RF-008-2012 at 15:25 on 30 de agosto de 2012, issued by the Registration and Application Equipment Unit of the Agrochemical Inputs and Equipment Department of the Servicio Fitosanitario del Estado (sic).”
  2. 2The co-defendants denied the claim, all raising solely the defense of lack of legal entitlement (falta de derecho).
  3. 3At 13 hours 31 minutes on 24 de marzo de 2014, the preliminary hearing was held, at which the representatives of both parties addressed the court.
  4. 4The Tribunal Contencioso Administrativo y Civil de Hacienda, Sección VI, composed of Judge Roberto Garita Navarro and Judges Cynthia Abarca Gómez and Silvia Consuelo Fernández Brenes, with the latter drafting the decision, ruled in judgment n° 153-2014-VI at 14 hours on 30 de setiembre de 2014: “The objection of lack of standing to sue on the merits (falta de legitimación ad causam activa) raised by the representative of the co-defendant companies is denied. The Court, on its own motion (de oficio), declares a lack of standing to be sued on the merits (falta de legitimación ad causam pasiva) as to the Estado. The defense of lack of legal entitlement raised by the Servicio Fitosanitario del Estado and the co-defendant companies is denied. Consequently, the action brought by SYNGENTA CROP PROTECTION SOCIEDAD ANÓNIMA against the ESTADO is declared WITHOUT MERIT, and the action against the SERVICIO FITOSANITARIO DEL ESTADO, QUIMÍCOS COSTARRICENSES QUICOSA SOCIEDAD ANÓNIMA, and DISTRIBUIDORA DE PRODUCTOS AGROPECUARIOS DPA SOCIEDAD ANÓNIMA is declared WITH MERIT; accordingly, the registration of the technical pesticide bearing the trade name ‘agromart fluazifop-b-butil 80-TC,’ under registration number 8702419, ordered by resolution AE-REG-P-RF-008-2012 at fifteen hours twenty-five minutes on treinta de agosto del dos mil doce, issued by the Unidad de Registros de Agroquímicos y Equipos de Aplicación, is declared absolutely null and void.By reason of connection and as a consequence, pursuant to artículo 122 inciso k) del Código Procesal Contencioso Administrativo, the Court, on its own motion, orders cancellation of the registration of this product (under code number 872419, in Tomo I, Folio 211, Asiento 419, with registration valid from treinta de agosto del dos mil doce to treinta de agosto del dos mil veintidós) in the Libro de Inscripción de Plaguicidas y Coadyuvantes del Ministerio de Agricultura y Ganadería. The Servicio Fitosanitario del Estado is ordered to pay the costs of the proceeding (attorney fees and procedural costs) (costas del proceso [personales y procesales]) in favor of the plaintiff company, the amounts of which shall be determined during the judgment-enforcement phase (fase de ejecución de sentencia) once this ruling becomes final; the remaining co-defendants are exempted from this payment.”

  6. 6The proceedings before this Chamber have complied with all statutory requirements.

Justice Rojas Morales drafts the opinion; and, CONSIDERING (CONSIDERANDO)

I.Since 2000, Químicos Costarricenses Quicosa S.A. (hereinafter QUICOSA) had applied to the Registro Fitosanitario del Estado to register the product named “Agromart Fluazifop-P-Butil 80 TC.” As it specified, it would import the product manufactured by two German companies whose names it included in its application. Nevertheless, the proceeding did not continue and remained unresolved. In November 2010, that application was reactivated during the three-year effective period of ley 8702, which permitted the revalidation of agrochemical registrations. On that date, the applicant, QUICOSA, amended its application and requested that the name of the registering entity be changed so that registration would be granted in favor of “Distribuidora de Productos Agropecuarios DPA. S.A.” Subsequently, during the proceeding, because two German companies had been proposed as suppliers of the product, the Administration ordered the applicant to select a single manufacturer.

In response, the name “Zhejiang-E-Tong Chemical Co. LTD CHINA” was submitted. Later, following publication of the official notice (edicto) publicizing the application, the plaintiff entered an appearance and formally opposed the registration. It contended that no prior verification had been performed to establish that the product would not adversely affect human or animal health or the environment, nor had its effectiveness been verified. That opposition was denied, the administrative appeals (recursos) filed were rejected, and by resolution AE-REG-P-RF- 00872012 at 15 hours 25 minutes on 30 de agosto de 2012, issued by the Unidad de Registros y Equipos de Aplicación del Departamento de Insumos Agroquímicos y Equipos del Servicio Fitosanitario, Agromart Fluazifop-P-Butil 80 TC was entered in the Registro de Agroinsumos under number 8702419. The plaintiff company sued the Estado, the Servicio Fitosanitario del Estado, and the companies Químicas Costarricenses Quicosa Sociedad Anónima and Distribuidora de Productos Agropecuarios DPA Sociedad Anónima, seeking annulment of the registration.

Those defendants denied the action and raised the defense of lack of legal entitlement, as well as the plaintiff’s lack of standing to sue (falta de legitimación activa). The judges denied the objection of lack of standing to sue and, on their own motion, declared a lack of standing to be sued on the merits with respect to the Estado, as to which they also rejected the defense of lack of legal entitlement and dismissed the action. They did not do so, however, with respect to the other defendants, against whom the action succeeded. The judgment declared the registration of the technical pesticide bearing the trade name “agromart fluazifop-p-butil 80 TC” absolutely null and void. On grounds of connection (conexidad), cancellation of that product’s registration in Tomo I, Folio 211, Asiento 419 of the Libro de Inscripción de Plaguicidas y Coadyuvantes del Ministerio de Agricultura y Ganadería was ordered. The Servicio Fitosanitario del Estado was ordered to pay costs. Dissatisfied, the representative of the two defendant companies filed an appeal in cassation, which was admitted by this Chamber.

Cassation for violation of procedural rules (Casación por violación de normas procesales)

II.As its first argument, the appellant asserted that, according to the judges, the plaintiff company has standing to bring a citizen action (acción popular) to protect health and the environment because, they stated, registration of the product at issue was not supported by prior studies concerning the effects of its application. On this point, the appellant argues that, given the plaintiff’s commercial nature as a for-profit legal entity, it lacks standing to bring a citizen action (art. 10.1.a y c del CPCA). It contends that numeral 105 de la Ley de Biodiversidad and art. 42 de la Ley de Uso, manejo y conservación de suelos apply only to nonprofit entities. Thus, in its view, the plaintiff does not actually seek to protect the environment, but rather its commercial activity, because more than 20 years ago it registered the first formulated product containing the active ingredient (ingrediente activo) at issue in this case, but at that time did not separately register it as a technical product, whereas the defendant companies did.

III.According to the judges, their judgment stated: “…the plaintiff company asserted that it has sufficient standing to bring an action in this jurisdiction seeking a declaration granting its claim for annulment—the registration of the herbicide bearing the trade name ‘agromart fluazifop-b-butil 80 TC’—alleging both the infringement of a right or legitimate interest (interés legítimo), under the terms established in artículo 10 inciso 1) punto a) del Código Procesal Contencioso Administrativo, because it states that it is the registrant of another agrochemical product containing the same active ingredient as the product now challenged, thereby directly affecting the company’s interests; and the existence of a diffuse interest (interés difuso), provided for in inciso c) del citado numeral de referencia (…) this in no way means that there is a lack of standing to sue (…) in the case of effective protection of the environment, (…) standing to bring an action in its defense is broadened to extend to and encompass ‘every person’; that is, without requiring impairment of any subjective right (derecho subjetivo) or legitimate interest of the interested party, although such impairment may exist.

It is therefore a judicial action (acción jurisdiccional) granted to each and every subject or person governed by the Administration within a community, regardless of (…) whether the party is a natural person or a legal entity. This citizen action—in matters involving environmental protection—is also established in artículo 105 de la Ley de Biodiversidad, número 7788, del treinta de abril de mil novecientos noventa y ocho (…) canon 42 de la Ley de Uso, Manejo y Conservación de Suelos, número 7779, del treinta de abril de mil novecientos noventa y ocho, vigente a partir del veintiuno de mayo siguiente, provides that ‘It is the obligation and right of every person, natural or legal, to monitor and oversee compliance with soil legislation (…)’ Since the specific subject of this proceeding is whether the registration of a technical agrochemical by (…) the Servicio Fitosanitario del Estado complies with the regulations (…) concerning the protection, conservation, and improvement of soils, (…) it is undeniable that there is not only a genuine diffuse interest, but also a genuine citizen action. Consequently, the objection of lack of standing to sue on the merits raised by the co-defendant companies must be denied.”

IV.For this Chamber, it is clear that the appellant’s argument merely expresses disagreement with the ruling because it does not challenge the basis of the judgment. The provisions alleged to have been violated (canones 105 de la Ley de Biodiversidad y 42 de la Ley de Uso, Manejo y Conservación de Suelos) do not require that a plaintiff legal entity be nonprofit in order to have standing to sue. Furthermore, the plaintiff has a legitimate interest because it has registered a product containing the same active ingredient, and this also entitles it to bring the action, as stated by the Tribunal in its analysis in the judgment (Considerando III). The argument advanced therefore fails to overcome the judges’ reasoning, and this ground of the appeal is accordingly denied.

V.In their second formal claim, they allege that the Tribunal incorporated new facts not included in the complaint and went beyond the matters at issue in this dispute, which, they state, were delimited at the preliminary hearing. They claim a violation of Article 155 of the Code of Civil Procedure, under which the matters submitted for debate must be decided without going beyond them, since the judgment must not address issues other than those debated. They assert that, upon the incorporation of new elements for consideration, the Tribunal was required to expand the hearing under Articles 90 and 110 of the CPCA. They contend that all those new facts considered by the trial judges are reflected in each of the substantive challenges raised in this appeal. The objection as presented is procedurally deficient because it is neither clear nor precise. The points listed from a) through h) on folio 12 of the appeal do not clearly and precisely describe the alleged new facts; they merely refer to the substantive challenges, leaving this Chamber to scrutinize each claim for an alleged violation of substantive rules.

This Chamber cannot, on its own initiative, search for how a new fact might exist when the interested parties have not first identified it, as they are required to do. In other words, the appellants do not provide a clear and reasonable explanation. There is only one element regarding which they do describe an alleged procedural defect (vicio procesal): the use of opinion FOE-AM-19/2009 of the Contraloría General de la República, which they believe should have been disclosed to the parties and, because it was not, violated, in their view, due process (debido proceso), legal certainty (seguridad jurídica), and equality.

VI.Regarding that opinion of the Contraloría, the Tribunal stated: “As may be observed, this registration does not entail the transcription of information supplied by the applicant; on the contrary, in the case of pesticides (…) the concept of ‘checklists’ should not be applied to the registration process, since it does not merely involve verifying whether the registrant has submitted the requirements, but rather conducting an evaluation based on that documentation”—as stated by the Contraloría General de la República in the cited report (FOE-AM-19/2009)—“in accordance with the terms defined in Article 2 (Definitions) of the International Code of Conduct on the Distribution and Use of Pesticides, adopted at the 123rd session of the FAO Council in noviembre del año dos mil dos, which defines the function of ‘pesticide registration’ as follows: ‘Registration: the process by which the responsible national or regional authority approves the sale and use of a pesticide following a comprehensive evaluation of scientific data demonstrating that the product is effective for its intended purpose and does not pose an unacceptable risk to human or animal health or to the environment.’ (Emphasis not in the original.) This was the definition adopted by the Contraloría General de la República in the cited report (FOE-AM-19/2009), and it fully coincides with the definition subsequently adopted in Article 3.55 of the Regulations on the Registration, Use, and Control of Formulated Synthetic Pesticides, Technical-Grade Active Ingredients, Adjuvants, and Related Substances for Agricultural Use (Reglamento sobre el Registro, Uso y Control de Plaguicidas, Sintéticos Formulados, Ingrediente Activo Técnico, Coadyuvante y Sustancias Afines de Uso Agrícola), Decreto Ejecutivo número 33495-MAG-S-MINAE-MEIC, del treinta de uno de octubre del año dos mil seis, effective as of diez de enero del dos mil siete, and issued precisely in accordance with the guidelines provided by the Constitutional Oversight Body in the indicated report.

It is appropriate to note that, on that occasion, the Contraloría General de la República expressly instructed the Administration how it was required to perform this function (pesticide registration), (…) pursuant to Articles 68, 69, and 70 of the Organic Law of the Contraloría General de la República (Ley Orgánica de la Contraloría General de la República), number 7428, del siete de setiembre de mil novecientos noventa y cuatro, effective as of cuatro de noviembre siguiente, the opinions issued by this Constitutional Body in the exercise of its powers are binding upon the corresponding Administration.”

VII.As this Chamber sees it, application of the precautionary principle (principio precautorio) and environmental protection has been the plaintiff’s argument since the beginning of the dispute. That principle is developed in the aforementioned binding opinion of the Contraloría, concerning which the omission of a hearing is alleged. The opinion expressed a legal position endorsed by the Tribunal; moreover, it is not evidence concerning the facts, and therefore Articles 90 and 110 of the CPCA do not apply. Nor do the appellants explain whether hypothetically removing that opinion could overturn the challenged judgment. The opinion, as may be observed, was cited only tangentially and in support of the Tribunal’s reasoning concerning environmental protection; even without it, the judges’ position would still stand. Accordingly, no useful cassation relief (casación útil) is available because the alleged defect is incapable of overturning the judgment, and the claim therefore cannot be sustained.

Cassation appeal for violation of substantive rules

VIII.As their first substantive ground of error, the appellants raise the issue of the temporal application of the law. According to the judges, the registration act was null because it was issued outside the effective period of Ley 8702. The parties seeking cassation disagree with that conclusion and characterize it as novel. In their view, the registration application should have been decided under that law pursuant to the principle of continued application (principio de ultraactividad), under which the law remains effective until the proceeding is completed, rather than only for the law’s stated term. They further note that, although the application was not decided until 2012, this was due to the plaintiff company’s challenges during the administrative proceeding.

IX.On this matter, the judges ruled: “This Tribunal has no doubt that this was a new application involving substantial changes both to the authorized product and to the registering company, and that this occurred outside the period during which Ley número 8702 was in effect (…) it is wholly irregular for special legislation to have been applied—not only outside the factual circumstances contemplated by the law, but, more seriously, after that legislation had ceased to be in force—since it is evident that the final approval act was dated treinta de agosto del dos mil doce, whereas Ley número 8702 produced legal effects only during the period from veintiocho de enero del año dos mil uno to veintiocho de enero del dos mil doce (…) Its effective period cannot be extended so that the Administration may rely on it for actions taken outside the period expressly defined by law. Indeed, it is understood that the Law applied solely to the processing and resolution of pesticide-registration applications filed with the competent Administration (Servicio Fitosanitario del Estado) before Decreto Ejecutivo 33495-MAG-S-MINAE-MEIC took effect, which occurred on diez de enero del año dos mil siete, and that remained unresolved when that special legislation entered into force, which occurred as of veintiocho de enero del dos mil nueve, provided that the final act was adopted while that law remained in force, that is, before veintiocho de enero del año dos mil doce; it is evident that this did not occur in the present case. d.) As a consequence of the foregoing, the content of the challenged act—namely, authorization of the registration of the technical-grade pesticide commercially known as ‘agromart fluazifop-b-butil 80 TC,’ under registration number 8702419, ordered through resolution AE-REG-P-RF-008-2012, de las quince horas veinticinco minutos del día treinta de agosto del dos mil doce, issued by the Unidad de Registros de Agroquímicos y Equipos de Aplicación—is tainted by absolute nullity (nulidad absoluta), because it is unlawful, having been adopted in breach of the principle of legality (principio de legalidad).”

X.Regarding the argument concerning the continued application of Ley 8702, this Chamber rules, first, that this is not a novel argument, as the party seeking cassation asserted, because the correct temporal application of the law is a matter that the adjudicatory body must necessarily verify. Regarding application of the law beyond its effective period, the appellant merely alleged continued application without further reasoning, stating that the application could be decided under Ley 8702 because the matter remained pending while that law was in force. To clarify this issue, the terms of Ley 8702 itself must be examined. Section 14 thereof provides: “ARTICLE 14.- All agrochemical products registered in the country, whether original or generic products, must revalidate their registration within a period of up to three (3) years from the publication of this Law.” Section 15, in turn, provided: “ARTICLE 15.- This Law shall remain in force for three (3) years from its publication….” Based on its interpretation of both sections, this Chamber understands that the period for revalidating a registration was up to three years; in other words, interested parties did not have until the final day of that period to submit their applications, because if insufficient time remained to process them, the revalidation would lapse (caducidad).

At the time the application to reactivate the registration was submitted (30 de noviembre de 2010), Ley 8702 was in force, having taken effect on 28 de enero de 2009, and there was no basis for declining to apply it. Accordingly, it was proper at that time to process the application under that law. Nevertheless, when the final act was issued (resolution AE-REG-OP-001/2012, de las 10 horas 15 minutos del 23 de mayo de 2012), the law was no longer in force. Furthermore, the argument that this law applies to the specific case because part of the proceeding was conducted while it was in force, as the appellant appears to contend, cannot be sustained. As the Tribunal ruled, Ley 8702 cannot be understood to have remained effective so that the Administration could rely on it for actions taken outside the legally established period; doing so would contravene the principle of legality. Once again, the parties seeking cassation merely express disagreement, without presenting reasoning capable of overturning that portion of the challenged decision, which remains undisturbed; consequently, the objection is procedurally deficient. Because it lacks supporting grounds, this part of the appeal is denied.

XI.In their second substantive objection, the appellants contend that, given the nature of the product to be registered (the active ingredient of a pesticide), the submission of studies is not required. This is based on the application of Law 8702, under which they were not required to submit prior studies concerning the product technically known as “Technical-Grade Active Ingredient” (“Ingrediente Activo Grado Técnico,” hereinafter IAGT). They explain that IAGTs may be registered through either of two possible pathways: complete data (when they are new products, their entire chemical and toxicological composition, among other information, is provided) or equivalence (when they are not new and are not subject to test-data protection because such data have become public information through the passage of time). They state that, in Costa Rica, to register a formulated pesticide (“plaguicida formulado,” hereinafter PF), the IAGT or ingredient with which it is formulated must first have been registered.

They assert that this is reflected in the following provisions: Article 15.10 of CAFTA defines a new product as one that does not contain a chemical entity previously approved in the territory of the Party. Section 8 of the Undisclosed Information Law (Ley de Información no Divulgada) defines a new product as one that does not contain a chemical entity previously approved in Costa Rica, and its regulations (Decreto 34927-J-S-MAG) refer to the definition in Decreto Ejecutivo 33495-MAG-S-MINAE-MEIC, which treats an IAGT as a New Agrochemical Product (Producto Agroquímico Nuevo).

XII.Regarding Law 8702 and the obligation to submit prior studies, the judges stated: “it constitutes a statutory regime (…) for (…) applications to register pesticides or to modify existing registrations that remained pending before Decreto Ejecutivo 33495-MAG-S-MINAE-MEIC took effect (…) it exempted only the requirements for that procedure which had previously been established in the aforementioned regulations (…) This Law establishes the sole and exclusive requirements that must be met by applications that were being processed before the promulgation of the Regulations on the Registration, Use, and Control of Formulated Synthetic Pesticides, Technical-Grade Active Ingredients, Adjuvants, and Related Substances for Agricultural Use (Reglamento sobre registro, uso y control de plaguicidas sintéticos formulados, ingrediente activo grado técnico, coadyuvantes y sustancias afines de uso agrícola).

Registration applications that were closed for failure to satisfy requirements other than those specified in this Law may be reviewed again upon application by the interested party to the authorities of the Registration Program (Programa de Registro) (…) this special law relaxed the requirements that applicants had to submit to the Administration (…) the requirements imposed by the law are more lenient than those contained in the regulatory provision (…) it even permits certain technical and scientific documentation not to be submitted (...) it is nevertheless necessary to clarify that this statutory text does not modify the authority previously conferred by law upon the State Phytosanitary Service (Servicio Fitosanitario del Estado) (…) The foregoing is supported by Articles 11 and the final paragraph of section 14 of Law 8702 (...) the (…) State Phytosanitary Service was empowered to waive submission requirements on its own initiative or at a party’s request, provided that it did so by means of a reasoned decision and ‘when there are technical and scientific arguments’ supporting such a decision (…) for this decision to be valid and effective, it had to be supported by technical and scientific criteria (…) the Administration (…) ‘could,’ likewise by means of a reasoned decision, require the applicant to provide ‘toxicological and ecotoxicological studies, biological-efficacy studies, and studies of effects on the abiotic environment, for the active-ingredient category,’ precisely ‘in order to ensure that health and the environment are not adversely affected’; this, it is understood, could occur only after the Administration had technically and scientifically evaluated the information provided by the applicant (…) the dispute in this proceeding does not concern the requirements established by Law 8702 for this type of procedure, but rather the manner in which the Administration (State Phytosanitary Service) exercised its authority; this appears not to have been understood by the defendants, who focused their defense solely on that issue (which requirements the Administration could or could not demand in this type of procedure) (…) the Phytosanitary Administration verified completion of the review established in the ‘Technical Product Case-File Review Form Pursuant to Law No. 7802’ (‘Formulario de Revisión del Expediente de un Producto Técnico de Acuerdo con la Ley N° 7802’).

There is no record of any subsequent review beyond merely verifying the response stating that there is now a different manufacturer of the product, without even analyzing—again—its physical and chemical characteristics, since this information is not even in the record. This circumstance alone renders the challenged registration decision absolutely defective, under sections 133 in conjunction with 158.1 and 158.4 of the General Law of Public Administration (Ley General de la Administración Pública), warranting a declaration of its absolute nullity, as requested in this action.”

XIII.The appellants’ argument that they were not required to submit prior studies concerning the product to be registered because it was a technical ingredient is unavailing because, as already determined, the provision under which the requirements had been relaxed was no longer in force. Because their entire argument is based on the application of that repealed legislation, this ground of appeal fails, since the Administration, when issuing the final decision, was required to demand compliance with all the requirements of Decreto 33495-MAG-S-MINAE-MEIC. The relaxation of requirements had ended, and submission of the studies had once again become mandatory for processing the registration of an IAGT. The procedure for registering a technical-grade active ingredient by equivalence (section 7.3.2 of that decree) was required to be followed. The toxicological and ecotoxicological information provided in the administrative proceedings regarding physical and chemical properties, first-aid instructions, and potential health effects related to a German product.

At pages 13 and 20 through 23 of the complaint, the need to exercise effective oversight to determine whether the product was acceptable was alleged. Consequently, this is not a new fact, and the basis of the judgment was not refuted: the information concerning the properties and characteristics of the technical-grade active ingredient produced in China had been omitted, and because its submission was necessary even while Law 8702 was in force, this ground of appeal fails.

XIV.As their third argument on the merits, the appellants in cassation contend that the SFE could not require prior studies of the product because it lacked authority to do so; that is, it could not evaluate or analyze the components of Fluazifop-P-Butil. The judges, however, held that it could, because the State Phytosanitary Service has authority to exercise effective oversight over chemical products used in agriculture. According to the judges, “…it may be concluded that conducting technical studies is a necessary precondition for the proper application of the precautionary principle (principio precautorio) in environmental matters (…) because any decision by the Administration must be supported by the identification, classification, and assessment of risk, which requires the necessary prior objective studies (…) the strict application of the prevention principle (principio de la prevención), which means that a project submitted for assessment cannot be authorized or carried out when reliable technical and scientific criteria establish that a human activity (of any kind, whether public or private, business-related, industrial, commercial, agricultural, etc.) will cause harm to the environment and its elements, since the duty is to prevent such harm in advance” (...) “it is nevertheless necessary to clarify that this statutory text does not modify the authority previously conferred by law upon the State Phytosanitary Service, which remains as established in the Phytosanitary Protection Law (Ley de Protección Fitosanitaria) of nineteen ninety-seven.

The foregoing is supported by Articles 11 and the final paragraph of section 14 of Law 8702. Indeed, the former (section 11) empowered the Administration—meaning the State Phytosanitary Service—to waive submission requirements on its own initiative or at a party’s request, provided that it did so by means of a reasoned decision and ‘when there are technical and scientific arguments’ supporting such a decision; it must therefore be understood that, notwithstanding the elimination of requirements, the protective purpose of the pesticide-registration mechanism would be fulfilled insofar as submission of one or more requirements was objectively unnecessary to establish quality and the absence of risk to the health of people and animals and to the integrity of the environment, specifically the elements of soil, water, air, and the biodiversity of flora and fauna, or to establish that the negative impact remained within acceptable or permitted levels.

In other words, for this decision to be valid and effective, it had to be supported by technical and scientific criteria. The latter provision, by contrast, instructs the Administration that it ‘could,’ likewise by means of a reasoned decision, require the applicant to provide ‘toxicological and ecotoxicological studies, biological-efficacy studies, and studies of effects on the abiotic environment, for the active-ingredient category,’ precisely ‘in order to ensure that health and the environment are not adversely affected’; this, it is understood, could occur only after the Administration had technically and scientifically evaluated the information provided by the applicant. It may therefore be concluded that the promulgation of Law No. 8702 did not affect (modify or relax) the pesticide-registration oversight and assessment authority conferred upon the State Phytosanitary Service (…) the dispute in this proceeding does not concern the requirements established by Law 8702 for this type of procedure, but rather the manner in which the Administration (State Phytosanitary Service) exercised its authority; this appears not to have been understood by the defendants, who focused their defense solely on that issue (which requirements the Administration could or could not demand in this type of procedure).”

XV.Once again, the appellants in cassation base their argument on a provision that had been repealed by the time the administrative act ordering registration was issued. Regarding the mandatory nature of conducting studies prior to registering a technical-grade active ingredient (ingrediente activo grado técnico, IAGT), this Chamber considers it appropriate to analyze the situation before, during, and after ley 8702 was in force. The request to reactivate the registration application, which is the subject of these proceedings, was filed while that law was in force, but when the final act was issued, that provision was no longer in effect. Before its entry into force, the submission of several studies was required as one of the conditions for processing the registration of an IAGT. Sections 7.2.2.1.d) and 6.2.1 of decreto 33495-MAG-S-MINAE-MEIC provided that all information required for such registration—including information on physical and chemical properties, as well as toxicological, ecotoxicological, efficacy, phytotoxicity, and residue information—had to be supplied through data obtained from tests or studies conducted on the product to be registered.

During the registration procedure, those studies were submitted at an initial document-receipt stage; they were then analyzed by the State Phytosanitary Service (Servicio Fitosanitario del Estado), and, in a third stage, mandatory consultation was undertaken with the ministries of Health and MINAE. Under the decree, those institutions were authorized to conduct additional tests or studies for decision-making purposes. Finally, they issued an opinion containing their assessment, which the registrant could request be clarified or supplemented. That procedure was subject to a three-year exception following the enactment of ley 8702. During that period, the applicable requirements were relaxed. There was no obligation to conduct prior studies of an IAGT, although all relevant information still had to be provided. Under its section 14, the SFE had discretion to conduct additional studies. According to the judges, in this case compliance with the requirements was established only through a form, without the new company providing supporting documentation on the chemical and physical composition of the new manufacturer’s product.

They therefore declared the registration void in the judgment due to a defect in the grounds of the act, because, in their view, if an exception to the submission requirements was intended, it should have been made through a reasoned decision, pursuant to the principle of objective environmental protection (principio de la objetivación de la tutela del ambiente), the precautionary principle (principio precautorio), article 14 of the same law, and sections 133, 158.1, and 158.4 of the Ley General de la Administración Pública. The judges also found a defect in the purpose of the act because the failure to safeguard the product’s quality entailed administrative action that disregarded the Administration’s powers and higher values. It is clear to this Chamber that ley 8702 was no longer in force when the final act was issued and therefore was not the provision applicable to the decision. Because the relaxed requirements were no longer in effect, the requirements of the ordinary procedure became applicable.

In any event, it should be noted that, under article 14, that exceptional law required anyone seeking to register an IAGT to provide information such as its toxicological classification according to the WHO, physical and chemical properties, first aid, potential health effects, and toxicological and ecotoxicological information. The submission of studies was not mandatory at that time. In this case, those requirements appear to have been declared on the first pages of the administrative record; that information was provided by the applicant company and, as may be read therein, the suppliers of the product described were German companies identified at the beginning of the proceeding (folios 4 and 9 of the file marked 2 in the administrative record). In other words, the existing information related to a German product, not to that of the Chinese manufacturer that was ultimately registered.

The requirement that, as a prerequisite for processing the registration, a serious analysis of the components be declared was alleged at folios 13 and 20 to 23 of the complaint, based on the asserted need to exercise effective oversight through a technical determination establishing whether the product was acceptable. The objection that this constitutes a new fact is unfounded. Once the obligation to declare all information regarding the IAGT’s physical and chemical properties, as well as toxicological, ecotoxicological, efficacy, phytotoxicity, and residue matters, has been established, the judges can only be understood to have been correct in finding that this was a new application, because the active ingredient’s physical and chemical properties, the technical product’s characteristics, the analytical method, hazards, precautions, and technical composition had been declared in relation to the product manufactured by the German companies.

When the Chinese company was proposed as the supplier, the same type of information was not provided, even though it was mandatory under ley 8702, which was in force when that step was taken. Even though it was the same product, its composition as manufactured by the new manufacturing company should have been declared; that was the purpose of the law. Accordingly, this claim does not succeed.

XVI.The fourth substantive objection concerns the Tribunal’s treatment of the registration application as a new filing because of the change in the applicant and the product’s manufacturer, instead of treating it as the reactivation of a registration application initiated by one of the defendant companies and processed in the name of the other. They argue that this was an assignment of ownership (cesión de titularidad), not a defect rendering the act void. On the contrary, the action taken created rights and was never challenged by the plaintiff; consequently, they contend that due process was violated. They object that the adjudicators deemed it unproven that Químicas Costarricenses Quicosa S.A. and Distribuidora de Productos Agropecuarios DPA S.A. had any commercial or corporate relationship, even though that issue was not challenged in either the complaint or the answer. Nevertheless, they note that both are represented by Marvin Martínez Araya, which supports the presumption that they constitute a corporate group or economic-interest group.

They argue that the plaintiff company never challenged that transfer of the proceeding and that, because both companies have the same representative, they must be understood to form an economic-interest group. They contend that article 194 of the Código Procesal Civil (hereinafter CPC) was violated because the assignment accomplished its purpose and created rights.

XVII.The adjudicators ruled as follows in this regard: “The application was initially filed by Químicos Costarricenses Quicosa Sociedad Anónima and concerned a specific product: agromart fluazifop-p-butyl 80 TC herbicide, composed of fluazifop-p-butyl, of the aryloxyphenoxy propionate type, and manufactured by Helm AG P.O.Box 10 30 60 Hamburgo DF-20021- Alemania; Biestefeld U.S.Inc. 757 Third Av New York 10017. Fax: 212 688 6038 Tel: 212 688 5850-U.S.A. Jebsen & Jesse - Alemania Iangvmonherend 200 95 Hamburgo - Alemania. Information was provided regarding the active ingredient’s physical and chemical properties, the technical product’s characteristics, the analytical method, hazards and precautions for technical products, and chemical composition—proven fact 1.)—. However, the final act approving the challenged registration concerned a different product and a different application because, as previously stated, it was modified pursuant to a notation submitted by the President, acting individually, of Distribuidora de Productos DPA Sociedad Anónima in a letter dated diecinueve de mayo del año dos mil once, concerning another manufacturer—‘Zhejiang-E-Tong; Chemical Co.

LTD CHINA’—without any documentation or information regarding the chemical and physical composition of the proposed new manufacturer’s product being attached on that occasion. In this respect, it is evident that the Administration ultimately authorized a different product and that this action arose from the reactivation of the application initially filed, which was again requested by the President, acting individually, of Distribuidora de Productos DPA Sociedad Anónima on treinta de noviembre del año dos mil diez, that is, after the period provided for in article 1 of Ley 8702. This Tribunal has no doubt that this was a new application involving substantial changes both to the authorized product and to the registrant company.” In this Chamber’s view, the appellants in cassation failed in this case to rebut the defect identified by the judges concerning the failure to prove continuity between the application first pursued by one company and subsequently by the other, as analyzed in considerando XV. Accordingly, the objection is unfounded and must be denied.

XVIII.As their fifth objection, they alleged improper assessment of a handwritten notation made by an evaluating chemist stating that the IAGT had been registered for more than 10 years. They state that, according to the adjudicators, there was a defect in that handwritten notation appearing on the professional’s “checklist,” in which he recorded that the technical-grade active ingredient had been registered for more than 10 years. According to the Tribunal, the defect was that the assertion lacked supporting evidence. The appellants contend that the adjudicators incorrectly interpreted this fact because, as they understand it, the State Phytosanitary Service allowed 10 years to pass without issuing an opinion on the application file, whereas that information is relevant only for determining whether the registration is entitled to test-data protection (protección de datos de prueba) under article 15:10 of CAFTA.

XIX.When verifying compliance with the applicable regulations, the trial Tribunal found that “the Administration checked or merely verified the requirements submitted by the initial applicant, which was recorded on a form entitled ‘Technical Product File Review Form Pursuant to Ley N° 7802’ (…) That form contains handwritten entries completing the required information (applicant’s name, product name, technical supervisor’s name, and application filing date). A notation states that ‘the change in the company’s name must be made through a registration amendment,’ and another states that only one manufacturer of the product must be selected; checkmarks also appear beside some items on the list (…) Finally, the following handwritten notation (…) appears: ‘(active ingredient registered more than 10 years ago).’ The form is not accompanied by any registry entry or documentation supporting that last notation (…) A review of the preceding factual account makes it absolutely clear that, before approving the registration of the technical pesticide named agromart fluazifop-b-butyl 80 TC, the Phytosanitary Service conducted no technical-scientific assessment of the information supplied by the applicant (…) The study or analysis performed by the Administration consisted solely of the mere verification or checking of the requirements purportedly established by law (…) It was recorded only in general terms (…) that the application complied with the requirements established in special Ley 8702, without any details whatsoever being known concerning those requirements.

Once again, the foregoing directly affects the grounds of the act because it is impossible to verify objectively that such compliance occurred; consequently, it cannot be corroborated in this case that the factual predicates existed in the manner in which they were taken into account when the act was adopted (article 133 of the Ley General de la Administración Pública).”

XX.In the opinion of this judicial body, the cassation appellants do not challenge the judgment. Their argument is limited to asserting that what was registered was not a new technical-grade active ingredient (ingrediente activo grado técnico, IAGT), but rather that a prior registration more than 10 years old was used. If their intention was to allege an indirect violation of law due to improper assessment of the evidence, they should have specified why, in their view, the reasoning was incorrect and which evidence should have been assessed differently. They did not do so; therefore, the claim must be rejected as procedurally defective. It is not enough to say that the IAGT had already been registered; they did not specify which registration was involved, nor was an equivalence assessment (evaluación de equivalencia) of both products conducted, including their chemical characteristics, to establish beyond doubt the composition, constitution, and molecular configuration of the active ingredient, so that a registration without confidential-data protection could be used. Consequently, because it is procedurally defective, this objection is inadmissible.

XXI.As their sixth objection, the appellants claim that, according to the judges, there were defects giving rise to absolute nullity (nulidad absoluta), because the State Phytosanitary Service (Servicio Fitosanitario del Estado) failed to fulfill its duty to obtain studies from other ministries guaranteeing health and environmental safety as a prerequisite for registration. They consider the judges’ reasoning mistaken because, they stated, IAGTs need not be evaluated by MINAE or the Ministry of Health as a prerequisite for registration, and the State Phytosanitary Service itself was not even required to conduct studies or analyses. The judges nevertheless required them, they recounted, because in the judges’ view the three-year relaxed regime established by that law did not mean that documentation for evaluating the product was no longer required. The cassation appellants contend that this position violated the principles of reasonableness and proportionality and improperly assessed the evidence.

According to the judges, the SFE acted through misuse of authority (desviación de poder) by issuing an act lacking purpose and content. The Court, in its judgment, did not distinguish, they argued, between a technical product (producto técnico) and a formulated product (producto formulado). A technical product is only an ingredient; it cannot harm health or the environment because it is not applied in the field, released into the environment, or brought into contact with persons or animals, and its sale was not authorized. For that to occur, the registered ingredient would have to be associated with a formulated product, at which point the Ministries of Health and Environment would issue their toxicological and exotoxicological opinions. The judges applied the precautionary principle (principio precautorio), or principle of prudent avoidance (principio de evitación prudente), but in their view this was not appropriate in this case because the registered product is a generic product that has been on the market for more than 20 years and whose information is publicly known.

They consider the ruling “premature” because the SFE was not consulted as to whether the technical, scientific, chemical, toxicological, and ecotoxicological information had already been evaluated. They argue that such a requirement applies only to a finished pesticide that is ready to be sold on the market, not to an ingredient. Regardless of whether it is manufactured in Germany or China, they assert, its formulation is the same and is publicly known; they therefore contend that the precautionary principle is inapplicable because the mere registration of a technical-grade active ingredient (hereinafter IAGT) does not authorize its sale. The requirement to conduct studies was “relaxed” under law 8702 to the point that it became necessary only to submit information; accordingly, they state, by requiring studies, the Court encroached upon technical and scientific authority. Furthermore, because this was a fact not argued by the plaintiff, they contend that the Court violated articles 155 CPC, 90 and 110 CPCA and contradicted its own case law, contained in resolution 2244-2010 of 10 hours 40 minutes of 11 de junio de 2010 of the Administrative Litigation Court (Tribunal Contencioso Administrativo), in which, they state, the judges adopted a position different from the manner in which they ruled in this case.

According to that precedent, law 8702 rendered Decreto Ejecutivo 33495-MAG-S-MINAE-MEIC inapplicable and simplified the requirements and procedures for updating registrations through a revalidation process (trámite de revalidación). In the challenged decision, however, they assert, the Court departed from what it had decided in that judgment and held in this case that requirements inapplicable to the registration of a technical product existed, such as conducting chemical, technical, and other tests. In other words, they contend that the judges imposed requirements inapplicable to the registration of a technical product. They further argue that the judgment did not analyze article 14 of law 8702, under which the study deemed mandatory by the judges is actually discretionary; consequently, they conclude, the substance of that law was violated. They ultimately contend that evaluation of the IAGTs by the Ministry of Health and the Ministry of Environment and Energy was unnecessary as a prerequisite for registration and that the judgment is therefore erroneous in seeking to impose upon the State Phytosanitary Service an obligation to conduct studies or analyses of technical products.

XXII.According to the judges, there was: “Finally, as a consequence of what has already been stated, this element is clearly infringed (…) the function of registering pesticides in the country has an extremely important significance within the national legal system, where it serves as one of the instruments for effectively safeguarding the fundamental rights to health and to a healthy and ecologically balanced environment, as well as consumer rights (articles (articles 21, 46 and 50 of the Political Constitution), which condition and limit the exercise of freedom of enterprise and commerce. Accordingly, this authority must be exercised ‘... efficiently, effectively, and in accordance with the principle of legality’ by the State Phytosanitary Service, consistently with the objectives for which it was created, ‘which call upon it to regulate, implement, and oversee the registration and use of agrochemicals within the framework of agricultural activity conducted in harmony with nature and in faithful observance of the constitutional principles of the right to life, health, and a healthy environment,’ as stated by the Office of the Comptroller General of the Republic (Contraloría General de la República) in its report FOE-AM-19/2009.

Otherwise, as in the present case, the manner in which it acted was directed toward facilitating the registration and sale of an agrochemical product, while wholly disregarding its authority and the higher values governing this field, without safeguarding in this case either the quality of the authorized product or the risks or effects on health and the environment; this constitutes a clear misuse of authority, as alleged and proven.”

XXIII.It was already stated in recital XIII (XIII considerando) of this decision that the final act was issued when Ley 8702 was no longer in force and the requirements of Decreto 33495-MAG-MINAE-MEIC had once again become applicable. It was therefore mandatory to follow the procedure for registering a technical-grade active ingredient by equivalence (por equivalencia) (section 7.3.2 of that decree). It should be noted here that, according to the appellants, the Ministries of Health and MINAE lacked authority to act because the regulatory provision establishing their participation is contrary to Ley 7664 or Ley de Protección Fitosanitaria. This Chamber finds no basis whatsoever for understanding Decreto 33495-MAG-S-MINAE-MEIC to be an implementing regulation solely of Ley 7664, so as to assert, as the cassation appellants understand it, that authority was transferred by regulation to the Ministries of Health and MINAE without statutory authorization.

Quite to the contrary, the heading of the decree cites all the laws it implements, and recitals 6 through 9 explain why a multidisciplinary approach is necessary to protect human health and plant health, reorganizing procedures to integrate the participation of the Ministry of Agriculture and Livestock, the Ministry of Health, and the Ministry of Environment and Energy, “in accordance with their respective authority.” It follows that the argument is unsupported and that the protection of health and the environment is fully grounded both in the laws cited in the decree and in constitutional article 50. Accordingly, because the argument was not properly presented, this ground of appeal is likewise rejected.

XXIV.In their seventh argument, they state that the registration act created a vested legal situation (situación jurídica consolidada) and that its cancellation required following one of the avenues established in the General Public Administration Law (Ley General de la Administración Pública): either the procedure for absolute, evident, and manifest nullity (nulidad absoluta, evidente y manifiesta), or an action for a declaration of injury to the public interest (proceso de lesividad). This argument is raised for the first time. In any event, that is the proper avenue when the State seeks nullification, and that prerequisite is not met in this case; this aspect of the appeal is therefore rejected.

XXV.As a corollary to the foregoing, the cassation appeal must be denied. The party bringing the appeal shall bear the costs incurred in this proceeding, under the terms established in article 150 subsection 3) of the Administrative Litigation Procedural Code (Código Procesal Contencioso Administrativo).

THEREFORE

The appeal brought by the co-defendants is denied, and they shall bear their own costs.

Proceso ordinario declarado de puro derecho establecido por SYNGENTA CROP PROTECTION SOCIEDAD ANÓNIMA, representado por su apoderado generalísimo sin límite de suma Mario Arrea Sierman, ingeniero, vecino de Heredia; contra el SERVICIO FITOSANITARIO DEL ESTADO, representado por su Directora Magda González Arroyo, ingeniera agrónoma, vecina de Heredia, el ESTADO, representado por la procuradora Laura Araya Rojas, soltera, vecina de San José y QUÍMICAS COSTARRICENSES QUICOSA SOCIEDAD ANÓNIMA, representado por su presidente Marvin Martínez Araya, no indica calidades, y DISTRIBUIDORA DE PRODUCTOS AGROPECUARIOS DPA SOCIEDAD ANÓNIMA, representado últimamente por José Alberto Castillo Calvo, ingeniero agrónomo, vecino de Limón, declarado rebelde. Figuran además, como apoderados especiales judiciales de la parte actora, José Pablo Sánchez Hernández, por parte del Servicio Fitosanitario, Robert William Ramírez Solano y Jorge Gómez Alpízar, soltero, vecino de Heredia y por las empresas codemandadas, Gustavo Silesky Jiménez, soltero, vecino de Cartago. Todos son mayores de edad y con las salvedades dichas, casados, abogados y vecinos de San José.

RESULTANDO

  1. 1Con base en los hechos que expuso y disposiciones legales que citó, la parte actora estableció proceso ordinario, ajustando sus pretensiones en audiencia preliminar, a fin de que en sentencia se declare: “(…) a nulidad absoluta del registro del plaguicida técnico de nombre comercial Agromart Fluazifop-b-butil 80TC, bajo el número de inscripción 8702419, ordenado mediante la resolución AE-REG-P-RF-008-2012 de las 15:25 horas del día 30 de agosto de 2012, de la de registros y equipos de aplicación del departamento de insumos agroquímicos y Equipos de Servicio Fitosanitario del Estado (sic)”.
  2. 2Los codemandados contestaron negativamente, oponiendo todos únicamente la defensa de falta de derecho.
  3. 3Al ser las 13 horas 31 minutos del 24 de marzo de 2014 se efectuó la audiencia preliminar, oportunidad en que hicieron uso de la palabra los representantes de ambas partes.
  4. 4El Tribunal Contencioso Administrativo y Civil de Hacienda, Sección VI, integrado por el juez Roberto Garita Navarro y las juezas Cynthia Abarca Gómez y Silvia Consuelo Fernández Brenes, con redacción de esta última, en sentencia n° 153-2014-VI de las 14 horas del 30 de setiembre de 2014, resolvió: “Se rechaza la falta de legitimación ad causam activa opuesta por el personero de las empresas codemandadas. De oficio se declara la falta de legitimación ad causam pasiva respecto al Estado. Se rechaza la defensa de falta de derecho opuesta por el Servicio Fitosanitario del Estado y las empresas codemandadas. En consecuencia, se declara SIN LUGAR la demanda interpuesta por SYNGENTA CROP PROTECTION SOCIEDAD ANÓNIMA contra el ESTADO y CON LUGAR en relación el SERVICIO FITOSANITARIO DEL ESTADO, QUIMÍCOS COSTARRICENSES QUICOSA SOCIEDAD ANÓNIMA y DISTRIBUIDORA DE PRODUCTOS AGROPECUARIOS DPA SOCIEDAD ANÓNIMA, por lo que se declara la nulidad absoluta del registro del plaguicida técnico de nombre comercial “agromart fluazifop-b-butil 80- TC, bajo el número de inscripción 8702419, ordenado mediante resolución AE-REG-P-RF-008-2012, de las quince horas veinticinco minutos del día treinta de agosto del dos mil doce, de la Unidad de Registros de Agroquímicos y Equipos de Aplicación.Por conexidad y consecuencia, en aplicación de lo dispuesto en el artículo 122 inciso k) del Código Procesal Contencioso Administrativo, de manera oficiosa se dispone la cancelación de la inscripción de este producto (con código número 872419, al Tomo I, Folio 211, Asiento 419, y con una vigencia de la inscripción del treinta de agosto del dos mil doce al treinta de agosto del dos mil veintidós) del Libro de Inscripción de Plaguicidas y Coadyuvantes del Ministerio de Agricultura y Ganadería. Se condena al Servicio Fitosanitario del Estado al pago de las costas del proceso (personales y procesales) a favor de la empresa accionante, sumas que se determinarán en la fase de ejecución de sentencia una vez firme este pronunciamiento y se exonera de este pago al resto de los codemandados”.
  5. 5El representante de las empresas codemandadas formula recurso de casación.
  6. 6En los procedimientos ante esta Sala se han observado las prescripciones de ley.

Redacta la magistrada Rojas Morales; y,

CONSIDERANDO

I.Desde el año 2000, la empresa Químicos Costarricenses Quicosa S.A. (en adelante QUICOSA) solicitó la inscripción del producto denominado “Agromart Fluazifop-P-Butil 80 TC” ante el Registro Fitosanitario del Estado. Según especificó, importaría el fabricado por dos empresas alemanas cuyos nombres consignó en su gestión. No obstante, el trámite no continuó y se quedó sin resolver. En noviembre de 2010, fue reactivada aquella solicitud, durante el plazo de tres años de vigencia de la ley 8702, la cual permitió revalidar los registros de los agroquímicos. En aquella fecha, la promovente QUICOSA, modificó su solicitud, pidió cambiar el nombre de la entidad registrante, para ser otorgado a favor de “Distribuidora de Productos Agropecuarios DPA. S.A.”. Posteriormente, durante el trámite, por estar propuestas dos empresas alemanas como suministradoras del producto, la Administración apercibió escoger un solo fabricante.

Al respecto, fue presentado el nombre de “Zhejiang-E-Tong Chemical Co. LTD CHINA”. Luego, a raíz de la publicación del edicto por el cual se publicitó la gestión, la actora se apersonó y se opuso formalmente a la realización del registro. No se realizó comprobación previa, reclamó, sobre la no afectación a la salud de las personas, animales y medioambiente, tampoco sobre la efectividad del producto. Dicha oposición fue denegada, se rechazaron los recursos interpuestos, y por resolución AE-REG-P-RF- 00872012 de las 15 horas 25 minutos de 30 de agosto de 2012 de la Unidad de Registros y Equipos de Aplicación del Departamento de Insumos Agroquímicos y Equipos del Servicio Fitosanitario se inscribió el Agromart Fluazifop-P-Butil 80 TC, en el Registro de Agroinsumos bajo el número 8702419. La sociedad actora demandó al Estado, al Servicio Fitosanitario del Estado y a las empresas Químicas Costarricenses Quicosa Sociedad Anónima y Distribuidora de Productos Agropecuarios DPA Sociedad Anónima, con la pretensión de anular el registro practicado.

Dichos demandados contestaron negativamente la acción e interpusieron la defensa de falta de derecho, también la falta de legitimación activa de la actora. Los juzgadores rechazaron la falta de legitimación activa y, de oficio, declararon falta de legitimación ad causam pasiva respecto del Estado, en relación con el cual también rechazó la defensa de falta de derecho y declaró sin lugar la demanda. Pero no así con relación a los demás demandados, contra quienes sí prosperó la acción. En la sentencia se declaró la nulidad absoluta del registro del plaguicida técnico de nombre comercial “agromart fluazifop-p-butil 80 TC”. Por conexidad, se dispuso la cancelación de la inscripción de dicho producto en el Tomo I, Folio 211, Asiento 419 del Libro de Inscripción de Plaguicidas y Coadyuvantes del Ministerio de Agricultura y Ganadería. El Servicio Fitosanitario del Estado fue condenado en costas. Inconforme, el representante de las dos empresas demandadas formuló recurso de casación, el cual fue admitido por esta Sala.

Casación por violación de normas procesales

II.Como primer argumento adujo, para los juzgadores, la empresa demandante posee legitimación activa para ejercer una acción popular en protección de la salud y el ambiente, pues la inscripción del producto registrado, señalaron, no contó con estudios previos relativos a los efectos de su aplicación. Sobre este punto, alegan, la naturaleza mercantil de la actora, como persona jurídica con ánimo de lucro, no tiene legitimación para establecer una acción popular (art. 10.1.a y c del CPCA). El numeral 105 de la Ley de Biodiversidad y el art. 42 de la Ley de Uso, manejo y conservación de suelos, argumentan, solo son aplicables tratándose de entidades sin fines de lucro. Entonces, a su juicio, en realidad la actora no pretende proteger el ambiente, sino su actividad comercial, pues hace más de 20 años registró el primer producto formulado con ese ingrediente activo motivo de este asunto, pero entonces no lo inscribió por aparte como producto técnico, lo cual sí lo hicieron las empresas demandadas.

III.Según los juzgadores, en su sentencia, “… la sociedad actora invocó que le asiste la suficiente legitimación para accionar en esta vía, en procura de que se declare su pretensión anulatoria -del registro del herbicida con nombre comercial "agromart fluazifop-b-butil 80 TC"-, alegando tanto la lesión de un derecho o interés legítimo, en los términos previstos en el artículo 10 inciso 1) punto a) del Código Procesal Contencioso Administrativo, en tanto indica que es registrante de otro producto agroquímico con el mismo ingrediente activo del que ahora impugna, de donde se produce una afectación directa a los intereses de la empresa; como la existencia de un interés difuso, previsto en el inciso c) del citado numeral de referencia (…) no supone en modo alguno que se esté ante un supuesto de falta de legitimación activa (…) en el caso de la tutela efectiva del ambiente, (…) para accionar en su defensa se amplia, para extenderse y comprender a "toda persona"; esto es, sin la exigencia de la afectación de un derecho subjetivo o interés legítimo alguno del interesado, aunque tal lesión pueda existir.

Se trata entonces, de la acción jurisdiccional concedida a todos y a cada uno de los sujetos o administrados de una colectividad, sin importar (…) si se trata de una persona física o jurídica. Esta acción popular -tratándose de la tutela del ambiente- está también establecida en el artículo 105 de la Ley de Biodiversidad, número 7788, del treinta de abril de mil novecientos noventa y ocho (…) el canon 42 de la Ley de Uso, Manejo y Conservación de Suelos, número 7779, del treinta de abril de mil novecientos noventa y ocho, vigente a partir del veintiuno de mayo siguiente, establece que "Es obligación y derecho de toda persona, física o jurídica vigilar y controlar el cumplimiento de la legislación en materia de suelos (…) siendo el objeto de este proceso cabalmente la discusión de si un registro de un agroquímico técnico por parte (…) del Servicio Fitosanitario del Estado- cumple o no con la normativa (…) relacionada con la protección, conservación y mejora de los suelos (…) es innegable que hay, no sólo un verdadero interés difuso, sino también una verdadera acción popular. Consecuentemente, procede rechazar la defensa de falta de legitimación ad causam activa opuesta por las empresas codemandadas”.

IV.Para esta Sala, está claro, lo argumentado por el recurrente es una mera disconformidad con lo resuelto, porque no combate el fundamento de la sentencia. Las normas alegadas como violentadas (canones 105 de la Ley de Biodiversidad y 42 de la Ley de Uso, Manejo y Conservación de Suelos) no exigen como requisito de legitimación activa la ausencia del fin de lucro en la persona jurídica demandante. Además, a la parte actora le asiste interés legítimo por tener inscrito un producto con el mismo componente activo y ello le faculta también para accionar, conforme lo indicado por el Tribunal al hacer el análisis en la sentencia (Considerando III). El argumento esgrimido entonces no logra destruir el razonamiento de los juzgadores, con lo cual, este extremo del recurso se desestima.

V.En su segundo reclamo formal, acusan que el Tribunal incorporó hechos nuevos no incluidos en la demanda, y fue más allá de los puntos objeto de este debate, los cuales, expresan, quedaron delimitados en la audiencia preliminar. Indican violación del artículo 155 del Código Procesal Civil, según el cual deben ser resueltos los puntos sometidos a debate y no ir más allá, pues la sentencia no debe contener cuestiones distintas a las debatidas. Ante la incorporación de nuevos elementos a considerar, refieren, era obligación del Tribunal ampliar la audiencia en los términos de los artículos 90 y 110 del CPCA. Todos esos hechos nuevos considerados por los juzgadores de instancia, afirman, se reflejan en cada uno de los reparos por el fondo en este recurso. El reproche así expuesto, resulta informal, al no ser claro, ni preciso. Los puntos enunciados de la a) a la h) en el folio 12 del recurso no describen con claridad y precisión cuáles son los hechos nuevos, solo remiten a los reparos de fondo para que esta Sala se dé a la tarea de escudriñarlos en cada uno de los reclamos por supuesta violación a normas de fondo.

Esta Cámara, de su propia iniciativa, busque cómo podría existir un hecho nuevo, sin ser previamente identificado por las interesadas, cuando esa es su obligación. Es decir, las recurrentes no desarrollan una explicación, clara y razonable. Solo hay un elemento sobre el cual sí describen un alegato de vicio procesal y fue la utilización del pronunciamiento FOE-AM-19/2009 de la Contraloría General de la República, el cual estiman, debió haber sido puesto en conocimiento de las partes y al no ser así, violentó, a su juicio, el debido proceso, la seguridad jurídica y la igualdad.

VI.Sobre ese pronunciamiento de la Contraloría, el Tribunal indicó “Como se observa, este registro no se traduce en la transcripción de una información suministrada por el gestionante, al contrario, en el caso de los plaguicidas (…) no se debe aplicar el concepto de 'listas de chequeo' al proceso de registro, ya que no se trata únicamente de corroborar la entrega o no de requisitos por parte del registrante, sino de llevar a cabo una evaluación con base en dicha documentación" -como señaló la Contraloría General de la República en el citado informe (FOE-AM-19/2009)-; lo anterior, en los términos definidos en el artículo 2 (Definiciones) del Código Internacional de Conducta para la Distribución y Utilización de Plaguicidas, adoptado por el 123° período de sesiones del Consejo de la FAO, en noviembre del año dos mil dos, que define la función de "registro de plaguicidas" en los siguientes términos: "Registro: proceso por el que la autoridad nacional o regional responsable aprueba la venta y utilización de un plaguicida, previa evaluación integral de datos científicos que demuestren que el producto es efectivo para el fin que se destina y no entraña un riesgo inaceptable para la salud humana, animal ni para el ambiente." (El resaltado no es del original.) Esta fue la definición adoptada por la Contraloría General de la República en el citado informe (FOE-AM-19/2009), y que resulta totalmente coincidente con la definición que posteriormente se adoptó en el artículo 3.55 del Reglamento sobre el Registro, Uso y Control de Plaguicidas, Sintéticos Formulados, Ingrediente Activo Técnico, Coadyuvante y Sustancias Afines de Uso Agrícola, Decreto Ejecutivo número 33495-MAG-S-MINAE-MEIC, del treinta de uno de octubre del año dos mil seis, vigente a partir del diez de enero del dos mil siete, y dictado precisamente conforme a los lineamientos dados por el Órgano Contralor Constitucional en el indicado informe.

Se estima conveniente advertir que en esa oportunidad la Contraloría General de la República le indicó de manera expresa a la Administración la forma en que debía de ejercer esta función (de registro de plaguicidas), (…) al tenor de las previsiones de los artículos 68, 69 y 70 de la Ley Orgánica de la Contraloría General de la República, número 7428, del siete de setiembre de mil novecientos noventa y cuatro, vigente a partir del cuatro de noviembre siguiente, los dictámenes que emita este Órgano Constitucional en ejercicio de sus potestades, son vinculantes para la Administración correspondiente”.

VII.Según aprecia esta Cámara, la aplicación del principio precautorio y la protección al ambiente ha sido el argumento de la parte actora desde el principio del conflicto. Ese principio es el desarrollado en el referido dictamen vinculante de la Contraloría, sobre el cual se reclama la omisión de una audiencia. El dictamen expresó un criterio jurídico amparado por el tribunal; además no es una prueba relativa a los hechos, con lo cual, no son aplicables los numerales 90 y 110 CPCA. Tampoco explica si suprimido hipotéticamente ese dictamen, se podría destruir la sentencia impugnada. El dictamen, se observa, fue citado de manera tangencial y como apuntalamiento del fundamento del Tribunal relativo a la protección al ambiente, pero si se le suprime, igual se sostiene la posición de los juzgadores. Entonces, no hay casación útil, porque lo argumentado no es un vicio capaz de destruir la sentencia, con lo cual, el cargo no es de recibo.

Casación por violación de normas sustantivas

VIII.Los recurrentes argumentan, como primer agravio de fondo, el problema de la aplicación de la ley en el tiempo. Para los jueces, hay nulidad del acto de inscripción del registro porque fue dictado fuera del plazo de vigencia de la Ley 8702. Ese criterio no es aceptado por las casacionistas, quienes lo califican de novedoso, en su opinión, la gestión de registro se debía resolver con dicha norma en aplicación del principio de ultraactividad, según el cual, la ley mantiene su vigencia hasta la finalización del trámite y no hasta el plazo de la ley. Además, señalan, si bien la gestión no fue resuelta hasta el año 2012, ello ocurrió debido a las impugnaciones de la empresa demandante durante el procedimiento administrativo.

IX.Los juzgadores, sobre este particular, dispusieron: “Para este Tribunal no hay duda de que se trató de una nueva solicitud, en la que existieron cambios sustanciales, tanto del producto autorizado como de la empresa registrante, y ello fuera del período respecto del cual regía la Ley número 8702 (…) resulta absolutamente irregular que se haya aplicado una normativa especial -no sólo fuera del presupuesto de hecho previsto en la ley-, sino lo que es más grave aún, fuera de la vigencia de dicha normativa, en tanto es evidente que el acto final de aprobación lo fue de data del treinta de agosto del dos mil doce, siendo que la Ley número 8702 surtió efectos jurídicos únicamente en el período comprendido del veintiocho de enero del año dos mil uno al veintiocho de enero del dos mil doce (…) No resulta posible extender aquella vigencia, para que la Administración sustente actuaciones fuera de aquel período, expresamente definido en la ley.

En efecto, se entiende que la Ley tenía aplicación únicamente para el trámite y resolución de las gestiones de registro de plaguicidas planteadas ante la Administración competente (Servicio Fitosanitario del Estado) previo a la vigencia del Decreto Ejecutivo 33495-MAG-S-MINAE-MEIC, lo que ocurrió el diez de enero del año dos mil siete; y que no estuviesen resueltas a la entrada en vigencia de aquella normativa legal especial, lo que se dio a partir del veintiocho de enero del dos mil nueve; pero cuyo acto final fuese adoptado dentro de la vigencia de esta ley, esto es, con anterioridad al veintiocho de enero del año dos mil doce; lo que resulta evidente que no se dio en este caso. d.) Consecuencia de lo anterior, el contenido del acto impugnado, esto es la autorización del registro del plaguicida técnico de nombre comercial "agromart fluazifop-b-butil 80 TC", bajo el número de inscripción 8702419, ordenado mediante resolución AE-REG-P-RF-008-2012, de las quince horas veinticinco minutos del día treinta de agosto del dos mil doce, de la Unidad de Registros de Agroquímicos y Equipos de Aplicación presenta vicio de nulidad absoluta, al no ser lícito, en tanto fue adoptado con quebranto del principio de legalidad”.

X.Esta Cámara, sobre el argumento de ultra actividad de la ley 8702, resuelve, primeramente, no es un problema de alegato novedoso, como lo indicó el casacionista, porque la correcta aplicación de la ley en el tiempo es un factor de obligada constatación por parte del órgano jurisdiccional. Sobre la aplicación de la ley fuera de su plazo de vigencia y eficacia, el recurrente solo alegó una supuesta ultra actividad, sin mayor razonamiento, la gestión se podía resolver, dijo, con fundamento en esta ley 8702 por estar el asunto pendiente de resolución durante su vigencia. Para aclarar este punto, deben observarse los términos de la propia ley 8702, cuyo canon 14 establece: “ARTÍCULO 14.- Todos los productos agroquímicos inscritos en el país, tanto productos originales como genéricos, deberán realizar la reválida de su registro en un plazo hasta de tres (3) años, contado a partir de la publicación de esta Ley”.

Por otra parte, el numeral 15 indicó: “ARTÍCULO 15.- Esta Ley tendrá una vigencia de tres (3) años a partir de su publicación…”. De la interpretación de ambos numerales, entiende esta Sala, el plazo para realizar la reválida del registro es hasta de tres años, es decir, no tenían los interesados hasta el último día de ese plazo para presentar su gestión, pues si ya no daba tiempo para tramitarla, operaba una caducidad de la reválida. En el momento de presentar la solicitud de reactivación del registro (30 de noviembre de 2010), regía esa Ley 8702, la cual surtió efectos a partir del 28 de enero de 2009 y no había motivo para su desaplicación. Consecuentemente, resultaba atendible, en aquel momento, tramitar la gestión de conformidad con esa norma. No obstante, al dictarse el acto final (resolución AE-REG-OP-001/2012, de las 10 horas 15 minutos del 23 de mayo de 2012), ya no estaba vigente.

Por otra parte, considerar aplicable dicha norma al caso concreto por haberse tramitado una parte del procedimiento durante su vigencia, como parece entender el recurrente, no es de recibo. Tal y como resolvió el Tribunal no es posible entender la vigencia de la Ley se extendió para que la administración sustentara actuaciones fuera del periodo establecido legalmente; ello es contrario al principio de legalidad. Nuevamente lo manifestado por las casacionistas no es más que una disconformidad, sin un razonamiento capaz de derrumbar esa parte de la resolución impugnada, la cual permanece incólume y como el reproche es informal. Al carecer de fundamentación, este extremo del recurso se rechaza.

XI.En su segundo reparo sustancial, las recurrentes estiman que dada la naturaleza del producto a registrar (el ingrediente activo de un plaguicida), no procede la presentación de estudios. Ello en virtud de la aplicación de la ley 8702, según la cual, no tenía obligación de presentar estudios previos del producto denominado técnicamente “Ingrediente Activo Grado Técnico” (en adelante IAGT). Los IAGT se pueden registrar, explican, por dos posibles vías, por data completa (cuando son productos nuevos se suministra toda su composición química y toxicológica, entre otros) o por equivalencia (cuando no son nuevos y no tienen protección de datos de prueba, porque estos pasaron a ser información pública debido al transcurso del tiempo). En Costa Rica, refirieren, para registrar un plaguicida formulado (en adelante PF) debe contarse previamente con el registro del IAGT o ingrediente con el cual se formula.

Tal afirmación, se expresan en las siguientes normas: El artículo 15:10 del CAFTA, define producto nuevo como aquel que no tiene una entidad química previamente aprobada en el territorio de la parte. El numeral 8 de la Ley de Información no Divulgada define producto nuevo como el que no tiene una entidad química previamente aprobada en Costa Rica y su reglamento (Decreto 34927-J-S-MAG) remite a la definición del Decreto Ejecutivo 33495-MAG-S-MINAE-MEIC, al entender el IAGT como Producto Agroquímico Nuevo.

XII.Los jueces, sobre la Ley 8702 y la obligación de presentar estudios previos, indicaron: “se constituye en un régimen (…) de orden legal-, para las (…) solicitudes de registro de plaguicidas o de modificaciones a registros vigentes, pendientes de resolución antes de la vigencia del Decreto Ejecutivo 33495-MAG-S-MINAE-MEIC (…) excepcionó únicamente los requisitos para aquél trámite que previamente habían sido establecidos en la indicada reglamentación (…) Esta Ley establece los requisitos, únicos y exclusivos, que deben satisfacer las solicitudes que se encontraban en trámite antes de la promulgación del Reglamento sobre registro, uso y control de plaguicidas sintéticos formulados, ingrediente activo grado técnico, coadyuvantes y sustancias afines de uso agrícola. Las solicitudes de registro que hayan sido archivadas por no cumplir requisitos distintos de los señalados en esta Ley, podrán ser conocidas nuevamente, previa solicitud del interesado a las autoridades del Programa de Registro (…) con esta ley especial se flexibilizaron los requisitos que los gestionantes debían presentar a la Administración (…) los requisitos que impone la ley frente a los contenidos en la norma reglamentaria son más benevolentes (…) incluso, se faculta la no presentación de cierta documentación técnico-científica (...) sí se estima necesario aclarar que en este texto legal no se modifican las competencias legales previamente asignadas al Servicio Fitosanitario del Estado (…) Lo anterior encuentra sustento en lo dispuesto en los artículos 11 y párrafo final del numeral 14 de la propia Ley 8702 (...) se facultó a (…) Servicio Fitosanitario del Estado- a excepcionar de la presentación de requisitos, de manera oficiosa o a gestión de parte, siempre y cuando para ello lo hiciese mediante una resolución razonada, y "cuando existan argumentos técnicos y científicos" que le den sustento (…) esta decisión debía estar sustentada en criterio técnico y científico para ser válida y eficaz (…) la Administración (…) "podía", y ello también mediante resolución motivada, solicitar al gestionante la aportación "de estudios toxicológicos, ecotoxicológicos, de eficacia biológica y los estudios de efectos del medio abiótico, para la modalidad del ingrediente activo", ello, cabalmente "a efecto de garantizar que no se afecte la salud y el ambiente"; lo cual, se entiende que sólo podía darse, una vez que la Administración hubiese evaluado técnica y científicamente la información aportada por el gestionante (…) la discusión en este proceso no versa sobre los requisitos que la Ley 8702 dispone para este tipo de trámites, sino de la forma cómo la Administración (Servicio Fitosanitario del Estado) ejerció su competencia; lo que parece no fue comprendido por los demandados, quienes centraron su defensa únicamente en ese elemento (de qué requisitos podía o no la Administración requerir en este tipo de trámites) (…) la Administración Fitosanitaria hizo la constatación del chequeo establecido en el "Formulario de Revisión del Expediente de un Producto Técnico de Acuerdo con la Ley N° 7802." No consta ningún control posterior, más que la mera constatación de la respuesta de que ahora es otro fabricante del producto, sin analizarse siquiera -se repite- sus características físico y químicas, dado que ni siquiera esta información no consta en los autos.

Esta sola circunstancia vicia de manera absoluta el acto de registro impugnado, en los términos previstos en los numerales 133 en relación con el 158.1 y 158.4 de la Ley General de la Administración Pública; ameritando su declaratoria de nulidad absoluta, en la forma en que ha sido pedida en esta demanda”.

XIII.El argumento de las recurrentes relativo a no tener obligación de presentar estudios previos del producto a registrar, por ser un ingrediente técnico pierde sentido, porque, conforme ya se ha resuelto, la norma por la cual fueron flexibilizados los requisitos perdió vigencia. Como todo su argumento se fundamenta en la aplicación de esa legislación derogada, este extremo del recurso no prospera, porque la Administración, al momento de dictar el acto final estaba obligada a exigir todos los requisitos del decreto 33495-MAG-S-MINAE-MEIC. La flexibilización de requerimientos había terminado y la presentación de los estudios volvía a ser preceptiva para tramitar el registro de un IAGT. Se imponía seguir el procedimiento para el registro de un ingrediente activo grado técnico por equivalencia (apartado 7.3.2 de dicho decreto). La información toxicológica y eco-toxicológica, brindada en sede administrativa sobre las propiedades físicas y químicas, instrucciones sobre primeros auxilios y potenciales efectos en la salud, correspondía a la de un producto alemán.

En los folios 13 y 20 a 23 de la demanda, se alegó la necesidad de ejercer un control efectivo por el cual se determine si el producto es aceptable. Consecuentemente, no es un hecho nuevo, y no fue desvirtuado el fundamento de la sentencia según el cual, la información relativa a las propiedades y características del ingrediente activo grado técnico producido en China fue omitida y, como era necesario aportarla, incluso en vigencia de la ley 8702, este aspecto del recurso no procede.

XIV.Como tercer alegato de fondo, dicen las casacionistas, el SFE no podía exigir estudios previos del producto por carecer de competencia, es decir, no podía evaluar o analizar los componentes del Fluazifop-P-Butil. Pero para los jueces sí, por ser competencia del Servicio Fitosanitario del Estado ejercer el control efectivo de los productos químicos de uso agrícola. Según los jueces, “…es posible concluir que la realización de los estudios técnicos actúa como condicionante necesario para la correcta aplicación del principio precautorio en materia ambiental (…) al exigir como sustento de cualquier decisión de la Administración, la definición, graduación y evaluación del riesgo, para lo cual se requieren de los necesarios estudios objetivos previos (…) la aplicación de manera tajante del principio de la prevención, que se traduce, en la imposibilidad de la autorización y realización del proyecto sometido a evaluación, cuando se está ante un criterio técnico y científico certero de que una actividad humana (de cualquier índole, sea pública o privada, empresarial, industrial, comercial, agrícola, etc.) provocará un daño al ambiente y a sus elementos, por cuanto se parte del deber de evitarlos con anticipación” (...) “sí se estima necesario aclarar que en este texto legal no se modifican las competencias legales previamente asignadas al Servicio Fitosanitario del Estado, las que se mantienen en los términos establecidos en la Ley de Protección Fitosanitaria, del año de mil novecientos noventa y siete.

Lo anterior encuentra sustento en lo dispuesto en los artículos 11 y párrafo final del numeral 14 de la propia Ley 8702. En efecto, en el primero de ellos (numeral 11) se facultó a la Administración -entiéndase Servicio Fitosanitario del Estado- a excepcionar de la presentación de requisitos, de manera oficiosa o a gestión de parte, siempre y cuando para ello lo hiciese mediante una resolución razonada, y "cuando existan argumentos técnicos y científicos" que le den sustento a tal decisión; debiéndose entender entonces, que no obstante la situación de eliminar requisitos, se cumpliría la finalidad de garantía del instituto del registro de plaguicidas, en tanto objetivamente resultaría innecesario la presentación de uno(s) requisito(s) para acreditar la calidad e inexistencia de riesgo para la salud de las personas, animales y para la integridad del ambiente, propiamente en los elementos del suelo, agua, aire y biodiversidad de la flora y fauna, o que su impacto negativo está dentro de los niveles aceptables o permitidos.

Es decir, esta decisión debía estar sustentada en criterio técnico y científico para ser válida y eficaz. Y en el segundo, al contrario del anterior, se le hace la indicación a la Administración de que "podía", y ello también mediante resolución motivada, solicitar al gestionante la aportación "de estudios toxicológicos, ecotoxicológicos, de eficacia biológica y los estudios de efectos del medio abiótico, para la modalidad del ingrediente activo", ello, cabalmente "a efecto de garantizar que no se afecte la salud y el ambiente"; lo cual, se entiende que sólo podía darse, una vez que la Administración hubiese evaluado técnica y científicamente la información aportada por el gestionante. Es decir, cabe concluir que con la promulgación de la Ley número 8702 no se afectaron (ni modificaron ni flexibilizaron) las competencias de control y evaluación en el registro de plaguicidas asignada al Servicio Fitosanitario (…) la discusión en este proceso no versa sobre los requisitos que la Ley 8702 dispone para este tipo de trámites, sino de la forma cómo la Administración (Servicio Fitosanitario del Estado) ejerció su competencia; lo que parece no fue comprendido por los demandados, quienes centraron su defensa únicamente en ese elemento (de qué requisitos podía o no la Administración requerir en este tipo de trámites)”.

XV.Nuevamente, las casacionistas fundan su argumento en una norma derogada para el momento del dictado del acto administrativo por el cual se ordenó la inscripción. Sobre la obligatoriedad de realizar estudios previos a un IAGT, estima esta Cámara, procede analizar la situación antes, durante y después de la vigencia de la ley 8702. La solicitud de reactivación de la solicitud de registro, motivo de este proceso, fue gestionada en vigencia de esa ley, y al momento del dictado del acto final, ya no regía esa norma. Antes de su entrada en vigor, era necesaria la presentación de varios estudios, como una de las condiciones para tramitar el registro de un IAGT. En los numerales 7.2.2.1.d) y 6.2.1, del decreto 33495-MAG-S-MINAE-MEIC, se dispuso que toda la información para dicho registro, tanto de Propiedades Físicas y Químicas, así como los toxicológicos, ecotoxicológicos, eficacia, fitotoxicidad y de residuos, debían suministrarse a través de datos provenientes de ensayos o estudios realizados sobre el producto a ser registrado.

En el trámite de registro, esos estudios eran aportados en una primera etapa de recepción de documentos, luego, en un segundo momento, eran analizados por el Servicio Fitosanitario del Estado y en una tercera fase, se establece una consulta preceptiva ante los ministerios de Salud y MINAE, dichas instituciones quedaban, según el decreto, facultadas para realizar pruebas o estudios adicionales para la toma de decisiones. Finalmente emitían un dictamen en el cual estaba contenida su evaluación, y podía ser objeto de aclaración o adición por parte del registrante. Ese procedimiento tuvo un período de excepción de tres años con el dictado de la ley 8702. En ese plazo, fueron flexibilizados los requisitos a cumplir. No había obligación de realizar estudios previos de un IAGT, pero sí era necesario aportar toda la información del caso. En su canon 14, era potestativo del SFE realizar estudios adicionales.

Según los jueces, en la especie solo se comprobó el cumplimiento de requisitos a partir de un formulario, sin el aporte, por parte de la nueva empresa, de documentación de respaldo sobre la composición química y física del producto del nuevo fabricante. Por ello, declararon en sentencia, nulidad del registro realizado por vicio en el elemento motivo del acto, pues para ellos, si lo pretendido era hacer una excepción en la presentación de los requisitos, entonces debió realizarse por resolución razonada, en aplicación del principio de la objetivación de la tutela del ambiente, el principio precautorio, el artículo 14 de la misma ley y los numerales 133, 158.1 y 158.4 de la Ley General de la Administración Pública. También encontraron los jueces vicio en el fin del acto, pues al no resguardarse la calidad del producto, implicó una actuación administrativa sin atender sus competencias y valores superiores.

Es claro, para esta Cámara, la ley 8702 había perdido vigencia al momento del dictado del acto final, entonces no era la norma aplicable para resolver. Al no regir la flexibilización, entonces sobreviene la exigencia de los requisitos del trámite normal. En todo caso, debe advertirse, dicha ley de excepción obligaba a quienes pretendían realizar el registro de un IATG, en los términos de su artículo 14, a entregar información, como la clasificación toxicológica según la OMS, propiedades físicas y químicas, primeros auxilios, potenciales efectos en la salud, información toxicológica y eco-toxicológica. La presentación de estudios no era, en esa fecha, obligatoria. En este caso, tales requerimientos se observan declarados en las primeras páginas del expediente administrativo, esa información fue brindada por la empresa gestionante y, conforme se puede leer, las empresas suministradoras del producto descrito eran las de nacionalidad alemana, referidas en un principio del trámite (folios 4 y 9 del legajo marcado 2 del expediente administrativo).

Es decir, la información existente era la de un producto alemán, y no la del fabricante chino, que fue el finalmente inscrito. Esa exigencia de declarar, como condición previa al trámite del registro, un análisis serio de los componentes, se alegó en los folios 13 y 20 a 23 de la demanda, bajo la afirmada necesidad de ejercer un control efectivo mediante resolución técnica a partir de la cual se determine si el producto es aceptable. No es de recibo el reproche de ser un hecho nuevo. Sentada entonces la obligación de declarar toda la información relativa a las propiedades físicas y químicas del IAGT, así como los aspectos toxicológicos, ecotoxicológicos, de eficacia, de fitotoxicidad y de residuos, solo puede entenderse llevan la razón entonces los jueces al considerar se trató de una nueva solicitud, porque las propiedades físicas y químicas del ingrediente activo, las características del producto técnico, el método analítico, peligros, precauciones y composición técnica fueron declarados con relación a lo fabricado por las empresas alemanas.

Cuando se propuso como suministradora a la empresa china, no se aportó ese mismo tipo de información, lo cual era preceptivo en la ley 8702, vigente al momento de realizar ese trámite, pues aún tratándose del mismo producto, debió declararse su composición conforme lo manufacturaba la nueva empresa fabricante, ese era el sentido de la ley. De modo que este reclamo no prospera.

XVI.El cuarto reparo sustancial, se refiere a que el Tribunal entendió la solicitud de registro como una gestión nueva, debido al cambio del titular de la gestión y del fabricante del producto, en vez de tomarlo como una reactivación de una solicitud de registro, iniciada por una de las empresas demandadas y practicada a nombre de la otra. Se trató de una cesión de titularidad, alegan, no de un vicio de nulidad. Por el contrario, lo actuado generó derechos y nunca fue objetado por la actora, con lo cual, considera hay violación al debido proceso. Reprocha, los juzgadores tuvieron como no demostrado que las empresas Químicas Costarricenses Quicosa S.A. y Distribuidora de Productos Agropecuarios DPA S.A. tuvieran alguna relación comercial o corporativa, cuando eso no fue cuestionado ni en la demanda, ni en la contestación. Sin embargo, señalan, ambas están representadas por Marvin Martínez Araya, lo cual hace presumir la existencia de un grupo corporativo o de interés económico. Argumentan, la empresa actora nunca objetó ese traspaso del trámite, y por tener ambas el mismo representante, debe entenderse son un grupo de interés económico. Estiman violentado el artículo 194 del Código Procesal Civil (en adelante CPC) porque la cesión cumplió su cometido y generó derechos.

XVII.Los juzgadores resolvieron al respecto: “la gestión inicialmente formulada lo fue de parte de la empresa Químicos Costarricenses Quicosa Sociedad Anónima, y en relación a un producto concreto: herbicida agromart fluazifop-p-butil 80 TC, compuesto a base de fluazifop-p-butil y de tipo propanoato arilico y fabricado por Helm AG P.O.Box 10 30 60 Hamburgo DF-20021- Alemania; Biestefeld U.S.Inc. 757 Third Av New York 10017. Fax: 212 688 6038 Tel: 212 688 5850-U.S.A. Jebsen & Jesse - Alemania Iangvmonherend 200 95 Hamburgo - Alemania, respecto del cual se hizo indicación de las propiedades físicas y químicas del ingrediente activo, características del producto técnico, método analítico, peligros y precauciones para productos técnicos y composición química -hecho probado 1.)-. Sin embargo, el acto final (de aprobación del registro impugnado), lo fue de otro producto y otra gestión, en tanto, ya se indicó que el mismo fue modificado según anotación que presentara el Presidente (actuando de manera individual) de la empresa Distribuidora de Productos DPA Sociedad Anónima en nota del diecinueve de mayo del año dos mil once, en relación a otra empresa fabricante -"Zhejiang-E-Tong; Chemical Co.

LTD CHINA"-; sin que en esa oportunidad se acompañase ninguna documentación o información en relación con la composición química y física del producto de la nueva empresa fabricante proponente. En este sentido, es evidente que se trata de otro producto el que fue finalmente autorizado por la Administración, y esta actuación se originó en la activación de la gestión inicialmente planteada que hiciera, nuevamente el Presidente (actuando de manera individual) de la empresa Distribuidora de Productos DPA Sociedad Anónima, el treinta de noviembre del año dos mil diez, esto es con posterioridad al plazo previsto en el artículo 1 de la Ley 8702. Para este Tribunal no hay duda de que se trató de una nueva solicitud, en la que existieron cambios sustanciales, tanto del producto autorizado como de la empresa registrante”. Para esta Cámara, en la especie, no lograron las casacionistas desvirtuar el defecto señalado por los jueces, relativo a no haberse demostrado una relación de continuidad entre la gestión realizada primero por una de las empresas y luego por la otra, tal y como se analizó en el considerando XV. Por ende, no es de recibo el reproche ha de denegarse.

XVIII.Como quinto reproche, se alegó indebida valoración de una anotación hecha a mano por un químico evaluador, según la cual, el IAGT tiene más de 10 años de registrado. En su criterio, señalan, según los juzgadores, hay un vicio en esa nota a mano visible en el “check list” del referido profesional, quien consignó que el ingrediente activo grado técnico tiene más de 10 años de registrado. El vicio estuvo, según el Tribunal, en que esa afirmación no tiene prueba de respaldo. Consideran las recurrentes, los juzgadores interpretaron incorrectamente ese hecho, pues, según se entiende, el Servicio Fitosanitario del Estado dejó transcurrir 10 años sin dictaminar el expediente de la solicitud, cuando ese dato, solo es relevante para determinar si debe darse protección de datos de prueba al registro, en los términos del artículo 15:10 del CAFTA.

XIX.Lo apreciado por el Tribunal de juicio, al momento de comprobar el cumplimiento de la normativa, es que “la Administración hace un chequeo o mera constatación de los requisitos presentados por la primera gestionante, de lo que se deja constancia en un formulario, que lleva como título "Formulario de Revisión del Expediente de un Producto Técnico de Acuerdo con la Ley N° 7802" (…) Dicha fórmula aparece con anotaciones a mano que completa la información requerida (nombre del gestionante, nombre del producto, nombre del regente, fecha de presentación de la solicitud). Se hace una anotación para indicar que "el cambio de nombre la compañía debe hacerse por medio de una modificación de registro" y otra para consignar que debe de escogerse un sólo fabricante del producto y una marca de visto bueno en algunos de los puntos de la lista (…) Finalmente a mano, (…) aparece la siguiente anotación "(registrado hace más de 10 años el ingrediente activo)." No se acompaña el formulario con ningún registro o documentación en la que se respalde esta última anotación (…) con el recuento del cuadro fáctico previo, se advierte con absoluta claridad que previo a la aprobación del registro del plaguicida técnico de nombre agromart fluazifop-b-butil 80 TC, el Servicio Fitosanitario no efectuó ninguna evaluación técnico-científica de la información suministrada por el gestionante (…) el estudio o análisis que realizó la Administración lo fue únicamente de mera constatación o chequeo de los requisitos supuestamente establecidos en la ley (…) únicamente de manera general se consignó (…) que la gestión cumplía con los requisitos establecidos en la Ley especial número 8702, sin saberse detalle alguno de aquellos.

Nuevamente lo anterior incide de manera directa en el motivo del acto, en tanto resulta imposible verificar de manera objetiva aquél cumplimiento, de donde no es posible corroborar en este caso, que los presupuestos fácticos se diesen en la forma en que fueron tomados para adoptarse el acto (artículo 133 de la Ley General de la Administración Pública.)”.

XX.En criterio de este órgano judicial, las casacionistas no combaten la sentencia. Su argumentación se limita a afirmar que lo registrado no se trató de un IAGT nuevo, sino de aprovechar un registro anterior, de más de 10 años. Si su intensión era acusar violación indirecta de ley por indebida valoración de prueba, debieron precisar cuál, en su criterio, es el motivo por el cual el razonamiento no es correcto y cuál era la prueba a valorar de otra manera. No lo hicieron y por ende, el reclamo debe rechazarse por informal. No basta decir que ya existía el IAGT previamente registrado, no concretó de qué registro se trató y tampoco se haya realizado la evaluación de la equivalencia de ambos productos, con sus características químicas para establecer la composición, constitución y configuración molecular del ingrediente activo de manera indubitable como para aprovechar un registro sin protección de datos confidenciales. Consecuentemente, por informal, este reparo no procede.

XXI.Como sexto reparo, reclaman las recurrentes, según los juzgadores, hubo vicios de nulidad absoluta, el Servicio Fitosanitario del Estado incumplió el deber de obtener estudios de otros ministerios por los cuales se garantice la seguridad sanitaria y ambiental, como requisito previo al registro. Considera desacertado ese razonamiento de los jueces, pues los IAGT, señaló, no tienen que ser evaluados por el MINAE o el Ministerio de Salud como requisito previo al otorgamiento del registro, e incluso, el Servicio Fitosanitario del Estado tampoco debía realizar estudios o análisis. Pero los jueces los exigieron, relató, porque según ellos, el régimen de flexibilización de tres años dictado por dicha norma, no significó dejar de exigir documentación para evaluar el producto. Con esa posición, las casacionistas estiman violentados los principios de razonabilidad y proporcionalidad, e indebida valoración de la prueba.

Según los jueces, el SFE actuó con desviación de poder al dictar un acto carente de fin y contenido. El Tribunal, en su sentencia, no distinguió, adujo, entre un producto técnico y un producto formulado. Un producto técnico, es solo un ingrediente, no puede dañar la salud o el ambiente porque no se aplica al campo, no se libera al ambiente, tampoco entra en contacto con personas ni animales, y no se autorizó su comercialización. Para eso, el ingrediente registrado tendría que estar asociado a un producto formulado, momento en el cual los ministerios de Salud y Ambiente sí rinden sus dictámenes toxicológicos y exotoxicológicos. Los jueces aplicaron el principio precautorio o de evitación prudente, pero a su juicio, eso no se ajusta al caso, por ser el registrado un genérico con más de 20 años de estar en el mercado y cuya información es de conocimiento público. Consideran “prematuro” el fallo porque no se consultó al SFE si ya había sido dictaminada la información técnica, científica, química, toxicológica y ecotoxicológica.

Tal requisito, aducen, solo procede con respecto a un plaguicida terminado, ya listo para vender en el mercado, pero no con relación a un ingrediente. Sin importar si es fabricado en Alemania, o en China, afirman, su formulación es la misma, la cual, alegan, es de conocimiento público, por eso, acusan de inaplicable el principio precautorio, porque el solo registro de un ingrediente activo grado técnico (en adelante IAGT) no autoriza la comercialización. El requisito de realizar estudios se “flexibilizó” en la ley 8702, al grado de ser solamente necesario aportar información, con lo cual, dicen, al exigir estudios el Tribunal, invadió una competencia técnico-científica y, además, por ser un hecho no argumentado por la parte actora, acusan, el Tribunal ha lesionado los artículos 155 CPC, 90 y 110 CPCA y contrarió su propia jurisprudencia, contenida en la resolución 2244-2010 de 10 horas 40 minutos de 11 de junio de 2010 del Tribunal Contencioso Administrativo, en la cual, refieren, los juzgadores sostuvieron una posición diferente a la forma de resolver en este asunto.

Según aquél precedente, la ley 8702 desaplicó el Decreto Ejecutivo 33495-MAG-S-MINAE-MEIC y simplificó los requisitos y procedimientos para actualizar los registros mediante un trámite de revalidación. Pero en la resolución impugnada, afirman, se desdijo de lo resuelto en dicha sentencia, para sostener, en este caso, la existencia de requisitos no aplicables al otorgamiento del registro de un producto técnico, como lo es la realización de pruebas químicas, técnicas y otras. Es decir, estiman, los jueces exigieron requisitos no aplicables al registro de un producto técnico. Por otra parte, alegan, la sentencia no analizó el artículo 14 de la ley 8702, según el cual, el estudio considerado como obligatorio por los jueces, en realidad es potestativo, con lo cual, concluyó, se violentó el contenido de esa ley. Según concluyen, no era necesaria la evaluación de los IAGT por parte del Ministerio de Salud y el Ministerio del Ambiente y Energía, como requisito previo al otorgamiento del registro, y por eso, la sentencia resulta errónea al pretender endilgar al Servicio Fitosanitario del Estado la obligación de realizar estudios o análisis de productos técnicos.

XXII.Según los jueces existió “Finalmente, consecuencia de lo ya anotado, de manera evidente se infringe este elemento (…) la función de registro de plaguicidas en el país tiene una importantísima connotación en el ordenamiento jurídico nacional, que se inserta como uno de los instrumentos de efectiva tutela de los derechos fundamentales de la salud y a un ambiente sano ecológicamente equilibrado, así como de los derechos de los consumidores (artículos (artículos 21, 46 y 50 de la Constitución Política), que condicionan y limitan el ejercicio de la libertad empresarial y de comercio. De manera que esta competencia debe ser ejercida "... con eficiencia, eficacia y con apego al principio de legalidad" por el Servicio Fitosanitario del Estado, conforme a los objetivos de su creación, "que lo llaman a regular, ejecutar y fiscalizar el registro y uso de agroquímicos, en el marco de una actividad agrícola en armonía con la naturaleza y con fiel apego a los principios constitucionales de derecho a la vida, a la salud y a un ambiente sano", como lo indicó en su informe FOE-AM-19/2009 la Contraloría General de la República, caso contrario, como en el presente, por la forma en que ha actuado, se ha orientado a facilitar el registro y comercialización de un producto agroquímico, con absoluta omisión de sus competencias y de los valores superiores que rigen la materia, sin resguardar este caso, ni la calidad del producto autorizado ni los riesgos o efectos en la salud y en el ambiente, lo que se constituye en una evidente desviación de poder, como ha sido acusado y comprobado”.

XXIII.Ya se indicó en el XIII considerando de esta resolución, que el acto final fue emitido cuando ya no estaba en vigencia la Ley 8702, y habían vuelto a regir las exigencias del Decreto 33495-MAG-MINAE-MEIC. Entonces, resultaba preceptivo seguir el procedimiento para el registro de un ingrediente activo grado técnico por equivalencia (apartado 7.3.2 de dicho decreto). Es necesario apuntar aquí, según las recurrentes, los ministerios de Salud y MINAE no tenían competencia para actuar, porque la disposición reglamentaria por la cual se establece su participación es contraria, a la Ley 7664 o Ley de Protección Fitosanitaria. Para esta Cámara, no hay razón alguna para entender que el Decreto 33495-MAG-S-MINAE-MEIC sea un desarrollo únicamente de dicha Ley 7664, como para afirmar, según lo entienden las casacionistas, que haya, vía reglamentaria, un traslado de competencias hacia los ministerios de Salud y MINAE, no autorizados por ley.

Muy por el contrario, el encabezado del referido decreto cita todas las leyes de las cuales es desarrollo y en los considerandos 6 a 9, expone las razones por las cuales es necesario un enfoque multidisciplinario, en protección de la salud humana, la sanidad vegetal, por el cual se reordenen los procedimientos con integración de la participación de los ministerios de Agricultura y Ganadería, Ministerio de Salud y el Ministerio de Ambiente y Energía, “de conformidad con sus competencias”. Se concluye, el argumento no se sostiene, y la protección de la salud y el ambiente está plenamente sustentada tanto en las leyes mencionadas en el decreto, como en el artículo 50 constitucional. Así las cosas, al no observarse formalidad en el planteamiento, este extremo del recurso también se desestima.

XXIV.En su séptima argumentación, señalan, el acto de registro consolidó una situación jurídica, y su cancelación requería seguir uno de los canales señalados en la Ley General de la Administración Pública, ya sea el de nulidad absoluta, evidente y manifiesta, o bien, el proceso de lesividad. El argumento es novedoso. En todo caso, esa es la vía cuando quien gestiona la nulidad es el Estado y en este caso no se cumple con ese presupuesto, este aspecto del recurso se rechaza.

XXV.Corolario de lo expuesto, el recurso de casación debe denegarse. La parte promovente deberá sufragar las costas generadas con el ejercicio de esta instancia, en los términos dispuestos por el artículo 150 inciso 3) del Código Procesal Contencioso Administrativo.

POR TANTO

Se declara sin lugar el recurso planteado por las codemandadas, quienes deberán sufragar sus propias costas.
