Enforcement of Judgment proceedings (Ejecución de Sentencia) brought before the Administrative and Civil Court of the Treasury by LUIS VALVERDE SALAZAR, married, occupation unknown, resident of Limón, against the STATE, represented by Deputy Attorney General Laura Araya Rojas, single, attorney, resident of San José. The natural persons are of legal age.
BACKGROUND

I.By official communication A2-109-95, the head of the Sarapiquí subregional office of the Ministry of Environment and Energy granted Mr. Luis Valverde Salazar a permit for the forest harvesting (aprovechamiento forestal) of 141 trees, 67 of which were almendro trees. However, through decision SN-076, issued at 9 hours 39 minutes on 3 de junio de 2005, Don Luis’s request for the issuance of waybills and tags for transporting the timber was denied. This was based on the fact that precautionary measures (medidas cautelares) for the conservation of the almendro species established by Executive Decree number 30961-MINAE remained in force, and it had not been possible to sign the decree on which the resumption of the processing and issuance of permits for the felling, harvesting, and transportation of standing or fallen almendro trees depended. Following the rejection of the appeals filed against that denial, Don Luis sought constitutional relief, alleging violations of Articles 34 and 39 of the Political Constitution.
The Constitutional Chamber found that those violations had occurred. It held that, even though the Administration acted to safeguard the precautionary principle (principio precautorio) governing environmental matters and in compliance with constitutional rulings concerning the conservation of the almendro species, decisions of this kind may not infringe fundamental rights. It established that, in order to extinguish Mr. Valverde Salazar’s vested right (derecho adquirido), the Administration should have complied with the formal and substantive requirements, either by challenging its own acts through administrative proceedings in accordance with the circumstances contemplated in Articles 155 and 173 of the General Law of Public Administration, or by bringing an action for declaration of injury to the public interest (lesividad) before the administrative-law courts. Consistent with that determination, the judgment being enforced declared decision SN-076 null and void, without prejudice to correcting the defects and conducting the administrative proceeding.
It ordered the State to pay the damages, consequential damages, and costs caused by the acts underlying the declaration. Pursuant to that award, Don Luis brought proceedings before the administrative-law court to quantify the damages that, in his view, arose from conduct by the Administration found to be contrary to constitutional law. He requests compensation for material and non-pecuniary harm. In ruling, the Court found no causal link (nexo de causalidad) between the relief sought and what was ordered in the constitutional judgment. The judgment creditor (ejecutante), dissatisfied with that ruling, appeals.
II.Four grounds of challenge were raised. The first two were procedural, and the remaining two were substantive. Given the manner in which this matter will be decided, only the first objection, alleging that the judgment lacks a statement of reasons, will be addressed. In this regard, the objecting party contends that the challenged judgment fails to consider that the judgment being enforced ordered the annulment of decision SN-076, which denied the waybills for transporting the timber. He explains that, by failing to address that annulment, the judgment contains no analysis of the State’s liability when it issues an administrative act (acto administrativo) that is declared null and void, or of the legal consequences, specifically when such decisions cause harm to the affected party (administrado). He states that the analysis in the challenged judgment fails to address the declaration of nullity ordered by the Constitutional Chamber itself and the resulting award against the State for the damages caused.
III.Regarding this type of error, this Chamber has held that it occurs when a judgment is entirely devoid of the reasons on which it is based. In this case, it is clear that the alleged error occurred. Indeed, this adjudicative body finds that the judgment lacks adequate reasoning. Upon review, it is apparent that the judge, in an exceedingly cursory manner, refers only to the absence of a causal link between the relief sought by the judgment creditor and the findings in the judgment being enforced concerning the constitutional right violated. However, the judge goes no further and fails to address the ruling in the judgment being enforced concerning the nullity of the administrative act—which infringed the fundamental rights of the petitioner for constitutional relief (amparado)—as declared by the Constitutional Chamber, in relation to the claims for compensation submitted by the judgment creditor in the enforcement proceedings. Accordingly, this Chamber finds that, in the absence of a complete analysis of the scope and holdings of the judgment being enforced, the judgment creditor cannot ascertain precisely the reasons why the judge ruled as he did and thus cannot come before this Chamber to challenge them, if appropriate. This plainly constitutes the defect of insufficient reasoning, and the challenge must therefore be sustained.
IV.As stated above, because the judgment contains the alleged defect of insufficient reasoning, the appeal shall be granted on procedural grounds. Accordingly, the appeal is granted, the challenged judgment is vacated, and the matter is remanded to the Administrative and Civil Court of the Treasury for a new judgment in accordance with law [Article 150, subsection 1), of the CPCA]. Because it is unnecessary, no ruling is made on the remaining objections raised by Mr. Luis Valverde Salazar.
THEREFORE
The appeal in cassation is granted on procedural grounds. The appealed judgment is vacated. The case file is remanded to the court of origin for issuance of a new judgment in accordance with law. Because it is unnecessary, no ruling is made on the remaining claims asserted by the judgment creditor.

Ejecución de Sentencia establecido en el Juzgado Contencioso Administrativo y Civil de Hacienda, por LUIS VALVERDE SALAZAR, casado, de profesión desconocida, vecino de Limón; contra el ESTADO, representado por la procuradora adjunta, Laura Araya Rojas, soltera, abogada, vecina de San José. Las personas físicas son mayores de edad.
RESULTANDO

CONSIDERANDO
I.Por medio del oficio A2-109-95 la jefatura del área subregional de Sarapiquí del Ministerio de Ambiente y Energía, le otorgó al señor Luis Valverde Salazar un permiso para el aprovechamiento forestal de 141 árboles de los cuales 67 eran de almendro. Sin embargo, por medio de la resolución SN-076 de las 9 horas 39 minutos del 3 de junio de 2005, a don Luis le fue denegada la solicitud de entrega de guías y placas para el transporte de la madera. Ello, bajo el argumento de que se mantenían medidas cautelares de conservación de la especie de almendros establecidas mediante el Decreto Ejecutivo número 30961-MINAE; sin que hubiese sido posible firmar el decreto del que depende la reactivación del trámite y permisos de corta, aprovechamiento y transporte de árboles en pie o caídos de la especie de almendros. Luego del rechazo de los recursos formulados en torno a esa denegatoria, don Luis acudió a la sede constitucional argumentando quebranto de los preceptos 34 y 39 de la Constitución Política.
La Sala Constitucional tuvo por verificados tales quebrantos. Estimó, que aún y cuando la Administración actuó en resguardo del principio precautorio que rige la materia ambiental y en respeto a los pronunciamientos constitucionales (conservación de la especie de almendros); no es admisible que con decisiones de este tipo se lesionen derechos fundamentales. Estableció que para anular el derecho adquirido del señor Valverde Salazar, debió la Administración observar los requisitos formales y sustanciales, sea recurriendo ésta última sus propios actos en vía administrativa según los supuestos contemplados en los numerales 155 y 173 de la Ley General de la Administración Pública o acudir a la vía de la lesividad ante la jurisdicción contenciosa administrativa. A tono con lo resuelto, dispone el fallo ejecutado la nulidad de la resolución SN-076 sin perjuicio de que se corrijan los vicios y se sustancie el procedimiento administrativo.
Condena al Estado al pago de los daños, perjuicios y costas causados con los hechos que sirven de fundamento a la declaratoria. En el marco de esa condenatoria, don Luis acude a la sede contenciosa con el objeto de liquidar los daños que en su criterio se generaron con la conducta de la Administración calificada como contraria al derecho de la Constitución. Ruega, le sean reconocidos daños de naturaleza material y de orden extrapatrimonial. El Juzgado al resolver estimó que no existe nexo de causalidad de lo pretendido con lo ordenado en la sentencia constitucional. Inconforme el ejecutante recurre.
II.Cuatro fueron las censuras formuladas. Las dos primeras con carácter adjetivo, las dos restantes de índole sustancial. Por la forma como será resuelto el presente asunto, se abordará únicamente el primer reparo donde se alega una falta de fundamentación de la sentencia. Al respecto, estima el objetante, en la sentencia controvertida no se analiza que en el fallo que se ejecuta se ordenó la nulidad de la resolución SN-076 donde se deniegan las guías de transporte de la madera. Al omitir referirse a esa anulación, explica, no existe un análisis relacionado con la responsabilidad del Estado cuando emite un acto administrativo que es declarado nulo y sus consecuencias legales específicamente cuando esas decisiones causan daño al administrado. El análisis del fallo impugnado, dice, obvia referirse a la declaratoria de nulidad ordenada por la propia Sala Constitucional con la consecuente condena impuesta al Estado con los daños ocasionados.
III.Esta Cámara en lo que a este tipo de yerro se refiere ha dispuesto que se produce cuando la sentencia carece por completo de las razones en las cuales se fundamenta. En la especie, es claro que se produce el error acusado. En efecto, observa este Órgano decisor la ausencia de la debida motivación del fallo. Revisado que fue aquel, se aprecia que el juzgador de una forma en extremo sucinta, se refiere únicamente a la inexistencia de un nexo de causalidad entre lo pretendido por el ejecutante y lo establecido en la sentencia ejecutada en torno al derecho constitucional vulnerado. Sin embargo, se limita a ello sin abordar lo resuelto en el fallo ejecutado en torno a la nulidad del acto administrativo (lesivo a los derechos fundamentales del amparado) decretada por la Sala Constitucional, en relación con los ruegos resarcitorios formulados por el ejecutante en el proceso de ejecución. En esa virtud, es criterio de esta Sala, que al no existir un análisis completo de los alcances y de lo resuelto en la sentencia ejecutada, no le es posible al ejecutante conocer con exactitud las razones que tuvo el Juzgador para resolver de la forma que lo hizo y de esa manera acudir a esta sede a objetarlas si fuera del caso; lo que evidentemente hace que se configure el vicio de falta de fundamentación y por ello deba de acogerse el embate.
IV.Según lo expresado, al producirse en la sentencia el vicio acusado de falta de motivación, se habrá de acoger el recurso por motivos adjetivos, razón por la cual, se acoge el recurso, se anula el fallo impugnado y se ordena el reenvío al Juzgado Contencioso Administrativo y Civil de Hacienda con el propósito de que lo emita de nuevo conforme a derecho [artículo 150 inciso 1) del CPCA]. Por innecesario, se omite el pronunciamiento sobre los restantes reproches formulados por el señor Luis Valverde Salazar.
POR TANTO
Se declara con lugar el recurso de casación por motivos procesales. Se anula el fallo recurrido. Reenvíese el expediente al despacho de procedencia para que se dicte nueva sentencia conforme a derecho. Por innecesario, se omite pronunciamiento en cuanto a los restantes cargos argüidos por el ejecutante.
