Ordinary proceeding (proceso ordinario) heard before the Agrarian Court of the Second Judicial Circuit of the Southern Zone, Corredores, brought by JOSÉ RODRIGO SOLANO CALDERÓN, widower, farmer, resident of Puntarenas; against JOSÉ ÁNGEL CASTRILLO ARIAS, single, farmer; URIEL TOBIAS CASTRILLO BOLAÑOS, farmer; NELSON FALLAS CAMPOS, forestry engineer; REYNIER CASTRILLO BOLAÑOS, single, farmer; and MARÍA, known as DAMARIS ARIAS JIMÉNEZ, homemaker. Also appearing as special litigation counsel (apoderados especiales judiciales) are attorney Carlos Azofeifa Arias, divorced, on behalf of the plaintiff; attorney Roy Thompson Chacón, single, resident of Alajuela, on behalf of defendant Nelson Fallas Campos; and attorneys Juan Antonio Mora Doninelli, divorced, resident of San José, and David Matamoros Salazar, on behalf of co-defendant Uriel Castrillo Bolaños. CONSIDERING
I.Mr. José Rodrigo Solano Calderón filed an action against Nelson Fallas Campos, Uriel Tobías Castrillo Bolaños, Reyner Castrillo Arias, Damaris Arias Jiménez, and José Ángel Castrillo Arias, essentially seeking declarations that: the last-mentioned co-defendant, represented by his attorney-in-fact (apoderado), Uriel Tobías, applied for and obtained permits for two removals of forest resources, the first under a management plan (plan de manejo) and the second under a timber harvesting permit (permiso de explotación de madera); in support of those applications, he submitted information concerning properties owned by Mr. José Ángel, but, he stated, the felling and removal carried out pursuant to those permits took place on his own property, recorded under real-property folio (folio real) 81.687-000 in the Registry District of Puntarenas; through those acts, he carried out unlawful felling, causing him damages (daños y perjuicios) consisting of the value of the timber cut and removed from the site, which he estimated at ¢29.575.000,00; ¢12.000.000,00 for environmental harm, plus the corresponding interest; Mr.
José Ángel Castrillo Arias is jointly and severally liable (responsable solidario) because the forest-resource harvesting permits were processed in his name and for his benefit, thereby resulting in an unlawful increase in his assets; Mr. Uriel Tobías Castrillo Bolaños is jointly and severally liable because he was the person who cut and removed the timber, even though he had express and direct knowledge that the activity was carried out on the plaintiff’s property and that the permits were intended to be implemented on properties belonging to his relative; engineer Nelson Fallas Torres, as forestry regent (regente) of the logging operations, is jointly and severally liable for the harm caused because he mapped the census of the trees to be cut, performed the technical field verifications, and negligently authorized and processed the operation, an error that led to the improper felling; Mr.
Gerardo Mora Mora, an official of the Subregión Coto Brus of the Área de Conservación la Amistad-Pacífico of the Sistema Nacional de Áreas de Conservación of MINAE, is jointly and severally liable for the harm caused because he conducted the field verifications and inspections, as well as the “legal” reviews and reviews of the survey plans submitted in the administrative proceedings (expedientes administrativos), and—despite the persistent discrepancies—erroneously and negligently authorized the harvesting of timber resources on the plaintiff’s property. On the basis of the foregoing, he requested that the co-defendants be ordered to pay the damages caused, as well as legal costs (costas). In the alternative, he requested a declaration that, because the properties in Puntarenas recorded under real-property folio numbers 77.308-000 and 32.985-000 were used as a means of unlawfully and surreptitiously expanding and modifying the scope of the management plan for forest harvesting and the timber harvesting permit in order to facilitate the unlawful removal of timber resources from his property, they must answer for the obligations claimed in these proceedings.
Co-defendants Uriel Castrillo Bolaños and Nelson Fallas Campos denied the complaint and raised defenses based on lack of legal right, cause of action, standing to sue and be sued, expiration (caducidad), and statute of limitations (prescripción), as well as the general defense of “sine actione agit.” The remaining co-defendants were declared in default (rebeldes). The Trial Court upheld the defenses of lack of legal right and standing to sue and be sued, as well as the defense of “sine actione agit”; it dismissed the action in its entirety and ordered the plaintiff to pay legal costs. The Appellate Court reversed only the award of legal costs against the plaintiff, ruling instead that there would be no special award of costs. In all other respects, it affirmed the decision. Dissatisfied with the ruling, the plaintiff and co-defendant Uriel Tobías Castrillo Bolaños appealed to this Chamber.
Appeal by the plaintiff
II.The appeal is divided into seven sections. In the first, he refers to the subject matter of the proceedings, namely compensation for the damages he claims to have sustained as a result of the felling of trees and removal of timber from his property in the Registry District of Puntarenas, real-property folio number 81.687-000. He states that the Appellate Court erroneously placed his property, for cadastral purposes, in a location different from its actual location. He asserts that his property is described in registered cadastral survey plan (plano catastrado) no. P-900124-90, which is the precise site where the logging operation took place. He states that he has possessed that parcel, as established through witness testimony. In the second section, he indicates that the co-defendants denied the complaint, arguing that the actual tract of land where the timber was removed corresponds to properties belonging to them.
He objects that the court below (Ad quem) accepted this argument, which is why he was not awarded compensation for the harm claimed. He states that the judges discredited the expert report (informe pericial)—particularly its supplemental report—even though it states that the timber was removed from his property. In the third section, he objects that the Appellate Court upheld the decision of the court of first instance (A quo), which failed to consider useful and effective evidence, such as the judicial inspection (reconocimiento judicial) and the expert opinions (dictámenes de peritos). He argues that the witnesses were consistent in placing the logged area on his property, as did the judicial inspection. Nevertheless, he objects, the appellate judges affirmed the Trial Court’s decision insofar as it concluded that the witnesses had made clear that the area from which the timber was removed belonged to the co-defendants.
He argues that the witnesses said the felling occurred there but did not state that the land belonged to the defendants. He reproaches the Appellate Court for disregarding the testimony of Mr. Gerardo Quirós Artavia, who stated that the timber was removed from the parcel that the plaintiff possessed. He further asserts that the judicial inspection locates his property, contradicting the opposing party’s assertion that it belongs to them. He objects to the statement that what can be observed in the field is secondary forest, with no evidence of felled trees, because, he argues, the inspection recorded that, upon entering the mountain, trees cut long ago and in a state of decomposition could be seen. Moreover, upon reaching the northwestern vertex, course seven of the plan identifying his property, felled and sawn trees could indeed be seen. He notes that this was confirmed by the witnesses Juan Herrera Villegas and Víctor Gerardo Rodríguez Berrocal, who stated that the felling extended from the place where they gave their testimony toward the creek—the northern boundary—and that there is evidence that this area lies within his parcel, according to the plan at folio 4 of the case file.
He charges that the court below erroneously established the cartographic position of his property at coordinates 573 and 574 parallels and 321-322 meridians, while placing property no. 81.687-000 at coordinates 321 and 322 meridians, concluding that his land lies one kilometer north of its actual location. He states that the court disregarded the fact that the physical extent of his property and his possession for more than 10 years correspond to the parcel where the logging operation took place. In the fourth section, he states that the Trial Court and the Appellate Court failed to find it proven that trees were felled at the location where the judicial inspection was conducted and that the defendants benefited from that felling; therefore, he should be awarded payment for the felled timber (192,2 m3 and 10,63 m3, for a total of ¢28.000.000,00 and ¢1.575.000,00, respectively), as well as compensation for the deforestation sustained (environmental damage of ¢12.000.000,00).
He continues that the supplemental expert opinion submitted by engineer Barrantes Acosta was also assessed erroneously because, he states, it established that his property, described in plan no. P-900124-1990, is consistent with the physical extent of the parcel where the timber was harvested and that, because of duplicate title registration (doble titulación), it overlaps another property belonging to Yanori Castrillo Arias. He further maintains that it establishes beyond doubt that the timber removal did not occur on the properties the co-defendants used to obtain the permits. In support, he transcribes part of the expert report referring to the duplicate title registration and stating that the timber was felled in the area described in plans P-992578-1991—real-property folio no. 77.307-000—; P900124-1990—real-property folio no. 81.687-000—and P-823320-2002—real-property folio no. 32.983-000—(to a lesser extent).
He also reproduces part of the explanation of the survey (levantamiento), which reveals similarities in the shapes of the plans and corresponding boundaries. In his opinion, this is the “decisive evidence in these proceedings” supporting his claims, and he explains that the deeds and plans used to obtain the permits do not correspond to the location of his property, yet the felling was carried out on that property. In the sixth section, he notes that the erroneous assessment of the evidence led the court below to rule incorrectly and then lists the facts that, in his view, should have been deemed proven and that relate to the arguments developed in the preceding sections. Finally, in the seventh section, he states that the provision violated is article 1045 of the Código Civil and argues that he proved that the co-defendants engaged in acts that diminished his assets as a result of the logging operation carried out on his property, as well as that the harm was causally related to those acts (causal nexus (nexo causal)).
III.In agrarian matters, an appeal to the Chamber of Cassation (Sala de Casación), because it is not subject to special technical formalities, does not require citation of the statutory provisions infringed. This does not mean that it is informal in a broad sense, because it must be organized in a technically proper manner, numbering and structuring the challenges to the judgment so as to explain and substantiate the legal violation it entails. Accordingly, the appellant must clearly and precisely explain the grounds on which the disagreement is based. In short, an appeal in agrarian matters is neither wholly informal nor exempt from all procedural technique, as provided by provision 557 of the Código de Trabajo, expressly incorporated by reference through ordinal 61 of the Ley de la Jurisdicción Agraria, as this Chamber has repeatedly held.
IV.It should be noted that the appeal (recurso) filed is practically a copy of the appeal lodged against the judgment of the A quo (folios 1629 to 1639 of the judicial case file), except that references to the Court were changed to the Tribunal, or else it continues to refer to the former but adds that the Ad quem upheld it. In addition, the appeal filed before this Chamber omitted the final claim—concerning costs—because it was granted by the judges of the second instance. Likewise, some sections contain additions, but they do not clearly and precisely challenge the grounds on which the Tribunal ruled as it did. The first two objections concern general aspects of the proceedings, their subject matter, and the parties’ positions, but do not challenge the contested judgment. In the first, he added matters relating to the Ad quem’s determination regarding the cadastral location of his property, which he characterizes as erroneous, and insists that the extraction occurred on his land.
He refers to the witnesses, and although he identifies them individually, as noted, he reiterates what was stated in the appeal against the judgment of the A quo, and therefore does not challenge the Tribunal’s ruling. Thus, he fails to explain how their testimony would support a different resolution. On this point, the Ad quem stated: “…the witnesses were consistent in stating that the timber extraction, in implementation of the management plan (plan de manejo), occurred on the property belonging to Tobías’s son, as Juan Ramón Herrera Villegas testified at folio 1233, reverse, in accordance with the deed and the survey plan. This witness places the harvesting to the north of the stream and the access lane, not to the south. This witness is credible because he was even assigned to mark one of the log yards, according to the sketch at folio 59. Second, the witness Walter Barrantes Soto, at folio 1234, reverse, also stated: ‘…from where we are standing, the land to the north belongs to the Castrillos.
I know that they have owned this property for about thirty years…,’ which is precisely the area where the extraction occurred, according to the preceding witness. The appellant complains that the testimony of Gerardo Quirós was not assessed, but not only is his interest evident, he also states that he has maintained the access lanes since 2008 (after the complaint was filed) and that he had not previously entered the property; yet he says he has had problems with one of the defendants, who tells him that the access lanes do not run there (see folio 1235). By contrast, the witness Reiner Castrillo Arias is among the most coherent in his testimony, stating that ‘…the log yard is located 400 meters north of José Ángel Castrillo’s property. When the harvesting occurred, no one raised any objection. The harvesting occurred within José Ángel Castrillo’s property…to the best of my knowledge, no trees were felled on any property belonging to Mr.
Rodrigo…no one raised any objection… The witness is shown the survey plan at folio 3 and identifies the point where we are currently located, which he marks as bearing point 17, and states that the land sold to the plaintiff within that plan lies between bearing points 11, 13, 15, and 16…’; that is precisely the analysis conducted at the beginning of this recital (considerando). Finally, the witness Víctor Gerardo Rodríguez, at folio 1137, reverse, clearly states: ‘I was always certain that it was understood that the property where the extraction occurred belonged to Mr. Tobías; even the forestry engineer told us so. We were shown the boundaries, and trees were cut uphill from the boundary, that is, to the north… At no time was timber removed from Rodrigo’s property; he knew about that extraction. The witness is shown the survey plan at folio 3 and states that the timber was removed from approximately the center of the plan toward the public road.
Where we are located, I recall that the access lane ran east to west, and the logging took place north of the access lane while respecting the stream area. I know of only one stream within this property…’ (folio 1237, reverse).” The appellant in cassation (casacionista) does not challenge the foregoing, and, contrary to his argument, the witnesses’ testimony establishes that the logging occurred on the co-defendants’ properties.
V.In the third ground of appeal, he reiterates his disagreement with the first-instance judge’s decision insofar as, in his view, the judicial inspection (reconocimiento judicial) and expert reports (dictámenes de peritos) were not assessed. In both instances, he cites the folios of the case file where they appear, although he neither specifies which portions support his assertion nor explains how they would warrant overturning the ruling. For their part, the second-instance judges stated: “…proven fact No. A) indicates that the plaintiff, Rodrigo Solano Calderón, acquired property 81.687-000 from José Ángel Castrillo Arias through segregation (segregación) from property 32.985-000. The area sold was 6 hectares 8.787,88 square meters. Upon close examination of the information in survey plan P-518194-83, it is readily apparent, according to the information shown there, that the portion segregated from that property is the southern part, the portion below the stream, which adjoins Rodrigo Solano Calderón’s property (see folio 3).
According to the plan, that portion would be located on the topographic map sheet halfway between coordinates 573 and 574 (parallels) and coordinates 321 and 322 (meridians), below the stream identified on the topographic map sheet as Hurri. This conclusion follows because the property originally measured 39 hectares 7.439,76 square meters and, following the segregation recorded at folio 2, measured 32 hectares 8.635,18 square meters… This means that a tract with an exact location was segregated from that property, but when it was registered, it was associated with Plan P-900124-1990. If its geographical location at folio 4 is examined, it is readily apparent that the segregated tract was associated with a plan located approximately one kilometer farther north, between vertices 322 and 323 (meridians), one kilometer above Quebrada Hurri. This very likely may have caused a clerical error (error material) and the alleged overlap between that tract and a third party’s property.
That original inaccuracy in the location of the plaintiff’s property is precisely what led him to bring the claim for damages (reclamo indemnizatorio), but it deprives him of standing (legitimación), because, as stated, the property allegedly segregated and sold was located in the southern portion of Registered Survey Plan No. P-518194-83, a property that remained adjoining the segregated tract… If the sketches from the management plans at folios 57 and 58 are examined, it is readily apparent that the boundaries of the forest-harvesting plan (plan de aprovechamiento forestal) were demarcated in the central portion of both properties, on the northern side or upper portion of Quebrada Hurri, with the southern portion shown on the topographic map sheet as lying outside the harvesting plan.” He states that the foregoing is also supported by the report of Engineer Juan Araque Skinner, Deputy Director of the Catastro Nacional (folio 613), as well as by the expert opinion (pericial) of José Barrantes Acosta (folios 1164 to 1175), whose first conclusion is that the locations shown on the registered survey plans are deficient when compared with the corresponding title documents.
Similarly, he cites the expert report at folios 1219 to 1222, which demonstrates that the property acquired by the claimant is incorrectly located or georeferenced. Consequently, the Tribunal found no basis for concluding that there was an “error of fact” (error de hecho) in the assessment of the evidence, because the property’s geographical location is one thing, while the land acquired by the plaintiff is another. The appellant fails to establish the alleged error and does not clearly and precisely explain how the judicial inspection and expert reports would support a different resolution. This Chamber upholds the Ad quem’s assessment of the evidence because it derives from a comprehensive assessment of the evidence contained in the record.
VI.In another vein, the appellant states that “all the witnesses” place the exploited area physically within his property, as does the judicial inspection (reconocimiento judicial). Nevertheless, he completely disregards what the Court stated and fails to challenge it as required. In recital V of their judgment, as explained, the judges set forth the grounds on which they became convinced that the timber extraction did not take place on the plaintiff’s property. Thus, they stated that Mr. Solano Calderón acquired from Mr. José Ángel Castrillo Arias a property measuring 6 hectares and 8,787.88 square meters, subdivided from property no. 32.985-000. They determined that this area is located in the southern portion, below Quebrada Hurri, halfway between coordinates 573 and 574 (parallels) and coordinates 321 and 322 (meridians). They added that, in what they regard as an error, the plaintiff’s property was assigned a survey plan (plano) located one kilometer farther north, between vertices 322 and 323 (meridians), above that creek.
In their view, this led him to bring the claim, even though his portion is actually located south of the creek and of registered survey plan no. P-518194-83. Most importantly, they noted: “This plan contains another important item of information, namely the distance between vertices 10 and 11, to the southwest, totaling 1003,59 meters in length, which coincides with Plan P-992579-91, registered in the name of co-defendant José Ángel Castrillo Arias, which reports a distance of 1003,58 meters between vertices 3 and 4 on its northeastern side. This cannot be a coincidence, but rather confirms that the two parcels are not only adjoining, but also that those plans (except for the portion sold to the plaintiff herein) were used to design the forest management plan (plan de manejo forestal). Indeed, upon examining the sketches from the management plans at folios 57 and 58, it is easy to verify that the boundaries of the forest harvesting plan (plan de aprovechamiento forestal) were drawn through the central part of both properties, on the northern or upper side of Quebrada Hurri, leaving the southern portion shown on the map sheet outside the harvesting plan.
It may also be observed that the copy of the Plan appearing at folio 79 of the administrative forest-harvesting file has the portion on the southern side of the creek crossed out and marked ‘sold.’ That portion, incidentally, has a very different shape from the one described by the Plan at folio 4, which is highly rectangular, whereas the portion of land allegedly sold to the plaintiff was more square-shaped.” The appellant does not challenge the foregoing analysis in any manner. The appellate court (Ad quem) further stated—again without challenge by the appellant—that the subdivision deed recorded that the transferred land consisted of brushland and pasture, not forest. Consequently, the plaintiff plainly raises no challenges against the Court’s judgment of the kind that alone may be heard at this stage. For this Chamber, and without the appeal having disproved it, it is evident that the exploited portion lies north of Quebrada Hurri, whereas the plaintiff’s land is located south of that reference point.
The location proposed by the appellant cannot be established. It should be noted that he merely argues that the witnesses said the logging occurred on his property, but without any specific geographic or cadastral reference, unlike the judges, who supported their finding with such references. The Ad quem analyzed the expert reports in light of the properties’ geographic location, stating: “See the geographic location of the parcels at folio 615, entirely separated from one another in relation to the plaza (folios 615 and 616).” They added, as transcribed above, that despite every effort made by expert José Barrantes Acosta, he was unable to determine the exact location of plan no. P-900124-1990. The plaintiff remains silent regarding the Ad quem’s ruling; he does not refute the Court’s assessment of the evidence, but merely presents his position in general terms, which, as stated, is similar to the position set forth in the appeal against the trial court’s judgment.
It must be observed that the Ad quem assessed the evidentiary materials as a whole—expert, testimonial, and cadastral evidence—to reach its conclusions. This enabled it to locate the timber extraction on Mr. Tobías Castrillo’s land, north of Quebrada Hurri, without the appellant undermining that conclusion in any way. His objections are plainly general and do not directly challenge the judges’ ruling. The claimant should have challenged it directly and provided the factual and legal grounds warranting reversal of the judgment, but the appeal contains none. Nor does he specify how the evidence affects the Court’s ruling or how it would contribute to reaching a different decision. He refers to a series of items of evidence, such as the testimony of Mr. Gerardo Quirós Artavia, but does not refute what the judges determined regarding that witness. Moreover, contrary to the appellant’s argument, the Court made clear how the witnesses precisely located the logging on Mr. Tobías’s property. The grounds of appeal are therefore unfounded.
Appeal by the defendants
VII.Sole Ground: They allege that the Court failed to assess the testimony of witnesses Juan Herrera Villegas and Walter Barrantes Soto, who stated that the timber extraction was carried out openly, that the plaintiff knew about it, and that he did not commence the proceedings until the work had been completed, relying on a registered survey plan whose location is incorrect. From the time property no. 32.985-000 of Puntarenas was subdivided, the claimant took possession of his parcel, which he consolidated with other properties belonging to him, located south of the parcels that were exploited. Thus, he knew from the outset that the properties from which the timber resource was extracted did not belong to him, that his property was located more than one kilometer away, and that it consisted of pastureland. They contend that, in light of the foregoing, “there can be no good faith on his part,” because he seeks to recover a parcel through an ownership action (reivindicar) that is not the one he purchased and that was fully identified, to the point that he entered into possession of it. Therefore, contrary to the ruling, the plaintiff litigated in bad faith and should be ordered to pay both categories of litigation costs (ambas costas del proceso).
VIII.Regarding the costs of the proceedings, the Court, in reversing the Trial Court’s determination on that issue, reasoned: “The appellant asserts that he litigated in evident good faith, since there has been no question that he is the owner of the registered property; therefore, the complaint was not frivolous, because the location had to be clarified through expert evidence. In that regard, the Court finds that the complaint was indeed based on a claim for damage to a duly registered property right, but one whose registered location was uncertain, which prevented the cause of the damage from being established with precision. Under Article 55 of the Ley de Jurisdicción Agraria, a party may be exempted from costs when sufficient grounds for litigation existed and evident good faith was present, circumstances that exist in this particular case. Consequently, solely as to this issue, the appealed judgment must be reversed insofar as it ordered the plaintiff to pay costs, and instead no special award of costs shall be entered.” As may be seen, it exempted the plaintiff from paying costs because it found that he held a registered property right, but one with an uncertain location.
For their part, the defendants argue in their appeal that there was no opposition during the timber operation; that from the time the claimant purchased the parcel, he took possession of it and consolidated it with other properties he owned; that the claim is based on a registered survey plan with an incorrect location; but that he knew from the outset that the logging did not occur on a parcel belonging to him and that his property consisted of pastureland. They thus seek to disprove the Ad quem’s ruling because, in their view, the plaintiff knew its location perfectly well. Section 55 of the Ley de la Jurisdicción Agraria provides that the party who loses the proceedings may be exempted from paying costs when it is evident that the party litigated in good faith because, in the judges’ opinion, sufficient grounds existed for doing so. With regard to payment of the costs of these proceedings, this Chamber finds that the final portion of section 55 ibídem applies, because the plaintiff had sufficient grounds to litigate, given that the cadastral information was inadequate to properly locate the plaintiff’s property in relation to those of the co-defendants, as it was incorrectly located or georeferenced.
It should be added that some of the properties were adjoining, which could have led the claimant to believe that his claim was factually and legally correct. It may therefore be concluded that Mr. José Rodrigo Solano Calderón’s participation in the proceedings was undertaken in evident good faith. The circumstances described constitute elements that reasonably caused him to believe his claim was well-founded when he concluded that the timber had been extracted from land belonging to him. It is apparent that the judges had to conduct a combined analysis of a substantial body of evidence before rejecting the relief sought by the plaintiff. The foregoing requires dismissal of this ground of appeal.
IX.In view of the foregoing, the violations alleged by the appellants have not been established. Accordingly, the appeals brought before this Chamber shall be denied, and the appealed judgment shall be affirmed.

The appeals are denied. The challenged judgment is affirmed.

Proceso ordinario tramitado en el Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, Corredores, por JOSÉ RODRIGO SOLANO CALDERÓN viudo, agricultor, vecino de Puntarenas; contra de JOSÉ ÁNGEL CASTRILLO ARIAS soltero, agricultor; URIEL TOBIAS CASTRILLO BOLAÑOS, agricultor; NELSON FALLAS CAMPOS, ingeniero forestal; REYNIER CASTRILLO BOLAÑOS, soltero, agricultor; MARÍA conocida como DAMARIS ARIAS JIMÉNEZ, oficios del hogar. Figuran además, como apoderados especiales judiciales del actor, el licenciado Carlos Azofeifa Arias, divorciado, del demandado Nelson Fallas Campos el licenciado Roy Thompson Chacón, soltero, vecino de Alajuela; del codemandado Uriel Castrillo Bolaños los licenciados Juan Antonio Mora Doninelli, divorciado, vecino de San José y David Matamoros Salazar. Las personas físicas son mayores de edad y con la salvedad hecha, casados, abogados, vecinos de Puntarenas.
RESULTANDO

CONSIDERANDO
I.El señor José Rodrigo Solano Calderón interpuso demanda contra Nelson Fallas Campos, Uriel Tobías Castrillo Bolaños, Reyner Castrillo Arias, Damaris Arias Jiménez y José Ángel Castrillo Arias, donde en lo medular pidió se declarara: el último de los codemandados representado por su apoderado Uriel Tobías tramitó y consiguió permisos para realizar dos extracciones del recurso forestal, la primera en la modalidad de plan de manejo y la segunda como permiso de explotación de madera, donde para sus gestiones aportó la información de fincas propiedad de don José Ángel, pero, señaló, las talas y extracciones que realizaron con merced a dichos permisos se efectuaron en la finca de su propiedad, matrícula de folio real 81.687-000 del Partido de Puntarenas; con dichas actuaciones realizó talas ilegitimas, causándole daños y perjuicios, consistentes en el valor de la madera cortada y retirada del lugar, que estimó en el monto de ¢29.575.000,00; ¢12.000.000,00 por concepto del menoscabo ambiental más los respectivos intereses; el señor José Ángel Castrillo Arias es responsable solidario dado que los permisos de aprovechamiento del recurso forestal se tramitaron a su nombre y en su beneficio, con lo que obtuvo un ingreso ilegítimo en su patrimonio; don Uriel Tobías Castrillo Bolaños es responsable solidario ya que fue quien hizo las cortas y retiro de la madera, aunque tuvo conocimiento expreso y directo de que la actividad se verificó en el inmueble de su propiedad y que los permisos eran para ejecutarlos en las propiedades de su familiar; el ingeniero Nelson Fallas Torres como regente de las explotaciones madereras, responde solidariamente por el detrimento causado, puesto que él realizó los mapeos del censo de población de árboles a cortar, así como las verificaciones técnicas en el campo y fue quien la autorizó y tramitó negligentemente, yerro que condujo a la indebida tala; el señor Gerardo Mora Mora, funcionario de la Subregión Coto Brus del Área de Conservación la Amistad-Pacífico del Sistema Nacional de Áreas de Conservación del MINAE es responsable solidario por los daños provocados, ya que realizó las verificaciones e inspecciones de campo, así como las “legales” y de los planos aportados a los expedientes administrativos, -y pese a las diferencias constantes autorizó errónea y negligentemente la explotación del recurso maderero en su finca.
En razón de lo anterior solicitó se condenara a los codemandados al pago de los daños y perjuicios causados, así como al pago de las costas. Subsidiariamente pidió se declarara en razón que las fincas de Puntarenas, folios reales números 77.308-000 y 32.985-000 se utilizaron como un instrumento para ampliar y modificar de manera ilegal y subrepticia el ámbito de aplicación del plan de manejo para aprovechamiento forestal y el permiso de explotación de madera a fin de facilitar la extracción ilegal del recurso maderero de su inmueble, deberán responder por las obligaciones que se reclaman en el presente proceso. Los co-accionados Uriel Castrillo Bolaños y Nelson Fallas Campos contestaron negativamente e interpusieron las excepciones de falta de: derecho, acción, legitimación activa y pasiva, caducidad, prescripción, así como la expresión genérica de “sine actione agit”. Los restantes codemandados fueron declarados rebeldes.
El Juzgado acogió las defensas de falta de: derecho, legitimación activa y pasiva y la de “sine actione agit”; sin lugar en todos sus extremos la demanda, con las costas a cargo del accionante. El Tribunal revocó únicamente en cuanto a la condena en costas a la parte actora, en su lugar resolvió sin especial condenatoria en costas. En todo lo demás confirmó lo resuelto. Inconformes recurren para ante esta Sala el demandante y el codemandado Uriel Tobías Castrillo Bolaños.
Recurso de la parte actora
II.El recurso lo divide en siete apartados, en el primero alude al objeto del proceso, cual es, la indemnización por los daños y perjuicios que aduce experimentó en virtud de la tala de árboles y extracción de madera de su finca del Partido de Puntarenas, folio real número 81.687-000. Expone el Tribunal de forma errónea localizó su inmueble catastralmente en lugar distinto al de su real ubicación. Afirma, su propiedad se describe en el plano catastrado no. P-900124-90 que es el sitio exacto donde se realizó la explotación maderera. Parcela que expresa, ha poseído, según lo acreditó mediante prueba testimonial. En el segundo aparte, indica, los codemandados contestaron negativamente la demanda, arguyendo, que la materialidad del terreno donde se verificó la extracción de madera corresponde a las fincas que les pertenecen. Recrimina, esto la avaló el Ad quem, razón por la cual no le concedieron el menoscabo reclamado.
Los jueces, dice, desacreditaron el informe pericial, -principalmente su ampliación-, donde se señala que la madera se extrajo de su finca. En el tercero, reprocha el Tribunal avaló el fallo del A quo, donde se dejó de apreciar prueba útil y eficaz, como son el reconocimiento judicial y los dictámenes de peritos. Alega, los testigos fueron contestes al ubicar el área explotada en su propiedad, al igual que el reconocimiento judicial. Sin embargo, objeta, los juzgadores de segunda instancia ratifican lo resuelto por el Juzgado, en tanto arribó a la conclusión de que los testigos dejaron claro, la zona de la extracción corresponde al terreno de los codemandados. Argumenta, los testigos dijeron que la tala se hizo ahí, pero no manifestaron correspondiera a la finca de la parte demandada. Increpa, el Tribunal obvió el testimonio del señor Gerardo Quirós Artavia, quien expresó, la madera se extrajo del predio que estaba siendo poseído por su persona.
Por otro lado, asevera, el reconocimiento judicial ubica su finca, lo que contradice el dicho de la contraria, atinente a que les pertenece a ellos. Reprocha, se indique lo que se observa en el campo es bosque secundario, sin evidencia de árboles cortados, pues, aduce, en la inspección se dijo al internarse en la montaña se aprecian árboles cortados hace tiempo, en estado de descomposición. Y, al llegar al vértice noroeste, derrotero siete del plano que identifica su inmueble, sí se ven árboles cortados y aserrados, lo cual, apunta, confirmaron los testigos: Juan Herrera Villegas y Víctor Gerardo Rodríguez Berrocal, quienes manifestaron la tala se realizó del lugar donde rindieron su deposición, hacia la quebrada –lindero norte-, y existe evidencia esa zona se ubica en su parcela, según plano de folio 4 del expediente. El Ad quem, con error, acusa, estableció el posicionamiento cartográfico de su inmueble en las coordenadas 573 y 574 paralelos y 321-322 meridianos; mientras que la finca no. 81.687-000 con las coordenadas 321 y 322 meridianos, concluyendo que su terreno está un kilómetro al norte de su ubicación real.
Dejó de lado, manifiesta, que la materialidad de su predio y la posesión por más de 10 años es sobre la parcela donde se verificó la explotación maderera. En el cuarto, enuncia, al juzgador y al Tribunal les faltó tener por probado que en el lugar donde se hizo el reconocimiento judicial se realizó una tala de árboles, de la que se aprovechó la parte demandada, de ahí, se le han de conceder el pago de la madera talada (192,2 m3 y 10,63 m3, para un total de ¢28.000.000,00 y ¢1.575.000,00, respectivamente) y los perjuicios por la deforestación sufrida (daño ambiental por ¢12.000.000,00). Continúa, también la ampliación del peritaje rendido por el ingeniero Barrantes Acosta fue apreciada erróneamente, pues, indica, se determinó, su propiedad descrita en el plano no. P-900124-1990 es conteste con la materialidad de la parcela donde se explotó la madera, y que en virtud de doble titulación se traslapa en otra finca (de Yanori Castrillo Arias), y sin duda alguna se acredita, la extracción maderera no se hizo en las fincas que los codemandados usaron para obtener los permisos; en su apoyo transcribe parte del informe pericial, donde se alude al doble título y que la madera se taló en la zona descrita en los planos P-992578-1991 –folio real no. 77.307-000-; P900124-1990 -folio real no. 81.687-000 y P-823320-2002 –folio real no. 32.983-000- (en menor grado).
Reproduce también parte de la explicación del levantamiento, donde se denotan las similitudes en la forma de los planos y coincidencia de los linderos. Ésta en su opinión, es la “prueba reina de este proceso” que apoya sus pretensiones, y explica, las escrituras y planos utilizados para obtener los permisos, no se corresponden con la ubicación de su predio, pero fue en este último donde se realizó la tala. En el sexto, apunta, la errada apreciación probatoria condujo al Ad quem a resolver erróneamente, de seguido, enumera los hechos que en su criterio, debieron tenerse por acreditados y que se relacionan con los argumentos desarrollados en los apartados precedentes. Por último en el sétimo manifiesta, la norma quebrantada es el artículo 1045 del Código Civil, y argumenta, demostró los codemandados realizaron actuaciones que desmejoraron su patrimonio a causa de la explotación maderera que se hizo en su propiedad, así como que el detrimento se relaciona con aquellas (nexo causal).
III.En materia agraria, el recurso ante la Sala de Casación, al no estar sujeto a formalidades técnicas especiales no requiere la mención de las disposiciones legales infringidas. Lo anterior no significa informalidad, en sentido amplio, pues debe ordenarse de modo técnico, enumerando y estructurando los reproches a la sentencia en orden a justificar y fundamentar el quebranto legal que ella importa. De manera que el recurrente deberá explicar, necesariamente en forma clara y precisa los motivos sobre los cuales sustenta su disconformidad. En suma el recurso en materia agraria no es absolutamente informal, ni ajeno a toda técnica procesal, conforme lo dispone el precepto 557 del Código de Trabajo por remisión expresa del ordinal 61 de la Ley de la Jurisdicción Agraria, según lo ha señalado esta Sala de forma reiterada.
IV.Ha de observarse, el recurso interpuesto es prácticamente una copia del de apelación formulado contra la sentencia del A quo (folios 1629 al 1639 del expediente judicial), solo que donde se aludía al Juzgado, se cambió por el Tribunal, o bien, refiere siempre al primero, pero agrega, el Ad quem lo avaló. Además, en el interpuesto ante esta Cámara se omitió el último extremo,-relativo a las costas-, dado que fue acogido por los juzgadores de segunda instancia. Asimismo, en algunos de los apartados tiene algunas adiciones, pero, sin combatir de forma clara y precisa los fundamentos del Tribunal para fallar como lo hizo. Los dos primeros reproches se refieren a generalidades del proceso, objeto, posición de las partes, pero sin atacar la sentencia impugnada. En el primero agregó lo pertinente a lo establecido por el Ad quem en cuanto a la ubicación catastral de su inmueble, la cual califica de errónea e insiste la extracción se realizó en su terreno.
Refiere a los testigos, y aunque los individualiza, según se señaló, reitera lo manifestado en el recurso de apelación contra la sentencia del A quo, de forma que no combate lo dispuesto por el Tribunal. Así, omite explicar cómo sus testimonios contribuirían a resolver distinto como se hizo. Sobre este particular, el A quem, expresó: “…los testigos fueron contestes al indicar que la extracción de madera, en ejecución del plan de manejo se produjo en la finca propiedad del hijo de Tobías, así lo declaró Juan Ramón Herrera Villegas, a folio 1233, vuelto, conforme a la escritura y el plano. Este testigo señala el aprovechamiento hacia el norte, de la quebrada y el carril, y no hacia el sur. Este testigo es creíble, porque se le puso a marcar incluso uno de los patios, según el croquis a folio 59. En segundo término, también el testigo Walter Barrantes Soto, a folio 1234 vuelto, indicó “…aquí donde estamos hacia el norte es de los Castrillos.
Sé que esta propiedad es de ellos desde hace unos treinta años…”, que es justamente la parte donde se hizo la extracción según lo dijo el testigo anterior. Reclama el recurrente no se valoró lo dicho por el testigo Gerardo Quirós, pero resulta no solo evidente su interés, sino también que indica cuida los carriles a partir del 2008 (después de la demanda), y que antes no había ingresado a la propiedad, pero dice que ha tenido problemas con uno de los demandados, que le indica que los carriles no son por ahí (ver folio 1235). Por el contrario, el testigo Reiner Castrillo Arias, es uno de los más coherentes en su declaración al indicar, que “…el patio se ubica 400 metros hacia el norte de la Propiedad de José Ángel Castrillo. Cuando se hizo el aprovechamiento nadie manifestó nada. El aprovechamiento se hizo dentro de la propiedad de José Ángel Castrillo…hasta donde tengo conocimiento no se hizo corta de árboles dentro de alguna propiedad de don Rodrigo…nadie manifestó nada…
Se le muestra al testigo el Plano de folio 3 y ubica el punto donde estamos actualmente que señala como el derrotero 17 y manifiesta que el terreno que se le vendió al, actor dentro de dicho plano se ubica entre los derroteros 11, 13, 15 y 16…”, ese es precisamente el ejercicio que se hizo al inicio de este considerando. Finalmente, el testigo Víctor Gerardo Rodríguez, a folio 1137 vuelto señala con claridad que “Siempre tuve claro que se habló que la finca donde se hizo la extracción era de don Tobías, inclusive de parte del ingeniero forestal, a nosotros nos indicaron los linderos y del lindero para arriba se cortaron árboles, es decir hacia el norte…En ningún momento se sacó madera de la finca de Rodrigo sabia de esa extracción. Se le muestra al testigo el plano a folio 3 e indica que la madera fue sacada aproximadamente hacia el centro del plano en dirección a calle pública. Donde estamos ubicados y recuerdo que el carril estaba en esta posición en el sentido este a oeste y lo que se madero fue hacia el norte del carril y respetando el área de la quebrada.
Dentro de esta finca solo conozco una quebrada…” (folio 1237 vuelto)”. Lo anterior no lo ataca el casacionista, y contrario a lo que argumenta de la declaración de los testigos se acredita, la tala fue en las propiedades de los codemandados.
V.En el tercer cargo, reitera su inconformidad contra la resolución del juez de primera instancia, en lo tocante a que en su opinión se dejó de valorar el reconocimiento judicial y los dictámenes de peritos, en ambos, casos, cita los folios del expediente donde constan, aunque sin especificar que porción de estos sustentan su dicho, ni exponer cómo contribuirían a la quiebra de lo fallado. Por su lado, ha de manifestarse los jueces de segunda instancia, apuntaron: “…en el hecho probado No. A) se indica que el actor Rodrigo Solano Calderón, adquirió la finca 81.687-000, de José Ángel Castrillo Arias, mediante segregación de la finca 32.985-000. El área de la venta fue de 6 hectáreas 8.787,88 metros cuadrados. Si se observa con mucha atención, la información del plano P-518194-83, resulta fácil constatar, según la información que ahí aparece, que lo que se segrega de dicho inmueble es la parte sur, la porción que está debajo de la Quebrada, que es la que colinda con Rodrigo Solano Calderón (ver folio 3).
Según el plano, dicha porción estaría ubicada en la Hoja Cartográfica, a mitad de las coordenadas 573 y 574 (paralelos), y las coordenadas 321 y 322 (meridianos), debajo de la quebrada que según la hoja cartográfica se denomina Hurri. Se llega a esa conclusión, porque la finca originalmente medía 39 hectáreas 7.439,76 metros cuadrados, y luego de la segregación de folio 2, quedó midiendo 32 hectáreas, 8.635,18 metros cuadrados… quiere decir que se segregó un terreno de dicha finca, con una ubicación exacta, pero que al momento de inscribirse, se asocia al Plano P-900124-1990, y si se observa la ubicación geográfica del mismo, a folio 4, es muy fácil concluir, que al terreno segregado se le asoció un plano ubicado aproximadamente un kilómetro más al norte, entre los vértices 322 y 323 (meridianos) un kilómetro más arriba de la Quebrada Hurri, lo cual muy probablemente pudo provocar la existencia de un error material y el supuesto traslape existente entre ésta y una finca de un tercero.
Esa inexactitud original de la ubicación de la finca del actor, es precisamente lo que lo lleva a plantear el reclamo indemnizatorio, pero le resta legitimación, pues como se indicó, el inmueble segregado y vendido supuestamente estaba ubicado en la parte sur del Plano Catastrado No. P-518194-83, inmueble que quedó colindando con el terreno segregado… si se observan los croquis provenientes de los planes de manejo, a folios 57 y 58, es fácil constatar que la demarcación del plan de aprovechamiento forestal, se dio en la parte central de ambos inmuebles, al lado norte o parte superior de la Quebrada Hurri, ubicando en la hoja cartográfica la porción sur, fuera del plan de aprovechamiento”.Lo expuesto dice encuentra sustento también en el informe del Ingeniero Juan Araque Skinner, Subdirector del Catastro Nacional (folio 613), al igual que en la pericial de José Barrantes Acosta (folios 1164 a 1175), quien en su primera conclusión es que las ubicaciones de los planos catastrados son deficientes, comparados con los títulos respectivos.
De igual modo, cita el informe pericial de folios 1219 al 1222, lo que permite denotar que el bien adquirido por el accionante está mal ubicado o georreferenciado. En consecuencia, el Tribunal no encontró fundamento para estimar existía un “error de hecho” en la apreciación de la prueba, pues una cosa en la ubicación geográfica del inmueble, y otra distinta corresponde al terreno adquirido por el actor. El impugnante, no logra demostrar el yerro que acusa, no explica de forma clara y precisa cómo el reconocimiento judicial y los dictámenes de peritos contribuirían a resolver de forma distinta. Esta Cámara avala la valoración probatoria efectuada por el Ad quem, pues, proviene de la apreciación conjunta de la prueba que obra en autos.
VI.En otro orden de ideas, la parte recurrente, señala, “todos los testigos” ubican el área explotada en la materialidad de su inmueble, al igual que el reconocimiento judicial. No obstante, obvia por completo lo expresado por el Tribunal y omite combatirlo como corresponde. Los juzgadores en el considerando V de su fallo según se expuso, dieron los fundamentos por los cuales llegaron al convencimiento de que la extracción maderera no se efectuó en la propiedad del actor. Así, señalaron el señor Solano Calderón adquirió de don José Ángel Castrillo Arias un inmueble de 6 hectáreas 8.787,88 metros cuadrados, segregado de la finca no. 32.985-000. Establecieron, tal área se ubica en la porción sur, abajo de la Quebrada Hurri, a la mitad de las coordenadas 573 y 574 (paralelos) y las coordenadas 321 y 322 (meridianos). Agregaron, por su parte, -lo que consideran un error-, a la heredad del demandante se le otorgó un plano ubicado un kilómetro más al norte, entre los vértices 322 y 323 (meridianos), arriba de dicha Quebrada.
Lo que en su criterio, lo condujo a plantear el reclamo, pese a que su porción está en realidad localizada al sur de la quebrada y del plano catastrado no. P-518194-83. Y, lo más relevante, apuntaron: “Este plano tiene otro dato importante, que es la distancia entre los vértices 10 a 11, al suroeste, que dan un total de 1003,59 metros de longitud, la cual coincide con el Plano P-992579-91 inscrito a nombre del codemandado José Ángel Castrillo Arias, que al lado noreste, reporta una longitud entre los vértices 3 y 4, de 1003,58 metros, lo cual no puede ser una casualidad, sino una constatación, de que ambos terrenos no solo son colindantes entre sino que con dichos planos (exceptuando la porción vendida al aquí actor), es que se diseño el plan de manejo forestal. En efecto, si se observan los croquis provenientes de los planes de manejo, a folios 57 y 58, es fácil constatar que la demarcación del plan de aprovechamiento forestal, se dio en la parte central de ambos inmuebles, al lado norte o parte superior de la Quebrada Hurri, ubicando en la hoja cartográfica, la porción sur, fuera del plan de aprovechamiento.
Además se observa que la copia del Plano que aparece en el expediente administrativo de aprovechamiento forestal, a folio 79, aparece rayada la porción del lado sur de la quebrada como “vendido”. Porción que por cierto, tiene una forma muy diferente a la descrita por el Plano de folio 4, que es muy rectangular, mientras que la porción del terreno supuestamente vendido al actor era más cuadrado”. El anterior análisis, sin que la parte recurrente lo ataque de modo alguno. Adicionó, el Ad quem, sin que tampoco lo combata la impugnante, en la escritura de segregación se asentó el terreno enajenado era de charral y potrero, no de montaña. En consecuencia, es indudable, el actor no realiza embates contra la sentencia del Tribunal que son los únicos pasibles de conocer en esta instancia. Para esta Sala, sin que se desvirtúe mediante el recurso interpuesto, es evidente, la porción explotada se encuentra al norte de la Quebrada Hurri, mientras que el terreno del actor se localiza al sur de tal punto de referencia.
La ubicación que propone el impugnante no es posible acreditarla, nótese, se limita a argüir, lo que los testigos dijeron es que la tala fue en su inmueble, pero sin una especial referencia geográfica, ni catastral, como si lo fundamentaron los jueces. El Ad quem analizó los peritajes a la luz de la ubicación geográfica de las propiedades, disponiendo: “Véase la ubicación geográfica de los terrenos, a folio 615, totalmente distanciados, respecto de la plaza (folios 615 y 616)”. A lo que agregaron, como se transcribió, el perito José Barrantes Acosta por más intento que hizo, le fue imposible ubicar de manera exacta el plano no. P-900124-1990. Sobre lo fallado por el Ad quem, el actor guarda silencio, no refuta la valoración probatoria efectuada por el Tribunal, sino que se limita a exponer su posición de una forma general, siendo como se dijo similar a la expuesta en el recurso de apelación contra la sentencia de primera instancia.
Ha de observarse, el Ad quem valoró en conjunto los elementos de convicción (pericial, testimonial y catastral) con el propósito de arribar a sus conclusiones, lo cual le permitió ubicar la extracción de madera en el terreno del señor Tobías Castrillo, al norte de la Quebrada Hurri, sin que el recurrente lo demerite de forma alguna. Es indudable, sus inconformidades son generales, sin atacar directamente lo fallado por los jueces. El accionante debió combatirlo de forma directa y brindar las razones fácticas y normativas que permitan la quiebra del fallo, pero, el recurso es ayuno al respecto. Tampoco precisa cómo inciden sobre lo resuelto por el Tribunal, ni la manera cómo contribuiría a fallar de modo distinto a como se hizo. Alude a una serie de probanzas, como por ejemplo, el testimonio de don Gerardo Quirós Artavia, pero sin refutar lo dispuesto por los juzgadores sobre dicho deponente.
Por otro lado, contrario a lo argumentado por el impugnante, el Tribunal hizo patente como los testigos de manera precisa ubicaron la tala en el predio de don Tobías. De ahí, los agravios no resultan procedentes.
Recurso de la parte demandada
VII.Único: alega, el Tribunal dejó de valorar la prueba testimonial de los deponentes Juan Herrera Villegas y Walter Barrantes Soto, quienes afirmaron la extracción de madera se hizo públicamente y el actor supo de ella y hasta que se terminó con las labores interpuso el proceso, con fundamento en un plano catastrado cuya ubicación está equivocada. Desde que se segregó la finca de Puntarenas no. 32.985-000 el accionante tomó posesión de su terreno, el cual reunió con otros inmuebles que le pertenecían, ubicados al sur de los predios que fueron objeto de explotación. Así, era conocedor desde un inicio, que las propiedades donde se extrajo el recurso maderero no le pertenecen, y que su heredad se encuentra a más de un kilómetro de distancia y es de repastos. De lo anterior, apunta, “no puede existir buena fe de su parte”, ya que pretende reivindicar un terreno que no es el que compró, y se identificó plenamente, al grado que entró a poseerlo. De ahí, contrario a lo resuelto, el actor litigó de mala fe, por lo que debe condenársele al pago de ambas costas del proceso.
VIII.En lo que a las costas del proceso se refiere, el Tribunal al revocar lo dispuesto por el Juzgado sobre el particular razonó: “Reclama el recurrente que ha litigado con evidente buena fe, pues no se ha dudado que es propietario de la finca inscrita, por lo que no resulta temeraria la demanda, pues la ubicación debió ser dilucidada por prueba pericial. En ese sentido, considera el Tribunal, efectivamente, que la demanda se basó en el reclamo de un daño, respecto de un derecho de propiedad debidamente inscrito, pero con dudosa ubicación registral, lo que no ha permitido establecer de manera exacta la causación del daño. De conformidad con el artículo 55 de la Ley de Jurisdicción Agraria, es posible establecer la exención de costas, cuando existían motivos suficientes para litigar y ha existido evidente buena fe, circunstancias que se dan en este caso particular. En consecuencia, respecto de este extremo, únicamente, deberá revocarse la sentencia apelada, en cuanto condenó en costas al actor, para en su lugar resolver sin especial condenatoria en costas”.
Según se aprecia, exoneró a la parte demandante del pago de las costas ya que estimó, tenía un derecho de propiedad inscrito, pero con una dudosa ubicación. Por su lado, la demandada en su recurso reprocha, durante la operación maderera no hubo oposición alguna, el accionante desde que compró el terreno, tomó posesión del mismo y lo reunificó con otros inmuebles de su propiedad; el fundamento del reclamo descansa en un plano catastrado que tiene una ubicación equivocada, pero que él conocía desde un inicio la tala no se hizo en un predio que le perteneciera, y, su finca es de repastos. Así, pretende desvirtuar lo resuelto por el Ad quem, ya que en su opinión, el actor conocía cabalmente su localización. El precepto 55 de la Ley de la Jurisdicción Agraria, estipula, la parte que resulte vencida en el proceso puede ser exonerada del pago de las costas, cuando sea evidente, litigó de buena fe, porque, a juicio de los juzgadores tuvo motivo suficiente para litigar.
En lo que respecta al pago de las costas del presente proceso, estima esta Sala procede la aplicación de la parte final del cardinal 55 ibídem, puesto que existió motivo suficiente para litigar por parte de la parte actora, debido a que la información catastral era deficiente a fin de ubicar debidamente la finca del demandante respecto a la de los codemandados, ya que está mal localizado o georeferenciado. Habría de agregarse, algunos de los inmuebles eran colindantes, lo cual pudo conducir al accionante a creer estaba en lo correcto y a derecho en cuanto a su reclamo. De ahí, puede concluirse, la intervención procesal del señor José Rodrigo Solano Calderón se dio con evidente buena fe. Las circunstancias descritas, constituyen elementos que de forma racional lo hicieron creer en lo acertado de su pretensión, cuando dedujo la madera había sido extraída del terreno de su propiedad. Se observa, tuvo que recurrirse al análisis conjunto de un cúmulo importante de elementos de convicción para que los jueces rechazaran lo solicitado por el actor. Lo anterior conduce a desestimar el agravio.
IX.En razón de lo expuesto, no se han verificado las conculcaciones acusadas por los recurrentes en virtud de lo cual se denegarán los recursos formulados para ante esta Cámara y se confirmará la sentencia recurrida.
POR TANTO
Se deniegan los recursos. Se confirma la sentencia impugnada.
