San José, at nine twenty in the morning on the twenty-second of June, two thousand seventeen.- In the action for demolition (interdicto de derribo) brought by ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO RURAL DEL DISTRITO DE TUCURRIQUE, in which the PROCURADURÍA GENERAL DE LA REPÚBLICA also intervenes, the Tribunal Agrario de Turrialba denied the objection for lack of subject-matter jurisdiction (excepción de incompetencia por razón de la materia) raised by the Procuraduría General de la República. Dissatisfied with the ruling, the latter expressed its disagreement, and the matter was therefore referred to this Chamber for consultation.

WHEREAS

I.The Asociación Administradora del Acueducto Rural del Distrito de Tucurrique brings an action for demolition, seeking a judgment declaring: “1-...that this action is granted. 2- That the felling of the fifty-nine cited trees be authorized. 3- That MINAE for the area be requested to appear at the property together with the judge to determine the condition of the trees and to carry out their felling. This is because special machinery is required, after which the resulting material must be disposed of in accordance with the Ley Forestal” (F. 33).

II.The Procuraduría General de la República raised an objection for lack of subject-matter jurisdiction. It alleged that this matter must be referred for consideration to the Juzgado Contencioso Administrativo y Civil de Hacienda, which is responsible for processing and deciding it, because the strip of land surrounding drinking-water collection sites that supply a population, or that should be reserved for that purpose, is in the public domain (dominio público); because all properties and facilities of State agencies intended to provide services relating to the collection, treatment, and distribution of drinking water are national assets; and therefore the movable and immovable property used by the ASADAS forms part of those assets. The large-scale felling of trees for which authorization is sought involves property allocated to the public domain, and the legal regime governing public-domain property (bien demanial) is administrative law.

The Juzgado Agrario de Turrialba referred the case file to the Tribunal Agrario del Segundo Circuito Judicial de San José for consideration of the objection raised (F. 62). The Tribunal Agrario denied the objection for lack of subject-matter jurisdiction. It found: “...although the area adjoining those tanks and springs (nacientes) is in the public domain, the fact remains that, as explained, Article 108 of the Ley de Biodiversidad assigns subject-matter jurisdiction to the agrarian courts, and the objection raised must therefore be denied…” (F. 69). The Procuraduría General de la República expressed its disagreement with the ruling, and the matter was therefore referred to this Chamber for consultation.

III.Article 108 of the Ley de Biodiversidad provides: “Jurisdictional authority. In biodiversity matters, and until an environmental jurisdiction exists, every dispute shall fall within the exclusive jurisdiction of the administrative courts. As exceptions to the foregoing rule, offenses against biodiversity shall be tried by the criminal courts; likewise, disputes arising between private parties that involve neither an administrative act nor the public domain shall fall within the jurisdiction of the agrarian courts…”. It follows from the foregoing that the agrarian courts have jurisdiction over biodiversity matters when:

  • 1)the disputes arise between private parties,
  • 2)no administrative act is involved, and
  • 3)the public domain is not involved. In addition, provisions 13 and 14 of Ley Forestal no. 7554 stipulate: “13.- The State’s natural heritage shall consist of the forests and forest lands of national reserves, areas declared inalienable, properties registered in its name, and those belonging to municipalities, autonomous institutions, and other Public Administration agencies, except for real property securing credit transactions with the Sistema Bancario Nacional that becomes part of its assets. The Ministerio del Ambiente y Energía shall administer this heritage. Where appropriate, through the Procuraduría General de la República, it shall register the lands in the Registro Público de la Propiedad as individually identified properties owned by the State. Nongovernmental organizations that acquire real property containing forest or suitable for forestry, using funds from donations or the public treasury obtained in the name of the State, must transfer such property to the State”; Article 14: “The forest lands and forests constituting the State’s natural heritage, as specified in the preceding article, shall be immune from attachment and inalienable; their possession by private parties shall create no right in their favor, and the State’s action for recovery (acción reivindicatoria) of these lands shall not be subject to prescription. Consequently, they may not be registered in the Registro Público through possessory information proceedings (información posesoria), and both their invasion and occupation shall be punished in accordance with this law.” In the case under consideration, it is apparent that the property on which the trees whose felling is requested are located belongs to the Asociación Administradora del Acueducto Rural del Distrito de Tucurrique; and under Article 18 of Ley 2726 Ley Constitutiva Instituto Costarricense Acueductos y Alcantarillados, “All properties and facilities of State agencies that are intended to provide services relating to the collection, treatment, and distribution of drinking water and the disposal of sewage or stormwater in the country are national assets…”. Accordingly, under the transcribed provisions, because real property allocated to the public domain is involved, the courts with jurisdiction to hear this proceeding are the administrative courts.

IV.Consequently, pursuant to section 110, subsection 3), of the Ley Orgánica del Poder Judicial, it is declared that jurisdiction over the action lies with the Juzgado Contencioso Administrativo y Civil de Hacienda.

V. Dissenting Opinion of Justice Escoto Fernández

The undersigned member of this Chamber respects the decision of the other members but departs from the majority’s position set forth in this ruling and dissents on the grounds stated below:

I.The initial complaint in this possessory injunction proceeding (proceso interdictal) was filed by the Asociación Administradora del Acueducto Rural del Distrito de Tucurrique before the Juzgado Agrario de Turrialba, Cartago, where the matter has been processed. The court below (A quo) admitted this Tree-Demolition Injunction (Interdicto de Derribo de Árbol) and notified the Procuraduría General de la República—hereinafter PGR—by ruling issued at 14 hours 7 minutes on 9 de noviembre de 2015. In official communication no. 15-000035-1002-AG, the Judge also ordered the Head of the Oficina Sub Regional de Turrialba of the Ministerio de Ambiente, Energía y Telecomunicaciones—hereinafter MINAET, now MINAE—to arrange, pursuant to section 474 of the Código Procesal Civil, for a judicial inspection (Reconocimiento Judicial) to be conducted in Tucurrique at 9 hours on 24 de julio de 2015 by the Judge and a forestry expert appointed by MINAET, now MINAE.

According to the record of the visit to the location of the trees at issue in this proceeding, at the time and on the date stated in the aforementioned official communication, the Juez Agrario de Turrialba, accompanied by Pedro Luna Montoya, administrator of the Acueducto Rural del Distrito de Tucurrique, and Mario Castro Mora, an official of MINAET, now MINAE, verified that the trees are taller than 25 metros and are located near homes and the drinking-water collection tanks supplying the communities of Tucurrique. PGR appeared in the proceeding and stated its opposition to felling the trees in question. It also raised an objection for lack of subject-matter jurisdiction, arguing that the strip of land surrounding drinking-water collection or intake sites is in the public domain. It further argued that, pursuant to section 4 of the Ley Orgánica del Ambiente, section 50, and the case law of the Sala Constitucional, all surface water and groundwater form part of the public domain (demanio), a designation extending to rivers, their tributaries, streams, springs or water sources, and channels; that private parties must obtain a concession from MINAE to use them; and that, in the case of the ASADAS, a delegation agreement with the Instituto Costarricense de Acueductos y Alcantarillados—hereinafter A y A—is required to manage that public service.

It added that the movable and immovable property used by the ASADAS to administer, operate, maintain, and develop aqueduct systems also forms part of the public domain (Ley 2726, Article 18, and Decreto 32589/2015, Articles 1, subsection 28, 18, and 24, subsection 11). Finally, it asserted that the legal regime governing public-domain property, including its protection, is governed by Administrative Law. It based its position on decisions of this Chamber. By ruling issued at 15 hours 8 minutes on 19 de noviembre de 2015, the Juzgado referred this case file to the Tribunal for such action as it deemed appropriate in view of the objection for lack of subject-matter jurisdiction. The appellate body, in an order issued at 16 hours 7 minutes on 20 de marzo de 2017 corresponding to decision no. 23-C-2016, denied the objection because it found that both the trees at issue and the springs and collection tanks are located within the property registered in the name of the petitioner; and although the area adjoining those tanks and springs is in the public domain, pursuant to section 108 of the Ley de Biodiversidad, subject-matter jurisdiction lies with the agrarian courts (Folios 67 a 69).

II.In the first allegation of the complaint, the plaintiff institution stated that it owns land on which the collection tanks of the Acueducto Rural de Tucurrique are located, within district two, Tucurrique, fourth canton Jiménez, province of Cartago. It added that the property measures 4801 m2, according to cadastral plan (plano catastrado) C-903400-2004, and is bounded to the north by Eduardo Calvo Fajardo, to the south by Eduardo Calvo Fajardo, to the east by a public street, and to the west by Eduardo Calvo Fajardo. It stated that the Association’s water-supply collection tanks are located on the land, together with many trees that pose a risk to the tanks, the houses located there, and the electrical power lines, because the bases of many of those trees have been undermined, creating a risk that they may fall. It therefore requested that the action be granted, that the felling of the specified trees be authorized, and that MINAET, now MINAE, be requested to appear at the property with the judge to determine the condition of the trees and carry out their felling. In summary, the undersigned observes that this case does not seek the nullification of any administrative act, but rather the felling of certain trees in a hazardous condition.

III.This judge concurs with the ruling of the Agrarian Court in the decision recently transcribed in part. The jurisdictional criteria (criterios de competencia) followed since before the enactment of the CPCA, based on the specialized nature of the subject matter and in accordance with the legal system, refer in particular to the case law of the Constitutional Chamber, which guarantees this approach (see, for reference, the decisions issued at 15 hours 6 minutes on 17 de octubre de 2007, which is Voto No. 14999-07, and the decision already cited by the Court, issued at 15 hours on 9 de junio de 2010, which is voto No. 2010009928, both by that adjudicatory body; the latter states, insofar as relevant to this case: “…Obviously, if the claim, by virtue of its substantive content, although related to some administrative conduct or specific manifestation of the administrative function—to the extent that a public entity or body is involved—is governed by the legal regime applicable to labor, family, or agrarian matters, it must be heard and decided by those judicial bodies, since what is being challenged is not, strictly speaking, the substantive conformity or nonconformity of the administrative function or conduct with the administrative legal system, which is what Article 49 of the Constitution reserves for the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa).

This Constitutional Court considers that the determining criteria for distinguishing the scope of jurisdiction of the contentious-administrative jurisdiction from that of other specialized jurisdictions—which must henceforth be taken into consideration by the ordinary courts—shall therefore be the following: 1°) The substantive or material content of the claim, and 2°) the applicable legal regime…” . According to the analysis of the factual framework and the claims in this case, the substantive legal relationship (relación jurídico material) in these proceedings is connected to agro-environmental activity, since the nullity of an administrative act (acto administrativo) is not in dispute such that its conformity or nonconformity with the legal system would have to be analyzed. In this matter, the undersigned member considers that, because the issue concerns whether authorization should be granted to fell certain trees on land suitable for agricultural use (fundo de aptitud agraria), and because the property is of considerable size and is devoted to forestry activities and environmental protection, while its ownership is likewise not in dispute, the proceedings are governed by agrarian and environmental law.

The two prerequisites established as binding by the Constitutional Chamber in the last-cited decision, transcribed in part above, are therefore satisfied, making the agrarian jurisdiction competent by reason of subject matter to hear proceedings of this kind. Moreover, since this case concerns real property registered in the Public Registry in the name of the Asociación Administradora del Acueducto Rural del Distrito de Tucurrique, which appears as the claimant in these possessory injunction proceedings (proceso interdictal), in which the ownership of no property is disputed, the provisions of Article 7, first paragraph, of the Ley de Tierras y Colonización apply. It provides verbatim: “Article 7. Until the State, on its own initiative or at the direction of the Ministerio de Agricultura or the Instituto de Desarrollo Agrario, and for reasons of national interest, determines which lands must remain under its ownership, the following shall be considered inalienable and incapable of acquisition through a land claim filing (denuncio) or possession, except for those held under private ownership with legitimate title . (…)”. This is because it is an association and therefore private in nature.

IV.In addition to the foregoing, consideration should be given to the fact that the litigation began in 2014 and constitutes summary possessory injunction proceedings, in which the entire procedure was conducted before the agrarian court; only the issuance of the first-instance judgment by the specialized agrarian court remains pending. Furthermore, the case file already contains judicial measures, such as site inspections, and relevant administrative reports. Accordingly, I do not concur with the majority of this Chamber’s decision to refer the case at this stage of the proceedings to the Juzgado Contencioso Administrativo y Civil de Hacienda, as doing so would also undermine procedural expediency, immediacy, and concentration. Consequently, the undersigned votes against that referral and, by reason of the subject matter, considers that these proceedings must be remanded to the Agrarian Court of origin, namely the court in Turrialba, for further proceedings within its authority.

POR TANTO

By majority vote, it is declared that jurisdiction to hear the present possessory injunction proceeding (interdicto) lies with the Juzgado Contencioso Administrativo y Civil de Hacienda. Magistrate Escoto Fernández dissents. San José, a las nueve horas veinte minutos del veintidos de junio de dos mil diecisiete .- En interdicto de derribo de ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO RURAL DEL DISTRITO DE TUCURRIQUE, donde también interviene la PROCURADURÍA GENERAL DE LA REPÚBLICA, el Tribunal Agrario de Turrialba, rechazó la excepción de incompetencia por razón de la materia; formulada por la Procuraduría General de la República. Inconforme con lo resuelto, la última planteó disconformidad por lo que se elevó en consulta ante esta Sala.

CONSIDERANDO

I.La Asociación Administradora del Acueducto Rural del Distrito de Tucurrique promueve interdicto de derribo para que en sentencia se declare "1-...con lugar la presente demanda. 2- Que se autorice el derribo de los cincuenta y nueve árboles citados. 3- Que se solicite al MINAE de la zona que se apersone en conjunto con el juez a la propiedad para determinar el estado de los árboles, así como el derribo del mismo. Lo anterior por cuanto se requiere maquinaria especial y posterior a ello se debe de disponer de la manera de conformidad con la Ley Forestal" (F. 33).

II.La Procuraduría General de la República opuso la excepción de incompetencia en razón de la materia. Alegó, el presente asunto debe ser remitido para su conocimiento, al Juzgado Contencioso Administrativo y Civil de Hacienda al que incumbe su tramitación y resolución ya que es de dominio público la faja de terreno circundante a los sitios de captación de agua potable que surtan de agua a una población o convenga reservar para ese fin, que todas las propiedades e instalaciones de los organismos del Estado destinadas a la prestación de servicios relativos a la captación, tratamiento y distribución de aguas potable son patrimonio nacional, por lo que son parte de éste los bienes muebles e inmuebles utilizados por las ASADAS, la corta masiva de árboles que se debe autorizar involucra bienes afectos a dominio público siendo el régimen jurídico de un bien demanial el derecho administrativo. El Juzgado Agrario de Turrialba remitió el expediente al Tribunal Agrario del Segundo Circuito Judicial de San José para conocer de la excepción planteada (F. 62).

El Tribunal Agrario, rechazó la excepción de incompetencia por razón de la materia. Consideró; "...si bien el área aledaña a dichos tanques y nacientes es de dominio público, lo cierto del caso es que, como se explicó el artículo 108 de la Ley de Biodiversidad le asigna la competencia material a la jurisdicción agraria, por lo que debe rechazarse la excepción opuesta…" (F. 69). La Procuraduría General de la República manifestó su inconformidad con lo resuelto por lo que se envió en consulta ante esta Sala.

III.El artículo 108 de la Ley de Biodiversidad establece “ Competencia jurisdiccional En materia de biodiversidad y mientras no exista una jurisdicción ambiental, toda controversia será competencia exclusiva de la jurisdicción contencioso administrativa. Como excepciones de la regla anterior, los delitos contra la biodiversidad serán juzgados por la jurisdicción penal; de igual modo, las controversias que se susciten entre particulares, donde no medie un acto administrativo ni del dominio público, serán competencia de la jurisdicción agraria…”. De lo anterior se colige, son competencia de la jurisdicción agraria los asuntos en materia de biodiversidad cuando;

  • 1)las controversias se susciten entre particulares,
  • 2)no exista de por medio un acto administrativo y
  • 3)no medie el dominio público. Aunado a lo anterior, las regulaciones 13 y 14 de la Ley Forestal no. 7554, estipulan: “13.- El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio. El Ministerio del Ambiente y Energía administrará el patrimonio. Cuando proceda, por medio de la Procuraduría General de la República, inscribirá los terrenos en el Registro Público de la Propiedad como fincas individualizadas de propiedad del Estado. Las organizaciones no gubernamentales que adquieran bienes inmuebles con bosque o de aptitud forestal, con fondos provenientes de donaciones o del erario, que se hayan obtenido a nombre del Estado, deberán traspasarlos a nombre de este”, artículo 14 “ Los terrenos forestales y bosques que constituyen el patrimonio natural del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley”. En el caso de estudio, se desprende de la propiedad en la cual se encuentran los árboles que se solicita derribar son propiedad de la Asociación Administradora del Acueducto Rural del Distrito de Tucurrique, y de conformidad con el artículo 18 de la Ley 2726 Ley Constitutiva Instituto Costarricense Acueductos y Alcantarillados “Todas las propiedades e instalaciones de los organismos del Estado que estén destinadas a la prestación de servicios relativos a la captación, tratamiento y distribución de aguas potables y evacuación de aguas servidas o pluviales en el país, son patrimonio nacional…”. Por lo que en aplicación de la normativa transcrita, al estar involucrado un inmueble afecto al dominio público, la jurisdicción competente para conocer este proceso es la Contencioso Administrativa.

IV.Consecuentemente, de conformidad con el numeral 110 inciso 3) de la Ley Orgánica del Poder Judicial se declara que el conocimiento del interdicto corresponde al Juzgado Contencioso Administrativo y Civil de Hacienda.

V. Voto Salvado de la Magistrada Escoto Fernández

La suscrita Integrante de esta Sala respeta la decisión de los restantes compañeros, pero se separa del criterio de mayoría dispuesto en esta resolución; y salva el voto según se dirá con fundamento en lo siguiente:

I.El escrito inicial de demanda, en este proceso interdictal, fue presentado por la Asociación Administradora del Acueducto Rural del Distrito de Tucurrique, ante el Juzgado Agrario de Turrialba, Cartago, donde se ha venido tramitando su conocimiento. El A quo, tuvo por establecido este Interdicto de Derribo de Árbol; y lo puso en conocimiento de la Procuraduría General de la República –en adelante PGR-, mediante resolución de las 14 horas 7 minutos del 9 de noviembre de 2015. En oficio no. 15-000035-1002-AG, el Juez también ordenó al Jefe de la Oficina Sub Regional de Turrialba, del Ministerio de Ambiente, Energía y Telecomunicaciones –en lo subsecuente MINAET hoy MINAE-, a efecto de que, conforme al canon 474 del Código Procesal Civil, se llevara a cabo el Reconocimiento Judicial, a realizarse en Tucurrique, a las 9 horas del 24 de julio de 2015, por parte del Juez, así como por un Perito Especialista en materia forestal, asignado por el MINAET hoy MINAE.

Según constancia de la visita al lugar donde se localizan los árboles objeto de este proceso, a la hora y fecha indicada en el oficio recién citado, el Juez Agrario de Turrialba, en compañía de los señores Pedro Luna Montoya, administrador del Acueducto Rural del Distrito de Tucurrique y Mario Castro Mora, funcionario del MINAET hoy MINAE, se constató que los árboles poseen una altura superior a los 25 metros, los cuales se localizan cerca de casas de habitación y de los tanques de captación de agua potable que abastece a las comunidades de Tucurrique. La PGR se apersonó al proceso, manifestando su oposición a la tala de los árboles en cuestión. Además, interpuso la excepción de incompetencia en razón de la materia, para lo cual argumentó, la franja de terreno circundante a los sitios de captación o tomas surtidoras de agua potable, es de dominio pública, además, acorde al numeral 4 de la Ley Orgánica del Ambiente, canon 50 y jurisprudencia de la Sala Constitucional, todas las aguas superficiales y subterráneas son parte del demanio, afectación que alcanza a los ríos, sus afluentes, arroyos, manantiales o nacientes y causes, para cuyo aprovechamiento, los particulares deben contar con concesión del MINAE, y, que, en el caso de las ASADAS requiere convenio de delegación del Instituto Costarricense de Acueductos y Alcantarillados (en adelante A y A), para la gestión de ese servicio público.

Adicionó, son parte del dominio, los bienes muebles e inmuebles utilizados por las ASADAS en la administración, operación, mantenimiento y desarrollo de los sistemas de acueductos (Ley 2726, artículo 18), y Decreto 32589/2015 artículos 1, inciso 28, numerales 18 y 24 inciso 11). Finalmente, afirmó, el régimen jurídico de un bien demanial, incluida su tutela, se rige por el Derecho Administrativo. Fundamentó su postura en fallos de esta Sala. Mediante resolución de las 15 horas 8 minutos del 19 de noviembre de 2015, el Juzgado, remitió este expediente al Tribunal, para lo que a bien tenga, dada la excepción de incompetencia por razón de la materia incoada. El Órgano de alzada, en auto de las 16 horas 7 minutos del 20 de marzo de 2017 que responde al voto no. 23-C-2016, rechazó la defensa interpuesta porque consideró, tanto los árboles objeto de pretensión como las nacientes y los tanques de captación, se encuentran dentro de la finca inscrita a nombre del promovente, y si bien el área aledaña a dichos tanques y nacientes es de dominio público, acorde al numeral 108 de la Ley de Biodiversidad, la competencia material corresponde a la jurisdicción agraria (Folios 67 a 69).

II.En el hecho primero de la demanda, la Institución actora dijo ser la dueña de un terreno donde se encuentran los tanques de acopio del Acueducto Rural de Tucurrique, ubicado dentro del distrito dos, Tucurrique, del cantón cuarto Jiménez, de la provincia de Cartago. Añadió, la propiedad mide 4801 m2, según plano catastrado C-903400-2004, linda al norte con Eduardo Calvo Fajardo, al sur con Eduardo Calvo Fajardo, al este con calle pública y al oeste con Eduardo Calvo Fajardo. Señaló, en el terreno se encuentran tanques de captación de abastecimiento de la Asociación, además de muchos árboles que presentan un riesgo para los tanques, las casas que se localizan en ese lugar y los cables de tendido eléctrico, ya que muchos de estos están socavados en sus bases, con el riesgo de caer. Por lo anterior, solicitó, se declare con lugar la demanda, se autorice el derribo de los árboles indicados; y se solicite al MINAET hoy MINAE apersonarse a la propiedad con el juez, para determinar el estado de los árboles, así como su derribo. En síntesis, la suscrita observa, en este caso no se pide la nulidad de algún acto administrativo, sino el derribo de determinados árboles, en estado de peligrosidad.

III.Esta juzgadora comparte lo dispuesto por el Tribunal Agrario en el voto de reciente trascripción parcial. Los criterios de competencia que se han seguido desde antes de la promulgación del CPCA con base en la especialidad de la materia, acorde al ordenamiento jurídico, remitiéndose en especial a la jurisprudencia de la Sala Constitucional que así lo garantiza (véanse de referencia las resoluciones de las 15 horas 6 minutos del 17 de octubre de 2007 que es Voto No. 14999-07 así como el ya citado por el Tribunal, de las 15 horas del 9 de junio de 2010, que es voto No. 2010009928 ambas de ese órgano decisor, donde en esta última se extrae en lo de interés al caso: “…Obviamente, si la pretensión, por su contenido material, aunque esté relacionada con alguna conducta administrativa o manifestación específica de la función administrativa –en la medida en que interviene un ente u órgano público-, se encuentra regida por el régimen jurídico laboral, de familia o agrario, debe ser conocida y resuelta por esos órganos jurisdiccionales, por cuanto, no se cuestiona, propiamente, conformidad o disconformidad sustancial de la función o conducta administrativa con el ordenamiento jurídico-administrativo que es lo que el artículo 49 constitucional le reserva a la jurisdicción contencioso-administrativa.

Este Tribunal Constitucional, estima que los criterios determinantes para deslindar el ámbito competencial de la jurisdicción contencioso-administrativa de otros ordenes jurisdiccionales especializados –que, en adelante, deben tenerse en consideración por la jurisdicción ordinaria- serán, entonces, los siguientes: 1°) El contenido material o sustancial de la pretensión y 2°) el régimen jurídico aplicable…” . De acuerdo al análisis del cuadro fáctico y pretensiones en este caso y la relación jurídico material de este proceso están vinculadas a la actividad agroambiental, pues no se discute la nulidad de un acto administrativo, como para entrar a analizar su conformidad o disconformidad con el ordenamiento jurídico. En este asunto, considera la suscrita integrante, al versar la cuestión sobre la autorización para el derribo o no de unos árboles dentro de un fundo de aptitud agraria, al tratarse de una finca con una extensión considerable y dedicado a actividades silviculturales y de tutela al ambiente, donde tampoco se discute su titularidad, el proceso se rige por la normativa agraria y ambiental, dándose los dos presupuestos establecidos en forma vinculante por la Sala Constitucional en el voto de última cita y su transcripción en parte, para que la jurisdicción agraria sea la competente en razón de la materia del conocimiento de este tipo de procesos.

Aunado a lo anterior, al tratarse en este caso de un bien inmueble inscrito en el Registro Público a nombre de la Asociación Administradora del Acueducto Rural del Distrito de Tucurrique, quien figura como parte accionante en este proceso interdictal donde no se discute la titularidad de bien alguno; rige lo previsto en el ordinal 7 párrafo primero de la Ley de Tierras y Colonización, el cual a la letra establece: “ Artículo 7. Mientras el Estado, por voluntad propia o por indicación del Ministerio de Agricultura o del Instituto de Desarrollo Agrario, atendiendo razones de conveniencia nacional, no determine los terrenos que deben mantenerse bajo su dominio, se considerarán inalienables y no susceptibles de adquirirse por denuncio o posesión, salvo lo que estuvieren bajo el dominio privado, con título legítimo los siguientes . (…)”. Ello por cuanto se trata de una asociación y por ende de naturaleza privada.

IV.Además de lo anterior, tómese en consideración, el litigio se inició desde el año 2014, que es un proceso interdictal considerado sumario, donde se dio todo el procedimiento en sede agraria; faltando sólo el dictado de la sentencia de primera instancia en la sede especializada agraria; además en el expediente existen ya actos judiciales como visitas al lugar e informes administrativos al respecto. De ahí que no se comparta lo dispuesto por la mayoría de esta Sala de remitir a esta altura procesal los autos al Juzgado Contencioso Administrativo y Civil de Hacienda, lo cual atentaría también con la celeridad, inmediatez y concentración procesales. En consecuencia, la suscrita vota en contra de esa remisión, y en razón de la materia, concibe que este proceso ha de remitirse al Juzgado Agrario de origen, sea al de Turrialba para lo de su cargo.

POR TANTO

Por mayoría, se declara que el conocimiento del presente interdicto corresponde al Juzgado Contencioso Administrativo y Civil de Hacienda. Salva el voto la Magistrada Escoto Fernández.
