San José, at nine hours zero minutes on the thirteenth of October, two thousand sixteen.- In the ordinary proceeding brought by BELÉN TERESITA ORTÍZ APARICIO against SUCESORES DE MALAQUÍAS JIMÉNEZ S.A., VÍCTOR MANUEL DÍAZ ANGULO, known as ROLANDO DÍAZ ANGULO, HUGO MARTÍN COTO DÍAZ, PODOCARPUS SOCIEDAD ANÓNIMA, CARLOS DÍAZ ANGULO, DENIA GERARDINA SEGURA ANGULO, IGNACIO DÍAZ ANGULO, and the STATE, the Agrarian Court of the Second Judicial Circuit of San José recused itself sua sponte for lack of subject-matter jurisdiction (competencia material) and referred the matter to the Agrarian Tribunal, which in turn rejected the recusal. Disagreeing with that decision, the State appealed, and the matter was therefore submitted to this Chamber for consultation.
WHEREAS
“A.- That the undersigned is the lawful owner of all the land referred to in cadastral survey map (plano catastrado) number SJ-647820-200, and therefore the defendant must restore the land that overlaps with its map 1-973516-2005 and that it seeks to annex through the cadastral, boundary, and access maneuvers it has carried out. B.- That there is a right-of-way easement (servidumbre de paso) for travel on foot or by an animal-, motor-, or human-powered vehicle, three meters wide, along the southern boundary, running south-southeast for a length of 905 meters, in favor of property number TWO HUNDRED THREE THOUSAND EIGHTY-ONE in the San José Registry District and encumbering the defendant’s property, registration number TWENTY-FOUR THOUSAND SEVEN HUNDRED FORTY-FIVE in the San José Registry District, and that the Registry be ordered to record it. C.- That the defendant be ordered to pay the costs arising from the boundary modifications necessary to restore matters to their prior condition, including restoring the damaged spring (naciente). D.- That cadastral survey map 1-973516-2005 be declared null and void and, consequently, that the National Cadastre be ordered to deregister it. E.- That, in the event of opposition, the defendant be ordered to pay costs” (F. 29 and 30, digital case file).
The complaint was expanded against Víctor Manuel Díaz Angulo, Hugo Martín Coto Díaz, Podocarpus S.A., and, as adjoining landowners, the State, Carlos Díaz Angulo, Denia Gerardina Segura Angulo, and Ignacio Díaz Angulo, seeking a judgment declaring:
“1.- That there is a right-of-way easement for travel on foot or by an animal-, motor-, or human-powered vehicle, three meters wide, along the southern boundary, running south-southeast for a length of 905 meters, in favor of property number TWO HUNDRED THREE THOUSAND EIGHTY-ONE in the San José Registry District and encumbering the defendant’s property, registration number TWENTY-FOUR THOUSAND SEVEN HUNDRED FORTY-FIVE in the San José Registry District, and that the Registry be ordered to record it. 2.- That, in the alternative, the existence of a right-of-way easement for travel on foot or by an animal-, motor-, or human-powered vehicle, three meters wide, be declared in favor of my principal’s property, number TWO HUNDRED THREE THOUSAND EIGHTY-ONE in the San José Registry District, and encumbering the properties identified below, with the plaintiff authorized to perform the work necessary to provide access to the public road through those properties, such as laying out a road, stabilizing the land, clearing the land, and removing all gates and other obstacles that impede the plaintiff’s passage.
That easement would encumber any of the properties described below, as indicated: A.- The property owned by the defendant VICTOR MANUEL DÍAZ ANGULO, known as ROLANDO DÍAZ ANGULO, whose identifying particulars have been stated, which is property recorded under real-property folio number FIVE HUNDRED EIGHT THOUSAND TWO HUNDRED SIX-ZERO ZERO ZERO in the San José Registry District, cadastral survey map SJ-0221703-1994. This easement would continue across the properties owned by the defendant IGNACIO DÍAZ ANGULO, whose identifying particulars have been stated, consisting of unregistered property; the route of this easement would also cross the property of the defendants DENIA GERARDINA SEGURA ANGULO and CARLOS DÍAZ ANGULO, whose identifying particulars have been stated, which is property recorded under real-property folio number 413735, subregistrations 001 and 002, in the San José Registry District.
That easement would be located along the northern boundary of my principal’s property, running north-northwest for a distance of approximately Three thousand five hundred meters. B.- The property owned by the defendant HUGO MARTÍN COTO DÍAZ, whose identifying particulars have been stated, which is property recorded under real-property folio number SIX HUNDRED TWENTY-SIX THOUSAND SIXTY-TWO-ZERO ZERO ZERO in the San José Registry District, cadastral survey map SJ-0745118-1988. This easement would continue across the properties owned by the defendant VÍCTOR MANUEL DÍAZ ANGULO, known as ROLANDO DÍAZ ANGULO, whose identifying particulars have been stated, which is property recorded under real-property folio number FIVE HUNDRED EIGHT THOUSAND TWO HUNDRED SIX-ZERO ZERO ZERO in the San José Registry District, cadastral survey map SJ-0221703-1994. This easement continues across the property [sic] of the defendant IGNACIO DÍAZ ANGULO, whose identifying particulars have been stated, consisting of unregistered property; the route of this easement would also cross the property of the defendants DENIA GERARDINA SEGURA ANGULO and CARLOS DÍAZ ANGULO, whose identifying particulars have been stated, which is property recorded under real-property folio number 413735, subregistrations 001 and 002, in the San José Registry District.
That easement would be located along the western boundary of my principal’s property, running [sic] north-northwest for a distance of approximately Five thousand meters. C.- The property owned by the defendant [sic] PODOCARPUS S.A., consisting of a possessory right (derecho de posesión) over unregistered property without a cadastral survey map. That easement would be located along the eastern boundary of my principal’s property, running north-northeast for a distance of approximately Seven [sic] thousand five hundred meters. D.- The property owned by the State, consisting of land that is unregistered and has no cadastral survey map. That easement would be located along the south-southwest [sic] boundary of my principal’s property, running south-southwest for a distance of approximately seven thousand meters. 3.- That, in the event of opposition, the defendants be ordered to pay costs and that, in any event, given the circumstances under which this expansion of the defendant [sic] is made, my principal be exempted from paying the costs of any defendants against whom judgment is not entered” (F. 1951 of the virtual case file).
II.The State requested sua sponte review of the agrarian jurisdiction’s subject-matter jurisdiction, arguing that the purpose of the proceeding is to obtain a declaration of a right-of-way easement over public-domain land (terrenos demaniales) forming part of the State’s natural heritage (patrimonio natural del Estado) (F. 2056 to 2057 of the virtual case file). The Agrarian Court of the Second Judicial Circuit of San José recused itself sua sponte for lack of subject-matter jurisdiction and referred the matter to the Agrarian Tribunal (F. 2167 of the virtual case file). The Agrarian Tribunal rejected the Court’s recusal because it considered it to be an objection for lack of jurisdiction (excepción de incompetencia) filed out of time (F. 2192-2194 of the virtual case file). The State appealed the decision and clarified that what it had requested was an application asking the judge to review subject-matter jurisdiction sua sponte for the reasons stated in its answer to the complaint (F. 2204-2210 of the virtual case file). Accordingly, the Agrarian Tribunal submitted the matter to this Chamber for consultation.
“The State’s natural heritage shall consist of the forests and forest lands (terrenos forestales) within national reserves, areas declared inalienable, properties registered in its name, and properties belonging to municipalities, autonomous institutions, and other Public Administration bodies, except for real property securing credit transactions with the National Banking System that becomes part of their assets. The Ministry of Environment and Energy shall administer that heritage. When appropriate, through the Office of the Attorney General of the Republic, it shall register the land in the Public Registry of Property as individually identified properties owned by the State. Nongovernmental organizations that acquire real property containing forest or suitable for forestry, using funds from donations or the public treasury obtained in the name of the State, must transfer it into the State’s name.” Article 14 of that same Law, in turn, states:
“The forest lands and forests constituting the State’s natural heritage, as detailed in the preceding article, shall be immune from attachment and inalienable; possession thereof by private parties shall create no right in their favor, and the State’s action to recover ownership (acción reivindicatoria) of such land shall not be subject to any limitation period. Consequently, such land may not be registered in the Public Registry through possessory information proceedings (información posesoria), and both its invasion and occupation shall be punished in accordance with this law.” Article 108 of the Biodiversity Law, in turn, establishes that, for as long as no specialized environmental courts exist, all matters involving private parties shall fall within the Agrarian Jurisdiction, while those involving the State shall be reserved for the Contentious-Administrative Jurisdiction. Specifically, it provides:
“In matters concerning biodiversity, and for as long as no environmental jurisdiction exists, every dispute shall fall within the exclusive jurisdiction of the contentious-administrative courts. As exceptions to the preceding rule, offenses against biodiversity shall be adjudicated by the criminal courts; likewise, disputes arising between private parties that involve neither an administrative act nor the public domain shall fall within the jurisdiction of the agrarian courts.” It follows from the foregoing that, because the specialized environmental jurisdiction has not yet been created, disputes arising in this area fall, as a general rule, within the jurisdiction of the contentious-administrative courts and cannot be deemed to fall exceptionally within the agrarian jurisdiction because the case concerns property forming part of the public domain (dominio público). Accordingly, this Chamber agrees with the Office of the Attorney General of the Republic that subject-matter jurisdiction over this proceeding belongs to the Contentious-Administrative Jurisdiction, which is consistent with the subject-matter jurisdiction established in Articles 1 and 2 of the Contentious-Administrative Procedure Code.
Both laws—the Biodiversity Law and the Contentious-Administrative Procedure Code—postdate the Agrarian Jurisdiction Law, Articles 1 and 2 of which establish the subject-matter jurisdiction of the agrarian courts, in relation to Article 22.
IV.In the case under review, the plaintiff seeks a judgment declaring it the owner of the entire parcel of land referred to in registered cadastral plan number SJ-647820-200 and declaring that a pedestrian right-of-way easement (servidumbre de paso a pie) exists between defendants’ properties nos. 508206-000, 413735-001 and 002, 626072-000, 508206-000, 413735-001 and 002, as well as across unregistered land “owned by the State.” According to official letter ACOPAC – OT – 118 -2013, issued by the Sistema Nacional de Áreas de Conservación of the Ministerio de Ambiente y Energía and appearing at folio 2072 of the electronic case file, the following conclusion was reached regarding those lands: “…It is concluded with respect (sic) to possible access to the land described in registered Cadastral plan SJ-647820-2000 that: a- One segment lies on part of the land described in registered cadastral plan SJ-973516-2005, belonging to Sucesores Malaquias Jiménez Sociedad Anónima.
B- It would affect an area of land described in Instituto Geográfico Nacional Map Sheet Vueltas N° xxxx, scale 1:50.000, as ‘Sabana y Paramo Vueltas,’ which are highly fragile ecosystems protected within the boundaries of Reserva Biológica Cerro Vueltas and are also located more than three Meters Above Sea Level. c- Part of it would lie within an area of the two thousand meters of Parque Nacional Los Robledales, created by Ley de Tierras y Colonización N° 2825 del 14 de octubre de 1961, art. 7 subsection a. d- One portion would pass through Parque Nacional Los Quetzales in an oak-forest area adjacent to the Carretera Interamericana….” In addition, the information contained in plans SJ-647820-2000—electronic folio 2067—and 1-973516-2005 (F. 2060 to 2073 of the electronic case file) establishes that they belong to Reserva Forestal Los Santos and are subject to the restrictions imposed by Ley Forestal.
Under these circumstances, the properties at issue in this case are part of the public domain (dominio público); therefore, jurisdiction over the plaintiff’s claims lies with the Administrative Litigation Jurisdiction (jurisdicción Contenciosa Administrativa) (art. 108 Ley de Biodiversidad), which extends to any matter in which the State has a direct interest.
V.Consequently, jurisdiction over these proceedings is declared to lie with the Tribunal Procesal Contencioso Administrativo y Civil de Hacienda. Based on the principle of preservation of procedural acts (principio de conservación de los actos procesales), the procedural actions and rulings, as well as the evidence received, shall remain valid, and the proceedings shall be brought into conformity with the Código Procesal Contencioso Administrativo only to the extent strictly necessary to ensure procedural economy, promptness, and effective judicial protection.
I.With due respect for the decision of the other members, the undersigned judge disagrees with the conclusions reached by the majority ruling, specifically in recital (considerando) III, where it determines that jurisdiction over these proceedings lies with the Administrative Litigation Jurisdiction. For that reason, she departs from that position and dissents on the basis of the following considerations.
II.As may be inferred from the record to date, the present conflict arose because the State’s representative asserted the defense of lack of jurisdiction (excepción de falta de competencia), claiming that the Administrative Litigation Jurisdiction has jurisdiction over matters involving the public domain.
III.Pursuant to sections 16 subsection b) and 41 second paragraph, in relation to section 40 first paragraph, of the Ley de la Jurisdicción Agraria, in proceedings of this nature that defense must be asserted within three days from the time the parties are served with the ruling admitting and transferring the complaint, or, as applicable, within the period granted by the court, namely six to 15 days. In this matter, the State was served on 15 de noviembre de 2013; nevertheless, it did not assert that defense until 5 de diciembre of that year, which shows that the defense was untimely. Moreover, because these proceedings concern an overlap of plans (superposición de planos), in which the parties have essentially invoked possession (posesión) and agricultural suitability (aptitud agraria), and because this is a dispute concerning their status as farmers and co-owners, it is undeniable that the matter involves elements characteristic of a dispute before the Agrarian Jurisdiction (jurisdicción agraria).
Accordingly, in case of doubt, the proceedings must remain within that jurisdiction. This follows from the principle of continuity of acts in agrarian proceedings (principio de continuidad de los actos en sede agraria) and the perpetuation of that jurisdiction (perpetuidad de dicha competencia). The fact that the State asserted from the outset that the Administrative Litigation Jurisdiction has jurisdiction over matters involving the public domain does not undermine the conclusion that the dispute must be resolved through the specialized agrarian process. This is because this member considers that other parameters exist for determining whether a matter must be heard by the Agrarian Jurisdiction, such as the suitability of the property, the nature of the possession exercised over it, and the nature of the persons involved. Technical concepts such as agricultural suitability, among others, are relevant in determining jurisdiction over the matter, together with the provisions of the legal system currently in force, so as to guarantee genuine access to justice within the Agrarian Jurisdiction and allow the specialized agrarian court to determine whether the social function assigned to properties of this nature has been fulfilled, based on sections 45, 50 and 69 of the Constitución Política and on how the case law has defined the suitability of agricultural holdings (aptitud de los fundos). It must further be noted that the defense under review was asserted out of time; therefore, the Tribunal was correct in finding that jurisdiction over this matter lies with that specialized court.
IV.In prior years, this adjudicative body, then differently constituted, held the following regarding subject-matter jurisdiction in agrarian cases (competencia agraria por la materia): “…III.-Agrarian jurisdiction, based on subject matter, is defined generally by articles 1 and 2 subsection h) of the Ley de Jurisdicción Agraria. Section 2 subsection h) of the cited statute expressly provides: ‘The agrarian courts shall have jurisdiction over: All matters relating to acts and contracts to which an agricultural entrepreneur is a party and that arise from activities involving the production, processing, industrialization, and disposal of agricultural products.’ The fundamental criterion is the agricultural production activity, whether involving animal husbandry or the cultivation of plants (commercial or subsistence activities), as well as related activities and sustainable agro-environmental activities (actividades agroambientales sostenibles).
Supplementary criteria have also been established, including the objective criterion concerning the property: in this case, the nature or suitability of the productive property and its size. This criterion is closely linked to agricultural holdings, which legislation incorrectly calls rural properties (predios rústicos), that are devoted or suitable for devotion to productive agricultural activities or to forest conservation and the sustainable management of agro-environmental activities. Of relevance to this matter is also the subjective criterion: that concerning the persons participating in agrarian proceedings as plaintiffs or defendants. Those persons likewise acquire the status of agrarian persons (sujetos agrarios) because they engage in productive agricultural activities…Domestic case law has repeatedly held that agrarian jurisdiction exists in the circumstances described above… (Emphasis not in the original).

V.Accordingly, because this matter falls within sections 1, 2, subsection h), and 4 of the Ley de la Jurisdicción Agraria, and because the defense of lack of jurisdiction was asserted out of time, jurisdiction over these proceedings lies with the Agrarian Jurisdiction, whose jurisdiction cannot be extended (improrrogable) by statutory mandate, pursuant to sections 16 and 4o of the cited statute. Consistent with that conclusion, the reasoning of the agrarian judges is adopted; consequently, the ruling of the Tribunal Agrario del Segundo Circuito Judicial de San José must be affirmed because the matter falls within the field of agrarian law and, therefore, within the jurisdiction of the Juzgado Agrario del II Circuito Judicial de San José, to which the case file should be forwarded.

Jurisdiction over these proceedings is declared to lie with the Tribunal Procesal Contencioso Administrativo y Civil de Hacienda. The procedural rulings and actions, as well as the evidence received, shall remain valid, and the proceedings shall be brought into conformity with the Código Procesal Contencioso Administrativo only to the extent strictly necessary. San José, a las nueve horas cero minutos del trece de octubre de dos mil dieciseis .- En proceso ordinario de BELÉN TERESITA ORTÍZ APARICIO contra SUCESORES DE MALAQUÍAS JIMÉNEZ S.A., VÍCTOR MANUEL DÍAZ ANGULO, conocido como ROLANDO DÍAZ ANGULO, HUGO MARTÍN COTO DÍAZ, PODOCARPUS SOCIEDAD ANÓNIMA, CARLOS DÍAZ ANGULO, DENIA GERARDINA SEGURA ANGULO, IGNACIO DÍAZ ANGULO y el ESTADO, el Juzgado Agrario del Segundo Circuito Judicial de San José, se inhibió de oficio por razón de la materia para conocer del asunto y lo remitió al Tribunal Agrario, el que a su vez improbó la inhibitoria. Inconforme, el Estado apeló por lo que se envió el asunto en consulta ante esta Sala.
CONSIDERANDO
I.La parte actora presenta proceso ordinario para que en sentencia se declare “ A.- Que la suscrita es la legitima (sic) dueña de los terrenos a que se refiere íntegramente el plano catastrado número SJ-647820-200, por lo que la demandada debe reintegrar los terrenos que se traslapan con su plano 1-973516-2005, y que pretende anexarse vía las maniobras catastrales, de linderos y de accesibilidad que ha llevado a cabo B.- Que existe servidumbre de paso a pie, o con vehículo de tracción animal, automotriz, o humana, con un ancho de tres metros, en el lindero sur, con rumbo sur-sureste, y con una longitud de 905 metros, a favor de la finca del Partido de San José número DOSCIENTOS TRES MIL OCHENTA Y UNO y en contra del inmueble de la demandada finca del Partido de San José matrícula VEINTICUATRO MIL SETECIENTOS CUARENTA Y CINCO, y se ordene al Registro su inscripción. C.- Que se condene a la demandada a cubrir el costo que generen las modificaciones de linderos, para dejar las cosas a su estado anterior, incluyendo restablecer la naciente de agua dañada.
D.- Que se declare la nulidad del plano catastrado 1-973516-2005, y por lo tanto se ordene al Catastro Nacional su desinscripción. E.- Que en caso de oposición se condene en costas a la demandada” (F. 29 y 30 expediente digital). Se amplía la demanda contra Víctor Manuel Díaz Angulo, Hugo Martín Coto Díaz, Podocarpus S.A. y como colindantes; el Estado, Carlos Díaz Angulo, Denia Gerardina Segura Angulo e Ignacio Díaz Angulo, para que en sentencia se declare: “ 1.- Que existe servidumbre de paso a pie, o con vehículo de tracción animal, automotriz, o humana, con un ancho de tres metros, en el lindero sur, con rumbo sur-sureste, y con una longitud de 905 metros, a favor de la finca del Partido de San José número DOSCIENTOS TRES MIL OCHENTA Y UNO y en contra del inmueble de la demandada finca del Partido de San José matrícula VEINTICUATRO MIL SETECIENTOS CUARENTA Y CINCO, y se ordene al Registro su inscripción. 2.- Que subsidiariamente se declare la existencia de servidumbre de paso a pie, o con vehículo de tracción animal, automotriz o humana, con un ancho de tres metros, a favor de la finca de mi mandante finca del Partido de San José número DOSCIENTOS TRES MIL OCHENTA Y UNO y en contra de las fincas que se dirán, quedando autorizada la actora para realizar las obras necesarias para implementar la salida a la calle pública por tales inmuebles tales como trazado de camino, estabilización de terreno, limpieza de terreno, y eliminando toda clase de portones y otros obstáculos que impidan el paso a la actora.
Dicha servidumbre sería contra cualquiera de los inmuebles que se describen a continuación, y con la descripción que indica: A.- El inmueble propiedad del demandado VICTOR MANUEL DÍAZ ANGULO conocido como ROLANDO DÍAZ ANGULO de calidades dichas, que es finca del Partido de San José matrícula de folio real número QUINIENTOS OCHO MIL DOSCIENTOS SEIS-CERO CERO CERO, plano catastrado SJ-0221703-1994. Esta servidumbre continuaría a través de las fincas propiedad del demandado IGNACIO DÍAZ ANGULO, de calidades dichas, que es finca sin inscribir, y también discurriría el trazado de esta servidumbre por la finca de los demandados DENIA GERARDINA SEGURA ANGULO y CARLOS DÍAZ ANGULO, de calidades dichas, que es finca del Partido de San José matrícula de folio real número 413735 submatricula 001 y 002. Dicha servidumbre se ubicaría en el lindero norte de la propiedad de mi mandante, con rumbo nor-noroeste, con una distancia de alrededor de Tres mil quinientos metros.
B.- El inmueble propiedad del demandado HUGO MARTÍN COTO DÍAZ, de calidades indicadas, que es finca del Partido de San José matrícula de folio real número SEICIENTOS VEINTISÉIS MIL SESENTA Y DOS-CERO CERO CERO, plano catastrado SJ-0745118-1988. Esta servidumbre continuaría a través de las fincas propiedad del demandado VÍCTOR MANUEL DÍAZ ANGULO conocido como ROLANDO DÍAZ ANGULO, de calidades dichas, que es finca del Partido de San José matrícula de folio real número QUINIENTOS OCHO MIL DOSCIENTOS SEIS-CERO CERO CERO, plano catastrado SJ-0221703-1994. Sigue esta servidumbre por las propiedad (sic) del demandado IGNACIO DÍAZ ANGULO, de calidades dichas, que es finca sin inscribir; y también discurriría el trazado de esta servidumbre por la finca de los demandados DENIA GERARDINA SEGURA ANGULO y CARLOS DÍAZ ANGULO, de calidades dichas, que es finca del Partido de San José, matrícula de folio real número 413735 submatricula 001 y 002.
Dicha servidumbre se ubicaría en el lindero oeste de la propiedad de mi mandante, con nombo (sic) nor-noroeste, con una distancia alrededor de Cinco mil metros. C.- El inmueble propiedad del demandada (sic) PODOCARPUS S.A., que es derecho de posesión sobre finca sin inscribir y sin plano catastrado. Dicha servidumbre se ubicaría en el lindero este de la propiedad de la propiedad de mi mandante, con rumbo nor-noreste, con una distancia de alrededor de Siete (sic) mil quinientos metros. D.- El inmueble propiedad del Estado, es un terreno no inscrito y sin plano catastrado. Dicha servidumbre se ubicaría en el lindero sur-suoeste (sic) de la propiedad de mi mandante, con rumbo sur-suroeste, con una distancia de alrededor de siete mil metros. 3.- Que en caso de oposición se condene en costas a los demandados, y que en todo caso, dada la circunstancias en las que se da la presente ampliación de demandada (sic) , para los demandados que no resulten condenados, se exima a mi mandante del pago de costas” (F. 1951 del expediente virtual).
II.El Estado, solicitó la revisión oficiosa de la competencia material de la jurisdicción agraria, bajo el argumento de que el proceso tiene por objeto la declaratoria de una servidumbre de paso sobre terrenos demaniales integrantes del patrimonio natural del Estado (F. 2056 a 2057 del expediente virtual). El Juzgado Agrario del Segundo Circuito Judicial de San José, de oficio, se inhibió por razón de la materia, y remitió el asunto al Tribunal Agrario (F. 2167 del expediente virtual). El Tribunal Agrario, improbó la inhibitoria del Juzgado, por considerar que se trataba de una excepción de incompetencia, presentada de forma extemporánea (F. 2192-2194 del expediente virtual). El Estado apeló de lo resuelto y aclara, lo pedido fue una gestión para que el juez de oficio revisara su competencia por razón de la materia, por las razones que dio en el escrito de contestación de la demanda (F. 2204-2210 del consulta ante esta Sala.
III.El artículo 13 de la Ley Forestal N° 7575 dispone: “El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio. El Ministerio de Ambiente y Energía administrará el patrimonio. Cuando proceda, por medio de la Procuraduría General de la República, inscribirá los terrenos en el Registro Público de la Propiedad como fincas individualizadas de propiedad del Estado. Las organizaciones no gubernamentales que adquieran bienes inmuebles con bosque o de aptitud forestal, con fondos provenientes de donaciones o del erario, que se hayan obtenido a nombre del Estado, deberán traspasarlos a nombre de éste”.
Por su parte, el numeral 14 de esa misma Ley señala: “ Los terrenos forestales y bosques que constituyen el patrimonio natural del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley.” Por su parte, el artículo 108 de la Ley de Biodiversidad establece que, mientras no existan tribunales ambientales especializados, corresponderá a la Jurisdicción Agraria todos los asuntos vinculados con particulares, reservando a la Jurisdicción Contenciosa Administrativa, aquellos en los cuales esté involucrado el Estado. Concretamente, dispone: “En materia de biodiversidad y mientras no exista una jurisdicción ambiental, toda controversia será competencia exclusiva de la jurisdicción contenciosa administrativa.
Como excepciones de la regla anterior, los delitos contra la biodiversidad serán juzgados por la jurisdicción penal; de igual modo, las controversias que se susciten entre particulares, donde no medie un acto administrativo ni del dominio público, serán competencia de la jurisdicción agraria.” De lo anterior se deduce, como no se ha creado aún la jurisdicción ambiental especializada, las controversias que se susciten, por regla general, son competencia de la jurisdicción contenciosa administrativa, sin que se pueda estimar que es propia de la jurisdicción agraria a manera de excepción, debido a que se está en presencia de bienes que forman parte del dominio público. Por ende, comparte esta Sala el criterio de la Procuraduría General de la República acerca de que la competencia material de este proceso corresponde a la jurisdicción contenciosa administrativa, lo cual es acorde con la competencia material establecida en los artículos 1 y 2 del Código Procesal Contencioso Administrativo.
Ambas leyes, la de Biodiversidad y el Código Procesal Contencioso Administrativo, son posteriores a la Ley de Jurisdicción Agraria que en sus artículos 1 y 2 establecen la competencia material de los tribunales agrarios, en relación con numeral 22.
IV.El caso de estudio, la parte actora pretende se declare en sentencia como dueña del terreno a que se refiere íntegramente el plano catastrado número SJ-647820-200 y que existe servidumbre de paso a pie entre las propiedades de los demandados no. 508206-000, 413735-001 y 002, 626072-000, 508206-000, 413735-001 y 002, además por terrenos sin inscribir “ propiedad del Estado”. Dichos terrenos -según se concluye en oficio del ACOPAC – OT – 118 -2013 emitido por el Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, que corre a folio 2072 del expediente virtual- señala; “ …Se concluye el relación (sic) al posible acceso al terreno que describe el plano Catastrado SJ-647820-2000 que: a- Un segmento se ubica sobre una parte del terreno descrito en el plano catastrado SJ-973516-2005 perteneciente a Sucesores Malaquias Jiménez Sociedad Anónima. B- Afectaría un área de terreno descrito en la Hoja Cartográfica Vueltas N° xxxx del Instituto Geográfico Nacional escala 1:50.000, como “Sabana y Paramo Vueltas” los cuales son ecosistemas muy frajiles protejidos dentro del límite de la Reserva Biológica Cerro Vueltas, además se ubican por encima de los tres Metros Sobre el Nivel del Mar. c- En parte se ubicaría en un área de los dos mil metros de Parque Nacional Los Robledales creada mediante la Ley de Tierras y Colonización N° 2825 del 14 de octubre de 1961, art. 7 inciso a. d- Una porción pasaría por el Parque Nacional Los Quetzales en un área de robledales contiguo a la Carretera Interamericana...”.
Aunado a lo anterior, de la información que consta en los planos SJ-647820-2000 –folio virtual 2067- y 1-973516-2005 (F. 2060 a 2073 virtual), se verifica que pertenecen a la Reserva Forestal Los Santos, limitadas por la Ley Forestal. Ante esta coyuntura, los inmuebles objeto de este asunto corresponden a un área de dominio público, por lo que es la jurisdicción Contenciosa Administrativa (art. 108 Ley de Biodiversidad), extensiva a cualquier asunto en los que el Estado tenga interés directo, a la que corresponde conocer de las pretensiones de la parte actora.
V.Consecuentemente, se declara que el conocimiento del presente proceso corresponde al Tribunal Procesal Contencioso Administrativo y Civil de Hacienda. Con base en el principio de conservación de los actos procesales, mantienen su vigencia las actuaciones y resoluciones procesales, así como la prueba recibida, debiendo adecuarse al Código Procesal Contencioso Administrativo en lo estrictamente necesario, para garantizar la economía, celeridad y tutela judicial efectiva del proceso.
I.Con el respeto debido a la decisión de los demás Integrantes, la suscrita juzgadora disiente de las conclusiones a que arriba el fallo de mayoría, propiamente en el considerando identificado como III donde define la competencia de este proceso en sede contencioso administrativa, razón por la cual se separa de ese criterio y salva el voto con fundamento en las siguientes estimaciones.
II .- El conflicto que se presenta, según se colige a la fecha de los autos, en virtud de haber presentado la representación estatal, la excepción de falta de competencia, porque afirma, la Jurisdicción Contencioso Administrativa es la competente para conocer de los asuntos donde está de por medio el dominio público.
III.-. Según lo establecen los numerales 16 inciso b) y 41 párrafo segundo en relación al numeral 40 párrafo primero de la Ley de la Jurisdicción Agraria, en procesos de esa naturaleza, la excepción dicha debe ser presentada dentro de tercer día, a partir del momento cuando, las partes han sido comunicadas de la resolución que da traslado a la demanda, o en su caso, dentro del plazo otorgado por el despacho, sea, de seis a 15 días. En este asunto, la notificación al Estado tuvo lugar el 15 de noviembre de 2013, no obstante, formuló dicha excepción hasta el 5 de diciembre de ese año, lo cual evidencia, la defensa se interpuso de forma extemporánea. Asimismo, por tratarse de un proceso donde se reclama una superposición de planos, en el cual en esencia, la posesión y aptitud agraria ha sido esgrimida por las partes, tratándose de un litigio referente a la condición de agricultores y copropietarios, resulta innegable, se está frente a elementos propios de una discusión en sede agraria, de ahí, ante la duda, el proceso deba mantenerse en esa jurisdicción.
Lo anterior con base en el principio de continuidad de los actos en sede agraria, y de la perpetuidad de dicha competencia. El hecho de que el Estado, quien desde un inicio afirmó, la Jurisdicción Contencioso Administrativa es la competente para conocer de asuntos donde esté de por medio el dominio público, no enerva la estimación de que ha de dirimirse en la vía especializada agraria. Ello porque, esta Integrante, estima, existen otros parámetros a efecto de dilucidar si un asunto ha de conocerse o no en la jurisdicción agraria, como lo es la aptitud del predio, así como la naturaleza de la posesión ejercida sobre aquel y de las personas involucradas. Los conceptos técnicos como lo son entre otros el de la aptitud agraria, resultan relevantes para determinar la competencia del asunto; unidos a aquellos lo que estipula el ordenamiento jurídico vigente; a fin de garantizar en el caso de la jurisdicción agraria un acceso real a la justicia y se discuta en esta sede especializada si se ha cumplido o no con la función social asignada a los predios de tal naturaleza con base en los ordinales 45, 50 y 69 todos de la Constitución Política y lo que la jurisprudencia ha definido por aptitud de los fundos .
A lo anterior debe adicionarse, la excepción de examen fue presentada extemporáneamente, de ahí que lleve razón el Tribunal al estimar, le compete el conocimiento del presente asunto a dicha sede especializada.
IV.Este órgano decisor en años anteriores con otra integración ha dispuesto en lo atinente a la competencia agraria por la materia: “...III.-La competencia agraria, por razón de la materia, está determinada en forma genérica por los artículos 1 y 2 inciso h) de la Ley de Jurisdicción Agraria. Dispone expresamente el numeral 2 inciso h) de la normativa de cita: "Corresponde a los tribunales agrarios conocer: De todo lo relativo a los actos y contratos en que sea parte un empresario agrícola, originados en el ejercicio de actividades de producción, transformación, industrialización y enajenación de productos agrícolas". El criterio fundamental es el de la actividad agraria de producción, sea de cría de animales o cultivo de vegetales (actividades empresariales o de subsistencia), o cuando se trate de actividades conexas, así como las agroambientales sostenibles. Como criterios complementarios, se han establecido, el objetivo respecto a los bienes en este caso la naturaleza o aptitud del bien productivo, su extensión, éste resulta estrechamente vinculado a los fundos agrarios (denominados incorrectamente por la legislación como predios rústicos), dedicados o que sean susceptibles de destinarse al ejercicio de actividades agrarias productivas, o a la conservación de bosques y manejo sostenible de actividades agroambientales.
Luego en lo de interés a este asunto el criterio subjetivo: atinente a los sujetos que participan dentro del proceso agrario como actores o demandados. Los sujetos, igualmente, adquieren su calificativo de sujetos agrarios, por su dedicación al ejercicio de actividades agrarias productivas…La jurisprudencia patria ha sido reiterada en el sentido de estimar competencia agraria a lo expuesto... (Lo enfatizado no responde al original). (Entre otras véanse resoluciones de las 9:20 horas del 9 de junio de 1993 correspondiente al voto No. 65, resolución No. 29 de las 14 horas 20 minutos del 30 de marzo de 1990 , No. 34 de las 15 horas de 27 de abril de 1990. y resolución de las 15 horas 20 minutos del 27 de junio de 1990 que es voto No. 57). V.De esa suerte, encontrándose contemplado en los cardinales 1, 2, inciso h) y 4 todos de la Ley de la Jurisdicción Agraria; y, habiéndose formulado extemporáneamente la excepción de incompetencia, el presente proceso, es de conocimiento de la jurisdicción agraria, la cual es improrrogable por mandato de Ley, acorde a los preceptos 16 y 4o de la normativa de referencia. En esa línea, se comparten los fundamentos dados por los juzgadores agrarios y en consecuencia, procede confirmar la resolución del Tribunal Agrario del Segundo Circuito Judicial de San José, al ser el asunto propio de la materia agraria. Y; por ende del conocimiento del Juzgado Agrario del II Circuito Judicial de San José al cual habría de remitirse el expediente.
POR TANTO
Se declara que el conocimiento del presente proceso le corresponde al Tribunal Procesal Contencioso Administrativo y Civil de Hacienda. Las resoluciones y actuaciones procesales, así como la prueba recibida conservan su vigencia, debiendo adecuarse el proceso al Código Procesal Contencioso Administrativo en lo estrictamente necesario.
