*071602410465AG* Res. 000513-C-S1-2016 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, at eleven ten a.m. on May nineteenth, two thousand sixteen.- In the ordinary proceeding brought by JORGE SÁENZ VARGAS against the INSTITUTO DE DESARROLLO RURAL (INDER), with the PROCURADURÍA GENERAL DE LA REPÚBLICA as an interested party, the Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica recused itself from continuing to hear the proceeding. The Tribunal Agrario del Segundo Circuito Judicial de San José rejects the recusal of the Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica. The Procuraduría General de la República expressed its disagreement with the ruling, and the matter was therefore referred to this Sala for consultation.
WHEREAS
I.The plaintiff brings an ordinary proceeding seeking a judgment declaring: “PRIMARY CLAIM: 1.- That my client acquired, by acquisitive prescription (prescripción positiva), the property recorded in the Registro Público de la Propiedad under Property Registration Number 021160-000 and described in Cadastral Plans numbers L-734339-2001 and L-734338-2001, with a total area of 252750.915 square meters, because my client has exercised acts of possession over the property since 1962, quietly, openly, peacefully, continuously, as owner and in good faith since 1962; accordingly, the registration entries for property registration 021160-000 shall be amended and the property shall be recorded in my client’s name in the Registro Público. 2.- That the defendant be ordered to pay both categories of costs. ALTERNATIVE CLAIM: 1.- That a judgment declare that my client acquired, by acquisitive prescription, the property recorded in the Registro Público de la Propiedad under Property Registration Number 7-021160-000 and described in Cadastral Plans numbers L-734339-2001 and L-734338-2001, with a total area of 252750.915 square meters, because my client has exercised acts of possession over the property since 1962, quietly, openly, peacefully, continuously, as owner and in good faith since 1962; and that the Instituto de Desarrollo Agrario be ordered to deliver the public deed transferring the property or, failing that, that the Honorable Judge appear in its stead to execute the transfer of the property. 2.- That the defendant be ordered to pay both categories of costs.” (F.39 and 40)
II.On its own motion, the Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica recused itself from continuing to hear the proceeding. It reasoned: “...given the repeated majority decisions of the Sala Primera de la Corte Suprema de Justicia holding that, even where the dispute concerns mere possession of property belonging to the State Natural Heritage (Patrimonio Natural del Estado), particularly where registered title to property is sought, the matter must be heard pursuant to the rules and reasoning stated by that honorable chamber, the undersigned Judge considers it appropriate to recuse himself from continuing to hear this proceeding.” It concluded: “...this action must be heard in the contentious-administrative jurisdiction (jurisdicción Contencioso Administrativa), rather than as an agrarian matter.” (F.431). The Tribunal Agrario del Segundo Circuito Judicial de San José rejects the recusal ordered.
It reasoned: “...it should be noted that, in this proceeding, the Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica has heard the matter since the proceeding began. By means of its ruling issued at eight a.m. on November first, two thousand seven (folio 43), more than seven years ago, that Juzgado Agrario implicitly assumed jurisdiction over this matter; jurisdiction was therefore vested in that court (see folio 43), which handled service of the complaint, defenses, the evidentiary stage, and closing arguments (see all folios). The parties did not express disagreement with the ruling. Jurisdiction was perpetuated and became definitively established in the agrarian forum. III. From the matters stated in the preceding whereas clause, it is clear that jurisdiction to hear this dispute was established as of the ruling by which the court of origin assumed jurisdiction over this matter; it is therefore plainly unacceptable for it, six years later, to recuse itself once again from hearing the case and attempt to refer it to the contentious-administrative forum, as this would violate the principle of perpetuation of jurisdiction (principio de perpetuidad de la competencia).” [sic].
(F.443). The Procuraduría General de la República expressed its disagreement with the ruling. It argued that this is an ordinary proceeding against the Instituto de Desarrollo Rural concerning real property consisting of pastureland and forests, located in the “Zona Protectora del Río Pacuare, or involving forestland within a property belonging to the Instituto de Desarrollo Rural, formerly the Instituto de Desarrollo Agrario....” Given these particular circumstances, jurisdiction over the dispute lies with the contentious-administrative courts (F. 450). Accordingly, the matter was referred to this Sala for consultation.
III.In the case under consideration, the plaintiff seeks a declaration in its favor of acquisitive prescription (prescripción adquisitiva) with respect to the properties that, according to Cadastral Plans L-734339-2001 and L734338-2001, are described as having areas of 2229536.05 and 23214.88 square meters, respectively, and as consisting of pastureland and mountain land. According to the plans appearing at folios 29 through 31 and official communication SINAC-ACLAPN-0084-2014 issued by the Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, appearing at folio 345, those lands are located in the Zona Protectora Pacuare, created by executive decree no. 165815-MAG dated January 30, 1986. Under these circumstances, the real property at issue in this matter constitutes an area within the public domain (dominio público); accordingly, the contentious-administrative jurisdiction (jurisdicción Contencioso Administrativa) (art. 108 Ley de Biodiversidad), which extends to any matter in which the State has a direct interest, has jurisdiction to hear the claimant’s requested relief.
IV.In this regard, Article 13 of Ley Forestal N° 7575 provides: “The State’s natural heritage (patrimonio natural del Estado) shall consist of the forests and forest lands (terrenos forestales) of national reserves, areas declared inalienable, properties registered in its name, and properties belonging to municipalities, autonomous institutions, and other agencies of the Public Administration, except for real property securing credit transactions with the National Banking System that becomes part of their assets. The Ministry of Environment and Energy shall administer this heritage. Where appropriate, through the Office of the Attorney General of the Republic, it shall register the lands in the Public Property Registry as individually identified properties owned by the State. Non-governmental organizations that acquire real property containing forests or suitable for forestry, using funds from donations or the public treasury obtained in the name of the State, shall transfer such property to the State.” Article 14 of that same Law, in turn, states: “The forest lands and forests constituting the State’s natural heritage, as described in the preceding article, shall be exempt from attachment and inalienable; possession thereof by private parties shall create no right in their favor, and the State’s action for recovery of these lands shall not be subject to a statute of limitations.
Consequently, they may not be registered in the Public Registry through possessory information proceedings (información posesoria), and both their invasion and occupation shall be punished in accordance with this Law.” In these proceedings, the property at issue consists of two parcels registered in the name of the Instituto de Desarrollo Rural, whose assets form part of the State’s Natural Heritage because it is an autonomous institution. Article 108 of Ley de Biodiversidad, in turn, establishes that, until specialized environmental courts exist, all matters involving private parties shall fall within the Agrarian Jurisdiction (Jurisdicción Agraria), while matters involving the State shall be reserved for the Administrative Litigation Jurisdiction (Jurisdicción Contenciosa Administrativa). Specifically, it provides: “In biodiversity matters, and until an environmental jurisdiction exists, every dispute shall fall within the exclusive jurisdiction of the administrative litigation courts.
As exceptions to the foregoing rule, offenses against biodiversity shall be tried by the criminal courts; likewise, disputes arising between private parties that do not involve an administrative act or public-domain property shall fall within the jurisdiction of the agrarian courts.” It follows from the foregoing that, because a specialized environmental jurisdiction has not yet been created, disputes that arise fall, as a general rule, within the jurisdiction of the administrative litigation courts and cannot be deemed to fall exceptionally within the agrarian courts’ jurisdiction, because the matter involves public-domain property (dominio público) registered in the name of the Instituto de Desarrollo Rural. Accordingly, this Chamber agrees with the Office of the Attorney General of the Republic that subject-matter jurisdiction (competencia material) over these proceedings lies with the administrative litigation courts, which is consistent with the subject-matter jurisdiction established in Articles 1 and 2 of the Código Procesal Contencioso Administrativo.
Both Ley de Biodiversidad and the Código Procesal Contencioso Administrativo postdate Ley de Jurisdicción Agraria, Articles 1 and 2 of which establish the subject-matter jurisdiction of the agrarian courts in relation to Article 22. In this regard, reference may be made to judgment Nº 9928-2010 of the Constitutional Chamber, issued at 15:00 on June 9, 2010, which expressly changed the position stated in decisions 3905-1994, 5686-1995, and 14999-2007; it cited the first of those decisions as 3995-1994, but was evidently referring to the ruling in judgment 3905-1994, under which the Agrarian Jurisdiction could review the legality of administrative acts. In this new judgment, the Chamber stated: “On this specific point, and upon fuller consideration, this Constitutional Court modifies or reverses the position set forth in Judgments Nos. 3095-94 of 15:57 on August 3, 1994; 7540-94 of 17:42 on December 21, also of 1994; 5686-95 of 15:39 on October 18, 1995; and 14999-2007 of 15:06 on October 17, 2007.
This means that when a litigant asserts a claim challenging the invalidity of, or substantive nonconformity with, the administrative legal order (ordenamiento jurídico-administrativo) of administrative conduct or any individual manifestation of the administrative function (formal or substantive omission, formal activity or material action, or administrative legal relationship), the administrative litigation courts must invariably hear and decide it. Obviously, if the claim, based on its substantive content, is governed by the labor, family, or agrarian legal regime, even though it relates to some administrative conduct or specific manifestation of the administrative function—to the extent that a public entity or body is involved—it must be heard and decided by those courts, because what is being challenged is not, strictly speaking, the substantive conformity or nonconformity of the administrative function or conduct with the administrative legal order, which is what Article 49 of the Constitution reserves for the administrative litigation courts.
This Constitutional Court considers that the decisive criteria for distinguishing the scope of jurisdiction of the administrative litigation courts from that of other specialized judicial branches—which henceforth must be taken into account by the ordinary courts—shall therefore be the following: 1°) The substantive content of the claim; and 2°) the applicable legal regime. Thus, if the substantive conformity or nonconformity of a specific manifestation of the administrative function with the body of legality (bloque de legalidad) is disputed, the conflict of interests must necessarily be heard by the administrative litigation courts.” In this case, the relief sought is a declaration of acquisitive prescription (prescripción positiva) over two properties belonging to the Instituto de Desarrollo Rural and therefore constituting public-domain property because they form part of the State’s Natural Heritage; consequently, the claim’s substantive content cannot be deemed to fall within the Agrarian Jurisdiction.
Subsequently, in judgment N° 9879-2015, the Constitutional Chamber, referring to the allocation of jurisdiction between the family courts and the administrative litigation courts, addressed, in a binding manner, the factors defining jurisdiction between the latter and other judicial branches, providing: “…It is not customary for this Court to rule on whether the referring court has jurisdiction; however, when its lack of jurisdiction is clear and manifest because it infringes a constitutional jurisdiction assigned to a particular judicial branch, this Court cannot and must not disregard that circumstance, which violates the Law of the Constitution. Viewed in this light, the subject matter of the proceedings underlying this judicial referral must be established with absolute clarity, because there is a clear and manifest lack of jurisdiction….” As provided in Article 49 of the Constitution and in the Código Procesal Contencioso-Administrativo, it concerns the State’s administrative function.
Through that wording, the constituent assembly fortunately incorporated into the Political Constitution language broader than the Public Administration’s merely express formal activity, encompassing all conduct of public administrations, as is apparent from the final phrase, “of any other public-law entity,” thereby moving beyond the limited concept of the administrative act to encompass administrative conduct or function, so that an Administrative Litigation Judge has jurisdiction to hear other, much broader and more extensive fields of public law.” Both rulings establish, in a binding manner, the criteria for allocating jurisdiction between the administrative litigation courts and other judicial branches, such as the labor, family, and agrarian courts.
V.Regarding the arguments presented by the Agrarian Court, it should be noted that they concern the application of what it considers to be the principle of perpetuation of jurisdiction (principio de la perpetuidad de la competencia). In this Chamber’s view, that principle does not apply because subject-matter jurisdiction had not previously been challenged in these proceedings. It is true that, when the complaint was filed, the Agrarian Court of the First Judicial Circuit of the Atlantic Zone continued processing the case and declared that it lacked jurisdiction (inhibitoria) long after proceedings had begun; nevertheless, Article 16 of Ley de Jurisdicción Agraria permits the first-instance judge to issue such a declaration at any stage of the proceedings. Thus, possibly upon fuller consideration, the court ordered the case file forwarded to the Agrarian Court so that it could determine subject-matter jurisdiction, because the lower court considered that jurisdiction lay with the administrative litigation courts, a position shared by this Chamber.
VI.Consequently, jurisdiction over these proceedings is declared to lie with the Tribunal Procesal Contencioso Administrativo y Civil de Hacienda. Based on the principle of preservation of procedural acts (principio de conservación de los actos procesales), the procedural actions and decisions, as well as the evidence received, shall remain valid, and the proceedings shall be brought into conformity with the Código Procesal Contencioso Administrativo only to the extent strictly necessary to ensure procedural economy, expedition, and effective judicial protection.
POR TANTO
By majority vote, jurisdiction over these proceedings is declared to lie with the Tribunal Procesal Contencioso Administrativo y Civil de Hacienda. The procedural decisions and actions, as well as the evidence received, shall remain valid, and the proceedings shall be brought into conformity with the Código Procesal Contencioso Administrativo only to the extent strictly necessary. Luis Guillermo Rivas Loáiciga Román Solís Zelaya Carmenmaría Escoto Fernández William Molinari Vílchez Damaris Vargas Vásquez MSEQUEIRA DISSENTING OPINION OF JUSTICE ESCOTO FERNÁNDEZ The undersigned member of this Chamber respects the decision of her fellow justices but disagrees with the majority position adopted in this decision and dissents on the grounds set forth below:
I.The initial complaint in this ordinary agrarian proceeding (proceso ordinario agrario) was filed by the special judicial attorney of Mr. Jorge Sáenz Vargas on October 29, 2007, before the Agrarian Court of Limón, where the case has since been heard. The plaintiff based his claim on the following facts. He stated that, around 1962, his principal and his father entered a property intending to possess and work it and, one day, to acquire rights allowing them to obtain title to it. However, he asserted that, given the remoteness of the land and the property’s suitability for forestry, after 10 years of possessing the parcel openly, undisturbedly, peacefully, continuously, as owner, and in good faith, his principal devoted himself to protecting the natural forest by establishing and maintaining boundary trails, preventing illegal hunting and indiscriminate logging, among other activities. He stated that, in the early 1990s, a Forest Management Plan (Plan de Manejo Forestal) was prepared for the property, and that the property was enrolled in the forestry-incentive payment program known as the “Certificado de Abono Forestal para el Manejo del Bosque Natural.” He explained that the property, with an area of “229536,05 hectares,” and registered cadastral survey plan (plano catastrado) no. L-734339-2001, is described as follows: it is located in Las Brisas de Pacuarito, canton of Siquirres, province of Limón; it borders Ramón Zapata Mora to the north, Bienvenido Campos Ramírez to the south and east, and Finca Padre Núñez to the west.
He further stated that registered cadastral survey plan no. L-734338-2001 was prepared for an area of 2314,88 square meters, bordering a public road to the east and the Instituto de Desarrollo Agrario—hereinafter IDA, now INDER—on all other sides. He stated that, in 1977, the defendant Institute purchased the property from a company named Desarrollos Forestales S.A., for the purpose, as described in the deeds, of allocating it to farmers, but asserted that this objective was never fulfilled. He indicated that his principal was declared an allottee (adjudicatario) in 1982, but that, as of the filing date of the complaint, no title had been processed for him. He stated that the allotted parcel 17 was recorded in the Public Registry under registration number 021160 on August 3, 1989. He added that the property was affected by the creation of the protected wildlife area (Área Silvestre Protegida) known as Zona Protectora Pacuare, established by Executive Decree no. 16815-MAG.
He maintained that his principal had acquired the property 10 years before the purchase made by the defendant Institute and therefore considered that he was entitled to acquisitive prescription (prescripción positiva) and, consequently, to registration of the property in his name. Based on the foregoing, he requested a judgment declaring that the plaintiff acquired by acquisitive prescription the disputed land described in registered cadastral survey plans nos. L-734339-2001 and L-734338-2001; ordering the amendment of the registry entries for property registration no. 021160-000 so as to register it in the plaintiff’s name; and ordering the defendant to pay both categories of costs (ambas costas). In the alternative, he requested a declaration that his principal acquired by acquisitive prescription the property that is the subject of this proceeding; an order requiring the defendant Institute to deliver the public deed of conveyance or, alternatively, directing the Judge to appear in its stead and execute the property conveyance; and an award of both categories of costs against it.
The defendant Institute denied the complaint and raised defenses alleging lack of a legal right, lack of standing to sue and be sued, and expiration (caducidad). It stated that the Procuraduría General de la República—hereinafter PGR—should be joined as a party. It filed a counterclaim seeking a declaration that the defendant Institute is the sole owner of parcel 1-17 by virtue of its registered title and that the disputed property is in the public domain (dominio público). It also requested a declaration that the plaintiff-counterdefendant had availed himself of the benefits of the land and had collected the forestry bond certificate without holding title to the property. In addition, it requested an order requiring the plaintiff-counterdefendant to reimburse IDA, now INDER, for all timber harvested without express authorization from that Institution’s Board of Directors and to refund to the State any amounts deemed to have been improperly collected in connection with the forestry bond certificate.
It sought to have PGR joined as a party, to have the case file requested from the Ministerio de Ambiente y Energía—hereinafter MINAE—and to have it incorporated into the proceeding. It requested that MINAE be ordered to provide a certification and a plan containing coordinates for the Zona Protectora de Río Pacuare, in order to verify the substantive status of the parcel at issue; that the value of the harvested timber be quantified through a technical study; and that the forestry bond certificates received be calculated. It sought a declaration that the plaintiff-counterdefendant must return the parcel to IDA, now INDER, and a declaration that the defendant-counterclaimant Institute is entitled to compensation for uncollected fruits (frutos no percibidos), in the amount determined by expert calculation. It requested a declaration that the plaintiff-counterdefendant acted in bad faith; that IDA, now INDER, acted in good faith; that any ecological damage be assessed; and that the opposing party be ordered to pay both categories of costs.
The plaintiff-counterdefendant denied the counterclaim and raised defenses alleging lack of a legal right and lack of standing to sue and be sued. In an order issued at 14:30 on October 1, 2008, PGR was joined as a party. In an order issued at 13:00 on August 4, 2010, the Court approved the settlement agreement entered into by Jorge Sáenz Vargas and IDA, now INDER. The plaintiff-counterdefendant stated that the defendant-counterclaimant Institute had failed to comply with the settlement agreement and therefore requested that a settlement hearing be scheduled or, failing that, that the taking of evidence proceed. The representative of PGR denied the claim and raised no defenses. In ruling no. 18-2015-JVR, issued at 13:00 on March 4, 2015, the Court ordered that the proceedings be forwarded to the Agrarian Tribunal of the Second Judicial Circuit of San José so that it could determine which court should continue hearing this case. In its order issued at 13:42 on April 23, 2015, the Ad quem rejected the declination of jurisdiction (inhibitoria).
II.The undersigned member does not concur with the majority opinion of this Chamber insofar as it refers the matter to the Contentious-Administrative and Civil Treasury Court, because, in my view, this proceeding falls within agrarian jurisdiction for the following reasons.
III.In my view, the fact that the property at issue in this litigation lies within the State Natural Heritage (Patrimonio Natural del Estado) is not sufficient to transfer it to the contentious-administrative courts. The Ley de la Jurisdicción Agraria—hereinafter LJA—provides that, in matters of an agrarian nature, IDA, now INDER, and the Procuraduría General de la República—hereinafter PGR—shall be parties. For greater clarity, section 22(c) and (ch) of the cited law is transcribed as follows: “In matters heard by the agrarian jurisdiction, the following shall be parties: c) The Instituto de Desarrollo Rural(*), in all matters relevant to fulfillment of the Ley de Ordenamiento Agrario y Desarrollo Rural. (*) (Its name was amended by Article 14 of Ley N° 9036 of May 11, 2012, ‘Transforma el Instituto de Desarrollo Agrario (IDA) en el Instituto de Desarrollo Rural (INDER) y Crea Secretaría Técnica de Desarrollo Rural’). ch) The Procuraduría General de la República, in all matters concerning the protection of the public domain and the exercise of the powers conferred upon it by law in this area.” Moreover, in the dissenting opinion issued by the undersigned in judgment 959-2013 rendered by this Chamber, I stated, with reasoning consistent with the LJA: “[…] IV.- Section 22(ch) of the Ley de la Jurisdicción Agraria (hereinafter LJA) provides: ‘In matters heard by the agrarian jurisdiction, the following shall be parties: ch) The Procuraduría General de la República, in all matters concerning the protection of the public domain and the exercise of the powers conferred upon it by law in this area.
The courts shall examine, sua sponte or at the request of the plaintiff or defendant, whether the aforementioned direct interest actually exists. As amended by Article 2 of law No. 6815 of September 27, 1982) (sic).’ (Emphasis not in the original). Subsection ch) clearly establishes that the existence of the aforementioned interest must be examined in every case. In this litigation, the State’s direct interest has not been alleged because the parcel forms part of a property that remains privately owned. Pursuant to Article 22 of the LJA, transcribed above, and… this matter falls within agrarian jurisdiction under the functional, objective, and subjective criteria alike. To date, the State does not yet possess the direct interest required for it to be joined as a party to this agrarian proceeding; this is because the property is registered in the National Real Property Registry and therefore remains privately owned.
Consequently, jurisdiction is agrarian because there is no evidence establishing that the properties legally form part of the refuge. Although this member agrees that protected wildlife areas are State-owned property and therefore form part of the public domain, that is true only once they have been expropriated. Moreover, under the provision transcribed above, this does not preclude the matter, by reason of its specialized subject matter, from being heard in a specialized forum such as the agrarian courts when the lands involved are agrarian in nature, regardless of any parties who must necessarily be joined as such—in this case, the State, given the interests it may have. The reproduced provision, section 22(ch), contemplates situations such as the one under review, in which the State may be joined as a legally required party before the agrarian courts in matters concerning the protection of the public domain, without requiring the dispute to be heard in the contentious-administrative jurisdiction.” Consequently, the mere fact that IDA, now INDER, and PGR participate in this proceeding and that the disputed property belongs to the public domain does not justify referring the matter to the contentious-administrative courts, because the LJA provides that, even in such cases, if the matter is agrarian in nature, it shall be heard by the courts specializing in that subject matter. Such is the case here.
IV.In the case under review, the disputed parcel is owned by the IDA, now INDER, identified as no. 17 of Block 1 in the Asentamiento Desarrollo Forestal, registration 251160-000, suitable for forestry use and located within the Zona Protectora Pacuare, created by Decreto Ejecutivo no. 165815-MAG of 30 de enero de 1986, as stated by the general judicial representative of the IDA, now INDER. The Ley de Tierras y Colonización sets forth among its objectives in its first provision: “1.- To establish that land ownership must be promoted for the gradual increase of its productivity and for the fair distribution of its output, improving the social condition of farmers and enabling them to participate consciously in the Nation’s economic and social development.” Next, provision 3 of that law, in keeping with its objectives, states: “... for the person who works it, the land must constitute the guarantee of that person’s economic well-being, freedom, and dignity and, therefore, the foundation of the Nation’s well-being, freedom, and dignity...” For its part, section 3(b) of the Ley de Creación del Instituto de Desarrollo Agrario describes one of the Institute’s functions, which is limited to: “To administer, on behalf of the State, national reserves and lands transferred for the fulfillment of its purposes, and to carry out comprehensive development plans, peasant settlements, colonization, subdivision (parcelación), and allocation thereon, all in accordance with the provisions of this law.” Provision 4 of the cited law states: “As a matter of priority, the Institute shall seek to resolve problems arising from the occupation of national reserves and the precarious occupation of privately owned land.
The Institute is authorized, where appropriate, to redistribute and reorganize the areas subject to the conflict after arranging their financing.” It bears noting that Agrarian Law (Derecho Agrario) recognizes different types and concepts of property, each with certain characteristics, particular features, purposes, and assigned functions. These include, among others, forest property (propiedad forestal), ecological property (propiedad ecológica), and Indigenous property (propiedad indígena). (See the judgments of this Chamber issued at 11:15 hours on 13 de mayo de 1994, corresponding to vote No. 26, and at 14:00 horas 20 minutos on 30 de octubre de 1991, which is vote No. 189). By way of example, among other sources, this is regulated in the aforementioned Ley del Instituto de Desarrollo Agrario and Ley de Tierras y Colonización, as well as in the Ley Forestal, Ley de Uso, Manejo y Conservación de Suelos, Ley Orgánica del Ambiente, artículos 45 y 50 of the Constitución Política, and decisions of this Chamber and the Constitutional Chamber (including those cited, as well as the decision issued at 14 horas 04 minutos on 3 julio de 2003, which is Voto No. 2003-06312 of the Sala Constitucional).
This function of agrarian property (propiedad agraria) makes it a right-duty (derecho-deber) or power-obligation (poder-obligación), because it is expressed in the legal framework in three respects: the objective or social function (función objetiva o social), assigned to the State as the obligation to distribute productive assets equitably, granting them preferably to persons who lack such assets. Next, the subjective function (función subjetiva), consisting of the obligation of the holder of the subjective right to agrarian property to exercise the powers of ownership effectively through productive and rational acts intended to cultivate and improve the agricultural operation (explotación agraria). The ecological function (función ecológica), directed at both the State and the agrarian owner in order to achieve a balance between production and conservation aimed at sustainable development (desarrollo sostenible) and the protection of the right to a healthy and ecologically balanced environment.
It is evident that, in this specific case, in which the plaintiff claims possession (posesión) of a property that he says he cared for over many years in order to protect the natural forest by creating and maintaining cleared boundary paths, as well as by preventing illegal hunting and indiscriminate logging, among other activities, the property fulfills a social function. With respect to agrarian property, it is not merely a matter of holding title based on a registry entry; rather, ownership must be manifested through the actual exercise of its attributes by means of agrarian possessory acts (actos posesorios agrarios) or, where applicable, agro-environmental acts (actos agroambientales). In general, this opinion concurs with the doctrinal views holding that the social function of agrarian assets constitutes an internal limitation on the right by conditioning its exercise and that, accordingly, the property is deemed functionally constrained (propiedad funcionalizada) with respect to the obligation to exploit and develop the asset’s productive vocation.
Although the majority ordered this proceeding transferred to the Tribunal Procesal Contencioso Administrativo because the disputed asset is in the public domain (dominio público), this case concerns agroforestry property (propiedad agroforestal), and what must essentially be determined is whether the claimants fulfilled the social function assigned to this type of property. This is without prejudice to any actions that the IDA might eventually bring in the future should other circumstances arise. I hereby set forth the position I have maintained on this matter.
V.In addition to the foregoing, it should be taken into consideration that the litigation began in 2007 as an ordinary agrarian proceeding (proceso ordinario agrario) concerning possession of a property, in which the plaintiff states that he entered the property many years ago and has devoted himself to protecting the natural forest by creating and maintaining cleared boundary paths and preventing illegal hunting and indiscriminate logging, among other activities. The entire proceeding has already been completed; only the issuance of the judgment remains. Furthermore, the case file contains judicial proceedings such as testimonial and confessional evidence (prueba testimonial y confesional); the PGR was joined as a party; a judicial consultation was submitted to the Sala Constitucional for a ruling on the constitutionality of section 26 of Ley no. 7018; and Informe no. SINAC-ACLAC-PNE-084-2014 was submitted by attorney Carlos Eduardo Vargas on behalf of the Sistema Nacional de Áreas de Conservación, among other actions.
Therefore, I do not concur with the majority’s decision to transfer the case at this procedural stage to the Tribunal Procesal Contencioso Administrativo y Civil de Hacienda, because doing so would also undermine the procedural principles of promptness, immediacy, and concentration (principios de celeridad, inmediatez y concentración procesales). Accordingly, the undersigned votes against that transfer and, given the subject matter, considers that the proceeding must continue before the agrarian courts (sede agraria) and be remanded to the original Juzgado Agrario, namely, the Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica, for the appropriate action.

San José, a las once horas diez minutos del diecinueve de mayo de dos mil dieciséis.- En proceso ordinario de JORGE SÁENZ VARGAS contra el INSTITUTO DE DESARROLLO RURAL (INDER), y como interesada la PROCURADURÍA GENERAL DE LA REPÚBLICA, el Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica, se inhibió en seguir conociendo del proceso. El Tribunal Agrario del Segundo Circuito Judicial de San José, imprueba la inhibitoria del Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica. La Procuraduría General de la República, manifestó su inconformidad con lo resuelto, por lo que se envió en consulta ante esta Sala.
CONSIDERANDO
I.El actor promueve proceso ordinario para que en sentencia se declare "PRINCIPAL: 1.- Que mi representada adquirió por prescripción positiva, la finca inscrita en el Registro Público de la Propiedad Matrícula Número 021160-000, y descrita en los Planos Catastrados número L-734339-2001 y L-734338-2001, con una medida total 252750.915 metros cuadrados por haber ejercido actos posesorios desde el año 1962 en la propiedad, de forma quieta, pública, pacífica, ininterrumpida, a título de dueño y de buena fe desde el año 1962, procediendo de esta forma con la modificación de los asientos registrales de la matrícula 021160-000 y que la misma se proceda a inscribir a nombre de mi representado en el Registro Público. 2.- Que se condene a la demandada al pago de ambas costas. SUBSIDIARIA: 1.- Que se declare en sentencia que mi representada adquirió por prescripción positiva, la finca inscrita en el Registro Público de la Propiedad Matrícula Número 7-021160-000, y descrita en los Planos Catastrados número L-734339-2001 y L-734338-2001, con una medida total 252750.915 metros cuadrados por haber ejercido actos posesorios desde el año 1962 en la propiedad, de forma quieta, pública, pacífica, ininterrumpida, a título de dueño y de buena fe desde el año 1962 y se proceda a ordenar al Instituto de Desarrollo Agrario, la entrega de la escritura pública de traspaso de la propiedad ó en su defecto comparezca el respetable Juez en sustitución a firmar el traspaso de la propiedad. 2.- Que se condene a la demandada al pago de ambas costas". (F.39 y 40)
II.De oficio, el Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica, se inhibió en seguir conociendo del proceso. Consideró, "...siendo reiterados los votos de mayoría de la Sala Primera de la Corte Suprema de Justicia, en cuanto a que aunque se discuta la simple posesión sobre un bien perteneciente al Patrimonio Natural del Estado, máxime cuando se pretende una titularidad registral sobre un bien, debe ser conocido, por las normas y razonamientos externados por tan honorable cámara, el suscrito Juez considera oportuno inhibirse en seguir conociendo del presente proceso." Concluye, "...la presente acción debe ser tramitada en sede Contencioso Administrativo y no en materia agraria." (F.431). El Tribunal Agrario del Segundo Circuito Judicial de San José, imprueba la inhibitoria decretada. Consideró; "..hacer alusión a que en este proceso el Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica conoció desde el principio del proceso.
El Juzgado Agrario dicho por resolución de las ocho horas del primero de noviembre de dos mil siete (folio 43) hace más de siete años, tácitamente se arrogó el conocimiento del presente asunto, por lo que la competencia quedó radicada en dicho juzgado (ver folio 43), tramitando traslado, excepciones, fase demostrativa y conclusiva (ver los folios en su totalidad). Las partes no se mostraron disconformes con lo resuelto. La competencia se perpetuó y quedó definitivamente fijada en la sede agraria. III. De lo expuesto en el considerando anterior resulta claro que la competencia para el conocimiento del presente conflicto quedó fijada a partir de la resolución donde el juzgado de origen se arrogó la competencia de este asunto por lo que resulta a todas luces inaceptable que seis años después venga nuevamente a inhibirse del conocimiento, tratando de enviarlo a la vía contenciosa administrativa, lo cual viene a atentar contra el principio de perpetuidad de la competencia.”. [sic].
(F.443). La Procuraduría General de la República, manifestó su inconformidad con lo resuelto. Argumentó, el presente es un proceso ordinario contra el Instituto de Desarrollo Rural, en relación con un inmueble cuya naturaleza es terreno de potreros y bosques, que se encuentra localizado en la “Zona Protectora del Río Pacuare o por tratarse de terrenos forestales dentro de una finca del Instituto de Desarrollo Rural, antes Instituto de Desarrollo Agrario…”. Dadas estas particularidades, corresponde conocer del litigio a la jurisdicción Contenciosa Administrativa (F. 450). Por lo anterior se envió en consulta ante esta Sala.
III.El caso de estudio, la parte actora pretende se declare a su favor la prescripción adquisitiva respecto a los inmuebles que según planos catastrados L-734339-2001 y L734338-2001, se describen con una medida de 2229536.05 y 23214.88 metros cuadrados respectivamente, y cuya naturaleza es terreno de potreros y montaña. Dichos terrenos -según se desprende de los planos de folios 29 a 31 y oficio SINAC-ACLAPN-0084-2014 emitido por el Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, que corre a folio 345- se encuentran localizados en la Zona Protectora Pacuare creada por decreto ejecutivo no. 165815-MAG de 30 de enero de 1986. Ante esta coyuntura, el inmueble objeto de este asunto corresponde a un área de dominio público, por lo que es la jurisdicción Contenciosa Administrativa (art. 108 Ley de Biodiversidad), extensiva a cualquier asunto en los que el Estado tenga interés directo, a la que corresponde conocer de las pretensiones del gestionante.
IV.Al respecto, el artículo 13 de la Ley Forestal N° 7575 dispone: “El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio. El Ministerio de Ambiente y Energía administrará el patrimonio. Cuando prroceda, por medio de la Procuraduría General de la República, inscribirá los terrenos en el Registro Público de la Propiedad como fincas individualizadas de propiedad del Estado. Las organizaciones no gubernamentales que adquieran bienes inmuebles con bosque o de aptitud forestal, con fondos provenientes de donaciones o del erario, que se hayan obtenido a nombre del Estado, deberán traspasarlos a nombre de éste ”.
Por su parte, el numeral 14 de esa misma Ley señala: “ Los terrenos forestales y bosques que constituyen el patrimonio natural del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley.” En este proceso, el bien objeto en litigio está constituido por dos inmuebles que están inscritos a nombre del Instituto de Desarrollo Rural, cuyos bienes forman parte del Patrimonio Natural del Estado, al ser una institución autónoma. Por su parte, el artículo 108 de la Ley de Biodiversidad establece que, mientras no existan tribunales ambientales especializados, corresponderá a la Jurisdicción Agraria todos los asuntos vinculados con particulares, reservando a la Jurisdicción Contenciosa Administrativa, aquellos en los cuales esté involucrado el Estado.
Concretamente, dispone: “En materia de biodiversidad y mientras no exista una jurisdicción ambiental, toda controversia será competencia exclusiva de la jurisdicción contenciosa administrativa. Como excepciones de la regla anterior, los delitos contra la biodiversidad serán juzgados por la jurisdicción penal; de igual modo, las controversias que se susciten entre particulares, donde no medie un acto administrativo ni del dominio público, serán competencia de la jurisdicción agraria.” De lo anterior se deduce, como no se ha creado aún la jurisdicción ambiental especializada, las controversias que se susciten, por regla general, son competencia de la jurisdicción contenciosa administrativa, sin que se pueda estimar es propia de la jurisdicción agraria a manera de excepción, debido a que se está en presencia de bienes que forman parte del dominio público, inscritos a nombre del Instituto de Desarrollo Rural.
Por ende, comparte esta Sala el criterio de la Procuraduría General de la República acerca de que la competencia material de este proceso corresponde a la jurisdicción contenciosa administrativa, lo cual es acorde con la competencia material establecida en los artículos 1 y 2 del Código Procesal Contencioso Administrativo. Ambas leyes, la de Biodiversidad y el Código Procesal Contencioso Administrativo, son posteriores a la Ley de Jurisdicción Agraria que en sus artículos 1 y 2 establecen la competencia material de los tribunales agrarios, en relación con numeral 22. Al respecto, pueden consultarse los votos de la Salas Constitucional Nº 9928-2010 de las 15 horas del 9 de junio de 2010, en la que de manera expresa varió el criterio externado en las resoluciones 3905-1994, 5686-1995 y 14999-2007; citando el primero de ellos con la numeración 3995-1994, pero evidentemente se está refiriendo a lo dicho en el voto 3905-1994, conforme al cual la Jurisdicción Agraria podía conocer de la legalidad de actos administrativos.
En este nuevo voto, la Sala señaló: “Sobre este punto en particular y, bajo una mejor ponderación, este Tribunal Constitucional varía o revierte la tesis expuesta en los Votos Nos. 3095-94 de las 15:57 hrs. de 3 de agosto de 1994, 7540-94 de las 17:42 hrs.de 21 de diciembre ambos de 1994, 5686-95 de las 15:39 hrs. de 18 de octubre de 1995 y 14999-2007 de las 15:06 hrs. de 17 de octubre de 2007. Lo anterior significa que cuando un justiciable deduce una pretensión para cuestionar la invalidez o disconformidad sustancial con el ordenamiento jurídico-administrativo de una conducta administrativa o cualquier manifestación singular de la función administrativa (omisión formal o material, actividad formal o actuación material o relación jurídico-administrativa), debe conocerla y resolverla, indefectiblemente, la jurisdicción contenciosoadministrativa. Obviamente, si la pretensión, por su contenido material, aunque esté relacionada con alguna conducta administrativa o manifestación específica de la función administrativa –en la medida en que interviene un ente u órgano público-, se encuentra regida por el régimen jurídico laboral, de familia o agrario, debe ser conocida y resuelta por esos órganos jurisdiccionales, por cuanto, no se cuestiona, propiamente, conformidad o disconformidad sustancial de la función o conducta administrativa con el ordenamiento jurídico-administrativo que es lo que el artículo 49 constitucional le reserva a la jurisdicción contencioso-administrativa.
Este Tribunal Constitucional, estima que los criterios determinantes para deslindar el ámbito competencial de la jurisdicción contencioso-administrativa de otros órdenes jurisdiccionales especializados –que, en adelante, deben tenerse en consideración por la jurisdicción ordinaria serán, entonces, los siguientes: 1°) El contenido material o sustancial de la pretensión y 2°) el régimen jurídico aplicable; de modo que si se discute la conformidad o disconformidad sustancial de una manifestación específica de la función administrativa con el bloque de legalidad, el conflicto de interés, será, necesariamente, de conocimiento de la jurisdicción contencioso-administrativa.” En este caso, lo pretendido es la declaratoria de prescripción positiva de dos bienes que pertenecen al Instituto de Desarrollo Rural, por ende, de dominio público al ser parte del Patrimonio Natural del Estado, de ahí que no podría estimarse que la pretensión material o sustancial de la pretensión corresponda a la Jurisdicción Agraria.
Así mismo, con posterioridad, la Sala Constitucional en voto N° 9879-2015, refiriéndose a la delimitación de la competencia entre la jurisdicción de familia y la contenciosa administrativa, se refirió a los elementos que definen la competencia entre esta última y otras jurisdicciones, de manera vinculante, al disponer: “…No es normal que este Tribunal se pronuncie sobre la competencia o no del órgano jurisdiccional consultante; empero cuando resulta evidente y manifiesta su incompetencia por vulnerar una competencia constitucional asignada a una jurisdicción concreta, no puede ni debe este Tribunal hacer caso omiso de ese hecho que vulnera el Derecho de la Constitución. Vistas así las cosas, debe establecerse, con meridiana claridad, cuál es el objeto del proceso que sirve de base a esta consulta judicial, porque hay una incompetencia evidente y manifiesta…". Según lo dispuesto en el artículo 49 constitucional y en el Código Procesal Contencioso-Administrativo se refiere a la función administrativa del Estado, con cuyo enunciado, el constituyente incorporó, afortunadamente, un lenguaje en la Constitución Política más amplio que la mera actividad formal expresa de la Administración Pública, abarcando todas las conductas de las administraciones públicas, según se entiende de la última frase “de toda otra entidad de derecho público”, con lo que se sobrepasa la noción limitada del acto administrativo para abarcar la conducta o función administrativa, con lo que el (la) Juez (a) de lo Contencioso-Administrativo tiene competencia para conocer otros campos mucho más amplios y bastos del Derecho público.” Ambos pronunciamientos, de manera vinculante, establecen los criterios de delimitación de la competencia entre la jurisdicción contenciosa administrativa y otras jurisdicciones como la laboral, la de familia y la agraria.
V.En relación con los argumentos expuestos por el Tribunal Agrario, debe señalarse, están referidos a la aplicación de lo que estiman es el principio de la perpetuidad de la competencia. En criterio de esta Cámara, dicho principio no es aplicable porque en este proceso no se ha cuestionado con antelación la competencia material. Ciertamente, al plantearse la demanda el Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica continuó con la tramitación del proceso, declarándose inhibido mucho tiempo después de que inicio con su tramitación; sin embargo, el artículo 16 de la Ley de Jurisdicción Agraria le permite a la persona juzgadora de primera instancia declarar la inhibitoria en cualquier estado del proceso, de manera tal que posiblemente con una mejor ponderación dispuso remitir el expediente al Tribunal Agrario para que éste definiera la competencia material al considerar le correspondía a la jurisdicción contenciosa administrativa, criterio que es compartido por esta Sala.
VI.Consecuentemente, se declara que el conocimiento del presente proceso corresponde al Tribunal Procesal Contencioso Administrativo y Civil de Hacienda. Con base en el principio de conservación de los actos procesales, mantienen su vigencia las actuaciones y resoluciones procesales, así como la prueba recibida, debiendo adecuarse al Código Procesal Contencioso Administrativo en lo estrictamente necesario, para garantizar la economía, celeridad y tutela judicial efectiva del proceso.
POR TANTO
Por mayoría, se declara que el conocimiento del presente proceso le corresponde al Tribunal Procesal Contencioso Administrativo y Civil de Hacienda. Las resoluciones y actuaciones procesales, así como la prueba recibida conservan su vigencia, debiendo adecuarse el proceso al Código Procesal Contencioso Administrativo en lo estrictamente necesario. Salva el Voto la Magistrada Escoto Fernández.
Luis Guillermo Rivas Loáicig a Román Solís Zelaya Carmenmaría Escoto Fernández William Molinari Vílchez Damaris Vargas Vásquez MSEQUEIRA VOTO SALVADO DE LA MAGISTRADA ESCOTO FERNÁNDEZ La suscrita Integrante de esta Sala respeta la decisión de los restantes compañeros, pero se separa del criterio de mayoría dispuesto en esta resolución; y salva el voto según se dirá con fundamento en lo siguiente:
I.El escrito inicial de demanda, de este proceso ordinario agrario, fue presentado por el apoderado especial judicial del señor Jorge Sáenz Vargas, el 29 de octubre de 2007, ante el Juzgado Agrario de Limón, donde se ha venido tramitando su conocimiento. El actor se fundamentó en los siguientes hechos. Dijo, aproximadamente para el año 1962, quien representa y su padre ingresaron en una finca con el ánimo de poseerla, trabajarla y algún día llegar a adquirir derechos para titularla. Sin embargo, adujo, dado lo abnegado de los terrenos y la aptitud forestal del bien, luego de 10 años de estar en el predio, de forma pública, quieta, pacífica, ininterrumpida, a título de dueño y de buena fe, su representado se dedicó a la protección del bosque natural, elaborando y manteniendo carriles, evitando la cacería ilegal y la tala indiscriminada, entre otros. Comentó, a principios de los años noventa, se realizó un Plan de Manejo Forestal en la propiedad; y se sometió al pago de Incentivos Forestales llamados “Certificado de Abono Forestal para el Manejo del Bosque Natural”.
Explicó, la propiedad con un área de “ 229536,05 hectáreas”, plano catastrado no. L-734339-2001 se describe así: se sitúa en Las Brisas de Pacuarito, cantón de Siquirres de la provincia de Limón, colinda al norte con Ramón Zapata Mora, al sur y al este con Bienvenido Campos Ramírez; y al oeste con la Finca Padre Núñez. Manifestó, por otra parte se realizó el plano catastrado no. L-734338-2001 con un área de 2314,88 metros cuadrados, colindante al este con calle pública y en los otros sectores con el Instituto de Desarrollo Agrario –en adelante IDA hoy INDER-. Expresó, en 1977 el Instituto demandado compró la finca a una sociedad llamada Desarrollos Forestales S.A., cuyo fin, según se describe en las escrituras, era destinarla a los agricultores, pero aseveró, ese objetivo nunca se cumplió. Indicó, su representado fue declarado adjudicatario desde 1982, pero hasta la fecha de presentación de la demanda, no se le había tramitado título alguno.
Dijo, la parcela 17 adjudicada se inscribió en el Registro Público con la matrícula 021160, desde el 3 de agosto de 1989. Agregó, la propiedad fue afectada por la creación del Área Silvestre Protegida conocida como Zona Protectora Pacuare, creada mediante Decreto Ejecutivo no. 16815-MAG. Sostuvo, su representado adquirió la finca 10 años antes de la compra realizada por el Instituto accionado, razón por la cual consideró, le asiste la prescripción positiva; y por ende, la matriculación del bien a su nombre. En mérito de lo anterior, solicitó, se declare en sentencia, el accionante adquirió por prescripción positiva el terreno en litis, descrito en los planos catastrados nos. L-734339-2001 y L-734338-2001, procediéndose a la modificación de los asientos registrales de la finca matrícula no. 021160-000, para inscribirla a nombre del accionante; y se condene al demandado al pago de ambas costas.
Subsidiariamente pidió, se declare su representado adquirió por prescripción positiva la finca objeto de este proceso; y se ordene al Instituto accionado, la entrega de la escritura pública de traspaso, o bien, comparezca el Juez en su sustitución a firmar el traspaso de la propiedad; y se le condene al pago de ambas costas. El Instituto accionado contestó de forma negativa e interpuso las excepciones de falta de: derecho, legitimación activa y pasiva; y caducidad. Indicó, se debía tener como parte a la Procuraduría General de la República –en adelante PGR-. Presentó contrademanda para solicitar, se declare que el Instituto demandado es el único propietario de la parcela 1-17 por derecho registral; y que el bien en litis es de dominio público. También pidió declarar, la parte actora-reconvenida se ha aprovechado de los beneficios del terreno; y cobró el certificado de bono forestal sin tener un título de propiedad.
Además requirió, se ordene al accionante-contrademandado reintegrar al IDA hoy INDER todo el aprovechamiento de madera en lo que no cuente con autorización expresa de la Junta Directiva de esa Institución; y devolver al Estado los cobros que se estimen indebidos referentes al certificado de bono forestal. Pretendió, se tenga como parte a la PGR, se pida el expediente al Ministerio de Ambiente y Energía –en lo subsecuente MINAE- y se incorpore al proceso. Solicitó, se pida al MINAE una certificación y un plano con coordenadas sobre la Zona Protectora de Río Pacuare, para verificar la situación de fondo respecto de la parcela en cuestión; se cuantifique mediante un estudio técnico, el monto de la madera aprovechada y se haga un cálculo de los certificados de bono forestal percibidos. Inquirió, se declare que el actor-reconvenido debe devolver la parcela al IDA hoy INDER, se declare el derecho del Instituto demandado-reconventor a ser indemnizado por los frutos no percibidos, según lo determine el cálculo de peritos.
Requirió, declarar mala fe del actor-reconvenido; que el IDA hoy INDER actúa de buena fe; se valore un eventual daño ecológico; y se condene a la contraparte al pago de ambas costas. El actor-reconvenido contestó de forma negativa, opuso las excepciones de falta de: derecho, legitimación activa y pasiva. En resolución de las 14 horas 30 minutos del 1 de octubre de 2008, se tuvo como parte a la PGR. En resolución de las 13 horas del 4 de agosto de 2010, el Juzgado homologó el acuerdo conciliatorio suscrito entre Jorge Sáenz Vargas y el IDA hoy INDER. Señaló la parte actora-reconvenida, el Instituto accionado-reconventor no cumplió el acuerdo conciliatorio, por ello solicitó, se programara una audiencia de conciliación; y en caso contrario, se procediera con la recepción de prueba. El representante de la PGR, contestó de forma negativa, no opuso excepciones. En pronunciamiento no. 18-2015-JVR de las 13 horas del 4 de marzo de 2015, el Juzgado ordenó remitir las diligencias al Tribunal Agrario del Segundo Circuito Judicial de San José, a fin de que éste determine a quién corresponde seguir conociendo de este proceso. El Ad quem, en resolución de las 13 horas 42 minutos del 23 de abril de 2015, rechazó la inhibitoria decretada.
II.La suscrita integrante, no coincide con el voto de mayoría de esta Sala, en la medida en que remite el asunto al Tribunal Procesal Contencioso Administrativo y Civil de Hacienda, pues según mi criterio, este proceso es de competencia agraria, en virtud de los siguientes motivos.
III.En mi criterio, el hecho de que el bien objeto de esta litis se encuentre dentro del Patrimonio Natural del Estado, no es suficiente para trasladarlo a la sede contencioso administrativa. En la Ley de la Jurisdicción Agraria –en adelante LJA- se prevé, que en los negocios de naturaleza agraria, serán partes el IDA hoy INDER y la Procuraduría General de la República –en lo subsecuente PGR-. Para mayor claridad, se transcribe el canon 22 incisos c) y ch) de la ley de cita, así: “En los negocios de conocimiento de la jurisdicción agraria, son partes: c) El Instituto de Desarrollo Rural(*). en todos los negocios que interesen para el cumplimiento de la Ley de Ordenamiento Agrario y Desarrollo Rural. (*) (Modificada su denominación por el artículo 14° de la Ley N° 9036 del 11 de mayo de 2012, "Transforma el Instituto de Desarrollo Agrario (IDA) en el Instituto de Desarrollo Rural (INDER) y Crea Secretaría Técnica de Desarrollo Rural") . ch) La Procuraduría General de la República, en todos los asuntos relativos a la tutela del dominio público y al ejercicio de las atribuciones que la ley le confiere en esta materia.” Incluso, en el voto de minoría emitido por la suscrita en la sentencia 959-2013 dictada por esta Cámara, donde de manera razonada y acorde a lo dispuesto en la LJA, indiqué: “[…] IV.- Dispone el ordinal 22 inciso ch) de la Ley de la Jurisdicción Agraria (en adelante LJA): “En los negocios de conocimiento de la jurisdicción agraria, son partes: ch) La Procuraduría General de la República, en todos los asuntos relativos a la tutela del dominio público y al ejercicio de las atribuciones que la ley le confiere en esta materia.
Los tribunales examinarán de oficio, o a petición del actor o demandado, si en realidad existe el interés directo aludido. Así reformado por el artículo 2º de la ley No. 6815 del 27 de septiembre de 1982 ) (sic)”. (Lo destacado no responde al original). El inciso ch) es claro al establecer que en todo caso se debe examinar la existencia de este interés aludido. Y en este litigio no se ha alegado el interés directo del Estado, porque se trata de un predio parte de una finca que aún está en dominio privado. De acuerdo con los artículos 22 de la LJA de reciente transcripción y… este asunto es de competencia agraria, tanto por los criterios funcional, como el objetivo y el subjetivo. El interés directo del Estado a la fecha aún no lo tiene para tenerle como parte dentro de este proceso agrario; ello, porque se trata de una finca inscrita en el Registro Nacional de la Propiedad Inmueble, por lo cual aún se encuentran en dominio privado.
Consecuentemente, la competencia es agraria, pues no existen elementos probatorios donde se acredite que los inmuebles jurídicamente forman parte del refugio. Si bien es cierto que esta integrante comparte el criterio de que las áreas silvestres protegidas son bienes del Estado y por ende forman parte del dominio público, esto lo es sólo cuando ya han sido ello no obsta para que por la especialidad de la materia el asunto se discuta en una sede especializada como la agraria, si se está ante fundos de tal naturaleza, independientemente de las partes obligadas que haya que tener como tales, en este caso al Estado dados los intereses que pueda tener. La norma reproducida 22 inciso ch) prevé situaciones como las de estudio, donde en sede agraria se puede tener como parte obligada legalmente al Estado, en asuntos relativos a la tutela del dominio público, sin que por ello deba ventilarse en la jurisdicción contenciosa.” En consecuencia, por el sólo hecho de que participen el IDA hoy INDER y la PGR dentro de este proceso; y el inmueble en discusión pertenezca al dominio público, no es dable por esa razón, remitirlo a la sede contenciosa, porque la LJA prevé que, aún en esos casos, si el asunto es de naturaleza agraria, será conocido en la sede especializada de la materia. Tal como sucede en la especie.
IV.En el caso de análisis, la parcela en discusión es propiedad del IDA hoy INDER, identificada como no. 17 del Bloque 1 en el Asentamiento Desarrollo Forestal, matrícula 251160-000, cuya aptitud es forestal, ubicado dentro de la Zona Protectora Pacuare creada por Decreto Ejecutivo no. 165815-MAG del 30 de enero de 1986, según lo indicó el apoderado general judicial del IDA hoy INDER. La Ley de Tierras y Colonización estipula entre sus objetivos en el ordinal primero: “1.- Determinar que la propiedad de la tierra se debe promover para el aumento gradual de su productividad y para una justa distribución de su producto, elevando la condición social del campesino y haciéndolo partícipe consciente del desarrollo económico-social de la Nación.” Seguidamente, la regla 3 de esa ley, acorde a sus objetivos, expresa: "... la tierra ha de constituir, para el hombre que la trabaja, la garantía de su bienestar económico, de su libertad y de su dignidad y, por lo tanto, base del bienestar, de la libertad y de la dignidad de la Nación...".
Por su parte, el canon 3 inciso b) de la Ley de Creación del Instituto de Desarrollo Agrario describe una de las funciones del Instituto, la cual se circunscribe a: “Administrar en nombre del Estado, las reservas nacionales y las tierras que se traspasen para el cumplimiento de sus fines, y efectuar en ellas planes de desarrollo integral, asentamientos campesinos, colonización, parcelación y adjudicación; todo ello con arreglo a las normas de la presente ley.” Y el precepto 4 de la ley de cita dispone: “El Instituto deberá, con prioridad, procurar la solución de los problemas que resulten de la ocupación de las reservas nacionales y de la ocupación en precario de tierras del dominio privado. El Instituto queda facultado, cuando proceda, para redistribuir y reordenar las áreas que fueren objeto del conflicto, posteriormente a su financiación.” Merece indicarse que en el Derecho Agrario se dan distintos tipos y conceptos de propiedades, cada una con ciertas características, particularidades, fines y funciones asignadas.
Así se tiene entre otras la propiedad forestal, la ecológica y la indígena. (Consúltense sentencias de esta Sala de las 11:15 horas del 13 de mayo de 1994 correspondiente al voto No. 26, la de las 14:00 horas 20 minutos del 30 de octubre de 1991 que es voto No. 189). A manera de ejemplo y entre otras se regula en la mencionada Ley del Instituto de Desarrollo Agrario y Ley de Tierras y Colonización así como en la Ley Forestal, Ley de Uso, Manejo y Conservación de Suelos, Ley Orgánica del Ambiente, artículos 45 y 50 de la Constitución Política, resoluciones de esta Sala y de la Constitucional (citadas así también la de las 14 horas 04 minutos del 3 julio de 2003, que es Voto No. 2003-06312 de la Sala Constitucional). Esta función de la propiedad agraria la convierte en un derecho-deber o un poder-obligación porque se manifiesta en la normativa en un triple sentido: función objetiva o social, atribuida al Estado como la obligación de distribuir equitativamente los bienes productivos, asignándoselos preferentemente a aquellas personas que carezcan de estos.
Luego, la subjetiva, consistente en la obligación del titular del derecho subjetivo de la propiedad agraria, de ejercitar sus facultades dominicales de modo efectivo mediante actos productivos y racionales tendientes a cultivar y mejorar la explotación agraria. La ecológica, dirigida tanto al Estado como al propietario agrario a efecto de lograr un equilibrio entre producción y conservación dirigidos al desarrollo sostenible y la tutela del derecho a un ambiente sano y ecológicamente equilibrado. Es evidente, en el caso concreto, donde el actor reclama la posesión de un fundo que dice haber cuidado durante muchos años, para proteger el bosque natural, mediante la elaboración y mantenimiento de carriles, así como evitando la caza ilegal y la tala indiscriminada, entre otros, la propiedad cumple una función social. Respecto a la propiedad agraria, no se trata sólo de poseer una titularidad, basada en una inscripción registral, sino que el dominio debe manifestarse en el ejercicio real de sus atributos, a través de actos posesorios agrarios o en su caso agroambientales.
En general, se comparte los criterios doctrinales donde se afirmado que la función social de los bienes agrarios vienen a ser un límite interno del derecho al condicionar su ejercicio y, por ende, se estima tratarse de una propiedad funcionalizada en cuanto a la obligación de explotar y desarrollar la vocación productiva del bien. Aunque por mayoría se haya dispuesto enviar este proceso al Tribunal Procesal Contencioso Administrativo, porque el bien objeto de discusión es de dominio público, en la especie, se está ante una propiedad agroforestal, donde en esencia lo que debe establecerse, es si los accionantes cumplieron o no con la función social asignada a este tipo de propiedad. Esto sin perjuicio de las acciones que eventualmente y a futuro pudiere ejercer el IDA, si otras situaciones se dieren. De esta manera dejo expuesta la posición que he mantenido al respecto.
V.Además de lo anterior, tómese en consideración, el litigio se inició desde el año 2007, sea un proceso ordinario agrario, donde se discute la posesión de un fundo, donde el actor, dice tener muchos años de haber ingresado al inmueble, donde se ha dedicado a la protección del bosque natural, elaborando y manteniendo carriles, evitando la cacería ilegal y la tala indiscriminada, entre otros. Ya se dio todo el procedimiento; faltando sólo el dictado de la sentencia. Aunado a lo anterior, en el expediente existen actos judiciales como prueba testimonial y confesional, se integró a la PGR como parte, se realizó la consulta judicial ante la Sala Constitucional para que se pronunciara sobre la constitucionalidad del canon 26 de la Ley no. 7018, se rindió el Informe no. SINAC-ACLAC-PNE-084-2014 por parte del licenciado Carlos Eduardo Vargas, en representación del Sistema Nacional de Áreas de Conservación, entre otros.
De ahí que no se comparta lo dispuesto por mayoría de remitir a esta altura procesal los autos al Tribunal Procesal Contencioso Administrativo y Civil de Hacienda, pues atentaría también contra los principios de celeridad, inmediatez y concentración procesales. En consecuencia, la suscrita vota en contra de esa remisión, y en razón de la materia, concibe que el proceso debe seguir tramitándose en la sede agraria, remitiéndose al Juzgado Agrario de origen, sea al del Primer Circuito Judicial de la Zona Atlántica, para lo de su cargo.
